[06:50.960 --> 06:55.200] the laws and noticed that City of Austin was driving golf carts on the street
[06:55.200 --> 06:59.920] just thinking there must be a commercial application for this and that's when
[06:59.920 --> 07:07.040] it all started and no idea the final was picking. Exactly so these are electric
[07:07.040 --> 07:12.760] cars they're similar to golf carts and you are talking about how you did
[07:12.760 --> 07:15.840] research into the laws to see if there's a commercial application and
[07:15.840 --> 07:20.960] apparently at least in this city there are no ordinances on the books that to
[07:20.960 --> 07:27.320] regulate commercial activity with golf carts and of course what we found and
[07:27.320 --> 07:32.640] even your attorney has found which we know to be true that all driver's
[07:32.640 --> 07:37.040] licenses are commercial driver's licenses. You don't need a special chauffeur's
[07:37.040 --> 07:43.120] license to transport passengers under most conditions and so you said hey hey
[07:43.120 --> 07:48.560] hey let's do this we're going to get these these electric golf carts I believe
[07:48.560 --> 07:51.200] you're calling them golf carts on steroids I've seen the pictures of them
[07:51.200 --> 07:57.120] they're very beautiful and no permit needed and so you proceeded to conduct
[07:57.120 --> 08:02.720] business these rides are free by the way and you you support the business
[08:02.720 --> 08:07.640] through advertising and so you're cruising along so to speak no pun intended
[08:07.640 --> 08:11.440] you've got drivers that work for you and they are cruising along given these
[08:11.440 --> 08:16.480] passengers these rides for free you're making money off of advertising and then
[08:16.480 --> 08:23.320] things started to change what happens well we pretty much got left alone the
[08:23.320 --> 08:27.720] first couple of months and then just out of nowhere we just started getting
[08:27.720 --> 08:34.040] pulled over one two three times a night and the police were just scratching
[08:34.040 --> 08:39.200] their heads just saying I don't think that you can do this and you know I took
[08:39.200 --> 08:43.800] the liberty to print up the laws pertaining to low speed vehicles and
[08:43.800 --> 08:47.280] had them in the vehicles just to present to the police and it just didn't seem to
[08:47.280 --> 08:52.520] matter and we just gotten we started by the heads of every transportation
[08:52.520 --> 08:59.680] company out there and they just don't want any competition and they're the
[08:59.680 --> 09:02.280] basically the thing that's unfair is that they have to pay for permitting and we
[09:02.280 --> 09:06.840] don't even though we've been fighting to get a permit just to put everybody on the
[09:06.840 --> 09:13.360] same page not like we've been avoiding it but at the same time it's just been
[09:13.360 --> 09:17.840] unreal that employees in the ground transportation department just kind of
[09:17.840 --> 09:23.800] do it go on regardless of a counselor counsel won't tell me right so at first
[09:23.800 --> 09:27.920] you're seeing that there is no permit required for this type of activity they
[09:27.920 --> 09:33.080] shouldn't be bothering you anyway and so basically y'all have been fighting all
[09:33.080 --> 09:38.480] these bogus traffic tickets on this ground that hate there's there's no
[09:38.480 --> 09:43.240] permit required and yes it's not that you're avoiding it or doing anything
[09:43.240 --> 09:50.720] illegal but there just simply isn't one required now can you tell us what types
[09:50.720 --> 09:56.280] of charges are in the traffic tickets are they charging your drivers with the
[09:56.280 --> 10:03.200] majority of them are no operating authority and no chauffeurs permit but
[10:03.200 --> 10:08.040] we've had even ridiculous one it's like the legal street vehicle on the
[10:08.040 --> 10:15.360] street driving a legal taxi I mean that none of these had are at least the ones
[10:15.360 --> 10:19.360] minus operating authority and chauffeur's license had a had a cause
[10:19.360 --> 10:24.200] number next to them they were just right on the ticket to give it to us and tell
[10:24.200 --> 10:29.800] us if we continue to operate my drivers will be arrested okay so you have you've
[10:29.800 --> 10:35.160] taken on an attorney to fight these traffic tickets because well we were
[10:35.160 --> 10:39.360] discussing off the air the other night that you love to be a pro se litigant
[10:39.360 --> 10:43.960] and you love to go in a court and fight these tickets unfortunately it is the
[10:43.960 --> 10:49.920] drivers that are getting these tickets and you can't expect them to learn all
[10:49.920 --> 10:54.200] of the legalese so to speak necessary to fight all these bogus traffic tickets as
[10:54.200 --> 10:58.520] a condition of employment so you've got this attorney to defend your drivers
[10:58.520 --> 11:04.240] on these tickets and you were telling me some of the arguments where the main
[11:04.240 --> 11:07.920] arguments your attorney's been using in court in these in the municipal court is
[11:07.920 --> 11:14.880] that there's no law requiring this and astoundingly or I guess I guess it
[11:14.880 --> 11:19.840] shouldn't be astounding anymore but they these these prosecutors never cease to
[11:19.840 --> 11:25.920] amaze me astoundingly the prosecutor is saying in court on the record that no
[11:25.920 --> 11:32.440] law is the same as breaking the law is this correct did I get this right yes
[11:32.440 --> 11:37.920] you did get it right our attorney Stephanie Collins took on just at the
[11:37.920 --> 11:43.000] time it was just a few cases that we had pending I feel sorry for because we we
[11:43.000 --> 11:48.600] sure keep her busy but what we did a lot of research on this and I was making
[11:48.600 --> 11:53.360] sure that yeah or maybe I needed an attorney's eyes to look at this and the
[11:53.360 --> 11:57.440] only thing we could find in anywhere in the city of Austin is actually an
[11:57.440 --> 12:01.880] incentive to buy these vehicles like Austin Energy will write a check to
[12:01.880 --> 12:07.640] anybody that will purchase an electrical speed vehicle to the tune of $500 and
[12:07.640 --> 12:12.440] that's it that's all they have on the books in the city of Austin it's to
[12:12.440 --> 12:15.440] incentivize the purchase and then they're telling us that our vehicles
[12:15.440 --> 12:22.400] aren't in street legal and I'd hate to point out but we have license plates it
[12:22.400 --> 12:25.920] just got nuts and they're just saying that we have to have permission before
[12:25.920 --> 12:30.960] we do anything and I'm wondering how this progress happened I mean okay so
[12:30.960 --> 12:33.720] they're saying you have to have permission even though there's no law
[12:33.720 --> 12:38.000] that says you have to have permission so you've been fighting these tickets and
[12:38.000 --> 12:44.040] winning and I was shocked to hear that when the prosecutor makes this

[12:49.080 --> 12:54.120] other words you have to have permission from the government to do it you said
[12:54.120 --> 12:58.520] that even one time one of the jurors was nodding his head yes
[12:58.520 --> 13:05.360] oh yeah yeah there was we actually lost that case unfortunately but it's just
[13:05.360 --> 13:10.640] in any group of people there's always gonna be a status but and at the same
[13:10.640 --> 13:18.880] time I mean it I'm not a lawyer but from my understanding the word or the term
[13:18.880 --> 13:26.880] illegal means breaking a law right and you know while in the books actually
[13:26.880 --> 13:32.120] what you're talking about here is breaking laws but it's not you breaking
[13:32.120 --> 13:46.760] law right the code pull out 39.03 what it says is that if a public official
[13:46.760 --> 13:53.280] acting under the color of his authority exerts or purports to exert an
[13:53.280 --> 13:58.960] authority he does not expressly have and in the process denies a citizen in
[13:58.960 --> 14:05.440] full free access to or enjoyment of a right that's the class a misdemeanor in
[14:05.440 --> 14:13.880] state of Texas and if he does that while he's displaying a deadly weapon well
[14:13.880 --> 14:21.120] that's aggravated assault first-degree felony right to life right so these
[14:21.120 --> 14:24.240] police are breaking the law and committing official oppression every time
[14:24.240 --> 14:28.840] they write your driver's ticket. Now your attorney is also aware that Texas
[14:28.840 --> 14:36.400] Transportation has only a 40% city can be used to do its permit basis on if the
[14:36.400 --> 14:41.080] Texas laws don't exist it gives them the right to regulate something involving
[14:41.080 --> 14:45.240] transportation the municipalities absolutely do not have it that's why
[14:45.240 --> 14:50.560] there's no ordinance because the Texas Transportation Code specifically
[14:50.560 --> 14:56.480] exempts golf carts from anything that it regulates therefore the city can't do it
[14:56.480 --> 15:00.320] either. That's a very good point Eddie so Chris you may be barking up the wrong
[15:00.320 --> 15:05.480] tree trying to petition City Council to pass an ordinance to regulate you
[15:05.480 --> 15:10.600] because if they don't have statutory and authority under the state laws then
[15:10.600 --> 15:14.320] they can't pass a regulate they can't pass an ordinance like that anyway. I'm
[15:14.320 --> 15:18.280] actually surprised you were even able to get license plates for these because
[15:18.280 --> 15:22.920] these are specifically exempted under Texas law as having to be anything at
[15:22.920 --> 15:28.000] all involving transportation whether it be registered licensed or anything. Well
[15:28.000 --> 15:31.960] actually I shied away from golf carts because there were no laws on it and that
[15:31.960 --> 15:38.080] just became I mean it got crazy so what we did is but low-speed electric
[15:38.080 --> 15:42.800] vehicles which is basically a golf cart like I said on steroids that is actually
[15:42.800 --> 15:47.480] spelled out in CFR 571.500 the transportation code I can pretty much
[15:47.480 --> 15:57.720] quote it. It's not state. That's true. True. And that's the whole point if there's no
[15:57.720 --> 16:04.480] state law implementing the federal law there isn't a law. So then the city the
[16:04.480 --> 16:09.320] city council still couldn't pass an ordinance to regulate him because there
[16:09.320 --> 16:14.560] is no state it could not be based on state law is that correct? That's correct. Wait a minute wait a minute
[16:14.560 --> 16:22.600] were you driving one of these through the federal courthouse? I've been tempted right now.
[16:22.600 --> 16:29.280] That's okay that's the point if it's a federal law you have to be operating it
[16:29.280 --> 16:33.760] on federal property and actually even if you were driving one through the middle
[16:33.760 --> 16:38.280] of the federal courthouse it would still be state property it wouldn't matter. Well no the
[16:38.280 --> 16:42.600] other exception is if he was using them in interstate commerce or interstate I'm

[36:30.840 --> 36:40.600] have memorized is 39.03 penal code public official exerts let's say a public
[36:40.600 --> 36:46.800] official acting under the color of his authority color meaning pretense if he
[36:46.800 --> 36:52.920] exerts or purports to exert an authority he does not expressly have or fails to
[36:52.920 --> 36:57.800] perform the duty he's required to perform and denies a citizen in a riot
[36:57.800 --> 37:07.360] that's a crime it's class a misdemeanor so if an attorney in order to get a
[37:07.360 --> 37:12.960] prosecution if you comes before the court it misrepresent the truth to the
[37:12.960 --> 37:21.560] court concerning a material fact that's aggravated perjury that's also
[37:21.560 --> 37:27.880] obstruction of justice and official approach these guys are committing lots
[37:27.880 --> 37:33.400] of crimes and if you start pushing the criminal side that's something you do
[37:33.400 --> 37:37.600] totally separate from the civil and you don't need your attorneys help to do
[37:37.600 --> 37:41.560] that either right criminal doesn't have anything to do with civil the civil is
[37:41.560 --> 37:47.080] where they harm you criminal they harm the state so you go to the prosecutor

[37:53.200 --> 37:59.600] these statutes and the prosecutor will refuse to act an article 2.03 code of
[37:59.600 --> 38:05.080] criminal procedure specifically commands the prosecutor when he's made
[38:05.080 --> 38:09.880] known in any manner that a public official has violated a law relating to
[38:09.880 --> 38:17.400] this office he shall present the complaint to the grand jury felony misdemeanor
[38:17.400 --> 38:23.360] makes no difference all go to grand jury he has no option but he'll exercise an
[38:23.360 --> 38:28.640] option but then you file a complaint with the highest judge you can find
[38:28.640 --> 38:32.320] against the prosecutor and I suggest just do all this by mail don't ever
[38:32.320 --> 38:38.200] never see you send it to the judge and he refused to prosecute then you send a
[38:38.200 --> 38:43.120] letter to the grand jury accusing the judge of shielding the prosecutor from
[38:43.120 --> 38:48.000] prosecution because he wouldn't prosecute these public officials and what's
[38:48.000 --> 38:52.320] going to happen when you do that is the phones are going to start buzzing all
[38:52.320 --> 38:58.720] over the place this judge is not going to be happy because when he runs for
[38:58.720 --> 39:03.280] office again his opponents going to drag out that criminal complaint rub it in
[39:03.280 --> 39:08.440] his face and he's going to go to that prosecutor and let's prosecute to know you
[39:08.440 --> 39:14.800] better do something this is how we create local politics and you know this
[39:14.800 --> 39:19.280] sounds like it that I would like to believe him my background is in
[39:19.280 --> 39:24.520] government and that there's a social contract and as a naval veteran I took

[42:29.840 --> 42:34.520] not regulated by anything in the state when they arrest these guys that's
[42:34.520 --> 42:39.040] false imprisonment when they take them from the scene that's kidnapping when
