[05:23.620 --> 05:28.620]  We definitely want to support you guys. We're big Ron Paul fans around here, that's for sure.
[05:28.620 --> 05:35.620]  So please tell us, what is this project, the Grass Roots Press Project? Okay, the Austin
[05:35.620 --> 05:43.620]  Ron Paul Meetup put together a team of writers and editors, and we're donating our time to
[05:43.620 --> 05:51.620]  create a Grass Roots newspaper titled, The Grass Roots Press. And the objective is to send out
[05:51.620 --> 05:58.620]  100,000 copies of this Grass Roots newspaper to Iowa, New Hampshire, and South Carolina,
[05:58.620 --> 06:05.620]  but primarily Iowa. And people always ask, why Iowa? Why are we focused on Iowa?
[06:05.620 --> 06:14.620]  The reason being, the Ames, Iowa straw poll is coming up August 13th, and as a nationwide
[06:14.620 --> 06:22.620]  Grass Roots, we're working to get 5,000 votes there at the straw polls for Dr. Paul. That
[06:22.620 --> 06:28.620]  should be enough to win it. If he wins it, there's two things that I think we can predict
[06:28.620 --> 06:37.620]  would happen. One is that establishment Republicans who maybe didn't accept Dr. Paul as
[06:37.620 --> 06:44.620]  mainstream in 2008 will maybe begin to recognize him as a mainstream candidate if he wins that
[06:44.620 --> 06:49.620]  poll. It's the most prominent straw poll in the nation. The second thing that we hope will
[06:49.620 --> 06:56.620]  happen is that the mainstream media cannot cover it up. If we can deliver a win, it really
[06:56.620 --> 07:04.620]  can't be covered up. So to drive the revolution to a critical mass and get Dr. Paul the publicity
[07:04.620 --> 07:12.620]  that he deserves, we're working really hard to achieve those winning straw poll votes in Iowa.
[07:12.620 --> 07:18.620]  Now Pam, let me ask you something concerning the Iowa straw poll. Can anyone go vote in
[07:18.620 --> 07:22.620]  the straw poll or do you have to be a registered Republican? I mean, I know here in the state
[07:22.620 --> 07:28.620]  of Texas, if you were not a delegate the previous year, you can't vote in the straw poll. So
[07:28.620 --> 07:30.620]  how does it work in Iowa?
[07:30.620 --> 07:36.620]  In Iowa, it's an open straw poll. Voters do not need to be registered Republican. They
[07:36.620 --> 07:43.620]  just need to be 18 years or older. They need to either be a resident of Iowa or a student
[07:43.620 --> 07:48.620]  of college in Iowa. And so those rules are explained in this newspaper. We have a big
[07:48.620 --> 07:54.620]  promo blurb about the straw poll explaining who can go vote and the importance of it.
[07:54.620 --> 08:03.620]  And this paper would go out as a scatter broadcast. So it would pick up independent things.
[08:03.620 --> 08:09.620]  Any, you know, to work outside the GOP. The official campaign is working mostly within
[08:09.620 --> 08:16.620]  the GOP. So to complement that, we'd like to do this scatter broadcast in print that
[08:16.620 --> 08:20.620]  could be received by independent and just anybody.
[08:20.620 --> 08:26.620]  And how is this, and also so folks know, Iowa is like one of the first primary states. Is
[08:26.620 --> 08:27.620]  that correct?
[08:27.620 --> 08:35.620]  It's a caucus, yes. And it is one of the first, yes, one of the first primary caucus
[08:35.620 --> 08:42.620]  even. In fact, Iowa, New Hampshire, and so on are all early primary states.
[08:42.620 --> 08:48.620]  So the way we've planned this is that meetup groups, organizers in Iowa, could request
[08:48.620 --> 08:54.620]  copies of this paper and they can distribute it with their beef on the ground. They can
[08:54.620 --> 09:01.620]  give it out at events. They can deliver it door to door. And when this gives them an
[09:01.620 --> 09:05.620]  official material, they can use it in addition to what the official campaign is furnishing
[09:05.620 --> 09:06.620]  them.
[09:06.620 --> 09:14.620]  So what we hope to do is raise the funds for this nationally. But, you know, if anyone
[09:14.620 --> 09:19.620]  within the sound of our voices could contribute to this project, it can be funded and ready
[09:19.620 --> 09:26.620]  to go. We'll be ready to go to print on July 15. We really need to get it funded by July
[09:26.620 --> 09:37.620]  9. And literally a $10 donation will cover 140 issues of this newspaper for circulation.
[09:37.620 --> 09:47.620]  So it's a very cost effective piece of literature. The website that gives the details and has

[09:58.620 --> 10:05.620]  a chip in there. So even, you know, if everyone just chipped in a small amount, you know, many
[10:05.620 --> 10:12.620]  hands make white work and many contributors make it easy and it gives us wings, you know,
[10:12.620 --> 10:17.620]  which is what the Ron Paul Revolution is so good at. We did each other wings.
[10:17.620 --> 10:24.620]  Absolutely. So Pam, give us an idea of what is going to be in this publication. What kind
[10:24.620 --> 10:26.620]  of information?
[10:26.620 --> 10:33.620]  Well, we have a big splash article on the front page. The headline is Americans are
[10:33.620 --> 10:40.620]  ready for Ron Paul. And it's describing the growth in the movement between 2008 and 2012.
[10:40.620 --> 10:47.620]  What types of people are flocked to become Ron Paul supporters now? And what we're seeing
[10:47.620 --> 10:57.620]  is quite a few neocons, former neocons, and that's how they describe themselves. I prefer
[10:57.620 --> 11:02.620]  to call them formerly neocons because there's a lot of deception that brought them to that
[11:02.620 --> 11:09.620]  place. So I commend them for turning around. They are, you know, becoming Ron Paul supporters
[11:09.620 --> 11:14.620]  this time around. They now appreciate the principle of liberty that he's talked about for so many
[11:14.620 --> 11:22.620]  years and they're becoming more non-interventionist in their views. So that's one exciting segment
[11:22.620 --> 11:28.620]  of growth that we're seeing. But just all kinds of people are turning to Ron Paul and that's
[11:28.620 --> 11:34.620]  what we describe in that article. And it's done from a grassroots peer level. In other
[11:34.620 --> 11:40.620]  words, we quote a lot of grassroots supporters in Iowa in that article. We also have articles
[11:40.620 --> 11:48.620]  about the economy, job and housing losses. We have an article about the Federal Reserve.
[11:48.620 --> 11:57.620]  We have an article about TSA, one about Dr. Paul's record of home school support, which
[11:57.620 --> 12:07.620]  is a big thing to Iowans. So basically we've chosen issues that appeal to the demographics
[12:07.620 --> 12:10.620]  there in Iowa especially.
[12:10.620 --> 12:13.620]  Is there a way that folks can read some of these articles on the Web site? Are they published
[12:13.620 --> 12:15.620]  yet on the Web site?
[12:15.620 --> 12:21.620]  There will be. They're going through, right now we have two phases running concurrently.
[12:21.620 --> 12:28.620]  We have final editing going on and layout going on. But what we have is my layout that does
[12:28.620 --> 12:34.620]  not have the final edited versions in it. That will be coming within days. So we hope to be
[12:34.620 --> 12:41.620]  able to put a PDF file of the actual newspaper up on the Web site. And we hope to do this
[12:41.620 --> 12:48.620]  before the funding deadline is, but we're working as fast as we can and we may or may not be
[12:48.620 --> 12:51.620]  able to get that done.
[12:51.620 --> 12:55.620]  Plus, y'all are just really working hard. And I remember you contacting me about this
[12:55.620 --> 13:00.620]  a few weeks ago to try to get some PSAs going through the different outlets that I have
[13:00.620 --> 13:06.620]  connections with. And folks, this is a very worthy cause. We've got to target these states
[13:06.620 --> 13:12.620]  like Iowa and New Hampshire. North Carolina, is that right? North Carolina?
[13:12.620 --> 13:14.620]  South Carolina.
[13:14.620 --> 13:18.620]  And we've got to target these states like South Carolina, Iowa and New Hampshire because
[13:18.620 --> 13:23.620]  they are the early primary states. And that will set the stage for how the whole primaries

[14:23.620 --> 14:28.620]  been timely and proven. Obviously, Texas isn't organized the same way Connecticut is,
[14:28.620 --> 14:35.620]  but if anything holds true, comparative to Nevada in 2008 and the way things have gone
[14:35.620 --> 14:40.620]  and comparatively to Connecticut with Peter Schiff in 2010.
[14:40.620 --> 14:46.620]  There's one thing I should say, and it's this. You may think a lot of people have been converted,
[14:46.620 --> 14:52.620]  but they're actually not. You've got to be very careful about who's saying what to you
[14:52.620 --> 14:58.620]  as far as what's going on in the Republican Party because a lot of times you have to be
[14:58.620 --> 15:02.620]  mindful of the networks that are going on in the Republican Party.
[15:02.620 --> 15:08.620]  Make sure you know who's who, who knows who and how the rules are actually going on
[15:08.620 --> 15:14.620]  concerning the convention. I'm not sure how Texas is organized, but in Connecticut,
[15:14.620 --> 15:19.620]  the convention actually has a lot to do with who can actually get on the primary ballot
[15:19.620 --> 15:21.620]  and who can't.
[15:21.620 --> 15:26.620]  All right. Well, right now we're targeting the straw poll in Iowa with this publication.

[15:29.620 --> 15:33.620]  Certainly, we have to keep mindful of the different rules in the different states,
[15:33.620 --> 15:39.620]  and that is an incredible situation that the straw poll is open.
[15:39.620 --> 15:43.620]  You don't even have to be registered as a Republican because I do know for sure in Texas
[15:43.620 --> 15:50.620]  in order to actually participate in the straw poll, you have to have been a delegate.
[15:50.620 --> 15:56.620]  You don't have to be a registered Republican, but you had to have been elected by your precinct
[15:56.620 --> 16:03.620]  to be a delegate representing your precinct in order to be able.
[16:03.620 --> 16:09.620]  The previous year in order to participate in the straw poll because they wanted to prevent sandbagging,
[16:09.620 --> 16:13.620]  so it's very difficult to be able to participate in the straw poll here in Texas,
[16:13.620 --> 16:21.620]  but in Iowa it's open, and so we want to target these Iowa voters to get them in to vote for Ron Paul

[22:38.620 --> 22:43.620]  I don't care because the point is here's what they do.
[22:43.620 --> 22:47.620]  The counting, it doesn't matter how great the software is.
[22:47.620 --> 22:49.620]  We don't know what it is.
[22:49.620 --> 22:57.620]  There's no way for us to have any oversight over this magnificent software or so-called magnificent software.
[22:57.620 --> 23:04.620]  And even in the state of Texas, it's in the Texas election code that the software is proprietary.
[23:04.620 --> 23:08.620]  So I don't want to hear about how great and reliable computers are.
[23:08.620 --> 23:10.620]  I work with computers all the time.
[23:10.620 --> 23:12.620]  They're not so reliable for one thing.
[23:12.620 --> 23:15.620]  And for another thing, it doesn't matter how reliable they are.
[23:15.620 --> 23:17.620]  This is about oversight.
[23:17.620 --> 23:22.620]  This is about public oversight of the counting process.
[23:22.620 --> 23:26.620]  That's what this is about and you're never going to get that with a computer.

[23:29.620 --> 23:36.620]  Some of these states have gone so far as to put the computer that counts the votes in the middle of the floor

[23:42.620 --> 23:45.620]  Even a two-year-old wouldn't buy that.

[23:47.620 --> 23:50.620]  We've got to have public oversight over the counting process.
[23:50.620 --> 23:55.620]  And that means I'm watching over your shoulder as you're pulling the ballot out of the box

[23:59.620 --> 24:03.620]  and that it's added up properly and that it's on videotape
[24:03.620 --> 24:06.620]  and that the video is going out live over the Internet

[25:09.620 --> 25:13.620]  In Connecticut, they elected their state central committee on May 10th
[25:13.620 --> 25:16.620]  and there was a lot of focus on that for one important reason,
[25:16.620 --> 25:19.620]  namely all delegates are not created equal.
[25:19.620 --> 25:25.620]  Each member of state central I believe has about three to four times the amount of vote
[25:25.620 --> 25:29.620]  that your average delegate has in the state of Connecticut
[25:29.620 --> 25:34.620]  and I believe there are only four seats that were overturned out of 72 in the state of Connecticut
[25:34.620 --> 25:38.620]  and the same applies to party officers which have even more poll.
[25:38.620 --> 25:43.620]  The chairman of the party has great sway to write the rules of the convention
[25:43.620 --> 25:49.620]  and can change them last minute distinctively last time they changed from Roberts to Mason
[25:49.620 --> 25:53.620]  at the last minute, never told any of the new people from the Tea Party that were getting involved.
[25:53.620 --> 25:58.620]  And the moral of the story on top of that is all the elected Republicans in the state,
[25:58.620 --> 26:02.620]  they're pretty much rhinos and they have pretty much the same delegate voting status.
[26:02.620 --> 26:06.620]  So combined with state central and the elected Republicans,
[26:06.620 --> 26:08.620]  they pretty much outweigh all of the delegates.
[26:08.620 --> 26:15.620]  Ergo, they determine who gets into the primary without a petition who doesn't.
[26:15.620 --> 26:21.620]  I understand that's not the way it works in every state but Connecticut's deck is incredibly stacked
[26:21.620 --> 26:31.620]  and that horse pretty much rode into town and left.
[26:31.620 --> 26:35.620]  Okay Dan, it's not nice to tell us a problem.
[26:35.620 --> 26:40.620]  I was just saying, you know, if somebody wants to get Ron Paul on the ballot,
[26:40.620 --> 26:46.620]  we better start thinking about a petition drive now as opposed to waiting until the last minute
[26:46.620 --> 26:52.620]  like Peter Schiff did, finding out at the last minute that all the delegates who told them,
[26:52.620 --> 26:56.620]  yes, I'm voting for you, in fact would not.
[26:56.620 --> 27:01.620]  I mean, you know, you can get them on the ballot, it's just a question of organizing that now instead of...

[27:21.620 --> 27:28.620]  Peter Schiff ended up losing that critical three week period because he believed that

[27:39.620 --> 27:46.620]  And unfortunately, I was the guy that told his campaign, no, that's not correct and he found that out the hard way.
[27:46.620 --> 27:52.620]  Well, hopefully people who are working within the Republican Party in Connecticut will already have a clue about this.
[27:52.620 --> 27:58.620]  I think they do this time, but I just want to put a C out there, you know, this time.
[27:58.620 --> 28:05.620]  I mean, if we're going to do this in the Republican Party, let's be smart about it and have a backup plan instead of, you know,
[28:05.620 --> 28:11.620]  putting all of our eggs in that basket and when it doesn't pan out, not have a backup plan after that.

[28:16.620 --> 28:22.620]  Well, the one thing I could say for sure is that the backup plan can pull out of the Republican primary and run as a libertarian.

[28:28.620 --> 28:33.620]  but I think the likelihood of that is probably fairly slim.

[28:35.620 --> 28:43.620]  He's already commented on that and the problem with running as a libertarian is that you spend all your resources getting on the ballot
[28:43.620 --> 28:47.620]  if you can even get on the ballot and then you don't have anything left for campaigning.

[28:49.620 --> 28:57.620]  In Connecticut, the primary last time, the petition deadline was only three or four days shy of the primary deadline.
[28:57.620 --> 29:09.620]  So basically what Peter shifted is he chose to not spend any resources petitioning for the general election and he lost the primary.
[29:09.620 --> 29:15.620]  Ergo, he got zero votes for the Senate. Ergo, he did not get elected to the Senate.
[29:15.620 --> 29:20.620]  I mean, in order to get elected, you need to get that first vote in November.
[29:20.620 --> 29:27.620]  Otherwise, you're not going to Washington.

[34:07.620 --> 34:15.620]  Yes, we've been talking about for some time, all of the shenanigans the banks have been pulling
[34:15.620 --> 34:23.620]  And last year we were talking about how we expected the legislators to throw the blenders to the wolves
[34:23.620 --> 34:29.620]  Well they certainly have, the sky is falling in on them from all sides
[34:29.620 --> 34:40.620]  Just today it was announced by Bloomberg that Bank of America cut a deal with a number of the investors
[34:40.620 --> 34:46.620]  Who purchased their mortgage back securities on the secondary real estate market
[34:46.620 --> 34:52.620]  They just made a deal to pay them 8.5 billion
[34:52.620 --> 35:01.620]  This year and another 7.5 billion, I'm sorry 6.5 billion next year
[35:01.620 --> 35:05.620]  It came up to a 15 billion dollar deal
[35:05.620 --> 35:10.620]  That they're paying these investors back
[35:10.620 --> 35:16.620]  For selling them these bogus notes that we've been talking about all this time
[35:16.620 --> 35:27.620]  And that is an incredibly big deal because it is the investor who is the holder of the note
[35:27.620 --> 35:38.620]  And now the investor has sued Bank of America based on these notes
[35:38.620 --> 35:45.620]  And they've received consideration for the notes, they didn't sell the notes back to Bank of America
[35:45.620 --> 35:50.620]  They just wrote a settlement for the harm Bank of America did to them
[35:50.620 --> 35:56.620]  So what that means is they have received consideration
[35:56.620 --> 36:04.620]  Now it's going to be very difficult for them to come back and foreclose on a mortgage they've already been paid for
[36:04.620 --> 36:10.620]  So they have really muddied the waters for all of the banks
[36:10.620 --> 36:17.620]  Anyone who tries to do a mortgage now is looking at an incredibly steep uphill climb
[36:17.620 --> 36:24.620]  We had someone just today call us about, they filed a suit
[36:24.620 --> 36:32.620]  And immediately the attorneys contacted them, wanted to feel them out about making a deal
[36:32.620 --> 36:36.620]  This is a dramatic change
[36:36.620 --> 36:46.620]  So it's really good to see that there actually may be some remedy for this real estate mess
[36:46.620 --> 36:52.620]  So if you've got a mortgage that you wrote in the last 15 to 20 years
[36:52.620 --> 36:56.620]  You might want to look at taking a shot at the banks
[36:56.620 --> 37:10.620]  Because the way things are shaping up, the problems the banks are having are moving more and more toward criminal prosecution of these guys
[37:10.620 --> 37:20.620]  And as it moves in that direction the banks are going to be a lot more amenable to try to find a way to make a lawsuit go away rather than fight it
[37:20.620 --> 37:28.620]  Well Randy, what this also looks like to me is that by them offering the settlement or agreeing to the settlement
[37:28.620 --> 37:32.620]  They're admitting that they did something wrong, they're admitting to a tort
[37:32.620 --> 37:38.620]  Precisely, yeah, they're admitting to what these guys accused them of
[37:38.620 --> 37:44.620]  Of writing bogus notes intended to default and then selling these guys the bogus notes
[37:44.620 --> 37:52.620]  China is coming after Bank of America for selling them the same note 20 to 30 times
[37:52.620 --> 37:56.620]  So Bank of America has really taken a lot of hits lately
[37:56.620 --> 38:02.620]  And the attorney generals of all the states are investigating the banks now
[38:02.620 --> 38:10.620]  This is just the tip of the iceberg, this is just beginning to crumble around the bank's ears
[38:10.620 --> 38:18.620]  And we are doing everything we can to make it worse for the banks
[38:18.620 --> 38:24.620]  Because that's the kind of guys we are
[38:24.620 --> 38:30.620]  So what do you think Eddie? You've been awful quiet
[38:30.620 --> 38:32.620]  I'm liking it
[38:32.620 --> 38:38.620]  Of course I kind of figured they would get into that soup one of these days where people would start figuring out that there was no way that
[38:38.620 --> 38:42.620]  They could have broke these up in such a way as to sell them only once
[38:42.620 --> 38:48.620]  Well that's, I expect that to be the next thing that comes out
[38:48.620 --> 38:54.620]  It appears as though everybody is trying to hide that part
[38:54.620 --> 38:59.620]  That part is actually the real elephant in the corner
[38:59.620 --> 39:04.620]  Not that the banks wrote predatory notes
[39:04.620 --> 39:13.620]  But that the banks had a very very large economic reason to foreclose on the note
[39:13.620 --> 39:19.620]  The banks wrote notes they did not intend to be paid back
[39:19.620 --> 39:24.620]  Because they sold these things over and over on the secondary market
[39:24.620 --> 39:34.620]  And the only way that they can make the Ponzi scheme work is if they force the borrower into foreclosure
[39:34.620 --> 39:42.620]  Because once they foreclose then all of the insurance policies pay off all of the investors
[39:42.620 --> 39:49.620]  So this is really a very large scheme to defraud the investors
[39:49.620 --> 39:53.620]  I'm sorry to defraud the insurance companies
[39:53.620 --> 39:58.620]  You remember those, the ones that came to the legislature and asked for this $7 trillion bailout
[39:58.620 --> 40:01.620]  Those insurance companies
[40:01.620 --> 40:10.620]  So the scheme began to fall apart in 08 and that's when all of this crash began to happen
[40:10.620 --> 40:12.620]  But it's getting worse and worse
[40:12.620 --> 40:19.620]  We're looking for it to bottom out about the middle or end of 2012
[40:19.620 --> 40:26.620]  And if you bought property in 0405 and you give $300,000 for it
[40:26.620 --> 40:28.620]  Just try to get $154,000 now
[40:28.620 --> 40:31.620]  Yeah, unless you live in Austin
[40:31.620 --> 40:38.620]  There are a few places around the country that so far have held up better
[40:38.620 --> 40:49.620]  But I don't expect, it sounds like Austin and there's a number of places that won't feel this hit quite so hard
[40:49.620 --> 40:58.620]  But even then, you have properties, if you bought them in the last 15 years that were grossly overpriced
[40:58.620 --> 41:04.620]  Then the price, the value of property is going to drop dramatically
[41:04.620 --> 41:12.620]  And then you sit and pay for a $300,000 piece of property that isn't worth $70,000
[41:12.620 --> 41:17.620]  What is the economic sense in that?
[41:17.620 --> 41:22.620]  So even if you can pay it, why would you?
[41:22.620 --> 41:26.620]  Unless you're your mother and your grandmother and your great grandmother
[41:26.620 --> 41:30.620]  Grew up in the house and you hold it for sentimental reasons
[41:30.620 --> 41:37.620]  But if your house is an investment, they're becoming very, very bad investments at the moment
[41:37.620 --> 41:47.620]  We had someone that was in D.C. and the bank came to them with a, they were looking at making a deal
[41:47.620 --> 41:53.620]  And she was asking what we thought she should do and make the deal
[41:53.620 --> 41:58.620]  Make the deal, take the money, give them the house, it was a condo, give them the condo
[41:58.620 --> 42:07.620]  Put the money, put you get from it in silver and rent until the system bottoms out
[42:07.620 --> 42:10.620]  Another year probably
[42:10.620 --> 42:15.620]  Once the system bottoms out, your silver will be worth it
[42:15.620 --> 42:19.620]  Way more than it was when you put it in there, when you bought it
[42:19.620 --> 42:24.620]  Traded the silver and buy the condo for chump change
[42:24.620 --> 42:30.620]  This is what we're looking at happening, happening even if you have property you can pay for
[42:30.620 --> 42:37.620]  The values of property are decreasing so dramatically and they're going to continue
[42:37.620 --> 42:43.620]  That it will become economically unfeasible to maintain the property
[42:43.620 --> 42:50.620]  But then again, being aware of what's happening
[42:50.620 --> 42:56.620]  We know what's happening, this is the time that people eight or ten years from now say
[42:56.620 --> 43:01.620]  Boy, if only knew then what I know now, well this is the end
[43:01.620 --> 43:06.620]  This is the time to unload the expensive property
[43:06.620 --> 43:09.620]  If you can get a deal, get a deal, get out of it
[43:09.620 --> 43:15.620]  Put your money into gold or silver, preferably silver, hold it for two years, two and a half years
[43:15.620 --> 43:18.620]  Buy back in at the bottom
[43:18.620 --> 43:23.620]  Everybody wants to, it's too late to sell high, we should have sold a year and a half ago
[43:23.620 --> 43:27.620]  And this is what we were suggesting, it's too late for that
[43:27.620 --> 43:33.620]  But it's not too late to suit the banks, stop paying
[43:33.620 --> 43:38.620]  And then once everything bottoms out, make a deal with them that you can live with

[47:33.620 --> 47:41.620]  I stopped for a second to listen to what he was saying and then he just keeps on going
[47:41.620 --> 47:45.620]  So I pulled over and I rolled my windows

[47:48.620 --> 47:54.620]  He said, are you crazy, maybe? Do you want to be run over by a truck or something?
[47:54.620 --> 47:58.620]  So I couldn't figure out why he was yelling at me like that
[47:58.620 --> 48:02.620]  So I said, officer, I don't understand what you're talking about
[48:02.620 --> 48:05.620]  I said, when I asked you to pull over, you need to pull over to the curb

[48:07.620 --> 48:10.620]  I said, well, I'm in the process of doing that when you kept yelling at me

[52:59.620 --> 53:07.620]  And then give it to them with a verified criminal affidavit attached
[53:07.620 --> 53:14.620]  And when I do that to a police officer, they look at that and they always get real excited and say, I can't take that
[53:14.620 --> 53:17.620]  And I tell them, well, it's your call
[53:17.620 --> 53:22.620]  You're a certified police officer, I'm making it known to you by a verified criminal affidavit
[53:22.620 --> 53:24.620]  That a crime has been committed
[53:24.620 --> 53:30.620]  You can either perform your duty or shield that person from prosecution
[53:30.620 --> 53:33.620]  It's your call, I don't care what you do
[53:33.620 --> 53:36.620]  I do that if I want to set up the police department
[53:36.620 --> 53:43.620]  And then if I do the police department that way, then I will take this guy
[53:43.620 --> 53:51.620]  With him with shielding from prosecution or official misconduct, whatever the appropriate charge in that state is
[53:51.620 --> 53:59.620]  And take that to a local magistrate, a JP or a municipal judge
[53:59.620 --> 54:03.620]  And get the local judge to refuse to take it
[54:03.620 --> 54:07.620]  They're going to tell you you really need to take that to the prosecutor
[54:07.620 --> 54:09.620]  Because they're going to tell you to take the police department first
[54:09.620 --> 54:14.620]  You're going to say you've already been there and that's why I'm bringing, got this complaint because of what they have
[54:14.620 --> 54:18.620]  And they're going to say, well, then you need to take the prosecutor attorney
[54:18.620 --> 54:23.620]  Well, you go to the prosecutor attorney, but you don't take a complaint against the police officer
[54:23.620 --> 54:31.620]  You take a complaint against the magistrate for not taking your complaint against the police officer
[54:31.620 --> 54:40.620]  And so far I have only had one prosecuting attorney smart enough to figure out what was coming
[54:40.620 --> 54:46.620]  And that was the district attorney in Waco, Texas
[54:46.620 --> 54:51.620]  He took my complaint against the district judge and gave it to the grand jury
[54:51.620 --> 54:56.620]  He said, Mr. Kelton, I get the impression that you're a man on a mission
[54:56.620 --> 55:00.620]  And I make it a point never to interfere with a man on a mission
[55:00.620 --> 55:02.620]  He was the only one
[55:02.620 --> 55:09.620]  Every other prosecutor I talked to was smart mouth and arrogant or patronizing
[55:09.620 --> 55:14.620]  Oh, yeah, you poor misguided little pros and no nothing
[55:14.620 --> 55:18.620]  We'll take care of this, don't you worry about it, you jerk
[55:18.620 --> 55:24.620]  So if you take these, actually I suggest you don't go to them at all
[55:24.620 --> 55:26.620]  But you do this by mail
[55:26.620 --> 55:28.620]  You sharp shoot them
[55:28.620 --> 55:34.620]  You send it to the magistrate and the magistrate will send you back a letter telling you you should take it somewhere else
[55:34.620 --> 55:38.620]  And you use status grounds to file against the magistrate
[55:38.620 --> 55:42.620]  You send it to the prosecutor and the prosecutor will send it back to you telling you
[55:42.620 --> 55:47.620]  He's examined into your accusation, decided to take no action
[55:47.620 --> 55:51.620]  Then you prepare a complaint against the prosecutor
[55:51.620 --> 55:56.620]  And you send it to the highest level judge you can find
[55:56.620 --> 56:02.620]  And get him to tell you that you need to do something else with it
[56:02.620 --> 56:07.620]  He may tell you it's not a crime, you don't care what he does
[56:07.620 --> 56:13.620]  As long as he doesn't accept it, and they never will
[56:13.620 --> 56:19.620]  Then you prepare a complaint against this judge
[56:19.620 --> 56:22.620]  And you send that to the grand jury
[56:22.620 --> 56:28.620]  Now it is the prosecuting attorney who generally presents to the grand jury
[56:28.620 --> 56:41.620]  And under the laws of most all states, only the prosecuting attorney may present to the grand jury as a matter of right
[56:41.620 --> 56:48.620]  Now the prosecutor will tell you that only the prosecuting attorney can present to the grand jury
[56:48.620 --> 56:52.620]  That is not true
[56:52.620 --> 56:58.620]  The prosecuting attorney may present to the grand jury as a matter of right
[56:58.620 --> 57:06.620]  Anyone can go before the grand jury and present a criminal complaint if they are invited before them
[57:06.620 --> 57:12.620]  But that's not what you're trying to do, you're not trying to give a present sentiment to the grand jury
[57:12.620 --> 57:16.620]  Presentment in this case is a term of art
[57:16.620 --> 57:25.620]  It means a formal presentation of criminal accusation to the grand jury in quorum in session
[57:25.620 --> 57:31.620]  That's not what you want to do, you want to perform your duty as a citizen
[57:31.620 --> 57:41.620]  And notify the grand jury that you have reason to believe and you do believe that this person has committed this particular crime
[57:41.620 --> 57:48.620]  You're just giving them notice and you want the grand jury to examine into the sufficiency of the allegation
[57:48.620 --> 57:56.620]  Now if that involves the grand jury asking you to come before them and do a presentment, then you can certainly do that
[57:56.620 --> 58:03.620]  But that's not your original purpose, you just start to let them know something's gone wrong and ask them to look into it
[58:03.620 --> 58:10.620]  And in California you have a very good grand jury system

[01:24:26.540 --> 01:24:30.980]  You know, if you file a criminal complaint, you file a complaint based on violation of

[01:38:43.340 --> 01:38:51.340]  if it's possible to reopen that case and get that changed.
[01:38:51.340 --> 01:38:56.340]  The only way you can get to that case, how long ago was it?
[01:38:56.340 --> 01:38:58.340]  2007.
[01:38:58.340 --> 01:39:06.340]  Okay, the only way you'll be able to get to that is by a challenge to subject matter jurisdiction.

[01:42:17.340 --> 01:42:27.340]  Not being in Tennessee, we wouldn't know how to make those kinds of distinctions in Tennessee law.

[01:43:05.340 --> 01:43:12.340]  Only the JP and municipal courts have original subject matter jurisdiction of fine-only offenses.
[01:43:12.340 --> 01:43:18.340]  Therefore, any rendering of a ruling by the county court is null and void.
[01:43:18.340 --> 01:43:23.340]  And you challenge it on the grounds that the county court lacked subject matter jurisdiction

[01:53:37.340 --> 01:53:45.340]  Well, it requires some data recovery work and some clean room work, which he was not able to do at his repair studio.
[01:53:45.340 --> 01:53:54.340]  So he subcontracted out a clean room and a data recovery center to do the recovery work on the hard drive.
[01:53:54.340 --> 01:54:03.340]  So he took the hard drive to the clean room, data recovery center, then he took the hard drive back to his own workshop to continue to do the rest of the work on the hard drive,
[01:54:03.340 --> 01:54:07.340]  then took the hard drive back again to the customer's office.
[01:54:07.340 --> 01:54:20.340]  The answer here is that no, my computer friend was not engaged in commerce on the roadways during the process of transporting this hard drive back and forth between the workshop and the clean room and the customer
[01:54:20.340 --> 01:54:25.340]  because he wasn't hired specifically to transport the hard drive between those places.
[01:54:25.340 --> 01:54:28.340]  He was hired to fix the hard drive.
[01:54:28.340 --> 01:54:40.340]  So even in that situation, you're not in commerce on the roadways. You have to be hired specifically to transport goods or passengers from point A to point B in order for it to be commerce

[01:54:44.340 --> 01:54:50.340]  Now, say for example, in contradiction to that, a pizza delivery guy is in commerce on the roadways.

[01:54:56.340 --> 01:55:10.340]  I'm just wondering because they're pretty strict here in the city of Austin and basically I'm dodging DOT inspection vehicles that the city of Austin has out there

[01:57:05.340 --> 01:57:13.340]  And I'd never heard of that before. But finally my daughter got ahold of one that made an exception and she got me out.
