[04:40.000 --> 04:47.000]  He is going to be talking with us tonight about what is going on with Texas and the Texas primaries
[04:47.000 --> 04:53.000]  and this redistricting scandal, this debacle that keep putting off our primaries.
[04:53.000 --> 05:00.000]  Normally, we're part of Super Tuesday, which was this past Tuesday, March 6th,
[05:00.000 --> 05:04.000]  but this year, we are not part of Super Tuesday.
[05:04.000 --> 05:11.000]  At first, they had pushed the primaries back to sometime in April, and now it looks like it's going to be May 29th
[05:11.000 --> 05:13.000]  before we have our primaries.
[05:13.000 --> 05:23.000]  Apparently, there's been a very heated court battle going on in San Antonio over this redistricting nightmare, debacle scandal.
[05:23.000 --> 05:27.000]  Somehow, I feel that it may have something to do with Lamar Smith.
[05:27.000 --> 05:33.000]  I know that former Sheriff Richard Mack is running against Lamar Smith in the Republican primaries.
[05:33.000 --> 05:35.000]  So, Richard, thank you.
[05:35.000 --> 05:37.000]  Welcome to the show, and break it all down for us.
[05:37.000 --> 05:40.000]  What is going on here?
[05:40.000 --> 05:46.000]  All right, Deborah, it would probably be like a giant trigonometry or algebraic,
[05:46.000 --> 05:49.000]  mathematic problem to really break it all down.
[05:49.000 --> 05:55.000]  But going back to last legislative session in 2011 here in Texas,
[05:55.000 --> 05:59.000]  legislature meets every two years on odd number of years.
[05:59.000 --> 06:07.000]  In 2011, the Texas state legislature had to redraw the U.S. congressional districts for the state of Texas
[06:07.000 --> 06:13.000]  because in 2010, the census showed our population had grown significantly,
[06:13.000 --> 06:20.000]  so we were to get, and we are getting, four new U.S. congressional seats in the state of Texas,
[06:20.000 --> 06:27.000]  which means they need to redraw all the lines, basically, to fit in these four new districts.
[06:27.000 --> 06:33.000]  So, predictably, the Republicans, they drew them, they were the majority in the House and Senate,
[06:33.000 --> 06:39.000]  and of course, he had Rick Perry, or Goober, nor, that would sign off on that,
[06:39.000 --> 06:45.000]  and predictably, though, more predictably than the Republicans drawing the lines as they saw fit,
[06:45.000 --> 06:49.000]  which I think they probably did a fairly decent job of it,
[06:49.000 --> 06:54.000]  but the Democrats were determined to file lawsuits against the redistricting,
[06:54.000 --> 06:58.000]  regardless of however the Republicans drew the lines,
[06:58.000 --> 07:07.000]  the left and the Democrats were going to cry racism and somehow that minorities had been districted against.
[07:07.000 --> 07:14.000]  So, they did file lawsuits from the left, and this took it into court in San Antonio, as you mentioned earlier,
[07:14.000 --> 07:22.000]  where back around November, December, the three judge court in San Antonio just threw out the redistricting map
[07:22.000 --> 07:27.000]  that the legislature had created completely and replaced it with their own map,
[07:27.000 --> 07:33.000]  and that took the case up to the U.S. Supreme Court, which the U.S. Supreme Court shot that down and said,
[07:33.000 --> 07:38.000]  no, three judges from Texas are not going to redraw the districts of Texas.
[07:38.000 --> 07:45.000]  You guys need to pay closer attention to what the legislature has done with the district boundaries and lines.
[07:45.000 --> 07:54.000]  So, it bounced back over here, and in the meantime, as all this lawsuit over redistricting is progressing,
[07:54.000 --> 07:58.000]  we have filing deadlines for people that want to run from every office,
[07:58.000 --> 08:07.000]  from, you know, figuratively speaking, dog catcher to U.S. congressman to president to precinct chairman.
[08:07.000 --> 08:13.000]  You name it, that deadline was supposed to have occurred in December, mid-December, roughly,
[08:13.000 --> 08:17.000]  and was pushed into, at first, I believe, was pushed into February,
[08:17.000 --> 08:23.000]  and in fact, subsequently, has actually been extended all the way until tomorrow.
[08:23.000 --> 08:30.000]  So, anybody that's looking at filing for any office all the way from president to precinct chairman
[08:30.000 --> 08:35.000]  is actually eligible to do so here in Travis County and other areas of Texas as well.
[08:35.000 --> 08:44.000]  But through tomorrow, March 9th at 6 p.m. is the deadline, and the office here in Travis County,
[08:44.000 --> 08:49.000]  which by the way, this unfortunately isn't going to be kind of a Travis County-centric program,
[08:49.000 --> 08:56.000]  but I encourage all the folks here in Texas, if you're listening, you got to check with your local Republican Party
[08:56.000 --> 09:01.000]  to see about becoming delegates for Ron Paul. I'm kind of jumping ahead again, but I need to mention that
[09:01.000 --> 09:08.000]  all the different counties and all the different senatorial districts are going to operate differently, potentially.
[09:08.000 --> 09:11.000]  So, that's why I'm going to break it down for Travis County,
[09:11.000 --> 09:16.000]  but whatever's happening in Travis County may not be what's happening in your neck of the woods if you're in Texas,
[09:16.000 --> 09:23.000]  so you're going to have to get on the horn on the web and find out what's going on specifically for your senatorial district
[09:23.000 --> 09:27.000]  and your county. It's very, very critical that we find out.
[09:27.000 --> 09:31.000]  But backing up to what we were talking about with all this redistricting and the deadlines and everything,
[09:31.000 --> 09:34.000]  the deadline is now tomorrow, March 9th.
[09:34.000 --> 09:41.000]  So, if you still want to file for running for Congress or running for some of these other seats that are available,
[09:41.000 --> 09:46.000]  it can still be done through tomorrow, and even after tomorrow's deadline,
[09:46.000 --> 09:53.000]  there will be one office still available to be filed for, and that will be for a precinct chair position,
[09:53.000 --> 09:57.000]  which is a critical precinct chair position. People always ask,
[09:57.000 --> 10:03.000]  well, who's making these decisions of how the party operates or how the establishment operates and all that?
[10:03.000 --> 10:09.000]  Well, it is. It's precinct chair people that are basically at the atomic level.
[10:09.000 --> 10:13.000]  They're the ones that make up these so-called establishment parties,
[10:13.000 --> 10:19.000]  and they're the ones that have a grip on it, and if we just come in with Liberty-minded folks,
[10:19.000 --> 10:25.000]  Ron Paulers, et cetera, and come in and fill in these seats and become precinct chairs,
[10:25.000 --> 10:32.000]  then all of a sudden the makeup of that entire Republican establishment will change to like-minded people like us.
[10:32.000 --> 10:40.000]  I know I kind of shotgun blasted there, but that's kind of at least a little bit of where we're at right now, Deborah.
[10:40.000 --> 10:49.000]  Right. Okay. I think the key issue here that is critical is that with all this redistricting and the court cases and such,
[10:49.000 --> 10:55.000]  it has put a delay on the primaries and put a delay on filing deadlines.
[10:55.000 --> 11:03.000]  Like you said, if anybody out there is wanting to run for any kind of an office, and Richard, is there a website where people can go to,
[11:03.000 --> 11:08.000]  whether they're in San Antonio or Austin or wherever, where they can see maybe what offices are open?
[11:08.000 --> 11:15.000]  People have until tomorrow at 6 p.m. Is this just in Travis County to sign up to run for office?
[11:15.000 --> 11:25.000]  Now, my understanding is that that's a statewide deadline. So, like I say, if you're looking at local offices in like, say, Hayes County or Tarrant County, Dallas County,
[11:25.000 --> 11:33.000]  you know, all these different counties that are going to operate differently, folks in those areas will need to look up at those areas.
[11:33.000 --> 11:46.000]  But here in Travis County, we do have the Travis County Republican Party. Their website is TravisCountyGOP.org, TravisCountyGOP.org,
[11:46.000 --> 11:52.000]  and they've got an events calendar there. But as far as, you know, people that are thinking about running for office right now,
[11:52.000 --> 12:01.000]  basically, you know, they've filed. But I would encourage anybody, if you have not filed to be a precinct chairman,
[12:01.000 --> 12:07.000]  then check it out and try to get it done. You do have Beyond Tomorrow, but I would try to get it done tomorrow.
[12:07.000 --> 12:15.000]  And for people wanting more information on that here in Travis County, for Travis County people only, call Don Zimmerman.

[12:51.000 --> 13:02.000]  because delegates are the ones that are going to elect and select the nominee from the Republican Party on who's going to be the nominee for president.
[13:02.000 --> 13:09.000]  It's going to be delegates. All of these primaries and caucuses right now, you know, they are of interest and they are notable events,
[13:09.000 --> 13:12.000]  and it's like a litmus test of what's really going on out there.
[13:12.000 --> 13:23.000]  But, you know, it's going to be these delegates that follow up and go all the way through the convention process that end up showing up at the RNC in Tampa, Florida,
[13:23.000 --> 13:38.000]  and this select the timber and those are the Republican nominees. So, the way I see it is this delicate battlefield, the battlefield for the Republican Party right now at the delegate level,
[13:38.000 --> 13:57.000]  and it's like the ground troops of the Info War, the ground troops of the Ron Paul movement, that is us, that is the people that we're talking about going to these delegate functions and conventions.
[13:57.000 --> 14:13.000]  And as a matter of fact, you mentioned earlier about how that the election has now been postponed until May 29th or Tuesday of this year, which is actually so late in the game that the both parties, Republican and Democrat,
[14:13.000 --> 14:22.000]  they have their, you know, of course their precinct convention is supposed to occur on the same evening as the primary election.
[14:22.000 --> 14:32.000]  Well, that's thrown out the window because if they wait till May 29th, well, the senatorial district conventions are scheduled in April for Travis County.
[14:32.000 --> 14:45.000]  Our senatorial district here in Travis County is scheduled for April 21st, you know, they've made venue decisions, they've come venue commitments and they made their commitments at the state level.
[14:45.000 --> 14:54.000]  They're in Fort Worth, Texas, that's supposed to occur in early June, so there's no way that they could wait and have precinct conventions on May 29th.
[14:54.000 --> 14:59.000]  So it's not for certain exactly how precinct conventions are going to be handled.
[14:59.000 --> 15:11.000]  As a matter of fact, there's a big meeting amongst the, some of the Travis County Republican Party even tonight as we speak right now, they're having a meeting on exactly what they're going to do about precinct conventions.
[15:11.000 --> 15:17.000]  And it's a possibility, a very strong possibility that there will be no precinct conventions.
[15:17.000 --> 15:20.000]  Well, then how are the delegates going to be chosen?
[15:20.000 --> 15:25.000]  Okay, see, this is why it's important that we can't sit on our hind ends on this.
[15:25.000 --> 15:27.000]  We've got to go for it.
[15:27.000 --> 15:36.000]  We've got to get as many people involved as possible because probably what's going to happen, a very likely scenario, it's not for certain.
[15:36.000 --> 15:41.000]  And I'm going to detail a little bit more on how we can get involved on finding out how that happens.
[15:41.000 --> 15:53.000]  But what may most likely occur is that they will have an open convention occur, a senatorial district convention occur here in Travis County for Travis County.
[15:53.000 --> 15:57.000]  Now, Travis County has four senatorial districts.
[15:57.000 --> 16:01.000]  We have four Senate districts in Travis County, so we're going to have four senatorial districts.
[16:01.000 --> 16:07.000]  They're all going to be held at the Hyde Park Baptist Church April 21st.
[16:07.000 --> 16:14.000]  And I suggest watching the Travis County GOP.org events calendar to find out the time when that's listed.
[16:14.000 --> 16:20.000]  They don't have a time on that event right now, but Hyde Park Baptist Church is on Speedway up there in Hyde Park.
[16:20.000 --> 16:25.000]  And most folks here in Austin, they've been a while, they know where it's at, but you can Google it and find it real easy.
[16:25.000 --> 16:33.000]  Anyway, most likely it's going to be a case where we just need to show up April 21st at the Hyde Park Baptist Church.
[16:33.000 --> 16:35.000]  Probably start at 7 or 8 a.m.
[16:35.000 --> 16:44.000]  Bring your voter registration card to prove that you are indeed a registered Travis County voter.
[16:44.000 --> 16:54.000]  If that's how this goes down, of course, Deborah, you know, we'll probably have to have a follow-up interview here in the next week or two when we find out more about what's going on.
[16:54.000 --> 16:56.000]  But that's how they're going to select.
[16:56.000 --> 17:00.000]  Initially, they just may just select, hey, whoever shows up.

[20:28.300 --> 20:34.500]  way it most likely will be is that whoever gets the word and whoever shows up at the
[20:34.500 --> 20:39.900]  senatorial district convention here in Travis County, April 21st, if you're a Travis County
[20:39.900 --> 20:46.580]  registered voter, you must bring your voter's registration card as proof that you are a registered
[20:46.580 --> 20:51.600]  Travis County voter and I'm sure that'll be true and that will be the case in whatever
[20:51.600 --> 20:57.600]  respective county you're in in Texas, but that should be your ticket into that convention
[20:57.600 --> 21:02.780]  to become a delegate and most likely since everything is such a turmoil, they're probably
[21:02.780 --> 21:08.100]  going to have a low turnout. I'm guessing that the establishment party faction is going
[21:08.100 --> 21:13.580]  to have just as big a problem in getting the turnout for delegates as the Ron Paul faction
[21:13.580 --> 21:19.480]  does, so we should all be buoyed by this and excited that this presents one heck of an
[21:19.480 --> 21:25.100]  opportunity to come in and overwhelm this convention process here in Texas in my book.
[21:25.100 --> 21:29.380]  That's the way I see it, so take your voter's registration card down there and then what
[21:29.380 --> 21:35.180]  they will do is that they will have the senatorial district convention April 21st here in Travis
[21:35.180 --> 21:41.500]  County for Travis County registered voters and out of that pool of whoever shows up that
[21:41.500 --> 21:50.260]  day, then that's the people that will be selected and nominated to go to the Texas State convention
[21:50.260 --> 21:52.340]  coming up in Tarrant County early June.

[22:00.940 --> 22:08.420]  nearly as important as what goes down at these senatorial conventions and the state convention

[24:48.740 --> 24:57.380]  the ballot May 29th, they will be on the runoff ballot that occurs July 31st so I tell you

[25:03.540 --> 25:08.500]  is out there and I cannot say how important it is for everybody out there to become a
[25:08.500 --> 25:13.740]  precinct chair in their precinct especially if it's vacant if you want to look at Travis
[25:13.740 --> 25:18.740]  County and I'm sure the same case probably follows for Hayes County where Gary is you
[25:18.740 --> 25:22.700]  can probably go to your Republican Party website for your county and I know for a fact at
[25:22.700 --> 25:29.100]  Travis County GOP.org you can look and see what precincts are vacant which you know have
[25:29.100 --> 25:34.620]  vacancies for their chair and by all means if you're a like minded Ron Paul Liberty
[25:34.620 --> 25:40.220]  Lever then you need to get on board and file to become a precinct chair because it's those
[25:40.220 --> 25:44.860]  precinct chairs that are going to meet here in Travis County and I'm talking about Travis

[25:55.340 --> 25:59.900]  and that meeting is going to be here on Cameron Road at the Travis County Republican office

[33:19.820 --> 33:26.320]  Well, I want to know how much that really matters because I'm thinking from what I remember of the delegate process,

[33:33.820 --> 33:37.320]  whereas whoever wins the primary gets all the delegates.

[33:43.820 --> 33:46.320]  but hey, that could change.
[33:46.320 --> 33:50.320]  I mean, once you get to the national convention, from what Richard was just telling me on the break,
[33:50.320 --> 33:55.820]  they have these rules committees, the delegates can change the rules, they can change them after the fact.
[33:55.820 --> 33:58.820]  So, I mean, anything can happen.
[33:58.820 --> 33:59.820]  That's what it looks like to me.
[33:59.820 --> 34:06.820]  But if you would go ahead, Richard, give out Don Zimmerman's number and then break it down for us about the delegate process

[34:08.820 --> 34:13.820]  And does that, how much does it really matter what the percentages are of these, of the primaries?

[34:21.820 --> 34:26.820]  it's going to be up to us turning out in math in big numbers all over the state.
[34:26.820 --> 34:36.820]  All right, Don Zimmerman's number, if you would like to see about being appointed to be a precinct chair and or get on the ballot to become a precinct chair,
[34:36.820 --> 34:37.820]  I recommend you do both.
[34:37.820 --> 34:42.820]  I recommend you try to get yourself appointed right now and also get on the ballot.
[34:42.820 --> 34:59.820]  His number, Don Zimmerman, 512-577-8842-512-577-8842 is very important for as many like-minded folks out there that love freedom and liberty
[34:59.820 --> 35:05.820]  and love our God-given rights to get on board and become precinct chairs.
[35:05.820 --> 35:12.820]  And even if you don't become a precinct chair, you do have to show up to be a delegate at these conventions,
[35:12.820 --> 35:21.820]  because what can happen is seeing many states, delegates are bound and in many states, delegates are unbound.
[35:21.820 --> 35:27.820]  And what it simply means is if delegates are bound, then they're supposed to, via the rules,
[35:27.820 --> 35:35.820]  even if they hate the candidate they've got to vote for, if that, let's say, you know, McCain won Pennsylvania,
[35:35.820 --> 35:39.820]  and those delegates are bound, and I don't know, right off the top of my head,
[35:39.820 --> 35:45.820]  Pennsylvania's bound, state or unbound, but just as an example, if those delegates are bound,
[35:45.820 --> 35:53.820]  then if McCain won that primary or election there, then they are required by the rules to vote for McCain.
[35:53.820 --> 36:01.820]  But during these conventions, let's say Pennsylvania decided that we got, you know,
[36:01.820 --> 36:07.820]  they got overwhelmed with Ron Paul delegates in the convention process, and at their state convention,
[36:07.820 --> 36:12.820]  they decided, hey, you know what, we're going to let our delegates be unbound.
[36:12.820 --> 36:16.820]  They can do that via the rules committee and just change those rules,
[36:16.820 --> 36:24.820]  and then the rules committee puts that motion up for a vote to the whole body of the convention,
[36:24.820 --> 36:28.820]  and if it's a majority of Ron Paulers, then they just simply vote to unbind themselves,
[36:28.820 --> 36:32.820]  and that's what can happen state by state by state.
[36:32.820 --> 36:34.820]  Texas could do the same thing.
[36:34.820 --> 36:37.820]  Texas, we're supposed to be bound delegates.
[36:37.820 --> 36:48.820]  When we go to the RNC in Tampa, Florida, the current rule is that we would be bound to vote for whoever the winner is of our primary,
[36:48.820 --> 36:52.820]  but that is something that can be changed via the rules process.
[36:52.820 --> 36:54.820]  You can start at the senatorial district.
[36:54.820 --> 36:58.820]  As a matter of fact, if we had a precinct convention, that would be a resolution,
[36:58.820 --> 37:04.820]  that we should have a resolution to unbind the national delegates from Texas.
[37:04.820 --> 37:08.820]  I'll start it right there, but anyway, if we can't start the precinct convention,
[37:08.820 --> 37:14.820]  then we start the resolution at the senatorial district, and then it moves on up to the state convention,
[37:14.820 --> 37:19.820]  and then at the state convention, if we were a majority, then we just change that rule
[37:19.820 --> 37:22.820]  and say, hey, we're not bound delegates anymore.
[37:22.820 --> 37:28.820]  When we go to the RNC and whoever goes to the RNC, those delegates are going to vote for who they want to vote for.
[37:28.820 --> 37:32.820]  That is absolutely amazing, and it's wonderful news,
[37:32.820 --> 37:40.820]  and it could very well work out in our favor the fact that our convention has been pushed back somewhat,
[37:40.820 --> 37:45.820]  but that our primaries have been pushed back somewhat because it gives us more time to deal with this process,
[37:45.820 --> 37:53.820]  and I certainly hope that the Ron Paul campaign has got boots on the ground in every state
[37:53.820 --> 38:01.820]  to make this sort of thing happen because this is what it's going to take to get him nominated in the national convention.
[38:01.820 --> 38:07.820]  Well, even if we don't officially have campaign people boots on the ground,
[38:07.820 --> 38:14.820]  I know there's just a lot of just plain old activists like yourself and like me that are just out there

[46:39.820 --> 46:45.820]  There's some interesting things that we're doing in the traffic and due process side of things right now.
[46:45.820 --> 46:49.820]  If you haven't been coming to the classes, you might want to start.
[46:49.820 --> 46:56.820]  We are going through the efforts of having impromptu mock trials as we progress through our studies
[46:56.820 --> 47:00.820]  over given sections of the statutes and such.
[47:00.820 --> 47:06.820]  There is, however, something specific I want to go over with for a little bit tonight if I may.
[47:06.820 --> 47:13.820]  Dealing with reasons number one, we don't talk to the cops on the side of the road or anywhere else for that matter.
[47:13.820 --> 47:21.820]  And number two, the things to watch out for so that you can actually get your case overturned and thrown out
[47:21.820 --> 47:24.820]  because of things that they do wrong.
[47:24.820 --> 47:33.820]  Those of you that come to the class know that one of the things that I harp on is knowing the rules by which the game is played.
[47:33.820 --> 47:40.820]  If you don't know the rules, then you don't know when the rules have been broken.
[47:40.820 --> 47:48.820]  And in the case of the justice and municipal courts, that's fatal to your ability to get the case overturned.
[47:48.820 --> 47:56.820]  Why? Because they always make fatal due process errors in what they do.
[47:56.820 --> 48:04.820]  In fact, the police officer himself on the side of the road begins that fatal due process error procedure.
[48:04.820 --> 48:08.820]  And I want to tell you exactly how I came to that legal conclusion.
[48:08.820 --> 48:15.820]  Okay, what I'm going to read to you right now is an excerpt from a case called Aziz v. State.
[48:15.820 --> 48:23.820]  Aziz is spelled A-Z-E-E-Z. It's from 248 SW 3rd 182.
[48:23.820 --> 48:30.820]  Now, the case is regarding failure to appear, but it's failure to appear on a traffic citation.
[48:30.820 --> 48:40.820]  So the case is actually discussed in a transportation code context, including Chapter 543, The Authority to Arrest Without Warrant.
[48:40.820 --> 48:48.820]  Now, most of the time the officers will lie and they will tell you that you're in an investigative detention.
[48:48.820 --> 48:55.820]  The courts will lie and tell you that you were never under arrest, you were in investigative detention.
[48:55.820 --> 49:06.820]  Well, sorry, folks, when it comes to a traffic citation, in Texas there is no such thing as an investigative detention.
[49:06.820 --> 49:13.820]  When you're stopped for the purpose of issuing that citation, you are in a custodial arrest.
[49:13.820 --> 49:17.820]  The statute themselves makes that very clear.
[49:17.820 --> 49:24.820]  And the Texas Appellate Court here went through this, and this is one of the statements they make.
[49:24.820 --> 49:30.820]  Later cases established that such an arrest does not amount to a full custodial arrest,
[49:30.820 --> 49:38.820]  such that it would authorize the arresting officer to conduct a search incident to arrest without first obtaining a search warrant.
[49:38.820 --> 49:43.820]  They're referring to the search of an automobile after a transportation stop has been made,
[49:43.820 --> 49:50.820]  that the stop itself does not constitute a stop that would allow a search without warrant.
[49:50.820 --> 50:00.820]  However, those of you that have had experience with these stops know for a fact that even after the officers arrest you and put you in their squad car,
[50:00.820 --> 50:04.820]  the first thing they do is conduct a warrantless search of your car.
[50:04.820 --> 50:07.820]  It's absolutely illegal.
[50:07.820 --> 50:11.820]  They need to have the warrant, but they never ever do.
[50:11.820 --> 50:20.820]  Guess what? Reverseable error has occurred if they uncover any evidence in that search to use against you.
[50:20.820 --> 50:28.820]  A tort action has occurred when that officer has conducted an illegal search without a warrant.
[50:28.820 --> 50:36.820]  So he is outside of the scope of his official duties when he conducts an illegal search.
[50:36.820 --> 50:38.820]  Let's go on.
[50:38.820 --> 50:48.820]  But the transportation code scheme clearly regards it as some form, degree, or gradation of arrest, however fleeting.
[50:48.820 --> 51:03.820]  We said as much in state versus curse, KURTZ, where we concluded that the transportation code makes it clear that its use of the term arrest is not limited to a custodial arrest.
[51:03.820 --> 51:13.820]  Now, I don't know where they're getting the argument that it's something other than a custodial arrest or how it even hints to be something other than a custodial arrest,
[51:13.820 --> 51:26.820]  since the very statute itself very clearly reads that a peace officer may arrest without warrant any person found committing a violation of this subtitle.
[51:26.820 --> 51:38.820]  Then as you progress through 543, it very clearly states that the person arrested may only be released from custody.
[51:38.820 --> 51:45.820]  Right there, the statute admits this was a custodial arrest.
[51:45.820 --> 51:52.820]  How can you be released from custody if you're not actually in custody?
[51:52.820 --> 51:58.820]  This goes to the heart of what I tell people about questions 2 and 3.
[51:58.820 --> 52:01.820]  Am I under arrest?
[52:01.820 --> 52:04.820]  Am I free to go?
[52:04.820 --> 52:13.820]  Those two questions are very important to establishing that you are in a custodial arrest.
[52:13.820 --> 52:15.820]  Do not forget to ask them.
[52:15.820 --> 52:22.820]  It is very important that those appear in the recording of the stop.
[52:22.820 --> 52:23.820]  Why?
[52:23.820 --> 52:30.820]  Because it hinges the entire argument about whether or not you were in a custodial arrest.
[52:30.820 --> 52:40.820]  I'll get to the point of that when I'll read you some of these cases on how that determination of custody or not custody is made by the courts.
[52:40.820 --> 52:50.820]  Now, it goes through several cases here and then it continues to discuss the transportation code.
[52:50.820 --> 53:00.820]  The enactment of the transportation code in 1995 was not intended to make substantive changes to earlier statutory provisions, but merely to recodify them.
[53:00.820 --> 53:03.820]  Well, if you've been to class, you know that.
[53:03.820 --> 53:06.820]  The original statutes are still in force and effect.
[53:06.820 --> 53:09.820]  All they've done is recodified.
[53:09.820 --> 53:17.820]  They've reorganized, renumbered, and rewritten the language of those statutes into this recodification.
[53:17.820 --> 53:22.820]  But no change of the original application has taken place.
[53:22.820 --> 53:24.820]  It can't.
[53:24.820 --> 53:31.820]  This is simply nothing more in the current transportation code than a restatement of the prior law.
[53:31.820 --> 53:37.820]  That's all it is.
[53:37.820 --> 53:50.820]  And indeed, section 543.005 of the transportation code still speaks in terms of releasing a motorist from custody once he signs the citation promising to appear.
[53:50.820 --> 54:04.820]  The third edition of Texas Jurisprudence has apparently construed the recodified provisions of the transportation code pertaining to traffic violations accordingly to authorize the arrest of violators, including speeders,
[54:04.820 --> 54:12.820]  subject to release from custody if and when the violator signs the promise to appear on the citation.
[54:12.820 --> 54:22.820]  And this is noted in 22 Texas Jurisprudence 3rd section or paragraph 2277, and that was done in 2001.
[54:22.820 --> 54:41.820]  Now, if we go on, if filthy to the statutory language of the transportation code requires that the detention involved in a traffic stop be labeled an arrest, it is not the sort of custodial arrest that subjects the person to the incidental searches allowed by Fourth Amendment law.
[54:41.820 --> 54:53.820]  Again, we've all watched police officers conduct illegal searches of our cars right there on the side of the road or in the parking lot or whatever without a warrant.
[54:53.820 --> 54:56.820]  They have no probable cause to conduct the search.
[54:56.820 --> 55:17.820]  Once they have you out of the car, they cannot make the argument that the interior of the car is accessible by the defendant for the purpose of conducting a search to determine if you have access to weapons, especially if they've already handcuffed you and put you in the back of their car.
[55:17.820 --> 55:25.820]  So again, any subsequent search at that point is completely illegal.
[55:25.820 --> 55:30.820]  Now, it goes on in this, in a zeal to discuss the arrest.
[55:30.820 --> 55:50.820]  But does the arrest associated with a traffic stop equate with being under arrest for purposes of the definition of custody in section 38.011A of the penal code such that a motorist who is released from custody under the provisions of the transportation code,
[55:50.820 --> 55:58.820]  who then fails to appear as promised in the citation, has committed an offense under section 38.10A of the penal code.
[55:58.820 --> 56:01.820]  We believe so.
[56:01.820 --> 56:11.820]  So the criminal court of appeal or the court of criminal appeals is saying that, yes, this arrest is good for the charge of failure to appear.
[56:11.820 --> 56:32.820]  They're not taking into consideration 1517G and 27.14D, however, where the statute clearly does not provide authority to issue an arrest warrant for failure to appear on a class C.
[56:32.820 --> 56:44.820]  Now, if it's an A or B citation, that's covered, but there's nothing in the language that covers the issuance of a warrant for failure to appear on a class C.
[56:44.820 --> 56:49.820]  That never gets analyzed in this case or any other one that I've seen so far.
[56:49.820 --> 56:59.820]  The penal code itself contains no definition of arrest to compare to the apparent scope of arrest as used in the transportation code.
[56:59.820 --> 57:17.820]  But the code of criminal procedure provides that a person is arrested when he has been actually placed under restraint or taken into custody by an officer or person executing a warrant of arrest or by an officer or person arresting without a warrant.
[57:17.820 --> 57:21.820]  Well, again, what's the definition of custody?
[57:21.820 --> 57:23.820]  This is what we're working toward.
[57:23.820 --> 57:38.820]  We have construed this provision to mean that, at least as a matter of state law, a restriction upon personal liberty that amounts to less than full custodial arrest may nevertheless constitute an arrest.
[57:38.820 --> 57:52.820]  At least one court of appeals has construed a transportation code arrest to be of the type to justify prosecution for resisting arrest under another offense in Chapter 38 of the Penal Code.
[57:52.820 --> 58:13.820]  We conclude that the failure to appear to answer to a traffic offense citation, including a speeding citation, does constitute a failure to appear under the terms of lawful release from custody for purposes of 38.011A and 38.10A of the Penal Code and is therefore an offense under the latter provision.

[01:04:08.820 --> 01:04:21.820]  Okay, all right. Now, back to the case of a ZV state, we can see very clearly that even the Texas Court of Criminal Appeals recognizes that this is a custodial arrest issue.
[01:04:21.820 --> 01:04:33.820]  Okay, now, this takes us to something that is very interesting to us. It's called Aerosman's Reversible Errors in Texas Criminal Cases.
[01:04:33.820 --> 01:04:47.820]  Now, what this book does is it outlines all the cases that are authoritative on the issue of the appellate courts handing back a case on reversible error by either dismissing the judgment,
[01:04:47.820 --> 01:04:51.820]  remanding it for other information, new trial, whatever.
[01:04:51.820 --> 01:05:05.820]  So what we're going to do is we're going to go through a little bit of Chapter 14 and look at some of the case law on this subject, and we're going to see why Question 2 and 3 that I teach you in the seminar, which is,
[01:05:05.820 --> 01:05:28.820]  am I under arrest and am I free to go, are so important. Now, this is the case of a Roscoe v. Texas, O-R-O-Z-C-O v. Texas, 394 U.S. 324, 89 Supreme Court 1095, 22.
[01:05:28.820 --> 01:05:47.820]  Okay, this case was in 1969. A defendant is in custody for the purposes of requiring Miranda warnings when he is under restraint by the police and is not free to leave regardless of whether he is at the police station or even as here in his own home.
[01:05:47.820 --> 01:06:05.820]  Another case, State v. Giles, 867 SW 2nd 105, Texas Court of Appeals, El Paso, in 1993. The charges were aggravated sexual assault and decency with a child.
[01:06:05.820 --> 01:06:20.820]  This is what the court decided. The trial court properly granted the defendant's motion to suppress evidence where officers admitted that the search was conducted to find evidence rather than to inventory the vehicle.
[01:06:20.820 --> 01:06:35.820]  This goes exactly to what I was talking about, about that illegal search of your car during a traffic stop. Okay, this is what they're doing. They're looking for evidence. They're not inventorying the car.
[01:06:35.820 --> 01:06:45.820]  Okay, so the arrest is patently illegal on its face once they have you outside of the car where you cannot access anything in it.
[01:06:45.820 --> 01:07:03.820]  But let's go back to the other issue here of when to know you're in a custodial arrest. Okay, Reagan, R-A-G-A-N 642 SW 2nd 489, Texas Criminal Appeals in 1982, the issues DWI.
[01:07:03.820 --> 01:07:18.820]  Defendant, who was stopped, told to leave his automobile and placed in the backseat of patrol car was in custody for purposes of Texas Code of Criminal Procedure Article 38.22 when tape recording of his answers to interrogations were made.
[01:07:18.820 --> 01:07:39.820]  Newberry 552 SW 2nd 457, Texas Court of Criminal Appeals in 1977, again the issue is DWI. The factors to be considered in determining whether a defendant is in custody are one, probable cause to arrest, two, subjective intent of the police,
[01:07:39.820 --> 01:07:54.820]  three, focus of the investigation, and four, subjective belief of the defendant. When these factors lead to a conclusion that the defendant was in custody, he must have been given warnings before being questioned.
[01:07:54.820 --> 01:08:17.820]  Now, why is that important? Well, let me tell you, when these officers walk up to your car, let's take number one, okay? Number one, they are assuming probable cause based upon the fact that this is a transportation stop and that you are engaging in transportation.
[01:08:17.820 --> 01:08:30.820]  They get this presumption because you're in a car that has all the stickers and all the plates that make the car commercial ready, at least most people do.
[01:08:30.820 --> 01:08:41.820]  Now, if they stop a car that doesn't have any of these accoutrements on it for the purposes of a transportation stop, they've got a whole nother problem to have to overcome.
[01:08:41.820 --> 01:08:51.820]  And that makes the stop a much different story than it would otherwise. But for these purposes, let's look at one, probable cause to arrest.
[01:08:51.820 --> 01:09:05.820]  Well, they've looked at the car, they see the plates, the presumption is transportation is occurring, and the car is being used to violate a transportation statute.
[01:09:05.820 --> 01:09:21.820]  So, for those purposes, they immediately have, at least in their mind, probable cause for an arrest. You are in transportation, you're violating the rules associated with transportation, so probable cause exists.
[01:09:21.820 --> 01:09:29.820]  I'm not saying it's right, I'm simply saying that's how they look at it and that's how the court's going to look at it, okay?
[01:09:29.820 --> 01:09:43.820]  Alright, now, number two, subjective intent of the police. If a police officer pulls you over for a transportation offense, what do you honestly believe his subjective intent is?
[01:09:43.820 --> 01:09:56.820]  Is it just to pull you over and say, hey, by the way, you're going what I perceived to be just a little bit too fast or a lot too fast, would you mind slowing it down so that you don't cause a problem further down the road?
[01:09:56.820 --> 01:10:06.820]  No. License registration proof of insurance. I want to know who you are, what you're doing here, whether or not you're violating any other laws and blah, blah, blah.
[01:10:06.820 --> 01:10:24.820]  That right there, folks, is where the rub comes in. Whether or not you're violating any other transportation laws, that's why he wants license registration proof of insurance.
[01:10:24.820 --> 01:10:35.820]  Remember, you are in a custodial arrest, whether he tells you that or not. This is how we establish that fact with our questions.
[01:10:35.820 --> 01:10:40.820]  What's the emergency and how can I help? Am I under arrest?
[01:10:40.820 --> 01:11:01.820]  When he says no and you say, am I free to go? And he again says no, then the courts have established that as a reasonable person, you do not feel that you are at liberty to leave of your own free will.
[01:11:01.820 --> 01:11:06.820]  That creates the custodial arrest situation we need.
[01:11:06.820 --> 01:11:25.820]  Now, when the officer starts demanding information from you that results in other charges or the continued levying of this stop against you, he has never, ever read you your rights.
[01:11:25.820 --> 01:11:32.820]  Never. There is no Miranda warning in progress here at all.
[01:11:32.820 --> 01:11:44.820]  He is simply wanting you to fork over information that he can turn around and charge you with other things with if it's not in proper order.
[01:11:44.820 --> 01:11:54.820]  Your car's expired. You don't have a new one with you. Your license is expired. He runs the license number and it comes back suspended.
[01:11:54.820 --> 01:12:04.820]  All of this is information that he is not entitled to have at this stage of the game without a proper warrant.
[01:12:04.820 --> 01:12:09.820]  So guess what? What should we be doing in court?
[01:12:09.820 --> 01:12:13.820]  We should be filing motions to suppress.
[01:12:13.820 --> 01:12:28.820]  I move the court suppressed the introduction of the license. I move the court suppressed the introduction of the insurance. I move the court suppressed everything that occurred at the stop because the stop and search were illegal by the officer.
[01:12:28.820 --> 01:12:41.820]  Why? One, he didn't have a warrant. Two, he did not Miranda as you. Three, he gathered testimony and evidence without a proper warrant and without informing you of your rights.
[01:12:41.820 --> 01:12:48.820]  Right there, the officer has become the chief violator of your due process rights.
[01:12:48.820 --> 01:13:05.820]  Okay? Now, consider all these cases we have going to these courts. What do I tell you? Never go to merits when there are outstanding due process violations there.
[01:13:05.820 --> 01:13:13.820]  Well, folks, this is one of them. Right off the bat, it's a big one. And guess what?
[01:13:13.820 --> 01:13:27.820]  I cannot find a single court case that addresses these issues from this perspective. No one, it appears, has ever brought it up in this context.
[01:13:27.820 --> 01:13:39.820]  So, if they've never brought it up, it's never been taken to the court to have it adjudicated. The court has to look at its own case law in the past.
[01:13:39.820 --> 01:13:48.820]  If they're doing things properly, at least the appeals court will and see whether or not they've ever adjudicated these issues prior.
[01:13:48.820 --> 01:14:00.820]  Well, we've established this was a custodial arrest in accordance with exactly what the courts say. We did not feel that we had the ability to leave of our own free will.
[01:14:00.820 --> 01:14:11.820]  That makes this a custodial arrest. Remember number four, subjective belief of the defendant.
[01:14:11.820 --> 01:14:22.820]  That subjective belief is that you are not free to leave. That creates the atmosphere and instance of a custodial arrest.
[01:14:22.820 --> 01:14:34.820]  No matter what the cop wants you to believe or what the lower court wants you to believe, you are in a custodial arrest according to what the high courts all agree on.

[01:15:12.820 --> 01:15:28.820]  Where the defendant considered to take the breath test only after being told in addition to the statutory warnings that if he did not do so, he would be arrested and jailed for DWI.
[01:15:28.820 --> 01:15:36.820]  The consent was not voluntary and the defendant's motion to suppress evidence should have been granted.
[01:15:36.820 --> 01:15:47.820]  What happens when you tell a police officer, I don't want to sign the ticket. I don't want to give you a license. What does he threaten you with?
[01:15:47.820 --> 01:15:54.820]  If you don't give me the license, you will go to jail for driving without one.
[01:15:54.820 --> 01:16:00.820]  This is exactly the same scenario we're looking at right here.
[01:16:00.820 --> 01:16:08.820]  The only difference is the actual crime itself. The circumstances and conditions are identical.
[01:16:08.820 --> 01:16:19.820]  The officer is threatening you to get you to produce testimony or evidence that he can use to incriminate you.
[01:16:19.820 --> 01:16:33.820]  If he takes that license and runs it or sees it and it's expired or it's suspended, then he has illegally seized that evidence because he's never read you your Miranda rights.
[01:16:33.820 --> 01:16:43.820]  Okay? Not only that, the information was provided under threat to arrest and coercion without the benefit of your Miranda rights.

[01:19:59.820 --> 01:20:06.820]  Folks, this applies to the implied consent statutes the legislature made.
[01:20:06.820 --> 01:20:14.820]  Now, this is something that me and the courts will never, ever agree on, and if any of us love freedom,
[01:20:14.820 --> 01:20:21.820]  we should be beating the living crap out of every legislator that said this was a viable law and every judge that agrees with it.
[01:20:21.820 --> 01:20:26.820]  I mean, consider the fact that the legislature passes a law that says,
[01:20:26.820 --> 01:20:45.820]  if you're doing this and this occurs, then it is implied that you have consented to the waiver of your rights and property for the purpose of our getting it from you to use as evidence against you in a criminal action.
[01:20:45.820 --> 01:20:51.820]  Now, that can be a breathalyzer, that can be your blood, that can be just about anything.
[01:20:51.820 --> 01:20:58.820]  Okay, if they can take one thing from you against your will to use against you,
[01:20:58.820 --> 01:21:03.820]  then there is no limit to what they can take from you and use against you.
[01:21:03.820 --> 01:21:07.820]  All the legislature has to do is create a statute authorizing it.

[01:21:11.820 --> 01:21:23.820]  Baloney, again, complete subversion of what we conceive to be our protected right against unlawful search and seizure.

[01:21:31.820 --> 01:21:37.820]  At least we had a judge up in Pennsylvania decide that breathalyzer tests were unconstitutional.
[01:21:37.820 --> 01:21:44.820]  Why? Because there's no opportunity for the accused to get rebuttal evidence.

[01:21:47.820 --> 01:21:53.820]  The state can assert that this is the evidence we collected against you and we're going to use it to convict you,
[01:21:53.820 --> 01:22:06.820]  but the defendant has no way to offset the evidence because they're never given opportunity to get an independent test done that may prove the fallacy of the state's test.
[01:22:06.820 --> 01:22:09.820]  So think about that.
[01:22:09.820 --> 01:22:23.820]  If the legislature in any state can authorize, just through an enactment, the seizure of personal property of any kind as evidence against you without a warrant
[01:22:23.820 --> 01:22:30.820]  by simply asserting that you have impliedly consented to this, then nothing's safe.
[01:22:30.820 --> 01:22:32.820]  No right is safe.
[01:22:32.820 --> 01:22:39.820]  It's just like the court saying that any right not claimed is considered waived.
[01:22:39.820 --> 01:22:42.820]  That's absolutely ridiculous.
[01:22:42.820 --> 01:22:54.820]  What would be the purpose of calling it a right if the individual that holds it is considered to have automatically waived it in every instance unless they verbally enacted?

[01:22:57.820 --> 01:23:09.820]  That's telling my servant, oh, if I don't specifically tell you that I object to what you're doing, feel free to do it anyway.

[01:23:12.820 --> 01:23:21.820]  Even your kids aren't enough to come up with the conclusion they can do what the hell they want until you tell them otherwise.

[01:23:33.820 --> 01:23:47.820]  State versus Williams, 814, Southwest 2nd, 256, Texas Appellate Court in Austin, affirmed under 832, Southwest 2nd, 52, in 1992, DWI.
[01:23:47.820 --> 01:23:57.820]  The defendant's motion to suppress the results of a blood test taken while he was under arrest at a hospital after an accident was properly granted.
[01:23:57.820 --> 01:24:00.820]  The defendant had a one-car accident.
[01:24:00.820 --> 01:24:04.820]  There was no evidence of alcohol involvement at the time of the accident.
[01:24:04.820 --> 01:24:13.820]  About one hour later, the officer saw the defendant at the hospital and noted that he had an odor of alcohol, slurred speech, and bloodshot eyes.
[01:24:13.820 --> 01:24:19.820]  He was placed under arrest and asked to consent to a blood test, which he did.
[01:24:19.820 --> 01:24:32.820]  Because there were no reasonable grounds to believe that the defendant was intoxicated at the time he was driving, the implied consent law did not apply, and there was insufficient evidence of voluntary consent.
[01:24:32.820 --> 01:24:41.820]  State versus cell, 798, Southwest 2nd, 865, again, Texas Appellate Court in Austin, driving while intoxicated.
[01:24:41.820 --> 01:24:48.820]  Trial court's granting of defendant's motion to suppress and toxilizer results was upheld on appeal.
[01:24:48.820 --> 01:24:58.820]  The policeman told the defendant that if he did not take a breath test, he would automatically be charged and incarcerated.
[01:24:58.820 --> 01:25:04.820]  This was a misstatement of the law and was coercive, so the breath test was not voluntary.
[01:25:04.820 --> 01:25:11.820]  So you see, folks, these cops do threaten us with incarceration to get evidence against us.
[01:25:11.820 --> 01:25:15.820]  There's no way that providing us such evidence can be voluntary.
[01:25:15.820 --> 01:25:32.820]  However, if you or your defense attorney fails to make a timely objection to its introduction, then the objection, once again, by the idiocy of the courts, has been determined to have been waived.
[01:25:32.820 --> 01:25:35.820]  Whether you wanted to waive it or not.
[01:25:35.820 --> 01:25:41.820]  So these are the reasons why you need to know the rules of the game.
[01:25:41.820 --> 01:25:53.820]  If you're playing the game and don't know the rules, you can get cheated, taken advantage of, and deprived of what you rightfully should get in the course of the game.
[01:25:53.820 --> 01:26:08.820]  Okay? I mean, have you ever played Monopoly with somebody that was just knew every nuance of the game and loved playing with people that didn't so that he could lie to him about what the rules were?
[01:26:08.820 --> 01:26:11.820]  And at the end of the game, they own everything.

[01:26:13.820 --> 01:26:14.820]  Why?
[01:26:14.820 --> 01:26:17.820]  Because they always play against people that they know they can beat.
[01:26:17.820 --> 01:26:26.820]  They always take advantage of the rules and the ignorance of the other players to steal and cheat and get what they want.

[01:26:29.820 --> 01:26:43.820]  In fact, when you learn the ins and outs of this system, you can see that this system was specifically engineered to do exactly that very thing.

[01:28:30.820 --> 01:28:40.820]  Well, that's the thing. They do have that kangaroo warrant system where there's a judge in a van that just gives them the warrant right there in the street, but they do have a little loophole.
[01:28:40.820 --> 01:28:49.820]  So basically, it pulls you over. There's a judge rubber stamping the warrant in a parking lot, and then they just pull your blood out right there in a little van.
[01:28:49.820 --> 01:28:55.820]  Well, let me ask a question. Do they take you before the judge to have the warrant issued?
[01:28:55.820 --> 01:28:58.820]  I don't think so. I think it's pretty much a rubber stamp.
[01:28:58.820 --> 01:29:08.820]  Okay, then here's the problem. What evidence is being introduced to that judge to establish probable cause in this proceeding?
[01:29:08.820 --> 01:29:14.820]  Probably just the police making the request for the warrant is all they do. It's a rubber stamp.
[01:29:14.820 --> 01:29:32.820]  Probably. But again, that causes two problems under Texas law. You're being deprived of the appearance before the magistrate, and this proceeding is not public, and it's required to be public.
[01:29:32.820 --> 01:29:42.820]  That's two problems right off the bat. I don't know that the second one's ever been brought up in these cases.

[01:33:07.820 --> 01:33:14.820]  Then they've been charging all these fees that they shouldn't be and all these kind of things and just doing all kinds of things.
[01:33:14.820 --> 01:33:19.820]  But anyway, I was going to say, if you quit paying, what is their recourse? Can they sue you or what can they actually do?
[01:33:19.820 --> 01:33:23.820]  What kind of line of credit are you talking about? Is this a credit card?
[01:33:23.820 --> 01:33:28.820]  It was just like what do you call it, a personal line of credit that was through another bank.
[01:33:28.820 --> 01:33:33.820]  Well, they can't do anything that's not in the terms of the original agreement, fees or otherwise.
[01:33:33.820 --> 01:33:40.820]  The acquisition of the debt does not change the terms of the contract surrounding the debt.
[01:33:40.820 --> 01:33:46.820]  The contract that was originally agreed to is still the only binding contract in existence.
[01:33:46.820 --> 01:33:52.820]  Anything they're adding to above and beyond that, they can't do if you dispute it.
[01:33:52.820 --> 01:33:56.820]  Well, what they'll do is they'll wait until they post the payment and then they'll say there was a late fee.
[01:33:56.820 --> 01:34:00.820]  And then you didn't pay the full amount because the late fee was added so they're going to charge you another late fee.
[01:34:00.820 --> 01:34:03.820]  Well, that's the same thing they do in mortgages.
[01:34:03.820 --> 01:34:10.820]  The problem here is you need to find out exactly how they've arranged this to be late.
[01:34:10.820 --> 01:34:14.820]  What is the contract term for when the payment is due?
[01:34:14.820 --> 01:34:21.820]  Are you making it on time according to the contract payment date?
[01:34:21.820 --> 01:34:26.820]  If you are, they cannot state that it is late.
[01:34:26.820 --> 01:34:34.820]  If they are, then they are illegally assessing fees in violation of the terms of the contract.
[01:34:34.820 --> 01:34:39.820]  Because the original was a bank called MCA Bank that got bought out by the...
[01:34:39.820 --> 01:34:43.820]  It doesn't matter who it was originally with or whether or not it was bought out.

[01:34:48.820 --> 01:34:55.820]  So the dates for the first contract that I originally signed, not what the Bank of America decided were the dates then, is that what you're saying?

[01:34:59.820 --> 01:35:04.820]  Okay, then the original terms of the contract are all that matters.
[01:35:04.820 --> 01:35:22.820]  The only thing that you may have to worry about is whether or not, if this is a revolving line of credit, if you pay it off and then you come in and you borrow against it again, does it fall subject to new terms?

[01:35:25.820 --> 01:35:48.820]  If you paid off the revolving credit terms, or there is language in the contract that says the credit terms can be adjusted on the fly by whatever bank controls the account at any given time and you agreed to that, then that's a problem.
[01:35:48.820 --> 01:35:55.820]  Yeah, I gotcha. I got to read your original contract with the original bank then and see the details about that then.

[01:36:43.820 --> 01:36:54.820]  If the bank writes off the revolving line of credit as a loss and sells it to a debt collector, then there's a problem here.
[01:36:54.820 --> 01:37:01.820]  The bank wrote off the loss so there's no longer a debt. What did they sell to the debt collector?
[01:37:01.820 --> 01:37:06.820]  And by what authority does this debt collector attempt to collect it?
[01:37:06.820 --> 01:37:18.820]  The only way that it can be legally collected, reasonably speaking, is if the bank does not write it off and hire someone to attempt to collect it on behalf of the bank.
[01:37:18.820 --> 01:37:27.820]  They're still susceptible to the Fair Debt Collection Practices Act and Tila, or not Tila, what's the other one, Deborah?
[01:37:27.820 --> 01:37:29.820]  Fair Credit Reporting Act.
[01:37:29.820 --> 01:37:32.820]  Yeah, Fair Credit Reporting and so on and so forth.
[01:37:32.820 --> 01:37:36.820]  You said there was something I should get, a book or something?

[01:49:22.820 --> 01:49:31.820]  And I researched your website, jurorsimprudence.com, and I've got some of the templates for preparing complaints, and I'm kind of using that as a starting point.
[01:49:31.820 --> 01:49:44.820]  Okay, question is, have you looked at the laws in your particular state, which I'm assuming is South Carolina here, to see what the requisites of a criminal complaint are in South Carolina?
[01:49:44.820 --> 01:49:53.820]  That's hard to find. I've contacted the local sheriff's department. He didn't even know what a criminal complaint was.
[01:49:53.820 --> 01:50:08.820]  So, go to the secretary of state and ask them where you go online to look at the state statutes, or do a Google search for South Carolina laws, codes, or whatever.
[01:50:08.820 --> 01:50:16.820]  That should pull you up a website that you can go directly to and peruse all of the statutes online.
[01:50:16.820 --> 01:50:31.820]  Every state has it. Now, not every state is up to date with the actual books, and Arkansas, for instance, will tell you that nothing posted on this website is to be considered valid.
[01:50:31.820 --> 01:50:40.820]  Now, this is the state code website, and yet they don't want you to consider anything on it valid.
[01:50:40.820 --> 01:50:53.820]  I've seen that little notation before, and yes, I guess I have to take that with a grain of salt, but that's as best as I can do, I guess.

[01:52:43.820 --> 01:52:50.820]  The sheriff departments and the police departments are never going to know what that is because that's not what they deal with.
[01:52:50.820 --> 01:53:01.820]  When people go and complain to the police, that's all it is. It's a complaining. It's not a real criminal complaint.
[01:53:01.820 --> 01:53:09.820]  When you file out, when you fill out a police report and file that with them, it's not a real criminal complaint.
[01:53:09.820 --> 01:53:20.820]  It's a verified criminal affidavit. That's generally something that there's a form for, like Eddie's saying, it'll be in the state criminal code of procedure for your state.
[01:53:20.820 --> 01:53:26.820]  And that's generally something that is filed either with a magistrate or with a district attorney.
[01:53:26.820 --> 01:53:32.820]  But that is not something that is filed with the police. It's not something that's filed with the sheriff.
[01:53:32.820 --> 01:53:45.820]  It's not filing entities for a criminal complaint. And so generally when people are a victim of a crime, they'll go and complain to the police or complain to the sheriff and fill out some kind of a report.
[01:53:45.820 --> 01:53:58.820]  And then that is submitted to the district attorney and then a criminal complaint would be basically put in action after that, which the victim would most likely have to sign.
[01:53:58.820 --> 01:54:03.820]  The police would sign it if he was or she was around at the time of the alleged event.
[01:54:03.820 --> 01:54:09.820]  But folks, if you want to file criminal charges against public servants, you don't go to the police.
[01:54:09.820 --> 01:54:19.820]  You fill out a verified criminal affidavit. It has to be notarized and you'll file that either with a magistrate, a judge, or the district attorney.

[01:54:30.820 --> 01:54:44.820]  Well, I just wanted to share some information. I don't know if you guys know, but the law that prohibited recording cops was overturned by a Cook County judge not too long ago.

[01:54:47.820 --> 01:55:01.820]  Also, you had a previous caller discussing a credit card issue. Aside from the federal laws, people have to understand that a lot of the state laws are even more protective than the federal laws.
[01:55:01.820 --> 01:55:08.820]  For example, the requirement of the many Miranda. Not every state requires as many Miranda. Texas is one of them.
[01:55:08.820 --> 01:55:19.820]  And I don't believe you can't be garnished in Texas. I believe that's a state law and if you can't be garnished in Texas, they cannot threaten you with garnishment.
[01:55:19.820 --> 01:55:31.820]  And I think actually Texas has some of the most protective laws regarding that. Some states, you can call after seven, whereas the federal law, you can call after nine.
[01:55:31.820 --> 01:55:45.820]  I think a couple, you can't even talk to the spouse. And people need to understand that they call you at work. You can verbally tell them, don't call me at work and they can't call you.
[01:55:45.820 --> 01:55:51.820]  But if they call you at home, you have to give it a writing for them not to call you at home.
[01:55:51.820 --> 01:56:01.820]  Also, some people seem to assume that because it's with a collection agency, that that collection agency owns it. That's not necessarily the case.
[01:56:01.820 --> 01:56:22.820]  But many times there are clients, the credit card company is the client of the collection agency. And sometimes, not very often, they can bring your account up to date at that agency. But they'll be tricky and lie about that.
[01:56:22.820 --> 01:56:31.820]  It can happen. Well, they'll re-age your account and bring it up to date if you agree to pay them. But that's only if it's not very delinquent.
[01:56:31.820 --> 01:56:42.820]  It's only a few to six months maybe. If it is still with the credit card company, you can ask them to re-age it and agree to plan.
[01:56:42.820 --> 01:56:51.820]  For example, if you have really good credit and you want to keep that, you might be able to get it up to date like that.
[01:56:51.820 --> 01:57:04.820]  Also, as far as the DUIs and the No Reviews and the Weekend and all that, you got a guy a few weeks ago who had like three DUIs or was talking about a friend of his that had a few DUIs.
[01:57:04.820 --> 01:57:14.820]  If you're in that kind of situation, then you need to get a competent attorney. I think you might agree in this situation, Nettie.
