[04:40.960 --> 04:46.120]  with one of the state representatives in his office at 8 a.m. Monday morning.
[04:46.120 --> 04:51.280]  I am in the process of trying to get all of my white papers together as much as possible
[04:51.280 --> 04:57.320]  that I've written up and am currently writing for the past couple of days so I can get those
[04:57.320 --> 05:03.080]  in his hands if he is not willing to sit down and talk for any amount of time whatsoever.
[05:03.080 --> 05:06.800]  At least I can leave something with him in writing that explains the issues we're up
[05:06.800 --> 05:08.440]  against here.
[05:08.440 --> 05:12.480]  Now that being said, before we get started on any of this, Debra, you said you had some

[05:23.200 --> 05:31.400]  on House Bill 1937, this is the bill that would outlaw the TSA groping, that hearing,
[05:31.400 --> 05:36.440]  that public hearing is tomorrow folks and I spent about a half an hour on the phone
[05:36.440 --> 05:43.440]  today with the clerk of the criminal jurisprudence committee to try to figure out what exactly
[05:43.440 --> 05:49.760]  is going on and how can folks participate in this hearing.
[05:49.760 --> 05:51.880]  Excuse me.
[05:51.880 --> 05:55.400]  Sorry folks.
[05:55.400 --> 06:00.720]  Okay, and here is the deal on that issue.
[06:00.720 --> 06:04.760]  There's not a specific set time, kind of like I said before.
[06:04.760 --> 06:11.800]  What happens is that they go into committee after the adjournment of the House on the
[06:11.800 --> 06:12.800]  floor.
[06:12.800 --> 06:19.040]  Now, the House normally adjourns at about 10 a.m., between 10 and 11 a.m., and then
[06:19.040 --> 06:26.980]  all the various members of the House go into committee.
[06:26.980 --> 06:35.040]  At that point in time, usually they're in committee for several hours.
[06:35.040 --> 06:41.760]  Now, there's 35 bills, I'm sorry, Eddie, can you go ahead, I'm having some problems
[06:41.760 --> 06:45.560]  with my mic, I've got to fix before I continue.
[06:45.560 --> 06:46.560]  Sure.
[06:46.560 --> 06:52.320]  Okay, the representative I'm going to be talking to is Representative James White.
[06:52.320 --> 06:59.920]  I am going to see if there's a possibility of also being able to get an interview with
[06:59.920 --> 07:05.640]  David Simpson, who is the representative that has brought in the two TSA bills that Debra
[07:05.640 --> 07:08.400]  is trying to give the announcement about.
[07:08.400 --> 07:14.960]  So hopefully there will be something productive done on Wednesday as far as getting some information
[07:14.960 --> 07:17.520]  into the hands of these representatives.
[07:17.520 --> 07:23.680]  Now, since we're so close to the time when the legislature is winding down its acts of
[07:23.680 --> 07:33.200]  business such as they are, I don't fully expect to see anything done at this particular session.
[07:33.200 --> 07:39.640]  However, this does give us time to make these issues that I will be putting in their hands
[07:39.640 --> 07:48.800]  and those that are to yet be addressed out to a wider range of people.
[07:48.800 --> 07:56.320]  What we need to work on doing is getting individuals in their particular areas going directly to
[07:56.320 --> 08:04.460]  their state representatives and verbally beating the tar out of them to properly address these
[08:04.460 --> 08:07.320]  issues on behalf of the people.
[08:07.320 --> 08:12.200]  And when I say on behalf of the people, I'm not saying in such a way that sanctions the
[08:12.200 --> 08:14.360]  way the government's doing it now.
[08:14.360 --> 08:21.960]  I'm not talking about ways that give the government more power to act arbitrarily or in complete
[08:21.960 --> 08:29.920]  delusion of the people's rights and our perception of what they are, but to actually enforce them
[08:29.920 --> 08:37.440]  the way we understand them to be, which is unalienable, irrevocable and outside the powers
[08:37.440 --> 08:41.400]  of the legislature to do anything to.
[08:41.400 --> 08:47.600]  And this gives us time to pound this home to them or show them that your failure to
[08:47.600 --> 08:55.960]  do so will ensure that we work against you at every turn to get you in office or prevent
[08:55.960 --> 08:58.440]  you from getting in office.
[08:58.440 --> 09:00.640]  The choice is yours.
[09:00.640 --> 09:07.120]  You either work with us or we get rid of you until we find somebody that will.
[09:07.120 --> 09:12.040]  If we don't wake up and get this going, folks, we're lost, we're sunk.

[09:16.760 --> 09:24.000]  America is dead and gone, Texas is dead and gone, because we're just not going to survive

[09:40.280 --> 09:46.400]  Now let's take one of the things that I'm addressing that I finished, or at least I'm
[09:46.400 --> 09:50.400]  trying to finish working on the white paper on today.
[09:50.400 --> 09:55.120]  What I've done is I've written another white paper on the State Bar Act of Texas.
[09:55.120 --> 10:02.720]  I have outlined how and why it is completely unconstitutional pursuant to Texas Constitution.
[10:02.720 --> 10:11.320]  I've gone into great detail and linked up every constitutional article and statutory
[10:11.320 --> 10:18.520]  section or provision that shows very clearly what the limitations and or powers under this
[10:18.520 --> 10:28.640]  act actually are, how it allows the lawyers to basically monopolize every branch of government
[10:28.640 --> 10:33.080]  to ensure that they control government.
[10:33.080 --> 10:37.960]  That's exactly how the State Bar Act is being used.
[10:37.960 --> 10:45.760]  It's being used to create a private monopoly for the private personal gain and benefit
[10:45.760 --> 10:54.600]  of lawyers who are actually using the color and authority and power and resources of what
[10:54.600 --> 11:04.240]  the law says is a government office to ensure their own personal gain and enrichment.
[11:04.240 --> 11:09.160]  There's absolutely no question that's what's being done.
[11:09.160 --> 11:16.960]  Even the penal code statute that they use to punish the unauthorized practice of law
[11:16.960 --> 11:26.840]  or the holding oneself out to be a lawyer, which are 38.122 for the lawyer, 38.123 for
[11:26.840 --> 11:33.520]  the unauthorized practice of law, both of those are under the section of the penal code
[11:33.520 --> 11:43.760]  that is entitled Interference with Governmental Operation, Obstruction of Governmental Operation.
[11:43.760 --> 11:52.360]  Well, that right there completely insinuates that the practice of law is a government function.
[11:52.360 --> 12:02.200]  Therefore, the practice of law is something limited to what government does.
[12:02.200 --> 12:10.960]  By that term, if a lawyer or an attorney is practicing law, then they must be a judicial
[12:10.960 --> 12:18.160]  officer because the State Bar Act creates the State Bar as an administrative office
[12:18.160 --> 12:21.680]  of the judicial branch of government.
[12:21.680 --> 12:27.720]  I go through and I outline all of this down through here to make this point very, very
[12:27.720 --> 12:29.320]  clear.
[12:29.320 --> 12:31.360]  We even go to the State Bar website.
[12:31.360 --> 12:35.200]  Now, listen to what's listed on the State Bar website.
[12:35.200 --> 12:42.040]  The State Bar of Texas is an administrative agency of the state's judicial branch and
[12:42.040 --> 12:50.400]  is charged with providing educational programs for the legal profession and the public, administering
[12:50.400 --> 12:59.120]  the mandatory continuing education program for attorneys and managing the grievance procedure,
[12:59.120 --> 13:01.840]  more like covering up the grievance procedure.
[13:01.840 --> 13:12.280]  But anyway, the Bar is a unified State Bar composed of 62,500 members with total budgeted
[13:12.280 --> 13:15.960]  revenues, budgeted revenues.
[13:15.960 --> 13:18.920]  They are using taxpayer money.
[13:18.920 --> 13:30.120]  It is taken out of the state budget to the tune of $26 million per year.
[13:30.120 --> 13:38.440]  The State Bar of Texas had its beginnings in 1882 with the unification coming in 1927.
[13:38.440 --> 13:53.640]  The State Bar Act was adopted by the legislature in 1939, in 1939, 49%, 73 of 150 of the members
[13:53.640 --> 13:58.280]  of the House of Representatives were attorneys.
[13:58.280 --> 14:07.800]  The Senate, okay, the Senate was 87% attorneys.
[14:07.800 --> 14:15.360]  Now tell me how it was possible for these people to vote on an act that created a direct
[14:15.360 --> 14:23.360]  personal financial benefit to them when the Texas Constitution, Article 3, Section 22,
[14:23.360 --> 14:31.400]  specifically forbids any member of the legislature from voting on any act from which they would
[14:31.400 --> 14:34.840]  derive a personal benefit.
[14:34.840 --> 14:39.440]  And yet every one of these idiots voted.
[14:39.440 --> 14:43.240]  And of course, that gave us the State Bar Act.
[14:43.240 --> 14:57.320]  Now 27 out of 31 of Texas Senators in 1939 were lawyers, okay?
[14:57.320 --> 15:02.920]  Now let's finish up with what's on the State Bar website.
[15:02.920 --> 15:10.560]  Now the State Bar is governed by a board of directors that receive no compensation and
[15:10.560 --> 15:16.680]  are elected by the membership, meaning other members of the bar.
[15:16.680 --> 15:22.000]  That's who governs the bar, it is other members of the bar.
[15:22.000 --> 15:25.160]  Talk about the Fox Garden, the hen house.
[15:25.160 --> 15:33.920]  The bar includes committees, boards, sections, and divisions that are run by more than 260
[15:33.920 --> 15:45.200]  full-time employees and 4,500 volunteers, both lawyers and non-lawyers.
[15:45.200 --> 15:52.680]  And you wonder why complaining to the bar association about a judge or about a lawyer
[15:52.680 --> 15:57.240]  and to the Judicial Conduct Committee about a judge does no good?
[15:57.240 --> 16:04.440]  Well, there's a really good indicator right there because they're the ones that want
[16:04.440 --> 16:09.280]  the offices that they're required to sanction.
[16:09.280 --> 16:14.080]  And in order to get there, they have to be in the good graces of those judges that are
[16:14.080 --> 16:16.040]  already there.
[16:16.040 --> 16:21.040]  Are they going to be able to get promoted or put in the place of a judge unless one
[16:21.040 --> 16:22.720]  of two things happens?
[16:22.720 --> 16:25.600]  They're not going to, I can guarantee you.
[16:25.600 --> 16:30.760]  The other judges pressure those in charge of making the elections or appointment to
[16:30.760 --> 16:40.320]  ensure that these people make it, or some crony like the governor's office manages to
[16:40.320 --> 16:45.440]  get dirt on these individuals so that when they appoint them to these offices, they can
[16:45.440 --> 16:49.320]  control them because they have the dirt on them.

[19:46.280 --> 19:49.680]  public hearing committee hearing that is tomorrow.
[19:49.680 --> 19:56.120]  I spent about half an hour on the phone with the clerk of the Criminal Jurisprudence Committee
[19:56.120 --> 19:59.280]  and he told me basically this is the way it works and this is the way it works with all
[19:59.280 --> 20:05.680]  committees and it's kind of messed up for the public but this is the way it is.
[20:05.680 --> 20:12.560]  The legislators go into committee after their session adjourns on the floor.
[20:12.560 --> 20:20.000]  They start their day on the floor debating bills, hearing bills, these sorts of things.
[20:20.000 --> 20:23.720]  That starts first thing in the morning and then they typically adjourn around 10 or 11
[20:23.720 --> 20:28.360]  o'clock in the morning, sometimes 12, and then they go into committee for the rest of
[20:28.360 --> 20:29.360]  the afternoon.
[20:29.360 --> 20:38.040]  They typically hear dozens of bills at a time in one committee hearing.
[20:38.040 --> 20:44.440]  This is not just for House Bill 1937 tomorrow.
[20:44.440 --> 20:51.880]  This committee hearing tomorrow is going to be hearing a lot of bills, 35 are on the agenda.
[20:51.880 --> 20:56.800]  I asked the gentleman, I said, well, what is the schedule?
[20:56.800 --> 21:00.480]  And I said, and how long are these committee hearings, these public hearings?
[21:00.480 --> 21:05.600]  He said, generally they're about five hours or longer and he said, but we've been kind
[21:05.600 --> 21:09.320]  of blazing through the bills and so it could be as short as two hours.
[21:09.320 --> 21:10.320]  They just don't know.
[21:10.320 --> 21:11.320]  They can't say.
[21:11.320 --> 21:16.880]  And I asked them, well, what is the deal concerning the agenda?
[21:16.880 --> 21:18.600]  Like which bill is heard first?
[21:18.600 --> 21:22.680]  And he said, they can't tell because what they'll do is they'll wait until the author
[21:22.680 --> 21:28.400]  of the bill comes into the committee or they may be waiting on witnesses or people that
[21:28.400 --> 21:32.640]  they want to testify in support of the bill in these sorts of things.
[21:32.640 --> 21:39.280]  So basically the deal is this, there are other issues at hand here because right now on the
[21:39.280 --> 21:48.160]  floor of the House is the extremely controversial Real ID Act bill, I guess for the implementation
[21:48.160 --> 21:50.920]  of the Real ID Act here in Texas.
[21:50.920 --> 21:55.520]  And they were supposed to be debating that on the floor of the House today and they expected
[21:55.520 --> 22:00.040]  that they were going to be on the floor all day long.
[22:00.040 --> 22:07.400]  Now for some reason they decided to put off the debate until tomorrow, maybe even Wednesday.
[22:07.400 --> 22:09.440]  This is what I'm being told.
[22:09.440 --> 22:15.960]  And so if they do that tomorrow, then the committee hearing for House Bill 1937 is going
[22:15.960 --> 22:17.720]  to be put off as well.
[22:17.720 --> 22:23.200]  And so what I'm going to do is I'm going to call them tomorrow around 10 in the morning
[22:23.200 --> 22:29.840]  to try to find out what the deal is from this clerk of the Criminal Jurisprudence Committee.
[22:29.840 --> 22:38.120]  He says that he expects that they will be out of the floor and into committee by approximately
[22:38.120 --> 22:40.200]  12 o'clock noon.
[22:40.200 --> 22:45.280]  He thinks that they're going to put off the debate again concerning the Real ID Act.
[22:45.280 --> 22:49.120]  So I'm going to plan on just going down there.
[22:49.120 --> 22:53.960]  Now concerning giving affidavits or submitting any kind of paperwork, like say you don't
[22:53.960 --> 23:00.720]  want to talk or even if you do want to talk, you cannot bring in affidavits from other
[23:00.720 --> 23:02.320]  people.
[23:02.320 --> 23:04.040]  That is not allowed.
[23:04.040 --> 23:10.200]  And the way the committee hearing works is that you have to fill out their form, their
[23:10.200 --> 23:14.800]  affidavit form where you state whether you're for or against the bill and you can write
[23:14.800 --> 23:17.080]  down a reason why and then you put your name.
[23:17.080 --> 23:18.080]  You have to use their form.
[23:18.080 --> 23:19.640]  You can't bring in your own letter.
[23:19.640 --> 23:24.120]  If you want to bring in your own letter or affidavit, you can and it will be submitted
[23:24.120 --> 23:27.800]  to the committee members but it won't go into the record.
[23:27.800 --> 23:32.760]  If you want what you have to say to go into the record, you have to use one of their forms
[23:32.760 --> 23:36.000]  and submit it to the clerk of the committee.
[23:36.000 --> 23:44.160]  Now what this gentleman told me was that even if the bill has already been discussed in
[23:44.160 --> 23:50.920]  the hearing and you show up late, you can still fill out one of their forms stating
[23:50.920 --> 23:55.760]  which side of the bill you're on for or against and any comments and that that will go into
[23:55.760 --> 24:00.920]  the record when they are, when they go to take a vote in the committee hearing.
[24:00.920 --> 24:04.540]  They will go back and review all of the affidavits that were submitted.
[24:04.540 --> 24:09.840]  And so what you, and so but the thing is as far as submitting the affidavits, like I can't
[24:09.840 --> 24:15.000]  just go down there at 8 o'clock in the morning or you know and drop it off and then everything

[25:44.160 --> 25:50.360]  extremely controversial bill that's being debated on the floor because the legislators
[25:50.360 --> 25:55.960]  can't be released to go into committee for their scheduled public hearings.
[25:55.960 --> 26:02.240]  Okay, so he apologized profusely but he said he's sorry, that's just the way it is and
[26:02.240 --> 26:08.560]  this is the way all committees work at the legislature, there's nothing that can be done
[26:08.560 --> 26:09.560]  about it.
[26:09.560 --> 26:14.440]  And there's specific reasons for that, it's to prevent fraud and to make sure that proper
[26:14.440 --> 26:21.000]  points of order are maintained in the committee hearing so that an opponent of a bill can't
[26:21.000 --> 26:26.040]  just get the whole thing trashed on some parliamentary point of order.
[26:26.040 --> 26:31.380]  And so they're trying to do everything that they can to preserve the proper process of
[26:31.380 --> 26:36.040]  moving these bills through committee and it just happens to have the unfortunate consequence
[26:36.040 --> 26:40.960]  of being extremely cumbersome on the public.
[26:40.960 --> 26:44.440]  So that's all I can basically say about that.
[26:44.440 --> 26:49.960]  I'm planning on calling them in the morning and probably getting down there around 11
[26:49.960 --> 26:56.880]  o'clock so I can at least wait around to submit my affidavit, you know, for whenever the committee
[26:56.880 --> 26:59.240]  hearing actually begins.
[26:59.240 --> 27:06.320]  Now, you know, it's going to depend on how long the House is in session before they adjourn
[27:06.320 --> 27:11.400]  to let everyone go to their committees because, you know, I got to get back to produce shows

[33:26.320 --> 33:31.280]  He was also a client on the complaint, brought it up.
[33:31.280 --> 33:38.400]  And the judge basically could care less, overruled it all, took it to county court.
[33:38.400 --> 33:45.600]  The judge there, who is now the Collin County District Attorney, and there's some ethics
[33:45.600 --> 33:53.960]  investigations going on on him, refused to rule on it.
[33:53.960 --> 34:02.440]  So took it to Court of Appeals, and they found a loophole to avoid ruling on it, that as
[34:02.440 --> 34:12.320]  the fine was under $100, they didn't have jurisdiction, even though I was fined $150.
[34:12.320 --> 34:20.040]  So take it to Court of Criminal Appeals and get a little postcard back the other day saying
[34:20.040 --> 34:26.440]  that your petition for discretionary review has been refused without comment.
[34:26.440 --> 34:33.120]  Called the clerk, and was told the same thing, there's no comment, it was just refused.
[34:33.120 --> 34:41.840]  So I've got until the day after tomorrow, the 24th, to get a motion for re-hearing in,
[34:41.840 --> 34:44.840]  and that's where we're trying to go with it.
[34:44.840 --> 34:56.760]  I think I'm bringing up enough good stuff that hopefully it will move them to grant
[34:56.760 --> 34:58.400]  the re-hearing on it.
[34:58.400 --> 35:01.520]  They have addressed this issue before.
[35:01.520 --> 35:07.080]  There was another case a few years back that brought up exactly the same points, but they
[35:07.080 --> 35:13.240]  avoided ruling on it, on his points directly, because he hadn't brought them up in the lower
[35:13.240 --> 35:18.240]  court, the first time he was bringing them up, he's on appeal, so sorry, you violate
[35:18.240 --> 35:24.280]  the rules, we don't have to rule on that, your conviction is affirmed.
[35:24.280 --> 35:29.000]  Yeah, but the problem with that argument on the part of the court is that if they don't
[35:29.000 --> 35:35.720]  have the oath, they lack jurisdiction, and jurisdiction can be challenged at any point
[35:35.720 --> 35:41.000]  in the process, even years after a conviction has been had.
[35:41.000 --> 35:47.160]  So this is just complete judicial nonsense they're pulling and saying, well, you didn't
[35:47.160 --> 35:52.400]  bring it up before this, so since you only did it on appeal, we're going to ignore the
[35:52.400 --> 35:53.400]  issue.
[35:53.400 --> 35:54.400]  Right.
[35:54.400 --> 35:58.720]  Well, fortunately, though, this has been brought up from day one, all the way through the municipal
[35:58.720 --> 36:08.040]  courts, the motions have been almost word for word, so they can't use that excuse, and
[36:08.040 --> 36:15.960]  they can't use an excuse of it's frivolous because they took an appeal on it in the past.
[36:15.960 --> 36:25.680]  And they have yet to rule on the actual facts of that regarding oath of office for anyone
[36:25.680 --> 36:33.800]  other than judges, and also the fact that, well, there's been other cases that have ruled
[36:33.800 --> 36:42.040]  in the past, which there's been cases on both sides of it, but they're not following precedent
[36:42.040 --> 36:45.720]  and they're not following the law, because the Constitution says you've got to have an
[36:45.720 --> 36:46.720]  oath of office.
[36:46.720 --> 36:51.800]  Even the local government code says you've got to have an oath of office, and there's
[36:51.800 --> 36:58.680]  also plenty of cases that say you can't be a complainant and prosecutor on the same case,
[36:58.680 --> 37:09.080]  but yet they ignore them all, and if I'm just trying to find if there's anything else that
[37:09.080 --> 37:15.240]  I'm missing here that I can throw in there, because I want to have, you know, two kitchen
[37:15.240 --> 37:19.600]  sinks on this one, that there's no way that they're going to be able to sidestep around
[37:19.600 --> 37:20.600]  anything.
[37:20.600 --> 37:26.640]  Well, do you also have the motion from the seminar material for the motion to show authority
[37:26.640 --> 37:29.560]  for the prosecuting attorney when it's a city attorney?
[37:29.560 --> 37:31.840]  Oh, I'm sorry.

[37:33.880 --> 37:40.360]  Well, in my traffic seminar material, I have a motion, a motion to show authority, and

[37:46.040 --> 37:53.840]  both statute and state constitution as to exactly why a city attorney cannot in any
[37:53.840 --> 37:58.400]  way, shape, or form prosecute in the name of the state.
[37:58.400 --> 38:05.760]  The constitution and the law specifically forbid it, and they forbid it because a city
[38:05.760 --> 38:11.160]  attorney has no authority to sign a charging instrument, among other things.
[38:11.160 --> 38:16.160]  Okay, no, I do not have that.
[38:16.160 --> 38:23.000]  Someone has also made the argument that the district attorney is allowed to delegate that
[38:23.000 --> 38:27.040]  authority to the city attorney to prosecute in the name of the state.
[38:27.040 --> 38:28.800]  That's bupkis.
[38:28.800 --> 38:31.440]  That does not exist in constitution.
[38:31.440 --> 38:40.360]  The constitution specifically limits the attorney for the state to those that are in the district
