[37:16.760 --> 37:22.760]  or local police to enter the premises then he should subpoena for the names of the federal
[37:22.760 --> 37:30.920]  the federal officers involved and sue them for criminal trespass okay also is there any way to
[37:30.920 --> 37:36.920]  get um they only give you the sheet that the judge signs but they don't give you the full warrant
[37:36.920 --> 37:45.240]  like okay what I suggest he does do does he have criminal charges against him he does and what
[37:45.240 --> 37:53.880]  happened was he was charged with on a state crime and held in prison and bailed out and then a week

[37:59.160 --> 38:05.400]  feds picked him up and denied him bail so he's charged pretty much state and federal for the same

[38:48.920 --> 38:55.000]  up beating him to death on the courthouse steps they are sued in the state they're prosecuted in

[40:55.480 --> 41:03.800]  a warrant so you get the subpoena the judge who issued the warrant and the officer who testified

[41:13.800 --> 41:19.160]  get the affidavit that's supposed to be attached to the search warrant like nobody will give it to

[42:44.280 --> 42:50.280]  would be aiding and abetting on the clerk's part also she's aware no no you can't you can't charge
[42:50.280 --> 42:57.720]  the clerk for what she didn't receive unless she helped the prosecutor not he gave it to him after
[42:57.720 --> 43:04.440]  the fact yeah if she received it and gave it to him then you can bind her but if she never received
[43:04.440 --> 43:10.920]  it you you can't implicate her even though she knows where it's at uh i don't know that she has

[47:37.720 --> 47:42.440]  um but there is a prosecution commenced against him because he was arrested and he was in jail
[47:43.000 --> 47:47.320]  and the district clerk's like well no i mean the prosecution hasn't commenced yet because the
[47:47.320 --> 47:52.440]  prosecutor hasn't filed it yet and they're like okay you don't know the law buddy but that's cool
[47:53.080 --> 47:59.880]  anyway just let us file the petition for writ well he wouldn't let us because apparently either the
[47:59.880 --> 48:04.200]  magistrate or the or he was under the impression that the prosecutor has to open the case actually

[48:42.040 --> 48:46.040]  there's no filing fee for writ for petition for writ of habeas corpus so they came back they
[48:46.040 --> 48:51.320]  didn't charge us so there was no problem with that um but anyway so we said okay let's go down
[48:51.320 --> 48:56.760]  now to the county prosecutor's office and let's let's find out if he's got the file that he's not
[48:56.760 --> 49:02.280]  supposed to have well he can have a copy of it if there's if it's already been entered into the
[49:02.280 --> 49:08.040]  record with the clerk of the court but he can't have it to the exclusion of the clerk of the court
[49:08.040 --> 49:12.920]  so we go down there you know we we put in the request that you know we're here to talk to him

[49:52.600 --> 49:58.760]  well wait a minute you can't decide to dismiss the case only the judge can make that decision you
[49:58.760 --> 50:05.240]  can put in a motion requesting the case be dismissed but uh that brings up the point that
[50:05.240 --> 50:12.120]  uh you can't even do that and i can't put uh put in my uh file my petition for rid of habeas corpus
[50:12.120 --> 50:19.160]  because there is no case and so because there's no file in the uh clerk of the court's records
[50:19.160 --> 50:25.480]  and by then you could see him start to get antsy in his chair and shuffling around even though he
[50:25.480 --> 50:34.360]  still got the file in his hand on top of everything else and so um and so randy starts to commence to
[50:34.360 --> 50:40.920]  quote the code to him and the statute numbers and everything talking about how um you know the
[50:40.920 --> 50:45.640]  magistrate has to cause his name to be written across the seal and and given to the clerk of
[50:45.640 --> 50:51.640]  the court in the whole nine yards and and uh randy's like uh saying to him well you know uh
[50:51.640 --> 50:57.240]  you're the clerk is telling me there's no prosecution commenced against me but as far as i

[56:54.920 --> 57:01.640]  and then she got a call back and they told her that um that uh their that her insurance my
[57:01.640 --> 57:09.000]  daughter's insurance said that she was excluded well you know she she was under her dad's insurance
[57:09.000 --> 57:15.080]  or she so she thought that she was under her dad's insurance and uh apparently her dad never added
[57:15.080 --> 57:22.840]  her on and so anyway uh long story short um nothing happened you know everybody she fixed
[57:22.840 --> 57:29.160]  her own car she didn't claim it on the other insurance um and uh now she gets a letter what
[57:29.160 --> 57:35.240]  is it this happened in july and now she got a letter from an attorney representing um state farm
[57:35.240 --> 57:42.200]  for the other uh party involved and the letter states that uh they're representing uh the other
[57:42.200 --> 57:48.760]  party and uh and our investigation indicates that you are responsible for the above loss
[57:48.760 --> 57:55.000]  therefore i i am making a demand on behalf of state farms seeking full reimbursement which is
[57:55.000 --> 58:05.640]  thirteen thousand three hundred and sixty eight dollars and um um okay yes counter sue for counter

[01:05:29.680 --> 01:05:34.680]  Okay, here's what I suggest, she wasn't at fault, so that's a moot point
[01:05:34.680 --> 01:05:41.680]  whether she had it or not, in order to make sure that they don't mess with you
[01:05:41.680 --> 01:05:47.680]  look up the attorney's name in the state bar, get his bar card number
[01:05:47.680 --> 01:05:56.680]  and file a bar grievance against him for malicious prosecution work
[01:05:56.680 --> 01:06:02.680]  that this was a case in which his client was clearly at fault
[01:06:02.680 --> 01:06:08.680]  and he's trying to use his position as an attorney to extort money from you
[01:06:08.680 --> 01:06:15.680]  file a bar grievance, the state bar will get your bar grievance and throw it in the trash
[01:06:15.680 --> 01:06:19.680]  but his insurance company won't
[01:06:19.680 --> 01:06:26.680]  it will cost him probably more than what he's asking for from you
[01:06:26.680 --> 01:06:29.680]  in increases in his malpractice insurance

[01:06:33.680 --> 01:06:39.680]  if this is his first year of practice, they'll cancel his malpractice insurance immediately

[01:06:46.680 --> 01:06:51.680]  three, they'll cancel his law firm's malpractice insurance
[01:06:51.680 --> 01:06:57.680]  so just for yucks, send in a bar grievance, complain about the letter as an attempted extortion

[01:07:09.680 --> 01:07:13.680]  the state bar will send you a letter saying that they got your complaint

[01:40:01.680 --> 01:40:04.680]  so that they would have a good comprehensive
[01:40:04.680 --> 01:40:07.680]  decision okay that's case law not legislation which you were just
[01:40:07.680 --> 01:40:10.680]  I'm sorry I'm sorry yeah that's right
[01:40:10.680 --> 01:40:13.680]  that's case law not legislation
[01:40:13.680 --> 01:40:16.680]  I'll have to check because as you were you were asking
