[00:00.000 --> 00:09.640] Some 50,000 new housing units in Jerusalem neighborhoods beyond the Green Line are in
[00:09.640 --> 00:14.440] various states of planning and approval. Most of the units will be built in predominantly
[00:14.440 --> 00:20.040] Jewish neighborhoods beyond the Green Line, while a smaller number will be built in Arab
[00:20.040 --> 00:25.600] neighborhoods. Vice President Joe Biden condemned the move, saying the decision undermined peace
[00:25.600 --> 00:31.440] talks. The U.S. State Department Friday issued its annual Human Rights Report, and once again
[00:31.440 --> 00:36.840] the human rights situation in America's two largest battlegrounds, Afghanistan and Iraq,
[00:36.840 --> 00:43.000] continued to worsen. The Afghanistan report focused on the civilians killed, blaming the
[00:43.000 --> 00:49.560] Taliban for the increase in civilian deaths. It also pointed out human trafficking, restrictions
[00:49.560 --> 00:55.960] on press and religion, torture and poor prison conditions. Only a brief mention was given
[00:55.960 --> 01:07.020] to the massive civilian toll from NATO airstrikes. In Somalia, 43 people were killed and hundreds
[01:07.020 --> 01:13.880] wounded in the past 48 hours as dueling offensives by the African Union-backed Somali government
[01:13.880 --> 01:20.000] and the militant faction led to some of the fiercest fighting in weeks. Most of the casualties
[01:20.000 --> 01:25.520] were civilians, and fighting prevented wounded people from being rescued as they lay dying
[01:25.520 --> 01:32.000] in the street. Karl Rove, a senior adviser to former President George Bush, has defended
[01:32.000 --> 01:37.840] harsh interrogation techniques such as waterboarding, saying he was proud of the intelligence the
[01:37.840 --> 01:43.960] U.S. gained from using them. Rove was often referred to as Bush's brain and is credited
[01:43.960 --> 01:50.640] with Bush's electoral successes. Last January, Barack Obama barred the use of waterboarding
[01:50.640 --> 02:00.360] after defining it as a form of torture. A bank examiner's report says Lehman Brothers
[02:00.360 --> 02:07.080] used a counting sleight of hand to conceal the bad investments that led to its undoing.
[02:07.080 --> 02:12.640] The report concluded Lehman died from bad mortgage holdings and, less directly, demands
[02:12.640 --> 02:18.200] by rivals like JPMorgan Chase and Citigroup that the Foundering Bank post-collateral
[02:18.200 --> 02:24.000] against loans it desperately needed, but the examiner Anton Valloukas laid out what the
[02:24.000 --> 02:29.200] report characterized as, quote, materially misleading accounting gimmicks that Lehman
[02:29.200 --> 02:35.760] used to mask the perilous state of its finances. Lehman's bankruptcy, the largest in U.S. history,
[02:35.760 --> 02:41.160] shook the financial world. According to the report, Lehman used what amounted to financial
[02:41.160 --> 02:47.720] engineering to temporarily shuffle $50 billion of troubled assets off its books in the months
[02:47.720 --> 02:53.720] before its collapse in September 2008 to conceal its dependence on borrowed money.
[02:53.720 --> 03:08.520] You are listening to the Rule of Law Radio Network at ruleoflawradio.com, live free speech
[03:08.520 --> 03:24.480] talk radio at its best.
[03:39.520 --> 03:48.520] Bad boys, bad boys, whatcha gonna do? Whatcha gonna do when they come for you? Bad boys,
[03:48.520 --> 03:54.520] bad boys, whatcha gonna do? Whatcha gonna do when they come for you? When you were eight
[03:54.520 --> 03:59.520] and you had bad traits, you'd go to school and learn the golden rules. So why are you
[03:59.520 --> 04:05.520] acting like a bloody fool? If you get hot, then you might get cool. Bad boys, bad boys,
[04:05.520 --> 04:12.520] whatcha gonna do, whatcha gonna do when they come for you? Bad boys, bad boys, whatcha
[04:12.520 --> 04:16.520] gonna do? Whatcha gonna do when they come for you? You chuck it on that one, you chuck
[04:16.520 --> 04:20.520] it on this one. You chuck it on your mother and you chuck it on your father. You chuck
[04:20.520 --> 04:24.520] it on your brother and you chuck it on your sister. You chuck it on that one and you chuck
[04:24.520 --> 04:31.520] it on me. Bad boys, bad boys, whatcha gonna do? Whatcha gonna do when they come for you?
[04:31.520 --> 04:33.520] Bad boys, bad boys,
[04:33.520 --> 04:34.520] what you gonna do?
[04:34.520 --> 04:37.520] What you gonna do when they come for you?
[04:37.520 --> 04:38.520] Bad boys, bad boys,
[04:38.520 --> 04:40.520] what you gonna do?
[04:40.520 --> 04:42.520] What you gonna do when they come for you?
[04:42.520 --> 04:44.520] Bad boys, bad boys,
[04:44.520 --> 04:45.520] what you gonna do?
[04:45.520 --> 04:46.520] What you gonna do when they come for you?
[04:46.520 --> 04:47.520] All right, bad boys!
[04:47.520 --> 04:48.520] bad boys!
[04:48.520 --> 04:50.520] and bad girls,
[04:50.520 --> 04:52.520] what are you going to do
[04:52.520 --> 04:55.520] when we come for you?
[04:55.520 --> 04:58.520] This is the rule of law!
[04:58.520 --> 04:59.520] I am psyched!
[04:59.520 --> 05:00.520] I am stoked right now!
[05:00.520 --> 05:07.000] right now. I am so pumped. Architects and engineers for 9-Eleven Truth massive
[05:07.000 --> 05:14.080] event next Saturday a week from tomorrow at the Doubletree Hotel 290 at I-35.
[05:14.080 --> 05:20.360] We've got a room it's going to seat 500 people so folks everybody needs to get
[05:20.360 --> 05:25.000] out there. We're going to be broadcasting live. Ron Avery is going to be
[05:25.000 --> 05:30.960] presenting. Alex Jones is going to be a speaker. Dr. Bob Bowman, Lt. Colonel Bob
[05:30.960 --> 05:37.040] Bowman, this is incredible. Yeah a rocket science, rocket scientist for real. So
[05:37.040 --> 05:41.120] everybody got to get out there. I am in such a good mood. This is going to be
[05:41.120 --> 05:46.000] awesome. Okay just had to get that out there. Go to go to our website
[05:46.000 --> 05:49.800] ruleoflawradio.com for more information. You can download the pamphlets and the
[05:49.800 --> 05:53.800] brochure and the press release and everything. Spread the news far and wide.
[05:53.800 --> 05:58.520] Everybody get out there. Free event but we do need your donations because it's
[05:58.520 --> 06:04.120] not cheap to put on something like this. So at any rate Randy and Eddie want to
[06:04.120 --> 06:15.440] talk about some kind of a road trip you guys want to plan. Guys? Well yeah kind of.
[06:15.440 --> 06:19.240] It's just an idea that I was going to throw out to Randy to see what you know
[06:19.240 --> 06:23.080] we might be able to accomplish and see who we've got listening that may actually
[06:23.080 --> 06:27.960] want to support it so that we could get it accomplished. We've been talking about
[06:27.960 --> 06:33.240] how do we get on the floor in front of our legislators as a collective group
[06:33.240 --> 06:40.760] and point out not only their mistakes in the law itself but their mistakes in the
[06:40.760 --> 06:46.120] belief that they can actually write those laws to apply to us the way they
[06:46.120 --> 06:52.760] do everything else. And the more we think about this the more it looks like we're
[06:52.760 --> 06:56.600] running into a roadblock on getting on the floor because they want to insist
[06:56.600 --> 07:02.240] that well it's never been done it can't happen you know you're just not allowed
[07:02.240 --> 07:06.560] to do that. Well now wait a minute these people work for us what right or power
[07:06.560 --> 07:12.280] do they have to say we can't come to them as a group and tell them where
[07:12.280 --> 07:18.280] they're screwing up. So how's that work going to work? Well okay Eddie I want to
[07:18.280 --> 07:24.400] make a comment on this because I've heard arguments concerning the government and
[07:24.400 --> 07:29.560] patriotism and all these kinds of things from my own family my own friends I've
[07:29.560 --> 07:35.880] heard it even from other guests on other shows on on patriot networks like this
[07:35.880 --> 07:41.640] one and there seems to be this prevailing attitude even amongst
[07:41.640 --> 07:48.200] hardcore real patriot truthers this underlying some kind of indoctrination
[07:48.200 --> 07:55.920] that's oh if you question the government or if you have any kind of accusation
[07:55.920 --> 07:59.760] that the government possibly could be doing something wrong well then you
[07:59.760 --> 08:05.840] don't love your country well you're unpatriotic oh it's such a sad thing to
[08:05.840 --> 08:10.240] be placed in this position that we are placed in this position to have to
[08:10.240 --> 08:15.720] question our government and and because we love our country and it's such a
[08:15.720 --> 08:21.120] disgrace no it's not a disgrace people this is our duty this is our job the
[08:21.120 --> 08:27.800] government is not our country the government is not the nation it is not
[08:27.800 --> 08:33.640] equivalent patriotism equivalent with worshipping the government give me a
[08:33.640 --> 08:40.200] break so I'm sorry I have to dispel dispel that myth once and for all it
[08:40.200 --> 08:46.000] is our duty to question and keep control of the government like unruly children I
[08:46.000 --> 08:51.480] mean are you a bad parent if you question and discipline your children I
[08:51.480 --> 08:56.400] don't think so but you know the way I see parents treating their kids these
[08:56.400 --> 09:00.840] days most of the time it seems like you know I really have to wonder which one
[09:00.840 --> 09:05.280] is boss well that's exactly what's going on with the government and us right now
[09:05.280 --> 09:12.960] hello we're the boss people okay go ahead sorry it's you're pretty well
[09:12.960 --> 09:17.280] correct that a lot of people seem to think that however if they'll do a
[09:17.280 --> 09:23.680] little reading on history the founding fathers absolutely knew and stated for a
[09:23.680 --> 09:32.520] fact that government is a necessary evil okay it's not a necessary good it is a
[09:32.520 --> 09:39.640] necessary evil and like anything evil it needs to be watched monitored and kept
[09:39.640 --> 09:45.440] within its place because if you unleash it where it becomes uncontrollable then
[09:45.440 --> 09:50.800] that evil spills over into everything that's where our duty kicks in is to
[09:50.800 --> 09:55.120] keep it contained we've given it a sandbox to play in it's called Washington
[09:55.120 --> 10:03.920] DC and pardon me guys Austin Texas okay that's their sandbox they can you know
[10:03.920 --> 10:08.240] do the things we've allowed them to do there but they're not allowed to kick
[10:08.240 --> 10:16.760] the sand in our face they're not and I for one don't take that very well so when
[10:16.760 --> 10:22.080] we have a very good listener and participant out there who has been
[10:22.080 --> 10:27.160] busting his hand in real hard to find a way for to get the information necessary
[10:27.160 --> 10:32.920] for us to get into the Capitol in Austin to have a face-to-face discussion with
[10:32.920 --> 10:38.820] our representatives now despite his best efforts he seems to be running into the
[10:38.820 --> 10:43.000] same stonewall that most of us do which is they either want to say well it's
[10:43.000 --> 10:48.440] never been done so it can't be done or they don't have any procedure for doing
[10:48.440 --> 10:55.120] that or no we're just not going to allow that and I agree with him none of those
[10:55.120 --> 10:59.960] answers in my opinion are satisfactory they don't even come close we didn't
[10:59.960 --> 11:04.440] set up a government and say okay toddle off do whatever you like we'll just be
[11:04.440 --> 11:07.720] here waiting for you to come back and buy this in the hind end later that's
[11:07.720 --> 11:14.600] not how we set this up go ahead Randy maybe we need to give them a need a
[11:14.600 --> 11:21.280] little leverage on them I've been doing some calls the last couple days about 10
[11:21.280 --> 11:28.120] minute YouTube videos maybe we could start go see one of the legislators or
[11:28.120 --> 11:34.400] try to get to one of the legislators record our calls to them and make up a
[11:34.400 --> 11:41.320] really nice roast video for one legislator after another start posting
[11:41.320 --> 11:46.480] them on YouTube here's your legislator in action now or we could just send out a
[11:46.480 --> 11:49.880] private investigator to give some of those really juicy videos of what they
[11:49.880 --> 11:53.760] do after hours and then we'd have all the leverage we wanted right that would
[11:53.760 --> 12:04.920] work Larry Flynn owner of Husker magazine still has a million dollar reward up for
[12:04.920 --> 12:11.680] anybody who brings them some really scumbag information on these politicians
[12:11.680 --> 12:16.320] I'm sure he's taking that offer down by now he's getting overload you know what
[12:16.320 --> 12:21.600] I think we should start doing people that are interested and active as far as
[12:21.600 --> 12:29.120] legislation and lobbying and trying to get certain bills pushed through we all
[12:29.120 --> 12:35.160] need to start looking at conflicts of interest of legislators who are blocking
[12:35.160 --> 12:43.460] certain bills namely one in Oklahoma and I won't get too much into it because I
[12:43.460 --> 12:48.320] don't want to step on anyone's toes up there the people that are working on
[12:48.320 --> 12:52.640] certain bills in Oklahoma but I'm just going to put it out there that people
[12:52.640 --> 12:57.880] who are working on legislation in any state legislature that if you have a
[12:57.880 --> 13:02.960] bill and you have a legislator that is sponsoring a bill and it's some how
[13:02.960 --> 13:09.240] somewhere along the line starts to get blocked by some powerful other
[13:09.240 --> 13:14.960] legislators start looking at why and let's start looking at the conflicts of
[13:14.960 --> 13:20.040] interest and let's start looking at the rules the parliamentary rules there may
[13:20.040 --> 13:26.640] even be statutes on on the issue of conflicts of interest I say take the
[13:26.640 --> 13:32.000] gloves completely off no more playing pussyfoot around with these people okay
[13:32.000 --> 13:37.080] we've got to expose what's really going on because these high-power high-dollar
[13:37.080 --> 13:43.920] corporate interests that are are getting a stronghold in our state houses that
[13:43.920 --> 13:50.560] has got to go people okay our state legislators especially the house reps
[13:50.560 --> 13:57.400] this is one of our final stands that we have sway we actually have sway with our
[13:57.400 --> 14:02.360] representatives in the houses of our state legislators and when you start to
[14:02.360 --> 14:08.440] get legislators who have you look at the maps of their constituency and they have
[14:08.440 --> 14:14.920] like no constituency like totally rural areas like maybe only a few hundred
[14:14.920 --> 14:19.520] people but then you start finding out they're the most powerful legislators
[14:19.520 --> 14:22.320] and they control the whole house and they control the speakers of the house
[14:22.320 --> 14:29.120] and everything else and everybody counts house to them and their hands are all
[14:29.120 --> 14:36.000] involved in media corporations FM stations ownerships all kinds of things
[14:36.000 --> 14:41.480] and they're blocking very strong bills for the will of the people I say enough
[14:41.480 --> 14:46.000] is enough people we've got to stop this conflict of interest in our state
[14:46.000 --> 14:52.600] legislators I'm not putting up with it anymore no more no more discussion with
[14:52.600 --> 15:01.560] these people man I'm sorry that's my rant well granted the only problem is is
[15:01.560 --> 15:05.960] once again even if you got all the goods on them who are you going to give it to
[15:05.960 --> 15:10.040] to spread the word around are they own all the systems that would normally
[15:10.040 --> 15:14.780] report on them they control them well basically be folks like us that would be
[15:14.780 --> 15:21.360] doing it I like Randy's idea what Robert Fox did you go park a truck in front of
[15:21.360 --> 15:27.000] the state legislature or in the parking spaces legal spaces with giant banners
[15:27.000 --> 15:32.840] okay yeah but then they start sending out the bomb squad to have you move it
[15:32.840 --> 15:38.760] thinking it was full of fertilizer or something it got Robert on national news
[15:38.760 --> 15:45.480] and he had some really ugly stuff on there about the judges and the
[15:45.480 --> 15:55.760] prosecutors these people crooks a crook no matter how he's dressed but I'm just
[15:55.760 --> 16:02.920] saying we have to start coming up with very creative over-the-top ideas to
[16:02.920 --> 16:08.440] battle this situation if we really want to win these guys are still afraid of
[16:08.440 --> 16:13.680] exposure mm-hmm we're about to go to break when we come back I'll tell you
[16:13.680 --> 16:20.120] about how I use that to get a guy out of moved out of a jail in Michigan where
[16:20.120 --> 16:23.520] they thought they were trying to kill him by hiding not giving him his
[16:23.520 --> 16:27.160] medication especially when you find out that they're grandstanding on issues
[16:27.160 --> 16:31.620] like state sovereignty and they're trying to put on a public show that
[16:31.620 --> 16:35.320] that's what they're all into and then you find out that they're really lap dogs
[16:35.320 --> 16:42.680] of the feds and trying to protect their corporate cartel monopolies and
[16:42.680 --> 16:50.320] blocking bills for their own profit margins you know who I'm talking about
[16:50.320 --> 16:56.200] we'll be right back and we also have Brian from Colorado
[16:59.320 --> 17:03.760] you feel tired when talking about important topics like money and politics
[17:03.760 --> 17:07.800] are you confused by words like the Constitution or the Federal Reserve what
[17:07.800 --> 17:12.400] if so you may be diagnosed with the deadliest disease known today stupidity
[17:12.400 --> 17:16.800] hi my name is Steve Holt and like millions of other Americans I was
[17:16.800 --> 17:21.200] diagnosed with stupidity at an early age I had no idea that the number one cause
[17:21.200 --> 17:25.040] of the disease is found in almost every home in America the television
[17:25.040 --> 17:29.380] unfortunately that puts most Americans at risk of catching stupidity but there
[17:29.380 --> 17:32.960] is hope the staff at brave new books have helped me and thousands of other
[17:32.960 --> 17:37.120] foxaholics suffering from sports zombieism recover and because of brave
[17:37.120 --> 17:40.720] new books I now enjoy reading and watching educational documentaries
[17:40.720 --> 17:45.400] without feeling tired or uninterested so if you or anybody you know suffers from
[17:45.400 --> 17:53.040] stupidity then you need to call 512 480 2503 or visit them in 1904 Guadalupe or
[17:53.040 --> 17:56.480] brave new bookstore calm side effects from using brave new books products may
[17:56.480 --> 17:59.160] include discernment and enlarged vocabulary and an overall increase in
[17:59.160 --> 18:16.880] mental functioning
[18:16.880 --> 18:22.040] all right justice that is what we are after all right we've got Brian from
[18:22.040 --> 18:27.040] Colorado Russell from Texas you guys just hold on for just a couple of
[18:27.040 --> 18:30.920] minutes Randy wants to tell a story about getting someone moved out of jail
[18:30.920 --> 18:37.240] in Michigan is that right Randy yes I'll make it a short story that's the guy
[18:37.240 --> 18:43.880] out of he's out of North Carolina he was up visiting his brother in Michigan he
[18:43.880 --> 18:48.520] had accused the district attorney in North Carolina Nashville North Carolina
[18:48.520 --> 18:53.800] was trying to prosecute and he had accused the prosecutor of using him to
[18:53.800 --> 18:59.560] rub drugs for it they claimed they were doing a sting and they got these guys to
[18:59.560 --> 19:05.080] sell drugs to up to buyers and he said he did this for several months and it
[19:05.080 --> 19:08.960] became clear nobody was getting prosecuted he's selling all these drugs
[19:08.960 --> 19:14.240] bringing all the money to the district attorney nobody's getting prosecuted well
[19:14.240 --> 19:18.240] now the prosecutors the district attorneys after him they had the US
[19:18.240 --> 19:22.000] Marshals arrest him in Michigan and he's in real bad health and they were
[19:22.000 --> 19:29.040] withholding his medication from him so I called up there and did my standard
[19:29.040 --> 19:33.320] song and dance and seltzer down your pants I have it recorded but we don't
[19:33.320 --> 19:38.000] have it mastered yet I'll try to have the recording mastered by next week we'll
[19:38.000 --> 19:42.840] play it for you but I told him that I had people calling my show telling me
[19:42.840 --> 19:46.480] that you guys had somebody in your jail up there and you're trying to murder him
[19:46.480 --> 19:51.840] by withholding his medication from him and and we want to do a YouTube video
[19:51.840 --> 19:56.840] but but since you know we don't want to just tell the bad side because you know
[19:56.840 --> 20:01.560] sometimes people tell us stories that they exaggerate or sometimes a BS so we
[20:01.560 --> 20:05.040] want to hear both sides and I'd like to interview either you because he was
[20:05.040 --> 20:14.200] ahead of the jail or the sheriff and you could hear him dance up I will we'll
[20:14.200 --> 20:21.120] play the video and we'll play the tape next week once we get it mastered once
[20:21.120 --> 20:26.440] Denver masters it but I got a call today that I made the call yesterday and I got
[20:26.440 --> 20:30.880] a call from North Carolina today all of a sudden they're moving this guy from
[20:30.880 --> 20:36.280] Michigan back to North Carolina well you know this is exactly what we have to do
[20:36.280 --> 20:41.320] in fact Randy these kinds of techniques that you just described probably save
[20:41.320 --> 20:45.200] Sherry Jackson's life because that's exactly what was happening with her she
[20:45.200 --> 20:51.560] was dying from neglect and as a I would say a political prisoner punishing her
[20:51.560 --> 20:57.360] for making a stand for doing the right thing withholding medication from her
[20:57.360 --> 21:06.780] and because of all of us hammering them I believe her life was saved now she's
[21:06.780 --> 21:10.820] okay she's the last letter I got from her she's in solitary confinement which
[21:10.820 --> 21:14.120] is fine with her she spends all her time in prayer and she doesn't need her
[21:14.120 --> 21:18.720] medication anymore and she is doing well in good health so we really are making a
[21:18.720 --> 21:24.840] difference yeah and they don't want exposure the last thing they want is
[21:24.840 --> 21:31.320] for other people to see what they're doing so if we even just go talk to call
[21:31.320 --> 21:36.620] the legislators and tell them we want to do a YouTube video that we're we're
[21:36.620 --> 21:46.280] doing videos on corrupt politicians and we want this guy to give his side hey
[21:46.280 --> 21:50.360] this is a hoot you have to try this once well that's what we are change does they
[21:50.360 --> 21:55.720] don't even ask they just go get in their face and film it well this is we don't
[21:55.720 --> 22:02.640] I'm gonna do this to the guys we don't have anything on he's gonna know what
[22:02.640 --> 22:06.900] he's done that's he doesn't want exposed and he's gonna figure we know about it
[22:06.900 --> 22:12.520] yeah that guilty conscience will get him every time that's hilarious if you know
[22:12.520 --> 22:19.080] a politician without a guilty conscience odds are he was elected yesterday okay
[22:19.080 --> 22:23.480] guys do y'all want to start taking some calls yes okay we've got Brian in
[22:23.480 --> 22:29.640] Colorado Brian thanks for calling in what's on your mind tonight oh I got a
[22:29.640 --> 22:33.800] lot of things to cover and just a very little short amount of time my name is
[22:33.800 --> 22:37.000] Brian Keith family and Meyer I am the judge your attorney general for the
[22:37.000 --> 22:41.400] state of Illinois number one Eddie if you want to get something in front of
[22:41.400 --> 22:44.120] legislature you go ahead and subpoena them with a subpoena
[22:44.120 --> 22:50.400] Dukas teakum and you schedule the hearing in front of the house very
[22:50.400 --> 22:54.600] simple to do I've done it in Illinois repeatedly and that's how you get your
[22:54.600 --> 22:59.200] address in and then you ask for a certified reporter that will go ahead
[22:59.200 --> 23:04.360] and take the minutes of the meeting and listening in this call you know earlier
[23:04.360 --> 23:09.840] this evening where do you get standing to issue a subpoena Dukas teakum you
[23:09.840 --> 23:13.200] issue a subpoena subpoena Dukas teakum that all of the legislators that you
[23:13.200 --> 23:18.040] want to ask questions of where do you get where do you get standing to issue
[23:18.040 --> 23:22.440] that that's a court proceeding where do you get standing case and and what
[23:22.440 --> 23:26.620] documents are you looking for if you're deuces teakum you're not asking for the
[23:26.620 --> 23:31.600] body oh you can you can do an in personam they have to present an in
[23:31.600 --> 23:38.280] personam what what court are you subpoena in these people too if you want
[23:38.280 --> 23:43.760] to have them answer questions you have to have an actual mechanism to bring
[23:43.760 --> 23:48.080] them to the floor there is a mechanism to bring them to the floor that's what
[23:48.080 --> 23:53.920] we want yeah I've brought the whole general assembly on the floor in
[23:53.920 --> 24:01.440] Illinois and believe me they don't like me okay what's the nature I'm trying to
[24:01.440 --> 24:05.200] think of the right way to ask this case it'd be constitutional violations by
[24:05.200 --> 24:11.440] the legislature what that right now what is the legal structure that gives you
[24:11.440 --> 24:16.400] the standing would be within the look like in Texas law for something
[24:16.400 --> 24:21.280] comparable new can't just go issue a subpoena
[24:21.280 --> 24:27.040] subpoenas is essentially an order of a court now while they allow attorneys
[24:27.040 --> 24:31.760] should know file them the court has to enforce them so the court has to have
[24:31.760 --> 24:37.560] some kind of standing and we're talking court and legislature here so we need
[24:37.560 --> 24:41.800] some legal structure that allows us to do this well the easiest way to go
[24:41.800 --> 24:44.480] through the Judiciary Committee and then the issue the subpoena through the
[24:44.480 --> 24:48.840] Judiciary Committee if they refuse to issue it then they have what's called
[24:48.840 --> 24:52.240] bias and if they have bias they have to withdraw they have to leave their
[24:52.240 --> 24:59.240] office I'm still not understanding what court this subpoena is being issued
[24:59.240 --> 25:05.160] could you buy me the legislature has your issue as a citizen yeah okay this
[25:05.160 --> 25:11.320] legislature has the citizens don't have subpoena I'm not quite sure anymore
[25:11.320 --> 25:18.400] yeah the only time I've ever heard of this kind of subpoena is if you have a
[25:18.400 --> 25:24.800] lawsuit if you're if you're in litigation against some someone you can
[25:24.800 --> 25:29.080] subpoena that you can subpoena your opponent wait y'all are talking together
[25:29.080 --> 25:34.120] now yeah yeah can you not hear us Brian I can hear you okay the only time I've
[25:34.120 --> 25:38.720] heard of subpoena without being enforced by a court order is if you're in
[25:38.720 --> 25:43.320] litigation with somebody like a civil litigation and you issue a subpoena to
[25:43.320 --> 25:47.840] your opposing party and then it's pretty much understood that you answer the
[25:47.840 --> 25:51.240] subpoena because if you don't then you're basically insulting the court
[25:51.240 --> 25:56.520] because then you have to ask the court to enforce it but other than that I've
[25:56.520 --> 26:01.640] heard of legislative subpoenas but I don't understand this we're just going
[26:01.640 --> 26:06.520] to issue a subpoena I mean I don't get that well it's real simple you issue the
[26:06.520 --> 26:10.960] subpoena and yes you are in opposition with the legislature so you filing a
[26:10.960 --> 26:15.240] lawsuit is this in federal court or state court opposition okay so are you
[26:15.240 --> 26:18.520] filing a lawsuit is this in federal court or state you don't have to file a
[26:18.520 --> 26:24.120] lawsuit to be in opposition you're asking for a actual accounting for what
[26:24.120 --> 26:30.360] they've done oh well okay concern is is you called it a subpoena yeah and that's
[26:30.360 --> 26:34.760] a that's a legal structure and we're trying to find the legal footing the
[26:34.760 --> 26:41.040] legal stand I am quite sure in Texas there is a little arcane law same as in
[26:41.040 --> 26:46.840] Illinois that states that a legislator has to answer any question by
[26:46.840 --> 26:54.440] constituent ie citizen of any question asked and if you ask yeah I would love
[26:54.440 --> 26:59.920] to see that statutes okay yeah I mean I'm not arguing that point of it I would
[26:59.920 --> 27:02.840] yeah I would love to see the statute directly so we can hold our feet to the
[27:02.840 --> 27:07.560] fire with it but my objective is to get them in a group that you and I can't
[27:07.560 --> 27:13.040] sighted to Russell who evidently is back to back with me he asked me to call I'm
[27:13.040 --> 27:16.960] supposed to be a black tie dinner and he asked me to call in oh you're the guy
[27:16.960 --> 27:22.520] yeah I'm the wonder fantastic in fact Russell's on the line right now Russell
[27:22.520 --> 27:27.600] no he just called me hey Russell thanks for joining us tonight well here's the
[27:27.600 --> 27:31.560] deal okay I didn't want to get off on a tangent because you guys were hitting on
[27:31.560 --> 27:36.200] stuff you know while I was listening in you know while I'm on hold number one
[27:36.200 --> 27:39.080] it's not that hard to get the legislature down on the floor and a
[27:39.080 --> 27:43.760] hammer it is not as difficult as you think number two I've never found it
[27:43.760 --> 27:48.800] difficult at all especially if you go to the committee hearings well yeah well
[27:48.800 --> 27:56.560] committee is that's kind of a joke in itself but you know that's that's what
[27:56.560 --> 28:01.280] we're wanting well I can help you guys you know with some ideas because I've
[28:01.280 --> 28:06.760] done in Illinois believe me don't hate me with a passion good and I mean a
[28:06.760 --> 28:12.800] passion that raises you high in our esteem yeah if you'll send me your
[28:12.800 --> 28:16.640] contact information I'll be in quick contact with you on how to make this
[28:16.640 --> 28:21.440] happen yep not a problem I can tell you okay the reason I was calling in I've
[28:21.440 --> 28:26.200] got a I've got a client actually he is the de jure lieutenant governor who's
[28:26.200 --> 28:31.440] come to Winnebago County Illinois can you explain what you mean by de jure lieutenant
[28:31.440 --> 28:36.800] governor well it's real simple there is a de jure government that's the actual
[28:36.800 --> 28:40.600] government that was elected by the people for the people you know you know
[28:40.600 --> 28:44.600] those guys and then there's the de facto which is the corporation that kind of
[28:44.600 --> 28:51.520] took it over I was a lobbyist for ten years and Springfield Illinois got
[28:51.520 --> 28:55.720] blindsided by some little guy who all of a sudden now is the president nobody
[28:55.720 --> 29:01.480] even knows who the heck he is that's completely confusing to me how can I
[29:01.480 --> 29:07.160] how can I have an individual who has zero background all of a sudden become
[29:07.160 --> 29:10.760] the president yeah there's there's a lot of questions about this oh that's right
[29:10.760 --> 29:17.720] sugar I've been involved with the big nasty let's go back to this thing on on
[29:17.720 --> 29:22.840] the reason that I called in Brian went into federal court he was indicted for
[29:22.840 --> 29:27.440] three counts of failure to file and three counts of felony tax evasion and
[29:27.440 --> 29:31.640] he's right on point on everything he's done he has done everything that he's
[29:31.640 --> 29:35.840] supposed to do as far as you know notifications everything else and then
[29:35.840 --> 29:40.600] when he had me indicted in I was at his residence when it was raided on April
[29:40.600 --> 29:44.200] 1st okay wait a minute hold on hold on we're going to break Brian stand the
[29:44.200 --> 29:47.800] line we've also got our friend our mutual friend Russell on the line too
[29:47.800 --> 29:54.920] so hold that thought about being raided we'll be right back on the other side
[29:59.520 --> 30:04.760] are you the plaintiff or defendant in a lawsuit win your case without an

[31:23.080 --> 31:37.960] okay we are speaking with Brian in Colorado we're gonna bring up Russell
[31:37.960 --> 31:42.360] from Texas as well for commentary okay go ahead Brian you were telling us about
[31:42.360 --> 31:49.400] a raid okay April 1st of last year we had 39 federal agents and local agents
[31:49.400 --> 31:56.540] raid a warehouse we were having a meeting and they basically took Mr.
[31:56.540 --> 32:02.240] Small into custody over three three misdemeanor and three felony counts on a
[32:02.240 --> 32:11.440] warrant for failure to pay income taxes failure to file slash and it just goes
[32:11.440 --> 32:16.400] off in a never-never land I mean they're listing is crazy we already had these
[32:16.400 --> 32:24.360] dismissed gone long ago but Mr. Small owned a building and still owns a
[32:24.360 --> 32:29.200] building in Rockford Illinois did the city wants to seize and they don't want
[32:29.200 --> 32:32.240] to pay him for it they just want to flat-out steal it that's worth about a
[32:32.240 --> 32:36.760] million five and he's sitting in the county jail right now on a traffic
[32:36.760 --> 32:42.160] ticket for no driver's license and I have been around we're in the when the
[32:42.160 --> 32:47.760] Court of Appeals they won't release him it's insane but mr. small went into
[32:47.760 --> 32:52.560] federal court Northern District of Illinois last week and he addressed the
[32:52.560 --> 32:59.200] court that he wished to have an appointment for a translator for legally
[32:59.200 --> 33:03.560] and the judge said what are you talking about he says everybody appointed an
[33:03.560 --> 33:07.920] attorney says I don't want the attorney I'll represent myself and I'm not
[33:07.920 --> 33:14.680] representing I'm presenting myself and I want a translator because understand
[33:14.680 --> 33:17.960] does not mean the same thing in Miriam Webster's dictionary that I was taught
[33:17.960 --> 33:23.600] when I was a kid because you're using Black's law 7th edition and he set the
[33:23.600 --> 33:28.400] judge back on his chair pretty hard there are a lot of people sitting in
[33:28.400 --> 33:33.880] jail because they don't even understand not even remotely what the charges are
[33:33.880 --> 33:38.680] because they're using legally which is a complete different language and don't I
[33:38.680 --> 33:44.960] know that up to the judge and the judge granted him that and he said that if you
[33:44.960 --> 33:53.160] wish to file a motion or other motions you can dictate which dictionary you
[33:53.160 --> 33:57.960] wish to utilize for the definitions of the words that are used and this is a
[33:57.960 --> 34:03.200] first look how many people are sitting in jail right now who can't even
[34:03.200 --> 34:07.640] comprehend why they're in jail because they didn't know the definitions
[34:07.640 --> 34:11.560] underneath a black law dictionary they thought it meant you know common law you
[34:11.560 --> 34:16.560] know common language and so this is the first time that somebody requested a
[34:16.560 --> 34:22.920] translator now the court is scrambling trying to find a translator and not get
[34:22.920 --> 34:27.960] into a problem with the Bar Association which by the way Brian Small and myself
[34:27.960 --> 34:31.680] are both directors of the Illinois Bar Association so we've got a little bit
[34:31.680 --> 34:36.240] more standing than the average guy and you can look that up on the internet you
[34:36.240 --> 34:42.960] know through Secretary of State Illinois we're the real deal and the courts have
[34:42.960 --> 34:46.760] just rolled over everybody and then you've got people coming in number one
[34:46.760 --> 34:51.320] don't even speak English in that same courtroom in Winnebago County Illinois
[34:51.320 --> 34:55.160] that don't even speak English and then they have a translator that comes in and
[34:55.160 --> 35:02.680] translates between English and you know Finnegrad one you know there's different
[35:02.680 --> 35:07.760] dialects of Spanish but they're not translating exactly what it means they're
[35:07.760 --> 35:12.760] translating underneath of the normal understanding of the language you know
[35:12.760 --> 35:17.320] like IE Merriam-Webster or you know what we were taught as kids they're not
[35:17.320 --> 35:24.160] translating what those words really mean like understand you stand under I got a
[35:24.160 --> 35:30.440] funny feeling that this may cause a lot of overturn of cases because how can you
[35:30.440 --> 35:35.800] make a knowledgeable plea to a charge when you don't even know what the hell
[35:35.800 --> 35:40.800] are saying and this has been going on for a long time that's another little a
[35:40.800 --> 35:45.920] little caveat little lawyer trick and I've been on top of this for a long time
[35:45.920 --> 35:51.120] and I even put in my briefs in my filings exactly what dictionary I'm
[35:51.120 --> 35:55.800] utilizing for the definitions of the words contained within that brief let me
[35:55.800 --> 36:00.800] ask you something Brian a lot of games let me let me ask you something Brian
[36:00.800 --> 36:08.120] why isn't it required or why aren't you just using the definitions of the terms
[36:08.120 --> 36:15.120] of the statute concerning the charges or whatever the issue is at hand I mean
[36:15.120 --> 36:21.200] usually these words are clearly defined not only in the statute but in the
[36:21.200 --> 36:26.080] chapters sometimes the sub chapters so I really don't understand this concept
[36:26.080 --> 36:30.720] that we can just pick whatever definition we want oh they do you know I
[36:30.720 --> 36:36.200] didn't say they I said we ain't no this is the part that's insane when you walk
[36:36.200 --> 36:39.840] into one of the administrative law courts which that's all they are they're
[36:39.840 --> 36:43.720] not article three courts when you walk in there they're utilizing blacks law
[36:43.720 --> 36:49.560] dictionary to define what these words mean okay well when I file lawsuits I
[36:49.560 --> 36:54.160] use the definitions of the words in the statute well that's fine but
[36:54.160 --> 36:58.180] unfortunately what you're missing is that when they define the words in the
[36:58.180 --> 37:02.560] definition of the statute they're using black law dictionary and believe me
[37:02.560 --> 37:07.560] there are words in there that are 180 degrees diametrically opposed to what we
[37:07.560 --> 37:12.120] understand those words to me yeah and the other thing about that scenario
[37:12.120 --> 37:16.240] Deborah is what I've been saying all along about when they say that they take
[37:16.240 --> 37:19.960] the common meaning they're not talking about the regular dictionary and that
[37:19.960 --> 37:26.520] applies to every single word including the conjunctions correct you know and or
[37:26.520 --> 37:34.240] as yeah I realize things so the reason realizing is they have their own little
[37:34.240 --> 37:41.040] secret book and people come before the bar which that's a joke in itself I
[37:41.040 --> 37:46.440] don't even want to get into that that's a that's a 12-hour seminar I teach when
[37:46.440 --> 37:50.440] people come in and you know the judge reads the charge and asks do you
[37:50.440 --> 37:55.120] understand as soon as you make the comment yes I understand yes what you
[37:55.120 --> 38:01.080] just said I'm guilty as charged I stand under the charges I am sure okay wait a
[38:01.080 --> 38:09.480] minute no no I've heard this before I've never heard any cogent explanation of
[38:09.480 --> 38:16.240] that stating before the court that you understand the words that they used how
[38:16.240 --> 38:21.960] on earth is that tantamount to a guilty plea it's real tantamount because they
[38:21.960 --> 38:26.000] don't bother to tell you they're utilizing a different definition book
[38:26.000 --> 38:31.080] what is the definition book you understand they take that to mean that
[38:31.080 --> 38:37.600] you are fully cognizant of life law of you know the whole court procedure and
[38:37.600 --> 38:45.840] that the words how does that how is that tantamount to a guilty plea well
[38:45.840 --> 38:49.660] technically no it's not tantamount to a guilty you just said it was and I keep
[38:49.660 --> 38:55.120] hearing this a lot guys keep coming on saying these kind of things and they
[38:55.120 --> 39:00.640] confuse people with it and I wind up with people going to jail because they go go
[39:00.640 --> 39:07.000] to court and refuse to to do what they have to do to stay out of jail and they
[39:07.000 --> 39:11.760] won't give a plea because they're afraid that if they give a plea they give the
[39:11.760 --> 39:15.000] court subject matter jurisdiction they're afraid that there's some kind of
[39:15.000 --> 39:20.520] magic little incantation you have to do to protect yourself and they wind up
[39:20.520 --> 39:23.760] doing stupid stuff and they come to me want me to get them out of jail for it
[39:23.760 --> 39:28.880] that's why I'm a little touchy on these kinds of this is a real simple issue to
[39:28.880 --> 39:34.400] me I mean it's real simple what definitions are you utilizing today are
[39:34.400 --> 39:38.320] we utilizing the standard English language Oxford dictionary Miriam
[39:38.320 --> 39:42.920] Webster are we utilizing the blacks law well Brian I really don't understand what
[39:42.920 --> 39:48.960] the point is here because our whole show is about analyzing law and analyzing the
[39:48.960 --> 39:54.880] definitions in the statute in the code in bouviers in blacks law so I don't
[39:54.880 --> 39:59.160] understand what the controversy is here are you are you trying to present some
[39:59.160 --> 40:02.800] material here or teach us something or do are you asking us a question or where
[40:02.800 --> 40:07.680] is this going I'm sorry if I'm I thought this is this is real simple
[40:07.680 --> 40:13.360] nobody ever quantifies or qualifies so what definitions are being used in court
[40:13.360 --> 40:19.360] statute wise charge wise or otherwise okay and I really agree with you on this
[40:19.360 --> 40:24.360] I really like this approach and the only reason I stepped on that one is because
[40:24.360 --> 40:28.200] we stepped outside it where you made a general statement they didn't have
[40:28.200 --> 40:34.280] sufficient referential index yeah I really like the idea of forcing them to
[40:34.280 --> 40:38.280] specifically tell me where did you get this meaning did you get this from the
[40:38.280 --> 40:43.120] statute did you get it from the case law did you get it from blacks or did you
[40:43.120 --> 40:48.160] get it off the toilet wall well that's what I've always done I'm a
[40:48.160 --> 40:51.800] mathematician it all boils down to definitions and well if that's what
[40:51.800 --> 40:59.080] you've always done in Illinois I've reviewed nowhere in those documents
[40:59.080 --> 41:04.800] even in the appellate side and I know many appellate judges in Illinois none of
[41:04.800 --> 41:11.040] them have ever come across a stand-up of which definition are we using are we
[41:11.040 --> 41:15.800] using the yachty rules the monopoly game rules are we using you know checkers
[41:15.800 --> 41:21.120] rules what in the heck are we talking about nobody's ever addressed that well
[41:21.120 --> 41:25.640] the past few days it's been addressed and now they're scrambling wonderful
[41:25.640 --> 41:31.200] okay Russell Russell from Texas you're on the air what do you have to say about
[41:31.200 --> 41:36.360] this well I loved it so much I added it to my Supreme Court petition for
[41:36.360 --> 41:43.440] rehearing fantastic I mean I was flabbergasted when I talked to Brian
[41:43.440 --> 41:48.520] about this you know last week when it happened and I thought to myself man that
[41:48.520 --> 41:54.520] you know it made perfect sense to me I mean when yeah if you can get the course
[41:54.520 --> 42:00.200] to do what they're supposed to do which is answer the question right well we've
[42:00.200 --> 42:05.920] got tools to handle that if we can get people to use them I have three tickets
[42:05.920 --> 42:10.160] which tools are you and I'll be going for the court with soon
[42:10.160 --> 42:14.560] yeah it sounds like we're all we're all doing the same thing here we're just
[42:14.560 --> 42:18.680] we're just breaking apart the code breaking apart the law getting down to
[42:18.680 --> 42:23.920] the actual definitions and no no this that's not exactly it what he's doing
[42:23.920 --> 42:27.640] well that's part of saying make those guys do it if you're going to use that
[42:27.640 --> 42:31.960] word which one you know I guess it depends on which side you're on if
[42:31.960 --> 42:35.720] you're the plaintiff like if I was going to be the plaintiff then I would be the
[42:35.720 --> 42:40.840] one doing it because I'd be the one doing they don't they operate on legal
[42:40.840 --> 42:44.360] presumptions in the courtroom they like everybody to presume what the
[42:44.360 --> 42:49.040] words mean when they're not challenged on it they let it go the judge is not
[42:49.040 --> 42:52.920] going to make them define it if you as the defendant don't make them define it
[42:52.920 --> 42:56.520] then they'll just slide it in the jury will buy it and that'll be all she wrote
[42:56.520 --> 43:00.160] that's how you get convicted because they're using common language and
[43:00.160 --> 43:05.360] they're not two different languages spoken in the courtroom trust me I was
[43:05.360 --> 43:09.420] at the trial from mr. small on the first time and I guarantee you there were two
[43:09.420 --> 43:12.800] languages being addressed there and I tried to bring that up and the judge
[43:12.800 --> 43:20.240] told me to shut up and sit down and he's an administrative war judge either did
[43:20.240 --> 43:24.440] you file a judicial conduct complaint against the judge I've done more than
[43:24.440 --> 43:32.440] that good man that was the first step I'm with that I believe the the name you
[43:32.440 --> 43:37.640] were looking to call him was a human like phallic symbol yeah something like
[43:37.640 --> 43:43.720] that okay we're going to break callers if you like to call in five one two six

[47:48.920 --> 47:51.920] yeah
[47:54.240 --> 47:57.240] whoa
[47:59.960 --> 48:02.960] whoa
[48:04.080 --> 48:12.320] all right we are back taking your calls 512-646-1984
[48:12.320 --> 48:18.880] we've got Rodney from Texas on the line Rodney thanks for calling in what's on
[48:18.880 --> 48:31.920] your mind tonight thank you very subject of Randy I actually in a situation where
[48:31.920 --> 48:39.360] I filed a lawsuit against the judge will actually hear as an administrative
[48:39.360 --> 48:45.080] hearing officer or what this guy just called in the column that lived
[48:45.080 --> 48:52.120] administration law judge and well everything was going okay until we
[48:52.120 --> 48:58.600] actually show showed up for the motion hearing and the judge looked at the
[48:58.600 --> 49:07.040] motion hearing says well I'm going to dismiss this lawsuit meaning my lawsuit
[49:07.040 --> 49:14.080] without prejudice because the amount that you're requesting and legal fees is
[49:14.080 --> 49:23.240] above the amount that this court is allowed to handle and since this is in
[49:23.240 --> 49:32.040] a JP court she dismissed it without prejudice and I asked if I could amend
[49:32.040 --> 49:40.640] the complaint for lower amount and she said no no you she's right you can't if
[49:40.640 --> 49:46.320] you filed that in a suit in a in a court and your amount is greater than the
[49:46.320 --> 49:53.000] court can address you can't replede you have to file in the court that would
[49:53.000 --> 49:57.680] handle the amount you originally pledged so she's correct yeah what state are you
[49:57.680 --> 50:04.800] in pardon me what state are you in Texas yeah $200 is the maximum a JP court can
[50:04.800 --> 50:10.680] hear no it's 2,000 no no not according to that you know I think not according
[50:10.680 --> 50:19.720] to step in in in 1879 it originally started at 200 in 18 and 1979 it went to
[50:19.720 --> 50:24.680] 2,000 and I've since heard it's gone to 10,000 state Constitution still sets it
[50:24.680 --> 50:34.040] 200 so no statutes going overpower that okay so I guess I guess County Court
[50:34.040 --> 50:41.800] would be the yes and that's a better place to do it anyway because a JP court
[50:41.800 --> 50:51.840] is not necessarily a the judge is not necessarily an attorney in County Court
[50:51.840 --> 50:59.000] it's a court of record and the judge is learning counsel and you you're answer
[50:59.000 --> 51:03.720] no it's more likely to follow the technical rule of law than a JP is JP
[51:03.720 --> 51:08.360] justice whatever you want to well in fact she did tell me that that court was
[51:08.360 --> 51:13.600] not a court of record and I did check the judge's background she did happen to
[51:13.600 --> 51:21.160] be a little an attorney but you basically answered all my questions I
[51:21.160 --> 51:25.360] was just kind of checking because I thought it was kind of strange that she
[51:25.360 --> 51:31.840] would wait all the way up until the hearing to let you know the she was
[51:31.840 --> 51:37.600] corrected she didn't rule on the motion prior to the hearing on the motion
[51:37.600 --> 51:42.640] before the motion was brought before the court right the motion was originally
[51:42.640 --> 51:46.760] just filed and she waited till it was brought before the court and that way
[51:46.760 --> 51:51.800] she got opportunity to explain to you why she rendered the ruling that she did
[51:51.800 --> 51:55.760] that sounds like she did that appropriate rather than just blowing it
[51:55.760 --> 52:03.040] off out of hand and giving you no feedback well with there were actually
[52:03.040 --> 52:09.680] several motions that she did so I guess they were all involved in that case
[52:09.680 --> 52:13.600] that would be typical because she has no jurisdiction to hear the suit she can't
[52:13.600 --> 52:19.240] hear any related motions either well I want Randy to extrapolate a little bit
[52:19.240 --> 52:24.200] on what the difference is between filing a motion and bringing it before the
[52:24.200 --> 52:31.920] court well when you file it the motion with the clerk there is a lot of room
[52:31.920 --> 52:41.260] for the other side to move to strike lack of service if the motion doesn't
[52:41.260 --> 52:49.600] ask the court a legal to do something we got a petition from one of the other
[52:49.600 --> 52:55.880] broadcasters and I looked at the suit and I told him these guys don't have a
[52:55.880 --> 53:02.960] prayer and he said well why said I don't know but they don't have a prayer they
[53:02.960 --> 53:08.080] told him the court what a dirty rotten scoundrel he was but they didn't ask the
[53:08.080 --> 53:12.440] court to do anything that's what's in the prayer they didn't have one so
[53:12.440 --> 53:17.520] there's a lot of things that can can cause a motion to get bumped out well
[53:17.520 --> 53:23.680] wait a minute before it gets before the court and this judge probably could have
[53:23.680 --> 53:27.400] looked at that and said I don't have subject matter jurisdiction and just
[53:27.400 --> 53:33.040] tossed it okay so Randy how do you get your motion before the court you after
[53:33.040 --> 53:38.200] you file it or can you do that at the same time yes you can you you contact the
[53:38.200 --> 53:46.120] clerk and ask the clerk for a date when the court will sit to hear motions a lot
[53:46.120 --> 53:49.660] of court a lot of courts have days that that's all they do is hear motions
[53:49.660 --> 53:53.920] because for the most part motions take just a couple minutes he states his side
[53:53.920 --> 53:58.080] as the other states their side or somebody's asking for a continuance or
[53:58.080 --> 54:02.320] asking for some minor thing and judge just all the attorneys line up and they
[54:02.320 --> 54:07.680] just walk through the motions kind of go through the motions so you want to find
[54:07.680 --> 54:12.600] a day they're gonna have motion hearings you want to get two days and then
[54:12.600 --> 54:16.440] contact the other side I got these two days for motion hearings which is best
[54:16.440 --> 54:20.960] for you and pick one or the other if you don't like one I'm gonna set it on the
[54:20.960 --> 54:26.440] other we're gonna get one of these two unless he has a legitimate objection to
[54:26.440 --> 54:31.520] both and he can make that before the court but you put you petition the clerk
[54:31.520 --> 54:37.360] to set it on a certain day and notify the other day notify the other side of
[54:37.360 --> 54:43.200] the day it gets set if you just file a motion and don't move to put it on for
[54:43.200 --> 54:47.600] hearing nothing ever happens well Randy let me ask you this are you saying that
[54:47.600 --> 54:55.160] you can set a motion hearing for a motion you haven't filed yet no no you
[54:55.160 --> 55:00.360] have to file the motion when you file it you the day you file it you can ask the
[55:00.360 --> 55:05.520] clerk for a date you have to give the other side a statutory amount of time
[55:05.520 --> 55:11.200] okay respond to the motion so the date has to be beyond that time and you can
[55:11.200 --> 55:17.320] ask for a day that's beyond the time limit for them to answer and generally
[55:17.320 --> 55:21.120] ask for two days so the other side gets to they can object to one but not to
[55:21.120 --> 55:25.600] both without cause can you move the court to make a ruling on your motion
[55:25.600 --> 55:32.360] without having to have a hearing depends on the nature of the motion yes you can
[55:32.360 --> 55:36.800] you can move for the court to rule on the pleadings and object to oral
[55:36.800 --> 55:45.320] argument I hope you can do that with some of the courts won't go ahead Randy
[55:45.320 --> 55:51.040] I'm sorry go ahead Rodney yeah she said I had to refile this in the court of
[55:51.040 --> 55:59.200] proper jurisdiction is there a time limit on refiling this years I didn't
[55:59.200 --> 56:05.280] hear you a couple of years it depends on the nature of the filing if it's fraud
[56:05.280 --> 56:13.320] it's generally four years if it's I think false imprisonments one year what
[56:13.320 --> 56:17.200] was one year I think that's been up to two most as a general rule you've got
[56:17.200 --> 56:21.840] two years on civil actions if it's official misconduct or something like
[56:21.840 --> 56:27.320] that how long that's a misdemeanor you got two years okay all right well great
[56:27.320 --> 56:31.840] guys now remember though that's two years from the date of the act not from
[56:31.840 --> 56:39.400] the day you tried to file it oh okay okay all right well thank you very much
[56:39.400 --> 56:47.680] oh wait one more thing from the date you filed this action to the date that she
[56:47.680 --> 56:53.560] dismissed the action the time tolls that that time period doesn't count so you
[56:53.560 --> 57:01.800] subtract that out of the two years all right okay all right well thanks guys
[57:01.800 --> 57:08.320] okie-doke thank you Rodney thank you for all your support okay we're about to go
[57:08.320 --> 57:11.520] to the top of the hour break we still got Russell on the line let's bring
[57:11.520 --> 57:15.040] Russell up hey Russell thanks for hanging in there with us you want to
[57:15.040 --> 57:21.720] stay on with us on the other side you want to continue your story yeah good
[57:21.720 --> 57:25.920] okay go ahead you got about a minute or so well I'm just going to tell that if
[57:25.920 --> 57:29.200] that guy can show that he's got constitutional violations done by the
[57:29.200 --> 57:34.280] judge he needs to look up the stripping doctrine and go after me in either state
[57:34.280 --> 57:40.000] or federal court that way there ain't no limitations on that well there's this
[57:40.000 --> 57:44.840] limitation on a time to sue there's no limitation on on going because the
[57:44.840 --> 57:49.400] constitutional violations there's not yeah there is they tried to set it at
[57:49.400 --> 57:55.480] two years for a constitutional tort they've tried to limit that as well we
[57:55.480 --> 57:58.200] didn't give them the authority to do that but that's what the courts are
[57:58.200 --> 58:02.240] trying to do is throw it out if it's over two years law but that's not what
[58:02.240 --> 58:09.280] they can do in federal federal law good yeah this is more up on federal than I
[58:09.280 --> 58:12.320] am okay Russell you want to stay on the line and talk about this some more on
[58:12.320 --> 58:16.440] the other side yeah okay perfect all right Russell is going to hang with us

[59:39.440 --> 59:43.920] request that will expose the fraud and put the lenders on the dime lender

[59:48.880 --> 59:57.400] in real estate comm or call 512-430-4140 and get the information you need to stop
[59:57.400 --> 01:00:05.880] the money changers in their tracks giving the administration another
[01:00:05.880 --> 01:00:10.280] potential excuse to stall the u.s. pullout from Iraq officials are now
[01:00:10.280 --> 01:00:16.360] warning that the asab al-haq league of the righteous an anti-us shiite militia
[01:00:16.360 --> 01:00:22.000] intends to attack the green zone and other u.s. bases Barack Obama's advisors
[01:00:22.000 --> 01:00:26.200] will likely recommend Khalid Sheikh Mohammed the self-proclaimed mastermind
[01:00:26.200 --> 01:00:31.360] of 9-11 be prosecuted in a military tribunal reversing Attorney General
[01:00:31.360 --> 01:00:35.960] Eric Holder's plan to try him in civilian court if Obama accepts his
[01:00:35.960 --> 01:00:40.560] advisor's recommendation the White House may be able to secure from Congress the
[01:00:40.560 --> 01:00:45.240] funding and legal authority needed to close the Guantanamo prison and replace
[01:00:45.240 --> 01:00:50.360] it with a facility in the u.s.
[01:00:53.240 --> 01:00:58.400] signs emerge that Pentagon subway shooter John Patrick Bedell harbored
[01:00:58.400 --> 01:01:03.360] strong hatred toward the u.s. government and the armed forces and questioned the
[01:01:03.360 --> 01:01:08.240] official version of 9-11 but L was shot and killed Thursday in an exchange of
[01:01:08.240 --> 01:01:13.760] fire at the entrance to the Pentagon station subway in Washington DC but L
[01:01:13.760 --> 01:01:18.880] left several internet postings under the username J Patrick Bedell saying he was
[01:01:18.880 --> 01:01:23.520] determined to see that justice is served in the death of Marine Colonel James
[01:01:23.520 --> 01:01:30.000] Sabo who was found dead in the backyard of his California home in 1991 the death
[01:01:30.000 --> 01:01:35.000] was ruled a suicide but Sabo's family maintains he was murdered because he was
[01:01:35.000 --> 01:01:39.480] about to expose covert military operations in Central America involving
[01:01:39.480 --> 01:01:44.360] drug smuggling Bedell said the Sabo case was a step toward establishing the
[01:01:44.360 --> 01:01:51.680] truth of events such as the September 11th demolitions Senate Armed Services
[01:01:51.680 --> 01:01:56.000] Committee chairman Carl Levin says the Pentagon should consider Blackwater's
[01:01:56.000 --> 01:02:01.080] past quote deficiencies and deciding whether to award a one billion dollar
[01:02:01.080 --> 01:02:06.800] contract to train Afghan National Police Levin wrote defense secretary Robert
[01:02:06.800 --> 01:02:11.880] Gates quote incidents in Iraq led many to conclude that Blackwater was not a
[01:02:11.880 --> 01:02:15.720] suitable contracting partner for the u.s. government and contributed to the
[01:02:15.720 --> 01:02:20.520] company's decision to change its name adding the inadequacies and Blackwater's
[01:02:20.520 --> 01:02:23.880] performance appeared to have contributed to a shooting incident that had
[01:02:23.880 --> 01:02:28.160] undermined our mission in Afghanistan Levin also said the firm may have
[01:02:28.160 --> 01:02:32.480] misappropriated government weapons and carried arms without authorization
[01:02:32.480 --> 01:02:37.360] Blackwater guards have been accused of murdering 17 Iraqi citizens in cold
[01:02:37.360 --> 01:02:42.360] blood in 2007 in January two u.s. security contractors working for
[01:02:42.360 --> 01:02:47.760] Paravent a unit of Z formerly Blackwater were arrested on charges they murdered

[01:07:03.480 --> 01:07:09.680] broadcast okay that's for my very good close friend Michael Badneric all right
[01:07:09.680 --> 01:07:15.560] we are go ahead Randy so when you pray for someone like Michael Badneric you
[01:07:15.560 --> 01:07:21.200] got to remember be careful what you ask for might have to back might have to
[01:07:21.200 --> 01:07:26.840] back it up well well you know and this is a historical presence and I'm not
[01:07:26.840 --> 01:07:32.360] advocating money for prayer or buying prayers by any means because that's not
[01:07:32.360 --> 01:07:36.480] the way it is but you know you see you've heard the stories or you see the
[01:07:36.480 --> 01:07:40.720] caricatures of the sailors in the old days and have the the the earring you
[01:07:40.720 --> 01:07:45.360] know where that came from I looked it up it was in the left ear not the right
[01:07:45.360 --> 01:07:50.440] ear and the reason it was a left ear is because the sailors that rounded the
[01:07:50.440 --> 01:07:54.760] horn rounded Cape Horn around the tip of South America not go through the
[01:07:54.760 --> 01:08:00.600] Straits of Magellan but actually went through Drake passage and they would
[01:08:00.600 --> 01:08:05.960] generally go from west to east because that was the circumpolar current the
[01:08:05.960 --> 01:08:11.720] strongest current on the face of the planet that circles around from west to
[01:08:11.720 --> 01:08:16.280] east around Antarctica and so they would sail around Cape Horn from west to east
[01:08:16.280 --> 01:08:21.040] their left ear would face the Cape and so the reason they had the the gold
[01:08:21.040 --> 01:08:28.520] earring was not just as a as a trophy but the the legend was that the sailors
[01:08:28.520 --> 01:08:35.600] would put gold in their left ear to pay to all as an offering to the captain to
[01:08:35.600 --> 01:08:42.800] pray for their souls if they died because it was such a traumatic tumultuous
[01:08:42.800 --> 01:08:50.720] tempest around that area all the time so it was a place of great prayer so anyway
[01:08:50.720 --> 01:08:55.360] I just wanted to relate that story because I did a lot of research on that
[01:08:55.360 --> 01:08:59.480] on that recently and to relate it back to Michael Badnerich so we did pray for
[01:08:59.480 --> 01:09:03.440] him so let's pay as well so all right enough of that let's get back to Russell
[01:09:03.440 --> 01:09:07.440] you were talking about the stripping doctrine and the research I've done
[01:09:07.440 --> 01:09:13.120] before on the stripping doctrine is if you can show them the judge or the
[01:09:13.120 --> 01:09:19.320] prosecutor remember whoever come against you violated the Constitution there is
[01:09:19.320 --> 01:09:23.000] no statute of limitations when it comes to that now if these people in Texas
[01:09:23.000 --> 01:09:27.880] want to try to make some legislation saying there is I think that that would
[01:09:27.880 --> 01:09:32.680] be unconstitutional but the best thing to do is take it into federal court don't
[01:09:32.680 --> 01:09:40.280] worry about today because it strips the officials of their immunity the state
[01:09:40.280 --> 01:09:45.640] couldn't do anything to affect the federal limitations or lack of
[01:09:45.640 --> 01:09:49.600] limitations right so they wouldn't make any difference what state did I mean
[01:09:49.600 --> 01:09:54.280] they may be able to borrow the state constitution but they'd have nothing say
[01:09:54.280 --> 01:09:59.800] about said the beautiful part about this is is is they can't the state can't get
[01:09:59.800 --> 01:10:05.360] involved when you sue them individually you cannot name the state and they also
[01:10:05.360 --> 01:10:11.040] cannot provide counsel for these people and I got one in federal court right now
[01:10:11.040 --> 01:10:15.920] waiting to see if the federal judge is going to allow it to proceed but if he
[01:10:15.920 --> 01:10:19.840] does then when I serve the parties I fully expect the Texas Attorney General
[01:10:19.840 --> 01:10:25.720] to turn around answer and then I'm going to put my objection in because they can't
[01:10:25.720 --> 01:10:29.780] answer because they're being sued in their individual capacity and they don't
[01:10:29.780 --> 01:10:34.120] have humidity then yeah well then you want to add the Attorney General for
[01:10:34.120 --> 01:10:40.720] embezzlement exactly right but that's what we did here in Travis County over
[01:10:40.720 --> 01:10:46.360] a credit card issue sued the judge for lack of subject matter jurisdiction
[01:10:46.360 --> 01:10:51.000] county attorney answered to suit for him so we counted cross-complained against
[01:10:51.000 --> 01:10:56.000] the county attorney then I think if they did respond then you could possibly bring in the
[01:10:56.000 --> 01:11:00.600] state in the action because of it I don't know if that's true but I'm waiting
[01:11:00.600 --> 01:11:06.760] to see what happens but the stripping doctor and it's not a stripper doctor
[01:11:06.760 --> 01:11:11.480] it's a stripping doctor if you google it it'll come up and it'll be a big
[01:11:11.480 --> 01:11:15.880] Wikipedia page about it yeah I've been looking at that a whole lot here the
[01:11:15.880 --> 01:11:21.680] last week or so along with some other stuff that I'm looking at because right
[01:11:21.680 --> 01:11:26.440] now we've got a police officer and a judge that we're going after in a case
[01:11:26.440 --> 01:11:32.720] for a kid that's being charged with a DUI a misdemeanor offense yet when the cop
[01:11:32.720 --> 01:11:37.480] arrested him the kid had been asleep in his car for a little over an hour well
[01:11:37.480 --> 01:11:41.320] being a misdemeanor there is no authority in law for the officer to
[01:11:41.320 --> 01:11:46.200] arrest without a warrant he cannot arrest unless the offense was committed
[01:11:46.200 --> 01:11:53.560] in his presence and it wasn't but he arrested the kid anyway I think if you I
[01:11:53.560 --> 01:11:57.080] think you could probably file that in federal court and before it even goes
[01:11:57.080 --> 01:12:02.840] through that that whole thing will be dropped against the kid well that's
[01:12:02.840 --> 01:12:07.840] entirely possible but we're like it sounds like a good strategy yeah but I
[01:12:07.840 --> 01:12:11.160] think you have to do it in the Fed not the state because the state people are
[01:12:11.160 --> 01:12:15.880] just protect each other and I'm you know to some degree I think the federal
[01:12:15.880 --> 01:12:20.040] will protect them too but when you got a such an outright violation they're not
[01:12:20.040 --> 01:12:23.240] gonna want that public they're not going to be watered brought to court and stuff
[01:12:23.240 --> 01:12:26.860] yeah but you know me Russell I'm all about making it public no matter what
[01:12:26.860 --> 01:12:33.720] they like yeah I know now I like to get back to what Brian I had my friend Brian
[01:12:33.720 --> 01:12:39.680] call in about sure if you and when I called Randy about a week ago and told
[01:12:39.680 --> 01:12:43.000] him about this I mean Randy laughed so hard I thought I didn't think I'd ever
[01:12:43.000 --> 01:12:46.720] going to get him back on the phone and he goes oh we got to tell Eddie about
[01:12:46.720 --> 01:12:53.880] this and I said no we're not we're gonna wait till on the air and so I think if
[01:12:53.880 --> 01:12:59.040] you go into court and it depends on you and how you explain this because what I
[01:12:59.040 --> 01:13:01.760] think is going to happen is some of the judge is going to turn around and say
[01:13:01.760 --> 01:13:06.440] oh this guy's wacko we need to we need to put him away for six months and see
[01:13:06.440 --> 01:13:11.840] and have him checked out but if you actually I've made that argument to a
[01:13:11.840 --> 01:13:15.680] judge I've asked them to bring somebody in that knows what the words mean
[01:13:15.680 --> 01:13:20.440] because obviously the prosecution didn't because they wanted to argue that it
[01:13:20.440 --> 01:13:24.320] didn't say something I'll even had the judge say the statute didn't say what it
[01:13:24.320 --> 01:13:28.520] said even when I showed it to him he want to say it's not what it means I'm
[01:13:28.520 --> 01:13:34.680] going like are you stupid it says right there that's what it means and here's
[01:13:34.680 --> 01:13:38.960] the dictionary and still you don't understand what's going on I want a new
[01:13:38.960 --> 01:13:46.280] judge bring me howdy duty he's got more brains right but the premise of this
[01:13:46.280 --> 01:13:50.120] whole thing is it's not just what the statute says it's what the court is
[01:13:50.120 --> 01:13:56.080] actually doing and I had to do my petition for rehearing which I had to
[01:13:56.080 --> 01:14:00.720] file I think it was last month I last I sent it last Monday it had to be there
[01:14:00.720 --> 01:14:06.240] you know by postmark by Tuesday but under the Supreme Court rules you have
[01:14:06.240 --> 01:14:12.240] grounds that not previously addressed and I put that specifically look the
[01:14:12.240 --> 01:14:19.520] last of the of my pleading that I was only schooled under the common English
[01:14:19.520 --> 01:14:24.040] language and that the courts the prosecution and the defense attorneys
[01:14:24.040 --> 01:14:29.400] when I had them committed fraud against me by not disclosing that they use legal
[01:14:29.400 --> 01:14:36.320] ease against me and I did not have a certified translator to tell me what
[01:14:36.320 --> 01:14:45.720] legalese meant so I was defrauded by the entire court system in the believing
[01:14:45.720 --> 01:14:52.400] that I had to represent that corporation that actually got indicted and that's
[01:14:52.400 --> 01:14:58.760] that's what I tacked on doing into my petition to the Supreme Court by
[01:14:58.760 --> 01:15:03.240] talking to Brian oh that'll be interesting if they pick that up well if
[01:15:03.240 --> 01:15:06.280] they pick that up I think that's going to be the reason why it gets picked up
[01:15:06.280 --> 01:15:09.440] because like I told when I talked to Ruth at the Supreme Court she said these
[01:15:09.440 --> 01:15:14.800] things are very rarely ever granted even though me and you know damn good will
[01:15:14.800 --> 01:15:20.120] that you know we put in the their own case law and they still denied my
[01:15:20.120 --> 01:15:28.160] petition for the writ of certiorari so if it's all of a sudden gets taken then I
[01:15:28.160 --> 01:15:34.280] know it has to do with those two issues I raised from grounds previously not not
[01:15:34.280 --> 01:15:42.400] taken before the court and that's a good point because the English language is
[01:15:42.400 --> 01:15:49.080] ambiguous enough when someone is speaking clearly and cogently but it's
[01:15:49.080 --> 01:15:54.520] kind of like Brian said you know you go into a room and you're you're called in
[01:15:54.520 --> 01:15:58.200] there and you're playing a monopoly game but then when you really look at the
[01:15:58.200 --> 01:16:04.480] guy again it's it's checker game it's not monopoly and that's does not mean
[01:16:04.480 --> 01:16:09.880] that's probably the simplest way of describing it because you're going in
[01:16:09.880 --> 01:16:13.600] there thinking that you know how to play the game and you're going to go in there
[01:16:13.600 --> 01:16:18.280] and say hey I'm here to play I'm here to play the monopoly game and then when
[01:16:18.280 --> 01:16:22.440] you sit down and you start doing doing the thing you find out it's a game of
[01:16:22.440 --> 01:16:30.920] checkers well who defrauded who here who did not disclose all the facts yeah I
[01:16:30.920 --> 01:16:37.680] certainly like the idea of this because it goes to a common problem it goes to
[01:16:37.680 --> 01:16:46.500] a common tool that attorneys use to defraud especially process and they do
[01:16:46.500 --> 01:16:50.760] the same thing to the judge say they lie that light of the judge by
[01:16:50.760 --> 01:16:54.360] misinformation and innuendo okay we'll be right back Randy I don't know if you
[01:16:54.360 --> 01:16:57.080] can hear the music we're about to go off to break we'll be right back hold on the

[01:18:18.360 --> 01:18:29.800] 125 spurred ups of rule of law coming at you people who studied oceanography knows
[01:18:29.800 --> 01:18:38.720] what that means that's the strength of the current around Antarctica and to put
[01:18:38.720 --> 01:18:45.480] it in perspective what that means all the oceans in the world emptying out into
[01:18:45.480 --> 01:18:50.120] the ocean I mean I'm sorry all the rivers of the world emptying out into the
[01:18:50.120 --> 01:18:58.560] ocean only amounts for one spurred up and that current around Antarctica is 125
[01:18:58.560 --> 01:19:03.760] so that's what we're coming at you with here on rule of law all right we're we're
[01:19:03.760 --> 01:19:09.480] going to continue this conversation with Russell after we take Leonard from Texas
[01:19:09.480 --> 01:19:15.680] first time caller Leonard thanks for calling in what's on your mind tonight
[01:19:15.680 --> 01:19:20.560] yes good evening I like to first of all say thank you and I appreciate your
[01:19:20.560 --> 01:19:25.920] broadcast Randy and Deborah and I'm calling about a classy Mr. Meener
[01:19:25.920 --> 01:19:34.000] traffic ticket that has been outstanding for since 2007 now can you explain to me
[01:19:34.000 --> 01:19:41.000] the statute of limitations on something like that two years two years and Texas
[01:19:41.000 --> 01:19:45.000] is two years it should be the same in Colorado as most of the states are pretty
[01:19:45.000 --> 01:19:51.000] well identical across the board on that but yeah they have two years from the
[01:19:51.000 --> 01:19:58.880] day to the offense or up to that amount of time to file the actual complaint
[01:19:58.880 --> 01:20:04.520] okay so what direction do I need to go to see if I can get this dismissed
[01:20:04.520 --> 01:20:11.000] because of the complaint while a motion with the court to dismiss too old to
[01:20:11.000 --> 01:20:18.440] prosecute too old to prosecute okay actually the two-year statute that's
[01:20:18.440 --> 01:20:24.440] from the date of the offense until a complaint is filed if an officer gave
[01:20:24.440 --> 01:20:32.760] you a citation speedy speedy trial clock started that day okay and while the
[01:20:32.760 --> 01:20:39.000] speedy trial statute in Texas has been overturned the right to a speedy trial
[01:20:39.000 --> 01:20:42.840] hasn't but the courts want to act like your right to speedy trial somehow
[01:20:42.840 --> 01:20:50.800] disappeared I think so you have to claim your right to speedy trial otherwise you
[01:20:50.800 --> 01:20:58.960] waive it so thing to do is file a motion to dismiss violation speedy trial too
[01:20:58.960 --> 01:21:06.200] old to prosecute okay the next question would be on the failure to appear oh you
[01:21:06.200 --> 01:21:11.280] have a failure to appear yes unfortunately that changes everything
[01:21:11.280 --> 01:21:22.360] okay on the failure to appear the clock stopped I see since it wasn't the court
[01:21:22.360 --> 01:21:30.000] that caused this delay it was you mm-hmm so until you make another appearance the
[01:21:30.000 --> 01:21:37.960] clocks not running okay now I called and spoke with the judge last weekend what
[01:21:37.960 --> 01:21:48.480] they absolutely are going to do is go ahead and send me another let's see to
[01:21:48.480 --> 01:21:56.760] either you know no contest or plead guilty a plea lay down roll over give us
[01:21:56.760 --> 01:22:05.120] the money that's all we care about what was your traffic ticket I'm a truck
[01:22:05.120 --> 01:22:10.600] driver and I was on my way to Houston over there in Brookshire Texas and the
[01:22:10.600 --> 01:22:18.560] ticket was for violating the license plate display expired license plate at
[01:22:18.560 --> 01:22:23.840] the time does it actually charge you an offense on the ticket in other words a
[01:22:23.840 --> 01:22:29.840] violation of a statute or code or does it just say you know how to out of a
[01:22:29.840 --> 01:22:35.920] license plate expired or whatever I don't have the original ticket in front
[01:22:35.920 --> 01:22:40.560] of me but see what they did send me it just says displayed expired license plate
[01:22:40.560 --> 01:22:45.880] and that's what the charge is but this was on an actual commercial vehicle yes
[01:22:45.880 --> 01:22:55.760] sir okay guess what odds are very very good you're stuck yeah and that's what I
[01:22:55.760 --> 01:23:00.840] was gonna say and since it's not a moving violation mm-hmm this really goes
[01:23:00.840 --> 01:23:08.880] down to what's it worth what's your time worth okay this one you know we fight
[01:23:08.880 --> 01:23:17.280] these things when the other side is acting improperly but there is one
[01:23:17.280 --> 01:23:28.160] question who gave you the citation okay it was a DPS or DPS okay they got you
[01:23:28.160 --> 01:23:34.640] that was here in Texas and yes here in Texas yeah that that is the venue of the
[01:23:34.640 --> 01:23:38.320] Department of Public Safety is to regulate commercial and for hire
[01:23:38.320 --> 01:23:43.360] traffic on Texas roadways you were in a commercial vehicle on a Texas roadway
[01:23:43.360 --> 01:23:50.200] they got you dead to rights if if in fact your plate was expired okay yeah so
[01:23:50.200 --> 01:23:56.000] if you were just a traveler we'd have a big fight to throw out yeah if you
[01:23:56.000 --> 01:23:59.440] were in your car doing nothing more than traveling down here and have gotten the
[01:23:59.440 --> 01:24:03.760] ticket that would be a different story okay wait one other question yes sir
[01:24:03.760 --> 01:24:10.840] were you loaded no got him oh no wait a minute was he going to pick up a load
[01:24:10.840 --> 01:24:15.120] doesn't matter coming to Texas and he's from yes it does if he's getting paid to
[01:24:15.120 --> 01:24:23.200] make that trip yes it does when he's dead head no fortunately I was dead
[01:24:23.200 --> 01:24:28.360] heading up there to pick up a load okay so you weren't getting mileage on the
[01:24:28.360 --> 01:24:37.320] trip to get the load no did you clean yeah that now you can fight okay so you
[01:24:37.320 --> 01:24:43.320] were traveling traveling with the intent of going doing some commercial
[01:24:43.320 --> 01:24:49.960] hauling time you weren't again Russell if he hasn't been properly charged by
[01:24:49.960 --> 01:24:54.360] the ticket he still has a fight yeah just like you might see what's on the
[01:24:54.360 --> 01:25:00.600] ticket you might want to get it Eddie's traffic course okay because just like on
[01:25:00.600 --> 01:25:05.400] my tickets they charged me with this and this but yet then I just didn't show up
[01:25:05.400 --> 01:25:09.920] and a year later they sent me a letter to show up I show up then all of a
[01:25:09.920 --> 01:25:14.280] sudden they filed a complaint the affidavits from the policeman well I
[01:25:14.280 --> 01:25:18.360] went away the year without an official complaint against me and that's too old
[01:25:18.360 --> 01:25:29.200] to prosecute question yes when you were traveling from your point of origin to
[01:25:29.200 --> 01:25:35.200] the point of picking up the load did that go in your log book yes then they
[01:25:35.200 --> 01:25:39.720] have you I was going to say let's make a clear distinction here on what dead
[01:25:39.720 --> 01:25:47.240] heading really means because if he was somehow being paid to go pick up the
[01:25:47.240 --> 01:25:54.040] loads then that is commercial activity yeah generally the time that you
[01:25:54.040 --> 01:25:58.520] don't have to log is not commercial yeah if you're logging it then you're you're
[01:25:58.520 --> 01:26:04.280] on the clock that's commercial it's not like if you were say an
[01:26:04.280 --> 01:26:10.520] entrepreneur or somebody who was self-employed and and you weren't
[01:26:10.520 --> 01:26:16.000] getting paid for the mileage you know or logging it to actually go pick it up and
[01:26:16.000 --> 01:26:21.320] you're only getting paid for the time that you were you know transporting the
[01:26:21.320 --> 01:26:26.940] load you know that's a different story are you owner-operator yes Debra hit it
[01:26:26.940 --> 01:26:32.480] right on the on the head there I am a owner-operator then what is with the
[01:26:32.480 --> 01:26:38.600] logging when you're going to pick it up then who's paying you to do that well
[01:26:38.600 --> 01:26:44.880] when it comes to the logging by federal statute I can't explain to you which one
[01:26:44.880 --> 01:26:51.080] but yeah he has to keep the law he's not he's only allowed but he is the he's
[01:26:51.080 --> 01:26:59.240] only he only has to log if he's actually in in commercial operation right if he's
[01:26:59.240 --> 01:27:04.040] driving around the neighborhood in his rig he don't have to log that do you
[01:27:04.040 --> 01:27:10.200] have to log your time from your last drop-off driving home yes from my
[01:27:10.200 --> 01:27:15.840] understanding even if we drive around the block we should we were supposed to
[01:27:15.840 --> 01:27:22.720] show on duty driving no that's not true you only have to show on duty when
[01:27:22.720 --> 01:27:29.120] you're getting paid to be on duty that's right okay but if you want to claim on
[01:27:29.120 --> 01:27:35.040] your tax return that that is part of your business then you're I guess
[01:27:35.040 --> 01:27:38.440] technically you're paying yourself that's a different story but you don't
[01:27:38.440 --> 01:27:44.720] have to log that what you can still claim the loss because you know I had my
[01:27:44.720 --> 01:27:49.700] own business and I got to claim what it cost me to get to the job yeah but the
[01:27:49.700 --> 01:27:57.200] point is we're trying to narrow down here whether that that at that point in
[01:27:57.200 --> 01:28:03.680] time when he was on the road was it commercial or was it not and if he's
[01:28:03.680 --> 01:28:07.880] going to claim in his business records a log and that was commercial well then I
[01:28:07.880 --> 01:28:12.520] don't see how he could you know have his cake and eat it too and say well no it's
[01:28:12.520 --> 01:28:18.600] traveling I mean yeah he was traveling you I get my travel time and that's not
[01:28:18.600 --> 01:28:25.000] me acting in commerce I'm going to the job and that's what he's doing if he's
[01:28:25.000 --> 01:28:29.040] deadheading to the job he's not in commerce at this point I guess it
[01:28:29.040 --> 01:28:34.960] depends on what what the law doesn't look at that way well they don't look
[01:28:34.960 --> 01:28:39.800] at the law the way it's written they look at the way it creates the most
[01:28:39.800 --> 01:28:45.160] dollar well yeah let me ask Leonard something what does it mean when you log
[01:28:45.160 --> 01:28:49.680] something does that mean that you're claiming that mileage as a business
[01:28:49.680 --> 01:28:53.840] expense what does that mean no when you log something in it as a commercial
[01:28:53.840 --> 01:28:58.640] driver the purpose is to show one how many hours of operation you've been
[01:28:58.640 --> 01:29:03.160] engaged in because you're limited on how long you can operate that vehicle and be
[01:29:03.160 --> 01:29:08.640] considered safe right you can only operate it so many hours per day with
[01:29:08.640 --> 01:29:12.600] them and just like on on some duties where they require you to take a certain
[01:29:12.600 --> 01:29:16.760] number of breaks and so on and so forth these are things you have to keep track
[01:29:16.760 --> 01:29:20.320] us so that they can determine that you're not driving in a condition that
[01:29:20.320 --> 01:29:23.800] makes you a hazard to the public and that does not matter whether you're
[01:29:23.800 --> 01:29:30.000] traveling or earning an income yes it does it sure it sure should matter
[01:29:30.000 --> 01:29:35.620] because you're like Eddie said you're logging the amount of hours that you
[01:29:35.620 --> 01:29:42.240] were driving oh they only have authority over the time you're in commerce so what
[01:29:42.240 --> 01:29:47.800] if you were traveling then you don't have to log it they don't okay well let's
[01:29:47.800 --> 01:29:50.880] talk about this some more on the other side this is really important okay
[01:29:50.880 --> 01:29:54.800] Leonard stay on the line okay sure well thank you and Russell too we'll be right
[01:29:54.800 --> 01:29:56.920] back

[01:31:17.120 --> 01:31:23.320] okay we're getting into the fine point of law here what is the deal with a log
[01:31:23.320 --> 01:31:29.920] and Eddie we were talking on the break concerning the log hours and that the
[01:31:29.920 --> 01:31:36.680] hours of operation are required to be logged but if you are a self-employed
[01:31:36.680 --> 01:31:44.680] sole proprietor you own the the the vehicle whatever I mean you're not
[01:31:44.680 --> 01:31:53.840] required by law to log commercially those hours of those miles if you're not
[01:31:53.840 --> 01:31:59.960] being paid for it so what's the deal don't log it then you're traveling well
[01:31:59.960 --> 01:32:06.400] the difference is once again what the law says versus what these guys do they
[01:32:06.400 --> 01:32:13.560] are not wanting the same thing is the is the presumption that if you have a 18
[01:32:13.560 --> 01:32:19.160] wheeler every second that you're behind that wheel or whatever you want to call
[01:32:19.160 --> 01:32:24.480] it legalese that that's commercial that's exactly what exactly right because
[01:32:24.480 --> 01:32:28.080] he's got a commercial driver's license he's driving commercial truck whether
[01:32:28.080 --> 01:32:33.200] or not he's making money during that time they're trying to find out whether
[01:32:33.200 --> 01:32:36.400] and I can't remember what the law says but the law says you have to have so
[01:32:36.400 --> 01:32:42.200] many hours off a day so if it's 10 hours then he or save eight hours then he's
[01:32:42.200 --> 01:32:47.720] got a he's got an account for 16 hours okay but the time he's deadheading he's
[01:32:47.720 --> 01:32:53.560] off the clock so he's traveling for eight hours without getting paid and
[01:32:53.560 --> 01:32:57.680] he'll have to log that eight hours so they could determine whether he had the
[01:32:57.680 --> 01:33:04.360] proper time off look of driving that truck right he can log the hours doesn't
[01:33:04.360 --> 01:33:08.000] make him commercially active that's right that was kind of what I was hoping
[01:33:08.000 --> 01:33:14.080] wait a minute what statute requires the federal people to log every second of
[01:33:14.080 --> 01:33:18.520] their day the federal statutes do because the log book the odometer on the
[01:33:18.520 --> 01:33:21.840] truck wheels and the trailer and everything else have to all match up
[01:33:21.840 --> 01:33:25.720] when it's all said and done so otherwise they're going to call him
[01:33:25.720 --> 01:33:30.960] running black if he's running black that means he's running hours and time that
[01:33:30.960 --> 01:33:35.600] he's not logging they can't account for that time where he was what he was doing
[01:33:35.600 --> 01:33:40.280] as far as his condition and so on and so forth they don't like that well wait a
[01:33:40.280 --> 01:33:45.280] minute is for a safety measure for the public well what is this running black
[01:33:45.280 --> 01:33:48.840] thing I mean is there a federal statute that if you are going to own or operate
[01:33:48.840 --> 01:33:55.560] or whatever a this kind of commercial vehicle that you are required by federal
[01:33:55.560 --> 01:34:02.000] statute to log every second of your life not of your life but of the operation of
[01:34:02.000 --> 01:34:07.160] that vehicle whether it's in commerce or not all all of the trailers and the
[01:34:07.160 --> 01:34:14.600] trucks have axle odometers on them okay they measure where that how far those
[01:34:14.600 --> 01:34:20.160] individual units have traveled okay and so on and so forth they account for
[01:34:20.160 --> 01:34:25.080] these things for obvious reasons to make them safe for the public because they do
[01:34:25.080 --> 01:34:28.280] this and the reason I know all this is we used to have a little three truck
[01:34:28.280 --> 01:34:33.200] trucking company so I'm familiar with how this works but when we used to call
[01:34:33.200 --> 01:34:38.000] it running black running black is when you're doing something that you don't
[01:34:38.000 --> 01:34:42.560] want to put in the logbook normally either because it's not because it's
[01:34:42.560 --> 01:34:46.480] illegal but it's simply because it's got nothing to do with the business
[01:34:46.480 --> 01:34:51.360] basically you know you're taking the truck with you because you're going to
[01:34:51.360 --> 01:34:54.880] pick up a load in Arkansas but if you're going to go visit the family over the
[01:34:54.880 --> 01:34:59.720] weekend or something and pick the load up on Monday or Tuesday well normally we
[01:34:59.720 --> 01:35:05.720] wouldn't have to log the time going up there in the truck for that weekend we
[01:35:05.720 --> 01:35:09.640] only had to log the time when we went to pick the trailer up on Monday or Tuesday
[01:35:09.640 --> 01:35:15.640] and we used to call that running black now they want to know where it is all the
[01:35:15.640 --> 01:35:20.160] time if it's on the road and whether or not he is actually using it for the
[01:35:20.160 --> 01:35:25.240] purposes of commerce whether it be interstate or interest state those logs
[01:35:25.240 --> 01:35:31.160] those log odometers and everything else have to match up over time they have to
[01:35:31.160 --> 01:35:35.640] be able to account for this stuff know where these vehicles are and all in all
[01:35:35.640 --> 01:35:39.640] for the commercial side of it I don't have a problem with that because they
[01:35:39.640 --> 01:35:45.240] use that for maintenance records service request requirements and generally
[01:35:45.240 --> 01:35:49.200] safety checks on these vehicles to make sure that they're not in a condition
[01:35:49.200 --> 01:35:52.640] that's going to allow them to fail I mean I went to garrison here about three
[01:35:52.640 --> 01:35:57.480] weeks ago there was a semi box trailer broken cleaned in two right in the middle
[01:35:57.480 --> 01:36:01.760] of the highway why because it hadn't been inspected in a year and a half and
[01:36:01.760 --> 01:36:06.400] it had a frame break from an oversized load someone had packed in it and the
[01:36:06.400 --> 01:36:10.080] guy and the frame on it was broke the guy hit a dip in the highway and the
[01:36:10.080 --> 01:36:14.600] whole loaded trailer shattered now because it hadn't been inspected no one
[01:36:14.600 --> 01:36:20.480] was checking the logs on that's why they do it had there been somebody running
[01:36:20.480 --> 01:36:25.160] just behind this guy at the time they'd have been killed with what come pouring
[01:36:25.160 --> 01:36:29.920] out of thing when half that box trailer went rolling over in the highway that's
[01:36:29.920 --> 01:36:36.120] why they do it well I don't know that's an argument for government regulation I
[01:36:36.120 --> 01:36:41.840] mean it's a pretty strong case but I guess my main question is is it illegal
[01:36:41.840 --> 01:36:46.960] or is it against federal statute at this point to run black as you're calling it
[01:36:46.960 --> 01:36:51.240] Eddie if he's running completely interstate no federal statutes would
[01:36:51.240 --> 01:36:54.560] have no applicability then the state statutes would be the only one that
[01:36:54.560 --> 01:36:59.040] applies but since he's traveling from Colorado to Texas federal statutes
[01:36:59.040 --> 01:37:05.440] apply oh you said enter you meant intra intra that intra would only be if he was
[01:37:05.440 --> 01:37:11.200] within Texas interstate he went from Colorado to Texas so your federal rules
[01:37:11.200 --> 01:37:17.680] apply so according to federal statute you cannot run black interstate in these
[01:37:17.680 --> 01:37:20.680] kinds of commercial vehicles is what you're saying right all right that's
[01:37:20.680 --> 01:37:27.160] very back to his tickets I would I would agree with you guys if his ticket
[01:37:27.160 --> 01:37:32.920] actually charged him with an offense in other words a statute or code now if
[01:37:32.920 --> 01:37:37.160] they just write some bull on that ticket that he hasn't probably properly charged
[01:37:37.160 --> 01:37:43.440] even administratively no then he can fight it commercial or non-commercial
[01:37:43.440 --> 01:37:50.680] but if he was properly charged they basically got him so was he properly
[01:37:50.680 --> 01:37:55.240] charged well that he'd have to look at the ticket and see if the ticket
[01:37:55.240 --> 01:38:02.720] actually spelled out a violation of the code or statute yes and this this
[01:38:02.720 --> 01:38:08.400] particular citation seems pretty clear I mean it's not ambiguous failure to
[01:38:08.400 --> 01:38:13.440] maintain registration I mean that can't be it's hard to confuse what that means
[01:38:13.440 --> 01:38:20.840] well yeah but the thing is because charging you with something the officer
[01:38:20.840 --> 01:38:25.160] may save what he thinks the charge should be but that's not a charge that
[01:38:25.160 --> 01:38:29.920] exists in statute it's it's irrelevant well my concern is is I read some case
[01:38:29.920 --> 01:38:41.760] law that says that the accusation just has to clearly define the action yeah
[01:38:41.760 --> 01:38:47.040] they were getting that you don't have to state what the specific statute you're
[01:38:47.040 --> 01:38:53.280] accusing them of violating is so long as he is advised of what action he took
[01:38:53.280 --> 01:38:58.000] that was illegal now I didn't like seeing that because I wanted to see tell
[01:38:58.000 --> 01:39:02.120] me what statute I violated so I know how to defend myself exactly that's what I
[01:39:02.120 --> 01:39:06.840] found in the case law is they weren't quite that well wait a minute Randy was
[01:39:06.840 --> 01:39:12.240] that was that within the parameter or the concept or the context of some kind
[01:39:12.240 --> 01:39:19.840] of violation of commercial law well if it's on traffic it was always commercial
[01:39:19.840 --> 01:39:24.520] well I'm asking about the case all that you're citing was this in the context of
[01:39:24.520 --> 01:39:29.720] commercial law because this wasn't in the context of traffic it was in the
[01:39:29.720 --> 01:39:36.040] context of making accusations and the sufficiency already excuse me now is that
[01:39:36.040 --> 01:39:43.080] a I am a registered intrastate carrier and not an interstate carrier at that
[01:39:43.080 --> 01:39:48.440] time would that make a difference because I don't know not particularly
[01:39:48.440 --> 01:39:51.800] because the feds have delegated the authority to the state for those
[01:39:51.800 --> 01:39:59.280] purposes okay that's what the administrative codes all about in a lot
[01:39:59.280 --> 01:40:05.480] of places is where title 49 which is the federal statutes dealing with commerce
[01:40:05.480 --> 01:40:15.960] on the highways is located and how Texas has adopted those but what Russell's
[01:40:15.960 --> 01:40:19.880] saying the the reason I say what I said Randy is because the case law dealing
[01:40:19.880 --> 01:40:23.800] with the driver's license is the perfect example all these people were getting
[01:40:23.800 --> 01:40:28.200] charged with the offense of no driver's license yet there existed nothing in
[01:40:28.200 --> 01:40:33.440] Texas law for no driver's license there was an offense of no operators license
[01:40:33.440 --> 01:40:38.920] but there was no such offense as no driver's license why because there was
[01:40:38.920 --> 01:40:43.400] no such thing to find in law at that time as a driver's license yeah yeah well
[01:40:43.400 --> 01:40:49.760] that fitted fit within the parameters of this legislative of this case law it
[01:40:49.760 --> 01:40:57.200] said it had to clearly describe the the nature of the criminal action and in
[01:40:57.200 --> 01:41:01.680] this case it it clearly defined the nature of the action the person was
[01:41:01.680 --> 01:41:07.840] being charged with so you can look at the charge and say well the action that
[01:41:07.840 --> 01:41:13.040] he's charged me with doesn't fall under any law well what I wanted to see don't
[01:41:13.040 --> 01:41:18.320] just tell me the action tell me what law you're accusing that action of violating
[01:41:18.320 --> 01:41:22.640] but the case law didn't require that well that's why I was asking you Randy
[01:41:22.640 --> 01:41:27.680] if this was in the context of some kind of commercial regulation because well
[01:41:27.680 --> 01:41:34.880] like say for example maybe this isn't directly related or analogous but one
[01:41:34.880 --> 01:41:39.360] time I got a ticket in Maine in the state of Maine and when I went to
[01:41:39.360 --> 01:41:45.680] traffic court apparently the law at that time was that they didn't have to prove
[01:41:45.680 --> 01:41:52.400] beyond a shadow of a doubt 99 percent that I had been speeding they only had
[01:41:52.400 --> 01:41:56.760] to show preponderance of evidence which is 51 percent and so I'm that's why I
[01:41:56.760 --> 01:42:03.840] was asking you civilly then rather than criminal that's what I was that's where
[01:42:03.840 --> 01:42:09.440] I was getting at with this yeah in Texas it's a criminal and that means that they
[01:42:09.440 --> 01:42:14.880] have to show beyond a reasonable doubt so Randy this case law that you're citing
[01:42:14.880 --> 01:42:18.440] that you're talking about right now are we talking a civil allegation or
[01:42:18.440 --> 01:42:24.320] actual criminal we're talking criminal is that Texas case law that was Texas
[01:42:24.320 --> 01:42:27.840] case law well we got to do something about that yeah I was unhappy with it
[01:42:27.840 --> 01:42:32.240] I had to do you know we got to do what we got to deal with we really need to get
[01:42:32.240 --> 01:42:36.160] moving on we have a lot of colors well I know we have a lot of colors but this is
[01:42:36.160 --> 01:42:42.520] really important yeah well the thing is is he's going to have a real hard time
[01:42:42.520 --> 01:42:47.040] making the argument but now you need to look at the ticket look at the ticket
[01:42:47.040 --> 01:42:51.280] and see what it says exactly if possible make a scan of it and email it to me you
[01:42:51.280 --> 01:42:56.480] can get my address off the rule of law website okay all right and I'll
[01:42:56.480 --> 01:43:00.960] correspond with you and tell you what I can figure out about what you what chance
[01:43:00.960 --> 01:43:05.800] you do or don't have okay and again guys thank you
[01:43:05.800 --> 01:43:12.560] Randy Debra and I enjoy the show thank you thank you mm-hmm okay we are going

[01:46:23.640 --> 01:46:28.680] what's on your mind Russell I thought you were still barred from all federal
[01:46:28.680 --> 01:46:36.120] courtrooms Russell drops off no did he he's not exactly barred he just has to
[01:46:36.120 --> 01:46:43.840] ask permission politely and for Russell asking politely that's tough is Russell
[01:46:43.840 --> 01:46:52.360] declared a vexatious litigants no I think he was declared an annoying litigant I
[01:46:52.360 --> 01:46:59.640] wish he was still here so he could defend himself Russell don't worry me I
[01:46:59.640 --> 01:47:08.200] can run faster scared than he can mad I'm not gonna I'm not gonna get into that
[01:47:08.200 --> 01:47:14.440] Mark what what else you got for us well I didn't realize that you were such an
[01:47:14.440 --> 01:47:19.760] expert on maritime customs I had a question for you why why do some of the
[01:47:19.760 --> 01:47:25.720] sailors wear the earring in the right ear well according to my research I is
[01:47:25.720 --> 01:47:32.280] because they sailed around no because they sailed around Cape Horn in the
[01:47:32.280 --> 01:47:38.400] opposite direction it was actually more of an honor and a trophy so to speak
[01:47:38.400 --> 01:47:42.080] because they that would mean that they had their right ear facing towards the
[01:47:42.080 --> 01:47:47.680] Cape sailing east to west which is extremely dramatic because like I said
[01:47:47.680 --> 01:47:54.280] the 125 subverts ups the most intense ocean current one of the most intense
[01:47:54.280 --> 01:47:58.840] currents on the planet and the the winds 80 miles an hour that go around it's
[01:47:58.840 --> 01:48:05.800] like a it's like a top you know like a gyroscope man I mean so to go the
[01:48:05.800 --> 01:48:09.960] opposite direction was pretty intense so that would if you are sailor back in
[01:48:09.960 --> 01:48:14.720] those days and had a ring in the right ear that means that you really were
[01:48:14.720 --> 01:48:19.600] something to go the other direction from that Cape those were the guys going the
[01:48:19.600 --> 01:48:24.680] wrong way right yeah yeah I think those are the guys who like the other so that's
[01:48:24.680 --> 01:48:30.280] what happened that's what happened with the mutiny on the bounty because they
[01:48:30.280 --> 01:48:36.960] the captain Bligh oh man okay now you want me to get into it okay I'll give
[01:48:36.960 --> 01:48:42.800] I'll try to give a short version Jerry and I talked about this mutiny on the
[01:48:42.800 --> 01:48:45.960] bouncy people you got it you got to hear this
[01:48:45.960 --> 01:48:51.760] Captain Bligh this is this is a classic story of public-private partnership how
[01:48:51.760 --> 01:48:56.480] the whole thing started with some private plantation prison planet
[01:48:56.480 --> 01:49:04.760] plantation slave owner in Jamaica wanted to bring breadfruit plants from Tahiti
[01:49:04.760 --> 01:49:11.040] to Jamaica as some kind of a free you know you know cheap means to feed the
[01:49:11.040 --> 01:49:17.440] slaves and so instead of hiring you know a private contractor they made some kind
[01:49:17.440 --> 01:49:22.200] of a deal with the Navy the British Navy so they get this guy Captain Bligh right
[01:49:22.200 --> 01:49:30.440] but because of his Admiralty duties they set sail late in the season and they
[01:49:30.440 --> 01:49:34.200] weren't there was oh there's like a small window of time where you could go
[01:49:34.200 --> 01:49:38.360] around the tip of South America from east to west and they missed the window
[01:49:38.360 --> 01:49:43.600] because they were late because of Captain Bligh's you know Navy duties or
[01:49:43.600 --> 01:49:50.240] whatever and so apparently the whole crew was outraged because they couldn't
[01:49:50.240 --> 01:49:55.960] sail around around the horn so they had to they had a month they tried and so
[01:49:55.960 --> 01:50:01.840] then they had to turn tail and go all the way around Africa and Australia they
[01:50:01.840 --> 01:50:07.160] had to they had to follow the current and then by time many months before five
[01:50:07.160 --> 01:50:11.480] months later they finally got to Tahiti then they were late in the season to
[01:50:11.480 --> 01:50:16.000] harvest the breadfruit plants okay so then they had to wait five months and
[01:50:16.000 --> 01:50:19.640] you know of course all the crew by then they've got wives and everything else
[01:50:19.640 --> 01:50:24.560] in Tahiti and then okay now they want to take the bread now Bligh's like come on
[01:50:24.560 --> 01:50:27.760] we got to go we got to take the breadfruit plants back to Jamaica and I'll
[01:50:27.760 --> 01:50:31.720] tell you they did not want to go right I don't know why they even agreed to go
[01:50:31.720 --> 01:50:36.440] to the first place but anyway the whole thing they ended up leaving then the
[01:50:36.440 --> 01:50:41.360] mutiny on the bounty thing happened okay and you can read the story about the
[01:50:41.360 --> 01:50:45.360] rest of the details about that part but I'm going to skip ahead in the story
[01:50:45.360 --> 01:50:52.280] Bligh and some of the people ended up getting back to England and then you've
[01:50:52.280 --> 01:50:57.000] got you will not believe this the plantation owner he still insisted on
[01:50:57.000 --> 01:51:04.280] the breadfruit plants for his slaves and so they set out again a second time to
[01:51:04.280 --> 01:51:09.840] go to get the breadfruits from Tahiti for the slaves in Jamaica I'm telling you
[01:51:09.840 --> 01:51:16.160] you could not make up this story all right so they finally ended up getting
[01:51:16.160 --> 01:51:22.760] the breadfruits two thousand some plus breadfruit plants and get this the
[01:51:22.760 --> 01:51:27.080] moral of the story is by the time they got the breadfruit plants to Jamaica
[01:51:27.080 --> 01:51:35.120] finally guess what the slaves wouldn't eat them and the whole thing was a total
[01:51:35.120 --> 01:51:41.320] bomb and you know what that should be a lesson to all of us concerning slavery
[01:51:41.320 --> 01:51:47.320] the moral of the story is you just cannot force people into something this
[01:51:47.320 --> 01:51:52.160] was like a decades-long saga this mutiny on the bounty thing and the breadfruit
[01:51:52.160 --> 01:51:55.920] plants I can't believe it's what happened and people were killing each
[01:51:55.920 --> 01:52:02.120] other on on the Isle of Piccairn is ridiculous and people died people were
[01:52:02.120 --> 01:52:06.640] enslaved the people selling their wives off to each other all these kinds of
[01:52:06.640 --> 01:52:13.240] things drownings hangings all because of this plantation prison planet owner
[01:52:13.240 --> 01:52:19.880] wanting cheap free food for slaves on Jamaica and insisting on bringing him
[01:52:19.880 --> 01:52:25.600] from Tahiti and also I think is just to show off like oh I've got the bread
[01:52:25.600 --> 01:52:30.160] fruits from Tahiti you know to try to dig up himself to the other plantation
[01:52:30.160 --> 01:52:35.640] owners this I'm tell you I could write a novel about this anyway I'm sorry that's
[01:52:35.640 --> 01:52:44.600] my rant the bottom line is no slavery right not a good idea and that's when it
[01:52:44.600 --> 01:52:49.480] sounds like another example of a failed public-private relationship exactly
[01:52:49.480 --> 01:52:56.840] sounds like another democracy to me yeah they probably they probably told them
[01:52:56.840 --> 01:53:02.800] they could vote well the best part of it for me was that they wouldn't eat the
[01:53:02.800 --> 01:53:08.640] plants okay go ahead yeah yeah oh well here's another caveat to that story
[01:53:08.640 --> 01:53:13.040] Deborah even back then they would ship in British dieticians to those islands
[01:53:13.040 --> 01:53:16.800] and and they would figure out a diet that would make them just strong enough
[01:53:16.800 --> 01:53:21.120] to finish their work and not plan revolts or get smart or anything like
[01:53:21.120 --> 01:53:25.880] that too so maybe that's why he wanted them those particular plants to feed to
[01:53:25.880 --> 01:53:29.120] its slaves and that's probably why they wouldn't eat them either yeah good point
[01:53:29.120 --> 01:53:33.920] the whole feudalist society I mean even way way back in the days of the serfdom
[01:53:33.920 --> 01:53:39.060] and feudalist states in in England you know with Scotland and the Irish the
[01:53:39.060 --> 01:53:47.600] Celts the Lords the barons they would not allow the serfs to basically have any
[01:53:47.600 --> 01:53:51.800] kind of enjoyment or like dances or play games or anything because they didn't
[01:53:51.800 --> 01:53:56.200] want them to be happy because right if they were happy then they would start to
[01:53:56.200 --> 01:54:00.840] be healthy and then they would start to realize the oppression and do something
[01:54:00.840 --> 01:54:06.520] about it so they had to keep them in a in a downtrodden down pressed emotional
[01:54:06.520 --> 01:54:12.000] state and I'm totally against that that's what you know what that's why they
[01:54:12.000 --> 01:54:18.960] are suppressing the teaching of arts and music in the public full system because
[01:54:18.960 --> 01:54:26.040] it's historically proven that arts and music the learning of art and music goes
[01:54:26.040 --> 01:54:31.360] hand-in-hand with science engineering and mathematics and emotional health and
[01:54:31.360 --> 01:54:35.600] that's why they're robbing the children and and trying to rob all of us of arts
[01:54:35.600 --> 01:54:40.160] and music and dance and the movement arts and everything else because it
[01:54:40.160 --> 01:54:45.160] takes away from that part of your brain that the functioning that also is
[01:54:45.160 --> 01:54:50.240] conducive to learning science and mathematics and engineering because they
[01:54:50.240 --> 01:54:54.360] don't want us to figure it out that they blew up the towers
[01:54:54.360 --> 01:55:00.520] Debra you're not a fan of rap and linguistic minimalism I don't know what
[01:55:00.520 --> 01:55:08.440] that is it's the science of reducing reducing the language down to a few
[01:55:08.440 --> 01:55:12.520] words and they say because of rap and computers and that sort of things our
[01:55:12.520 --> 01:55:19.280] children are losing their vocabulary but anyway I had a question for already hey
[01:55:19.280 --> 01:55:25.160] Randy my I got I got about six thousand dollars in violations against this this
[01:55:25.160 --> 01:55:28.760] attorney and they pulled a credit report twice and I'm getting ready I'm waiting
[01:55:28.760 --> 01:55:35.880] for hard copies for my dad's credit report and I was wondering in the in the
[01:55:35.880 --> 01:55:40.240] federal rules it's up to two years in prison for each one of those violations
[01:55:40.240 --> 01:55:43.600] and I wanted to add that into the because I'm going to I'm going to send a
[01:55:43.600 --> 01:55:48.480] federal a federal complaint along with the the tort letter and I was wondering
[01:55:48.480 --> 01:55:53.480] how do I introduce that to them do I do I add that as judicial notice or do I add
[01:55:53.480 --> 01:56:01.360] that as in your in your tort letter yeah you make the make the accusations so
[01:56:01.360 --> 01:56:08.720] that your tort letter becomes the verified affidavit oh okay and you refer
[01:56:08.720 --> 01:56:15.120] to the attached criminal affidavit well I don't know if I was going to go for the
[01:56:15.120 --> 01:56:19.680] criminal I just want to shake them up so they pay off that well you what you do
[01:56:19.680 --> 01:56:25.000] is you put the criminal affidavit before the magistrate now they're not going to
[01:56:25.000 --> 01:56:30.140] want to pursue it but you put it out there and then if these guys don't come
[01:56:30.140 --> 01:56:35.040] around then you hammer the magistrate for failing to perform his duty as a
[01:56:35.040 --> 01:56:40.440] magistrate and when you start hammering the magistrate accusing the magistrate
[01:56:40.440 --> 01:56:45.600] of violation 18 years go to 42 in denying you your right to petition the
[01:56:45.600 --> 01:56:48.880] court for redress agreements the magistrate is going to go to these guys
[01:56:48.880 --> 01:56:59.120] and say do something get this guy off me I'm going to crucify you yep yep okay
[01:56:59.120 --> 01:57:03.040] and I I've got another tort letter out there for a hundred and sixty four
[01:57:03.040 --> 01:57:06.440] thousand dollars in a federal complaint I haven't filed yet I just I just sent it
[01:57:06.440 --> 01:57:11.440] to them and they they keep calling me and leaving a message and and you need
[01:57:11.440 --> 01:57:18.000] to dial a code in to get to their message machine you believe that
[01:57:22.000 --> 01:57:27.600] you mean they leave you a message is that a message to call them back yeah
[01:57:27.600 --> 01:57:35.440] they say they want to settle and then they leave me a number to nowhere that's
[01:57:35.440 --> 01:57:39.840] interesting so I guess I guess I'm just going to have to file that in a federal
[01:57:39.840 --> 01:57:44.940] court yeah then they'll make sure they get a hold of you oh yeah they'll get a
[01:57:44.940 --> 01:57:49.400] hold of me and then they'll they'll ask how come I didn't answer their their
[01:57:49.400 --> 01:57:53.840] messages and then whichever bonehead attorneys giving me this number is going
[01:57:53.840 --> 01:58:00.040] to get in trouble good but anyway I'm starting a legal club down here we're
[01:58:00.040 --> 01:58:03.480] going to handle legal affairs I want to go after we're going after the top one
[01:58:03.480 --> 01:58:09.640] or two legal firms that are raped in the Madison area as far as credit card bills
[01:58:09.640 --> 01:58:18.000] go wonderful good for you mark okay mark we're going to break do you need to tell
