[11:39.760 --> 11:45.720]  find anything that requires a trust to either be registered with the Secretary of State
[11:45.720 --> 11:49.400]  or even with a county recorder as an entity.

[11:51.040 --> 11:58.800]  There's no requirements at all to make the entity known to the state in any manner whatsoever.

[14:44.320 --> 14:47.280]  the transfer or a third person.
[14:47.280 --> 14:53.320]  A property owner's testamentary transfer to another person as trustee for a third person.
[14:53.320 --> 14:58.680]  An appointment under a power of appointment to another person as trustee for the donnie
[14:58.680 --> 15:00.520]  of the power or for the third person.
[15:00.520 --> 15:05.840]  These are all different conditions and they don't define in Title IX what declaration

[15:06.840 --> 15:11.520]  If that means privately declared or publicly declared, but again I can't find any filing
[15:11.520 --> 15:19.360]  requirements and so I mean to me it looks like there's no forms in the state of Texas.

[19:35.400 --> 19:44.480]  A trust is not like a corporation, a corporation has a very specifically defined structure.
[19:44.480 --> 19:52.880]  It seems to me that a trust is just a way of defining a certain type of a contract.
[19:52.880 --> 19:56.760]  A private, generally a private contract between individuals.
[19:56.760 --> 20:06.080]  A trust is not some specifically structured, highly designed legal entity.
[20:06.080 --> 20:10.800]  Just agreement between two or three people to do certain things and because of the way
[20:10.800 --> 20:19.200]  they make the agreement, it involves one person acting in behalf of another and that's what
[20:19.200 --> 20:20.200]  becomes a trust.
[20:20.200 --> 20:27.840]  So Don, am I right about this, that a trust is really kind of nebulous that way?
[20:27.840 --> 20:32.840]  It is, supposed to be and it works great that way and it's like open ended.
[20:32.840 --> 20:38.000]  And every trust can be different, very different, but it is just a contractual relationship
[20:38.000 --> 20:39.800]  and you can set it up however you want.
[20:39.800 --> 20:47.480]  And that's kind of what it looks to me according to the statute as well, that there's not like
[20:47.480 --> 20:55.600]  a specific type of structure that is imposed regarding a quote unquote statutory trust
[20:55.600 --> 20:59.280]  under the trust law, at least in the state of Texas.
[20:59.280 --> 21:05.200]  There are some restrictions, you know, like you can't set up a trust for the purpose of
[21:05.200 --> 21:06.200]  something illegal.
[21:06.200 --> 21:10.200]  That's determined and the courts can dissolve the trust and things like that.
[21:10.200 --> 21:15.720]  You know, there's certain things, but there's no like specific like filing requirements
[21:15.720 --> 21:21.280]  regarding you have to register it with the secretary of state or anything like that,
[21:21.280 --> 21:26.160]  whereas that's a huge difference between the trust and an association.
[21:26.160 --> 21:29.480]  Associations have to be registered with the secretary of state.
[21:29.480 --> 21:34.480]  Associations and LLCs, these all have to have specific type of incorporated structures.
[21:34.480 --> 21:39.960]  Well, I mean, an association is not necessarily incorporated, but with the trust statute here
[21:39.960 --> 21:46.200]  in Texas, it pretty much is open ended that you can make it be just about whatever you

[21:58.160 --> 22:03.560]  it looks like these private contract trusts actually do qualify as statutory trust, at
[22:03.560 --> 22:05.400]  least in the state of Texas.
[22:05.400 --> 22:11.000]  Well, I've had, that's been my concern with trying to understand trust.
[22:11.000 --> 22:20.240]  People keep talking about trust as if they are specific discrete objects.
[22:20.240 --> 22:23.840]  And as I learned more about them and, you know, and I'd ask people, well, what exactly
[22:23.840 --> 22:24.840]  is a trust?
[22:24.840 --> 22:30.080]  And they would talk about how to create what they call the trust.
[22:30.080 --> 22:34.880]  And finally, it became clear that it like a lien.
[22:34.880 --> 22:35.880]  People say, show me the lien.
[22:35.880 --> 22:38.920]  Well, you can't touch or feel a lien.
[22:38.920 --> 22:43.640]  It's just a relationship.
[22:43.640 --> 22:45.120]  I do some work for you.
[22:45.120 --> 22:46.800]  You don't pay me for it.
[22:46.800 --> 22:49.700]  The lien is not something that's physical.
[22:49.700 --> 22:51.680]  It's created as a matter of law.
[22:51.680 --> 23:00.040]  The trust is merely defining a relationship between individuals, a certain kind of relationship
[23:00.040 --> 23:08.320]  So the answer to my question might be yes, as long as the terms of the contract do not
[23:08.320 --> 23:17.640]  violate the statute of the trust statute, then it could, this entity could also qualify
[23:17.640 --> 23:23.520]  as a quote statutory trust and not just a private contract.
[23:23.520 --> 23:27.720]  If you want to claim that, I would say that's something you have to claim.
[23:27.720 --> 23:29.200]  But if you want to claim that, I guess you could.
[23:29.200 --> 23:33.840]  And if you wanted to claim it's non statutory, I guess you could claim that too.
[23:33.840 --> 23:36.040]  What does statutory mean?
[23:36.040 --> 23:43.640]  Does that just mean that this particular contract is in compliance with existing statutes?
[23:43.640 --> 23:52.600]  Suppose you just made a contract that happened to me fall within the requirement.
[23:52.600 --> 23:54.160]  That doesn't mean you were intending to do that.
[23:54.160 --> 23:56.000]  It just may have randomly done that.
[23:56.000 --> 24:01.440]  I'd say statutory means that the legislature has set out specific things that you must
[24:01.440 --> 24:04.320]  do if you want to be called this.
[24:04.320 --> 24:06.000]  And I would always call it not a trust.
[24:06.000 --> 24:08.800]  I don't say that I'm a trustee of a trust.
[24:08.800 --> 24:13.160]  It's just a private contract in the form of a pure trust.
[24:13.160 --> 24:15.920]  And there are lots of different types of trusts you could have a private contract to look
[24:15.920 --> 24:17.260]  like.
[24:17.260 --> 24:19.800]  But it just looks like certain things.
[24:19.800 --> 24:21.640]  But like you say, it's just ink on paper.
[24:21.640 --> 24:23.920]  It's just a relationship.
[24:23.920 --> 24:27.920]  And it falls under your unlimited rights contract under the Constitution.
[24:27.920 --> 24:34.440]  Now Don, you are correct when it comes to like the statutory entity under the trust
[24:34.440 --> 24:35.440]  law.
[24:35.440 --> 24:39.640]  And it says a trust is created under these certain circumstances.
[24:39.640 --> 24:41.440]  And there are specific guidelines and restrictions.
[24:41.440 --> 24:51.240]  And if all those things are followed, then by the trust law, I guess it would be a trust.
[24:51.240 --> 24:54.640]  And so I guess my question is a little more abstract.
[24:54.640 --> 24:57.680]  It's not so much having to deal specifically with trust.
[24:57.680 --> 25:07.760]  But in any situation, call it whatever you want, not necessarily a trust, but any statutorily
[25:07.760 --> 25:09.640]  defined entity.
[25:09.640 --> 25:18.280]  If a private contract satisfies all the restrictions, regulations, requirements, whatever of a certain
[25:18.280 --> 25:28.200]  statutorily defined entity, does it not necessarily then also be a statutory entity and not just
[25:28.200 --> 25:29.200]  the private contract?
[25:29.200 --> 25:31.440]  I mean, it doesn't really matter, trust or anything else.
[25:31.440 --> 25:34.040]  That's really my question of law.
[25:34.040 --> 25:39.720]  Is there such a thing as an entity, like a trust entity?
[25:39.720 --> 25:45.840]  Or is the statutory requirements just defining limits of certain kinds of contracts?
[25:45.840 --> 25:49.920]  You know, it's specifically for an entity called a trust.
[25:49.920 --> 25:53.200]  And it's even called the Texas Trust Code.
[25:53.200 --> 26:01.920]  And the only restrictions regarding naming an entity, where I found on the Secretary
[26:01.920 --> 26:08.720]  of State website, is that if you want to, you can't use the name, you can't use the
[26:08.720 --> 26:16.000]  word bank, and you can't use the word trust in the name of an entity that you want to
[26:16.000 --> 26:23.440]  register as like an incorporated entity with the Secretary of the State, unless you get
[26:23.440 --> 26:27.520]  permission from the Texas Banking Commission.
[26:27.520 --> 26:35.800]  And it said specifically regarding trust, that the word trust implies all the powers
[26:35.800 --> 26:37.880]  of a trust.
[26:37.880 --> 26:44.960]  And so, if you want to incorporate an entity with the word trust as part of its name, you
[26:44.960 --> 26:47.600]  have to get permission from the Texas Banking Commission.
[26:47.600 --> 26:56.800]  But that is in the BOC law, that's in the business code, that's not in the property
[26:56.800 --> 26:57.800]  code.
[26:57.800 --> 27:02.000]  See, in Texas, the trust statute falls under the property code.
[27:02.000 --> 27:07.000]  So it seems to me that, at least in Texas, the trust is really just like a private contract,
[27:07.000 --> 27:08.880]  which is exactly what we're talking about.
[27:08.880 --> 27:10.840]  Now, in other states, it may be different.
[27:10.840 --> 27:11.840]  I don't know.
[27:11.840 --> 27:18.640]  Yeah, I just want to mention, my wife just mentioned, this was in the paper, I saw this.
[27:18.640 --> 27:22.800]  Now, a sitting president, or even a former president, cannot accept gifts from foreign
[27:22.800 --> 27:23.800]  countries.
[27:23.800 --> 27:31.200]  But Bush, the elder Bush, in Houston, he received a 747 load of stuff, and I saw this, he received
[27:31.200 --> 27:35.680]  gold statues and all this stuff from the Saudis after the Gulf War.
[27:35.680 --> 27:36.680]  How did he do it?
[27:36.680 --> 27:37.680]  He didn't accept it.
[27:37.680 --> 27:38.680]  It was in a trust.
[27:38.680 --> 27:43.880]  There was some trust he had set up that received all this stuff, and somehow he has a relationship
[27:43.880 --> 27:45.960]  to it, probably as a trustee.
[27:45.960 --> 27:50.440]  But he received all these goodies from foreign dignitaries that he couldn't receive personally,
[27:50.440 --> 27:53.280]  but they could put it into a trust that he controlled.
[27:53.280 --> 27:54.280]  Right.
[27:54.280 --> 27:55.960]  I remember seeing it.
[27:55.960 --> 28:02.640]  Now, Don, I wanted to ask you, too, when we were chatting on Skype a little while ago
[28:02.640 --> 28:08.360]  during Dennis' interview, you were mentioning something about that associations may be a
[28:08.360 --> 28:14.960]  relatively new type of entity, whereas trusts have been around for hundreds of years, 200
[28:14.960 --> 28:20.080]  years at the least, and that there is a long history of common law associated with trust.
[28:20.080 --> 28:26.280]  So I would like you to just extrapolate on that a little bit in the strength of trust.
[28:26.280 --> 28:32.600]  I don't know too much history, but I do know Kings of England have set up trusts to separate
[28:32.600 --> 28:41.200]  themselves personally from property and valuables that they wanted to control, but have it separate
[28:41.200 --> 28:42.200]  from them.
[28:42.200 --> 28:48.040]  So I know it's been around for Kings of England back in the 1700s, I know it has done that,
[28:48.040 --> 28:50.000]  but I can't cite any specific thing.
[28:50.000 --> 29:01.600]  I've heard that Paul Revere had set up a trust, and that it's still in service today, still
[29:01.600 --> 29:02.600]  in service.
[29:02.600 --> 29:03.600]  I don't know if that's true or not.
[29:03.600 --> 29:07.240]  I had just heard that hearsay information, but it's interesting.
[29:07.240 --> 29:15.080]  But it has been around a long time to separate your estate from property so that you're not
[29:15.080 --> 29:23.000]  responsible for liabilities associated with that property, but you can control it.
[29:23.000 --> 29:27.700]  And I have heard, of course I don't know, another hearsay, but I've heard that wealthy
[29:27.700 --> 29:33.080]  people put stuff in trusts, lots of trusts, but they're swimming pool in one trust, and
[29:33.080 --> 29:37.120]  anything that has a liability to it goes into a separate trust.
[29:37.120 --> 29:38.120]  Right.

[32:19.940 --> 32:28.940]  As I think, as I recall, some monasteries or churches in England were put into a trust
[32:28.940 --> 32:33.940]  rather than owned by the church to keep them from being destroyed,
[32:33.940 --> 32:39.940]  like in Henry, I think, because he was needing money,
[32:39.940 --> 32:44.940]  so he was looting churches to get their valuables, to get money.
[32:44.940 --> 32:48.940]  I think some churches were put into a trust so he couldn't get, supposedly he couldn't get to them.
[32:48.940 --> 32:53.940]  But I do want to mention, we're talking on the break and before,
[32:53.940 --> 32:58.940]  I believe the trust, the contract is the law, the law of trust.
[32:58.940 --> 33:04.940]  I have sent you a link on Google, Google Books about Loring's Trust from the 1800s, 1840s or something.
[33:04.940 --> 33:05.940]  Right.
[33:05.940 --> 33:07.940]  They scan his book and read that.
[33:07.940 --> 33:09.940]  That's good information.
[33:09.940 --> 33:11.940]  The law of trust, well, the trust is the law.
[33:11.940 --> 33:17.940]  When you go for a judge, on any contract, he's going to look to see who fulfilled the contract and who didn't.
[33:17.940 --> 33:18.940]  The contract is the law.
[33:18.940 --> 33:24.940]  The trust document and all the minutes of all the trustees, that is the law of the trust.
[33:24.940 --> 33:25.940]  Right.
[33:25.940 --> 33:32.940]  So it does fall under, like, say, the laws of commerce then because it's a contract or it falls under the contract law.
[33:32.940 --> 33:38.940]  Well, I don't know about that, but I just know that the contract itself is the law,
[33:38.940 --> 33:42.940]  and if there's any adjudication that has to be done, that's what he has to look at.
[33:42.940 --> 33:49.940]  He can't look at, theoretically, what I've understood all these years, he really can't look at what somebody else wrote.
[33:49.940 --> 33:55.940]  He has to look at the document they're working off of and make a decision who followed it, who didn't follow it.
[33:55.940 --> 33:56.940]  Right.
[33:56.940 --> 34:03.940]  And yes, the IRS, when they want to go after somebody, they want to bust the trust because they're making money.
[34:03.940 --> 34:04.940]  They can't tax it.
[34:04.940 --> 34:07.940]  But they have to bust it, they say, as we talked about, an illegal entity.
[34:07.940 --> 34:09.940]  Well, artificial entity.
[34:09.940 --> 34:10.940]  Well, it is an artificial entity.
[34:10.940 --> 34:15.940]  It's one you create rather than the legislature created or somebody else created.
[34:15.940 --> 34:17.940]  So yes, it's an artificial entity.
[34:17.940 --> 34:21.940]  But, you know, you can defend it like you were saying.
[34:21.940 --> 34:28.940]  You can defend it by saying, as a fallback position, hey, look, it meets all the requirements the legislature set out.
[34:28.940 --> 34:30.940]  How can it be illegal?
[34:30.940 --> 34:31.940]  Right.
[34:31.940 --> 34:36.940]  Now, see, that was the point I was trying to make just by bringing this whole issue up,
[34:36.940 --> 34:46.940]  of can a private contract created entity also qualify as a statutory entity, as in the trust laws here in Texas?
[34:46.940 --> 34:53.940]  And, Don, you were saying earlier, we were talking about this yesterday, you were saying just because it looks like it doesn't necessarily mean that it is
[34:53.940 --> 35:00.940]  and that you might have to declare that it is somehow, whether in public record or on paper or something.
[35:00.940 --> 35:07.940]  And in the Texas trust law, there is nothing that I've been able to find that requires any kind of public declaration.
[35:07.940 --> 35:11.940]  It just says declaration, and the word declaration is not defined in Title IX.
[35:11.940 --> 35:13.940]  So I guess that could be a private declaration.
[35:13.940 --> 35:15.940]  It could be any kind of declaration you want.
[35:15.940 --> 35:20.940]  And, you know, I guess we'd have to maybe look up any kind of overriding definition in that case.
[35:20.940 --> 35:27.940]  But the point I was trying to make, well, Don, you were saying was that you like to function more on the private side
[35:27.940 --> 35:32.940]  instead of the public side or the statutory side, and so you prefer that.
[35:32.940 --> 35:41.940]  And so why would you want to also say that it's also a statutory trust?
[35:41.940 --> 35:48.940]  And my goal here, or I guess my line of thinking or logic, was that say you've got this private trust,
[35:48.940 --> 35:55.940]  this private contract in the form of a pure trust, and say somehow the government breaks it illegally
[35:55.940 --> 35:58.940]  because they don't have the right to impair on any contract.
[35:58.940 --> 36:00.940]  Well, say they do anyway.
[36:00.940 --> 36:05.940]  Say they break the trust and say it's a sham because it's not a statutory entity, okay,
[36:05.940 --> 36:09.940]  or it's not some kind of incorporated entity or whatever, and so they dissolve,
[36:09.940 --> 36:15.940]  they just throw it out the window in court just because it's a contract and it's not a, quote, real trust.
[36:15.940 --> 36:21.940]  Well, if, and say they are able to subpoena the private contract and they force you to hand it over
[36:21.940 --> 36:25.940]  or else sit in jail for the rest of your life for contempt or whatever.
[36:25.940 --> 36:26.940]  And so, well, what are you going to do?
[36:26.940 --> 36:29.940]  Sit in jail for the rest of your life or are you going to hand over the private contract?
[36:29.940 --> 36:32.940]  And so say they manage to get the contract.
[36:32.940 --> 36:40.940]  Well, if the contract satisfies all the restrictions and requirements of a statutory trust,
[36:40.940 --> 36:44.940]  then you could go back to the government and say, well, hey, okay,
[36:44.940 --> 36:47.940]  you don't like the fact that I created this private contract trust entity.
[36:47.940 --> 36:48.940]  You throw that out the window.
[36:48.940 --> 36:49.940]  Well, guess what?
[36:49.940 --> 36:54.940]  It's a statutory trust because, look, all the terms and conditions of the original paperwork
[36:54.940 --> 36:59.940]  satisfy all the restrictions and regulations as laid out in the statutory trust law.
[36:59.940 --> 37:00.940]  So take those cookies.
[37:00.940 --> 37:02.940]  You know, now what are you going to do about it?
[37:02.940 --> 37:06.940]  Yeah, that sounds like a good defense.
[37:06.940 --> 37:10.940]  What do you have to say about it, Randy?
[37:10.940 --> 37:12.940]  Is Randy there?
[37:12.940 --> 37:21.940]  Yeah, I'm here. I'm having trouble getting past the fact that it's simply a contract.
[37:21.940 --> 37:26.940]  And if it's just a contract, I want to go back to the Constitution
[37:26.940 --> 37:30.940]  and tell them this is a private contract but out.
[37:30.940 --> 37:34.940]  Well, the problem with that, Randy, is that the IRS and other government entities
[37:34.940 --> 37:37.940]  have been slamming that and ignoring that.
[37:37.940 --> 37:42.940]  And so that's why I was looking at the additional fallback defense
[37:42.940 --> 37:46.940]  to say it's a statutory entity so that they can't break it
[37:46.940 --> 37:52.940]  because these high-minded constitutional arguments a lot of times are not flying in court.
[37:52.940 --> 37:56.940]  Now, Don, you did tell me about a situation that you heard of,
[37:56.940 --> 38:00.940]  and maybe you could send me a link to the case or the case number or whatever,
[38:00.940 --> 38:03.940]  and this was in California, I believe you told me,
[38:03.940 --> 38:07.940]  where there was a private contract trust and the judge,
[38:07.940 --> 38:11.940]  the court demanded the documents of the trust,
[38:11.940 --> 38:15.940]  and it was a private contract and the gentleman had an oath to that effect.
[38:15.940 --> 38:21.940]  And so I believe what you were telling me is that he brought the original private contract trust documents
[38:21.940 --> 38:26.940]  in a locked box with the key, and the box was locked, and he had his oath with him,
[38:26.940 --> 38:31.940]  and he presented the oath to the court and said, Your Honor, this is my oath.
[38:31.940 --> 38:33.940]  I took an oath of secrecy, an oath of privacy.
[38:33.940 --> 38:34.940]  Here it is.
[38:34.940 --> 38:35.940]  It's notarized.
[38:35.940 --> 38:41.940]  And so if the court is going to order me to violate my oath and open the locked box,
[38:41.940 --> 38:44.940]  then I will do it, but you're going to have to order me to do that.
[38:44.940 --> 38:49.940]  And you said that the judge did not order him to violate his oath and open the box.
[38:49.940 --> 38:52.940]  That was going to tell that story, but you just told it.
[38:52.940 --> 38:55.940]  Sorry, I just told the thunder.
[38:55.940 --> 38:57.940]  I didn't want to tell the story, but you told it really great.
[38:57.940 --> 39:02.940]  Yeah, that's back in the 90s when we were in Dallas in our trust study group,
[39:02.940 --> 39:04.940]  and that guy told me that.
[39:04.940 --> 39:08.940]  They did, and the judge refused to order him to violate that oath he took.
[39:08.940 --> 39:09.940]  That was the end of that.
[39:09.940 --> 39:10.940]  That was the end of the lawsuit.
[39:10.940 --> 39:11.940]  Somebody was suing the trust.
[39:11.940 --> 39:16.940]  I think he had a business, and he had some machinery in a building,
[39:16.940 --> 39:19.940]  maybe like a printing press, and he had several pieces of machinery.
[39:19.940 --> 39:21.940]  Each one belonged to a different trust.
[39:21.940 --> 39:22.940]  Somebody got injured.
[39:22.940 --> 39:23.940]  I believe this is a story.
[39:23.940 --> 39:27.940]  Somebody got injured, tried to sue him, said, look, it's in the trust.
[39:27.940 --> 39:28.940]  You've got to sue the trust, not mine.
[39:28.940 --> 39:32.940]  And so they tried to sue the trust, and that was the end of the lawsuit right there.
[39:32.940 --> 39:34.940]  Didn't turn over the documents, didn't have a lawsuit.
[39:34.940 --> 39:35.940]  That was the end of it.
[39:35.940 --> 39:36.940]  Right.
[39:36.940 --> 39:41.940]  And see, the reason that I'm interested in whether or not it may also qualify as a statutory trust
[39:41.940 --> 39:45.940]  is say the intent of the lawsuit, whether by the government or the creditor,
[39:45.940 --> 39:51.940]  is to get at the personal assets of the trustee, okay, that that's the goal, all right?
[39:51.940 --> 39:59.940]  And so say in a situation similar to this, say a judge would order somebody to open the box
[39:59.940 --> 40:03.940]  and submit the documents, and then the court says, you know, forget this.
[40:03.940 --> 40:04.940]  This is just a contract.
[40:04.940 --> 40:06.940]  This isn't a real trust entity.
[40:06.940 --> 40:11.940]  Well, at that point, if you could show that the original trust contract documents
[40:11.940 --> 40:16.940]  satisfied the requirements and regulations with statutory trust, then you could say, well, guess what?
[40:16.940 --> 40:19.940]  It's a statutory trust, so now do something about it.
[40:19.940 --> 40:21.940]  So that was my only point.
[40:21.940 --> 40:22.940]  Yeah, that sounds like a good thing.
[40:22.940 --> 40:26.940]  Let me tell you one more story that happened to me personally on a child support.
[40:26.940 --> 40:30.940]  I had custody of my son, who's called into your soul a couple of times,
[40:30.940 --> 40:33.940]  but I had custody of him.
[40:33.940 --> 40:39.940]  His mother wanted custody of him and whatever, so I went back to Dallas, Fort Worth,
[40:39.940 --> 40:43.940]  and actually in this case, they were trying to find out the financials of the trust.
[40:43.940 --> 40:44.940]  I said, you know, I'm a trustee of a trust.
[40:44.940 --> 40:47.940]  I don't have a job.
[40:47.940 --> 40:51.940]  But anyway, she was trying, this judge was trying to find out the financials of the trust.
[40:51.940 --> 40:53.940]  I said, look, I have an oath of secrecy.
[40:53.940 --> 40:55.940]  I didn't bring it with me.
[40:55.940 --> 40:56.940]  I have an oath of secrecy.
[40:56.940 --> 40:57.940]  I can't divulge that information.
[40:57.940 --> 40:58.940]  It's private.
[40:58.940 --> 41:00.940]  Are you ordering me to violate that oath?
[41:00.940 --> 41:04.940]  She said, yes, just like that, and just snapped her finger, yes.
[41:04.940 --> 41:07.940]  I said, I didn't expect you to answer that, but I'll have to seek counsel on it,
[41:07.940 --> 41:09.940]  and that was the last it was ever brought up.

[46:02.940 --> 46:04.940]  these sham trusts they called them.
[46:04.940 --> 46:07.940]  And when it went up to Congress for a vote, it was voted down.
[46:07.940 --> 46:09.940]  It was voted down by quite a bit.
[46:09.940 --> 46:10.940]  It's almost the landslide.
[46:10.940 --> 46:13.940]  Almost nobody voted for it because they're all in trust.
[46:13.940 --> 46:16.940]  They put all their money in trust when they go into the office
[46:16.940 --> 46:19.940]  and they recognize the value of it.
[46:19.940 --> 46:22.940]  And so they can make billions of dollars on these trusts
[46:22.940 --> 46:25.940]  and their income doesn't show anything.
[46:25.940 --> 46:27.940]  They just show the salary that they get.
[46:27.940 --> 46:31.940]  But they funnel all the money, all the grass and corruption they get,
[46:31.940 --> 46:33.940]  I guess, into these trusts.
[46:33.940 --> 46:35.940]  So that was funny.
[46:35.940 --> 46:37.940]  So, okay, let's get back to the caller.
[46:37.940 --> 46:40.940]  Okay, Carl, please continue, Carl.

[46:41.940 --> 46:44.940]  Well, on that line of thought, when I go back to it,
[46:44.940 --> 46:49.940]  when you take the all-caps name of the individual that, you know,
[46:49.940 --> 46:55.940]  is a fiction entity, well, that's right.
[46:55.940 --> 46:57.940]  And that's an all-caps individual.
[46:57.940 --> 46:59.940]  And what is a trust?
[46:59.940 --> 47:05.940]  A trust is to absorb liability.
[47:05.940 --> 47:10.940]  The purpose of a trust is so that that entity can absorb,
[47:10.940 --> 47:15.940]  or that instrument can absorb the liability of a problem.
[47:15.940 --> 47:19.940]  So why not make the trust an all-caps entity and then go ahead
[47:19.940 --> 47:20.940]  and patent it?
[47:20.940 --> 47:24.940]  And then if someone tries to sue it or tries to come and break it,
[47:24.940 --> 47:27.940]  then you can go after them for patent infringement.
[47:27.940 --> 47:29.940]  I suppose that's one way you could do it.
[47:29.940 --> 47:31.940]  But watch your language.
[47:31.940 --> 47:34.940]  I would never say that that's the purpose of a trust,
[47:34.940 --> 47:36.940]  even though that may be a really good benefit.
[47:36.940 --> 47:41.940]  You know, the purpose of a trust is for some good benefit of family.
[47:41.940 --> 47:43.940]  Maybe you set up a family trust.
[47:43.940 --> 47:46.940]  And it's for the purpose, stated purpose in the trust documents
[47:46.940 --> 47:50.940]  that nobody's supposed to see unless, like Debra was saying,
[47:50.940 --> 47:51.940]  you're forced to.
[47:51.940 --> 47:57.940]  The purpose would be some altruistic thing to do for the benefit of the family.
[47:57.940 --> 48:01.940]  It may be that you have good protection,
[48:01.940 --> 48:04.940]  but you don't ever say that that's the purpose of it.
[48:04.940 --> 48:06.940]  You just hold that unsaid.
[48:06.940 --> 48:08.940]  That way you don't get in trouble.
[48:08.940 --> 48:12.940]  Yes, and also when I was doing my research on Texas trusts
[48:12.940 --> 48:19.940]  and reading on some of these attorneys' websites who set up trusts for people,
[48:19.940 --> 48:24.940]  one of the pieces of information on the FAQs of one of these attorneys' websites
[48:24.940 --> 48:31.940]  had to do with will a trust protect assets that are in the trust?
[48:31.940 --> 48:37.940]  The answer was no, because if a trust gets sued and the trust loses,
[48:37.940 --> 48:44.940]  then the assets that are in the trust can be leaned, levied, confiscated,
[48:44.940 --> 48:49.940]  whatever to satisfy the judgment of the lawsuit.
[48:49.940 --> 48:52.940]  And that's why if you really want asset protection,
[48:52.940 --> 48:55.940]  and I've heard this before from other people,
[48:55.940 --> 49:02.940]  a typical asset protection setup is that you will also use an LLC,
[49:02.940 --> 49:04.940]  a limited liability company,
[49:04.940 --> 49:09.940]  and in that event then you get protection in lawsuits.
[49:09.940 --> 49:14.940]  So they'll have situations like where a trust or one or more trusts
[49:14.940 --> 49:18.940]  will be the member owners of the LLC or vice versa.
[49:18.940 --> 49:23.940]  You'll have LLCs held in asset by trusts
[49:23.940 --> 49:27.940]  or some sort of setup like that in series.
[49:27.940 --> 49:33.940]  In Texas there's something called an LLC series setup according to a statutory setup.
[49:33.940 --> 49:40.940]  So yeah, I wouldn't say that a trust is for the purpose of absorbing some kind of liability,
[49:40.940 --> 49:44.940]  and in fact in Texas it absolutely will not.
[49:44.940 --> 49:49.940]  Whatever assets are held in the trust can be leaned if the trust loses a lawsuit.
[49:49.940 --> 49:54.940]  True, but think about this, the trustees have a fiduciary duty to protect the assets of the trust
[49:54.940 --> 49:57.940]  if they think they're going to be sued or if there's something coming up.
[49:57.940 --> 50:00.940]  I used to say they can't create another trust and transfer most of the assets into that.
[50:00.940 --> 50:04.940]  Well, there you go, and I don't think that that would be illegal.
[50:04.940 --> 50:07.940]  The courts have something to say about that.
[50:07.940 --> 50:15.940]  If you transfer ownership of property in order to avoid lien or levy, I think that's criminal.
[50:15.940 --> 50:19.940]  Well, in this case, no, this tastes like a machine.
[50:19.940 --> 50:21.940]  Somebody gets injured on a machine belonging to the trust.
[50:21.940 --> 50:23.940]  The trust may own a bank account.
[50:23.940 --> 50:27.940]  The money goes out of the bank account to another trust for another reason,
[50:27.940 --> 50:29.940]  but the machine stays in the trust.
[50:29.940 --> 50:30.940]  He can have the machine.
[50:30.940 --> 50:36.940]  Well, I think the point of the trust is that the machine is in one trust
[50:36.940 --> 50:40.940]  and the company operating the machine is in another trust.
[50:40.940 --> 50:42.940]  That's exactly right there, too.
[50:42.940 --> 50:47.940]  Yeah, you have separate trusts set up for all different property.
[50:47.940 --> 50:50.940]  Like if you own multiple pieces of property, each one is in a separate trust.
[50:50.940 --> 50:52.940]  Each bank account is in a separate trust.
[50:52.940 --> 50:54.940]  Here's an example case in point.
[50:54.940 --> 51:02.940]  When JFK Jr., when the plane went down in the ocean with his brand new bride,
[51:02.940 --> 51:08.940]  they had only been married a few months, and the plane crashed into the ocean.
[51:08.940 --> 51:13.940]  It's still not clear whether there was some kind of sabotage involved
[51:13.940 --> 51:18.940]  or whether it was just a situation of extremely bad weather, and he lost his bearings.
[51:18.940 --> 51:25.940]  Randy was saying that witnesses reported that the plane slowly spiraled down
[51:25.940 --> 51:31.940]  like in a very large spiraling circle, and Randy said that that's a typical indicator
[51:31.940 --> 51:36.940]  that someone doesn't know what their horizon is, and he thought he was flying straight,
[51:36.940 --> 51:38.940]  and he was actually at an angle and spiraled down.
[51:38.940 --> 51:41.940]  So based on that evidence, it could have been a total accident.
[51:41.940 --> 51:47.940]  But at any rate, the point is, Carolyn, I forgot what her maiden name was.
[51:47.940 --> 51:55.940]  Her family sued the Kennedy family over her death, over negligence.
[51:55.940 --> 52:03.940]  But the problem for Carolyn's family was that the plane was in a trust by itself
[52:03.940 --> 52:12.940]  with nothing else other than the pet cat, and so they lost their beloved family member,
[52:12.940 --> 52:17.940]  and all they got for it in return was the cat.
[52:17.940 --> 52:21.940]  That's true, and what Randy said is true individually.
[52:21.940 --> 52:26.940]  I don't know if that's true if a corporation or an entity does that.
[52:26.940 --> 52:31.940]  If an individual does it, yes, that's a crime, but if companies do that all the time,
[52:31.940 --> 52:37.940]  they transfer assets out when there's a problem, or it looks like there's going to be a problem.
[52:37.940 --> 52:39.940]  But I think that's what I think.
[52:39.940 --> 52:42.940]  What I've been reading, it's different for her.
[52:42.940 --> 52:52.940]  If you transfer the asset after a claim has become evident for the purpose of avoiding liability,
[52:52.940 --> 53:01.940]  then it's criminal, but if you transfer assets before it becomes evident, then it's not.
[53:01.940 --> 53:06.940]  And if you have multiple trust setups, then you don't have to worry about it.
[53:06.940 --> 53:08.940]  Yeah, there you go. That's true, too.
[53:08.940 --> 53:12.940]  And they're always handling that, and typically in trusts you have a number of them,
[53:12.940 --> 53:20.940]  and you have one trust that has the potential of creating liability, and that trust owns nothing.

[53:22.940 --> 53:25.940]  But that's her leases, everything from all the other trusts.

[01:08:15.940 --> 01:08:18.940]  and now they're realizing they need to have their property in a trust

[01:08:27.940 --> 01:08:30.940]  into the trust as long as there's a lien on it

[01:08:33.940 --> 01:08:36.940]  the remaining equity of the property
[01:08:36.940 --> 01:08:39.940]  into the trust but you cannot wholly

[01:21:09.940 --> 01:21:12.940]  quickly as you can the closer you get to
[01:21:12.940 --> 01:21:15.940]  the foreclosure sale the less likely the judge
[01:21:15.940 --> 01:21:18.940]  is to give you an injunction to stop the
[01:21:18.940 --> 01:21:21.940]  lender if you're already
[01:21:21.940 --> 01:21:24.940]  past foreclosure and a third party has
[01:21:24.940 --> 01:21:27.940]  purchased your properties very difficult
[01:21:27.940 --> 01:21:30.940]  to keep from being evicted in that case
[01:21:30.940 --> 01:21:33.940]  and this is because even if you can prove that you
[01:21:33.940 --> 01:21:36.940]  have lawful title the problem is once it's
[01:21:36.940 --> 01:21:39.940]  already gone to sale the courts have ruled that
[01:21:39.940 --> 01:21:42.940]  whoever buys it has the right to take possession
[01:21:42.940 --> 01:21:45.940]  and that has nothing to do with the title is that
[01:21:45.940 --> 01:21:48.940]  correct exactly and so if you want to get
[01:21:48.940 --> 01:21:51.940]  them and so then you would have to use your
[01:21:51.940 --> 01:21:54.940]  lawful right to title
[01:21:54.940 --> 01:21:57.940]  in order to get them out and so then
[01:21:57.940 --> 01:22:00.940]  that would be a whole another process so that's why you want to stop
[01:22:00.940 --> 01:22:03.940]  the foreclosure before it's completed and sold because
[01:22:03.940 --> 01:22:06.940]  even if you manage to get a
[01:22:06.940 --> 01:22:09.940]  no answer default in a situation
[01:22:09.940 --> 01:22:12.940]  if the house has already been sold even if you have the
[01:22:12.940 --> 01:22:15.940]  no answer default and you have lawful title
[01:22:15.940 --> 01:22:18.940]  the person who bought it still has can take possession
[01:22:18.940 --> 01:22:21.940]  so you would have to fight that issue
[01:22:21.940 --> 01:22:24.940]  a word of caution if you are
[01:22:24.940 --> 01:22:27.940]  in modification
[01:22:27.940 --> 01:22:30.940]  negotiations with the bank
[01:22:30.940 --> 01:22:33.940]  be very careful because they will give you
[01:22:33.940 --> 01:22:36.940]  notice of foreclosure and then
[01:22:36.940 --> 01:22:39.940]  stay the foreclosure based on the modification
[01:22:39.940 --> 01:22:42.940]  but if you miss one payment
[01:22:42.940 --> 01:22:45.940]  they can go ahead and foreclose and
[01:22:45.940 --> 01:22:48.940]  sell with no notice
[01:22:48.940 --> 01:22:51.940]  because they've already given you notice before the
[01:22:51.940 --> 01:22:54.940]  modification so they're using modification
[01:22:54.940 --> 01:22:57.940]  to trick people into a position of where they can sneak up
[01:22:57.940 --> 01:23:00.940]  behind them and foreclose on them
[01:23:00.940 --> 01:23:03.940]  so be real careful if you're in modification it's a scam
[01:23:03.940 --> 01:23:06.940]  yeah and that sounds like a similar situation with credit cards
[01:23:06.940 --> 01:23:09.940]  and these debt consolidation
[01:23:09.940 --> 01:23:12.940]  plans where you sign a contract to make
[01:23:12.940 --> 01:23:15.940]  you know a payment
[01:23:15.940 --> 01:23:18.940]  and it's an additional contract and then if you miss one payment
[01:23:18.940 --> 01:23:21.940]  they make it like an automatic judgment against you that's why the
[01:23:21.940 --> 01:23:24.940]  Mike Mears method is so much more desirable
[01:23:24.940 --> 01:23:27.940]  because you go after the violations of law
[01:23:27.940 --> 01:23:30.940]  that they have committed to just
[01:23:30.940 --> 01:23:33.940]  get out of the whole thing altogether it has nothing to do with the debt

[01:31:53.940 --> 01:31:58.940]  It's in lieu of something called an examining trial which is a hearing to determine probable cause
[01:31:58.940 --> 01:32:03.940]  And since it's held inside the jail no the public is not allowed in
[01:32:03.940 --> 01:32:07.940]  However because the laws in Texas require all court hearings to be public
[01:32:07.940 --> 01:32:11.940]  What they generally do is that they'll have a video camera
[01:32:11.940 --> 01:32:17.940]  And then there'll be an area where the public can go and sit and watch the Magistration hearings
[01:32:17.940 --> 01:32:23.940]  on some kind of a like closed circuit television situation. Randy and I have done that before
[01:32:23.940 --> 01:32:25.940]  I don't think they had that
[01:32:25.940 --> 01:32:29.940]  Okay well we're going to need more information on that
[01:32:29.940 --> 01:32:40.940]  You need to find out from the jail if it's possible for the public to view these hearings through closed circuit TV video
[01:32:40.940 --> 01:32:43.940]  You need to call and find that out
[01:32:43.940 --> 01:32:49.940]  In addition these are some of your assignments you need to get a copy of everything that's in your file
[01:32:49.940 --> 01:32:59.940]  You need to find out if the jail has a provision for the public to be able to view the Magistration hearings
[01:32:59.940 --> 01:33:04.940]  Through some kind of video situation in a waiting area somewhere else
[01:33:04.940 --> 01:33:09.940]  And also have you had any other hearing yet to date?
[01:33:09.940 --> 01:33:10.940]  No ma'am
[01:33:10.940 --> 01:33:16.940]  And to your knowledge they have not assigned you any court appointed attorney?

[01:33:40.940 --> 01:33:43.940]  What you need to do is you need to pull everything from your file
[01:33:43.940 --> 01:33:49.940]  Find out if there is any kind of provision at the jail for closed circuit viewing
[01:33:49.940 --> 01:33:51.940]  No facility for that
[01:33:51.940 --> 01:33:54.940]  Well there might be and you just may not know it so you've got to ask
[01:33:54.940 --> 01:33:59.940]  And get the person's name that tells you either yes or no
[01:33:59.940 --> 01:34:07.940]  Also what you need to do is you need to write a narrative of a very detailed narrative of what happened that night
[01:34:07.940 --> 01:34:13.940]  From beginning to end while this situation is still fresh in your memory
[01:34:13.940 --> 01:34:19.940]  Because you'll start remembering things that you may not remember when you're just talking about it
[01:34:19.940 --> 01:34:26.940]  And we're going to do another show walking through the due process laws in the state of Texas pretty soon

[01:35:02.940 --> 01:35:08.940]  I was the one that the cops got a 911 call of somebody shooting out of a vehicle similar to mine
[01:35:08.940 --> 01:35:11.940]  It was not me I got pulled over in front of my house
[01:35:11.940 --> 01:35:15.940]  They searched the vehicle came back to me and told me what they had stopped me for and the reason
[01:35:15.940 --> 01:35:19.940]  And I told them stupidly yes I do have my gun told them where it was
[01:35:19.940 --> 01:35:23.940]  And then they came back on me and said it wasn't concealed and arrested me for unlawful carry of the weapon
[01:35:23.940 --> 01:35:25.940]  That's the quick recap of it
[01:35:25.940 --> 01:35:32.940]  I've done my homework and I've been reading through the penal code and the criminal procedure
[01:35:32.940 --> 01:35:38.940]  And what I want to ask about first is criminal charges against these officers
[01:35:38.940 --> 01:35:45.940]  I've been able to come up with a whole list of things and I went through all the elements
[01:35:45.940 --> 01:35:52.940]  There's six of them that match almost exactly what they did and there's a couple I have questions on
[01:35:52.940 --> 01:35:59.940]  But my point I guess is I'm not really interested in getting these guys indicted
[01:35:59.940 --> 01:36:03.940]  And having these charges stick isn't really the whole goal
[01:36:03.940 --> 01:36:08.940]  And the secondary benefit is that they can't testify against me once I do file these
[01:36:08.940 --> 01:36:12.940]  So with that being said I've got six charges here
[01:36:12.940 --> 01:36:16.940]  One being fabrication of evidence, they all conspired to this whole deal
[01:36:16.940 --> 01:36:22.940]  There's aggravated kidnapping, official oppression, aggravated perjury and tampering with a government document
[01:36:22.940 --> 01:36:28.940]  So do I need to go that far and file all six charges against all six officers who were there?
[01:36:28.940 --> 01:36:30.940]  Absolutely
[01:36:30.940 --> 01:36:36.940]  The more charges you file the less likely they are of getting indicted
[01:36:36.940 --> 01:36:41.940]  When I file criminal charges against public officials I never want them indicted
[01:36:41.940 --> 01:36:43.940]  That is never my point
[01:36:43.940 --> 01:36:47.940]  That's the major difference between Randy's approach and mine
[01:36:47.940 --> 01:36:52.940]  Well I want to fix the system, I'm not interested in punishing someone
[01:36:52.940 --> 01:36:54.940]  Well Randy sometimes
[01:36:54.940 --> 01:36:59.940]  Well the thing is though when you fix a bad machinery if you've got a gear with messed up teeth
[01:36:59.940 --> 01:37:02.940]  You don't just patch the gear you replace it
[01:37:02.940 --> 01:37:03.940]  And Randy sometimes
[01:37:03.940 --> 01:37:08.940]  Yes but if you go in to get an indictment you're not going to get one and all you're going to do is fail every time
[01:37:08.940 --> 01:37:18.940]  Okay but Randy sometimes it requires some people being made examples of in order to fix the system
[01:37:18.940 --> 01:37:22.940]  I mean we don't want to come with empty threats
[01:37:22.940 --> 01:37:28.940]  When you discipline a child you don't threaten to spank him if he doesn't do what he's supposed to
[01:37:28.940 --> 01:37:35.940]  And then when he disobeys you, you don't spank him because then the child will not respect the parent
[01:37:35.940 --> 01:37:39.940]  Because they'll say oh yeah he's threatening to spank me but it doesn't really happen
[01:37:39.940 --> 01:37:45.940]  Now we have to go in there with full intention and if it doesn't happen well then it doesn't happen
[01:37:45.940 --> 01:37:48.940]  The threat is enough and we want to try to do it
[01:37:48.940 --> 01:37:51.940]  I'm with Eddie on this one
[01:37:51.940 --> 01:37:59.940]  And you know at first I wasn't but the longer they dragged this on I'm ready to drag them out you know
[01:37:59.940 --> 01:38:05.940]  What do you say Eddie you put them something about running them out of town on the rail or something like that
[01:38:05.940 --> 01:38:10.940]  Yeah well that or you know take them for a show them what a tall tree and a short rope looks like
[01:38:10.940 --> 01:38:13.940]  Just anything of that nature would work for them
[01:38:13.940 --> 01:38:17.940]  Okay so my next question is to get us to timing
[01:38:17.940 --> 01:38:23.940]  I haven't had my pretrial hearing yet because they've delayed me six times or they've reset me six times
[01:38:23.940 --> 01:38:28.940]  The last time the judge wasn't even there and I realized I should have moved to this mess there but I didn't
[01:38:28.940 --> 01:38:35.940]  So they've rescheduled me for my pretrial hearing for late next month
[01:38:35.940 --> 01:38:40.940]  I guess do I need to file those criminal charges against those officers before that pretrial hearing
[01:38:40.940 --> 01:38:44.940]  Yes now how long has this been going on
[01:38:44.940 --> 01:38:48.940]  It happened in August of last year
[01:38:48.940 --> 01:38:52.940]  And they've reset you six times in that amount of time
[01:38:52.940 --> 01:38:54.940]  Yes
[01:38:54.940 --> 01:39:02.940]  Okay I was just reading a Texas Appellate Court case today on speedy trial and delay of trial
[01:39:02.940 --> 01:39:07.940]  There's a possibility you may have something to go on with that as well
[01:39:07.940 --> 01:39:10.940]  Okay and what was that specifically
[01:39:10.940 --> 01:39:14.940]  Well send me an email and I'll send you a copy of the case
[01:39:14.940 --> 01:39:20.940]  It just goes into deciding how the court determines when a case has been delayed by rescheduling
[01:39:20.940 --> 01:39:24.940]  and exceeds the requirements of a speedy trial
[01:39:24.940 --> 01:39:27.940]  Okay I'd be interested in that for sure
[01:39:27.940 --> 01:39:31.940]  Okay so we'll say that those need to be filed before my pretrial hearing
[01:39:31.940 --> 01:39:35.940]  I've got a couple of quick more questions I can fly through
[01:39:35.940 --> 01:39:41.940]  I do have a lawyer on this bill and I'm really just got interested in all this stuff to double check what he's doing
[01:39:41.940 --> 01:39:47.940]  And there is a motion to suppress that he did file in the court file
[01:39:47.940 --> 01:39:52.940]  But there was no I guess there was no set date for it to be heard
[01:39:52.940 --> 01:39:57.940]  I guess whenever we come to that pretrial hearing will that automatically be heard if it's there in the court file
[01:39:57.940 --> 01:40:09.940]  If the attorney reminds the judge that there's still an open brief or petition on the docket that has not been responded to
[01:40:09.940 --> 01:40:18.940]  Okay but normally what the requirement is is the judge is not allowed to proceed to anything further in the chain of action
[01:40:18.940 --> 01:40:22.940]  until all pending issues have been addressed
[01:40:22.940 --> 01:40:24.940]  And this would be one of those
[01:40:24.940 --> 01:40:30.940]  A pretrial hearing is held for the purpose of hearing motions
[01:40:30.940 --> 01:40:32.940]  Okay now is that specifically
[01:40:32.940 --> 01:40:38.940]  Well under Code Criminal Procedure Chapter 28 it lists specifically what needs to happen in a pretrial
[01:40:38.940 --> 01:40:44.940]  So if I wanted to move let's say if I wanted to move to disqualify the officers and the magistrate
[01:40:44.940 --> 01:40:47.940]  That would be after the pretrial hearing right
[01:40:47.940 --> 01:40:49.940]  No that would be at the pretrial hearing
[01:40:49.940 --> 01:40:53.940]  At the pretrial hearing even though something is set apart in Article 28
[01:40:53.940 --> 01:41:01.940]  Well you're trying to disqualify them before their testimony is even accepted because their testimony is tainted by their actions
[01:41:01.940 --> 01:41:05.940]  Right and it does challenge the subject matter jurisdiction
[01:41:05.940 --> 01:41:06.940]  Correct
[01:41:06.940 --> 01:41:14.940]  I've talked to my lawyer and he did this whole deal and I guess he'll go through this pretrial for the $500 he charged me
[01:41:14.940 --> 01:41:17.940]  But he did tell me that he wants $750 if he goes to trial
[01:41:17.940 --> 01:41:23.940]  So can I use him just for the pretrial and then dump him and go pro se in the trial if they want to go that route
[01:41:23.940 --> 01:41:28.940]  What is the possible outcome if you're found guilty
[01:41:28.940 --> 01:41:32.940]  Well it's a Class A misdemeanor I haven't really looked into all that
[01:41:32.940 --> 01:41:34.940]  Class A can mean jail
[01:41:34.940 --> 01:41:39.940]  So I would not recommend that
[01:41:39.940 --> 01:41:48.940]  Okay and the thing is my only deal is that this guy was a recommendation from a friend and he's friends with that friend
[01:41:48.940 --> 01:41:51.940]  I mean we're friends through mutual friends I guess you could say
[01:41:51.940 --> 01:42:03.940]  So I can't really pin him down with the threat of bar grievances and all that stuff like I would need to in the event that he's not going to fully represent me
[01:42:03.940 --> 01:42:04.940]  Which he never will
[01:42:04.940 --> 01:42:09.940]  Well what you need to do is ensure that you know what he should be doing
[01:42:09.940 --> 01:42:15.940]  And friend or not this is your life and your freedom we're talking about
[01:42:15.940 --> 01:42:22.940]  If he is not doing what he should be doing then whose side of the bargain is not being upheld here yours or his
[01:42:22.940 --> 01:42:24.940]  Yeah that's true that's a good point
[01:42:24.940 --> 01:42:31.940]  So you cannot be afraid of doing what's necessary to make him protect you the way he's supposed to as an attorney
[01:42:31.940 --> 01:42:36.940]  Right that's a good way to look at it
[01:42:36.940 --> 01:42:43.940]  That is well that's all my questions for now as I dig deeper into this stuff you know this thing is kind of consuming me
[01:42:43.940 --> 01:42:49.940]  You know right after work I get off and look at all this stuff and end up doing it until about 2 o'clock in the morning

[01:46:16.940 --> 01:46:23.940]  And so if we just go in there with the sole intention, remember like Randy always says, what is your intended outcome?
[01:46:23.940 --> 01:46:30.940]  If our intended outcome has to do with anger and vengeance and these sorts of things and then it doesn't happen,
[01:46:30.940 --> 01:46:34.940]  well then we get our feelings hurt and we feel like there's no justice.
[01:46:34.940 --> 01:46:41.940]  So we have to realize that yes, it's likely that it's not going to happen, but I still believe we need to intend for it to happen.

[01:46:45.940 --> 01:46:50.940]  Yeah, it's not my personal intention to harm someone else.
[01:46:50.940 --> 01:46:53.940]  It's always my personal intention to fix the system.
[01:46:53.940 --> 01:47:01.940]  If someone happens to get clobbered really bad, sorry, Bubba, life is tough.
[01:47:01.940 --> 01:47:10.940]  When I presented the district attorney to the grand jury in Johnson County, the foreman was irate that I'd be presenting the district attorney
[01:47:10.940 --> 01:47:13.940]  and he was sure I had an axe to grind against him.
[01:47:13.940 --> 01:47:15.940]  And I told him, I don't have any axe to grind against this guy.
[01:47:15.940 --> 01:47:18.940]  He never prosecuted me, never prosecuted anybody I know.
[01:47:18.940 --> 01:47:22.940]  He said, then why are you doing this? Well, he committed a crime.
[01:47:22.940 --> 01:47:28.940]  He violated this law. And this is my job. This is my duty.
[01:47:28.940 --> 01:47:35.940]  I don't have to dislike him or want him harm. This is my job.
[01:47:35.940 --> 01:47:38.940]  And I don't want him indicted.
[01:47:38.940 --> 01:47:42.940]  And the district and the foreman said, if you don't want him indicted, why are you here?
[01:47:42.940 --> 01:47:46.940]  I said, well, because I'm here.
[01:47:46.940 --> 01:47:51.940]  And he's sitting out there wondering if you're going to end his career tomorrow.
[01:47:51.940 --> 01:47:53.940]  That's all I need.
[01:47:53.940 --> 01:48:01.940]  Next time I come to him with a complaint against a public official, he's not going to hide it from you.
[01:48:01.940 --> 01:48:02.940]  That's what I need.
[01:48:02.940 --> 01:48:07.940]  Now you, on the other hand, you have a duty I'm glad I don't have to deal with.
[01:48:07.940 --> 01:48:11.940]  You have to decide whether or not I gave you sufficient cause to believe he's committed a crime.
[01:48:11.940 --> 01:48:15.940]  I'm glad I'm not in your position.
[01:48:15.940 --> 01:48:17.940]  They didn't see the humor in all of that.
[01:48:17.940 --> 01:48:21.940]  And they wound up not inditing him. But it had its effect.
[01:48:21.940 --> 01:48:25.940]  Had they indicted him, I wouldn't have felt bad.
[01:48:25.940 --> 01:48:29.940]  I didn't do anything to harm him. What's my job?
[01:48:29.940 --> 01:48:39.940]  Well, and also, listen, Randy, I got a chat from someone who was saying that if this person was on a grand jury,
[01:48:39.940 --> 01:48:41.940]  he might go easy on a public official the first time.
[01:48:41.940 --> 01:48:48.940]  But if they kept seeing the same thing over and over, they would eventually want to throw the book at him.
[01:48:48.940 --> 01:48:52.940]  And like you're saying, no, we're not out to harm people, okay?
[01:48:52.940 --> 01:48:55.940]  But we are out for justice.
[01:48:55.940 --> 01:49:02.940]  And the thing is, they've harmed themselves through their own actions, and it's their karma, okay?
[01:49:02.940 --> 01:49:04.940]  So that's just all there is to it.
[01:49:04.940 --> 01:49:13.940]  Justice is justice, and righteousness is righteousness, and whichever side you fall on, it's still righteous.
[01:49:13.940 --> 01:49:16.940]  It's still justice. It's not a harm.
[01:49:16.940 --> 01:49:18.940]  Yeah, I'm not going to cut him any slack.
[01:49:18.940 --> 01:49:26.940]  I'm going to take my best shot, but only because that's my job, not because I want to have him harmed.
[01:49:26.940 --> 01:49:30.940]  It's like my grandkids. I love them dearly.
[01:49:30.940 --> 01:49:34.940]  But if one of them runs out in the road, I'm fixing to tan his hide.
[01:49:34.940 --> 01:49:39.940]  And I'm not going to do it out of anger or avarice. It's my job.
[01:49:39.940 --> 01:49:51.940]  If we do it that way, we'll be more effective, because if you don't go in angry, they can't manipulate you.
[01:49:51.940 --> 01:50:01.940]  If you simply go in to do your job, they won't be able to get you to do this little song and dance for them.
[01:50:01.940 --> 01:50:08.940]  When I go into courthouses, these guys hate to see me coming, because they can't entice me.
[01:50:08.940 --> 01:50:11.940]  They can't induce me to do stupid stuff.
[01:50:11.940 --> 01:50:20.940]  I come right at them. They do all the stuff they want to do, and when they're finished, I'm still coming right at them.

[01:50:39.940 --> 01:50:49.940]  Finally, they said they'll pay me $1,200, and I told them, pay me $1,200 plus court cost, $350, and send it to me by Thursday.
[01:50:49.940 --> 01:50:54.940]  I'm pretty sure they're going to be agreeable to that, so I think we'll have a W there.
[01:50:54.940 --> 01:51:00.940]  In the email, I said, in the alternative—Randy's going to like this—in the alternative, the plaintiff is ready to proceed,
[01:51:00.940 --> 01:51:09.940]  but remember, I stand on the shoulder of giants—Plato, Socrates, and Aristotle, but mostly Perry Mason.
