[04:46.600 --> 04:52.320]  got a couple things that we want to talk about up front, one of which is very important and
[04:52.320 --> 04:57.360]  near and dear to those in Texas, and that is Texas property taxes.
[04:57.360 --> 05:04.080]  I was privy to some information that was sent to us today via an email regarding a lawsuit
[05:04.080 --> 05:08.440]  that's been filed in relation to property taxes here in Texas, and it does a very good
[05:08.440 --> 05:13.480]  job of taking information that I've had in my possession for a long time and I've used
[05:13.480 --> 05:20.760]  to give to others and turning it into an actual lawsuit against the counties for assessing
[05:20.760 --> 05:26.360]  property taxes in violation of the Texas Constitution.
[05:26.360 --> 05:33.480]  Everyone knows back in 2005, the Texas Supreme Court ruled that property taxes for the state
[05:33.480 --> 05:39.600]  in this form of ad valorem property taxes were unconstitutional in the state of Texas,
[05:39.600 --> 05:46.240]  and it does say right in the Texas Constitution that there shall be no state ad valorem taxes.
[05:46.240 --> 05:50.760]  Well, a lot of people are going, well, but the county's the one that charges the tax
[05:50.760 --> 05:56.320]  and the city's the one that charges the tax, yes, but they do so under the direction, supervision,
[05:56.320 --> 06:01.800]  and training of the state, who also receives a portion of that money.
[06:01.800 --> 06:08.320]  Now, since the state is being compensated, the state is partnered to the taxation, and
[06:08.320 --> 06:16.680]  since the Constitution forbids that, that makes the whole thing unconstitutional.
[06:16.680 --> 06:21.640]  So I went through the lawsuit that they wrote up today, and I made some points on it as
[06:21.640 --> 06:25.940]  far as there's a couple things here that you're referencing that you might want to reconsider
[06:25.940 --> 06:31.840]  or do slightly different, and I'm waiting to hear back from them to see exactly what
[06:31.840 --> 06:37.680]  the response is they have to what I wrote.
[06:37.680 --> 06:42.640]  But if you've got property tax issues going on in Texas right now, please feel free to
[06:42.640 --> 06:48.760]  call in tonight and let us know what's going on, where you're at in Texas, and what they're
[06:48.760 --> 06:56.880]  doing, because odds are that this suit is something that you yourself can take and file
[06:56.880 --> 07:04.480]  on your own and make hay with all day long, and this is getting to be one of the biggest
[07:04.480 --> 07:09.360]  problems in any State of the Union is the fact that they want more and more money out
[07:09.360 --> 07:14.160]  of an individual just because they own property.
[07:14.160 --> 07:18.240]  This suit makes a very good job of pointing out exactly what I've tried to point out to
[07:18.240 --> 07:22.640]  people the whole time, and it's got the case law and the historical references from the
[07:22.640 --> 07:27.680]  statute and everything that proves the point, just like what I've got, and what I've always
[07:27.680 --> 07:37.280]  said about property taxes is this, they can only tax private property if the owner renders
[07:37.280 --> 07:47.040]  the property for taxation voluntarily for the objective of being able to vote on a fiscal
[07:47.040 --> 07:55.320]  bill, meaning any bill that's requiring financing from the public in order to cast your vote
[07:55.320 --> 08:02.720]  in favor of that bill, you have to render property for taxation to fund that bond.
[08:02.720 --> 08:09.080]  Now, of course, the rendering would only have to take place if the bond issue passed, and
[08:09.080 --> 08:17.720]  you only have to render property for taxation if you're voting yes on the expenditure, okay?
[08:17.720 --> 08:25.760]  Now, this serves two purposes. One, it ensures that nobody that disagrees with the spending
[08:25.760 --> 08:31.000]  of public funds is required to put their money into the pot to have it spent in a way they
[08:31.000 --> 08:38.200]  disagree with. Now, that's part of basic standard true freedom. You can't make me pay for something
[08:38.200 --> 08:43.640]  I disagree with. You can't walk up to me, stick a gun in my face and demand $1,000 out
[08:43.640 --> 08:48.180]  of my wallet because your girlfriend needs an abortion when I disagree with the subject
[08:48.180 --> 08:55.280]  of abortion, okay? Just as one of those types of similarities. You just can't take my money
[08:55.280 --> 09:00.520]  and spend it on whatever you want if it's something I, as a free man, completely disagree
[09:00.520 --> 09:09.200]  with. So that was one of the things that it did. The other thing that it does by requiring
[09:09.200 --> 09:16.560]  it to be done that way is that it sets the funding for a particular project on those
[09:16.560 --> 09:21.880]  that have the property to be able to render for its construction and its use. And of course,
[09:21.880 --> 09:27.040]  they perceive they're going to receive some benefit from it by funding such a project,
[09:27.040 --> 09:35.000]  okay? So once again, if they want to erect a water works or a water treatment plant inside
[09:35.000 --> 09:40.480]  a city limits and the city wants to fund it from a bond, great. But those that don't want
[09:40.480 --> 09:45.600]  it in the city or don't think a water treatment plant is a smart way to be subsidizing certain
[09:45.600 --> 09:49.760]  things of government because there's already a private one in town that the government's
[09:49.760 --> 09:53.840]  now going to be competing with, so on and so forth, they're not required to support
[09:53.840 --> 10:01.160]  that. Now, this is just a couple of things that we can look at regarding the property
[10:01.160 --> 10:09.360]  taxes, but here are some others. A man cannot truly own property if someone else is charging
[10:09.360 --> 10:15.520]  him a fee for the purpose of owning it. I mean, let's go back to the taxation of a right
[10:15.520 --> 10:23.040]  issue. If a man has a right to own property, then he has a right to own it. And if he can
[10:23.040 --> 10:29.320]  own it, it cannot be taken away from him because he didn't pay someone else for it when they
[10:29.320 --> 10:35.160]  have no financial interest in the property. It doesn't matter if it's the state, it doesn't
[10:35.160 --> 10:42.680]  matter if it's anyone else. If you don't have a financial interest in my property, you didn't
[10:42.680 --> 10:50.480]  help pay for it, you don't receive any type of rights to my property when I purchase and
[10:50.480 --> 10:56.880]  pay for it with my money, my sweat, my blood, my hard work and labor, then why am I paying
[10:56.880 --> 11:05.120]  you a dime to keep it? That makes no sense. At least it makes no sense to normal people.
[11:05.120 --> 11:12.560]  You have to have a particularly large tumor to operate and work in government without
[11:12.560 --> 11:17.160]  a conscience, it seems. And a lot of these people do. They think it's perfectly okay
[11:17.160 --> 11:21.400]  that they can tell a private property owner that, well, if you want to keep your property,
[11:21.400 --> 11:27.360]  you got to pay us. If you want your property protected and kept safe, you got to pay us.
[11:27.360 --> 11:31.120]  If you don't want somebody to come in and damage your property and cause other problems
[11:31.120 --> 11:36.240]  for you and your property, you got to pay us. This sounds a whole lot like the racketeering
[11:36.240 --> 11:42.400]  schemes that went on in the big cities back in the 20s, 30s and 40s. And if you really
[11:42.400 --> 11:50.360]  know about it, it's pretty much going on today, except now they call them police forces. But
[11:50.360 --> 11:57.280]  the point being that it's your property. Who has the right to take your property and tell
[11:57.280 --> 12:05.880]  you that you have to pay them money to have and to use what rightfully belongs to you?
[12:05.880 --> 12:12.000]  All right? So that's the first part of my little tarot tonight. And I would like to
[12:12.000 --> 12:15.360]  see if Randy or Deborah's got any commentary on that before we go any further.
[12:15.360 --> 12:23.160]  You have the lawsuit. Yes, I've got a copy of what was filed. How does the lawsuit address
[12:23.160 --> 12:29.920]  the issue? I haven't had an opportunity to see it. The lawsuit addresses the issue by
[12:29.920 --> 12:36.080]  going through the tax code, the Texas Constitution, the several variations of it since 1836 to
[12:36.080 --> 12:43.680]  date, and case law. From right here in Texas, it deals with the subjects of taxation and
[12:43.680 --> 12:50.280]  rendering of property. And it shows very clearly what I've always said, that it's a voluntary
[12:50.280 --> 12:54.600]  thing, and it's only to be done if you're going to be voting on a particular type of
[12:54.600 --> 13:03.680]  bond bill. But I did forward you a copy of the email with my reply to these guys, Randy,
[13:03.680 --> 13:12.040]  and I did attach the lawsuit to that, as well as the email that contains my responses to
[13:12.040 --> 13:16.800]  their individual sections of the lawsuit. Yes, and I didn't get time to go through it
[13:16.800 --> 13:24.600]  today. That's why I was interested in how they approached making this claim, because
[13:24.600 --> 13:29.080]  people hear this and they say, holy crap. I've been paying all these taxes all these
[13:29.080 --> 13:34.680]  years, and it's absolutely clear in the law that I'm not supposed to be paying. How does
[13:34.680 --> 13:46.880]  these guys address the issues in a way, or do they address it in a way that the court
[13:46.880 --> 13:59.240]  can give this ruling without bankrupting the state? Well, the thing about it is, the issue,
[13:59.240 --> 14:04.880]  and I know that this is not what they're going to do, but the issue is not whether or not
[14:04.880 --> 14:13.580]  it would bankrupt the state, because here's the problem. Okay, if the state's been conducting
[14:13.580 --> 14:20.640]  illegal activities for decades, which we know they have, why are they any less financially
[14:20.640 --> 14:26.160]  liable for a tort action than anybody else would be? A crime is a crime no matter under
[14:26.160 --> 14:34.360]  what guise it was committed, right? So, if the state has been stealing money, at the
[14:34.360 --> 14:42.000]  very least, it owes that money with interest back to those it stole it from. I understand
[14:42.000 --> 14:51.360]  that, but the problem is, in the real world we live in, if they posed a question before
[14:51.360 --> 15:00.840]  the court that would essentially bankrupt the entire state, which judge is going to
[15:00.840 --> 15:07.120]  be the one to make the ruling to bankrupt the entire state that he works for? Well,
[15:07.120 --> 15:12.640]  they're not filing the lawsuit to recover for the fraud. They're not after the recovery
[15:12.640 --> 15:19.880]  of money. They're after the stopping of the taxation. So, you've got an immediate response
[15:19.880 --> 15:25.760]  requirement versus an overtime response requirement where the treasury would dwindle from the
[15:25.760 --> 15:33.760]  source of property taxes point of view, overtime, but they're not being sued to pay out compensatory
[15:33.760 --> 15:39.640]  damages, at least if there is. I'm misreading that part in the suit. Okay, it's not going
[15:39.640 --> 15:50.040]  to matter if this suit rules that in any way the property taxes are invalid. Maybe these
[15:50.040 --> 15:55.960]  people aren't suing for all of the back taxes, but someone else could come in and do that
[15:55.960 --> 16:04.040]  tomorrow. So, I can't see how we're going to get the courts to rule in our favor because
[16:04.040 --> 16:09.760]  after all, the courts are absolutely corrupt. I guess I'm thinking more practically than
[16:09.760 --> 16:17.440]  I am pure law. Right, well, and I agree with you, but it's back to what Michael Baden-Erik
[16:17.440 --> 16:20.600]  and I talked a little bit about on the show last night, Randy, and that is we're going

[21:12.520 --> 21:17.520]  how this can be ruled on. I've read through this memorandum of law about four or five
[21:17.520 --> 21:25.520]  times, and the main issue that still exists is that people can still render their property
[21:25.520 --> 21:32.520]  if they so choose to. There's a presumption that all the property has been rendered for
[21:32.520 --> 21:39.520]  taxation unless it is objected to by the property owner. So, from that perspective, I think
[21:39.520 --> 21:46.520]  this is more of an individual simply exercising his right to object and not have his property
[21:46.520 --> 21:52.520]  subject to taxation and, therefore, not be liable for the tax and giving up that benefit
[21:52.520 --> 21:55.520]  of being able to vote on it. Now, the changes...
[21:55.520 --> 22:01.520]  Excellent. That's what I couldn't figure and couldn't find. That's exactly what we
[22:01.520 --> 22:09.520]  would need to be able to actually get this done since if they can presuppose that everybody
[22:09.520 --> 22:15.520]  who has paid the tax did so voluntarily, then the state's not looking at having to pay it
[22:15.520 --> 22:17.520]  all back.
[22:17.520 --> 22:23.520]  Another key point about that, too, Randy, is that the property needs to be rendered
[22:23.520 --> 22:31.520]  each year. So, if the property was put on a tax roll either by the Voluntary Act of
[22:31.520 --> 22:38.520]  the property owner or by the tax assessor and the homeowner did not object, then they
[22:38.520 --> 22:43.520]  would have no recourse to go back and collect taxes they paid because they never objected
[22:43.520 --> 22:46.520]  to it. They paid it. So, therefore, they acquiesced.
[22:46.520 --> 22:55.520]  Okay, so now the hill we have to overcome is the consideration that all of the taxpayers
[22:55.520 --> 23:03.520]  will, if they render a positive ruling in your favor, then everybody will run down to
[23:03.520 --> 23:09.520]  the tax office to get taken off the rolls.
[23:09.520 --> 23:14.520]  Well, I don't think everybody's going to do that. I think that's the majority of the
[23:14.520 --> 23:19.520]  people are going to think that this is crazy and that they need to pay it or it's their
[23:19.520 --> 23:24.520]  responsibility or duty or whatever. But I don't think you're going to have a flooding.
[23:24.520 --> 23:29.520]  But I think it does open the door for some of the people who decide that they don't want
[23:29.520 --> 23:31.520]  to participate in this.
[23:31.520 --> 23:37.520]  What I'm thinking of is if I'm the judge sitting up there on the bench and I'm looking ahead
[23:37.520 --> 23:43.520]  at my career, which is the less of two evils?
[23:43.520 --> 23:51.520]  Having these guys come after me or render a ruling, that could possibly open the door
[23:51.520 --> 24:00.520]  to a floodgate. Whether it actually would or not, I would be concerned that when the
[24:00.520 --> 24:05.520]  state of Texas goes into bankruptcy and everybody says, how did this happen, they're going to
[24:05.520 --> 24:07.520]  say, he did it.
[24:07.520 --> 24:10.520]  Are you talking about the district, Judge Randy?
[24:10.520 --> 24:13.520]  Yeah, whoever makes the ruling.
[24:13.520 --> 24:19.520]  We're under the impression the district judge is not going to rule in favor of the property
[24:19.520 --> 24:25.520]  owner in this case. He's going to save his own career and send it up to the higher court.
[24:25.520 --> 24:31.520]  So eventually the goal is to get it to the Supreme Court and let them deal with it.
[24:31.520 --> 24:41.520]  Excellent. Can you appeal this past the state Supreme Court?
[24:41.520 --> 24:48.520]  Well, if it comes from a constitutional issue, then I would say yes. Do you agree?
[24:48.520 --> 24:54.520]  Well, this is a state constitutional issue. This is the state assessing a tax against
[24:54.520 --> 24:59.520]  its state citizens. How do we invoke the federal jurisdiction?
[24:59.520 --> 25:04.520]  Because it's also a taking a property without due process of law because a tax that you
[25:04.520 --> 25:10.520]  don't owe is still a taking a property that's yours. That's still a violation of the
[25:10.520 --> 25:14.520]  federal protection of rights in the Constitution.
[25:14.520 --> 25:18.520]  I don't know. That's kind of reaching. How is it reaching?
[25:18.520 --> 25:29.520]  Well, by calling the tax taking a property, do we have case law supporting that?
[25:29.520 --> 25:33.520]  Sure. We've got case law that says money is property, just like labor is property.
[25:33.520 --> 25:39.520]  Labor is not a physical existing thing, but it is property.
[25:39.520 --> 25:45.520]  I would like it that we could do that. That's really where I want to find out how we can
[25:45.520 --> 25:52.520]  get it out of the state into the Fed. I don't know. Even the Fed tends to be more
[25:52.520 --> 26:02.520]  political than the state because the problem we have now is if the Fed rules to interfere
[26:02.520 --> 26:09.520]  with the state's ability to tax its own citizens, I suspect they're going to be real
[26:09.520 --> 26:18.520]  reluctant in view of the Turner Rule to interfere with what they consider to be state business.
[26:18.520 --> 26:24.520]  I don't think Michael and I would limit the rail riding business to Texas if necessary.
[26:24.520 --> 26:29.520]  I think we can grow and expand to make it national.
[26:29.520 --> 26:34.520]  I think the rail riding is a little short-sighted. We should look more to the skinning them
[26:34.520 --> 26:39.520]  and upholstering the chair with the previous judge's hide.
[26:39.520 --> 26:45.520]  I wouldn't go beyond saying that's a good idea or bad idea.
[26:45.520 --> 26:56.520]  They actually used to do that. That's historical, that you're sitting on the hide of a previous corrupt judge.
[26:56.520 --> 26:59.520]  That makes you think twice, huh?
[26:59.520 --> 27:01.520]  I would hope so.
[27:01.520 --> 27:07.520]  The other thing I wanted to mention too about one of the issues being brought up in this case
[27:07.520 --> 27:15.520]  is that supposedly these provisions within the Texas Constitution were changed in 1999
[27:15.520 --> 27:19.520]  as a result of House Joint Resolution No. 62.
[27:19.520 --> 27:25.520]  When you look at the bill analysis of those amendments to the Constitution,
[27:25.520 --> 27:31.520]  the vast majority of those changes were non-substantive or conforming changes.
[27:31.520 --> 27:34.520]  Well, but there's another issue there also, Tim.
[27:34.520 --> 27:41.520]  The legislature cannot administratively or legislatively alter the Constitution.
[27:41.520 --> 27:47.520]  They cannot do that. That's another problem with that bill.
[27:47.520 --> 27:58.520]  It cannot be said that a legislature has the authority to amend the Constitution through a legislative act.
[27:58.520 --> 28:06.520]  If it is not a constitutional amendment put before the public, it is invalid in every sense of the word.
[28:06.520 --> 28:11.520]  Exactly, and that's another point that's being brought up is Article 1, Section 29.
[28:11.520 --> 28:18.520]  But also the fact that this also brings up the vested rights that Eddie, you've been talking about before.
[28:18.520 --> 28:28.520]  Whereas before 1999, the Constitution clearly stated that in order to be a qualified elector to vote in city bond elections,
[28:28.520 --> 28:34.520]  you had to render your property for taxation and then become liable for the tax.
[28:34.520 --> 28:40.520]  And when they made the change under House Joint Resolution 62 as a non-substantive change,
[28:40.520 --> 28:47.520]  they tacked on the temporary transition provisions and said that this does not affect vested rights.
[28:47.520 --> 28:51.520]  Correct, and just like the lawsuit says, it says that over time,
[28:51.520 --> 28:57.520]  those little footnotes tend to disappear into the obscurities of history so that they're lost.
[28:57.520 --> 29:01.520]  And it appears like the Constitution's always said what it says now when it doesn't,
[29:01.520 --> 29:06.520]  so that the meaning of the change itself is lost as well.
[29:06.520 --> 29:11.520]  This is exactly what I keep saying about the 1836 version of the Constitution
[29:11.520 --> 29:16.520]  versus 1876 version of the Constitution and everything in between.
[29:16.520 --> 29:21.520]  Any change to the Constitution does not remove a vested right that already existed.
[29:21.520 --> 29:26.520]  The Constitution itself does not grant rights, does not give rights.
[29:26.520 --> 29:34.520]  It only enumerates particularly protected rights, but it doesn't grant any.
[29:34.520 --> 29:38.520]  And because of that, it doesn't matter what they alter the Constitution to,
[29:38.520 --> 29:43.520]  it does not change the vested rights of the people that created it.

[32:33.520 --> 32:41.520]  would it be possible to go from the angle of the fact that a vested right has been allegedly taken away by their actions,
[32:41.520 --> 32:48.520]  even though the changes to the Constitution say that these changes don't affect vested rights?
[32:48.520 --> 32:51.520]  Yeah, again, we're back in practice.
[32:51.520 --> 32:55.520]  What state's the vested right?
[32:55.520 --> 33:05.520]  Well, the vested right was that the people had a right to decide to render their property for taxation
[33:05.520 --> 33:10.520]  so they could receive the benefit of voting in bond elections.
[33:10.520 --> 33:13.520]  But at the same token, if they have the right to choose to render it,
[33:13.520 --> 33:18.520]  they also have the right to choose not to render it and not have the privilege of voting.
[33:18.520 --> 33:27.520]  Okay, the reason I ask this is we have privileges as opposed to the right.
[33:27.520 --> 33:31.520]  The right is, I think we'd go back to what Eddie said,
[33:31.520 --> 33:38.520]  is the right to be free from the assessment of our property without due process.
[33:38.520 --> 33:51.520]  And being able to decide to render our property for taxation wouldn't go to the right.
[33:51.520 --> 33:57.520]  The right is being protected from unlawful seizure.
[33:57.520 --> 34:02.520]  Well, the right is also in the right to own, acquire, and use our own property.
[34:02.520 --> 34:09.520]  Yeah, that's what I'm going to...the problem we have with the courts is we have to say it just right.
[34:09.520 --> 34:12.520]  We have to pose it just right.
[34:12.520 --> 34:15.520]  I'm real pleased that you're doing this.
[34:15.520 --> 34:22.520]  And frankly, you obviously spent a lot of time working out how to go at this.
[34:22.520 --> 34:27.520]  And I'm probably telling you stuff you've already considered a long time ago.
[34:27.520 --> 34:30.520]  Well, I mean, just so it's clear, it's not me doing it.
[34:30.520 --> 34:32.520]  I'm simply helping the guy who is doing it.
[34:32.520 --> 34:35.520]  So I wanted to make sure he gets due credit for that as well.
[34:35.520 --> 34:37.520]  Yeah.
[34:37.520 --> 34:40.520]  Yeah, I didn't know if anybody wanted names mentioned
[34:40.520 --> 34:43.520]  because I did not know at what stage this suit was at.
[34:43.520 --> 34:46.520]  So I wasn't going into the details of the who yet.
[34:46.520 --> 34:47.520]  Yeah, it's too early.
[34:47.520 --> 34:50.520]  So we want to kind of let things fatter out.
[34:50.520 --> 34:54.520]  Now, there is one particular section on here that I would like to bring up
[34:54.520 --> 34:56.520]  and point something out here.
[34:56.520 --> 35:00.520]  This is item number 23 of the memorandum, and it reads,
[35:00.520 --> 35:04.520]  judicial notice will be taken of Article 1, Section 17 of the Texas Constitution,
[35:04.520 --> 35:09.520]  which reads, no person's property shall be taken, damaged, or destroyed
[35:09.520 --> 35:15.520]  for or applied to public use without adequate compensation being made.
[35:15.520 --> 35:20.520]  Now, this is the analysis that I sent back as one of my comments on that particular item.
[35:20.520 --> 35:25.520]  Here's a point that I think was missed in item 23 of the property tax memorandum.
[35:25.520 --> 35:30.520]  The constitutional provision of applied to public use would also imply that it is
[35:30.520 --> 35:36.520]  unlawful to use private property for the purpose of raising revenue for public use
[35:36.520 --> 35:40.520]  without compensation for and the consent of the owner,
[35:40.520 --> 35:45.520]  which is exactly what these taxation items are.
[35:45.520 --> 35:49.520]  If they cannot take the property for private use without compensation,
[35:49.520 --> 35:53.520]  then they cannot lease the property for the purpose of generating public revenue
[35:53.520 --> 35:57.520]  without the owner's consent either.
[35:57.520 --> 35:59.520]  All right.
[35:59.520 --> 36:03.520]  If they could do either of those things, then it would mean they could immediately
[36:03.520 --> 36:07.520]  perform an end run around the Constitution and seize the property
[36:07.520 --> 36:12.520]  or evict the occupant because of nonpayment of this alleged tax.
[36:12.520 --> 36:16.520]  Even though it says you can't take the property without just compensation,
[36:16.520 --> 36:22.520]  oh, well, the fact that you're not paying us means that we can take it without compensation.
[36:22.520 --> 36:27.520]  Now, that's kind of a completely backwards way of looking at things in my book.
[36:27.520 --> 36:29.520]  Right.
[36:29.520 --> 36:34.520]  So that was one of the things I sent back that if they can't take it in that regard
[36:34.520 --> 36:38.520]  or they can't use it according to the Constitution for the public use
[36:38.520 --> 36:47.520]  without just compensation, that means they can't use it to generate revenue either.
[36:47.520 --> 36:50.520]  Would you agree with that, Randy?
[36:50.520 --> 36:52.520]  I want to go ahead and get off and open up the lines,
[36:52.520 --> 36:57.520]  but I just wanted to once again ask Randy and Eddie if you ever get a chance to spend some time
[36:57.520 --> 36:59.520]  in the evenings or something.

[37:41.520 --> 37:53.520]  Right now, I'm not really comfortable with the argument that taxing the property is seizure.
[37:53.520 --> 38:02.520]  I understand the logical process, but I'd like to see some law supporting that position.

[38:06.520 --> 38:14.520]  Well, the only real issue I've got with the thing you're talking about about having the context is this.
[38:14.520 --> 38:18.520]  The Constitution says here's the powers you have.
[38:18.520 --> 38:24.520]  Now, it doesn't say anything as far as numerating the powers they don't have.
[38:24.520 --> 38:27.520]  It says here's what you can do.
[38:27.520 --> 38:34.520]  Now, when you are exercising a power and authority outside of that granted for what you can do,
[38:34.520 --> 38:39.520]  there's not going to be any law or statute saying, no, don't do that over there.
[38:39.520 --> 38:44.520]  There is only law that says this is what you're allowed to do.
[38:44.520 --> 38:50.520]  So by difference, if you are doing something you're not allowed to do,
[38:50.520 --> 38:56.520]  then what you're doing doesn't exist as a lawful authority and power.
[38:56.520 --> 38:59.520]  That's my argument against wanting to see law on it.
[38:59.520 --> 39:04.520]  It isn't law because the law just simply says this is what we told you you can do.
[39:04.520 --> 39:11.520]  Therefore, automatically anything outside of that you cannot do.
[39:11.520 --> 39:20.520]  Okay, yeah, and that goes to my position on the sovereign issue that as the sovereign,
[39:20.520 --> 39:28.520]  as the sovereign or the citizen, I can do anything I'm not specifically forbidden to do.
[39:28.520 --> 39:33.520]  And the official may only do that which he is specifically authorized to do.
[39:33.520 --> 39:34.520]  Right.
[39:34.520 --> 39:37.520]  So I like the argument.
[39:37.520 --> 39:44.520]  I'd like to get it structured clearly in law.
[39:44.520 --> 39:46.520]  Well, it's going to be interesting.
[39:46.520 --> 39:52.520]  It's going to be interesting to work in this case because I think it's time for this.
[39:52.520 --> 40:01.520]  We're looking at the country going into a major crisis where more and more people
[40:01.520 --> 40:09.520]  simply don't have the funds and are looking at losing their property because they don't have the funds.
[40:09.520 --> 40:13.520]  Which brings me to something I'd like to read to you.
[40:13.520 --> 40:20.520]  A little excerpt from J.P. Morgan circa 1913.
[40:20.520 --> 40:27.520]  Debts must be collected and loans and mortgage foreclosed as soon as possible.
[40:27.520 --> 40:32.520]  When, through a process of law, the common people have lost their homes,
[40:32.520 --> 40:37.520]  they will be more tractable and more easily governed by the strong arm of the law
[40:37.520 --> 40:42.520]  applied by the central power of leading financiers.
[40:42.520 --> 40:45.520]  People without homes will not quarrel with their leaders.
[40:45.520 --> 40:53.520]  This is well known among our principal men now engaged in forming an imperialism of capitalism to govern the world.
[40:53.520 --> 41:01.520]  By dividing the people, we can get them to expend their energies in fighting over questions of no importance to us
[41:01.520 --> 41:06.520]  except as teachers of the common herd.
[41:06.520 --> 41:18.520]  I think if anytime in history this particular approach was appropriate, it is appropriate now.
[41:18.520 --> 41:26.520]  But the crisis that we have with so many losing their properties in this economic downturn
[41:26.520 --> 41:33.520]  and those of us who are aware of the underlying forces,
[41:33.520 --> 41:40.520]  J.P. Morgan certainly speaks to those underlying forces and what their agenda is.
[41:40.520 --> 41:49.520]  When I talk about the foreclosure issues, I maintain that the lenders are deliberately
[41:49.520 --> 41:56.520]  or have been deliberately creating loans that they intended to foreclose on
[41:56.520 --> 42:00.520]  so that they could strip the individual of their equity,
[42:00.520 --> 42:05.520]  strip the backbone of this nation of their equity in the country,
[42:05.520 --> 42:09.520]  and render them free slaves on the land.
[42:09.520 --> 42:21.520]  They get to speak in terms of freedom and sovereignty, but in reality they're slaves to the landowner.
[42:21.520 --> 42:25.520]  Sounds about right.
[42:25.520 --> 42:30.520]  This is part of it, the property taxes.
[42:30.520 --> 42:35.520]  I've got an issue now with the Homeowners Association.
[42:35.520 --> 42:44.520]  They have a minor lien against a major property, and they foreclose on and sell the property for chump change.
[42:44.520 --> 42:53.520]  In Florida, the Homeowners Association is becoming a really big scam that they're using to strip people of their property.
[42:53.520 --> 43:04.520]  It seems that those in places of real power behind the figureheads and functionaries
[43:04.520 --> 43:13.520]  do literally intend to strip this nation of its equity and render us all slaves.
[43:13.520 --> 43:16.520]  We've got to do something about that.
[43:16.520 --> 43:18.520]  You've got to do something, Eddie.
[43:18.520 --> 43:20.520]  Yeah, I know.
[43:20.520 --> 43:22.520]  Fix it.
[43:22.520 --> 43:27.520]  Well, believe me, they would not like the way that I would go about fixing it, I promise you.
[43:27.520 --> 43:34.520]  Well, there's a lot of us working on it, and with the foreclosure issue is just one approach.
[43:34.520 --> 43:41.520]  And the tax issue would be another very powerful approach if we can get it implemented.

[47:10.520 --> 47:16.520]  We're beginning to get a lot of rulings from the courts in our favor.
[47:16.520 --> 47:26.520]  I just got a number of emails and Steve Fritz in Utah went to a hearing on this issue
[47:26.520 --> 47:34.520]  where the courts in Utah told Bank of America to hit the road jack.
[47:34.520 --> 47:39.520]  You have not filed to do business in the state of Utah.
[47:39.520 --> 47:43.520]  Until you have, you cannot come into our courts.
[47:43.520 --> 47:53.520]  I got a number of cases because the bank had claimed that under a federal banking act
[47:53.520 --> 47:57.520]  that they could do business in any state.
[47:57.520 --> 48:05.520]  And what the states are saying is, well, while the feds will allow you to do business in any state,
[48:05.520 --> 48:10.520]  the feds have no power to dictate to the states.
[48:10.520 --> 48:15.520]  So in order to do business in the states, the attorney generals are saying,
[48:15.520 --> 48:18.520]  you have to register in my state.
[48:18.520 --> 48:22.520]  Now you have to consider the history.
[48:22.520 --> 48:25.520]  Up until this point, nobody cared.
[48:25.520 --> 48:27.520]  Nobody said a word.
[48:27.520 --> 48:32.520]  And now all of a sudden the attorney generals are taking them on.
[48:32.520 --> 48:36.520]  That's because they can hear the toilet flushing.
[48:36.520 --> 48:41.520]  And they need to do something to get the voters back on their side.
[48:41.520 --> 48:45.520]  They're throwing the lenders to the wolves.
[48:45.520 --> 48:48.520]  And we're the wolves.
[48:48.520 --> 48:57.520]  This is exactly what we need to help keep the equity of this nation in the hands of the people.
[48:57.520 --> 49:00.520]  The last thing we want to happen is to have all this equity
[49:00.520 --> 49:12.520]  in the hands of folks like JP Morgan, who would then render us little more than serfs, beholden to the landowner.
[49:12.520 --> 49:15.520]  So I see good things happening.
[49:15.520 --> 49:19.520]  And there's some other approaches we're working out to take them on.
[49:19.520 --> 49:30.520]  I'm getting close to the point that I can start getting people to help research out some issues.
[49:30.520 --> 49:35.520]  Trafficking in illegal securities.
[49:35.520 --> 49:43.520]  The lenders are required each time the security instrument is sold.
[49:43.520 --> 49:50.520]  It is intended by the Securities and Exchange Commission that the sale of securities be public.
[49:50.520 --> 49:59.520]  And they are required to register the sale of the security instrument with the clerk of the county in which the property lies.
[49:59.520 --> 50:08.520]  And that's to be filed into the public record so it is available for anyone who cares to go check.
[50:08.520 --> 50:21.520]  So we have all these people filing QWRs and letters with the lender asking who is the holder of the security instrument.
[50:21.520 --> 50:30.520]  That should never have to happen because the holder of the security instrument should be filed with the clerk of the court.
[50:30.520 --> 50:39.520]  And the courts are beginning to rule in the favor of the lender when the security instrument isn't properly registered.
[50:39.520 --> 50:47.520]  And I'm trying to get time free or get some other researchers to help research this issue out.

[51:07.520 --> 51:26.520]  And then we can go to the lenders and the subsequent servicers and name them as co-conspirators with the holder of the security instrument in the criminal act of trading in illegal securities.

[51:30.520 --> 51:45.520]  And another associated issue is I'm preparing a challenge in the suit itself wherein we make a qui tam claim against the lender,
[51:45.520 --> 52:03.520]  accusing the lender of failing to make the proper filing of the sale of the security instrument with the clerk of the court and suing them for the amount that they deprived the state of.
[52:03.520 --> 52:09.520]  And if we win that, we'll get 25% of that $35.
[52:09.520 --> 52:28.520]  But we're only naming, unlike the guy in Tennessee who sued under qui tam, every lender in the state of Tennessee that does business with MERS and named as co-plaintiffs every county in the state of Tennessee.
[52:28.520 --> 52:40.520]  And he claims some $235 million in funds that were denied, that were defrauded, they defrauded the clerks of the court of.
[52:40.520 --> 52:49.520]  They should have filed these sales with the clerk of the court and paid the $35 or $25, whatever it is in the particular county or state.
[52:49.520 --> 53:05.520]  And he's suing to recover those funds being a qui tam suit if the state does not step in and take over the prosecution and he wins, he gets 25% of what he recovers.
[53:05.520 --> 53:09.520]  If the state does step in, then he gets 10%.
[53:09.520 --> 53:19.520]  In this case, we're moving to bring the lender to a position to where he's forced to make a deal.
[53:19.520 --> 53:26.520]  So we're just suing for the one county, the one filing.
[53:26.520 --> 53:31.520]  But a sharp attorney will take that as fair warning.
[53:31.520 --> 53:47.520]  He'll take the deal or we amend the suit naming every loan that you have in the state under a qui tam and ask you to pay all of those all at once.

[55:49.520 --> 55:55.520]  that the one that they take under the state is good enough to cover the statute listed in the federal.

[55:59.520 --> 56:04.520]  So there's not necessarily a statute that has to say that because the Constitution says it's mandatory.

[56:09.520 --> 56:13.520]  Well, it would seem to me like they would have to file it the same place all the other federal
[56:13.520 --> 56:20.520]  oaths are required to be filed, most likely with the secretary of state, meaning the federal,
[56:20.520 --> 56:26.520]  because they're the ones responsible for maintaining that information at the federal level
[56:26.520 --> 56:32.520]  unless there's a statute that requires them to set it up as different branches governing the oaths.
[56:32.520 --> 56:36.520]  But I don't see them being quite that disjointed with it.
[56:36.520 --> 56:41.520]  How would they recognize the distinction, though, the distinction between the two oaths?
[56:41.520 --> 56:46.520]  Because the issue that I'm having is the one in Michigan, the oath that they take,
[56:46.520 --> 56:50.520]  is very similar to the federal oath except they throw in, you know,
[56:50.520 --> 56:55.520]  we pledge allegiance to the Constitution of Michigan.
[56:55.520 --> 57:01.520]  So I'm having difficulty understanding, you know, how they would recognize the distinction
[57:01.520 --> 57:08.520]  or how you get the court to recognize that there would be a distinction between the two oaths.
[57:08.520 --> 57:13.520]  Well, you get the court to recognize the distinction by showing that the federal Constitution requires
[57:13.520 --> 57:21.520]  one oath and that the state Constitution requires another oath.
[57:21.520 --> 57:26.520]  There are two separate documents, so they can't be said to include the same oath
[57:26.520 --> 57:31.520]  because the federal Constitution does not dictate an oath within the states and vice versa.
[57:31.520 --> 57:37.520]  So the court would have no choice but to look at them as meaning separate oaths.
[57:37.520 --> 57:44.520]  This sounds like you might be able to invoke the House on Un-American Activities,
[57:44.520 --> 57:47.520]  currently called Homeland Security.

[57:52.520 --> 57:57.520]  that have not sworn allegiance to the United States Constitution.

[01:35:35.520 --> 01:35:39.520]  It was just a DUI that happened quite a while back.
[01:35:39.520 --> 01:35:42.520]  And anyways, I've been just doing what,
[01:35:42.520 --> 01:35:46.520]  been filing criminal complaints and doing all kinds of pleadings and stuff,
[01:35:46.520 --> 01:35:51.520]  but this guy came up to me, and I was talking to him.
[01:35:51.520 --> 01:35:52.520]  He's like, what's your name?
[01:35:52.520 --> 01:35:54.520]  And I told him my name, and he goes, oh, I've heard all about you.
[01:35:54.520 --> 01:35:59.520]  Well, it turns out this guy was building a house for the judge.
[01:35:59.520 --> 01:36:02.520]  So I was like, oh, that's another judicial complaint.
[01:36:02.520 --> 01:36:05.520]  And he all backtracked and was like, no, they didn't say nothing.
[01:36:05.520 --> 01:36:06.520]  And I said, sorry, too late.
[01:36:06.520 --> 01:36:08.520]  You've already spilled the beans.
[01:36:08.520 --> 01:36:10.520]  And anyways, that kind of just blew over.
[01:36:10.520 --> 01:36:14.520]  And then he came over to me a little bit later, and he came up to me and he says,
[01:36:14.520 --> 01:36:19.520]  he goes, you must know what you're doing because you have them all screwed up.
[01:36:19.520 --> 01:36:21.520]  He says, they don't know what to do with you.
[01:36:21.520 --> 01:36:24.520]  And I thought that was kind of funny.
[01:36:24.520 --> 01:36:27.520]  He's a contractor that's building a house for the judge.
[01:36:27.520 --> 01:36:30.520]  So why do you even talk to him?
[01:36:30.520 --> 01:36:32.520]  Well, it was just a friendly thing.
[01:36:32.520 --> 01:36:38.520]  We were at the restaurant, and I was talking to one of his friends,
[01:36:38.520 --> 01:36:42.520]  and he was just kind of in the mix of the mingle.
[01:36:42.520 --> 01:36:50.520]  But anyways, my question was, I filed an affidavit of prejudice
[01:36:50.520 --> 01:36:55.520]  and in Montana I found some Supreme Court cases
[01:36:55.520 --> 01:37:00.520]  where a judge loses all jurisdiction by an affidavit of prejudice.
[01:37:00.520 --> 01:37:04.520]  And she still hasn't decided to step off of the case.
[01:37:04.520 --> 01:37:07.520]  And it's been, oh, about a month or so ago since I've done that.
[01:37:07.520 --> 01:37:15.520]  Have you filed any documents, motions for the judge to either recuse him or herself
[01:37:15.520 --> 01:37:21.520]  or filing any motions to have the judge disqualified?
[01:37:21.520 --> 01:37:26.520]  Yeah, I did an affidavit of prejudice with a motion to disqualify.
[01:37:26.520 --> 01:37:29.520]  And they just kind of took it, and I brought it up in court,
[01:37:29.520 --> 01:37:32.520]  and I showed them the law, brought out the book of the statute.
[01:37:32.520 --> 01:37:35.520]  I was like, here it is, and then blah, blah, blah.
[01:37:35.520 --> 01:37:38.520]  Well, the judge just keeps making rulings and orders.
[01:37:38.520 --> 01:37:44.520]  Was there a motion hearing on that particular motion to disqualify?
[01:37:44.520 --> 01:37:46.520]  Well, I did it at a pretrial.
[01:37:46.520 --> 01:37:50.520]  Yeah, we talked about it, but she said, well, I'll get back to you on that.
[01:37:50.520 --> 01:37:55.520]  Did the judge rule on her own motion to disqualify?
[01:37:55.520 --> 01:37:57.520]  No, they can't.
[01:37:57.520 --> 01:38:01.520]  Well, was there a ruling on the motion to disqualify?
[01:38:01.520 --> 01:38:08.520]  This was March or May 15th, no, May 2nd.
[01:38:08.520 --> 01:38:12.520]  And she said, I'll get back to you in five days on that motion.
[01:38:12.520 --> 01:38:14.520]  Answer Randy's question.
[01:38:14.520 --> 01:38:17.520]  Was there a ruling on the motion to disqualify?

[01:38:42.520 --> 01:38:44.520]  the jurisdiction and the premise is taken away.
[01:38:44.520 --> 01:38:45.520]  Wait, wait, wait, wait.
[01:38:45.520 --> 01:38:47.520]  Hold on, hold on, hold on, hold on, hold on.

[01:39:39.520 --> 01:39:45.520]  because they know the bailiff is there to keep peace in the courtroom
[01:39:45.520 --> 01:39:48.520]  and it makes no difference who breaches it.
[01:39:48.520 --> 01:39:50.520]  Okay, Randy, let me ask you a question.
[01:39:50.520 --> 01:39:56.520]  In a situation like what Stephen is describing where there's statute in place,
[01:39:56.520 --> 01:40:00.520]  the judge blatantly violates the statute,
[01:40:00.520 --> 01:40:05.520]  let's just say, for example, Stephen asked the bailiff to arrest the judge.
