[00:00.000 --> 00:04.360] This news brief brought to you by the International Newsnet.
[00:04.360 --> 00:09.980] Ten months since the U.S. declared an end to combat operations in Iraq, 15 U.S. troops
[00:09.980 --> 00:13.600] died in June, the deadliest month in two years.
[00:13.600 --> 00:15.720] All but one were killed in combat.
[00:15.720 --> 00:20.680]  Forty-five thousand non-combat troops remain in Iraq.
[00:20.680 --> 00:24.440] The Washington Post reported Wednesday the U.S. conducted what's believed to be the
[00:24.440 --> 00:29.920] first drone attack in Somalia, wounding two senior members of the Islamic militant group
[00:29.920 --> 00:31.360]  al-Shabaab.
[00:31.360 --> 00:35.880] Up to now, U.S. attacks have been carried out by fighter aircraft and special operations
[00:35.880 --> 00:37.080]  commandos.
[00:37.080 --> 00:43.080] Somalia joins Afghanistan, Pakistan, Libya, Iraq and Yemen as countries under U.S. drone
[00:43.080 --> 00:44.080]  attack.
[00:44.080 --> 00:50.400] Former Kabul Bank Chairman Shaykh Khan Fanoud and former Chief Executive Officer Khalilullah
[00:50.400 --> 00:55.920] Fruzy were arrested Thursday for the massive fraud that led to the bank's collapse.
[00:55.920 --> 01:01.080] The governor of Afghanistan's central bank, Abdul Qadir Fetrat, said Monday he'd quit
[01:01.080 --> 01:07.400] his job and fled to the U.S. in fear of his life, his role in investigating the scandal.
[01:07.400 --> 01:12.800] Soon after his resignation, Afghanistan issued a warrant for his arrest.
[01:12.800 --> 01:17.280] More than 100 days after the U.S. and NATO launched what was supposed to be a quick-air
[01:17.280 --> 01:22.360] campaign in Libya, fighting continues and has run into stiff opposition from both parties
[01:22.360 --> 01:23.480]  and Congress.
[01:23.480 --> 01:28.600] Pentagon officials conceded recently the effort has little strategic value for the U.S.
[01:28.600 --> 01:33.560] and NATO's desired outcome remains unclear, whether to remove Mamar Qaddafi from power
[01:33.560 --> 01:35.480]  or protect Libyan civilians.
[01:35.480 --> 01:40.320] Pentagon officials speaking on condition of anonymity told McClatchy News airstrikes alone
[01:40.320 --> 01:45.400] would not lead to regime change and that only diplomatic talks would protect civilians.
[01:45.400 --> 01:50.680] On PBS NewsHour recently, Defense Secretary Robert Gates described U.S. involvement as
[01:50.680 --> 01:55.960] payback to NATO nations which joined U.S. troops in Afghanistan, a war about U.S. strategic
[01:55.960 --> 01:59.360] interests saying, quote, they helped us in Afghanistan.
[01:59.360 --> 02:03.960] We are in a position of helping them with respect to Libya.
[02:03.960 --> 02:08.840] Afghan officials have vowed Tuesday's terrorist attack on one of Kabul's best-known hotels
[02:08.840 --> 02:13.520] that left 21 people dead wouldn't disrupt plans for the country's police and military
[02:13.520 --> 02:19.080] to assume responsibility for security next month as U.S. search troops begin to leave.
[02:19.080 --> 02:24.200] Dr. Ashraf Ghani, the Afghan government's point man, said the government was undeterred
[02:24.200 --> 02:25.200]  by the attack.
[02:25.200 --> 02:30.120]  Ghani spoke hours after the six-hour siege ended around 3.30 a.m.
[02:30.120 --> 02:34.680] The opening of a security conference underscored the government's determination.
[02:34.680 --> 02:37.440] Security change go ahead as scheduled.
[02:37.440 --> 02:41.720] The meeting had been planned for the Intercontinental, but Afghan officials moved it to a government
[02:41.720 --> 02:45.400] media center and proceeded as if the attack hadn't happened.
[02:45.400 --> 02:50.840] Taliban spokesman Zabouila Mujahid claimed credit for the attack, saying the conference's
[02:50.840 --> 02:53.320]  300 delegates had been the target.
[02:53.320 --> 02:57.360] It was not known how the attackers gained entry to one of the most fortified buildings
[02:57.360 --> 02:58.360]  in the city.
[02:58.360 --> 03:16.000] You are listening to the Rural Law Radio Network at RuralLawRadio.com, live free speech talk
[03:16.000 --> 03:29.520]  radio at its best.
[03:29.520 --> 03:56.520] You are listening to the Rural Law Radio Network at RuralLawRadio.com, live free speech talk
[03:56.520 --> 04:03.520] radio at RuralLawRadio.com, live free speech talk radio at RuralLawRadio.com, live free
[04:26.520 --> 04:53.320]  speech talk radio at RuralLawRadio.com
[04:53.320 --> 04:58.840] Alright folks, what are you going to do when we come for you?
[04:58.840 --> 05:08.840] Here on the Rule of Law, ruleoflawradio.com, tonight is Thursday, June 30th, 2011.
[05:08.840 --> 05:16.720] We are taking your calls tonight, 512-646-1984, and we have a couple of announcements we need
[05:16.720 --> 05:20.120] to make before we go ahead into the topics of the show.
[05:20.120 --> 05:25.800] For those of you out there, and we're not going to give out the profile ID name, but
[05:25.800 --> 05:35.280] for those of you out there who have been contacts of Randy's on Skype, Randy's Skype account
[05:35.280 --> 05:37.360]  got hacked.
[05:37.360 --> 05:44.440] So if you've been getting weird messages from Randy's Skype account asking for money,
[05:44.440 --> 05:46.640]  it's not real.
[05:46.640 --> 05:55.680] And Randy has put in a troubleshoot identity theft report to the Skype company.
[05:55.680 --> 05:58.880] This was a few days ago, but they have not responded yet.
[05:58.880 --> 06:01.480]  I'm sure they're slammed with this sort of thing.
[06:01.480 --> 06:03.280]  This is rampant lately.
[06:03.280 --> 06:09.280] And so the best way that we can help Randy get Skype to do something about getting his
[06:09.280 --> 06:14.760] account back to him is for all of you out there, if you've been contacts with Randy
[06:14.760 --> 06:19.200] on Skype, block his Skype username.
[06:19.200 --> 06:28.160] And when you go to say, block this user, you can check a click box that says report abuse
[06:28.160 --> 06:29.440]  and say yes.
[06:29.440 --> 06:38.120] Go ahead and report the abuse because if you don't report the abuse, well then Skype isn't
[06:38.120 --> 06:39.120] going to know about it.
[06:39.120 --> 06:42.640] So the more you report the abuse, the more people we can get to report the abuse, the
[06:42.640 --> 06:46.760] better chance and the quicker we'll be able to get Skype to do something about Randy's
[06:46.760 --> 06:48.520]  identity theft report.
[06:48.520 --> 06:55.600] Randy did try to log back into a Skype account immediately as soon as it got hacked and it
[06:55.600 --> 06:57.720]  was too late.
[06:57.720 --> 07:06.120] They had changed the password and they had changed the email contact address as well.
[07:06.120 --> 07:07.600]  So it's too late.
[07:07.600 --> 07:10.320] I mean, whoever hacked it did it immediately.
[07:10.320 --> 07:16.960] So Randy could not log back in to change his password or to change the email contact.
[07:16.960 --> 07:22.120] So if you've had Randy on your Skype account list, that's what you need to do.
[07:22.120 --> 07:29.040] You need to go in and you need to block his username, block his account and definitely
[07:29.040 --> 07:38.800] check the box that says report user for abuse and then Skype will either disable the account
[07:38.800 --> 07:43.720] which it needs to be disabled right now and then hopefully Randy will be able to work
[07:43.720 --> 07:49.920] with them regarding his troubleshooting account because right now there's somebody going around
[07:49.920 --> 07:52.200] in Randy's name trying to get money.
[07:52.200 --> 07:54.520]  So without an answer.
[07:54.520 --> 07:56.720] And it's not for my beer fund.
[07:56.720 --> 08:02.040] And it's not for Randy's beer fund either which is the worst of all of this.
[08:02.040 --> 08:05.040]  Yeah, no more beer.
[08:05.040 --> 08:07.360] That's the worst part about it all.
[08:07.360 --> 08:13.040] Let me let me explain some things about that so you understand.
[08:13.040 --> 08:21.760] I got a Skype message from another broadcaster that I knew and trusted and he said, I just
[08:21.760 --> 08:23.840] got it up and working.
[08:23.840 --> 08:24.840]  Check the link.
[08:24.840 --> 08:25.840]  You'll like this.
[08:25.840 --> 08:31.240] Just got what up and working didn't say.
[08:31.240 --> 08:33.640]  And I was I didn't have time to ask him.
[08:33.640 --> 08:34.640]  I didn't go into all that.
[08:34.640 --> 08:37.480]  I'm telling you what he said.
[08:37.480 --> 08:41.040]  I got it up and working.
[08:41.040 --> 08:45.120] And I didn't think he had Skype before so I thought maybe he got Skype up and working.
[08:45.120 --> 08:46.120]  I didn't.
[08:46.120 --> 08:50.320] Didn't occur to me at the moment with someone I knew and trusted.
[08:50.320 --> 08:51.800] So I clicked on it went to my account.
[08:51.800 --> 08:52.800]  I came back.
[08:52.800 --> 08:54.640] I said, wait a minute that went to my account.
[08:54.640 --> 08:56.960]  He said, I know, I know it's okay.
[08:56.960 --> 08:57.960]  Don't worry about it.
[08:57.960 --> 08:58.960]  Check it.
[08:58.960 --> 08:59.960]  You'll like this.
[08:59.960 --> 09:03.620] Whoever it was responded to me.
[09:03.620 --> 09:12.600] So if you get any kind of email requesting that you do go to anything, even if you know
[09:12.600 --> 09:17.320] who the person is, they might have had a bot talking to me.
[09:17.320 --> 09:23.480] So ask them a question only they would know how to answer before you click on anything.
[09:23.480 --> 09:26.760] Well, and here's another rule of thumb.
[09:26.760 --> 09:35.720] Whenever log in with your username and password to anything in your life, whether it's email
[09:35.720 --> 09:43.520] or Skype or your bank account by clicking on a link from a chat or from a link in an
[09:43.520 --> 09:50.960] email, you go into the Skype website to log in to your Skype account.
[09:50.960 --> 09:53.560] You go to your bank account website.
[09:53.560 --> 09:59.920] You go to PayPal's website to enter your username and password.
[09:59.920 --> 10:05.400] You go to your email server website to enter your username and password.
[10:05.400 --> 10:11.200] Don't ever enter your username and password for anything in your life by clicking on a
[10:11.200 --> 10:14.480]  link from anything else.
[10:14.480 --> 10:20.520] Only go to that entity's website to log in because if you click on a link, I promise
[10:20.520 --> 10:25.520]  you it's a scam and that's just a general rule of thumb, all right?
[10:25.520 --> 10:33.000] And I can vouch for that and I can also vouch for how stupid you feel after you do it.
[10:33.000 --> 10:38.800] This is a typical scam of how people accomplish identity theft.
[10:38.800 --> 10:43.440] You don't do it through going through your mail that you throw out even though it is
[10:43.440 --> 10:46.840] a good idea to shred everything that you throw away, all right?
[10:46.840 --> 10:52.360] But the way people get their identity stolen and their usernames and passwords stolen is
[10:52.360 --> 11:01.280] because they fall for a scam by clicking on a link that takes you to a bogus login page
[11:01.280 --> 11:07.800] for PayPal or Skype or your email or your bank account or something like that and then that
[11:07.800 --> 11:11.240] person gets, and it looks just like the login page.
[11:11.240 --> 11:20.960] I mean, I get this kind of spam mail from scammers all the time, mostly for PayPal where
[11:20.960 --> 11:26.120] it says, PayPal, I get these emails, PayPal has new security features.
[11:26.120 --> 11:28.360] Please click on this link to log in.
[11:28.360 --> 11:31.160]  Don't do it, all right?
[11:31.160 --> 11:39.680] I get a scam and if you go to the link, it looks exactly like the PayPal login website
[11:39.680 --> 11:50.800] page and if you look at the URL, they somehow manage to mask the true URL, okay?
[11:50.800 --> 11:53.120]  And so you can't really tell.
[11:53.120 --> 11:56.560] Sometimes you can tell depending on your browser settings and how savvy you are working with
[11:56.560 --> 12:01.040] the Internet, you can find out what the IP address is and then you'll know it's a scam
[12:01.040 --> 12:03.120] if you really know how to look at these things.
[12:03.120 --> 12:08.600] But general rule of thumb, you guys get emails, you guys and gals out there get emails or
[12:08.600 --> 12:15.880] Skype chats even or other kinds of chats no matter what chat engine you use.
[12:15.880 --> 12:19.840] From somebody that you know, just click on this link, you'll like this.
[12:19.840 --> 12:26.160] If it goes to a login page of something that you normally log into, do not put in your
[12:26.160 --> 12:27.440]  username and password.
[12:27.440 --> 12:38.640] Only go to the website of the entity itself by typing in www.paypal.com or whatever, www.skype.com.
[12:38.640 --> 12:45.280] Only go to the entity's website, known URL to ever enter in any login information of anything
[12:45.280 --> 12:46.280]  in your life.
[12:46.280 --> 12:51.480] So I think that this should be a lesson to everybody but unfortunately Randy fell for
[12:51.480 --> 12:55.240] it and now your beer fund is suffering, dude.
[12:55.240 --> 13:08.440] I have gotten lots of these just like they ever have and I never click on them and this
[13:08.440 --> 13:13.640] would caught me busy with other things and just caught me at the right moment.
[13:13.640 --> 13:19.120] Well, I'll tell you when it happened, Randy and I were actually on a Skype call when it
[13:19.120 --> 13:20.120]  happened.
[13:20.120 --> 13:25.440] You had a chat come in from somebody else and you and I were talking on Skype and then
[13:25.440 --> 13:30.800] all of a sudden you went offline in the middle of the call and then about 30 seconds later
[13:30.800 --> 13:35.760] you came back online again and then I get a chat from you asking me for money and I'm
[13:35.760 --> 13:37.760]  like what?
[13:37.760 --> 13:38.760]  And I said what?
[13:38.760 --> 13:42.080] To the chat and whoever it was on the other end goes, yeah, that's right.
[13:42.080 --> 13:43.080]  I need money.
[13:43.080 --> 13:44.080]  I'm busy.
[13:44.080 --> 13:45.080]  I can't talk right now.
[13:45.080 --> 13:49.400] Just send it to autopay or whatever and please click on this link to send me the money and
[13:49.400 --> 13:51.440]  I was like, huh?
[13:51.440 --> 13:54.440] And I just put a bunch of question marks in the chat window and then I called you on the
[13:54.440 --> 13:56.880] phone and I'm like, Randy, why are you asking me for money?
[13:56.880 --> 13:58.400]  He's like, what?
[13:58.400 --> 14:06.040] So yeah, it ended when you, the guy or whoever it was, when you clicked on that link and gave
[14:06.040 --> 14:11.240] him your login information, he or she or whoever it was or the bot program logged into your
[14:11.240 --> 14:16.440] account and immediately changed the password and user name or not user name, immediately
[14:16.440 --> 14:19.840] changed the password and the email contact address.
[14:19.840 --> 14:24.080] So now you can't even try to get, the only way to solve the problem now is for Skype
[14:24.080 --> 14:27.800] to do the troubleshooting report, the identity fed report.
[14:27.800 --> 14:31.280] So, but people do need to report it as abuse.
[14:31.280 --> 14:34.880] The account does need to be shut down because there's a scammer in control of the account
[14:34.880 --> 14:38.880] now trying to scam other people out of money.
[14:38.880 --> 14:43.280]  So that's what's going on with Randy's Skype account and so there's a little lesson on
[14:43.280 --> 14:50.720] some internet security for you and believe me, the Obama's kill switch is not the answer.
[14:50.720 --> 14:54.720] Just a little bit of common sense is the answer.
[14:54.720 --> 15:04.680] Okay, so, Randy's got another Skype account now, that's how he's got on the air with us.
[15:04.680 --> 15:08.480] So hopefully we're going to try to move on from this and I hope you've learned your
[15:08.480 --> 15:11.080] lesson because your beer fun suffering dude.
[15:11.080 --> 15:15.560] Yes, I know, that goes all my beer money.
[15:15.560 --> 15:19.120] Well, folks, have a little mercy on Randy and maybe you could try to send him some beer
[15:19.120 --> 15:26.920] fun money and the network is hurting too so we need to do it through Skype, just don't
[15:26.920 --> 15:32.960] do it through his Skype chats because they're phony.
[15:32.960 --> 15:37.960] Alrighty then, okay, so you have two, what now?
[15:37.960 --> 15:40.600] Two messages, you have two issues.
[15:40.600 --> 15:41.600]  I had two issues?
[15:41.600 --> 15:42.600]  No, that's all.
[15:42.600 --> 15:44.600]  That's all I had for tonight.
[15:44.600 --> 15:45.600]  Okay.
[15:45.600 --> 15:46.600]  Yeah.
[15:46.600 --> 15:50.600]  Okay, Randy's a chump this time.
[15:50.600 --> 15:58.600] Yeah, I like that qualification this time.
[15:58.600 --> 16:04.520] Okay, there was one thing I wanted to kind of touch on.
[16:04.520 --> 16:09.560] I don't talk about my real estate business much on this show because I don't want the
[16:09.560 --> 16:20.560] show to be an infomercial but there's a lot of things happening in the real estate area.
[16:20.560 --> 16:27.080] When we first started this, we researched what was going on, we researched what the
[16:27.080 --> 16:36.440] lenders were doing and had been doing and we told people this was before the election
[16:36.440 --> 16:43.720] and we told people that we'd be listening to some annoying music that says we're going
[16:43.720 --> 16:44.720]  to go to break.
[16:44.720 --> 16:49.760] So when we get back on the other side, I'll go through some of the things that's been
[16:49.760 --> 16:52.160]  happening and I think you'll find it interesting.
[16:52.160 --> 16:56.840] This is Randy Chalkson and David Stevens at Craig, you have low radio, we'll be right

[23:12.480 --> 23:22.480] We expected the legislators to throw the lenders to the wolves, and we intended to be the wolves.
[23:22.480 --> 23:30.480] Well, they did that, but what we didn't expect was for them to throw them under the bus and run over them a couple of times.
[23:30.480 --> 23:36.480] The revelations that have been coming out against the banks are just incredible.
[23:36.480 --> 23:44.480]  We talked a few shows back about a 60-minute program.
[23:44.480 --> 23:56.480]  If you'll do a search for NBC 60-minutes foreclosure, you'll get a story about foreclosure documents.
[23:56.480 --> 24:09.480] What we've been claiming is that the lenders deliberately created loans they did not intend that you pay back.
[24:09.480 --> 24:13.480] When you first hear that, it sounds counterintuitive.
[24:13.480 --> 24:17.480]  When I first heard it, I thought, give me a break.
[24:17.480 --> 24:23.480] The guy's going to give me $300,000 to buy a house with, and he doesn't want me to pay it back.
[24:23.480 --> 24:26.480]  Everybody's telling me, no, no, they don't.
[24:26.480 --> 24:29.480]  I thought that was horse manure.
[24:29.480 --> 24:31.480]  It was just outrageous.
[24:31.480 --> 24:34.480] Even the concept was outrageous.
[24:34.480 --> 24:38.480] Then I began to find out what was actually going on.
[24:38.480 --> 24:41.480] That is exactly the case.
[24:41.480 --> 24:50.480] Those people who have mortgages and are having mortgage issues,
[24:50.480 --> 24:56.480] when you go to the bank to ask the bank for a loan modification,
[24:56.480 --> 24:59.480] they will say, oh, yeah, no problem.
[24:59.480 --> 25:02.480] We can help you out with that.
[25:02.480 --> 25:08.480] They will offer to do a modification.
[25:08.480 --> 25:15.480] When they do that, the Obama administration will pay them about $1500 and $3,000.
[25:15.480 --> 25:20.480] Then they will go through this song and dance.
[25:20.480 --> 25:27.480] It's also down your pants, and either deny your modification or offer you a modification that's impossible.
[25:27.480 --> 25:34.480] It is absolutely designed to ensure that you wind up defaulting.
[25:34.480 --> 25:41.480] It has lower payments for a few months, and then the payments go up astronomically.
[25:41.480 --> 25:49.480] The reason they would do that is they absolutely do not want you to pay off this note.
[25:49.480 --> 25:59.480] The reason they don't want you to pay off this note is that they sold it several times.
[25:59.480 --> 26:05.480] If you pay off the note, they will be like Bank of America,
[26:05.480 --> 26:16.480] who was sued in the Hague by China, being accused of selling them the same note 20 to 30 times.
[26:16.480 --> 26:26.480] When I first heard this, I thought, how on earth could they ever make a Ponzi scheme of this nature work?
[26:26.480 --> 26:32.480] How could they expect that this wouldn't come back to haunt them?
[26:32.480 --> 26:41.480] There was all this talk about derivatives, and how it was the derivatives market that brought the system down,
[26:41.480 --> 26:44.480] and had a lot of trouble with derivatives.
[26:44.480 --> 26:53.480] They are a form of an unregulated insurance policy.
[26:53.480 --> 27:04.480] The IG was the primary one. They were selling insurance policies to the banksters.
[27:04.480 --> 27:10.480] It took a while for all of this to fit together. Here's how it works.
[27:10.480 --> 27:19.480] They create a loan that they intend would default. This is all an insurance scam.
[27:19.480 --> 27:23.480] They get the note. They get your signature on the note. That's what they need.
[27:23.480 --> 27:28.480] That's all they care about, and they're willing to pay you $300,000 for it.
[27:28.480 --> 27:34.480] Once they get your signature on the note, then they promptly sell it,
[27:34.480 --> 27:44.480] normally for 103% of the amount they paid out to purchase the title to sell to you.
[27:44.480 --> 27:50.480] They make a 3% profit right on the front end.
[27:50.480 --> 27:57.480] They give the purchaser of the note, the private mortgage insurance,
[27:57.480 --> 28:06.480] that you will require to purchase on the note. Then they sell the note again.
[28:06.480 --> 28:10.480] Then they go get a derivative insurance policy that's unregulated.
[28:10.480 --> 28:15.480] Normally, you couldn't get two policies on the same property, but in the derivatives market,
[28:15.480 --> 28:18.480]  they were totally unregulated.
[28:18.480 --> 28:29.480] Now, the derivatives, there's another show on 60 Minutes called Financial Weapons of Mass Destruction.
[28:29.480 --> 28:34.480] Do a search for that one, and you will find a story about derivatives.
[28:34.480 --> 28:41.480] In 1907, there was a major stock market crash. It was a crash that was caused by what they called bucket shops.
[28:41.480 --> 28:49.480] These were places where you could go in and bet on a stock or a security, not a security, I'm sorry,
[28:49.480 --> 28:57.480] bet on a stock, rather it would increase or decrease without actually having to buy the stock.
[28:57.480 --> 29:05.480] And this so destabilized, the stock market caused a crash in 1907. The legislature said after that,
[29:05.480 --> 29:09.480] no more of this stuff, to do it as a felony.
[29:09.480 --> 29:17.480] In the year 2000, the last thing the legislature did before they closed signed by, was remove that restriction.
[29:17.480 --> 29:25.480] And that's about the time the housing boom got kicked off in earnest.
[29:25.480 --> 29:33.480] The lenders bought these titles, sold them to the buyer, then took the promissory note,
[29:33.480 --> 29:38.480] and sold it 20 to 30 times on the secondary market.
[29:38.480 --> 29:45.480] They wrote an insurance policy for each one, and I'll finish up how that works when we come back
[29:45.480 --> 29:50.480] and we'll start different calls. We have Frank from New York and Kathy from Texas.
[29:50.480 --> 29:55.480] This is Randy Kelton, Deborah Stevens, Eddie Craig, we'll have our radio. We'll be right back.
[30:20.480 --> 30:26.480] There is more to the story. Bring justice to my son, my uncle, my nephew, my son, go to buildingwatch.org.
[30:26.480 --> 30:30.480] Why it fell, why it matters, and what you can do.
[30:30.480 --> 30:37.480] Is it stealing to download music from the Internet? You might be surprised at the way college students answer that question.
[30:37.480 --> 30:44.480] I'm Dr. Catherine Albrecht and I'll be back in a moment with results of the new study that explores current attitudes about digital piracy.
[30:44.480 --> 30:50.480] Privacy is under attack. When you give up data about yourself, you'll never get it back again.
[30:50.480 --> 30:55.480] And once your privacy is gone, you'll find your freedoms will start to vanish too.
[30:55.480 --> 31:00.480] So protect your rights, say no to surveillance, and keep your information to yourself.
[31:00.480 --> 31:06.480] Privacy, it's worth hanging on to. This public service announcement is brought to you by startpage.com.
[31:06.480 --> 31:14.480] The private search engine alternative to Google, Yahoo, and Bing. Start over with Start Page.
[31:14.480 --> 31:18.480] You've probably seen public service messages about digital piracy.
[31:18.480 --> 31:23.480] One of the most famous ads likens illegally downloading digital content to stealing a car.
[31:23.480 --> 31:26.480] But apparently those education efforts aren't working.
[31:26.480 --> 31:32.480] A new study by the University of Nebraska found that students believe shoplifting a CD from a music store is wrong.
[31:32.480 --> 31:37.480] But those same students view illegal digital downloads as far less serious.
[31:37.480 --> 31:43.480] Researchers believe digital piracy is more acceptable because there's no physical danger and no visible victim.
[31:43.480 --> 31:48.480] And since the practice is widespread on college campuses, there's a lot of social support.
[31:48.480 --> 31:53.480] But as an author who's had my own work pirated, I can say it's pretty unpleasant from this end.
[31:53.480 --> 32:02.480] Look at your Catherine Albrecht. More news and information at CatherineAlbrecht.com.
[32:02.480 --> 32:08.480] Yes, Mr. Officer, you're taking the line ahead.
[32:08.480 --> 32:14.480]  Won't you follow the law of the land? I don't understand.
[32:14.480 --> 32:23.480] If y'all are stupid, take out the service. Be an abuse.
[32:23.480 --> 32:44.480]  When you're gonna stop abuse, you're gonna stop abuse.
[32:44.480 --> 32:47.480] Okay, folks, we are back.
[32:47.480 --> 32:56.480] We are discussing some mortgage issues tonight and then we're gonna be taking your phone calls 512-646-1984.
[32:56.480 --> 32:58.480]  Okay, Randy, please continue.
[32:58.480 --> 33:09.480] Okay. What they did with the derivatives is they would buy a private mortgage insurance policy for each sale they made.
[33:09.480 --> 33:18.480] They sell the note to an investor. They provide the investor with private mortgage insurance and they tell the investor,
[33:18.480 --> 33:30.480] this private mortgage insurance will pay you 85% of the principal if the client's foreclosures or defaults.
[33:30.480 --> 33:36.480] And it's pretty well a standard thing. So they sell it to the first one and they get 103% of their investment.
[33:36.480 --> 33:40.480] They sell it to the second one. They get another 103% of their investment.
[33:40.480 --> 33:43.480] And the next one and the next one and the next one.
[33:43.480 --> 33:47.480] They can essentially sell it as many times as they think they can get by with it.
[33:47.480 --> 33:58.480] And then when the buyer makes a payment on the note, they go into this large pool of money that they've collected
[33:58.480 --> 34:04.480] and make a payment to all of these different entities that's purchased the note.
[34:04.480 --> 34:12.480] They're trying to get the note down to that 15% off the top.
[34:12.480 --> 34:21.480] But even if it doesn't make it that far, they don't really care because if you subsequently default,
[34:21.480 --> 34:30.480] then they go to each of the investors and say, oh my goodness, look here, this note defaulted.
[34:30.480 --> 34:40.480] Now you collect the 85% of the mortgage from the insurance, private mortgage insurance.
[34:40.480 --> 34:47.480] And I would suspect that to keep the investors happy, they would pay the other 15%.
[34:47.480 --> 34:57.480] And that leaves them with about 88% in hand for each time they sell it.
[34:57.480 --> 35:03.480] On a $300,000 note due to math, they sell it 20 times.
[35:03.480 --> 35:12.480] They keep 88% of that in their pocket. That is not bad profit.
[35:12.480 --> 35:22.480] The problem was, had they only seated the remix, let me quickly explain remix.
[35:22.480 --> 35:27.480] These investors would get together, put together a special purpose vehicle.
[35:27.480 --> 35:36.480] And this vehicle was for the special purpose of securing promissory notes from residential mortgages.
[35:36.480 --> 35:42.480] They would then combine those into a single investment conduit.
[35:42.480 --> 35:48.480] They would file it with the eternal revenue service as real estate mortgage investment conduit,
[35:48.480 --> 35:52.480] and they would get this great tax break on it.
[35:52.480 --> 36:01.480] And then they would take this investment conduit and sell it to people or entities that needed long-term investments.
[36:01.480 --> 36:09.480] It was a perfect match for people with a long-term payment plan, the residential mortgages,
[36:09.480 --> 36:17.480]  and retirement funds that needed a long-term investment portfolio.
[36:17.480 --> 36:22.480] But it felt perfect. They took the note converted into a security and sold it.
[36:22.480 --> 36:31.480] They expected 5% that was a general foreclosure in any given group of residents or mortgages.
[36:31.480 --> 36:34.480]  That was a statistical meaning.
[36:34.480 --> 36:43.480] Had they only seated the portfolio with 5% bad loans, they probably got away with the scheme.
[36:43.480 --> 36:51.480] But in the early 2000s, things were doing really well.
[36:51.480 --> 37:01.480] And in 2004, 2005, they sort of got into a feeding frenzy and sold everything they had.
[37:01.480 --> 37:07.480] It was good. It was like all of the banks were competing to see who could give the most predatory loans out there
[37:07.480 --> 37:10.480] and fill in these remakes with them.
[37:10.480 --> 37:13.480] It got out of hand. It got out of control.
[37:13.480 --> 37:17.480] And then by 2006, things began to slow down.
[37:17.480 --> 37:21.480]  2007, they peaked out.
[37:21.480 --> 37:25.480]  2008, it started to decline.
[37:25.480 --> 37:32.480] The slowdown caused a number of these mortgages to foreclose.
[37:32.480 --> 37:42.480] And AIG, Houston, Lehman Brothers had to start paying off on all of these mortgages, derivative mortgages,
[37:42.480 --> 37:45.480] insurance policy, say it sold.
[37:45.480 --> 37:48.480] And they were paying off big time.
[37:48.480 --> 37:53.480] And it came at them too fast. They had too many foreclosures.
[37:53.480 --> 37:58.480] And the sky fell in and they come to the taxpayers through our legislators.
[37:58.480 --> 38:02.480]  And we gave them $7 trillion.
[38:02.480 --> 38:08.480] So they stole from you on the front end by stealing the equity and your property and stealing your own from you.
[38:08.480 --> 38:15.480] They stole from you on the back end by stealing your investment, your retirement funds.
[38:15.480 --> 38:20.480] And they steal in the middle by stealing your tax money.
[38:20.480 --> 38:26.480] From the year from 1916, when the Federal Reserve was put in existence,
[38:26.480 --> 38:33.480] the Federal Reserve put into circulation $1 trillion.
[38:33.480 --> 38:38.480] And if you look at it on a graph, it rises on about a 2% grade.
[38:38.480 --> 38:42.480] If you look at gold and silver, it rises exactly with it.
[38:42.480 --> 38:49.480] In the year 2008, the graph went straight up off the charts
[38:49.480 --> 38:58.480] with the purpose of bathing these scoundrels out for stealing everything this country had.
[38:58.480 --> 39:04.480] And when the foreclosures occurred, the bankers would get to collect all this insurance,
[39:04.480 --> 39:12.480] pay off all of these guys, the bankers walk away with everything.
[39:12.480 --> 39:17.480] So now the bankers are finding themselves in a lot of trouble.
[39:17.480 --> 39:29.480] And they would have had a lot less trouble had they been exercising some kind of reasonable business acumen.
[39:29.480 --> 39:33.480] But they didn't. They got absolutely crazy.
[39:33.480 --> 39:39.480] When I first heard this, it came from an FBI source a couple of years ago.
[39:39.480 --> 39:47.480] I was told that the banks could not produce the original security instrument
[39:47.480 --> 39:52.480] because they shredded the original documents.
[39:52.480 --> 39:59.480] And I thought, nah, that can't be so. That is just too stupid.
[39:59.480 --> 40:04.480] Nobody could be that stupid.
[40:04.480 --> 40:12.480] That is exactly what they did with it in order to be able to sell these security instruments
[40:12.480 --> 40:16.480] and trade in them on the secondary market.
[40:16.480 --> 40:22.480] The banks got together and created this company called Merse.
[40:22.480 --> 40:32.480] And what Merse did was they would stand as what they called a nominee for the lender.
[40:32.480 --> 40:38.480] They would represent themselves as the holder of the note.
[40:38.480 --> 40:50.480] Then the lender could go behind Merse and sell and resell the security instruments on the secondary real estate market.
[40:50.480 --> 40:56.480] These remits, these investment conduits, some did better than others.
[40:56.480 --> 41:01.480] And the ones that did well were making profit that had to pay tax on.
[41:01.480 --> 41:07.480] So what they would do is shift income stream from one remit to the other
[41:07.480 --> 41:14.480] to keep the overall incomes of each one at a rate where they wouldn't have to pay tax on them.
[41:14.480 --> 41:22.480] And in order to make those adjustments, they had to trade thousands of notes, sometimes two or three times a week.
[41:22.480 --> 41:38.480] And the law, in order to create a stable real estate market, every state had a requirement that the any sale of a security instrument
[41:38.480 --> 41:47.480] based on a commercial real estate transaction, I'm sorry, a consumer real estate transaction
[41:47.480 --> 41:57.480] must be a public sale and it must be registered with the county registrar's office.
[41:57.480 --> 42:07.480] So that if a person went to purchase a piece of property, they could purchase the property with absolute surety
[42:07.480 --> 42:15.480] that no one had a claim against that property because the claim was required to be filed at the clerk of the court.
[42:15.480 --> 42:19.480] Each change of ownership of the property.
[42:19.480 --> 42:25.480] Well, with this investment scheme they had going, that was an absolute impossibility.
[42:25.480 --> 42:38.480] So MERS came up, the banks, Fannie Mae, Freddie Mac, GMAC, Bank of America, Wells Fargo and Chase.
[42:38.480 --> 42:42.480] They all got together and put together this company.
[42:42.480 --> 42:51.480] And they wanted it to be a really high-tech, efficient company, so they made it a paperless system.
[42:51.480 --> 42:55.480] The banks would file their mortgages with these people.
[42:55.480 --> 43:01.480] They would scan the documents into their system and shred the originals.
[43:01.480 --> 43:10.480] The problem with that is, is uniform commercial code says if you want to collect on a security instrument
[43:10.480 --> 43:16.480] and the debtor demands production of the security instrument, you must produce it.
[43:16.480 --> 43:27.480] Or the debtor is at liberty to seesaw payment without dishonor.
[43:27.480 --> 43:29.480] Well, Randy, they don't care about that.
[43:29.480 --> 43:34.480] I mean, they're running a scam and they figure people are too stupid to figure it out.
[43:34.480 --> 43:36.480]  Yeah, I think that's the case.
[43:36.480 --> 43:41.480] And even if some people figured it out, the amount of people that would figure it out
[43:41.480 --> 43:48.480] and the amount they would get sued for over it is far less than the cost that it would take to keep all these notes
[43:48.480 --> 43:50.480] and store them and keep track of them.
[43:50.480 --> 43:54.480] So they just consider it collateral damage cost of doing business.
[43:54.480 --> 43:56.480] All right, we'll be right back, folks.
[43:56.480 --> 44:00.480]  512-646-1984.
[44:00.480 --> 44:01.480]  Hey, did you hear?
[44:01.480 --> 44:03.480] Ron Paul has announced he's running for president in 2012.
[44:03.480 --> 44:04.480]  Who's Ron Paul?
[44:04.480 --> 44:07.480] Really? Okay, put down the cell phone for one minute.
[44:07.480 --> 44:10.480] Your friends really don't care about your Twitter updates on what you had for breakfast.
[44:10.480 --> 44:13.480] Oh, but I'd love to make those little smiley faces with punctuation marks.
[44:13.480 --> 44:14.480]  Of course you do.
[44:14.480 --> 44:15.480]  Now, listen closely.
[44:15.480 --> 44:20.480] You need to go down to Brave New Books and learn as much as you can about Ron Paul and his message before it's too late.
[44:20.480 --> 44:23.480] They have all of his books and many of the books he talks about.
[44:23.480 --> 44:28.480] They also have t-shirts, bumper stickers, and yard signs so that you can show your support for him during the campaign.
[44:28.480 --> 44:29.480]  Brave New Books?
[44:29.480 --> 44:31.480] Did they have Harry Potter and Twilight?
[44:31.480 --> 44:36.480] Well, but they do carry a large selection of survival and preparedness books to protect your family in time of emergency.
[44:36.480 --> 44:39.480] Ugh, that sounds like that show on the Discovery Channel.
[44:39.480 --> 44:46.480] Yeah, there's even a wilderness survival expert that teaches classes called Earth Skills School that you can sign up for on the website BraveNewBooksStore.com.
[44:46.480 --> 44:47.480]  What are you doing?
[44:47.480 --> 44:52.480] I'm tweeting all my friends that they should go to BraveNewBooksStore.com or down to the bookstore in person.
[44:52.480 --> 44:53.480]  Where's it located?
[44:53.480 --> 44:55.480]  1904 Guadalupe Street.
[44:55.480 --> 44:56.480]  There, it's sent.
[44:56.480 --> 44:57.480]  I even made a smiley face.

[46:14.480 --> 46:31.480] Okay folks, we are back.
[46:31.480 --> 46:38.480] Callers, we've got Frank, Kathy, Mark. Just stay right there. Randy has a little bit left to go.
[46:38.480 --> 46:42.480] We've got him back on Skype again. Hopefully we can keep his connection.
[46:42.480 --> 46:45.480] All right, go ahead, Randy.
[46:45.480 --> 46:49.480] Okay. This is basically what has went on.
[46:49.480 --> 47:00.480] When we started, we were asking for the banks to show us the notes, and the courts were ruling against us out of hand.
[47:00.480 --> 47:05.480] They were simply tossing the argument without even considering it.
[47:05.480 --> 47:18.480] And then a few months ago, Bank of America stopped all foreclosures for the stated purpose of getting their paperwork corrected.
[47:18.480 --> 47:29.480] Well, when that happened, it seemed like all of the judges in the country's heads popped up.
[47:29.480 --> 47:41.480] I used an example. You're out in West Texas, and you look out over across the desert, and it looks completely blank and barren out there.
[47:41.480 --> 47:47.480] And then you pick up a twig and crack it, and about 100 jackrabbit heads pop up and look around.
[47:47.480 --> 47:54.480] That's kind of what the courts did. And they said, oops, maybe there's actually something to this.
[47:54.480 --> 48:01.480] And after that, we started getting more rulings where the judges were paying more attention.
[48:01.480 --> 48:12.480] And then every attorney general in the country started investigations against the banks, except for four states.
[48:12.480 --> 48:24.480] And more and more issues came down, and then this issue of 60 minutes on foreclosure.
[48:24.480 --> 48:31.480] The reason I went through all of that stuff about the paperwork is they couldn't produce the paperwork.
[48:31.480 --> 48:46.480] And then they sued this woman in Florida. And the problem was, if she wasn't just a woman behind on her mortgage payments, she was an attorney.
[48:46.480 --> 48:53.480] And if she wasn't just an attorney, she was an expert in forged documentation.
[48:53.480 --> 48:58.480] She trained FBI agents on how to recognize forged documentation.
[48:58.480 --> 49:06.480] Well, the first year of the bankruptcy proceedings where she's fighting them, they couldn't produce any of the records.
[49:06.480 --> 49:11.480] And then after about a year, all of a sudden, the records showed up.
[49:11.480 --> 49:20.480] So being of the suspicious nature that she was, and considering her particular expertise, she looked at the documents,
[49:20.480 --> 49:29.480] and what she found was probably one of the stupidest frauds I've ever heard of.
[49:29.480 --> 49:38.480] She found this signature on these documents. The name was Linda Green.
[49:38.480 --> 49:46.480] And Linda Green's name turned up on these documents thousands of times.
[49:46.480 --> 49:52.480] She signed as the vice president for over 20 banks.
[49:52.480 --> 50:01.480] And this attorney being the astute investigator that she was said, that doesn't look good.
[50:01.480 --> 50:08.480] They traced the documents down to a company called DOCX in Georgia.
[50:08.480 --> 50:16.480] DOCX was producing forged loan documents.
[50:16.480 --> 50:25.480] A moron got on national television and bragged that he signed, all of these people signed Linda Green's name
[50:25.480 --> 50:30.480] because it was nice and short and easy to spell.
[50:30.480 --> 50:42.480] And they could sign it quickly. He bragged that he could sign her name on 370 forged documents an hour.
[50:42.480 --> 50:46.480] I thought, are you out of your mind?
[50:46.480 --> 50:48.480] This is a high school kid, right?
[50:48.480 --> 50:54.480] No, no, they talked about high school kids, but this guy wasn't. He was grown.
[50:54.480 --> 50:56.480]  Oh boy.
[50:56.480 --> 51:07.480] He committed to enough fraud in one hour for him to spend the next 10 of his lifetimes in a federal penitentiary.
[51:07.480 --> 51:11.480]  I couldn't believe there was actually saying this.
[51:11.480 --> 51:16.480] But it was clear that the banks had destroyed all these documents.
[51:16.480 --> 51:22.480] And now we have all of these court cases where people are demanding the documents.
[51:22.480 --> 51:26.480] I'd like to think we had something to do with it.
[51:26.480 --> 51:34.480] When we started this, we started putting filings in the hands of proceeds.
[51:34.480 --> 51:43.480] And after about a year, someone sent me a number of people sent me a copy of a seminar that was making rounds
[51:43.480 --> 51:52.480] from an attorney in Chicago teaching attorneys how to handle prosaic filings in federal court issues.
[51:52.480 --> 52:00.480] And in that seminar, he stated that there has been a large increase in the number of prosaic filings in the last year.
[52:00.480 --> 52:03.480]  There's been over 600.
[52:03.480 --> 52:06.480]  400 were ours.
[52:06.480 --> 52:09.480] And he was showing people how to handle prosaic filings.
[52:09.480 --> 52:12.480] And it was pretty well standard garbage.
[52:12.480 --> 52:17.480] But this put pressure on them to come up with the documentation.
[52:17.480 --> 52:19.480]  And they couldn't.
[52:19.480 --> 52:22.480] And so they came up with a way to come up with the documentation.
[52:22.480 --> 52:24.480] And it was so stupid.
[52:24.480 --> 52:32.480] It was as idiotic and asinine as the rest of the things that they had been doing.
[52:32.480 --> 52:40.480] If you secured a mortgage any time in the last 20 years,
[52:40.480 --> 52:49.480] any time after the repeal of the Glass-Steel Act, which occurred late 1980s,
[52:49.480 --> 52:52.480] you need to look real close at your mortgage.
[52:52.480 --> 52:58.480] If you have a mortgage and you have been foreclosed on and they've taken your house,
[52:58.480 --> 53:04.480] you need to look closely at going back and suing these scoundrels.
[53:04.480 --> 53:12.480] The Bank of America is in the process of closing the deal in a suit
[53:12.480 --> 53:17.480]  by a number of investment organizations.
[53:17.480 --> 53:23.480]  They're about to agree to pay them $8.5 billion.
[53:23.480 --> 53:33.480] What that amounts to is the investor giving up on attempting to collect on his investment.
[53:33.480 --> 53:43.480] He's holding the security instruments and the investor is asking for consideration on these holdings.
[53:43.480 --> 53:56.480] And the Bank of America's willingness to settle is tantamount to admission that the notes were fraudulent.
[53:56.480 --> 54:05.480] That's exactly the claim that's in the suit claiming that the Bank sold them fraudulent notes,
[54:05.480 --> 54:09.480] sold them notes produced by predatory learning practices.
[54:09.480 --> 54:16.480] And that will have the effect of collateral estoppulence against Bank of America.
[54:16.480 --> 54:22.480] When they make this deal and pay these investors,
[54:22.480 --> 54:31.480] they have essentially given judicial acknowledgement of their fraud.
[54:31.480 --> 54:39.480] So when they come to foreclose from you and you raise the issue that the contract was produced in fraud,
[54:39.480 --> 54:47.480] Bank of America will be statutorily or collateralally stopped from arguing that it's not.
[54:47.480 --> 54:56.480] The sky's falling in on them and everyone we have in court suing them right now has a good chance of winning the whole deal.
[54:56.480 --> 55:00.480] And we never expected that when we started.
[55:00.480 --> 55:11.480] Frankly, we helped people file cases in court to help them buy time to recover from their financial difficulties.
[55:11.480 --> 55:17.480] And then we figured if we could buy them some time, then they'd be able to go to the banks and make a deal.
[55:17.480 --> 55:24.480] But that was before we found out what was really going on and it became clear the banks can't afford to make a deal.
[55:24.480 --> 55:29.480] They make a deal, the Ponzi scheme falls apart.
[55:29.480 --> 55:35.480] And then they have to give up everything and that's what's happening to them anyway.
[55:35.480 --> 55:45.480] But because they just got things out of hand, so the moral of the story is if you have a mortgage and you're all up to date,
[55:45.480 --> 55:51.480] take a good look at your mortgage, rather use us, somebody else doesn't make any difference.
[55:51.480 --> 55:57.480] Sue them, sue the lender, put him in court with you.
[55:57.480 --> 56:04.480] What they're doing is criminal and a number of the states are beginning to look at this as criminal.
[56:04.480 --> 56:10.480] We can expect the banks to sacrifice some people to criminal prosecution.
[56:10.480 --> 56:20.480] Once that part begins to come out and we're close to that part now, the banks are going to want to be making a deal to get these things to go away.
[56:20.480 --> 56:28.480] This is one of those times, the 10 years treatment now you look back and you say,
[56:28.480 --> 56:38.480] if I only knew then what I know now, well, folks, this is then, actually this is now.
[56:38.480 --> 56:42.480] And we know precisely what's going to happen to the real estate market.
[56:42.480 --> 56:44.480] The real estate market is in free fall.
[56:44.480 --> 56:52.480]  If you purchased a house $2,000, $300,000, just try to get $154,000 now.
[56:52.480 --> 56:58.480] And by the end of 2012, just try to get $50 or $64,000.
[56:58.480 --> 57:00.480] This is going to happen.
[57:00.480 --> 57:03.480] This is what always happens.
[57:03.480 --> 57:08.480] This has been happening since we started keeping financial records.
[57:08.480 --> 57:15.480] We're going through a bell curve into a bubble that looks like a bell curve, starts out slow, gradually increases,
[57:15.480 --> 57:22.480] and it starts to increase in a dramatic rate that then it begins to slow. It was over the top and then it drops.
[57:22.480 --> 57:30.480] It drops like a stone and it will fall down below where it started.
[57:30.480 --> 57:32.480]  It will bottom out.
[57:32.480 --> 57:35.480] Then you'll be looking at an inverted bell curve.
[57:35.480 --> 57:40.480] It'll climb back up again, but it won't climb as high as it was at the bubble.
[57:40.480 --> 57:49.480] It will climb back to where it should have been at the beginning, except it will climb to something somewhat larger.
[57:49.480 --> 58:00.480] So it'll come back a little beyond what it started out at with an adjustment for the increase in the market by more people entering the market.
[58:00.480 --> 58:03.480] Right now we have no construction.
[58:03.480 --> 58:07.480] That's going to increase the demand on the backside of the curve.
[58:07.480 --> 58:10.480]  I will finish up real quickly.
[58:10.480 --> 58:16.480] We'll come back and then we'll go to Frank in New York and Kathy and Mark Park in Michigan.
[58:16.480 --> 58:19.480] This is Randy Kelton and Steven Daddy Craig.
[58:19.480 --> 58:20.480]  We have low radio.
[58:20.480 --> 58:25.480]  Our call in number is 512-646-1984.
[58:25.480 --> 58:27.480]  Call us.
[58:27.480 --> 58:38.480] When we get back, we'll be taking calls for the rest of the show.
[58:58.480 --> 59:07.480] The Bible remains the most popular book in the world, yet countless readers are frustrated because they struggle to understand it.
[59:07.480 --> 59:16.480] Some new translations try to help by simplifying the text, but in the process can compromise the profound meaning of the Scripture.
[59:16.480 --> 59:18.480]  Enter the recovery version.
[59:18.480 --> 59:27.480] First, this new translation is extremely faithful and accurate, but the real story is the more than 9,000 explanatory footnotes.
[59:27.480 --> 59:37.480] Difficult and profound passages are opened up in a marvelous way, providing an entrance into the riches of the Word beyond which you've ever experienced before.

[01:00:28.480 --> 01:00:43.480] Analysts worry that wars of the future will be fought over blue gold as thirsty people offer to mystic politicians and powerful corporations battle for dwindling water resources.
[01:00:43.480 --> 01:00:52.480] Adele Darwish, co-author of Water Wars, Coming Conflicts in the Middle East, says modern history has already seen at least one water war.
[01:00:52.480 --> 01:01:01.480] Former Israeli Prime Minister Ariel Sharon said the reason for going to war in 1967 was for water.
[01:01:01.480 --> 01:01:16.480] African Union Commissioner Jean Ping expressed concern Thursday over the flow of weapons into Libya after France revealed it had dropped assault rifles, machine guns and rocket-propelled grenade launchers to unarmed civilians in western Libya earlier this month.
[01:01:16.480 --> 01:01:27.480] Ping said the weapons would contribute to the destabilization of African states, adding the AU already has proof these weapons are in the hands of al-Qaeda and traffickers.
[01:01:27.480 --> 01:01:46.480] Federal Mine Disaster Investigators Tuesday charged Massey Energy, owner of Upper Big Branch Mine where 29 miners were killed in April 2010, kept two sets of records chronicling safety problems. One internal set of reports detailed problems and how they delayed coal production.
[01:01:46.480 --> 01:02:09.480] Second set, reviewed by Federal Mine Safety Inspectors, failed to mention the same hazards. Some were identical to those believed to have contributed to the explosion. Portions of the mine hit by the explosion were not treated for excessive and explosive coal dust because the entries or tunnels in those areas were too small to accommodate the machine used to spray the material that neutralizes coal dust.
[01:02:09.480 --> 01:02:24.480] Three men, part of the Newberg Four were sentenced to 25 years in prison Wednesday. The four men had been convicted of plotting to blow up synagogues in the Bronx and shoot down a military jet. However critics say an FBI paid informant entrapped the defendants.
[01:02:24.480 --> 01:02:37.480] US District Judge Colleen McMahon, who levied the minimum sentence, said their decision would have been overturned if she'd given them less than 25 years. She refused government demands to give them a life sentence.
[01:02:37.480 --> 01:02:53.480] Referring to one of the defendants, James Cromity, McMahon said, I suspect that real terrorists would not have bothered themselves with a person who was so utterly inept, adding, only the government could have made a terrorist out of Mr. Cromity, whose buffoonery is positively Shakespearean.
[01:02:53.480 --> 01:03:08.480] Government informant Shahed Hossein, applied the quartet with gifts, promising to pay big money if they went along with the plot.
[01:03:53.480 --> 01:04:08.480] He said, I suspect that real terrorists would not have bothered themselves with a person who was so utterly inept, adding, only the government could have made a terrorist out of Mr. Cromity, whose buffoonery is positively Shakespearean.
[01:04:08.480 --> 01:04:23.480] I suspect that real terrorists would not have bothered themselves with a person who was so utterly inept, adding, only the government could have made a terrorist out of Mr. Cromity, whose buffoonery is positively Shakespearean.
[01:04:23.480 --> 01:04:39.480] I suspect that real terrorists would not have bothered themselves with a person who was so utterly inept, adding, only the government could have made a terrorist out of Mr. Cromity, whose buffoonery is positively Shakespearean.
[01:04:39.480 --> 01:04:54.480] I suspect that real terrorists would not have bothered themselves with a person who was so utterly inept.
[01:04:54.480 --> 01:05:12.480] I suspect that real terrorists would not have bothered themselves with a person who was so utterly inept, adding, only the government could have made a terrorist out of Mr. Cromity, whose buffoonery is positively Shakespearean.
[01:05:12.480 --> 01:05:30.480] Yes, the sky is really falling down on the limbers. We've talked about the Bilderberger, the real big money people who are behind everything.
[01:05:30.480 --> 01:05:43.480] We've had people say, you can't fight the banks. The banks are too big, blah, blah, blah. No, the banks of Kent and Potter. The ones who really stole all the money are behind all of this.
[01:05:43.480 --> 01:05:52.480] They're out of our reach. We can't get to them. That may not be right, but that's how it is. We can fix that right now.
[01:05:52.480 --> 01:06:02.480] But it seems those people are, this is such a large scam that they need a large scapegoat.
[01:06:02.480 --> 01:06:17.480] And they're throwing the banksters to the wolves, and we intend to be the wolves. If you have a mortgage that you secured in the last 20 years, which most of us will have one of those, then you need to look at that mortgage.
[01:06:17.480 --> 01:06:29.480] Get a forensic analysis of the mortgage. And one thing you need to look at all of the fees they charged you, most of the forensic analysis out there, don't look at the fees.
[01:06:29.480 --> 01:06:42.480] On every note we've seen so far, almost, we found what were obviously, outrageously false fees.
[01:06:42.480 --> 01:06:49.480] And then we find other fees that are not so obvious, but they're just as outrageous.
[01:06:49.480 --> 01:06:58.480] On the front end, they stole a lot from you. They deliberately defrauded you on every turn.
[01:06:58.480 --> 01:07:21.480] If you bought a house for $300,000 anywhere from $2,000 on, if you took every penny that you're paying into it and applied it all to principle, instead of interest or anything, you would still be behind.
[01:07:21.480 --> 01:07:29.480] The house is now worth less than half of what you paid for it. Now, this goes back to January.
[01:07:29.480 --> 01:07:40.480] Last year, across the board in the United States, housing lost 44% of its value. They expected to be worse this year.
[01:07:40.480 --> 01:07:54.480] So this is a strategical move. If you're paying for a house, you're paying for a house that you will owe three or four times what its value is.
[01:07:54.480 --> 01:08:11.480] You'll never get it paid off. In the end, if you're completely up to date on your payments, to keep paying those payments is an incredibly bad strategy.
[01:08:11.480 --> 01:08:21.480] Soothe them. If you're up to date, if you're behind, if you're looking at foreclosure, if you're in foreclosure, soothe them.
[01:08:21.480 --> 01:08:30.480] If you use our suit, you use someone else's suit, soothe them. Stop them, put them in a position where they have to answer to you.
[01:08:30.480 --> 01:08:33.480] The only thing they pay attention to is a lawsuit.
[01:08:33.480 --> 01:08:43.480] Yeah, and Randy, people can keep making the payments and still file lawsuits. So that way they're not in any danger. They have the total upper hand.
[01:08:43.480 --> 01:08:56.480] Exactly. That gives you the absolutely the best position. But soothe them. We need to stop as much of this fraud as we possibly can.
[01:08:56.480 --> 01:09:04.480] We absolutely need to keep as many people in their properties as is possible.
[01:09:04.480 --> 01:09:14.480] If we're going to limit the effect of this depression that's coming at us like a freight train, we need to keep people in their properties.
[01:09:14.480 --> 01:09:22.480] We need to allow as much of the American public to maintain the equity in this country as possible.
[01:09:22.480 --> 01:09:31.480] So, soothe them. File a good suit, bad suit, and you end up making a difference. Just soothe them.
[01:09:31.480 --> 01:09:39.480] You file a good suit, put them in the tracks. You file a bad suit, you stop them in their tracks.
[01:09:39.480 --> 01:09:47.480] The first suit I filed, the fellow broadcaster was in looking at a foreclosure hearing in a couple of days.
[01:09:47.480 --> 01:09:52.480] And I told him, I'm not ready yet. I'm still doing research. He said, I don't have time for you to do research.
[01:09:52.480 --> 01:10:01.480] And then on the internet, pulled down a bunch of pleadings. And I looked at it and I said, well, that looks like a good argument.
[01:10:01.480 --> 01:10:05.480] I pulled it off, dropped it in the suit. This one looks good. I pulled it, dropped it in the suit.
[01:10:05.480 --> 01:10:13.480] They took it to him and he filed it. The other side filed an answer to stop the fiction hearing.
[01:10:13.480 --> 01:10:19.480] And the other side had 20 days to answer. They answered and said, this suit's a piece of crap.
[01:10:19.480 --> 01:10:28.480] And the judge, after another 30 days or so, came back with a ruling and said, this suit's a piece of crap.
[01:10:28.480 --> 01:10:35.480] You need, I'm going to dismiss the suit and you need to file it and then to plead it.
[01:10:35.480 --> 01:10:39.480] Gave us a couple of months to come up with a better suit. So we filed another one.
[01:10:39.480 --> 01:10:45.480] And they said, that was a piece of crap. And the judge agreed. That was a piece of crap too.
[01:10:45.480 --> 01:10:56.480] I think they're under fourth and into pleading. That was November a year ago, still in their house.
[01:10:56.480 --> 01:11:10.480] And he was very astute. He hired a private investigator and gave him the names of the individuals who signed the documents
[01:11:10.480 --> 01:11:19.480] that the banks filed in the case. And the one who signed the affidavit that claimed that the banks had authority to foreclose
[01:11:19.480 --> 01:11:27.480] had five pseudonyms and two social security numbers. What do you think of that?
[01:11:27.480 --> 01:11:36.480] They could win the whole enchilada. So the moral of this story is if you have a mortgage, sue them.
[01:11:36.480 --> 01:11:44.480] If you have had a mortgage and have been foreclosed on, sue them. File a good suit, file a bad suit, just sue them,
[01:11:44.480 --> 01:11:51.480] stop them in their tracks, force them to the table because in the next year to year and a half the sky is going to continue
[01:11:51.480 --> 01:12:01.480] to fall in on these guys. The FDIC and several other governmental institutions are pushing the banks to put together
[01:12:01.480 --> 01:12:10.480] a fund to reimburse these people who have been falsely foreclosed on and who do you think is going to get the biggest piece of that pie?
[01:12:10.480 --> 01:12:16.480] The people who just rolled over and said, oh, just do whatever to me you want to,
[01:12:16.480 --> 01:12:24.480] but the ones who are fighting them like a tiger and pushing for criminal prosecution of them,
[01:12:24.480 --> 01:12:30.480] those are the ones that are going to get the biggest piece of the pie. So the opportunity is in front of you.
[01:12:30.480 --> 01:12:33.480] All right. That sounds great, Randy.
[01:12:33.480 --> 01:12:37.480] If we can use somebody else, use anybody, but do something. Now let's go to calls.
[01:12:37.480 --> 01:12:43.480] All right. We've got Frank from New York. Frank, thanks for holding for so long. Thank you for being so patient.
[01:12:43.480 --> 01:12:45.480] What is your question for us tonight?
[01:12:45.480 --> 01:12:51.480] That was excellent, Randy. Thanks for that. I've been following this.
[01:12:51.480 --> 01:13:04.480] Anyways, I got a serious thing going on here in Garter, New York. I was accosted by two, no, a Ranger,
[01:13:04.480 --> 01:13:13.480] a forest ranger at a campground. He said that my tent was in its place for whatever, over the time limit or something
[01:13:13.480 --> 01:13:18.480] because it was raining like crazy. It didn't really matter. I asked him if I was under arrest.
[01:13:18.480 --> 01:13:29.480] He said no. I said, then why would you like my full name, not under arrest? Why should I volunteer to incriminate myself on that ticket?
[01:13:29.480 --> 01:13:36.480] Basically, I was trying to get arrested because I had a warrant in Rosendale and I wanted to clear that up.
[01:13:36.480 --> 01:13:41.480] I was doing this sort of educational thing. I think I informed the guys that I was going to wait until they arrested me
[01:13:41.480 --> 01:13:45.480] and see if I could learn some things about how corrupt they were.
[01:13:45.480 --> 01:13:51.480] But anyways, it went as planned. I had two tape recorders because I had this all planned out.
[01:13:51.480 --> 01:14:02.480] I held the one in their face as I was very non-agitated and I expected them to erase it and they did.
[01:14:02.480 --> 01:14:06.480] But I had the other one going and I got all of that, everything.
[01:14:06.480 --> 01:14:12.480] So they arrested me for obstruction when they brought the troopers in on it.
[01:14:12.480 --> 01:14:17.480]  I warned him, which I shouldn't have done, that it didn't hurt anything.
[01:14:17.480 --> 01:14:24.480] But I warned him that if he arrested me or trumped up a charge, I had a tape and I was going to use it.
[01:14:24.480 --> 01:14:30.480] He got help from Ms. Weber, who was another trooper, to erase the tape.
[01:14:30.480 --> 01:14:35.480] I don't know if I can amplify the one that was hidden enough.
[01:14:35.480 --> 01:14:46.480] I could probably do that with a Soundforge audio editor to get them talking about how to erase the tape.
[01:14:46.480 --> 01:14:58.480] I went to the judge and I told him I didn't understand the charges and I addressed down the ranger for how he got the name to fill out the ticket,
[01:14:58.480 --> 01:15:05.480] but he didn't volunteer for it because I know that in the code it says person means administrative, this and that and what it was.
[01:15:05.480 --> 01:15:11.480] It wasn't me and I was in my common law self.
[01:15:11.480 --> 01:15:15.480] I didn't have any obligation to give him anything because it's not an arrestable offense.
[01:15:15.480 --> 01:15:17.480]  It's a violation.
[01:15:17.480 --> 01:15:21.480] He explained that to me and he couldn't arrest me and he knew it.
[01:15:21.480 --> 01:15:24.480] But the trooper brought up a charge of obstruction.
[01:15:24.480 --> 01:15:26.480] Chris is going to help me with it.
[01:15:26.480 --> 01:15:29.480] He screened me and he said to call him.
[01:15:29.480 --> 01:15:31.480]  I handled this pretty well.
[01:15:31.480 --> 01:15:33.480]  I didn't get emotional.
[01:15:33.480 --> 01:15:43.480] I did jump into stuff when they tried to make me get off the topic and stuff like that.
[01:15:43.480 --> 01:15:46.480] I said, let's get back to the topic at hand.
[01:15:46.480 --> 01:15:48.480]  Let's get back to business.
[01:15:48.480 --> 01:15:53.480] I did get out of the trooper that he was bullied when he was a child.
[01:15:53.480 --> 01:16:00.480] I told him I wouldn't assume too hard that if he had any big deaths I would let him off.
[01:16:00.480 --> 01:16:02.480]  I wouldn't assume really hard.
[01:16:02.480 --> 01:16:04.480]  I really didn't want to go after him.
[01:16:04.480 --> 01:16:06.480]  I wanted his boss.
[01:16:06.480 --> 01:16:15.480] He was pretty nice to me, but he still went ahead and lied on this paper here.
[01:16:15.480 --> 01:16:19.480] I did tell the judge that I didn't understand the charges and I wasn't standing under them.
[01:16:19.480 --> 01:16:24.480] I would like jury trial. I was invoking the Constitution.
[01:16:24.480 --> 01:16:27.480] I would be giving him motions on my next appearance.
[01:16:27.480 --> 01:16:32.480] I also demanded an examining trial because he refused me that.
[01:16:32.480 --> 01:16:35.480] I'll let you guys go to break.
[01:16:35.480 --> 01:16:37.480] All right. Stay right there.
[01:16:37.480 --> 01:16:40.480]  You are my idol.
[01:16:40.480 --> 01:16:42.480]  You are a God.
[01:16:42.480 --> 01:16:45.480] I don't know about that. Jesus Christ is our only God.
[01:16:45.480 --> 01:16:49.480] But we will be right back, folks.
[01:16:49.480 --> 01:16:51.480] This is the rule of law.
[01:16:51.480 --> 01:16:53.480] Randy Kelton, Eddie Craig, and Deborah Stevens.
[01:16:53.480 --> 01:16:56.480] We've also got Kathy and Mark on the line.
[01:16:56.480 --> 01:17:00.480] So, folks, stay right there. We'll be right back.

[01:18:09.480 --> 01:18:15.480] With the mortgage crisis worsening, we set our sights on finding a remedy for people who have been cheated by their lenders.
[01:18:15.480 --> 01:18:20.480] If you have a mortgage or have paid yours off, you have probably been cheated out of thousands.
[01:18:20.480 --> 01:18:22.480]  But there is a remedy.
[01:18:22.480 --> 01:18:30.480]  Go to remediesinrealestate.com or call me at 512-430-4140

[01:18:43.480 --> 01:18:48.480] Lender fraud is bankrupting this country and it's time to fight back.
[01:18:48.480 --> 01:18:55.480]  Go to remediesinrealestate.com or call 512-430-4140
[01:18:55.480 --> 01:19:00.480] and get the information you need to stop the money changers in their tracks.
[01:19:00.480 --> 01:19:25.480] Okay, folks, we are back. We're talking with Frank in New York.
[01:19:25.480 --> 01:19:32.480] But we do have a few comments about some of the stuff. Randy, you want to go?
[01:19:32.480 --> 01:19:38.480] Okay, when I said you were a God, you were a lesser God, okay?
[01:19:38.480 --> 01:19:43.480] I mean, anybody from New York, I mean, you have to consider that part.
[01:19:43.480 --> 01:19:49.480] But, you know, I really appreciate hearing what you're telling me.
[01:19:49.480 --> 01:19:54.480] You're one of the few people who've done exactly what we suggested.
[01:19:54.480 --> 01:19:59.480] And now you're going to find out how much fun it is.
[01:19:59.480 --> 01:20:01.480]  It used to be...
[01:20:01.480 --> 01:20:03.480]  I hope Chris can help me.
[01:20:03.480 --> 01:20:07.480] Oh, Chris will be overjoyed to help.
[01:20:07.480 --> 01:20:10.480] And good chance if they find out Chris is helping.
[01:20:10.480 --> 01:20:15.480] When you hammer one of these people, everybody finds out about it.
[01:20:15.480 --> 01:20:19.480] And Chris has got a judge and a prosecutor hammered.
[01:20:19.480 --> 01:20:24.480] He is getting known for his activities.
[01:20:24.480 --> 01:20:32.480] You will get known when they find out that you have a second recording,
[01:20:32.480 --> 01:20:38.480] they're going to vomit. You need to put together obstruction of justice,
[01:20:38.480 --> 01:20:44.480] tampering with the evidence, aggravated perjury.
[01:20:44.480 --> 01:20:46.480] You can just get a whole stack of them.
[01:20:46.480 --> 01:20:50.480] I know, and it's scaring me because they're going to kill me.
[01:20:50.480 --> 01:20:55.480] Hey, and Eddie, Eddie, you did want to make something about this stand-under stuff.
[01:20:55.480 --> 01:20:57.480] You want to make a comment about that?
[01:20:57.480 --> 01:21:01.480] Yeah, do keep in mind that you can stand under the rain,
[01:21:01.480 --> 01:21:05.480] you can stand under a fallen airplane, but you can't stand under the law.
[01:21:05.480 --> 01:21:09.480] Either it has jurisdiction over you or it doesn't.
[01:21:09.480 --> 01:21:10.480]  Exactly.
[01:21:10.480 --> 01:21:18.480] The only thing you can do to become accessible through it is to be engaged in whatever act it governs.
[01:21:18.480 --> 01:21:20.480]  Correct.
[01:21:20.480 --> 01:21:26.480] But using those particular phrases as an argument is going to get you red flagged in a hurry
[01:21:26.480 --> 01:21:28.480]  and not in a good way.
[01:21:28.480 --> 01:21:34.480] Don't mind that Patriot bull crap about I stand under this.
[01:21:34.480 --> 01:21:36.480]  That's Maloney.
[01:21:36.480 --> 01:21:39.480]  I don't stand under the charges.
[01:21:39.480 --> 01:21:42.480]  No, I don't stand under what I don't understand.
[01:21:42.480 --> 01:21:44.480]  I don't understand the charges.
[01:21:44.480 --> 01:21:51.480] Yeah, I think what we're trying to say is that that line of thinking isn't really accurate.
[01:21:51.480 --> 01:21:57.480] Okay, but I knew that I could say what I wanted because I had them dead to rights.
[01:21:57.480 --> 01:22:02.480]  I was basically right about that.
[01:22:02.480 --> 01:22:04.480]  They're going down anyway.
[01:22:04.480 --> 01:22:11.480] I did call the trooper an idiot right in front of the judge, okay, in a nice way.
[01:22:11.480 --> 01:22:16.480] Did you happen to bring up the fact that they tampered with evidence on the scene?
[01:22:16.480 --> 01:22:19.480] No, because I was afraid for my life.
[01:22:19.480 --> 01:22:22.480]  It's probably too soon.
[01:22:22.480 --> 01:22:24.480]  You're right.
[01:22:24.480 --> 01:22:27.480] No need to tip your hand at this point.
[01:22:27.480 --> 01:22:35.480] You want to tip that hand once you have a high level judge involved in the procedure.
[01:22:35.480 --> 01:22:43.480] There are killers out there and I had a new pulse police officer take his high performance vehicle
[01:22:43.480 --> 01:22:51.480] and race it at me at about 70 miles an hour in about probably 200 yards or less
[01:22:51.480 --> 01:22:54.480]  and I had nowhere to go.
[01:22:54.480 --> 01:23:01.480] He didn't have his emergency lights on and all he was doing was making a turn down a dead end street.
[01:23:01.480 --> 01:23:09.480] They threatened me and they know I was after their little trooper friend.
[01:23:09.480 --> 01:23:17.480] You need to engage a high level judge.
[01:23:17.480 --> 01:23:19.480]  That's what I need to do immediately.
[01:23:19.480 --> 01:23:24.480]  If I don't, he's going to end up in a ditch somewhere.
[01:23:24.480 --> 01:23:31.480] Bush whacked him in his courtroom with criminal complaints against these guys.
[01:23:31.480 --> 01:23:37.480] You go in and run the routine on the bailiff.
[01:23:37.480 --> 01:23:43.480] My name is Frank from New York, an instructor judge that I have business with the court
[01:23:43.480 --> 01:23:46.480] and the bailiff would say, may I tell the judge and they see the business.
[01:23:46.480 --> 01:23:49.480] I may not. I have business with the court and it's none of yours.
[01:23:49.480 --> 01:23:51.480]  You're dismissed. Go sit down.
[01:23:51.480 --> 01:23:56.480] I want to work with Chris to perfect a criminal complaint for each one.
[01:23:56.480 --> 01:24:03.480] Have the criminal complaints, drop the criminal complaints on the judge and when he refuses to act,
[01:24:03.480 --> 01:24:06.480] then you file criminal charges against the judge.
[01:24:06.480 --> 01:24:17.480] Now that's set up the judge. Once you have filed on him, then if you can get a policeman, a trooper,
[01:24:17.480 --> 01:24:26.480] a bailiff, anyone to say or do anything that you can construe as threatening,
[01:24:26.480 --> 01:24:34.480] then you file against the judge, accuse the judge of sending them to harass and intimidate you.
[01:24:34.480 --> 01:24:38.480] And the judge is going to have a connection to it.
[01:24:38.480 --> 01:24:42.480] He will release police officers to riot act.
[01:24:42.480 --> 01:24:48.480] I've been dreaming this. I want this so bad because they're so corrupt there.
[01:24:48.480 --> 01:24:52.480] I'm traveling without any licenses or nothing like that.
[01:24:52.480 --> 01:24:58.480] My license is revoked. They tried to say I was driving in the park in a lot of the campground
[01:24:58.480 --> 01:25:02.480] and I said I'm traveling. I'm not using my license. I have one. I'm not using it.
[01:25:02.480 --> 01:25:07.480] Wait a minute. I happen to know some stuff about this being in the national campgrounds
[01:25:07.480 --> 01:25:13.480] and national forest as far as traveling and driving and stuff like that.
[01:25:13.480 --> 01:25:21.480] Was this an area where there was a state road that was on?
[01:25:21.480 --> 01:25:26.480] Was it a state road passing through the national forest like state highway something or other?
[01:25:26.480 --> 01:25:31.480] Even if it was a dirt road, was it called national forest road or what was it called?
[01:25:31.480 --> 01:25:42.480] This is route 299 and 4455 in Gardner, New York and it's a parking lot. It's a multiple use area.
[01:25:42.480 --> 01:25:46.480] Wait, is this a state campground or this is national?
[01:25:46.480 --> 01:25:51.480] Wait a minute. This goes to something else. This is a parking lot.
[01:25:51.480 --> 01:25:56.480] Okay, but I'm trying to find out if this was state or federal. This is very important.
[01:25:56.480 --> 01:25:59.480] State. What kind of property it is?
[01:25:59.480 --> 01:26:09.480] It's 58 acres of land you can hunt on. You can camp on and there's no facilities except for maybe an outhouse.
[01:26:09.480 --> 01:26:13.480]  Were you driving on a roadway?
[01:26:13.480 --> 01:26:19.480] I was traveling on a parking lot to back my car.
[01:26:19.480 --> 01:26:23.480] You were not on a public thoroughfare?
[01:26:23.480 --> 01:26:25.480]  Nope.
[01:26:25.480 --> 01:26:30.480]  Do not apply there.
[01:26:30.480 --> 01:26:44.480] If I want to, I can put my two-year-old behind the wheel on my personal property and have that two-year-old drive all over that place if I want to is none of their business.
[01:26:44.480 --> 01:26:52.480] A primary court case in Fort Worth here in Texas was out of Fort Worth and it happens to be a place I know really well.
[01:26:52.480 --> 01:27:03.480] The guy is pulling out of a health food, a whole food foods market on Horn Street just off of I-30.
[01:27:03.480 --> 01:27:10.480] He pulls up to the stop sign, runs through the stop sign and pulls out in the street to please pull him over.
[01:27:10.480 --> 01:27:20.480] He maintained that the stop sign was not on a public thoroughfare and therefore had no force and effect under law.
[01:27:20.480 --> 01:27:23.480] And the courts agreed with him.
[01:27:23.480 --> 01:27:30.480] It was on private property, not a public thoroughfare.
[01:27:30.480 --> 01:27:41.480] And even if the property belongs to the state, if it's not a public thoroughfare, the traffic laws do not apply, period.
[01:27:41.480 --> 01:27:44.480]  Right. They don't even have color.
[01:27:44.480 --> 01:27:56.480] Now, the police can come onto a private parking lot and enforce common law crime or statutory crime.
[01:27:56.480 --> 01:27:57.480]  Right.
[01:27:57.480 --> 01:27:59.480]  But not traffic law.
[01:27:59.480 --> 01:28:00.480]  Right.
[01:28:00.480 --> 01:28:02.480]  They got a problem.
[01:28:02.480 --> 01:28:16.480] They didn't try. They tried to insinuate that I was going to enter the road when I was just backing up to my tent area to gather my belongings.
[01:28:16.480 --> 01:28:27.480] They can do that and you can ask them to give you an intent to write you a ticket.
[01:28:27.480 --> 01:28:28.480]  Right.
[01:28:28.480 --> 01:28:30.480]  Yeah, really.
[01:28:30.480 --> 01:28:36.480] The traffic laws do not apply on that private area.
[01:28:36.480 --> 01:28:49.480] They wrote me two tickets, one for camping for four days instead of three, and then burning cans in the fire because I was getting rid of the residue so the ants wouldn't come.
[01:28:49.480 --> 01:28:51.480]  But anyways, cans don't burn, I told them.
[01:28:51.480 --> 01:28:56.480] And plus, I'm not going to answer to this ticket because all I'm giving you is my common name.
[01:28:56.480 --> 01:28:58.480] I'm not giving you my other name.
[01:28:58.480 --> 01:29:00.480]  I was trying to get arrested.
[01:29:00.480 --> 01:29:01.480]  So anyways...
[01:29:01.480 --> 01:29:03.480]  Okay, wait a minute.
[01:29:03.480 --> 01:29:06.480]  Burning cans in a fire.
[01:29:06.480 --> 01:29:09.480]  There's a statute that says you can't burn cans in a fire.
[01:29:09.480 --> 01:29:17.480] It says burning unpermitted material in an open fire.
[01:29:17.480 --> 01:29:23.480] How is unpermitted material defined?
[01:29:23.480 --> 01:29:27.480]  It's garbage, basically.
[01:29:27.480 --> 01:29:44.480] If it's a state campground, there probably are some kind of ordinances or statutes that prohibit burning of certain items and allow burning of certain items because they don't want people burning plastic and stuff like that or styrofoam because it releases too much toxins into the air.
[01:29:44.480 --> 01:29:45.480]  It's reasonable.
[01:29:45.480 --> 01:29:47.480]  Right, that's reasonable.
[01:29:47.480 --> 01:29:49.480] Okay, Frank, listen, we're coming to the end of the segment.
[01:29:49.480 --> 01:29:51.480] Do you have any other questions for us?
[01:29:51.480 --> 01:29:52.480]  Yes, I do.
[01:29:52.480 --> 01:29:58.480] Okay, let's finish up quickly on the other side because we've already gone into our second segment with you and we've got other callers on the line. We'll be right back.
[01:30:22.480 --> 01:30:34.480]  Is this your mommy?
[01:30:34.480 --> 01:30:43.480] Getting kids paired up with parents after school is a critical responsibility of teachers and school administrators, but is technology a good substitute for common sense?
[01:30:43.480 --> 01:30:46.480] Look at your Catherine Albrecht and I'll tell you more in just a moment.
[01:30:46.480 --> 01:30:56.480] Privacy is under attack. When you give up data about yourself, you'll never get it back again. And once your privacy is gone, you'll find your freedoms will start to vanish too.
[01:30:56.480 --> 01:31:04.480] So protect your rights. Say no to surveillance and keep your information to yourself. Privacy, it's worth hanging on to.
[01:31:04.480 --> 01:31:15.480] This public service announcement is brought to you by StartPage.com, the private search engine alternative to Google, Yahoo, and Bing. Start over with StartPage.
[01:31:15.480 --> 01:31:20.480] A product called KidGopher promises to match kids with parents waiting to pick them up.
[01:31:20.480 --> 01:31:27.480] It assigns parents RFID radio frequency microchipped ID cards that can be read by a computer system several feet away.
[01:31:27.480 --> 01:31:39.480] The unique number on each card triggers a screen display of guardian names and pictures, but radio signals can be cloned and databases can be altered, and supposedly secure technology tends to make humans lazy.
[01:31:39.480 --> 01:31:51.480] Nothing can replace the security of staff simply knowing the students and their parents. KidGopher would not only put kids at risk, it would condition them to accept RFID and tracking, and that's not good for our future.
[01:31:51.480 --> 01:32:10.480] I'm Dr. Catherine Albrecht, more news and information at CatherineAlbrecht.com.
[01:32:21.480 --> 01:32:31.480]  Thank you for watching.
[01:32:52.480 --> 01:32:56.480] Okay, folks, we are back.
[01:32:56.480 --> 01:33:00.480] All right, we've got Frank, Kathy, Mark.
[01:33:00.480 --> 01:33:06.480] Okay, Frank, we can only give you about two more minutes here because we've already given you like 20 minutes and there's other callers waiting on the line.
[01:33:06.480 --> 01:33:14.480] This isn't our Friday 4-hour info marathon, so if you could just give us one more question quickly and then we'll answer it the best we can and then we've got to move on.
[01:33:14.480 --> 01:33:26.480] Okay, Rush, I got to Rosendale, New York for the warrant. I expected them when I showed for court after the initial appearance and they blah, blah, blah, and everything.
[01:33:26.480 --> 01:33:42.480] Then I went to the court again and then I got from the judge and the prosecutor was told by the son of my wife that he was not going to pursue the charges.
[01:33:42.480 --> 01:33:47.480] That's what Mr. Blackman, the district attorney or whatever assistant said to the judge.
[01:33:47.480 --> 01:33:51.480] We're going to offer Frank an ACD.
[01:33:51.480 --> 01:34:00.480] I said, what? The kid's guilty of sin. He lied on the affidavit and everything.
[01:34:00.480 --> 01:34:05.480] I said, there's no way. I got his mother's affidavit and mine in the file.
[01:34:05.480 --> 01:34:16.480] We thought we had this taken care of. You guys are pulling shenanigans. This is what I'm thinking. You're going to make more money off the taxpayers. You're going to delay the case.
[01:34:16.480 --> 01:34:23.480] We've got to move on. We need to make this a very shift. Frank, maybe it's better if you just call back in tomorrow night.
[01:34:23.480 --> 01:34:24.480]  I'm done.
[01:34:24.480 --> 01:34:25.480]  Okay, all right.
[01:34:25.480 --> 01:34:30.480] What do you got to say about that? I rushed it.
[01:34:30.480 --> 01:34:34.480] You mean about the prosecutor not wanting to prosecute?
[01:34:34.480 --> 01:34:41.480] Well, he wants to prosecute because I don't want to take a deal. But he has no claim.
[01:34:41.480 --> 01:34:43.480] Okay, well then, fight back.
[01:34:43.480 --> 01:34:49.480] Oh, this is trying to prosecute you. This is just standard procedure. They're trying to squeeze a deal.
[01:34:49.480 --> 01:34:54.480] You need to go back after the prosecutor for malicious prosecution. Just make a decision.
[01:34:54.480 --> 01:34:56.480]  Man, prosecutorial misconduct.
[01:34:56.480 --> 01:34:57.480]  Okay.
[01:34:57.480 --> 01:34:59.480] Five grievances here against it.
[01:34:59.480 --> 01:35:00.480]  That's what I wanted to hear. I'll call back.
[01:35:00.480 --> 01:35:01.480]  Okay, great.
[01:35:01.480 --> 01:35:02.480]  One more question.
[01:35:02.480 --> 01:35:08.480] Okay, thanks, Frank. Okay. All right, we are going now to Kathy in Texas. Kathy, thank you for calling in.
[01:35:08.480 --> 01:35:10.480] What is your question for us tonight?
[01:35:10.480 --> 01:35:15.480] Well, Randy started it off, though, now. It happened to get in the mail today.
[01:35:15.480 --> 01:35:23.480] Whatever this is, proof of claim form, notice of class action proposed settlement.
[01:35:23.480 --> 01:35:28.480] Someone apparently has opened up a class action lawsuit against Washington Mutual.
[01:35:28.480 --> 01:35:37.480] And since they're bankrupt, it's against the FDIC, actually, and the receivership of Washington Mutual.
[01:35:37.480 --> 01:35:46.480] So the question is, I was looking through all these documents that they sent and have not read every word of it.
[01:35:46.480 --> 01:35:50.480] But the first thing that comes to mind is the first line of it says,
[01:35:50.480 --> 01:35:58.480] you receive this notice because the records of Washington Mutual show that you are a member of the class.
[01:35:58.480 --> 01:36:07.480] And apparently they're suing over just exactly what you're talking about, Randy, the fees, penalties, finance charges,
[01:36:07.480 --> 01:36:21.480] UCC3 fees, recording fees, payoff statement fees, all those sorts of things that were, you know, not proper but charged.
[01:36:21.480 --> 01:36:26.480] And so it's alleged that they owe us all these fees back.
[01:36:26.480 --> 01:36:39.480] So as I read on to here, it says in exchange for the settlement and dismissal of the litigation that Washington Mutual has agreed to pay $13 million,
[01:36:39.480 --> 01:36:44.480] which is the gross settlement fund, into the settlement account.
[01:36:44.480 --> 01:36:53.480] And then that would be used to pay plaintiff's attorney's fees, class council administration fees,
[01:36:53.480 --> 01:37:05.480] and they've also agreed to pay all the costs related to settlement administration to provide notice to the class of the settlement.
[01:37:05.480 --> 01:37:07.480]  So it continues on.
[01:37:07.480 --> 01:37:16.480] It says any funds that remain in the net settlement fund after the payment of incentive award attorney's fees, account payments,
[01:37:16.480 --> 01:37:26.480] blah, blah, blah, those fees shall be distributed amongst all such funds remaining in the net settlement fund,
[01:37:26.480 --> 01:37:34.480] which funds shall be returned to Washington Mutual's bankruptcy estate.
[01:37:34.480 --> 01:37:40.480] So as I'm kind of, you know, my poor, idle brain is trying to get through this.
[01:37:40.480 --> 01:37:47.480] It just sounds to me like we're going to take, you know, $2.50 and hand it to everybody on this list,
[01:37:47.480 --> 01:37:51.480] and all the rest of the money is going to go back to us, and we're going to keep it.
[01:37:51.480 --> 01:37:56.480] That's exactly the way it works at a class action.
[01:37:56.480 --> 01:38:04.480] The lawyers get all the money, you get nothing, and you sign away your right to take action.
[01:38:04.480 --> 01:38:13.480] Yeah, the other thing I see on this is if you do nothing, it says you have, in effect, signed away and said that you will not sue in the future on your own.
[01:38:13.480 --> 01:38:15.480]  There's a piece on that.
[01:38:15.480 --> 01:38:18.480] Absolutely. You have said no such thing. Who told you that?
[01:38:18.480 --> 01:38:21.480]  That's what the statement said.
[01:38:21.480 --> 01:38:24.480] Oh, yay. Thank you to go after them for that.
[01:38:24.480 --> 01:38:29.480] They're saying that we put together this class action.
[01:38:29.480 --> 01:38:36.480] If you either agree to sign away all your rights or you waive all your rights.
[01:38:36.480 --> 01:38:42.480] That's kind of what it is. It says one of your options says you can file a proof of claim form, which is included here,
[01:38:42.480 --> 01:38:51.480] which means I go and do all of their legwork to provide to them everything they need to provide to me, in essence.
[01:38:51.480 --> 01:38:59.480] And then that would put me, you know, right up there with I'm going to maybe get something.
[01:38:59.480 --> 01:39:04.480] And then it says you can opt out of the class.
[01:39:04.480 --> 01:39:08.480] You can remove yourself by submitting a timely opt out notice.
[01:39:08.480 --> 01:39:12.480] And if you do not opt out, you will be a settlement class member,
[01:39:12.480 --> 01:39:19.480] but will only receive a claim payment if you file a timely, valid proof of claim form.
[01:39:19.480 --> 01:39:24.480]  So if I don't sign the form, I can opt out or I can't opt out.
[01:39:24.480 --> 01:39:28.480] But it seems to me that it doesn't matter what I do.
[01:39:28.480 --> 01:39:30.480] I'm not going to get anything out of this.
[01:39:30.480 --> 01:39:39.480] And so the question is, is it better in these sorts of mumbo jumbo that I think this is the standard thing.
[01:39:39.480 --> 01:39:49.480] I've seen these before, but is it going to hurt them more for us to go ahead and play the game
[01:39:49.480 --> 01:39:57.480] and submit the proof of claim form and make our name known knowing there's no money involved?
[01:39:57.480 --> 01:40:02.480] Is it better to have more names on the list who are valid claimants?
[01:40:02.480 --> 01:40:06.480] Or is it better to just stay out of it?
[01:40:06.480 --> 01:40:11.480] Whatever they're going to pay, it doesn't seem to me that my being in or out
[01:40:11.480 --> 01:40:17.480] is going to help the people who actually stood forward and put their names down on this document.
[01:40:17.480 --> 01:40:22.480] It's not going to help them to have more if I stay out, is it?
[01:40:22.480 --> 01:40:27.480] No. The lawyers are going to get all the money. It always works.
[01:40:27.480 --> 01:40:33.480] You may get a dollar or two, and it will be that small an amount.
[01:40:33.480 --> 01:40:36.480] And you'll sign away your right to take action.
[01:40:36.480 --> 01:40:42.480] That's right. And this is, for me personally, this is an old note. It doesn't exist for me anymore.
[01:40:42.480 --> 01:40:50.480] It was, you know, it's long ago, but I fall within the timeframe of the suit.
[01:40:50.480 --> 01:40:57.480] So for me, it's more worth to go find the forms and to see what they charge.
[01:40:57.480 --> 01:41:04.480] If it's more work for me to file the proof of claim form, then it would mean it's the same work as I see it
[01:41:04.480 --> 01:41:10.480] as if I went out and just going to go through the mortgage holder that I have now.
[01:41:10.480 --> 01:41:14.480] So for me, I don't care to do the work for this old thing that, you know,
[01:41:14.480 --> 01:41:17.480] for ten cents or whatever it's going to be.
[01:41:17.480 --> 01:41:26.480] Yeah. Send in the letter back and ask them what will be the amount you can expect to make this worth your while.
[01:41:26.480 --> 01:41:29.480] Yeah, what part of it, 13 million is mine, huh?
[01:41:29.480 --> 01:41:31.480]  Yeah.
[01:41:31.480 --> 01:41:32.480]  Because if...
[01:41:32.480 --> 01:41:40.480]  Yeah, there's probably 20 million cases in the suit.
[01:41:40.480 --> 01:41:44.480] So what part of that is going to be yours? You might ask them that before you pursue.
[01:41:44.480 --> 01:41:49.480] Yeah, because this is like an eight or a ten-year timeframe that's covered on the thing.
[01:41:49.480 --> 01:41:54.480] So they're bound to be multiple, multiple, you know, people.
[01:41:54.480 --> 01:41:58.480]  But I just basically...
[01:41:58.480 --> 01:42:07.480] It just seems to me that if there were any added benefit for the folks who stepped up and made the effort,
[01:42:07.480 --> 01:42:12.480] then I'm willing to step up and put my effort on there so that the winnings are bigger.
[01:42:12.480 --> 01:42:19.480] But when they've already stated the settlement amount, that's not going to be the case, is it?
[01:42:19.480 --> 01:42:21.480]  No. No, it couldn't change anything.
[01:42:21.480 --> 01:42:30.480] Okay, so I'm going to save my effort pursuing the one I have, maybe, as you suggested, right?
[01:42:30.480 --> 01:42:32.480]  So, okay.
[01:42:32.480 --> 01:42:39.480] Not having seen the documentation of it, you don't understand what the nature of the action is,
[01:42:39.480 --> 01:42:44.480] so it would be hard to truly give any coaching advice or...
[01:42:44.480 --> 01:42:51.480] Now, I think the action is pretty much what you were talking about earlier because they are claiming
[01:42:51.480 --> 01:42:58.480] that the fees that were charged up front and the fees for all the different things,
[01:42:58.480 --> 01:43:01.480] that the fees are not what they should have been.
[01:43:01.480 --> 01:43:10.480] They were more, they were not, you know, written properly or, you know...
[01:43:10.480 --> 01:43:17.480] I definitely want to see that suit because I want to take advantage of all the work they did.
[01:43:17.480 --> 01:43:19.480]  Yeah.
[01:43:19.480 --> 01:43:20.480]  Well, you didn't have it.
[01:43:20.480 --> 01:43:22.480] So I can take their arguments and...
[01:43:22.480 --> 01:43:26.480] I'll give it to you for your birthday. How about that?
[01:43:26.480 --> 01:43:30.480]  Oh, darn. I don't have birthdays anymore.
[01:43:30.480 --> 01:43:32.480]  Oh, sure you do.
[01:43:32.480 --> 01:43:34.480] I canceled them for lack of interest.
[01:43:34.480 --> 01:43:36.480]  No. No.
[01:43:36.480 --> 01:43:38.480]  We'll have a party.
[01:43:38.480 --> 01:43:40.480] We'll have a good weekend and thank you so much.
[01:43:40.480 --> 01:43:42.480] All right. Thank you, Kathy.
[01:43:42.480 --> 01:43:44.480]  Thank you very much. Bye-bye.
[01:43:44.480 --> 01:43:47.480] All right. We have one more segment. We've got Mark from Michigan.
[01:43:47.480 --> 01:43:52.480] After that, we don't have any more callers, so folks, if you'd like to call in this final segment,
[01:43:52.480 --> 01:43:56.480]  the number is 512-646-1984.
[01:43:56.480 --> 01:43:59.480] We will be right back.
[01:43:59.480 --> 01:44:03.480] Hey, did you hear? Ron Paul has announced he's running for president in 2012.
[01:44:03.480 --> 01:44:04.480]  It is Ron Paul.
[01:44:04.480 --> 01:44:07.480] Really? Okay. Put down the cell phone for one minute.
[01:44:07.480 --> 01:44:10.480] I really don't care about your Twitter updates on what you had for breakfast.
[01:44:10.480 --> 01:44:13.480] Oh, but I'd love to make those little smiley faces with punctuation marks.
[01:44:13.480 --> 01:44:14.480]  Of course you do.
[01:44:14.480 --> 01:44:17.480] Now, listen closely. You need to go down to Brave New Books and learn as much as you can
[01:44:17.480 --> 01:44:20.480] about Ron Paul and his message before it's too late.
[01:44:20.480 --> 01:44:22.480] They have all of his books and many of the books he talks about.
[01:44:22.480 --> 01:44:25.480] They also have t-shirts, bumper stickers, and yard signs
[01:44:25.480 --> 01:44:27.480] so that you can show your support for him during the campaign.
[01:44:27.480 --> 01:44:30.480] Brave New Books? Did they have Harry Potter and Twilight?
[01:44:30.480 --> 01:44:34.480] No, but they do carry a large selection of survival and preparedness books
[01:44:34.480 --> 01:44:36.480] to protect your family in time of emergency.
[01:44:36.480 --> 01:44:39.480] Ugh, that sounds like that show on the Discovery Channel.
[01:44:39.480 --> 01:44:43.480] Yeah, there's even a wilderness survival expert that teaches classes called Earthskill School
[01:44:43.480 --> 01:44:46.480] that you can sign up for on the website bravenewbookstore.com.
[01:44:46.480 --> 01:44:47.480]  What are you doing?
[01:44:47.480 --> 01:44:50.480] I'm tweeting all my friends that they should go to bravenewbookstore.com
[01:44:50.480 --> 01:44:53.480] or down to the bookstore in person. Where's it located?
[01:44:53.480 --> 01:44:55.480]  1904 Guadalupe Street.
[01:44:55.480 --> 01:44:57.480]  There, it's sent. I even made a smiley face.
[01:44:57.480 --> 01:44:59.480]  Great.
[01:45:00.480 --> 01:45:03.480] Are you the plaintiff or defendant in a lawsuit?

[01:46:26.480 --> 01:46:30.480]  Something I realized fully
[01:46:30.480 --> 01:46:33.480]  Somebody's on a bully,
[01:46:33.480 --> 01:46:35.480]  that bully's mine
[01:46:35.480 --> 01:46:38.480]  Somebody's on a bully, bully
[01:46:38.480 --> 01:46:43.480] There's always room at the top of the hill
[01:46:43.480 --> 01:46:45.480]  I hear through the grapevine
[01:46:45.480 --> 01:46:48.480]  and it's lonely left too
[01:46:48.480 --> 01:46:51.480] They're wishing it was more than opposition to bill
[01:46:51.480 --> 01:46:54.480] They know that if they don't do it
[01:46:54.480 --> 01:46:57.480] Somebody will lose the place
[01:46:57.480 --> 01:47:00.480] This world will never understand
[01:47:00.480 --> 01:47:07.480]  Somebody's on a bully, somebody's on a bully
[01:47:07.480 --> 01:47:09.480]  That bully's mine
[01:47:09.480 --> 01:47:10.480]  Somebody's on a bully
[01:47:10.480 --> 01:47:12.480]  All right, folks, we're back.
[01:47:12.480 --> 01:47:15.480] Final segment on this Thursday, June 30th.
[01:47:15.480 --> 01:47:16.480]  We're taking your calls.
[01:47:16.480 --> 01:47:18.480]  We've got Mark from Michigan.
[01:47:18.480 --> 01:47:20.480] Mark, thank you for calling in.
[01:47:20.480 --> 01:47:23.480] What is your question for us tonight?
[01:47:23.480 --> 01:47:26.480] Okay, thank you guys for what you do.
[01:47:26.480 --> 01:47:29.480]  I really appreciate it.
[01:47:29.480 --> 01:47:32.480]  I had a court date today,
[01:47:32.480 --> 01:47:36.480]  I guess you can say a phony trial.
[01:47:36.480 --> 01:47:38.480]  I filed a motion to dismiss
[01:47:38.480 --> 01:47:42.480] based on the Administrative Procedures Act
[01:47:42.480 --> 01:47:44.480]  and I filed an affidavit
[01:47:44.480 --> 01:47:48.480]  that I had filed in Eddie's course.
[01:47:48.480 --> 01:47:52.480] And the judge outright denied the motion
[01:47:52.480 --> 01:47:57.480] and they refused to give me a file,
[01:47:57.480 --> 01:48:02.480] staff copy to stamp my motion
[01:48:02.480 --> 01:48:05.480]  but I had proof that I had filed it
[01:48:05.480 --> 01:48:10.480] and they just went on and proceeded with trial.
[01:48:10.480 --> 01:48:12.480] And of course they found me guilty.
[01:48:12.480 --> 01:48:13.480]  I objected to everything.
[01:48:13.480 --> 01:48:15.480]  I objected to the trial.
[01:48:15.480 --> 01:48:21.480] I objected to the testimony of the police officer.
[01:48:21.480 --> 01:48:24.480]  I motioned the court to stay
[01:48:24.480 --> 01:48:27.480] the sentence pending an appeal.
[01:48:27.480 --> 01:48:30.480] So I was wondering, did I do anything wrong here?
[01:48:30.480 --> 01:48:36.480]  I mean, where did I mess up that?
[01:48:36.480 --> 01:48:39.480] You need to go ahead and file for a findings of fact
[01:48:39.480 --> 01:48:41.480] and conclusions of law of your motion.
[01:48:41.480 --> 01:48:44.480] You need to file against the clerk of the court
[01:48:44.480 --> 01:48:47.480]  for tampering with a government document
[01:48:47.480 --> 01:48:49.480] because they refused to file stamp
[01:48:49.480 --> 01:48:52.480] an official pleading filed in a case.
[01:48:52.480 --> 01:48:55.480]  I would file for a judicial conduct
[01:48:55.480 --> 01:48:57.480]  complaint against the magistrate
[01:48:57.480 --> 01:49:00.480] for failure to be fair and impartial
[01:49:00.480 --> 01:49:03.480] because they also did not enforce
[01:49:03.480 --> 01:49:05.480] the general rules of the court
[01:49:05.480 --> 01:49:08.480] in requiring the clerk to accept the filing
[01:49:08.480 --> 01:49:11.480] and the place of stamp upon it and so on and so forth.
[01:49:11.480 --> 01:49:14.480] And then complain him again
[01:49:14.480 --> 01:49:18.480] for denial of due process.
[01:49:18.480 --> 01:49:19.480]  Okay.
[01:49:19.480 --> 01:49:24.480] And now these motions here that I filed,
[01:49:24.480 --> 01:49:26.480] do I still go ahead and do my appeal
[01:49:26.480 --> 01:49:28.480]  because I have to do that within 21 days
[01:49:28.480 --> 01:49:31.480] for those issues I raise up on the appeal?
[01:49:31.480 --> 01:49:33.480]  Well, it depends.
[01:49:33.480 --> 01:49:35.480]  You can, yes.
[01:49:35.480 --> 01:49:37.480] But you need to file a findings of fact
[01:49:37.480 --> 01:49:39.480] and conclusions of law so you'll know
[01:49:39.480 --> 01:49:41.480]  what you're addressing on appeal.
[01:49:41.480 --> 01:49:43.480] If the judge just denied them out of hand,
[01:49:43.480 --> 01:49:46.480]  you don't really know why.
[01:49:46.480 --> 01:49:49.480] Okay, there's two things you need to file.
[01:49:49.480 --> 01:49:52.480] The motion for findings of fact and conclusions
[01:49:52.480 --> 01:49:56.480] do not stop the appeal, the appeal clock.
[01:49:56.480 --> 01:49:59.480]  File a motion for reconsideration.
[01:49:59.480 --> 01:50:01.480]  That stops the clock.
[01:50:01.480 --> 01:50:04.480] And he will certainly deny it,
[01:50:04.480 --> 01:50:06.480] but file the motion for reconsideration
[01:50:06.480 --> 01:50:09.480] with a findings of fact and conclusions of law
[01:50:09.480 --> 01:50:12.480]  of your own.
[01:50:12.480 --> 01:50:14.480]  Here are the facts.
[01:50:14.480 --> 01:50:17.480] Now, this is a conclusion you should have came to,
[01:50:17.480 --> 01:50:20.480] either accept my findings of fact and conclusions of law
[01:50:20.480 --> 01:50:22.480]  of your own.
[01:50:22.480 --> 01:50:25.480]  And I'll file a motion for reconsideration.
[01:50:25.480 --> 01:50:28.480]  That stops the clock.
[01:50:28.480 --> 01:50:30.480] Now, what state are you in?
[01:50:30.480 --> 01:50:32.480]  I'm in Michigan here.
[01:50:32.480 --> 01:50:33.480]  Okay.
[01:50:33.480 --> 01:50:35.480] Because in Texas you have to file a motion
[01:50:35.480 --> 01:50:38.480] for new trial before you can do the
[01:50:38.480 --> 01:50:42.480] request or the motion for appeal.
[01:50:42.480 --> 01:50:44.480] I was just making sure of that.
[01:50:44.480 --> 01:50:48.480] Okay, so I should file an order.
[01:50:48.480 --> 01:50:50.480] In the chronic article order,
[01:50:50.480 --> 01:50:53.480]  I should do a motion for findings of fact
[01:50:53.480 --> 01:50:59.480] and conclusions of law to the judge I've seen today.
[01:50:59.480 --> 01:51:00.480]  Yes.
[01:51:00.480 --> 01:51:02.480]  In that court.
[01:51:02.480 --> 01:51:04.480]  Exactly.
[01:51:04.480 --> 01:51:06.480]  And before I do that,
[01:51:06.480 --> 01:51:09.480]  I should file a motion
[01:51:09.480 --> 01:51:13.480] for, what was that motion you told me?
[01:51:13.480 --> 01:51:16.480]  A motion for, I got the conclusion.
[01:51:16.480 --> 01:51:18.480]  Reconciliation.
[01:51:18.480 --> 01:51:21.480] Yes, but then you said in Texas a motion for new trial.
[01:51:21.480 --> 01:51:24.480] Yes, in Texas you have to do a motion for new trial,
[01:51:24.480 --> 01:51:27.480]  but Randy's suggestion for Michigan
[01:51:27.480 --> 01:51:29.480]  is the reconsideration.
[01:51:29.480 --> 01:51:30.480]  Okay.
[01:51:30.480 --> 01:51:33.480] You might check what the law actually says
[01:51:33.480 --> 01:51:36.480] in Michigan on those issues.
[01:51:36.480 --> 01:51:39.480]  Okay, let's see how court believes.
[01:51:39.480 --> 01:51:41.480]  Okay.
[01:51:41.480 --> 01:51:44.480]  All right, I guess I'll take that advice
[01:51:44.480 --> 01:51:46.480] and allow them to go that way
[01:51:46.480 --> 01:51:49.480]  and see what happens.
[01:51:49.480 --> 01:51:50.480]  Thanks, Mark.
[01:51:50.480 --> 01:51:52.480]  Okay, have fun.
[01:51:52.480 --> 01:51:53.480]  Okay.
[01:51:53.480 --> 01:51:54.480]  Thanks, Mark.
[01:51:54.480 --> 01:51:55.480]  All right.
[01:51:55.480 --> 01:51:56.480]  Bye.
[01:51:56.480 --> 01:51:59.480] Okay, we've got Christian in La Porte, Texas.
[01:51:59.480 --> 01:52:01.480] Hey, Christian, we hadn't heard from you
[01:52:01.480 --> 01:52:02.480]  for a while.
[01:52:02.480 --> 01:52:04.480]  How's it going?
[01:52:04.480 --> 01:52:06.480]  Hey, I'm Carl.
[01:52:06.480 --> 01:52:09.480] I got my diapers on, you know, my panties on.
[01:52:09.480 --> 01:52:13.480] Danny Murphy and Don Bacon have helped me out a whole lot.
[01:52:13.480 --> 01:52:16.480]  I wanted to be complimented.
[01:52:16.480 --> 01:52:20.480] Randy Kelton on his law suit,
[01:52:20.480 --> 01:52:23.480] his federal law suit on the mortgage companies,
[01:52:23.480 --> 01:52:26.480] and it has managed to keep me in my house
[01:52:26.480 --> 01:52:29.480] through the help of Danny Murphy,
[01:52:29.480 --> 01:52:37.480] using this Kim and Chris's law suit on the mortgage companies.
[01:52:37.480 --> 01:52:40.480] I've then already gotten rid of the vacate
[01:52:40.480 --> 01:52:45.480] within 24 hours, probably three months ago,
[01:52:45.480 --> 01:52:51.480] and through this law suit,
[01:52:51.480 --> 01:52:56.480] raising it to the federal level,
[01:52:56.480 --> 01:52:59.480]  Danny has been step-by-step with me
[01:52:59.480 --> 01:53:01.480] and in court with me,
[01:53:01.480 --> 01:53:03.480]  and I'm still in my house,
[01:53:03.480 --> 01:53:06.480] and these people are just at their wit's.
[01:53:06.480 --> 01:53:07.480]  Wait a minute.
[01:53:07.480 --> 01:53:10.480] You mean you're working with Danny Murphy,
[01:53:10.480 --> 01:53:13.480] and he hasn't got you thrown in jail yet?
[01:53:13.480 --> 01:53:15.480]  Danny Murphy's awesome, man.
[01:53:15.480 --> 01:53:21.480]  He's enough over the years.
[01:53:21.480 --> 01:53:25.480] Danny Murphy gets no slack.
[01:53:25.480 --> 01:53:27.480] He goes into this show and asks us questions.
[01:53:27.480 --> 01:53:29.480]  It's hard to answer.
[01:53:29.480 --> 01:53:36.480]  He don't get any slack.
[01:53:36.480 --> 01:53:40.480] I'll tell you, all these listeners out there that don't watch,
[01:53:40.480 --> 01:53:45.480]  I mean, I've got two mouses that I'm fighting right now,
[01:53:45.480 --> 01:53:47.480] and I'm still in both of them,
[01:53:47.480 --> 01:53:54.480] because of rule of law, Randy Kelton, Chris,
[01:53:54.480 --> 01:53:59.480] and the advice and the law suit,
[01:53:59.480 --> 01:54:05.480] and Danny Murphy is really spearheading this thing,
[01:54:05.480 --> 01:54:07.480]  and I'll tell you what,
[01:54:07.480 --> 01:54:15.480]  I'm giving them my headache.
[01:54:15.480 --> 01:54:17.480]  I do appreciate Danny.
[01:54:17.480 --> 01:54:19.480]  I've known Danny.
[01:54:19.480 --> 01:54:22.480] Matter of fact, I think he was at the second presentation
[01:54:22.480 --> 01:54:24.480]  I ever gave.
[01:54:24.480 --> 01:54:26.480]  This was a long time ago.
[01:54:26.480 --> 01:54:30.480]  He's been in this fight a long time,
[01:54:30.480 --> 01:54:34.480]  and I'm glad he's on our side.
[01:54:34.480 --> 01:54:36.480]  You've been in Australia for a while,
[01:54:36.480 --> 01:54:38.480] so it's been kind of hard to get the information,
[01:54:38.480 --> 01:54:43.480]  but it's happening for us,
[01:54:43.480 --> 01:54:46.480]  and I really appreciate it.
[01:54:46.480 --> 01:54:49.480] Okay, have you filed for...
[01:54:49.480 --> 01:54:54.480] Did I take it they filed a Rule 12 motion to dismiss?
[01:54:54.480 --> 01:54:56.480]  No.
[01:54:56.480 --> 01:55:00.480]  We had a default judgment.
[01:55:00.480 --> 01:55:02.480]  They didn't answer,
[01:55:02.480 --> 01:55:11.480] and they didn't answer in the 14 days that the court gave them,
[01:55:11.480 --> 01:55:16.480] but they'd now turned around and gave them more time,
[01:55:16.480 --> 01:55:18.480] and with all their excuses,
[01:55:18.480 --> 01:55:22.480] they're going to deny my default judgment.
[01:55:22.480 --> 01:55:25.480] Yeah, we always expect that,
[01:55:25.480 --> 01:55:28.480] and you shouldn't be really upset about that.
[01:55:28.480 --> 01:55:32.480] The courts really don't like to give default judgments.
[01:55:32.480 --> 01:55:37.480] They want to give every opportunity they can
[01:55:37.480 --> 01:55:40.480] for someone to alleviate their issue,
[01:55:40.480 --> 01:55:42.480] so they're really reluctant to do that.
[01:55:42.480 --> 01:55:47.480] 75% of all the default judgments get overturned,
[01:55:47.480 --> 01:55:49.480] but it buys more time,
[01:55:49.480 --> 01:55:52.480] and it puts them in an uphill position,
[01:55:52.480 --> 01:55:55.480]  and if they hadn't moved for Rule 12,
[01:55:55.480 --> 01:55:59.480] they most certainly or almost certainly will,
[01:55:59.480 --> 01:56:04.480] and what you might want to do is talk to Chris
[01:56:04.480 --> 01:56:09.480]  and get our pre-Rule 12 discovery in hand,
[01:56:09.480 --> 01:56:12.480] so when they filed for the Rule 12,
[01:56:12.480 --> 01:56:18.480]  then you immediately filed the pre-Rule 12 discovery.
[01:56:18.480 --> 01:56:21.480] You want them to prove up all the fees,
[01:56:21.480 --> 01:56:25.480] and since they charge the fees, that should be easy enough,
[01:56:25.480 --> 01:56:31.480] and you want them to prove that they are in fact the holder of the note.
[01:56:31.480 --> 01:56:33.480]  Now, they've claimed they were,
[01:56:33.480 --> 01:56:37.480] and if in fact they are, proving it will be simple
[01:56:37.480 --> 01:56:40.480] because they'll already have the proof in their hand,
[01:56:40.480 --> 01:56:45.480] so it cannot be considered unduly onerous.
[01:56:45.480 --> 01:56:47.480] So this is what we ask them for,
[01:56:47.480 --> 01:56:53.480] and that has been pushing them straight into discovery.
[01:56:53.480 --> 01:56:56.480] So it almost makes the Rule 12 moved.
[01:56:56.480 --> 01:56:58.480] So make sure you do that.
[01:56:58.480 --> 01:57:00.480]  Okay.
[01:57:00.480 --> 01:57:04.480] I also wanted to say that, you know,
[01:57:04.480 --> 01:57:08.480] the judge said before the fall of the default judgment,
[01:57:08.480 --> 01:57:10.480] that we were in court,
[01:57:10.480 --> 01:57:13.480] and the attorney on the other side was there,
[01:57:13.480 --> 01:57:18.480] and we had told him that this was all the fraud
[01:57:18.480 --> 01:57:22.480] that was discovered through professional advice,
[01:57:22.480 --> 01:57:28.480] and the judge said that we were,
[01:57:28.480 --> 01:57:33.480] that all this is all past sexual limitations
[01:57:33.480 --> 01:57:39.480] and she's not going to give me the,
[01:57:39.480 --> 01:57:43.480] allow me to be able to stay in the house,
[01:57:43.480 --> 01:57:45.480] and then Danny wrote me a little note,
[01:57:45.480 --> 01:57:49.480] so there is no, there is no,
[01:57:49.480 --> 01:57:53.480]  there is no,
[01:57:53.480 --> 01:57:56.480]  sexual limitations on fraud,
[01:57:56.480 --> 01:57:58.480]  and so I told her that,
[01:57:58.480 --> 01:58:02.480]  and she denied that,
[01:58:02.480 --> 01:58:06.480] and so you need to go after the judge.
[01:58:06.480 --> 01:58:08.480] The judge has been bought and paid for,
[01:58:08.480 --> 01:58:10.480] make it expensive for her,
[01:58:10.480 --> 01:58:14.480] and we can talk about that off the air how to do that.
[01:58:14.480 --> 01:58:17.480] They want to get in the middle of the suit,
[01:58:17.480 --> 01:58:19.480] they want to deny you in your remedy,
[01:58:19.480 --> 01:58:21.480]  take them to task,
[01:58:21.480 --> 01:58:25.480] and we've got tools for taking them to task,
[01:58:25.480 --> 01:58:28.480] and with the way the industry is changing,
[01:58:28.480 --> 01:58:31.480] the judges are getting a lot more worried
[01:58:31.480 --> 01:58:32.480] about being taken to task.
[01:58:32.480 --> 01:58:34.480] Okay, this is Randy Kelsen,
[01:58:34.480 --> 01:58:35.480]  Deborah Stevens, Eddie Craig,
[01:58:35.480 --> 01:58:37.480]  Unibrow Radio.
[01:58:37.480 --> 01:58:38.480] We thank you all for listening.
