[05:17.040 --> 05:23.360]  of the Constitution and specifically in violation of the 13th Amendment regarding slavery because
[05:23.360 --> 05:30.560]  the health care law compels another person to provide services, which is basically slavery.
[05:30.560 --> 05:37.600]  She's asking him questions about this, very well-spoken woman, and this guy responds to
[05:37.600 --> 05:41.520]  her that the federal government can do most anything in this country.
[05:41.520 --> 05:44.800]  You should hear the response of the crowd.

[06:01.480 --> 06:06.380]  a privilege because of the legislation that passed earlier this year, but such a right
[06:06.380 --> 06:10.960]  is actually beyond the power of the federal government to confer, and this is because
[06:10.960 --> 06:11.960] ... Wait, let me finish.
[06:11.960 --> 06:17.120]  This is because it necessarily infringes the inalienable rights of other people, and the
[06:17.120 --> 06:22.200]  reason I say this is because in order to get health care services, those services have
[06:22.200 --> 06:27.680]  to be rendered by somebody else using their time, their energy, their knowledge, and their
[06:27.680 --> 06:28.680]  labor.
[06:28.680 --> 06:35.400]  This means that if any of us want health care and we have a right to it, then we necessarily
[06:35.400 --> 06:42.960]  have the right to compel others to provide those services or to pay for them for us.
[06:42.960 --> 06:47.760]  I have a two-part question, and the first one is, how can legislation such as this be
[06:47.760 --> 06:55.160]  constitutional when it seems to be in direct conflict with the 13th Amendment, which abolished
[06:55.160 --> 07:01.680]  slavery, the first thing, and the second thing is, if this legislation is constitutional,
[07:01.680 --> 07:07.240]  what limitations are there on the federal government's ability to tell us how to run
[07:07.240 --> 07:12.240]  our private lives?
[07:12.240 --> 07:28.400]  I think that there are very few constitutional limits that would prevent the federal government
[07:28.400 --> 07:34.480]  from rules that could affect your private life.
[07:34.480 --> 07:40.800]  Now, the basis for that would be, how does it affect other people?
[07:40.800 --> 07:47.600]  The Constitution specifically enumerates certain powers to the federal government and leaves
[07:47.600 --> 07:59.200]  all other authority to the state or the people, so the Constitution is very limited in what
[07:59.200 --> 08:05.240]  it can do, sir, and it specifically prohibits slavery.
[08:05.240 --> 08:10.240]  When you tell somebody you have a right to get a service from another, that's essentially
[08:10.240 --> 08:15.720]  saying, you get to make that person do something for you, and sir, that is a form of slavery.
[08:15.720 --> 08:20.000]  So my question is, how can this law be constitutional?
[08:20.000 --> 08:28.040]  But more importantly than that, if they can do this, what can't they?
[08:28.040 --> 08:38.600]  Is your question, is your answer that they can do anything?
[08:38.600 --> 08:49.240]  The federal government, yes, can, and do most anything in this country, but you can't, people

[08:50.240 --> 08:59.240]  You heard, you heard, people like you are destroying this nation.

[11:33.120 --> 11:39.360]  taxation to pay for the services being provided forcefully to another, all right?

[15:47.440 --> 15:53.280]  at the precinct, make sure it's empty, watch it all day long as the ballots are put in
[15:53.280 --> 15:58.520]  one by one to make sure they're not stuffed, watch as the ballots are taken out of the
[15:58.520 --> 16:04.840]  box at the precinct, not at the convention center, you know, because you lose a chain
[16:04.840 --> 16:11.560]  of custody, and then the ballots are taken out, they're counted by multiple people,
[16:11.560 --> 16:16.280]  and we have to watch over the shoulder of the counters to make sure that the tick marks
[16:16.280 --> 16:23.240]  get ticked in the right tally column, make sure the addition is correct, make sure that
[16:23.240 --> 16:29.040]  the right results, accurate results are posted on the precinct door, make sure that those
[16:29.040 --> 16:34.720]  results are properly reported to the county, and that all the precincts are added up properly,
[16:34.720 --> 16:41.400]  and that the county results are accurately reported to the state election officers, that's
[16:41.400 --> 16:46.760]  the only way we are going to be able to legitimately take back this country through elections,
[16:46.760 --> 16:52.200]  as long as the counting is done on machines, we don't have a chance, so at any rate, that's

[19:54.640 --> 20:00.280]  is I want to go over this article that was sent to me. There is an attorney whose name
[20:00.280 --> 20:08.720]  is Publius Holdoff and they basically submitted an article that shows exactly where the Constitution
[20:08.720 --> 20:17.200]  makes Judge Susan R. Bolton's ruling in the injunction case against Arizona absolutely
[20:17.200 --> 20:25.500]  illegal. There is no way a federal court has jurisdiction over anything involving a state
[20:25.500 --> 20:33.800]  and that is written right into the Constitution. For an example here, Holdoff references the
[20:33.800 --> 20:39.680]  style of the Arizona case and shows that it is made out state of Arizona and Janice K.
[20:39.680 --> 20:47.520]  Brewer, governor of the state of Arizona, in her official capacity as defendants. Now,
[20:47.520 --> 20:52.920]  as the attorney points out where it says state of Arizona and Janice K. Brewer in her official
[20:52.920 --> 21:00.040]  capacity, that puts it right squarely within the realm of Article 3, Section 2, Clause
[21:00.040 --> 21:06.760]  2 of the United States Constitution. And that clause specifically gives the United States
[21:06.760 --> 21:17.680]  Supreme Court original jurisdiction of the case, not any federal court. Okay? Now, this
[21:17.680 --> 21:24.640]  is from Federalist Paper No. 81, Alexander Hamilton's commentary. Let us now examine
[21:24.640 --> 21:28.560]  in what manner the judicial authority is to be distributed between the Supreme and the
[21:28.560 --> 21:33.800]  inferior courts of the Union. The Supreme Court is to be invested with original jurisdiction
[21:33.800 --> 21:41.040]  only in cases affecting ambassadors, other public ministers and consuls, and those in
[21:41.040 --> 21:50.560]  which a state shall be a party. Now, the way he commented on it is almost verbatim how
[21:50.560 --> 21:58.040]  it's written into the Constitution. I mean, it is practically identical. And he goes on
[21:58.040 --> 22:04.480]  to say, public ministers of every class are the immediate representatives of their sovereigns.
[22:04.480 --> 22:08.200]  All questions in which they are concerned are so directly connected with the public
[22:08.200 --> 22:14.360]  peace that, as well as for the preservation of this, as out of respect to the sovereignties
[22:14.360 --> 22:19.960]  they represent, it is both expedient and proper that such questions should be submitted in
[22:19.960 --> 22:26.840]  the first instance to the highest judicatory of the nation. Though consuls have not in
[22:26.840 --> 22:32.040]  strictness a diplomatic character, yet as they are the public agents of the nations
[22:32.040 --> 22:38.280]  to which they belong, the same observation is in a great measure applicable to them.
[22:38.280 --> 22:43.280]  In cases in which a state might happen to be a party, it would ill-suit its dignity
[22:43.280 --> 22:49.840]  to be turned over to an inferior tribunal. All right? Now, you would think the Attorney
[22:49.840 --> 23:00.360]  General of the United States would know this, but no. Just like this usurper in office,
[23:00.360 --> 23:06.280]  that he is surrounded by incompetents that have no qualifications for the positions they
[23:06.280 --> 23:13.240]  hold and holder appears to be no exception to that rule, he goes and files for an injunction
[23:13.240 --> 23:21.400]  in a federal court that has zero jurisdiction to hear the case or to make a ruling of any
[23:21.400 --> 23:30.560]  kind. Therefore, the injunction handed down by this Judge Susan R. Bolton is null and
[23:30.560 --> 23:37.760]  void on its face. Governor Brewer should stand up and announce in public that it is null
[23:37.760 --> 23:44.000]  and void, it is of no effect, it does not in any way, shape or form bind the state of
[23:44.000 --> 23:52.640]  California in any way, and we are enforcing our law as it is written. And the federal
[23:52.640 --> 23:58.320]  court can go jump in the proverbial lake. And that's exactly what she ought to do. Then
[23:58.320 --> 24:03.880]  she ought to send the Arizona State Troopers to the federal courthouse to arrest the judge
[24:03.880 --> 24:11.000]  for impersonating a public servant because she acted absent all jurisdiction, which makes
[24:11.000 --> 24:19.200]  her an imposter in office. Bolton should be in jail. And it would seem to me at this point
[24:19.200 --> 24:27.440]  Brewer would want to see that done, just out of spite. Okay, now, let's go down and take
[24:27.440 --> 24:35.160]  a look, see if I can find words written in here, exactly what the Constitution says.
[24:35.160 --> 24:40.140]  Now this is where the requirement for the federal government to step in and do something
[24:40.140 --> 24:45.960]  exists. It's an Article 4, Section 4, and it requires the federal government to protect
[24:45.960 --> 24:54.320]  each of the states against invasion. And they're not doing it. They're simply not doing it.
[24:54.320 --> 25:03.320]  Now that section also specifically states that the state can itself enforce it when

[25:30.040 --> 25:37.200]  Supreme Court shall have appellate jurisdiction. So in the case involving a state, the Supreme
[25:37.200 --> 25:44.080]  Court has original jurisdiction, not any inferior court, okay?
[25:44.080 --> 25:50.560]  Now let's go down and find the article here. Let's see.

[26:25.340 --> 26:29.640]  or proceedings to which ambassadors, other public ministers, consuls, or vice-consuls
[26:29.640 --> 26:34.440]  of foreign state are parties. All controversies between the United States
[26:34.440 --> 26:38.920]  and the state, all actions or proceedings by a state against the citizens of another
[26:38.920 --> 26:45.860]  state or against aliens. Now, they go on, this attorney goes on to show
[26:45.860 --> 26:49.720]  that this is a pretended law. Why?
[26:49.720 --> 26:57.360]  Because the Congress does not have the authority to alter strict mandates of the Constitution.
[26:57.360 --> 27:05.000]  They cannot take exclusive jurisdiction granted by the Constitution and make it non-exclusive
[27:05.000 --> 27:09.480]  and susceptible to opinions of the inferior courts.
[27:09.480 --> 27:14.640]  That would be supplanting the Constitution with legislation, which they cannot do, which
[27:14.640 --> 27:19.560]  we should not ever allow them to even think they can do.

[28:28.760 --> 28:34.880]  neighborhoods in Washington, D.C. are so old, most of them have lead pipes, well, the water
[28:34.880 --> 28:40.440]  department switched the kind of antibacterial agent it was using to treat the water.
[28:40.440 --> 28:43.820]  It had been using chlorine, which most cities use for a long time, and they switched to
[28:43.820 --> 28:48.440]  another chemical which is not as hazardous to your health as chlorine.
[28:48.440 --> 28:53.320]  It was a well-meaning intention at the beginning. However, no one considered how that would

[29:30.120 --> 29:38.000]  the CDC and all health agencies recommend that lead shouldn't be more than three parts

[32:50.440 --> 32:56.560]  for their immigration law. The federal court is absolutely without jurisdiction. Let me
[32:56.560 --> 33:01.880]  give you a little insight into Article 4, Section 4 of the United States Constitution.
[33:01.880 --> 33:07.020]  The United States shall guarantee to every state in this union a Republican form of government
[33:07.020 --> 33:13.400]  and shall protect each of them against invasion and on application of the legislature or of
[33:13.400 --> 33:20.240]  the executive when the legislature cannot be convened against domestic violence. It
[33:20.240 --> 33:25.640]  is right there in the Constitution that it is an absolute duty of the federal government
[33:25.640 --> 33:38.000]  to do this. So why then has Arizona simply not pressed for charges against Obama? Why
[33:38.000 --> 33:45.000]  have they not demanded articles of impeachment produced for his failure to uphold his oath
[33:45.000 --> 33:53.480]  of office and failure to uphold the Constitution in so many ways other than this one and just
[33:53.480 --> 34:03.960]  complete disregard for the laws under which he is required to operate? Why? I mean, personally,
[34:03.960 --> 34:08.360]  in a lot of ways, I don't agree with the Arizona law because of the things it would allow to
[34:08.360 --> 34:13.960]  be abused. I think it could have been written differently to ensure that. One of the problems
[34:13.960 --> 34:22.920]  being okay, how are you going to demand the production of papers from everyone when one
[34:22.920 --> 34:27.240]  of the issues we have right now is a complete invasion of privacy to demand papers whether
[34:27.240 --> 34:32.200]  you are required to have them or not? It doesn't matter whether you're an alien or not. One
[34:32.200 --> 34:36.960]  of the things they do is just interrogate you for your papers, no matter what state
[34:36.960 --> 34:43.640]  you're in and whether or not you're going across the border. I want to see identification.
[34:43.640 --> 34:47.760]  Give it to me now. I'm going to place you under arrest. You don't have to be crossing
[34:47.760 --> 34:52.440]  the border for that to happen anywhere in America. So that's one of the issues that
[34:52.440 --> 34:58.320]  I saw with this law when it comes out. I understand the reason for its implementation as I'm well
[34:58.320 --> 35:04.800]  aware also that some of the worst abuses have always been brought to us with the kindest
[35:04.800 --> 35:12.400]  of faces. We see it all the time. Let's take Social Security, for example. It was brought
[35:12.400 --> 35:20.040]  to us at one of the lowest spots in our nation's history. It was put out there as the save
[35:20.040 --> 35:28.080]  all so that this could never happen to people again, that it would be there for you when
[35:28.080 --> 35:31.920]  you got old, wouldn't have to worry about starving to death because you didn't have
[35:31.920 --> 35:38.960]  any money. It was promised that the funds would only be used for the purposes for which
[35:38.960 --> 35:44.640]  they were collected, that it would never be used in the general application of monies
[35:44.640 --> 35:50.720]  by the government, that the Social Security number and the card could never and would
[35:50.720 --> 35:56.960]  never be used for identification purposes and so on and so forth. And look at what it
[35:56.960 --> 36:04.120]  is today. This is my problem with what they do, whether it be the Arizona law or whether
[36:04.120 --> 36:10.920]  it be a federal law because any time they get it in place, it's just a matter of changing
[36:10.920 --> 36:16.760]  it to change what it was and what it was intended from the get-go. All they want is for you
[36:16.760 --> 36:21.040]  to let them get it in. Then they can come back behind your back and change it any time
[36:21.040 --> 36:29.960]  they want to. And again, we let them get away with this. Again, this is our fault. We've
[36:29.960 --> 36:36.320]  got to the point where it's just ridiculously easy for them to force things down our throat
[36:36.320 --> 36:43.840]  and tell us to swallow. Okay. So those are the issues with the Arizona problem right
[36:43.840 --> 36:50.680]  now. If I was governor of Arizona, I would be sending my state troopers to the federal
[36:50.680 --> 36:55.360]  court as we speak or to her house at this point since it's this late in the day. I'd
[36:55.360 --> 37:02.080]  be hauling her out of her jammies and sticking her in jail. That judge does not deserve any
[37:02.080 --> 37:09.920]  consideration whatsoever for her position as a judge because, my, she should not even
[37:09.920 --> 37:14.720]  be a judge if she's that in it and knowing what her jurisdiction is and isn't.
[37:14.720 --> 37:21.280]  Well, yes. Very clearly, Eddie, it's in the Constitution that the U.S. Supreme Court should
[37:21.280 --> 37:27.360]  have original jurisdiction. So let me ask you, say, you know, the Obama administration
[37:27.360 --> 37:33.840]  filed a lawsuit against the state of Arizona and they filed it in her court. What should
[37:33.840 --> 37:38.480]  she have done at that point? Should she have referred the case to the Supreme Court or
[37:38.480 --> 37:43.800]  just thrown it out or what? The only thing she could do is throw it out.
[37:43.800 --> 37:45.800]  Okay. She couldn't remand it to the Supreme Court.
[37:45.800 --> 37:47.440]  It wasn't filed in the Supreme Court. Okay.
[37:47.440 --> 37:50.760]  And just like what they do with us, if we file a suit in the wrong court, what do they
[37:50.760 --> 37:53.200]  do with us? They throw it out.
[37:53.200 --> 37:57.040]  Right. They do it without prejudice most of the time,
[37:57.040 --> 38:01.440]  but they throw it out because they can't remand it to a different court because it was not
[38:01.440 --> 38:05.940]  within their jurisdiction to act on at all. Right. Right.
[38:05.940 --> 38:11.400]  So they have no choice but to dismiss it and throw it out, which is exactly what she should
[38:11.400 --> 38:16.960]  have done. She doesn't have to wait for the opposition to say you don't have jurisdiction.
[38:16.960 --> 38:21.640]  The judge is required to know if they've got jurisdiction of a particular case.
[38:21.640 --> 38:25.240]  Right. Now, it's when they've got an argument before
[38:25.240 --> 38:32.760]  them stating and see this is where Holder's pleadings should get him an aggravated perjury
[38:32.760 --> 38:38.720]  charge and a fraud upon the court charge because his pleadings would have had to have stated
[38:38.720 --> 38:44.360]  this court has original jurisdiction under such and such and what do they cite? Federal
[38:44.360 --> 38:51.960]  law, not the Constitution. And Holder should know very well that that federal law is in
[38:51.960 --> 38:56.840]  direct conflict with the Constitution and is therefore null and void and grants this
[38:56.840 --> 39:03.400]  court no jurisdiction. He should know that. If he doesn't know that, then he should have
[39:03.400 --> 39:08.240]  made the effort to find out. And with as many other morons as these people
[39:08.240 --> 39:12.880]  have running around working in their office, not a single one of them could come up with
[39:12.880 --> 39:19.240]  this and understand it. You see where your money's going, folks? At least what little
[39:19.240 --> 39:23.400]  bit of it they steal in other ways to fund the government because most of it's certainly
[39:23.400 --> 39:27.120]  not going there. None of it from taxes, I'll tell you that.
[39:27.120 --> 39:31.920]  Absolutely not. That was in the Grace Commission report back in the days of Reagan, of President
[39:31.920 --> 39:41.200]  Reagan. An official U.S. Government Commission report stated that all of your income tax
[39:41.200 --> 39:47.040]  money goes to pay the interest to the private banksters, the Federal Reserve. Not one penny
[39:47.040 --> 39:52.480]  goes to any government service whatsoever. It's all borrowed into existence. And so we
[39:52.480 --> 39:58.480]  end up paying for all these social government programs and the military and everything else
[39:58.480 --> 40:03.680]  through the hidden tax called inflation, people. That's the way it works because if they raise
[40:03.680 --> 40:13.440]  taxes to pay for all the violent crime that they commit with these services and the military
[40:13.440 --> 40:18.080]  and everything, if they had to actually raise your taxes to pay for it, there would be a
[40:18.080 --> 40:23.680]  revolt. And so they just borrow the money into existence to pay for these programs.
[40:23.680 --> 40:30.360]  And we end up paying for it anyway through inflation. It's a hidden tax. And honestly,
[40:30.360 --> 40:37.360]  it's taxation without representation because we do not authorize this. We weren't taxed
[40:37.360 --> 40:43.360]  for it directly or indirectly, so to speak. It's not being paid for through either excise
[40:43.360 --> 40:50.000]  taxes or direct taxes. It's being paid for by inflation, through them just borrowing
[40:50.000 --> 40:56.040]  it into existence. So it's taxation without representation. These people are criminals.
[40:56.040 --> 41:04.880]  High treason. Always. Every government program, federal government program, high treason.
[41:04.880 --> 41:11.400]  Because all our income tax goes to pay for the interest on the debt to the Federal Reserve.

[42:22.600 --> 42:26.880]  get it through fraud. They're going to lie, cheat, and steal to get what they want in

[47:36.240 --> 47:38.240]  talk to them a little bit
[47:38.240 --> 47:41.240]  with still mostly just one or two word answers
[47:41.240 --> 47:44.240]  to very simple questions such as
[47:44.240 --> 47:46.240]  do you believe in God and do you pray
[47:46.240 --> 47:48.240]  and so on and so forth.
[47:50.240 --> 47:53.240]  But what it all boiled down to was
[47:53.240 --> 47:55.240]  they tricked him into making a statement
[47:55.240 --> 47:58.240]  that they turned around and used against him.

[48:01.240 --> 48:03.240]  that went all the way to the Supreme Court
[48:03.240 --> 48:06.240]  that he was never given his Miranda rights
[48:06.240 --> 48:11.240]  and he had invoked them by his remaining silent
[48:11.240 --> 48:14.240]  and refusing to answer the questions.
[48:14.240 --> 48:17.240]  Well, the Supreme Court for decades now
[48:17.240 --> 48:19.240]  has been chipping away at Miranda
[48:19.240 --> 48:22.240]  trying to find a way to get rid of it.

[48:23.240 --> 48:26.240]  It's because the way the judges on the
[48:26.240 --> 48:28.240]  Supreme Court have been packed in.
[48:28.240 --> 48:32.240]  You've got right now a minimum of four of them
[48:32.240 --> 48:35.240]  that have been there for quite a while
[48:35.240 --> 48:38.240]  and their sole purpose on that court
[48:38.240 --> 48:42.240]  is to remove individual protections
[48:42.240 --> 48:44.240]  and supplant them with
[48:44.240 --> 48:47.240]  governmental authority and protections.
[48:47.240 --> 48:49.240]  In other words, we're going to kick out
[48:49.240 --> 48:51.240]  the individual's rights so that we can give
[48:51.240 --> 48:53.240]  more expansive powers to government
[48:53.240 --> 48:55.240]  to invade those rights.
[48:55.240 --> 48:59.240]  And these justices have been working very hard
[48:59.240 --> 49:02.240]  without specifically overturning Miranda
[49:02.240 --> 49:05.240]  to minimize what it does.
[49:05.240 --> 49:09.240]  Now, this is an excerpt out of a white paper
[49:09.240 --> 49:11.240]  on this case and I want to read you
[49:11.240 --> 49:13.240]  a little bit of what it's got here.
[49:13.240 --> 49:16.240]  The first basic issue decided by the Supreme Court
[49:16.240 --> 49:18.240]  was whether Tompkins had invoked his right
[49:18.240 --> 49:21.240]  to silence before making the incriminating statement.
[49:21.240 --> 49:24.240]  Under Miranda, police must terminate an interrogation
[49:24.240 --> 49:26.240]  as soon as the suspect invokes his right
[49:26.240 --> 49:28.240]  to silence or requests a lawyer.
[49:28.240 --> 49:30.240]  Therefore, if Tompkins had invoked his right
[49:30.240 --> 49:32.240]  to silence before the point in the interrogation
[49:32.240 --> 49:34.240]  when he made the incriminating remark,
[49:34.240 --> 49:36.240]  the remark would have been obtained in violation
[49:36.240 --> 49:39.240]  of Miranda and hence inadmissible.
[49:39.240 --> 49:41.240]  This issue is pretty much a no-brainer.
[49:41.240 --> 49:43.240]  For Miranda itself, the court had said
[49:43.240 --> 49:45.240]  that interrogation must cease
[49:45.240 --> 49:47.240]  if the suspect indicates in any manner
[49:47.240 --> 49:50.240]  at any time prior to or during questioning
[49:50.240 --> 49:52.240]  that he wishes to remain silent.
[49:52.240 --> 49:55.240]  Here, Tompkins had remained uncooperative,
[49:55.240 --> 49:58.240]  almost entirely unresponsive and silent
[49:58.240 --> 50:00.240]  for nearly three hours.
[50:00.240 --> 50:01.240]  He had hardly spoken at all
[50:01.240 --> 50:04.240]  throughout a prolonged interrogation session.
[50:04.240 --> 50:06.240]  The current court, however, held that Tompkins
[50:06.240 --> 50:08.240]  had not invoked his right to silence
[50:08.240 --> 50:11.240]  by his near silence and uncooperative behavior.
[50:11.240 --> 50:14.240]  The only way the right to silence can be invoked,
[50:14.240 --> 50:16.240]  the court startlingly decreed,
[50:16.240 --> 50:19.240]  is by the suspect unambiguously and unequivocally
[50:19.240 --> 50:22.240]  stating his wish to remain silent.
[50:22.240 --> 50:24.240]  Since Tompkins did not say the words
[50:24.240 --> 50:28.240]  I want to remain silent or I do not want to talk to you,
[50:28.240 --> 50:31.240]  he had not invoked his right to silence.
[50:31.240 --> 50:33.240]  The court did not, however, require police
[50:33.240 --> 50:36.240]  to tell the suspect that specific words are required
[50:36.240 --> 50:39.240]  to invoke the right or that anything less
[50:39.240 --> 50:41.240]  than the magic words are insufficient
[50:41.240 --> 50:43.240]  to assert the right.
[50:43.240 --> 50:45.240]  Furthermore, the court held it was of no confidence
[50:45.240 --> 50:48.240]  that in the face of Tompkins' uncooperativeness,
[50:48.240 --> 50:50.240]  police failed prior to interrogating him
[50:50.240 --> 50:52.240]  to ask him any questions to clarify
[50:52.240 --> 50:55.240]  whether he was claiming his right to silence.
[50:55.240 --> 50:58.240]  The court therefore rejected Tompkins' claim
[50:58.240 --> 51:00.240]  that in violation of Miranda, he had been interrogated
[51:00.240 --> 51:04.240]  after asserting his right to remain silent.
[51:04.240 --> 51:07.240]  The court was thus counterintuitively holding
[51:07.240 --> 51:10.240]  that remaining silent in the face of police questioning
[51:10.240 --> 51:14.240]  does not by itself invoke the right to silence
[51:14.240 --> 51:16.240]  and that in order to invoke this right,
[51:16.240 --> 51:20.240]  the suspect is compelled to speak.
[51:20.240 --> 51:23.240]  The court was demanding that assertions of rights
[51:23.240 --> 51:28.240]  made by a secluded captive inside an interrogation room
[51:28.240 --> 51:32.240]  be asked specifically and clearly.
[51:32.240 --> 51:35.240]  The court was deeming it as too much of a burden on police
[51:35.240 --> 51:38.240]  to require them when an interrogatee's response
[51:38.240 --> 51:43.240]  to the advice of rights is ambiguous or equivocal
[51:43.240 --> 51:48.240]  to simply ask for clarification.
[51:48.240 --> 51:51.240]  Isn't that a little bit of a paradox, Eddie,
[51:51.240 --> 51:55.240]  that in order to invoke your right to remain silent,
[51:55.240 --> 51:57.240]  you have to say something?
[51:57.240 --> 52:01.240]  Well, I would contend that that depends on what dimension
[52:01.240 --> 52:04.240]  your brain is actually operating in.
[52:04.240 --> 52:07.240]  And I'm starting to think most of these justices
[52:07.240 --> 52:10.240]  are operating in dementia.
[52:10.240 --> 52:11.240]  Yeah.
[52:11.240 --> 52:17.240]  Because, all right, folks, let's jump out of the statements
[52:17.240 --> 52:19.240]  here for a second and let's go with a little bit of
[52:19.240 --> 52:22.240]  common sense learning process in this effort.
[52:22.240 --> 52:27.240]  First and foremost, if I have a right, okay,
[52:27.240 --> 52:32.240]  and you as a government official know I have this right,
[52:32.240 --> 52:37.240]  by what authority do you make an effort to violate it?
[52:37.240 --> 52:40.240]  By what authority do you make an effort to ignore it
[52:40.240 --> 52:42.240]  as if it doesn't exist?
[52:42.240 --> 52:45.240]  You know I have it.
[52:45.240 --> 52:49.240]  By what authority do you presume that I have inherently
[52:49.240 --> 52:53.240]  waived it unless I've expressly reserved it?
[52:53.240 --> 52:54.240]  Absolutely.
[52:54.240 --> 52:56.240]  And how do you invoke a right anyway?
[52:56.240 --> 52:59.240]  If you have a right, it's just there.
[52:59.240 --> 53:00.240]  It exists.
[53:00.240 --> 53:01.240]  You don't need to invoke it.
[53:01.240 --> 53:03.240]  Give me a break.
[53:03.240 --> 53:06.240]  The Supreme Courts and the other courts in this country
[53:06.240 --> 53:12.240]  have completely turned the concept of rights
[53:12.240 --> 53:17.240]  as upside down as a pineapple upside down cake gets.
[53:17.240 --> 53:20.240]  They're trying to turn rights into privileges.
[53:20.240 --> 53:22.240]  That's why people need to understand what the difference
[53:22.240 --> 53:24.240]  between a right and a privilege is.
[53:24.240 --> 53:26.240]  And I think it's more than dementia.
[53:26.240 --> 53:29.240]  I think maybe in some cases it might be dementia, Eddie,
[53:29.240 --> 53:31.240]  but I think this is very calculated.
[53:31.240 --> 53:33.240]  I think they know exactly what they're doing.
[53:33.240 --> 53:35.240]  And they're pretending to have dementia.
[53:35.240 --> 53:39.240]  Well, when I say dementia, I don't mean the ailment.
[53:39.240 --> 53:40.240]  I mean the attitude.
[53:40.240 --> 53:41.240]  Right.
[53:41.240 --> 53:43.240]  Because in regards to that type of attitude,
[53:43.240 --> 53:47.240]  they are really demented if they think that the people
[53:47.240 --> 53:51.240]  of this country are going to let this go on forever
[53:51.240 --> 53:54.240]  and that they're not going to be held accountable for this
[53:54.240 --> 53:56.240]  at some point in time.
[53:56.240 --> 53:58.240]  That is dementia of the highest magnitude.
[53:58.240 --> 54:02.240]  Yeah, demented, dementia, exactly.
[54:02.240 --> 54:03.240]  Okay.
[54:03.240 --> 54:08.240]  And so what these justices are doing is, once again,
[54:08.240 --> 54:15.240]  they are trying to take a right and say that its existence
[54:15.240 --> 54:18.240]  is not enough.
[54:18.240 --> 54:23.240]  If you don't specifically state that you want to protect
[54:23.240 --> 54:28.240]  the right, then the government has the right to presume
[54:28.240 --> 54:32.240]  the right as non-existent.
[54:32.240 --> 54:39.240]  Now, tell me that does not fly in the face of the very concept
[54:39.240 --> 54:42.240]  of a constitutional republic.
[54:42.240 --> 54:44.240]  It absolutely does.
[54:44.240 --> 54:46.240]  It's straight up tyranny.
[54:46.240 --> 54:52.240]  I mean, the Constitution itself invoked and protects
[54:52.240 --> 54:56.240]  and reserves the right of the people to be free
[54:56.240 --> 54:59.240]  from these intrusions by government.
[54:59.240 --> 55:03.240]  We don't have to declare them physically, verbally,
[55:03.240 --> 55:04.240]  or in writing.
[55:04.240 --> 55:07.240]  That's already been done for us.
[55:07.240 --> 55:10.240]  That was the whole reason the Bill of Rights was instituted
[55:10.240 --> 55:15.240]  in the respective Constitution, was to invoke those rights
[55:15.240 --> 55:19.240]  and put them completely outside the authority of government
[55:19.240 --> 55:21.240]  to interfere with them.
[55:21.240 --> 55:25.240]  And then you have these geriatric, demented morons
[55:25.240 --> 55:32.240]  that think that that means nothing.
[55:32.240 --> 55:39.240]  Well, because they're getting paid to make it nothing.
[55:39.240 --> 55:42.240]  This was one of the biggest things I've always considered
[55:42.240 --> 55:47.240]  about having a permanent justice in a Supreme Court
[55:47.240 --> 55:51.240]  or any other court being appointed for life.
[55:51.240 --> 55:55.240]  The entire purpose of the original for-life appointment
[55:55.240 --> 55:58.240]  was to ensure that these judges did not have to worry
[55:58.240 --> 56:01.240]  about the politics that were going on around them.
[56:01.240 --> 56:04.240]  To ensure that these judges did not have to get involved
[56:04.240 --> 56:08.240]  in politics to keep their position so that they could be
[56:08.240 --> 56:13.240]  free from influence from all outside sources and independent
[56:13.240 --> 56:19.240]  and above the political hankering and bickerings of the day
[56:19.240 --> 56:24.240]  so that they could act first and foremost as the preserver
[56:24.240 --> 56:29.240]  and protector of the rights of the people
[56:29.240 --> 56:34.240]  and the boundaries placed upon government by the Constitution.
[56:34.240 --> 56:38.240]  That's a good idea, but Eddie, the problem is,
[56:38.240 --> 56:42.240]  what if you get a corrupt appointee in there with the agenda?
[56:42.240 --> 56:44.240]  There's no question of that.
[56:44.240 --> 56:46.240]  There's no question that was going to be the outcome
[56:46.240 --> 56:51.240]  eventually, especially when you have corrupt politicians
[56:51.240 --> 56:54.240]  making the appointments.
[56:54.240 --> 56:58.240]  Let's analyze what the Founding Fathers were thinking here
[56:58.240 --> 56:59.240]  for just a minute.
[56:59.240 --> 57:04.240]  The Founding Fathers foresaw the people being willing to only
[57:04.240 --> 57:08.240]  put into office wholesome, upstanding,
[57:08.240 --> 57:14.240]  law-abiding, God-fearing men who would abide in an honest fashion
[57:14.240 --> 57:19.240]  by the rights of the people and the protections of the Constitution.
[57:19.240 --> 57:28.240]  Though that was very utopian view for them to have, it's not reality.
[57:28.240 --> 57:35.240]  See, in their day and age, people had a very serious review
[57:35.240 --> 57:39.240]  of their public image.
[57:39.240 --> 57:46.240]  They never wanted to be perceived as a detrimental type of faction
[57:46.240 --> 57:47.240]  in the public view.
[57:47.240 --> 57:50.240]  They wanted to always be honest, upstanding, wholesome,
[57:50.240 --> 57:52.240]  and well thought of.
[57:52.240 --> 57:55.240]  So in the public eye, they were never, ever going to do something
[57:55.240 --> 57:58.240]  to destroy their image unless they were so well protected
[57:58.240 --> 58:01.240]  and insulated they had no care or concept,
[58:01.240 --> 58:03.240]  pretty much like the king would do.
[58:03.240 --> 58:05.240]  Right, and now it's getting to be that way again
[58:05.240 --> 58:07.240]  because of the rigged elections.
[58:07.240 --> 58:12.240]  Yeah, so what we've got to do, folks, is figure out a way to make
[58:12.240 --> 58:17.240]  these alterations a curve where we once again can get control of this,
[58:17.240 --> 58:20.240]  and it's not going to be a do-it-one-day type of fight.

[01:09:12.240 --> 01:09:14.240]  and you ever see on TV or a movie
[01:09:14.240 --> 01:09:16.240]  when they have a female cop
[01:09:16.240 --> 01:09:18.240]  how they're all gorgeous looking
[01:09:18.240 --> 01:09:20.240]  and they got the makeup on
[01:09:20.240 --> 01:09:21.240]  well this is one of those cops
[01:09:21.240 --> 01:09:23.240]  she was blonde and she was beautiful
[01:09:23.240 --> 01:09:25.240]  and I kind of felt bad
[01:09:25.240 --> 01:09:27.240]  because my girlfriend is sitting in between us

[01:10:26.240 --> 01:10:29.240]  or organization where we study all this
[01:10:29.240 --> 01:10:30.240]  and protect our rights

[01:10:32.240 --> 01:10:37.240]  and she finally she goes well I just want to
[01:10:37.240 --> 01:10:39.240]  I said look would you want to know what my name is?

[01:10:43.240 --> 01:10:45.240]  I looked at my watch it's 10.30 p.m.

[01:10:49.240 --> 01:10:52.240]  she goes no no look you don't have to give me this stuff under duress

[01:27:13.240 --> 01:27:24.240]  I'll give you another example I recently had to take an oath I have a 12 year old daughter and she needed a passport to go to Canada

[01:27:31.240 --> 01:27:40.240]  I didn't want to complete it because I read some about that and I thought that I was a citizen of the United States of America
[01:27:40.240 --> 01:27:48.240]  not a US citizen can that come back to haunt you with regards to at some point in the future
[01:27:48.240 --> 01:27:57.240]  if you pursue an income tax issue that was discussed a couple of days ago on your show with Dave Champion
[01:27:57.240 --> 01:28:07.240]  are you not in that regard taking a benefit from the government I don't know if I'm making a lot of sense here

[01:28:59.240 --> 01:29:06.240]  because everything in the federal that the Congress was given power to legislate over is outside of the purview of the people
[01:29:06.240 --> 01:29:14.240]  why because everything that they can do is a government granted privilege whereas what the people can do is an absolute right
[01:29:14.240 --> 01:29:24.240]  and they are as oil and water you cannot mix the two yes and Eddie I agree with you but just to show how that applies

[01:36:28.240 --> 01:36:34.240]  they shifted their burden of proof onto your shoulders to prove they lost

[01:36:42.240 --> 01:36:53.240]  and again making assumptions under the guise of legal advice from other idiots that haven't bothered to read or understand the law

[01:36:57.240 --> 01:37:08.240]  Okay it sounds like as far as the going back to the credit card thing I can pursue that without worrying about

[01:42:21.240 --> 01:42:28.240]  And I just simply asked for an examining trial because I needed to clarify the nature and sufficiency

[01:42:33.240 --> 01:42:40.240]  And the clerk was of course very confused didn't understand and tried to explain to me the nature of the charges

[01:42:47.240 --> 01:42:52.240]  To explain to me the nature of the charges so that I might prepare my defense adequately
[01:42:52.240 --> 01:43:00.240]  And so she took a nice little note down and gave it to the judge and note said refuses to flee once court dates
[01:43:00.240 --> 01:43:07.240]  Well okay not exactly what I said but that's fine and so I got a nice little letter from the judge
[01:43:07.240 --> 01:43:14.240]  That said hey you need to flee and basically said if you think you're not guilty
[01:43:14.240 --> 01:43:18.240]  Then go ahead and send this plea form back this is the third copy of the plea form I've gotten now
[01:43:18.240 --> 01:43:25.240]  They really really really want me to flee and they said give me an extension though
[01:43:25.240 --> 01:43:29.240]  They said I had until August 11th take care of it so that's really nice
[01:43:29.240 --> 01:43:33.240]  But I guess at this point I've got the seminar materials

[01:46:02.240 --> 01:46:10.240]  So what I'm looking at in these seminar materials is the nature and cause motion
[01:46:10.240 --> 01:46:17.240]  And it's to clarify the nature and cause of the accusations against me

[01:46:25.240 --> 01:46:30.240]  Basically in the new seminar motions that I've got set up there is a folder

[01:46:35.240 --> 01:46:40.240]  Inside of that there are six folders one is stop and citation two is get your
[01:46:40.240 --> 01:46:44.240]  Records three is pre-trial motions four is discovery five is trial briefs and
[01:46:44.240 --> 01:46:49.240]  Orders and six is countersuit where he's talking about right now is from the
[01:46:49.240 --> 01:46:55.240]  Pre-trial motions number three and that you will find that there are eleven
[01:46:55.240 --> 01:47:01.240]  Numbered motions right up front the first ten are ones that need to be filed
[01:47:01.240 --> 01:47:05.240]  Immediately if they pertain to you the first one is fair and impartial trial
[01:47:05.240 --> 01:47:10.240]  Second is a motion or petition for assistance of counsel the third is motion
[01:47:10.240 --> 01:47:14.240]  To dismiss citation is not a valid complaint if the court is acting without a
[01:47:14.240 --> 01:47:19.240]  Complaint and only using the ticket as the complaining document you want to
[01:47:19.240 --> 01:47:24.240]  File that motion number three motion number four petition prosecutor to show
[01:47:24.240 --> 01:47:28.240]  Authority this is where we challenge the jurisdiction if this is municipal
[01:47:28.240 --> 01:47:33.240]  Court for the prosecutor to act in the name of the state since Aaron is in a
[01:47:33.240 --> 01:47:40.240]  Justice court that one will not be filed petition number five court to follow
[01:47:40.240 --> 01:47:45.240]  Texas code of criminal procedure that's a definite must petition number six
[01:47:45.240 --> 01:47:50.240]  Demand the court of record that's a definite must now petition seven our
[01:47:50.240 --> 01:47:56.240]  Motion to dismiss no information that is also a mandatory one number eight
[01:47:56.240 --> 01:48:01.240]  Petition provide copy of indictment and information again mandatory nine
[01:48:01.240 --> 01:48:06.240]  Petition nature and cause of accusations which is the one Aaron's speaking to
[01:48:06.240 --> 01:48:10.240]  Right now and number ten is a motion to dismiss for failure to follow the
[01:48:10.240 --> 01:48:16.240]  Administrative Procedures Act and then number 99 which is the 11th motion is a
[01:48:16.240 --> 01:48:21.240]  Petition for findings of fact and conclusions of law that motion is filed
[01:48:21.240 --> 01:48:27.240]  Only after the is ruled on your other motions and denied them and what you'll
[01:48:27.240 --> 01:48:30.240]  Do with that findings of facts and conclusions of law is you will go in and
[01:48:30.240 --> 01:48:37.240]  You will take out the sections that deal with any motion that the judge granted
[01:48:37.240 --> 01:48:41.240]  Because you're not going to need a finding of fact and conclusions of law if
[01:48:41.240 --> 01:48:45.240]  He grants it but leave every part in there that deals with a motion or
[01:48:45.240 --> 01:48:50.240]  Petition that they denied and what this motion does is it demands the judge
[01:48:50.240 --> 01:48:56.240]  Provides you in writing with his conclusions of law with the findings of
[01:48:56.240 --> 01:49:01.240]  Facts and the actual conclusions of law meaning I want to know what statute I
[01:49:01.240 --> 01:49:07.240]  Want to know what case law I want to know by what authority you denied me in
[01:49:07.240 --> 01:49:13.240]  My petition or my motion and you follow that one after they've denied or
[01:49:13.240 --> 01:49:20.240]  Granted everything that you filed so that's really what these are all breaking
[01:49:20.240 --> 01:49:24.240]  Down into the other motions to disqualify down there for the individual
[01:49:24.240 --> 01:49:29.240]  Actors the arresting officer a motion to disqualify for failure to follow due
[01:49:29.240 --> 01:49:33.240]  Course of law motion to disqualify the magistrate motion to disqualify the
[01:49:33.240 --> 01:49:39.240]  Prosecutor motion to dismiss for denial of substantive due process on a
[01:49:39.240 --> 01:49:44.240]  Public intoxication arrest then you've got the same motion again rewritten to
[01:49:44.240 --> 01:49:49.240]  Go with due process under the Texas transportation code and then you've got
[01:49:49.240 --> 01:49:54.240]  Just a straight up motion to dismiss for complete and total failure to
[01:49:54.240 --> 01:50:00.240]  Provide due course of law so the new set of motions are extensive but they're
[01:50:00.240 --> 01:50:04.240]  Still by no means complete there are so many more I'm working on to go in the
[01:50:04.240 --> 01:50:09.240]  Other folders and sections as well as this one there are so many ways they
[01:50:09.240 --> 01:50:13.240]  Violate the law and the constitution with what they do it's not even funny
[01:50:13.240 --> 01:50:17.240]  And I am doing my dead level best to get them all research documented and
[01:50:17.240 --> 01:50:24.240]  Argued in these motions so yes Erin most certainly you file everything in
[01:50:24.240 --> 01:50:30.240]  That folder that's got a number in front of it except for number 99 and the
[01:50:30.240 --> 01:50:35.240]  Number 04 petition for prosecutor to show authority and then you file number
[01:50:35.240 --> 01:50:42.240]  Three if there is no signed and verified complaint otherwise file all the rest
[01:50:42.240 --> 01:50:45.240]  Of them because I almost guarantee you there's not going to be an information
[01:50:45.240 --> 01:50:50.240]  In there even with the county attorney prosecuting now also be aware make very
[01:50:50.240 --> 01:50:55.240]  Very certain who the prosecutor is when you go into this case somebody could
[01:50:55.240 --> 01:51:00.240]  Come in and say they're from the county attorney's office and yet not be so you
[01:51:00.240 --> 01:51:05.240]  Still want to demand they provide proof of authority and agency to work if for
[01:51:05.240 --> 01:51:10.240]  The county attorney.

[01:53:31.240 --> 01:53:41.240]  do there but anyway although he continued I just wanted to see normally what
[01:53:41.240 --> 01:53:50.240]  occurs or what does from your experience what do you guys recommend or what have
[01:53:50.240 --> 01:53:55.240]  you guys seen that may have worked?

[01:54:50.240 --> 01:54:55.240]  Actual affidavit of the testifying party then it's almost always granted unless
[01:54:55.240 --> 01:55:00.240]  It can be shown there is no valid ground for the injunction.
[01:55:00.240 --> 01:55:08.240]  Okay well I walked into a hearing today it was regarding looks like they wanted
[01:55:08.240 --> 01:55:16.240]  Me to sell like a bond for a certain amount temporary it's like a temporary
[01:55:16.240 --> 01:55:24.240]  State and I filed a recusal for cause because I caught the attorney in
[01:55:24.240 --> 01:55:36.240]  Perjury and also the judge was finding me in contempt for saying that I was the
[01:55:36.240 --> 01:55:40.240]  One that was misleading the court when I really proved it all that it was the
[01:55:40.240 --> 01:55:48.240]  Attorney who was misleading the court on the transcript so I have a rogue judge
[01:55:48.240 --> 01:55:55.240]  Anyways I filed before the hearing I filed a demotion or the demand for
[01:55:55.240 --> 01:56:08.240]  Recusal under the 170.1 and the 170.3 for cause and he still kept going.

[01:57:57.240 --> 01:58:03.240]  Ritza mandamus in order to get the higher court to order the lower court to
[01:58:03.240 --> 01:58:08.240]  Do what the law requires them to do there there is no magic answer to that
