[33:25.880 --> 33:32.760]  Well, I know exactly how Randy felt when he got off the plane in Australia and saw all
[33:32.760 --> 33:39.600]  the kangaroos, because this courtroom was packed.
[33:39.600 --> 33:46.720]  It could not have worked out better for us in the long run, I mean, it really couldn't.
[33:46.720 --> 33:51.920]  It was a complete and total comedy of errors on the part of the court and the prosecution.
[33:51.920 --> 33:56.440]  The prosecutor stood right there in the middle of the court and admitted they had failed
[33:56.440 --> 34:05.840]  to provide proper notice, but because I hadn't cited the specific statutes that I was quoting
[34:05.840 --> 34:12.440]  in the courtroom, I hadn't given a specific statute number, then the prosecution asked
[34:12.440 --> 34:18.120]  the judge just to ignore my objection, even though the statutes and everything else were
[34:18.120 --> 34:24.200]  written directly into our special appearance motion that we had filed weeks ago.
[34:24.200 --> 34:26.680]  Now that was just one.
[34:26.680 --> 34:35.640]  We also filed at the time before trial actually began, we got in a list of written objections
[34:35.640 --> 34:39.960]  and some oral objections that were outstanding.
[34:39.960 --> 34:46.760]  The written objections were simply written as briefs to the court, letting the court
[34:46.760 --> 34:52.720]  know that we have standing objections to the following terms and we intend to object to
[34:52.720 --> 34:56.120]  the following terms throughout the trial.
[34:56.120 --> 35:04.600]  Well he treated this like a motion asking the court to do something and denied the motion
[35:04.600 --> 35:11.920]  and the prosecutor immediately asked the judge for a motion in limony preventing me from
[35:11.920 --> 35:20.800]  objecting to any of the terms used in our standing objections motion.
[35:20.800 --> 35:23.280]  Right off the bat, that's a very big problem.
[35:23.280 --> 35:30.200]  They are completely denying me and my right to object to their presentation of the case
[35:30.200 --> 35:32.880]  and how they're doing it.
[35:32.880 --> 35:39.520]  They basically, by arbitrary command, took away my complete and total ability to put
[35:39.520 --> 35:43.640]  on a defense and I made a big show of that.
[35:43.640 --> 35:51.880]  I finally got the judge to state on the record that you are ordered not to say anything in
[35:51.880 --> 35:53.720]  regards to these terms.
[35:53.720 --> 35:59.560]  Well, me being me, I didn't take that very well.
[35:59.560 --> 36:07.000]  I made him, I went through it several times, just so I'm clear for the record is the court
[36:07.000 --> 36:15.200]  ordering me and depriving me of my right to put on a proper defense.
[36:15.200 --> 36:20.360]  Well he hemmed and hauled and tried everything under the sun to say that, you know, that
[36:20.360 --> 36:25.320]  that wasn't precisely what he was doing but I would not let him quit until he admitted
[36:25.320 --> 36:30.320]  that I'm ordering you not to object to these terms.
[36:30.320 --> 36:37.640]  But me being me, every time the first few times it came out of somebody's mouth, I objected.
[36:37.640 --> 36:43.640]  Finally he said, I'm telling you not to do that again because every time I objected,
[36:43.640 --> 36:48.760]  the prosecutor brought up the motion and lemony and asked the court to punish me because
[36:48.760 --> 36:50.720]  I was ignoring it.
[36:50.720 --> 36:53.200]  Well, I have every right to ignore it.
[36:53.200 --> 36:55.120]  I have the right to put on a defense.
[36:55.120 --> 36:59.600]  I have the right to object to what they're doing.
[36:59.600 --> 37:05.600]  But the judge says, I'm telling you, I'm ordering you not to do that again.
[37:05.600 --> 37:11.560]  Well of course as trial progressed, every now and then I popped up anyway still objecting
[37:11.560 --> 37:18.920]  to the use of the terminology judge and she would then object to the judge about me doing
[37:18.920 --> 37:24.240]  that and the judge would look at me, stop.
[37:24.240 --> 37:28.040]  And finally he just got to where neither one of them would address me at all when I would
[37:28.040 --> 37:29.040]  do it.
[37:29.040 --> 37:31.600]  They just ignore me as if I'd never opened my mouth.
[37:31.600 --> 37:37.800]  So the record is set to prove that the court acted in concert and collusion with the prosecution
[37:37.800 --> 37:43.600]  to deprive me of my right to put up a defense.
[37:43.600 --> 37:47.800]  This is what is known as compelled consent.
[37:47.800 --> 37:56.600]  They're compelling me to consent to the use of terms and those terms are meant to describe
[37:56.600 --> 38:04.760]  my actions even though my entire defense is I'm not doing anything to which those terms
[38:04.760 --> 38:12.800]  apply and therefore have no application whatsoever to my actions.
[38:12.800 --> 38:17.400]  But we've got that in the record that the court was actively depriving me of my right
[38:17.400 --> 38:19.960]  to put up that defense.
[38:19.960 --> 38:26.920]  Now not only that, some of my other standing objections of course was the lack of notice,
[38:26.920 --> 38:32.200]  the court's lack of jurisdiction because of lack of notice and so on and so forth.
[38:32.200 --> 38:40.400]  Then we got to the issue of the fact that the complaint had been served to me right
[38:40.400 --> 38:43.120]  there in the courtroom the day of trial.
[38:43.120 --> 38:48.680]  I made a big stink about that too, about it not being timely nor proper and that it deprived
[38:48.680 --> 38:56.240]  me of my rights under 45.018 and 45.019F of the Code of Criminal Procedure in order to
[38:56.240 --> 38:59.840]  object to anything in the complaint.
[38:59.840 --> 39:04.480]  But I looked at the judge when I got the complaint and I said, well, despite what the statute
[39:04.480 --> 39:09.800]  is saying about my right to object, since you deprived me of the right to notice for
[39:09.800 --> 39:13.640]  the record I'm going to object anyway.
[39:13.640 --> 39:19.200]  The first thing I object to is the fact that the clerk is the person that signed the complaint
[39:19.200 --> 39:20.720]  as the affian.
[39:20.720 --> 39:27.360]  The clerk is an agent of the court and if the clerk is acting in their official capacity
[39:27.360 --> 39:30.760]  then the court is the complainant.
[39:30.760 --> 39:39.520]  The court cannot be both the complainant and the trier of the law in the same case.
[39:39.520 --> 39:45.680]  This is where the prosecutor proved just how completely inept she is at understanding the
[39:45.680 --> 39:47.520]  right of due process.
[39:47.520 --> 39:51.200]  The judge looks at her and goes, what's your response to that objection?
[39:51.200 --> 39:53.880]  She goes, judge, I have no clue what he's talking about.
[39:53.880 --> 39:57.200]  Well, that figures.
[39:57.200 --> 39:59.420]  She didn't look all that smart.
[39:59.420 --> 40:05.080]  She just figured the deck was stacked entirely in her favor anyway, which it was.
[40:05.080 --> 40:07.520]  But she was like, I have no clue what he's talking about.
[40:07.520 --> 40:11.080]  It doesn't matter that the clerk is a person that works for the court.
[40:11.080 --> 40:12.760]  That's not the issue here today.
[40:12.760 --> 40:18.800]  The issue here today is whether or not this man was speeding this fast and this fast.
[40:18.800 --> 40:21.480]  And I objected to that too, objection.
[40:21.480 --> 40:28.160]  The issue here is whether or not the law you're using ever applied to me in the first place.
[40:28.160 --> 40:33.920]  If it didn't, then I couldn't possibly violate it, could I?
[40:33.920 --> 40:39.320]  And of course, that concept went completely over both the judge and the prosecutor's head
[40:39.320 --> 40:46.320]  because they couldn't for the life of them figure out how transportation was not a commercial
[40:46.320 --> 40:48.520]  occupation.
[40:48.520 --> 40:49.520]  But they're going to.
[40:49.520 --> 40:55.960]  They're going to have explained to them in great detail in federal court, I promise you.
[40:55.960 --> 41:00.840]  So this process continued on and on throughout the trial.
[41:00.840 --> 41:03.120]  I would sit there letting them do their thing.
[41:03.120 --> 41:08.320]  I would occasionally object to what they were doing and make the judge look at me sideways
[41:08.320 --> 41:11.880]  and so on and so forth.
[41:11.880 --> 41:15.960]  Everybody says I did a really good job of putting up a fight with them and making that
[41:15.960 --> 41:19.320]  prosecutor work her ugly behind off.
[41:19.320 --> 41:24.600]  She was over there taking notes as fast as her hands could write and then doing everything
[41:24.600 --> 41:28.760]  she could to cook up an argument that would refute it.
[41:28.760 --> 41:33.000]  And when it got to closing, I'm actually looking at the jury and I says, let's look at what
[41:33.000 --> 41:36.440]  the state really wants you to do here.
[41:36.440 --> 41:41.200]  The state wants you to take a law.
[41:41.200 --> 41:48.360]  And without questioning whether or not the law is applicable, simply convict me because
[41:48.360 --> 41:51.360]  the law says such and such.
[41:51.360 --> 42:00.000]  Now ask yourself, if you're not working as a peace officer, would a law that is written
[42:00.000 --> 42:04.640]  to affect police officers apply to you?
[42:04.640 --> 42:10.600]  If you're not a commercial fisherman, would a law that's written to regulate a commercial
[42:10.600 --> 42:14.080]  fisherman apply to you?
[42:14.080 --> 42:21.080]  And it looked like for just a moment, the jury actually understood the concept.
[42:21.080 --> 42:26.600]  But jurors being what they are, that little spark quickly vanished from their eyes and
[42:26.600 --> 42:31.680]  was replaced by the dull glaze most jurors tend to have.
[42:31.680 --> 42:36.680]  Now my closing argument was very simple.
[42:36.680 --> 42:39.080]  This is a transportation code.
[42:39.080 --> 42:44.160]  I had called a DOT witness to testify regarding the speed signs.
[42:44.160 --> 42:52.160]  I managed to get him to testify on the record to 201.904, specifically stating what a speed
[42:52.160 --> 42:54.120]  sign was there to regulate.
[42:54.120 --> 43:04.160]  He could not identify any other statute that regulated anything in a disconnect between
[43:04.160 --> 43:12.160]  excuse me, that speed sign and what it regulated versus private travel.
[43:12.160 --> 43:16.200]  He couldn't name any other code that would apply.
[43:16.200 --> 43:19.880]  But of course that didn't stop the prosecutor.
[43:19.880 --> 43:22.680]  All that Mr. Craig has brought up deals with commercial.
[43:22.680 --> 43:24.200]  Yes, you twint.
[43:24.200 --> 43:28.080]  That's all that's in the book is what deals with commercial.
[43:28.080 --> 43:31.560]  That's the whole point.

[46:44.360 --> 46:48.740]  What is a regulatory system for somebody engaging in an occupation?
[46:48.740 --> 46:54.500]  The other is you and me and the only thing that can be regulated about us is us harming

[46:55.920 --> 46:58.840]  The state's got no authority to do anything else.
[46:58.840 --> 47:02.720]  Again, just a dull blank expression.
[47:02.720 --> 47:07.480]  Most of them seem to have just shut off their wind-up spring and wound-down or something.

[47:08.960 --> 47:15.200]  But in any case, the outcome of yesterday's trial, when it's all said and done, was absolutely

[47:21.240 --> 47:28.760]  The issue yesterday was complete and total deprivation of the right of due process by

[47:33.320 --> 47:39.240]  Now, not only did we raise that issue, we raised the issue of it not being a proper
[47:39.240 --> 47:40.560]  court of record.
[47:40.560 --> 47:44.360]  We raised the issue of the citation not complying with law.
[47:44.360 --> 47:48.560]  We raised the issue of the clerk being the person signing the complaint and acting as
[47:48.560 --> 47:54.120]  an agent for the court, thus involving the court in the accusation and making the court
[47:54.120 --> 48:00.520]  completely ineligible to preside over the case and so on and so on and so on.
[48:00.520 --> 48:06.520]  So the jury goes out, 20, 30 minutes, comes back in, declares me guilty.
[48:06.520 --> 48:13.160]  And then when we get done and the judge says, come up to the bench and while I'm up there
[48:13.160 --> 48:19.280]  talking to him, I decide to let him in on a little information and I say, you know,
[48:19.280 --> 48:27.480]  I really wished that you would find yourself able to come down and attend my class.
[48:27.480 --> 48:30.120]  And he goes, well, I just don't see things the way you do.
[48:30.120 --> 48:31.600]  I says, I know you don't.
[48:31.600 --> 48:35.640]  And the problem is, is you don't see things the way the statute has them either.
[48:35.640 --> 48:39.600]  And if you did come to the class and learn something, then you wouldn't find yourself
[48:39.600 --> 48:45.640]  in the middle of that dark and lonely, old crap pit that you're going to find yourself
[48:45.640 --> 48:47.800]  in real soon.
[48:47.800 --> 48:53.800]  So he kind of looked at me for half a second and I just stood there and looked back at him.
[48:53.800 --> 48:58.440]  And finally he wouldn't say anything else to me and just kept filling out his paperwork.
[48:58.440 --> 49:03.080]  Now this was Judge Jenkins for those of you that have been down there.
[49:03.080 --> 49:10.040]  Out of all the judges, I will have to admit that most of the time he appears to be the
[49:10.040 --> 49:16.000]  least impartial one way or the other, but he does have his off days.
[49:16.000 --> 49:18.440]  But he had a real off day yesterday.
[49:18.440 --> 49:20.640]  Not so much as getting smart elicky with me.
[49:20.640 --> 49:23.800]  I never gave him the opportunity to do that.
[49:23.800 --> 49:31.440]  It probably surprised him that a non-lawyer was doing as well as I was doing at going
[49:31.440 --> 49:32.440]  after them.
[49:32.440 --> 49:40.000]  And that came to the point where they attempted to prevent me from even using the words commerce
[49:40.000 --> 49:41.840]  or commercial activity.
[49:41.840 --> 49:46.640]  The prosecutor kept jumping up and objecting to my use of those terms saying that they
[49:46.640 --> 49:52.920]  were forbidden by the motion and since her request for an lemony was in effect, then
[49:52.920 --> 49:55.640]  I was not allowed to use even those terms.
[49:55.640 --> 49:59.360]  And I stood right there and I just kind of looked at Justice and Judge, if you'll bother
[49:59.360 --> 50:07.440]  to go back and read, commerce and commercial activity are none of the terms I told the
[50:07.440 --> 50:09.800]  court I was going to object to.
[50:09.800 --> 50:17.520]  They're used in the definitions of the terms, but I never objected to the use of commerce
[50:17.520 --> 50:20.240]  or commercial activity.
[50:20.240 --> 50:24.320]  Well he spent 10 minutes going back through the motions again and when he couldn't find
[50:24.320 --> 50:29.360]  commerce or commercial activity inside a pair of double quotes, he finally agreed that he
[50:29.360 --> 50:33.800]  could not limit me from objecting or using that term.
[50:33.800 --> 50:40.520]  The prosecutor not only tried to prevent me from objecting to her use of the other terms,
[50:40.520 --> 50:46.320]  she attempted to basically get the court to just tie me up, gag me and sit me in a chair
[50:46.320 --> 50:51.880]  and say, we'll let you talk after you're convicted.
[50:51.880 --> 50:56.480]  That's exactly what they did down there or attempted to do.
[50:56.480 --> 51:01.200]  But me being me, I keep pushing and kicking the corners of the envelope and still came
[51:01.200 --> 51:06.960]  out with the occasional judge, I'm still objecting and he would give me an admonishment and I'd
[51:06.960 --> 51:07.960]  ignore it.
[51:07.960 --> 51:14.840]  You know, sometime later, I'm still objecting to the use of the terms and it never seemed
[51:14.840 --> 51:19.680]  to register to him like when the cop would say drive or vehicle or motor vehicle and
[51:19.680 --> 51:26.080]  I would object, it never seemed to register with Jenkins exactly what word I was objecting
[51:26.080 --> 51:33.600]  to because he kept saying, well the officer is talking about the facts, he was present
[51:33.600 --> 51:36.400]  so overruled.
[51:36.400 --> 51:43.080]  Well he's allowing the witness to make a legal conclusion and the witness is not capable
[51:43.080 --> 51:45.880]  of doing so.
[51:45.880 --> 51:51.880]  So again, it was a complete and total kangaroo job and that's okay, we knew it was going
[51:51.880 --> 51:57.120]  to be, that's in fact what we were hoping would happen and we have more than enough
[51:57.120 --> 52:04.560]  witnesses and a nice lengthy three and a half hour transcript to completely prove that's
[52:04.560 --> 52:07.320]  what was going on.
[52:07.320 --> 52:12.200]  We are fortunate that we actually have an independent court reporter that was in there
[52:12.200 --> 52:18.040]  yesterday rather than the clerk of the court, court reporter.
[52:18.040 --> 52:23.080]  So that being said, the court may not be able to tamper with the record before we get our
[52:23.080 --> 52:24.920]  hands on it.
[52:24.920 --> 52:30.440]  I would at this time though like to ask folks out there, hey, if you can, this is going
[52:30.440 --> 52:37.400]  to cost me about a thousand bucks to set up for appeal, we're going to set up a bond reduction
[52:37.400 --> 52:43.480]  motion because the trial court lacked jurisdiction in the first place, the best they should be
[52:43.480 --> 52:48.240]  able to do is give me a PR bond because the court didn't have any jurisdiction to go to
[52:48.240 --> 52:50.360]  trial and did it anyway.
[52:50.360 --> 52:52.760]  But we don't know if that will be granted.
[52:52.760 --> 52:59.880]  So between the, and they find me the maximum $200 on the speeding, because again the jury
[52:59.880 --> 53:04.280]  didn't like being told that I believe the law didn't apply to me, so they kind of took
[53:04.280 --> 53:07.560]  that personal, which again, doesn't matter.
[53:07.560 --> 53:11.720]  But in any case, between that and the cost of the transcript, this first bump in the
[53:11.720 --> 53:14.760]  road is going to cost us about a thousand bucks.

[56:10.760 --> 56:17.960]  And it's as if they're doing this deliberately, so that anyone who has the nerve to come to
[56:17.960 --> 56:26.520]  one of these courts and try to fight one of these issues gets it clearly demonstrated
[56:26.520 --> 56:33.600]  to them that trying to fight an issue in court is a futile process.
[56:33.600 --> 56:36.600]  Yeah, absolutely.
[56:36.600 --> 56:38.600]  I agree, Randy.
[56:38.600 --> 56:43.520]  I think they're doing it on purpose to try to train the public, so to speak.
[56:43.520 --> 56:49.280]  And it's also the easiest place, it's the easiest court venue for them to get away with
[56:49.280 --> 56:54.760]  this sort of thing, because most of the time these transportation issues, traffic tickets
[56:54.760 --> 56:59.160]  and such, we're only talking about a few hundred bucks at the most, okay?
[56:59.160 --> 57:00.680]  And what are you going to do?
[57:00.680 --> 57:06.600]  You're going to spend $800 to hire a traffic ticket lawyer to get you out of a $200 ticket.
[57:06.600 --> 57:15.440]  I mean, okay, $1500, so it becomes a cost analysis for people, unless they're in a situation
[57:15.440 --> 57:20.720]  where they're about to lose their license or lose their insurance or whatever, which
[57:20.720 --> 57:23.240]  wouldn't necessarily be such a bad thing.
[57:23.240 --> 57:27.120]  But at any rate, people think that at the end of the world, they're not going to be
[57:27.120 --> 57:31.520]  spending that kind of money on an attorney to help them with a traffic ticket.
[57:31.520 --> 57:32.520]  They don't know how to fight it.
[57:32.520 --> 57:35.000]  They don't want to take the time to fight it.
[57:35.000 --> 57:39.600]  People are living such a hand-to-mouth existence, they don't have time.
[57:39.600 --> 57:43.560]  All they have time for is to go to work and work the two jobs so that they can feed their

[57:44.560 --> 57:47.160]  That's it, and they can't even hardly pay their bills.
