[04:01.000 --> 04:05.000]  about what has transpired in this past week.
[04:05.000 --> 04:12.000]  To put it mildly, this is absolutely the most criminal thing
[04:12.000 --> 04:15.000]  I have ever seen, almost.
[04:15.000 --> 04:22.000]  A county court at law in this great state of Texas do.
[04:22.000 --> 04:26.000]  But on this past Monday, Randy went down for his trial
[04:26.000 --> 04:30.000]  in Cherokee County at the county court at law.
[04:30.000 --> 04:34.000]  He was charged with operating an investigations company
[04:34.000 --> 04:36.000]  without a license.
[04:36.000 --> 04:47.000]  Now, that statute is 1702.104 of the Texas Occupations Code.
[04:47.000 --> 04:49.000]  When you go and look at that statute,
[04:49.000 --> 04:53.000]  it clearly states that part of the elements of the offense
[04:53.000 --> 05:00.000]  are that you must be engaged in the business of
[05:00.000 --> 05:07.000]  or working in the occupation of a private investigator
[05:07.000 --> 05:12.000]  or someone that is providing security services.
[05:12.000 --> 05:16.000]  And up in the 17 beginning of the chapter there,
[05:16.000 --> 05:20.000]  it gives you the definitions of what these terms are.
[05:20.000 --> 05:24.000]  Well, these individuals in Cherokee County
[05:24.000 --> 05:27.000]  completely prostituted the definitions
[05:27.000 --> 05:29.000]  they used against Randy in court.
[05:29.000 --> 05:33.000]  They did not even begin to use the words and terms
[05:33.000 --> 05:35.000]  as they're defined in the statute.
[05:35.000 --> 05:38.000]  Instead, they defined them separately and individual
[05:38.000 --> 05:42.000]  from law dictionaries rather than use the terms
[05:42.000 --> 05:45.000]  and phrases from the statutes.
[05:45.000 --> 05:48.000]  They did this so that they could create the illusion
[05:48.000 --> 05:51.000]  to the jury that Randy was doing something
[05:51.000 --> 05:54.000]  that the statute did not allow,
[05:54.000 --> 05:57.000]  when in fact the definitions in the statute
[05:57.000 --> 06:01.000]  proved conclusively that Randy was not guilty of anything.
[06:01.000 --> 06:04.000]  Now, let's top this off with a couple of other
[06:04.000 --> 06:08.000]  extremely criminal activities by this court.
[06:08.000 --> 06:13.000]  First and foremost, the judge was the very same judge
[06:13.000 --> 06:17.000]  that Randy had already filed criminal complaints
[06:17.000 --> 06:21.000]  against with the Cherokee County grand jury.
[06:21.000 --> 06:25.000]  Now, prior to Randy being charged with anything,
[06:25.000 --> 06:28.000]  Randy had gone to the Cherokee County grand jury
[06:28.000 --> 06:31.000]  with a list of criminal complaints against public officials.
[06:31.000 --> 06:33.000]  This judge was one of them.
[06:33.000 --> 06:39.000]  Yet, the head administrative judge, Ovard,
[06:39.000 --> 06:44.000]  over that district where Cherokee County is,
[06:44.000 --> 06:47.000]  refused to grant Randy's motion of recusal
[06:47.000 --> 06:51.000]  against this judge, Craig Fletcher,
[06:51.000 --> 06:54.000]  even though there was a conflict of interest
[06:54.000 --> 06:57.000]  because Randy had criminally accused this man
[06:57.000 --> 07:00.000]  before the Cherokee County grand jury.
[07:00.000 --> 07:05.000]  To top that off, Randy was entitled to a special prosecutor
[07:05.000 --> 07:08.000]  because he had also filed criminal charges
[07:08.000 --> 07:12.000]  against the county attorney for criminal conspiracy
[07:12.000 --> 07:15.000]  with Judge Craig Fletcher.
[07:15.000 --> 07:21.000]  Now, the county attorney is Craig Caldwell.
[07:21.000 --> 07:28.000]  On top of this, one of the state's star witnesses is Joe Evans.
[07:28.000 --> 07:32.000]  Joe Evans is the ex-Nacogdoches County sheriff
[07:32.000 --> 07:38.000]  that I used to work for and who I have good cause to believe
[07:38.000 --> 07:40.000]  is a bigger crook than anybody we ever had
[07:40.000 --> 07:43.000]  in the Nacogdoches County jail.
[07:43.000 --> 07:46.000]  He's gone out of his way since he's become the chief investigator
[07:46.000 --> 07:50.000]  over in Cherokee County working for these other two crooks
[07:50.000 --> 07:53.000]  to prove just how crooked he is.
[07:53.000 --> 07:58.000]  He is the one that filed the criminal complaints against Randy
[07:58.000 --> 08:03.000]  at the instigation of the prosecutor, Craig Caldwell,
[08:03.000 --> 08:06.000]  who maliciously and fraudulently told Joe Evans
[08:06.000 --> 08:11.000]  that Randy had committed a crime by going into
[08:11.000 --> 08:14.000]  the public records of the court,
[08:14.000 --> 08:19.000]  getting copies of the information from those public records,
[08:19.000 --> 08:24.000]  and then using them as evidence of a crime
[08:24.000 --> 08:26.000]  by these public officials.
[08:26.000 --> 08:28.000]  Now, do you get that?
[08:28.000 --> 08:31.000]  We have a group of public officials that says
[08:31.000 --> 08:39.000]  it is a crime in Texas to go through public records
[08:39.000 --> 08:42.000]  or any other records for that matter
[08:42.000 --> 08:46.000]  for the purpose of gathering evidence of criminal wrongdoing
[08:46.000 --> 08:49.000]  by a public servant.
[08:49.000 --> 08:54.000]  Now, when you read 1702.104,
[08:54.000 --> 08:58.000]  it's extremely clear that it applies only to someone
[08:58.000 --> 09:04.000]  that is operating a business for the purpose of compensation
[09:04.000 --> 09:09.000]  to conduct security services or investigative services.
[09:09.000 --> 09:16.000]  It does nothing in regards to a private individual
[09:16.000 --> 09:20.000]  getting this information for whatever purpose on their own
[09:20.000 --> 09:24.000]  without compensation from anybody.
[09:24.000 --> 09:28.000]  It has nothing to do with an individual that's not operating
[09:28.000 --> 09:33.000]  a business or selling those services to anybody.
[09:33.000 --> 09:38.000]  Yet, these three people colluded and criminally conspired
[09:38.000 --> 09:44.000]  in a trial to convict Randy Kelton of violating a law
[09:44.000 --> 09:47.000]  that doesn't even apply to him.
[09:47.000 --> 09:51.000]  Does this sound familiar to y'all that get traffic tickets?
[09:51.000 --> 09:55.000]  Now, this is a class A misdemeanor,
[09:55.000 --> 09:59.000]  which means they sentenced Randy to the maximum
[09:59.000 --> 10:03.000]  one year in the county jail in Cherokee County
[10:03.000 --> 10:08.000]  and a $4,000 fine.
[10:08.000 --> 10:13.000]  Now, there are numerous problems with this trial.
[10:13.000 --> 10:16.000]  We'll start with the very basics,
[10:16.000 --> 10:18.000]  and we just covered that the individuals
[10:18.000 --> 10:22.000]  that presided over his trial all had a conflict of interest
[10:22.000 --> 10:26.000]  in being associated with that trial.
[10:26.000 --> 10:28.000]  None of them should have been there.
[10:28.000 --> 10:33.000]  They were all immediately disqualified from being there
[10:33.000 --> 10:38.000]  because they had a vested outcome in that case,
[10:38.000 --> 10:42.000]  especially the judge and the prosecutor.
[10:42.000 --> 10:45.000]  Now, the other problem is,
[10:45.000 --> 10:49.000]  Texas law is extremely clear on what is required
[10:49.000 --> 10:52.000]  to charge an individual in a court of law
[10:52.000 --> 10:56.000]  to give that court of law jurisdiction.
[10:56.000 --> 11:02.000]  We have Article 5, Section 12, Bravo of the Texas Constitution,
[11:02.000 --> 11:04.000]  which clearly states that the only thing
[11:04.000 --> 11:07.000]  that vests a court with jurisdiction of a cause
[11:07.000 --> 11:11.000]  is an indictment or information.
[11:11.000 --> 11:16.000]  If you go to Chapter 21 of the Texas Code of Criminal Procedure,
[11:16.000 --> 11:22.000]  you see what's required for indictments and information.
[11:22.000 --> 11:24.000]  Okay?
[11:24.000 --> 11:29.000]  21.02 gives you what the requisites of an indictment are.
[11:29.000 --> 11:33.000]  Then 21.03 reads this way,
[11:33.000 --> 11:35.000]  what should be stated?
[11:35.000 --> 11:38.000]  Everything should be stated in an indictment
[11:38.000 --> 11:42.000]  that is necessary to be proved.
[11:42.000 --> 11:46.000]  That means that if the offense has five elements
[11:46.000 --> 11:48.000]  that they're required to prove,
[11:48.000 --> 11:52.000]  then what the issue is that violated that element
[11:52.000 --> 11:56.000]  must be in the charging instrument.
[11:56.000 --> 12:03.000]  The very prominent requirement in this is compensation for hire.
[12:03.000 --> 12:06.000]  Everything in the statute is based upon
[12:06.000 --> 12:11.000]  the activity being conducted for compensation or hire.
[12:11.000 --> 12:15.000]  Nothing in the information says a word
[12:15.000 --> 12:20.000]  about anything regarding compensation or hire.
[12:20.000 --> 12:24.000]  In fact, the two documents the states filed
[12:24.000 --> 12:28.000]  in no way whatsoever meet any aspect of law
[12:28.000 --> 12:31.000]  in Texas to be valid.
[12:31.000 --> 12:33.000]  Of the two documents they filed,
[12:33.000 --> 12:36.000]  an affidavit of probable cause.
[12:36.000 --> 12:39.000]  When you read the affidavit of probable cause,
[12:39.000 --> 12:42.000]  it says here by states the following facts
[12:42.000 --> 12:44.000]  against the accused.
[12:44.000 --> 12:46.000]  Guess what's not there?
[12:46.000 --> 12:48.000]  A single fact.
[12:48.000 --> 12:50.000]  It just simply says,
[12:50.000 --> 12:53.000]  Randall Kelton did operated investigations company
[12:53.000 --> 12:55.000]  without an investigator's license,
[12:55.000 --> 12:57.000]  and the following facts will show this to be true.
[12:57.000 --> 12:59.000]  And then there's no facts.
[12:59.000 --> 13:02.000]  None whatsoever.
[13:02.000 --> 13:07.000]  It doesn't accuse him of anything on a factual basis.
[13:07.000 --> 13:12.000]  Joe Evans signed that affidavit of probable cause.
[13:12.000 --> 13:17.000]  Craig Caldwell verified Joe Evans' signature
[13:17.000 --> 13:20.000]  on that affidavit of probable cause.
[13:20.000 --> 13:24.000]  Then Craig Fletcher, the judge in this case,
[13:24.000 --> 13:27.000]  signed that affidavit of probable cause
[13:27.000 --> 13:30.000]  as being sufficient probable cause
[13:30.000 --> 13:33.000]  to issue a warrant for Randy's arrest.
[13:33.000 --> 13:38.000]  And there's nothing in it setting probable cause.
[13:38.000 --> 13:41.000]  Nothing.
[13:41.000 --> 13:45.000]  Now here's their other problem.
[13:45.000 --> 13:48.000]  I can't get anyone to produce
[13:48.000 --> 13:52.000]  a criminal complaint out of the five.
[13:52.000 --> 13:55.000]  There doesn't appear to be one.
[13:55.000 --> 14:00.000]  This creates a significant problem for the jurisdiction of the court
[14:00.000 --> 14:04.000]  because without a signed and verified complaint,
[14:04.000 --> 14:08.000]  an information cannot exist.
[14:08.000 --> 14:10.000]  Don't believe that?
[14:10.000 --> 14:14.000]  Look at article 21.22, code of criminal procedure.
[14:14.000 --> 14:17.000]  Information based upon complaint.
[14:17.000 --> 14:21.000]  No information shall be presented until affidavit has been made
[14:21.000 --> 14:26.000]  by some credible person charging the defendant with an offense.
[14:26.000 --> 14:30.000]  The affidavit shall be filed with the information.
[14:30.000 --> 14:34.000]  It may be sworn to before the district or county attorney
[14:34.000 --> 14:38.000]  who for that purpose shall have the power to administer the oath.
[14:38.000 --> 14:42.000]  Or it may be made before any officer authorized by law
[14:42.000 --> 14:44.000]  to administer oaths.
[14:44.000 --> 14:48.000]  In Texas, a criminal complaint must run
[14:48.000 --> 14:51.000]  in and by the authority of the state of Texas
[14:51.000 --> 14:56.000]  and it must conclude against the peace and dignity of the state.
[14:56.000 --> 14:59.000]  Check chapter 15 of the code of criminal procedure
[14:59.000 --> 15:02.000]  and that will be shown to be true.
[15:02.000 --> 15:06.000]  The affidavit of probable cause does not contain
[15:06.000 --> 15:08.000]  either of these records.
[15:08.000 --> 15:10.000]  It's of a criminal complaint.
[15:10.000 --> 15:15.000]  So as an affidavit for the purposes of issuing a charging instrument,
[15:15.000 --> 15:17.000]  it doesn't hold water.
[15:17.000 --> 15:21.000]  The fact that it does not assert any facts of any kind
[15:21.000 --> 15:27.000]  accusing Randy of anything doesn't make it valid for any purpose.
[15:27.000 --> 15:32.000]  Not the issuance of a warrant nor as support for an information.
[15:32.000 --> 15:36.000]  Then we get to look at the information itself.
[15:36.000 --> 15:39.000]  It mimics the probable cause affidavit
[15:39.000 --> 15:45.000]  in the fact that it has absolutely no stated facts of any kind.
[15:45.000 --> 15:47.000]  Why is that important?
[15:47.000 --> 15:52.000]  We just saw where the indictment is required to state
[15:52.000 --> 15:55.000]  everything that must be proved.
[15:55.000 --> 15:58.000]  Well, what does it say about a complaint?
[15:58.000 --> 16:01.000]  Or, I'm sorry, an information.
[16:01.000 --> 16:03.000]  Article 21.23.
[16:03.000 --> 16:07.000]  Rules as to indictment apply to information.
[16:07.000 --> 16:12.000]  The rules with respect to allegations in an indictment
[16:12.000 --> 16:18.000]  and the certainty required apply also to an information.
[16:18.000 --> 16:21.000]  So that means that all of the things that must be proved
[16:21.000 --> 16:26.000]  from an indictment must also exist in an information.
[16:26.000 --> 16:29.000]  And there is nothing there.
[16:29.000 --> 16:33.000]  Nothing at all.

[19:33.000 --> 19:41.000]  They're trying to also argue the point that it's not so much that Randy was gathering evidence.
[19:41.000 --> 19:46.000]  They're trying to say the evidence he gathered was from other than public records.
[19:46.000 --> 19:50.000]  The problem is it doesn't frickin' matter.
[19:50.000 --> 19:55.000]  He can gather evidence and information from anywhere he wants to
[19:55.000 --> 20:00.000]  as long as he's doing it on a private individual basis.
[20:00.000 --> 20:05.000]  There's nothing in the statute that prevents that or addresses it.
[20:05.000 --> 20:10.000]  It only addresses whether or not they're operating a business
[20:10.000 --> 20:14.000]  and whether or not they're employed for those purposes.
[20:14.000 --> 20:16.000]  He was not.
[20:16.000 --> 20:24.000]  He was acting as an investigative journalist, which they can't license anyway.
[20:24.000 --> 20:29.000]  So whatever their argument was, it didn't hold water
[20:29.000 --> 20:36.000]  and it doesn't matter what the argument was because the court lacked jurisdiction to hear the argument.

[25:33.000 --> 25:38.000]  in the local media and the whole community was up in arms about it
[25:38.000 --> 25:43.000]  and it took the community getting the FBI involved.
[25:43.000 --> 25:48.000]  They had to crowbar the feds to get them into the county to do something about it.
[25:48.000 --> 25:52.000]  The FBI had to get involved before they could finally put a stop to this guy
[25:52.000 --> 25:56.000]  and he killed and raped nine women before they could finally stop him.
[25:56.000 --> 25:59.000]  And in case you all don't know what happened with Robert Fox,
[25:59.000 --> 26:03.000]  bless his heart, I love him to death, when he went into that jail,
[26:03.000 --> 26:09.000]  the same jail that Randy is in now, he looked like Santa Claus, if you know what I mean.

[26:11.000 --> 26:14.000]  When he came out, he was about 85 pounds.
[26:14.000 --> 26:18.000]  They nearly killed him with starvation and daily beatings.

[36:04.000 --> 36:11.000]  In fact, there is Texas law that says that we have the right not only to resist an illegal arrest,

[36:18.000 --> 36:23.000]  And there's tons of case law in Texas on that very subject.
[36:23.000 --> 36:30.000]  We need to stop being afraid of doing what's right.
[36:30.000 --> 36:37.000]  If we continue to be afraid of doing what's right, we are over.

[36:41.000 --> 36:46.000]  If we don't let that sink in and start being willing to do something, people, they're going to run over us.

[41:30.000 --> 41:35.000]  Because Texas law has limited the jurisdiction of who can hear it.

[41:37.000 --> 41:42.000]  Texas law says the habeas corpus for a misdemeanor can only be directed

[51:03.000 --> 51:10.000]  His contractor called the sheriff's department and claimed that my new neighbor threatened

[51:12.000 --> 51:18.000]  And the sheriff's department sent six, well, three days later when the contractor showed
[51:18.000 --> 51:25.000]  up, they went with him to my new neighbor's place, six deputies, 15 board of patrol agents
[51:25.000 --> 51:26.000]  and Parks and Wildlife.
[51:26.000 --> 51:29.000]  They raided his place.
[51:29.000 --> 51:34.440]  The head deputy was the same head deputy that over a year ago didn't know about the penal
[51:34.440 --> 51:41.000]  code covering traveling with weapons and didn't know you had to show your ID when asked by
[51:41.000 --> 51:42.000]  someone.
[51:42.000 --> 51:44.200]  He's the head deputy now.
[51:44.200 --> 51:51.400]  And he was ordered or told by my neighbor, he says, get in your car and don't say a word.
[51:51.400 --> 51:56.560]  And he went and talked to one of the junior deputies because of the incompetency of the
[51:56.560 --> 51:58.680]  senior person.
[51:58.680 --> 52:04.000]  And he explained to them that he was actually on his way down to them because he had been
[52:04.000 --> 52:07.400]  getting death threats by the contractor.
[52:07.400 --> 52:13.880]  Plus, the contractor had emailed and called his wife, who is a deputy sheriff in Georgia,
[52:13.880 --> 52:22.000]  which is communicating a criminal threat against a peace officer cross-line.
[52:22.000 --> 52:24.400]  And she's already at the DA there.
[52:24.400 --> 52:28.000]  So while they were there illegally on his property, because guess what?
[52:28.000 --> 52:32.680]  They didn't have a warrant when they raided his place and they had three days' notice.
[52:32.680 --> 52:36.880]  They went into the contractor's trailer, which was on the property because this is West
[52:36.880 --> 52:41.480]  Texas miles from anything, and they found two shotguns.
[52:41.480 --> 52:47.680]  And they found, I think they found the guns in the contractor's vehicle and then some
[52:47.680 --> 52:53.160]  illegal drugs in the trailer.
[52:53.160 --> 52:58.360]  My neighbor's wife ran the serial numbers and both those shotguns the contractor had
[52:58.360 --> 52:59.680]  were stolen.
[52:59.680 --> 53:05.040]  And one of the stolen weapons was used to murder its owner 15 years ago.
[53:05.040 --> 53:08.080]  Did I mention we didn't have any warrants on that either?
[53:08.080 --> 53:15.480]  So this happened Thursday night, Saturday morning, they let the contractor go.
[53:15.480 --> 53:21.280]  They sent him, they released him because they had illegally searched his vehicle and illegally
[53:21.280 --> 53:29.480]  searched his trailer that was on my neighbor's property while they were building his house
[53:29.480 --> 53:30.480]  and stuff.
[53:30.480 --> 53:35.880]  So plus now my neighbor is getting harassed by a board of patrol and is afraid that they're
[53:35.880 --> 53:40.600]  going to try to do to him, but they tried a couple of years ago with us and let's try
[53:40.600 --> 53:43.320]  to plant drugs on our property.
[53:43.320 --> 53:48.320]  So I don't know, it seems like there's so many crooked cops out there and I'm not
[53:48.320 --> 53:52.080]  here now today about Randy and I'm really concerned.
[53:52.080 --> 53:57.440]  Well, they're definitely stepping up their campaign against those that won't bow down
[53:57.440 --> 53:58.440]  to them.

[53:59.440 --> 54:06.880]  Well, my neighbor suffers from PTSD badly and you know, he's like a lot of military
[54:06.880 --> 54:12.520]  that were in the same kind of job as my husband was and their attitude is I'm not going to

[54:14.960 --> 54:22.560]  If it comes pushed to shove, they will not hesitate to defend themselves.
[54:22.560 --> 54:28.960]  But right now, you know, I'm concerned that they are trying to go after my neighbor.

[54:30.440 --> 54:32.720]  His wife hasn't quit her job yet in Georgia.

[54:34.200 --> 54:40.920]  But like I said, now we have a guy who has communicated, he was going to kill my neighbor.

[54:45.720 --> 54:52.000]  used to murder somebody like the owner of the weapon kind of concerns me.

[55:17.480 --> 55:21.880]  So when he was going home later that day, they had two Border Patrol vehicles on either

[55:22.880 --> 55:28.280]  They blocked the road when he was coming up, but he couldn't drive by and one of the supervisors
[55:28.280 --> 55:32.480]  was wearing a vest so he couldn't see his name tag, got out and chewed him out saying,
[55:32.480 --> 55:35.440]  I don't like the way you talk to my people when they came to apologize to you.
[55:35.440 --> 55:38.680]  And he said, you're still not coming on my property.
[55:38.680 --> 55:39.680]  But this is the kind of harassment.
[55:39.680 --> 55:40.680]  They have no jurisdiction.
[55:40.680 --> 55:41.680]  They're fed.
[55:41.680 --> 55:48.320]  Well, they'll be able to hang around there as long as the sheriff of your county lets

[01:21:56.800 --> 01:22:03.720]  grand jury about in criminal complaints because of their activities involving Robert Fox.

[01:22:09.400 --> 01:22:15.400]  They tried to say that he got the information from some place other than the public records.
[01:22:15.400 --> 01:22:23.400]  The problem is, is what they charged in with doesn't make any issues whatsoever of a private
[01:22:23.400 --> 01:22:26.480]  individual investigating anything.
[01:22:26.480 --> 01:22:32.920]  The charge only applies if you are operating a business for the purpose of being employed
[01:22:32.920 --> 01:22:40.400]  to act as an investigator or a security services company, which Randy wasn't doing.

[01:22:45.840 --> 01:22:51.480]  public records, which was the only place Randy got his information from.
