[05:16.320 --> 05:24.480] but not pumping really well and so they airlifted me by helicopter to Gundersen Lutheran Hospital

[12:33.960 --> 12:45.960] the average, were retiring and two years later they died. And here I was, 23, 24, and it
[12:45.960 --> 12:48.000] terrified me.
[12:48.000 --> 13:00.360] Well, a lot of people die because they have lost a reason to live. But that is not a requirement.
[13:00.360 --> 13:06.600] My dad has been retired for 20 years and based on that same information, my brothers and
[13:06.600 --> 13:12.000] I were a little bit worried about him. We were planning to take turns each weekend taking
[13:12.000 --> 13:17.200] him out fishing or taking him here and there. Well, my dad turned into a social butterfly.
[13:17.200 --> 13:22.360] He's busier now than when he actually had a job.
[13:22.360 --> 13:30.480] Every person I know who has survived retirement tells exactly the same story. And that's a
[13:30.480 --> 13:40.160] nice segue into one of the greatest gifts my father ever gave me. And somebody may think
[13:40.160 --> 13:48.280] this is a little racist, but I absolutely is not. My father, when I was 12, took me
[13:48.280 --> 13:55.440] to see a man who fed a furnace for his room and board. He lived in the basement of a tenement
[13:55.440 --> 14:03.680] building in Chicago. And this man related to me and my father his personal experience
[14:03.680 --> 14:12.320] of the Civil War. This was 1967. He claimed to be a hundred and twelve.
[14:12.320 --> 14:13.320] Wow.
[14:13.320 --> 14:19.160] I did the math. He said he was five years old when the Civil War ended. And he told
[14:19.160 --> 14:29.320] about the Union troops coming in and giving them candy bars and such. My father asked
[14:29.320 --> 14:38.720] him, what do you reckon is the reason you managed to live so long? And he said, well,
[14:38.720 --> 14:47.800] sir, I worked like a nigger ever day of my life. And with all due respect, this is not
[14:47.800 --> 14:58.520] in any way racist. The science bears it out. Life was meant for enterprise, not for ease.

[54:02.080 --> 54:08.080] Where I first talked to Michael on the phone on one of the radio programs there
[54:08.080 --> 54:16.080] I've heard a lot of talk back here about the formation of the National Common Law Grand Jury
[54:16.080 --> 54:19.080] And I wondered if I could get some of Michael's thoughts on that
[54:19.080 --> 54:26.080] I know there was some upset over trying to talk about that at the convention
[54:26.080 --> 54:30.080] I'm not sure what thoughts we're talking about
[54:30.080 --> 54:38.080] We the people invented government and as Bill Cosby told his children
[54:38.080 --> 54:41.080] I brought you into this world, I can take you out
[54:41.080 --> 54:46.080] And that is literally true of the government status
[54:46.080 --> 54:49.080] So, I mean, it's not going to happen
[54:49.080 --> 54:56.080] But we have the power to just disband this version of the government
[54:56.080 --> 54:59.080] And create something else if that's what we chose to do
[54:59.080 --> 55:07.080] Well, if we can do that, we also, therefore, have the power to create these grand juries
[55:07.080 --> 55:13.080] Instead of eliminating the government, to simply modify it and fix it
[55:13.080 --> 55:20.080] So we need to get a lot of people behind this citizen grand jury concept
[55:20.080 --> 55:31.080] And, I mean, literally hold a trial, indict these people and put them in jail for perjury
[55:31.080 --> 55:35.080] Violating their oath of office and in some cases treason
[55:35.080 --> 55:43.080] You know, if they knew that they were violating the Constitution and they did it anyway
[55:43.080 --> 55:46.080] That's treason
[55:46.080 --> 55:49.080] And I believe most certainly that they do
[55:49.080 --> 55:57.080] Well, it didn't seem at the convention that it was the right time to, this time, to bring it up
[55:57.080 --> 56:01.080] Because it seemed to be, according to the people from Ohio that went up there
[56:01.080 --> 56:06.080] That it was, discussion of it seemed to be stifled because there wasn't room on the agenda for it
[56:06.080 --> 56:10.080] Yeah, well, what we need is numbers
[56:10.080 --> 56:18.080] I mean, you can be right, but unless you've got the people behind you to help you enforce the ideas
[56:18.080 --> 56:23.080] Then unfortunately nothing's going to happen

[56:26.080 --> 56:29.080] Well, I guess it was the hope of the people that I'm hearing
[56:29.080 --> 56:35.080] I'm listening and trying to learn about what they've been doing here in Ohio since I've been gone for 22 years

[56:38.080 --> 56:43.080] But they seem to think that it was a powerful possibility
[56:43.080 --> 56:55.080] Because you had such a gathering of people from all over the country that possibly a national common law grand jury could be set at that time
[56:55.080 --> 56:59.080] And they wondered why it didn't, more talk about that didn't go forward
[56:59.080 --> 57:02.080] That's, I guess, what I was asking

[01:06:23.080 --> 01:06:28.080] In the 1836 version of the Constitution, we don't have a bill of rights.
[01:06:28.080 --> 01:06:31.080] We have a declaration of rights.
[01:06:31.080 --> 01:06:38.080] Now in that declaration of rights, it says the following in terms of property.
[01:06:38.080 --> 01:06:45.080] No person's particular services shall be demanded nor property taken or applied to public use
[01:06:45.080 --> 01:06:50.080] unless by the consent of himself or his representative
[01:06:50.080 --> 01:06:56.080] without just compensation being made therefore according to law.
[01:06:56.080 --> 01:07:01.080] Now that right there would throw imminent domain right out the window
[01:07:01.080 --> 01:07:04.080] because not only can you not take it without my consent,
[01:07:04.080 --> 01:07:09.080] you can't take it if you're not willing to pay what I'm asking for.
[01:07:09.080 --> 01:07:15.080] Now one of my first questions is where did we the people of the Republic of Texas
[01:07:15.080 --> 01:07:20.080] grant the authority on the reformation of this republic,
[01:07:20.080 --> 01:07:24.080] not that I knew that it was ever dissolved to begin with to tell you the truth.
[01:07:24.080 --> 01:07:28.080] How did we come to the point where all the things we reserved in our declaration of rights
[01:07:28.080 --> 01:07:32.080] got rewritten and taken away from us?
[01:07:32.080 --> 01:07:34.080] That would be the first thing I'd like to ask.
[01:07:34.080 --> 01:07:39.080] Now when you go to a little later version, this is the 1845 version,
[01:07:39.080 --> 01:07:46.080] allegedly the version when we joined the United States as people of the Union.
[01:07:46.080 --> 01:07:49.080] Now this is what it said at that time.
[01:07:49.080 --> 01:07:54.080] No bill of attainder, ex post facto law, retroactive law,
[01:07:54.080 --> 01:07:58.080] or any law impairing the obligation of contract shall be made,
[01:07:58.080 --> 01:08:02.080] and no person's property shall be taken or applied to public use
[01:08:02.080 --> 01:08:10.080] without adequate compensation being made unless by the consent of such person.
[01:08:10.080 --> 01:08:15.080] So even when we joined the United States, allegedly joined that is,
[01:08:15.080 --> 01:08:19.080] did we give consent for eminent domain?
[01:08:19.080 --> 01:08:21.080] Even at that point.
[01:08:21.080 --> 01:08:24.080] But as you progress through each of these constitutions,
[01:08:24.080 --> 01:08:31.080] you will see that over time as we became more and more under the control of the federal government,
[01:08:31.080 --> 01:08:35.080] our constitution seems to keep devolving.
[01:08:35.080 --> 01:08:40.080] We keep losing more and more things out of our original declaration of rights,
[01:08:40.080 --> 01:08:44.080] and they're being replaced with more of what looks like privileges.
[01:08:44.080 --> 01:08:46.080] Now let me give you another example here.
[01:08:46.080 --> 01:08:54.080] In the 1836 version, this declaration of rights is declared to be a part of this constitution
[01:08:54.080 --> 01:09:00.080] and shall never be violated on any pretense whatever.
[01:09:00.080 --> 01:09:06.080] That to me sounds like, what can we consider a pretense in that case, Randy?
[01:09:06.080 --> 01:09:12.080] Would an amendment process be considered a pretense?
[01:09:12.080 --> 01:09:15.080] We would have to define pretense.
[01:09:15.080 --> 01:09:21.080] Pretense is really kind of a vague term.
[01:09:21.080 --> 01:09:25.080] That's true, but it is followed by the word whatever.
[01:09:25.080 --> 01:09:27.080] Any pretense, whatever.
[01:09:27.080 --> 01:09:33.080] So as vague or as ambiguous as it may be, it doesn't appear to matter because it can be anything.
[01:09:33.080 --> 01:09:44.080] When you said that, I'm thinking that would tend to restrict any subsequent constitutional amendment
[01:09:44.080 --> 01:09:48.080] that would appear to infringe on that one.
[01:09:48.080 --> 01:09:52.080] Exactly, and it specifically speaks to the declaration of rights.
[01:09:52.080 --> 01:09:57.080] So it isn't limiting the amendment process of the rest of the Constitution,
[01:09:57.080 --> 01:10:02.080] but it is strictly limiting what is known as the declaration of rights.
[01:10:02.080 --> 01:10:07.080] In other words, we feel these are important enough that nobody can ever change them,

[01:10:36.080 --> 01:10:44.080] but unless the person that owned it or his representative granted you the permission to take it.
[01:10:44.080 --> 01:10:52.080] Now, another important aspect of this is what it used to say about the right to keep and bear arms.
[01:10:52.080 --> 01:10:57.080] This is what it said in the original 1836 Republic Constitution.
[01:10:57.080 --> 01:11:03.080] Every citizen shall have the right to bear arms in defense of himself and the republic.
[01:11:03.080 --> 01:11:10.080] The military shall at all times and in all cases be subordinate to the civil power.
[01:11:10.080 --> 01:11:20.080] Now, defense of himself, that to me sounds like an individual right, not a collective right.
[01:11:20.080 --> 01:11:22.080] Would anybody disagree with that?
[01:11:22.080 --> 01:11:32.080] That's still in statute, that you have the right to defend your property and your person.
[01:11:32.080 --> 01:11:35.080] Ah, but see, you can only do it the way they've got it in the legislature.
[01:11:35.080 --> 01:11:38.080] You can only do it if you're standing in your own house.
[01:11:38.080 --> 01:11:41.080] No, no, no, don't say that in statute.
[01:11:41.080 --> 01:11:46.080] It says you have the right to defend your property and your person.
[01:11:46.080 --> 01:11:54.080] You have the right to defend the property and the person of another as if it were your own.
[01:11:54.080 --> 01:12:01.080] This is true, but my point of this is where it says you have the right to bear arms for that purpose.
[01:12:01.080 --> 01:12:07.080] And the legislature has removed your right to bear arms anywhere except on your own property, more or less,
[01:12:07.080 --> 01:12:11.080] unless you get one of their permit slips.
[01:12:11.080 --> 01:12:14.080] And notice that in this version of the Constitution,
[01:12:14.080 --> 01:12:21.080] there is no such thing as a legislative process to keep that right,
[01:12:21.080 --> 01:12:26.080] whereas the current Constitution says the legislature has the right to regulate.
[01:12:26.080 --> 01:12:30.080] And it has said that since the original version of the 1876 version,
[01:12:30.080 --> 01:12:34.080] which is what they're running on now with amendments.
[01:12:34.080 --> 01:12:39.080] The 1876 version allegedly put that saying in there where,
[01:12:39.080 --> 01:12:45.080] but the state has the right to regulate the wearing of arms with an eye towards crime prevention.
[01:12:45.080 --> 01:12:46.080] I got news for you.
[01:12:46.080 --> 01:12:51.080] In 1876, we were still fighting Indians and everything else in this part of Texas.
[01:12:51.080 --> 01:12:56.080] There is no way you're going to convince me the people of Texas rewrote the bill of rights
[01:12:56.080 --> 01:13:00.080] to take away their guns because they didn't have a license.
[01:13:00.080 --> 01:13:03.080] You're just never going to convince me of that.
[01:13:03.080 --> 01:13:08.080] It appears as though in the original Constitution, they were forbidden to do that.

[01:13:48.080 --> 01:13:52.080] our declaration of rights was never allowed to be amended or altered.
[01:13:52.080 --> 01:13:58.080] And it seems like they have used the Reformation after the Civil War and all that
[01:13:58.080 --> 01:14:07.080] as a conduit to allow them to change the Constitution in ways the people would never have agreed to.
[01:14:07.080 --> 01:14:10.080] That's what it's looking like to me.
[01:14:10.080 --> 01:14:14.080] So you're going to spoils of war?

[01:14:18.080 --> 01:14:27.080] The thing about it is, see, is most of the Constitution as it exists today still more or less looks like this,

[01:14:36.080 --> 01:14:40.080] Now they're government-regulated privileges.
[01:14:40.080 --> 01:14:45.080] And I, for one, being who I am, have a problem with that.
[01:14:45.080 --> 01:14:50.080] Now, let's see, there was also one of these versions I found very interesting.
[01:14:50.080 --> 01:14:58.080] It held that the legislators themselves were liable to the people.
[01:14:58.080 --> 01:15:02.080] And part of their oath of office, Randy, you would love this,
[01:15:02.080 --> 01:15:10.080] part of the oath of office required that under no circumstances would they introduce or write
[01:15:10.080 --> 01:15:19.080] or even vote upon any bill that would act in the detriment of the people of Texas.
[01:15:19.080 --> 01:15:24.080] They were forbidden right in the Constitution by their oath from ever creating, writing,
[01:15:24.080 --> 01:15:26.080] or supporting a bill that did that.
[01:15:26.080 --> 01:15:40.080] Yeah, but the problem with that is it's high-minded rhetoric, but how do you determine in advance
[01:15:40.080 --> 01:15:50.080] what kind of bill will over time work and injustice?
[01:15:50.080 --> 01:15:56.080] Well, but that point is there has to come a point where you deviate from the original setup of that bill enough
[01:15:56.080 --> 01:16:01.080] that it becomes unmistakable that the next step is going to result in an injury.
[01:16:01.080 --> 01:16:03.080] That point's got to come eventually.
[01:16:03.080 --> 01:16:06.080] Up to that point, you may not have rendered an injury.
[01:16:06.080 --> 01:16:12.080] But after that point, you're going to, and that should become an obvious fact.
[01:16:12.080 --> 01:16:18.080] Even if it's high-minded rhetoric, Randy, it still, you know, directs the intention.
[01:16:18.080 --> 01:16:24.080] Well, my concern is more that this is rah, rah, rah stuff.
[01:16:24.080 --> 01:16:35.080] It's rhetoric that sounds as though it has meaning, but when you look more closely, there's no substance.

[01:21:32.080 --> 01:21:44.080] And while he was in strict compliance with Part A, what the officer was trying to say was that he was not in compliance with this Part D on this other side of the street.
[01:21:44.080 --> 01:21:49.080] So filed a motion to dismiss, sat down with the attorney, instructed my son a little bit.
[01:21:49.080 --> 01:21:55.080] They had a 45-minute discussion, and the thing got dismissed.
[01:21:55.080 --> 01:22:01.080] I'll just emphasize that, you know, read over these things, look up the statutes, and really see what they are.
[01:22:01.080 --> 01:22:03.080] This is only a $20 ticket.
[01:22:03.080 --> 01:22:05.080] They couldn't believe you're fighting this thing.
[01:22:05.080 --> 01:22:09.080] Well, if they go around the town and they issue 100 of these, 100 people say, I ain't going to fight it.

[01:23:06.080 --> 01:23:10.080] Well, we better beat some of the stuff in the Court of Appeals because that's where our cases are.
[01:23:10.080 --> 01:23:20.080] If we're going to get purchase in the higher courts, we have to get control of the lower courts.
[01:23:20.080 --> 01:23:22.080] Everything else will fall before them.
[01:23:22.080 --> 01:23:30.080] Ninety-nine percent of the public never have any interaction with the government except down here at the bottom.
[01:23:30.080 --> 01:23:33.080] We start taking control at the bottom.
[01:23:33.080 --> 01:23:36.080] It'll filter up to the top.
[01:23:36.080 --> 01:23:55.080] And in these small issues, if the public stops just saying, well, you know, I realize that it's not right and I wasn't guilty, but heck, it's only $500 and it'll cost me $700 to fight it.

[01:23:59.080 --> 01:24:07.080] The calculus they need to use is what will this cost my children?
[01:24:07.080 --> 01:24:16.080] I am a steward of this system until it leaves my hands and is put in the hands of my children.
[01:24:16.080 --> 01:24:27.080] And it is my personal intention that I bequeath this system to my children in better condition than I got it.
[01:24:27.080 --> 01:24:46.080] So if all of us start using these minor, seemingly minor issues, traffic tickets, parking tickets, and the Class C misdemeanors and such as an opportunity not only to learn the law,
[01:24:46.080 --> 01:24:57.080] but to demonstrate to the judges and prosecutors that if you don't follow the law, I will kick your behind.
[01:24:57.080 --> 01:25:07.080] This will filter on up because not everybody is equipped or put here to fight the bigger fight.
[01:25:07.080 --> 01:25:12.080] I'm in the process of writing criminal charges against federal district judges.
[01:25:12.080 --> 01:25:16.080] Yeah, and I've got cases that are in front of the Fifth Circuit Court of Appeals.
[01:25:16.080 --> 01:25:21.080] So come on, people, fight it at the low level so we can have the support for our big cases.
[01:25:21.080 --> 01:25:32.080] Not everybody is geared to fight the higher fights, but if you guys help us at the lower end and become more knowledgeable, it destabilizes everything.

[01:25:33.080 --> 01:25:39.080] The lower end is like an inverted pyramid and it's standing on this little kernel.
[01:25:39.080 --> 01:25:47.080] We kick that little kernel out from under and everything begins to collapse on top of it.

[01:26:23.080 --> 01:26:30.080] When you look at these things, these people trip up all over themselves, and you go back and you look at the statutes and say, what was supposed to happen here?

[01:26:32.080 --> 01:26:35.080] In this case, there were just two little simple issues.
[01:26:35.080 --> 01:26:46.080] Took that up, and they're supposed to have an answer in by the 16th of next week as a reply brief, and we'll see how that's all going to wash out.
[01:26:46.080 --> 01:26:51.080] So first step to move on up to the appellate court, playing around with the circuit.
[01:26:51.080 --> 01:27:01.080] What I'm going to suggest is that you forget about the original complainant, and you forget about the prosecutor.
[01:27:01.080 --> 01:27:06.080] Set your sights on the judge.
[01:27:06.080 --> 01:27:13.080] Always keep in mind, see, we have a gross misconception about what judges are.
[01:27:13.080 --> 01:27:19.080] We tend to think that judges sit up there and they make the decisions.
[01:27:19.080 --> 01:27:23.080] We tend not to understand what their duty is.
[01:27:23.080 --> 01:27:29.080] The judge is a public servant, and he serves you.
[01:27:29.080 --> 01:27:35.080] And what he's there to do is develop the facts in the case.
[01:27:35.080 --> 01:27:37.080] And let me qualify.
[01:27:37.080 --> 01:27:40.080] This is a trial judge.
[01:27:40.080 --> 01:27:54.080] A trial judge has the duty to develop the facts in the case and then apply the law as it exists to the facts that he develops.
[01:27:54.080 --> 01:28:05.080] If he determines for himself what he believes the law means, then he has violated a ministerial duty.
[01:28:05.080 --> 01:28:12.080] The appeals court makes the determination of what the law means.
[01:28:12.080 --> 01:28:19.080] The trial court may only apply the law as it comes to him to the facts in the case.
[01:28:19.080 --> 01:28:34.080] And that's why I challenge the legal reform guys who go in there saying this guy's a dirty, rotten scoundrel and doesn't give the judge law.
[01:28:34.080 --> 01:28:44.080] You must give the law – my tongue is getting tangled – you must give the judge law to apply to the facts.
[01:28:44.080 --> 01:28:47.080] That's all he needs.
[01:28:47.080 --> 01:28:49.080] This is the fact.
[01:28:49.080 --> 01:28:51.080] This is the law governing the fact.
[01:28:51.080 --> 01:28:58.080] If you don't give him the law and you just give him your opinion, even if he agrees with you, he can't rule on it.
[01:28:58.080 --> 01:29:04.080] That's why a lot of these legal reformists out there practice what I call legal myths.
[01:29:04.080 --> 01:29:13.080] They come to the court with their own legal conclusions and they get thrown out every single time.
[01:29:13.080 --> 01:29:22.080] And it gives the legal reform movement a bad name, I'll tell you, because then people like us who are actually doing something get discredited by that kind of behavior.

[01:36:25.080 --> 01:36:32.080] And this attorney is telling him that these guys aren't considering Chapter 45 of the Code of Criminal Procedure,
[01:36:32.080 --> 01:36:37.080] which specifically grants municipal and JP courts jurisdiction for traffic violations.
[01:36:37.080 --> 01:36:41.080] Attorney Guerra, you are absolutely incorrect.
[01:36:41.080 --> 01:36:43.080] I take that into full consideration.
[01:36:43.080 --> 01:36:49.080] What you seem to fail to understand is Chapter 45 applies of the process at trial.
[01:36:49.080 --> 01:36:59.080] The things that I am arguing regarding 14.06 and 1517 is that those are the events that occur prior to trial.
[01:36:59.080 --> 01:37:05.080] And because those events come first and what it says must happen must be followed,
[01:37:05.080 --> 01:37:13.080] it only goes to show that the JP and municipal court is removed of jurisdiction to hear the case
[01:37:13.080 --> 01:37:19.080] because they are specifically directed to send you to the county court or the statutory county court,
[01:37:19.080 --> 01:37:23.080] who is then directed to hold an arraignment.
[01:37:23.080 --> 01:37:30.080] And they cannot hold an arraignment in this case because incarceration does not involve a part of the penalty.
[01:37:30.080 --> 01:37:33.080] It's a catch-22.
[01:37:33.080 --> 01:37:38.080] Neither court has jurisdiction to do the thing they are directed to do.
[01:37:38.080 --> 01:37:45.080] Why? Because the traffic laws fall under the Administrative Procedures Act

[01:37:51.080 --> 01:37:55.080] Chapter 29.02 to be exact of Title 37.
[01:37:55.080 --> 01:38:01.080] So, once again, we have attorneys that like to make all types of assertions,
[01:38:01.080 --> 01:38:07.080] but who don't bother to read everything inclusive, they read only the small part that they think makes their point.

[01:38:48.080 --> 01:38:53.080] and they're just saying, see, see, it says here, Part 15, you have to have a license.

[01:38:56.080 --> 01:39:01.080] You know, a person is the only one that can commit the offense under the Transportation Code.

[01:40:56.080 --> 01:41:01.080] Scheduled a hearing on this five months out, way outside the 90-day limit.
[01:41:01.080 --> 01:41:07.080] So those were the points that went up to the appeals court and said, hey, turn around,
[01:41:07.080 --> 01:41:12.080] put an order in here the way it's supposed to be, and then turn around.
[01:41:12.080 --> 01:41:16.080] And within the 90-day limit, which is coming up on March 17,
[01:41:16.080 --> 01:41:19.080] let's have the hearing on this motion for a new trial.

[01:50:40.080 --> 01:50:44.080] That's tampering with the government document and it's failing in the state of Texas.
[01:50:44.080 --> 01:50:54.080] And then he took that document and presented it to the court when the officer presents a citation to the court.
[01:50:54.080 --> 01:51:03.080] It is the presumption that the citation is presented under oath so that it's not necessary for him to go to a notary
[01:51:03.080 --> 01:51:08.080] and have the notary verify every citation.
[01:51:08.080 --> 01:51:10.080] They did that for convenience.
[01:51:10.080 --> 01:51:14.080] So when he presents it to the court, it's presented under oath.
[01:51:14.080 --> 01:51:19.080] That's a separate violation of aggravated perjury.

[01:52:46.080 --> 01:53:03.080] himself says that he's not allowed to get involved in lawsuits where, you know, it's a private matter or a private individual that they're only supposed to represent state agencies, however.
[01:53:03.080 --> 01:53:05.080] There is a carry-up to that.

[01:53:07.080 --> 01:53:16.080] Randy, about a month and a half ago you gave me some real big legal strategy that I used.

[01:54:32.080 --> 01:54:48.080] An attorney general, the only time the attorney general has original jurisdiction in a prosecution is a criminal complaint against a prosecuting attorney for violating the Open Records Act.
[01:54:48.080 --> 01:54:58.080] Otherwise, there's only two times the attorney general has authority in child support,
[01:54:58.080 --> 01:55:21.080] or when he is requested by a district attorney to assist in a prosecution, in which case he does not act as an attorney general, but rather as an assistant district attorney to assist a district attorney in a prosecution.
[01:55:21.080 --> 01:55:29.080] So in that case, he doesn't act under his authority, but under the district attorney's authority.
[01:55:29.080 --> 01:55:43.080] So if you file suit against an individual public official, normally the county attorney, if the person is sued in his official capacity,
[01:55:43.080 --> 01:55:59.080] the county attorney would be the one that would defend and not the district, but if you are sued claiming that the individual acted outside the scope of his authority,
[01:55:59.080 --> 01:56:23.080] then the individual doesn't have a right to be represented by the county attorney, the attorney general, or any other publicly funded attorney until such time as the individual gets an adjudication that determines that the person was acting under official authority.
[01:56:23.080 --> 01:56:41.080] And we just cross-complained against the county attorney in Travis County for exactly that reason, because the county attorney answered a cross-complaint against a justice of the peace.
[01:56:41.080 --> 01:56:46.080] We claim the justice of the peace had no subject matter jurisdiction.
[01:56:46.080 --> 01:57:02.080] Without subject matter jurisdiction, you have no immunity. So until the judge demonstrated that he had subject matter jurisdiction, the county attorney was stopped from representing him and expending county funds to do that.
[01:57:02.080 --> 01:57:20.080] So if you sued a public official claiming that he acted outside the scope of his authority, until he proves up that he acted within scope, he's on his own. Does that make sense?
[01:57:20.080 --> 01:57:41.080] Everything that you said, I followed, and this official hasn't proved up anything. We're in small claims court. They filed an answer, or she had an assistant attorney general file her answer for her.
[01:57:41.080 --> 01:57:54.080] And it's like they care less about anything that you just pointed out. By the way, I have read everything that you just stated.
[01:57:54.080 --> 01:58:09.080] It's right there at the attorney general's website. It's in the Texas State Constitution, Article 4, Section 22, which says everything that you just said about the duties of the attorney general and their limitations.
[01:58:09.080 --> 01:58:23.080] And yet, I don't understand how this assistant attorney general can come into small claims court and represent this public official who hasn't proved up anything and even file an answer for them.
[01:58:23.080 --> 01:58:29.080] Cross-complain against the attorney who filed the answer.
