[05:37.640 --> 05:42.640]  of a town notary, and it basically promises to do all these things, and of course, under
[05:42.640 --> 05:47.640]  penalty of perjury, if I don't, I'm a felon, I can't vote, I am disqualified for office,
[05:47.640 --> 05:49.640]  I can't even run for office again.
[05:49.640 --> 05:54.640]  And I basically said, okay, Republicans, if you're serious about it, then you'll go
[05:54.640 --> 05:59.640]  ahead and take this oath, and I will drop out of the election and back you.
[05:59.640 --> 06:03.640]  I have three Republican opponents that are running for the primary, and either one of
[06:03.640 --> 06:08.640]  them who takes this oath, they won't have to worry about a libertarian challenger.

[07:37.640 --> 07:44.640]  There's a chance you might get in there this time with the anti-incumbency movement on

[07:48.640 --> 07:53.640]  Yeah, you know, speaking of the anti-incumbency movement, there was a debate which two of
[07:53.640 --> 07:57.640]  my Republican opponents showed up to attend and actually participate in.
[07:57.640 --> 08:03.640]  And the one that did not show up, she was the Republican establishment choice, and basically
[08:03.640 --> 08:08.640]  her argument was, well, I was a news reporter, and people saw me in their living room every
[08:08.640 --> 08:12.640]  night, and so therefore they would be inclined to trust me.
[08:12.640 --> 08:14.640]  She's being backed by the establishment.
[08:14.640 --> 08:15.640]  She was AWOL.
[08:15.640 --> 08:19.640]  And one of the organizers of the debate was like, well, you should really consider supporting
[08:19.640 --> 08:20.640]  these guys.
[08:20.640 --> 08:25.640]  And, of course, when I attended, I'd been up for probably about 48 hours straight at
[08:25.640 --> 08:26.640]  that point.
[08:26.640 --> 08:27.640]  I'm like, you know what?
[08:27.640 --> 08:31.640]  I'm really tired, and I would like to not do this.
[08:31.640 --> 08:38.640]  I'd like to spend some time with my family, do a little work, catch up and pay for that
[08:38.640 --> 08:41.640]  refrigerator we just had to get and the dryer and all that.
[08:41.640 --> 08:44.640]  And I basically said, look, my offer is out there.
[08:44.640 --> 08:50.640]  I mean, it doesn't take a rocket scientist to see what you would need to do to get elected.
[08:50.640 --> 08:55.640]  So if you want me to drop out and back one of these guys, I mean, haven't taped my offer
[08:55.640 --> 08:56.640]  up.
[08:56.640 --> 09:01.640]  And the way I did it is I didn't put it out there by contacting any one of them directly.
[09:01.640 --> 09:07.640]  I basically put it out to the party, because I don't want to give any one of them the chance.
[09:07.640 --> 09:10.640]  But the first one who does this, they have my support.
[09:10.640 --> 09:11.640]  I'm done.

[09:14.640 --> 09:15.640]  I don't have to run around.

[09:24.640 --> 09:31.640]  So it just goes to show you how much of a joke this is in a lot of districts.

[09:39.640 --> 09:44.640]  And I put out an update on the 17th basically saying, well, you know what?

[09:48.640 --> 09:55.640]  if you're confident in it, or you can go home.

[10:26.640 --> 10:33.640]  But this is a good time with the strong movement against the incumbent.
[10:33.640 --> 10:38.640]  No matter who they are, this is probably the best shot the libertarians are going to have
[10:38.640 --> 10:45.640]  to get standing in office that we're going to have for a long time.
[10:45.640 --> 10:49.640]  Yeah, and we have to be really careful about what kind of remedies we propose regarding
[10:49.640 --> 10:56.640]  citizen access to grand juries, because we can't fall down the wayside by trying to propose
[10:56.640 --> 11:02.640]  legislation that would require grand juries to do anything, because that's an infringement
[11:02.640 --> 11:07.640]  on that branch of government, and once you start legislating duties and requirements
[11:07.640 --> 11:10.640]  on the grand jury, well, then they're just going to legislate the whole thing away.
[11:10.640 --> 11:19.640]  But rather, I think the way to go is to legislate extremely stiff penalties, both civil
[11:19.640 --> 11:27.640]  and criminal, for perps who try to prevent citizen's access to grand juries.
[11:27.640 --> 11:34.640]  Yeah, and that's exactly where I was going with this, because I've seen this all over.
[11:34.640 --> 11:38.640]  I know one of the problems is the typical attitude is, you know, oh, well, you need
[11:38.640 --> 11:43.640]  to be a prosecutor in order to present information, and this kind of goes back to the standard
[11:43.640 --> 11:52.640]  set back in Bailu v. US, that 1871 case that Mark Adams sent me the link to, and he actually
[11:52.640 --> 11:56.640]  sent me the information, and it was really helpful.
[11:56.640 --> 12:02.640]  This is the information that I've shared with a lot of people, but in Bailu, that was a
[12:02.640 --> 12:08.640]  case of a freed slave who'd attempted to present information of criminal wrongdoing, and the
[12:08.640 --> 12:13.640]  judge in the Kentucky Circuit Court basically said, this is federal, he basically said,
[12:13.640 --> 12:17.640]  well, you know, if you can't do that, you might as well be a slave, and if you don't
[12:17.640 --> 12:22.640]  have that ability, see, that's pretty much going to open you up to a whole bunch of different
[12:22.640 --> 12:26.640]  abuses.
[12:26.640 --> 12:28.640]  And that's exactly what's happened.
[12:28.640 --> 12:36.640]  We've been opened up to these abuses because of the limitations on our access to the grand
[12:36.640 --> 12:38.640]  jury, and we need to fix that.
[12:38.640 --> 12:44.640]  Yeah, and most of the time, there aren't any limitations as far as statutes go.
[12:44.640 --> 12:51.640]  It's just the prosecutor polling nefarious actions to get in our way and doing things
[12:51.640 --> 12:56.640]  like, they'll set the courthouse up, literally the architectural structure of the courthouse
[12:56.640 --> 13:03.640]  where the grand jury office will be like a back hidden room that's part of the prosecutor's
[13:03.640 --> 13:09.640]  office so that you can't even get there, or if you can't even get to the grand jury office
[13:09.640 --> 13:14.640]  from the main hallway, then of course it's right next to the prosecutor office, and then
[13:14.640 --> 13:19.640]  they have a joining, you know, a door that adjoins them in the back and things like this.
[13:19.640 --> 13:26.640]  I mean, in Texas, it's actually an adjudicated right that citizens do have the right to present
[13:26.640 --> 13:27.640]  criminal complaints.
[13:27.640 --> 13:33.640]  Any credible person, any credible citizen has the right to present charges directly
[13:33.640 --> 13:34.640]  to a grand jury.
[13:34.640 --> 13:36.640]  I mean, it's not just an unwritten right.
[13:36.640 --> 13:43.640]  It is a legislated, enumerated right, and I'm all for that, but because there's no
[13:43.640 --> 13:51.640]  legislated requirements upon the grand jury, it's just an enumerated right, but what is
[13:51.640 --> 13:58.640]  missing is that there are not enough stiff penalties to put people in jail for a very
[13:58.640 --> 14:05.640]  long time and seize all their property if they try to prevent the citizens from accessing
[14:05.640 --> 14:06.640]  the grand jury.
[14:06.640 --> 14:12.640]  That's what we need, but I think in a lot of places, there's not really any laws in
[14:12.640 --> 14:13.640]  place.
[14:13.640 --> 14:18.640]  There's not much laws in place that inhibit us from being able to access the grand jury.
[14:18.640 --> 14:21.640]  It's just nefarious activities on the part of the prosecutor.
[14:21.640 --> 14:22.640]  That's all.
[14:22.640 --> 14:24.640]  So we just need to increase the penalties.
[14:24.640 --> 14:29.640]  You reminded me of an email that I got earlier today, you know, because one thing I've been
[14:29.640 --> 14:35.640]  trying to do, believe it or not, in my campaign is let people know that, you know, you can
[14:35.640 --> 14:40.640]  use the courts, and it's not this magical box, and a lot of the response I've gotten,
[14:40.640 --> 14:44.640]  you know, despite some of the things that, you know, I've told people, hey, you can do
[14:44.640 --> 14:49.640]  this, and it's a matter of fact, the weird thing is a lot of them, you know, will run
[14:49.640 --> 14:53.640]  by lawyers what I propose, and, you know, they're like, wow, the lawyer thought this
[14:53.640 --> 14:57.640]  was really neat, you know, but they're still afraid of it.
[14:57.640 --> 15:03.640]  And I finally got this email today, and you just made me think of it, where this guy was
[15:03.640 --> 15:08.640]  basically saying, people think of dollars, you know, when you talk about litigation,
[15:08.640 --> 15:13.640]  and of course, you know, the response is, I need money to do this.
[15:13.640 --> 15:17.640]  And I used an appropriate analogy because I've learned to do these two other things,
[15:17.640 --> 15:24.640]  and I said, look, you know, people are terrified of brewing, you know, say, six gallons of
[15:24.640 --> 15:30.640]  beer or making a loaf of bread from scratch, you know, when they think of dollars, as if
[15:30.640 --> 15:36.640]  mankind, you know, itself somehow didn't know how to do these things before the grocery
[15:36.640 --> 15:42.640]  store was invented, and I said, look, it's a process that involves people throwing
[15:42.640 --> 15:49.640]  dollars in a magic box, and a loaf of bread or a can of beer comes out the other side.
[15:49.640 --> 15:56.640]  There's a process in that magic box that occurs, and that's the process of somebody
[15:56.640 --> 16:02.640]  doing something, and the proposal that we can't access our own courts without money
[16:02.640 --> 16:07.640]  is like saying, man didn't figure out how to culture yeast or fill flour until the
[16:07.640 --> 16:13.640]  grocery store was invented, you know, but it made sense to a lot of people, you know,
[16:13.640 --> 16:14.640]  and it kind of made them think about it.
[16:14.640 --> 16:18.640]  I mean, somebody's got to do something, and there's mechanics behind it, you know,
[16:18.640 --> 16:23.640]  and it's not like somebody just does something automatically, like a town approves an
[16:23.640 --> 16:26.640]  education budget, and automatically people get educated.
[16:26.640 --> 16:31.640]  It's not like that at all, you know, so people, I think, are looking at that, you know,
[16:31.640 --> 16:34.640]  because they've just seen things broken for so long.

[19:15.640 --> 19:18.640]  there's no due process at all.
[19:18.640 --> 19:22.640]  And I kind of looked at it a little bit and looked up on the Internet, and I found out
[19:22.640 --> 19:28.640]  that the Supreme Court actually ruled on it, Bell v. Burston.
[19:28.640 --> 19:33.640]  And they basically said that it's a privilege to drive.
[19:33.640 --> 19:37.640]  I don't agree with this, but they say it's a privilege to drive.
[19:37.640 --> 19:42.640]  But once they give you that license and that registration and you pay for it, it becomes
[19:42.640 --> 19:43.640]  your property.
[19:43.640 --> 19:48.640]  So for them to deprive you of that property, they first have to give you due process.
[19:48.640 --> 19:55.640]  And when I was talking to the people at the DMV, they were saying that in these hearings,
[19:55.640 --> 20:04.640]  what happens is there's somebody there that acts as the judge and the prosecution, almost
[20:04.640 --> 20:12.640]  like an agent for the commissioner of the DMV, which in turn acts as both the prosecution
[20:12.640 --> 20:15.640]  and the judge.
[20:15.640 --> 20:23.640]  Interestingly enough, in Connecticut, the person in that hearing is an attorney, which
[20:23.640 --> 20:25.640]  kind of makes things a little bit more interesting, I think.

[21:00.640 --> 21:06.640]  Connecticut's one of those places where they pull you over, give you a ticket for not having
[21:06.640 --> 21:11.640]  your seat belt, give you a ticket for not having your wipers on when it's overcast,
[21:11.640 --> 21:15.640]  give you a ticket for not having your lights on when it's overcast.
[21:15.640 --> 21:21.640]  So it's something where just driving, they're just sucking so much money out of me that
[21:21.640 --> 21:26.640]  I just woke up one morning and I'm like, if they want that $200, I'm going to make them
[21:26.640 --> 21:27.640]  work for it.
[21:27.640 --> 21:35.640]  And maybe you can kind of give me some advice on how it can be as much of a pain in the
[21:35.640 --> 21:41.640]  butt to where they're just not going to bother with it.
[21:41.640 --> 21:43.640]  What state are you in?
[21:43.640 --> 21:47.640]  In Connecticut.
[21:47.640 --> 21:52.640]  It has very similar statutes as California.
[21:52.640 --> 21:54.640]  It's almost identical.
[21:54.640 --> 22:00.640]  Well, Texas statutes were actually originally based on Connecticut statutes as well,
[22:00.640 --> 22:05.640]  though I can't say that may be true anymore.
[22:05.640 --> 22:10.640]  Well, the first thing is have you looked up what is supposed to occur in these hearings?
[22:10.640 --> 22:14.640]  Have you looked at the statutes requiring what's to be done, what's to be presented,
[22:14.640 --> 22:19.640]  who is to testify, who is to sit in judgment, and so on and so forth?
[22:19.640 --> 22:26.640]  Yes, what happens is I go there, they give me two things that I can talk about,
[22:26.640 --> 22:34.640]  and that's it, which is whether the identified vehicle was registered to you at the time
[22:34.640 --> 22:39.640]  that the insurance was canceled and whether you've maintained the insurance
[22:39.640 --> 22:42.640]  throughout the registration period.
[22:42.640 --> 22:49.640]  Anything outside of that, from what I understand, they won't even have a conversation with you about.
[22:49.640 --> 22:58.640]  It's one person, it's an attorney that represents the commissioner of DMV.
[22:58.640 --> 23:09.640]  What's weird is they say that the prosecution is actually the insurance enforcement office of the DMV.
[23:09.640 --> 23:14.640]  So it's basically the DMV is the prosecution that's not there presently,
[23:14.640 --> 23:26.640]  it's not there at the hearing, and the DMV is also represented by, it's kind of confusing, but it's one attorney.
[23:26.640 --> 23:30.640]  You're saying the one individual has to sit on both sides of the fence?
[23:30.640 --> 23:32.640]  Yes.
[23:32.640 --> 23:40.640]  And so your argument is lack of due process because of this, correct?
[23:40.640 --> 23:41.640]  Yes.
[23:41.640 --> 23:44.640]  And who are you arguing it to?
[23:44.640 --> 23:47.640]  Well, that's where I'm confused.
[23:47.640 --> 23:54.640]  How do I argue that to a, you know, in this type of a hearing?
[23:54.640 --> 24:02.640]  I don't know where to go from there besides just bringing it into, I don't know how to bring it into the court system.
[24:02.640 --> 24:07.640]  It's actually, what happens is in Connecticut, from what I understand,
[24:07.640 --> 24:13.640]  and what they kind of explained to me is the appeals court, superior appeals court,
[24:13.640 --> 24:23.640]  granted DMV, the state agency, the right to hold these hearings almost as an extension of the court.
[24:23.640 --> 24:32.640]  Does the state constitution allow them to create courts outside of legislative act?
[24:32.640 --> 24:35.640]  I believe so.
[24:35.640 --> 24:39.640]  They, from what they told me, that they can do that,
[24:39.640 --> 24:48.640]  but it has to provide the same protections as any other court, which it's not, it just doesn't do that.
[24:48.640 --> 24:51.640]  Okay, then that's how you get it into court.
[24:51.640 --> 25:01.640]  You file an injunction and then you file suit against that department for violation of state constitution and state law.
[25:01.640 --> 25:05.640]  Okay.
[25:05.640 --> 25:14.640]  And when I was listening to the previous caller that, you know, in California, you guys mentioned like a franks hearing.
[25:14.640 --> 25:25.640]  Would I do that with the attorney that's in that hearing challenging, you know, his position as a judge or whatever?
[25:25.640 --> 25:28.640]  You're challenging the validity of the system as a whole.
[25:28.640 --> 25:30.640]  The franks hearing would not apply in this case.
[25:30.640 --> 25:32.640]  Okay.
[25:32.640 --> 25:43.640]  A franks hearing only applies when you are testing the veracity of an officer who testified before a magistrate to secure a warrant.
[25:43.640 --> 25:44.640]  Okay.
[25:44.640 --> 25:47.640]  So that's something completely different.
[25:47.640 --> 25:53.640]  Now, what about faulty policy?
[25:53.640 --> 26:04.640]  Here it looks like you have a hearing that denies you in a fair hearing, a fair adjudication in the first instance,
[26:04.640 --> 26:10.640]  that this one is biased by its very structure.
[26:10.640 --> 26:16.640]  And that would go to due process that you could file a civil action against this.
[26:16.640 --> 26:21.640]  I don't know if, you know, you don't have a waiver of sovereign immunity.
[26:21.640 --> 26:25.640]  This is a difficult spot.
[26:25.640 --> 26:30.640]  Well, the other thing is that the sole purpose for which it was created, you can obviously argue,
[26:30.640 --> 26:36.640]  was for the purpose of generating revenue without due process.
[26:36.640 --> 26:38.640]  Okay.
[26:38.640 --> 26:46.640]  That could go to a private attorney general suit.
[26:46.640 --> 26:48.640]  And a quitem.
[26:48.640 --> 26:57.640]  Well, no, I thought quitem, but not quitem, because quitem is where you recover government funds that are misapplied.
[26:57.640 --> 27:03.640]  This is where they're stealing government funds they intend to misapply later.
[27:03.640 --> 27:06.640]  Yeah.
[27:06.640 --> 27:14.640]  So it would go to a private attorney general where you sue for yourself and all others similarly situated.
[27:14.640 --> 27:20.640]  So a suit filed with the private attorney general?
[27:20.640 --> 27:22.640]  No, no.
[27:22.640 --> 27:27.640]  This is the only time you can file as a private attorney general.
[27:27.640 --> 27:37.640]  And that's when you file a civil action in the court for yourself and all others similarly situated.
[27:37.640 --> 27:40.640]  All others.
[27:40.640 --> 27:42.640]  Okay.
[27:42.640 --> 27:48.640]  Well, let me ask, since I have you here, let me ask you another quick question.
[27:48.640 --> 27:51.640]  Hopefully it's quick.
[27:51.640 --> 28:02.640]  When I go and speak with this person at that hearing, what are the types of things that I should talk about
[28:02.640 --> 28:11.640]  that might make it a little less likely that he's going to want to keep chasing this $200?
[28:11.640 --> 28:14.640]  Due process.
[28:14.640 --> 28:23.640]  Violation of due process and indicate that the hearing, that because he's the prosecutor and the judge,
[28:23.640 --> 28:30.640]  that this is fundamentally unfair.
[28:30.640 --> 28:38.640]  If he's an attorney, he'll recognize that term, because you have a specific right to fundamental fairness.
[28:38.640 --> 28:48.640]  And you need to say things that indicate that you intend that you think the whole thing is fundamentally unfair
[28:48.640 --> 28:59.640]  and constitutes a breach of due process and goes to denying you of your property without due process.
[28:59.640 --> 29:04.640]  And that'll warn him about a federal suit.
[29:04.640 --> 29:07.640]  Okay.
[29:07.640 --> 29:13.640]  And he also mentioned somebody, not him, but that same, I ended up talking to the legal department
[29:13.640 --> 29:20.640]  and they said that what happens, what they would want me to do was go ahead, go to the first hearing,
[29:20.640 --> 29:28.640]  all right, it doesn't work, go to the second hearing, and then if that doesn't work, then go to,
[29:28.640 --> 29:32.640]  then bring it into the appeals court.
[29:32.640 --> 29:37.640]  Is that something that I'd want to do or is it?
[29:37.640 --> 29:38.640]  In other words...
[29:38.640 --> 29:42.640]  That sounds like it goes specifically to Connecticut law.

[32:04.640 --> 32:14.640]  It seems to me like in California, post foreclosure after they sell the home at a trustee sale after these pretender lenders take our home,
[32:14.640 --> 32:22.640]  it seems to me like the only thing that's going to work going back to them is going to be a criminal complaint.
[32:22.640 --> 32:29.640]  In my opinion, if we file a criminal complaint against everybody that touched that process,
[32:29.640 --> 32:36.640]  that'll be the guys that give the notice of default, everybody, including the servicers and the attorneys.
[32:36.640 --> 32:41.640]  Now, they're not going to be worried about giving our home back.
[32:41.640 --> 32:43.640]  They're going to be worried about going to jail.
[32:43.640 --> 32:45.640]  Does that make any sense, Skelton?

[32:46.640 --> 32:49.640]  That's pretty surprising you should bring that up.
[32:49.640 --> 32:54.640]  I was talking to someone in California this morning about the exact same issue,
[32:54.640 --> 33:02.640]  and I got some advice from a good paralegal out of New York,
[33:02.640 --> 33:12.640]  and that's precisely what he said as a strategy to stop a third party from taking possession after a trustee sale.
[33:12.640 --> 33:13.640]  Right.
[33:13.640 --> 33:21.640]  You come to the court and make criminal accusations, and that stops everybody.
[33:21.640 --> 33:28.640]  It's not something I can definitively comment on yet because I haven't had time to research it,
[33:28.640 --> 33:34.640]  but it certainly sounds like a good way to stop the whole thing.
[33:34.640 --> 33:48.640]  The problem we have when the property has been sold, if a third party purchases an apparently innocent third party,
[33:48.640 --> 33:53.640]  the question before the courts become who has a right to possession,
[33:53.640 --> 34:00.640]  and almost always the right to possession will go to the apparently innocent third party.
[34:00.640 --> 34:06.640]  If you can show that that party is not precisely innocent, then you can bind them up with a lawsuit.
[34:06.640 --> 34:12.640]  Yes, but Mr. Skelton, we're not worried about the property at the moment.
[34:12.640 --> 34:18.640]  We're worried about filing criminal complaints and getting natural damages from these pretender lenders
[34:18.640 --> 34:21.640]  so that they don't worry about giving back the home.
[34:21.640 --> 34:26.640]  They're going to be worried about not going 15 years through jail, and most likely they're going to give up.
[34:26.640 --> 34:32.640]  I don't care about the home as long as I get something that I can buy in a similar home.
[34:32.640 --> 34:34.640]  I mean, that's my strategy.
[34:34.640 --> 34:38.640]  Okay, yeah, if you're not trying to get the home back.
[34:38.640 --> 34:47.640]  The way I had planned this and what I'm doing is we do an original suit without the criminal complaints,
[34:47.640 --> 34:54.640]  and then we use an amended pleading to bring the lender to the table.
[34:54.640 --> 35:00.640]  We use the original complaint to give him all the accusations against him and soften him up.
[35:00.640 --> 35:04.640]  Generally, that's not going to be enough to bring him to the table.
[35:04.640 --> 35:10.640]  So we get him to try to fight against us and file motions in the case.
[35:10.640 --> 35:18.640]  The one we really want to see is the Rule 12 motion to dismiss for failure of state of claim of which recovery can't be had.
[35:18.640 --> 35:27.640]  We get that one, and we treat it, we file sanctions against the, or we move for sanctions against the attorney for filing a frivolous pleading.
[35:27.640 --> 35:29.640]  We bargain with the attorney.
[35:29.640 --> 35:38.640]  We file an amended pleading, name the attorney as a litigant, and here's where we start bringing in the criminal actions.
[35:38.640 --> 35:42.640]  But we don't actually file them with the court yet.
[35:42.640 --> 35:56.640]  We make our accusations against the lender in this civil action in terms of criminal actions that create a civil tort.
[35:56.640 --> 35:58.640]  So this is fair warning.
[35:58.640 --> 36:08.640]  Then if they don't come to the table, then we go to the grand jury or to the district attorney with criminal complaints and get him to refuse to take them.
[36:08.640 --> 36:15.640]  But he will also call the lender and say, why are these guys down here trying to get me to arrest you?
[36:15.640 --> 36:17.640]  And we raise the stakes.
[36:17.640 --> 36:28.640]  If that doesn't get it done, then our next shot is to go straight to the grand jury with the criminal complaints against the district attorney for shielding from prosecution.
[36:28.640 --> 36:36.640]  Just steadily raise the stakes, and we get the prosecutor mad at these guys because he's in trouble for protecting them.
[36:36.640 --> 36:44.640]  Right. What if we raise Rule 27 so that they can come up and prove that they were – because we know the services don't have any standing.
[36:44.640 --> 36:45.640]  We know that.
[36:45.640 --> 36:47.640]  Everybody knows that.
[36:47.640 --> 36:56.640]  Now under Rule 27, don't they have to come up and prove they had standing to sue and they're not going to be able to?
[36:56.640 --> 37:01.640]  Mostly they don't want to touch us with that.
[37:01.640 --> 37:11.640]  That's what they're supposed to do, but we had a judge tell someone in California that you really need to sue in the federal court
[37:11.640 --> 37:20.640]  because the laws in California have been structured by the banks so that you're not going to get remedy in the state.
[37:20.640 --> 37:24.640]  Right. We know that, and also that's why we're changing our strategy.
[37:24.640 --> 37:32.640]  We're going also under Bankruptcy 7, and Bankruptcy 7, we're going to bring them in and prove that they are the creditors,
[37:32.640 --> 37:34.640]  and they don't prove they're the creditors.
[37:34.640 --> 37:41.640]  So at that 341 meeting, we start winning because we have started to build a record in federal court, in equity court,
[37:41.640 --> 37:45.640]  and then we have the equity law on our side.
[37:45.640 --> 37:46.640]  We start building a record.
[37:46.640 --> 37:47.640]  They have defaulted.
[37:47.640 --> 37:52.640]  They don't touch us until the Bankruptcy 7, but they never came up and proved it.
[37:52.640 --> 37:54.640]  Now we have our record.
[37:54.640 --> 37:56.640]  Does that make any sense?
[37:56.640 --> 38:00.640]  Now you have the record you can bring into a direct suit back against them.
[38:00.640 --> 38:14.640]  Yes, yes, because on the 341, I add them as a unsecured, non-priority loan, unsecured on Schedule F,
[38:14.640 --> 38:17.640]  and then they're going to go to a judge and say, well, we're securing.
[38:17.640 --> 38:19.640]  The judge is going to say, well, prove it.
[38:19.640 --> 38:25.640]  They won't be able to prove it, and that's when all the damage starts going towards their side.
[38:25.640 --> 38:28.640]  Do you understand what I'm trying to say?
[38:28.640 --> 38:35.640]  Yes, if they try to prove it with the deed of trust, we can certainly go after the validity of the deed of trust
[38:35.640 --> 38:42.640]  because we can maintain that became void immediately after it was created
[38:42.640 --> 38:49.640]  because the lender received consideration and didn't transfer the deed of trust to the purchase of the security instrument.
[38:49.640 --> 38:52.640]  Therefore, the deed of trust became void.
[38:52.640 --> 38:59.640]  Right, and we have a case now in California where a U.S. bank says, I have the note in my hand,
[38:59.640 --> 39:03.640]  but you don't have the power, you don't have the authority on that note.
[39:03.640 --> 39:05.640]  You don't have a chain of title, any law.
[39:05.640 --> 39:09.640]  So they had standing?
[39:09.640 --> 39:13.640]  But they have to write it to the note.
[39:13.640 --> 39:15.640]  They have to have the actual note.
[39:15.640 --> 39:18.640]  The note's not enough.
[39:18.640 --> 39:19.640]  The note's not enough.

[41:01.640 --> 41:04.640]  I'm going to do a quick rundown of what's happened.
[41:04.640 --> 41:07.640]  I got pulled over in October of last year.
[41:07.640 --> 41:12.640]  And then the officer, okay, I listened to Eric Huru,
[41:12.640 --> 41:18.640]  which I'm sure you guys are familiar with and his stance on a name and everything.
[41:18.640 --> 41:25.640]  So I've chosen to call myself something other than the birth certificate that I was issued.
[41:25.640 --> 41:33.640]  And so anyways, I told the officer who I am and he decided that that wasn't who I was,
[41:33.640 --> 41:35.640]  so he took me to jail.
[41:35.640 --> 41:43.640]  He was actually a motorcycle police and he took me to jail and he had some other officer come
[41:43.640 --> 41:50.640]  and take me and they said that they wouldn't let me go until I told them who I really was.
[41:50.640 --> 41:58.640]  And I told them there's no way that anyone can be sure that the birth certificate pertains to them.
[41:58.640 --> 42:04.640]  So anyways, I went through, then in November I went to an arraignment
[42:04.640 --> 42:09.640]  and I challenged political jurisdiction, which they just absolutely ignored.
[42:09.640 --> 42:18.640]  And the judge basically, he threatened to throw me in jail for contempt after less than five minutes.
[42:18.640 --> 42:25.640]  He threatened to throw me in jail for contempt if I wasn't going to tell him a name or, you know.
[42:25.640 --> 42:30.640]  So finally I told them that I was the individual that got pulled over
[42:30.640 --> 42:37.640]  and then he basically forced me to plead not guilty because, you know, I wasn't going to plead guilty.
[42:37.640 --> 42:42.640]  But anyways, we went through several other hearings where I challenged political jurisdiction,
[42:42.640 --> 42:49.640]  which they refused to address at all and then they somehow jumped to finding jurisdiction,
[42:49.640 --> 42:55.640]  subject matter jurisdiction and personam and personam jurisdiction.
[42:55.640 --> 43:04.640]  And then on January 28th, he threw me in jail for contempt, which he said I was speaking over him.
[43:04.640 --> 43:16.640]  So then I filed or in the morning I pled guilty, you know, just to get out there because a $25,000 bail was set.
[43:16.640 --> 43:25.640]  So I figured that the easiest way for me to get out at that time was to just plead guilty and get out and file an appeal, which I have done.
[43:25.640 --> 43:36.640]  And then so I filed all the appeal paperwork and I hear the music.

[01:32:06.120 --> 01:32:10.520]  and then they came to rent in January and they sent me a letter saying, we're having

[01:32:11.520 --> 01:32:13.520]  Their checks we gave you are no good.
[01:32:13.520 --> 01:32:19.280]  They gave me some checks for each month and they said, we have lots of your mail and we

[01:32:20.280 --> 01:32:24.360]  I tried to make contact and I wasn't able to get a hold of them for a couple of months

[01:32:31.360 --> 01:32:38.360]  us and you're the worst landlord in the world and they said, actually I sent them a notice
[01:32:38.360 --> 01:32:43.760]  to evict, a letter and then they sent me some nasty email and then I went to, I filed a small
[01:32:43.760 --> 01:32:53.600]  claim court suit of eviction and then I presented my case and I won a judgment and all was well
[01:32:53.600 --> 01:33:02.560]  but then they got a lawyer and they filed an appeal and they also filed a popper's affidavit.
[01:33:02.560 --> 01:33:07.040]  I filed a motion to contest the popper's affidavit and I thought I did a perfect job on it.
[01:33:07.040 --> 01:33:12.200]  Like I mentioned some great points that the reason for eviction was non-payments and the
[01:33:12.200 --> 01:33:17.600]  very fact that they're filing a popper's affidavit proves my suit but the judge treated me like
[01:33:17.600 --> 01:33:18.600]  garbage.
[01:33:18.600 --> 01:33:25.000]  He told me to the lawyer and he said, proceeds don't have a chance, quote and I said okay
[01:33:25.000 --> 01:33:29.920]  but he seemed to like me because during the eviction suit he gave the tenants, he gave
[01:33:29.920 --> 01:33:36.160]  the tenant lady a contempt charge, $100 fine or whatever for speaking out of turn and yelling
[01:33:36.160 --> 01:33:37.160]  at them.
[01:33:37.160 --> 01:33:43.120]  Then I filed a motion, then the tenants filed a suit against me, the claiming I violated
[01:33:43.120 --> 01:33:46.320]  the property code and it was nonsense.
[01:33:46.320 --> 01:33:51.240]  Talking about smoke detector and in the contract I wrote that they have to write me a registered
[01:33:51.240 --> 01:33:56.160]  letter saying and giving me time to remedy the solution, irregardless they filed this

[01:33:58.680 --> 01:34:05.960]  In the meantime I found out and their lawyer told me that the mortgage company had foreclosed

[01:34:11.640 --> 01:34:15.400]  but I wanted a divorce and she wouldn't sign over the title to me.

[01:34:23.520 --> 01:34:28.280]  sold it and they contacted the clients and they claimed they offered them a rental agreement.
[01:34:28.280 --> 01:34:34.080]  So now their lawyer is telling me if I try to present again in the county court of law,
[01:34:34.080 --> 01:34:39.480]  it went from JP court to county court, that he's going to say that I hurt myself by saying
[01:34:39.480 --> 01:34:42.920]  I didn't know about the foreclosure and I really didn't.
[01:34:42.920 --> 01:34:45.800]  Filing the motion to contest the Pauper's affidavit, he called me everything on the
[01:34:45.800 --> 01:34:50.440]  sun, compared me to Hitler, I mean it was just silly and ridiculous.
[01:34:50.440 --> 01:34:54.920]  So what I want to know is what can I do to get all the, what is a magic bullet to get
[01:34:54.920 --> 01:35:00.480]  ridiculous case dismissed from a private party and what can I do for this appeal?
[01:35:00.480 --> 01:35:05.160]  And it seems outrageous to me that you can file a Pauper's affidavit claiming you have
[01:35:05.160 --> 01:35:08.680]  no money and you haven't had any money for months but still not pay your rent.

[01:39:24.400 --> 01:39:29.440]  thing thrown out because they really have no, from my point of view, no proof, no evidence.
