[05:15.160 --> 05:19.720]  So these bills have been referred to their respective committees at this point, we should
[05:19.720 --> 05:25.660]  be expecting any day now that these bills will be scheduled for public hearing and folks
[05:25.660 --> 05:31.840]  when they do get scheduled for public committee hearing, we need to go out there in droves

[06:25.860 --> 06:32.640]  private communications with each other because they didn't want their communications to
[06:32.640 --> 06:36.120]  be splashed on the headline of the Austin American Statesman, that was a quote from
[06:36.120 --> 06:40.160]  one of these council members, so I'll let him explain more about that on Thursday but
[06:40.160 --> 06:46.000]  this is becoming national news here, Ken Martin's lawsuit, so he will be our guest this Thursday
[06:46.000 --> 06:50.280]  night and that's all the announcements I have for tonight, Eddie, so what have you got for
[06:50.280 --> 06:51.280]  us tonight on traffic?
[06:51.280 --> 06:54.480]  Well that's great, I like those kinds of announcements.

[07:04.200 --> 07:08.760]  Now as far as what she was saying about this bill being referred to the Senate Judicial
[07:08.760 --> 07:13.120]  Committee, we need to watch this committee folks, this is the same committee that has
[07:13.120 --> 07:16.200]  managed- It's the Criminal Jurisprudence Committee.
[07:16.200 --> 07:23.400]  Well that's the one I'm referring to, they're the ones that are responsible for the amendments
[07:23.400 --> 07:29.080]  and committee hearings on the Code of Criminal Procedure and what goes into the penal code,
[07:29.080 --> 07:36.460]  they're the reason the Code of Criminal Procedure is such a dabbling mess, so we need to stay
[07:36.460 --> 07:40.200]  on top of this bill, we need to make sure these people don't come up with an ignorant
[07:40.200 --> 07:44.400]  argument such as, well federal law will trump whatever we do and blah blah blah, that's
[07:44.400 --> 07:50.640]  baloney, federal law will not trump the laws of the state when there is no authority for
[07:50.640 --> 07:56.680]  the federal act within the state, if it doesn't belong as one of the 18 enumerated powers
[07:56.680 --> 08:02.480]  it doesn't have any authority within the state and then only if that particular enumerated
[08:02.480 --> 08:07.640]  power would have authority within the state, so we need to keep these people toeing the
[08:07.640 --> 08:13.400]  line on that or they will run roughshod over this bill and we won't see any change at all,
[08:13.400 --> 08:16.080]  so just keep that in mind.
[08:16.080 --> 08:22.240]  Now I've been doing a little bit more research today on the repealed section 45.01 of the
[08:22.240 --> 08:27.720]  Code of Criminal Procedure, I've been reviewing some of the old case law regarding that section,
[08:27.720 --> 08:34.200]  I've been reviewing the discussional topics on everything up to that and folks, after
[08:34.200 --> 08:37.160]  a little thing that Randy and I went through the other evening and we talked about on the
[08:37.160 --> 08:42.360]  show a little bit about how these judges tend to completely ignore what the legislature
[08:42.360 --> 08:49.720]  has put in place to create their own law like they did regarding the ability of an individual
[08:49.720 --> 08:58.680]  to sue a municipality, I'm astounded somebody wasn't hung from a tree over what occurred
[08:58.680 --> 09:08.560]  with 27.14D and 45.01 Code of Criminal Procedure, 45.01 as everyone that's been to one of my
[09:08.560 --> 09:13.200]  seminars knows, used to be the statute in the Code of Criminal Procedure that dealt
[09:13.200 --> 09:20.400]  with the ability of a municipality or a justice of the peace court to commence all prosecutions
[09:20.400 --> 09:28.600]  by complaint, well here's the problem, every criminal prosecution commences by complaint,
[09:28.600 --> 09:37.640]  they're not any different but the courts in their infinite wisdom decided that somehow
[09:37.640 --> 09:45.160]  or other additional words somehow escaped the legislature's attention and did not appear
[09:45.160 --> 09:54.120]  in this statute, so the courts just added them, words such as upon complaint alone meaning
[09:54.120 --> 10:02.360]  there's no requirement for a charging instrument, unfortunately without a sworn complaint against
[10:02.360 --> 10:12.840]  someone nothing charges them with anything, even 45.01 wouldn't have given that permission
[10:12.840 --> 10:17.040]  because even if there was a complaint it would have had to have been sworn to before it was
[10:17.040 --> 10:23.920]  valid but the complaint still does not constitute a charging instrument when you look at the
[10:23.920 --> 10:30.200]  rest of the Code of Criminal Procedure and the Texas Constitution, now one of these case
[10:30.200 --> 10:38.400]  analysis that I've seen and the NAG's opinion back from 1988 said that because the Constitution
[10:38.400 --> 10:43.000]  didn't specifically mention complaints then the legislature could just create it out of
[10:43.000 --> 10:52.120]  thin air but I see a problem with that, this is the court's interpretation where if the
[10:52.120 --> 11:01.120]  Constitution doesn't specifically forbid it then the legislature can do it, wrong answer,
[11:01.120 --> 11:07.960]  the people gave the state legislature just like they gave the Congress specific powers
[11:07.960 --> 11:18.120]  and authorities, if it's not in the Constitution it's not within your power to exercise, period,
[11:18.120 --> 11:25.160]  this is not rocket science, this is not even kindergarten, but these judges can't seem
[11:25.160 --> 11:30.720]  to make heads or tails of this concept, oh well if the Constitution doesn't forbid it
[11:30.720 --> 11:36.600]  they can do it, well the Constitution doesn't forbid them from directly murdering the people
[11:36.600 --> 11:44.640]  of Texas, does that mean they can do it? It doesn't directly prevent them from committing
[11:44.640 --> 11:50.040]  fraud against the people of Texas, does that mean they can do it? They can pass a law that
[11:50.040 --> 11:56.480]  lets them do it? It doesn't say they can steal the people's property, does that mean they
[11:56.480 --> 12:04.080]  can pass a law that lets them do it? No, the Constitution was designed and put in place
[12:04.080 --> 12:12.240]  to set limits and anything that exceeds those limits is null and void, we put that in there
[12:12.240 --> 12:22.120]  too, article 1 section 29, anything you idiots do that violates any provision of this Constitution
[12:22.120 --> 12:31.160]  is void, the people weren't stupid, they're not going to write a document of limitation
[12:31.160 --> 12:38.760]  and then say anything we don't put in here feel free to do anyway, that's idiocy, oh
[12:38.760 --> 12:45.360]  wait, we're dealing with judges, of course it's idiocy, for somebody that's supposed
[12:45.360 --> 12:49.600]  to be highly educated and knowledgeable these people prove beyond a shadow of a doubt to
[12:49.600 --> 12:59.120]  me every single time I read a case just how stupid they really are, if these guys walked
[12:59.120 --> 13:03.240]  up and said the kind of crap they say in the face of one of my great grandparents, my great
[13:03.240 --> 13:11.600]  grandfather for example, this dude would have got shot, people before our time didn't put
[13:11.600 --> 13:18.560]  up with this kind of crap from their elected public servants, why are we? We're just getting
[13:18.560 --> 13:27.040]  way too good at acquiescing folks, we need to stop, but through this study of 4501 it
[13:27.040 --> 13:34.040]  is obvious that none of these people read all of the stuff that's in paramateria to
[13:34.040 --> 13:39.240]  what they're writing about, each one of them whether it be a judge or be an attorney general
[13:39.240 --> 13:44.640]  or an assistant attorney general or some law student doing a review and writing a paper
[13:44.640 --> 13:54.820]  for his doctorate writes about one of these things, I have found very, very few that actually
[13:54.820 --> 14:02.320]  bother to read anything more than the single statute they're writing about, and the only
[14:02.320 --> 14:09.640]  time I have ever seen it, it was actually a law student that bothered to do so, it's
[14:09.640 --> 14:19.680]  never a judge and it's never a lawyer, and we wonder why we're in this mess, it's because
[14:19.680 --> 14:26.160]  the system is completely corrupt because these people think their opinion is law and it's
[14:26.160 --> 14:32.600]  not, especially when their opinion doesn't comply with the law and it doesn't take the
[14:32.600 --> 14:41.440]  law in its totality into consideration, and all you have to do is read some of these opinions
[14:41.440 --> 14:49.720]  and it's obvious that's exactly what they don't do, they do not take it into consideration
[14:49.720 --> 15:00.240]  in its totality, and because of that we get hosed, I found a really interesting movie
[15:00.240 --> 15:06.000]  I'm going to show on our next Saturday's seminar, it's about 8 minutes long and it's a little
[15:06.000 --> 15:12.440]  animated movie it's called So What Did You Learn As A Legal Intern, and I don't know

[15:19.620 --> 15:28.680]  intricacies of the system cold, you will see everything that's said in this little animated
[15:28.680 --> 15:36.200]  short to be so dead on the money we ought to be taken to the streets with pitchforks,
[15:36.200 --> 15:42.480]  ropes, tar and rails, and lots of feathers and taken every dress wearing fool that sits

[20:10.280 --> 20:19.300]  upon complaint alone. Well, proceed is a misnomer. It says the prosecution commences with a complaint.
[20:19.300 --> 20:26.160]  And like I said earlier, that's true of any kind of case. Even a civil case commences
[20:26.160 --> 20:30.520]  and then proceeds with a complaint. But we're not talking about civil here, we're talking
[20:30.520 --> 20:32.560]  about criminal.
[20:32.560 --> 20:36.760]  And of course, when you look through the provisions of the Code of Criminal Procedure, you have
[20:36.760 --> 20:44.500]  27.01 where it says very clearly that the indictment or information is the primary pleading
[20:44.500 --> 20:51.120]  of the state in any criminal prosecution. What is the primary pleading? It's what gets
[20:51.120 --> 20:59.280]  it on the go here. The primary pleading is what must exist that states the offense.
[20:59.280 --> 21:04.600]  Now here's what the courts have all said about a complaint. The complaint is not required
[21:04.600 --> 21:12.880]  to have all of the requisite elements that are required to prove the charge that is made
[21:12.880 --> 21:22.320]  against you in that complaint. However, an indictment or information must have them.
[21:22.320 --> 21:29.500]  So if they must have them and they are the primary pleadings of the state in a criminal
[21:29.500 --> 21:36.640]  prosecution, then who would come up with the lame-brained idea that a complaint which does
[21:36.640 --> 21:44.800]  not meet the requisites of spelling out the exactitude of what the offense is, thus enabling
[21:44.800 --> 21:51.640]  the person accused to better prepare a defense, that in these cases it's just simply not required
[21:51.640 --> 21:54.440]  all of a sudden?
[21:54.440 --> 22:03.040]  I mean, we know that violates Article 5, Section 12b, Texas Constitution. We know that violates
[22:03.040 --> 22:08.840]  almost a dozen sections of the Code of Criminal Procedure that deals with the necessity of
[22:08.840 --> 22:17.780]  an indictment or information in order to proceed to trial against someone in a criminal case.
[22:17.780 --> 22:30.880]  So how can two sections, 45.01 and 27.14d, how can those two sections override the requisites
[22:30.880 --> 22:38.240]  that are specifically spelled out both in the Texas Constitution and at least a dozen
[22:38.240 --> 22:47.240]  other articles of the Code of Criminal Procedure? Especially since there is no language in either
[22:47.240 --> 22:57.560]  of those two that specifically says that a complaint is all that is required. One says
[22:57.560 --> 23:02.600]  that the prosecution commences with it. The other says that unless there is a plea of
[23:02.600 --> 23:07.600]  not guilty, you can get away with using the citation as the complaint. But here's another
[23:07.600 --> 23:14.440]  problem with that. Again, if the only thing that vests the court with jurisdiction of
[23:14.440 --> 23:21.280]  the cause is a valid charging instrument, which again, the Texas Constitution, Article
[23:21.280 --> 23:29.960]  5, Section 12b, and Article 5, Section 17, and these dozen other sections of the Code
[23:29.960 --> 23:37.160]  of Criminal Procedure all say that in order for the court to get jurisdiction, there must
[23:37.160 --> 23:43.520]  be a proper charging instrument in the form of an indictment or information. Where did
[23:43.520 --> 23:49.320]  the idea come from that all a complaint will suffice when it doesn't qualify compared to
[23:49.320 --> 23:57.360]  any of these other parts of the Code or the Constitution? I'll tell you. Some idiotic
[23:57.360 --> 24:03.840]  judge decided he knew better than the legislature and that in order to streamline their process
[24:03.840 --> 24:10.020]  and prevent the prosecutors from having to actually do their job, we'll just go ahead
[24:10.020 --> 24:17.760]  and do it the simple way. And as long as someone's just accusing them, that's all we'll need.
[24:17.760 --> 24:27.200]  And that's exactly what it is. The complaint is nothing more than an accusation. The citation
[24:27.200 --> 24:37.000]  itself is not even that because it's not sworn to. It's simply written out by the cop. Now
[24:37.000 --> 24:44.800]  if it's written out by the cop, how does the cop establish probable cause that carries
[24:44.800 --> 24:52.480]  over to a magistrate for the purpose of issuing a warrant? All the case law says that probable
[24:52.480 --> 25:00.960]  cause must be determined by an independent magistrate. Now the case law also says this

[25:42.640 --> 25:50.800]  Both of them put together show very clearly it's mandatory and they refuse to do it. Then
[25:50.800 --> 25:57.920]  that same magistrate instead of conducting the preliminary hearing like they're supposed
[25:57.920 --> 26:02.960]  to do and issuing an order to appear at a later date in a different court for the purpose
[26:02.960 --> 26:09.640]  of arraignment then moves immediately to trying to hold an arraignment, wants to know how
[26:09.640 --> 26:17.320]  you plead. The problem there is chapter 45 which governs the municipal injustice courts
[26:17.320 --> 26:25.680]  says very clearly the entering of a plea is not required until the jury has been impaneled.
[26:25.680 --> 26:31.040]  Well we haven't even gotten to a jury selection, much less one being impaneled. This is your
[26:31.040 --> 26:35.280]  initial appearance. Why aren't you going by the code of criminal procedure and doing what
[26:35.280 --> 26:43.640]  1517A says to do? Because they're idiots. They want to do it their way not the way the
[26:43.640 --> 26:51.280]  law says. And this folks is where we're going to hang them. Because when I file this lawsuit
[26:51.280 --> 26:56.800]  against them I'm not going to cite just one statute. I'm not going to cite two statutes
[26:56.800 --> 27:03.040]  out of context. I'm going to take every statute there is that's in paramateria to that specific

[32:39.240 --> 32:50.000]  3.09C says special responsibilities of a prosecutor. The prosecutor in a criminal case shall see
[32:50.000 --> 32:56.360]  not initiate or encourage efforts to obtain from an unrepresented accused a waiver of
[32:56.360 --> 33:03.560]  important pre-trial, trial, or post-trial rights. Isn't that what they're doing all
[33:03.560 --> 33:11.760]  the time when they're, you know, when we walk in there with a citation and they are encouraging
[33:11.760 --> 33:19.160]  us to make a plea because basically what that is is a waiver of our rights. Is that not
[33:19.160 --> 33:23.720]  so? Well, that's one thing. The other thing is when they call you in to hold a little
[33:23.720 --> 33:29.000]  special tette-a-tette with the prosecuting attorney, that's exactly what they're doing
[33:29.000 --> 33:36.600]  and the judge is aiding, abetting, and colluding to make this happen. So, I would judicial
[33:36.600 --> 33:43.320]  conduct complaint the judge as well as bar-grieve the prosecuting attorney. And as far as your
[33:43.320 --> 33:49.040]  defense counsel that you did say that you used, I'd bar-grieve him for being an idiot
[33:49.040 --> 33:55.360]  because you ought to know that you can't be arrested for failure to appear. That charge
[33:55.360 --> 34:01.280]  can only be a supplemental charge for being arrested for something else.
[34:01.280 --> 34:12.280]  Actually, in my case, I was arrested for failure to ID and the elements of the crime weren't
[34:12.280 --> 34:20.440]  there because there wasn't a valid arrest warrant. I was arrested for failure to ID fugitives,
[34:20.440 --> 34:21.440]  which while the elements-
[34:21.440 --> 34:26.520]  That's the thing. That's what I'm saying. There is no such law in Texas as failure to
[34:26.520 --> 34:36.040]  ID as an initial charge. That law is very clear. You must already be lawfully arrested
[34:36.040 --> 34:40.880]  for something else before you can be charged with failure to ID.
[34:40.880 --> 34:45.680]  Yeah, that's right. We're not in a show-your-paper society here, people, really. And that's
[34:45.680 --> 34:51.320]  the law that's on the books. The police cannot just demand your ID for no good reason. And
[34:51.320 --> 34:55.880]  if you don't give it to them, then they arrest you for failure to ID. Failure to ID only
[34:55.880 --> 35:01.680]  applies if you have already been arrested under probable cause for something else and
[35:01.680 --> 35:04.880]  then you don't give your ID.
[35:04.880 --> 35:15.000]  Yes. And like I said, the prosecutor, I think, saw that because in the court documents, the
[35:15.000 --> 35:23.720]  sheriff did not confirm that there was a valid arrest warrant for me. So they conjured up
[35:23.720 --> 35:30.920]  this lawyer who suddenly was my appointed lawyer, although I had never requested one.
[35:30.920 --> 35:36.480]  And I told him that I wasn't wanting one, that I wanted to represent myself. And he
[35:36.480 --> 35:41.200]  was telling me that, well, then instead of being in court on Friday, it would probably
[35:41.200 --> 35:46.520]  be Monday or so. And he'd already worked out a deal where I could get out of jail on Friday
[35:46.520 --> 35:52.760]  night if I signed these papers. Is that cool?
[35:52.760 --> 35:58.840]  No, it's not cool. It's taking advantage of someone that doesn't know any better.
[35:58.840 --> 35:59.840]  Do what?
[35:59.840 --> 36:01.560]  I said it's not cool.
[36:01.560 --> 36:04.440]  I just went a couple years ago and I didn't know better.
[36:04.440 --> 36:10.000]  Yeah, it's taking advantage of someone that does not know any better. That's the whole
[36:10.000 --> 36:12.000]  point of the problem.
[36:12.000 --> 36:22.400]  Yep. So I filed one of these grievances on the website and then I realized that I'm putting
[36:22.400 --> 36:28.800]  all this personal information on it and it doesn't seem to be a secured site.
[36:28.800 --> 36:34.160]  That's Randy's issue and that is a very good point. If it's not a secured site, we're going
[36:34.160 --> 36:36.400]  to have to talk to him about that.
[36:36.400 --> 36:43.920]  And there wasn't a place on the form for me to put my contact information. Doesn't he
[36:43.920 --> 36:49.800]  want to get back with the person who fills out the form on that?
[36:49.800 --> 36:56.320]  Actually I don't think so. Even on my site, when I get mine up for doing that very same
[36:56.320 --> 37:01.480]  thing, mine will not store the information of the person that submits the complaint.
[37:01.480 --> 37:06.840]  Only the information regarding who it was filed against. That is specifically for the
[37:06.840 --> 37:10.160]  protection of the person submitting the complaint.
[37:10.160 --> 37:18.120]  Okay. I just wanted to bring that to your attention. And as you were talking tonight,
[37:18.120 --> 37:24.720]  I was thinking to file, do a little court watching and whenever the prosecutor there
[37:24.720 --> 37:33.480]  is talking to unrepresented people basically, isn't that what they're really initiating,
[37:33.480 --> 37:39.360]  violating that portion of the rules?
[37:39.360 --> 37:44.560]  Well again, it's an individual choice as to whether or not they allow that to happen.
[37:44.560 --> 37:48.120]  If they tell them they have to talk to him when they don't want to talk to him, then
[37:48.120 --> 37:53.720]  yes it is. But if the person voluntarily waives their right and holds a conversation with
[37:53.720 --> 37:59.960]  somebody, that is their choice. But odds are they're not being informed that they have
[37:59.960 --> 38:05.240]  that option. They're being told in a manner that makes them presume it's the only one
[38:05.240 --> 38:08.240]  they have.
[38:08.240 --> 38:18.120]  Exactly. And the majority of the times that I've seen it, nobody has ever informed of
[38:18.120 --> 38:21.640]  their Miranda rights either, which they're supposed to know.
[38:21.640 --> 38:27.880]  Oh, and that's exactly why they should be doing 1517 of the Code of Criminal Procedure
[38:27.880 --> 38:33.680]  because that's where that gets done. And none of these judges are doing it. Every one of
[38:33.680 --> 38:38.760]  them is violating law the moment they open their mouth and the moment they refuse to
[38:38.760 --> 38:44.360]  do what they're told to do by the Code of Criminal Procedure. Every one of them is breaking
[38:44.360 --> 38:45.360]  the law.
[38:45.360 --> 39:04.000]  So how many bar grievances or judicial complaints does it take to break a court?
[39:04.000 --> 39:07.400]  That hasn't been tested. It's kind of like getting to the center of a tootsie roll. No
[39:07.400 --> 39:16.960]  one knows for sure.

[40:17.000 --> 40:21.200]  And so he's saying that if you don't want that information public, then I guess you
[40:21.200 --> 40:23.400]  can't use the website.
[40:23.400 --> 40:28.680]  He's standing by right now. I just suggested to him that perhaps what can be done, because
[40:28.680 --> 40:34.240]  he's saying that if the whole bargrievance isn't made public, if there's no name, no
[40:34.240 --> 40:39.960]  address, no nothing, then there's no substance to it, and it could be anybody making up anything
[40:39.960 --> 40:41.720]  about these attorneys.
[40:41.720 --> 40:47.560]  And I just suggested to him that perhaps he set it up so that it's people's, maybe people
[40:47.560 --> 40:52.000]  would enter their first name and their state, like we ask the callers. We don't ask callers
[40:52.000 --> 40:57.000]  for their full name, but I'll speak with them some more on this matter. But he was basically
[40:57.000 --> 41:02.120]  explaining that all the information has to be there. The whole point is to make it public.
[41:02.120 --> 41:05.960]  But perhaps an alternate would be just to have people's first names and states. But
[41:05.960 --> 41:08.520]  we'll get back to the listeners on that one.
[41:08.520 --> 41:13.140]  Well, the thing about it is, though, is we can actually collect the information necessary
[41:13.140 --> 41:18.200]  to allow the individual to print out the complaint so they can file it. But when we display it
[41:18.200 --> 41:22.440]  back to the general public, we really don't need anything other than a first name and
[41:22.440 --> 41:28.880]  a zip code or something of that nature or a state for the individual that filed it. There's
[41:28.880 --> 41:34.920]  no reason to show all the information for the individual because nobody else can use
[41:34.920 --> 41:37.640]  a printed copy of the bar complaint.
[41:37.640 --> 41:42.420]  The whole reason we want it out there, though, is so they can see that this attorney has
[41:42.420 --> 41:47.920]  bar complaints against him, 1, 10, 50, doesn't matter how many. They just need to see that
[41:47.920 --> 41:51.360]  it's filed and know that it was a real person that filed it.
[41:51.360 --> 41:56.880]  So we really don't have to give back all of the personal information just because someone
[41:56.880 --> 42:02.840]  wants to see how many bar complaints there are against one of these individual attorneys.
[42:02.840 --> 42:08.000]  But I can go over the details of that with Randy and help him hash it out.
[42:08.000 --> 42:15.720]  And what I was sort of thinking was to, you know, once it's out there and I can see, you
[42:15.720 --> 42:21.800]  know, what I've filed, look at, you know, watch for people who are in similar positions
[42:21.800 --> 42:29.800]  and just give them a link to the website so that they can go and say, oh, hey, I can do
[42:29.800 --> 42:30.800]  this too.
[42:30.800 --> 42:31.800]  You know, it's a little harder.
[42:31.800 --> 42:36.920]  Yeah, they could actually turn around and, you know, the way I was going to set mine
[42:36.920 --> 42:40.280]  up would have allowed it to make it as easy as possible. If there was a bar complaint
[42:40.280 --> 42:44.360]  already up dealing with a particular issue that they just needed to make slight changes
[42:44.360 --> 42:50.320]  to, they could duplicate that bar complaint, put in their information, change what needed
[42:50.320 --> 42:54.760]  to be changed in the specifics and resubmit it and it would generate an all new complaint
[42:54.760 --> 42:58.580]  number and all that stuff for it to keep track of on the website.
[42:58.580 --> 43:04.160]  And then again, once that complaint went in, it didn't come back with all of the submitter's
[43:04.160 --> 43:09.680]  information, only the stuff that was needed to show it was done by a real person in some
[43:09.680 --> 43:10.680]  location.

[01:12:32.040 --> 01:12:35.040]  And I kind of came under a gang threat.
[01:12:35.040 --> 01:12:40.040]  And when I went in to tell the police department, where I'd had a good rapport with three or
[01:12:40.040 --> 01:12:44.040]  four officers that had come to my site and, you know, there had been issues at my site
[01:12:44.040 --> 01:12:46.040]  before I got there.
[01:12:46.040 --> 01:12:48.040]  So they were familiar with me.
[01:12:48.040 --> 01:12:52.040]  And when I went in, this officer I'd never talked to before says, well, if I come to
[01:12:52.040 --> 01:12:56.040]  your site and you've got gang members there and there's, like, weapons involved, you could
[01:12:56.040 --> 01:12:58.040]  get shot and I shoot to kill.
[01:12:58.040 --> 01:12:59.040]  Really?
[01:12:59.040 --> 01:13:02.040]  And you didn't file a complaint on this officer?
[01:13:02.040 --> 01:13:04.040]  That's a bail threat.
[01:13:04.040 --> 01:13:11.040]  Yeah, no, it got very strange from there because, you know, I kind of went to go get some things
[01:13:11.040 --> 01:13:17.040]  to secure myself with at the site, just like a knife to keep by my bed from Big Five Sport.
[01:13:17.040 --> 01:13:21.040]  It's a legal thing, you know, in a box, just legally.
[01:13:21.040 --> 01:13:28.040]  And ultimately what happened is I went into these restaurants just to go over receipts
[01:13:28.040 --> 01:13:30.040]  and stuff for my job.
[01:13:30.040 --> 01:13:33.040]  And I was trying to put the waitress at ease.
[01:13:33.040 --> 01:13:38.040]  And I told the waitress that I'm a licensed security guard because I was dressed in some
[01:13:38.040 --> 01:13:39.040]  of my gear.
[01:13:39.040 --> 01:13:41.040]  And I just came under gang threat.
[01:13:41.040 --> 01:13:46.040]  And I think I said this stupid officer threatened to shoot me or something like that.
[01:13:46.040 --> 01:13:52.040]  Well, this intoxicated guy had been coming to my table several times.
[01:13:52.040 --> 01:13:56.040]  I handled him very well, but I guess he must have known the waitress and they ended up
[01:13:56.040 --> 01:13:59.040]  calling the police on me and I got arrested.
[01:13:59.040 --> 01:14:04.040]  And what she told the police is that I was going to shoot the cop if he came to my site,
[01:14:04.040 --> 01:14:08.040]  not he was going to shoot me like I was trying.
[01:14:08.040 --> 01:14:14.040]  And ultimately they were trying to charge me with three felonies, threatening an officer,
[01:14:14.040 --> 01:14:21.040]  a concealed weapon, and obstructing an officer from his job, a PC-69.
[01:14:21.040 --> 01:14:24.040]  And I fought it for a year.
[01:14:24.040 --> 01:14:31.040]  It cost almost $20,000 in bail and attorney fees.
[01:14:31.040 --> 01:14:36.040]  And they also messed with me when they threw me in jail because they thought I threatened
[01:14:36.040 --> 01:14:37.040]  a cop, which I did not.
[01:14:37.040 --> 01:14:39.040]  I would never do that.
[01:14:39.040 --> 01:14:43.040]  And it was a pretty horrible experience.
[01:14:43.040 --> 01:14:48.040]  I ultimately got it all reduced down to a misdemeanor.
[01:14:48.040 --> 01:14:50.040]  A misdemeanor what?
[01:14:50.040 --> 01:14:52.040]  You assaulted your dinner?
[01:14:52.040 --> 01:14:53.040]  What's that?
[01:14:53.040 --> 01:14:54.040]  A misdemeanor what?

[01:15:00.040 --> 01:15:05.040]  Well, no, I mean, I had to plead to a misdemeanor of threatening an officer and I had to plead
[01:15:05.040 --> 01:15:08.040]  to the PC-69.
[01:15:08.040 --> 01:15:10.040]  Why did you have to?
[01:15:10.040 --> 01:15:15.040]  Well, I mean, I hired a private attorney and then I just couldn't afford him any longer
[01:15:15.040 --> 01:15:20.040]  than the public defender negotiated for me.
[01:15:20.040 --> 01:15:24.040]  In other words, he threw you under the bus and you went willingly?
[01:15:24.040 --> 01:15:29.040]  Well, they were very, the DA was being, there were two different DAs and they were being
[01:15:29.040 --> 01:15:35.040]  real sticklers as far as, the judge even told the DAs in this instance that they didn't
[01:15:35.040 --> 01:15:37.040]  have the best case.
[01:15:37.040 --> 01:15:41.040]  They better settle the case.
[01:15:41.040 --> 01:15:45.040]  And I guess the judges don't do that too often.
[01:15:45.040 --> 01:15:49.040]  But these guys, you know, they were trying to get me for felonies, even one.
[01:15:49.040 --> 01:15:53.040]  And so I was happy to kind of get out of there with just the misdemeanors and no additional
[01:15:53.040 --> 01:15:57.040]  jail time or, I mean, I was just happy to be gone out of there.
[01:15:57.040 --> 01:16:01.040]  Now, I mean, part of me feels like going back and like, I don't know, talking to the FBI,
[01:16:01.040 --> 01:16:09.040]  talking to the governor, the state DA about what happened and that I had was wrongly charged
[01:16:09.040 --> 01:16:12.040]  and kind of, you know, do something retroactive.
[01:16:12.040 --> 01:16:19.040]  But one of the main reasons I'm calling is the, they said that I couldn't carry a weapon
[01:16:19.040 --> 01:16:24.040]  for up to 10 years as part of my informal probation.
[01:16:24.040 --> 01:16:26.040]  In California?
[01:16:26.040 --> 01:16:28.040]  Correct.
[01:16:28.040 --> 01:16:31.040]  I'm here in Texas now and I'm going to probably be a permanent resident here.

[01:21:13.040 --> 01:21:16.040]  Now, if you had fought it in court and lost,
[01:21:16.040 --> 01:21:20.040]  you would have a chance at getting it overturned after the fact,
[01:21:20.040 --> 01:21:23.040]  but since you took a plea deal, it's over.
[01:21:23.040 --> 01:21:26.040]  Well, what about the aspect of trying to...
[01:21:26.040 --> 01:21:30.040]  For me, very much in the vein that you guys do here,
[01:21:30.040 --> 01:21:33.040]  in these small towns, I mean, they're threatening you.
[01:21:33.040 --> 01:21:36.040]  If you take this to court, you can get up to four years.
[01:21:36.040 --> 01:21:37.040]  That's what they do everywhere.
[01:21:37.040 --> 01:21:39.040]  Yeah, they do that everywhere.
[01:21:39.040 --> 01:21:45.040]  That's the standard screw-turning effect that all prosecutors apply.
[01:21:45.040 --> 01:21:47.040]  They threaten you with this and that,
[01:21:47.040 --> 01:21:53.040]  and that's how they get people to succumb and cave in and plea bargain.
[01:21:53.040 --> 01:21:59.040]  That's just normal standard business procedure on their part.
[01:21:59.040 --> 01:22:03.040]  If you took a plea deal, you're not going to be able to get it overturned.
[01:22:03.040 --> 01:22:04.040]  That's just the way it is.
[01:22:04.040 --> 01:22:07.040]  Every court's going to look at it as you took the deal willingly
[01:22:07.040 --> 01:22:10.040]  and knowing the consequences.
[01:22:10.040 --> 01:22:13.040]  Therefore, you can't say that you were hosed or lied to or anything else
[01:22:13.040 --> 01:22:18.040]  because the presumption is that you entered into it with full knowledge and consent.
[01:22:18.040 --> 01:22:20.040]  That's going to be how they look.
[01:22:20.040 --> 01:22:23.040]  Whether it's true or not, that's irrelevant
[01:22:23.040 --> 01:22:28.040]  because you don't have any way of proving that you didn't do it willingly,
[01:22:28.040 --> 01:22:34.040]  and all the evidence against you would indicate clearly that you did do it willingly.
[01:22:34.040 --> 01:22:36.040]  You signed everything.
[01:22:36.040 --> 01:22:37.040]  Yeah, you signed it.
[01:22:37.040 --> 01:22:39.040]  You put your hand on the paper,
[01:22:39.040 --> 01:22:44.040]  unless you have some evidence that they held a gun to your head or something

[01:22:58.040 --> 01:23:01.040]  Everybody you ask this question is going to tell you the same thing.

[01:23:04.040 --> 01:23:08.040]  You entered into the deal willingly, and that's just the way it is.

[01:23:18.040 --> 01:23:26.040]  The result of that deal follows you around far longer than if you fight it and win,
[01:23:26.040 --> 01:23:30.040]  or even if you fight it and lose, at least you still stand a chance of fighting it,
[01:23:30.040 --> 01:23:34.040]  and if you eventually win, you stand a chance of recovering something from it.
[01:23:34.040 --> 01:23:35.040]  Right.
[01:23:35.040 --> 01:23:40.040]  Yeah, one of my fears was if they did get any kind of a win in me going back to that jail,
[01:23:40.040 --> 01:23:43.040]  I got punched and thrown in the gut by a sergeant.
[01:23:43.040 --> 01:23:46.040]  I got thrown into the psych ward, which I didn't deserve to be.
[01:23:46.040 --> 01:23:48.040]  It was just because I was trying to put my shoulder back in socket.
[01:23:48.040 --> 01:23:50.040]  They weren't giving me medical attention.
[01:23:50.040 --> 01:23:52.040]  I did not want to go back there.
[01:23:52.040 --> 01:23:53.040]  I know, I know.
[01:23:53.040 --> 01:23:58.040]  Well, I understand, but again, this is where the necessity of having a witness
[01:23:58.040 --> 01:24:03.040]  or of standing your ground because you did nothing wrong.
[01:24:03.040 --> 01:24:07.040]  If you agreed to cut a deal just to prevent your own misery,
[01:24:07.040 --> 01:24:10.040]  and I'm not saying that you shouldn't if that's what it takes,
[01:24:10.040 --> 01:24:13.040]  especially if you're being abused because of it,
[01:24:13.040 --> 01:24:16.040]  but without some way of proving that abuse,
[01:24:16.040 --> 01:24:19.040]  like immediately going to the hospital when you were released

[01:24:37.040 --> 01:24:42.040]  Well, I mean, it definitely, when you're thrown into a padded room with a grate
[01:24:42.040 --> 01:24:47.040]  and you're not given water and stuff like that, it's pretty horrible.
[01:24:47.040 --> 01:24:51.040]  Well, you know, we're not trying to bash you or knock you for your decision, Max.
[01:24:51.040 --> 01:24:54.040]  I mean, everybody makes the best decisions that they can at the time,
[01:24:54.040 --> 01:24:59.040]  but, you know, unfortunately, this is the consequences of that particular decision
[01:24:59.040 --> 01:25:04.040]  that you basically have zero chance of getting that case overturned
[01:25:04.040 --> 01:25:08.040]  or going back after them or suing them or anything like that
[01:25:08.040 --> 01:25:10.040]  in any successful way whatsoever.
[01:25:10.040 --> 01:25:14.040]  But as far as being able to carry a weapon in the state of Texas,
[01:25:14.040 --> 01:25:18.040]  depending on what the level of misdemeanor was in California,
[01:25:18.040 --> 01:25:20.040]  you may or may not have that much difficulty here.
[01:25:20.040 --> 01:25:22.040]  Hopefully, you won't.
[01:25:22.040 --> 01:25:26.040]  Yeah, and it's not that big of a deal for me,
[01:25:26.040 --> 01:25:29.040]  but, you know, when you have certain things happen to you,

[01:25:34.040 --> 01:25:41.040]  and now that you have them try and put the rule of law on you, you want that freedom.
[01:25:41.040 --> 01:25:46.040]  Well, let me give you a little bit of advice I give to everybody that listens to me on this show

[01:33:26.040 --> 01:33:32.040]  Well, there's malicious prosecution if it was a prosecutorial case.

[01:33:38.040 --> 01:33:42.040]  what exactly were the necessities of the case?
[01:33:42.040 --> 01:33:45.040]  I mean, I don't need details of names or such,
[01:33:45.040 --> 01:33:47.040]  but was someone filing suit against somebody
[01:33:47.040 --> 01:33:50.040]  or was someone pressing charges against somebody?
[01:33:50.040 --> 01:33:54.040]  My ex-husband appeared after seven years of no contact
[01:33:54.040 --> 01:33:59.040]  and filed for removal of child support
[01:33:59.040 --> 01:34:04.040]  and to take custody of my 17-year-old son.
[01:34:04.040 --> 01:34:06.040]  Okay.
[01:34:06.040 --> 01:34:10.040]  If you can show that there was no merit to what he was doing,
[01:34:10.040 --> 01:34:13.040]  you can certainly counter sue him and try to get your costs back,
[01:34:13.040 --> 01:34:15.040]  but how long ago was this?
[01:34:15.040 --> 01:34:18.040]  Well, he turned 18 last year,
[01:34:18.040 --> 01:34:24.040]  and I would say eight months prior to his turning 18,
[01:34:24.040 --> 01:34:26.040]  the ex just disappeared into the woodwork again.
[01:34:26.040 --> 01:34:29.040]  He has a fuller or psychotic episode.
[01:34:29.040 --> 01:34:31.040]  Okay, if you can do it,
[01:34:31.040 --> 01:34:34.040]  the maximum amount of time you'd have to do it would be two years.
[01:34:34.040 --> 01:34:35.040]  Okay.
[01:34:35.040 --> 01:34:38.040]  But for some reason, something is nagging in my brain
[01:34:38.040 --> 01:34:41.040]  and said this particular type of suit would only have one,

[01:34:55.040 --> 01:34:57.040]  and if you don't know where he is, then you can't sue him.
[01:34:57.040 --> 01:35:00.040]  Yeah, he's in Birmingham, Alabama now.

[01:35:02.040 --> 01:35:06.040]  If you know where he is and you can get him properly served,

[01:38:11.040 --> 01:38:17.040]  I mean, it's a scary fight, and every time I go into the courthouse, in my head, I think,
[01:38:17.040 --> 01:38:23.040]  Wendy Kelton, Deborah Stevens, Eddie Craig, you know, and I can't say that, you know,
[01:38:23.040 --> 01:38:27.040]  anytime I don't sit there and shake in my boots because these are powerful people,
[01:38:27.040 --> 01:38:32.040]  but now I get to where I go in the courthouse and say, hey, hey, how you doing?
[01:38:32.040 --> 01:38:37.040]  They all know me. They know me, and they know that I will fight to the very end against these people,
[01:38:37.040 --> 01:38:40.040]  you know, and you have to learn how to do it.
[01:38:40.040 --> 01:38:46.040]  Recently, I've had two cases, one of them that I've lost, but the only one out of 12 cases that I lost
[01:38:46.040 --> 01:38:55.040]  was in a magistrate court where I had an attorney file a case against me,
[01:38:55.040 --> 01:39:01.040]  and in a magistrate court, I learned that the first thing you do is you get the rules of that court
[01:39:01.040 --> 01:39:05.040]  and you learn what all of them are, and you make sure you follow them.
[01:39:05.040 --> 01:39:11.040]  And what happened was the attorney never gave his address, so I could not subpoena him to court.
[01:39:11.040 --> 01:39:15.040]  I filed a countersuit against him, and he never showed up.
[01:39:15.040 --> 01:39:18.040]  He had another attorney show up for him.
[01:39:18.040 --> 01:39:23.040]  What you have to file is called an apparent, and it must be in writing.
[01:39:23.040 --> 01:39:27.040]  You have to have their name, their business address, and their phone number.
[01:39:27.040 --> 01:39:32.040]  Neither attorney did it, and therefore I couldn't summon them to court to sue him.
[01:39:32.040 --> 01:39:37.040]  And so now I have to go back to the judge, because when I let the judge know that he violated Rule 7
[01:39:37.040 --> 01:39:44.040]  of the magistrate court rules here in Columbus, Georgia, the judge said he didn't care.
[01:39:44.040 --> 01:39:48.040]  So that's how they're doing it, and unless you learn what to do.
[01:39:48.040 --> 01:39:52.040]  And now I'm in the process of filing my complaints, because I'm going after him.

[01:55:52.040 --> 01:55:54.040]  you're going to get yourself in big trouble.

[01:56:18.040 --> 01:56:22.040]  Yeah, and actually Federal Reserve notes don't even classify as real notes.

[01:56:25.040 --> 01:56:29.040]  like when it can be redeemed, when it was issued, when it can be redeemed.
