[00:53.200 --> 00:58.080] state house Thursday protesting a bill that would restrict collective bargaining rights.
[00:58.080 --> 01:03.160] The Ohio protests mirror those taking place in Wisconsin, where a similar measure has
[01:03.160 --> 01:09.720] been proposed. In Yemen, police shot and killed three people Thursday as tens of thousands
[01:09.720 --> 01:15.920] took to the streets of Aden, calling for an end to President Ali Abdullah Saleh's 32
[01:15.920 --> 01:21.080] years of rule. Three more demonstrators were killed in Taiz Friday, including one from
[01:21.080 --> 01:26.760] a hand grenade. In the capital Sanaa, pro-government forces Thursday attacked student activists

[01:31.840 --> 01:37.000] palace chanting anti-government slogans. Demonstrators' grievances included poverty

[02:43.520 --> 02:47.720] the posts of the internal security forces and the People's Guard and offices of the

[06:28.520 --> 06:58.480] Tonight we have a very special guest for y'all very good friend of mine gentleman named Harman Taylor he was an attorney he's no longer an attorney he's gotten out of the system so to speak and he was an attorney representing family members and survivors of the victims of the Oklahoma City bombing in a litigation that he calls the Terre Haute litigation where they filed suit to try to get a stay for a
[06:58.480 --> 07:28.040] of execution of Timothy McVeigh to preserve evidence for many reasons not only because of knowledge that Timothy McVeigh had but also potential evidence in his body there was a suspicion that he was under some type of mind control possibly from RFID chips or other mechanisms so we're going to discuss this Terre Haute litigation and Harman thank you very much and welcome to the show

[07:30.440 --> 07:52.200] So Harman just start off telling us a little bit about the background that you have of the research in the Oklahoma City bombing and how did you get into this litigation did these people come to you or did you seek them out I mean how were you motivated and driven to get into this case to begin with
[07:52.200 --> 08:20.640] The case started from the trial side what happened at the trial level shook me to the core on the legal analysis side article 3 section 2 article 4 section 2 and the 6th amendment all teach us the same thing there's one state that has jurisdiction of the crime so what happens in the murder building bombing cases
[08:20.640 --> 08:42.880] But they're exported across the state line so that was very upsetting from the beginning wasn't a whole lot of opportunity to participate at the trial first direct opportunity to participate was an amicus brief in the 10th circuit on direct appeal and amicus briefs appellate matters at the federal appellate court aren't really that significant
[08:42.880 --> 09:05.760] It turns out there were at least 5 others to my understanding there were at least 6 briefs asserting essentially the same position there's a problem with the transfer there's no authority in it you can't take a criminal case and export it across the state lines so of course it goes up through the appeal convictions confirmed
[09:05.760 --> 09:23.600] Goes to the Supremes the Supremes don't change anything and so he's on death row where is that terror out in the end they built the facility there and he's sitting there sitting there comes up for execution and some things had happened in the in between
[09:23.600 --> 09:37.360] I had started a website legalreality.com to address certain issues and at the time I started that I was still a constitutionist so I was asserting the constitutional position and why these things can't happen
[09:37.360 --> 09:56.480] The website was where I posted my letter to the president saying if there's ever going to be a review of these constitutional issues you're going to have to allow it so that we can run the appeal through the court through the courts
[09:56.480 --> 10:15.360] And in that exchange of information out on the website there were people directly related to the murder building bombing incident who read the letter and they got in touch with me and communications got around and a couple of the survivors
[10:15.360 --> 10:30.480] Jane Graham who was on the ninth floor and BZ Lawton who was on the eighth floor agreed basically to be spokespersons for the entire group of survivors to go to try to do what we did which was preserve evidence
[10:30.480 --> 10:44.960] Key in the evidence thing here of course is the destruction of the building what's the best evidence of what happened in the Kennedy assassination his body what's the best evidence of what happened in this bombing case the building
[10:44.960 --> 11:03.280] So what happens the building comes down and there's just too much destruction of evidence going on so we've got one more piece of evidence to get the information that McVeigh has there is some theory about whether he had something actually in his body
[11:03.280 --> 11:24.160] And whether or not that was the case there's only one way to find out and that's to preserve the evidence how do you preserve the evidence of someone on death row you stop the execution how do you stop an execution you go to the mainstay of an issue that can be raised anytime subject matter jurisdiction
[11:24.160 --> 11:43.520] So it happens that we had brilliant subject matter jurisdiction challenges to what was going on in the Murrah building bombing what are those article three section two article four section two sixth amendment there's one state that has jurisdiction of the crime
[11:43.520 --> 12:07.360] Okay what state is that Oklahoma one of these cases being tried not only in a federal court homicides of state law matter we can go through article one section eight through all the enumerated subject matters that are there and realize very plainly that there's a whole lot of items subjects for legislation that are not delegated to that system
[12:07.360 --> 12:14.960] Yeah and Harman wasn't even also the case that this federal building wasn't even technically on federal land
[12:14.960 --> 12:33.360] Yes now that's another issue that we raised in a couple of different ways where are we going there what we're distinguishing here is the difference between the article and enumerated subjects and the clause 17 area about what's referred to as exclusive legislative authority
[12:33.360 --> 12:49.520] There's the judicial there's the legislative power to create law of the United States that's what normally comes to mind in article one enumerated subject matter and then there's another role that the congress is supposed to have designed to have
[12:49.520 --> 13:10.880] And that's the role of the cause I state legislative role by which they are the legislative body for land and items related to land owned by that governmental system for example district of Columbia so that's that's one land area
[13:10.880 --> 13:34.480] So let's let's take that path real quick we we have a homicide case normally that state law and in homicide matters instrumentality is completely irrelevant it doesn't matter whether it was paint thinner or a big pen or a shotgun instrumentality doesn't matter except now all of a sudden it matters
[13:34.480 --> 13:48.880] If you're if you successfully murder somebody with an airplane or a bomb that's no longer a state homicide matter that's federal homicide matter so that was that's the cover story for it
[13:48.880 --> 14:12.720] The the reason that the land comes into play is this article three jurisdiction the normal area where everyone thinks to go to look for jurisdiction gives authority to an article three judge to preside over matters that arise under the constitution
[14:12.720 --> 14:35.440] Under the laws of the united states or under the treaties now let's go back to part two laws of the united states how are those made those are made under the subject matters subject items in article one the enumerated subject matters are the ones in which that body called congress
[14:35.440 --> 14:51.280] Theoretically we get to this the rest of the story in a minute but just presume a constitution for now article one enumerated powers are the areas in which the congress has the authority to make what law of the united states
[14:51.280 --> 15:02.560] What does article three address what does an article three judge jurisdiction over a case that involves law of the united states okay
[15:02.560 --> 15:24.320] Outside of that congress does have the authority to legislate matters but that's law of the district that's the exclusive legislative authority so where we don't have the law of the united states at issue why because it's not a law of the united states doesn't go to homicide
[15:24.320 --> 15:46.720] It doesn't get us there so there would be the appearance of federal authority if everything was on that land and then we could come in under the state legislation through congress law of the district if it were on that land if it were federal land if it were united states government land
[15:46.720 --> 16:01.520] Okay so we check in and find out there's never been a title transfer of the property and there was never an act by the state legislature and in this case it would be oklahoma legislature to cede title to united states
[16:01.520 --> 16:04.400] And Harman they also have to cede jurisdiction too
[16:04.400 --> 16:12.240] And that's what happens when they consent to the title transfer they're consenting loss of their authority over that property
[16:12.240 --> 16:12.560] Right
[16:12.560 --> 16:15.360] It's exactly right and neither one of those happen
[16:15.360 --> 16:22.160] Because in the state of texas that document that ceding document actually even has to be signed by the governor
[16:22.160 --> 16:22.560] Okay
[16:22.560 --> 16:40.000] And this was what happened with the burks from air force base technically even if the federal government owned the land which even in that case it didn't but say like the federal government buys land for a post office it still doesn't necessarily mean they have jurisdiction over it
[16:40.000 --> 16:49.360] It's not enough for them to just own the land that the governor has to cede jurisdiction to it too and so that didn't happen in this murrah building case either

[20:15.760 --> 20:22.080] Yeah that whole thing seemed ridiculous to me it should have been in the state court this has never gone to federal court in the first place
[20:22.080 --> 20:25.760] It should have been in the state court it never should have gone to federal court and it should have stayed in oklahoma
[20:25.760 --> 20:34.880] Yes if we had a constitution and if any of those concepts and limitations mattered it should never have been transferred at all
[20:34.880 --> 20:42.640] It should have been the the community victimized by this should have been respected enough to seat the jury
[20:42.640 --> 20:50.800] And we know the real reason why they moved it is because everyone in oklahoma city knew that there was multiple bombs that went off that day
[20:50.800 --> 21:02.320] That's exactly right part of the plan here part of the litigation plan was to demonize mcveigh and thereby justify this this ungodly transfer
[21:02.320 --> 21:10.800] And it's not ungodly it's very self-consistent with the system it's just the system has nothing to do with the constitution
[21:10.800 --> 21:20.720] So here we are talking about whether there's even a case how do they get it there and the land itself was never seated it's not federal lands
[21:20.720 --> 21:30.160] All of this happened on state land no question so we've got a state homicide on state land being tried in federal court
[21:30.160 --> 21:40.560] In in another state in another state this is ridiculous how does how does it so in the in trial court we assert our position
[21:40.560 --> 21:50.400] The trial judge very diplomatically says effectively i don't see it try again so submitted another brief and in that we change gears a little bit
[21:50.400 --> 21:56.400] He's giving a very nice hint you're you're not giving me a case that i can help you with
[21:56.400 --> 22:04.160] So we changed strategy a little bit same time around and said okay if there's no way to stop the execution
[22:04.160 --> 22:13.520] At least let us take his deposition that's called perpetuation of testimony and it's a process
[22:13.520 --> 22:20.800] We cited one rule the seventh circuit of appeal cited three our rule and two more so
[22:20.800 --> 22:27.120] There's a the seventh circuit understood exactly what we're talking about when we go up to the appeal and
[22:27.120 --> 22:34.880] That's part of the thing that gives the padding on the two by four sorry
[22:34.880 --> 22:40.640] But at any rate the the fundamental question was was there a jurisdiction
[22:40.640 --> 22:49.440] We threw article one at them saying this is not homicide we distinguished law of the united states from law of the district
[22:49.440 --> 22:59.200] And law of the district is not the basis for jurisdiction in the article three judges court
[22:59.200 --> 23:05.520] None of it worked none of it worked the trial court dismissed the case
[23:05.520 --> 23:12.000] And the debate was do we even appeal this when it first came out when the trial decision first came out
[23:12.000 --> 23:17.280] The decision was okay there's not really a whole lot left to appeal a lot of communications happen
[23:17.280 --> 23:22.480] It was a very busy weekend no need to get into all those details but i was on the road at the time
[23:23.040 --> 23:30.480] The phone call came with an authority that has very good authority in the area of constitutional law
[23:31.360 --> 23:36.560] And the end of that conversation was this you have about 10 minutes to file your notice of appeal
[23:37.920 --> 23:45.440] It's raining i'm on my way from dallas to houston on the road and so how do you get
[23:45.440 --> 23:53.120] information to the appellate court you get creative stopped off at a truck stop that's very modern
[23:53.120 --> 23:58.080] They had a fax machine i wrote out the notice of appeal by hand remembering everything from the
[23:58.080 --> 24:03.040] case in the case style wrote it out by hand faxed it from the truck stop to the appellate court
[24:03.040 --> 24:08.960] Called them to make sure they got it and they're very nice and the basic thought at the time was
[24:08.960 --> 24:15.120] What took you so long? The lady the person i talked with said we've been waiting on this all day
[24:15.920 --> 24:25.200] So anyway we got it we got the appeal filed and it was that weekend that the appellate court wrote
[24:25.200 --> 24:30.400] The ruling they didn't waste any time on it at all they got on it immediately and all of this
[24:30.400 --> 24:36.000] Information the documents the arguments that we filed at trial and the appellate ruling are

[25:28.960 --> 25:34.960] with us because standing was a huge issue would the survivors of the bombing the actual people who
[25:34.960 --> 25:40.800] were there and are victims of attempted murder because they didn't die do they have standing
[25:40.800 --> 25:47.520] to assert the challenge at all and the seventh circuit said yes they agreed with us a critical
[25:47.520 --> 25:53.120] issue who do we get to advance this and the answer is the victims should be able to do this and they
[25:53.120 --> 25:58.400] did and they agreed with us and the other thing they agreed with us on is the perpetuation of
[25:58.400 --> 26:05.840] testimony side as i mentioned we mentioned one rule in our in our brief and the seventh circuit
[26:05.840 --> 26:12.080] mentioned two more they understood exactly what we are doing they agreed with us and that's where
[26:12.080 --> 26:18.560] the padding is the rest of the padded two by four in other words the two by four is next and to
[26:18.560 --> 26:26.160] summarize that two by four part they characterized as purely constitutional position this way four
[26:26.160 --> 26:35.760] four different ways they categorize this frivolous without merit of no authority and ludicrous we
[26:35.760 --> 26:45.680] argued the constitution frivolous without merit of no authority and ludicrous they cured me at
[26:45.680 --> 26:51.120] that instant when the time i got to the parenthetical that said of no authority there's the third item
[26:51.120 --> 26:56.400] in there by the time i got to that the information went in instantly like the instant absorption
[26:56.400 --> 27:03.200] hand creams or or novocaine it went in instantly and i understood what they were teaching me they
[27:03.200 --> 27:09.920] took the time to teach and they did it immediately the perfect approach because they agreed with us
[27:09.920 --> 27:15.920] on two critical points and then basically communicated fasten your seat belt this is going to be a bumpy
[27:15.920 --> 27:22.320] ride and then they just they just trashed the case frivolous without merit of no authority and
[27:22.320 --> 27:28.480] ludicrous and what do we argue the constitution and so they went beyond the issues this is the
[27:28.480 --> 27:31.920] best thing about it they went beyond the issues they answer the question the question is how
[27:31.920 --> 27:37.360] they will they do this and the answer is it doesn't have a thing to do the constitution
[27:37.360 --> 27:42.160] the lesson here cured me forever of arguing the constitution or thinking the constitution was
[27:42.160 --> 27:48.800] relevant ever again did they say in did they further explain their themselves or did you
[27:48.800 --> 27:54.240] like file up for findings of fact and conclusion at law no all of this is in reflection just
[27:54.240 --> 27:59.360] reading their ruling they they they're really i don't remember four pages three pages wasn't
[27:59.360 --> 28:07.760] four pages three pages wasn't that long wasn't that long and they very clearly documented that
[28:07.760 --> 28:13.920] they didn't like what we were arguing all we argued was constitution and frankly we argued it
[28:13.920 --> 28:21.760] brilliantly if the constitution had mattered if the constitution were relevant then we would have
[28:21.760 --> 28:27.040] popped mcveigh out of jail so fast it had to be spinning to this day well did they say what was
[28:27.040 --> 28:33.040] relevant did we say something about uh they were saying all of this was in proper compliance with
[28:33.040 --> 28:40.560] statute they did their jurisdiction is article uh 18 title 18 section 7 special territorial
[28:40.560 --> 28:46.800] maritime jurisdiction maritime jurisdiction yeah let's go with it section 7 special maritime
[28:46.800 --> 28:53.120] territorial jurisdiction they said under title 18 section 7 maritime jurisdiction we've got the
[28:53.120 --> 28:58.400] authority well that kind of just says it all right there doesn't it it explained everything to me
[28:59.120 --> 29:05.120] it took two months for me to recover from the shock of this it took did they say why they were
[29:05.120 --> 29:10.720] claiming this was maritime jurisdiction nope they didn't get into it they didn't explain it they
[29:10.720 --> 29:17.360] just said it's ludicrous to challenge jurisdiction go look at uh the title 18 section 7 and then they
[29:17.360 --> 29:23.760] you know they explained it it wasn't it wasn't uh a sledgehammer it was a padded two by four but
[29:23.760 --> 29:30.560] they swung true and the the lesson for me and i don't at the time i don't know is anyone else
[29:30.560 --> 29:36.080] in a position to hear it but the lesson to me was you need to start arguing that stuff you need to

[33:05.200 --> 33:11.600] going on here oklahoma then colorado and then they put them in indiana okay and there's a
[33:11.600 --> 33:17.360] direct connection between oklahoma and indiana would you like to know what it is sure the facility
[33:17.360 --> 33:26.080] in which mcveigh was housed is on land transferred in title to the united states government but guess
[33:26.080 --> 33:33.360] what you have to have two pieces it wasn't seated correct legislature of state of indiana never
[33:33.360 --> 33:41.360] transferred title solve that's state land too and how does how does that factor into this it factors
[33:41.360 --> 33:47.920] into it on who you give notice of the suit to if they're doing a non-profit thing in this prison
[33:49.120 --> 33:53.200] then the state attorney general has to be involved in the case because if you don't give notice to
[33:53.200 --> 33:57.920] the right parties state attorney general can show up later and say well you never gave us notice

[34:14.560 --> 34:20.080] these things didn't do either of them in oklahoma and you've got one of them and that was an
[34:20.080 --> 34:26.400] interesting vignette in this whole case getting the documents that prove the title of transfer
[34:26.400 --> 34:32.560] was basically a godsend i've tried to get in touch with that person several times since and they've
[34:32.560 --> 34:42.000] moved and in that same line of uh assistance from friends that sometimes we just never meet
[34:42.000 --> 34:48.480] though we talk with them on the phone or by email there was a huge contribution of research through
[34:48.480 --> 34:57.520] a very well staffed library in indiana and you can you can probably figure out which one
[34:57.520 --> 35:01.840] but it doesn't matter which one the point is someone who understood exactly what the issue
[35:01.840 --> 35:08.480] was spent a lot of time looking through the legislative materials a lot of time conclusion
[35:09.440 --> 35:17.200] no no legislation by state of indiana regarding that property so we have what we needed and you
[35:17.200 --> 35:21.840] know these two contributions coming in from time to time from from friends we'll probably never
[35:21.840 --> 35:28.000] meet any other way and it just made it made the entire case line up correctly we're just banging
[35:28.000 --> 35:33.680] on all eight cylinders anyway that's just another interesting vignette on the case but that facility
[35:33.680 --> 35:38.880] wasn't any more transferred over into title of the united states government completely
[35:38.880 --> 35:43.200] i mean they had the deed for it i can show you the deed i've got a copy of it they'd never had
[35:43.200 --> 35:49.440] legislation so anyway that's another interesting connection here and it's it's why the case is
[35:49.440 --> 35:52.960] dialed the way it is and it's why the people who are served the way they are because you have to
[35:52.960 --> 35:57.600] cover all those bases but we don't know if it's for profit or not for profit system they're running

[36:48.560 --> 36:53.360] was a letter to the president not long after he had taken office there's a little bit time in there
[36:53.360 --> 37:00.640] a lot of transitions go on at the beginning of the the the new system the new administration
[37:00.640 --> 37:06.560] and the letter went out about the earliest it could go out and be treated the way it needed
[37:06.560 --> 37:10.800] to be treated which was with respect and they were treated with very high respect and i'm
[37:10.800 --> 37:17.600] satisfied is because everyone knew ahead of time what was going on that this was possible to

[38:02.000 --> 38:08.240] process server thursday and of course they had followed all that they knew exactly what's going
[38:08.240 --> 38:13.840] on and who was doing what and so it's thursday evening i'm thinking six something eastern time

[38:18.160 --> 38:23.760] a change in the case and that an administrative stay was being issued and that's what happened

[38:30.160 --> 38:35.920] the lawsuit and you can picture around the the death facility got all the journalists out there
[38:35.920 --> 38:41.280] doing the reporting on it oh he's about to get the needle and doing the final story on all that and
[38:41.280 --> 38:48.080] of course they they left someone said oh there's been a lawsuit filed and so the whole camp of
[38:48.080 --> 38:55.200] journalists just emptied out you never heard about it though the case was no no there was some news
[38:55.200 --> 38:59.760] there was we there was one interview and i didn't see it but i'm sure they put it on the tv
[38:59.760 --> 39:09.200] there was a one interview by local tv about the case and that's it all the journalists were
[39:09.200 --> 39:15.680] there as if all of the national media was still on denver all of it none of it transferred over
[39:15.680 --> 39:21.680] to tarot in the end and at first it really upset me and then the case came out and then i reflected
[39:21.680 --> 39:27.840] on the ruling of it and i thought okay they did they did exactly right they did it exactly right

[39:35.280 --> 39:42.480] uh the case went along in this fashion from the beginning the stay was announced actually the day
[39:42.480 --> 39:48.880] before the case was filed case was actually filed on that friday and then it just went through the
[39:48.880 --> 39:54.560] normal process the judge entered so cause order saying i don't get it i just don't i just don't
[39:54.560 --> 39:59.520] say i mean i read everything that you've got and i don't see it so try again so we did more briefs
[39:59.520 --> 40:06.480] and then he dismissed it and then we appealed it and the real lesson the real lesson comes from the
[40:06.480 --> 40:15.680] from the seventh circuit opinion the the details of the issues are a little bit we're going to
[40:15.680 --> 40:21.760] spend a few more minutes here on the actual position there were there are two subject matter
[40:21.760 --> 40:25.920] jurisdiction problems one is the transfer and the other is the source of authority where the
[40:25.920 --> 40:31.120] statute comes from we've hit on that a little bit but let's go a little bit more into the transfer
[40:31.120 --> 40:36.960] because this this is the biggie this is the one where they had to i say they paid them it's just
[40:36.960 --> 40:42.720] an expression they paid the media to demonize mcveigh to justify the transfer and as you've
[40:42.720 --> 40:49.200] already mentioned they had to transfer the case why because a jury pool from oklahoma county
[40:49.200 --> 40:56.160] is going to have personal experience with multiple explosions multiple explosions everyone within
[40:56.720 --> 41:04.560] the tri-state area everyone within the county experienced multiple explosions that even showed
[41:04.560 --> 41:10.960] up on the seismograph equipment you can hear it in the tape there's an audio tape there's a hearing
[41:10.960 --> 41:15.520] in the water resources building going on at the time they had an audio tape going because that's
[41:15.520 --> 41:21.600] how you record the administrative hearings and you hear the multiple explosions in the audio

[52:10.720 --> 52:15.440] seventh circuit's description of this purely constitutional case and they describe it as
[52:15.440 --> 52:20.880] frivolous without merit of no authority the constitution is of no authority and ludicrous
[52:20.880 --> 52:26.160] why because there's no state lines crossed everybody knows that i mean how stupid can you
[52:26.160 --> 52:30.320] be to think there are states there and there's a constitution in the article three section two
[52:30.320 --> 52:35.840] article four section two and sixth amendment relatively just stupid it's ludicrous okay so
[52:35.840 --> 52:42.400] this is the case and it's a padded two by four it's a wicked paradigm shift now now harman this was
[52:42.400 --> 52:47.600] the appellate court that ruled this way correct the trial court dismissed we appealed and the
[52:47.600 --> 52:53.040] seventh circuit actually spent some time teaching us what was really going on and the reason that
[52:53.040 --> 52:59.120] you were saying that you you couldn't file for uh findings of fact and conclusion at law is because
[52:59.120 --> 53:03.360] you can't do that with the appellate courts you can only do that at the trial court correct did
[53:03.360 --> 53:08.800] you guys appeal to the supreme court after that no didn't didn't need to they had already explained
[53:08.800 --> 53:16.000] it and it's too late we could have gone on i'm i'm sure there are people on standby in washington

[55:37.680 --> 55:46.640] this state from the funny money zone then we get a very clear shocking alarming at the time

[56:18.640 --> 56:22.960] it's early sunday morning as i'm recalling i'm thinking maybe seven o'clock on sunday morning
[56:22.960 --> 56:31.120] two-hour show monday they are very nice about it the fbi guy went to the to the video producer's
[56:31.120 --> 56:37.440] studio and said we want the original and all the copies we've never seen that video again well
[56:37.440 --> 56:44.880] well uh harman i heard this i'd heard about this already did the fbi have a warrant for this no
[56:44.880 --> 56:50.000] warrant they just showed up and took it well but why did the video producer didn't have to give
[56:50.000 --> 56:55.360] it to him without a warrant that's true we could have gotten into a hassle about it i mean talk
[56:55.360 --> 57:01.600] about squelching some things called freedom of the press and freedom of speech i mean they talk
