[25:22.720 --> 25:29.720] back a check for the difference, and both accounts got closed, but the second account
[25:29.720 --> 25:34.200] didn't pay off, so I kept calling and keeping up with it.
[25:34.200 --> 25:38.920] I was told all sorts of things, and the collection agency at one point told me, or the collections

[25:50.920 --> 25:55.040] about that dispute, so we're going to put that amount back on your account.

[27:17.500 --> 27:24.440] I would be monitoring that very, very closely because the electronic system, once they show
[27:24.440 --> 27:29.440] a balance and they enter that into the computer system, that electronic system updates the
[27:29.440 --> 27:35.600] credit report and that could probably be one of the best things that could happen to you
[27:35.600 --> 27:42.240] because you've got this other fact on the side over here that says you've either paid
[27:42.240 --> 27:48.160] it or attempted to pay it, it's been settled or whatever, and now they go back into the
[27:48.160 --> 27:51.680] credit report and you dispute it with them and you bring them in under fair credit in
[27:51.680 --> 27:53.280] federal court.
[27:53.280 --> 27:58.160] They're reporting erroneous and inaccurate information, you dispute it, they fail to
[27:58.160 --> 28:04.560] mark the account in dispute, $6,000 across the three bureaus times every month they do
[28:04.560 --> 28:06.520] it and hit them from another angle.
[28:06.520 --> 28:16.160] Yeah, I'm going to start paying more closely attention to these accounts and keeping track
[28:16.160 --> 28:21.880] of every detail because it sounds like it could be a nice big paycheck in the end.

[28:27.140 --> 28:32.240] course where you can go pull your credit report, annual credit report, once a year free, doesn't

[29:01.760 --> 29:03.400] you can go in and pull your credit report.
[29:03.400 --> 29:09.000] If you're going to do this stuff, it's imperative that you have a service like that so you can
[29:09.000 --> 29:13.720] see what's going on in your credit report and then also if you go into federal court
[29:13.720 --> 29:19.400] having the PACER set up so you can actually see the lawyers will pull fast ones on you

[29:21.160 --> 29:27.360] What they'll do is they can upload immediately documents to the court, you can't unless you
[29:27.360 --> 29:31.400] get permission from the judge which is kind of difficult but sometimes they will, sometimes

[29:32.400 --> 29:36.400] But what they'll do is for instance let's say they put a motion in and they're supposed
[29:36.400 --> 29:42.200] to mail it to you and I hear the music coming up.

[29:48.880 --> 29:52.600] you out of time to respond so you've got to be on PACER and check your case every day.

[34:42.520 --> 34:50.360] and the clerks will try to pull sheisterisms too and they'll render rulings or orders and

[34:52.000 --> 34:58.000] That's what I'm dealing with right now regarding a friend that I'm helping with a federal case.
[34:58.000 --> 35:06.520] And the judge, the federal magistrate judge issued an order and the clerk did not serve
[35:06.520 --> 35:11.840] my friend and the only way we knew about it was because I was checking on his case on
[35:11.840 --> 35:17.600] PACER every single day to make sure something like that didn't happen and it was basically
[35:17.600 --> 35:20.680] just stupidness.
[35:20.680 --> 35:28.880] The judge wanted him to basically construct this elaborate certificate of service that
[35:28.880 --> 35:34.480] is just beyond the call of duty like craziness while they're, meanwhile while they're letting
[35:34.480 --> 35:40.760] the opposing side, the U.S. attorney, you know, just give these flimsy certificates
[35:40.760 --> 35:41.760] of service.
[35:41.760 --> 35:47.560] Oh but he has to have this exorbitantly elaborate certificate of service and the judge's order
[35:47.560 --> 35:51.960] was that if he didn't have it in by a certain date, the judge was going to throw his case
[35:51.960 --> 35:58.880] out and then he never got served with the order and so it looked to me like the judge
[35:58.880 --> 36:06.640] was colluding with the U.S. attorney here to try to shut down his lawsuit and since
[36:06.640 --> 36:14.720] I saw it on PACER, we sent in this certificate of service and then it turned up on PACER
[36:14.720 --> 36:21.080] a few weeks later that the clerk made a note that she made a second mailing.
[36:21.080 --> 36:25.920] Yeah right, she never made the first one.
[36:25.920 --> 36:32.920] Did you get that notice I sent you the other day about the signatures in PACER?
[36:32.920 --> 36:35.200] I saw it but I haven't had a chance to go over it yet.
[36:35.200 --> 36:42.280] You might find that very interesting and not to get real off topic on this but there's
[36:42.280 --> 36:51.000] a Ph.D. out in California who's doing an investigation on this and he was looking for help.
[36:51.000 --> 36:59.840] Electronic signatures are an issue on PACER documents, the judges, the notary stamps are
[36:59.840 --> 37:07.540] not showing up and according to the rules, they must be visible and they're not.
[37:07.540 --> 37:11.880] So I sent that out to everybody I knew who was involved in federal court stuff because
[37:11.880 --> 37:17.440] you may have gotten a judgment in the past or something and if this becomes a major issue,
[37:17.440 --> 37:22.440] any judgment that was granted against you could be void because it wasn't properly
[37:22.440 --> 37:23.440] signature.

[37:24.440 --> 37:30.840] They're doing electronic filings and according to the rules, or excuse me, electronic signatures
[37:30.840 --> 37:35.120] and according to the rules, it's supposed to be a visible signature.

[37:40.840 --> 37:42.320] name on it, everybody can see it.

[38:43.400 --> 38:50.560] And the first thing you must do and see people, and I don't want to say naive, but they feel
[38:50.560 --> 38:53.880] they're in the court system and everything must be true.
[38:53.880 --> 38:57.800] An affidavit of debt should be questioned thoroughly.
[38:57.800 --> 39:02.360] Number one, the name of the person who's making the affidavit, does that person really work
[39:02.360 --> 39:06.420] for that company or is it the lawyer's secretary?

[51:21.400 --> 51:26.400] My question is, I'm hearing down here, you know, as things tighten up a little bit,
[51:26.400 --> 51:31.400] I've got another vehicle financed with a company.
[51:31.400 --> 51:33.400] And I just got a letter of demand today.
[51:33.400 --> 51:40.400] And I'm wondering if anybody there knows how I may be able to preempt this first letter of demand.
[51:40.400 --> 51:48.400] They've not got an attorney involved yet on a collection, but they are demanding the note.
[51:48.400 --> 51:52.400] And so I'm wondering if I can file something to keep them out of a local court
[51:52.400 --> 51:58.400] so I can keep this from going into a judgment case in a local court
[51:58.400 --> 52:03.400] and get them into the federal court.
[52:03.400 --> 52:05.400] The lawyer, let me just get some clarity with you.
[52:05.400 --> 52:08.400] The lawyer is working for the creditor?
[52:08.400 --> 52:13.400] The lawyer hasn't got an attorney after me yet.

[52:31.400 --> 52:37.400] could be another 90 days or six months out before they turn this over to a debt collector.
[52:37.400 --> 52:41.400] What I would do in the interim, I would just use the, you've got both courses,
[52:41.400 --> 52:47.400] I'd go to that second course, how to get the creditors out of your credit report
[52:47.400 --> 52:52.400] and just follow the instructions in there and challenge them, you know, see what they do.
[52:52.400 --> 52:57.400] And when they don't do it, build that case right up, man, and go bury them.
[52:57.400 --> 53:01.400] Take them into federal court under fair credit violations.
[53:01.400 --> 53:05.400] And, you know, just, you know, maybe they'll have a change of heart.
[53:05.400 --> 53:07.400] Or maybe you can cut a deal.
[53:07.400 --> 53:11.400] I'll go away if you go away.
[53:11.400 --> 53:12.400] Right.

[53:31.400 --> 53:36.400] Depending on how backed up they are and how busy they are, it might take them another couple of months.
[53:36.400 --> 53:42.400] You might be looking six months down the road before anything happens on this thing.
[53:42.400 --> 53:43.400] Okay.
[53:43.400 --> 53:48.400] And what I would do if I was you, I'd go build my case.
[53:48.400 --> 53:54.400] You know, the waiting game, you know, every month you can wait to rack them violations up.
[53:54.400 --> 53:57.400] I'd just sit there and rack up the violations.
[53:57.400 --> 54:03.400] And the first time they sent you notice of a complaint or something,
[54:03.400 --> 54:08.400] or the debt collector sends you a notice, I'd nail the debt collector,
[54:08.400 --> 54:11.400] take all the violations against the creditor,
[54:11.400 --> 54:17.400] and go file against the debt collector and the creditor as the co-defendant.

[54:18.400 --> 54:23.400] You'll get their attention then, I can assure you.

[55:26.400 --> 55:29.400] You think you're the first one who's done this?
[55:29.400 --> 55:31.400] You will be shocked.
[55:31.400 --> 55:35.400] Walproff and Abramson, one of the biggest debt collectors,
[55:35.400 --> 55:38.400] they used to run the national arbitration form,
[55:38.400 --> 55:44.400] got shut down by the attorney general of the state of Minnesota for fraud.
[55:44.400 --> 55:49.400] You go in there and query Walproff and Abramson,
[55:49.400 --> 55:55.400] like over 3,500 times these guys have been sued for violations of debt collection.
[55:55.400 --> 55:57.400] Yeah, and for them to get shut down in Minnesota,
[55:57.400 --> 56:04.400] that's really saying something because that's like one of the most corrupt court systems in the country.
[56:04.400 --> 56:08.400] Well, they just wouldn't pay in the judges their 150 bucks a month.
[56:08.400 --> 56:09.400] There you go.
[56:09.400 --> 56:10.400] There you go.
[56:10.400 --> 56:15.400] But, you know, the national arbitration form, that's where everybody went with that.
[56:15.400 --> 56:19.400] They started that around 98 where they made it mandatory.
[56:19.400 --> 56:20.400] You couldn't sue us.
[56:20.400 --> 56:21.400] You've got to go to arbitration.
[56:21.400 --> 56:24.400] And they were getting all these default judgments,
[56:24.400 --> 56:27.400] and they were supposed to be an independent agency,
[56:27.400 --> 56:30.400] and it turned out that Walproff and Abramson owned them.
[56:30.400 --> 56:32.400] They're a debt collector, for Pete's sake.
[56:32.400 --> 56:34.400] How can you be independent?
[56:34.400 --> 56:36.400] My God.
[56:36.400 --> 56:39.400] So, I mean, this stuff goes on and on and on.
[56:39.400 --> 56:45.400] I don't have a bit of bad feelings about what I do, what I teach people.
[56:45.400 --> 56:49.400] I just enjoy seeing people standing up and fighting for their rights
[56:49.400 --> 56:53.400] and maybe getting some justice in their house for a change.
[56:53.400 --> 56:56.400] Besides, it's the bankers that's causing all the problems anyway.
[56:56.400 --> 57:01.400] It can run in the government, so this is our chance to, you know, take a shot at them.

[57:36.400 --> 57:41.400] But the downside to that is, is yes, they will clean your credit report.
[57:41.400 --> 57:45.400] In fact, two out of the three credit bureaus will not even go into the court.
[57:45.400 --> 57:50.400] They will settle with you prior to going into that court.
[57:50.400 --> 57:56.400] But the problem is, is once you get it all cleaned out of your credit report,
[57:56.400 --> 57:58.400] you're going to have perfect credit score.
[57:58.400 --> 58:01.400] You're going to have a perfect credit report.
[58:01.400 --> 58:04.400] But if you've got creditors in there that are chasing you,
[58:04.400 --> 58:07.400] you're going to lose your right to the violations they commit.
[58:07.400 --> 58:08.400] Yeah.
[58:08.400 --> 58:12.400] So you've got to stop the creditors and the debt collectors from chasing you.
[58:12.400 --> 58:14.400] You've got to settle those accounts out first,
[58:14.400 --> 58:17.400] and then get it removed from your credit report.

[01:20:15.400 --> 01:20:22.400] You know, I hated to email you, but it was like the question was when I did it, you know, paid for it,
[01:20:22.400 --> 01:20:26.400] me being on disability, I was only getting part one at the time.
[01:20:26.400 --> 01:20:28.400] I wanted to do this one step at a time.
[01:20:28.400 --> 01:20:31.400] I'm in first grade here, but I want to graduate early, if you know what I mean.
[01:20:31.400 --> 01:20:33.400] Oh, yeah.
[01:20:33.400 --> 01:20:36.400] So you emailed me back and said don't worry about the one and the two.
[01:20:36.400 --> 01:20:40.400] That's my numbers. Don't worry about it. You know, you just got part one.
[01:20:40.400 --> 01:20:41.400] That's right. That's right.
[01:20:41.400 --> 01:20:44.400] As soon as I get through this, I can't wait for part two.
[01:20:44.400 --> 01:20:46.400] But my question, I had a quick question.
[01:20:46.400 --> 01:20:51.400] The credit card company, the major one that's hassling me the most
[01:20:51.400 --> 01:20:56.400] and has been for the last two years basically got information, public information,
[01:20:56.400 --> 01:21:01.400] when I received my disability in 08 about a credit card that had been closed for years,
[01:21:01.400 --> 01:21:04.400] and they're one of the bottom feeders that went and dug this up
[01:21:04.400 --> 01:21:07.400] and have taken me to court here in the local court.
[01:21:07.400 --> 01:21:11.400] And that's why I said I wished I had your program years ago.
[01:21:11.400 --> 01:21:16.400] But anyway, they drugged me into court like nine months ago, and I played stupid.
[01:21:16.400 --> 01:21:19.400] I told them I didn't know anything. I was on disability.
[01:21:19.400 --> 01:21:22.400] I don't have any money. You know, I don't know what you guys want.
[01:21:22.400 --> 01:21:25.400] You know, when I got my disability, I paid off all my debtors.
[01:21:25.400 --> 01:21:28.400] The ones that were working with me got a little bit of money.
[01:21:28.400 --> 01:21:30.400] The ones that were inviting me didn't get none.
[01:21:30.400 --> 01:21:32.400] You know, and I said this debt's been wrote off.
[01:21:32.400 --> 01:21:35.400] You guys returned checks back in 07, you know.
[01:21:35.400 --> 01:21:39.400] And so anyway, they took me to court,
[01:21:39.400 --> 01:21:43.400] and the judge asked me if I wanted a judgment or if I wanted to go to trial.
[01:21:43.400 --> 01:21:45.400] And I told him I have no idea.
[01:21:45.400 --> 01:21:47.400] I'm not a lawyer. I'm not versed in this.
[01:21:47.400 --> 01:21:51.400] You know, here I am. You know, I have nothing.
[01:21:51.400 --> 01:21:53.400] What do these guys want, you know?
[01:21:53.400 --> 01:21:55.400] I tried to pay them some money, and I said, you know,
[01:21:55.400 --> 01:21:59.400] they're demanding 300 bucks a month, you know, get reasonable or whatever.
[01:21:59.400 --> 01:22:03.400] So the judge told me, he says, well, go back and think about it for a minute,
[01:22:03.400 --> 01:22:06.400] and I'll call you back up to the podium in a minute, you know.
[01:22:06.400 --> 01:22:10.400] So I went and sat down, and bailiff come got me, brought me back up there,
[01:22:10.400 --> 01:22:12.400] and the judge says, okay, what do you want?
[01:22:12.400 --> 01:22:14.400] Do you want a judgment or do you want to go to trial?
[01:22:14.400 --> 01:22:17.400] And I says, well, I says, I'll be honest with you.
[01:22:17.400 --> 01:22:20.400] Just like I told you a minute ago, I says, I don't know.
[01:22:20.400 --> 01:22:21.400] I says, this is your ball game.
[01:22:21.400 --> 01:22:23.400] I said, you know, I'm just standing here.
[01:22:23.400 --> 01:22:25.400] I'm playing stupid. I don't know nothing.
[01:22:25.400 --> 01:22:27.400] He says, let me help you.
[01:22:27.400 --> 01:22:29.400] I says, okay, well, go ahead and help me.
[01:22:29.400 --> 01:22:31.400] He says, tell me you want to go to trial.
[01:22:31.400 --> 01:22:34.400] I says, okay, I want to go to trial, and he says, good answer.
[01:22:34.400 --> 01:22:37.400] You know, and he says, now just cooperate with these guys.
[01:22:37.400 --> 01:22:38.400] Do whatever they tell you to do.
[01:22:38.400 --> 01:22:40.400] And he says, chances are, you know,
[01:22:40.400 --> 01:22:44.400] they're going to decide that it's not worth going after all, putting up all this money
[01:22:44.400 --> 01:22:48.400] and wasting all this time and effort for such a small debt, you know.
[01:22:48.400 --> 01:22:53.400] So nothing ever happened for like nine months, you know, all going on a year.
[01:22:53.400 --> 01:22:59.400] And then I got a letter from the court stating that the court is going to file a motion
[01:22:59.400 --> 01:23:03.400] and dismiss the case for lack of prosecution on its own period.
[01:23:03.400 --> 01:23:07.400] They had 30 days to respond, and they were going to dismiss it.
[01:23:07.400 --> 01:23:09.400] Well, they sent me a copy of the same letter.
[01:23:09.400 --> 01:23:12.400] And so I waited for that day, and I showed up in court,
[01:23:12.400 --> 01:23:16.400] and I had my financial report with me if they wanted to look at it,
[01:23:16.400 --> 01:23:20.400] and so that I could sit there and say, here I am again, dude.
[01:23:20.400 --> 01:23:21.400] You know, what do you want?
[01:23:21.400 --> 01:23:24.400] You tell me where the money is at, and I'll help you dig it up,
[01:23:24.400 --> 01:23:27.400] but I don't have any money, and, you know, this debt was already wrote off.
[01:23:27.400 --> 01:23:31.400] You know, show me a contract I have with you, et cetera.
[01:23:31.400 --> 01:23:33.400] So anyway, I'm sitting there, and, you know,
[01:23:33.400 --> 01:23:35.400] I've learned enough to know what to do in court,
[01:23:35.400 --> 01:23:39.400] and I sat there and I waited for him, and the lady attorney for Capital One
[01:23:39.400 --> 01:23:44.400] went to the stand and sat there and talked to the judge about eight cases,
[01:23:44.400 --> 01:23:46.400] and all she did was ask for extensions.
[01:23:46.400 --> 01:23:49.400] And while she was doing this, she was quoting case numbers,
[01:23:49.400 --> 01:23:53.400] and, you know, she accidentally overstated and said,
[01:23:53.400 --> 01:23:57.400] I'm sorry, sir, I had that one confused with another case for Terry Muzzy.
[01:23:57.400 --> 01:24:02.400] He says, but he says, we'll go back to that.
[01:24:02.400 --> 01:24:05.400] And the judge says, he says, yes, he says,
[01:24:05.400 --> 01:24:09.400] I told you that you requested 60 days, and I changed it to 30.
[01:24:09.400 --> 01:24:11.400] And she goes, oh, okay.
[01:24:11.400 --> 01:24:13.400] So she went through four or five more cases,
[01:24:13.400 --> 01:24:16.400] and then she grabbed her bag and walked right out the door of the court.
[01:24:16.400 --> 01:24:19.400] So there was one other attorney there, and he had eight people,
[01:24:19.400 --> 01:24:22.400] and all their cases were dismissed for lack of prosecution,
[01:24:22.400 --> 01:24:26.400] and the judge told the people, you know, go home, you're free.
[01:24:26.400 --> 01:24:28.400] They might try to come after you later,
[01:24:28.400 --> 01:24:31.400] but for right now, you know, they're not going to prosecute you.
[01:24:31.400 --> 01:24:33.400] And they'd say, thank you, Your Honor, walk out.
[01:24:33.400 --> 01:24:35.400] Everybody's gone but me.
[01:24:35.400 --> 01:24:38.400] I'm the last one there, and he says, is there someone I haven't called?
[01:24:38.400 --> 01:24:40.400] And I says, yeah, I'm sitting right here.
[01:24:40.400 --> 01:24:41.400] I'm Terry Muzzy.
[01:24:41.400 --> 01:24:45.400] I said, you know, I heard my name mentioned, but I was never called to the bench.
[01:24:45.400 --> 01:24:48.400] And he says, well, Capital One is already gone.
[01:24:48.400 --> 01:24:49.400] I says, exactly.
[01:24:49.400 --> 01:24:53.400] I said, I got the same letter she did about this thing was supposed to be
[01:24:53.400 --> 01:24:55.400] dismissed for lack of prosecution.
[01:24:55.400 --> 01:24:59.400] I said, I'm standing here to appeal that and say, absolutely not.
[01:24:59.400 --> 01:25:02.400] Nine months, you know, she's out of year, you know.
[01:25:02.400 --> 01:25:04.400] I'm not going for a 30-day extension.
[01:25:04.400 --> 01:25:06.400] The judge was just caught off guard totally.
[01:25:06.400 --> 01:25:08.400] He didn't know what to do.
[01:25:08.400 --> 01:25:12.400] So he says, well, you know, she's already gone.
[01:25:12.400 --> 01:25:15.400] I did cut what she was asking for in half.
[01:25:15.400 --> 01:25:17.400] He says, yeah, I wouldn't worry about it.
[01:25:17.400 --> 01:25:19.400] Just go on home, you know.
[01:25:19.400 --> 01:25:21.400] Well, today is 30 days.
[01:25:21.400 --> 01:25:24.400] The 26th of this month today, that 30 days is up.
[01:25:24.400 --> 01:25:26.400] I haven't heard a word from nobody.
[01:25:26.400 --> 01:25:30.400] Yeah, yeah, yeah.
[01:25:30.400 --> 01:25:34.400] Yeah, you know, in the local courts it's difficult.
[01:25:34.400 --> 01:25:38.400] You know, we have, you know, we've been in there.
[01:25:38.400 --> 01:25:40.400] Willow is going to come on shortly.
[01:25:40.400 --> 01:25:46.400] And she had an experience in the local court up there in the Austin, Texas area.
[01:25:46.400 --> 01:25:49.400] I'm sure she'll be glad to tell us about it again.
[01:25:49.400 --> 01:25:57.400] But if you know a couple of things, sometimes you can get these judges to go with you.
[01:25:57.400 --> 01:26:05.400] If I had been you, once that lawyer had left and didn't pursue going any further,
[01:26:05.400 --> 01:26:06.400] I would have motioned the court.
[01:26:06.400 --> 01:26:12.400] I would have said the defendant motions the court for dismissal with prejudice.
[01:26:12.400 --> 01:26:19.400] Your Honor, the plaintiff isn't in the courtroom. They didn't even wait around to show up.
[01:26:19.400 --> 01:26:21.400] Well, that was his excuse.
[01:26:21.400 --> 01:26:25.400] And so, well, sorry, the plaintiff was here and has left.
[01:26:25.400 --> 01:26:28.400] And he says, so if you wanted to speak up, you should have spoke up then.
[01:26:28.400 --> 01:26:31.400] I said, Your Honor, my name wasn't called.
[01:26:31.400 --> 01:26:34.400] I said, the clerk that's handing you those clipboards one at a time
[01:26:34.400 --> 01:26:39.400] and telling you what case is up next, when I walked into this courtroom,
[01:26:39.400 --> 01:26:45.400] she asked me my name and had me write it in my handwriting, not hers, my name and case number.
[01:26:45.400 --> 01:26:50.400] So she is standing there working directly with you, and she knows I am in this courtroom.
[01:26:50.400 --> 01:26:56.400] So when she handed my case to you, she said, and Terry Muzzy is here.
[01:26:56.400 --> 01:27:02.400] And who did they have as a competent back witness to support their documentation
[01:27:02.400 --> 01:27:04.400] when they were in that courtroom?
[01:27:04.400 --> 01:27:05.400] They didn't have nothing.
[01:27:05.400 --> 01:27:09.400] They sent me, when they first took me to court the first time, they sent me a packet that,
[01:27:09.400 --> 01:27:12.400] you know, just like you described, it was a half-dick,
[01:27:12.400 --> 01:27:17.400] and it was just old statements that they sent me and what payments and what late fees
[01:27:17.400 --> 01:27:20.400] and all this other stuff, but they had no contract whatsoever.
[01:27:20.400 --> 01:27:24.400] There was nothing, you know, and I called Capital One and asked them, you know,
[01:27:24.400 --> 01:27:28.400] I said, look, I had an old account, and you guys have obviously closed it, you know,
[01:27:28.400 --> 01:27:31.400] but I have another account with you that's in good standing,
[01:27:31.400 --> 01:27:35.400] so if, you know, now this one is a zero, can I help pay on that other one?
[01:27:35.400 --> 01:27:37.400] You know, I kind of want to do the right thing here.
[01:27:37.400 --> 01:27:40.400] Oh, sorry, that's been closed for a long time, you know.
[01:27:40.400 --> 01:27:45.400] So now this was an original $1,200 charge on a $1,500 limit credit card,
[01:27:45.400 --> 01:27:49.400] and I made payments on it for a year and a half.
[01:27:49.400 --> 01:27:52.400] When I got disabled, I couldn't pay what they wanted minimum,
[01:27:52.400 --> 01:27:54.400] so I paid $40 a month and they couldn't back me.
[01:27:54.400 --> 01:27:56.400] I understand, man. I understand.
[01:27:56.400 --> 01:28:01.400] Well, it sounds like, you know, it's working out for you. You had some sympathy from the judge.
[01:28:01.400 --> 01:28:05.400] I think you could have had a judge up there that didn't give a darn
[01:28:05.400 --> 01:28:08.400] and just said, ah, grant the judge a bit tough.
[01:28:08.400 --> 01:28:11.400] I don't care if you can pay it or not, that's your problem, you know.
[01:28:11.400 --> 01:28:14.400] Well, I was sitting here on pins and needles waiting for your,
[01:28:14.400 --> 01:28:19.400] I bought your package like, you know, within a day of that court appearance, you know,
[01:28:19.400 --> 01:28:23.400] and started going through it in books and notes and everything and lots of reading.
[01:28:23.400 --> 01:28:29.400] I downloaded the Fair Debt Credit Act law and the Fair Credit Reporting Act law.
[01:28:29.400 --> 01:28:31.400] I've downloaded those.
[01:28:31.400 --> 01:28:34.400] I've got everything in a folder, but like I say, I'm just getting started.
[01:28:34.400 --> 01:28:39.400] Oh, yeah. Well, once you learn this stuff, and this is the nice thing about it,
[01:28:39.400 --> 01:28:45.400] when this stuff starts coming at you, you'll know what to do so you don't get drug into that local court
[01:28:45.400 --> 01:28:48.400] because you will become the plaintiff in these cases.
[01:28:48.400 --> 01:28:52.400] Well, can I still take them to court for being in my credit report?
[01:28:52.400 --> 01:28:54.400] Absolutely. Absolutely.
[01:28:54.400 --> 01:28:56.400] That's what I'm after.
[01:28:56.400 --> 01:29:00.400] You know, I played their game, I let them walk on me, now I'm done.
[01:29:00.400 --> 01:29:02.400] They ended up wasting all that money.
[01:29:02.400 --> 01:29:08.400] See, they wanted almost $3,000 for court fees, attorney fees and all this other stuff,
[01:29:08.400 --> 01:29:13.400] and they probably paid $100 for that supposed debt, you know, that didn't even exist.
[01:29:13.400 --> 01:29:17.400] And now that's in my credit report over and over and over and over.
[01:29:17.400 --> 01:29:19.400] I got a book by the telephone.
[01:29:19.400 --> 01:29:23.400] I just write, all these 800 numbers are bill collectors.
[01:29:23.400 --> 01:29:27.400] And I had a message, I don't take phone calls from 800 numbers,
[01:29:27.400 --> 01:29:30.400] and for a while they'd leave a message just as an attempt to collect the debt
[01:29:30.400 --> 01:29:34.400] or it's an important business matter, you know, call me back.
[01:29:34.400 --> 01:29:39.400] But, you know, I just write a book down and say, okay, well, they called this many times on this day,
[01:29:39.400 --> 01:29:43.400] this many times on this day, so, you know, I'm just putting all my notes in books.
[01:29:43.400 --> 01:29:45.400] Good for you, Terry.
[01:29:45.400 --> 01:29:47.400] Black and white is hard to beat.

[01:32:26.400 --> 01:32:36.400] I mentioned last time I was on the radio that the company Man Bracken had been in bankruptcy
[01:32:36.400 --> 01:32:42.400] at the time that I went to court and they never even showed up for court.
[01:32:42.400 --> 01:32:48.400] I had followed Mike's advice and just filed for a lack of jurisdiction.
[01:32:48.400 --> 01:32:52.400] Since nobody showed up, I won my case.
[01:32:52.400 --> 01:33:02.400] The judge actually asked me for my information because her daughter also was being sued by Man Bracken.
[01:33:02.400 --> 01:33:05.400] I gave her that information and I went home.
[01:33:05.400 --> 01:33:13.400] Two weeks later, the company that bought Man Bracken out filed against me again.
[01:33:13.400 --> 01:33:15.400] For the same thing?
[01:33:15.400 --> 01:33:16.400] For the same thing.
[01:33:16.400 --> 01:33:23.400] The new company tried to take over the loan even though I had won the case in court.
[01:33:23.400 --> 01:33:28.400] I just sent them the paperwork showing that I had won the case and that they couldn't pursue it.
[01:33:28.400 --> 01:33:32.400] I was amazed at the same company even though it had gone to court.
[01:33:32.400 --> 01:33:37.400] They were the ones that set the court and all that.
[01:33:37.400 --> 01:33:44.400] They still had the balls to send me another issue of saying I owed them money.
[01:33:44.400 --> 01:33:46.400] Yep.
[01:33:46.400 --> 01:33:48.400] It doesn't surprise me.
[01:33:48.400 --> 01:33:52.400] And I had another company contact me saying that I owed them money
[01:33:52.400 --> 01:33:58.400] because the credit card bureau still has not taken the information off.
[01:33:58.400 --> 01:34:06.400] So I'm going to have to pursue going after the credit bureau, I guess, for not removing my information.
[01:34:06.400 --> 01:34:10.400] Well, either that or you go after the creditor.
[01:34:10.400 --> 01:34:14.400] Either one.
[01:34:14.400 --> 01:34:16.400] Go after the creditor.
[01:34:16.400 --> 01:34:18.400] Send them a dispute letter.
[01:34:18.400 --> 01:34:22.400] Tell them, hey, what's this all about?
[01:34:22.400 --> 01:34:24.400] I dispute this and see what they do.
[01:34:24.400 --> 01:34:31.400] And then when they don't do anything, you rack up the violations and go sue them and get them out of your credit report.
[01:34:31.400 --> 01:34:39.400] That would be the right thing to do because otherwise they'll just keep selling it off to more debt collectors
[01:34:39.400 --> 01:34:44.400] and they'll just keep the process will be never ending.
[01:34:44.400 --> 01:34:48.400] In order to really get it removed from your credit report once and for all,
[01:34:48.400 --> 01:34:52.400] you have to make some kind of settlement agreement.
[01:34:52.400 --> 01:35:01.400] You have to get the creditor and or the debt collector to agree to remove it and to not sell it or pursue it anymore.
[01:35:01.400 --> 01:35:06.400] God, you sound just like me.
[01:35:06.400 --> 01:35:14.400] It just amazes me how persistent they are knowing that this is an illegal case to begin with.
[01:35:14.400 --> 01:35:17.400] Well, that's because they just prey on suckers.
[01:35:17.400 --> 01:35:20.400] They don't care.
[01:35:20.400 --> 01:35:23.400] Ninety-nine percent of the people aren't going to fight it.
[01:35:23.400 --> 01:35:27.400] Ninety-nine percent of the people don't know their game.
[01:35:27.400 --> 01:35:29.400] So that's what they count on.
[01:35:29.400 --> 01:35:32.400] It's good odds for them.
[01:35:32.400 --> 01:35:34.400] It's a good gamble for them.
[01:35:34.400 --> 01:35:41.400] So when they see that one person does know their game, then they'll roll over.
[01:35:41.400 --> 01:35:49.400] Well, it's amazing how quickly people have rolled over using the techniques that I've been learning from all of the LR radio.
[01:35:49.400 --> 01:35:53.400] My court case ended up just completely disappearing.
[01:35:53.400 --> 01:36:03.400] The court case I was talking about with the police and driving without a license ticket that I had that was an ongoing thing for years.
[01:36:03.400 --> 01:36:06.400] It just disappeared.
[01:36:06.400 --> 01:36:17.400] I had basically caught the clerk acting like a judge and trying not to give the judge my paperwork.
[01:36:17.400 --> 01:36:26.400] And I told her that I had noticed that she had done this action, which was an illegal action,
[01:36:26.400 --> 01:36:31.400] or else she had lost her paperwork, which was also an illegal action.
[01:36:31.400 --> 01:36:36.400] And she said, well, I'll make sure that ends up on the judge's desk,
[01:36:36.400 --> 01:36:44.400] and then the entire thing just disappeared as if I never even had the ticket to begin with.
[01:36:44.400 --> 01:36:47.400] It's fantastic.
[01:36:47.400 --> 01:36:56.400] It's amazing how I became very much aware that all of these people that are perpetrating the illegal acts are very much aware that they're doing it.
[01:36:56.400 --> 01:37:04.400] That they are consciously and illegally performing acts that they know are illegal
[01:37:04.400 --> 01:37:09.400] and doing it anyway because they can get away with it because we don't stand up and do something.
[01:37:09.400 --> 01:37:14.400] When I stood up and did something on both cases, they just disappeared.
[01:37:14.400 --> 01:37:22.400] I mean, I still have creditors trying to contact me, but I'm pursuing that and getting it taken care of.
[01:37:22.400 --> 01:37:27.400] I have something to fight with now because I have a court order saying it was dismissed.
[01:37:27.400 --> 01:37:30.400] So that's very, very cool.
[01:37:30.400 --> 01:37:34.400] And it certainly has empowered me to try to help trends
[01:37:34.400 --> 01:37:41.400] and comment on my Facebook page a number of times about how much you guys have helped me out.

[01:38:21.400 --> 01:38:28.400] and the ideas on they had a problem with T-Mobile who they always would mess something up
[01:38:28.400 --> 01:38:33.400] and would always coincidentally toss me money and put more money in their pockets,
[01:38:33.400 --> 01:38:36.400] and it's always an accident according to them.
[01:38:36.400 --> 01:38:40.400] I'm all sorry, we'll fix this, but it always involves a lot of my time,
[01:38:40.400 --> 01:38:46.400] and then my time is never compensated, neither is the integration and convenience, et cetera,
[01:38:46.400 --> 01:38:53.400] and neither is any damages that it might cost to me to have more money taken from me than is due
[01:38:53.400 --> 01:38:57.400] because things do have domino effects.
[01:38:57.400 --> 01:39:00.400] At any rate, I've been with T-Mobile for almost six years,
[01:39:00.400 --> 01:39:07.400] and the final straw was that they had made another mistake,
[01:39:07.400 --> 01:39:11.400] and then they wanted to fix it and not give me any compensation about that,
[01:39:11.400 --> 01:39:15.400] and I pointed out that it's multiple times a year that this happens,
[01:39:15.400 --> 01:39:19.400] and I'm never compensated just fixing the initial error.
[01:39:19.400 --> 01:39:24.400] I was promised $30 and $40, two separate amounts.
[01:39:24.400 --> 01:39:29.400] I specifically asked if those together add up to $70 or whatever.
[01:39:29.400 --> 01:39:30.400] They said yes.
[01:39:30.400 --> 01:39:36.400] Later on, they tried to tell me that there was no two amounts that I was to be credited,
[01:39:36.400 --> 01:39:43.400] that the $40 actually included the $30 plus $10, and that it was only $40.
[01:39:43.400 --> 01:39:54.400] Anyways, to make a long story short, I ended up breaking off the client relationship with them
[01:39:54.400 --> 01:39:59.400] over what ended up being $15, and it just became a matter of principle for me.
[01:39:59.400 --> 01:40:00.400] I was irate.
[01:40:00.400 --> 01:40:05.400] When I told them I would sue them because I could prove that they had offered
[01:40:05.400 --> 01:40:08.400] or that they had committed and that they had now backed out,
[01:40:08.400 --> 01:40:19.400] they told me that in the contract I signed was the agreement to go to arbitration instead of court,
[01:40:19.400 --> 01:40:21.400] and therefore I wouldn't be able to take them to court.
[01:40:21.400 --> 01:40:23.400] Does that sound right to you at all?
[01:40:23.400 --> 01:40:29.400] I believe that the contract does include the arbitration stipulation.
[01:40:29.400 --> 01:40:35.400] Well, you know, that's the purpose of small claims court.

[01:42:36.400 --> 01:42:40.400] Their bookkeeping shows absolutely no record of this.
[01:42:40.400 --> 01:42:46.400] It resulted in numerous overdraft fees on my account,
[01:42:46.400 --> 01:42:54.400] and when I got a printout of all the transactions for that day
[01:42:54.400 --> 01:43:00.400] and the weeks before and after that day,
[01:43:00.400 --> 01:43:09.400] their records do not show that unauthorized deposit.
[01:43:09.400 --> 01:43:15.400] In other words, my balance shows $99.00 and some cents
[01:43:15.400 --> 01:43:19.400] from the day prior to this event happening,
[01:43:19.400 --> 01:43:25.400] and it was still $99.00 and some cents until the next thing is shown,
[01:43:25.400 --> 01:43:31.400] which is me withdrawing $240.00, which ends up putting me $140.00 negative on their paper.
[01:43:31.400 --> 01:43:33.400] Well, what really happened?

[01:47:05.400 --> 01:47:09.400] coming from a place that you are expecting it to come from.

[01:47:36.400 --> 01:47:42.400] Do you have any receipt showing that you were expecting a payment from your job at that same time?

[01:47:46.400 --> 01:47:51.400] or that you were supposed to have a deposit in your account from somebody?
[01:47:51.400 --> 01:47:57.400] Because if so, what bank do you bank at?
[01:47:57.400 --> 01:48:00.400] It's just a small Minnesota bank.
[01:48:00.400 --> 01:48:04.400] Well, I don't know with small banks, but I know with most banks,
[01:48:04.400 --> 01:48:09.400] if you can prove that that amount was in your account through your ATM
[01:48:09.400 --> 01:48:13.400] and go to your bank, they should remove all of the charges.
[01:48:13.400 --> 01:48:16.400] If you can prove that you were expecting money to come in
[01:48:16.400 --> 01:48:19.400] and that you were shown that this amount was in your account
[01:48:19.400 --> 01:48:22.400] and it was their mistake,
[01:48:22.400 --> 01:48:25.400] you can prove that that amount was in your account,
[01:48:25.400 --> 01:48:27.400] whether they have a record of it or not.
[01:48:27.400 --> 01:48:29.400] So it's their mistake.
[01:48:29.400 --> 01:48:32.400] And for the most part, I would have said,
[01:48:32.400 --> 01:48:35.400] oh, no, right, this went off because you withdrew money,
[01:48:35.400 --> 01:48:38.400] assuming that this was your money.
[01:48:38.400 --> 01:48:40.400] But since that amount was in your account,
[01:48:40.400 --> 01:48:45.400] if you take your proof to the bank and talk to one of the managers of the bank,
[01:48:45.400 --> 01:48:49.400] they should remove all of the charges unless you already have
[01:48:49.400 --> 01:48:53.400] a lot of overdraft charges from the last six months.
[01:48:53.400 --> 01:48:59.400] Did the other deposit that you were actually expecting, did that ever go in?
[01:48:59.400 --> 01:49:04.400] Well, it ended up that it was behind schedule and I actually...
[01:49:04.400 --> 01:49:06.400] But did it ever go in?
[01:49:06.400 --> 01:49:09.400] When I noticed the problem, I called that source
[01:49:09.400 --> 01:49:12.400] and told them to not send it to my account
[01:49:12.400 --> 01:49:15.400] because I wanted to clear up this problem with the bank.
[01:49:15.400 --> 01:49:19.400] Okay, so the deposit that you were actually expecting never went into your account.
[01:49:19.400 --> 01:49:21.400] But you know what, that's pretty immaterial.
[01:49:21.400 --> 01:49:22.400] What is material?
[01:49:22.400 --> 01:49:24.400] Well, no, I'm just trying to get the question answered.
[01:49:24.400 --> 01:49:33.400] Did the other deposit that you were expecting ever go into the account?
[01:49:33.400 --> 01:49:34.400] No.
[01:49:34.400 --> 01:49:35.400] Okay, okay.
[01:49:35.400 --> 01:49:36.400] You have proof.
[01:49:36.400 --> 01:49:43.400] You have proof that you were supposed to get that deposit at that time.
[01:49:43.400 --> 01:49:47.400] You have somebody willing to say you were supposed to get that deposit at that time?
[01:49:47.400 --> 01:49:53.400] Their records do not indicate their mistake, but my ATM receipt does indicate it.
[01:49:53.400 --> 01:49:57.400] Their records seem to have covered up their mistake
[01:49:57.400 --> 01:49:59.400] and they're pretending like it never happened.
[01:49:59.400 --> 01:50:03.400] And the bank manager even told me that in the event that the bank makes enough unauthorized
[01:50:03.400 --> 01:50:08.400] or makes a mistake and deposits money into some of the accounts that isn't supposed to be there,
[01:50:08.400 --> 01:50:11.400] that they have a duty to notify that customer that that's happened
[01:50:11.400 --> 01:50:14.400] and tell the customer to give the money back to the bank
[01:50:14.400 --> 01:50:19.400] because they understand that it can cause somebody financial injury
[01:50:19.400 --> 01:50:23.400] to have things going on in their account there.
[01:50:23.400 --> 01:50:27.400] Freeman, just go to the small claims court and file an application.
[01:50:27.400 --> 01:50:30.400] Yeah, that's what we've been talking about for the last hour, small claims court.
[01:50:30.400 --> 01:50:33.400] That sounds like the perfect remedy.
[01:50:33.400 --> 01:50:37.400] When they get the summons, they will want to talk to you.
[01:50:37.400 --> 01:50:39.400] Yeah, I agree.

[01:50:48.400 --> 01:50:50.400] for these kinds of things, the small claims court.
[01:50:50.400 --> 01:50:51.400] I think that's the best remedy.
[01:50:51.400 --> 01:50:55.400] As far as their records, they're omitting the error on their part
[01:50:55.400 --> 01:51:00.400] being able to prove that the error did take place by my ATM paper.
[01:51:00.400 --> 01:51:05.400] Should I claim any kind of fraud against them?
[01:51:05.400 --> 01:51:07.400] Not exactly.
[01:51:07.400 --> 01:51:10.400] They would have a duty to correct their records.
[01:51:10.400 --> 01:51:16.400] However, if you can show that you took the money out in good faith reliance
[01:51:16.400 --> 01:51:22.400] on it being covered based on the records you had in front of you,
[01:51:22.400 --> 01:51:24.400] you're acting in good faith.
[01:51:24.400 --> 01:51:28.400] That's why we're asking about if you have documentation showing
[01:51:28.400 --> 01:51:35.400] that you were expecting this deposit to come in from another source.
[01:51:35.400 --> 01:51:40.400] If it had ever actually gone in, that would be even more hardcore proof.
[01:51:40.400 --> 01:51:44.400] Since it never went in, if you can show paperwork showing that,

[01:52:10.400 --> 01:52:13.400] Because otherwise they could just pin the onus on you and say,
[01:52:13.400 --> 01:52:17.400] well, he just thought it was free money and was trying to take advantage of the bank.

[01:52:21.400 --> 01:52:25.400] that's why we're asking those questions about if that other deposit actually went in.
[01:52:25.400 --> 01:52:29.400] But since it didn't, then you can at least show that you were expecting it.

[01:53:28.400 --> 01:53:32.400] Well, as we've been talking about here, it's obviously under the Fair Credit

[01:53:34.400 --> 01:53:35.400] They're both federal laws.
[01:53:35.400 --> 01:53:40.400] They're consumer laws, but they're geared at the creditors and the debt collectors,
[01:53:40.400 --> 01:53:43.400] things they're supposed to do with challenge.
[01:53:43.400 --> 01:53:48.400] Of course, as walking through all this, step by step, plain English, easy to understand.
[01:53:48.400 --> 01:53:54.400] There's been some folks on here tonight who have attested to my statement that, you know,
[01:53:54.400 --> 01:53:59.400] it's easy to understand, it's easy to follow, it's a learning curve.
[01:53:59.400 --> 01:54:03.400] You get some satisfaction out of it because you take over
[01:54:03.400 --> 01:54:06.400] and you become the plaintiff in these cases.
[01:54:06.400 --> 01:54:11.400] And if they don't want to settle, well, you know, we'll let the judge and jury decide.
[01:54:11.400 --> 01:54:16.400] I've never seen one of these cases go into trial as of yet, first time for everything,
[01:54:16.400 --> 01:54:20.400] but they don't seem to want to go in front of that jury.
[01:54:20.400 --> 01:54:24.400] And I don't want to get into the fact that when this stuff gets exposed,
[01:54:24.400 --> 01:54:28.400] their liability insurance premiums may be affected.
[01:54:28.400 --> 01:54:31.400] Oh, you know, like when you get a speed ticket right away,
[01:54:31.400 --> 01:54:35.400] the insurance company wants to double your yearly premium.
[01:54:35.400 --> 01:54:39.400] Oh, yeah, well, they do the same with banks because the banks are insured.
[01:54:39.400 --> 01:54:42.400] I talked about that earlier, the notes, OK?
[01:54:42.400 --> 01:54:48.400] AIG, we bailed them all out $180 billion to make those notes all good.
[01:54:48.400 --> 01:54:51.400] They were insured for all those bad notes.
[01:54:51.400 --> 01:54:54.400] Same thing with these creditors and what have you.
[01:54:54.400 --> 01:54:57.400] And at the very least, they take the facts right off on it
[01:54:57.400 --> 01:55:00.400] and they get a credit on their facts.
[01:55:00.400 --> 01:55:05.400] So the courses show you how to get there, folks, so you can get the power to do something
[01:55:05.400 --> 01:55:07.400] and they can pay attention to you.
[01:55:07.400 --> 01:55:10.400] That's basically what this is all about.

[01:55:12.400 --> 01:55:16.400] You know, you may have a conference call with the judge once in a while.
[01:55:16.400 --> 01:55:21.400] You may go into the judge's chambers for a conference, but it's not a court action, OK?
[01:55:21.400 --> 01:55:25.400] It's working up to going to trial and preparing for trial.
[01:55:25.400 --> 01:55:29.400] And once you clear the mud and get the water nice and clear
[01:55:29.400 --> 01:55:33.400] so they can see the laws that they broke and their attorney goes back and says,
[01:55:33.400 --> 01:55:38.400] you know what, this guy's got you because you didn't follow the rules.
[01:55:38.400 --> 01:55:41.400] You broke the law and if we continue, he's going to win.
[01:55:41.400 --> 01:55:46.400] I suggest you make an offer for this person to go away and they make an offer.
[01:55:46.400 --> 01:55:50.400] You do a settlement agreement, get everything in writing so it doesn't come back,
[01:55:50.400 --> 01:55:55.400] you know, six months or a year or five years from now and fight you.
[01:55:55.400 --> 01:56:01.400] Now, Mike, generally you would, OK, regarding, you have your debt collectors,
[01:56:01.400 --> 01:56:03.400] your third party debt collectors and then the creditors.
[01:56:03.400 --> 01:56:04.400] Right.
[01:56:04.400 --> 01:56:09.400] You were saying earlier that you want to kind of go after the creditor at the same time
[01:56:09.400 --> 01:56:13.400] because what I'm concerned with in some of these cases is that, OK,
[01:56:13.400 --> 01:56:15.400] you may get the debt collector to go away,
[01:56:15.400 --> 01:56:19.400] but what if the original creditor tries to come back after you?
[01:56:19.400 --> 01:56:25.400] Well, that's the beauty of getting them both in the court at the same time.
[01:56:25.400 --> 01:56:29.400] If the creditor gets involved, the debt collector is as the defendant,
[01:56:29.400 --> 01:56:35.400] the creditor as the co-defendant, you're going to have another negotiating point
[01:56:35.400 --> 01:56:39.400] because, you know, they can go back to the creditor and say,
[01:56:39.400 --> 01:56:41.400] look, this guy's going to cause a lot of trouble.
[01:56:41.400 --> 01:56:44.400] You know, the account is closed, it's dead.
[01:56:44.400 --> 01:56:46.400] Why don't we just settle with them?
[01:56:46.400 --> 01:56:50.400] They'll have an attorney that may represent both parties
[01:56:50.400 --> 01:56:53.400] or they may have two separate attorneys.
[01:56:53.400 --> 01:56:56.400] But the point is, is you go in there and you win it
[01:56:56.400 --> 01:57:00.400] and the settlement agreement is the creditor's got to get out of your credit report.
[01:57:00.400 --> 01:57:03.400] They'll never report this again now in the future.
[01:57:03.400 --> 01:57:06.400] They won't sell it to a debt collector or debt collector attorney.
[01:57:06.400 --> 01:57:11.400] And this is what gives you the power to do this in the settlement agreement.
[01:57:11.400 --> 01:57:13.400] That's the beauty of this thing.
[01:57:13.400 --> 01:57:16.400] You get the creditor to go away, get out of your credit report.
[01:57:16.400 --> 01:57:17.400] You're done with him. He's finished.
[01:57:17.400 --> 01:57:20.400] You've got a settlement agreement. It's all over.
