[06:25.680 --> 06:32.580] What I'm going to try to do is to get these gentlemen to co-sponsor the bill that I am writing
[06:32.580 --> 06:40.080] that will institute a citizens grand jury in Texas for the express purpose of looking
[06:40.080 --> 06:43.780] into criminal complaints against public servants.
[06:43.780 --> 06:47.780] There will be no governmental intervention in this grand jury.
[06:47.780 --> 06:55.180] No governmental employee or attorney shall be allowed to participate in this grand jury.
[06:55.180 --> 07:01.380] This shall be strictly citizens only that are not acting in a governmental
[07:01.380 --> 07:04.680] or judicial capacity of any kind.
[07:04.680 --> 07:10.380] They will be free to evaluate both the law and the actors and determine whether
[07:10.380 --> 07:15.080] or not that public servant overstepped the bounds of their authority
[07:15.080 --> 07:23.380] and actually created themselves either a civil tort, a criminal act, or both.
[07:23.380 --> 07:28.580] This is one of the only ways I see that we the people are going to be able to get control
[07:28.580 --> 07:33.680] of our government servants and put them back in the place they're supposed to be,
[07:33.680 --> 07:38.380] out of our lives and watching over our rights.
[07:38.380 --> 07:42.680] And when they fail to do that, we will finally have a place to go to
[07:42.680 --> 07:45.880] where we can have something done about it.
[07:45.880 --> 07:47.980] That's the goal.

[08:14.080 --> 08:19.580] by the public servant before trial, during trial, and after trial.
[08:19.580 --> 08:26.780] Normally, we are most interested in what's occurring before and during trial.
[08:26.780 --> 08:32.080] Because if there's an after trial and things were done properly, you do one,
[08:32.080 --> 08:35.480] things are over, there's nowhere to go from there.
[08:35.480 --> 08:38.480] But the way that we have to win is the fact
[08:38.480 --> 08:42.280] that they don't do the things they're supposed to do.
[08:42.280 --> 08:46.780] The other part is when we actually have to go to the merit of a particular action
[08:46.780 --> 08:52.380] and deal with the specific event or alleged defense itself.
[08:52.380 --> 08:57.480] These are the things that we're going over in our Saturday seminars, folks.
[08:57.480 --> 09:02.180] So if you want to know whether or not things are being done properly,
[09:02.180 --> 09:06.180] how to recognize them, how to ensure that you're not being railroaded
[09:06.180 --> 09:10.980] in your own particular case and so on and so forth, you really need to consider coming
[09:10.980 --> 09:13.680] down to these seminars on Saturdays.
[09:13.680 --> 09:18.380] Now, there is a possibility we're looking at to see if there may be a chance

[12:44.580 --> 12:48.080] no matter what unless there's some kind of search warrant or whatever.
[12:48.080 --> 12:53.480] Well, it has just been scheduled for public hearing on March 22nd.
[12:53.480 --> 12:55.480] That is this coming Tuesday.

[15:33.680 --> 15:40.280] that the courts will not do their job of upholding the people's rights
[15:40.280 --> 15:42.780] in relation to the Constitution.
[15:42.780 --> 15:48.880] They always try to find a way to legitimize the actions of government even
[15:48.880 --> 15:56.280] when they completely contrast or contradict prohibitions made within our founding documents.
[15:56.280 --> 16:03.980] Now, I understand that the view is that the Constitution is no more and so on and so forth.
[16:03.980 --> 16:09.980] And while that may be how it's being practiced, that's not what we the people created.
[16:09.980 --> 16:16.380] And just like everything else, we the people are the only ones that are going to be able
[16:16.380 --> 16:19.280] to fix that and do something about it.
[16:19.280 --> 16:22.180] Here's our place and time to start.
[16:22.180 --> 16:24.480] We need to go after these judges.
[16:24.480 --> 16:25.580] We need a way to do it.
[16:25.580 --> 16:30.380] That is where this people's grand jury would work so well in that regard.

[16:35.380 --> 16:38.580] He couldn't declare immunity for a police officer.
[16:38.580 --> 16:45.980] He couldn't declare immunity for anybody just because he wanted to protect what they did
[16:45.980 --> 16:48.980] and save his own behind in the process.

[21:22.780 --> 21:28.180] If an actor's actions result in harm to another, then the one harmed has the right to be made
[21:28.180 --> 21:34.180] whole at least to whatever extent possible and to seek remuneration, and if the act was
[21:34.180 --> 21:39.380] done with malice or criminal negligence rather than being purely accidental in nature for
[21:39.380 --> 21:46.180] actual punishment of whoever caused the unjustified harm, using the collective punitive powers
[21:46.180 --> 21:51.580] of society that were put into place to protect such rights and property.
[21:51.580 --> 21:54.580] Justifiable harm, however, is another matter entirely.
[21:54.580 --> 21:59.180] A victim of an attempted burglary or robbery has every right to defend themselves and their
[21:59.180 --> 22:04.180] property from that act, including the right to use deadly force, regardless of who the
[22:04.180 --> 22:09.180] perpetrator is, a common thief, a murderer, or a government employee.
[22:09.180 --> 22:14.180] A victim of an assault has the absolute right to defend themselves from their assault using
[22:14.180 --> 22:20.380] any means necessary to stop the assault, including using deadly force against the assailant if
[22:20.380 --> 22:26.680] it is the only way to prevent further life-threatening injury or death, and again, regardless of
[22:26.680 --> 22:30.080] actually who the perpetrator is or represents.
[22:30.080 --> 22:35.380] A government office license or badge carries no more authority to commit crimes and harm
[22:35.380 --> 22:41.180] people than the tools or weapons used by the common criminals in our society, yet it has
[22:41.180 --> 22:46.580] become commonly accepted in modern America that such practices are normal and that it
[22:46.580 --> 22:52.180] is somehow wrong to resist such unlawful and illegal actions simply because they are being
[22:52.180 --> 22:57.780] perpetrated under the color of some unaccountable governmental authority by a governmental agent.
[22:57.780 --> 23:02.180] While I don't condone unnecessary and arbitrary acts of violence against government employees
[23:02.180 --> 23:07.980] by anyone, I also do not condone acts of violence or unlawful interference upon the people by
[23:07.980 --> 23:13.380] the agents of government and feel that we all have the right to resist such acts or
[23:13.380 --> 23:18.880] treatment by any necessary means the situation demands.
[23:18.880 --> 23:21.580] Now, we go on to another paragraph here.
[23:21.580 --> 23:22.980] This one is called the state of things.
[23:22.980 --> 23:24.980] This is fairly short.
[23:24.980 --> 23:29.180] It is more or less common knowledge that the Constitution for the United States of America
[23:29.180 --> 23:33.980] was created to specifically limit the power and authority of the federal government.
[23:33.980 --> 23:37.980] By declaring those limits, it was intended that the federal government be able to do
[23:37.980 --> 23:42.580] only those things that the people saw fit to granted authority to do.
[23:42.580 --> 23:48.780] Yet, when it comes to the various state constitutions, the courts of the states have taken a directly
[23:48.780 --> 23:53.380] inverse approach to the reasons the Constitution is created in the first place.
[23:53.380 --> 23:58.780] In Texas, for example, the courts interpreted the Texas Constitution to mean that anything
[23:58.780 --> 24:03.780] not specifically forbidden to the powers of government granted within its provisions and
[24:03.780 --> 24:07.780] language is somehow fair game for legislation.
[24:07.780 --> 24:10.380] Are you frigging kidding me?
[24:10.380 --> 24:15.380] Let's try once again to use some actual logic in what is being done here.
[24:15.380 --> 24:20.580] We should also understand that a Constitution's purpose is to define the limited power and
[24:20.580 --> 24:23.580] authority of the government that is to act under it.
[24:23.580 --> 24:29.180] We should understand that a Constitution does not grant or create a single one of the people's
[24:29.180 --> 24:31.580] individual unalienable rights.
[24:31.580 --> 24:37.180] Those rights existed long before there was ever a Constitution or a state to speak of.
[24:37.180 --> 24:42.980] Now, if the purpose of a Constitution is to limit government and it does not limit or
[24:42.980 --> 24:48.780] create the rights of the people, then how can it be interpreted in this backwards manner?
[24:48.780 --> 24:52.580] Think about the logical result of the court's interpretation.
[24:52.580 --> 24:58.180] By stating that the Constitution places only specific limits and hindrances on the power
[24:58.180 --> 25:03.380] and authority of government, the courts have converted the Texas Constitution into a document
[25:03.380 --> 25:09.580] that, instead of limiting governmental power, limits the protections of the people and their
[25:09.580 --> 25:13.780] rights from governmental power.
[25:13.780 --> 25:18.380] Now, that is part of what's going to be in the new seminar book at the introduction area.
[25:18.380 --> 25:25.780] So, we explain where this traffic or the transportation code originated back in 1917, what its purposes
[25:25.780 --> 25:28.380] were, and so on and so forth.
[25:28.380 --> 25:35.380] This is basically the chapter laying the groundwork for all of the detail to come in what the transportation
[25:35.380 --> 25:42.780] code is and isn't and how it relates to us or doesn't relate to us as sovereign people.
[25:42.780 --> 25:49.980] Now, that's another thing that they're trying to do in this country right now.
[25:49.980 --> 25:52.180] We need to be aware of that.
[25:52.180 --> 25:59.980] They are trying to take what was once a badge of honor, to be a patriot, to be a constitutionalist,
[25:59.980 --> 26:08.380] to be someone that decried the acts of governmental authorities when they stepped outside of the
[26:08.380 --> 26:11.980] limitations that we placed upon them.
[26:11.980 --> 26:16.780] They are taking anyone that would stand up against this, that would declare themselves
[26:16.780 --> 26:25.480] against this, and taking them from a status of honor to one of criminality.
[26:25.480 --> 26:30.100] If you call yourself a patriot these days, you're a criminal, according to the Department
[26:30.100 --> 26:31.900] of Homeland Security.
[26:31.900 --> 26:33.740] You're a terrorist.
[26:33.740 --> 26:40.180] If you do this, that, or the other by declaring that you're a sovereign citizen or that the
[26:40.180 --> 26:44.940] government laws that they're dealing with in these statutes doesn't have any authority
[26:44.940 --> 26:49.860] over you or your property, then you're declared a terrorist.
[26:49.860 --> 26:56.340] If you try to file suit to protect yourself and to get restitution for the crimes perpetrated
[26:56.340 --> 27:04.940] against you by these public employees, you're declared a vexatious litigant, a paper terrorist.
[27:04.940 --> 27:13.060] In that regard, they seek to completely limit the people's ability to get reconciliation
[27:13.060 --> 27:17.340] for these acts upon them by their servants.
[27:17.340 --> 27:20.740] That's what these people are, whether they want to admit it or not.
[27:20.740 --> 27:28.500] They're servants, but they have completely tried to invert our system of government and
[27:28.500 --> 27:35.900] make themselves the power and we the subservience of that power.
[27:35.900 --> 27:40.020] Folks, we've got to wake up and do something about that.

[35:46.100 --> 35:50.780] Now, what you need to do is write up an affidavit of appearance.

[35:54.780 --> 35:59.300] Then you need to be looking online to get some examples of an affidavit.
[35:59.300 --> 36:04.980] The one thing about an affidavit you must understand, an affidavit is a dangerous instrument
[36:04.980 --> 36:09.060] to an individual that does not use it properly.
[36:09.060 --> 36:12.380] An affidavit must state specific facts.
[36:12.380 --> 36:17.660] It does not ask questions beyond the statement of those specific facts, if it must ask a
[36:17.660 --> 36:24.540] question at all, and it does not make suppositions, presumptions, or conclusions.
[36:24.540 --> 36:29.180] It states only specific facts.
[36:29.180 --> 36:33.820] In this affidavit, you're going to certify under penalty of perjury that you are of sound
[36:33.820 --> 36:38.180] mind and that you make the following statements of your own free will without coercion or
[36:38.180 --> 36:40.220] duress.
[36:40.220 --> 36:46.460] And then you're going to state, I, whatever your full name is, did appear in this particular
[36:46.460 --> 36:52.900] location on this particular date at this particular time in response to citation blah, blah, blah,
[36:52.900 --> 36:58.020] and the notice to appear signed and sworn or signed by me on the day of whenever the
[36:58.020 --> 37:00.940] ticket was issued.
[37:00.940 --> 37:07.860] And then number two, I hereby certify I am in full compliance with the notice to appear
[37:07.860 --> 37:12.620] as required on the citation number such and such.
[37:12.620 --> 37:16.340] Then you go get it notarized.
[37:16.340 --> 37:24.220] You get three or four copies of it made, mail two copies, certified mail, return receipt
[37:24.220 --> 37:33.020] requested to the clerk of the court, and have one of those with a yellow sticky or something
[37:33.020 --> 37:40.780] on it that says please provide to prosecutor since you don't yet know who that's going
[37:40.780 --> 37:44.260] to be.
[37:44.260 --> 37:54.060] That will take care of your initial appearance on the citation.
[37:54.060 --> 37:58.820] Now if they attempt to issue a warrant for your arrest after you've already appeared
[37:58.820 --> 38:04.020] in compliance with that, that's going to create a whole new problem for them if you go after

[38:06.020 --> 38:17.180] So once I mail that in, say tomorrow morning, then I'm good until they send me back my information
[38:17.180 --> 38:20.740] for my pretrial date if they do that.

[38:21.740 --> 38:26.020] The other problem is you need to make sure that if you're notified of a pretrial date
[38:26.020 --> 38:29.940] that it is proper.
[38:29.940 --> 38:35.580] Summons to appear in court for pretrial must comport itself and comply with the provisions
[38:35.580 --> 38:45.340] of Chapter 23 of the Code of Criminal Procedure dealing with capious warrants and summonses.
[38:45.340 --> 38:48.740] They almost never do.
[38:48.740 --> 38:54.100] The law says that a summons must look just like the capious and have exactly the same
[38:54.100 --> 39:01.020] information except that the summons is made out to the individual being summoned not to
[39:01.020 --> 39:04.740] a law enforcement officer to arrest them.
[39:04.740 --> 39:07.460] Otherwise they should be identical.
[39:07.460 --> 39:09.500] Okay.
[39:09.500 --> 39:15.060] So check Chapter 23 and it will spell out for you exactly what the criteria of a capious
[39:15.060 --> 39:19.660] warrant is and then you'll know what the summons is supposed to look like.
[39:19.660 --> 39:25.180] Then when you get the summons and it doesn't conform to what the law requires, you will
[39:25.180 --> 39:28.020] file a motion to quash the summons.
[39:28.020 --> 39:33.220] And where do I get the motion to, where do I find that?
[39:33.220 --> 39:35.980] Well if you don't have the seminar material, you're going to have to learn how to write
[39:35.980 --> 39:36.980] one on your own.

[01:20:17.980 --> 01:20:19.980] There was a little stress at all.
[01:20:19.980 --> 01:20:24.980] I wasn't badly stressed, but being in that position is bad.
[01:20:24.980 --> 01:20:31.980] So this trooper talks for about five minutes, sort of giving me a feel for, I guess, getting a feel for me or whatever.
[01:20:31.980 --> 01:20:38.980] And then he decides to act, and he says, this is your final warning before I arrest you for failure with ID.
[01:20:38.980 --> 01:20:43.980] And he said that if ID, that I could go after stating that I was only observing previously.
[01:20:43.980 --> 01:20:48.980] And so I thought for a few seconds about it, whether it was worth taking the risk of being arrested.
[01:20:48.980 --> 01:20:51.980] And I decided this time wasn't the time.
[01:20:51.980 --> 01:20:56.980] So I showed him my driver's license and stated that I was only observing, and then I left.
[01:20:56.980 --> 01:21:04.980] And my question, well, I went and researched afterwards and looked up the law for failure to show ID.
[01:21:04.980 --> 01:21:06.980] The only thing I found was something in 2004.
[01:21:06.980 --> 01:21:12.980] I don't know if it's changed at them, but that law said that you had to be arrested before you had to show ID.
[01:21:12.980 --> 01:21:13.980] That's correct.
[01:21:13.980 --> 01:21:22.980] Code 28.02, penal code, failure to identify, only applies if you have already been lawfully arrested.
[01:21:22.980 --> 01:21:30.980] Well, it sounds like this cop was trying to play that card by saying that he didn't like this caller's attitude,
[01:21:30.980 --> 01:21:35.980] that he didn't like Lynn's attitude and felt threatened by him.
[01:21:35.980 --> 01:21:45.980] But he was considering in his mind that he was placing Lynn under arrest for feeling threatened and using that as an excuse to demand ID.
[01:21:45.980 --> 01:21:47.980] Well, this was actually a different officer.
[01:21:47.980 --> 01:21:51.980] This was a different officer that was making this address to him than the one that actually told him he felt threatened.
[01:21:51.980 --> 01:21:52.980] Okay.
[01:21:52.980 --> 01:21:55.980] Well, then they can't use that as an excuse then.
[01:21:55.980 --> 01:22:00.980] So what I would do first and foremost, Lynn, is I would file criminal charges
[01:22:00.980 --> 01:22:05.980] and complaints against both the diminutive little officer that started the whole thing
[01:22:05.980 --> 01:22:17.980] and both officers that came up and forced you through this entire scenario, the first one and all of them for unlawful detainer.
[01:22:17.980 --> 01:22:24.980] Now, since I don't know any of their names, I saw their name tags, but I don't remember what their names were because of the situation.
[01:22:24.980 --> 01:22:27.980] How do I find out who to file them against?
[01:22:27.980 --> 01:22:31.980] Well, you have a camera, right?
[01:22:31.980 --> 01:22:32.980] Well, the camera wasn't rolling.
[01:22:32.980 --> 01:22:38.980] I had already handed it over to somebody else, and they didn't have it rolling when...
[01:22:38.980 --> 01:22:43.980] Well, now, I thought you said you were recording when the DPS officers were talking to this girl at the fence.

[01:28:31.980 --> 01:28:33.980] He got his bar card in the early 90s.
[01:28:33.980 --> 01:28:37.980] He was in medical malpractice, and he got kind of fed up with it.
[01:28:37.980 --> 01:28:44.980] By the mid-90s, he had a head accident surfing in Mexico and quit practice and went on disability.
[01:28:44.980 --> 01:28:51.980] And around 2001, my mom had a stroke, and she became disabled.
[01:28:51.980 --> 01:28:59.980] And then fast forward to the late, well, about three or four years ago, my grandparents were getting pretty ill,
[01:28:59.980 --> 01:29:07.980] and my grandfather had put his home into a trust where my mom had access to the house as long as she was alive,
[01:29:07.980 --> 01:29:13.980] but she didn't have any ownership, and he made my uncle trustee, even with a head injury.
[01:29:13.980 --> 01:29:21.980] So soon after that, well, not soon after that, but then a couple years ago,
[01:29:21.980 --> 01:29:28.980] we got some information that kind of led us to believe that the head injury wasn't all it was cracked up to be
[01:29:28.980 --> 01:29:32.980] and that perhaps he just wanted an early retirement.

[01:33:40.980 --> 01:33:43.980] My grandparents had put the house in trust.
[01:33:43.980 --> 01:33:49.980] She was going to have access to the house upon their death if she so chose.
[01:33:49.980 --> 01:33:51.980] And she did that.
[01:33:51.980 --> 01:33:55.980] My grandmother passed away in 2010.
[01:33:55.980 --> 01:34:01.980] And my uncle, despite his brain injury, and one of my aunts,
[01:34:01.980 --> 01:34:04.980] who has since passed away, were appointed trustees
[01:34:04.980 --> 01:34:08.980] in the trust document that my grandfather drew up.
[01:34:08.980 --> 01:34:14.980] So we have, like I said, we've since had reason to believe
[01:34:14.980 --> 01:34:18.980] that the brain injury wasn't all it was supposed to be,
[01:34:18.980 --> 01:34:21.980] and that hasn't made my mom feel very good,
[01:34:21.980 --> 01:34:24.980] having suffered a real brain injury herself, as you can imagine.
[01:34:24.980 --> 01:34:29.980] And so anyhow, there's been sort of a falling out between the two,
[01:34:29.980 --> 01:34:34.980] and my uncle has, despite this brain injury,
[01:34:34.980 --> 01:34:38.980] has kept his attorney-ness about him.
[01:34:38.980 --> 01:34:42.980] And I'd like to read you one little thing he wrote in a letter,
[01:34:42.980 --> 01:34:47.980] which is that, and before I read this,
[01:34:47.980 --> 01:34:49.980] I want to tell you that when my grandmother passed away,
[01:34:49.980 --> 01:34:53.980] there was some money disbursed in my mom's portion.
[01:34:53.980 --> 01:34:55.980] This relates to my mom's portion.
[01:34:55.980 --> 01:34:57.980] So he wrote, under Article 7 of the trust,
[01:34:57.980 --> 01:34:59.980] and under statutory powers granted to me,
[01:34:59.980 --> 01:35:02.980] the trust will require that $10,000 of Carol's cash distribution
[01:35:02.980 --> 01:35:08.980] will be withheld as a security deposit.
[01:35:08.980 --> 01:35:13.980] Now, you know, it's occurred to us that one of the angles we could go with
[01:35:13.980 --> 01:35:16.980] is that, hey, you know, if you've got a brain injury,
[01:35:16.980 --> 01:35:20.980] what are you doing in this position as trustee in the first place?
[01:35:20.980 --> 01:35:26.980] I mean, if you can't practice law, how can you be a trustee?
[01:35:26.980 --> 01:35:29.980] But the other thing that just occurred to me that made me want to call you
[01:35:29.980 --> 01:35:31.980] was, you know, Randy's always talking about bar grievances.

[01:50:18.980 --> 01:50:26.980] which is that the state has the right to regulate the wearing of arms with an eye towards the prevention of crime.
[01:50:26.980 --> 01:50:36.980] Okay. And open carry, I know, is a legal layer. But what is the exact effect of that phrase?
[01:50:36.980 --> 01:50:48.980] Well, that phrase is to place that particular right or rights under the regulatory auspices of statutory law that the legislature creates.

[01:50:51.980 --> 01:50:55.980] That all depends on what the law is the legislature passes.
[01:50:55.980 --> 01:51:02.980] If it's subject to the police power, then most certainly they can pass a law that makes it illegal.

[01:54:27.980 --> 01:54:39.980] which basically you just get this form, write no guilty on it, send it in, and if the officer doesn't respond, then it's dismissed.
[01:54:39.980 --> 01:54:48.980] If he does respond, you automatically get, well, not automatically, you're entitled to a trial de novo if you request it.

[01:56:49.980 --> 01:56:58.980] And every time they demanded that I show them proof of ownership, I produced a certified copy of the certificate of title.
[01:56:58.980 --> 01:57:07.980] I never, ever let them get their hands on the certificate of title and a certified copy of that notarized bill of sale.
[01:57:07.980 --> 01:57:08.980] Okay.
[01:57:08.980 --> 01:57:09.980] And that's what I used.
[01:57:09.980 --> 01:57:14.980] So you never got a title from the state then?
[01:57:14.980 --> 01:57:16.980] No.
[01:57:16.980 --> 01:57:23.980] I used the title that was originally issued to the person whom I bought the automobile from.

[01:57:24.980 --> 01:57:28.980] Because as I was sitting here looking at my title and thinking about what you said in the past,
[01:57:28.980 --> 01:57:34.980] I was wondering why couldn't I use the bill of sale as a proof of ownership?

[01:57:35.980 --> 01:57:36.980] And that's what I did.
[01:57:36.980 --> 01:57:44.980] But I noticed another thing on the title where there's a box where it says use class
[01:57:44.980 --> 01:57:48.980] and it's got the abbreviation for passenger and there we go back.

[01:57:49.980 --> 01:57:51.980] And you need to know what the legal definition of that is.
[01:57:51.980 --> 01:57:54.980] It is not a passenger motor vehicle.
[01:57:54.980 --> 01:57:55.980] Exactly.
[01:57:55.980 --> 01:58:00.980] A passenger is someone that pays to be transported from point A to point B.

[01:58:02.980 --> 01:58:08.980] I was wondering have you ever seen where they change that to like use of class private?

[01:58:09.980 --> 01:58:14.980] That's exactly why I say if you do the registration thing then you're granting them an authority over your property
[01:58:14.980 --> 01:58:17.980] and converting it to a state owned vehicle.

[01:58:18.980 --> 01:58:23.980] Because the use class specifically relates to commerce not to private use.
[01:58:23.980 --> 01:58:29.980] And if I was you I'd start corresponding with my state DMV on exactly those issues.
