[05:05.460 --> 05:09.820]  that's been passed by Congress, we're not talking about Codex Alimentarius here, this
[05:09.820 --> 05:18.540]  is new regulations that apply to basically natural herbal products or, you know, any
[05:18.540 --> 05:25.820]  kind of natural products, they don't apply to nutraceuticals, which are synthetics,
[05:25.820 --> 05:33.460]  which is odd, however, but the alarming news is that this could mean the end of Shintrition.
[05:33.460 --> 05:40.340]  And so we need to rally to help Stephen here, because I know all of us that use his product
[05:40.340 --> 05:44.900]  greatly benefit from it, so Stephen, give us the low down, what is going on with the
[05:44.900 --> 05:45.900]  FDA?
[05:45.900 --> 05:52.420]  Well, nutraceuticals, and you're right about that, nutraceuticals is being used improperly
[05:52.420 --> 06:01.220]  a lot out there, and it includes a lot of chemical-based vitamins and mineral supplements,
[06:01.220 --> 06:11.340]  but it also can include or does include extracts, which can either be active or full-spectrum
[06:11.340 --> 06:17.100]  extracts or standardized extracts, so a full-spectrum extract would, of course, take out all the
[06:17.100 --> 06:22.860]  active ingredients, whereas in supporting ingredients, an extract amount, either concentrate
[06:22.860 --> 06:29.700]  them or just keep them on whatever basis they've extracted them out in, a standardized extract
[06:29.700 --> 06:34.100]  will identify what they believe to be the primary active ingredient and pull that out
[06:34.100 --> 06:40.980]  and then utilize that in either a concentrate formula or pill or some other capsule or gel
[06:40.980 --> 06:47.180]  cap or something like that, and sort of nutraceuticals has been used across the board that term,
[06:47.180 --> 06:52.220]  but the ones you're right that are exempt from this are the ones that, of course, are
[06:52.220 --> 06:59.700]  synthesized active ingredients up front, and their make-up is, of course, man-made chemical,
[06:59.700 --> 07:02.060]  and they're exempt from this because who makes those?
[07:02.060 --> 07:03.820]  Well, the pharmaceutical industry.
[07:03.820 --> 07:08.140]  Basically, what is happening is they're undermining the Disha Act, and if your listeners don't
[07:08.140 --> 07:12.260]  know exactly what the Disha Act, I'll go ahead and sell that out for them.
[07:12.260 --> 07:17.860]  It's the Dietary Supplement Health and Education Act, and that was passed in 1994.
[07:17.860 --> 07:26.580]  There was landmark legislation, and it was passed to protect all of us, consumers first,
[07:26.580 --> 07:31.740]  and that was to protect our dietary rights, our rights to be able to go out here and buy
[07:31.740 --> 07:32.740]  food stuff.
[07:32.740 --> 07:39.700]  Food stuff includes whole foods or any derivative of food such as herbs, vitamins, minerals,
[07:39.700 --> 07:43.900]  and extracts, like I said, to better our health and well-being.
[07:43.900 --> 07:50.980]  Secondly, it was to protect manufacturers or designer of products like myself from government
[07:50.980 --> 07:55.660]  encroachment, namely the FDA coming in and over-regulating it.
[07:55.660 --> 07:56.820]  Why did we do that?
[07:56.820 --> 08:03.020]  Because they wanted to regulate all medicinal food stuff as drugs.
[08:03.020 --> 08:10.540]  Now, they used the Nevilleur language, of course, and that was the language or the premise
[08:10.540 --> 08:13.500]  that they come from is that we want to protect the consumer, and that's nice.
[08:13.500 --> 08:14.500]  I want to protect the consumer, too.
[08:14.500 --> 08:18.820]  I don't want to poison the consumer, but they wanted us to meet the same standards that
[08:18.820 --> 08:23.500]  the drug companies meet, and in order to meet those standards, it would put just about all
[08:23.500 --> 08:27.580]  of the natural product manufacturers out of business.
[08:27.580 --> 08:28.580]  Why would it do that?
[08:28.580 --> 08:32.420]  Because then we would have to throw out thousands of years, in some cases, of anecdotal studies,
[08:32.420 --> 08:37.020]  that is testimonial studies, because they were no longer met the scientific method of
[08:37.020 --> 08:42.100]  double blind studies, since that's the only thing that they used to meet their requirements.
[08:42.100 --> 08:47.980]  A little note, big pharma only meets 15% of their own requirements.
[08:47.980 --> 08:51.980]  In order to do that, meet those requirements, someone like me who has 39 ingredients in
[08:51.980 --> 08:57.420]  his product cannot rely on anecdotal studies or testimonial studies or trial and improvement
[08:57.420 --> 09:01.340]  with patients and clients over thousands of years.
[09:01.340 --> 09:05.180]  They would have to submit this double blind study, and in some cases, it could be as much
[09:05.180 --> 09:10.700]  as $2 million in several years to a study on just one of these herbs or just one of these
[09:10.700 --> 09:11.700]  ingredients.
[09:11.700 --> 09:17.100]  Now, most of all of the products out there, the big boom we experienced with the superfoods
[09:17.100 --> 09:21.780]  products and the multi-ingredients and the heavy concentrate that we all rely on for
[09:21.780 --> 09:24.820]  our health and stuff has come on the market since 1994.
[09:24.820 --> 09:28.780]  So, here's where the big issue we're having now.
[09:28.780 --> 09:34.380]  These new regulations that are coming down basically target all of the products made
[09:34.380 --> 09:35.380]  after 1994.
[09:35.380 --> 09:38.980]  Now, they have what they call ODI and NDI.
[09:38.980 --> 09:41.740]  ODI means Old Dietary Ingredients.
[09:41.740 --> 09:47.100]  That means anything that was used in plain sight in the retail arena and whatever they
[09:47.100 --> 09:53.380]  determined to be enough quantity is an ODI, an Old Dietary Ingredient, prior to 1994.
[09:53.380 --> 09:56.620]  And they're not subjected to this.
[09:56.620 --> 09:57.620]  But they are.
[09:57.620 --> 10:03.580]  Now, anything used after that is an NDI, New Dietary Ingredient, after 1994.
[10:03.580 --> 10:08.660]  Now, what we were supposed to do, any New Dietary Ingredient.
[10:08.660 --> 10:12.500]  It was not in the general marketplace in 1994.
[10:12.500 --> 10:19.060]  You had to submit or just notify, just notify the FDA that you're using it.
[10:19.060 --> 10:22.940]  It wasn't an approval process, it was just notification.
[10:22.940 --> 10:29.700]  So what they've done to the Disha law is they're undermining it with semantics by saying that
[10:29.700 --> 10:37.620]  now anything, 17 years later, anything that was designed since 1994, that means if you're
[10:37.620 --> 10:42.980]  using all Old Dietary Ingredients but you're using them in a different arrangement or a
[10:42.980 --> 10:50.380]  different form as an extract or a concentrate, a 5 to 1, a 7 to 1, a 3 to 1 concentrate, or
[10:50.380 --> 10:59.220]  a different part of this plant, the stem, the root, or the rhizome, or it's harvested
[10:59.220 --> 11:05.380]  at a different time of the year, or is supposed to be as stronger because of where it's harvested.
[11:05.380 --> 11:07.540]  I mean, there's a long list of this stuff.
[11:07.540 --> 11:14.900]  You have to submit an application more or less and go through an approval process through
[11:14.900 --> 11:16.220]  the FDA now.
[11:16.220 --> 11:19.460]  That's what the new regulations are going to have everyone do.
[11:19.460 --> 11:24.940]  So, the FDA now is no longer a notification process, which is all we had to do before
[11:24.940 --> 11:28.500]  because remember, our rights were protected, our health rights.
[11:28.500 --> 11:36.820]  Now it's an approval process that each manufacturer of any product after 1994 health care product
[11:36.820 --> 11:41.820]  that is natural products that are ingestible will have to go through this process.
[11:41.820 --> 11:47.620]  Now, Stephen, I've heard some rumblings about this before you called me.
[11:47.620 --> 11:53.140]  Isn't it true that every manufacturer would have to go through this even if they were
[11:53.140 --> 11:57.460]  selling the exact same herb or the exact same extract?
[11:57.460 --> 12:04.420]  It's not like one manufacturer could do it for the benefit of all the other manufacturers.
[12:04.420 --> 12:07.860]  Every single manufacturer would have to do this for every single thing even if they're
[12:07.860 --> 12:08.860]  all identical.
[12:08.860 --> 12:09.860]  Is that correct?
[12:09.860 --> 12:10.860]  Exactly.
[12:10.860 --> 12:13.860]  And the big thing is cost.
[12:13.860 --> 12:17.660]  That's really going to bury a lot of folks, especially mom and pop.
[12:17.660 --> 12:25.700]  Even big companies who carry hundreds of products or hundreds of multi-herbal and vitamin and
[12:25.700 --> 12:26.700]  mineral products.
[12:26.700 --> 12:32.220]  And I couldn't even imagine if I had a huge line and I would have to go through each one.
[12:32.220 --> 12:36.940]  And then the pain of it all is that you can't sell during this whole process for a minimum
[12:36.940 --> 12:37.940]  of 75 days.
[12:37.940 --> 12:45.140]  That is, they return your application within 75 days, but until you get an okay, you cannot
[12:45.140 --> 12:46.140]  sell.
[12:46.140 --> 12:49.300]  So everything must shut down as we pull from the shelf.
[12:49.300 --> 12:54.420]  And that's really where I believe is going to undermine a lot of these folks out there
[12:54.420 --> 13:00.340]  because 75 days is a long time to stop business and that's minimum.
[13:00.340 --> 13:01.660]  That's what we're looking at.
[13:01.660 --> 13:04.900]  When does this all go into effect, Stephen?
[13:04.900 --> 13:09.380]  Well, I spoke with my attorney and he said anywhere from about two months to two years,
[13:09.380 --> 13:11.140]  he said plan on about a year.
[13:11.140 --> 13:12.340]  So we're already on it.
[13:12.340 --> 13:18.300]  We're getting all of our NDIs taken care of right now to submit them at the moment.
[13:18.300 --> 13:21.100]  We have an opportunity to submit them.
[13:21.100 --> 13:25.020]  And then, you know, he told us it's a 50-50 chance basically, you know, if you can jump
[13:25.020 --> 13:29.940]  through all of their hoops, then, you know, you're in business and he says, really, we
[13:29.940 --> 13:31.620]  don't know what that is.
[13:31.620 --> 13:36.540]  They could decide that a particular herb and the milligram dosage we're using it in is
[13:36.540 --> 13:37.540]  toxic.
[13:37.540 --> 13:45.020]  And just for your consumers out there, the listeners out there, we don't have any recorded
[13:45.020 --> 13:49.820]  cases of anyone ever ODing on dietary supplements.
[13:49.820 --> 13:55.180]  What we do have, if I should correct that, natural whole food dietary supplements, which
[13:55.180 --> 14:02.860]  is what centrition is, the toxicology reports on dietary supplements that have harmed people
[14:02.860 --> 14:08.740]  are those chemically-based ones made by Big Pharma and not the whole foods ones.
[14:08.740 --> 14:14.580]  So what they're trying to do is to link us and the whole food industry to these individuals
[14:14.580 --> 14:19.700]  and these products that they make at synthesizing laboratories, which are unnatural to the body.
[14:19.700 --> 14:24.220]  You don't have to be a scientist and you certainly don't have to be a clinician to figure out
[14:24.220 --> 14:25.900]  that these things are unnatural to the body.
[14:25.900 --> 14:31.500]  You take them in high enough doses, they're going to create toxicity in the system.

[14:32.500 --> 14:38.700]  Well, I mean, it's pretty obvious they've been bringing this down for a long time in
[14:38.700 --> 14:46.740]  different forms, whether statute or regulation, they want to get rid of whole natural substances.
[14:46.740 --> 14:51.900]  They don't want people to be able to get herbs and superfoods at all.
[14:51.900 --> 14:56.820]  And if they're going to even let it be available at all, they want it to go through the Western
[14:56.820 --> 15:01.340]  medicine machine where you have to go and get a prescription for it.

[15:03.540 --> 15:05.340]  They want you to go to get a prescription for it.
[15:05.340 --> 15:07.180]  They want to monetize every end of it.
[15:07.180 --> 15:10.300]  They bought up most of the manufacturing houses out there.
[15:10.300 --> 15:14.300]  So their next step is to get it on the other end, on the retail end.
[15:14.300 --> 15:16.220]  And this is their big push to do it.
[15:16.220 --> 15:21.140]  Now, they didn't do it the same way in the European Union or in Canada.

[15:23.340 --> 15:28.340]  In Europe, as of June 1st this last year, I could no longer sell my product in Europe.
[15:28.340 --> 15:34.020]  And Canada, it's troublesome to get our product in bulk over in Canada.
[15:34.020 --> 15:38.420]  And they both use different methods to get this done in Canada and in the European Union.
[15:38.420 --> 15:43.020]  Of course, they couldn't get Kodak's elementaries through here, but this actually went through
[15:43.020 --> 15:45.140]  through the Food Safety Act.
[15:45.140 --> 15:49.260]  I love those words, the Food Safety Bill, the F510 Bill.

[15:51.020 --> 15:58.980]  So it kind of pushed the FDA forward into language that was already in the book for

[15:59.980 --> 16:06.460]  It was somewhat ambiguous to move forward in this direction with the NDIs, new dietary
[16:06.460 --> 16:13.540]  ingredients, by just grouping any supplement created after 1994 as an NDI simply because
[16:13.540 --> 16:15.660]  of the arrangement of those NDIs.
[16:15.660 --> 16:22.340]  And of course, farming methods and cultivation methods, all of these things have changed in
[16:22.340 --> 16:27.820]  the last 17 years because a lot of these places that all these products were farmed at, or
[16:27.820 --> 16:33.340]  a lot of them, and the hills and mountains and Nepal and China, they were still putting
[16:33.340 --> 16:37.460]  a hose to the ground and using very ancient old farming methods.
[16:37.460 --> 16:41.500]  And when our technology went in there and tried to mass produce, we changed a lot of
[16:41.500 --> 16:42.500]  that.
[16:42.500 --> 16:43.500]  That's an NDI.

[26:41.020 --> 26:46.700]  is important, that protects the right of access of consumers to safe dietary supplements

[26:50.340 --> 26:56.580]  This is, for my sake, why they're having a public hearing because dietary supplements

[26:57.580 --> 27:01.980]  We don't have anything out there that shows the whole food, anyone has ever been poisoned

[27:18.460 --> 27:23.060]  Well, medical doctors who are not qualified to prescribe herbal medicine or nutritional
[27:23.060 --> 27:35.100]  medicine, they found that another secondary function of Ma Hong or ephedra was an amputation,
[27:35.100 --> 27:36.100]  an amputated suppressant.
[27:36.100 --> 27:40.420]  Well, we would never use that in Chinese medicine as an amputated suppressant, but
[27:40.420 --> 27:46.020]  it makes sense, if you have a bronchial dilator, the VLI and the lungs are getting bigger,
[27:46.020 --> 27:48.260]  more oxygen, we would crave less food.
[27:48.260 --> 27:53.540]  So they started using a dietary supplement, and they were using extracts, standardized
[27:53.540 --> 27:58.540]  extracts, that would take it out, or they would take, and they would concentrate in
[27:58.540 --> 28:05.060]  high amounts, or they would take and synthesize through man-made chemicals, the equivalent,
[28:05.060 --> 28:08.460]  or what they believe the equivalent of ephedra, or fadrin.
[28:08.460 --> 28:14.060]  And then that was used improperly, as a weight loss supplement, and people would go out in
[28:14.060 --> 28:17.780]  the hot sun, of course, morbidly obese people that had no business being in the hot sun,
[28:17.780 --> 28:20.660]  trying to lose weight, they would be on this product.
[28:20.660 --> 28:26.100]  So because it was improperly used, there was this big outcry all over the news that we
[28:26.100 --> 28:30.780]  need to pull it from the shelves, and they did pull it from the shelves, and it's a great
[28:30.780 --> 28:37.380]  herbal treatment for asthma and other bronchial conditions that we use in Chinese medicine,
[28:37.380 --> 28:41.180]  and the Chinese have used for thousands of years, and we can't get it in this country
[28:41.180 --> 28:42.180]  anymore.
[28:42.180 --> 28:47.020]  And it's just, I mean, that's the kind of stuff that we're facing.
[28:47.020 --> 28:54.100]  We get someone that's not qualified to be prescribing this, and they prescribe it improperly,
[28:54.100 --> 29:00.060]  and then someone does get hurt from it, or there's a chemical synthesized equivalent

[01:50:05.780 --> 01:50:10.780]  Now, just so we're clear, why do they not have subject matter jurisdiction?

[01:50:18.780 --> 01:50:27.780]  The state failed to meet the statutory requirements that are necessary in order to invoke the subject
