[09:46.600 --> 09:51.600] The creditor, you dispute with the creditor because the creditors don't have to validate it.

[09:55.600 --> 09:59.600] But if you dispute, they must mark the account in dispute,
[09:59.600 --> 10:04.600] and if they don't answer you to prove that you had this account,
[10:04.600 --> 10:07.600] well, they must be reporting erroneous and inaccurate information.
[10:07.600 --> 10:15.600] So under fair credit, under fair credit, that's $1,000 per violation.
[10:15.600 --> 10:23.600] So it's $2,000 on that one credit report, and if they're in three credit reports, it's $6,000.

[20:45.600 --> 20:50.600] proof of evidence because it's not about filing criminal charges against them

[20:53.600 --> 20:57.600] Mike is saying that according to his method you just make a log and according to
[20:57.600 --> 21:03.600] your sworn testimony that is accepted as facts and evidences in court.
[21:03.600 --> 21:09.600] And if they want to try to prove you wrong and try to accuse you of perjury,
[21:09.600 --> 21:14.600] then the onus, the burden of proof is on the other side to come up with the
[21:14.600 --> 21:19.600] telephone records or whatever else to try to prove your log wrong because it's
[21:19.600 --> 21:21.600] not even about that.
[21:21.600 --> 21:25.600] It's about this goes to the fact of sworn testimony in court.

[22:19.600 --> 22:21.600] Did you have this credit card?
[22:21.600 --> 22:22.600] Did you not have this loan?
[22:22.600 --> 22:24.600] Did you not borrow this amount of money?
[22:24.600 --> 22:30.600] And even then that's overstating because they very seldom put it that way
[22:30.600 --> 22:35.600] because that is not the question that's generally before the court under fair
[22:35.600 --> 22:36.600] credit, okay?
[22:36.600 --> 22:38.600] It's your civil rights.
[22:38.600 --> 22:41.600] But if the debt collector is in your credit report,
[22:41.600 --> 22:43.600] it's going to fall under fair credit.
[22:43.600 --> 22:46.600] So you see how it all swings in together.

[22:48.600 --> 22:52.600] I mean if they're calling under an anonymous caller ID, you know,

[23:04.600 --> 23:08.600] logged with, you know, the little digital voice of such-and-such date and

[23:11.600 --> 23:15.600] They don't leave messages half the time and it's funny because I'll pick up.
[23:15.600 --> 23:17.600] Well, then how are you going to know?
[23:17.600 --> 23:22.600] The way that I knew was because I continued to get three more calls after I
[23:22.600 --> 23:28.600] sent out my cease and desist letter and I knew because I saw the phone number,
[23:28.600 --> 23:31.600] but calling me was a computer.
[23:31.600 --> 23:35.600] So four months out of six months my call was a computer.
[23:35.600 --> 23:36.600] It's real simple.
[23:36.600 --> 23:37.600] Here's what you'll do.
[23:37.600 --> 23:41.600] You record the log, the time, the date, no caller ID,
[23:41.600 --> 23:44.600] but you're pretty sure it's the debt collector calling.
[23:44.600 --> 23:52.600] When that goes into court, you can subpoena because you're in a federal court.
[23:52.600 --> 23:54.600] You can subpoena the records.
[23:54.600 --> 23:55.600] I know.
[23:55.600 --> 23:58.600] So you get all of the telephone company and say,
[23:58.600 --> 24:00.600] here's the subpoena telephone company.
[24:00.600 --> 24:06.600] Tell me who called me on this day and let's see if they want to go there.
[24:06.600 --> 24:07.600] Right.
[24:07.600 --> 24:10.600] And all that is probably not even necessary.
[24:10.600 --> 24:11.600] Right.
[24:11.600 --> 24:16.600] And I just want to make an additional point that, Brian, you're right.

[24:17.600 --> 24:18.600] Don't write it down on the log.
[24:18.600 --> 24:22.600] Don't claim it if you can't prove it, if you're not sure,

[33:50.600 --> 33:55.600] So if you validate to the attorney, he's going to send you this judgment.

[34:38.600 --> 34:43.600] and in this particular case, there was a motion for reconsideration that was granted,
[34:43.600 --> 34:51.600] but the enemy never responded, and start a little bit of agitation going over there.
[34:51.600 --> 34:56.600] Well, I think the key word you're looking for here is the older and due course.

[48:09.600 --> 48:19.600] Now, the suit was not answered, however, this alleged agent of a federal agency brings the
[48:19.600 --> 48:26.600] U.S. attorney into the picture and the U.S. attorney files for removal of the case to
[48:26.600 --> 48:36.600] federal court on the very last day of that the defendant would have to answer the lawsuit.
[48:36.600 --> 48:43.600] Now, does a removal to federal court count as an answer to the lawsuit or not?
[48:43.600 --> 48:45.600] I believe it does.
[48:45.600 --> 48:47.600] The law is pretty clear.
[48:47.600 --> 48:53.600] It says you have to respond to the complaint within 20 days and it's different in each
[48:53.600 --> 48:58.600] district, but generally they don't count Saturdays or Sundays or holidays.
[48:58.600 --> 49:04.600] It's when the court is open and they don't count generally the first day of service.
[49:04.600 --> 49:07.600] So the first day they're served, you can't count.
[49:07.600 --> 49:11.600] So the 20th day, the 20 days starts the next day.

[50:57.600 --> 51:02.600] I've been in situations where I didn't even bother to answer it and the judge just

[01:13:02.600 --> 01:13:05.600] if they're reporting it in three credit reports, there's $6,000.
[01:13:05.600 --> 01:13:10.600] You wrap the whole package up, the debt collector doesn't validate,
[01:13:10.600 --> 01:13:15.600] doesn't prove you owe the debt, he's calling you, sending you letters, whatever,
[01:13:15.600 --> 01:13:24.600] go after him under Debt Collection Practices Act, name him as the defendant and HSBC as the co-defendant,
[01:13:24.600 --> 01:13:28.600] take them in and let the court sort out all the violations.
[01:13:28.600 --> 01:13:38.600] So validation directly to Midland through the lawyer or to each of them and the dispute to HBSC?

[01:20:36.600 --> 01:20:46.600] Yes, but here's the point, as I explained it to you before, very seldom in this fair credit debt collection process,
[01:20:46.600 --> 01:20:52.600] will you even go before the judge, it's very seldom that you'll do that, okay?
[01:20:52.600 --> 01:20:58.600] That you and the lawyer and the judge are in the same courtroom, it's very seldom, okay?
[01:20:58.600 --> 01:21:07.600] Once in a while they'll have a conference, and it's an informal thing, you're not in trial, you're not under oath or anything like that.
[01:21:07.600 --> 01:21:16.600] But the point is, Willow, what you want to make is even when this guy or gal first appears as the defendant's attorney,
[01:21:16.600 --> 01:21:20.600] that's the time to go see if this person has been admitted to the bar.
[01:21:20.600 --> 01:21:26.600] And if they haven't been admitted to the bar as the plaintiff, you make a motion to the court.
[01:21:26.600 --> 01:21:32.600] The plaintiff did some investigation, has found that Mr. So-and-so or Ms. So-and-so is not admitted to the bar,
[01:21:32.600 --> 01:21:37.600] it takes exception to the fact that they are representing this company,
[01:21:37.600 --> 01:21:42.600] and then let them come back and prove that they are admitted to the federal bar.
[01:21:42.600 --> 01:21:45.600] There's nothing else that buys you time, right?
[01:21:45.600 --> 01:21:53.600] Exactly, exactly. Well, when this goes into federal court, all the nonsense is going to stop very quickly, okay?
[01:21:53.600 --> 01:21:57.600] You're going to have most of these cases, so you get an idea.
[01:21:57.600 --> 01:22:02.600] I've had them settle before they had to respond to the complaint.
[01:22:02.600 --> 01:22:09.600] Once they got served, I've had them settle a week before they had a response to the complaint, okay?
[01:22:09.600 --> 01:22:12.600] And then you've got some that are going to fight you a little bit,
[01:22:12.600 --> 01:22:17.600] and I've seen some of these cases go two, three, four months before you reach a settlement agreement.
[01:22:17.600 --> 01:22:23.600] So it's not like the local courts where you've got to have everything answered by tomorrow.
[01:22:23.600 --> 01:22:28.600] You're going to have a lot of time to play with this stuff.
[01:22:28.600 --> 01:22:29.600] That's awesome.
[01:22:29.600 --> 01:22:30.600] Yeah.
[01:22:30.600 --> 01:22:31.600] Awesome.
[01:22:31.600 --> 01:22:35.600] It's more regulated, it's more orderly in that federal court.
[01:22:35.600 --> 01:22:42.600] The judge doesn't even want to see you guys because that's the part of him putting you into 26F discovery,
[01:22:42.600 --> 01:22:47.600] and then maybe somebody will get a light to come on and say, oh boy, this guy's got us.
[01:22:47.600 --> 01:22:49.600] We don't want to go to trial.
[01:22:49.600 --> 01:22:54.600] And there's another step even before going to trial that happens, which I didn't talk about tonight,
[01:22:54.600 --> 01:22:59.600] but two to three weeks before you pick the jury for the trial,
[01:22:59.600 --> 01:23:04.600] the judge is going to call the plaintiff and the defendant into the court,
[01:23:04.600 --> 01:23:11.600] and the judge is going to determine what evidence is admissible for the trial.
[01:23:11.600 --> 01:23:15.600] Well, if you've got all these admissions and denials from them saying,
[01:23:15.600 --> 01:23:19.600] hey, we didn't mark your account in dispute, we got your letter,
[01:23:19.600 --> 01:23:23.600] and you can show that all to the judge, you don't have to go to trial
[01:23:23.600 --> 01:23:27.600] because you can move the judge to make a summary judgment on the spot.
[01:23:27.600 --> 01:23:30.600] Your Honor, they've admitted everything they've done here.
[01:23:30.600 --> 01:23:32.600] We don't need to go to trial.
[01:23:32.600 --> 01:23:33.600] Yeah.
[01:23:33.600 --> 01:23:40.600] That's why they don't want to go there because all you've got to do is get them on one count, one count,
[01:23:40.600 --> 01:23:43.600] and they're cooked. They're done. That's it.

[01:23:47.600 --> 01:23:53.600] but how do you go about getting the prejudgment with the federal judge?

[01:24:15.600 --> 01:24:21.600] I've talked to people that have done that and do a lot of this pre-trial admissions, okay,

[01:24:23.600 --> 01:24:27.600] The discovery really doesn't involve the court.
[01:24:27.600 --> 01:24:33.600] It's between the two litigants unless one of the litigants doesn't act in good faith.
[01:24:33.600 --> 01:24:38.600] The only reason you go to the court then is to ask the court to intervene
[01:24:38.600 --> 01:24:40.600] and force them to act in good faith.
[01:24:40.600 --> 01:24:47.600] So if you have discovery, just send it to the other side and tell them this is discovery,
[01:24:47.600 --> 01:24:49.600] pre-litigation discovery, answer it.
[01:24:49.600 --> 01:24:54.600] If they don't like it, they'll go to the judge and ask the judge to strike the discovery,
[01:24:54.600 --> 01:24:56.600] and you can fight about that.

[01:25:51.600 --> 01:25:58.600] If I were to give anybody any advice, it would be that any kind of verbal dissertation or verbal dialogue
[01:25:58.600 --> 01:26:01.600] you have with these people on the telephone, record it every time.

[01:26:02.600 --> 01:26:09.600] The first thing they'll do, and my wife recorded somebody the other day from one of our favorite banks.
[01:26:09.600 --> 01:26:17.600] I won't give out their name, but their initials were Wells Fargo, called her on something.
[01:26:17.600 --> 01:26:24.600] The first thing the lady did was she asked for the account number or her social.
[01:26:24.600 --> 01:26:27.600] She wanted to know her social security number.
[01:26:27.600 --> 01:26:35.600] Mr. Craig, can you tell the listening audience what the penalty is under the Privacy Act of 1974,
[01:26:35.600 --> 01:26:40.600] what public law under Title 42 is for doing that?
[01:26:40.600 --> 01:26:45.600] No federal, state, or local government agency shall deprive any individual of a right, benefit, or privilege
[01:26:45.600 --> 01:26:49.600] because of that individual's refusal to disclose the social security number.
[01:26:49.600 --> 01:26:54.600] To do so is a penalty of $10,000, five years in jail, or both.
[01:26:54.600 --> 01:26:57.600] It is a felony.

[01:27:01.600 --> 01:27:10.600] Now, if you've got a debt collector saying that you owe them $2,000, $3,000, $5,000 on a credit card, on a car, on whatever.

[01:27:11.600 --> 01:27:20.600] You've got them right there to your betterment if it's $5,000 to have that equal amount in fines.
[01:27:20.600 --> 01:27:26.600] Now, my question to you, Michael, how do you make it stick?
[01:27:26.600 --> 01:27:36.600] Now, the point is, under that title, I have not done anything and I don't give people stuff that I haven't done personally or have personal knowledge of.
[01:27:36.600 --> 01:27:43.600] But the point is, under debt collection, when they come through, if they're asking you,
[01:27:43.600 --> 01:27:51.600] I've never had one ask me for a social, well, I take it back, I've had them ask me for the last four digits.
[01:27:51.600 --> 01:27:56.600] And I will not give that information, absolutely.
[01:27:56.600 --> 01:28:02.600] But I'm not sure how to proceed to get them in under this law that you guys are talking about.
[01:28:02.600 --> 01:28:03.600] But I'm sure there's a way to do it.
[01:28:03.600 --> 01:28:05.600] It's the Privacy Act of 1974.
[01:28:05.600 --> 01:28:07.600] It's a public law, federal law.

[01:28:08.600 --> 01:28:17.600] So to me, I go after them for the simple stuff, the Fair Credit Debt Collection Practices Act violations.

[01:28:22.600 --> 01:28:27.600] And the whole purpose of that is that you're taking control of this.
[01:28:27.600 --> 01:28:35.600] You know what the last question is, and they won't give that to you, which is fine.
[01:28:35.600 --> 01:28:38.600] And then you know what to do at that point, you hang up.
[01:28:38.600 --> 01:28:45.600] But the point is, they need to identify themselves because you don't know who the heck you're talking to.
[01:28:45.600 --> 01:28:52.600] It could be anybody with all the IT staff throughout the day and everything, come on.
[01:28:52.600 --> 01:28:58.600] So with that said, when they don't give you the mini Miranda,
[01:28:58.600 --> 01:29:02.600] when they send you letters that doesn't have the mini Miranda on it,
[01:29:02.600 --> 01:29:06.600] the mini Miranda so people who don't know what that is who are listening,
[01:29:06.600 --> 01:29:10.600] this is an attempt to collect the debt, any information will be used for that purpose.
[01:29:10.600 --> 01:29:15.600] When they don't do that stuff, that's a violation of the Debt Collection Practices Act.
[01:29:15.600 --> 01:29:20.600] And every time they do it, it racks up a $1,000 violation.
[01:29:20.600 --> 01:29:23.600] Funny you mentioned that because that was my next question.
[01:29:23.600 --> 01:29:32.600] Are they, by any statute that you know of, obligated to reveal this when you speak to them on the telephone?
[01:29:32.600 --> 01:29:34.600] Yes, sir. It's in the law.
[01:29:34.600 --> 01:29:40.600] It's in the Debt Collection Practices Act that says every time they contact you,
[01:29:40.600 --> 01:29:43.600] they must tell you that they're a debt collector.

[01:34:46.600 --> 01:34:50.600] I have it copied and I want to present it as evidence into the case.
[01:34:50.600 --> 01:34:56.600] And oh, by the way, if the lawyer gets up, we don't know if that's true or not, Your Honor, then you would stand up and say,
[01:34:56.600 --> 01:35:03.600] Your Honor, just so you know, there is a full recording to support every one of these documents.
[01:35:03.600 --> 01:35:10.600] And if the court will allow me to bring the recording in, they could confirm it against the documents word by word.
[01:35:10.600 --> 01:35:19.600] Well, when my wife started the recording, she got the lady's name and her employee number.
[01:35:19.600 --> 01:35:21.600] She went through the questions.
[01:35:21.600 --> 01:35:24.600] And then it was the lady's turn.
[01:35:24.600 --> 01:35:28.600] She wanted to know who she was talking to, so she asked for the Social Security number.
[01:35:28.600 --> 01:35:29.600] So that's nailed her right there.
[01:35:29.600 --> 01:35:35.600] And if I can bring this statute forward, that's $10,000 right on, I mean, right square, straight up off the bat.
[01:35:35.600 --> 01:35:42.600] Well, what I would do, see, I would file the complaint under fair credit and pet collection and also add that in as part of the complaint.
[01:35:42.600 --> 01:35:45.600] And let the judge adjudicate it.
[01:35:45.600 --> 01:35:52.600] Yeah, and Steve, we were talking about this earlier as far as the testimony, the witness testimony.
[01:35:52.600 --> 01:35:56.600] We don't even need to bring forth those recordings.

[01:37:18.600 --> 01:37:29.600] You know, I remember vaguely somebody asking me that a while back, and my understanding is it doesn't, but don't hold me 100 percent.
[01:37:29.600 --> 01:37:38.600] Again, if they have a debt collector involved with this thing, if they're in your credit report, you know, you can stir up a lot of trouble.
[01:37:38.600 --> 01:37:42.600] Okay, Mike, this brings up a very important question.

[01:37:44.600 --> 01:37:46.600] I've been waiting to ask this question all night.
[01:37:46.600 --> 01:38:02.600] How can you determine if a federal agency or a state agency or local agency, whatever, is using a third-party debt collector to attempt to collect a fine, forfeiture, fee, child support order, et cetera, et cetera, et cetera?
[01:38:02.600 --> 01:38:10.600] How can you determine if it's actually a third-party debt collector issue or if it's actually the government going after you?
[01:38:10.600 --> 01:38:16.600] Well, again, this goes back to researching, and you can never do enough researching.
[01:38:16.600 --> 01:38:18.600] I've done tons of it.
[01:38:18.600 --> 01:38:33.600] And I'll tell you, first of all, the first thing I would do is, whoever's attempting to collect this alleged debt, okay, go to BASER and query them and see if they've been sued, if they've been in the federal court.
[01:38:33.600 --> 01:38:41.600] You might wind up with a lot of intuitive information there that's going to blow your mind, okay?
[01:38:41.600 --> 01:38:42.600] That's one thing.
[01:38:42.600 --> 01:38:49.600] The other thing is, a lot of these companies will identify themselves as ABC attorney.
[01:38:49.600 --> 01:38:52.600] Well, how do you know the attorney's a debt collector?
[01:38:52.600 --> 01:38:56.600] Again, most of these attorneys today have websites.
[01:38:56.600 --> 01:38:59.600] And I had someone contact me a couple of weeks ago.
[01:38:59.600 --> 01:39:04.600] I got contacted by this attorney, but I don't know if they're a debt collector or what then.
[01:39:04.600 --> 01:39:06.600] I went by the attorney's name.
[01:39:06.600 --> 01:39:07.600] I went to Google.
[01:39:07.600 --> 01:39:09.600] I went to their website.
[01:39:09.600 --> 01:39:10.600] We're a debt collector.
[01:39:10.600 --> 01:39:11.600] We collect debts.
[01:39:11.600 --> 01:39:14.600] Case closed.
[01:39:14.600 --> 01:39:22.600] I can address the question on collecting child support in Texas.
[01:39:22.600 --> 01:39:26.600] That will always be the attorney general's office itself.
[01:39:26.600 --> 01:39:28.600] Okay.
[01:39:28.600 --> 01:39:30.600] They can pretty much do what they want to.
[01:39:30.600 --> 01:39:31.600] Yeah, yeah.
[01:39:31.600 --> 01:39:34.600] It's a tough situation on child support.
[01:39:34.600 --> 01:39:44.600] I know it's very difficult to get out of, and I know that there's some stuff going on that the children aren't children anymore.
[01:39:44.600 --> 01:39:50.600] They're grown adults and they're out working, but they're still trying to collect the child support.
[01:39:50.600 --> 01:39:53.600] And I have a problem with that, okay?
[01:39:53.600 --> 01:39:58.600] I think somebody's trying to collect it who shouldn't be getting it.
[01:39:58.600 --> 01:40:06.600] Well, in a situation in which I'm referring to, there's been no consideration as far as having any visitation with the children.
[01:40:06.600 --> 01:40:13.600] That does not apply in the state of Texas, but you're in New York, so I can't comment on that.
[01:40:13.600 --> 01:40:21.600] But in the state of Texas, there are two totally completely separate issues, and I know it's not fair.
[01:40:21.600 --> 01:40:24.600] I don't agree with it, but that's the way it is.
[01:40:24.600 --> 01:40:30.600] Child support falls under the criminal statute, the penal code.
[01:40:30.600 --> 01:40:34.600] Visitation falls under the civil code.
[01:40:34.600 --> 01:40:37.600] Two completely different situations.
[01:40:37.600 --> 01:40:45.600] The custodial parent could completely withhold all visitation from the other parent and the other parent.
[01:40:45.600 --> 01:40:52.600] Honestly, all they're going to do is sue and sue and sue. Someday, maybe something would be done about it.
[01:40:52.600 --> 01:40:55.600] But there's no penal code.
[01:40:55.600 --> 01:41:04.600] There's no enforcement under the penal to force the custodial parent to turn the child over to the other parent.
[01:41:04.600 --> 01:41:10.600] All it's going to do is it's just going to go to civil and forfeitures and liens and levies and things like this.
[01:41:10.600 --> 01:41:16.600] But unfortunately, when it comes to child support, that's under the penal code, and that's just the way it is in this state.
[01:41:16.600 --> 01:41:20.600] I don't necessarily agree with it, but you cannot argue, at least in this state,
[01:41:20.600 --> 01:41:25.600] you cannot argue that the other parent would not let me see my child, and so therefore, I don't have to pay.
[01:41:25.600 --> 01:41:32.600] That argument will not fly in this state, and it's probably not going to fly in any other state. Sorry.

[01:43:42.600 --> 01:43:47.600] and what this will teach you is how to go after the credit bureau and take them into federal court.

[01:47:14.600 --> 01:47:25.600] 807 paragraph 11, it's called False or Misleading Representations, paragraph 11.
[01:47:25.600 --> 01:47:32.600] The failure to disclose in the initial written communication with the consumer,
[01:47:32.600 --> 01:47:40.600] and in addition if the initial communication with the consumer is oral,
[01:47:40.600 --> 01:47:47.600] in that initial oral communication the debt collector is attempting to collect the debt
[01:47:47.600 --> 01:47:53.600] and that any information obtained will be used for that purpose, comma.
[01:47:53.600 --> 01:47:59.600] And the failure to disclose in subsequent communications
[01:47:59.600 --> 01:48:03.600] that the communication is from a debt collector,
[01:48:03.600 --> 01:48:09.600] except that this paragraph shall not apply to a formal plea
[01:48:09.600 --> 01:48:12.600] made in connection with the legal action.
[01:48:12.600 --> 01:48:15.600] So there you have it, ladies and gentlemen, right from the law,
[01:48:15.600 --> 01:48:19.600] they've got to tell you every time, and when I file my complaints,
[01:48:19.600 --> 01:48:24.600] I can assure you I've put that paragraph in the complaint.
[01:48:24.600 --> 01:48:26.600] That makes the guesswork out.
[01:48:26.600 --> 01:48:29.600] Now what statute is that again?
[01:48:29.600 --> 01:48:35.600] That's the Debt Collection Practices Act, section 807, paragraph 11,
[01:48:35.600 --> 01:48:39.600] False or Misleading Representations under 807.
[01:48:39.600 --> 01:48:42.600] Okay, well that answers the question that I've had for a long time,
[01:48:42.600 --> 01:48:46.600] in connection with a formal...
[01:48:46.600 --> 01:48:51.600] Right, when you go into a plea, because, and I find this, for instance,
[01:48:51.600 --> 01:48:55.600] if they're suing you in the local court, okay,
[01:48:55.600 --> 01:49:00.600] they don't have to put this as an attempt to collect the debt on the documentation,
[01:49:00.600 --> 01:49:05.600] but I know that a lot of these debt collectors now just automatically do that
[01:49:05.600 --> 01:49:07.600] to avoid any question.
[01:49:07.600 --> 01:49:11.600] So that means that the government is going after someone
[01:49:11.600 --> 01:49:18.600] for like, say, a fine or a forfeiture collection on some kind of infraction.
[01:49:18.600 --> 01:49:22.600] If it's a connection with a formal pleading,
[01:49:22.600 --> 01:49:28.600] then we cannot use the Fair Debt Collection Practices Act as a remedy.
[01:49:28.600 --> 01:49:29.600] Is that what you're saying?
[01:49:29.600 --> 01:49:31.600] Well, that part of it you can't.
[01:49:31.600 --> 01:49:36.600] There are many parts to it, because this is just one small part of it.
[01:49:36.600 --> 01:49:40.600] You know, you've asked them to prove the debt, the obligation, whatever,
[01:49:40.600 --> 01:49:45.600] and if they don't do that, they're attempting to collect something that doesn't exist.
[01:49:45.600 --> 01:49:48.600] What right do you have to bring me into a courtroom?
[01:49:48.600 --> 01:49:53.600] You've never proved to me that I owe something, and I challenge you and ask you to do that.
[01:49:53.600 --> 01:50:00.600] So this is just another section of it, when they contact you, what their requirements are to do.
[01:50:00.600 --> 01:50:05.600] But if we can prove that the government is using a third-party debt collector
[01:50:05.600 --> 01:50:11.600] to try to enforce a fine or forfeiture, then we can use the Fair Debt Collection Practices Act.
[01:50:11.600 --> 01:50:15.600] Absolutely. If there's a third-party debt collector involved, absolutely.
[01:50:15.600 --> 01:50:20.600] And my understanding is that when they come after you, they do this,
[01:50:20.600 --> 01:50:26.600] they turn it over to some debt collector, they've hired, and they let the debt collector go after you.
[01:50:26.600 --> 01:50:28.600] Like Dyncor?
[01:50:28.600 --> 01:50:32.600] Yep, any of those. They're a third-party debt collector.
[01:50:32.600 --> 01:50:36.600] And it's very easy to find out information by querying them,
[01:50:36.600 --> 01:50:40.600] through checking lawsuits in the federal courts. That's what I do.
[01:50:40.600 --> 01:50:43.600] Pre-litigation discovery, perhaps?
[01:50:43.600 --> 01:50:47.600] Yeah, yeah. I mean, you know, there's just, you can't know the lie.
[01:50:47.600 --> 01:50:52.600] I have a very simple saying, know thy enemy, know thy enemy, okay?
[01:50:52.600 --> 01:50:55.600] Know who you're going up against, know what they do for a living,
[01:50:55.600 --> 01:51:02.600] and what laws do they have to follow in doing that living. It's that simple.
[01:51:02.600 --> 01:51:04.600] Question.
[01:51:04.600 --> 01:51:17.600] When you dispute the debt, what statute restricts the lender from any further collections
[01:51:17.600 --> 01:51:22.600] until they've answered the dispute?
[01:51:22.600 --> 01:51:31.600] Oh, well, here's the thing. When you dispute this thing, as you know, they must do an investigation.
[01:51:31.600 --> 01:51:36.600] The law is very clear under fair credit that says, okay, if you dispute this,
[01:51:36.600 --> 01:51:43.600] they're obligated to do an investigation, which 99 percent of the time they never do.
[01:51:43.600 --> 01:51:48.600] But the point is, within the fair credit, it is clearly explained in there,
[01:51:48.600 --> 01:51:52.600] then it says that if you dispute it, they have to do an investigation,
[01:51:52.600 --> 01:51:58.600] and they have to provide you with some type of results of that investigation.
[01:51:58.600 --> 01:52:04.600] And when they don't do that, the statutes within the Fair Credit Reporting Act,
[01:52:04.600 --> 01:52:10.600] then I don't have the paragraph exactly up here in front of me, but that's what does,
[01:52:10.600 --> 01:52:15.600] that's what turns the law on to go after these guys because they don't follow the law.
[01:52:15.600 --> 01:52:20.600] You know, they come back, and I've had people, you know, talk to,
[01:52:20.600 --> 01:52:25.600] they come back and the creditor will send back a letter to you and say,
[01:52:25.600 --> 01:52:32.600] we want your Social Security number, uh-oh, and or your account number.
[01:52:32.600 --> 01:52:40.600] And my argument to that is, it's really simple, you're in my credit report,
[01:52:40.600 --> 01:52:45.600] you're reporting this in my credit report where my Social Security number is,
[01:52:45.600 --> 01:52:49.600] and now you're saying you don't know what I'm talking about
[01:52:49.600 --> 01:52:55.600] because you don't have my Social Security and you don't have the account number.
[01:52:55.600 --> 01:53:03.600] That tells me they have holes in their system, and the law addresses this
[01:53:03.600 --> 01:53:08.600] that says they must have systems in place to prevent error.
[01:53:08.600 --> 01:53:14.600] And by asking you for that, to me, they don't have the systems in place to prevent error.
[01:53:14.600 --> 01:53:16.600] They should have my name and address in there.
[01:53:16.600 --> 01:53:18.600] You're in my credit report, now you're coming back
[01:53:18.600 --> 01:53:22.600] and you're asking me for my social and an account number.
[01:53:22.600 --> 01:53:24.600] Are you kidding me?
[01:53:24.600 --> 01:53:26.600] Mike, let me ask you something.
[01:53:26.600 --> 01:53:32.600] If it's a government agency that actually appears in someone's credit report,
[01:53:32.600 --> 01:53:37.600] is there some way we could go back after the government agency under these statutes?
[01:53:37.600 --> 01:53:45.600] Well, I'm going to answer that, and again, I've had people ask me about IRS,
[01:53:45.600 --> 01:53:49.600] and I say, I don't know, I don't go there, I've never done anything with IRS,
[01:53:49.600 --> 01:53:54.600] but if you've got some other government agency in your credit report,
[01:53:54.600 --> 01:53:58.600] these are federal laws.
[01:53:58.600 --> 01:54:05.600] They are adjudicated or can be adjudicated to any competent court of jurisdiction.
[01:54:05.600 --> 01:54:07.600] I'm going to say that one more time.
[01:54:07.600 --> 01:54:10.600] The law under fair credit and debt collection states,
[01:54:10.600 --> 01:54:15.600] these you can bring action in any competent court of jurisdiction.
[01:54:15.600 --> 01:54:18.600] So if you don't want to go to federal, you can go to the local.
[01:54:18.600 --> 01:54:20.600] I don't recommend that.
[01:54:20.600 --> 01:54:23.600] I go to the federal because these are federal laws.
[01:54:23.600 --> 01:54:27.600] You're in a federal court and they understand, okay?
[01:54:27.600 --> 01:54:31.600] So my answer to your question is if they're in your credit report,
[01:54:31.600 --> 01:54:33.600] they have to follow the rules.
[01:54:33.600 --> 01:54:38.600] Unless there's some statute that specifically exempts that particular federal agency.
[01:54:38.600 --> 01:54:39.600] Exactly.
[01:54:39.600 --> 01:54:41.600] We're in a fight right now.
[01:54:41.600 --> 01:54:45.600] I have a gentleman who just went after Sallie Mae.
[01:54:45.600 --> 01:54:49.600] Well, at one time, Sallie Mae used to be part of the federal government.
[01:54:49.600 --> 01:54:56.600] You couldn't go after them, but they sold that off and they became a private company, okay?
[01:54:56.600 --> 01:55:01.600] But now the problem he has is Sallie Mae has turned this case back over,
[01:55:01.600 --> 01:55:05.600] Sallie Mae walked away and they paid him to go away, okay?
[01:55:05.600 --> 01:55:14.600] The point is now they've turned the paperwork and everything back to the state that he got this loan.
[01:55:14.600 --> 01:55:20.600] And they're going to try and enforce putting a lien on his pay, suspending his license,
[01:55:20.600 --> 01:55:22.600] and he's in the medical field.
[01:55:22.600 --> 01:55:27.600] I won't get into discussions about that, but they're threatening to do these things.
[01:55:27.600 --> 01:55:33.600] My question is the place, the state that's doing this is Illinois, and he's in another state,
[01:55:33.600 --> 01:55:41.600] and I says I don't understand how the state of Illinois can have jurisdiction over the state you're living in.
[01:55:41.600 --> 01:55:43.600] How can they do that?
[01:55:43.600 --> 01:55:49.600] They just can't come in and send your employer a notice and say start garnishing this guy's wages.
[01:55:49.600 --> 01:55:54.600] You need a court order to do that as far as I know.
[01:55:54.600 --> 01:55:56.600] So we're digging into this a little bit.
[01:55:56.600 --> 01:55:58.600] It's getting pretty interesting.
[01:55:58.600 --> 01:56:03.600] We know some people who have done this stuff that we're kind of querying them now,
[01:56:03.600 --> 01:56:08.600] but the guy's a little upset over this, and rightfully so.
[01:56:08.600 --> 01:56:14.600] They sent him this package and fill out all these forms and sign this and start paying us.
[01:56:14.600 --> 01:56:19.600] But we've come up with some other alternate plans on this.
[01:56:19.600 --> 01:56:22.600] At this point it won't fall under fair credit and pet collection,
