[05:38.520 --> 05:45.920] County District for folks to be interviewed if they are at-large candidates.

[06:05.520 --> 06:10.200] I apologize this last Thursday when I was on, I did not have that news, I just discovered
[06:10.200 --> 06:11.640] this the other day.
[06:11.640 --> 06:15.800] And that's part of what we talked about the last Thursday is whatever county you're in
[06:15.800 --> 06:20.920] here in Texas, you need to get on the ball there in that county and check out because
[06:20.920 --> 06:24.800] you're either going to have your Senatorial District Convention this Saturday coming up
[06:24.800 --> 06:28.000] or you're going to have it the following Saturday, next Saturday coming up.
[06:28.000 --> 06:34.040] So it's going to be one or the other in Williamson County, it will be this Saturday and they're
[06:34.040 --> 06:35.040] going to have Saturday.
[06:35.040 --> 06:40.240] On April 14th, it's going to be at the Taylor Main Street Campus, it's the old high school
[06:40.240 --> 06:48.000] at 3101 North Main, that's in Taylor, Texas and registration starts at 730 and I suggest
[06:48.000 --> 06:52.200] if you are not credentialed, if you're not already credentialed for that Williamson County
[06:52.200 --> 06:57.240] Convention to get there early at 730 and those committee meetings unfortunately have already
[06:57.240 --> 07:02.840] passed and occurred for the Williamson County Senatorial District but it's absolutely critical.
[07:02.840 --> 07:09.200] I'll tell you what, we did have Rick Santorum deal a pretty bad rough blow on the Ron Paul
[07:09.200 --> 07:13.680] campaign from my perspective by his impromptu resignation.
[07:13.680 --> 07:19.200] I'll tell you, I was really surprised to see Rick Santorum pull out of this campaign here,
[07:19.200 --> 07:22.840] I guess it was a couple of days back on Tuesday, I was really shocked.
[07:22.840 --> 07:28.120] I think the mainstream towers to be and the new old older boys got to Santorum and said
[07:28.120 --> 07:33.400] hey buddy, it's time for you to bow out, it's time for you to sit down because they didn't
[07:33.400 --> 07:38.920] want any kind of us that they want to hand the ball clearly now to Romney so barring
[07:38.920 --> 07:44.600] some big major gas by Romney, you know, it does look like he will have the delegates
[07:44.600 --> 07:47.320] but that doesn't necessarily ace us out.
[07:47.320 --> 07:53.080] If we go to these conventions and sufficient of numbers, we can still potentially have
[07:53.080 --> 07:58.360] a huge effect at that RNC convention come in late August 30th, September.
[07:58.360 --> 08:04.040] Right, and Richard, I have to agree with you, when I heard that Santorum had dropped out
[08:04.040 --> 08:11.280] of the race, I was like oh great because I knew that that would severely inhibit our
[08:11.280 --> 08:17.240] chances for having this brokered convention that we've been hoping and praying for which
[08:17.240 --> 08:24.000] would make it that much easier for us to push Ron Paul in and now that Santorum has dropped
[08:24.000 --> 08:30.120] out, they are clearly going to be pushing Romney and it's going to be much more difficult
[08:30.120 --> 08:34.520] to have that brokered convention, it may even be too late, I'm not sure if he's got sufficient
[08:34.520 --> 08:38.520] delegates right now for us to even have a chance at a brokered convention.
[08:38.520 --> 08:40.120] Richard, what is your take on that?
[08:40.120 --> 08:45.120] Well, we would have to see a big fall preen by Mitt Romney which can happen.
[08:45.120 --> 08:50.800] I mean, folks that can remember that are my age and older, I'm in my 50s, they can remember
[08:50.800 --> 08:55.680] Walter Mondale having a pretty good collapse during his campaign when it looked like for
[08:55.680 --> 08:57.880] a little while he was going to be president.
[08:57.880 --> 09:03.960] So these things can't happen, you never know, in politics these times right now, I mean,
[09:03.960 --> 09:09.800] a week can be a long time and we saw Rick Perry collapse, remember how Rick Perry soared to
[09:09.800 --> 09:15.680] the number one front runner position last year in late summer or early fall, he soared
[09:15.680 --> 09:21.600] to number one and just as quickly fell apart and pretty soon became an also ran and within
[09:21.600 --> 09:24.120] a handful of primaries actually dropped out.
[09:24.120 --> 09:28.480] So these things can fall apart and unfortunately that would mean that Newt Dingerich would
[09:28.480 --> 09:34.360] have to have a big rise in popularity somehow there but you know what, if we can wrangle
[09:34.360 --> 09:40.600] a broker convention that really puts us in the ballpark and those unknowns to quote
[09:40.600 --> 09:46.360] Don Rumsfeld, remember Don Rumsfeld his famous quote, we have known knowns and I can't quote
[09:46.360 --> 09:51.120] it exactly, there were so many unknowns in his known and unknown little quote but anyway
[09:51.120 --> 09:56.880] it was really confusing, there are so many unknown unknowns that we could have a surprise
[09:56.880 --> 10:02.800] and that's where we do not want to be left out by not showing up at these senatorial
[10:02.800 --> 10:08.280] district conventions, what a shame it would be if there's some collapse in the Romney
[10:08.280 --> 10:11.720] campaign and we just say right now, hey we're not going to show up senatorial districts
[10:11.720 --> 10:17.400] because we think that Romney's got it, no we have to show up and another reason you
[10:17.400 --> 10:23.560] have to show up is this is info war at its finest, you're going to be there talking
[10:23.560 --> 10:27.920] to republican establishment folks, most of them are not awake, most of them are good
[10:27.920 --> 10:32.960] intentions and most of them are on board with the majority of our issues, the biggest differences
[10:32.960 --> 10:37.400] we have with a lot of these establishment party acts is they're still wanting to make
[10:37.400 --> 10:41.800] a lot of glass parking lots all over the world, they want to invade countries and blow up
[10:41.800 --> 10:47.160] stuff but you know what, once you talk to them and wake them up and tell them that these
[10:47.160 --> 10:51.600] endless wars were broke etc and you tell them that a lot of this stuff is instigated
[10:51.600 --> 10:56.440] by the powers of being the new world order, you can convert a lot of these folks to the
[10:56.440 --> 10:59.920] cause of liberty and freedom.
[10:59.920 --> 11:06.120] Absolutely, absolutely well you know Richard another thing that I was thinking concerning
[11:06.120 --> 11:12.440] the whole Santorum thing is what we were discussing last time you were on the show which is what
[11:12.440 --> 11:20.920] do you say to this committee because I remember last time when I was in front of the committee
[11:20.920 --> 11:25.520] they were not very, well I would say many of them were happy but there was a few of the
[11:25.520 --> 11:33.400] old hacks, the old party hacks that were obviously not very happy with me when I voiced my very
[11:33.400 --> 11:39.560] strong feelings that I was going to vote for Ron Paul no matter what, they were not happy
[11:39.560 --> 11:44.960] that I did not give them the politically correct answer that I would vote for whoever
[11:44.960 --> 11:51.640] happened to come out the winner of the nomination and so Richard I think what you said last
[11:51.640 --> 11:57.120] time on the air was very good about telling the committee well you know we are here because
[11:57.120 --> 12:03.000] we want to get Obama out of office and want to do everything we can to support that endeavor
[12:03.000 --> 12:09.600] and if they ask well who are you going to vote for whoever the nominee is, my answer
[12:09.600 --> 12:15.080] was going to be well I would have a very difficult time supporting Mitt Romney since he is the
[12:15.080 --> 12:20.640] author of Obamacare and he pushed his own version of Obamacare through in the state
[12:20.640 --> 12:25.520] of Massachusetts as the governor and one of the reasons I want to get Obama out is because
[12:25.520 --> 12:31.560] of Obamacare and now that we know that it is clearly obvious that Mitt Romney is their
[12:31.560 --> 12:38.600] quote anointed one that little rap may not go over so well as the committee, I don't
[12:38.600 --> 12:45.240] know Richard do you have any strategic advice here on how we can deal with the committee?
[12:45.240 --> 12:50.320] Well in the case of committee meetings which are coming up Monday and Tuesday of next week

[13:09.120 --> 13:15.800] Monday the Central District Committee meetings are coming up Monday April 16th 7 p.m. and
[13:15.800 --> 13:23.120] that's a 7901 Cameron Road Building 3 Suite 202 and folks you got to get to these committee
[13:23.120 --> 13:28.120] hearings that's a great place for you to get credential you have to be if you're Travis
[13:28.120 --> 13:33.240] County and want to be a delegate you have to be a registered Travis County voter if
[13:33.240 --> 13:38.080] you don't have your voter registration but you're sure you're registered Travis County
[13:38.080 --> 13:43.200] they can look up your voter ID number online but you don't necessarily have to have your
[13:43.200 --> 13:47.360] voter registration part I missed place by I couldn't find it but there's no problem
[13:47.360 --> 13:51.840] just as a matter of fact you can check yourself before you even go if you just go to the Travis
[13:51.840 --> 13:57.040] County website and navigate into the voter ID there you can check for your own number
[13:57.040 --> 14:01.520] and make sure you register get on down there sitting 901 Cameron Road Building 3 Suite
[14:01.520 --> 14:11.080] 202 that's Monday and Tuesday Monday April 16th Tuesday April 17th from 7 p.m. to 9 p.m.
[14:11.080 --> 14:16.920] folks I think there is a fantastic chance that if you just show up at these events there's
[14:16.920 --> 14:21.240] a great opportunity that you will be going to the state convention I think they're going
[14:21.240 --> 14:28.360] to have a big big time attendance problem you know Santorum retiring in this race is
[14:28.360 --> 14:33.280] a double edged sword because now not only you know some would say there's less motivation
[14:33.280 --> 14:38.400] for us while Paulers to get there because we think maybe the campaign is over but also
[14:38.400 --> 14:43.160] you got to remember that these establishment people are folding up their tent you know
[14:43.160 --> 14:48.320] if they were heavy for Santorum or whatever they're gonna they're gonna stay home so here's
[14:48.320 --> 14:53.160] our opportunity we got a season you go to these folks and these committee hearings you
[14:53.160 --> 14:58.080] can you know you can info warrior with them or you can you know you can talk about not
[14:58.080 --> 15:01.560] one of the truth if you want to be hardcore you can do all that stuff new world order
[15:01.560 --> 15:06.360] in the Fed or you can take another tactic and say hey I want to do everything I can
[15:06.360 --> 15:12.160] to defeat Obama in the fall but I think regardless of your tactic I think there's a good chance
[15:12.160 --> 15:16.480] that all of us are going to go to state convention so you don't think it's going to matter this
[15:16.480 --> 15:20.720] time I don't think it's going to matter I think they're going to have a huge attendance
[15:20.720 --> 15:26.640] problem big fact there's no that there's no precinct conventions and we don't have
[15:26.640 --> 15:31.280] that primary vote that's going to happen I think they're really concerned I think you're
[15:31.280 --> 15:36.920] going to have a few precincts on the west side of Austin that they're really connected
[15:36.920 --> 15:42.080] they've got a real strong network of people but I think those strong networks of people
[15:42.080 --> 15:46.680] are limited to maybe five or ten precincts in Travis County and I think there's well
[15:46.680 --> 15:51.360] over a hundred precincts Travis County so if we just get there and we show up and we
[15:51.360 --> 15:57.840] represent in a good manner we represent eighty or ninety of our precincts in Travis County
[15:57.840 --> 16:04.400] I believe that we will absolutely be an overwhelming majority and I know for a fact that our last
[16:04.400 --> 16:08.920] Travis County executive committee hearing we had a vote that was kind of breaking up
[16:08.920 --> 16:15.200] how many Ron Paulers there were versus the establishment folks and in just even the precinct
[16:15.200 --> 16:21.640] committee chairs we were almost fifty percent of that crowd and when we do this call out
[16:21.640 --> 16:26.920] to the general public for registered voters in Travis County then we should easily have
[16:26.920 --> 16:31.040] I think the numbers that we can send pretty much everybody to state I think the only
[16:31.040 --> 16:36.440] one that wouldn't make it to state is if it's a precinct that is full that already has too
[16:36.440 --> 16:39.240] many delegates and I don't think that's going to be an issue either.
[16:39.240 --> 16:42.840] Alright well Richard we're going to break right now so we're going to talk about this
[16:42.840 --> 16:47.800] some more on the other side you're getting me really excited here because when you go

[19:41.960 --> 19:49.960] We could change the rules of the Republican Party to make it so that the delegates can vote freely when they go to the national convention
[19:49.960 --> 19:54.960] and not be bound by whatever the results of the primary would be.
[19:54.960 --> 20:00.960] And so folks, listen, I got to admit, you know, I didn't want anything to do with this.
[20:00.960 --> 20:03.960] I did it four years ago. It's a real pain.
[20:03.960 --> 20:08.960] You got to go to these committee meetings and it's real boring and sit at the convention and I hate getting up early.
[20:08.960 --> 20:11.960] You got to get there sometime between 7.39 and register.
[20:11.960 --> 20:15.960] It's just like, blah, you know, and you have to sit in your chair on the convention floor.
[20:15.960 --> 20:27.960] If you abandon your seat, then it could be a problem because your precinct won't be represented in votes and there could be other ramifications.
[20:27.960 --> 20:29.960] That's why you have an alternate.
[20:29.960 --> 20:35.960] So I'm just like, man, I don't want to do it because it's so cramped and I was just thinking, forget it, I'm just not going to do it.
[20:35.960 --> 20:40.960] But now that I'm finding out all this other stuff, Richard, you're getting me riled up again to go be the delegate,

[27:28.960 --> 27:34.960] But I went to that and I knew there was no way the way the votes were breaking out of that caucus.
[27:34.960 --> 27:38.960] I knew there was no way I was going to make it to the RNC, but I ran anyway.
[27:38.960 --> 27:45.960] And if you're running for the RNC, that gives you three minutes in front of that crowd of, you know, these are political movers and shakers.

[28:31.960 --> 28:37.960] I looked into 9-11 and I thought you were nuts at the time, but now I know you were right.

[28:38.960 --> 28:45.960] And folks, just a little tidbit of advice here from someone who's done this before.
[28:45.960 --> 28:58.960] I would highly recommend you trying to round up other Ron Paulers in your precinct to become alternate delegates from your precinct
[28:58.960 --> 29:04.960] because what will happen is that if you don't have an alternate at the senatorial convention,
[29:04.960 --> 29:11.960] you have to sit in that chair on the floor the whole time or else your precinct,
[29:11.960 --> 29:16.960] well, especially from my precinct, there's only one delegate because it's such a small precinct,
[29:16.960 --> 29:19.960] your precinct won't get representative, represented,
[29:19.960 --> 29:27.960] or if you've got more than one delegate, then you don't have as many delegates representing your point of view.
[29:27.960 --> 29:34.960] You want to have an alternate so you can switch off seats because the seats are small and everything is really crammed in,
[29:34.960 --> 29:36.960] and there are assigned seats.
[29:36.960 --> 29:42.960] You have to sit where you're supposed to sit and it's not all that much fun,

[32:57.960 --> 33:05.960] I think it's very important that the people get familiar with the Robert's Rules of Border,
[33:05.960 --> 33:11.960] because this gives them, this helps them to get the understanding of how to navigate the committee.
[33:11.960 --> 33:15.960] The people that you're going to encounter there, they're like the establishment.
[33:15.960 --> 33:22.960] They know these rules in and out and they manipulate the process with those rules.
[33:22.960 --> 33:27.960] So when you go against, you know, an opponent, you have to have the same weapons.
[33:27.960 --> 33:35.960] And it is important that people who don't know how it works, that they get this Robert's Rules of Law and become familiar with it.
[33:35.960 --> 33:39.960] And the people who are familiar with it to get, you know, reacquainted with it.
[33:39.960 --> 33:46.960] Because it's really, it's going to be an intellectual battle once you get in there.
[33:46.960 --> 33:48.960] And you need to know the rules.
[33:48.960 --> 34:02.960] Now, Katherine, you're talking about in the committee when the delegates go up in front of the committee to, I guess, speak with them to try to make their pitch to become a state delegate.

[34:40.960 --> 34:50.960] Well, there's opportunity at the, there's opportunity at the senatorial convention to change the rules for that convention on a whole slew of matters.
[34:50.960 --> 35:08.960] As a matter of fact, when we have people go up to these committee hearings, you know, they should go and talk with some of the people on the rules committees and see their rules pertinent to what they're interested in and the issues that they're looking at to see if they're changing the rules.
[35:08.960 --> 35:17.960] But a lot of that's kind of for folks that are already involved, and luckily we do have Ron Paul's folks already involved in that process.
[35:17.960 --> 35:18.960] So they're already there.
[35:18.960 --> 35:30.960] So what we're doing tonight on the radio is calling out more for, like, the masses where we just need bodies of delegates to show up that are patriots and are ready to take on the intellectual fight for liberty.
[35:30.960 --> 35:37.960] We need a massive showing up of those folks at these committee hearings, especially in front of the nominations committees.
[35:37.960 --> 35:48.960] If we just get enough delegates, if we get enough delegates there, it's a federal district commission in both Williamson County this Saturday the 14th, and then in Travis County on April 21st.
[35:48.960 --> 36:01.960] If we get enough liberty, might and delegates, then there's enough of a nucleus of already, of Ron Paul people that are already in there that are going to be fighting for the rules that we need to make things work,
[36:01.960 --> 36:07.960] so the rule changes that we need to make things work for the nominee slate.
[36:07.960 --> 36:13.960] So there are already people there that are broken through the barrier and that are doing work there.
[36:13.960 --> 36:22.960] So it would be good if everybody did do a little primer on Robert's Rules of Orders, just get online on the computer and Google up Robert's Rules of Orders.
[36:22.960 --> 36:31.960] And, you know, you can look right there and you can read 15 or 20 minutes worth and there will be a little primer to give you an idea of how to operate in these convention scenarios.
[36:31.960 --> 36:43.960] But it is important, but just remember, we do have patriot leaders that are already there that are going to be there to help guide us and work us through that maze, especially in the convention scenario.
[36:43.960 --> 36:55.960] That is wonderful news and I'm sure that once we get there, we'll be hooking up with other like-minded people and we'll find out who the leaders are in our movement real quick.
[36:55.960 --> 37:02.960] Oh yeah, that'll be pretty clear. There'll be people there with buttons and signs and you name it, it'll look like one of those mini conventions.
[37:02.960 --> 37:13.960] You know how you see when you see the big RNCs and the DNCs that are played basically in a wall to wall. Yeah, they used to be on all the networks years ago. You used to have them on all the major networks.
[37:13.960 --> 37:19.960] But now we've got all these cable channels that they've cut back and they're more or less on the news network. But that's what it's like.
[37:19.960 --> 37:31.960] It's that type of atmosphere. You've got science going on. You know, if you want a chance to meet a lot of candidates, that's another reason why to go these things is because there's a lot of candidates
[37:31.960 --> 37:41.960] that are going to be attending these events. You're going to have a chance to talk with them, pick their brain, put ideas in their brain about different issues.
[37:41.960 --> 37:49.960] Like I said, this is info warrior at the ground level. These are the ground troops. This is where the rubber meets the road.
[37:49.960 --> 37:57.960] You're going to be working on changing hearts and minds in these scenarios that they really, really do count.
[37:57.960 --> 38:05.960] Your efforts are multiplied because, you know, you can go talk to your neighbor and you ask them, they might not have ever voted even in a primary.
[38:05.960 --> 38:16.960] You know, it's great to wake up your neighbor. We all need to wake up all of our neighbors. But if they haven't even voted in a primary, if they haven't even voted in a general election, if they haven't done squats,
[38:16.960 --> 38:25.960] well, when you're up there at these conventions, these people are active. They're there for a reason and you can't change everybody's heart and mind, but you can change a lot of them.
[38:25.960 --> 38:39.960] Well, Richard, I wanted to ask you something because one rule, at least at the senatorial level that I wanted to see changed from way back in the day, which is having to do with these at-large delegates.
[38:39.960 --> 38:58.960] For the precincts that don't have enough delegates to actually elect among themselves representatives to go directly to the state convention, there's a committee that decides which at-large delegates are going to go to state because there's too many precincts,
[38:58.960 --> 39:15.960] not every precinct can be represented. Now, the problem that I have with the process that's in place now is that there's a group of about 15 to 20 people that basically decide which at-large delegates are going to go to state.
[39:15.960 --> 39:29.960] And that slate is presented to the convention and the convention either votes the slate up or down. And I have a problem with that because at the beginning of the convention, one of the, I don't know, one of the main speakers said,
[39:29.960 --> 39:49.960] look, folks, this is a convention and the convention decides who goes to state. The precincts don't get to elect representatives. Well, that is total hypocrisy because the precinct does not, I mean, the convention does not get to decide who goes to the state convention.
[39:49.960 --> 40:00.960] This one committee does. And so I want to know, is there anything on the table right now, any proposals that have been written up or Richard, maybe you and I could write up something?
[40:00.960 --> 40:10.960] Is there anything on the table right now to actually allow the convention itself to decide which at-large delegates go?
[40:10.960 --> 40:25.960] I think that in these at-large delegates, instead of going before this committee and then having the committee put the slate together, I think that at-large delegates should go up and do their little two-minute or three-minute spiel in front of the entire convention
[40:25.960 --> 40:41.960] and then let the convention pick who they want to go. I think that that should be the process and that that would be much more fair because what happened four years ago is that everybody sat or the entire convention sat on their thumbs.
[40:41.960 --> 40:57.960] Like my grandma used to say, sit on your fist and lean back on your thumbs. We're sitting on our thumbs for almost five hours while the committee was interviewing the at-large delegates and listening to everyone's little two-minute speech.
[40:57.960 --> 41:06.960] I'm sorry. That should have been done in front of the entire convention, not the committee, while everyone is just sitting there all afternoon and they had a lot of other things better to do.
[41:06.960 --> 41:17.960] So, Richard, is there anything on the table to change this rule or should we come up with something right now within the next week and a half to try to push this through?
[41:17.960 --> 41:36.960] Actually, that could be submitted into the Rules Committee during these committee hearings. There's a lot of business that gets done in these committee hearings and the reason they have these committee meetings next Monday and Tuesday, April 16th and 17th, 7pm, up there at the Travis County Republican Headquarters,
[41:36.960 --> 41:49.960] is kind of on Cameron Road. The reason that they do those is to try to wrap up a lot of businesses they would have to have during the convention that would make the convention literally last 24 hours if they did not have these committee meetings.
[41:49.960 --> 42:01.960] Now, however, to address the problem you talked about, actually, I think we've got a cornucopia of hope in this one to overcome all of these things you mentioned.
[42:01.960 --> 42:08.960] For one thing, the first big thing that can happen, well, there's actually several things. I don't know which one's first out of all these.
[42:08.960 --> 42:20.960] But number one, during the convention itself, I think we're going to have sufficient numbers that if we needed to and wanted to, we could probably overturn the nominations committee's flight right during the convention.
[42:20.960 --> 42:37.960] The leadership of the convention may also be us because one of the first pieces of business that we take care of is we elect a convention chairman. I think we're going to have a great shot of electing a friendly, raw-paw-type convention chair.
[42:37.960 --> 42:49.960] I think that's a strong possibility. And let me tell you, that chairman is so important. The chairman of the convention wields so much power that if we get past, then another piece of business that I could see happening very easily
[42:49.960 --> 42:59.960] is if we needed to and wanted to, we could overthrow whatever the nomination committee's flight has been. But backing up even before that, I don't think it's going to be a problem.
[42:59.960 --> 43:08.960] I think there's going to be such a shortage of attendance that they're just going to be glad you're there. I think they're going to be welcoming anybody that shows up.
[43:08.960 --> 43:20.960] If you do that little oath of affirmation that you're going to vote as a Republican primary, not a big deal, you just do that and you'll get credentialed. You can go to the nomination committee hearing and I think you're going to be walked right on in.
[43:20.960 --> 43:30.960] I think most others are going to be going to the state convention. And let me mention another thing because you were talking about the at-large situation and that really hasn't necessarily been addressed to my knowledge.
[43:30.960 --> 43:38.960] But get this. Get this. They can't dominate like they were. Here we've got a break coming up. We'll talk about it on the other side.
[43:38.960 --> 43:55.960] All right. Yeah, there was some domination going on last time and I'm telling you, it was not pretty. I was very mad because we did sit there for over five hours that Saturday afternoon while the committee cherry picked all the establishment delegates.

[47:55.960 --> 48:04.960] One of my proposed ideas is we have all the at-large delegates go up in front of the entire convention one by one.
[48:04.960 --> 48:11.960] They get a two-minute limit on their speech or whatever the time is.
[48:11.960 --> 48:13.960] I think the two minutes is what we had before.
[48:13.960 --> 48:20.960] And then the delegates that are at the convention, they put to each delegate, puts together their own slate.
[48:20.960 --> 48:31.960] Say, for example, if the slate can be maximum of 50 candidates, then each delegate puts their favorite 50 delegates on their slate.
[48:31.960 --> 48:34.960] And each delegate submits their own slate.
[48:34.960 --> 48:39.960] And then whichever delegates get the most votes, those are the ones that go to state.
[48:39.960 --> 48:44.960] That's the way I think it should be done, that I think that's the most fair instead of having this committee.
[48:44.960 --> 48:47.960] So anyway, Richard and I, we're going to try to do something about this.
[48:47.960 --> 48:51.960] We may slightly modify that plan, but we're going to try to do something about this.
[48:51.960 --> 48:56.960] So Richard, please continue on your line of thought as we were coming into the break.

[49:06.960 --> 49:17.960] But Deborah, you're right, you know, that rule was a big obstacle for you trying to get to state because you were in a precinct that they said, well, we're not going to send a delegate from this precinct.
[49:17.960 --> 49:24.960] Now, we do have some large precincts in Travis County that they get together and they select their own delegates.
[49:24.960 --> 49:30.960] There's some big precincts where they are in charge of selecting their own delegates so they know they're represented.
[49:30.960 --> 49:37.960] But in the case of the smaller Travis County precincts, sometimes some of those precincts don't have a representative.
[49:37.960 --> 49:43.960] And unfortunately, the math, just the math alone guarantees that some of them won't.
[49:43.960 --> 49:47.960] But in this case, I think they're going to have such an attendance issue.
[49:47.960 --> 49:54.960] They're going to have such a shortage of attendees that that's going to help a lot of us just walk right in and go to state.
[49:54.960 --> 49:57.960] Another big factor, and I think they hate this.
[49:57.960 --> 50:04.960] I think they really do hate it, but Travis County has five congressional districts in it.
[50:04.960 --> 50:14.960] And in each of these five congressional districts, they're obligated to push a certain number of delegates out of each of those congressional districts in Travis County.
[50:14.960 --> 50:25.960] So in some ways, their hands are tied that they can't play with the geography of Travis County to try to stack it with people from a really heavy establishment Republican precinct.
[50:25.960 --> 50:27.960] They're not going to have that luxury.
[50:27.960 --> 50:36.960] They're going to have to make sure that South Austin and these other areas of Travis County where you've got more freedom and liberty-minded people living,
[50:36.960 --> 50:46.960] they're going to be forced to take them to state because of these congressional district boundaries that they're required to push a certain number of delegates out.
[50:46.960 --> 50:50.960] So you've got all these things in your favor, all of that being said.
[50:50.960 --> 50:59.960] I love your idea about going into their rules committee and working to get these rules changed on how these plates are created, et cetera,
[50:59.960 --> 51:10.960] to where as many precincts as possible, as mathematically possible, unfortunately the math works against them in some cases where occasionally a precinct or two mathematically is not going to work.
[51:10.960 --> 51:16.960] But still, everything has to be done to get the most representation out of each precinct.
[51:16.960 --> 51:25.960] Well, and I also think that everything needs to be done to get the most representation from the convention as a whole,
[51:25.960 --> 51:35.960] because that concept was really pushed hard at the last convention that I went to when basically it was explained to everyone.
[51:35.960 --> 51:48.960] And I understand it's a mathematical impossibility. Every precinct can't be represented because there are more precincts than there are available delegates to go to state.
[51:48.960 --> 51:55.960] So I understand that it's just not going to be possible for every precinct to be represented.
[51:55.960 --> 52:05.960] And so like you're saying, Richard, the larger precincts, they can basically elect their own delegates to go directly to state, but the smaller precincts, it's not that way.
[52:05.960 --> 52:19.960] And I just don't think that it's fair that this committee has a stranglehold on the at-large delegates to decide which ones get to go and which ones don't get to go because it was hammered into us at that last convention
[52:19.960 --> 52:29.960] that the convention decides which delegates go to state. And so, hey, if that's the way it's going to be, then that's the way it should be.
[52:29.960 --> 52:36.960] And if people on the rules committee say something like, well, the convention will be too long if we do it that way, blah, blah, blah.
[52:36.960 --> 52:42.960] We have to have some of this business taken care of before the convention. That's where we have these committees and blah, blah, blah.
[52:42.960 --> 52:53.960] I'll be like, hey, man, I was there. I know what happened. We sat on our thumbs for five hours. The entire convention sat on their thumbs for five hours while we waited, all right?
[52:53.960 --> 53:01.960] And I'm sorry, that is not acceptable. All of those delegates should have been speaking to the entire convention, not the committee.
[53:01.960 --> 53:08.960] So maybe, I don't know. I mean, I don't know what to say about the committee meeting ahead of time.
[53:08.960 --> 53:13.960] And as we were talking about during the break, is that you and I need to be up there and we'll address the rules committees.
[53:13.960 --> 53:21.960] We'll figure out how to craft this rule that you're talking about. Let's submit it. There's a good chance that we've got a majority in that rule committee.
[53:21.960 --> 53:27.960] There's no teller. I guarantee you that we're close to at least half the representation on that rules committee.
[53:27.960 --> 53:36.960] I'm telling you already, within the executive committee, which is made up of all the precinct chairs in Travis County, I've remained active.
[53:36.960 --> 53:43.960] I haven't gone to every meeting, but I've gone to about half of them. And I'm telling you, we've got a lot of liberty constitutional minded people.
[53:43.960 --> 53:50.960] They're already inside, already operating. For all we know, we're going to have friendly rules committing majorities.
[53:50.960 --> 53:55.960] For all we know, we're going to have friendly nominations committing majorities. We don't know that until we get there.
[53:55.960 --> 54:03.960] But here's the other thing, the attendance, that's going to be an issue. That's going to be in our favor if we just show up.
[54:03.960 --> 54:15.960] Santorum dropping out, I think, has taken a lot of the wind out of some of the establishment folks that were pro-Santorum, which may actually, in Texas, the Santorum may have been a majority.
[54:15.960 --> 54:23.960] There may have been a majority of people that would be backing Santorum. I think there's actually a smaller faction that really died in the wool Romney people.
[54:23.960 --> 54:30.960] And now they're thinking, well, Romney's got it made. He doesn't need us to go show up. So they may not show up.
[54:30.960 --> 54:36.960] The door is wide open. We've got to show up. We've got to persevere. So let's get down there to these committee hearings.
[54:36.960 --> 54:40.960] Let me back up and say, in Williamson County, if you're in Williamson County, you're listening.
[54:40.960 --> 54:48.960] Well, whatever other county in the state of Texas, your convention might be this Saturday. So check and find out about your state convention.
[54:48.960 --> 54:58.960] It could be this Saturday to 14th if you're in some other county besides Travis County. If you're in Williamson County, I know for a fact that is this Saturday in Williamson County.
[54:58.960 --> 55:06.960] And that's going to be at the Taylor Main Street campuses, the old high school, 3101 North Main, Taylor, Texas.
[55:06.960 --> 55:19.960] And get up there and the contact number is 512-577-160. That's for Bill Fairbrother. He's the county chair for the Republican Party in Williamson County.
[55:19.960 --> 55:30.960] Even if you can't contact him, show up there at 7.30 in the morning, Saturday, April 14th. And get up there and let's get enough people to dominate the Williamson County Centrional District.
[55:30.960 --> 55:44.960] And then Monday, April 16th, 7 p.m. to 9 p.m. and Tuesday, April 17th, 7 to 9 p.m. If you're a registered Travis County voter, you've got to get to these committee hearings that you've heard Deborah and I talking about
[55:44.960 --> 55:51.960] because you've got to go in front of the nomination committee, you've got to get credentials to go to the convention and start the fight right there.
[55:51.960 --> 56:00.960] And that's going to be up at 7901 Cameron Road, Building 3, Suite 202. And the websites go to find out more about that.

[56:16.960 --> 56:29.960] We've got, you know, here in Travis County, we're blessed to have, actually, Rosemary Edwards is very friendly to the Ronald Paul people. Rosemary Edwards is the chair of the Travis County Republican Party.
[56:29.960 --> 56:38.960] And they actually, they man that office up there. It's amazing the work they do. They really do a lot of work. Their number is 302-1776.
[56:38.960 --> 56:51.960] You can call them up and make sure you get credentials. Make sure you go to these committee hearings. And then April 21st, all the stuff we've been talking about, I think the door is wide open.
[56:51.960 --> 57:01.960] I don't think that any of us are going to have the same type of problem that you encountered, Deborah. I think there's going to be such a shortage of attendance that we're just going to walk in.
[57:01.960 --> 57:17.960] And chances are we can all go and stay up there for Texas at the State Convention. And who knows, Deborah, you and I and other folks in Travis County could likely be the people from our areas that go to the RNC and Tampa, Florida.
[57:17.960 --> 57:27.960] And we can go there and, you know, change the rules if we can. Change the rules if we can to become unbound. This is going to be a shot across the bow.
[57:27.960 --> 57:42.960] I think there's going to be one or two states, maybe five states, that break links and vote for Ron Paul at that national RNC convention. This is all of our chance to have a little bit of history and make a little bit of history, Deborah.
[57:42.960 --> 58:00.960] Well, you never know. This whole business about Rick Santorum dropping out, it could work to our favor in many ways more than one. I mean, there's a lot of the Rick Santorum camp that may come over the Ron Paul camp. They may be opposed to Romney because of his socialist philosophy.
[58:00.960 --> 58:13.960] You know, that's a great point. That's a great point. And absolutely. I think the door is wide open. I think Texas can really go in there and represent. We can offer a lot of delegates to the RNC.

[01:06:57.960 --> 01:07:03.960] Well, first of all, I would just love to thank Richard for coming on and bringing us all the good information.
[01:07:03.960 --> 01:07:14.960] I did participate in our precinct and district conventions in 08 to try and fight against Obama, basically, mostly.
[01:07:14.960 --> 01:07:30.960] But it was just like you said, the people who had been in for a long time showed up with their written proposals already signed and sealed and ready to go.
[01:07:30.960 --> 01:07:34.960] And the chairman came in and he said, here's what we're going to vote on.
[01:07:34.960 --> 01:07:35.960] And he just read out the titles.
[01:07:35.960 --> 01:07:36.960] He said, let's vote.
[01:07:36.960 --> 01:07:40.960] And I looked around the room and everybody's going, okay.
[01:07:40.960 --> 01:07:47.960] Well, yeah, that's the way these conventions are normally run where most of the business is taken care of before the convention.
[01:07:47.960 --> 01:07:50.960] Otherwise, as Richard said, it would take longer than 24 hours.
[01:07:50.960 --> 01:07:51.960] It would take days.
[01:07:51.960 --> 01:08:05.960] And so when it comes to especially the at-large delegates, and I think that this process has been highly abused, they cherry pick a slate and the entire convention either votes up or down on the slate.
[01:08:05.960 --> 01:08:14.960] And what happened last time with us at the Senatorial, the Travis County Senatorial convention was we tried to vote down the slate.
[01:08:14.960 --> 01:08:17.960] But unfortunately, there weren't quite enough of us.
[01:08:17.960 --> 01:08:26.960] And there may have been enough of us to vote down the slate, except for a lot of people started leaving early because they were getting tired of sitting around there and waiting all day long.
[01:08:26.960 --> 01:08:28.960] But that's the way it's normally done.
[01:08:28.960 --> 01:08:29.960] It kind of has to be done that way.
[01:08:29.960 --> 01:08:31.960] But we can make a difference.

[01:08:33.960 --> 01:08:38.960] Well, the thing that I wanted to point out to everybody is that they show up and do that.

[01:09:03.960 --> 01:09:06.960] I said, excuse me, you know, I'm new to this and I don't know anything.

[01:09:08.960 --> 01:09:19.960] Well, I told you he said it's like, know what you read to me are three titles of things that I completely and utterly am opposed to and should never even be in the Republican Party.

[01:09:20.960 --> 01:09:27.960] Well, you know, Kathy, this is why and maybe they didn't have this where you are in Texas.

[01:09:33.960 --> 01:09:40.960] Don Zimmerman and Robert Morrow put on some trainings and there have been some trainings that brave new books on this issue.
[01:09:40.960 --> 01:09:48.960] Well, this time on the senatorial convention, but we had trainings on how to take over the precinct convention.
[01:09:48.960 --> 01:09:56.960] And the step one is to go around your neighborhood, look for other people that have Ron Paul signs, Ron Paul bumper stickers, these sorts of things.
[01:09:56.960 --> 01:09:58.960] Look on the voter registration role.
[01:09:58.960 --> 01:10:08.960] See who all has voted in the primaries in the past and to go and meet those people and find out if they're on Paul supporters and if they're not, try to get them to be.
[01:10:08.960 --> 01:10:19.960] And then you coordinate and there was a specific plan that we had come up with according to Robert's rules of order where we could have taken over our precinct conventions,
[01:10:19.960 --> 01:10:26.960] even if there was a majority of the establishment people there so that we could get control and get our people in.
[01:10:26.960 --> 01:10:33.960] And so there were trainings on that last time and of course this time it's a moot point because there are no precinct conventions.
[01:10:33.960 --> 01:10:38.960] But yeah, definitely you have to network with other people in your precinct for things like that to go on.

[01:11:13.960 --> 01:11:29.960] But what was managed to do at that precinct hearing was we met each other and we voted down the proposal, the slate that he wanted to push up into the national convention.
[01:11:29.960 --> 01:11:33.960] But we weren't able to vote out the precinct chair.
[01:11:33.960 --> 01:11:42.960] Almost everyone in the room was able to go to district as a representative because, like Richard said, there weren't any bodies.

[01:11:45.960 --> 01:11:53.960] I think so. They called it the district convention, but it was the larger area after our precinct.
[01:11:53.960 --> 01:11:55.960] Yeah, that's the senatorial convention.
[01:11:55.960 --> 01:12:06.960] And at that one, there was enough networking and some side things and those same committee chair people came in, they tried the same thing.
[01:12:06.960 --> 01:12:16.960] They set up the podium, they put the bunting up, they brought refreshments and all this stuff and they had the committees all set up and they came in and they said, let's vote.
[01:12:16.960 --> 01:12:25.960] And there were enough people that said, whoa, whoa, time out, we want to challenge and vote in a new chairman.
[01:12:25.960 --> 01:12:30.960] Well, see, this is why, this goes to what Catherine was saying earlier.

[01:13:05.960 --> 01:13:15.960] You can suspend motions. You can do all kinds of things to thwart the bad guys with just simply knowing the rules.
[01:13:15.960 --> 01:13:22.960] Well, what happened at this convention, though, was very heartwarming and I'm trying to just encourage people to go participate

[01:13:31.960 --> 01:13:42.960] that the first thing that happened was, whoa, whoa, we want to elect a new chairman and we actually voted them out before we got started.

[01:14:01.960 --> 01:14:08.960] So, of course, the convention became very long because there were committees then to be assigned and to go off and do those same things.
[01:14:08.960 --> 01:14:16.960] It had been done prior at 6.30 that night. I went home because I had a prior commitment and they were still going at it.
[01:14:16.960 --> 01:14:22.960] And I understood that it was done about 9.30 that night and we had come at 8 o'clock on Saturday morning.
[01:14:22.960 --> 01:14:29.960] And I was very encouraged by it because, like you said, you know, it was Robert Shrill's order
[01:14:29.960 --> 01:14:36.960] but the bad guys didn't just come railroad everybody because we came prepared.
[01:14:36.960 --> 01:14:42.960] There were proposals. There were people already ready to say, I nominate this one and second that one
[01:14:42.960 --> 01:14:46.960] and it was lined up and the homework was done.
[01:14:46.960 --> 01:14:53.960] So, my take is for anyone who can show up on Monday and Tuesday, if you have something in your hand
[01:14:53.960 --> 01:15:01.960] typed up, written in the right format that is your proposal, there should not be any reason that you can't get it into the committee
[01:15:01.960 --> 01:15:07.960] or even vote it on if that's actually, if they're actually sitting committees there.

[01:16:34.960 --> 01:16:39.960] and it was very clear very quickly who is on the ball, who cares and who doesn't.

[01:20:41.960 --> 01:20:49.960] When I first got up there, I was in the suit so they all thought I was a lawyer.
[01:20:49.960 --> 01:21:05.960] And the president of the Criminal Trial Lawyers Association for Harris County for some other place that didn't ever get exactly where the second guy was from.
[01:21:05.960 --> 01:21:13.960] And the president, I'm sorry, he was the president of the Trial Lawyers Association for Travis County.
[01:21:13.960 --> 01:21:19.960] The other one was the president of the Trial Lawyers, the Texas Trial Lawyers Association.
[01:21:19.960 --> 01:21:28.960] And they were all there to ask the commission to sunset the bar.
[01:21:28.960 --> 01:21:37.960] And they were very much against the bar, I said, I mean the Judicial Conduct Commission.
[01:21:37.960 --> 01:21:50.960] The president of the Trial Lawyers Association for Texas brought in a survey of the trial, of the criminal trial lawyers.
[01:21:50.960 --> 01:22:00.960] And 70, almost 80%, 77% or so, felt like the commission should be abolished.
[01:22:00.960 --> 01:22:05.960] 80-something percent felt like they were ineffective.
[01:22:05.960 --> 01:22:12.960] And it surprised me that these lawyers of this stature would ask actually to abolish it.
[01:22:12.960 --> 01:22:15.960] The problem is I don't trust them.
[01:22:15.960 --> 01:22:21.960] I suspect that they would like to see the commission go away.
[01:22:21.960 --> 01:22:24.960] Then it's just them and the judges.
[01:22:24.960 --> 01:22:29.960] They don't have us pesky citizens interfering with their judges and their deals.
[01:22:29.960 --> 01:22:33.960] I frankly didn't want it to go away.
[01:22:33.960 --> 01:22:47.960] Anyway, we got into the hearing and it started out with the assistant director, a chairman, and the chairman of the Judicial Conduct Commission spoke first.
[01:22:47.960 --> 01:22:57.960] And they were addressing an issue that apparently went to some infighting.
[01:22:57.960 --> 01:23:04.960] They never really understood precisely what information they were arguing about.
[01:23:04.960 --> 01:23:19.960] But apparently the Sunset Commission had requested certain information from the Judicial Conduct Commission, which the Judicial Conduct Commission did not want to divulge.
[01:23:19.960 --> 01:23:40.960] And this assistant in giving her presentation was talking about the fact that they had released information into the commission and that someone decided to go to the press with some of the information.
[01:23:40.960 --> 01:23:52.960] And it took that to mean that with the implication that these public officials could not be trusted with sensitive information.
[01:23:52.960 --> 01:24:09.960] That was a really bad maneuver because Sponer, the chairman of the commission, landed on her quickly and said they wanted to know what she meant by the fact that someone decided to go.
[01:24:09.960 --> 01:24:19.960] Someone decided to go to the press and she indicated that there was a negative article that was written concerning some of the information.
[01:24:19.960 --> 01:24:28.960] And my goodness, these representatives were not happy campers.
[01:24:28.960 --> 01:24:31.960] They were all over her.
[01:24:31.960 --> 01:24:41.960] And they grilled her for about 45 minutes and the chairman was sitting next to her, the director.
[01:24:41.960 --> 01:24:52.960] And he was a white-headed fellow, apparently been around a while, and I looked for him for a bit more polish and wisdom.
[01:24:52.960 --> 01:24:55.960] That didn't happen.
[01:24:55.960 --> 01:25:09.960] When he started to speak, it really went downhill. He was trying to lecture these guys about law and his duty and their duty, and they were not going forth.
[01:25:09.960 --> 01:25:17.960] They spent about two hours grilling this guy and it almost deteriorated into a shouting mass.
[01:25:17.960 --> 01:25:19.960] Two or three hours?
[01:25:19.960 --> 01:25:25.960] Yes. It was nearly lunchtime before they started at 10.
[01:25:25.960 --> 01:25:36.960] And it was right at lunchtime, I guess it was an hour and a half because it was about 11.30 when they got to the public comments.
[01:25:36.960 --> 01:25:47.960] Well, Randy, I remember when I was at that House committee, the judicial committee, testifying on the TSA bill and some other issues.
[01:25:47.960 --> 01:25:55.960] And they grilled this prosecutor, this district attorney out of Houston, and that was one of the most fun things I'd ever...
[01:25:55.960 --> 01:26:01.960] That was truly entertainment, but that only went on for maybe 45 minutes at the most.
[01:26:01.960 --> 01:26:05.960] These people got grilled. This guy got grilled for two hours?
[01:26:05.960 --> 01:26:08.960] This was the director of the agency.
[01:26:08.960 --> 01:26:14.960] That's great. Oh, you know what? That's all recorded. It's all on videotape. We've got to download it.
[01:26:14.960 --> 01:26:21.960] You have to download this. This was a hoot and I was sitting next to one of the judges on the commission.
[01:26:21.960 --> 01:26:26.960] And she was not happy.
[01:26:26.960 --> 01:26:35.960] And I told her, oh, don't worry, it gets worse. You haven't heard me yet.
[01:26:35.960 --> 01:26:38.960] And then these lawyers got up there grilling them.
[01:26:38.960 --> 01:26:47.960] Like, really, we were working them over and I told this judge, he's just getting them warmed up for me.
[01:26:47.960 --> 01:26:58.960] I think he wanted to leave the building because no one spoke in favor of the commission.
[01:26:58.960 --> 01:27:03.960] This was a very negative set of comments.
[01:27:03.960 --> 01:27:11.960] There was just one after the other grilling the commission. So all in all, I thought it was a very good hearing.
[01:27:11.960 --> 01:27:16.960] Well, Randy, what about this three-minute time limit? Did they limit the testimonies from the public to three minutes apiece?
[01:27:16.960 --> 01:27:19.960] Yes, they did. Too bad.
[01:27:19.960 --> 01:27:34.960] And that was difficult. It was just three minutes. So when you're trying to make some kind of point, it's very, very short amount of time.
[01:27:34.960 --> 01:27:42.960] And Ken was right to be upset about that, but we still have time to get in written comments to the commission.
[01:27:42.960 --> 01:27:52.960] We still have tomorrow. So I need to get together a written statement to the commission tomorrow and get it in.
[01:27:52.960 --> 01:27:59.960] I'm sure Ken's in his presentation, he's asking for more hearings.
[01:27:59.960 --> 01:28:08.960] And he's been making a request for hearings every two years until we get the problems with the commission straightened out.

[01:28:22.960 --> 01:28:32.960] I don't think went to the likelihood of any changes. It was just a kind of a turf war.

[01:28:35.960 --> 01:28:48.960] Well, the commission wanted information that the Sunset Commission wanted information that did as a conduct did not want to release it.
[01:28:48.960 --> 01:28:53.960] They felt like it was rendered confidential by Constitution.
[01:28:53.960 --> 01:29:06.960] The director of the agency was saying that the Constitution said that their deliberations would be confidential.
[01:29:06.960 --> 01:29:13.960] And then he used that to extend it to all aspects of the agency.
[01:29:13.960 --> 01:29:22.960] And the representatives argued that other agencies who had confidential information reported
[01:29:22.960 --> 01:29:30.960] information to these committees because they weren't, this wasn't being reported to the public.
[01:29:30.960 --> 01:29:34.960] It was still with inside government agencies.
[01:29:34.960 --> 01:29:44.960] And this director was saying that the confidentiality meant that it all stayed only with him and his agency to his staff.
[01:29:44.960 --> 01:29:53.960] So that sounds like a bunch of BS to me and that has nothing to do and that's not really quite a turf war.
[01:29:53.960 --> 01:29:59.960] This has to do with open government and the bureaucracy is going to be open.
[01:29:59.960 --> 01:30:05.960] This is building 7, a 47 story skyscraper that fell on the afternoon of September 11.

[01:32:57.960 --> 01:33:04.960] But one comment I was going to make is that concerning these internal documents,
[01:33:04.960 --> 01:33:12.960] this has to do with checks and balances of the different branches of our government.
[01:33:12.960 --> 01:33:24.960] We can't just have bureaucratic agencies, bureaucracies run amok completely autonomous with no oversight by Congress.
[01:33:24.960 --> 01:33:29.960] That leads to dictatorship. That's the executive branch completely run amok.
[01:33:29.960 --> 01:33:33.960] And even if according to constitution or statute or whatever,
[01:33:33.960 --> 01:33:40.960] certain of their internal documents are supposed to be confidential and not available to the public.
[01:33:40.960 --> 01:33:47.960] That's one thing. But the members of Congress are not counted as the public
[01:33:47.960 --> 01:33:54.960] and they have the authority to have oversight over these bureaucracies.
[01:33:54.960 --> 01:33:59.960] This happens off time even at the federal level with all kinds of bureaucracies
[01:33:59.960 --> 01:34:03.960] and different aspects of the military, et cetera, et cetera.
[01:34:03.960 --> 01:34:11.960] And they were thinking about all these recordings of these tortures and things like this that were given to Congress,
[01:34:11.960 --> 01:34:14.960] but the public wasn't allowed to see it or hear it or whatever.
[01:34:14.960 --> 01:34:21.960] I mean, there is no reason why Congress, this committee specifically should not have oversight
[01:34:21.960 --> 01:34:25.960] into what's going on into the internal workings of this bureaucracy.
[01:34:25.960 --> 01:34:29.960] After all, it was established by Congress and they hold the purse strings.
[01:34:29.960 --> 01:34:37.960] So this is just absolutely ridiculous. It's a violation of the principle of the separation of branches of our government.

[01:34:46.960 --> 01:34:59.960] There was a memorandum of opinions that were circulated through the Judicial Conduct Commission on these issues.
[01:34:59.960 --> 01:35:12.960] And what the commission was saying is that this information was supposed to be confidential to protect the sanctity of the judiciary.
[01:35:12.960 --> 01:35:16.960] And the legislators were saying, no, wait a minute.
[01:35:16.960 --> 01:35:25.960] They were calling this information that's being presented to the commission work product.
[01:35:25.960 --> 01:35:28.960] And they were saying, let's not work product.
[01:35:28.960 --> 01:35:31.960] And they asked, are you all lawyers?
[01:35:31.960 --> 01:35:34.960] And they said, well, not all of us.
[01:35:34.960 --> 01:35:42.960] Some of their staff, if you reuse this, and some of their staff produces some of this who are not lawyers.
[01:35:42.960 --> 01:35:46.960] And the legislators are saying, now, wait a minute, they're not lawyers.
[01:35:46.960 --> 01:35:55.960] And they're not lawyers who are advising you or one of the other members that it's not work product.
[01:35:55.960 --> 01:35:58.960] So you can't hide it under that.
[01:35:58.960 --> 01:36:11.960] And I was listening to it and I would agree that their deliberations, just like a grand jury, should be private.
[01:36:11.960 --> 01:36:26.960] But what is actually presented to them as they maintained to the House representatives that they were acting in a judicial function.
[01:36:26.960 --> 01:36:35.960] Therefore, their actual hearing should be public.

[01:36:50.960 --> 01:36:56.960] that was a question, I think it was Whitmire, I was really pleased with him.
[01:36:56.960 --> 01:36:59.960] He was very effective.
[01:36:59.960 --> 01:37:03.960] Whitmire made that distinction.
[01:37:03.960 --> 01:37:13.960] And they argued that, you know, he asked him, are you acting as judicial officers?
[01:37:13.960 --> 01:37:16.960] And he said, yes.
[01:37:16.960 --> 01:37:27.960] And when he says that, I thought, wait a minute, if you're acting in a judicial capacity, we need to go back to 1.24 code of criminal procedure,
[01:37:27.960 --> 01:37:33.960] which says all courts shall be public.
[01:37:33.960 --> 01:37:42.960] And that goes back to the Constitution that grants everyone a right to a fair and public court.
[01:37:42.960 --> 01:38:04.960] So this constitutional amendment that created the Judicial Conduct Commission would have a provision that would seem to be in conflict with a much older and more basic provision that we should have public court.
[01:38:04.960 --> 01:38:16.960] So if the Commission is going to sit there and claim they're acting in a judicial capacity, then they'll invoke a portion of the Constitution I don't think they're going to want to get to.
[01:38:16.960 --> 01:38:35.960] If they're in an administrative capacity, then their administrative functions may be exempt from release to the public, but not to other members of government that are oversight councils.
[01:38:35.960 --> 01:38:46.960] So the director was trying to get everything within the same context of client lawyer privilege.
[01:38:46.960 --> 01:38:52.960] And the representatives were not going for that nonsense.
[01:38:52.960 --> 01:39:11.960] So this was kind of the basics of the argument, and I listened to it and I was thinking, you know, I have no problem with the details of the complaint being kept private for the time being,
[01:39:11.960 --> 01:39:30.960] and certainly the private deliberations of the individuals in making a determination they need to be able to speak candidly without fear of public outcry or negative scrutiny.
[01:39:30.960 --> 01:39:37.960] But once they convene a hearing and present findings, that should be public.
[01:39:37.960 --> 01:39:41.960] So these are issues we'll be developing.
[01:39:41.960 --> 01:40:06.960] But unfortunately with all of the animosity that was in the room, I did not take the tension between the two as an indication that the House had any intention of basically changing the commission so that it would be more effective.
[01:40:06.960 --> 01:40:13.960] There was nothing in the interactions that indicated that.
[01:40:13.960 --> 01:40:23.960] It all appeared as though we want to see more of what you're doing, and they're saying we don't trust you to give it to you.
[01:40:23.960 --> 01:40:26.960] So we're going to make you go to court to get it.
[01:40:26.960 --> 01:40:29.960] It's what it appeared at the stance for us.
[01:40:29.960 --> 01:40:33.960] So we'll see how that shakes out in the end.
[01:40:33.960 --> 01:40:40.960] But more of us should raise a public outcry.
[01:40:40.960 --> 01:40:47.960] This is ultimately where the problem lies.
[01:40:47.960 --> 01:40:54.960] Judges do not feel threatened by the Judiciary Conduct Commission.
[01:40:54.960 --> 01:41:04.960] And this was in my statement to them that the Judiciary Conduct Commission was worse than not being there.
[01:41:04.960 --> 01:41:20.960] Because its being there would give people the impression that there was a check and balance, that there was an oversight to these judges' bad behavior, when in fact there was no such thing.
[01:41:20.960 --> 01:41:35.960] It was merely there to mollify the public, to give them a place to vent their spleen, and think something was going to be done, when in fact absolutely nothing would be done.
[01:41:35.960 --> 01:41:39.960] So in that context, it was worse than nothing.
[01:41:39.960 --> 01:41:46.960] And unlike the trial lawyers, I did not want the commission abolished.
[01:41:46.960 --> 01:41:59.960] I asked them, do not abolish the commission, give it some teeth, then give us some teeth so that we can enforce the commission.
[01:41:59.960 --> 01:42:06.960] Give us the teeth to hold the commission to their jobs under 3903 penal code.
[01:42:06.960 --> 01:42:11.960] Then we'll have a commission that will actually function.
[01:42:11.960 --> 01:42:19.960] I don't expect to give that, but we need to push for accountability.
[01:42:19.960 --> 01:42:33.960] So it would be nice if anyone out there has been worked over by the courts to get a statement in, get it to the commission, get it in the record.
[01:42:33.960 --> 01:42:36.960] That's my story and sticking to it.
[01:42:36.960 --> 01:42:48.960] Absolutely, they need to have some teeth, but they also need to be accountable because right now they don't even want to release any information to the congressional committee.
[01:42:48.960 --> 01:42:55.960] And so if we give them more power on top of that, it could make the situation worse.
[01:42:55.960 --> 01:42:58.960] So we have to have both.
[01:42:58.960 --> 01:43:00.960] We have to give them teeth to do something.
[01:43:00.960 --> 01:43:14.960] And we also have to, they need to be a little bit more open and we also need to have a way to hold them accountable to in order to make them do something with their teeth if and when they get it.
[01:43:14.960 --> 01:43:21.960] Because if they're just not going to do anything and we can't hold them accountable, then, you know, what good is it?

[01:46:59.960 --> 01:47:04.960] The Sunset Commission comes around for each agency every 12 years,
[01:47:04.960 --> 01:47:11.960] and they decide whether to get rid of an agency or just to overhaul it or to do nothing.
[01:47:11.960 --> 01:47:16.960] While it's a good idea, I would like to see it happen a little bit more often.
[01:47:16.960 --> 01:47:22.960] We get to make comments on the State Commission on judicial conduct.
[01:47:22.960 --> 01:47:26.960] We get three minutes every 12 years.
[01:47:26.960 --> 01:47:37.960] So in order to counter that, I've just finally got enough cash flow in that I can pay a little bit to a programmer
[01:47:37.960 --> 01:47:41.960] to get judicial conduct up and working.
[01:47:41.960 --> 01:47:45.960] There are things we can do.
[01:47:45.960 --> 01:47:51.960] And I didn't have anywhere near enough time to tell the commission that
[01:47:51.960 --> 01:47:55.960] you do your job or we'll take care of it for you.
[01:47:55.960 --> 01:48:02.960] And what I'm looking at doing is getting, of course, getting judicial conduct up and working
[01:48:02.960 --> 01:48:11.960] where all of the complaints and all of the information someone sends in on the complaint
[01:48:11.960 --> 01:48:14.960] will be public.
[01:48:14.960 --> 01:48:21.960] So that will make their issue of whether or not they release information essentially moved,
[01:48:21.960 --> 01:48:26.960] at least from the perspective of the information, the actual complaint given
[01:48:26.960 --> 01:48:30.960] and the evidence given in the complaint.
[01:48:30.960 --> 01:48:39.960] But also, the issue of rendering a complaint to the commission that alleges
[01:48:39.960 --> 01:48:45.960] an act that is in violation of law.
[01:48:45.960 --> 01:48:57.960] Now the way I read the code, a jurist, a judge, has two trial judge, has two primary duties.
[01:48:57.960 --> 01:49:03.960] The first is to develop the facts in accordance with the rules of evidence.
[01:49:03.960 --> 01:49:09.960] The second is to apply the law as it comes to him to the facts in the case.
[01:49:09.960 --> 01:49:17.960] He has no power to ignore rulings of the higher court.
[01:49:17.960 --> 01:49:30.960] It is a ministerial duty on his part to properly apply the law as it comes to him to the facts in the case.
[01:49:30.960 --> 01:49:39.960] If he fails to do that and in the process denies a citizen in full free access to or enjoyment of the right,
[01:49:39.960 --> 01:49:47.960] the way I read 39.03 penal code, that's a crime in Texas.
[01:49:47.960 --> 01:49:55.960] It's my position that if we give notice to these judges on the commission
[01:49:55.960 --> 01:50:05.960] or if they come to knowledge by way of their official capacity in sitting on this commission,
[01:50:05.960 --> 01:50:15.960] that a crime has been committed, that it invokes their duty under Article 2.10 Code of Criminal Procedure.
[01:50:15.960 --> 01:50:19.960] And it is their duty to keep the peace in the county beyond lawful means.
[01:50:19.960 --> 01:50:24.960] The issue process caused the arrest of the accused.
[01:50:24.960 --> 01:50:35.960] So when they receive an affidavit from a citizen alleging with specificity and particularity
[01:50:35.960 --> 01:50:39.960] that a particular person has committed a specific crime,
[01:50:39.960 --> 01:50:47.960] that invokes their magisterial duty under Article 2.10 Code of Criminal Procedure.
[01:50:47.960 --> 01:50:58.960] If they don't act in that capacity, hold an examining trial, examine into the sufficiency of the accusation,
[01:50:58.960 --> 01:51:07.960] then issue an order stating whether the no probable cause was found,
[01:51:07.960 --> 01:51:20.960] whether probable cause was found, and bail was set, or whatever they did, and seal that up in an envelope with all the evidence in the case,
[01:51:20.960 --> 01:51:25.960] and forward it to the clerk of the court of jurisdiction.
[01:51:25.960 --> 01:51:30.960] Then they've committed misseasons in office.
[01:51:30.960 --> 01:51:38.960] And in the process, denies you and your right to petition courts for redress of grievance and the equal protection of the laws.
[01:51:38.960 --> 01:51:43.960] And that amounts to the denial of a right.
[01:51:43.960 --> 01:51:53.960] And the Code 39.03 does not stipulate the denial of a constitutional right.
[01:51:53.960 --> 01:52:01.960] It says they deny, if it denies the citizen the full entry access to or enjoyment of a right.
[01:52:01.960 --> 01:52:05.960] And I said it that way. I probably should read it again. That's out of the federal.
[01:52:05.960 --> 01:52:11.960] I think it's a little bit different in the Texas Code, but it goes to the same thing.
[01:52:11.960 --> 01:52:13.960] It does not work exactly the same way.
[01:52:13.960 --> 01:52:24.960] But if a judge breaches a ministerial duty, and fails to properly perform his duty,
[01:52:24.960 --> 01:52:32.960] and denies you and your right in the process, the way I read 39.03, that's a crime in the state of Texas.
[01:52:32.960 --> 01:52:37.960] So we need to do our duty.
[01:52:37.960 --> 01:52:44.960] We prepare the judicial conduct complaint, file it with the commission.
[01:52:44.960 --> 01:52:55.960] And when the judges on the commission fail to act in accordance with their duty as magistrates, then we go after them.
[01:52:55.960 --> 01:53:02.960] With local grand juries and with judicial conduct complaints against them.
[01:53:02.960 --> 01:53:10.960] We'll see how much fun it is to protect their buddies when it's getting them and their necks in a noose.
[01:53:10.960 --> 01:53:17.960] We are the sovereigns. We are the citizens. We have the power to do this.
[01:53:17.960 --> 01:53:25.960] And it's my suggestion to bring this home.
[01:53:25.960 --> 01:53:34.960] Since you and I are the sovereigns, essentially each of us is a CEO of this corporation.
[01:53:34.960 --> 01:53:47.960] When we file a accusation, we should go to the entity that's just below us.
[01:53:47.960 --> 01:53:52.960] That would be the Chief Justice of the Supreme Court.
[01:53:52.960 --> 01:54:00.960] And he just happens to be listed in Article 2.09, Code of Criminal Procedure.
[01:54:00.960 --> 01:54:08.960] 2.09 is entitled, Who Are Magistrates?
[01:54:08.960 --> 01:54:15.960] First one on the list, Justices of the Supreme Court.
[01:54:15.960 --> 01:54:30.960] So we take a complaint against these judges on the State Commission on Judicial Conduct forward that to the Chief Justice of the Supreme.
[01:54:30.960 --> 01:54:45.960] And if we send a complaint to the Chief Justice of the Supreme accusing a judicial officer acting in a separate judicial capacity.
[01:54:45.960 --> 01:55:01.960] And that's what when I was sitting there and the Director of the Agency told the House representatives that, yes, we act as judicial officers.
[01:55:01.960 --> 01:55:05.960] I said, wonderful.
[01:55:05.960 --> 01:55:17.960] So the judge can't say he's acting in an administrative capacity or some other capacity that is separate from him being a judge.
[01:55:17.960 --> 01:55:24.960] He's acting in a judicial capacity and he hasn't made known to him to the crime community and folks at duty.
[01:55:24.960 --> 01:55:26.960] So we hold him to it.
[01:55:26.960 --> 01:55:44.960] Now, we give the Chief Justice a complaint alleging that these Commission members have done exactly what the Chief Justice is going to want to do.
[01:55:44.960 --> 01:55:49.960] Not hold an examining trial.
[01:55:49.960 --> 01:55:53.960] So that should be an interesting conundrum.
[01:55:53.960 --> 01:56:05.960] I would like to be a fly on the wall when he gets the first one of those and tries to figure out how to handle that.
[01:56:05.960 --> 01:56:13.960] So I'm hoping we can get a lot of people to begin to file judicial conduct complaints.
[01:56:13.960 --> 01:56:21.960] And then let's just work the routine on the system.
[01:56:21.960 --> 01:56:25.960] That's how we'll get teeth in the Commission.
[01:56:25.960 --> 01:56:36.960] Once Commission's in a position to where they say, just like this Director said, this is what the law says I must do.
[01:56:36.960 --> 01:56:38.960] I have no option.
[01:56:38.960 --> 01:56:49.960] Now this Director got up there and told these House representatives, the Constitution forbids me from doing this.
[01:56:49.960 --> 01:56:57.960] Now, however much I might want to, I am forbidden.
[01:56:57.960 --> 01:57:10.960] Same situation, however much I might not want to hold an examining trial based on these criminal accusations, the law says that I must do this thing.
[01:57:10.960 --> 01:57:19.960] And if I don't do this thing, got some chomps out there fixing land on me like a ton of bricks.
[01:57:19.960 --> 01:57:22.960] I think we can bring these guys to tow.
[01:57:22.960 --> 01:57:30.960] I don't think it will take many complaints to these guys to get them off to die.
