[04:03.480 --> 04:11.000]  some information to the folks out there regarding registration of your private automobile.
[04:11.000 --> 04:15.720]  Now afterward we've done that I've got to announce what to make regarding some issues
[04:15.720 --> 04:20.760]  that we've been getting together in the works here but right now let's get on with the educational
[04:20.760 --> 04:21.760]  part of this.
[04:21.760 --> 04:27.080]  Okay, for those of you that have access to the internet go to the Texas government statutory
[04:27.080 --> 04:33.600]  website and if you don't know where that is just go to www.texas.gov.
[04:33.600 --> 04:39.240]  On there you will find a banner headline that says government, click on that.
[04:39.240 --> 04:44.800]  Somewhere in that you will see on usually it's down the left hand side a row of clickable
[04:44.800 --> 04:48.440]  links one of them will say laws, codes and statutes.
[04:48.440 --> 04:52.800]  If you'll click on that one then that same banner will appear in the middle of the screen
[04:52.800 --> 04:57.040]  under laws, codes and statutes and when you get there you will see two links.
[04:57.040 --> 05:00.760]  One for the Texas constitution and one for Texas statutes.
[05:00.760 --> 05:06.840]  If you expand the Texas statutes what we need to be looking at first is the Texas transportation
[05:06.840 --> 05:08.000]  code.
[05:08.000 --> 05:13.120]  When you expand that out go into chapter 501.
[05:13.120 --> 05:18.320]  Now what I want to do here is I want to explain to you a couple of pieces of information that
[05:18.320 --> 05:24.920]  are used in the registration of your automobile to convert it into a motor vehicle and let
[05:24.920 --> 05:29.800]  me go through this and I'll show you exactly how it's set up to work.
[05:29.800 --> 05:35.200]  In section 501.002 we have the definitions that are used in this chapter.
[05:35.200 --> 05:43.840]  This chapter is 501 and it is titled certificate of title act sub chapter A general provisions.
[05:43.840 --> 05:51.720]  Now the very first definition given here is for certificate of title and it reads certificate
[05:51.720 --> 05:58.760]  of title means an instrument issued under section 501.021.
[05:58.760 --> 06:02.280]  Now for those of you that have been to my class the first thing I teach you to do when
[06:02.280 --> 06:06.640]  you read a statute is to look for rabbit trails.
[06:06.640 --> 06:12.000]  In this we have one right off the bat in the word instrument.
[06:12.000 --> 06:18.680]  We have a second one in the term itself certificate of title.
[06:18.680 --> 06:23.400]  You need to see if that term is actually defined anywhere else in code as well as whether or
[06:23.400 --> 06:28.080]  not instrument is defined anywhere else in code.
[06:28.080 --> 06:34.880]  Well neither of these two terms have any other definition within the Texas transportation
[06:34.880 --> 06:36.200]  code.
[06:36.200 --> 06:42.480]  In order to find the definition of instrument we must actually go to the Texas business
[06:42.480 --> 06:44.880]  and commerce code.
[06:44.880 --> 06:49.360]  And if you'll scroll back up in that long list of statutory codes there you will find
[06:49.360 --> 06:53.960]  the business and commerce code and if you expand that out you want to go to section
[06:53.960 --> 07:01.480]  three and down in section three you want to go to 3.104.
[07:01.480 --> 07:08.120]  Now what 3.104 is is the definition of negotiable instrument.
[07:08.120 --> 07:12.160]  Now you're going to say well negotiable instrument and instrument not the same thing.
[07:12.160 --> 07:17.760]  Ah hang on just a minute and we'll show you why this definition applies to our singular
[07:17.760 --> 07:21.960]  instrument definition from the transportation code.
[07:21.960 --> 07:30.800]  3.104 reads negotiable instrument subsection A except as provided in subsections C and
[07:30.800 --> 07:39.400]  D negotiable instrument means an unconditional promise or order to pay a fixed amount of
[07:39.400 --> 07:49.320]  money with or without interest or other charges described in the promise or order if it one
[07:49.320 --> 07:56.600]  is payable to bearer or to order at the time it is issued or first comes into possession
[07:56.600 --> 07:58.280]  of a holder.
[07:58.280 --> 08:03.080]  Now there's another term you're going to want to figure out the definition for bearer and
[08:03.080 --> 08:05.640]  holder.
[08:05.640 --> 08:14.760]  Number two is payable on demand or at a definite time and three does not state any other undertaking
[08:14.760 --> 08:21.840]  or instruction by the person promising or ordering payment to do any act in addition
[08:21.840 --> 08:29.000]  to the payment of money but the promise or order may contain A an undertaking or power
[08:29.000 --> 08:35.640]  to give, maintain and protect collateral to secure payment, B an authorization or power
[08:35.640 --> 08:43.840]  to the holder to confess judgment or realize on or dispose of collateral or C a waiver
[08:43.840 --> 08:52.080]  of the benefit of any law intended for the advantage or protection of an obliger.
[08:52.080 --> 08:55.920]  As you can see there's a whole list of terms in here we want to find out what they actually
[08:55.920 --> 08:56.920]  mean.
[08:56.920 --> 09:01.440]  Not now we're concentrating on negotiable instrument and instrument.
[09:01.440 --> 09:10.200]  Now after subsection A we have subsection B it defines the exact term instrument and
[09:10.200 --> 09:16.920]  it says instrument means a negotiable instrument.
[09:16.920 --> 09:22.560]  Now this creates a quandary in the area of a certificate of title and the reason for
[09:22.560 --> 09:29.040]  it is this, according to what 3.104 here says about a negotiable instrument the negotiable
[09:29.040 --> 09:36.320]  instrument must define the terms of the contract in relation to the money amounts that are
[09:36.320 --> 09:42.800]  at issue in the negotiable instrument and that are the subject of the obligation to
[09:42.800 --> 09:43.800]  pay.
[09:43.800 --> 09:50.640]  That says it right here in 3.104 that that's what's on a negotiable instrument.
[09:50.640 --> 09:55.960]  This information is not on a certificate of title.
[09:55.960 --> 10:01.520]  So when it defines instrument down here it says instrument is a negotiable instrument
[10:01.520 --> 10:07.640]  and we apply that definition to a certificate of title they don't match up because the certificate
[10:07.640 --> 10:15.960]  of title does not say anything about the amounts owed or due and owing on the lien that the
[10:15.960 --> 10:20.240]  certificate of title actually records.
[10:20.240 --> 10:28.080]  So does it fulfill the necessary statutory requirements of a negotiable instrument?
[10:28.080 --> 10:34.880]  I can't see that it would and I can't see that because again it doesn't contain the
[10:34.880 --> 10:46.920]  requisites of a negotiable instrument but let's see if there is a definition for certificate
[10:46.920 --> 10:54.640]  of title itself in the business and commerce code.
[10:54.640 --> 11:09.160]  And when we look at it, let's see, it is listed in chapter 9 under secured transactions, okay.
[11:09.160 --> 11:15.040]  Let's see what it says the certificate of title is in relation to a secured transaction.
[11:15.040 --> 11:26.080]  Now this is out of section 9.102 sub-item 10 certificate of title means a certificate
[11:26.080 --> 11:32.600]  of title with respect to which a statute provides for the security interest in question
[11:32.600 --> 11:40.920]  to be indicated on the certificate as a condition or result of the security interest obtaining
[11:40.920 --> 11:50.200]  priority over the rights of a lien creditor with respect to the collateral, okay.
[11:50.200 --> 11:58.640]  Now again more terms we need to know definitions of collateral, lien creditor, so on and so
[11:58.640 --> 11:59.640]  forth.
[11:59.640 --> 12:02.120]  All rabbit trails we need to be following up.
[12:02.120 --> 12:05.280]  Let's see if this same section gives us the definition.
[12:05.280 --> 12:09.680]  It does for collateral but let's see if it gives us the one for lien creditor and it
[12:09.680 --> 12:14.560]  does down in section or item 52.
[12:14.560 --> 12:20.680]  Lien creditor means A, a creditor that has acquired a lien on the property involved by
[12:20.680 --> 12:27.360]  attachment, levy or the like, B, an assignee for benefit of creditors from the time of
[12:27.360 --> 12:34.560]  an assignment, C, a trustee in bankruptcy from the date of the filing of the petition
[12:34.560 --> 12:40.440]  or D, a receiver in equity from the time of appointment.
[12:40.440 --> 12:45.680]  Now what I want you to look at is what all of these things in relation to a certificate
[12:45.680 --> 12:49.480]  of title do.
[12:49.480 --> 12:56.040]  Everything relating to the certificate of title directly goes to the fact that there
[12:56.040 --> 13:03.720]  is a lien established against a piece of property, in this case what they have termed a motor
[13:03.720 --> 13:13.280]  vehicle and that lien is evidenced on the certificate of title.
[13:13.280 --> 13:20.120]  But the certificate of title itself is not a negotiable instrument because it does not
[13:20.120 --> 13:28.120]  contain the statutory requisites of the specified money and obligation in monetary terms that
[13:28.120 --> 13:31.360]  are due and owing on the lien.
[13:31.360 --> 13:37.160]  So the certificate of title is not a negotiable instrument, a negotiable instrument, again
[13:37.160 --> 13:42.760]  something that denotes something is due and owing and it specifies the amounts when they
[13:42.760 --> 13:45.440]  are due, how they are due, so on and so forth.
[13:45.440 --> 13:51.360]  The conditions of the agreement, none of which the certificate of title does.
[13:51.360 --> 13:58.160]  That being said, the certificate of title by that definition as we follow through each
[13:58.160 --> 14:04.720]  of these does not convey a property interest in the car.
[14:04.720 --> 14:14.440]  It can't because the only reason it exists is to show that there is a claim of lien against
[14:14.440 --> 14:18.760]  the property for money due and owing.
[14:18.760 --> 14:28.560]  So all it does is preserve that fact, it cannot suffice to transfer ownership rights of that
[14:28.560 --> 14:31.400]  property from one to another.
[14:31.400 --> 14:41.240]  All it can do is provide evidence of the existence or nonexistence of a lien.
[14:41.240 --> 14:46.720]  Now that we know what the certificate of title is and what it isn't, we now know the certificate
[14:46.720 --> 14:54.600]  of title does not create the presumption that we own the property.
[14:54.600 --> 15:00.600]  It just creates the presumption that we have the right of possession of the property but
[15:00.600 --> 15:02.360]  not ownership.
[15:02.360 --> 15:05.200]  They are not the same thing.
[15:05.200 --> 15:08.000]  A friend can loan me his car.
[15:08.000 --> 15:13.160]  I have the right of possession because he loaned it to me.
[15:13.160 --> 15:20.720]  I can't be arrested for driving around in a stolen car just because my name is not on
[15:20.720 --> 15:22.040]  the paperwork.
[15:22.040 --> 15:27.480]  The friend's acquiescence to loaning me the car gave me the right of possession just like
[15:27.480 --> 15:32.920]  this certificate of title would do under the lien.
[15:32.920 --> 15:37.960]  Now since I have the right of possession, I have the right of use because that's why
[15:37.960 --> 15:40.160]  the friend loaned it to me.
[15:40.160 --> 15:42.240]  But I can't sell the car.
[15:42.240 --> 15:45.480]  It's not mine.
[15:45.480 --> 15:53.240]  I have no ownership interest in the car in order to be able to sell it to someone else.
[15:53.240 --> 15:58.360]  Now when we were covering this in class yesterday, we have a gentleman that actually has a car
[15:58.360 --> 16:01.640]  dealership that's been attending the classes.
[16:01.640 --> 16:05.280]  This is what I ran by him.
[16:05.280 --> 16:12.480]  The cars that he sells, or any dealer that sells, that have an involvement with a salvage
[16:12.480 --> 16:21.120]  title, okay, or the only way that he gets possession of the car is through the signing
[16:21.120 --> 16:25.560]  off of the certificate of title.
[16:25.560 --> 16:33.320]  That gives him the right of possession, but it doesn't give him the right of ownership.
[16:33.320 --> 16:38.760]  Now this creates a real predicament for a car dealer, and I'll pick that up on the other
[16:38.760 --> 16:40.960]  side when we get back.

[20:36.760 --> 20:41.760]  When you go down to register a motor vehicle
[20:41.760 --> 20:47.760]  There's a little thing they forget to tell you in section 502.152
[20:47.760 --> 20:50.760]  You'll figure this out when you get there though
[20:50.760 --> 20:58.760]  In 502.152, this section is titled Certificate of Title Required for Registration
[20:58.760 --> 21:05.760]  Subsection A, the department may not register or renew the registration of a motor vehicle
[21:05.760 --> 21:10.760]  for which a certificate of title is required under chapter 501
[21:10.760 --> 21:15.760]  unless the owner, one, obtains a certificate of title for the vehicle
[21:15.760 --> 21:23.760]  or two, presents satisfactory evidence that a certificate of title was previously issued to the owner
[21:23.760 --> 21:26.760]  by the department of another jurisdiction
[21:26.760 --> 21:36.760]  Subsection B, this section does not apply to an automobile that was purchased new before January 1, 1936
[21:36.760 --> 21:47.760]  Now, I don't see anything here that would allow them to register a car absent a certificate of title
[21:47.760 --> 21:53.760]  I mean A, the department may not register or renew the registration of a motor vehicle
[21:53.760 --> 21:57.760]  which a certificate of title is required under chapter 501
[21:57.760 --> 22:01.760]  unless the owner gets the certificate of title for the vehicle
[22:01.760 --> 22:07.760]  or shows that it would have one acquired from another jurisdiction in another state

[22:23.760 --> 22:28.760]  which means an instrument issued under section 501.021
[22:28.760 --> 22:32.760]  and we go down and look at 501.021
[22:32.760 --> 22:35.760]  This is what it says about the certificate of title
[22:35.760 --> 22:42.760]  Subsection A, a motor vehicle certificate of title is an instrument issued by the department
[22:42.760 --> 22:45.760]  and in this case, department means who?
[22:45.760 --> 22:50.760]  Go back up and look at the definition under 501.002
[22:50.760 --> 22:55.760]  department means the Texas Department of Motor Vehicles
[22:55.760 --> 22:56.760]  Okay?
[22:56.760 --> 23:02.760]  So registration is through the department of motor vehicles
[23:02.760 --> 23:06.760]  Now, in the certificate of title
[23:06.760 --> 23:11.760]  the motor vehicle certificate of title is an instrument issued by the department that includes one
[23:11.760 --> 23:15.760]  the name and address of the purchaser and seller at the first sale
[23:15.760 --> 23:21.760]  or the transferee and transferer at a subsequent sale
[23:21.760 --> 23:22.760]  Okay?
[23:22.760 --> 23:24.760]  Two, the make of the motor vehicle
[23:24.760 --> 23:26.760]  Three, the body type of the vehicle
[23:26.760 --> 23:28.760]  Four, the manufacturer's permanent... Oh, by the way
[23:28.760 --> 23:32.760]  Did you notice in two or three, they swapped terminology
[23:32.760 --> 23:36.760]  In two, the make of the motor vehicle
[23:36.760 --> 23:41.760]  In three, it's the body type of the vehicle
[23:41.760 --> 23:47.760]  The thing is, is both motor vehicle and vehicle have definitions in this chapter
[23:47.760 --> 23:49.760]  They are not the same thing
[23:49.760 --> 23:53.760]  You have a separate definition for vehicle
[23:53.760 --> 23:57.760]  and then you have a separate definition for motor vehicle
[23:57.760 --> 23:59.760]  Okay?
[23:59.760 --> 24:03.760]  So just be aware, that's a separate issue here
[24:03.760 --> 24:05.760]  but this is what they do
[24:05.760 --> 24:09.760]  When they do this, they give us the ability to make the argument
[24:09.760 --> 24:15.760]  that since they're using the references interchangeably to the same object
[24:15.760 --> 24:21.760]  that they are inherently tied together against that object
[24:21.760 --> 24:24.760]  Whether you call it a vehicle or a motor vehicle
[24:24.760 --> 24:28.760]  it implies that we're still dealing with the same piece of property
[24:28.760 --> 24:30.760]  under the same conditions and circumstances
[24:30.760 --> 24:34.760]  even though the definition for the two terms are different
[24:34.760 --> 24:42.760]  Now, on four, the manufacturer's permanent vehicle identification number of the vehicle
[24:42.760 --> 24:44.760]  or the vehicle's motor number
[24:44.760 --> 24:47.760]  if the vehicle is manufactured before the date that stamping

[25:00.760 --> 25:05.760]  Seven, now get this, you're trying to register the car
[25:05.760 --> 25:11.760]  but they're telling you you can't register the car without a certificate of title
[25:11.760 --> 25:14.760]  and here they're telling you that if it's got a Texas license plate
[25:14.760 --> 25:18.760]  then you have to put that on the certificate of title
[25:18.760 --> 25:22.760]  but you can't register it to get the plates until you have the certificate of title
[25:22.760 --> 25:26.760]  See this little circular logic they got going here?
[25:26.760 --> 25:30.760]  Now, how does this work for somebody that comes from a different jurisdiction?
[25:30.760 --> 25:34.760]  Hence the need they had to put if any on here
[25:34.760 --> 25:38.760]  They have to leave it blank if there isn't any
[25:38.760 --> 25:42.760]  But why would you need to come in and do this again
[25:42.760 --> 25:44.760]  if it already had Texas plates on it?
[25:44.760 --> 25:46.760]  All you're doing is renewing the registration
[25:46.760 --> 25:52.760]  you're not creating a new one requiring a reissuance of a certificate of title
[25:52.760 --> 26:00.760]  But let's go to eight, a space for the signature of the owner of the vehicle
[26:00.760 --> 26:02.760]  Well, there's a problem
[26:02.760 --> 26:04.760]  Who owns it?
[26:04.760 --> 26:09.760]  The certificate of title is not a sign of ownership, we just covered that
[26:09.760 --> 26:13.760]  It's simply a sign of any outstanding liens
[26:13.760 --> 26:20.760]  and the assignment of possessory right to a particular individual
[26:20.760 --> 26:26.760]  But it is not proof of ownership
[26:26.760 --> 26:34.760]  So who has to sign this block as the owner?
[26:34.760 --> 26:42.760]  Number nine, a statement indicating rights of survivorship under section 501.031
[26:42.760 --> 26:47.760]  Again, how can there be rights of survivorship granted
[26:47.760 --> 26:53.760]  if you don't own the property?
[26:53.760 --> 26:59.760]  The certificate of title does not convey or substitute for proof of ownership
[26:59.760 --> 27:03.760]  only right of possession
[27:03.760 --> 27:09.760]  So how can it be used for the right of survivorship?
[27:09.760 --> 27:13.760]  Yet there's a place here for it
[27:13.760 --> 27:17.760]  Now, number ten, if the vehicle has an odometer
[27:17.760 --> 27:21.760]  the odometer reading indicated by the application for the certificate of title
[27:21.760 --> 27:27.760]  and 11, any other information required by the department
[27:27.760 --> 27:33.760]  So this is what a certificate of title is and how it's used
[27:33.760 --> 27:40.760]  The problem is the use they've got defined here does not meet the definition of what it's for
[27:40.760 --> 27:50.760]  and what it's for does not allow ownership to be transferred through the medium of the certificate of title
[27:50.760 --> 27:56.760]  Thus negating the survivability clause in there
[27:56.760 --> 28:00.760]  or survivorship clause of who gets it if I die
[28:00.760 --> 28:04.760]  Since you're not the owner, you die
[28:04.760 --> 28:12.760]  Whoever bequeathed to you the right of possession now has the right to reassume possession of the car automatically
[28:12.760 --> 28:15.760]  or the piece of property automatically
[28:15.760 --> 28:22.760]  because they only gave right of possession to you, the person named on the certificate of title
[28:22.760 --> 28:30.760]  But whoever the true owner is, is the one that has the right of disposition to the property
[28:30.760 --> 28:34.760]  not the person that simply has right of possession
[28:34.760 --> 28:42.760]  So this creates a problem of ownership of the property when it's only identified through a certificate of title
[28:42.760 --> 28:48.760]  Now, we have one other little problem with this certificate of title issue
[28:48.760 --> 28:54.760]  and we find that back over in chapter 501
[28:54.760 --> 28:57.760]  a little further down
[28:57.760 --> 29:02.760]  when we go to 501.004
[29:02.760 --> 29:05.760]  we find the following
[29:05.760 --> 29:08.760]  Now this is going to really set you off
[29:08.760 --> 29:10.760]  because I want you to remember
[29:10.760 --> 29:17.760]  they're telling you you can't register a car without a motor vehicle without a certificate of title
[29:17.760 --> 29:20.760]  that you must have it
[29:20.760 --> 29:25.760]  So if you must have the certificate of title
[29:25.760 --> 29:29.760]  then what do we have to do with it?
[29:29.760 --> 29:33.760]  We have to take it down to the county of Sassar Collector
[29:33.760 --> 29:39.760]  They have to use it in order to apply for the certificate of title
[29:39.760 --> 29:43.760]  I'm sorry, they get you the certificate of title with this information
[29:43.760 --> 29:45.760]  But I'll cover this on the other side when we get back

[33:36.760 --> 33:47.760]  Okay, now, when you do that, and it says that you have to have the certificate of title that is identified in chapter 501
[33:47.760 --> 33:55.760]  Then you need to go to 501 and read a few things. It sends you to 501.021
[33:55.760 --> 34:02.760]  But you need to go two sections above that to section 501.004
[34:02.760 --> 34:10.760]  Let's see what the Texas legislature said that the Certificate of Title Act actually applies to
[34:10.760 --> 34:19.760]  Now remember, no certificate of title, the county tax assessor cannot register the motor vehicle
[34:19.760 --> 34:21.760]  Got that?
[34:21.760 --> 34:25.760]  Joined it to him. No certificate of title, no registration
[34:25.760 --> 34:36.760]  So who does the Certificate of Title Act apply to? Section 501.004, applicability, subsection A
[34:36.760 --> 34:46.760]  This chapter applies to a motor vehicle owned by the state or a political subdivision of the state
[34:46.760 --> 34:48.760]  Got that?
[34:48.760 --> 35:01.760]  The entire chapter on certificates of title applies to a motor vehicle owned by the state or a political subdivision of the state
[35:01.760 --> 35:06.760]  Doesn't apply to anybody else, people. Never has
[35:06.760 --> 35:15.760]  The state cannot force anyone to register their property with the state
[35:15.760 --> 35:28.760]  Not even if they are a commercial enterprise, does this act obligate them in any way to get a certificate of title for the purpose of registration
[35:28.760 --> 35:32.760]  Just flat doesn't do it
[35:32.760 --> 35:39.760]  And just in case you think I'm leaving something out, let's go a little deeper. That's subsection A. Let's look at subsection B
[35:39.760 --> 35:50.760]  This chapter does not apply to a trailer or semi-trailer used only for the transportation of farm products if the products are not transported for hire
[35:50.760 --> 35:57.760]  Now let's take that item and match it up against the ability of the state to have an application here
[35:57.760 --> 36:12.760]  Can the state operate a vehicle that can use a trailer or semi-trailer that is only for the transportation of farm products and not for hire
[36:12.760 --> 36:17.760]  Can they do that? Absolutely
[36:17.760 --> 36:32.760]  Take for instance when they used to have prison farms where the farms would grow and raise their own food for the inmates and they would sell the extra produce at the local markets
[36:32.760 --> 36:43.760]  The state would still have to transport the produce from where it was grown to the markets unless they paid somebody to come and get it
[36:43.760 --> 36:56.760]  Well, here you go. They can do this and not be for hire. The state can't hire that truck out to someone else but they can use it for the benefit of the prison to transport the farm produce it grew
[36:56.760 --> 37:01.760]  or the livestock it grew for the purpose of settlement market
[37:01.760 --> 37:16.760]  Number two, the filing or recording of a lien that is created only on an automobile accessory including a radio, a tire, or a heater
[37:16.760 --> 37:24.760]  Why in heaven's name was certificate of title apply to a tire, radio, or heater to begin with?
[37:24.760 --> 37:32.760]  How would that even begin to qualify as a motor vehicle when you're only talking about one of those accessories?
[37:32.760 --> 37:39.760]  Number three, a motor vehicle while it is owned or operated by the United States
[37:39.760 --> 37:55.760]  Or number four, a new motor vehicle on loan to a political subdivision of the state for use only in a driver education course approved by the Central Education Agency
[37:55.760 --> 38:00.760]  That's all there is under applicability
[38:00.760 --> 38:15.760]  Where in that is your car? Where is my car? Where is the general population's private automobile in regard to being applicable to the certificate of title act?
[38:15.760 --> 38:20.760]  I just can't find it
[38:20.760 --> 38:28.760]  So for those of you out there that are better researchers, dissectors, and readers than me, please locate that for me. I am at a loss
[38:28.760 --> 38:31.760]  I just don't know where to go from here
[38:31.760 --> 38:36.760]  I have looked and I have looked 17 years I've looked and I still can't find it
[38:36.760 --> 38:44.760]  So it's either extremely well hidden or I'm obviously missing something in relation to what the term transportation actually means
[38:44.760 --> 38:46.760]  Okay?
[38:46.760 --> 38:59.760]  Now, what this would indicate to me based upon the information that I have been able to locate in all these years of reading this and researching this and studying this and dissecting this
[38:59.760 --> 39:11.760]  Is that the only vehicles that this act can one that the state is allowed to take possessory notice of a lien
[39:11.760 --> 39:23.760]  Is if it involves property the state purchased because remember that's all that's on the certificate of title is evidence of a lien against the property
[39:23.760 --> 39:26.760]  That's all it's for
[39:26.760 --> 39:32.760]  Now why would that have to make sense? Well, let's put it this way
[39:32.760 --> 39:44.760]  The state in order to issue the certificate of title the MSO or MCO must be sent to the state
[39:44.760 --> 39:49.760]  Then and only then will the state issue a certificate of title
[39:49.760 --> 39:56.760]  Now that MSO or MCO is the true ownership papers for the car
[39:56.760 --> 40:02.760]  There are the true ownership papers and the state has them
[40:02.760 --> 40:11.760]  Now, since those documents are in the hands of the state they belong to the state
[40:11.760 --> 40:19.760]  The state has the authority to manage and maintain those records by whatever method the law allows
[40:19.760 --> 40:32.760]  Now, if it was a public record they would have a certain set of rules that they must have in order to disclose that information to the general public
[40:32.760 --> 40:36.760]  But there isn't any in relation to MCOs and MSOs
[40:36.760 --> 40:40.760]  At least I can't find that either if there is
[40:40.760 --> 40:47.760]  And not only that when the state gets those documents the first thing it does is microficial
[40:47.760 --> 40:52.760]  And then it shreds and burns what the actual paper document
[40:52.760 --> 41:00.760]  Now if the state actually owns the property and that's simply their document they do live it what they want
[41:00.760 --> 41:07.760]  I got no problem with that other than if I wish to audit my state employees to make sure that they still have possession of the property
[41:07.760 --> 41:12.760]  They say they use tax money to purchase
[41:12.760 --> 41:20.760]  But the point here being that they destroy that original ownership document and they issue that certificate of title in its place
[41:20.760 --> 41:29.760]  But the certificate of title only applies to vehicles that are owned by the state or political subdivision of the state
[41:29.760 --> 41:34.760]  So that must mean that when a dealer sells a car to the general public
[41:34.760 --> 41:48.760]  There has to be some other mechanism involved about who maintains the MSO or MCO in good stead to return it to the individual when the lien has paid off
[41:48.760 --> 41:57.760]  Because a certificate of title cannot be issued to a private owner
[41:57.760 --> 42:05.760]  It's right here in the code a certificate of title doesn't apply to a private owner
[42:05.760 --> 42:16.760]  So where's the mechanism for a private owner to register a private automobile as a motor vehicle?
[42:16.760 --> 42:20.760]  Again, I can't find it
[42:20.760 --> 42:24.760]  This creates a large disparity we need to be looking at
[42:24.760 --> 42:29.760]  This only applies to the state and the political subdivisions of the state
[42:29.760 --> 42:39.760]  There's nothing in here dealing with a manner in which a private citizen can register private property with the state
[42:39.760 --> 42:50.760]  And still be the owner of the property because he must surrender the ownership papers in order to get the lien document
[42:50.760 --> 43:01.760]  So somewhere there has to be a different set of rules if the rules are intended to apply to you and I
[43:01.760 --> 43:08.760]  But I can't find them, I spent years looking, I can't find them
[43:08.760 --> 43:15.760]  So for those of you that are out there, have a shot, I'm still taking money

[47:51.760 --> 47:57.760]  On November 1st, 2009, I was traveling in my private automobiles
[47:57.760 --> 48:05.760]  Sands any commercial nexus of any kind, no tags, no registration, no inspection, no driver's license, no nothing
[48:05.760 --> 48:11.760]  And I was stopped in the city of Rockdale by a city of Rockdale Municipal Police Officer
[48:11.760 --> 48:19.760]  After educating the officer somewhat, and he was very pleasant at listening to everything I had to say
[48:19.760 --> 48:22.760]  And taking it all in, very, very well in fact
[48:22.760 --> 48:35.760]  But in the process of the stop, he was ordered via radio contact by his chief of police to place me under arrest and to take me to jail
[48:35.760 --> 48:38.760]  Now, he never actually did that
[48:38.760 --> 48:44.760]  He did place me in custody, did put me in his car, and he did take me down to the police station
[48:44.760 --> 48:50.760]  But my jail consisted of sitting in the little booking room with him, talking to him about this subject matter
[48:50.760 --> 48:54.760]  And him typing my name and address into their computer system
[48:54.760 --> 49:00.760]  We then went out front to where the individual, the dispatcher sits
[49:00.760 --> 49:05.760]  And sitting in with the dispatcher was the municipal judge
[49:05.760 --> 49:11.760]  This was a Sunday, but the municipal judge was present in the municipal police station
[49:11.760 --> 49:21.760]  Sitting with the dispatcher when the officer came before him with a prisoner under a transportation code of fence
[49:21.760 --> 49:34.760]  Okay? However, the magistrate made absolutely no effort of any kind to perform any of the ministerial duties placed upon their shoulders by the code of criminal procedure
[49:34.760 --> 49:39.760]  And simply directed the police officer on what to fill out on the paperwork
[49:39.760 --> 49:44.760]  And what to tell me and everything about when I needed to come back
[49:44.760 --> 49:50.760]  The officer then took me back to his patrol car, chauffeured me back to my car
[49:50.760 --> 49:59.760]  And watched me after I gave him a copy of the very seminar book that I had taught out of in class the day before, or the week before
[49:59.760 --> 50:04.760]  And had taken it and promised to read it
[50:04.760 --> 50:12.760]  I then got back in my car and he politely watched me get back on the road and go my merry way as if nothing had ever happened
[50:12.760 --> 50:24.760]  Now, obviously this officer read the book because within a week, I got a notice in the mail from Stein by that very same municipal judge and the city prosecutor
[50:24.760 --> 50:27.760]  Dismissing my case in the interest of justice
[50:27.760 --> 50:34.760]  Now that being said, this officer came to realize he made a boo boo
[50:34.760 --> 50:41.760]  And the problem he has is he made a bigger boo boo based upon a direct order by a superior officer
[50:41.760 --> 50:47.760]  So we will be going after the superior officer, the city itself, and so on and so forth
[50:47.760 --> 50:52.760]  Now, since we're going after him in federal court
[50:52.760 --> 50:58.760]  I have to ask for your support in getting the funds together to support this suit
[50:58.760 --> 51:09.760]  When you donate, if you donate, I want you to remember this money is being used to fight a battle that affects everybody, everywhere

[01:04:41.760 --> 01:04:56.760]  And have questions regarding jurisdiction, the constitutionality of the law, the breathalyzer of the reason for being stopped, the fact that it's been two years since I got pulled over and it still hasn't nothing been decided.
[01:04:56.760 --> 01:05:15.760]  So I don't know any of those that you would like to address. It was a state trooper. It was a two block local road. That's first and foremost I don't think that he really had any business pulling people over on that street.
[01:05:15.760 --> 01:05:19.760]  Well he's a state trooper. His jurisdiction is state wide.
[01:05:19.760 --> 01:05:21.760]  Oh I thought it was just state roads.
[01:05:21.760 --> 01:05:37.760]  No. As far as they're concerned, if the state has any authority over it to set speed limits or anything of that nature in the area by request of the community itself or some other means, then the state has jurisdiction there.

[01:05:42.760 --> 01:05:57.760]  Your statute of limitations question however, that's something a lot more significant. The first thing we need to figure out is one, have you been indicted for this DUI? Is it a misdemeanor or is it a felony?
[01:05:57.760 --> 01:06:03.760]  I think, I don't know. I thought it was considered a misdemeanor but I really don't know.
[01:06:03.760 --> 01:06:12.760]  Well you need to find out and then what you find out after that is what is the statute of limitations on that particular class of misdemeanor.
[01:06:12.760 --> 01:06:35.760]  Now, for the purpose of the statute of limitations, the actual clock for speedy trial kicks in or the statute of limitations kicks in from the date of the actual event in the case of the statute of limitations or in the case of prosecution,
[01:06:35.760 --> 01:06:43.760]  whatever the statute of limitations is from the date the complaint is filed when it comes to speedy trial.
[01:06:43.760 --> 01:06:50.760]  The speedy trial clock does not start ticking until a complaint or an indictment has been filed.
[01:06:50.760 --> 01:06:58.760]  Okay. And generally in most states they can't do an indictment unless there's been a complaint.
[01:06:58.760 --> 01:07:05.760]  Okay. Well, you know, also it's, I don't know how much of the responsibility falls on my lawyer.
[01:07:05.760 --> 01:07:12.760]  Well, a lot of the responsibility, all of it falls on your lawyer. He's the one that's supposed to be keeping track of what's going on.
[01:07:12.760 --> 01:07:23.760]  But again, you have to be responsible for your lawyer. If you want to know what's going on, you have to ride him like you would any horse in a race.
[01:07:23.760 --> 01:07:33.760]  Okay. Every time he isn't going as fast as you want or where you want, you yank the reins, gouge him and smack him with your whip if you need to.
[01:07:33.760 --> 01:07:40.760]  But unless you're working to control your lawyer, he's going to do whatever he wants at whatever pace he wants.
[01:07:40.760 --> 01:07:42.760]  Right. And please, whatever friends he wants.

[01:07:43.760 --> 01:07:52.760]  And that's what I'm trying to find out. Like, how can I, like, what is it I should tell him to get a fire under his butt?
[01:07:52.760 --> 01:08:02.760]  Well, the first thing is you want to know what's been filed against you. Where's the complaint? When was it filed? Where's the indictment if one is necessary? When was it filed?

[01:08:04.760 --> 01:08:13.760]  Now, the problem here is, is you don't know what has been going on behind the scenes if you haven't been keeping tabs on your attorney.
[01:08:13.760 --> 01:08:20.760]  He may have been requesting continuances, which causes your clock to reset.
[01:08:20.760 --> 01:08:33.760]  If all he's doing is dragging his feet on this and he's requesting continuances to extend the time, then your speedy trial clock is reset every time a continuance is requested and granted.

[01:08:34.760 --> 01:08:36.760]  Okay. Well, that's probably what's happening.
[01:08:36.760 --> 01:08:41.760]  So if you're not monitoring this guy, now here's the other problem.
[01:08:41.760 --> 01:08:51.760]  If he goes in and allows a continuance request because the state says they're not ready for trial and he says, oh, well, I'll give you time. Go ahead.
[01:08:51.760 --> 01:08:58.760]  Do what you need to do to get ready to convict my client. Whose side is his attorney actually on?
[01:08:58.760 --> 01:09:02.760]  Yeah. Well, that's a big question in my mind right now.
[01:09:02.760 --> 01:09:06.760]  Okay. So when you hired this guy, did they appoint him or did you pay money for him?

[01:09:08.760 --> 01:09:16.760]  Okay. Then why would you feel like your employee is not under your control and that you don't need to be watching what kind of job they're doing?

[01:10:39.760 --> 01:10:44.760]  What was their articulatable probable cause to make the stop?
[01:10:44.760 --> 01:10:51.760]  Well, they said I took the turn too wide, which they observed from the bottom of the hill a block away.
[01:10:51.760 --> 01:10:56.760]  Now, the reason I took that turn wide is the same reason I would have, had I not had a.08 alcohol level,
[01:10:56.760 --> 01:11:03.760]  which is because I live in a college town and there were students all over the road, all over the sidewalk everywhere.
[01:11:03.760 --> 01:11:09.760]  And the light visibility is not good at that corner. And I took their turn wide to be safe.
[01:11:09.760 --> 01:11:16.760]  Okay. Then there's mitigating circumstances involved as to the reason they initiated the stop.
[01:11:16.760 --> 01:11:22.760]  Right. And unfortunately they don't have cameras in the car because that actually probably would very much work for me in this case.
[01:11:22.760 --> 01:11:26.760]  Yeah. But then again, they can't disprove your point of view either, can they?
[01:11:26.760 --> 01:11:35.760]  Well, right. And that's why I don't think I have much to go on with that one because, you know, I don't have people coming into court saying,
[01:11:35.760 --> 01:11:40.760]  Oh, yeah. Was it day or was it night? It was three o'clock in the morning. There were no other cars.
[01:11:40.760 --> 01:11:47.760]  I never saw a single. Wait, wait, wait, wait. I'm trying to draw a picture here and I need this picture before I can tell you anything else.
[01:11:47.760 --> 01:11:53.760]  It's night time three in the morning. The corner where you made this turn, are there streetlights?
[01:11:53.760 --> 01:11:58.760]  There's a streetlight on the far corner and it actually creates kind of a blind spot. It creates a weird shadow.

[01:12:02.760 --> 01:12:10.760]  It was a right, right turn. Okay. So you made a right hand turn. The light is not on the corner of the right hand turn.

[01:12:24.760 --> 01:12:37.760]  Now, could you, from where these officers were sitting, see if there was anybody standing on the sidewalk in the right hand turn or crossing the street in the right hand turn?
[01:12:37.760 --> 01:12:45.760]  Well, I guess I would have to go and see where they were staying to know that for sure, but probably because it's a pretty clear, it's a straight view right up the road.
[01:12:45.760 --> 01:12:50.760]  Okay. But it's three o'clock in the morning now. Again, it's dark, or is it?
[01:12:50.760 --> 01:12:54.760]  Do you live where there's a lot of northern lights here in New York?
[01:12:54.760 --> 01:13:01.760]  No. Okay. But that street creates a glare. I don't know what kind of glare it creates from their angle.
[01:13:01.760 --> 01:13:07.760]  Okay. Well, you might want to go take that position one night around that same time and see if you can find out.

[01:13:08.760 --> 01:13:18.760]  Have somebody go with you that you can drop off at that corner, go where they were, and see how visible they are moving around on that corner or trying to cross that street.

[01:13:24.760 --> 01:13:42.760]  Now, what this does is it gives you something to use in court if necessary to show the conditions then existing to show that the reason you took the turn wide was that someone was on the corner and you wanted to make sure they did not step off and, you know, into the traffic when you made the turn.
[01:13:42.760 --> 01:13:45.760]  Now, is there a crosswalk there?
[01:13:45.760 --> 01:13:48.760]  Probably. I don't recall for sure.
[01:13:48.760 --> 01:13:53.760]  Well, again, something you need to find out and make sure of because here's the other problem.
[01:13:53.760 --> 01:14:06.760]  If they were already in the crosswalk, if there was pedestrians present, then you should have never made the right hand turn because they have the right of way, unless there's a light for the crosswalk.
[01:14:06.760 --> 01:14:17.760]  In which case they have probable cause to stop you if they saw pedestrians and you attempting to make a right turn when the pedestrian had the right of way.
[01:14:17.760 --> 01:14:22.760]  Right. I understand that. That wasn't their reason that they gave for pulling me over.
[01:14:22.760 --> 01:14:36.760]  And the people all were going to an apartment complex that is down that street so people wouldn't have actually been crossing the street. They would be approaching that corner to turn right to go in the same direction I was going in.
[01:14:36.760 --> 01:14:50.760]  Okay. Well, even if so, my earlier question was what did they do as saying what their probable cause was? What did they tell you it wasn't?

They could certainly see as they pulled, after they pulled me over that there was a horde of, you know, 18 to 22 year old students walking by who are not knowing enough to stay out of the street like there are cars coming.

[01:15:26.760 --> 01:15:30.760]  I mean, they certainly saw all that because they all stopped and looked.

[01:21:51.760 --> 01:21:58.760]  I do have a date, but I'm trying to figure out where I could find out the or before to show up and file the affidavit.
[01:21:58.760 --> 01:22:06.760]  Well, usually the citation itself is where it says in the statement that I promised to appear on or before the following date and time.

[01:34:42.760 --> 01:34:46.760]  Her mom was coming from North Dakota, which was about an hour and a half away, so on the
[01:34:46.760 --> 01:34:51.760]  drive, her mom on her drive back to Gator from this town, which is this reservation town,
[01:34:51.760 --> 01:34:54.760]  so it was kind of unsafe and he didn't want her to drive.
[01:34:54.760 --> 01:34:58.760]  So he just sat there with her in her front seat of his car at a gas station waiting for
[01:34:58.760 --> 01:35:00.760]  her mom to pick her up.
[01:35:00.760 --> 01:35:04.760]  The person there, after he already sat, cited her for a ticket.
[01:35:04.760 --> 01:35:09.760]  Anyways, her mom called me and then she's saying he's allowing her phone call, so I
[01:35:09.760 --> 01:35:10.760]  called her.
[01:35:10.760 --> 01:35:12.760]  I talked to her about what's going on.
[01:35:12.760 --> 01:35:14.760]  I talked to the officer, asked what happened.
[01:35:14.760 --> 01:35:18.760]  He told me she failed two sobriety tests and I said, was that enough raiser for you to
[01:35:18.760 --> 01:35:20.760]  give her a DUI charge?
[01:35:20.760 --> 01:35:21.760]  He's like, yes.
[01:35:21.760 --> 01:35:22.760]  I said, okay.
[01:35:22.760 --> 01:35:26.760]  So anyways, I got the phone with him, got the phone with her and then I called her back.
[01:35:26.760 --> 01:35:30.760]  I had her call me after she got out of the car and I said, well, why don't you go back
[01:35:30.760 --> 01:35:39.760]  to him and tell him that he will consent to a breath test with a lawyer present and buy
[01:35:39.760 --> 01:35:42.760]  a physician or a nurse, buy a qualified physician or a nurse.
[01:35:42.760 --> 01:35:46.760]  So she went back, got the phone with me, went back and said that.
[01:35:46.760 --> 01:35:48.760]  And I knew he was going to say this, well, it's too late.
[01:35:48.760 --> 01:35:54.760]  So I told her, I was like, well, he's probably just going to say it's too late and you're
[01:35:54.760 --> 01:35:57.760]  not going to do it, but at least he tried.
[01:35:57.760 --> 01:36:02.760]  And so at none of this point, he was ever read or write.
