[00:00.000 --> 00:09.680] In Brazil, at least 640 people have died from floods and landslides that have wiped out
[00:09.680 --> 00:13.560] much of the Serrano region of Rio de Janeiro state.
[00:13.560 --> 00:19.200] State Governor Sergio Cabral, Sunday, decreed a state of calamity after new landslides caused
[00:19.200 --> 00:24.680] more deaths and blocked more roads, complicating rescue efforts and the transport of basic
[00:24.680 --> 00:29.680] provisions to many still stranded without food and water.
[00:29.680 --> 00:35.280] The French government suspects former Tunisian President Zine El Abidine Ben Ali and his
[00:35.280 --> 00:39.840] family may have fled the country with 1.5 tons of gold.
[00:39.840 --> 00:45.240] According to the French secret service, Leila Trabelsi, wife of the ex-president, went to
[00:45.240 --> 00:49.680] the central bank of Tunisia to fetch the 60 million dollars in bars.
[00:49.680 --> 00:55.120] The governor of the bank refused but caved under pressure from the president.
[00:55.120 --> 00:59.280] Three US troops were killed in two separate attacks in Iraq Saturday.
[00:59.280 --> 01:04.280] In the first, two men were killed by an Iraqi soldier who smuggled real bullets into a training
[01:04.280 --> 01:05.280]  exercise.
[01:05.280 --> 01:10.440] A US military official said the killer was immediately shot dead by US soldiers.
[01:10.440 --> 01:15.240] Another US soldier was killed during an unrelated military operation, making one of the deadliest
[01:15.240 --> 01:18.240] days for US forces in months.
[01:18.240 --> 01:24.680] BP announced plans Friday to drill in the Arctic, one of the last unspoiled wildernesses
[01:24.680 --> 01:25.680]  on earth.
[01:25.680 --> 01:31.040] Environmentalists are dismayed that BP has decided to set up rigs in an area of great
[01:31.040 --> 01:34.000] biodiversity and treacherous weather conditions.
[01:34.000 --> 01:39.520] The region is one of the few remaining havens left for a number of endangered species, including
[01:39.520 --> 01:46.960] polar bears, walruses, beluga whales and fish such as halibut, capelin and arctic cod.
[01:46.960 --> 01:52.320] Mike Childs of Friends of the Earth said BP a number of years ago was positioning itself
[01:52.320 --> 01:57.200] to be the greenest of the oil companies, promising to go, quote, beyond petroleum.
[01:57.200 --> 02:03.120] Childs added, this latest move positions them quite nicely as environmental villain number
[02:03.120 --> 02:06.800] one, given the huge impact they had in the Gulf of Mexico.
[02:06.800 --> 02:12.600] The World Wildlife Fund says BP's oil response plans are even less adequate than they were
[02:12.600 --> 02:15.480]  in the Gulf.
[02:15.480 --> 02:20.560] The New York Times reported Saturday US and Israeli intelligence services collaborated
[02:20.560 --> 02:26.160] to develop a computer worm that sabotaged Iran's efforts to make a nuclear bomb.
[02:26.160 --> 02:31.540] The Times quoted intelligence and military experts as saying Israel had tested the effectiveness
[02:31.540 --> 02:37.400] of the Stuxnet computer worm which shot down one-fifth of Iran's nuclear centrifuges in
[02:37.400 --> 02:41.800] November and helped delay its ability to make its first nuclear weapon.
[02:41.800 --> 02:47.260] The Times said the testing took place at Israel's Dimona complex in the Negev desert, housing
[02:47.260 --> 02:49.880] its undeclared nuclear weapons program.
[02:49.880 --> 02:56.880] The effort to create Stuxnet was a US-Israeli project with the help of Britain and Germany.
[03:19.880 --> 03:27.780] Bad boys, bad boys, whatcha gonna do Bad boys, bad boys, whatcha gonna do
[03:49.880 --> 04:09.680] Good evening folks. This is Rule of Law Radio. It is Monday night, January 17, 2011. This
[04:09.680 --> 04:16.880] is Eddie Craig, Deborah Stevens. This is our Monday night traffic night show. I do not
[04:16.880 --> 04:20.780] have a lot of material to present this evening. I would like to go ahead and start taking
[04:20.780 --> 04:25.880] phone calls if we have any pretty quickly. But there are several things that I have been
[04:25.880 --> 04:31.520] researching this week and one of those is one of our favorite judges down at the municipal
[04:31.520 --> 04:37.420] court. The one that was sitting at trial in Mike Handel's case and the one that is sitting
[04:37.420 --> 04:45.000] at trial in another case that I am helping with and this is Judge Sherry Statman. Now
[04:45.000 --> 04:52.120] the research I have got shows that the associate judges of the Austin Municipal Court are
[04:52.120 --> 05:02.160] being paid in excess of $101,000 per year for their activities. Now another interesting
[05:02.160 --> 05:12.480] note to this is that Sherry Statman is an associate with one of the law firms in Austin.
[05:12.480 --> 05:17.880] The law firm is Rothgarry. I do not have the full name in front of me here, but it is Rothgarry
[05:17.880 --> 05:24.880] and something. But needless to say, it is kind of odd that we have someone that is also
[05:24.880 --> 05:36.200] a private practicing attorney that is drawing $101,000 a year salary from the city. That
[05:36.200 --> 05:40.840] is kind of having your cake and eating it too in my personal opinion. And it would also
[05:40.840 --> 05:46.760] seem to indicate that there is the possibility of conflicts of interest arising out of this,
[05:46.760 --> 05:52.460] especially if she is presiding over individuals or other things that have a direct association
[05:52.460 --> 06:00.040] with her particular law firm. Granted the law firm says that it is involved directly
[06:00.040 --> 06:10.040] in medical types of practice and her specialty is medical and administrative law. But needless
[06:10.040 --> 06:16.080] to say, there is more to this than meets the eye. But in any case, the reason I bring her
[06:16.080 --> 06:25.960] up is this. We have a lot of pull over this judge at the moment as far as possibly costing
[06:25.960 --> 06:31.680] her her position down at the municipal court. And for those of you that have been following
[06:31.680 --> 06:40.000] the story on Mike's TSA case, let's explain that just a little bit. This magistrate gave
[06:40.000 --> 06:49.300] direct, very clear and specific orders on both dates of Mike's trial that absolutely
[06:49.300 --> 06:59.600] no media personnel of any kind were to be allowed access to her courtroom. Now, I did
[06:59.600 --> 07:06.120] not attend Mike's trial in the capacity of a media anything. I attended it as a court
[07:06.120 --> 07:11.800] watcher, I attended it as a member of the public, and I attended it as someone there
[07:11.800 --> 07:19.960] in support of Mike during the trial. So had the judge attempted to remove me from the
[07:19.960 --> 07:24.760] court or hold me in contempt, we would have had a whole new fight on our hands about what's
[07:24.760 --> 07:31.760] going on down there. But on the last day of the trial, she did state very clearly while
[07:31.760 --> 07:39.120] staring directly at me that if there is any media present in my courtroom, you run the
[07:39.120 --> 07:46.160] risk of being held in contempt of court if you are still here when the jury enters. Now,
[07:46.160 --> 07:52.440] me being me, I ignored her, I sat there. I was not getting up and I was not going to
[07:52.440 --> 08:00.080] leave. Now, moments before the jury came in, however, an actual news reporter did show
[08:00.080 --> 08:09.160] up from YNN, which has just became YNN from Austin News 8, I believe is what the station
[08:09.160 --> 08:18.040] was, and it is now YNN News. Now, he comes in, and as soon as Mary starts speaking with
[08:18.040 --> 08:26.240] him and makes it known that he is with the media, one of the city marshals, Mr. Hort
[08:26.240 --> 08:33.280] Hay Rodriguez, I believe his name is, upon direct order of the judge prior to this, asked
[08:33.280 --> 08:38.640] him if he would step out of the hall and speak to him. And this reporter was immediately
[08:38.640 --> 08:47.520] informed he was not to have access to the courtroom. Now, on top of this, the reporter,
[08:47.520 --> 08:54.080] Mr. John Salazar, asked him if he is absolutely certain that that was the judge's instructions.
[08:54.080 --> 08:58.840] The city marshal was very clear, oh, yes, that's her instructions. So Mr. Salazar asked
[08:58.840 --> 09:06.040] him to go check again, and the city marshal did so. He came right by us in the courtroom,
[09:06.040 --> 09:09.800] went straight over to the door leading into the judge's chambers, and came right back
[09:09.800 --> 09:15.920] out, went back out in the hallway, and proceeded to inform Mr. Salazar he could not enter the
[09:15.920 --> 09:23.200] courtroom. Now, this, of course, upset Mr. Salazar. It would upset anybody that knows
[09:23.200 --> 09:30.800] that all trials in Texas are to be held publicly, and that no one may be excluded from the court,
[09:30.800 --> 09:39.480] especially the press, unless the court can show that individual has caused a disruption
[09:39.480 --> 09:47.040] or impedes the ability of the court to function. That's the only time they can be excluded.
[09:47.040 --> 09:51.160] But she had given a blanket order that no media personnel were to be allowed in her
[09:51.160 --> 09:59.200] court. Now, Mr. Salazar then proceeded to get in touch with a district judge here in
[09:59.200 --> 10:07.800] Austin who immediately made the proclamation that she's crazy. Who's in charge over there?
[10:07.800 --> 10:15.280] Have them call me. So Mr. Salazar informed the judge that it was Evelyn McKee, who is
[10:15.280 --> 10:22.400] the head presiding judge over the municipal court. And the conversation that was transferred
[10:22.400 --> 10:31.640] to me by Mary while she was on the phone talking to him is this. The reporter, Mr. Salazar,
[10:31.640 --> 10:42.560] received an email from the judge stating, my people did not properly follow the instructions
[10:42.560 --> 10:54.520]  I gave. They misunderstood. That's not what I meant. So I apologize for my personnel's
[10:54.520 --> 11:03.000] lack of understanding. Now, let me be frank and clear here. There was absolutely no lack
[11:03.000 --> 11:13.520] of understanding. This judge was absolutely clear in her instructions. But this same judge
[11:13.520 --> 11:20.800] is now setting up these same city marshals that followed her instructions and the court
[11:20.800 --> 11:29.680] clerks to be thrown under the bus to save her behind. Why? Because what she did was
[11:29.680 --> 11:41.360] patently illegal and it is absolutely unconstitutional in Texas. So now the very people that she
[11:41.360 --> 11:51.840] ordered to violate these rules and laws, she's now going to sacrifice to save herself. So
[11:51.840 --> 11:57.600] I have requested that Mr. Salazar send me a copy of the email that the judge sent him
[11:57.600 --> 12:04.880] stating that that was not her intent and that these city personnel had not properly followed
[12:04.880 --> 12:11.520] or implemented her exact instructions. Now, the reason for this is simple. I would like
[12:11.520 --> 12:16.040] to take a copy of this email down there and show it to these city marshals and ask them
[12:16.040 --> 12:24.640] directly what they think about being put up on the sacrificial altar by this judge after
[12:24.640 --> 12:33.000] the judge ordered them to do this thing. And then once she was brought to task for it,
[12:33.000 --> 12:40.040] trying to lay the blame on their shoulders. And that's what they did or she did anyway.
[12:40.040 --> 12:45.600] So I would really like to get their response to this. But I don't want to just go down
[12:45.600 --> 12:51.960] and make the accusation. I want to have the email that shows this is exactly what she
[12:51.960 --> 13:01.360] did. Now, folks, if these judges down here are willing to just blow off the law and say
[13:01.360 --> 13:07.960] it doesn't apply in my courtroom whenever it suits them, do you honestly think these
[13:07.960 --> 13:15.280] judges have a care in the world for depriving you of your due process rights? They don't.
[13:15.280 --> 13:20.200] I don't care how nice they are. I don't care how much they act like they're trying to help
[13:20.200 --> 13:27.400] you in court. They will do whatever suits them based upon how they feel at any given
[13:27.400 --> 13:33.720] moment. If they're in a bad mood, you're going to suffer for it. If they're in a good
[13:33.720 --> 13:40.560] mood, oh, they'll treat you nice and fair today. No one should have to go to court guessing
[13:40.560 --> 13:47.160] what mood the neutral arbiter is supposed to be in so that they can get a fair trial.
[13:47.160 --> 13:53.320] Either the judge obeys the law and does what is required in accordance with that law or
[13:53.320 --> 14:00.360] they don't. And when they don't, we should come down on them with hobnail boots kicking,
[14:00.360 --> 14:07.080] screaming, and stomping for all we're worth. How do we do that? In this case, it's very
[14:07.080 --> 14:14.640] simple. We are going to prepare a judicial conduct complaint, several, in fact, against
[14:14.640 --> 14:21.400] Judge Statman. And since Judge Statman is also a bar card carrying attorney, we are
[14:21.400 --> 14:28.720] going to prepare bar grievances that match the judicial conduct complaints. And all told,
[14:28.720 --> 14:36.720] there will be about nine of each for specific violations of law, specific violations of
[14:36.720 --> 14:46.800] the right of due process, and specific violations of the right to a public trial. Okay? So once
[14:46.800 --> 14:53.000] we get this written up, anyone out there, just like a criminal complaint, anyone out
[14:53.000 --> 14:59.280] there that believes that this is what happened, send me an email. I will send you copies of
[14:59.280 --> 15:06.240] the bar grievances and the judicial conduct complaints. You can sign your name to it and
[15:06.240 --> 15:14.560] you can file it as well. Let's start the new year off right with one less self-serving
[15:14.560 --> 15:22.400] judge in the Austin Municipal Court. We can do this if we do it by the numbers and we
[15:22.400 --> 15:27.800] do it together. Nobody is going to be able to ignore a delusion of complaints against
[15:27.800 --> 15:33.680] this judge for her activities. And I would also highly recommend that you package all
[15:33.680 --> 15:40.320] of those up as you send them in to the individual judicial conduct committee and the state bar
[15:40.320 --> 15:49.560] and send copies of that to the mayor of Austin and to the city manager. Let them all see
[15:49.560 --> 15:57.920] that we're sick and tired of this. This is what we've got to do. This is how we're going
[15:57.920 --> 16:06.720] to regain control of our justice system by getting the unjust out of it. Nobody can do
[16:06.720 --> 16:13.360] it but us, folks. Now, before we go to break, which should be here in just a couple of minutes,
[16:13.360 --> 16:17.760] I just want you folks to know that this coming Saturday, we're going to be holding another

[16:24.880 --> 16:32.440] to be continuing with the one that we just did regarding how to go to court, lay foundation,

[19:27.480 --> 19:52.600] Alright folks, we are back. Rule of Law Radio. This is Eddie Craig, Debra Stevens. Okay,
[19:52.600 --> 19:58.560] we have a couple of folks on the caller board. Right now we have C.J. in Texas. C.J., what
[19:58.560 --> 19:59.560] can we do for you?
[19:59.560 --> 20:06.200] Hi Eddie. Well first, it can't be said enough. Thank you guys for what you do for the whole
[20:06.200 --> 20:11.640] network, for Debra, for what you guys do on this show. You have taught me so much. I'm
[20:11.640 --> 20:18.920] winning an eviction on my own without a lawyer. Thanks to you guys. What I'm calling about
[20:18.920 --> 20:27.160] right now, I called actually a month or two ago about smart meters. A smart meter was
[20:27.160 --> 20:35.440] – well, they were trying to install a smart meter on my house and I wouldn't let them.
[20:35.440 --> 20:41.520] And let's see, I think – oh, they were threatening to turn off my electricity, which
[20:41.520 --> 20:48.640] is illegal under the PUC rule. This is all Texas law I'm talking about.
[20:48.640 --> 20:56.080] And so I ended up, out of sheer desperation, I found the CEO's home phone number and
[20:56.080 --> 21:06.240] called him and within an hour that disconnection threat was gone. But they have continued and
[21:06.240 --> 21:15.680] I ended up filing for a restraining order because they were going to file one against
[21:15.680 --> 21:23.920] me. One thing I've discovered through all this is that the legislature put a nice little
[21:23.920 --> 21:31.440] loophole – or special treatment maybe is the better word, better phrase – in the
[21:31.440 --> 21:37.720] utilities code there's a statute that says something to the effect of them. If someone
[21:37.720 --> 21:45.440] is going to intimidate, harass, and threaten utility employees or might intimidate, harass
[21:45.440 --> 21:52.400] or threaten utility employees for the sake of not letting them maintain their equipment,
[21:52.400 --> 21:59.680] that would be the relevant part in this situation. They can get a temporary restraining order
[21:59.680 --> 22:10.840] to keep you from intimidating, harassing, and threatening the employees. It's worded
[22:10.840 --> 22:16.640] as a restraining order means to maintain the status quo, but it actually acts as what's
[22:16.640 --> 22:21.120]  called a mandatory injunction, which means they're mandating – they're forcing you
[22:21.120 --> 22:29.240] to do something. Because if you can't stop them from coming on your property, that's
[22:29.240 --> 22:34.320] basically allowing them to do something you don't want them to do. So they were real
[22:34.320 --> 22:43.400] fly about that. And, of course, this happens without due process because a TRO is done
[22:43.400 --> 22:50.680] without notice, without notice to the other party. So if the electric company filed against
[22:50.680 --> 22:57.520] me, I would get no notice, this thing would be issued, and I would have no say, no due
[22:57.520 --> 23:06.360] process whatsoever. So I filed against them first, and I figured out how to do it. I wasn't
[23:06.360 --> 23:14.200] too sure back when I talked to you the first time. But the TRO, for me, the TRO was denied,
[23:14.200 --> 23:20.520] but a temporary – it goes, as I'm sure you know, but for the other listeners, it
[23:20.520 --> 23:25.840] goes temporary restraining order, which is the one without notice. You have a certain
[23:25.840 --> 23:32.800] burden of proof that you will suffer irreparable harm and things like that. And then within
[23:32.800 --> 23:39.000] 14 days, you have to have a hearing so that the other party can respond to see if that
[23:39.000 --> 23:42.960] temporary restraining order should continue. And that's called the temporary injunction
[23:42.960 --> 23:48.840] part of it. But then you have to have an underlying case. And in this case, it would be a permanent
[23:48.840 --> 23:57.320] injunction. And I also asked for declaratory relief, which means that basically I can't
[23:57.320 --> 24:02.800] find any law that forces them – that allows them to force me to take installation of the
[24:02.800 --> 24:16.200] meter. They tried to give me some, and it was bogus. So anyway, the TRO for me was denied.
[24:16.200 --> 24:24.680] The temporary injunction hearing is on January 28th. And if I don't get past that, I probably
[24:24.680 --> 24:33.680]  won't even get a determination about the legalities underlying it. I started a website
[24:33.680 --> 24:41.960] called Bandsmartmeters.com, where I – probably by tomorrow I will put up all the documents.
[24:41.960 --> 24:49.560] I just got the electric company's answer and counterclaim, which basically is the TRO.
[24:49.560 --> 24:53.800] I was just telling you – or the temporary injunction against me forcing me to allow
[24:53.800 --> 25:02.480] them to install the meter. It's completely devoid of – they make certain arguments
[25:02.480 --> 25:07.720] that the court doesn't have jurisdiction because the PUC has the jurisdiction, yet
[25:07.720 --> 25:13.680] there's no citation. They do a lot of song and dance is what they do. Like, look right
[25:13.680 --> 25:19.040] here so you don't actually focus on the actual issue that they don't have anything to back
[25:19.040 --> 25:28.360] them up. The lies that they have told about me, which everything is on video. All my interactions
[25:28.360 --> 25:35.280] with them are on video, so that should be interesting. But anyway, I started that website
[25:35.280 --> 25:40.200] so that – I'm doing this without a lawyer, of course, if I can't afford one. And thanks
[25:40.200 --> 25:52.000] to you guys, I actually have a fighting chance of actually sounding competent anyway. And
[25:52.000 --> 26:00.560] it would be most helpful if people could come to that injunction hearing for media attention
[26:00.560 --> 26:08.640] as well as to show the judge this isn't just some dumb poor indigent pro se that you can
[26:08.640 --> 26:16.440] just ignore at the expense of this big monopoly company. It's about an hour's drive from
[26:16.440 --> 26:25.480] Austin. I know you've heard a lot of places, but – and I'm going to put the information
[26:25.480 --> 26:32.840] on Bansmartmeters.com. I think that's about all I was going to cover at the moment. Do
[26:32.840 --> 26:44.520] you have any suggestions or any advice on the temporary injunctions? I'm getting what
[26:44.520 --> 26:50.440] evidence I can in open records, certified documents, open records. I can't afford any
[26:50.440 --> 26:55.000] expert witnesses or anything to show that – I have to show irreparable harm for this
[26:55.000 --> 27:01.080] temporary injunction to be granted so that I can go ahead to the actual trial of the
[27:01.080 --> 27:06.400] – you know, determining what the law is on this. And what are you making as your argument
[27:06.400 --> 27:14.280] for irreparable harm? The fires that have occurred because of these smart meters, the
[27:14.280 --> 27:21.120] illnesses that people are reporting short term, you know, almost immediately as a result
[27:21.120 --> 27:28.680] of these meters, the enormous price increases that some people are reporting. Well actually
[27:28.680 --> 27:33.840] that's been the only news story in Texas. Oh yeah, I know when they first put one of
[27:33.840 --> 27:41.560] those on my business meter out there, my bill almost tripled. Well, you want to be a witness?
[27:41.560 --> 27:48.240]  I don't – I don't know if I could, but I can certainly testify that I've seen it
[27:48.240 --> 27:56.120] happen. Well, that's what, aside from expert witnesses and the other evidence, I could
[27:56.120 --> 28:02.560] use witnesses who say, yes, my bill tripled or my bill doubled. And I'm going to be contacting
[28:02.560 --> 28:07.400] people who have been on the news in the local area, see if they'll come and testify just
[28:07.400 --> 28:11.720] that yes, it happened. I don't know why it happened. They don't know why it happened.
[28:11.720 --> 28:18.520] But it happened, and it would kill me financially. I mean, that – I couldn't do it, you know?
[28:18.520 --> 28:23.680] Yeah, that's true. There was a gentleman here in Texas who – his electric bill the
[28:23.680 --> 28:29.520] first month after the meter was installed, he normally ran a little over, I think he
[28:29.520 --> 28:35.320] said $130 a month. The very first month after the meter was installed, he was sending an
[28:35.320 --> 28:42.280] electric bill for over $11,000. Whoa. Now, wait a minute. I have a question here on the
[28:42.280 --> 28:47.200] showing of irreparable harm. This seems to be backwards from everything that I've learned
[28:47.200 --> 28:53.480] up until this point. I know for sure at the federal level, the person asking or the entity
[28:53.480 --> 29:00.680] requesting the TRO is the entity that has to show irreparable harm if the court does
[29:00.680 --> 29:07.000] not grant the TRO. Now, you're the one who has an – they're trying to get an injunction
[29:07.000 --> 29:12.520] against you. Why are you the one having to show irreparable harm if the court grants
[29:12.520 --> 29:16.360] it? That seems opposite from what – the way I understand TROs.
[29:16.360 --> 29:21.480] No, she actually filed first, trying to prevent them from filing against her.
[29:21.480 --> 29:22.480]  Right.
[29:22.480 --> 29:25.560] So that's why she's having to show she filed first.
[29:25.560 --> 29:30.040] But aren't they the ones seeking a TRO against her?
[29:30.040 --> 29:31.680]  Not yet. They have.
[29:31.680 --> 29:34.200]  Oh, okay. I understand. I understand.
[29:34.200 --> 29:35.560]  No, actually they are.
[29:35.560 --> 29:37.680]  And now they are?
[29:37.680 --> 29:43.680] They are as a part of – I put in my original petition. That's what starts the whole –
[29:43.680 --> 29:48.160] Okay. Wait a minute. Hold on. Stay there, C.J. We'll get right back to you on the
[29:48.160 --> 29:53.400] other side of the break. Okay. We've also got Craig in Texas, Terry in Michigan. So
[29:53.400 --> 29:57.160] if you all would sit tight, we'll be right back on the other side. This is the rule of
[29:57.160 --> 29:58.160]  law.
[29:58.160 --> 30:05.400] Come down and enjoy Austin's own piece of the Caribbean, right on the banks of the Colorado

[30:29.520 --> 30:37.840] Do you drink bottled water? Even those BPA-free plastic containers and metal water bottles
[30:37.840 --> 30:41.360] could be putting your health at risk. I'm Dr. Catherine Albrecht. I'll be back in a
[30:41.360 --> 30:46.360] moment with three reasons why you may want to switch to a newfangled glass water bottle.
[30:46.360 --> 30:51.680] Your search engine is watching you, recording all your searches and creating a massive database
[30:51.680 --> 30:57.560] of your personal information. That's creepy. But it doesn't have to be that way. StartPage.com
[30:57.560 --> 31:02.080] is the world's most private search engine. StartPage doesn't store your IP address, make
[31:02.080 --> 31:06.280] a record of your searches or use tracking cookies and they're third party certified.

[31:16.120 --> 31:20.360] If you're looking for a healthy alternative to plastic water bottles that contain the
[31:20.360 --> 31:27.040] chemical bisphenol A or BPA, here are three reasons to consider glass. BPA-free or not,
[31:27.040 --> 31:31.480] plastic water bottles don't release other chemicals. Metal water bottles often have
[31:31.480 --> 31:35.840] plastic liners and many are made in China, which worries people like me who know that
[31:35.840 --> 31:40.560] country's history with tainted products. Finally, metal containers can leach and leave
[31:40.560 --> 31:45.360] a metallic taste in the water. Yuck. Water from glass bottles tastes great naturally
[31:45.360 --> 31:49.280] with no chemicals. And if you're worried about broken glass, the new bottles are made of
[31:49.280 --> 31:55.000] resilient tempered glass and many have rubberized protective covers. I'm Dr. Katherine Albrecht.
[31:55.000 --> 32:24.400] For more news and information at KatherineAlbrecht.com.
[32:55.000 --> 33:06.720] Okay folks, we are back. We're talking with CJ. Okay CJ, so you are the one that is seeking
[33:06.720 --> 33:12.600] an injunction or are they seeking an injunction too? I'm a little bit confused here.
[33:12.600 --> 33:19.360] Yes, I filed the original petition which makes me the plaintiff and in that I asked for a
[33:19.360 --> 33:25.560] temporary injunction, which means I have to prove that I will suffer irreparable harm,
[33:25.560 --> 33:30.000] like you said, if they don't grant that injunction. Right, now I was talking with Eddie on the
[33:30.000 --> 33:36.400] break. You know, the issues about potential fires and the outrageous electric bills and
[33:36.400 --> 33:43.040] all these things, those are good points to raise. Okay, you can't prove that for sure
[33:43.040 --> 33:49.160] you know for a fact that there will be a fire as a result or that your electric bill will
[33:49.160 --> 33:54.640] triple as a result. But here's what I was telling Eddie on the break. Here's the irreparable
[33:54.640 --> 34:01.360] damage. Once the meter is in, it's in. Okay, it's over. That's the irreparable damage right
[34:01.360 --> 34:08.240] there because once it's in, they're not going to replace it back with the old one later
[34:08.240 --> 34:14.280] on down the line even if you win your case. And it's not your will that this be done on
[34:14.280 --> 34:20.160] your property. So it basically goes to property rights and so to me the real irreparable damage
[34:20.160 --> 34:25.160] is that the meter will go in and then it will stay in and there's nothing that will be able
[34:25.160 --> 34:32.240] to be done to change that after the fact. So that's your real issue concerning the irreparable
[34:32.240 --> 34:37.680] damage right there and all the stuff about the potential fires, et cetera, you can use
[34:37.680 --> 34:45.040] those as backup reasons but that's not, I don't think is going to be your real reason.
[34:45.040 --> 34:52.480] That's a good point. As I was studying to see if I would even might be entitled to an
[34:52.480 --> 34:58.720] injunction, a temporary injunction, it does seem that there, it doesn't have to be a guarantee
[34:58.720 --> 35:05.000] because that's one thing that crossed my mind too. It doesn't, there is some flexibility
[35:05.000 --> 35:13.000] in that part but also going to what you said, I think I'm going to bring up some, something
[35:13.000 --> 35:22.040] about due process because if you don't grant, I'll say report, if you don't grant me this
[35:22.040 --> 35:29.400] injunction and keep this meter off, the underlying cause of action will probably become moot
[35:29.400 --> 35:35.320] and that means we won't get to find out what my rights are. So I'm going to, I guess I'm
[35:35.320 --> 35:43.400] going to frame that as I won't get due process and definitely can't compensate me, that will
[35:43.400 --> 35:47.760] be irreparable harm because you definitely can't compensate me for not getting my due
[35:47.760 --> 35:48.760]  process.
[35:48.760 --> 35:54.520] Yeah, absolutely. Depri, deprivement of due process is definitely irreparable harm there
[35:54.520 --> 35:55.520]  for sure.
[35:55.520 --> 36:00.560] Yes, I'm definitely going to stick to that. So those are two things right there. The irreparable
[36:00.560 --> 36:06.480] harm is that something will be done with your property that is against your will and you
[36:06.480 --> 36:09.720] will be deprived of due process. Those are your reasons.
[36:09.720 --> 36:10.720]  Exactly.
[36:10.720 --> 36:13.440] And then you can use the fires and other things.
[36:13.440 --> 36:18.240] They can't prove irreparable harm because they won't be harmed at all. In fact, if I
[36:18.240 --> 36:23.760] get granted an injunction, they will actually save money from all the harassment that they've
[36:23.760 --> 36:26.480] been paying their people to do to me.
[36:26.480 --> 36:31.520] Well, are they seeking an injunction against you right now or are they just threatening?
[36:31.520 --> 36:37.920] They're basing it. No, I've already gotten their answer, the defendant's answer and counterclaim
[36:37.920 --> 36:41.680] and in the counterclaim, that's where they ask for the injunction.
[36:41.680 --> 36:45.600] To stop you from harassing their employees?
[36:45.600 --> 36:51.880] Actually, they've taken it a step further and just made it what they call mandatory,
[36:51.880 --> 36:59.320] meaning it's not just cloaked in, oh, restraining you from interfering. It's make her allow
[36:59.320 --> 37:03.760] us to install the meter.
[37:03.760 --> 37:09.200] Well, does it specifically say that you have to allow them on your property?
[37:09.200 --> 37:19.080] Yes. And the reason, I won't go into it now, but I will on the website. The reasons that
[37:19.080 --> 37:25.640] they are giving are number one, based on a contract that doesn't exist. They're basing
[37:25.640 --> 37:31.760] it on, oh, we have a contract, but they don't because thanks to deregulation, we only have
[37:31.760 --> 37:38.240] contracts, we the customers only have contracts with these, what they call retail providers
[37:38.240 --> 37:44.240] like TXU, Reliant, the ones that you can switch between. Those are the only people we have
[37:44.240 --> 37:45.240]  contracts with.
[37:45.240 --> 37:47.720]  And you don't have a contract with them?
[37:47.720 --> 37:54.040] No, because they're the distributor or the producer or something like that. And deregulation,
[37:54.040 --> 37:56.000]  and we can't switch them.
[37:56.000 --> 38:01.280] Are you putting this in your defense against their, I mean, has the court already granted
[38:01.280 --> 38:03.160]  this injunction against you?
[38:03.160 --> 38:05.800] No, that hearing is on January 28th.
[38:05.800 --> 38:13.000] Okay. Yeah, you need to put all of these things in your reasons against that TRO and you need
[38:13.000 --> 38:21.320] to move the court for them to show cause as to what the irreparable damage would be if
[38:21.320 --> 38:27.440] the court did not grant their injunction. What kind of irreparable damage are they going
[38:27.440 --> 38:34.800]  to suffer? I don't see any. I mean, there's still a meter there. They're still billing
[38:34.800 --> 38:40.800] you. Your account is not in arrears. So what damage are they, what harm are they suffering?
[38:40.800 --> 38:42.560]  Exactly, none.
[38:42.560 --> 38:48.120] And so if you can show that they don't even have any legal standing to, if they don't
[38:48.120 --> 38:55.680] have any legal standing to get that injunction, then that's what you need to move for, motion
[38:55.680 --> 39:03.680] to dismiss either for lack of standing or for failure to show cause. That's rule 12B1
[39:03.680 --> 39:04.680]  or 12B6.
[39:04.680 --> 39:13.840] Absolutely, but also keep in mind that they can base it, yeah, they can still base it
[39:13.840 --> 39:22.240] on this utilities code. I think it's 186.004, I think that's it, in the utilities code that
[39:22.240 --> 39:29.480] gives them this ridiculous loophole that basically allows them to do anything that they want
[39:29.480 --> 39:39.520] to. I got some other, well, that's nevermind, but they're also partially basing it on that.
[39:39.520 --> 39:50.640] Although it's reading their document, it's really kind of pitiful because they don't
[39:50.640 --> 39:54.720] seem to be staying focused. They seem to be wanting to do character assassination instead
[39:54.720 --> 39:59.400] of focusing on what they're supposed to be proving. And I'm finding that lawyers do that.
[39:59.400 --> 40:03.840] Now that I have a much better understanding of the law, like in the last six months, I'm
[40:03.840 --> 40:08.480] noticing that lawyers don't seem to be able to focus. I stay focused. When I'm doing documents
[40:08.480 --> 40:13.440] or something like that, I go through my research, I find out what I'm supposed to prove, and
[40:13.440 --> 40:14.960]  that's what I stick with.
[40:14.960 --> 40:20.760] They don't think they have to. They don't think they have to because that's just the
[40:20.760 --> 40:27.640] way they normally play their game. And they normally, the attorneys work out deals between
[40:27.640 --> 40:32.600] each other and they never really have to fight that hard in court. But when they're dealing
[40:32.600 --> 40:36.920] with a pro se, it's different, but they still don't feel that they have to because they
[40:36.920 --> 40:40.360] just think that the judge is going to side with them. And unfortunately, most of the
[40:40.360 --> 40:42.240]  time that's the case.
[40:42.240 --> 40:47.880] That's exactly right. So I'm going to fight as hard as I can on this with the limited
[40:47.880 --> 40:55.280] resources I have. I've seen in my other case, unrelated case, that the judge just completely
[40:55.280 --> 40:59.800] ignores the law. And I knew that it's not like I, you know, I've been listening to you
[40:59.800 --> 41:04.280] guys for a while and I'm no stranger to this kind of thing. I know that that's what happens.
[41:04.280 --> 41:08.760] But it's still, you still sit there and go, did I just see that?
[41:08.760 --> 41:15.680] Well, remember, CJ, you may get very well get railroaded at the trial court level. And
[41:15.680 --> 41:21.720] so this is what Frederick Graves always says, the trial court level is mainly for you to
[41:21.720 --> 41:25.560] get as much onto the record as possible for appeal.
[41:25.560 --> 41:30.000] That's not the way it's supposed to work. But that's how they make it work.
[41:30.000 --> 41:32.240]  Yeah, unfortunately, that's the case.
[41:32.240 --> 41:37.440] That is actually what I did in my other case. I thought, you know, I'm not going to win
[41:37.440 --> 41:43.800] this. I know I'm not, regardless of how right I am. I am going to concentrate on making
[41:43.800 --> 41:45.080]  my appellate record.
[41:45.080 --> 41:46.080]  Yep.
[41:46.080 --> 41:52.640] And that's what I did. And the other lawyer, the lawyer on the other side, he, oh my gosh,
[41:52.640 --> 41:56.640] he would withdraw, rather than like, for example, one thing that you do to make your appellate
[41:56.640 --> 42:04.000] record is, say you ask a witness a question, the other side objects, relevant, say, you
[42:04.000 --> 42:11.560] know, I object to that question, it's irrelevant. So you let the judge rule on it. And then
[42:11.560 --> 42:18.080] later on, if you want to claim error or abusive discretion or something like that, and not
[42:18.080 --> 42:22.040] let me ask that question, you can. But the lawyer, in this case, the lawyer on the other
[42:22.040 --> 42:26.800] side, his ego was more important than making an appellate record. So he, every time I would
[42:26.800 --> 42:31.880] object, he would just withdraw the question. So I'm thinking, wow, I'm glad he's not my
[42:31.880 --> 42:36.000] lawyer, because he's not concerned about his appellate record at all.
[42:36.000 --> 42:37.000]  Right.
[42:37.000 --> 42:43.120] Yeah, you're absolutely right. That's what they do. So just, if, I'm going to upload
[42:43.120 --> 42:51.120] those documents to the website, bansmartmeters.com. It's rather sparse right now, because I'm
[42:51.120 --> 42:58.120] having to do everything by myself. But I'll upload those documents, all the court documents.
[42:58.120 --> 43:03.840] And if anybody can make it at 9 a.m. on January 28th.
[43:03.840 --> 43:04.840] And what court is this?
[43:04.840 --> 43:07.280] This is in Bell County.
[43:07.280 --> 43:13.320] Bell County, up in Temple. Yeah, up in Temple. All right. So listeners out there who may
[43:13.320 --> 43:21.040] be listening, who live in Georgetown, Round Rock area, it's not too far up the road, I-35
[43:21.040 --> 43:22.640] for you guys. So please go out.
[43:22.640 --> 43:26.960] It's just a straight shot up I-35. It's like the courthouse is less than a mile off of
[43:26.960 --> 43:28.840] the highway. So it's all highway driving.
[43:28.840 --> 43:35.400] All right. Well listen, C.J., we really appreciate you fighting Agenda 21. We need more people
[43:35.400 --> 43:40.320] like you to fight this Agenda 21. Anything that's called Smart Anything, I don't trust
[43:40.320 --> 43:45.200] it anymore these days. Smart Meter, Smart Growth, Sustainable Development, all that

[43:49.200 --> 43:53.080] Okay, C.J., thanks for calling in. Please keep us posted.
[43:53.080 --> 43:54.840] Thank you. Thank you very much.
[43:54.840 --> 43:57.840] And that website one more time.

[46:31.640 --> 46:52.520] find one, where are you going to look for one? If you could not find one, where are you
[46:52.520 --> 47:20.960] going to look for one? Okay folks, we are back. We're watching the sparks fly. Oddly
[47:20.960 --> 47:26.760] enough there's a federal judge in Austin named Judge Sparks. So we'll see how the sparks
[47:26.760 --> 47:32.960] are going to be flying in his courtroom in the upcoming months. Alright, we've got callers
[47:32.960 --> 47:38.680] on the line. Craig in Texas. Craig, thanks for calling in. What is on your mind tonight?
[47:38.680 --> 47:44.160] Hey Debra, it's Craig in California. Oh, Craig's from California. Sorry, Craig. Go ahead. That's
[47:44.160 --> 47:52.160] fine. Yeah, I have a traffic infraction case here and you go in and we have a law that
[47:52.160 --> 48:00.160] you can make a request for a verified complaint at your arraignment. So we make the request.
[48:00.160 --> 48:06.240] The judge then says, well, we'll forward that to district attorney. Comes back, they denied
[48:06.240 --> 48:14.140] that request based upon a case here in California. We make a memorandum in opposition to that
[48:14.140 --> 48:21.560] request. Go in, they deny all of that based upon the same case. So I'm basically looking
[48:21.560 --> 48:32.360] for a strategy on how to go forward with this. Trial's been set for February 14th. Okay,
[48:32.360 --> 48:41.240] what is the exact charge? It's a failure to stop at a stop sign. Okay. And have you read
[48:41.240 --> 48:48.840] the statute in question? Yes. And what does it apply to? Well, it just says that you must
[48:48.840 --> 48:54.880] come to a complete stop. Any vehicle must come to a complete stop at the DMR station.
[48:54.880 --> 48:59.800] That's exactly what it says. It doesn't say any motor vehicle, any commercial motor vehicle.
[48:59.800 --> 49:05.620] It says any vehicle must come to a complete stop. Yes. Okay. What's the legal definition
[49:05.620 --> 49:11.720] of vehicle? Well, that's a good question. I've looked at all the definitions and basically
[49:11.720 --> 49:18.560] out here, it pretty much covers everything. It's very broad. Okay. But it can only be
[49:18.560 --> 49:22.440] broad dealing with the things for which it was intended to cover to begin with, right?
[49:22.440 --> 49:32.160] In other words, the subject matter of the statute must be specified. It can be, for
[49:32.160 --> 49:40.520] instance, anything that you can use for private purposes to travel upon the road can also
[49:40.520 --> 49:48.440] be used for commercial purposes upon the road, from the bicycles and tricycles all the way
[49:48.440 --> 49:57.960] up to the 18 wheelers and above. So the question is, are the statutes written in such a way
[49:57.960 --> 50:05.560] in California as to limit the applicability of all those things possible to only those
[50:05.560 --> 50:13.040] things engaged in commerce? Well, it does say about anything under human power or moving
[50:13.040 --> 50:22.360] upon rails as being the exception. Okay. But again, for instance, let's take here in Texas,
[50:22.360 --> 50:29.320] the definition of vehicle in one part of the code is this. Any device designed for the
[50:29.320 --> 50:38.800] purpose of transporting passengers or property upon the highway? Correct. The commercial
[50:38.800 --> 50:47.240] applicability. Okay. Transporting. Key word here. What's transporting? Right. Well, that's
[50:47.240 --> 50:57.080] a commercial term also. Transport. Yes. Transport, transporting, transportation. Correct. Okay.
[50:57.080 --> 51:01.880] So the argument can be made that vehicle is limited only to the things engaged in that
[51:01.880 --> 51:10.360] activity. Okay. The fact that you can haul something around in your private automobile
[51:10.360 --> 51:15.480] does not mean that it is used for the purpose of transport or transporting or transportation
[51:15.480 --> 51:24.400] per se. Yes. Okay. However, if you will send me an email, I will try to get it sent to
[51:24.400 --> 51:29.920] Rick in California who is much more knowledgeable specifically to those statutes in your state
[51:29.920 --> 51:35.320] than I am. And he is having good success there in virtually everything he's doing regarding
[51:35.320 --> 51:40.880] the traffic issues. So he could probably point you in the right direction better than I at
[51:40.880 --> 51:47.400] this point. But if he'll just send me an email at Eddie at ruleoflawradio.com, I'll make
[51:47.400 --> 51:51.960] sure that it's sent to him and that he gets in touch with you. And for all those folks
[51:51.960 --> 51:57.480] out there that have sent me emails to that respect, I have not gotten an email address
[51:57.480 --> 52:02.440] for Rick. He's given me a phone number, but I am trying to get an email address as well
[52:02.440 --> 52:06.960] because I just kind of don't want to give his cell number out on the air or things like
[52:06.960 --> 52:11.600] that or in emails and let it get scattered to the four winds. He'll never get sleep.
[52:11.600 --> 52:17.520] I've been there. I've done that. So I'm trying to get an email address from him.
[52:17.520 --> 52:24.560] Well, I have a question about the verified complaint. I mean, if they have a statute
[52:24.560 --> 52:30.840] that allows you to request that and the court denies that, that's really where I wanted
[52:30.840 --> 52:37.480] to, is there a way to force them to comply with that statute? That's what the statute
[52:37.480 --> 52:42.480] says. What does the state constitution say? For instance, here in Texas, the accused shall
[52:42.480 --> 52:46.760] have the right to know the nature in charge against him and to have a copy written, a
[52:46.760 --> 52:54.200] written copy thereof. That is the complaint. Yes. And that was part of my memorandum was
[52:54.200 --> 52:59.200] pointing those things out that the notice to appear cannot even come close to being
[52:59.200 --> 53:05.040] a verified complaint. And all verified complaints are required for any, any action in a criminal
[53:05.040 --> 53:12.920] court in this state. Then simply file against the, is this an actual judge or is this an
[53:12.920 --> 53:17.600] attorney or is this a commissioner or who are you supposed to appear before? He's a
[53:17.600 --> 53:24.320] judge pro tem. So he's a temporary judge appointed. Is he a bar card carrying attorney? Well,
[53:24.320 --> 53:29.280] that I don't know. I haven't really looked into his background. Okay. And if he is a
[53:29.280 --> 53:35.720] judge pro tem, has he taken the oath of office to act in that capacity? Well, that's a good
[53:35.720 --> 53:43.640] question too, to do a little research on him. Correct. You have to make sure that all actors
[53:43.640 --> 53:48.600] are acting legally, that they have the authority to do what they're doing and that the law
[53:48.600 --> 53:57.720] allows them to do what they're doing. But how do you enforce that after they've already
[53:57.720 --> 54:02.360] ruled against you and they just summarily? Well, hopefully you're doing this before it,
[54:02.360 --> 54:07.040] it's ruled against you so that you have it on the record that you brought up the issue
[54:07.040 --> 54:12.800] before they ever got that far. However, if they rule against you and they lacked jurisdiction
[54:12.800 --> 54:19.520] or authority or power by law to act, then anything they did is null and void. You simply
[54:19.520 --> 54:31.520] take it to a higher court and file for a void judgment order. Okay. Well, then at this point,
[54:31.520 --> 54:37.320] from my understanding is that if there is no verified complaint, they are acting in
[54:37.320 --> 54:44.000] excess of the jurisdiction. But as we know, they really don't care about any of that.
[54:44.000 --> 54:49.680] They just kind of go along with it and deny, deny, and they'll deny you. Well, I agree.
[54:49.680 --> 54:53.680] That's what they do. We have to teach them they're not going to get away with it. They
[54:53.680 --> 54:58.760] only do it because to this point we have allowed them to get away with it. Yeah, and that's
[54:58.760 --> 55:04.200] where I'm at. There has to be some kind of remedy after because they just summarily deny
[55:04.200 --> 55:09.040] you. Criminal complaints, judicial conduct complaints, and bar grievances. You can go
[55:09.040 --> 55:13.840] to your grand jury there in California just as well as we can here in Texas, if not even
[55:13.840 --> 55:21.720] more so. Do the people have access to them? Yes, you do. Okay, so the person can actually
[55:21.720 --> 55:27.560] go in, submit a complaint before the grand jury, and speak to them and explain it or
[55:27.560 --> 55:31.360] do you have... I haven't ever walked into a grand jury room in California, so I can't
[55:31.360 --> 55:36.240] say that specifically how it would work, but I know you have the right to go to the grand
[55:36.240 --> 55:42.720] jury with a criminal complaint in California. Yeah, that's the way it should work. Okay.
[55:42.720 --> 55:49.160] Well, then the other question is, what is the best way to preserve the record because
[55:49.160 --> 55:56.880] here they won't even allow you to... Written motions filed in the case. To do what? Written
[55:56.880 --> 56:02.400] motions and briefs filed in your case. Okay, so that's the best way to preserve the record
[56:02.400 --> 56:08.840] because we did ask them to stipulate on the court minutes several objections in which
[56:08.840 --> 56:14.000] they said they would note them, but they just don't allow audio recordings or video recordings
[56:14.000 --> 56:19.840] of any sort. Then demand that you appear in a court of record. File a written motion that
[56:19.840 --> 56:26.640] you demand a court of record with a court reporter. Well, there is a statute that says
[56:26.640 --> 56:34.040] all proceedings or all rules apply to infractions just like misdemeanors, so... Well, but there's
[56:34.040 --> 56:39.200] also a constitutional requirement that bills of attainder not be allowed to exist and anytime
[56:39.200 --> 56:43.280] there is an administrative or legislative determination of guilt without a judicial
[56:43.280 --> 56:54.120] proceeding, it is a bill of attainder. It is null and void. Okay. Well, that gives me
[56:54.120 --> 57:02.560] some good things to chew on for a bit and I will send you guys off an email and... You
[57:02.560 --> 57:10.160] said Rick out in California here? Yes. Okay. Well, I think... If you'll go look on YouTube,
[57:10.160 --> 57:21.080] his name on YouTube is Tactical Guy and it's spelled T-A-C-K-T-I or T-A-L Guy, G-U-Y and
[57:21.080 --> 57:28.920] it's either just Tactical Guy or Tactical Guy One. Okay. And he's got a ton of videos
[57:28.920 --> 57:33.720] up there but you can probably post a commentary on one of his videos and that would get you
[57:33.720 --> 57:38.340] in direct touch with him as well because I know from his postings back that he does read
[57:38.340 --> 57:46.720] the commentaries posted to the videos he makes. Okay. Do you know what his basic argument
[57:46.720 --> 57:53.240] is? Yeah, he argues the codes in the case law of California. The California code is
[57:53.240 --> 57:58.720] very clear that your traffic is all commercial in relation to the citations and all the other
[57:58.720 --> 58:04.880] crap associated with motor vehicles. Yeah, and I have all of that case law. I'm very
[58:04.880 --> 58:08.600] familiar with it but it's, you know, trying to get these guys to pay attention to it.
[58:08.600 --> 58:13.440] That's what I want to go and just make sure that they actually follow it. You're not going
[58:13.440 --> 58:18.920] to want to make sure that by yourself. But all you can do is fight and make the record
[58:18.920 --> 58:25.160] and then bury them for it later. Okay. Thank you very much. Anything else, Craig? That'll
[58:25.160 --> 58:28.200] do it. Thank you very much, Eddie. All right. You're very welcome. Thanks and have a good
[58:28.200 --> 58:33.680] night. All right, folks. We're about to go to break. This is the top of the hour break.
[58:33.680 --> 58:41.200] This is Rule of Law Radio. Eddie Craig, Deborah Stevens, 512-646-1984 is the call-in number.
[58:41.200 --> 58:46.440] We do have Terry, Scott, Mehta and an unscreened call which we'll know when we get back from
[58:46.440 --> 59:00.240] break. Please hang on to the line, folks. We will be back. Thank you very much.
[59:00.240 --> 59:05.680] The Bible remains the most popular book in the world, yet countless readers are frustrated
[59:05.680 --> 59:10.880] because they struggle to understand it. Some new translations try to help by simplifying
[59:10.880 --> 59:17.400] the text, but in the process can compromise the profound meaning of the scripture. Enter
[59:17.400 --> 59:23.600] the recovery version. First, this new translation is extremely faithful and accurate, but the
[59:23.600 --> 59:29.960] real story is the more than 9,000 explanatory footnotes. Difficult and profound passages
[59:29.960 --> 59:35.360] are opened up in a marvelous way, providing an entrance into the riches of the word beyond
[59:35.360 --> 01:00:04.480]  which you've ever experienced before.
[01:00:04.480 --> 01:00:10.040] A former Swiss banker Monday handed over data on hundreds of offshore bank account holders
[01:00:10.040 --> 01:00:16.080] to WikiLeaks founder Julian Assange at a news conference in London. Rudolf Elmer said he
[01:00:16.080 --> 01:00:21.800] hoped the information would call attention to offshore financial abuses and promote WikiLeaks
[01:00:21.800 --> 01:00:27.760] as a way for other whistleblowers to air their stories. Six people, including women and children,
[01:00:27.760 --> 01:00:33.080] were killed Saturday in Helmand province, Afghanistan, when a minivan full of civilians
[01:00:33.080 --> 01:00:38.840] struck a roadside bomb. In the east, international and Afghan troops killed two insurgents and
[01:00:38.840 --> 01:00:45.560] captured two suspected militants. Celebrations over the Tunisian president's ouster have
[01:00:45.560 --> 01:00:51.720] spread as the popular uprising raised hopes in the Arab world it could inspire reforms
[01:00:51.720 --> 01:00:57.480] across the dictator-ruled region. In Jordan, thousands joined rallies Friday against rising
[01:00:57.480 --> 01:01:05.320] prices and demanded the prime minister's ouster. Monday marks the 50th anniversary of a CIA
[01:01:05.320 --> 01:01:10.720] assassination that led to the death of millions in the Democratic Republic of Congo. Patrice
[01:01:10.720 --> 01:01:16.240] Lumumba, the first democratic leader of the former Belgian colony, had attempted to redistribute
[01:01:16.240 --> 01:01:21.560] the country's wealth. This conflicted with Belgian, European and US investors' expectations
[01:01:21.560 --> 01:01:28.320] of huge profits from Congo's factories, plantations and lucrative mines. Shortly after Lumumba
[01:01:28.320 --> 01:01:34.640] took office as prime minister, the CIA, with White House approval, ordered his assassination.
[01:01:34.640 --> 01:01:41.440] The US and Belgium covertly funneled cash and aid to rival politicians who seized power,
[01:01:41.440 --> 01:01:46.400] arrested Lumumba and flew him to the country's Katanga region, where he was beaten, tortured
[01:01:46.400 --> 01:01:53.160] and shot in a precursor to what the CIA now calls extraordinary rendition. Lumumba's assassination
[01:01:53.160 --> 01:01:57.960] sparked a civil war in the Congo that still rages to this day and has led to the death
[01:01:57.960 --> 01:02:05.040] of millions. A top Department of Defense official suggested recently Martin Luther King would
[01:02:05.040 --> 01:02:11.520] have supported the wars in Iraq and Afghanistan. At a Pentagon commemoration of King's accomplishments,
[01:02:11.520 --> 01:02:17.160] former counsel Jay Johnson said, Every day our servicemen and women practice the dangerous
[01:02:17.160 --> 01:02:24.400] unselfishness Dr. King preached on April 3, 1968. King and followers practiced nonviolent
[01:02:24.400 --> 01:02:31.760] resistance against racism, war and economic exploitation. In April 1967, King spoke out
[01:02:31.760 --> 01:02:36.880] against the Vietnam War in a speech at Riverside Church in New York stating, This business
[01:02:36.880 --> 01:02:42.640] of burning human beings with napalm, filling our nation's homes and with offerings and
[01:02:42.640 --> 01:02:49.720] widows of injecting poisonous drugs of hate into the veins of people's normally humane,
[01:02:49.720 --> 01:02:56.000] sending men home from dark and bloody battlefields, physically handicapped and psychologically
[01:02:56.000 --> 01:03:10.040] deranged, and not be reconciled with wisdom, justice and love.
[01:03:10.040 --> 01:03:29.040] You are listening to the Rule of Law Radio Network at ruleoflawradio.com, live free speech
[01:03:29.040 --> 01:03:44.040]  at ruleoflawradio.com.
[01:03:59.040 --> 01:04:09.040] All right, folks, we are back. Rule of Law Radio. You have several callers on the board.
[01:04:09.040 --> 01:04:15.040] And right now, it looks like we need to get to Terry in Michigan, then we'll have Teresa,
[01:04:15.040 --> 01:04:19.800] Meta and Scott. Meta, we know that you're hanging out there. Teresa is a first-time
[01:04:19.800 --> 01:04:23.360] caller, so please bear with us and we'll get right back with you. All right, Terry, what
[01:04:23.360 --> 01:04:24.360] can we do for you?
[01:04:24.360 --> 01:04:29.960] Hey, Eddie. Yeah, I talked to you guys about two weeks ago, and I was telling you about
[01:04:29.960 --> 01:04:35.560] the good results that I've had with the bar agreements that I filed against the prosecutor.
[01:04:35.560 --> 01:04:41.680] They'd been having a lot of problems with my neighbor, who was a convicted child molester
[01:04:41.680 --> 01:04:48.560] trying to keep him off my property. And because of that, I've had all kinds of broken windows
[01:04:48.560 --> 01:04:57.360] and slashed tires and stuff like that. And I'd gotten a letter from them that said that
[01:04:57.360 --> 01:05:02.720] there was an arraignment on January 6th, but I didn't get it until January 6th, where this
[01:05:02.720 --> 01:05:09.560] place is 60 miles from where I live. And now I got another letter from them telling me
[01:05:09.560 --> 01:05:15.660] that there's an arraignment on January 24th. And I'm just wondering, is there anything
[01:05:15.660 --> 01:05:22.400] I can do, is it worthwhile for me to go to the arraignment? He's been arrested for trespassing
[01:05:22.400 --> 01:05:29.040] and eavesdropping. We haven't been able to prove any of the other stuff, although he's
[01:05:29.040 --> 01:05:32.440] admitted to me face to face that he has done it.
[01:05:32.440 --> 01:05:37.480] Well now, in Michigan, what does the law say the purpose of an arraignment is?
[01:05:37.480 --> 01:05:47.040] For instance, in Texas it says it is to fix the identity of the accused and to hear his
[01:05:47.040 --> 01:05:53.840] plea. There's no cross-examination of witnesses, no introduction of evidence, no testimony,
[01:05:53.840 --> 01:05:59.120] nothing of that nature at an arraignment as far as that goes in Texas. What does Michigan
[01:05:59.120 --> 01:06:00.840] say they're supposed to be doing that day?
[01:06:00.840 --> 01:06:05.760] Yeah, basically from what I can tell, it's the same thing.
[01:06:05.760 --> 01:06:09.760] Okay, then really what I'd do is I'd just call the court and find out if there are any
[01:06:09.760 --> 01:06:12.360] witnesses that need to be present that day.
[01:06:12.360 --> 01:06:18.280] Okay, yeah, I talked to them and they said no, that there's no reason for me to be there.
[01:06:18.280 --> 01:06:23.560] I don't know why though that they said that he was arraigned on January 6th, but now they're
[01:06:23.560 --> 01:06:27.080]  saying he's being arraigned on the 24th. I don't know if he didn't do it.
[01:06:27.080 --> 01:06:31.520] Well, it's possible he may not have had assistance of counsel on the original arraignment.
[01:06:31.520 --> 01:06:43.760] Okay, that could be. Basically you're saying that there's really no reason for me to go
[01:06:43.760 --> 01:06:44.760]  through all that.
[01:06:44.760 --> 01:06:48.400] Well, I'm not saying, I'm saying call them and find out. You said you just did that and
[01:06:48.400 --> 01:06:51.880] they said no, there was no real reason for you to be there that day.
[01:06:51.880 --> 01:06:53.240]  Correct.
[01:06:53.240 --> 01:06:58.300] So given that, I wouldn't worry too much about having to go unless you just wanted to see
[01:06:58.300 --> 01:07:08.400] what the plea is or whatever. But on any day regarding evidentiary hearings or things of
[01:07:08.400 --> 01:07:12.520] that nature where people are going to be testifying and so on and so forth, I'd make a point of
[01:07:12.520 --> 01:07:17.360] going to that simply because you may be the only witness against him.
[01:07:17.360 --> 01:07:27.360] Yeah, they told me that if I'm needed as a witness because I have two other witnesses
[01:07:27.360 --> 01:07:30.920] and they said they'd let us know if we're needed as witnesses otherwise.
[01:07:30.920 --> 01:07:37.760] Okay. In that case, what they'll do is send you a subpoena to appear in court on a specific
[01:07:37.760 --> 01:07:39.920]  date and time.
[01:07:39.920 --> 01:07:48.120] Okay. I guess my biggest question is if there's anything that I can say by going if I haven't
[01:07:48.120 --> 01:07:51.120]  been subpoenaed.
[01:07:51.120 --> 01:07:57.920] Well, yeah, you run the risk of being arrested if you're subpoenaed and don't show up.
[01:07:57.920 --> 01:08:04.480] Okay. Now for a court conference, if I'm not subpoenaed, if I don't have to be there, is
[01:08:04.480 --> 01:08:07.480] there anything I can accomplish by being there?
[01:08:07.480 --> 01:08:13.240] Again, it all depends on what the purpose of that is to be. The only reason you would
[01:08:13.240 --> 01:08:18.480] have to be there is if they're going to elicit testimony from you.
[01:08:18.480 --> 01:08:20.480]  Okay.
[01:08:20.480 --> 01:08:26.680] And they have to notify any witness that they need them on a particular date and time.
[01:08:26.680 --> 01:08:35.160] Okay. Well, I'm concerned even if they don't tell me that I need to be there. They've pretty
[01:08:35.160 --> 01:08:38.280] much let this guy skate on despite everything that's happened.
[01:08:38.280 --> 01:08:43.360] Well, there's nothing you're going to be able to do with that. If he pleas out, there may
[01:08:43.360 --> 01:08:48.400] not be a trial. You'll never get summoned and they'll do whatever the deal calls for.
[01:08:48.400 --> 01:08:49.400]  Uh-huh.
[01:08:49.400 --> 01:08:53.720] You don't have any control over that aspect of it at all. All you can deal with is what
[01:08:53.720 --> 01:08:57.400] you're required to do based upon what's sent to you.
[01:08:57.400 --> 01:09:02.640] Okay. All right. Yeah, that's pretty much what I figured. I just didn't know if it would
[01:09:02.640 --> 01:09:10.240] make a difference being there in the courtroom, even if I didn't have to be there. But, you
[01:09:10.240 --> 01:09:13.000] know, in regard to the same thing...
[01:09:13.000 --> 01:09:17.800] The only thing that might be useful, Terry, is that if the judge also sets bail at the
[01:09:17.800 --> 01:09:23.960] arraignment, then it's possible that if he sets it to nothing or lower that you could
[01:09:23.960 --> 01:09:29.840] object as the party that's in danger from this guy being released or not being held
[01:09:29.840 --> 01:09:30.840]  accountable.
[01:09:30.840 --> 01:09:32.080]  Oh, okay.
[01:09:32.080 --> 01:09:37.120] That's possible, but I can't say that they will or they won't allow you to make that
[01:09:37.120 --> 01:09:38.120]  objection.
[01:09:38.120 --> 01:09:47.520] Okay. All right. I just wanted to mention, too, that when you guys were talking about
[01:09:47.520 --> 01:09:51.920] the smart meter, I hadn't even thought about that. But in regard to the same piece of property
[01:09:51.920 --> 01:09:59.080] last year, I went to the property. It's like 60 miles from my house. And I got there and
[01:09:59.080 --> 01:10:04.280] the power was shut off. And I had one of the old meters on there. And when I called the
[01:10:04.280 --> 01:10:07.720] power company and asked them about it, they said, oh, well, you called and told us to
[01:10:07.720 --> 01:10:12.360] shut it off. I said, well, no, I didn't. You know, where are you coming up with that information
[01:10:12.360 --> 01:10:16.200] from? They said, well, that's what our records indicate. And I said, well, I didn't tell
[01:10:16.200 --> 01:10:19.200] you to shut it off. And I'd like you to turn it back on. And they said, well, we can't
[01:10:19.200 --> 01:10:22.400] turn it back on. And I said, well, what do you mean? They said, well, you need to come
[01:10:22.400 --> 01:10:26.480] in and fill out paperwork, give us your social security number, blah, blah, blah, all this
[01:10:26.480 --> 01:10:31.240] kind of stuff. And I said, no way. You know, I already have an account with you. Just turn
[01:10:31.240 --> 01:10:35.520] the power back on. Well, we can't do that until you fill out the paperwork. So I went
[01:10:35.520 --> 01:10:40.800] round and round with them for like three weeks. And they finally said, well, we'll just look
[01:10:40.800 --> 01:10:48.640] at your records from your house and use those. And well, whatever, you know. And so lo and
[01:10:48.640 --> 01:10:52.160] behold, they turned the power back on. But they went and swapped my meter out and put
[01:10:52.160 --> 01:10:57.320] a smart meter on. Yeah. Well, you know, you could sue them for that, right? Most states
[01:10:57.320 --> 01:11:03.480] have laws. Matter of fact, someone sent me copies of them here. But it is absolutely
[01:11:03.480 --> 01:11:12.400] illegal for anyone to interrupt your power without some very specific authority or reason
[01:11:12.400 --> 01:11:22.000] for doing it. Really? Really. And I should look into that. The use of public utilities
[01:11:22.000 --> 01:11:30.840] is considered a must have thing. And no one is to be deprived of access to those utilities,
[01:11:30.840 --> 01:11:35.880] except in the manner as prescribed by law. Well, that's what I was questioning with them
[01:11:35.880 --> 01:11:39.320] because when they're down, well, we need all that information. Oh, we're dealing with
[01:11:39.320 --> 01:11:45.240] this or both. Well, this is how a lot of electric companies go about trying to get you to give
[01:11:45.240 --> 01:11:51.000] them information for their records they may or may not have or to verify it or something
[01:11:51.000 --> 01:11:56.240] of that nature. But they'll use this as a ploy. They tried that with me when I was living
[01:11:56.240 --> 01:12:01.000] in Conroe and I made it very simple for them. You will reconnect the power or the next thing
[01:12:01.000 --> 01:12:06.680] you will see is me in the front of your building with the sheriff and a court order to reinstate
[01:12:06.680 --> 01:12:15.800] it with a warrant for your arrest. Which would you prefer? I had power in 15 minutes. Yeah.
[01:12:15.800 --> 01:12:22.400] Wow. Yeah. I wish I would have, you know, known about that then because I just, I tried
[01:12:22.400 --> 01:12:26.400] to hold my ground and tell them, no, I'm not filling out new papers. I'm not giving you
[01:12:26.400 --> 01:12:30.160] my social security number or anything like that. Yeah. They had actually turned mine
[01:12:30.160 --> 01:12:34.880] off because they were saying that I hadn't paid the bill. And what I had done was I had
[01:12:34.880 --> 01:12:39.760] contested three months worth of bills after they had changed out the meter on the house
[01:12:39.760 --> 01:12:46.040] that I was renting and the, and the electricity just skyrocketed through the roof. And I
[01:12:46.040 --> 01:12:51.640] contested every one of the bills and refused to pay them. And so they tried to turn the
[01:12:51.640 --> 01:13:00.280] power off. And I'd already filed the objection to the bills with the company and with the
[01:13:00.280 --> 01:13:05.480] credit agencies regarding it, stating, no, this isn't right. I'm not paying these bills
[01:13:05.480 --> 01:13:10.520] and so on and so forth. And went down and filed a police report on it. So when they
[01:13:10.520 --> 01:13:19.760] turned the power off, that was retaliatory. That I could get them for. Well, I didn't
[01:13:19.760 --> 01:13:24.520] even really pay that much attention to it before, but I think you guys are right about
[01:13:24.520 --> 01:13:29.200] when they put them new meters and because it, you know, I need to go back and look at
[01:13:29.200 --> 01:13:34.240] my bills, but I, it's not that high of a bill normally, but it seems like it's like double
[01:13:34.240 --> 01:13:38.880] what it was before they put that. Yeah, exactly. And that's what those smart meters are doing.
[01:13:38.880 --> 01:13:47.480] They're smartly stealing extra money from everybody. Yeah. I'm going to look into them
[01:13:47.480 --> 01:13:56.240] shutting it off and, and look at the records of my bills. Okay. Anything else we can do
[01:13:56.240 --> 01:14:02.160] for you? Nope. Thank you so much. You're appreciated. Yes, sir. Not a problem. Glad to help. Thanks,
[01:14:02.160 --> 01:14:09.000] Terry. Take care. Okay. And also I did want to announce that I do have Rick's email address.
[01:14:09.000 --> 01:14:15.560] I found it. I didn't realize that he was tactical guy. His email address is tactical and that's
[01:14:15.560 --> 01:14:25.960]  spelled T-A-C-T-I-K-A-L, tactical, where the call is with a K, tactical guy, G-U-Y, at
[01:14:25.960 --> 01:14:31.520] yahoo.com. So that's how you contact Rick in California. All right. We're going to move
[01:14:31.520 --> 01:14:35.560] on. Meta, I know you're up there on the tower, but if you can, Scott, you've been waiting
[01:14:35.560 --> 01:14:39.600] for a while, but if you could just hold tight, we'd like to give a preference to our first
[01:14:39.600 --> 01:14:43.480] time callers. We've got a first time caller, Teresa on the line. Teresa, thank you for
[01:14:43.480 --> 01:14:49.360] holding. Thank you for calling in. What is on your mind tonight? Well, I'm kind of new
[01:14:49.360 --> 01:14:55.040] to all this and I've been listening to you all for about a month and I got a speeding
[01:14:55.040 --> 01:15:04.120] ticket and I'd like to know how I fight this. I got, it was 65 in a 45 mile per hour zone.
[01:15:04.120 --> 01:15:13.240] Okay. Where are you located? I'm in Dallas and I got the ticket in Lake Dallas. Okay.
[01:15:13.240 --> 01:15:20.480] How you fight it is kind of a loaded question. There's a process to it, basically speaking.
[01:15:20.480 --> 01:15:25.800] If you will send me an email offline, I'll be happy to correspond with you and send me
[01:15:25.800 --> 01:15:30.320] your phone number and I'll talk to you offline and let you know how that works out. But basically
[01:15:30.320 --> 01:15:44.640] speaking, you need to get familiar with transportation code section 545.351 and 545.352. Read and
[01:15:44.640 --> 01:15:51.040] study those two sections of statute. Don't worry if it sounds confusing. They're meant
[01:15:51.040 --> 01:15:56.480] to be that way. Now, if you don't have the traffic seminar material, the one thing I
[01:15:56.480 --> 01:16:02.800] can tell you about that is I take great pains in the seminar book to teach you how to read
[01:16:02.800 --> 01:16:11.400] a statute, how to take it apart, how to understand what it says and what it applies to. So, that
[01:16:11.400 --> 01:16:15.760] would also go a long way to helping you learn how to fight these because the paperwork for
[01:16:15.760 --> 01:16:22.360] doing it is already included in the course. Now, I say that because most of the legal
[01:16:22.360 --> 01:16:26.720] arguments about what's what are already made in the court documents associated with the
[01:16:26.720 --> 01:16:34.960] seminar material. We are having issues with the courts not abiding by the law, but we
[01:16:34.960 --> 01:16:39.600] also have issues with folks not knowing how to lay proper foundation to get their evidence
[01:16:39.600 --> 01:16:45.320] and information of the law in, which is what we're taking care of at Brave New Books. But,
[01:16:45.320 --> 01:16:50.080] Teresa, if you will hang on for just a moment. We're about to go to break. Folks, this is
[01:16:50.080 --> 01:17:00.400] Rule of Law Radio, Eddie Craig, Deborah Stevens, 512-646-1984. Please give us a call.
[01:17:00.400 --> 01:17:05.360] It is so enlightening to listen to 90.1 FM, but finding things on the Internet isn't so
[01:17:05.360 --> 01:17:10.200] easy and neither is finding like-minded people to share it with. Oh, well, I guess you haven't
[01:17:10.200 --> 01:17:15.480] heard of Brave New Books then. Brave New Books? Yes, Brave New Books has all the books and
[01:17:15.480 --> 01:17:20.400] DVDs you're looking for by authors like Alex Jones, Ron Paul, and G. Edward Griffin. They
[01:17:20.400 --> 01:17:25.680] even stock inner food, Berkey products, and Calvin Soaps. There's no way a place like
[01:17:25.680 --> 01:17:31.040] that exists. Go check it out for yourself. It's downtown at 1904 Guadalupe Street, just
[01:17:31.040 --> 01:17:37.040] south of UT. By UT, there's never anywhere to park down there. Actually, they now offer
[01:17:37.040 --> 01:17:42.420] a free hour of parking for paying customers at the 500 MLK parking facility just behind
[01:17:42.420 --> 01:17:49.040] the bookstore. It does exist, but when are they open? Monday through Saturday, 11 AM
[01:17:49.040 --> 01:17:56.200] to 9 PM, and 1 to 6 PM on Sundays. So give them a call at 512-480-2503, or check out
[01:17:56.200 --> 01:18:04.000] their events page at bravenewbookstore.com. Capital Coin and Goyon is your local source
[01:18:04.000 --> 01:18:08.200] for rare coins, precious metals, and coin supplies in the Austin metro area. We also
[01:18:08.200 --> 01:18:12.400] ship worldwide. We are a family-owned and operated business that offers competitive
[01:18:12.400 --> 01:18:17.640] prices on your coin and metal purchases. We buy, sell, trade, and confine rare coins,
[01:18:17.640 --> 01:18:21.560] gold, and silver coin collections, precious metals, and scrap gold. We purchase and sell
[01:18:21.560 --> 01:18:27.320] gold and jewelry items. We offer daily specials on coins and Goyon. We are located at 5448
[01:18:27.320 --> 01:18:31.680] Burnett Road, Suite 3, at the corner of Burnett and Shoalmark, and we're open Mondays and
[01:18:31.680 --> 01:18:36.680] Fridays 10 to 6, Saturdays 10 to 5. You are welcome to stop in our shop during regular
[01:18:36.680 --> 01:18:43.800] business hours or call 512-646-6440 with any questions. Ask for Chad and say you've heard
[01:18:43.800 --> 01:18:48.600] about us on Google Law Radio or Texas Liberty Radio. That's Capital Coin and Goyon at the
[01:18:48.600 --> 01:18:52.920] corner of Burnett and Shoalmark, and we're open Mondays and Fridays 10 to 6, Saturdays
[01:18:52.920 --> 01:19:22.840]  10 to 5. That's Capital Coin and Goyon, 512-646-6440.
[01:19:22.840 --> 01:19:28.040] Folks, we are back to the law radio. We are currently talking to Teresa about a speeding
[01:19:28.040 --> 01:19:36.640] ticket. Okay, Teresa, let's continue. Okay. All right. Those two sections of the transportation
[01:19:36.640 --> 01:19:44.440] code that I gave you, 545.351 and 545.352, deal specifically with prima facie speed limits
[01:19:44.440 --> 01:19:50.400] in the state of Texas. Like I say, read them. Don't worry that they don't make a lot of
[01:19:50.400 --> 01:19:55.920] sense to you yet. If you will send me the contact information, I will get in touch with
[01:19:55.920 --> 01:20:01.360] you and I'll be happy to sit down and talk with you about what it means, what it says.
[01:20:01.360 --> 01:20:07.240]  I've got a written set of questionnaires for cross-examination of a police officer that
[01:20:07.240 --> 01:20:13.680] I'll send to you as well to show you exactly how to question the officer on the stand.
[01:20:13.680 --> 01:20:19.600] Now, the thing that I want everybody to understand about that cross-examination of the officer,
[01:20:19.600 --> 01:20:26.000] it is not complete and total as of yet. I set that out so that we could start a preliminary
[01:20:26.000 --> 01:20:30.740] discussion over that. There are some nuances that we were talking about this past Saturday
[01:20:30.740 --> 01:20:35.400] that I need to get integrated into that. And hopefully here in the next few days, I can
[01:20:35.400 --> 01:20:41.560] get that done. Right now, I'm coming up on a deadline for several court cases for folks
[01:20:41.560 --> 01:20:46.960] that I'm helping with. And I've got a lot of documents to prepare exhibits and things
[01:20:46.960 --> 01:20:53.680] like that for them to use. So please bear with me and be patient. But Theresa, if you
[01:20:53.680 --> 01:20:59.720] will read those sections and start studying up on them, then you can write out a list
[01:20:59.720 --> 01:21:03.320] of questions you might have and then we can go from there.
[01:21:03.320 --> 01:21:12.520] Okay. I'm supposed to be in court on or before the 24th, so I have time to get prepared?
[01:21:12.520 --> 01:21:16.920] I can't answer that. That's entirely dependent upon how much time you spent pro-crash to
[01:21:16.920 --> 01:21:21.880] vaccinating versus doing something. If you do, if you work diligently on it, yes, you'll
[01:21:21.880 --> 01:21:29.000] be prepared. Okay. I can't guarantee outcomes, of course, because most of these people absolutely
[01:21:29.000 --> 01:21:34.240] will not abide by the law no matter what it says. But you need to make sure that what
[01:21:34.240 --> 01:21:38.340] you do is to prepare the record for appeal to show where your due process rights were
[01:21:38.340 --> 01:21:44.360] denied by the trial court. Okay. Now, are you going to a municipal court or a justice
[01:21:44.360 --> 01:21:49.360]  court? Oh, I'm not sure.
[01:21:49.360 --> 01:21:56.640] Well, that would help. That makes a big determination in what paperwork will or won't be there and
[01:21:56.640 --> 01:22:01.400] how you need to argue that. It's a municipal court. I see it right here.
[01:22:01.400 --> 01:22:05.880] Okay. So that means right off the bat, you're going to be denied in a fundamental right
[01:22:05.880 --> 01:22:11.920] of due process. No yes, no ands, no buts. You're going to have three or four immediately thrust
[01:22:11.920 --> 01:22:17.360] upon you that will deny you in your rights. They will not give you assistance of counsel.
[01:22:17.360 --> 01:22:23.440] They will not file a proper charging instrument. They will not hold a proper examining trial
[01:22:23.440 --> 01:22:31.400] nor will they hold a proper arraignment. So just be aware. Those are things that we will
[01:22:31.400 --> 01:22:34.920] discuss when I speak to you directly off air. Okay?
[01:22:34.920 --> 01:22:39.240] Okay. All right. Well, I appreciate it, Eddie. Thank you very much.
[01:22:39.240 --> 01:22:44.960]  Yes, ma'am. Just send me an email. Eddie, E-D-D-I-E at ruleoflawradio.com.
[01:22:44.960 --> 01:22:50.520] Yeah. And, Teresa, you can get Eddie's traffic seminar off our website too. You can purchase
[01:22:50.520 --> 01:22:54.880] it. Yeah. I just was looking at it. Yeah. I will.
[01:22:54.880 --> 01:22:59.320] Okay. Well, I really appreciate your help. Thank you. And I will contact you, Eddie.
[01:22:59.320 --> 01:23:02.120] All right, ma'am. Thank you very much. All right. All right.
[01:23:02.120 --> 01:23:06.440] Thank you, Teresa. Okay. We're going now to Meta in Texas. She's probably up there on
[01:23:06.440 --> 01:23:09.640] the tower. Meta, how's it going? Thank you for holding.
[01:23:09.640 --> 01:23:15.480] Oh, it's cold. But from some of them, it's off the grid. I have an officer, Vick, the
[01:23:15.480 --> 01:23:22.960] C.J. I used to live in San Antonio. If there's a water leak, if it was my side of the meter,
[01:23:22.960 --> 01:23:28.520] the meter to the house was my property. The responsibility to fix it. If it was other
[01:23:28.520 --> 01:23:36.760] side of the water meter, the responsibility starts. The same thing with the electrical.
[01:23:36.760 --> 01:23:44.640] San Antonio, the cable and the meter belongs to the electrical company. The box belongs
[01:23:44.640 --> 01:23:49.680] to the homeowner. They own it. If something breaks up, they're responsible to pay for
[01:23:49.680 --> 01:23:55.400] the fix. It's private property. It is not the property of the electrical company. And
[01:23:55.400 --> 01:24:03.240] therefore, if they remove, they're stealing. And Article 1 of the Constitution, a property
[01:24:03.240 --> 01:24:11.040] of, look at it, the Texas Constitution, of course. And also, they're gathering patients
[01:24:11.040 --> 01:24:17.200] on her. And isn't there a privacy thing about gathering people here in Texas?
[01:24:17.200 --> 01:24:20.960] I'm not sure. You're breaking up pretty bad, Meta. And as far as, you know, what they're
[01:24:20.960 --> 01:24:26.280] trying to do is they're trying to replace the meter itself. And I don't know if she's
[01:24:26.280 --> 01:24:31.480] researched out yet who actually owns the meter, whether the property owner owns it or whether
[01:24:31.480 --> 01:24:38.720] the electric company owns it. That's not clear to me at this point in time. I mean, I'm concerned
[01:24:38.720 --> 01:24:45.840] that ultimately she may lose this case because if the electric company owns the meter and
[01:24:45.840 --> 01:24:51.880] they own all the equipment, you know, regarding metering their usage, then I would think that
[01:24:51.880 --> 01:24:56.000] the electric company has the right to put whatever meter they want. It's their meter.
[01:24:56.000 --> 01:25:00.320] It's, you know, they have the right to decide how they want to monitor usage.
[01:25:00.320 --> 01:25:05.200] There's two ways to analyze that argument. The first one is the entire reason that you're
[01:25:05.200 --> 01:25:09.840] required to have code inspectors and things of that nature look at particular houses when
[01:25:09.840 --> 01:25:15.080] they're built and so on and so forth is so that your property does not cause damage to
[01:25:15.080 --> 01:25:20.960] their electrical system by feeding back into it, being improperly wired and causing problems
[01:25:20.960 --> 01:25:28.120] for other people that are using the same utility. That same argument can be applied here. You
[01:25:28.120 --> 01:25:33.960] don't want the risk of your property being damaged because of their faulty meter. Their
[01:25:33.960 --> 01:25:40.360] faulty meter causes fires in homes. Their faulty meter steals money by reporting back
[01:25:40.360 --> 01:25:46.400] bad information as to the kilowatt usage and so on and so forth. All of these things cause
[01:25:46.400 --> 01:25:51.120]  a harm to the homeowner. Yeah, that's a good point.
[01:25:51.120 --> 01:25:57.520] So that can be used as a two-way argument here. You're telling me I have to do certain
[01:25:57.520 --> 01:26:03.280] things because they don't want me causing harm to their equipment or their side of the
[01:26:03.280 --> 01:26:08.400] line. Well, here's why I'm arguing you can't do what you're doing right now because that
[01:26:08.400 --> 01:26:15.400] will cause harm to my side of the line. Good point. Very good point. Okay, Meta.
[01:26:15.400 --> 01:26:19.720] I believe that's pretty much the same gist that Meta was arguing regarding the water
[01:26:19.720 --> 01:26:27.080] meter she was speaking of. Right, right. Exactly. All right, Meta dropped
[01:26:27.080 --> 01:26:30.960] off the line. I know it's cold out there. She's probably up on the tower and not good
[01:26:30.960 --> 01:26:35.300] cell phone reception also. All right, we are going to move on now. The call boards are
[01:26:35.300 --> 01:26:39.000] almost empty, folks. We've got another half an hour left, so if you'd like to call in
[01:26:39.000 --> 01:26:46.160] 512-646-1984. We've got Scott in Austin right now. Scott, thank you for calling in and thank
[01:26:46.160 --> 01:26:48.360] you so much for holding. What is on your mind tonight?
[01:26:48.360 --> 01:26:53.840] Thank you for the show. While I was sitting on hold, I was surfing the net and I thought
[01:26:53.840 --> 01:26:59.080] you might be interested in this. I don't know if you're familiar with the Breitbart boards,
[01:26:59.080 --> 01:27:05.120] Andrew Breitbart and his stuff out there. I'm not a fan of his stuff. I do monitor it.
[01:27:05.120 --> 01:27:09.800] He's got a blog out there, one of his bloggers out there covering Agenda 21. I mean, you
[01:27:09.800 --> 01:27:13.360] guys are having an effect out there. Everybody is talking about this and they're having to
[01:27:13.360 --> 01:27:19.160] discuss it. Anyway, that aside, I wanted to make a comment about CJ. I've never heard
[01:27:19.160 --> 01:27:25.320] the health or the safety argument. I just heard more from that privacy point of view
[01:27:25.320 --> 01:27:31.040] and objection. If they're trying to make a change and it's a safety issue and if she's
[01:27:31.040 --> 01:27:36.880] trying to say it's a health safety issue, they may not have done any tests and it seems
[01:27:36.880 --> 01:27:42.160] to me that burden of proof would be on them. Maybe you'd handle this before court. You'd
[01:27:42.160 --> 01:27:48.000] make an inquiry saying, can you prove that this is not dangerous to my health or something
[01:27:48.000 --> 01:27:52.800] to that effect? I'm sure they've done the due diligence as far as fire safety goes,
[01:27:52.800 --> 01:27:58.480] but just a shot in the dark there. Well, I mean, all that's possible, but based
[01:27:58.480 --> 01:28:04.080] upon the information that she has and some that I've read stories of also, they have
[01:28:04.080 --> 01:28:08.320] managed to track the cause of fires and places back to these new meters.
[01:28:08.320 --> 01:28:14.160] Okay. And another just a funny story. When I was moving once and trying to... Dealing
[01:28:14.160 --> 01:28:19.600] with utilities has always kind of made me kind of set shivers up my spine for some reason,
[01:28:19.600 --> 01:28:25.040] I guess, because you're dealing with somebody that has a monopoly. I was trying to get the
[01:28:25.040 --> 01:28:29.280] gas turned on to a place I was moving to and I was doing it on the phone and they say,
[01:28:29.280 --> 01:28:33.520] well, what's your social security number? And I just answered back and say, you don't
[01:28:33.520 --> 01:28:37.280] need my social security number to turn on the gas. And then they say, we don't need
[01:28:37.280 --> 01:28:42.320] your social security number to turn on the gas. It was like a Jedi mind trick and this
[01:28:42.320 --> 01:28:48.080] is a sort of education that people know when to push back and say the magical phrase. Most
[01:28:48.080 --> 01:28:54.320] people just go ahead and just give it to them. Yeah. And I never would give it out either.
[01:28:54.320 --> 01:28:57.840] I tell them very simply that has nothing to do with social security,
[01:28:57.840 --> 01:29:01.920] has nothing to do with credit. You're not getting a social security number from me.
[01:29:01.920 --> 01:29:06.640] And please don't make me take you to court for refusing to give it to me because I won't
[01:29:06.640 --> 01:29:11.520] give you one. All right. Thanks a lot, guys. Yes, sir. Thank you for calling in.
[01:29:14.320 --> 01:29:20.160] All right. Thank you, Scott. Okay. We are continuing on now. We've got Dominic in Texas.
[01:29:20.160 --> 01:29:22.480] Dominic, thank you for calling in. What's on your mind tonight?
[01:29:22.480 --> 01:29:25.280] Happy new year. Well, happy new year to you.
[01:29:26.240 --> 01:29:32.000] Mr. Eddie. Yes. Send you an email regarding what you were talking about earlier about
[01:29:34.640 --> 01:29:38.080] Judge Sherry. Yes. Now wait till after the break.
[01:29:38.800 --> 01:29:44.640] All right. We'll just hang in there, Dominic, and we'll get right back to you as soon as we come back.
[01:29:44.640 --> 01:29:50.080] Folks, this is Rule of Law Radio, Eddie Craig, Denver Stevens. It is Monday night, traffic night,
[01:29:50.080 --> 01:29:55.280] 512-646-1984. We have a half an hour left, so please give us a call.
[01:30:20.240 --> 01:30:24.240] This leg belonged to a perpetrator close enough to the bomb or his body to be damaged,
[01:30:24.240 --> 01:30:29.680] leaving only a left leg behind. Who was this person? Please go to okcbombingtruth.com.
[01:30:33.120 --> 01:30:38.400] Computer jargon can be confusing. Take SSL encryption. You may have heard the term,
[01:30:38.400 --> 01:30:42.800] but did you know that using it could save you thousands of dollars and your privacy?
[01:30:42.800 --> 01:30:46.000] I'm Dr. Catherine Albrecht, and I'll be back to tell you more in just a moment.
[01:30:46.000 --> 01:30:52.080] And privacy is under attack. When you give up data about yourself, you'll never get it back again.
[01:30:52.080 --> 01:30:56.880] And once your privacy is gone, you'll find your freedoms will start to vanish too.
[01:30:56.880 --> 01:31:03.040] So protect your rights, say no to surveillance, and keep your information to yourself. Privacy,
[01:31:03.040 --> 01:31:08.240] it's worth hanging on to. This public service announcement is brought to you by Startpage.com,
[01:31:08.240 --> 01:31:16.640] the private search engine alternative to Google, Yahoo, and Bin. Start over with Startpage. SSL is
[01:31:16.640 --> 01:31:22.400] short for Secure Sockets Layer, a way to transmit information securely over the Internet. Hackers
[01:31:22.400 --> 01:31:26.880] can eavesdrop on your wireless Internet connections, but although pick up is a gobbledygook when you
[01:31:26.880 --> 01:31:32.320] use SSL, that's why it's so important to you. You can tell you're protected with SSL when the
[01:31:32.320 --> 01:31:39.840] Internet address in your browser window shows HTTPS, not just HTTP. The S is for Secure.
[01:31:39.840 --> 01:31:44.080] In addition, a little yellow padlock pops up at the bottom of your computer screen.
[01:31:44.080 --> 01:31:48.400] You should always look for that padlock symbol before paying for purchases over the Internet
[01:31:48.400 --> 01:31:53.760] or typing in a username and password. I'm Dr. Catherine Albrecht. More news and information

[01:32:24.000 --> 01:32:31.360] All right, folks, we are back. We have a half an hour left here on Rule of Law Radio.
[01:32:31.360 --> 01:32:35.360] We were speaking with Dominic, and I believe he was talking about our
[01:32:35.360 --> 01:32:40.000] current topic of Judge Statman down at the Austin Municipal Court.
[01:32:43.200 --> 01:32:50.000] Yes, sir. I had put in a motion to dismiss on my traffic citation because they never did get
[01:32:50.000 --> 01:32:57.280] the signed, verified criminal complaint in on time. So when I went to go see Statman,
[01:32:59.520 --> 01:33:03.840] I appeared and she and I advised her that I had put in the motion. That's why I was not going to
[01:33:03.840 --> 01:33:09.520] file. That's why I was not going to make a plea. And she said, well, she wasn't going to give me
[01:33:09.520 --> 01:33:16.880] a legal education, but that she can make a plea on my behalf. So she put a plea that I pleaded not
[01:33:16.880 --> 01:33:22.720] guilty and for a jury trial. So since she felt that she didn't have to give me a legal education,
[01:33:22.720 --> 01:33:29.120] I didn't feel I had to give her one. So I just came home and did file a judicial complaint against
[01:33:29.120 --> 01:33:36.080] her for moving forward in a case where they have no subject matter jurisdiction. So I'll be more
[01:33:36.080 --> 01:33:42.240] than happy if you can send me that paperwork that you had to also put my name on those complaints.
[01:33:42.240 --> 01:33:48.320] Hey, not a problem. That's exactly what we need. Folks want to make a change and this is how we're
[01:33:48.320 --> 01:33:51.840] going to do it. But I'll certainly do that, Dominic. Soon as we get them all written up and
[01:33:51.840 --> 01:33:56.800] completed, they'll be in your hands. Anybody else out there want them, send me an email.
[01:33:57.360 --> 01:34:04.000] These are judicial conduct complaints and bar grievances against municipal court judge Sherry
[01:34:04.000 --> 01:34:12.800] Statman. She is one of those who is all knowing and all seeing and blind as a bat at every turn
[01:34:13.360 --> 01:34:21.040] because she does not and has not read the law regarding what she's doing. If she did, she would
[01:34:21.040 --> 01:34:26.880] not act the way she does because she would know she's violating that law. Or she thinks she's above
[01:34:26.880 --> 01:34:34.800] it. Well, that too. She definitely has that high and mighty air to her at times, I'll say that.
[01:34:34.800 --> 01:34:38.080] But thanks, Dominic. I'll most certainly get them to you as soon as we get them finished.
[01:34:38.800 --> 01:34:44.000] I already got one letter from the judicial complaint board just saying that they're going
[01:34:44.000 --> 01:34:50.320] to look into it. But I'm just waiting for the other one saying that they found nothing that rose
[01:34:50.320 --> 01:34:56.960] to the level of misconduct. Well, obviously that's because the same idiots that keep her there are
[01:34:56.960 --> 01:35:03.600] guilty of doing the same thing themselves. Exactly. Folks, don't get me wrong. I have nothing
[01:35:03.600 --> 01:35:10.480] personally against any of these judges. I just have a problem with stupid people and it's not my fault
[01:35:10.480 --> 01:35:15.280] that they qualified long before I ever had occasion to run into them. Well, I have a problem with
[01:35:15.280 --> 01:35:20.880] people trying to deprive us of our life, liberty, and property without due process. Well, that just
[01:35:20.880 --> 01:35:25.360] goes beyond stupid. That goes to criminal. And I have an issue with those types of folks as well,
[01:35:25.360 --> 01:35:28.720] no matter how they dress and what they wear or what their job title may be.
[01:35:31.360 --> 01:35:35.360] All right, Dominic, anything else? No, that's it. Well, y'all have a wonderful evening.
[01:35:35.360 --> 01:35:39.200] Okay, thank you. Thank you, Dominic. You too. Thank you, Dominic. Okay, we've got a couple of
[01:35:39.200 --> 01:35:43.520] first-time callers on the board here, so we're going to give them preference. We've got Clint
[01:35:43.520 --> 01:35:48.480] in Texas and then Floyd. Clint, thank you for calling in. What's on your mind tonight?
[01:35:49.200 --> 01:35:59.040] Hey, hello everybody. So I went over to March today for MLK and I saw a cruiser that was
[01:35:59.040 --> 01:36:05.920] obviously a police car, but there was no printing or anything on it. And I was wondering what the
[01:36:05.920 --> 01:36:16.000] legality of that is. As far as it being an undercover car? It wasn't undercover. I mean,
[01:36:16.000 --> 01:36:25.040] undercover to me seemed to be a non-Victoria car. This one was obviously a police car,
[01:36:25.040 --> 01:36:28.800] but it just didn't have any printing on it. It's just an unmarked police car.
[01:36:28.800 --> 01:36:34.640] Yeah, the statutes are clear that there are certain that all types of government vehicles
[01:36:34.640 --> 01:36:42.480] shall be clearly marked. And then it makes a specific exception for certain types of vehicles
[01:36:42.480 --> 01:36:47.360] for traffic enforcement. In other words, if they can't get you one way, they're going to get you
[01:36:47.360 --> 01:36:54.960] by stealth. Okay, where could I find that statute? I don't recall what the number is off the top of
[01:36:54.960 --> 01:36:59.520] my head, but it will be in the transportation code. Transportation, all right. All right,
[01:36:59.520 --> 01:37:04.960] well, thank you for your time. You're very welcome, Clint. You're welcome. Bye-bye. Bye. Okay,
[01:37:04.960 --> 01:37:10.480] we are going now to another first-time caller, Floyd in California. Floyd, thank you for calling
[01:37:10.480 --> 01:37:21.520] in. What is on your mind tonight? Floyd, are you there? Floyd, are you there? Okay, he must have
[01:37:21.520 --> 01:37:30.240] dropped off. Okay, we are going to go now to David in Texas. David, thanks for calling in. What is on
[01:37:30.240 --> 01:37:36.480] your mind tonight? Thank you, Deborah. I was calling in with a little parallel issue to the traffic,
[01:37:36.480 --> 01:37:44.480] and that is dealing with the social security number. Eddie, I went down to bank a while back
[01:37:44.480 --> 01:37:49.760] and tried to open a business account with a legal ID. In fact, they used a passport,
[01:37:49.760 --> 01:37:53.520] but the passport did not have a social security number attached, and I didn't give them a social
[01:37:53.520 --> 01:37:59.040] security number. It was the Bank of America, and they approved it all the way through until they
[01:37:59.040 --> 01:38:05.680] got into the inner workings of what they asked for, and the clerk even approved it, called in,
[01:38:05.680 --> 01:38:10.400] got it approved, and right at the last minute, they said, if you don't give us a social security
[01:38:10.400 --> 01:38:15.840] number, we can't open this an account. My question is, like the driver's license,
[01:38:15.840 --> 01:38:22.000] I know there are lots of federal laws and things that say we used to have a right to privacy,
[01:38:22.000 --> 01:38:27.120] and they couldn't identify you by a social security number. I would love to put together a course,
[01:38:27.120 --> 01:38:32.720] kind of like your course, or kind of like Michael Maris' course, where they sue in federal court
[01:38:32.720 --> 01:38:38.000] over a federal violation, and I was thinking that there is some sort of a federal law in the Privacy
[01:38:38.000 --> 01:38:42.480] Act that says they cannot identify you by a social security number. I was wondering if you knew off
[01:38:42.480 --> 01:38:53.200] hand any of those? The Privacy Act of 1974 is one. Now, let's talk real quick a little bit about
[01:38:53.200 --> 01:38:59.520] the social security number in relation to a bank. Okay. There are specific federal statutes
[01:38:59.520 --> 01:39:07.840] involving the use of the social security number. One of those is 31 CFR 103.28, where specifically
[01:39:07.840 --> 01:39:15.680] states requires identification as follows. Before concluding any transaction with respect to which
[01:39:15.680 --> 01:39:20.880] a report is required under Section 103.22, a financial institution shall verify and record
[01:39:20.880 --> 01:39:25.600] the payment address of the individual presenting a transaction, as well as record the identity,
[01:39:25.600 --> 01:39:30.000] account number, and the self-security number or taxpayer identification number, if any,
[01:39:30.000 --> 01:39:36.400] of any person or entity on whose behalf such transaction is to be affected. Okay. Now,
[01:39:36.400 --> 01:39:46.000] if you go a little further down, however, that does not mean it's mandatory. 31 CFR 103.33 requires
[01:39:46.000 --> 01:39:52.800] financial institutions to include a notation in the record that a customer lacks or did not
[01:39:52.800 --> 01:40:02.480] disclose a social security number or other identification. 31 CFR 103.34 provides in the
[01:40:02.480 --> 01:40:08.240] event that a bank has been unable to secure the required identification, it shall nevertheless
[01:40:08.240 --> 01:40:15.120] not be deemed to be in violation of this section if I, or one, it has made a reasonable effort to
[01:40:15.120 --> 01:40:20.400] secure such identification, and two, it maintains a list containing the names, addresses, and
[01:40:20.400 --> 01:40:26.000] account numbers of those persons from whom it has been unable to secure such identification,
[01:40:26.000 --> 01:40:30.800] and makes the names, addresses, and account numbers of those persons available to the
[01:40:30.800 --> 01:40:38.800] Secretary as directed by him. Secretary here means Secretary of the Treasury. Okay. Now.
[01:40:38.800 --> 01:40:44.800] Okay. The federal law is providing punitive damages to these individuals for what they do
[01:40:44.800 --> 01:40:56.800] with these numbers is as follows. 18 USC section 242 and 1983. Okay. And 42 USC section 408,
[01:40:56.800 --> 01:41:05.600] which states, whoever sub-item number eight discloses, uses, or compels the disclosure
[01:41:05.600 --> 01:41:11.840] of the social security number of any person in violation of the laws of the United States
[01:41:11.840 --> 01:41:18.560] shall be guilty of a felony and upon conviction thereof shall be fined under Title 18 or imprisoned
[01:41:18.560 --> 01:41:31.280] for not more than five years or both. Great. Great. All right. So. I needed the paperwork.
[01:41:31.280 --> 01:41:36.480] I even filed a DBA and gave them a DBA, and they had a taxpayer identification number.
[01:41:37.200 --> 01:41:43.280] Yes. I've actually got a notice that I used to use when I went to get a bank account that has
[01:41:43.280 --> 01:41:49.920] tons of case law and the specific code citations listed, highlighted, and annotated directly in it.
[01:41:49.920 --> 01:41:53.120] If you want it, send me an email. I'll be happy to send it to you.
[01:41:53.760 --> 01:42:01.440]  I would love to. What's your email address? eddie at ruleoflawradio.com.
[01:42:02.960 --> 01:42:11.680] Great. And one other thing. I went to another bank and actually opened a personal account,
[01:42:11.680 --> 01:42:17.920] got it open, made a deposit. Everything was great. And a month later, same situation,
[01:42:17.920 --> 01:42:23.760] they sent me a letter. And this is what it says. Enclosed, you'll find the cashier's check for the
[01:42:23.760 --> 01:42:29.360] opening deposit you made of $50. We will not be able to do business with you so the account's
[01:42:29.360 --> 01:42:34.960] been closed. Please give us a call to inquire the reason. We have tried contacting you on the
[01:42:34.960 --> 01:42:42.880] phone number you gave us, but it's no good. So they want to talk to you on the phone about it,
[01:42:42.880 --> 01:42:47.600] but they won't tell you in writing what the reason is? Absolutely. Yeah, because they don't
[01:42:47.600 --> 01:42:53.040] want to put it on the record where you could present it in court. And every time they've done
[01:42:53.040 --> 01:43:01.280] that, I go back and I demand in writing the reason that my account was closed or denied.
[01:43:01.280 --> 01:43:08.400] I want it in writing. That's what I'm going to do. But I also heard y'all talking one night about
[01:43:09.200 --> 01:43:16.240] one of these little PIN recorders or a digital recorder that records and also goes directly
[01:43:16.240 --> 01:43:23.120] to the Internet or a receiver. Well, going directly to the Internet, that's on a smartphone,
[01:43:23.120 --> 01:43:27.920] like one of these iPhones or Androids, or you can use a little iTouch or something like that.
[01:43:27.920 --> 01:43:34.880] It's an app called Quick, QIK, and you go to qik.com and set up an account. But that's different
[01:43:34.880 --> 01:43:40.960] than just having like a little pocket MP3 recorder. Okay, well listen, thank you very much. I
[01:43:40.960 --> 01:43:45.840] appreciate all the help. Okay, thank you, David. Yeah, and I do highly recommend people getting
[01:43:45.840 --> 01:43:52.000] these smartphones. I hate calling them that anyways, where it's got Internet connection all
[01:43:52.000 --> 01:43:58.000] the time and you can upload video as you're streaming it so it's there and preserved. We'll

[01:46:22.080 --> 01:46:31.760] Okay, folks, we are taking our calls. We've got one more segment left and we are going now to
[01:46:31.760 --> 01:46:40.480] Floyd in California. Floyd, are you there? Is Floyd there? Floyd, yeah. Okay, there you are.
[01:46:40.480 --> 01:46:45.360] What's going on, Floyd? What's your question? I can barely hear you, though. Well, Floyd,
[01:46:45.360 --> 01:46:49.280] you're calling in on Skype and you're having issues with your computer and your headset
[01:46:49.280 --> 01:46:54.480] and stuff, so, I mean, there's nothing that I can do about that. You may want to call back from a
[01:46:54.480 --> 01:47:02.240] regular telephone or after you diagnose your Skype issues or whatever, a call back on a regular phone,
[01:47:02.240 --> 01:47:09.120] okay? Okay, we're going to have to let Floyd go. He's having too many problems with his Skype and
[01:47:09.120 --> 01:47:14.640] his computer. We're going now to Suzanne in New York. Suzanne, thank you for calling in. What is
[01:47:14.640 --> 01:47:26.080] on your mind tonight? Excuse me, because I'm very nervous. There was, can a criminal action,
[01:47:27.120 --> 01:47:36.080] somebody sued us, they did a criminal action and they sued us civilly. Now, can the court disregard
[01:47:36.080 --> 01:47:41.840] the criminal aspect? Suzanne, you said that they did a criminal action. Can you explain that?
[01:47:41.840 --> 01:47:48.560] They used a forgery, a forged poverty attorney to take a loan out in my husband's name.
[01:47:48.560 --> 01:47:54.480] Okay, so they committed a criminal act. Right, and they committed more because they lied during
[01:47:54.480 --> 01:48:02.560] the whole case. And then they took documents, whitened them out. They committed perjury.
[01:48:03.840 --> 01:48:09.040] What we found out at the end of the case through Randy, because I had been in touch with him,
[01:48:09.040 --> 01:48:16.720] and I got the jurisdictionary, you know, I went for that. We found out that the house was actually
[01:48:17.520 --> 01:48:25.120] stolen in essence, and they call that grand larceny. We had gone to the district attorney
[01:48:26.240 --> 01:48:33.680] to press charges, and the DA, apparently there's friendships going on here, and the one DA
[01:48:33.680 --> 01:48:39.840] I talked to, another chief DA, and he was going to do something about it, and he told me, I have
[01:48:39.840 --> 01:48:45.360] this on tape by the way, I recorded them, and he said they had to do what they had to do.
[01:48:46.400 --> 01:48:52.000] And they being who? The people that took this loan out in my husband's,
[01:48:53.840 --> 01:48:59.280] my husband was not on the note, okay, was $100,000. Okay, I remember this conversation.
[01:48:59.280 --> 01:49:08.960] Yeah. But the mortgage that was put against the house was a forgery. So according to law,
[01:49:10.080 --> 01:49:15.120] my husband didn't have to pay a note because he didn't take it out, and the mortgage that they
[01:49:15.120 --> 01:49:23.920] put on my husband's property is null and void. So it's basically a simple, you know, the title was
[01:49:23.920 --> 01:49:32.480] defective. The mortgage is defective. You can't sue a victim, in essence, of a crime, but they did
[01:49:32.480 --> 01:49:40.640] anyway. And so, you know, this guy who's, now we found out that this guy was the mortgage broker,
[01:49:41.440 --> 01:49:49.360] and he is the person who got the mortgage for these, it was my husband's father.
[01:49:49.360 --> 01:49:54.880] He was the mortgage broker. Now, he testified he didn't know anything about this and how they did
[01:49:54.880 --> 01:50:01.040] it. He just came along and helped them later on and lent them money. And they apparently had
[01:50:01.600 --> 01:50:07.680] a couple forbearance agreements. They used the private attorney again, using my husband's name.
[01:50:07.680 --> 01:50:13.360] Now, we contacted the bank, and we wanted to get the information. How did they do this?
[01:50:13.360 --> 01:50:20.160] How did they do this? They cited the Bailey Act or something, saying that we weren't on the note,
[01:50:20.880 --> 01:50:28.880] so it would violate the borrower's rights, their constitutional rights or privacy rights, whatever,
[01:50:28.880 --> 01:50:34.880] you know, that they wouldn't give us that information. Now, this guy here, this person
[01:50:34.880 --> 01:50:42.160] who was supposedly now, he bought the loan, or something happened with the bank where they
[01:50:42.160 --> 01:50:50.240] allowed him to become an owner. They dropped my husband's name from the property. When we found
[01:50:50.240 --> 01:50:55.680] out what happened, my husband's sister, who's the one that did this, that was her boyfriend,
[01:50:55.680 --> 01:51:02.400] that was her employer, and she said, I'm going to pay for the mortgage. I'm going to pay it.
[01:51:02.400 --> 01:51:08.640] Don't worry about it. He just wants you to sign for a new mortgage, a new note, a new, you know.
[01:51:08.640 --> 01:51:14.560] So, as we were trying to find out what was going on, the documents were missing, and they refused
[01:51:14.560 --> 01:51:20.080] to give them to us. So, as we contacted the bank, and we made a complaint against them, they said,
[01:51:20.080 --> 01:51:25.280] well, if you have a problem with crimes, we'll help you, but we can't give you any documents.
[01:51:25.280 --> 01:51:33.520] It'll violate them. Well, what happened was, we refused to go for a new mortgage, I mean,
[01:51:33.520 --> 01:51:41.120] a new loan. So, what they did was, they sued my husband for a partition action. Now, from what
[01:51:41.120 --> 01:51:48.640] I understand, a partition action is where there's two co-owners of record, but my husband was dropped
[01:51:48.640 --> 01:51:54.400] from the title, and one of the reasons why they did that, the sister told us, and I had that on
[01:51:54.400 --> 01:52:02.080] tape, was because they wanted to get section eight, and section eight is given to people,
[01:52:02.080 --> 01:52:08.160] you know, that live in the house, and her boyfriend played owner, so they could get this money,
[01:52:08.160 --> 01:52:12.880] a federal, you know, grant to pay the rent, and they were using that money to pay the mortgage
[01:52:12.880 --> 01:52:19.440] off, or to pay the note off, you see. Well, but is there a question you have associated with this?
[01:52:19.440 --> 01:52:26.000] Yes. Well, basically, my husband, he wasn't the owner. He lost ownership to the house,
[01:52:26.000 --> 01:52:33.680] and the bank came in at the end of the case. Now, the judge, it gets more complicated than this,
[01:52:33.680 --> 01:52:43.440] the judge signed a foreclosure notice, and the bank presented to the judge that my husband was
[01:52:43.440 --> 01:52:47.760] on the note and the mortgage. Now, we were never notified. We never had any hearings.
[01:52:47.760 --> 01:52:55.120] We never knew that this took place. She signed it, and just recently, from looking at the documents
[01:52:55.120 --> 01:53:02.640] at the documents, my husband was not on the note, so they lied to the court. The court signed that
[01:53:05.280 --> 01:53:13.520] the foreclosure, you see, and then this guy became an owner, okay. Now, from Randy's course,
[01:53:14.640 --> 01:53:20.560] this guy supposedly was making money through the loan or whatnot, and they wanted it to go
[01:53:20.560 --> 01:53:27.200] in foreclosure, but he sued us to pay for the loan. The bank showed up and said that we were
[01:53:29.680 --> 01:53:36.240] falsely enriched by this, and we were ordered to pay for it. We were thrown out of our house.
[01:53:37.040 --> 01:53:44.880] They sold it for half price, and we have to pay this guy all this money back. It has come to
[01:53:44.880 --> 01:53:52.320] our attention that that part of attorney has his handwriting on it. He lied in the court,
[01:53:52.320 --> 01:53:59.760] say, another wife. I can't believe this is happening. I've contacted the FBI. They said
[01:53:59.760 --> 01:54:04.720] they don't have enough money to investigate this. There is such a thing as too much crime
[01:54:05.440 --> 01:54:10.800] committed that when we went to lawyers, they said, we don't even want to hear this. Get away.
[01:54:10.800 --> 01:54:15.840] You know how much it's going to cost. They already did a test. We didn't have due process.
[01:54:16.400 --> 01:54:23.040] The same judge happened to get on the case, the partition action, and we presented. I tried to
[01:54:23.040 --> 01:54:29.040] tell her things, wanted to present my tape, wanted to prove that it was a fraud, wanted to show the
[01:54:29.040 --> 01:54:35.120] documents. We did show documents, bringing up how they whiten documents out. They took my husband's
[01:54:35.120 --> 01:54:40.640] name off. That's why we needed the documents from the bank, you see. Well, Suzanne, have you
[01:54:40.640 --> 01:54:48.720] guys filed lawsuit against these people yet? Well, we kind of sued the sister and the father
[01:54:48.720 --> 01:54:54.720] and the brother, you see. And the judge threw it off. They didn't even file an answer in the court.
[01:54:54.720 --> 01:55:02.320] They never showed up. They wouldn't even let us depose the father. The father said he never
[01:55:02.320 --> 01:55:08.400] took the loan out. And we filed the original loan document, the application, you know.
[01:55:08.400 --> 01:55:12.000] Well, did you sue them? Did you sue them in state or federal court?
[01:55:12.000 --> 01:55:16.960] They sued us. Well, I mean, with your counter suit, was that a state case?
[01:55:16.960 --> 01:55:19.440] It was a state case. Okay. You may want to consider-
[01:55:19.440 --> 01:55:22.880] And she threw everything out. Okay. Well, you may want to consider suing
[01:55:22.880 --> 01:55:26.880] them in federal court, open up a new venue, open up a new case as a plaintiff.
[01:55:29.120 --> 01:55:34.560] If you've already talked with Randy offline about this, Randy's going to be far better suited to
[01:55:34.560 --> 01:55:39.120] helping you in this particular case than I will. Mortgage is not what I do.
[01:55:39.840 --> 01:55:44.320] Right. And I think I remember you've called in on Monday nights before, Suzanne. You need to call
[01:55:44.320 --> 01:55:47.680] in and explain all this to Randy on like a Thursday or a Friday.
[01:55:48.320 --> 01:55:54.640] You know, Randy wants me to write certain things down. I don't know what to write down.
[01:55:55.520 --> 01:56:01.360] I don't know what's the most important thing. Well, just write down in chronological order
[01:56:01.360 --> 01:56:05.600] the facts that occurred. I did. I wrote things down.
[01:56:06.320 --> 01:56:11.840] I know that this judge took the case that she already ruled, you know, falsely. So she ruled
[01:56:11.840 --> 01:56:18.720] for him. That was to cover her little bottom up, you know. And this bank showed up and said we
[01:56:18.720 --> 01:56:25.840] were unjustly enriched. That was a crime. That's why I'm saying that your best remedy
[01:56:25.840 --> 01:56:32.720] here likely is going to be to initiate a brand new lawsuit in the federal court system.
[01:56:33.360 --> 01:56:40.080] See, you know what? I heard you say something earlier that when something is void, that you
[01:56:40.080 --> 01:56:46.480] could go to the court and void it out. Now, the appeals court came back and they didn't address
[01:56:47.360 --> 01:56:53.840] why we have to pay this money to him, but they affirmed it. But the other bills that this guy
[01:56:53.840 --> 01:57:01.920] put in, I mean, they went back to 1993. I mean, 18, 1993, the guy didn't even borrow the money.
[01:57:01.920 --> 01:57:04.720] He said he lent the money to the sister and the father and the brother.
[01:57:06.400 --> 01:57:11.120] Suzanne, hold on. Did you have an attorney helping you with this or did you try to do it on your own?
[01:57:11.120 --> 01:57:18.400] We had seven attorneys and every one of them cheated us. They lied to us. They didn't do the
[01:57:18.400 --> 01:57:23.920] things they were supposed to do. But the last one in the case, he's bringing stuff up and the
[01:57:23.920 --> 01:57:28.800] judge said, strike that, take that off, do this, do that. In fact, when I started telling her stuff,
[01:57:28.800 --> 01:57:34.080] she says, if you don't be quiet, she says, I'm going to bring the full force of weight of the
[01:57:34.080 --> 01:57:41.040] court on you. That's what she said. I couldn't even talk. I was so terrified because they were
[01:57:41.040 --> 01:57:46.400] all sitting there smirking. It was like they were all together laughing and they had leading
[01:57:46.400 --> 01:57:54.560] questions and our attorney objected. And they just did it anyway. They were all interconnected.
[01:57:56.560 --> 01:58:01.920] They didn't even, the father, now we're looking at the documents, the father didn't even sign the
[01:58:01.920 --> 01:58:06.400] notes. Okay, well, listen, Suzanne, we're at the end of the show. We're at the end of the show.
[01:58:06.400 --> 01:58:13.120] I'm sorry. We have to go now. The show's over. But listen, like Randy said, you need to write down
[01:58:13.120 --> 01:58:19.680] in chronological order, the facts as they happen and try not to jump around in time order very much.
[01:58:19.680 --> 01:58:25.840] And I'm thinking that for sure the only way you're going to get any remedy is to file a lawsuit in
[01:58:25.840 --> 01:58:32.640] the federal court as plaintiffs, not the state court because that whole situation is a cluster.
[01:58:32.640 --> 01:58:37.440] But in federal court, you're going to need to start a new action and you may want to call back
[01:58:37.440 --> 01:58:41.920] on a Thursday or Friday. You've been calling in on Mondays and Randy is on the air with us on
[01:58:41.920 --> 01:58:47.120] Thursdays and Fridays. Yeah, Suzanne, if you'll send me an email, I will send you a chronology
[01:58:47.120 --> 01:58:52.480] example and template to use to make your entries in so that you can get this stuff in order.
[01:58:52.480 --> 01:58:56.400] Yes, absolutely. Tell us the way you're telling it. It's very hard to follow.
[01:58:56.400 --> 01:59:12.880] OK, please use this. We'll be back on Thursday.
