[04:29.520 --> 04:37.440]  Now, I've been working with a gentleman on getting some new material put together for
[04:37.440 --> 04:45.960]  the seminar, eventually for the seminar, once we get it worked out, but one of the issues
[04:45.960 --> 04:53.720]  that he is pounding on over and over and over again is the lack of notice issue when we
[04:53.720 --> 04:57.200]  talk about dealing with these local courts.
[04:57.200 --> 05:03.680]  Now, if you're having problems with code enforcement, if you're having problems with traffic tickets
[05:03.680 --> 05:08.400]  and so on and so forth, then this is going to be very important to you.
[05:08.400 --> 05:09.400]  Why?
[05:09.400 --> 05:17.320]  Because notice never, ever is forthcoming from these people in compliance with law and in
[05:17.320 --> 05:21.600]  compliance with the provisions of due process.
[05:21.600 --> 05:29.120]  No matter what they do, they cannot violate the tenets of due process and be allowed to
[05:29.120 --> 05:31.200]  get away with it.
[05:31.200 --> 05:33.920]  That is paramount.
[05:33.920 --> 05:42.160]  If they violate any part of the right of due process, call them on it and do it by stomping
[05:42.160 --> 05:51.760]  on their spleen, preferably with those aerators shoes you buy for your lawn.
[05:51.760 --> 05:56.880]  Just throw them down, tap dance on them and refuse to get off.
[05:56.880 --> 06:02.480]  What am I talking about when it comes to, well, let's look a little bit about how things
[06:02.480 --> 06:09.320]  are currently being done by the municipal idiocy and the JP idiocy that exist in the
[06:09.320 --> 06:12.000]  form of these local courts.
[06:12.000 --> 06:15.640]  Look at the process.
[06:15.640 --> 06:21.600]  You get pulled over by an incompetent officer and I say the officer is incompetent because
[06:21.600 --> 06:27.400]  he has made a presumption that he makes no attempt to verify at the time of the stop.
[06:27.400 --> 06:33.120]  Are you or are you not engaged in commerce at this time?
[06:33.120 --> 06:39.520]  If you're acting in transportation, then my stop is valid for the following reasons.
[06:39.520 --> 06:46.040]  If you're not in transportation, my stop is not valid and I bid you good day.
[06:46.040 --> 06:50.880]  The officer doesn't make any effort to verify this one way or the other.
[06:50.880 --> 07:00.240]  He is operating 100% on a preconceived non-factual presumption.
[07:00.240 --> 07:08.080]  If I have stood the chance of being sued into financial destitution and criminally charged
[07:08.080 --> 07:15.200]  for my acts, you better bet I would want to know if I was acting properly.
[07:15.200 --> 07:23.800]  Well, these officers say that they are protected for acting improperly and in a manner of speaking,
[07:23.800 --> 07:24.800]  they are.
[07:24.800 --> 07:25.960]  Why?
[07:25.960 --> 07:30.560]  Because they are protected by our ignorance.
[07:30.560 --> 07:38.240]  When we are ignorant of the limitations of his authority, then he is protected.
[07:38.240 --> 07:40.800]  We don't know that he's done anything wrong.
[07:40.800 --> 07:45.960]  We can't call him on it because we don't know what it is or how it was accomplished.
[07:45.960 --> 07:49.440]  It's really that simple.
[07:49.440 --> 07:59.140]  But as incompetent as he is, he has this presumption set forth and he's going to operate on it.
[07:59.140 --> 08:03.360]  So he goes through the motions, he issues the citation.
[08:03.360 --> 08:10.160]  Well here in Austin, they've got a very big problem as 99.9% of the citation books they're
[08:10.160 --> 08:21.160]  using are in direct violation of 708.105 of the transportation code.
[08:21.160 --> 08:28.760]  So the officer has pulled you over, one, under the false presumption you're in transportation
[08:28.760 --> 08:37.480]  and two, for the absolutely illegal purpose of issuing an illegal citation.
[08:37.480 --> 08:43.760]  And because it's an illegal citation, that makes all of his actions retroactively illegal
[08:43.760 --> 08:45.280]  along with it.
[08:45.280 --> 08:52.680]  He can't pull you over for the purpose of doing something illegal, okay?
[08:52.680 --> 08:58.400]  But he doesn't seem to understand that concept, so it's up to us to teach him.
[08:58.400 --> 09:03.080]  Now when he issues this illegal citation, he turns around and gets you to put your name
[09:03.080 --> 09:09.240]  on the bottom of it agreeing to appear in the municipal court or JP court having jurisdiction
[09:09.240 --> 09:11.480]  of the offense.
[09:11.480 --> 09:16.800]  Well, there's two problems there.
[09:16.800 --> 09:22.760]  He tells you one, if you don't sign the ticket, no matter what the charge, he's going to take
[09:22.760 --> 09:25.040]  you to jail.
[09:25.040 --> 09:33.880]  The problem is Chapter 543 of the transportation code says that the only two offenses for which
[09:33.880 --> 09:42.640]  the officer must issue a citation and for which he must get a signed promise to appear
[09:42.640 --> 09:47.320]  is speeding an open container.
[09:47.320 --> 09:48.840]  That's it.
[09:48.840 --> 09:56.480]  You are not required by any law to sign the citation under any other charge.
[09:56.480 --> 09:59.080]  Got it?
[09:59.080 --> 10:05.320]  Doesn't matter what it is, but the officer is telling you that regardless of the law,
[10:05.320 --> 10:09.120]  sign it or be taken to jail.
[10:09.120 --> 10:17.720]  The second problem is, is he's not authorized to take you to jail, 543.002 specifically requires
[10:17.720 --> 10:25.480]  he take you immediately before a magistrate, but in all good conscious with the dealings
[10:25.480 --> 10:30.720]  of the cop, it's not really his fault because the magistrate is also going to refuse to
[10:30.720 --> 10:36.480]  do his job or is too stupid to understand what it actually is.
[10:36.480 --> 10:44.000]  So as you can see, the entire citation process just so far is a complete and total Chinese
[10:44.000 --> 10:48.360]  fire drill.
[10:48.360 --> 10:57.520]  Now once the officer threatens you with being thrown in jail if you won't sign and you go
[10:57.520 --> 11:04.680]  ahead and sign, now you're told if you fail to appear a warrant will be issued for your
[11:04.680 --> 11:06.840]  arrest.
[11:06.840 --> 11:18.480]  Second problem, according to the statutes, they can issue a warrant for arrest on anything
[11:18.480 --> 11:22.920]  other than an A or B misdemeanor.
[11:22.920 --> 11:30.840]  They cannot issue a warrant for arrest if it's a Class C fine only offense.
[11:30.840 --> 11:34.280]  And I can hear people out there all over going, ah, that ain't right.
[11:34.280 --> 11:35.280]  They do it.
[11:35.280 --> 11:40.680]  Yeah, they're doing it, but it doesn't work in accordance with law.
[11:40.680 --> 11:41.680]  Here's why.
[11:41.680 --> 11:44.920]  In fact, here's the specific law.
[11:44.920 --> 11:55.840]  543.009 says and appears to give the blanket statement that a person commits an offense
[11:55.840 --> 12:02.720]  if he fails to appear on the sign noticed to appear regardless of the disposition of
[12:02.720 --> 12:05.920]  the original charge.
[12:05.920 --> 12:08.160]  Here's the problem.
[12:08.160 --> 12:15.680]  First off, that section does not say what kind of misdemeanor the individual committed.
[12:15.680 --> 12:20.560]  It just says the individual is guilty of a misdemeanor.
[12:20.560 --> 12:24.160]  What freaking misdemeanor?
[12:24.160 --> 12:30.560]  The courts are the ones that have automatically interpreted that to mean the failure to appear
[12:30.560 --> 12:40.320]  under 38.10 of the penal code, but with a transportation code limitation of a $200 fine
[12:40.320 --> 12:45.920]  and you can't take them to jail for it because it was a fine only offense.
[12:45.920 --> 12:49.640]  You can only charge them the fine for the failure to appear.
[12:49.640 --> 13:01.160]  And again, problem, the type of misdemeanor that you are guilty of committing is not specified.
[13:01.160 --> 13:05.800]  The courts have jumped to the wrong conclusion based upon the information contained in two
[13:05.800 --> 13:19.600]  other statutes, 15.17 G and 27.14 D of the code of criminal procedure.
[13:19.600 --> 13:24.120]  Now, give me just a second here and I'm going to pull up those sections and I'm going to
[13:24.120 --> 13:31.680]  tell you exactly how they read so you'll know what we're talking about here.
[13:31.680 --> 13:37.200]  Now, folks, you're very well aware that I do my very best not to say something I have
[13:37.200 --> 13:43.200]  not researched and read and I try to take nothing out of context with what's in the
[13:43.200 --> 13:44.200]  statute.
[13:44.200 --> 13:50.560]  That is why I do my best to make sure to read you the statute in its entirety along with
[13:50.560 --> 13:58.840]  what's where it's at and everything else so that you take it in the proper context, okay?
[13:58.840 --> 14:00.240]  And I want you to be aware of that.
[14:00.240 --> 14:05.280]  I don't just spout this stuff off the, you know, point of my brain here.
[14:05.280 --> 14:11.120]  I read this thoroughly time and time again and every lawyer out there screaming, where's
[14:11.120 --> 14:12.120]  your case law?
[14:12.120 --> 14:14.680]  Well, unfortunately, there isn't any.
[14:14.680 --> 14:17.440]  This is an issue of first impression.
[14:17.440 --> 14:24.680]  No court's ever ruled on it based upon the composition of these multiple arguments.
[14:24.680 --> 14:30.560]  So there is no case law, but there is common sense.
[14:30.560 --> 14:35.120]  Let's take for one second the common sense issue.
[14:35.120 --> 14:40.640]  The offense itself is punishable by fine only.
[14:40.640 --> 14:47.320]  You can't sentence me to jail no matter how frickin' guilty I am of committing the offense.
[14:47.320 --> 14:50.360]  It is fine only.
[14:50.360 --> 14:56.960]  So where in heaven's name would logic come into play to say that the cop or the judge
[14:56.960 --> 15:06.760]  either one have the right to throw you in jail for a fine only offense?
[15:06.760 --> 15:13.560]  If the courts are all in agreement that the failure to appear charge can't hold any consequence
[15:13.560 --> 15:21.440]  other than the one applied to the classification of the alleged offense, in this case, a Class
[15:21.440 --> 15:29.000]  C fine only, then the failure to appear could only be fine only.
[15:29.000 --> 15:34.040]  In which case, there's still no authority to issue a warrant of arrest.
[15:34.040 --> 15:36.200]  And here's why I say that.
[15:36.200 --> 15:40.480]  Let's look at 1517 G real quick.
[15:40.480 --> 15:45.200]  And I'm going to read it to you just like it's got it.
[15:45.200 --> 15:53.120]  Now in subsection G it reads as follows, if a person charged with an offense punishable
[15:53.120 --> 16:01.400]  as a misdemeanor appears before a magistrate in compliance, now get this, if you sign the
[16:01.400 --> 16:08.080]  ticket and you appear on or before the date the ticket requires, this is who it's talking
[16:08.080 --> 16:20.520]  about right here, in compliance with a citation issued under article 1406 B or C. If you go
[16:20.520 --> 16:28.200]  read 1406 B or C of the code of criminal procedure, you will see that that deals with the issuance
[16:28.200 --> 16:37.680]  of a citation in relation to an offense that is under 1406 B, a Class C misdemeanor.
[16:37.680 --> 16:41.960]  Under 1406 C, it's an A or B misdemeanor.

[23:21.920 --> 23:33.280]  C fine only. In the 1517 hearing the magistrate can only have only is given authority by law
[23:33.280 --> 23:43.120]  to issue a warrant if it's an A or B misdemeanor. Got it? Now let's look at our secondary proof
[23:43.120 --> 23:56.720]  of this fact. Our secondary proof is found in 27.14d. Now 27.14d is perhaps the most offensive
[23:56.720 --> 24:04.400]  statute in existence other than 25.04 which I'll cover that here in just a little bit.
[24:05.200 --> 24:15.840]  But 27.14d is the legislature's attempt to do an end run around the constitutional requirements
[24:16.880 --> 24:23.760]  that vest the court with jurisdiction of a cause. The legislature by this statute attempted to say
[24:23.760 --> 24:30.160]  we don't care what the constitution says gives the court jurisdiction we want it to be simpler
[24:30.160 --> 24:36.960]  we want it to be easy for the court to do what it wants to do and that is hold a trial and take
[24:36.960 --> 24:42.480]  your money so we're going to forget what the constitution says and ignore it and we're going
[24:42.480 --> 24:53.600]  to do it like this. That's what 27.14d does and we should be stomping all over them because of it.
[24:54.240 --> 24:59.360]  Now I'm going to read this one in its entirety as well and it's also broken up into several sentences.
[25:02.880 --> 25:11.200]  27.14d if written notice of an offense for which maximum possible punishment

[25:27.520 --> 25:37.520]  class C or related to parking then do this and and that citation is filed with the court
[25:37.520 --> 25:47.040]  and a legible duplicate copy has been given to the defendant the written notice serves as a complaint
[25:47.040 --> 25:57.600]  to which the defendant may plead guilty not guilty or no contender problem 45.019 says
[25:57.600 --> 26:03.600]  that a complaint is sufficient if it has the following requisites these freaking citations
[26:03.600 --> 26:13.680]  have none of those requisites the citation is also not sworn to as a complaint absolutely must be
[26:16.080 --> 26:23.200]  so no matter how you slice it the legislature cannot convert a citation into a complaint
[26:24.560 --> 26:32.480]  here's the other problem in order for the court and this right here tells us where the defendant
[26:32.480 --> 26:38.800]  may plead guilty not guilty or no low contender the court is being granted the authority to
[26:38.800 --> 26:47.600]  take a plea from the accused slight problem the constitution requires that the court be
[26:47.600 --> 26:55.040]  invested with jurisdiction via a proper charging instrument if the court is not properly vested
[26:55.040 --> 27:04.720]  with jurisdiction it can't hold any type of judicial proceeding except to dismiss the cause
[27:04.720 --> 27:12.960]  that's the only kind of jurisdiction they have if proper jurisdiction has not been invoked
[27:12.960 --> 27:20.400]  to that court the court can't do anything but dismiss the case in front of it it can't hold
[27:20.400 --> 27:29.520]  a proceeding to do anything else including taking a plea in order to take a plea there
[27:29.520 --> 27:38.240]  must be a judicial proceeding by definition a judicial proceeding can be had only in a court
[27:38.240 --> 27:46.720]  with jurisdiction of the cause and if it doesn't have it then the only proceeding it can effectively
[27:46.720 --> 28:00.000]  do is dismissal that's just the way it is nothing else to do yet here we are they're still going
[28:00.000 --> 28:09.120]  through this process as if everything is hunky dory and it's not okay now let's continue on with
[28:09.120 --> 28:22.080]  27.14 d and see what all it's got for us now if we go on and read this a little further
[28:22.800 --> 28:30.720]  if the defendant pleads not guilty to the offense or fails to appear based on the written notice
[28:30.720 --> 28:39.440]  a complaint shall be filed that conforms to the requirements of chapter 45 of this code
[28:39.440 --> 28:50.400]  now how many of you caught that if the defendant please not guilty to the offense or fails to appear
[28:50.400 --> 29:03.120]  based on the written notice even here in 27.14 d if it is a fine only offense and the defendant
[29:03.120 --> 29:15.760]  fails to appear guess what okay the court's only authority granted by law is to do the following
[29:15.760 --> 29:24.720]  a complaint shall be filed that conforms to the requirements of chapter 45 of this code
