[00:00.000 --> 00:04.900] This news brief brought to you by the International News Net.
[00:04.900 --> 00:10.740] At least 12 people were reported killed Thursday when Sudanese aircraft hit a southern border
[00:10.740 --> 00:15.400] town where refugees fleeing earlier fighting had sought shelter.
[00:15.400 --> 00:20.680] In separate clashes, Sudanese ground forces attacked southern Allied rebels in another
[00:20.680 --> 00:25.280]  oil-rich border area, killing 18 and wounding 73.
[00:25.280 --> 00:30.760] The north aggression is stoking fears of a return to war with the newly created South
[00:30.760 --> 00:31.760]  Sudan.
[00:31.760 --> 00:38.120] In Yemen, at least 11 people, including two children, were killed Friday in heavy fighting
[00:38.120 --> 00:39.560]  in Taiz.
[00:39.560 --> 00:45.280] One day after a UN envoy began a new mission to push President Ali Abdullah Saleh to resign
[00:45.280 --> 00:47.400]  under a Gulf States peace plan.
[00:47.400 --> 00:51.400] Clashes broke out between Saleh's Republican guards and tribesmen defending opposition
[00:51.400 --> 00:52.400]  protesters.
[00:52.400 --> 00:56.960] Abdul Rahim al-Sami, an opposition government activist, said quote, what's happening in
[00:56.960 --> 01:00.080]  Taiz is a war against civilians.
[01:00.080 --> 01:07.280] Activists with the nationwide movement Occupy Homes are camping on the front lawn of home
[01:07.280 --> 01:11.760] owner Monique White in Minneapolis as she faces eviction.
[01:11.760 --> 01:17.280] White was on the verge of homelessness after U.S. bank moved to foreclose and occupiers
[01:17.280 --> 01:18.600]  moved in.
[01:18.600 --> 01:23.320] White never received a foreclosure notice, but instead heard she'd lose her home from
[01:23.320 --> 01:27.400] the gas company U.S. bank is seeking to negotiate.
[01:27.400 --> 01:33.880] Penn State fired its iconic football coach Joe Paterno Wednesday in a child sex abuse
[01:33.880 --> 01:37.920] scandal triggering riots by outraged Penn State students.
[01:37.920 --> 01:42.720] The school's board of trustees dismissed Paterno, the nation's winningest and longest tenured
[01:42.720 --> 01:47.240] college football coach, and also dumped Graham Spaniard, the school's president.
[01:47.240 --> 01:52.520] The actions followed last weekend's indictment of assistant coach Jerry Sandusky on charges
[01:52.520 --> 01:56.080]  of child sex abuse over a 15-year period.
[01:56.080 --> 02:02.000] Sandusky has been charged with 40 sex crimes against boys dating back to 1994.
[02:02.000 --> 02:06.280] All the minors were under the care of Sandusky's charity for impoverished youth, the Second
[02:06.280 --> 02:07.280]  Mile Foundation.
[02:07.280 --> 02:12.680] In 2001, Sandusky was caught raping a 10-year-old in the football team's shower when informed
[02:12.680 --> 02:16.400] of the abuse Paterno chose not to inform the police.
[02:16.400 --> 02:21.880] In 2009, Sandusky was on campus running a sleepaway camp for boys as young as nine years
[02:21.880 --> 02:22.880]  old.
[02:22.880 --> 02:28.800] A Human Rights Watch report Friday accused the Syrian government of Bashar al-Assad of
[02:28.800 --> 02:33.600] committing crimes against humanity following reports of dozens of deaths at the hands of
[02:33.600 --> 02:36.840] the country's security forces in the past two days.
[02:36.840 --> 02:41.600] The rights group urged the Arab League to suspend Syria's membership and called on them
[02:41.600 --> 02:48.040] to ask the UN Security Council to impose an arms embargo and sanctions against those responsible.
[02:48.040 --> 02:52.560] It also called for the League to refer Syria to the International Criminal Court for reported
[02:52.560 --> 02:59.040] torture including security forces use of heated metal rods, electric shocks and stress positions.

[04:34.120 --> 04:35.120]  I hope.
[04:35.120 --> 04:37.400] We got a little bit of extra exposure this week.
[04:37.400 --> 04:43.160] I was a guest on Alex Jones' show yesterday and thoroughly enjoyed it.
[04:43.160 --> 04:47.680] I'd only got to meet Alex in person once before down at the Capitol when we were down there
[04:47.680 --> 04:52.160] demonstrating about the TSA bills when we were trying to get those passed.
[04:52.160 --> 04:57.120] And I was actually pleasantly surprised to find out that Alex is actually a regular listener
[04:57.120 --> 05:03.040] to my Monday night traffic show and our Thursday and Friday show here on Rule of Law Radio.
[05:03.040 --> 05:08.720] Now, I am also aware, after looking through my email today and last night, that there
[05:08.720 --> 05:12.880] were several people that are interested in what we do here and the information I have
[05:12.880 --> 05:16.760] regarding the traffic tickets here in Texas and other states.
[05:16.760 --> 05:20.840] So for all you new listeners out there that are here because of the interview on the Alex
[05:20.840 --> 05:23.000]  Jones show, welcome.
[05:23.000 --> 05:27.520] What I would like to take time to do with my co-host, Randy Kelton here, is explain
[05:27.520 --> 05:31.640] to you guys a little bit about what we do and why we do it.
[05:31.640 --> 05:33.880]  And we'll go from there afterwards.
[05:33.880 --> 05:39.120] Randy, since you've been on this far longer than I have, would you please let these folks
[05:39.120 --> 05:43.600] know what your basic premise for what we do and why we do it is?
[05:43.600 --> 05:45.480]  And then I'll chip in afterward.
[05:45.480 --> 05:46.480]  Okay.
[05:46.480 --> 05:52.240] What we do is we offer remedies.
[05:52.240 --> 05:58.120] We don't deal much with what we call patriot mythology.
[05:58.120 --> 06:06.080] There's a lot of ideas out there and we're not against any of those ideas.
[06:06.080 --> 06:14.280] But we're reluctant to use ideas because they are ideas.
[06:14.280 --> 06:20.120] We primarily use the law as it stands.
[06:20.120 --> 06:29.040] From studying the law, the way it is, we find that most every state, and especially Texas,
[06:29.040 --> 06:36.600] has a very good jurist, a corpus jurist, a very good body of law.
[06:36.600 --> 06:39.800] All of the protections we need are there.
[06:39.800 --> 06:47.800] All of the tools we need are there to take control of the legal system.
[06:47.800 --> 06:50.880] We just have to exercise them.
[06:50.880 --> 07:00.640] And in doing that, we talk about the remedies that exist in the law and primarily, any primary
[07:00.640 --> 07:05.280] specialty is traffic minus due process.
[07:05.280 --> 07:11.840] And frankly, they don't tail together nicely because essentially they're both the same.
[07:11.840 --> 07:20.720] It's just we specialize in different areas and we show people how to use what's available.
[07:20.720 --> 07:26.440] There are a lot of people come on and they say they've been into court and the judge
[07:26.440 --> 07:30.040] will say, don't bring the Constitution into my court.
[07:30.040 --> 07:34.720] Well, I never bring the Constitution into court.
[07:34.720 --> 07:37.880] The Constitution is really not so much about us as it's about them.
[07:37.880 --> 07:43.400] It's about what they're restricted to do, but everything that's in the Constitution
[07:43.400 --> 07:46.640] is codified into the statutes.
[07:46.640 --> 07:54.520] And when you go to court, this is what the courts for the most part deal with.
[07:54.520 --> 08:01.960] And we deal from the premise that a judge has two duties.
[08:01.960 --> 08:07.360] His first duty is to develop the facts in accordance with the rules of evidence.
[08:07.360 --> 08:08.360]  I'm sorry.
[08:08.360 --> 08:09.360]  Let me back up.
[08:09.360 --> 08:14.600] A trial judge has these two duties to develop the facts in accordance with the rules of
[08:14.600 --> 08:22.440] evidence, then apply the law as it comes to him to the facts in the case.
[08:22.440 --> 08:31.240] And this is one thing we try to get across is the understanding of how this is different
[08:31.240 --> 08:38.960] than what we do in normal everyday communications and behavior.
[08:38.960 --> 08:41.760]  In law, it's different.
[08:41.760 --> 08:49.400] In law, when you're speaking before a court, you can never make a proactive statement of
[08:49.400 --> 08:52.040] law out of your own mouth.
[08:52.040 --> 09:00.880] You must make all of your proactive statements of law out of the mouth of the courts, out
[09:00.880 --> 09:08.080] of the mouth of the legislature and their statutes that they pass, or out of the mouth
[09:08.080 --> 09:16.600] of the courts in the rulings that they have made interpreting and applying those statutes.
[09:16.600 --> 09:24.320] If you come to the court with anything else, the court may well listen politely, but it
[09:24.320 --> 09:31.320] will ignore your arguments and your pleadings if they're not written in the terms of the
[09:31.320 --> 09:35.320] law that's been laid down for the court.
[09:35.320 --> 09:42.400] That's sometimes difficult because we're used to explaining ourselves and laying out
[09:42.400 --> 09:48.040] our position primarily from our own knowledge and understandings, and we don't do that
[09:48.040 --> 09:49.960]  in court.
[09:49.960 --> 09:55.880] In court, we put the law down before the judge, and for the most part on this show, we try
[09:55.880 --> 10:04.720] to go through the law as it stands, and we try to frame the law in a way so that it makes
[10:04.720 --> 10:14.640] sense to an ordinary individual, except for Eddie, isn't that right, Eddie?
[10:14.640 --> 10:21.920] You kind of explain what you do with more specifically the due process with traffic.
[10:21.920 --> 10:28.560] Well, what I do is I spent the last 17 years researching various laws in Texas.
[10:28.560 --> 10:36.160] My main category of study has been the transportation code, the Code of Criminal Procedure, and property
[10:36.160 --> 10:39.040]  taxes and sales tax.
[10:39.040 --> 10:43.080] In fact, it was my study of sales tax that actually got Randy and Deborah to invite me
[10:43.080 --> 10:47.000]  onto this show.
[10:47.000 --> 10:51.640] The things that I have learned about what the law says versus what is actually being
[10:51.640 --> 11:01.240] done would flat-turn your hair white because it should scare you and anger you as a human
[11:01.240 --> 11:07.640] being to find out that those you've trusted to protect your rights and your property have
[11:07.640 --> 11:13.280] instead abused and misused and misrepresented the law for the express purpose of depriving
[11:13.280 --> 11:16.280] you of those rights and your property.
[11:16.280 --> 11:22.040] This is one of the things that drove me to learn what I've learned.
[11:22.040 --> 11:27.840] Basically I chose the traffic statutes to begin this because they are the one area of
[11:27.840 --> 11:34.080] law that virtually every individual is involved in whether they know it or not.
[11:34.080 --> 11:38.640] Everybody has led to believe that a license is necessary to function in our society, not
[11:38.640 --> 11:45.160] only as someone using an automobile, but it's also used primarily for identification and
[11:45.160 --> 11:52.640] virtually any kind of business, any type of transactional sales that require the knowledge
[11:52.640 --> 11:56.120] of the identity of the people involved.
[11:56.120 --> 12:02.920] Driver's license and those types of things just permeate every area of our society.
[12:02.920 --> 12:07.920] But the more I've studied this, the more I've come to realize that those licenses are being
[12:07.920 --> 12:13.160] used for far more than just common identification.
[12:13.160 --> 12:17.960] They are being used to track people, to keep track of our every move.
[12:17.960 --> 12:24.000] They're being used to control our ability to act upon our liberty.
[12:24.000 --> 12:31.920] Every state has, until I can find the written agreement from Congress that makes it legal,
[12:31.920 --> 12:37.480] the federal constitution states that no state shall enter into any compact or agreement with
[12:37.480 --> 12:44.360] any other state, and yet Texas law and other states have law on the books that has terms
[12:44.360 --> 12:52.240] in it such as multi-state license compact, multi-state insurance agreements, and so on
[12:52.240 --> 12:54.160]  and so forth.
[12:54.160 --> 13:00.440] Where is the authority granted for the states to engage in these types of things?
[13:00.440 --> 13:04.600] It's also become about regulating the use of your private property.
[13:04.600 --> 13:09.160] If we go out and buy an automobile, that automobile is supposed to be ours.
[13:09.160 --> 13:10.880]  We paid for it.
[13:10.880 --> 13:16.120] But because of the paperwork that you do and because of what you have to do afterwards,
[13:16.120 --> 13:20.680] I can prove with the law that you don't actually own the car that you think you bought and
[13:20.680 --> 13:22.200]  paid for.
[13:22.200 --> 13:29.440] You simply have legal title to it, which is not the same thing as equitable ownership.
[13:29.440 --> 13:31.160]  You don't believe that.
[13:31.160 --> 13:38.080] Go look up the definition of those two phrases, legal owner versus equity owner.
[13:38.080 --> 13:40.200] They are not the same thing.
[13:40.200 --> 13:45.640] They do not have the same rights, nor do they have the same capability of disposition of
[13:45.640 --> 13:48.120]  the property itself.
[13:48.120 --> 13:53.640] When you get to looking into all this as I have, you will find that there are just tons
[13:53.640 --> 13:56.360] of things we're being lied to about.
[13:56.360 --> 13:57.680]  That's what made me angry.
[13:57.680 --> 14:01.040] That's what made me want to do what I am doing now.
[14:01.040 --> 14:08.440] I was actually literally physically attacked at gunpoint by the state comptroller's office
[14:08.440 --> 14:14.880] and the local police department over in my hometown of Nacogdoches on four separate occasions.
[14:14.880 --> 14:18.520] These people raided my business at gunpoint.
[14:18.520 --> 14:21.680] The reason they raided my business?
[14:21.680 --> 14:26.960] Because I refused to be an indentured servant to the state.
[14:26.960 --> 14:35.200] The state attempted to compel me to act as an uncompensated tax collector on behalf
[14:35.200 --> 14:44.160] of the state, when, one, I am not an incorporated business, two, I am not a regulatable business,
[14:44.160 --> 14:51.200] I am simply a man with the right to work and the ability to do so that has private contracts
[14:51.200 --> 14:53.560]  with the people that I help.
[14:53.560 --> 14:56.360] The state's got no interest in that.
[14:56.360 --> 15:06.240] The state can't make me pay taxes on property that belongs to me to the state itself.
[15:06.240 --> 15:10.720] These are the kind of things that motivated me to learn what I've learned.
[15:10.720 --> 15:15.320] When I got on the show with Randy, I quickly realized that just knowing those aspects
[15:15.320 --> 15:20.680] of it was not enough, I had to get into the due process side as well.
[15:20.680 --> 15:26.360] What I have learned in relation to the Texas traffic laws is the code of criminal procedure
[15:26.360 --> 15:30.800] laws and the rights of due process associated with those laws.
[15:30.800 --> 15:37.480] And again, I can show you in the law itself where the courts and the prosecutors forego
[15:37.480 --> 15:43.840] the requirements of law for the specific purpose of stealing the money belonging to the general
[15:43.840 --> 15:47.240] public and the accused in the courts.
[15:47.240 --> 15:53.200] So people, if you're listening to this, you will never find a better place to get the
[15:53.200 --> 15:58.600] information to understand what's being done to you than you will right here on our network.
[15:58.600 --> 16:05.240] Yes, most people don't understand the nature of the country we now live in.
[16:05.240 --> 16:08.880]  There's a question I like to ask a lot.
[16:08.880 --> 16:14.520] Would you recognize a police state if you were in one?
[16:14.520 --> 16:25.880] The average conviction rate in Texas stands at and has for quite a while, 99.6 percent.
[16:25.880 --> 16:29.240]  It rounds up to a hundred.
[16:29.240 --> 16:34.520] The United States contains approximately 3 percent of the world's population.
[16:34.520 --> 16:40.240] We house approximately 50 percent of the world's population of inmates, which you recognize
[16:40.240 --> 16:42.360] a police state if you were in one.
[16:42.360 --> 16:48.280] We are in the worst police state the world has ever seen, and most people have no clue.
[16:48.280 --> 16:51.640] This is Randy Kelton, David Stevens, Eddie Craig with La Radio.
[16:51.640 --> 16:54.520] We'll start, we've got a bunch of callers on the caller board.
[16:54.520 --> 16:57.040] We'll start taking calls when we come back on the other side.
[16:57.040 --> 17:04.160]  Thank you, you're welcome.
[17:04.160 --> 17:09.560] In the 80s, they fitted to Reagan a debt ceiling compromise.
[17:09.560 --> 17:14.920] Democrats promising spending cuts, but delivering only tax items.
[17:14.920 --> 17:21.120] The 90s brought more compromises, more broken promises, and more new taxes.
[17:21.120 --> 17:27.000] This August, the next chapter will be written, a defining moment.
[17:27.000 --> 17:32.440] Fourteen trillion in debt, inmates unemployed, the dollar in decline.
[17:32.440 --> 17:38.520] We know where they stand, but will our party's leaders repeat the mistakes of the past?
[17:38.520 --> 17:42.560] Will they choose compromise or conviction?
[17:42.560 --> 17:45.120] One candidate has always been true.
[17:45.120 --> 17:50.680] Ron Paul, cut spending, balance the budget, no deals.
[17:50.680 --> 17:56.920] Standing up to the Washington machine, guided by principle, restore America now.
[17:56.920 --> 18:00.560]  I'm Ron Paul, and I approve this message.
[18:00.560 --> 18:05.840] Are you being harassed by debt collectors with phone calls, letters, or even lawsuits?
[18:05.840 --> 18:09.280] Up debt collectors now, with the Michael Mears Proven Method.
[18:09.280 --> 18:13.680] Michael Mears has won six cases in federal court against debt collectors, and now you
[18:13.680 --> 18:14.680]  can win two.
[18:14.680 --> 18:19.480] You'll get step-by-step instructions in plain English on how to win in court using federal
[18:19.480 --> 18:25.240] civil rights statutes, what to do when contacted by phones, mail, or court summons, how to answer

[20:09.000 --> 20:12.520] from the man that came all the way from Galathea
[20:12.520 --> 20:15.720] I'm gonna call this day from one place to be
[20:15.720 --> 20:18.600] Well, I don't have to work so hard to be free
[20:18.600 --> 20:23.320] Some guys are trying to rewrite history, but they got caught
[20:23.320 --> 20:28.360] Now them guys got to play, it looks like Justice
[20:31.480 --> 20:33.720]  Looks like Justice
[20:33.720 --> 20:36.760] Alright, folks, we are back in this brutal radio
[20:36.760 --> 20:39.720] This is our Friday night for our Marathon
[20:39.720 --> 20:42.360] This is Eddie Craig, Randy Kelton, Debra Stephens
[20:42.360 --> 20:46.840]  Calling number is 512-646-1984
[20:46.840 --> 20:49.320]  Right now we've got a full caller board
[20:49.320 --> 20:52.040] So we're gonna begin taking your calls
[20:52.040 --> 20:54.760] Right now we're gonna start with Ramon in Texas
[20:54.760 --> 20:56.200] Wait, wait, wait, wait, wait, wait, wait, wait
[20:56.200 --> 20:57.320]  You guys
[20:57.320 --> 20:58.840] Wendy dropped off and came back
[20:58.840 --> 21:00.200]  Oh, okay, alright
[21:00.200 --> 21:02.280] Well, we'll go to Wendy in California first then
[21:03.400 --> 21:05.160] Eden, Wendy, what can we do for you?
[21:05.160 --> 21:10.520] Oh, hi, well, I just wanted to let you know that the call-in line
[21:10.520 --> 21:12.760]  There's no sound coming off that
[21:14.600 --> 21:15.400]  It's not working
[21:16.520 --> 21:20.920] Okay, well, we are having some technical difficulties on the internet side
[21:20.920 --> 21:22.680]  We're having a couple of router issues
[21:22.680 --> 21:26.200] So we may be not having sound on the call-in line just yet
[21:26.200 --> 21:29.160] So bear with us and we'll try to get that fixed up
[21:29.880 --> 21:30.760]  Okay, thank you
[21:30.760 --> 21:33.400]  Yes, ma'am
[21:33.400 --> 21:35.560] The interview with Alex Jones was fantastic
[21:35.560 --> 21:37.640] Oh, well, thank you, appreciate that
[21:38.360 --> 21:39.800]  That was great
[21:39.800 --> 21:42.280] Well, thank you, I don't have any questions right now
[21:42.840 --> 21:44.520] Alright, ma'am, thank you for calling in
[21:44.520 --> 21:45.160]  Appreciate you
[21:45.800 --> 21:47.080]  Alright, bye-bye
[21:47.080 --> 21:48.200]  Bye-bye
[21:48.200 --> 21:51.800] Alright, now let's go to Ramon in Texas
[21:51.800 --> 21:53.400] Eden and Ramon, what can we do for you?
[21:54.040 --> 21:55.240]  Well, Sam, how's it going?
[21:55.240 --> 21:58.440] As I was listening, I heard you were with Alex Jones also
[21:58.440 --> 22:01.640] And I heard you talk about it a few times on here, I'm really raw
[22:01.640 --> 22:03.000]  And I'm just wondering
[22:03.000 --> 22:06.760] Because, you know, we're saying that the transportation code in the past is in commerce
[22:06.760 --> 22:11.000] But when a time comes, it's there that you decide, you know, not to
[22:11.000 --> 22:12.600]  We need a driver's license for a while
[22:12.600 --> 22:16.200]  And then all of a sudden you'll get a little bit over if we're not having a driver's license
[22:16.200 --> 22:18.520] That in Texas, it's an arrestable offense, right?
[22:19.160 --> 22:22.680] Every offense in the transportation code is an arrestable offense
[22:22.680 --> 22:26.120] If it falls under subtitle C of the transportation code
[22:26.120 --> 22:28.440] So let me put this little bug in your ear
[22:29.160 --> 22:33.080]  543.001, Texas Transportation Code
[22:33.800 --> 22:37.160] Any peace officer may arrest without warrant
[22:37.160 --> 22:39.960] For any person committing an offense
[22:41.080 --> 22:44.680] Found committing an offense of this subtitle
[22:45.480 --> 22:50.120]  Subtitle C chapters are 541-600
[22:50.760 --> 22:54.600]  The driver's license is in 521
[22:54.600 --> 22:57.400]  It is not a subtitle C offense
[22:58.200 --> 23:00.520] My legal argument here is this
[23:01.240 --> 23:05.080] Since there is a local provision in the transportation code
[23:05.080 --> 23:10.600] Specifically limiting the ability of an officer to arrest without warrant
[23:10.600 --> 23:14.920] To the offenses listed specifically in subtitle C
[23:14.920 --> 23:17.720] If he arrests you for no driver's license
[23:17.720 --> 23:21.560] That is false imprisonment and aggravated assault
[23:21.560 --> 23:25.720] Because he has no authority under the transportation code
[23:25.720 --> 23:30.200] To arrest without warrant for not having a driver's license
[23:30.200 --> 23:35.800] Same thing applies to the no insurance or no financial responsibility
[23:35.800 --> 23:38.520]  That is in chapter 601
[23:38.520 --> 23:41.800]  Which is subtitle D not C
[23:43.560 --> 23:44.120]  Does that help?
[23:44.120 --> 23:46.520]  That's what's pretty confusing because
[23:47.080 --> 23:49.240] Because you know it's kind of like the whole vaccination deal
[23:49.240 --> 23:53.640] Where you're not legally required to get a vaccination to enter school
[23:53.640 --> 23:57.080] But you know they make it seem like it's necessary
[23:57.880 --> 23:59.000] Well of course they do
[23:59.000 --> 24:00.600] They want you to do it
[24:00.600 --> 24:03.960] They want to coerce you into volunteering to do it
[24:04.680 --> 24:07.640] And by lying to you that's exactly what they do
[24:08.360 --> 24:11.880]  Personally I think it should be a criminal act
[24:11.880 --> 24:15.480] For a public servant to lie to their employer
[24:15.480 --> 24:20.600] Or it should be a dismissable offense and it should be a criminal offense
[24:23.240 --> 24:26.680] But of course that would mean all the legislators would be in jail
[24:26.680 --> 24:27.960] First day on the job
[24:31.080 --> 24:33.080] Is there anything that we can do?
[24:33.080 --> 24:37.240] Because I mean if you leave there is anywhere that we can bring suit or something
[24:37.240 --> 24:41.640] Well believe it or not there is a penal code statute in Texas
[24:41.640 --> 24:46.120] Directed specifically at misrepresentation of law
[24:48.760 --> 24:53.880] It is a criminal offense to misrepresent the law
[24:53.880 --> 24:58.680] In order to compel someone to obey an instruction
[24:58.680 --> 25:01.160] Or thing that you're directing them to do
[25:03.560 --> 25:10.520] So is this to imagine like the possible defense if we are given like some kind of a citation
[25:10.520 --> 25:14.520] You know that they're not actually you know they're not supposed to
[25:16.520 --> 25:23.080] Okay right now the legislature has left us without a lot of specific recourse
[25:23.080 --> 25:26.440] On how to go after a public servant for doing these things
[25:26.440 --> 25:30.200] We have laws that we can charge them with
[25:30.200 --> 25:35.480] The problem is is we have to go through another crooked public servant to make it happen
[25:35.480 --> 25:38.600] We call him the attorney for the state
[25:38.600 --> 25:40.680] Which is your county or district attorney
[25:41.480 --> 25:45.720] When they choose not to do what the law requires them to do
[25:46.360 --> 25:47.560]  They're committing a crime
[25:48.200 --> 25:50.280] But then who do we get to prosecute them?
[25:50.920 --> 25:54.920] It leaves us pretty much having to go straight to the grand jury for everything
[25:57.160 --> 25:59.160]  And that's something we're working on
[25:59.160 --> 26:01.480]  Start happening you know the one I won't moment
[26:01.480 --> 26:04.840] You know the state was like oh we need some money for you know drivers
[26:04.840 --> 26:07.240] I think you know when did it begin happening?
[26:07.240 --> 26:09.720] Yeah how did it begin because you know they wrote the law
[26:09.720 --> 26:15.480] It began in 1910 or 1913 with the passing of the Federal Reserve Act
[26:15.480 --> 26:22.280] That's when the country was bought and sold and everything you knew as law was kicked out the window
[26:24.040 --> 26:30.600] That's when it began and it has steadily encroached upon the rights and property of the people ever since
[26:30.600 --> 26:36.840] So what exactly do those benefits from requiring them requiring them to
[26:37.400 --> 26:39.880] Require us to register ourselves?
[26:39.880 --> 26:44.120] Is it just that extra level of information that they'll have enough and never lose?
[26:44.120 --> 26:47.320]  I don't it's about control and it's about money
[26:48.120 --> 26:53.240] If they know everything about you then they can control everything about you
[26:54.360 --> 26:57.000]  If they know I mean let's see
[26:57.000 --> 27:01.560] Have you ever seen the the movie the net with Sandra Bullock?
[27:02.600 --> 27:05.400] The the website the movie the net
[27:06.120 --> 27:09.480] The net no I haven't seen it but I will you need to watch it
[27:09.480 --> 27:13.080]  It's a little more far-fetched than what things used to be
[27:13.960 --> 27:22.760] But for the most part a lot of what's in that movie is very very plausible impossible in today's environment of technology
[27:22.920 --> 27:24.920]  It's extremely plausible in fact
[27:24.920 --> 27:26.920]  It's scary plausible
[27:28.040 --> 27:32.760] But when they can access every piece of information about everybody
[27:33.960 --> 27:38.120] And they can do what they want with that information trade it sell it
[27:38.520 --> 27:40.520]  Alter it whatever
[27:40.840 --> 27:47.640] Then it becomes a major issue about controlling the individuals that information relates to you can track them
[27:48.200 --> 27:51.800] You can deny them access to certain benefits or privileges
[27:51.800 --> 27:56.200] Uh on a whim just because you know everything about them
[27:58.200 --> 27:59.800]  Oh, man
[27:59.800 --> 28:05.160] So let's say that if you were to try to take the defense the court saying you know tell us you're telling the judge
[28:05.160 --> 28:09.400] Hey, well, you're not actually about how to do this if you're just going to say, you know, that's not proper ground
[28:09.480 --> 28:11.080]  Do you know you're guilty?
[28:11.080 --> 28:14.280] Okay. Well, this is the reason for what I do
[28:14.840 --> 28:20.760] When we're fighting traffic tickets, we never ever go to the merits of the citation itself
[28:20.760 --> 28:22.760] Why we never have to
[28:23.960 --> 28:26.760] Like I said on alex's show and I teach in my class
[28:27.400 --> 28:32.680] By the time the traffic stop itself is over the officer has
[28:33.480 --> 28:38.360] In a minimum of five due process violations a minimum of five
[28:38.760 --> 28:45.560] I will never address the merits of a case if there are outstanding due process violations to be addressed
[28:45.560 --> 28:55.560] Oh, man, I will let's get to here and uh wish you could make some kind of a you know, we should start some kind of a robbing group for this, you know
[28:55.560 --> 28:58.040] Well, we're working on that right now though
[28:58.040 --> 29:06.520] What I'm hoping to do is to train as many people as possible in the sunday seminars about what's being done and what we can do to fight back
[29:06.760 --> 29:12.440] This system has stayed in place as long as it has because nobody fights back
[29:12.440 --> 29:16.200] Over hand over their money and play the good little slave
[29:17.000 --> 29:19.000]  I stopped doing that
[29:19.080 --> 29:22.760] And I am now teaching other people to stop doing that
[29:24.120 --> 29:26.120]  If we take
[29:26.280 --> 29:34.120] Yeah, if we take the money out of the system where it's no longer profitable the system will wind up eating itself and disappearing
[29:35.640 --> 29:39.320] All right, cool. Well, thank you very much. Thank you for calling in Ramon. Thank you
[29:39.320 --> 29:45.080] All right, we are about to go to break. We do have some more callers on the board. Everybody that's out there
[29:45.160 --> 29:47.640] We don't have a screener so I know what your names are
[29:47.640 --> 29:50.920] But if you're on the board, please hang on we'll be right back and get with you
[29:51.240 --> 29:58.600] This is rule of law radio. Eddie Craig, Randy Kelton, Debra Stevens, 512-646-1984. We'll be right back
[29:59.960 --> 30:07.240] This is building seven a 47 story skyscraper that fell on the afternoon of september 11 the government says that fire brought it down
[30:07.240 --> 30:13.320] However, 1500 architects and engineers have concluded. It was a controlled demolition over 6000
[30:13.320 --> 30:17.880] My fellow service members have given their lives of thousands of my fellow force responders at night
[30:18.040 --> 30:22.920]  I'm not a conspiracy theorist. I'm a structural engineer. I'm a new york city correction officer. I'm an air force pilot
[30:22.920 --> 30:29.800] I'm a father who lost his son. We're americans and we deserve the truth go to rememberbuilding7.org today
[30:32.360 --> 30:34.360]  Let's get physical
[30:34.360 --> 30:40.920] Physical hey, if you exercise even attempt as much as you should you can extend your life by years
[30:41.240 --> 30:45.400] I'm Dr. Catherine Albrecht and I'll hike right back with the good news in just a moment
[30:46.120 --> 30:49.880] Privacy is under attack when you give up data about yourself
[30:49.960 --> 30:55.960] You'll never get it back again and once your privacy is gone. You'll find your freedoms will start to vanish too
[30:56.440 --> 31:01.320] So protect your rights say no to surveillance and keep your information to yourself
[31:01.320 --> 31:07.560] Privacy it's worth hanging on to this public service announcement is brought to you by start page dot com
[31:07.800 --> 31:13.720] The private search engine alternative to google yahoo and bin start over with start page
[31:15.960 --> 31:19.800] Exercise we all know we need it, but we don't always take the time to do it
[31:20.120 --> 31:26.280] Now new evidence says just 15 measly minutes of physical activity a day can extend your life a lot
[31:26.280 --> 31:32.920] Researchers in taiwan found that an hour and a half of exercise a week extended people's lives by three whole years
[31:33.240 --> 31:40.840] That's just 13 minutes a day the study found that small amounts of daily exercise made people 10% less likely to die of cancer
[31:41.000 --> 31:44.040] And 14% less likely to die for any reason
[31:44.360 --> 31:50.120] So come on couch potatoes dig out those olivian newton john cds and let me hear your body talk
[31:50.120 --> 31:55.720] I'm dr. Catherine albrecht more news and information at Catherine albrecht dot com
[32:03.720 --> 32:05.720]  Yeah, I got the warrant
[32:06.520 --> 32:08.520]  And I'm gonna solve that
[32:09.720 --> 32:11.720] To the end of the momentum
[32:12.760 --> 32:17.400] All right folks. We are back. This is Rudolf on radio. We have Jim and Mark on the board
[32:17.400 --> 32:21.800] Guys, please be patient for just a couple more minutes. I am trying to get this wrapped up
[32:21.880 --> 32:24.440] But I believe this to be important stuff at the moment
[32:25.240 --> 32:26.280]  okay
[32:26.280 --> 32:30.920] Now the rest of the definition of security interest deals with information
[32:31.400 --> 32:35.560] out of chapter 2 or 2a with the exception of
[32:36.520 --> 32:40.200] Continuing to refer back to chapter 9 as a security interest
[32:40.680 --> 32:44.120] Then we have the very last sentence of that definition
[32:44.120 --> 32:51.000] Whether a transaction in the form of a lease creates a security interest is determined pursuant to section 1.203
[32:52.200 --> 32:57.160] Now for the moment, we're going to pursue or presume that we're not dealing with a lease option
[32:57.240 --> 32:59.480] We're dealing with automobiles that we own
[33:01.240 --> 33:02.200]  So
[33:02.200 --> 33:07.240] Since this is talking about that we have to get a promissory note that is subject to chapter 9
[33:07.640 --> 33:10.040]  We need to know what's in chapter 9
[33:10.040 --> 33:14.440] Chapter 9 of the business and commerce code the UCC
[33:15.400 --> 33:18.200]  Is titled secured transactions
[33:18.840 --> 33:23.400] Sub chapter a is a short title definitions and general concepts
[33:24.120 --> 33:29.320]  Section 9.102 definitions and index of definitions a
[33:31.080 --> 33:35.400] In this chapter number 10 definitions certificate of title
[33:35.400 --> 33:41.960] Certificate of title means a certificate of title with respect to which a statute provides
[33:42.520 --> 33:44.520] for the security interest in question
[33:45.400 --> 33:52.440] To be indicated on the certificate as a condition or result of security interest obtaining priority
[33:52.920 --> 33:54.920] over the rights of a lien creditor
[33:55.400 --> 33:57.400] with respect to the collateral
[33:58.280 --> 34:04.280] 12 collateral means the property subject to a security interest or agricultural lien
[34:04.280 --> 34:06.280]  The term includes a
[34:07.080 --> 34:10.040] Proceeds to which a security interest attaches

[34:18.200 --> 34:21.240] Goods that are the subject of a consignment
[34:23.400 --> 34:25.400] Now the first question is
[34:25.480 --> 34:30.440] Is your car being consigned to you by the bank while there's a lien on it?
[34:32.120 --> 34:33.560]  Okay
[34:33.560 --> 34:35.560]  number 47 instrument

[34:50.760 --> 34:57.800] And is a type of a type that an ordinary course of business is transferred by delivery with any necessary

[35:06.840 --> 35:12.200] Three writings that evidence of right to payment are rising out of the use of a credit or charge card
[35:12.520 --> 35:16.520] Or information contained on or for use with the card or for
[35:17.560 --> 35:19.960]  non-negotiable certificates of deposit
[35:20.760 --> 35:22.760]  number 52 lien creditor
[35:23.800 --> 35:25.400]  means a
[35:25.400 --> 35:31.000] A creditor that has acquired a lien on the property involved by attachment levy or the like
[35:31.720 --> 35:32.680]  b
[35:32.680 --> 35:36.600] An assignee for benefit of creditors from the time of assignment
[35:37.160 --> 35:38.040]  c
[35:38.040 --> 35:42.840] A trustee and bankruptcy from the date of the filing of the petition or d
[35:43.640 --> 35:46.600] a receiver inequity from the time of appointment

[35:50.360 --> 35:57.000] A person in whose favor a security interest is created or provided for under a security agreement

[36:21.720 --> 36:25.800] A security interest or agricultural lien is created or provided for or
[36:26.440 --> 36:27.320]  f
[36:27.320 --> 36:32.360]  A person that holds a security interest arising under section 2.401
[36:33.000 --> 36:35.000]  2.505
[36:35.000 --> 36:37.000]  2.711 c
[36:37.240 --> 36:39.560]  2a 0.508 e
[36:40.360 --> 36:42.360]  4.210 or
[36:42.360 --> 36:44.360]  5.118
[36:45.720 --> 36:53.480] Definition 74 security agreement means an agreement that creates or provides for a security interest
[36:54.360 --> 36:55.720]  All right, folks
[36:55.720 --> 36:59.000] There you have all the necessary definitions to see
[36:59.880 --> 37:03.160] What a certificate of title actually does
[37:03.880 --> 37:08.520] The certificate of title does not grant the possessor
[37:08.520 --> 37:11.640] ownership rights to the car
[37:12.920 --> 37:17.800] It simply denotes who holds the higher
[37:19.720 --> 37:26.840] Priority on the encumbered property in reference to any liens against said property
[37:27.400 --> 37:29.000]  That's all it does
[37:29.720 --> 37:36.760] It does not transfer ownership interest in the property at all
[37:36.760 --> 37:38.760]  It simply records
[37:39.320 --> 37:47.640] Who has the highest priority right to the property while there is a lien in existence
[37:48.920 --> 37:50.040]  Got it?
[37:50.040 --> 37:52.040]  So the question becomes
[37:52.760 --> 37:58.040] What document actually grants ownership rights
[37:58.680 --> 38:04.040] Rather than legal title like the certificate of title does and remember
[38:04.040 --> 38:06.600] I've read you the definition of legal title before
[38:07.400 --> 38:13.640] Legal title gives the legal impression of all the rights of ownership
[38:14.280 --> 38:20.680] But none of the actual rights of ownership dealing with this position of the property
[38:21.560 --> 38:25.560] The certificate of title may give you a right of possession
[38:26.040 --> 38:29.480] But it does not give you a right of ownership
[38:29.480 --> 38:35.880] If it did, the ownership right would be superior to the lien right
[38:36.760 --> 38:38.200] It would have to be
[38:38.760 --> 38:43.560] You could not be the owner if there was a lien
[38:45.240 --> 38:46.360]  Understand that?
[38:46.920 --> 38:51.560] The moment you put any piece of property under a lien
[38:52.440 --> 38:55.400] Someone else has a legal claim to it
[38:55.400 --> 38:58.760] You are no longer the true owner
[38:59.720 --> 39:03.000] Until that lien is gotten rid of
[39:03.560 --> 39:13.400] Someone else has a viable security interest and ownership and possessory interest in the property
[39:15.720 --> 39:17.320]  Now think about that
[39:18.520 --> 39:20.280] If that is the case
[39:20.280 --> 39:25.080] How can a certificate of title create a right of ownership?
[39:27.240 --> 39:28.280]  It can't
[39:28.280 --> 39:41.240] It lists more than one individual or agency or corporation with a claim to the same piece of property
[39:43.560 --> 39:46.040]  Nobody actually owns it
[39:46.040 --> 39:48.760]  Not yet
[39:50.920 --> 39:53.160]  So this creates a significant problem
[39:54.280 --> 39:57.960] But the problem does not belong to you and me
[39:58.440 --> 40:02.840] It belongs to the state and the political subdivisions of the state
[40:03.240 --> 40:08.040] 501.004a clearly mandates that when it says
[40:08.040 --> 40:15.400] This title applies to motor vehicles owned by the state or political subdivisions of the state
[40:16.680 --> 40:20.360] You could not ask for the language to be any clearer than that
[40:21.640 --> 40:23.880]  There is no nothing
[40:25.080 --> 40:29.400] No conveyance of any kind in this entire chapter
[40:30.680 --> 40:34.840] That is designated as being required to have the certificate of title
[40:34.840 --> 40:39.160] If it's not owned by the state or political subdivision of the state
[40:41.160 --> 40:49.880] Again another perfect example of where the law is being used to literally steal your property
[40:50.920 --> 40:56.920] When a certificate of title is issued for that property and the state seizes the mso or mco
[40:57.560 --> 40:59.720]  That is a taking people
[40:59.720 --> 41:06.280] They have taken your private property assumed ownership for public use
[41:07.240 --> 41:11.000] Even though you're actually using it if the state owns it
[41:12.520 --> 41:14.520] What is the presumption here?
[41:15.080 --> 41:18.920] If a private individual has access to it and it's owned by the state
[41:19.560 --> 41:22.280] Then it must be up for public use
[41:23.560 --> 41:25.560]  So the question becomes
[41:25.560 --> 41:28.120] How can you report your car stolen?
[41:28.120 --> 41:30.120]  You don't own the thing
[41:30.840 --> 41:36.760] The state would have to claim the car is stolen as somebody walked into your driveway hot wired it and took off
[41:39.560 --> 41:41.560]  Think about that for a second
[41:43.160 --> 41:48.120] They have created literally a spaghetti bowl worth of garbage
[41:48.120 --> 41:57.560] An intricate knot tying in who actually has a rightful claim to this property known as an automobile
[41:59.320 --> 42:02.520] By illegally converting the automobile
[42:03.160 --> 42:08.200] Into a motor vehicle without your consent or knowledge
[42:09.320 --> 42:11.320]  That's fraud
[42:12.120 --> 42:14.120]  It's conversion
[42:14.120 --> 42:17.640]  It's unconstitutional on its face
[42:19.640 --> 42:23.400] Yet the car dealers are the ones that are doing it to you
[42:24.040 --> 42:27.800] Because they don't read they simply obey
[42:29.080 --> 42:32.040]  When they sell you a car and it's not
[42:33.480 --> 42:37.880] Or you have to get a lien on it who should be holding the certificate
[42:39.080 --> 42:40.680]  of title
[42:40.680 --> 42:44.440] That would work the way it is now except the state's the one that has to issue it
[42:45.080 --> 42:52.440] What should be happening is is the state should be holding the original mso or mco as a third party
[42:53.080 --> 42:55.080]  disinterested
[42:55.320 --> 43:01.880] Individual agency or whatever their job simply being hold the paper
[43:03.000 --> 43:05.000] Once the lien is done
[43:05.000 --> 43:11.320] Or it's defaulted on and some one of the two parties makes an actual possessory
[43:12.200 --> 43:14.200] ownership claim of the property
[43:15.080 --> 43:17.080]  and proves it up
[43:17.480 --> 43:21.640] Then return the actual ownership papers to them
[43:23.000 --> 43:25.000]  But that's not what they're doing
[43:25.800 --> 43:33.640] The moment the certificate of title is issued the law written the way it is says the state is the only one that needs that document
[43:33.640 --> 43:36.520] So the state is making the presumption of ownership
[43:37.880 --> 43:43.560] All right, I'll wrap this up jim mark. I will get you guys on the other side of the break. Thank you so much for holding

[44:29.640 --> 44:33.720] Was also told by atf agents that they had been paid to not come into work
[44:34.360 --> 44:40.360] The atf initially denied these claims and now variously claim that one of their agents was in a free falling elevator

[46:34.840 --> 46:39.400] This is not normal for the network. Believe me. Uh, it just so happens that uh

[47:13.400 --> 47:18.200] Uh, this is dan from south west missouri. Hi dan. How you doing? What can we do for you?
[47:18.200 --> 47:22.680] Uh, well, you know, I've got an issue. I uh, I'm not sure how to address
[47:23.960 --> 47:25.560]  my son
[47:25.560 --> 47:29.880] citations for no driver's license just the last three weeks one today
[47:31.080 --> 47:33.080]  and uh, he's uh
[47:33.320 --> 47:41.160] He's never had a driver's license. He's uh, almost 20 years old and uh, he carries a notice for a judicial uh, judicial mandate
[47:41.160 --> 47:47.720] Siding uh court cases, uh determining that uh, private persons, uh, don't require a
[47:48.520 --> 47:49.880]  license to
[47:49.880 --> 47:51.880]  travel on public roads
[47:51.880 --> 47:53.880]  Now is that a missouri case?
[47:54.840 --> 47:58.120] Yes, and I haven't went to court anything like that yet
[47:58.680 --> 48:01.320] First of all, he he he run a stop sign
[48:01.480 --> 48:05.000] So caught pulled him over and he showed him that he said well, that don't work here
[48:05.000 --> 48:08.920] You must be some kind of sovereign or something like that. So he sided him for run a stop sign
[48:08.920 --> 48:12.520] And uh, gave him a citation for no driver's license
[48:13.400 --> 48:17.960] Well, that's been uh, about two and a half two weeks three weeks ago something like that
[48:17.960 --> 48:23.960] He's messed around today and they caught him running 90 mile an hour down at 55 mile an hour highway passing an automobile
[48:24.760 --> 48:31.240] And uh, they gave him another citation for running 90 mile an hour and 55 and and he presented that uh
[48:31.640 --> 48:37.960] Notice for judicial mandate to the police officer if they're interested in the police officer said yeah, but that doesn't give you the right
[48:37.960 --> 48:41.160] You're running 90 mile an hour and we can agree with that I guess
[48:42.200 --> 48:45.880] Well, that depends are the speed limits in missouri prima facie
[48:47.080 --> 48:54.360] Well, I'm not sure what that means my friend, but uh, prima facie means that something is on its face
[48:54.840 --> 49:03.480] One way or another, but it's refutable by something more substantial. It just simply means on its face or on the face of
[49:03.480 --> 49:07.560] Okay, a prima facie speed limit is one that
[49:08.440 --> 49:12.440] Appears to be legal under a specific set of conditions
[49:13.080 --> 49:17.880] But is refutable by other facts and other conditions
[49:18.760 --> 49:21.960] For instance here in texas the speed limits are prima facie
[49:22.600 --> 49:30.040] One of the required elements of a speeding offense is that they must charge you with driving a motor vehicle
[49:30.040 --> 49:39.240] On a highway at a speed that is other than reasonable and prudent under the conditions or circumstances then existing
[49:40.200 --> 49:42.200] Now in that section of statute
[49:42.840 --> 49:45.400] The only way that you can do that
[49:46.120 --> 49:48.920] Is if the the prosecutor can prove
[49:49.720 --> 49:51.720]  That reasonable and prudent
[49:52.280 --> 49:56.920] Resulted in an accident or harm to some property
[49:56.920 --> 50:00.280] So in order to charge you with speeding
[50:01.160 --> 50:04.680] In order to prove the element of reasonable and prudent
[50:05.160 --> 50:11.880] They have to prove there was a harm perpetrated against someone or someone else's property
[50:12.360 --> 50:14.360]  You understand that part?
[50:18.200 --> 50:20.200]  Hello
[50:21.240 --> 50:23.240] We might have lost him
[50:23.240 --> 50:25.240] We might have lost him
[50:26.760 --> 50:31.560] All right, well he still seems to be on the board there. Are you still there in Missouri?
[50:32.280 --> 50:33.720]  Yeah, I'm here
[50:33.720 --> 50:35.240]  Okay, um
[50:35.240 --> 50:38.200] But did you understand what I was talking about on the prima facie part?
[50:38.840 --> 50:43.000] Well, I think so. I'm not sure how it's applicable to this situation necessarily
[50:43.560 --> 50:49.960] Just search through the statutes and search for the words prima facie pr im a
[50:49.960 --> 50:53.160]  Second word facie
[50:54.680 --> 50:56.680] Search for that in the statutes
[50:57.080 --> 51:00.280] And find where it has that in relation to speed
[51:01.160 --> 51:07.960] Or speed ordinances or the speeding statutes or the reasonable and prudent speeds on the highways there in Missouri
[51:08.600 --> 51:12.520] Right. Did he did he cause an accident? Did he run somebody off the road?
[51:13.560 --> 51:18.600] Uh, do you run over a little boy or a little girl? Do anything like that happen or?
[51:18.600 --> 51:20.920]  Uh, there's no violation of natural
[51:21.960 --> 51:25.160]  And so that's what's going to prima facie if
[51:26.440 --> 51:28.440] It has to on the face of it
[51:29.240 --> 51:30.200]  be
[51:30.200 --> 51:34.040] Cause some type of harm and if you didn't cause some type of harm
[51:35.160 --> 51:40.440] If it's not a violation necessarily to exceed the speed limit
[51:41.640 --> 51:45.400] But you must exceed the speed limit in a way that causes harm
[51:45.400 --> 51:50.920] I understand that. Is that sound right, Eddie? Yeah, that's perfectly right
[51:54.680 --> 52:02.360] Okay, well, you know, we're we're we're a bit of a quandary how to address this and uh, we're needing some help and I
[52:03.160 --> 52:06.120] I appreciate that your information so far. We will
[52:07.000 --> 52:08.600]  peruse
[52:08.600 --> 52:12.040] any kind of the internet information we get concerning prima facie
[52:12.040 --> 52:19.160] And uh, well, don't just look at the internet every state has its statutes online
[52:19.800 --> 52:22.200] All you got to do is find the ones for Missouri
[52:22.920 --> 52:25.960] Go through and read them or search through them
[52:26.440 --> 52:31.400] Using the search feature built into the database there where the statutes are on the government website
[52:32.280 --> 52:38.280] Look it up. Don't just search the internet get it from the statutes that belong to your state
[52:38.360 --> 52:40.360] That's what you need to know is the statute
[52:40.360 --> 52:42.360]  I understood
[52:43.240 --> 52:47.800] And we uh, how do we present that to uh, the magistrate to uh,
[52:48.920 --> 52:54.760] I would do it as a motion to quash the citation and a motion to quash the complaint based upon the citation
[52:55.640 --> 52:57.640]  Excellent
[52:57.640 --> 53:01.640] Is it does that need to be in print? We need to have a paper document
[53:02.200 --> 53:07.960] Rule number one do everything in writing no exceptions
[53:07.960 --> 53:09.960]  That's good
[53:10.200 --> 53:12.200]  Uh
[53:12.920 --> 53:15.960] Getting back to the no driver's license thing. Uh
[53:16.920 --> 53:17.960]  There's uh
[53:17.960 --> 53:21.800] The first citation you got from no driver's license is a city cop. He said well
[53:21.880 --> 53:25.080]  It looks like you're something have a sovereign or something that's just don't apply
[53:25.720 --> 53:31.320] All you need to do is verify the case you're using has not been overturned by subsequent case law
[53:32.920 --> 53:34.200]  Yes, sir
[53:34.200 --> 53:38.440] If that case is still good the lower court must still abide by it
[53:40.760 --> 53:46.040] Is that uh, there's have to be a Missouri case or a supreme court case in any other state or uh,
[53:46.680 --> 53:54.440] How does that work if you go if you go with anything other than a Missouri case you better make sure it's absolutely on point with your argument
[53:55.400 --> 53:58.280] Yes, if you go with anything other than a state case
[53:58.920 --> 54:00.920]  Since you're addressing state law
[54:00.920 --> 54:06.200] Then anything other than a state case would have to go to due process
[54:06.920 --> 54:08.920]  Which would be a federal violation?
[54:09.320 --> 54:14.520] Otherwise the case wouldn't be appropriate and that's what I was talking about earlier when I said
[54:15.720 --> 54:20.760] Never make a proactive statement of law out of your own mouth because the judge can't listen to you
[54:21.640 --> 54:25.160] You have to bring to the court. These are the facts
[54:25.880 --> 54:28.760] And this is the law that applies to you
[54:28.760 --> 54:36.280] That you must apply to these facts when you start doing your research and this is what you're looking for
[54:39.560 --> 54:44.040] Then literally it you have to pretty well write the
[54:45.400 --> 54:47.320]  Your documents
[54:47.320 --> 54:53.240] Out of the verbiage of the case law now. I know on the surface that sounds really difficult
[54:53.240 --> 55:01.480] It's not as hard as it seems, but it takes a a little bit of getting your head wrapped around the fact
[55:02.280 --> 55:06.280] That you can't say anything to the court out of your own mouth
[55:06.840 --> 55:08.840]  I understand
[55:09.320 --> 55:16.840] Is there anywhere I can go to find uh, some sort of documentation that would reflect a precedent that's necessary for me to uh
[55:17.160 --> 55:19.160]  review
[55:19.160 --> 55:20.840]  Absolutely
[55:20.840 --> 55:24.200] Go to your any local legal library
[55:25.320 --> 55:31.160] And just go to the librarian. You will be amazed at how helpful they will be
[55:32.040 --> 55:37.320] He he means law library if you call it a legal library, you're going to get some sideways claims. Let's go into what?
[55:38.280 --> 55:40.280]  Okay, a law library
[55:41.240 --> 55:45.080] Or a library that handles legal information books. Yeah
[55:45.800 --> 55:49.640] Okay, the thing is I was wondering is there any uh form
[55:49.640 --> 55:51.640]  that provides a
[55:52.200 --> 55:53.720]  a
[55:53.720 --> 55:58.760] Any form that provides a documentation or a precedent that would reflect my position
[55:59.400 --> 56:01.400]  But I could present you know
[56:01.400 --> 56:07.960] Yes, there is there is precedent that would affect your position, but there's absolutely no way we could know
[56:07.960 --> 56:11.400] I'm looking for the easy way out here. There's not an easy way out
[56:12.600 --> 56:14.600]  The best thing about a traffic
[56:14.600 --> 56:18.840] Is it is the cheapest way to get a legal education?
[56:19.640 --> 56:23.480] Now we're not talking about something that's going to take
[56:24.680 --> 56:26.680] Six or eight years of law school
[56:27.320 --> 56:29.320] In six or eight years of law school
[56:29.960 --> 56:37.480] They don't teach the attorneys about this kind of thing. They teach attorneys how to argue legal issues
[56:38.600 --> 56:43.640] When an attorney gets out of law school, he learns how to write motions how to file motions
[56:43.640 --> 56:47.720] How to get motions put on for hearing how to argue motions in court
[56:48.920 --> 56:55.800] The standard things that that you would be doing are the things attorneys learn once they get out of law school
[56:56.280 --> 57:00.600] So they're not it's not new as difficult as it seems
[57:01.480 --> 57:04.200] When you first started to learn to write by
[57:05.720 --> 57:09.880] You have to pay attention to everything starts in little detail
[57:09.880 --> 57:13.320] And it seemed incredibly complex
[57:14.680 --> 57:16.680] But very quickly you notice
[57:29.720 --> 57:31.720] The basic laws the same way there are some
[57:32.280 --> 57:36.840] Basic things and if you listen to this show we go over those basic things
[57:37.560 --> 57:39.320]  over and over
[57:39.320 --> 57:44.040] And once you have the basics down how to write a motion a motion is not magic
[57:44.680 --> 57:49.240] It's a letter to the court. It has a different heading than a business letter
[57:50.360 --> 57:53.320] Each state has their own heading format
[57:54.120 --> 57:56.360]  And then you write a motion
[57:57.720 --> 57:59.720]  In a motion
[58:00.200 --> 58:04.920] The first thing you do is tell the judge why he has authority to hear your motion
[58:05.560 --> 58:07.560] Then you tell the judge what you want
[58:07.560 --> 58:13.960] And then you tell the judge what law tells him he has to give you what you want
[58:15.160 --> 58:20.520] Then you ask him to give you what you want. That's the every motion will essentially follow that format
[58:20.760 --> 58:23.720] Once you got that down 90% of right motions is
[58:24.280 --> 58:26.280]  That's the hardest part
[58:26.680 --> 58:31.560] And then all you have to do is find the law that supports it. That's nothing to care about easy, but

[01:03:53.960 --> 01:03:56.760]  I won't pay for the fun with my body
[01:03:57.240 --> 01:03:59.960]  They're friends wicked and they're not shy
[01:03:59.960 --> 01:04:06.840] Ain't gonna pay for the car with my body
[01:04:06.840 --> 01:04:29.720]  They're friends wicked and they're not shy
[01:04:36.840 --> 01:04:45.480] I have yet to meet a lawyer that's ever bothered to read most of the actual laws he operates under
[01:04:46.760 --> 01:04:51.480] They don't study them in school. I know that for a fact. I've been to some of these schools and watched
[01:04:51.480 --> 01:04:58.600] All they really study as randy put it is how to properly format paperwork and the court's legal opinion
[01:04:59.080 --> 01:05:05.160] About certain issues before the courts. They don't ever actually study the law
[01:05:05.160 --> 01:05:10.280] And that's where we can beat the lawyers is by reading the law
[01:05:12.920 --> 01:05:16.680] And taking on the task over it randy do you agree or disagree with that?
[01:05:17.480 --> 01:05:21.080]  Yeah, I agree 100% and you know
[01:05:22.520 --> 01:05:29.000] It amazes me I have a friend who is the prosecuting attorney the district attorney for wise counting
[01:05:29.800 --> 01:05:33.320] And if there exists an honest prosecutor, this would be the one
[01:05:33.320 --> 01:05:40.280] But as the time I was talking to him he was county attorney and I she mentioned something about the illegal practice of law
[01:05:40.280 --> 01:05:42.280] And I quoted the statute to him
[01:05:43.240 --> 01:05:49.800] And he said are you sure I said I'm sure Greg he took out the code of criminal procedure and read it and it said exactly what I told him
[01:05:51.160 --> 01:05:55.960] So I said Greg you ought to be ashamed of yourself. So where was the last time you read that code?
[01:05:56.680 --> 01:05:59.240] He said well, I don't know that I've ever read the whole thing
[01:05:59.240 --> 01:06:07.400] No, he's prosecuting attorney. I said Greg you ought to be ashamed of yourself. He said well, frankly, Mr. Kelton
[01:06:07.960 --> 01:06:11.000]  I don't know a single attorney who's read the whole thing
[01:06:12.680 --> 01:06:20.760] Greg that's beautiful if he said yes, it is but that is the state of our legal community
[01:06:20.760 --> 01:06:27.480] Our legal community learns how to argue legal issues
[01:06:29.400 --> 01:06:32.040] They in law school, they don't learn law
[01:06:33.640 --> 01:06:39.720] They don't necessarily know the code and and that's understandable the teaching attorneys
[01:06:40.600 --> 01:06:45.880] The basic tool that an attorney has to have that he can't get by reading the law
[01:06:45.880 --> 01:06:50.360] They expect when he gets out whatever specialty he goes into
[01:06:51.080 --> 01:06:53.480] He'll read the code concerning that specialty
[01:06:54.680 --> 01:06:59.640] Well, what they do is they get out and mostly they go to work for a law firm
[01:07:00.280 --> 01:07:03.880] And the law firm tells them this is how we do it
[01:07:04.840 --> 01:07:08.440] And they do it the way the law firm tells them that they're ready to read the code
[01:07:08.440 --> 01:07:16.200] So if you read the code then you get a step up on them
[01:07:17.800 --> 01:07:22.040] And just listen to what Eddie's been doing. You know, this doesn't take a
[01:07:24.920 --> 01:07:32.680] Six-year law degree to be able to read and understand the code. I mean if Eddie can do it
[01:07:32.680 --> 01:07:39.960] Yeah, if I can do it anybody can do it. Why I'm not the smartest apple in the whole barrel
[01:07:41.000 --> 01:07:47.560] I'm not even the most rotten Dolly that job to Randy, but at least I make the effort to you know to be bright and shiny
[01:07:48.040 --> 01:07:53.800] I've told people that I do not settle for being second best at anything I do including this
[01:07:54.520 --> 01:07:59.000] I may be second best, but it will not be because I settled for it
[01:07:59.000 --> 01:08:03.960] I make it my endeavor in life to be the best at everything I do because
[01:08:04.600 --> 01:08:08.280] I want to be right about it. I want to do it to the best of my ability
[01:08:08.600 --> 01:08:14.440] That's another area where I haven't met too many attorneys willing to participate. They actually have to work
[01:08:14.840 --> 01:08:16.840] They don't really want to do it
[01:08:16.840 --> 01:08:18.840] They would rather get plenty for free
[01:08:19.800 --> 01:08:23.160] And our other colleague that was looking for an easy way out
[01:08:24.200 --> 01:08:26.200]  I want to say
[01:08:26.200 --> 01:08:28.200]  Shame on you
[01:08:28.200 --> 01:08:29.480]  you
[01:08:29.480 --> 01:08:32.600]  You are missing a tremendous opportunity
[01:08:33.800 --> 01:08:36.520] And you are not taking the easy way out
[01:08:37.880 --> 01:08:45.480] Traffic tickets. I mean, what are they going to do pull out your fingernails? I mean, that's as minor a charge as you can get
[01:08:46.280 --> 01:08:49.000] Now the 90 miles an hour may not be exactly mindy
[01:08:50.280 --> 01:08:51.880]  minor but
[01:08:51.880 --> 01:08:53.880]  Generally traffic is
[01:08:54.200 --> 01:08:56.040]  fine only
[01:08:56.040 --> 01:09:02.840] So you get a traffic ticket and if you don't find it, it's going to cost you between three and five hundred dollars
[01:09:04.280 --> 01:09:06.280] If you do find it
[01:09:06.280 --> 01:09:09.560] It's going to cost you between three and five hundred dollars if you lose
[01:09:11.160 --> 01:09:13.160] But what you will gain
[01:09:13.880 --> 01:09:17.160] Is you'll gain some degree of your freedom back
[01:09:18.520 --> 01:09:22.280] What i'm driving down the road and those red lights come on behind me
[01:09:22.280 --> 01:09:26.920] I don't get that little sick feeling in the pit of my stomach
[01:09:28.520 --> 01:09:30.120]  I think
[01:09:30.120 --> 01:09:32.040]  Go ahead Bubba
[01:09:32.040 --> 01:09:34.040]  Take your best shot
[01:09:34.360 --> 01:09:37.720] Because when I get done with you you may win in the end
[01:09:38.840 --> 01:09:41.240] You're not ever going to want to do that again
[01:09:43.400 --> 01:09:47.960] It gives me a level of freedom that I otherwise would not have
[01:09:47.960 --> 01:09:51.720] And this is that is far more valuable
[01:09:53.080 --> 01:09:54.280]  than
[01:09:54.280 --> 01:09:56.280]  A few hundred bucks for tickets
[01:09:56.440 --> 01:10:00.600] And having to read a few books missing a few tv programs
[01:10:00.600 --> 01:10:05.160] I have people asking me about tv programs all the time and I tell them well, I don't know
[01:10:05.640 --> 01:10:09.000]  I don't know the tv. I don't know the radio. I don't have time
[01:10:10.280 --> 01:10:14.280] Life is far too exciting far too much going on
[01:10:14.280 --> 01:10:17.720] To spend my time sitting there watching those programs
[01:10:18.520 --> 01:10:23.320] And you will find it is a great adventure. It's a well worth the effort
[01:10:24.280 --> 01:10:26.280]  That's all the preaching I'm going to do
[01:10:29.240 --> 01:10:30.040]  Eddie?
[01:10:30.040 --> 01:10:30.840]  Yes?
[01:10:30.840 --> 01:10:33.720] You want to pick up the preaching?
[01:10:34.600 --> 01:10:39.720] I believe me. I don't know if anybody else wants to listen to me preach. Mr. Missouri, are you still there?
[01:10:40.040 --> 01:10:41.320]  Yeah, I'm still here.
[01:10:41.320 --> 01:10:46.040] Yeah, I'm still here. Okay. Anything else you need to ask us about what's going on there?
[01:10:46.360 --> 01:10:50.840] Read, study, and learn. That's your first line of defense and offense
[01:10:51.720 --> 01:10:53.720]  In the event that a
[01:10:53.880 --> 01:10:55.400]  magistrate
[01:10:55.400 --> 01:11:01.240] Doesn't honor our documentation or presentation or our motion or or notice the judicial mandate
[01:11:01.720 --> 01:11:06.920] Okay, then you won't look at it or honor it. All right. Listen closely to this, okay
[01:11:06.920 --> 01:11:12.280] Most of the initial trial courts in these cases are courts of no record
[01:11:12.680 --> 01:11:20.840] Meaning there's no court reporter and these judges do what they want because there's no record to hold them accountable to the law. Okay
[01:11:21.960 --> 01:11:28.200] You do not go to trial in these courts expecting to win to win is not your issue
[01:11:28.680 --> 01:11:31.320] To make the record is your issue
[01:11:32.040 --> 01:11:34.040] Are we clear on that first part?
[01:11:34.600 --> 01:11:35.560]  Yes, sir
[01:11:35.560 --> 01:11:43.320] The record is always made in writing. Do nothing that is not backed up with something in writing
[01:11:43.640 --> 01:11:45.640] We clear on the second issue
[01:11:46.360 --> 01:11:51.880] Yes, sir. Okay, make sure that you hold on. Hold on. Let me address just a little bit of that
[01:11:52.680 --> 01:11:55.480] The real action happens in the court of appeals
[01:11:56.280 --> 01:12:01.000] And we have Dr. Graves who does jurisdictionary on monday nights
[01:12:01.880 --> 01:12:03.080]  and
[01:12:03.080 --> 01:12:07.320] What he keeps telling everybody is the trial court
[01:12:07.960 --> 01:12:13.000] The reason for the trial court is to lay the record for the appeals court
[01:12:13.480 --> 01:12:15.480] You lay down the law to the judge
[01:12:15.960 --> 01:12:21.400] He makes his rulings and if you don't get the ruling you like you appeal it to the appeals court
[01:12:21.720 --> 01:12:26.280] Now the appeals court is in a whole different situation than the trial court is
[01:12:27.160 --> 01:12:31.480] The appeals court is there to maintain the corpus jurus
[01:12:31.480 --> 01:12:35.960] To maintain the integrity of the body of law
[01:12:37.160 --> 01:12:41.240] If the appeals court rules in violation of standing law
[01:12:41.800 --> 01:12:48.120] Then other attorneys can use that ruling and the law will turn into a horrible mess
[01:12:49.080 --> 01:12:54.760] So they have a different agenda than the trial court, especially when you're in traffic court
[01:12:54.760 --> 01:13:03.000] Traffic has been turned into an unauthorized tax. All these courts care about is collecting money
[01:13:03.960 --> 01:13:10.280] They want to give you as miserable a time as they can so you don't ever try to do this again
[01:13:12.040 --> 01:13:14.280] So what we try to get people to do
[01:13:15.320 --> 01:13:17.320]  Is give them a miserable time
[01:13:17.880 --> 01:13:21.880] If the prosecutor says it does anything that's not exactly appropriate
[01:13:21.880 --> 01:13:26.760] Find a bark rivets against you. If the judge fails to apply the law to the facts
[01:13:27.320 --> 01:13:29.480] Find a judicial conduct complaint against him
[01:13:30.840 --> 01:13:32.600]  That is a hoot
[01:13:32.600 --> 01:13:34.520]  It makes some nuts
[01:13:34.520 --> 01:13:36.920] Because it affects their insurance
[01:13:38.120 --> 01:13:41.160] You find a bark rivets against them. It won't uh
[01:13:42.040 --> 01:13:45.240] The bar will just throw it in the trash. It won't do anything
[01:13:46.120 --> 01:13:48.760] All the bars are seen across the state are absolutely worthless
[01:13:48.760 --> 01:13:53.960] And their insurance company knows that they're absolutely worthless
[01:13:55.080 --> 01:13:59.880] So the insurance company is where the action is you file a bar grievance
[01:14:01.960 --> 01:14:07.480] Well for one bar grievance your first year of practice the catch of your malpractice insurance immediately
[01:14:08.520 --> 01:14:11.000] Two bar grievance is one year of practice sale cancer
[01:14:11.720 --> 01:14:17.240] And that's because their insurance company and they don't care if you were right wrong or what have you
[01:14:17.240 --> 01:14:19.880]  You start getting bar grievances. You're a risk
[01:14:20.680 --> 01:14:22.680]  so as a pro se
[01:14:23.640 --> 01:14:25.800] We have tools that we can use
[01:14:26.680 --> 01:14:28.680]  That the attorneys can't
[01:14:29.800 --> 01:14:32.600] So look look to the law in
[01:14:33.240 --> 01:14:36.120] Missouri for bar grievances and judicial conduct complaints
[01:14:37.480 --> 01:14:39.480]  On I have a website
[01:14:40.760 --> 01:14:42.760]  Bar grievance.net
[01:14:43.560 --> 01:14:45.560] Go onto that website and just
[01:14:45.560 --> 01:14:47.560]  Click on the
[01:14:49.320 --> 01:14:52.760]  It's it's a relatively new site. So if you're doing some work on it
[01:14:53.480 --> 01:15:01.960] Go through it and find the questionnaire. I've got the american bar association model standards in questionnaire format
[01:15:03.080 --> 01:15:05.800] Go to that and just walk down those questions
[01:15:07.160 --> 01:15:10.360] What those questions will do is tell you
[01:15:11.320 --> 01:15:14.280] What a attorney can be grieved for
[01:15:14.280 --> 01:15:18.040] You will be amazed at some of the stuff in there
[01:15:18.040 --> 01:15:24.440] You need to read like a comic book because you read it say oh goody. Look what I could do to this scumbag
[01:15:25.400 --> 01:15:29.720] You can beat him up big time with it and go to
[01:15:30.920 --> 01:15:35.480] Your state website and pull down the canons of judicial ethics
[01:15:36.920 --> 01:15:38.920] And go through them. They're generally not
[01:15:38.920 --> 01:15:46.120] Not very many of them. It's not like reading the penal code or something. There's not a whole lot of those canons
[01:15:46.760 --> 01:15:48.760]  Once you've gone through them
[01:15:48.840 --> 01:15:51.160] Didn't you go to court if he violates so one of them
[01:15:52.040 --> 01:15:54.040]  judicial conduct complaining
[01:15:54.280 --> 01:15:56.520]  especially these lower courts
[01:15:57.560 --> 01:15:59.080]  because
[01:15:59.080 --> 01:16:05.800] The judicial conduct commissions are not they're reluctant to go after higher level judges
[01:16:05.800 --> 01:16:11.720] So they like to crucify low level judges to make it look like they're doing something
[01:16:12.520 --> 01:16:14.760]  And I can tell you from people I know
[01:16:15.720 --> 01:16:18.760] Kim Magnus is a friend of mine. His brother was a municipal judge
[01:16:19.720 --> 01:16:24.840] Those municipal judges think that the judicial conduct commission will crucify
[01:16:25.720 --> 01:16:27.720]  So they're terrified of them
[01:16:27.720 --> 01:16:31.480] So let's use the tools we have. Let's use traffic
[01:16:31.480 --> 01:16:38.760] As an opportunity to learn how to protect your rights in case something far and less serious comes up

[01:20:09.240 --> 01:20:11.240]  I wanted to say that
[01:20:11.800 --> 01:20:14.360] Both of you fellows have been making some pretty good points tonight
[01:20:15.880 --> 01:20:19.880] Randy about what it is that lawyers learn in law school
[01:20:20.760 --> 01:20:22.040]  and
[01:20:22.040 --> 01:20:25.080] Hey, uh, your name is eddie. Is that correct? Yes, sir
[01:20:25.960 --> 01:20:29.240] Uh about that everything has to be in writing
[01:20:30.120 --> 01:20:32.120]  But um, you know, I've been
[01:20:32.840 --> 01:20:36.920]  suing lawyers and judges since I was 17 years old. I'm a writer
[01:20:37.560 --> 01:20:39.720]  I I write about corrupt people
[01:20:40.360 --> 01:20:45.240] And expose them and so you should be constantly busy with lawyers and judges then I am
[01:20:46.040 --> 01:20:50.760] Constantly even while I'm in court. I'm being threatened with new lawsuits for defamation
[01:20:50.760 --> 01:20:52.760] And because I'm telling him the truth
[01:20:53.320 --> 01:20:57.320]  I've never in my life. I'm 72 years old. I started when I was 17
[01:20:57.960 --> 01:20:59.960] I have never once in my life
[01:21:00.440 --> 01:21:03.480] Ever been sued for defamation and there are reasons for that
[01:21:04.200 --> 01:21:10.040] But uh, uh, one of the things that disturbs now, um, I only learned about you fellows from Alex Jones
[01:21:10.920 --> 01:21:16.040] And uh, I was very interested in what you do. I was especially interested in angry
[01:21:16.920 --> 01:21:18.920] about what was done to Randy
[01:21:18.920 --> 01:21:22.760] Uh, I wrote an extensive email to you eddie. Uh, last night
[01:21:23.480 --> 01:21:27.960] Was saying hey, just you know, you anything just call me. Uh, I do everything
[01:21:28.120 --> 01:21:30.760]  I've got a half a dozen different professional specialties
[01:21:31.080 --> 01:21:35.800] I used to be licensed to practice administrative law in the field of finance
[01:21:36.360 --> 01:21:41.000]  I was also I started out as a boy as a uh, of course, a sonographer
[01:21:41.800 --> 01:21:44.040] On capital cases in the u.s. Army
[01:21:44.040 --> 01:21:49.480] Um, I I had a consulting practice where all my clients were lawyers
[01:21:50.040 --> 01:21:53.640] Who were enrolled in the bankruptcy question? I'll tell you Randy
[01:21:54.200 --> 01:21:59.640] If uh, you're uh, you're obviously upset about corruption in the judiciary as I am and always have been
[01:21:59.880 --> 01:22:01.880] I assume you always have been too
[01:22:02.360 --> 01:22:08.600] Uh from the uh, the the vigor with which you pursue this and the pleasure that you obviously get out of winning
[01:22:08.600 --> 01:22:15.320] Uh, when you do but you haven't seen anything until you've seen corrupt lawyers and judges in the bankruptcy court
[01:22:15.400 --> 01:22:17.960] It is an unbelievable free for all
[01:22:18.840 --> 01:22:23.240] But uh, you know, I've never been sued uh threatened constantly all the time
[01:22:24.040 --> 01:22:28.920] Um, I I just recently was threatened with a lawsuit from an attorney named
[01:22:29.800 --> 01:22:34.360] Ken Hutchison at Dallas. It took me one letter to get rid of him
[01:22:34.360 --> 01:22:39.000] Uh, there are a number of reasons for that but but backing up in terms of premises
[01:22:39.720 --> 01:22:45.240] What disturbed me in listening to your archives is the number of callers and I'm I'm really talking to the callers now
[01:22:45.880 --> 01:22:52.680] Who want you and I I get this all the time as well when people find out like I'm suing three judges right now
[01:22:53.960 --> 01:22:58.360] Uh add to get to one of them is that to prison along with the court sonographer
[01:22:59.080 --> 01:23:02.520] for four major felonies in the court
[01:23:02.520 --> 01:23:06.840] And so people come at me. Oh, how do I get this? How do I get what they want me to do?
[01:23:07.400 --> 01:23:13.160] And randy your your comments about the traffic ticket were really right on target. Maybe even a little bit
[01:23:13.960 --> 01:23:15.960]  conservative and kindly
[01:23:16.200 --> 01:23:23.080] Uh, I am nowhere near so kindly. I tell these people what you want me to do is tell you how to succeed at breaking the law
[01:23:23.960 --> 01:23:25.960]  go away
[01:23:26.040 --> 01:23:30.920] Flat out on top of which I surrendered my license to practice
[01:23:30.920 --> 01:23:34.680] of the very day that Glass-Steagall was revoked
[01:23:35.560 --> 01:23:41.240] or repealed I should say uh because uh that of that meant that uh derivatives
[01:23:41.880 --> 01:23:48.280] Which for the majority of the western financial history have always been criminal violations always
[01:23:49.240 --> 01:23:53.640] and every time the the law was uh eased
[01:23:54.680 --> 01:24:00.280] Uh, the sale of derivatives in every conceivable form that you can imagine took off like wildfire
[01:24:00.280 --> 01:24:02.040]  and
[01:24:02.040 --> 01:24:07.720] Every instance in every case where that happened. It led to terrible disaster grief
[01:24:08.360 --> 01:24:10.040]  and trouble for
[01:24:10.040 --> 01:24:12.040]  for millions of people
[01:24:12.200 --> 01:24:17.400] So I knew that I was heading for a malpractice lawsuit if I continued to practice
[01:24:19.000 --> 01:24:20.360]  Excuse me
[01:24:20.360 --> 01:24:24.120] And uh already my insurance payments were seventy five thousand dollars a year
[01:24:24.840 --> 01:24:27.080] Uh, which by the way at that time
[01:24:27.080 --> 01:24:32.760] Uh, we're talking about 1998 was the insurance premium for a brain surgeon
[01:24:33.800 --> 01:24:34.840]  Okay
[01:24:34.840 --> 01:24:39.160] So uh to tell people what they should and should not buy in the stock market
[01:24:39.640 --> 01:24:41.640] I had to pay the same malpractice
[01:24:42.440 --> 01:24:44.440]  insurance premium as a brain surgeon
[01:24:44.920 --> 01:24:51.160] And with the repeal of Glass-Steagall and at the same time what very few people understood was that the government
[01:24:51.800 --> 01:24:54.120] had authorized the treasury department then
[01:24:54.120 --> 01:24:59.240] to make secret transactions of any size and of any nature that it shows
[01:24:59.800 --> 01:25:02.520] Which meant very simply that the entire stock market was rigged
[01:25:03.240 --> 01:25:04.680]  from beginning to end
[01:25:04.680 --> 01:25:07.960] And I just threw up my hands and said hey, I'm too old. I don't need to do this
[01:25:08.040 --> 01:25:13.000]  I've got a half a dozen different professionals that I can I can pursue. I don't have to do this
[01:25:13.640 --> 01:25:15.080]  and I didn't
[01:25:15.080 --> 01:25:17.080]  but
[01:25:17.720 --> 01:25:22.760] Through all those years of the for the for the most part, I do not sue the lawyer from judges
[01:25:22.760 --> 01:25:27.880] I have a student a number of them and I have gotten judges kicked off the bench
[01:25:28.520 --> 01:25:30.280]  and so forth, but
[01:25:30.280 --> 01:25:35.480] That's not my primary goal. I just like I really hate shakedown artists and con men with a passion
[01:25:36.200 --> 01:25:38.200]  and a particular kind I've
[01:25:38.280 --> 01:25:40.280]  um, I've always been
[01:25:41.000 --> 01:25:45.560] Really annoyed with people who say oh, you're such a genius. I have heard this
[01:25:46.280 --> 01:25:48.760] From as long as I can remember as a child
[01:25:48.760 --> 01:25:55.400] And it is absolutely meaningless to me. Yes, I have a 95,000 word vocabulary only in English and you you know
[01:25:55.400 --> 01:25:58.600] That doesn't even do with my other languages and all the rest of that stuff
[01:25:59.400 --> 01:26:01.400]  But that's not the way I live
[01:26:01.960 --> 01:26:06.760] I in all my life. I have never had one close friend who was college educated not one
[01:26:07.720 --> 01:26:12.200] In my entire life and I don't screen and I'll say oh you have a college degree. You can't be my friend
[01:26:12.200 --> 01:26:16.760] That's not what's going on. What's going on is what kind of people there are
[01:26:16.760 --> 01:26:20.600] There are people who connect to other people and there are people who don't
[01:26:21.320 --> 01:26:26.440] They just don't I don't know why they don't I have one of my just one of my degrees is in psychology
[01:26:26.520 --> 01:26:34.760] I don't know why they don't they just don't and what I've discovered is the people who are especially gifted in language
[01:26:36.040 --> 01:26:39.640] Living their heads and I'm talking now about lawyers and accountants
[01:26:40.440 --> 01:26:43.160] Uh in particular because I'm also an accountant
[01:26:43.160 --> 01:26:48.600] I don't know as I've gone into the lion's den and I beat the lions at their own game
[01:26:49.400 --> 01:26:51.400]  and
[01:26:51.400 --> 01:26:55.320] Another of my my specialties because I'm just interested. I never watched television
[01:26:55.320 --> 01:27:01.080] I watched television my whole life. I just initiated things and so I study them one of the things I say was epistemology
[01:27:01.720 --> 01:27:04.040]  and what I've discovered is that
[01:27:05.240 --> 01:27:10.680] That's the theory of knowledge and what I discovered is these people get locked up in their prefrontal lobes
[01:27:10.680 --> 01:27:15.000] That the whole world is to them just nothing but ideas
[01:27:15.800 --> 01:27:19.000] The reason they don't connect with other people they don't feel they think
[01:27:20.600 --> 01:27:23.000] And what really drives me right up the wall
[01:27:23.960 --> 01:27:27.560] Is it you know all the people that I have really loved in all my life?
[01:27:29.000 --> 01:27:31.000] Uh people that I would die for
[01:27:32.600 --> 01:27:38.920] We're just ordinary people. Maybe they had an 800 word or a thousand word a 1200 word vocabulary
[01:27:38.920 --> 01:27:44.040] But there's the greatest people on the face who hear it. They would give you anything. They would do anything for you
[01:27:44.040 --> 01:27:46.040]  They wouldn't harm anybody
[01:27:46.680 --> 01:27:47.720]  Um
[01:27:47.720 --> 01:27:54.440] Because they didn't have a mean bone in their body and here these people are being ruthlessly exploited by these verbal compulsive idiots
[01:27:55.880 --> 01:28:04.200] And so when I when I come across a lawyer or a judge let alone an entire court system yet here in big spring, Texas
[01:28:04.200 --> 01:28:11.000] And the entire court system is set up by a a core family of corrupt lawyers
[01:28:11.640 --> 01:28:16.440] Uh who have taken over the whole court for the purpose of ruthlessly exploiting the whole town
[01:28:17.080 --> 01:28:23.880] Ruthlessly exploiting it and I'm talking about everything that you heard Alex Jones to talk about Eddie yesterday and the day before
[01:28:24.200 --> 01:28:28.520] when in connection with this Penn State scandal with the sexual exploitation of boys
[01:28:28.520 --> 01:28:34.440] And all every every sort of corruption that you can imagine drug dealing manufacturing distribution
[01:28:34.760 --> 01:28:38.440] All that goes on here in this little town. We have we have 8,000
[01:28:39.080 --> 01:28:40.840]  TV installations
[01:28:40.840 --> 01:28:46.760] Which can tell you, you know, if there's two what 2.5 people per family, you know, that's that's how many two we've got a fewer than
[01:28:47.160 --> 01:28:50.120] 20,000 people in this town and we are one of the major
[01:28:50.840 --> 01:28:55.240] methamphetamine re-packaging and distribution centers in the southwestern united states
[01:28:55.240 --> 01:29:00.600] Okay, Al. I hate to interrupt you. We've got about a minute left before we go to the break
[01:29:01.160 --> 01:29:05.080] Is there something that you actually need to ask a question or anything about what we're talking about?
[01:29:05.080 --> 01:29:09.560] Because we do have a full caller board on this and we really need to get some more of these guys off here
[01:29:09.560 --> 01:29:11.960] So we can get more callers in the outages
[01:29:12.040 --> 01:29:18.280] What I'm pointing out is is that just this there is a completely different approach to what you do
[01:29:18.920 --> 01:29:22.040]  I wouldn't touch criminal law with a 10 foot pole. I won't go into it
[01:29:22.040 --> 01:29:26.360] But there's a completely different approach to it and that an important part of the law
[01:29:26.760 --> 01:29:29.720] For the people who are calling is not to help you be a traffic ticket
[01:29:30.200 --> 01:29:35.560] The important part of the rule of law is that it creates a society that's decent to live in
[01:29:36.200 --> 01:29:43.720] And that's the way I encourage you to listen to randy and ed and and the other people who come in as guest speakers
[01:29:44.280 --> 01:29:46.280] How does the rule of law?
[01:29:46.680 --> 01:29:48.680] And making sure it gets followed
[01:29:48.680 --> 01:29:53.880] Create a really good society for us. That's it. Thank you guys. Yes, sir. All right folks
[01:29:53.880 --> 01:29:58.040]  We'll be right back after this break 512 646 1984
[01:29:59.800 --> 01:30:03.960] Top 10 reasons to question the official story of the Oklahoma City bombing reason number 10
[01:30:04.360 --> 01:30:05.800] What is on the surveillance tapes?
[01:30:05.800 --> 01:30:08.840] There were many video surveillance cameras that recorded the morning of the bombing
[01:30:09.080 --> 01:30:13.080] Yet the few of these that have been released do not show what transpired with the rider truck at the Murrow building
[01:30:13.080 --> 01:30:18.440] Most recently the government has claimed that all of the cameras that were in different buildings and maintained by different businesses
[01:30:18.600 --> 01:30:21.880] We're all having their tapes changed at the exact same time 902 a.m
[01:30:22.280 --> 01:30:27.400] This is insulting to the memory of those who perish in the bombing. What is being hidden from us for more information?
[01:30:27.400 --> 01:30:29.400]  Please go to okcbombingtruth.com
[01:30:33.080 --> 01:30:37.320] What would you do if you ran into a pack of wolves on your way home from work?
[01:30:37.320 --> 01:30:44.760] I'm Dr. Catherine Albrecht. I'll tell you how one brave 13 year old boy scared away four big bad wolves right after this
[01:30:45.960 --> 01:30:50.840] Privacy is under attack. When you give up data about yourself, you'll never get it back again
[01:30:51.160 --> 01:30:55.480] And once your privacy is gone, you'll find your freedoms will start to vanish too
[01:30:55.960 --> 01:31:00.840] So protect your rights. Say no to surveillance and keep your information to yourself
[01:31:00.840 --> 01:31:07.000] Privacy it's worth hanging on to this public service announcement is brought to you by startpage.com
[01:31:07.240 --> 01:31:13.240] The private search engine alternative to google yahoo and bin start over with start page
[01:31:14.840 --> 01:31:19.640] Imagine you're walking down a country road when suddenly you're surrounded by hungry wolves
[01:31:19.960 --> 01:31:25.720] Should you play dead wave your arms try and fight? Well, I probably try to run and turn into dinner
[01:31:25.720 --> 01:31:32.760] But let me tell you what 13 year old Walter Icrem of Rockestad Norway did when he came face to face with four
[01:31:33.000 --> 01:31:35.880] Count them four big bad wolves on his way home from school
[01:31:36.040 --> 01:31:38.760] He aimed his cell phone at him and cranked up the volume
[01:31:39.160 --> 01:31:43.080] The phone had been playing hard rock and the wolves apparently were not fans
[01:31:43.320 --> 01:31:47.720] They cringed and then trotted away and Walter hightailed at home without a scratch
[01:31:47.960 --> 01:31:51.480] It's another kid versus wolf story. This one with a happy ending
[01:31:51.480 --> 01:31:56.440] I'm Dr. Catherine Albrecht more news and information at CatherineAlbrecht.com
[01:32:21.480 --> 01:32:33.480] All right folks, we are back. This is rule of law radio Randy Kelton, Kevin Stevens, Eddie Craig
[01:32:34.920 --> 01:32:39.960] Just to let you know Al, I have seen your email. I have not had a chance to read it as of yet
[01:32:40.440 --> 01:32:44.600] I have gotten over two dozen email responses from my parents on alex yesterday
[01:32:44.680 --> 01:32:47.080] So I'm trying to get through these as quickly as I can
[01:32:47.080 --> 01:32:53.640] But I've also got dozens of emails from people that I'm working with regularly on their traffic ticket and other case situations
[01:32:53.960 --> 01:32:59.320] So please be patient and bear with me folks. I am getting this information out just as fast as I can
[01:33:00.200 --> 01:33:07.640] I do have several lawyers and law enforcement officers that have written in requesting a copy of the seminar book and things
[01:33:08.120 --> 01:33:13.560] And I am getting those wrapped up and sent out as quickly as I can as well to those folks
[01:33:13.560 --> 01:33:19.240] Right now, Randy, you had a comment you wanted to make as well as I was going to be able to allow
[01:33:19.880 --> 01:33:25.160] Yeah, a quick comment about making this a better place
[01:33:26.440 --> 01:33:32.600] It is my position that if you don't know where you're going, you will probably wind up somewhere else
[01:33:33.640 --> 01:33:39.320] And in everything I do, I always know precisely where I'm going
[01:33:39.320 --> 01:33:45.640] Now everything I do before the courts or any of these in any court at all
[01:33:46.360 --> 01:33:50.760] I always have one thing in mind and that is it is my purpose
[01:33:51.480 --> 01:33:54.840] To place every judge in the country in a position such that
[01:33:55.640 --> 01:34:01.240] When he steps up behind the bench and looks out across the bar at the gallery, I want him wondering which one
[01:34:02.040 --> 01:34:06.520] Which one of those scoundrels out there in the gallery and waiting for me to render a ruling
[01:34:06.520 --> 01:34:10.120] He doesn't like so he can run down to the grand jury or to the state
[01:34:11.080 --> 01:34:14.040] Commission on judicial conduct and try to get me thrown out office
[01:34:15.320 --> 01:34:18.840] Thomas Jefferson said when the people fear the government there is tyranny
[01:34:19.560 --> 01:34:22.360] When the government fears the people there is liberty
[01:34:23.720 --> 01:34:25.720] If we go in from that perspective
[01:34:26.600 --> 01:34:31.240] And not from the perspective of how can I get out of this? How can I beat what's going on?
[01:34:32.120 --> 01:34:34.520]  How can I especially how can I find an
[01:34:34.520 --> 01:34:36.520]  Easy road around
[01:34:38.040 --> 01:34:39.720]  We do that
[01:34:39.720 --> 01:34:45.800] We will be buying into what is already going on this corruption is nothing new
[01:34:46.200 --> 01:34:48.200]  It's always been there
[01:34:48.760 --> 01:34:56.200] It always will be and it will always be our duty to stand up and do something about it
[01:34:57.160 --> 01:34:59.160]  That's the story and I'm sticking to it
[01:34:59.160 --> 01:35:07.880] Okay, we have some new callers. I see you Julius and Barrett and we will get to you
[01:35:07.960 --> 01:35:10.760] But we always like to take the new callers first
[01:35:11.400 --> 01:35:14.280] So we're going to go to Samir in Texas
[01:35:15.000 --> 01:35:16.680]  Did I pronounce that right?
[01:35:16.680 --> 01:35:18.520] Yes, Randy. How you doing?
[01:35:18.520 --> 01:35:20.520]  I am doing well
[01:35:21.160 --> 01:35:22.840]  I'm uh
[01:35:22.840 --> 01:35:27.480] The purpose of my call today is that I have a tribe coming up on a speeding ticket
[01:35:27.480 --> 01:35:30.040]  And I wasn't sure which
[01:35:31.640 --> 01:35:35.880] Which books should I study to be prepared for this?
[01:35:36.920 --> 01:35:38.920] Okay, you have a trial coming up when?
[01:35:39.640 --> 01:35:42.280]  Uh, they haven't sent me a letter yet
[01:35:43.320 --> 01:35:47.800] Okay, first thing I'd recommend you do then if you don't have an actual trial date set
[01:35:47.960 --> 01:35:53.400] Is start coming to the sunday seminar classes if you're in austin. I am in austin. Yes, okay
[01:35:53.400 --> 01:35:58.920] We have a sunday class from two to five which usually runs two to six at brave new books
[01:35:59.160 --> 01:36:05.960] The first class is free and what we do is go over what you do in court and why you do it
[01:36:06.600 --> 01:36:11.480] Speeding tickets are relatively easy. The reason they're easy is one
[01:36:12.120 --> 01:36:17.320] You need to go read texas transportation code section 201.904
[01:36:17.320 --> 01:36:22.600] That tells you what speed signs in texas actually apply to
[01:36:23.400 --> 01:36:30.920] They are the only thing that gives notice to the general public as to what the general speed is
[01:36:31.240 --> 01:36:36.120] The prima facie speed is actually on a particular section of roadway
[01:36:37.320 --> 01:36:40.520] You'll find it very interesting. What is in that section?
[01:36:40.520 --> 01:36:50.680] The other two sections you need is 545.351 and 545.352 of the texas transportation code
[01:36:51.480 --> 01:36:56.440] 351 is something you need to know because that is the statute that deals with
[01:36:57.160 --> 01:37:02.760] Uh, a speed other than reasonable and prudent under the circumstances that existing
[01:37:03.560 --> 01:37:07.240] If that is entered into the complaint, which it must be
[01:37:07.240 --> 01:37:15.640] Then one of the elements they must prove at trial is that your speed was neither reasonable nor prudent
[01:37:16.200 --> 01:37:20.120] The only way they can do that as I was telling the gentleman from Missouri
[01:37:20.680 --> 01:37:25.960] Is if they can show that there was damage to persons or property
[01:37:26.840 --> 01:37:28.840] That's the only way they can prove
[01:37:29.400 --> 01:37:31.800] Other than was reasonable and prudent
[01:37:32.680 --> 01:37:34.520]  Okay, okay
[01:37:34.520 --> 01:37:36.040]  so
[01:37:36.040 --> 01:37:42.600] What we do in this case is we don't cross examine anybody. We don't do anything of the sort
[01:37:43.320 --> 01:37:45.720]  We only make a particular objection
[01:37:46.360 --> 01:37:51.720] Every time they use a term out of the transportation code that is vehicle
[01:37:52.520 --> 01:37:56.360]  license or driver's license drive operate
[01:37:57.560 --> 01:38:03.800] Uh transportation or this state if any of those terms get used
[01:38:03.800 --> 01:38:09.480] Then you object to it the objection goes like this
[01:38:10.440 --> 01:38:14.440] Objection assumes facts not in evidence
[01:38:15.240 --> 01:38:17.240]  Not agreed to
[01:38:17.480 --> 01:38:21.560] And requires a legal conclusion by the fact witness
[01:38:22.200 --> 01:38:26.200] The reason for that is every single one of those terms
[01:38:26.200 --> 01:38:35.160] Is specially defined in the statute the prosecution is making no attempt to educate the jury on what those special meanings are
[01:38:36.280 --> 01:38:43.240] Therefore he is leaving it up to the jury to make a particular presumption about their meaning
[01:38:44.680 --> 01:38:50.360] That is denying you and your right of due process because what the jury is presuming
[01:38:51.080 --> 01:38:53.880] Is not the definition that applies in law
[01:38:53.880 --> 01:38:59.160] Therefore the presumption is harmful to you as the defense
[01:38:59.800 --> 01:39:06.280] So we object to the use of those terms without those terms being properly spelled out for the jury
[01:39:06.680 --> 01:39:11.320] Indirect correlation with the other law surrounding their use
[01:39:12.280 --> 01:39:14.280]  All right, okay
[01:39:14.280 --> 01:39:15.400]  now
[01:39:15.400 --> 01:39:21.560] While you're objecting to any testimony or questions that involve those terms
[01:39:21.560 --> 01:39:23.560] Once the trial is over
[01:39:23.960 --> 01:39:29.080] You immediately stand up after the prosecution has says the state rests
[01:39:29.880 --> 01:39:31.880] And you're going to say the following
[01:39:33.080 --> 01:39:36.280]  Defense I move the court for a
[01:39:37.080 --> 01:39:39.080]  Directed verdict in
[01:39:39.080 --> 01:39:45.640] Of the defense the prosecution has failed to prove all the necessary elements of its case
[01:39:45.960 --> 01:39:47.960]  They never proved
[01:39:47.960 --> 01:39:51.960] Never proved the reasonable and prudent
[01:39:53.080 --> 01:39:57.880] They never offered any evidence of any harm to persons or property
[01:39:58.280 --> 01:40:03.160] That is a required element. It's listed in the complaint. They never proved it
[01:40:03.720 --> 01:40:06.040]  Therefore they're dead in the water
[01:40:06.760 --> 01:40:13.080] Any offense they charge you with may have more than one necessary element that is required to be proven
[01:40:13.720 --> 01:40:15.720]  They must prove them
[01:40:16.200 --> 01:40:17.480]  all
[01:40:17.480 --> 01:40:22.200] Not one or two out of five. They must prove them all
[01:40:24.120 --> 01:40:26.920] They never prove reasonable and prudent
[01:40:30.840 --> 01:40:35.640] Got it. Yes. Thank you. Okay. I'll be there. I'll be there sunday and
[01:40:37.080 --> 01:40:44.920] Thanks. Thanks for all your help and uh, randy. I'm I'm uh, I'm also, you know, taking up my mortgage company
[01:40:44.920 --> 01:40:50.760] We your company have determined that there is fraud on my loan. So we're in the middle of
[01:40:51.400 --> 01:40:55.080] Doing something about that to let you know how it goes
[01:40:56.760 --> 01:40:59.640] Wonderful wonderful the more we can stop the better
[01:41:00.360 --> 01:41:01.480]  Yes
[01:41:01.480 --> 01:41:07.480] Well, thank you guys. I appreciate you and we'll talk soon. Thanks for your time. All right, Samir. Thanks for calling in
[01:41:07.560 --> 01:41:11.480] Great. We appreciate it. You bet. Bye. Bye. Bye. Bye. All right
[01:41:11.480 --> 01:41:17.640] All right. Now we are going to go to kevin in hawaii kevin. Evening. What can we do for you?
[01:41:18.280 --> 01:41:20.040]  Hey guys, how's it going?
[01:41:20.040 --> 01:41:21.640]  Great so far
[01:41:21.640 --> 01:41:23.640]  good, um, okay, so
[01:41:24.600 --> 01:41:27.400] A few weeks ago probably about like three weeks ago. I mentioned, um
[01:41:28.360 --> 01:41:33.480] My son had a run-in with um one of the police officers here
[01:41:34.120 --> 01:41:37.880] And I happened to be fortunately across the street
[01:41:37.880 --> 01:41:45.320] Uh, probably a good 75 yards away and I could hear the officers screaming at my child
[01:41:45.800 --> 01:41:48.120]  Um, and so I walked
[01:41:48.920 --> 01:41:55.080] Over I didn't actually physically cross the street, but I just kind of like stood on the sidewalk and said, hey, is there a problem here?
[01:41:55.080 --> 01:41:57.800] He says, well, yeah, your kid was skateboarding then
[01:41:58.440 --> 01:42:00.120]  um
[01:42:00.120 --> 01:42:07.400] You know, he that's against the law and he could be cited for it and um, he was blocking traffic and uh,
[01:42:09.080 --> 01:42:13.400] I basically told the officer at that point because he was pulled over on the side of the road
[01:42:13.800 --> 01:42:17.320] And the bicycle waned without his emergency lights on or anything
[01:42:17.880 --> 01:42:20.840] Um and said, well, you know at this point you're also a hazard
[01:42:21.480 --> 01:42:23.480]  and the officer light
[01:42:23.720 --> 01:42:25.720]  threw his hands up
[01:42:25.720 --> 01:42:30.600] Slammed his door open slams the door closed and runs over to me
[01:42:31.240 --> 01:42:34.600] And my kid at this time was also walking across the street
[01:42:35.240 --> 01:42:40.360] Um, and he says, well, we're just I'm just going to go ahead and fight your kid and um
[01:42:41.320 --> 01:42:45.160] We'll just let a judge handle it and I said, well, you know, first of all
[01:42:45.160 --> 01:42:50.680] I don't believe that you've uh established jurisdiction at this point and he says, well, what do you mean?
[01:42:50.680 --> 01:42:56.280] I said, well, I mean you you have to you know establish jurisdiction and he immediately
[01:42:56.600 --> 01:43:02.920] I know he knew what I was talking about because then he immediately turned to my kid and asked him what his name was
[01:43:03.640 --> 01:43:05.640]  And I said do not answer
[01:43:06.040 --> 01:43:09.960] Do not answer and the officer grabbed my kid
[01:43:10.920 --> 01:43:16.680] Slung him around snatched the skateboard out of his hand and I told the officer I said you release my child
[01:43:17.160 --> 01:43:19.000]  that is assault
[01:43:19.000 --> 01:43:22.840] And then he turned actually it's aggravated assault if he's carrying a gun
[01:43:24.120 --> 01:43:27.800] Yes, yeah, that's what that's what I put into the complaint form, but um
[01:43:29.320 --> 01:43:31.800] Then he turned at me
[01:43:32.360 --> 01:43:37.240] I'm okay. Hang on kevin. We're about to go to break hold that thought and we'll get back with you on the other side

[01:46:27.800 --> 01:46:29.800]  I
[01:46:37.880 --> 01:46:40.440] Right now we are talking to kevin in hawaii
[01:46:41.000 --> 01:46:46.120] All right, kevin. Let's see what we can wrap up here the officer committed aggravated assault against your son
[01:46:46.200 --> 01:46:48.200]  He grabbed him took a skateboard
[01:46:48.680 --> 01:46:52.440] All because he allegedly was skateboarding and impeding traffic
[01:46:52.440 --> 01:46:59.880] Which the officer was doing himself with his park cruiser with no emergency lighting activated. So please pick that up and let's go on with it
[01:47:00.440 --> 01:47:04.680] Okay, perfect. Um, so then after I told the officer to release my child
[01:47:05.320 --> 01:47:08.840] He turns to me and I was probably a good six seven year way
[01:47:08.840 --> 01:47:13.400] I wasn't moving towards him or anything and he turns at me with his tazer pointed at me
[01:47:13.960 --> 01:47:15.960] And told me that I was going to be tazed
[01:47:17.080 --> 01:47:20.600] And I turned around and said well, you're going to have to taze me in the back
[01:47:20.600 --> 01:47:28.280] At this point and then I had probably three or four friends there and I said everybody get your video cameras out and start
[01:47:29.000 --> 01:47:32.200] videoing this this officer this incident and
[01:47:33.000 --> 01:47:35.000] Everybody pulls now and the cop
[01:47:35.560 --> 01:47:43.000] Puts his tazer away and then the meeting please tell me they activated their cameras before he got the tazer put away
[01:47:44.360 --> 01:47:46.360] Uh, no, they did not
[01:47:46.360 --> 01:47:53.320] Okay, that's all right though. You've got three verifiable witnesses who all they have to do is fill out affidavits of the incident
[01:47:53.560 --> 01:47:57.720] I'd immediately charge the officer with excessive use of force
[01:47:58.440 --> 01:48:05.400] I tried to I tried to um, the officer then said if you want to skateboard back you have to come down to the uh
[01:48:05.880 --> 01:48:09.480] Um substation and pick it up. No problem. We're on our way
[01:48:09.880 --> 01:48:13.480] So we went down there and I figured while we were down there. I just go ahead and file
[01:48:13.480 --> 01:48:17.240] Um a complaint against the officer and with who?
[01:48:18.360 --> 01:48:20.600] against the officer and with who?
[01:48:22.280 --> 01:48:24.600] I'm sorry. Who did you complain to?
[01:48:25.320 --> 01:48:27.160] Oh, well at first, um
[01:48:27.160 --> 01:48:31.720] It was a written complaint and a female officer came out and reviewed the complaint
[01:48:32.520 --> 01:48:37.160] Okay, here's here's the problem. All you did was complain
[01:48:37.800 --> 01:48:39.800]  You didn't write a complaint
[01:48:39.800 --> 01:48:45.000] You need to write your own criminal complaint or go to a prosecuting attorney
[01:48:45.400 --> 01:48:48.840] And demand that he take your written verified statement
[01:48:49.720 --> 01:48:57.640] And press the proper charges if he won't do it then find out what the format for a complaint is in hawaii
[01:48:58.120 --> 01:49:05.880] Write one yourself and take it directly to the grand jury in your area and file it directly with them yourself
[01:49:05.880 --> 01:49:09.880]  Or just go to juristimprudence.com
[01:49:11.240 --> 01:49:17.080] And there's a bunch of frogs on there because I call all of this mess the frog farm conspiracy
[01:49:17.800 --> 01:49:20.360]  That's jurist j u r i s
[01:49:21.000 --> 01:49:22.280]  imprudence
[01:49:22.280 --> 01:49:25.240]  i m p r u d e n c e dot com
[01:49:26.120 --> 01:49:34.360] And top frog on the on the right is documents and research click on blanks and go down to complaint
[01:49:34.360 --> 01:49:36.360] Now that complaint is written for
[01:49:36.680 --> 01:49:40.680] Texas but you can change Texas to hawaii
[01:49:41.560 --> 01:49:44.840] And file it you make up the complaint
[01:49:46.120 --> 01:49:52.520] And you can look in the folders where I have some written up. You can see how I write up the complaint
[01:49:53.960 --> 01:49:57.000] Then take it to a note or you can have it verified
[01:49:57.480 --> 01:49:59.480]  I did
[01:49:59.480 --> 01:50:07.400] All right, because if you file a volunteer statement with the police department, that's just complaining
[01:50:07.720 --> 01:50:13.320] But when you file a verified criminal affidavit that invokes a specific legal duties
[01:50:13.880 --> 01:50:18.920] Yeah, I actually filed something with internal affairs, but I don't think it ever went to internal affairs
[01:50:18.920 --> 01:50:22.120] Um, and then I got a call back from the lieutenant
[01:50:22.840 --> 01:50:27.480] Um, and he brought me into his you know into the break room area
[01:50:27.480 --> 01:50:31.480] And then I started questioning my child and myself and uh
[01:50:32.120 --> 01:50:38.200] I basically told him that you know that the officer you know over stuff is you know boundaries
[01:50:38.200 --> 01:50:43.880] My child has the right to travel and the cops was like, oh no, no, he doesn't you know
[01:50:43.880 --> 01:50:49.400] But uh Hawaiian statutes, you know say that you know he broke the law this officer did nothing wrong
[01:50:49.640 --> 01:50:55.960] And I said well actually, you know, there's there's higher court rulings saying that we have a right to travel across
[01:50:55.960 --> 01:50:58.600] We have a right to travel a common law right to travel
[01:50:59.160 --> 01:51:04.840] And um, he says well, I don't I don't you know uphold the laws but the constitution
[01:51:05.640 --> 01:51:07.640] Uh, Kevin, let me interrupt you for one second
[01:51:07.640 --> 01:51:12.920] Was the officer attempting to charge your son under statute or was he attempting to charge him under ordinance?
[01:51:13.640 --> 01:51:20.040] I he never said he never said he just said that he was going to cite my child and the judge will handle it
[01:51:20.040 --> 01:51:28.840] So almost always skateboarding will fall under an ordinance rather than a statute because it's local to a municipality
[01:51:29.240 --> 01:51:34.040] Okay, that's where that's where the code is actually at is under the municipal code
[01:51:34.520 --> 01:51:39.240] Okay, if it's municipal code, it is ordinance. Here's the deal about ordinances
[01:51:39.880 --> 01:51:43.800] Hawaii has a state constitution just like texas and every other state
[01:51:43.800 --> 01:51:51.400] The Hawaiian constitution if you will look it up under whatever section of it deals with the legislative branch
[01:51:51.960 --> 01:51:53.960] There should be a section in there that says
[01:51:54.760 --> 01:51:59.400] All laws in hawaii are to be enacted by the legislature
[01:52:00.280 --> 01:52:02.120]  okay
[01:52:02.120 --> 01:52:05.320] Only the legislature can create law
[01:52:06.920 --> 01:52:10.760] You may also have a section in there just like we do in texas. It says
[01:52:10.760 --> 01:52:19.080] All laws must have the following enacting clause being enacted by the state of texas or the legislature of the state of texas
[01:52:20.200 --> 01:52:24.600] Okay, if if the law does not have that enacting clause
[01:52:25.080 --> 01:52:27.240] It is not originated by bill
[01:52:27.480 --> 01:52:30.760] It is not originated in one of the two houses of the legislature
[01:52:31.000 --> 01:52:34.840] It is not reviewed on the floor over three several days by each house
[01:52:34.840 --> 01:52:41.720] It is not voted out of each house by a vote of the legislature and it's not signed by the governor
[01:52:42.120 --> 01:52:46.840] It is not as far as the texas constitution is concerned
[01:52:47.400 --> 01:52:49.400]  It is a rule
[01:52:49.640 --> 01:52:55.800] And a rule can only be directory on the people it cannot be mandatory
[01:52:56.520 --> 01:53:02.600] In other words a rule simply says we would prefer it if you did it this way
[01:53:02.600 --> 01:53:09.080] But it cannot be applied as you will do it this way or else
[01:53:10.440 --> 01:53:16.920] Because we did not grant law making authority to the municipalities and the counties
[01:53:18.360 --> 01:53:20.860] Only to the state legislature
[01:53:21.720 --> 01:53:23.720]  okay
[01:53:24.600 --> 01:53:31.720] Okay, and um also the officer told me I said well you swore an oath to the constitution of the united states and he says well
[01:53:31.720 --> 01:53:36.760] No, I did not I swore an oath to the alliance state constitution fine
[01:53:37.000 --> 01:53:39.800] Then go get that and beating black and blue with it
[01:53:41.240 --> 01:53:45.880] Okay, well who would I you know take okay, let me make a suggestion here
[01:53:47.640 --> 01:53:50.280] Never make a complaint to the policing agency
[01:53:51.800 --> 01:53:54.600] They're just gonna no matter what you say to them
[01:53:54.600 --> 01:54:01.400] Uh, they will take everything you say and twist it around into something else if you talk to a
[01:54:02.120 --> 01:54:05.320] Policing agency about law and about your rights
[01:54:05.960 --> 01:54:10.360]  Now you're a sovereign now. You're some kind of sub subversive
[01:54:11.400 --> 01:54:13.880] I wouldn't talk to them at all take your complaint
[01:54:14.840 --> 01:54:16.840]  To a prosecuting attorney
[01:54:17.400 --> 01:54:18.680]  okay
[01:54:18.680 --> 01:54:26.520] And give him a verified criminal affidavit and insist that he act in accordance with his duties as a prosecuting attorney
[01:54:26.840 --> 01:54:33.480] In texas we have a specific statute addressing criminal complaints against public officials
[01:54:34.840 --> 01:54:39.160] But even if they don't have a specific statute in texas it says
[01:54:39.720 --> 01:54:41.080]  when a
[01:54:41.080 --> 01:54:46.280] Prosecuting attorney is made known that a public official has violated law related his office
[01:54:46.280 --> 01:54:49.480] He shall reduce the complaint to an information submitted to the grand jury now
[01:54:49.480 --> 01:54:54.920] That's paraphrase because the statute's a little bit longer than a a little convoluted, but that's what it tells it
[01:54:55.640 --> 01:54:58.440] Takes away any discretion he would have
[01:54:59.240 --> 01:55:01.240] But even if you don't have that
[01:55:01.800 --> 01:55:04.200] It is when you make the prosecuting attorney
[01:55:04.760 --> 01:55:11.000] You make it known to him that a crime has been committed. It's his duty to prosecute and if he elects not to prosecute
[01:55:11.000 --> 01:55:15.320] Then you file a criminal complaint against the prosecuting attorney
[01:55:16.600 --> 01:55:18.600]  accusing the prosecuting attorney
[01:55:19.800 --> 01:55:21.800]  Not of exercising
[01:55:23.640 --> 01:55:25.640]  Judicial discretion
[01:55:26.200 --> 01:55:33.160] Now i've never seen a state except pennsylvania that has that written into law where a prosecutor has discretion
[01:55:35.560 --> 01:55:37.560]  But
[01:55:37.560 --> 01:55:43.000] They give him discretion they the courts allow a certain amount of discretion anyway
[01:55:44.440 --> 01:55:46.440] And what you maintain is
[01:55:47.160 --> 01:55:48.440]  the
[01:55:48.440 --> 01:55:52.440] Prosecutor did not exercise judicial discretion
[01:55:53.400 --> 01:55:56.840] Instead he exercised judicial caprice
[01:55:57.640 --> 01:56:03.400] In that he decided who he wanted to prosecute and who he did not want to prosecute
[01:56:03.400 --> 01:56:11.160] Not whether or not there was sufficient problem because that's not a power in which he has it's a violated it's a breach of his
[01:56:11.800 --> 01:56:13.800]  his
[01:56:13.880 --> 01:56:19.000] fiduciary duty to you to grant me the equal protections of the law
[01:56:19.800 --> 01:56:23.080] And that's an act of official misconducting most every state
[01:56:23.560 --> 01:56:27.160] Look up official misconduct for hawaii. You'll almost certainly have it
[01:56:27.800 --> 01:56:31.640] Because the official misconduct statutes in the state
[01:56:31.640 --> 01:56:34.680] Follow the Ku Klux Klan Act
[01:56:35.560 --> 01:56:41.800]  Most people are familiar with 82 us code 19. I'm sorry 14 42 us code 1983
[01:56:42.200 --> 01:56:48.040] That's where you consume the public official. That's the second half of the Ku Klux Klan Act
[01:56:48.280 --> 01:56:52.440]  The first half is 18 us code 242
[01:56:53.320 --> 01:56:57.560] Which makes it a crime for a public official acting on the code of his authority
[01:56:57.560 --> 01:57:04.520] To exert a report to exert an authority. He does not expressly have or as in this case
[01:57:05.320 --> 01:57:09.000] Fail to perform the duty. He is required to perform
[01:57:09.960 --> 01:57:16.280] And if in the process he denies a citizen for free access to enjoyment of right that is a crime
[01:57:17.080 --> 01:57:19.080]  in most every state has a
[01:57:19.960 --> 01:57:23.000] official misconduct statute they have to because
[01:57:23.000 --> 01:57:29.320] Public officials people are drawn into these positions of apparent power
[01:57:31.000 --> 01:57:36.520] Some not all for reasons that should keep them out of those positions
[01:57:37.000 --> 01:57:40.440] And they tend to abuse them so to protect themselves
[01:57:41.000 --> 01:57:43.960] The other public officials have to have tools to weed these
[01:57:45.400 --> 01:57:49.000] Really crazy guys out of there. So everybody will have that one
[01:57:49.000 --> 01:57:52.440] Then you make a criminal complaint against the prosecuting attorney
[01:57:54.040 --> 01:57:55.080]  Now
[01:57:55.080 --> 01:58:00.760] What we say is is you will not win your case because you have the law and the facts on your side
[01:58:01.800 --> 01:58:03.800] To think so is naive
[01:58:03.880 --> 01:58:05.880]  You'll only win your case
[01:58:05.880 --> 01:58:10.840] If you have the politics on your side and when you start hammering the prosecuting attorney
[01:58:11.560 --> 01:58:14.920]  You're going to generate yourself a little local politics
[01:58:14.920 --> 01:58:22.200] He is not going to be a happy camper when he gets back to this police officer who's got it in this spot
[01:58:23.080 --> 01:58:25.080]  Okay
[01:58:24.680 --> 01:58:33.160] Okay, do you have anything else for us? No, actually that's it pretty much. Um, and is there any way to uh pursue this civilly?
