[20:44.400 --> 20:50.400]  So this year is round two, and I'm trying to decide on my strategy.
[20:50.400 --> 20:53.400]  I've only got like two weeks or less than two weeks before the hearing,
[20:53.400 --> 20:58.400]  and I'm trying to decide on the strategy of how to approach this
[20:58.400 --> 21:03.400]  because I know that if you go to the merits, you've lost your jurisdictional challenge.
[21:03.400 --> 21:04.400]  They've got you.
[21:04.400 --> 21:05.400]  I know that if...
[21:05.400 --> 21:11.400]  Okay, well, first thing is have you researched what comparable locations such as yours
[21:11.400 --> 21:15.400]  are actually being taxed in your general area?
[21:15.400 --> 21:17.400]  Actually, no.
[21:17.400 --> 21:21.400]  There's no really comparable things, and I challenged that this last year,
[21:21.400 --> 21:24.400]  and it just went in one ear and out the other.
[21:24.400 --> 21:28.400]  The fact is it's private property, and they have no right to tax it.
[21:28.400 --> 21:30.400]  I have a land patent.
[21:30.400 --> 21:34.400]  They have no right to tax it, but they tax everybody anyway.
[21:34.400 --> 21:37.400]  It's a matter of they don't care.
[21:37.400 --> 21:38.400]  They do it to everybody.
[21:38.400 --> 21:42.400]  Just like municipal ordinances, it only applies to municipal property,
[21:42.400 --> 21:44.400]  but they apply it to everybody.
[21:44.400 --> 21:48.400]  But I don't have their extortion, so I'm fighting,
[21:48.400 --> 21:54.400]  and where I'm at is they automatically go through
[21:54.400 --> 21:58.400]  and put your property in forfeit at the beginning of the year,
[21:58.400 --> 22:01.400]  and then by now it gets to the foreclosure hearing.
[22:01.400 --> 22:04.400]  So we've got a petition to foreclose,
[22:04.400 --> 22:10.400]  and the instructions on how to challenge that is write a written challenge
[22:10.400 --> 22:14.400]  which is an answer which brings you into jurisdiction,
[22:14.400 --> 22:17.400]  or you bring up the merits, it brings you into jurisdiction.
[22:17.400 --> 22:22.400]  So I'm trying to figure out how to challenge jurisdiction
[22:22.400 --> 22:28.400]  and fight this or get what I'm trying to do is win in which way I can,
[22:28.400 --> 22:33.400]  and if I can't stall or hold off or whatever, I can do.
[22:33.400 --> 22:38.400]  But I've got all sorts of possibilities of getting into the federal court
[22:38.400 --> 22:42.400]  or filing a claim against them.
[22:42.400 --> 22:47.400]  There's just so many things I've researched and so many avenues to go.
[22:47.400 --> 22:52.400]  I'm kind of confused right now because the latest thing I've got going
[22:52.400 --> 22:55.400]  is to just stand on jurisdiction.
[22:55.400 --> 22:59.400]  And no, don't just stand on jurisdiction.
[22:59.400 --> 23:02.400]  You've made your jurisdictional claim.
[23:02.400 --> 23:06.400]  Make all of your other claims.
[23:06.400 --> 23:10.400]  Make the record for appeal.
[23:10.400 --> 23:15.400]  These guys who tell people if you go in the court you give them jurisdiction,
[23:15.400 --> 23:18.400]  I want to choke them.
[23:18.400 --> 23:24.400]  You challenge jurisdiction if they rule against you.
[23:24.400 --> 23:29.400]  And you don't make all of your other challenges.
[23:29.400 --> 23:31.400]  You can never bring them up.
[23:31.400 --> 23:35.400]  And if you go to an appeals court and they rule against your challenge
[23:35.400 --> 23:38.400]  to jurisdiction, it's over.
[23:38.400 --> 23:40.400]  You can't bring these other issues.
[23:40.400 --> 23:46.400]  So you cannot live totally in the private.
[23:46.400 --> 23:49.400]  This is not a private world we live in.
[23:49.400 --> 23:55.400]  When you walk outside your home, out onto the street, you're in the public.
[23:55.400 --> 24:00.400]  When you purchase something from the corner store, you're in the public.
[24:00.400 --> 24:08.400]  The stuff about the straw man, it's a crazy metaphor.
[24:08.400 --> 24:11.400]  We are all in the private and in the public.
[24:11.400 --> 24:14.400]  It depends on what we're doing at the time.
[24:14.400 --> 24:19.400]  It's just unreasonable to try to live outside the public.
[24:19.400 --> 24:22.400]  And that's not a problem.
[24:22.400 --> 24:25.400]  You have plenty of tools in the public.
[24:25.400 --> 24:30.400]  A major jurisdictional challenge, if they don't have jurisdiction,
[24:30.400 --> 24:35.400]  nothing you can do will give them jurisdiction, period.
[24:35.400 --> 24:38.400]  We're talking subject matter jurisdiction here.
[24:38.400 --> 24:43.400]  In personum jurisdiction, if you've made your challenge,
[24:43.400 --> 24:47.400]  you still have the challenge available for appeal.
[24:47.400 --> 24:49.400]  It's not over yet.
[24:49.400 --> 24:52.400]  Make all of your other challenges.
[24:52.400 --> 24:57.400]  Fight them like a tiger. Give them no quarter.
[24:57.400 --> 25:00.400]  So you have all your other challenges available.
[25:00.400 --> 25:04.400]  And give them opportunity to violate more law so you can file against them
[25:04.400 --> 25:06.400]  and countersue against them personally.
[25:06.400 --> 25:09.400]  If they want to fight, take the fight back to them.
[25:09.400 --> 25:12.400]  That's another thing I've been wanting to,
[25:12.400 --> 25:17.400]  desperately looking for the right cause of action that I can prove.
[25:17.400 --> 25:23.400]  I can put together one heck of an argument against them for, you know,
[25:23.400 --> 25:27.400]  charges against them for all sorts of things.
[25:27.400 --> 25:38.400]  But the smoking gun that'll get them on a, you know, I just, it's eluded me.
[25:38.400 --> 25:40.400]  I mean, in Florida, I've got a friend, you know,
[25:40.400 --> 25:44.400]  we've got a mutual friend in Florida, Orlando Steve.
[25:44.400 --> 25:46.400]  He doesn't pay property taxes.
[25:46.400 --> 25:49.400]  One of his other friends, he's helped get out of property taxes
[25:49.400 --> 25:51.400]  because it's their residence.
[25:51.400 --> 25:53.400]  Your home can't be taxed.
[25:53.400 --> 25:55.400]  Well, this is my home.
[25:55.400 --> 25:59.400]  But it's registered as commercial property.
[25:59.400 --> 26:00.400]  But it's not.
[26:00.400 --> 26:02.400]  It's not income-generating property.
[26:02.400 --> 26:04.400]  It's not commercial.
[26:04.400 --> 26:07.400]  It's my store, but there's no profit.
[26:07.400 --> 26:09.400]  There's no income.
[26:09.400 --> 26:16.400]  Technically not, but they've classified it as they see fit,
[26:16.400 --> 26:21.400]  and their assessor assessed me three times the value from day one.
[26:21.400 --> 26:27.400]  Instead of taking the actual true cash value and 50% of that,
[26:27.400 --> 26:33.400]  they tripled what I paid for it and then cut that in half.
[26:33.400 --> 26:36.400]  Okay, we got that part.
[26:36.400 --> 26:42.400]  Do you have a litigation guide for Michigan?

[37:32.400 --> 37:42.400]  for the kind of things that the lenders are doing and see if you can't find a pleading
[37:42.400 --> 37:45.400]  that's on a case similar to yours.
[37:45.400 --> 37:52.400]  You have to go down to the court and look in the court record for other cases that are in there.
[37:52.400 --> 37:55.400]  When I first started doing legal research, that's how I did it.
[37:55.400 --> 37:59.400]  I'd go down to the court and start going through court records
[37:59.400 --> 38:02.400]  and I'd look for the thickest ones I could find
[38:02.400 --> 38:05.400]  because generally those are the ones fought hard.
[38:05.400 --> 38:08.400]  And look what the attorneys did.
[38:08.400 --> 38:11.400]  I found some really interesting stuff in there.
[38:11.400 --> 38:12.400]  Okay.
[38:12.400 --> 38:17.400]  So you might go look at unlawful detainer court records.
[38:17.400 --> 38:22.400]  Look through their records and see what the attorneys have filed.
[38:22.400 --> 38:23.400]  Okay.
[38:23.400 --> 38:26.400]  So what should I expect at the hearing?
[38:26.400 --> 38:28.400]  Are they going to try to throw me out?
[38:28.400 --> 38:29.400]  Yeah.
[38:29.400 --> 38:33.400]  You can expect them to rule against you, especially if you go ahead and pro se.

[50:37.400 --> 50:52.400]  Once you get discovery, then you discover all of this stuff and your suit becomes a lot bigger than the JP court, so you dismiss the JP court suit and then file in the district court.

[50:53.400 --> 50:58.400]  It's a lot easier and cheaper to file in the JP court and then send them discovery immediately.

[51:00.400 --> 51:07.400]  If that will stop them, that will keep them from erasing the security tapes.

[51:11.400 --> 51:13.400]  And prepare criminal charges against them.
[51:13.400 --> 51:21.400]  The only way we're going to stop these guys, the only way we're going to bring our police back is to let them know that we're the baddest motor school in the building.

[51:25.400 --> 51:36.400]  You better be more worried about the starboard citizen being upset about you because he's the one that gets you and your boss both fired or in jail.

[51:44.400 --> 51:57.400]  Whenever you go – well, I don't know your status or your license or anything, but whenever you go to a courthouse, do the cops bother you about that issue or not?

[52:02.400 --> 52:04.400]  There's a routine to go through.
[52:04.400 --> 52:08.400]  Generally, I suggest you never go to the courthouse.

[52:10.400 --> 52:32.400]  As you make up a criminal complaint against these guys with a statement of probable cause and you mail it to the district attorney, all right, you put together a verified criminal complaint and a verified statement of probable cause.
[52:32.400 --> 52:41.400]  You can look through the criminal records and find – they'll all have criminal complaints. If you can't find a complaint, get that information.
[52:41.400 --> 52:50.400]  The information looks just like a complaint except it says information is two complaints and that will show you the form.
[52:50.400 --> 52:51.400]  Okay.
[52:51.400 --> 53:02.400]  Make up a complaint, take it to a notary, have it notarized, make up your statement, have it notarized, and send those to the district attorney.
[53:02.400 --> 53:03.400]  Okay.
[53:03.400 --> 53:07.400]  District attorney will absolutely refuse to act on them.
[53:07.400 --> 53:08.400]  Okay.
[53:08.400 --> 53:20.400]  They can make a criminal complaint against the district attorney for obstruction of justice and misfeasance in office or official misconduct.
[53:20.400 --> 53:21.400]  Right.
[53:21.400 --> 53:25.400]  And send those to a district judge.
[53:25.400 --> 53:27.400]  He's going to refuse to act on it.
[53:27.400 --> 53:35.400]  He's not going to move to prosecute his prosecutor for exercising prosecutorial discretion.
[53:35.400 --> 53:51.400]  Then you file and make up criminal complaints against the judge for failing to act with his capacity as a magistrate. That's official apportion denying your right to petition the court for redress of grievance. Send that to the grand jury.
[53:51.400 --> 53:55.400]  The only address you have for the grand jury is the district attorney's office.
[53:55.400 --> 54:06.400]  So you put form in the grand jury and the district attorney's address, send it restricted, send it registered restricted.
[54:06.400 --> 54:09.400]  So only the person's name who's on it can sign for it.
[54:09.400 --> 54:14.400]  Well, the guy in the mail room will sign for it and give it to the district attorney.
[54:14.400 --> 54:19.400]  And when the district attorney opens it, he's going to realize you set him up.
[54:19.400 --> 54:25.400]  He's got somebody who knows how to kick him in the teeth.
[54:25.400 --> 54:34.400]  And then when you fail to hear from that, then you may want to go down there or file a civil action against him.
[54:34.400 --> 54:36.400]  Okay.
[54:36.400 --> 54:46.400]  By that time, I think things will start to get pretty hot and you want to look at putting together a civil action against these individuals.
[54:46.400 --> 54:53.400]  Most likely, prosecutors are going to go to these guys or to the mall and say, you guys better do something.
[54:53.400 --> 54:58.400]  This guy is P-O-N, the district judge.
[54:58.400 --> 55:04.400]  The district judge is unhappy because this guy is trying to get the district judge indicted,
[55:04.400 --> 55:09.400]  trying to get him indicted because I wouldn't arrest you guys.
[55:09.400 --> 55:14.400]  Do something, make this go away.
[55:14.400 --> 55:20.400]  Let them come to you and say, let's make a deal.
[55:20.400 --> 55:23.400]  Make a deal with them, get in their pockets.
[55:23.400 --> 55:25.400]  It's all about the money.

[55:27.400 --> 55:29.400]  It's about them having to give up the money.

[01:25:11.400 --> 01:25:13.400]  and ensure the safety of the officer.

[01:25:19.400 --> 01:25:25.400]  He must get the person before a magistrate for an examination.
