[04:41.560 --> 04:49.480]  Something that most of you should be familiar with, but probably aren't, since you are fighting
[04:49.480 --> 04:55.080]  these battles in courts, is you need to be aware that any of these local courts that
[04:55.080 --> 05:04.240]  you are going into may have a separate set of local rules, and you need to get a copy
[05:04.240 --> 05:08.320]  of those when you are going into these courts.
[05:08.320 --> 05:15.400]  Each of these courts can set up a different timeline for motions filings, they can set
[05:15.400 --> 05:23.560]  up not completely prohibitive processes, but they can change the way that delivery and
[05:23.560 --> 05:27.360]  everything has to be made up to a point.
[05:27.360 --> 05:31.040]  So you need to be familiar with the local rules of court.
[05:31.040 --> 05:41.960]  Now, Austin Municipal Court has those local rules online, it's about 11 pages, but it's
[05:41.960 --> 05:49.440]  not actually that much information, most of the stuff in it is spaced out really wide,
[05:49.440 --> 05:54.480]  so you've only got like 5 or 6 rules to a page.
[05:54.480 --> 05:59.440]  So it's really not that big a deal to read, it's relatively simple to learn, but there
[05:59.440 --> 06:05.600]  are some important things in it that you need to be aware of.
[06:05.600 --> 06:13.240]  For instance, in their rules, they treat a court reporter as an optional item in the
[06:13.240 --> 06:14.520]  court of record.
[06:14.520 --> 06:18.800]  Basically, they are stating if you want it, you've got to request it.
[06:18.800 --> 06:26.680]  Well, the thing is, that's also in the statutes, the actual state law.
[06:26.680 --> 06:31.560]  Now you don't have to provide it unless one of the parties requests it, even in a court
[06:31.560 --> 06:32.760]  of record.
[06:32.760 --> 06:37.040]  This is exactly why I teach everyone that the first words out of your mouth when you're
[06:37.040 --> 06:43.520]  called forward is to say, I move the court that all proceedings be on the record.
[06:43.520 --> 06:48.760]  That way you activate the necessity of the court reporter's presence and the taking
[06:48.760 --> 06:50.520]  of the record.
[06:50.520 --> 06:55.920]  You just do not want to be in these lower courts without an accurate record if it's
[06:55.920 --> 06:57.520]  a court of record.
[06:57.520 --> 06:59.240]  Just don't do that.
[06:59.240 --> 07:01.880]  You're making a fatal mistake.
[07:01.880 --> 07:08.760]  Now they have, in rule one, this is something they're going to create problems with here
[07:08.760 --> 07:12.760]  and the legislature has already introduced more problems than they can imagine by what
[07:12.760 --> 07:14.640]  they've allowed.
[07:14.640 --> 07:19.880]  In rule 1.1, it reads, the court's record system is electronic.
[07:19.880 --> 07:26.160]  The public has access to case histories and status at this particular website, which is
[07:26.160 --> 07:31.960]  www.cityofaustin.org forward slash court.
[07:31.960 --> 07:34.040]  A name and date of birth is required.
[07:34.040 --> 07:36.580]  Well, I got news for you.
[07:36.580 --> 07:40.040]  You can't find my case there by name.
[07:40.040 --> 07:44.920]  You have to have the case number or it will not pull it up.
[07:44.920 --> 07:50.880]  So you don't have to have a name and date of birth if you got a cause number.
[07:50.880 --> 07:52.840]  So keep that in mind.

[07:57.040 --> 08:02.760]  Now attorneys of record can have full online access to their clients file.

[08:09.800 --> 08:15.560]  This rule right here tells me that there is a separate set of rules regarding people with

[08:19.040 --> 08:26.520]  This to me is telling me that the attorney has full access, whereas a process does not.
[08:26.520 --> 08:33.000]  Now I know for a fact that the prosecuting attorneys can pull up any of the filed pleadings
[08:33.000 --> 08:39.160]  on the computers in their office or in the courtroom.
[08:39.160 --> 08:48.040]  But I was unable to access any of the filed pleadings in my case online at all.
[08:48.040 --> 08:56.080]  So there is a distinct difference between the access you have as just a procé defendant
[08:56.080 --> 08:59.320]  and a defendant with an attorney.
[08:59.320 --> 09:01.720]  So again, keep that in mind.
[09:01.720 --> 09:05.720]  They're actually creating two disparate systems.
[09:05.720 --> 09:12.800]  One where a procé is denied full access to their own record in order to work their case
[09:12.800 --> 09:19.360]  and the other where it's open to attorneys so that they have easy access to make money
[09:19.360 --> 09:21.200]  from their clients.
[09:21.200 --> 09:28.200]  You can tell right off the bat it's a biased system as to who has access and how much.
[09:28.200 --> 09:34.880]  Now some other primary rules that you need to be aware of in Austin especially, but
[09:34.880 --> 09:40.560]  again, read the local rules where you are to make sure that you're following them.
[09:40.560 --> 09:47.520]  Written plea, all pleas shall be in writing except for pleas entered in open court before
[09:47.520 --> 09:51.560]  a judge, okay?
[09:51.560 --> 09:58.440]  Now a fine payment shall constitute a plea of no low contender as allowed by law.
[09:58.440 --> 10:03.200]  That's rule 2.1, a written plea, okay?
[10:03.200 --> 10:09.480]  For assistance, on the request for assistance, they let you get a language interpreter.
[10:09.480 --> 10:13.560]  They let you request anything you may need if you have a disability.
[10:13.560 --> 10:18.440]  They let you request audio or visual aids that you may need for the purposes of trial
[10:18.440 --> 10:22.520]  or other presentation at pretrial or whatever.
[10:22.520 --> 10:25.440]  That's about the limit of your request for assistance.
[10:25.440 --> 10:30.560]  They go further down in here and tell you we're not going to give you assistance of
[10:30.560 --> 10:33.120]  counsel in a municipal court.
[10:33.120 --> 10:40.400]  Again, not what the law says, not what your rights are, but it's what they're doing.
[10:40.400 --> 10:43.360]  Court reporter request, this goes to what I was speaking of earlier.
[10:43.360 --> 10:48.320]  A defendant may request or waive a court reporter at the initial announcement of the case or
[10:48.320 --> 10:51.320]  at the time of trial.
[10:51.320 --> 10:55.040]  Always ask for that reporter if it's a court of record.
[10:55.040 --> 10:59.680]  Plea by mail, the date of the postmark will be designated as the date of filing of any

[11:01.640 --> 11:08.040]  We don't do filed pleadings by mail as far as entering a plea because the only pleas

[12:08.800 --> 12:14.600]  of the prosecutor in one of my client's cases.

[12:19.960 --> 12:27.800]  not once but twice in open court to, uh, absolutely refusing to serve me with a copy
[12:27.800 --> 12:34.040]  of anything, uh, and that they had not and would not do so.
[12:34.040 --> 12:45.480]  Uh, right here, it says directly in, uh, section four of the rules, responsibility, okay?
[12:45.480 --> 12:49.640]  It's responsibility of all persons with business before the court to determine date, time,
[12:49.640 --> 12:52.200]  nature and all that stuff.
[12:52.200 --> 12:56.680]  Notice, notice that the date and time and nature of each setting shall be given to each
[12:56.680 --> 12:59.360]  party in writing, okay?
[12:59.360 --> 13:06.400]  By email, in person or by mail to the last known address, verbal representation.

[14:23.560 --> 14:27.840]  a hearing, response to motions with a hearing and with substitution.
[14:27.840 --> 14:37.200]  Now another interesting aspect of this is rule 5.11 and rule 5.12 refer to rule 4.21.
[14:37.200 --> 14:42.680]  What's interesting is there is no rule 4.21 in these local rules.
[14:42.680 --> 14:50.560]  So the criteria as far as the requirements that are stipulated under rule 4.21, don't
[14:50.560 --> 14:55.480]  be upset if you don't know what they are because they didn't put them in here.
[14:55.480 --> 14:59.360]  So they don't know any better than you do what the requirements are and anything they
[14:59.360 --> 15:04.560]  say will have to be made up because it's not in the local rules.
[15:04.560 --> 15:08.480]  So you have, I would say, just as much right to make them up as they do.
[15:08.480 --> 15:12.960]  Well, it's not in the local rules, judge, so I think it ought to be this way.
[15:12.960 --> 15:18.360]  All right, rule 6, appearance docket.
[15:18.360 --> 15:23.600]  Now you read through this and it's got some interesting things in it.
[15:23.600 --> 15:26.840]  At the appearance docket that the defendant will be given an opportunity to speak with
[15:26.840 --> 15:27.840]  the prosecutor.
[15:27.840 --> 15:30.400]  We've made aware of options and moved trial.
[15:30.400 --> 15:33.840]  Cases in which an attorney enters, I'm not guilty plea on behalf of their client will
[15:33.840 --> 15:39.680]  be set on an attorney appearance docket and only attorneys are set on this docket.
[15:39.680 --> 15:44.120]  The appearance docket can be waived, a waiver may result in the defendant losing any opportunity
[15:44.120 --> 15:47.720]  to negotiate and we don't want to negotiate anyway.
[15:47.720 --> 15:53.120]  Now this is where things get interesting when we get to section 7 of the rules.
[15:53.120 --> 15:54.800]  Okay, motions.
[15:54.800 --> 15:58.080]  Now listen carefully to what we have in here.
[15:58.080 --> 16:05.000]  Trial motions shall be filed in writing in all cases where defendants claim there are
[16:05.000 --> 16:11.720]  legal issues involving the sufficiency of the criminal complaint or the law from which the
[16:11.720 --> 16:13.720]  complaint is drawn.
[16:13.720 --> 16:18.520]  Okay, so if you're going to challenge the statutes or the complaint, you can only do
[16:18.520 --> 16:23.000]  that by pleadings filed in writing.
[16:23.000 --> 16:29.240]  These issues shall include but not be limited to any factual situations that would invalidate
[16:29.240 --> 16:33.440]  the premise upon which a law or ordinance has been promulgated.

[20:23.800 --> 20:32.800]  In 7.2, hearings no more than one pre-trial hearing shall be set per case without leave of the court.
[20:32.800 --> 20:41.800]  Failure to file pre-trial motions as indicated herein shall constitute a waiver of having those issues heard before trial.
[20:41.800 --> 20:54.800]  7.3, deadline to file, unless leave of court has been granted, all pre-trial motions shall be filed at least 14 days prior to trial.
[20:54.800 --> 21:00.800]  Such motions shall be heard no later than three days prior to trial.
[21:00.800 --> 21:01.800]  Okay?
[21:01.800 --> 21:11.800]  Now, let me explain 7.3, the problem that these guys are going to run into was 7.3, exactly like they did in my case.
[21:11.800 --> 21:16.800]  Notice that you have a 14-day minimum hearing requirement.
[21:16.800 --> 21:23.800]  Once you're within that 14 days of the pre-trial, then you can't file.
[21:23.800 --> 21:27.800]  Well, we filed motions in my case and they never set a pre-trial.
[21:27.800 --> 21:30.800]  They went straight to trial.
[21:30.800 --> 21:38.800]  Not only did they go straight to trial, they did it despite there never being a complaint at all.
[21:38.800 --> 21:44.800]  Or anything based upon a complaint that could even be remotely called a charging instrument.
[21:44.800 --> 21:50.800]  None of that existed, yet they set a trial date.
[21:50.800 --> 22:01.800]  Then six days prior to trial is when they actually put a complaint in the file.
[22:01.800 --> 22:19.800]  Now had I, at that time, gotten a copy of the complaint, I would not have been able, according to Rule 7.3, to have filed any objections to the complaint.
[22:19.800 --> 22:27.800]  They didn't put it in before 14 days and I'm now well within the 14 days.
[22:27.800 --> 22:34.800]  If I file a motion to quash the complaint or objecting to it, they're going to deny it.
[22:34.800 --> 22:35.800]  Why?
[22:35.800 --> 22:37.800]  Because I'm within the 14 days.
[22:37.800 --> 22:48.800]  The fact that they violated the rules and never gave me notice when they were supposed to is going to be irrelevant to them.
[22:48.800 --> 22:53.800]  This is one of those due process violations that we have to hammer them on.
[22:53.800 --> 22:56.800]  And that's exactly what we're doing in my case.
[22:56.800 --> 23:02.800]  This is one of the violations that we're going to use as a tort action in the federal lawsuit.
[23:02.800 --> 23:12.800]  Because when they do this, they are absolutely denying you and your right to object to the form and content of the complaint.
[23:12.800 --> 23:25.800]  The Code of Criminal Procedure gives you that right, the courts in the way and the prosecutors in the way they're behaving are acting in collusion to deny you in that right.
[23:25.800 --> 23:37.800]  So that they can't have the case kicked out at the lower court level by you objecting to something they did wrong because everything that you did is now considered untimely.
[23:37.800 --> 23:43.800]  And no, you never got proper notice in order to make it timely.
[23:43.800 --> 23:50.800]  So they've intentionally set this up as a catch-22 problem for pro-state defendants.
[23:50.800 --> 23:52.800]  Now, service.
[23:52.800 --> 23:55.800]  This is where I beat the prosecuting attorney up.
[23:55.800 --> 24:08.800]  It shall be the responsibility of the party filing any pre-trial motion to serve opposing counsel or party with a copy of the motion within three days of filing said motion.
[24:08.800 --> 24:13.800]  Service may be made by hand delivery, certified mail or fax.
[24:13.800 --> 24:14.800]  Okay?
[24:14.800 --> 24:23.800]  Now, again, here they're requiring certified mail delivery, whereas the statute just says that's to be placed in the mail.
[24:23.800 --> 24:38.800]  They're required to have that certified mail receipt that delivery was made, a fax cover sheet that was delivery was made, or some sort of signed receipt that hand delivery was made.
[24:38.800 --> 24:39.800]  Okay?
[24:39.800 --> 24:46.800]  Now, notice that they took out the option here that's in the statute of service in open court.
[24:46.800 --> 24:52.800]  That makes sense when you consider 45.018b.
[24:52.800 --> 25:00.800]  They do service in open court because if they're in open court, they're engaged in a proceeding.
[25:00.800 --> 25:15.800]  If they're engaging in a proceeding, then you were entitled to a copy of that complaint the day before this proceeding began at a minimum, and you don't have it.
[25:15.800 --> 25:23.800]  So they can't serve it to you in court and not violate 45.018b.
[25:23.800 --> 25:33.800]  So it makes sense that service in open court is not one of the options for service set forth in 7.4 of the local rules.
[25:33.800 --> 25:50.800]  See, they know more than they're letting on, but they're banking on the fact that you don't so that they can ignore their own rules when it suits them or implement them when it suits them.
[25:50.800 --> 25:53.800]  Now, setting of the hearing date.
[25:53.800 --> 26:01.800]  It shall be the responsibility of the party filing any pre-trial motion to obtain a hearing from the clerk of the court.
[26:01.800 --> 26:13.800]  Now, I have told every student in my class to schedule their motions for a pre-trial hearing date, and the clerk of the court refuses to set one.
[26:13.800 --> 26:23.800]  And yet, rule 7.5 of the local rule says that is exactly what the pros say defendant is supposed to do.
[26:23.800 --> 26:36.800]  So once again, here's the rules, but we're going to violate the rules and thus deprive you of the ability to conduct your trial appropriately.
[26:36.800 --> 26:40.800]  These are the things we need to make known to people.
[26:40.800 --> 26:53.800]  These are the things we need to make known when we sue the living crap out of these judges and these clerks and everybody involved in that little food chain.
[26:53.800 --> 26:58.800]  Now, rule 7.6, last rule in section 7.
[26:58.800 --> 27:06.800]  The state is responsible for the appearance of all necessary witnesses in response to a defendant's motion to suppress evidence.
[27:06.800 --> 27:14.800]  In all other cases, each party shall be responsible for subpoenaing its own witnesses and physical evidence.
[27:14.800 --> 27:17.800]  Okay, well, I don't have a problem with that.
[27:17.800 --> 27:20.800]  Rule 8, trial settings, docket order.
[27:20.800 --> 27:28.800]  This just goes into what cases get preferential treatment and the criteria that is used to determine that.
[27:28.800 --> 27:37.800]  Okay, now, one thing in section 8 is rule 8.4 failure to appear.
[27:37.800 --> 27:50.800]  If a defendant or defense counsel is not present, a bond must be posted in order to have the case reset unless waived by a judge for good cause shown.
[27:50.800 --> 27:59.800]  If the state's witness is not present, the state shall show good cause for witness's absence or proceed to trial.
[27:59.800 --> 28:05.800]  Now, that second part there is extremely important about the proceeding to trial.
[28:05.800 --> 28:11.800]  Here's what has to happen and you as the defendant have to make it happen.
[28:11.800 --> 28:13.800]  The state has no witness.
[28:13.800 --> 28:15.800]  They didn't show for whatever reason.
[28:15.800 --> 28:20.800]  The court says, you can't give me a good reason, so we're going to proceed to trial.
[28:20.800 --> 28:28.800]  The first thing you should be doing is standing up and saying, I demand a dismissal with prejudice.
[28:28.800 --> 28:32.800]  There is no witness to provide testimony against me.
[28:32.800 --> 28:34.800]  What are they going to do?
[28:34.800 --> 28:36.800]  They had to go to trial.
[28:36.800 --> 28:37.800]  They have no witness.
[28:37.800 --> 28:40.800]  They can't get a conviction without their witness.
[28:40.800 --> 28:42.800]  The judge has to grant your motion.
[28:42.800 --> 28:53.800]  Now, he may not grant it with prejudice, but he has to grant the motion to dismiss because they can't hold a trial without the testifying witness.
[28:53.800 --> 29:01.800]  So, end it right there, but be sure to ask for a dismissal with prejudice, whether you get it or not.
[29:01.800 --> 29:02.800]  Okay?
[29:02.800 --> 29:08.800]  Now, the other thing to be looking at there is that bond issue.
[29:08.800 --> 29:12.800]  What they're going to say is they're going to issue a warrant if you're not present.
[29:12.800 --> 29:21.800]  Now, I've studied and studied and studied what I found in the sections over these Class C misdemeanor offense citations.
[29:21.800 --> 29:31.800]  I cannot find any authority in the statute for a magistrate to issue a warrant for failure to appear on a Class C misdemeanor ticket.
[29:31.800 --> 29:40.800]  If the only offense charged on the citation is Class C misdemeanors, there is nothing in the statute requiring an appearance.
[29:40.800 --> 29:45.800]  But, they're going to file the warrant anyway, so don't fail to show until we get this fixed.

[32:39.800 --> 32:47.800]  Now, record of the proceedings, Rule 8.5, request an availability.
[32:47.800 --> 32:52.800]  A defendant may request a court reporter at the initial announcement of the case or at the time of trial.
[32:52.800 --> 32:55.800]  No fee is required to have a court reporter present.
[32:55.800 --> 32:56.800]  Purpose.
[32:56.800 --> 32:58.800]  Austin Municipal Court is a court of record.
[32:58.800 --> 33:03.800]  It is the court reporter's function to record, meaning transcribe the entire trial proceeding.
[33:03.800 --> 33:11.800]  In order to appeal a finding of guilt to county court, a defendant should have a written record of the trial proceeding sent to the appellant court,
[33:11.800 --> 33:18.800]  either by a court reporter's transcript or by the agreed statement of facts approved by the assistant city attorney.
[33:18.800 --> 33:22.800]  Yes, if they're going to approve any true facts that would get them all canned.
[33:22.800 --> 33:29.800]  Alright, visual audio aids and then media access, okay?
[33:29.800 --> 33:41.800]  Now, Rule 9, section post trial code, motions for new trials and appeals are governed by the Texas government code, section 30.00014.
[33:41.800 --> 33:44.800]  Appellate information following a trial in which there is a guilty judgment.
[33:44.800 --> 33:50.800]  The clerk of the court shall make available to each defendant a handout summarizing the appeal process.
[33:50.800 --> 33:57.800]  Indigency, if a defendant is indigent or otherwise too poor to pay out of the appeal bond or the transcript,
[33:57.800 --> 34:05.800]  she or he may file an affidavit of indigency with the court and a motion to waive costs within 10 days period to file an appeal bond.
[34:05.800 --> 34:09.800]  A hearing on the motion to waive costs shall then be scheduled by the court.
[34:09.800 --> 34:11.800]  Inability to pay fine.
[34:11.800 --> 34:19.800]  If a defendant does not appeal the court's decision but is unable to pay the fine when due, the defendant can request an extension to pay or a payment plan.
[34:19.800 --> 34:28.800]  If a defendant qualifies, the court may allow the defendant to pay the fine in installments or discharge the fine by performing community service.
[34:28.800 --> 34:29.800]  Warrant.
[34:29.800 --> 34:38.800]  If a defendant does not pay the fine, meet all obligations of an installment plan or discharge the fine by performing community service as ordered by the court,
[34:38.800 --> 34:45.800]  a warrant will be issued which will subject the defendant to arrest, okay?
[34:45.800 --> 34:46.800]  That folks is it.
[34:46.800 --> 34:48.800]  That's all the local rules.
[34:48.800 --> 34:52.800]  Like I said, there's not many and you need to know them.
[34:52.800 --> 34:58.800]  Know what these people are hiding from you that they can use against you later.
[34:58.800 --> 35:00.800]  That's very, very important.
[35:00.800 --> 35:11.800]  Now, the other thing I want to go over and you can do a search for this and get a copy of it because it is not in the online statutes.
[35:11.800 --> 35:13.800]  It has not been integrated.
[35:13.800 --> 35:18.800]  You will not find this in the current version of the online government code.
[35:18.800 --> 35:26.800]  You need to do a search for House Bill 3475, okay?
[35:26.800 --> 35:31.800]  Subchapter A-1.
[35:31.800 --> 35:35.800]  That will pull up a PDF version of this bill.
[35:35.800 --> 35:38.800]  You need to download that and read it carefully.
[35:38.800 --> 35:52.800]  This is the new statutory methodology for recusing or disqualifying a municipal judge, okay?
[35:52.800 --> 35:55.800]  It's got some very good requirements in it.
[35:55.800 --> 36:04.800]  First and foremost is that whether it's disqualification or recusal, they have to hold a hearing.
[36:04.800 --> 36:12.800]  And the hearing has to be presided over by the regional presiding judge.
[36:12.800 --> 36:22.800]  So the judge no longer has the ability in the municipal court to determine their own recusal or disqualification, okay?
[36:22.800 --> 36:24.800]  That's the good thing.
[36:24.800 --> 36:34.800]  Bad thing is, is this statute has a contempt provision that can be used against you for filing the motion in the first place.
[36:34.800 --> 36:37.800]  Here's what they're trying to do.
[36:37.800 --> 36:41.800]  I've watched them try to do it to this same client of mine.
[36:41.800 --> 36:53.800]  Instead of following the roadmap I gave him about what to say and do, he basically went in there and started just saying everything under the sun and slinging crap at the wall to see what stuck.
[36:53.800 --> 36:55.800]  Don't do that, okay?
[36:55.800 --> 36:58.800]  Please don't do that.
[36:58.800 --> 37:04.800]  Go in there with the stuff written down that you need to know and use it.
[37:04.800 --> 37:06.800]  That's what it's for.
[37:06.800 --> 37:16.800]  But in any case, while he was doing all of this, he started saying, recuse, recuse, recuse, okay?
[37:16.800 --> 37:25.800]  And the judge in this pretrial was the head presiding municipal judge Evelyn McKee.
[37:25.800 --> 37:30.800]  While he's talking about this statute, she's up there reading it.
[37:30.800 --> 37:43.800]  So she immediately gets to the portion dealing with contempt and she's listening to my client here who is talking about all kinds of different things.
[37:43.800 --> 37:52.800]  And she comes to the conclusion that this guy doesn't really understand what he's doing and why he's asking for this.
[37:52.800 --> 37:56.800]  So we're going to play a game of gotcha.
[37:56.800 --> 38:07.800]  She looked at my client and says, can you put this motion for recusal against me in writing?
[38:07.800 --> 38:10.800]  And he immediately goes, sure.
[38:10.800 --> 38:14.800]  Okay, that part of the trap is now set.
[38:14.800 --> 38:18.800]  Can you have it filed by Monday?
[38:18.800 --> 38:20.800]  Sure.
[38:20.800 --> 38:21.800]  Good.
[38:21.800 --> 38:23.800]  Now the other release is ready and the trap is set.
[38:23.800 --> 38:28.800]  Now all we got to do is get him to step in it.
[38:28.800 --> 38:41.800]  Then these proceedings are adjourned pending the filing of a motion, a written motion by you no later than close of business Monday.
[38:41.800 --> 38:48.800]  In which case if that motion is not filed, we will set a date for trial.
[38:48.800 --> 38:50.800]  Do you agree?
[38:50.800 --> 38:51.800]  Yes.
[38:51.800 --> 38:52.800]  Boom.
[38:52.800 --> 38:54.800]  The trap is sprung.
[38:54.800 --> 38:55.800]  Okay.
[38:55.800 --> 39:02.800]  What she did was she got my client to agree to file a written motion.
[39:02.800 --> 39:19.800]  When this contempt citation that's included in this language states that the presiding judge, if they determine that the motion is filed for the purpose of delay,
[39:19.800 --> 39:29.800]  they can charge the individual with contempt up to $100 fine and I believe they said three days in jail.
[39:29.800 --> 39:34.800]  She was setting my client up to hit him with that contempt.
[39:34.800 --> 39:46.800]  The problem is she had actually committed several things during the course of these proceedings that already had disqualified her.
[39:46.800 --> 39:49.800]  She was sitting there watching the whole proceeding.
[39:49.800 --> 39:52.800]  So I'd already made my notes.
[39:52.800 --> 39:57.800]  So I told my client, go ahead, do it.
[39:57.800 --> 40:05.800]  So he went down and filed this motion today to recuse or in this case disqualify this judge.
[40:05.800 --> 40:10.800]  And I went after Evelyn McKee with Ariator shoes on.
[40:10.800 --> 40:15.800]  I mean I went after her stomping holes in every place I could find.
[40:15.800 --> 40:22.800]  What she did at this pre-trial proceeding were just obnoxious to the rights of due process.
[40:22.800 --> 40:29.800]  One of the things, several of the things she did, beginning with the first, she's reading through the motions.
[40:29.800 --> 40:41.800]  She is denying all of the motions out of hand that my client has filed, including the motion to quash the complaint because it's based upon an illegal citation.
[40:41.800 --> 40:45.800]  And reading them, she's just glancing over them.
[40:45.800 --> 40:49.800]  Now, why is she denying them?
[40:49.800 --> 41:02.800]  She's denying them because I don't believe that they were filed within or outside of that 14-day limitation the local rules talked about.
[41:02.800 --> 41:09.800]  The problem is they didn't give him 14 days between the last hearing and this one to get him filed.
[41:09.800 --> 41:16.800]  How is he supposed to file them in a timely manner when he isn't given the proper number of days to do it?
[41:16.800 --> 41:33.800]  Yet at the same time, the prosecuting attorney stood up in the courtroom and stated for the record that she had filed her motions at the end of the prior proceeding to get the in-camera review that we were having today.
[41:33.800 --> 41:36.800]  And that had been granted.
[41:36.800 --> 41:44.800]  So she had filed a motion within the 14 days and so had my client.
[41:44.800 --> 41:49.800]  Hers were allowed, his were denied.
[41:49.800 --> 41:56.800]  Right off the bat, we have a problem with bias by the judge.
[41:56.800 --> 41:59.800]  Second problem.
[41:59.800 --> 42:11.800]  The prosecutor confessed not once but twice to failing in failing to serve my client with anything that had been filed.
[42:11.800 --> 42:14.800]  We didn't serve him with the complaint.
[42:14.800 --> 42:16.800]  We didn't serve him with a copy of our motion.
[42:16.800 --> 42:27.800]  Did we not just read in the local rules where it says the other party, the filing party is required to serve the other party?
[42:27.800 --> 42:31.800]  And yet she's saying we never served him a copy of the motion.
[42:31.800 --> 42:41.800]  So how is he supposed to know what these proceedings are about when he hasn't seen the motion that brought it about?
[42:41.800 --> 42:43.800]  So again, lack of notice.
[42:43.800 --> 42:59.800]  So we went after her to disqualify her for intentionally and willingly depriving the defendant of notice and colluding with the prosecutor to ensure that they're deprived of notice.
[42:59.800 --> 43:13.800]  When the prosecutor stands up in open court and confesses on the record, we never gave notice to this individual and the judge goes, well here, let me correct that problem for you, Mr. Prosecutor.
[43:13.800 --> 43:20.800]  I'll print out a copy of the complaint and I'll serve it on the defendant for you myself.
[43:20.800 --> 43:23.800]  Instant disqualification.
[43:23.800 --> 43:30.800]  The judge is now acting as the process server on behalf of the prosecutor's office.
[43:30.800 --> 43:34.800]  Again, making her a party to the whole deal.
[43:34.800 --> 43:38.800]  Instant disqualification.
[43:38.800 --> 43:42.800]  Now folks, that's not even the tip of the iceberg on how bad this got.
[43:42.800 --> 43:46.800]  I'll finish this up on the other side and we'll start taking your calls.

[47:52.800 --> 48:06.800]  The judge looks at the client and says, you mean that you only are entitled to have a copy at one day prior to trial, don't you?
[48:06.800 --> 48:10.800]  No, I don't. I'm entitled to have it before any proceeding.
[48:10.800 --> 48:13.800]  And then the judge goes, no, you aren't.
[48:13.800 --> 48:18.800]  You may only have a copy of the complaint one day prior to trial.
[48:18.800 --> 48:25.800]  Ding, game over. The judge has now given legal advice from the bench.
[48:25.800 --> 48:37.800]  Not only that, she gave intentionally false and misleading legal advice to a defendant in her court.
[48:37.800 --> 48:51.800]  What she said completely violates 45.018b and 1.05 of the code of criminal procedure. No question it violates it outright.
[48:51.800 --> 49:05.800]  She denied a defendant in a right to notice and then lied to the defendant in open court about him even having that right at all.
[49:05.800 --> 49:22.800]  The only reason a judge would do this is so that a defendant would hit that 14-day wall and never be able to file a written objection to the complaint
[49:22.800 --> 49:34.800]  because the court would ensure that they never saw the complaint until just before trial where they have no chance whatsoever to object to it.
[49:34.800 --> 49:43.800]  And I wrote all of that up in the motion to disqualify point by point.
[49:43.800 --> 49:49.800]  And I laid out her judicial, how judicially inept and incompetent she is.
[49:49.800 --> 49:57.800]  And for a presiding judge not to even know or understand her own local rules, that's just unforgivable.
[49:57.800 --> 50:00.800]  I mean, I went after her tooth and nail.
[50:00.800 --> 50:09.800]  And when he came over here today to pick up the file, I made him read it twice to make sure he understand what the argument is and why it's being made.
[50:09.800 --> 50:18.800]  So folks, believe me, you need to pay attention to what they're doing because they are intentionally trying to screw us.

[50:21.800 --> 50:33.800]  They will go to any links to keep you in the process to make you follow through so that they can kangaroo court you and take your money.

[56:00.800 --> 56:10.800]  The way they've got their motor vehicle code written, they believe in that code that they not only have the right to regulate commerce but everybody else.

[56:12.800 --> 56:17.800]  But if you're playing with the statutes, the statutes are going to read as if they do.
[56:17.800 --> 56:22.800]  The problem is the legislature can't regulate the right of liberty that way.

[56:23.800 --> 56:38.800]  I find, since I listened to you, I kept, I guess I was more on the sovereign patriotic thing of the definition of words and kept pouring through the motor vehicle code, trying to make an argument or that, you know.

[56:43.800 --> 56:50.800]  The one thing I can tell you about traffic is you never ever go to merits.

[01:21:11.800 --> 01:21:29.800]  Well, I agree with you, but I agree that just sometimes I've found myself in that situation when I, the other hasn't worked, but I, this is, they brought up sort of an interesting concept and that is to go look at jury instructions as an alternate way to kind of

[01:21:34.800 --> 01:21:49.800]  And they gave, so I wanted to ask you if you, what you thought of that, and they gave an example, they said whether it's in the penal code or the vehicle code, it's just an alternate way of finding out.
[01:21:49.800 --> 01:22:02.800]  And the example they gave was for a marijuana violation. So if you're charged with, you know, transporting one ounce or less of marijuana.
[01:22:02.800 --> 01:22:09.800]  Yeah, but see, they're right there is where they're getting the individual, transporting.
[01:22:09.800 --> 01:22:20.800]  See, they're charging them with a commercial crime, the transporting of marijuana. That's the crime, not having it.

[01:22:25.800 --> 01:22:37.800]  See the problem? This is the problem with going to merits, not fully understanding all of the terms that comprises those elements.
[01:22:37.800 --> 01:22:52.800]  When you start arguing the elements and you don't understand every word that's in that element, you are setting yourself up for a fall because you're arguing A, they're arguing B, and guess what?

[01:23:01.800 --> 01:23:10.800]  Okay. The only way to win this is to fight fire with fire, not with water.

[01:24:31.800 --> 01:24:41.800]  No, I think I do, you know, but I'm still tough when it's in the court, you know, because they just roll over here.

[01:24:42.800 --> 01:24:50.800]  But what you have to understand is that the initial court, that is to be expected 99 times out of 100.
[01:24:50.800 --> 01:24:55.800]  We never, ever go to court with the plan of winning at trial.
[01:24:55.800 --> 01:24:56.800]  Why?
[01:24:56.800 --> 01:24:58.800]  Because the courts are corrupt.
[01:24:58.800 --> 01:25:02.800]  Their job is to take your money, not provide you justice.
[01:25:02.800 --> 01:25:03.800]  Okay.
[01:25:03.800 --> 01:25:12.800]  So you go in looking for justice, you're going to walk out completely disheartened and disappointed.
[01:25:12.800 --> 01:25:19.800]  So don't go in there knowing that they're going to fight dirty.
[01:25:19.800 --> 01:25:20.800]  They're going to cheat.
[01:25:20.800 --> 01:25:24.800]  They're going to lie and they're going to win at all costs.
[01:25:24.800 --> 01:25:37.800]  What you do is document everything they do that violates the rules and your rights to get that win.
[01:25:37.800 --> 01:25:39.800]  Because guess what?
[01:25:39.800 --> 01:25:48.800]  When you take that documentation in the record and you take it up on appeal, the appellate court has to look at it and say,
[01:25:48.800 --> 01:25:55.800]  the referee punched him from behind while he was boxing the other guy, that's not fair.
[01:25:55.800 --> 01:26:02.800]  Now the referee tripped him while he was boxing the other guy, that's not fair.
[01:26:02.800 --> 01:26:06.800]  And pretty soon the appellate court has to go, hey, that wasn't a fair fight here.
[01:26:06.800 --> 01:26:10.800]  We have to overturn this judgment.
[01:26:10.800 --> 01:26:13.800]  You guys cheated.
[01:26:13.800 --> 01:26:20.800]  You guys denied them in ringing the bell and blowing the whistle and separating them when they were down and out and so on and so forth.
[01:26:20.800 --> 01:26:24.800]  You didn't obey any of the rules of a proper fight.
[01:26:24.800 --> 01:26:28.800]  So we call and give the fight to the other guy now.
[01:26:28.800 --> 01:26:30.800]  That's what you're after.
[01:26:30.800 --> 01:26:33.800]  We don't go into the trial court looking to win.
[01:26:33.800 --> 01:26:41.800]  It's just very rarely going to happen.
[01:26:41.800 --> 01:26:45.800]  What you do is document, document, document.
[01:26:45.800 --> 01:26:48.800]  This is why reading is a requirement.
[01:26:48.800 --> 01:26:53.800]  You must study the rules that they have to operate under.
[01:26:53.800 --> 01:27:04.800]  You must know everything the law requires them to do so you recognize immediately when they don't do it.
[01:27:04.800 --> 01:27:11.800]  And then you document that failure to perform that duty as required by law.
[01:27:11.800 --> 01:27:17.800]  Then you document how that failure deprived you in your case.
[01:27:17.800 --> 01:27:19.800]  That it deprived you of the right of notice.
[01:27:19.800 --> 01:27:21.800]  That it deprived you of a way to prepare and defense.
[01:27:21.800 --> 01:27:25.800]  That it deprived you of the introduction of evidence that proved exculpatory.
[01:27:25.800 --> 01:27:32.800]  That it deprived you of anything that affected the outcome of your case.
[01:27:32.800 --> 01:27:36.800]  If it did, it's not a fair fight.
[01:27:36.800 --> 01:27:42.800]  And the appellate court is going to recognize that as long as you preserve it in the record properly.
[01:27:42.800 --> 01:27:49.800]  That is your job, not to argue elements of the merit on the charges.
[01:27:49.800 --> 01:27:55.800]  Would you review again when you say we have to know the rules, like where we look for all the...
[01:27:55.800 --> 01:27:59.800]  Okay, for instance, here in Texas we have the code of criminal procedure.
[01:27:59.800 --> 01:28:03.800]  Traffic cases in Texas are treated as criminal cases.
[01:28:03.800 --> 01:28:08.800]  So the rules they're supposed to play by is the code of criminal procedure.
[01:28:08.800 --> 01:28:17.800]  The problem is the procedures they use look nothing like what the code of criminal procedure says they should.
[01:28:17.800 --> 01:28:25.800]  So right off the bat here in Texas, we've got a foot high stack of paper going, didn't do this, didn't do this, didn't do this.
[01:28:25.800 --> 01:28:30.800]  And they never do it, okay?
[01:28:30.800 --> 01:28:33.800]  Because this is what the procedures are.
[01:28:33.800 --> 01:28:36.800]  That's where my little roadmap that I was talking about comes in.
[01:28:36.800 --> 01:28:45.800]  That roadmap is exactly what tells you this is what they're supposed to be doing right now.
[01:28:45.800 --> 01:28:49.800]  And you can readily see that they're not doing it.
[01:28:49.800 --> 01:28:57.800]  So you put it in an affidavit or you put it in a motion, you file it in your case.
[01:28:57.800 --> 01:29:00.800]  Where they've not followed the code of criminal procedure?
[01:29:00.800 --> 01:29:03.800]  Where they did not follow the rules.
[01:29:03.800 --> 01:29:11.800]  Every time they screw up, you document it.
[01:29:11.800 --> 01:29:17.800]  Is there any other place to look besides the code of criminal procedure to cover all basins?

[01:29:25.800 --> 01:29:30.800]  These codes invoke several codes at a time in some places.

[01:29:45.800 --> 01:29:48.800]  So these are the things you've got to understand.
[01:29:48.800 --> 01:29:51.800]  There are multiple pieces to these puzzles at every stage,
[01:29:51.800 --> 01:29:54.800]  but you have to get them pulled together so you know what's going on.

[01:55:54.720 --> 01:56:01.760]  ruling in her favor. And then, then for some reason here, uh, well, I don't know if I should
[01:56:01.760 --> 01:56:08.000]  say the, the major insurance company's name or not on the air, but, uh, but at any rate, they appealed
[01:56:08.000 --> 01:56:14.880]  and then for some strange reason, um, all of it went back to court. She wasn't really even, uh,
[01:56:16.560 --> 01:56:23.120]  notified because she works, um, a different job now naturally, but she worked long hours and,
[01:56:23.120 --> 01:56:29.280]  and works nights and, um, and stuff. And so they, they were not able to, uh, to contact her. Somehow
[01:56:29.280 --> 01:56:34.080]  another, she was, she wasn't even contacted. Yeah. They would have contacted her attorneys and they
[01:56:34.080 --> 01:56:38.720]  were the ones responsible for notifying her. That's what I thought. That is exactly what I
[01:56:38.720 --> 01:56:44.400]  thought. And they should have notified her, but still, uh, when it did go to court, um,
[01:56:44.400 --> 01:56:51.040]  she wasn't there. They, they notified her of the results of the case, uh, later, but they, they said
[01:56:51.040 --> 01:56:58.720]  that, uh, that the same judge ruled, turned around and ruled in the insurance company's favor. And,
[01:56:58.720 --> 01:57:06.400]  um, so basically it just leaves her, uh, I mean, you know, uh, with the, having to,
