[09:08.940 --> 09:13.940] plaintiff files his verified cross-complaint and petition for injunctive declaration
[09:13.940 --> 09:18.940] of jurisdictional immunity against defendants for causes stated and shown herein.
[09:18.940 --> 09:22.940] The answers to the questions posed in Subpart A herein are vital issues
[09:22.940 --> 09:26.940] to the sustainable authority and validity of the respective constitutions
[09:26.940 --> 09:28.940] and the people's right and authority to control
[09:28.940 --> 09:33.940] and manage their servant government through the means and provisions thereof.
[09:33.940 --> 09:40.940] Now, Subsection A poses 15 questions, and the questions are as follows.
[09:40.940 --> 09:44.940] Subordinate only to the word of Almighty God as written within the Holy Bible
[09:44.940 --> 09:49.940] is the Constitution of the United States of America, the supreme law of the land.
[09:49.940 --> 09:53.940] Number two, within each individual state of the union,
[09:53.940 --> 09:58.940] and as long as no provision thereof is in violation of the provisions and bill
[09:58.940 --> 10:02.940] of rights within the Constitution of the United States of America,
[10:02.940 --> 10:07.940] is that state's constitution the supreme law of the land within that state?
[10:07.940 --> 10:12.940] Number three, do the respective constitutions grant or create
[10:12.940 --> 10:16.940] the unalienable rights belonging to the people?
[10:16.940 --> 10:21.940] Number four, are the people's unalienable rights inherent at birth
[10:21.940 --> 10:24.940] and therefore automatically vested?
[10:24.940 --> 10:29.940] Number five, are the respective constitutions based upon the common law
[10:29.940 --> 10:33.940] as it existed at the time of their composition and prior to the formation
[10:33.940 --> 10:36.940] of the United States of America?
[10:36.940 --> 10:41.940] Number six, are the respective state and constitutions based upon the same
[10:41.940 --> 10:46.940] common law as it existed prior to the formation of the individual states?
[10:46.940 --> 10:51.940] Number seven, are both the federal and state governments bound by the precepts,
[10:51.940 --> 10:55.940] mandates, and prohibitions written into these foundational documents
[10:55.940 --> 11:00.940] and the writings documenting their intent, deliberation, and creation,
[11:00.940 --> 11:04.940] such as the Declaration of Independence, the Anti-Federalist and Federalist Papers,
[11:04.940 --> 11:07.940] and the writings of the Founders?
[11:07.940 --> 11:12.940] Number eight, can government under its own perceived authority or power
[11:12.940 --> 11:16.940] alter or abolish the common law foundation upon which these documents
[11:16.940 --> 11:22.940] that created and govern its very existence and powers were themselves created?
[11:22.940 --> 11:27.940] Number nine, if the government purports to claim such authority and power,
[11:27.940 --> 11:30.940] then where within the people's documents is it stated that the people
[11:30.940 --> 11:34.940] granted such power and authority to their servant government?
[11:34.940 --> 11:40.940] Number ten, if such authority cannot be shown to exist, then by what authority
[11:40.940 --> 11:45.940] can or does government declare that the common law be relegated to the past
[11:45.940 --> 11:50.940] and or declared moot and subsequently replaced by a new concept of law
[11:50.940 --> 11:54.940] created entirely by government such as statutory law?
[11:54.940 --> 11:59.940] Number eleven, lacking any lawful grant of authority and power by the people
[11:59.940 --> 12:03.940] to abolish or minimize the protections of the common law, by what expressed
[12:03.940 --> 12:07.940] or usurped authority does the state legislature create statutory law
[12:07.940 --> 12:13.940] declaring the common law of no or of minimal force and effect?
[12:13.940 --> 12:19.940] Number twelve, if the people's rights and protections under the common law
[12:19.940 --> 12:23.940] can be replaced by governmental fiat through statutory enactment,
[12:23.940 --> 12:27.940] then by what means is government to remain bound as a servant to the people
[12:27.940 --> 12:30.940] and the people's individual rights protected?
[12:30.940 --> 12:37.940] Number thirteen, how, where, and when did the people decide and grant to any level
[12:37.940 --> 12:41.940] of government the authority to replace or destroy our common law heritage
[12:41.940 --> 12:45.940] and protections with another less protective, less effective,
[12:45.940 --> 12:50.940] and fundamentally more offensive and oppressive form and body of law?
[12:50.940 --> 12:57.940] Fourteen, if the people have not granted such authority, then is the common law
[12:57.940 --> 13:02.940] under the respective constitution still the supreme law above any other form of law
[13:02.940 --> 13:06.940] created by man when government acts against the rights, property,
[13:06.940 --> 13:11.940] and interest of the people, either collectively or individually?
[13:11.940 --> 13:17.940] And number fifteen, can any number of the people, either individually or collectively,
[13:17.940 --> 13:23.940] come together and act or vote to abrogate or derogate the rights of another
[13:23.940 --> 13:28.940] of any other one or more of the people absent a proper showing of harm by one
[13:28.940 --> 13:33.940] or more of such people and without consideration of the proper procedures
[13:33.940 --> 13:37.940] constituting due process of law?
[13:37.940 --> 13:41.940] Now, those are the fifteen questions to be addressed.
[13:41.940 --> 13:46.940] The remainder of the document, once I get it completed,
[13:46.940 --> 13:49.940] is going to address those fifteen questions.
[13:49.940 --> 13:55.940] Now, what I would like to do at this point is read the introduction that I've got
[13:55.940 --> 13:59.940] that segues into the arguments and authorities.
[13:59.940 --> 14:02.940] This is what we have.
[14:02.940 --> 14:06.940] Being known and declared that we the people established and intended that our
[14:06.940 --> 14:10.940] commandments to our servant governments, whether federal, state, or local,
[14:10.940 --> 14:15.940] as set forth within the respective constitutions were and are to be followed
[14:15.940 --> 14:20.940] to the letter and at all times until we cease to exist as a country
[14:20.940 --> 14:23.940] and as individual sovereign republics.
[14:23.940 --> 14:27.940] It must therefore be established and understood that there are certain facts
[14:27.940 --> 14:30.940] in existence that are not born into this world by the declaration
[14:30.940 --> 14:32.940] or codification of men.
[14:32.940 --> 14:36.940] These facts do not exist because of some professed written declaration
[14:36.940 --> 14:40.940] with any document, law, statute, or book.
[14:40.940 --> 14:44.940] For example, the air that we breathe, it is a combination of oxygen and nitrogen,
[14:44.940 --> 14:48.940] and the combination of these two elements into that breathable gas known as air
[14:48.940 --> 14:52.940] was neither created nor exists because acknowledgement of its existence
[14:52.940 --> 14:58.940] either is or is not codified within some document, law, statute, or book.
[14:58.940 --> 15:02.940] It is simply fact, and man has nothing to do with it.
[15:02.940 --> 15:06.940] Nor did man have anything to do with the creation of the two individual elements
[15:06.940 --> 15:10.940] of nitrogen and oxygen, just as man had nothing to do with the creation
[15:10.940 --> 15:14.940] or composition of any of the other naturally occurring elements we have
[15:14.940 --> 15:17.940] documented in our version of the periodic table.
[15:17.940 --> 15:21.940] These elements existed long before man came into being and will continue
[15:21.940 --> 15:26.940] to exist far beyond our limited concept of time and space.
[15:26.940 --> 15:31.940] In this same vein of pre-existence and preeminence, it is a fact that the
[15:31.940 --> 15:37.940] respective constitutions neither granted nor created the rights of we the people.
[15:37.940 --> 15:41.940] Our rights existed long prior to any enumeration or written declaration
[15:41.940 --> 15:45.940] as to what those rights were and to whom they belonged.
[15:45.940 --> 15:49.940] The respective constitutions neither granted nor created limitations
[15:49.940 --> 15:54.940] and or restrictions directly upon we the people or our rights,
[15:54.940 --> 15:58.940] but only to serve to act upon the people's servant governments
[15:58.940 --> 16:02.940] and their various agencies, officers, agents, and employees.
[16:02.940 --> 16:06.940] While acting in their official capacities, the power and authority
[16:06.940 --> 16:11.940] of such public servants are subservient to the rights and authority of the people,
[16:11.940 --> 16:15.940] and except where we the people specifically made delegation of an authority
[16:15.940 --> 16:19.940] superior to that of the individual for the just protection of our private
[16:19.940 --> 16:23.940] individual rights and property and the safeguarding of our public papers
[16:23.940 --> 16:30.940] and property, governmental authority over we the people is non-existent.
[16:30.940 --> 16:35.940] Amendments or alterations to the respective constitutions do not
[16:35.940 --> 16:39.940] and cannot alter or abolish even a single one of the unalienable
[16:39.940 --> 16:44.940] or vested rights of the people as they neither granted nor created those rights.
[16:44.940 --> 16:48.940] And this remains true regardless of whatever date such alteration was made
[16:48.940 --> 16:51.940] or previous number of attempts performed.

[21:13.940 --> 21:21.940] However, an unalienable right and a vested right, though very similar and in many ways synonymous, are not exactly the same.
[21:21.940 --> 21:28.940] The rights that are written into the Bill of Rights within the respective constitutions were not granted or created by those documents,
[21:28.940 --> 21:36.940] but were so enumerated only to expound and clarify exactly what rights and ideals inherently belong to the people individually,
[21:36.940 --> 21:45.940] and that the intent behind the general declaration of these rights was to ensure that the broadest application of protection for them was to be maintained.
[21:45.940 --> 21:52.940] It was not to narrowly tailor them for the instituting of governmental exceptions to those protections.
[21:52.940 --> 21:59.940] Societies are generally formed for two main purposes, both of which are based on individual self-interest and preservation.
[21:59.940 --> 22:05.940] One of these reasons is common fellowship and its resulting circumstantial conveniences.
[22:05.940 --> 22:10.940] The second is more basic and necessary to survival, which is to present a unified,

[22:27.940 --> 22:35.940] It shall be noted that an intentionally basic simplification of these two purposes is used in order to show that the people created government
[22:35.940 --> 22:41.940] to serve their public needs and functions based primarily on these perspectives and realities.
[22:41.940 --> 22:48.940] In order to ensure the protection of our individual, unalienable, and vested rights of life, liberty, and property,
[22:48.940 --> 22:58.940] we the people created government to assist us with daily management and maintenance of the public necessities within our society and to provide for our common defense.
[22:58.940 --> 23:03.940] And it is important to understand that government exists for no other reason.
[23:03.940 --> 23:10.940] Government was not born, it was created, and it was created in all its various forms by the people.
[23:10.940 --> 23:17.940] Therefore, it is subject to our will and completely dependent on our support for its continued existence.
[23:17.940 --> 23:26.940] It is an established fact that the people may alter, abolish, and reform government either in its entirety or any part thereof
[23:26.940 --> 23:33.940] in any manner they deem necessary or expedient in keeping that government in check and serving the people.
[23:33.940 --> 23:39.940] This is clearly stated within virtually every constitution in existence in America today.
[23:39.940 --> 23:44.940] This fact alone conclusively shows that government is not sovereign, it is servant,
[23:44.940 --> 23:52.940] and it is subject to the will and exercise of the rights of the only true sovereigns under God, the people themselves.
[23:52.940 --> 24:02.940] Government cannot and does not exist in autonomy, but only exists at all because of the people's consent, will, and support to maintain that existence.
[24:02.940 --> 24:10.940] When government begins to operate in a manner or fashion that implies it has the right to exist independent of the people
[24:10.940 --> 24:20.940] and that because it exists it has the right to subjugate the people through its own mechanisms and devices, the people and the union are in dire peril.
[24:20.940 --> 24:27.940] At that moment all that the people hold dear to themselves and their posterity is in mortal danger of being destroyed.
[24:27.940 --> 24:34.940] At that moment the servant has decided that it now has the right to declare itself master over its creator.
[24:34.940 --> 24:40.940] This same scenario has played out before, long before the creation of the world as we humans know it.
[24:40.940 --> 24:47.940] It happened when the archangel Lucifer rose up in defiance of God and declared himself of greater power and authority.
[24:47.940 --> 24:57.940] Lucifer attempted to wage war and sow dissent and rebellion among the multitude of angels, imploring them to support him in his defiance against God, their creator.
[24:57.940 --> 25:02.940] But in the end God cast Lucifer out of heaven along with all those that dared follow him.
[25:02.940 --> 25:09.940] Fully one-third of the angels fell from grace, and peace reigned in heaven once more.
[25:09.940 --> 25:13.940] The creator always was and is supreme.
[25:13.940 --> 25:21.940] When governmental persons begin to believe and act as if they are superior, that they are somehow sovereign and separate from their creator,
[25:21.940 --> 25:26.940] then the time has come for we the people to exercise our sovereign power and authority.
[25:26.940 --> 25:34.940] It is the people's right to ensure that government persons act only in the servile capacity and purpose for which they were created.
[25:34.940 --> 25:41.940] And when those persons consistently fail and or refuse to do so, it is time to cast them out.
[25:41.940 --> 25:50.940] The respective constitutions were and are based, written, and designed upon a particular modality of law known as the common law,
[25:50.940 --> 25:59.940] which existed and governed the people in their desired form of government long before, during, and after the time of their respective creations.
[25:59.940 --> 26:10.940] If the respective constitutions are to maintain their original meaning and intent, then the common law must also be maintained as it is the underlying foundation upon which they are built.
[26:10.940 --> 26:19.940] A sane and reasonable man knows that if you try to fundamentally alter or replace the underlying foundation of a structure after it is already built,
[26:19.940 --> 26:29.940] such as a house, for instance, it is guaranteed outcome that you will introduce some form of stress to the overall structure that sits upon such foundation.
[26:29.940 --> 26:39.940] It is absolutely unavoidable and will occur regardless of the type or number of precautions taken to prevent such stress.
[26:39.940 --> 26:48.940] To introduce stress of this magnitude in nature is to necessarily introduce and cause harm to the structure itself in some form or fashion.
[26:48.940 --> 26:53.940] If this stress were the only factor to consider, then the damage might be more easily mitigated.
[26:53.940 --> 27:05.940] But there are always numerous and varying outside factors and circumstances that will assail upon the structure and compound the damage, sometimes overtly and sometimes imperceptibly.
[27:05.940 --> 27:09.940] The harm to the structure may not immediately cause it to crumble or to fall.
[27:09.940 --> 27:13.940] It may not even show immediate signs of the underlying damage.
[27:13.940 --> 27:21.940] But over time, the evidence of the harm will reveal itself in some form or fashion and almost always at the most inopportune time.
[27:21.940 --> 27:24.940] It is a foregone certainty.
[27:24.940 --> 27:41.940] Since the respective constitutions have mandated certain particularities regarding the unalienable rights of the people and did so in order to ensure that no form or level of government could alter or abolish such rights by any means other than due process of law,
[27:41.940 --> 27:51.940] then it is a simple operation of common sense that the rights so enumerated are also based upon the very same modality of law that the constitution and the cells are.
[27:51.940 --> 27:54.940] That was and is the common law.
[27:54.940 --> 28:06.940] The various forms of government are also bound by the requirement that an unalienable right is subject to removal or suspension only through the required due process of law as founded in the common law.
[28:06.940 --> 28:11.940] Such is a mandatory and integral part of the people's ability to control governmental actions.
[28:11.940 --> 28:24.940] As the abrogation or derogation of an unalienable right may only be achieved by following due process of law, it is axiomatic that a right cannot be subjected to regulation, licensing or taxation.
[28:24.940 --> 28:35.940] That allowing such a thing could and would be used to circumvent the necessity of due process of law in an attempt to subjugate or destroy the people's unalienable rights,
[28:35.940 --> 28:42.940] as is proven by every new legislative enactment and the news article evaluating the merits and effects of sane.
[28:42.940 --> 28:46.940] Once such an act is deemed allowable and within the power of government,
[28:46.940 --> 29:00.940] it becomes a relatively simple matter to deprive the individual of any right by setting unreasonable regulations, taxes or licensing fees so far out of reach as to make them unattainable, thus totally destroying the right itself.
[29:00.940 --> 29:05.940] As these rights were so declared at the time of their writing within the respective constitutions,
[29:05.940 --> 29:16.940] it can only be reasonably argued that these rights are based upon the same modality of law as the constitution themselves, which is once again the common law.
[29:16.940 --> 29:21.940] Then we'll get into the body of the thing where we'll have arguments and authorities.
[29:21.940 --> 29:32.940] The first section states that we have attached affidavits in the form of verified criminal complaints to this petition to establish facts not apparent from the record and incorporate them by reference.

[33:45.940 --> 33:49.940] for the people against their government when they don't wish to do what we tell them to do
[33:49.940 --> 33:51.940] and how we tell them to do it.
[33:51.940 --> 33:54.940] And I don't mean by having to go to court every day.
[33:54.940 --> 34:01.940] I mean by the way we originally instructed them within the constitutions of the respective states,
[34:01.940 --> 34:07.940] the federal constitution, and the authorities and powers that we granted to them therein.
[34:07.940 --> 34:17.940] Now I've gone through everything down to where we are now going through the arguments
[34:17.940 --> 34:23.940] and authority section which as of right now there are no specific arguments and authorities made.
[34:23.940 --> 34:27.940] I've only got a couple of paragraphs in there and I'll touch on those real quick.
[34:27.940 --> 34:32.940] When one or more of the people alleges constitutional violations and or usurpations
[34:32.940 --> 34:34.940] by governmental actors or agencies,
[34:34.940 --> 34:39.940] it is the duty of the courts to honestly and diligently evaluate such allegations and evidence
[34:39.940 --> 34:43.940] in the light most favorable to the people and their unalienable rights.
[34:43.940 --> 34:47.940] To presume to do otherwise is to make a mockery of the American Revolution
[34:47.940 --> 34:51.940] and the sacrifice of the fighting men and women throughout our history
[34:51.940 --> 34:55.940] whom risked all that they possessed, including their sacred honor,
[34:55.940 --> 34:59.940] and willingly shed their blood, sweat, and tears defending those rights and liberties
[34:59.940 --> 35:03.940] for each and every one of the people within this great country called America.
[35:03.940 --> 35:07.940] And that same caliber of freedom-loving men and women have fought and died
[35:07.940 --> 35:12.940] to preserve those rights and liberties not only in America for our own people,
[35:12.940 --> 35:15.940] but for many other countries and peoples of the world.
[35:15.940 --> 35:18.940] The courts have a duty to protect the rights of the people,
[35:18.940 --> 35:23.940] to hold them sacred over any and all acts of government that would tend to deprive the individual
[35:23.940 --> 35:26.940] of even the smallest of those unalienable rights
[35:26.940 --> 35:31.940] without the proper and mandatory means and methods set forth in our constitutions.
[35:31.940 --> 35:36.940] The very same means and methods that we the people declared to be the required
[35:36.940 --> 35:41.940] and acceptable method providing for due process of law as it was known
[35:41.940 --> 35:44.940] and exercised long before the founding of our country.
[35:44.940 --> 35:49.940] And after that, we'll go down to the conclusions section when we get through
[35:49.940 --> 35:52.940] with the rest of our arguments on the presentation of it.
[35:52.940 --> 35:56.940] And the conclusion at the moment reads thusly.
[35:56.940 --> 36:03.940] Therefore, plaintiff asserts that plaintiff is not engaging in any regulatable activity
[36:03.940 --> 36:08.940] or occupation, but is exercising one or more of plaintiff's unalienable rights
[36:08.940 --> 36:12.940] in a manner that is in no way a conclusive or evidentiary showing
[36:12.940 --> 36:17.940] of a direct and palpable harm and detriment to any other member of the public,
[36:17.940 --> 36:20.940] whether of their person or their property.
[36:20.940 --> 36:25.940] Therefore, plaintiff is not and cannot be under the authority of any regulatory enactment
[36:25.940 --> 36:30.940] created by the legislature and intended to regulate activities outside of those
[36:30.940 --> 36:33.940] that are a part of plaintiff's unalienable rights.
[36:33.940 --> 36:40.940] These rights include but are not limited to the right of life, liberty, the pursuit of happiness,
[36:40.940 --> 36:44.940] acquisition and use of private property and material possessions,
[36:44.940 --> 36:49.940] and to be free from intrusions upon those rights and or plaintiff's person or property
[36:49.940 --> 36:53.940] by either government or any other one or more of the people.
[36:53.940 --> 36:58.940] Therefore, plaintiff asserts that it is axiomatic that plaintiff owes no duty
[36:58.940 --> 37:03.940] and therefore incurs no liability of any kind whatsoever to the public
[37:03.940 --> 37:09.940] other than to ensure that plaintiff's actions do not violate the rights, person or property
[37:09.940 --> 37:12.940] of any other one or more of the people.
[37:12.940 --> 37:17.940] And unless and until plaintiff's actions are such that they act to harm or infringe
[37:17.940 --> 37:23.940] upon the rights and or property of another one or more of the people in such manner,
[37:23.940 --> 37:28.940] then no claim of harm against plaintiff by the government can lawfully stand,
[37:28.940 --> 37:32.940] and such claim must be dismissed with prejudice for lack of subject matter
[37:32.940 --> 37:34.940] and impersonal jurisdiction.
[37:34.940 --> 37:40.940] Therefore, plaintiff asserts that government cannot and does not have any lawful claim
[37:40.940 --> 37:44.940] against plaintiff unless and until the government can produce evidence
[37:44.940 --> 37:51.940] of an actual palpable harm to another one or more of the people or their property.
[37:51.940 --> 37:56.940] Therefore, plaintiff asserts that plaintiff's ability to exercise
[37:56.940 --> 38:01.940] each and every one of plaintiff's unalienable rights end and or may be curtailed
[38:01.940 --> 38:06.940] only where the exercise of those rights would constitute a direct and palpable harm
[38:06.940 --> 38:10.940] to the rights and or property of one or more of the people,
[38:10.940 --> 38:14.940] not because the government wishes to regulate or control the rights of the people
[38:14.940 --> 38:20.940] through usurpations of legislative or rulemaking powers never granted.
[38:20.940 --> 38:28.940] Then we have what would normally be the prayer, and it's two paragraphs, both short.
[38:28.940 --> 38:31.940] For these reasons, plaintiff moves the court to issue an order instituting
[38:31.940 --> 38:36.940] injunctive relief to plaintiff, said order declaring that statutory laws
[38:36.940 --> 38:40.940] are intending to be regulatory in nature whether or not said statute contains
[38:40.940 --> 38:45.940] any punitive provisions are of no force and effect upon the people in general
[38:45.940 --> 38:48.940] and in the instant matter, plaintiff in particular,
[38:48.940 --> 38:52.940] and that no such legislative enactment has any authority to act upon
[38:52.940 --> 38:55.940] or otherwise regulate plaintiff or the people,
[38:55.940 --> 39:00.940] and that said order is issued and intended to be effective on the behalf of plaintiff
[39:00.940 --> 39:04.940] and the people of Texas and those temporarily within its borders.
[39:04.940 --> 39:08.940] Plaintiff further moves the court to reiterate within said order that the people of Texas
[39:08.940 --> 39:12.940] and all those within its borders have at all times the power and authority
[39:12.940 --> 39:17.940] to perform citizen's arrest for violations of the common law that constitute
[39:17.940 --> 39:21.940] felonies that become known to them and breaches of the peace that are committed
[39:21.940 --> 39:25.940] in their presence, and that such power and authority encompasses the power
[39:25.940 --> 39:30.940] and authority to arrest any and all public officials committing such violations
[39:30.940 --> 39:34.940] regardless of title or position.
[39:34.940 --> 39:40.940] And that's the end of it other than the signature block and so on and so forth.
[39:40.940 --> 39:45.940] So that is where my thoughts and process have been today in trying to outline a way
[39:45.940 --> 39:49.940] for us to get remedy.
[39:49.940 --> 39:52.940] Now, this is, of course, a work in progress.
[39:52.940 --> 40:01.940] It is not written in a form or fashion that is normally supported or used within common lawsuits,
[40:01.940 --> 40:05.940] but all of you listening out there have to admit we are not in common times.
[40:05.940 --> 40:09.940] We are not making common arguments the way the courts want to hear them,
[40:09.940 --> 40:13.940] and we are not standing on the common ground that belongs to we the people
[40:13.940 --> 40:16.940] as to where the government wishes for us to stand,
[40:16.940 --> 40:20.940] which is only upon what they wish to give us.
[40:20.940 --> 40:26.940] So though I understand that to many folks what is contained here is a lot of presuppositions.
[40:26.940 --> 40:34.940] These presuppositions are based in what is known and written in the documents of the Founding Fathers
[40:34.940 --> 40:41.940] through the debates known and recorded in the Federalist and Anti-Federalist Papers,
[40:41.940 --> 40:52.940] the Constitution itself, the plethora of writings and historical books on those subjects that I have read,
[40:52.940 --> 40:57.940] that I have attended classes on, that I have listened to others speak so dearly of
[40:57.940 --> 41:01.940] or to spit upon in their dissertation.
[41:01.940 --> 41:07.940] However you want to take it, these are precepts upon which America is founded
[41:07.940 --> 41:11.940] and the rights of the people are built.
[41:11.940 --> 41:16.940] There just isn't any other way the country could be set up the way it is
[41:16.940 --> 41:26.940] and these not be the ideals supporting and holding together the structure of what was supposed to be America.
[41:26.940 --> 41:31.940] Right now the House of America is in shambles.
[41:31.940 --> 41:35.940] It is on the verge of complete and total collapse.
[41:35.940 --> 41:38.940] It is not the fault of the builders.
[41:38.940 --> 41:45.940] It is the fault of the maintenance people that we hired to ensure its well-being and safekeeping.
[41:45.940 --> 41:50.940] And that, folks, is government.
[41:50.940 --> 42:00.940] So we need to come up with a way to start making an impact, a real impact, a hard impact.
[42:00.940 --> 42:05.940] And this is just one idea I've got for how we can do that.
[42:05.940 --> 42:10.940] So I'm completely open on suggestions, recommendations, alterations,
[42:10.940 --> 42:17.940] whatever will make it better, stronger, and more powerful for its intended purpose,
[42:17.940 --> 42:22.940] which is to be used against the servant government and the individuals in it
[42:22.940 --> 42:28.940] to show that we're done putting up with what we're getting
[42:28.940 --> 42:32.940] and we're not going to take it or accept it any longer.
[42:32.940 --> 42:33.940] All right.
[42:33.940 --> 42:34.940] That's what I've got.
[42:34.940 --> 42:36.940] So we've only got two or three minutes to break.

[46:13.940 --> 46:18.940] Any kind of logic structure that you're going to form, any kind of structure of rules of any sort,
[46:18.940 --> 46:22.940] there's going to always have to be a set of axioms.
[46:22.940 --> 46:26.940] And the axioms are what you start off with, which are unproven,
[46:26.940 --> 46:31.940] which are accepted by all who choose to engage in that logic structure,
[46:31.940 --> 46:35.940] that they are accepted as true without being proven,
[46:35.940 --> 46:42.940] mainly because they are self-evident, just as the founding fathers said in their documents.
[46:42.940 --> 46:45.940] We hold these truths to be self-evident.
[46:45.940 --> 46:46.940] They don't need to be proven.
[46:46.940 --> 46:48.940] They are a set of axioms.
[46:48.940 --> 46:54.940] And so, like Randy made a comment on the break, is that these are a bunch of unstated presuppositions
[46:54.940 --> 46:55.940] or unproven.
[46:55.940 --> 47:02.940] Well, you can't prove everything, okay, because in order to prove a theorem in math
[47:02.940 --> 47:07.940] or in order to prove a concept or a statement in logic,
[47:07.940 --> 47:11.940] you're going to have to start with something that's not proven.
[47:11.940 --> 47:12.940] That's just the way it is.
[47:12.940 --> 47:16.940] You have to start with a set of axioms that are the foundation
[47:16.940 --> 47:21.940] in order to structure any logic proof in any system of logic.
[47:21.940 --> 47:25.940] And so, if we can't agree on the set of axioms,
[47:25.940 --> 47:29.940] then we're not going to be able to agree on the subsequent proofs
[47:29.940 --> 47:34.940] and the subsequent sets of rules and definitions that are based on those axioms.

[50:19.940 --> 50:24.940] sitting, you know, 400, 500 yards down the freeway.
[50:24.940 --> 50:28.940] And the top guy just sits there with the gun on the overpass,
[50:28.940 --> 50:33.940] and radars everybody going by and radios down the license plate.
[50:33.940 --> 50:38.940] Now, I've heard past discussion, and I know that that's just not allowed.
[50:38.940 --> 50:44.940] The guy's accusing you of speeding when he didn't even see you speeding.
[50:44.940 --> 50:45.940] That's correct.
[50:45.940 --> 50:49.940] So I'm just wondering, is arrest without warrant the best place to start there,
[50:49.940 --> 50:56.940] the very beginning where it says officer may arrest if the offense is committed within view?
[50:56.940 --> 50:59.940] Is that the best place to start with that?
[50:59.940 --> 51:07.940] Well, that would be the very first nail you would want to hammer into their forehead
[51:07.940 --> 51:13.940] regarding that the moment the officer on the motorcycle pulled you over,
[51:13.940 --> 51:16.940] he did not witness an offense.
[51:16.940 --> 51:21.940] He is relying solely upon the hearsay accusation of someone else
[51:21.940 --> 51:24.940] as to the commission of the offense.
[51:24.940 --> 51:30.940] And the officer nowhere in Texas law is the officer given the authority to arrest
[51:30.940 --> 51:36.940] for a misdemeanor if he did not witness the misdemeanor
[51:36.940 --> 51:42.940] and does not have a warrant in his hand.
[51:42.940 --> 51:47.940] So the fact that he is having someone else radio him the information
[51:47.940 --> 51:52.940] and then proceeds to pull you over based upon a misdemeanor act
[51:52.940 --> 51:57.940] that he himself did not witness and the fact that a traffic stop in Texas
[51:57.940 --> 52:02.940] constitutes a custodial arrest,
[52:02.940 --> 52:07.940] then you've got a lawsuit that will hammer him nine ways from Monday
[52:07.940 --> 52:10.940] if you wish to pursue it.
[52:10.940 --> 52:15.940] Okay, the police do this on a regular basis and they get it hammered down,
[52:15.940 --> 52:19.940] they get it thrown out of court, and then they come back and do it again
[52:19.940 --> 52:25.940] because they get hundreds and hundreds of citations before it gets thrown out.
[52:25.940 --> 52:30.940] It is absolutely, totally and completely corrupt
[52:30.940 --> 52:35.940] and they absolutely know it's corrupt, but they make money with it.
[52:35.940 --> 52:40.940] That's right, and that's absolutely the reason it's done.
[52:40.940 --> 52:50.940] That's why you should file a private attorney general suit for yourself
[52:50.940 --> 52:57.940] and all others similarly situated and sue the officers personally.
[52:57.940 --> 53:02.940] And that's where I was going next was, well, first off, in this individual case
[53:02.940 --> 53:07.940] it seems like if the officer gets up on the stand to testify that I was going
[53:07.940 --> 53:15.940] at a rate of speed that was greater than the reasonable and prudent speed,
[53:15.940 --> 53:19.940] then I would be able to say, objection, hearsay.
[53:19.940 --> 53:24.940] Well, what you would want is you would want a copy of the signed complaint
[53:24.940 --> 53:27.940] and you would want to ensure that the officer that pulled you over
[53:27.940 --> 53:31.940] was the same officer that signed the complaint
[53:31.940 --> 53:35.940] because he is the officer that signed the citation.
[53:35.940 --> 53:39.940] So one of the supporting documents is going to be perjurious.
[53:39.940 --> 53:43.940] One of them has to be because the one on the overpass
[53:43.940 --> 53:46.940] is the one that actually saw the alleged offense.
[53:46.940 --> 53:50.940] He's the only one that can sign a complaint.
[53:50.940 --> 53:55.940] The officer that issued the ticket is the only one that can sign the citation
[53:55.940 --> 54:02.940] that's issued, and the complaint cannot be based upon a document
[54:02.940 --> 54:06.940] for which there is no competent fact witness.
[54:06.940 --> 54:08.940] And in this case, there isn't.
[54:08.940 --> 54:10.940] There cannot be.
[54:10.940 --> 54:15.940] Only the officer that saw the offense can initiate the foundational document
[54:15.940 --> 54:22.940] that is the basis for the complaint and its stand in order to proceed to trial.
[54:22.940 --> 54:26.940] Now, Randy's right that anybody can file a complaint for the purpose
[54:26.940 --> 54:30.940] of an evidentiary hearing to establish probable cause.
[54:30.940 --> 54:35.940] But once probable cause is found and a trial proceeds,
[54:35.940 --> 54:44.940] then only a competent fact witness may be used to establish the facts in question.
[54:44.940 --> 54:46.940] Well, there's another problem they have.
[54:46.940 --> 54:48.940] The one who wrote the citation.
[54:48.940 --> 54:51.940] He cannot be a competent fact witness in this circumstance
[54:51.940 --> 54:54.940] because he did not witness the offense.
[54:54.940 --> 54:59.940] The one who wrote the citation, that's aggravated perjury on its face.
[54:59.940 --> 55:00.940] That's right.
[55:00.940 --> 55:01.940] That's what I'm saying.
[55:01.940 --> 55:08.940] One or more of the two documents themselves at the foundational level are faulty
[55:08.940 --> 55:13.940] because one or both of them is going to be done under aggravated perjury.
[55:13.940 --> 55:16.940] Because if the same officer writes the ticket, signs the ticket,
[55:16.940 --> 55:22.940] and signs the complaint, he has falsely sworn that he saw the offense
[55:22.940 --> 55:27.940] and had perfectly reasonable, competent, first-hand information
[55:27.940 --> 55:31.940] to believe what he was writing in that complaint, and he doesn't.
[55:31.940 --> 55:37.940] You need to subpoena all the citations that were written in that time period.
[55:37.940 --> 55:43.940] You need to look at the time logs for the officers,
[55:43.940 --> 55:49.940] find out what officers were present, how long they were detailed to that location,
[55:49.940 --> 55:53.940] then seek out all the citations they wrote during that time
[55:53.940 --> 55:58.940] and cite each one of the officers for aggravated perjury,
[55:58.940 --> 56:05.940] false imprisonment for each citation.
[56:05.940 --> 56:06.940] That ought to get the attention.
[56:06.940 --> 56:08.940] And that's what I was going to go through next,
[56:08.940 --> 56:11.940] was trying to figure out how to get them to stop this practice
[56:11.940 --> 56:14.940] because just getting one ticket thrown out, they're still getting hungry.
[56:14.940 --> 56:16.940] Well, you're not going to stop the practice
[56:16.940 --> 56:21.940] as long as it gets them more money to do it than to stop.
[56:21.940 --> 56:26.940] You will if you start going after the officers themselves,
[56:26.940 --> 56:28.940] going after their careers.
[56:28.940 --> 56:31.940] You need them all for an ongoing criminal conspiracy.
[56:31.940 --> 56:35.940] So that means I have to submit it to the district attorney, right?

[01:19:06.940 --> 01:19:13.940] Anyway, I did a public information request that I'd mentioned earlier to find out which municipalities in Texas
[01:19:13.940 --> 01:19:15.940] are authorized to enforce the traffic code.
[01:19:15.940 --> 01:19:18.940] It turns out there's only 45 of them.
[01:19:18.940 --> 01:19:24.940] I did a further inquiry about the city I had in question as to whether the certain policeman who issued a citation to me
[01:19:24.940 --> 01:19:33.940] was specifically authorized himself to enforce the traffic code, and it turns out he is not.
[01:19:33.940 --> 01:19:36.940] In the city I'm talking about, there's nearly 500 policemen.
[01:19:36.940 --> 01:19:38.940] There's only six that are authorized.
[01:19:38.940 --> 01:19:43.940] So I will go out there on a limb and say that almost, let me say,
[01:19:43.940 --> 01:19:50.940] a small number of police are authorized to enforce the traffic code anywhere in Texas.
[01:19:50.940 --> 01:19:57.940] So it might be a simpler way to win a case rather than to prove that you don't have to register your vehicle
[01:19:57.940 --> 01:20:05.940] or don't have a driver's license or whatever falls under the transportation code to just go and do a public information request,
[01:20:05.940 --> 01:20:09.940] to find out whether that officer can enforce that at all anyway, and if he can't,
[01:20:09.940 --> 01:20:15.940] I don't think it's relevant as to whether or not you have it or you did it.
[01:20:15.940 --> 01:20:22.940] Well, at that point, what you should be doing, however, is still going after the officer for acting under an authority he did not have.

[01:34:27.940 --> 01:34:34.940] then he's opened up a whole bigger can of worms than you don't have in insurance, and it all is on him.

[01:34:37.940 --> 01:34:43.940] So that would probably be a lot easier than just trying to prove that transportation code doesn't actually apply to me.
[01:34:43.940 --> 01:34:53.940] Well, yeah, but the deal is here is the first thing, folks, you need to understand is you very ever rarely
[01:34:53.940 --> 01:34:58.940] have to go to the merits of the accusations against you,
[01:34:58.940 --> 01:35:08.940] because they very ever rarely follow the law according to what they're supposed to do when they make such an accusation against you.
[01:35:08.940 --> 01:35:13.940] And as the old saying goes, two wrongs don't make a right.
[01:35:13.940 --> 01:35:18.940] So when they fail to follow the law to get you into court,
[01:35:18.940 --> 01:35:27.940] then they don't have any authority to hold a charge over your head that they violated your rights and the law in order to create.

[01:40:03.940 --> 01:40:07.940] for someone else with a traffic ticket in the municipal court,
[01:40:07.940 --> 01:40:15.940] and they keep wanting her to come in and they keep responding back with something else
[01:40:15.940 --> 01:40:19.940] and, you know, declining their offer, but maybe offering something else,
[01:40:19.940 --> 01:40:22.940] and they just keep talking and sending stuff.
[01:40:22.940 --> 01:40:27.940] And the first time they find this individual out somewhere away from their house,
[01:40:27.940 --> 01:40:34.940] they're going to jail because they don't care.
[01:40:34.940 --> 01:40:40.940] The fact that they're avoiding whatever the thing is that the court
[01:40:40.940 --> 01:40:47.940] and the police are attempting to do does not make them correct,
[01:40:47.940 --> 01:40:51.940] nor does it protect them.
[01:40:51.940 --> 01:40:58.940] Just because they don't come in doesn't mean that they will not do something with them if they catch them.
[01:40:58.940 --> 01:41:03.940] So don't let that, you know, aspect of that escape you
[01:41:03.940 --> 01:41:08.940] because that's exactly what's going to happen.
[01:41:08.940 --> 01:41:12.940] Now, I agree that they attempt to do a lot of things that are not kosher,
[01:41:12.940 --> 01:41:18.940] but they're stepping up and not in any way valid under our Constitution

[01:41:20.940 --> 01:41:23.940] So don't get me wrong in what I'm stating here.
[01:41:23.940 --> 01:41:28.940] I'm simply telling you that if they're willing to commit fraud, aggravated perjury,

[01:41:36.940 --> 01:41:42.940] if they didn't agree to be arrested or to accept their offer.

[01:41:57.940 --> 01:42:03.940] and was heard as he passed the 11th floor to say, so far so good.

[01:42:10.940 --> 01:42:17.940] You hear them talking about they're trying these unique and unusual maneuvers,

[01:42:24.940 --> 01:42:26.940] you don't hear them coming out and bragging about that

[01:48:24.940 --> 01:48:26.940] I remember that was a show on federal grand juries.
[01:48:26.940 --> 01:48:31.940] That was kind of a railroading scheme that happened though.

[01:50:31.940 --> 01:50:45.940] And when you don't receive that back, then petition a district court for a writ of mandamus ordering the US attorney to present the exculpatory evidence to the grand jury.
[01:50:45.940 --> 01:51:02.940] Whether he actually does or not, what it does is compromises his position so that if you then get it indicted, you can use that petition for mandamus to show that exculpatory evidence was in the hands of the US attorney and that he failed to present it.
