[22:42.140 --> 22:51.580]  in a mortgage fraud scheme, she ended up pleading guilty to a notary, basically notary fraud
[22:51.580 --> 22:57.260]  and notarizing signatures when the signator was not in her presence, which of course is
[22:57.260 --> 22:58.620]  a crime.
[22:58.620 --> 23:00.860]  This happened in Las Vegas.
[23:00.860 --> 23:07.940]  She was found guilty, of course, she pleaded guilty and then Monday morning when she was
[23:07.940 --> 23:15.900]  supposed to show up for her sentencing hearing, she didn't show up and so I'm sorry, it wasn't
[23:15.900 --> 23:23.420]  Monday morning, she didn't show up, so the Attorney General's office sent their investigators,
[23:23.420 --> 23:28.940]  that is their thugs, to her home to bring her into court.
[23:28.940 --> 23:33.140]  They found her dead, hmm, imagine that.
[23:33.140 --> 23:39.140]  Well, more interestingly, the police are not investigating this as a homicide.
[23:39.140 --> 23:41.580]  Oh, nothing wrong here.
[23:41.580 --> 23:47.820]  Nothing to see here, just go about your business, it is most likely natural causes, even though
[23:47.820 --> 23:49.820]  the woman was 43 years old.

[23:53.860 --> 24:01.140]  It says here, Tracy Lawrence, the notary public who blew the whistle on a massive foreclosure
[24:01.140 --> 24:09.580]  fraud scheme was found dead in her Las Vegas home on November 28, MSNBC reported.
[24:09.580 --> 24:16.940]  Because of death has not yet been determined, but Officer Jacinto Rivera, a Las Vegas Metropolitan
[24:16.940 --> 24:23.380]  Police Department spokesman, said the case was not being investigated as a homicide.
[24:23.380 --> 24:25.620]  She was 43.
[24:25.620 --> 24:29.660]  Earlier this month, Lawrence came forward and admitted to the Nevada Attorney General's
[24:29.660 --> 24:38.820]  office that she notarized 25,000 fraudulent documents for lender processing services,
[24:38.820 --> 24:45.260]  a Florida company used by most major banks to process home repossessions.
[24:45.260 --> 24:52.460]  The documents were filed with the Clark County Recorder's Office between 2005 and 2008.
[24:52.460 --> 24:58.420]  Lawrence also accused two loan officers of allegedly running the massive robo-signing
[24:58.420 --> 25:05.500]  scheme, saying they forged signatures on tens of thousands of default notices.
[25:05.500 --> 25:13.740]  Nevada now alleges that Gary Trafford, 49 of Irving, California, and Jerry Shepard, 62
[25:13.740 --> 25:21.620]  of Santa Ana, California, directed their employees to forge foreclosure documents, notarize the
[25:21.620 --> 25:26.020]  signatures on the documents they had forged, and file the fraudulent paperwork in order
[25:26.020 --> 25:31.140]  to begin foreclosures on homes throughout the county.
[25:31.140 --> 25:37.300]  Shepard and Shepard have been indicted on more than 600 counts of offering false instruments
[25:37.300 --> 25:42.820]  for recording, false certification on certain instruments, and notarization of the signature
[25:42.820 --> 25:46.980]  of a person not in the presence of a notary public.
[25:46.980 --> 25:50.980]  Authorities are currently negotiating the terms of their surrender.
[25:50.980 --> 25:55.340]  Earlier this month, Lawrence pleaded guilty to one count of notarizing the signature of
[25:55.340 --> 25:57.540]  a person not in her presence.
[25:57.540 --> 26:01.780]  Had Lawrence shown up at her sentencing hearing on Monday, she could have faced a potential
[26:01.780 --> 26:06.060]  sentence of up to one year in jail and a fine of up to $2,000.
[26:06.060 --> 26:11.460]  On November 17th, Linder Processing Services issued a statement acknowledging that the
[26:11.460 --> 26:15.660]  signing procedures on some of the documents were, quote, flawed.
[26:15.660 --> 26:20.700]  I can't keep a straight face reading that.
[26:20.700 --> 26:25.700]  The company also agreed to fully cooperate with the Attorney General's investigation,
[26:25.700 --> 26:30.980]  quote, I am deeply committed to ensuring that LPS meets rigorous standards of professional
[26:30.980 --> 26:37.940]  conduct and operating excellence, end quote, newly appointed LPS President and CEO Hugh
[26:37.940 --> 26:42.620]  Harris stated, quote, I have full confidence in the ability of our leadership team and
[26:42.620 --> 26:47.460]  over 8,000 dedicated employees to deliver on that commitment.
[26:47.460 --> 26:53.100]  According to reality track, Nevada has had the highest foreclosure rate in the nation
[26:53.100 --> 27:00.420]  for 56 straight months and that's the end of the article and also I did read on some
[27:00.420 --> 27:08.660]  other news websites about this murder, what I'm calling a murder, is that the police have
[27:08.660 --> 27:15.380]  not determined whether or not it's a suicide or natural or the cause of death was natural
[27:15.380 --> 27:17.900]  and that was as recent as yesterday.
[27:17.900 --> 27:21.140]  Come on, the woman was 43 years old, you've got to be kidding me.
[27:21.140 --> 27:26.740]  What it looks like to me is that the banks are now murdering their passing notaries and
[27:26.740 --> 27:31.420]  anybody else who may come forward and blow the whistle and they're paying the police

[39:32.060 --> 39:42.940]  I haven't found a 9 percent that approves of us, so he was very frank, but he could be

[40:00.620 --> 40:08.740]  So I suspect everyone in politics is looking around real close to try to figure out how

[01:51:07.420 --> 01:51:15.420]  And I assume the only evidence that they could bring in the court would be your cell phone bill, which would coincide with the time of the ticket, right?

[01:51:18.420 --> 01:51:24.420]  He'll swear up and down you're on a cell phone, though he has no evidence that's what you were actually holding to your head.

[01:51:27.420 --> 01:51:30.420]  Besides, here's what I tell everybody.
[01:51:30.420 --> 01:51:36.420]  Whether or not you're holding your cell phone to your head doesn't matter unless you're actually using it as a phone.
[01:51:36.420 --> 01:51:44.420]  If you're using it to listen to an MP3 on your phone, there ain't a dang thing that statute applies to.

[01:51:51.420 --> 01:51:59.420]  The only way he can know is if he's electronically eavesdropping on the conversation, which without a warrant is highly illegal.

[01:54:49.420 --> 01:54:55.420]  Well, the thing about the housing market, that started with, I've had two people on my street.
[01:54:55.420 --> 01:54:58.420]  They had to purposely go into foreclosure.
[01:54:58.420 --> 01:55:04.420]  I mean, they had to not pay for two months just to get the bank to even talk to them about restructuring their loans.
[01:55:04.420 --> 01:55:10.420]  In the meantime, the banks foreclosed on them and they tried fighting it for about a year and they just gave up.
[01:55:10.420 --> 01:55:14.420]  A woman down one way and a rabbi up the street the other way.
[01:55:14.420 --> 01:55:16.420]  And it's just horrible what's happening.
[01:55:16.420 --> 01:55:24.420]  And one of our lead investigative reporters here in town did a week-long series and came to find out that his own home,
[01:55:24.420 --> 01:55:29.420]  he doesn't really own because he bought a foreclosure about, I don't know, four or five years ago.
[01:55:29.420 --> 01:55:33.420]  And he doesn't have a clear chain of title.
[01:55:33.420 --> 01:55:35.420]  It's a big mess here in this state.
[01:55:35.420 --> 01:55:38.420]  And we have a non-judicial foreclosure state.
[01:55:38.420 --> 01:55:45.420]  And I've sent a qualified written request to my bank, which used to be Washington Mutual, now Chase.
[01:55:45.420 --> 01:55:46.420]  I know they received it.
[01:55:46.420 --> 01:55:52.420]  I got my little green card back, but I'm interested to see if they're going to answer any of the questions that I ask.
[01:55:52.420 --> 01:55:58.420]  You know, if there's any allowances or anything on the deed because I want to find out if, you know, they even,
[01:55:58.420 --> 01:56:02.420]  if I pay them off, if I even have a marketable deed to sell,
[01:56:02.420 --> 01:56:04.420]  you know, at the end of the deal.
[01:56:04.420 --> 01:56:08.420]  Okay. If you ask for that in the qualified written request,
[01:56:08.420 --> 01:56:15.420]  they're not statutorily required to give you that answer.
[01:56:15.420 --> 01:56:23.420]  But there's something really cool you might be able to find in Nevada law.
[01:56:23.420 --> 01:56:25.420]  We have it in Texas law.
[01:56:25.420 --> 01:56:32.420]  And you'll most likely find this in your rules of civil procedure.
[01:56:32.420 --> 01:56:33.420]  Okay.
[01:56:33.420 --> 01:56:38.420]  And it's a statute authorizing pre-litigation discovery.
[01:56:38.420 --> 01:56:45.420]  If you have reason to believe that you may have a claim to get someone,
[01:56:45.420 --> 01:56:51.420]  but you don't have all the evidence you need to be sure,
[01:56:51.420 --> 01:57:01.420]  in order to avoid entering into a civil litigation that you would ultimately lose
[01:57:01.420 --> 01:57:04.420]  and therefore cause everybody all this difficulty,
[01:57:04.420 --> 01:57:07.420]  you need more information.
[01:57:07.420 --> 01:57:12.420]  And the courts have provided for that through pre-litigation discovery.
[01:57:12.420 --> 01:57:21.420]  So you might call an attorney and just, and ask him, do we have pre-litigation discovery in Nevada?
[01:57:21.420 --> 01:57:22.420]  Okay.
[01:57:22.420 --> 01:57:26.420]  He says, yes, ask him where to find it so you can study it.
[01:57:26.420 --> 01:57:31.420]  I'm sure if you go on the internet and do a search on pre-litigation discovery,
[01:57:31.420 --> 01:57:35.420]  Nevada, you'll find it if it's there.
[01:57:35.420 --> 01:57:36.420]  Okay.
[01:57:36.420 --> 01:57:43.420]  You cannot get, they have no duty to respond to discovery in a qualified written request.
[01:57:43.420 --> 01:57:49.420]  A qualified written request goes to an accounting error.
[01:57:49.420 --> 01:57:54.420]  You have to claim there's an accounting error and demand that they correct the error.
[01:57:54.420 --> 01:57:59.420]  But pre-litigation discovery will really get their attention.
[01:57:59.420 --> 01:58:00.420]  Okay.
[01:58:00.420 --> 01:58:03.420]  I'm going to try that.
