[05:05.760 --> 05:10.400] get our property taxes reduced because they were already way out of hand.
[05:10.400 --> 05:16.400] And instead, everyone's bill is like 30% more than it was last year.
[05:16.400 --> 05:22.240] And so we are going to be bringing some people on tonight and coming up next week to try
[05:22.240 --> 05:25.640] to get a remedy to this situation.
[05:25.640 --> 05:28.360] Randy's been doing some research, Eddie's been doing some research, I've been doing

[05:29.360 --> 05:36.960] Tonight, in the second hour, we're going to bring on Pat from Texas, who knows how to
[05:36.960 --> 05:43.040] deal with the land patent issue, how to go back and get a land patent to prove that your

[05:44.680 --> 05:52.520] Now, I do know of one remedy, one technique, but I've only briefly spent time with this
[05:52.520 --> 05:57.760] individual who has basically mastered this technique involving you.
[05:57.760 --> 06:04.560] Basically, the gist of it is this, you ask for a list of all the properties from your
[06:04.560 --> 06:11.280] appraisal district, a list of properties that they have interest in, in other words, public
[06:11.280 --> 06:12.280] properties.
[06:12.280 --> 06:16.600] So they'll give you a list, library, schools, government buildings, etc.
[06:16.600 --> 06:21.560] Then you follow up with a second letter asking them to confirm that your property is not
[06:21.560 --> 06:23.760] on that list.
[06:23.760 --> 06:26.120] And then they'll say, yes, your property is not on the list.
[06:26.120 --> 06:32.160] Then you go petition the district court for an order declaring that your property is private
[06:32.160 --> 06:36.680] property, and then you take that order back to the appraisal district saying, look, I
[06:36.680 --> 06:41.000] have a court order, my property is private property, take my property off the tax roll.
[06:41.000 --> 06:43.440] And they basically have to at that point.
[06:43.440 --> 06:47.560] And then you don't need to argue with the appraisal district about taking your property
[06:47.560 --> 06:48.560] off the tax roll.
[06:48.560 --> 06:54.440] Now, the specifics of how you get that order and the nature of the petition and the filings
[06:54.440 --> 06:57.360] is what I have not totally fleshed out yet.
[06:57.360 --> 07:01.720] And I'll be talking to this person hopefully over the weekend and maybe even be able to
[07:01.720 --> 07:06.280] get him on the show next week because even Pat Baker last night I spoke with him after

[07:33.880 --> 07:39.680] County and in major metropolitan areas like Houston, Dallas, Fort Worth, etc. San Antonio,
[07:39.680 --> 07:40.680] they're going to fight.
[07:40.680 --> 07:42.880] The appraisal district is going to fight.
[07:42.880 --> 07:47.920] And Pat told me last night that even if you go through his process to get your land patent,
[07:47.920 --> 07:52.520] that basically all that does is prove that your property is private property.
[07:52.520 --> 07:57.040] And that you still we still are most likely going to have to go through this additional
[07:57.040 --> 08:02.360] process that procedure that I just described about getting the court order, etc, etc.
[08:02.360 --> 08:07.960] He said we're still probably going to have to do that in addition to getting the land

[08:08.960 --> 08:12.560] The land patent is just additional proof that your property is private property.

[08:57.640 --> 09:01.840] So once again, the first thing you want to do is start taking apart the information about
[09:01.840 --> 09:06.760] the terms that they're using to describe you, the property, or whatever else they may be
[09:06.760 --> 09:08.960] after at the moment.
[09:08.960 --> 09:15.400] In the Texas tax code, there are three specific definitions of the term taxpayer.
[09:15.400 --> 09:20.560] They are in Chapter 101 of the tax code, they are in Chapter 111 of the tax code, and they
[09:20.560 --> 09:24.080] are in Chapter 141 of the tax code.
[09:24.080 --> 09:30.920] We'll start with the simple one under Chapter 141, Multistate Tax Compact, sub-item 3.
[09:30.920 --> 09:37.600] Taxpayer means any corporation, partnership, firm, association, governmental unit or agency
[09:37.600 --> 09:44.040] or person acting as a business entity in more than one state.
[09:44.040 --> 09:46.520] That's pretty succinct, don't you think?
[09:46.520 --> 09:52.840] Chapter 111, taxpayer means the person whose tax obligation the comptroller is seeking
[09:52.840 --> 09:54.640] to determine.
[09:54.640 --> 10:00.560] Notice we have the term person and we have the term tax obligation.
[10:00.560 --> 10:08.360] Then in Chapter 101, taxpayer means a person liable for a tax fee, assessment, or other
[10:08.360 --> 10:14.600] amount imposed by a statute under the authority of a statutory function administered by the
[10:14.600 --> 10:15.600] comptroller.
[10:15.600 --> 10:22.520] Now, we know that statutes themselves are limited in what they can be applied to.
[10:22.520 --> 10:27.080] A statute is not law, it is evidence of law.
[10:27.080 --> 10:32.040] The Supreme Court has said time and time again that statutes when they're being administered
[10:32.040 --> 10:37.080] by judges are ministerial in nature, which means they're administrative in nature.
[10:37.080 --> 10:40.320] So these are administrative rules.
[10:40.320 --> 10:43.640] Administrative rules have nothing to do with the people.
[10:43.640 --> 10:47.680] But as we know from the term person that's used in each and every one of these, if we
[10:47.680 --> 10:53.960] go back to the top of Chapter 101, we notice once again that the purpose of this title
[10:53.960 --> 10:58.600] is to go through the statutory language revision program like they've done in every code in
[10:58.600 --> 11:03.920] Texas since 1963, that's in 101.001.
[11:03.920 --> 11:08.800] And then you have 101.002, construction of code.

[11:11.440 --> 11:17.920] The Code Construction Act, Chapter 311 government code applies to the construction of each
[11:17.920 --> 11:22.880] provision of this title, except as specifically provided by this title.
[11:22.880 --> 11:29.140] And as you all know, Chapter 311.005 sub-item 2 specifically defines person, pretty much
[11:29.140 --> 11:36.000] just like it did back over here in Chapter 141, corporation, partnership, firm, association,
[11:36.000 --> 11:41.260] governmental unit or agency, or any other legal entity.
[11:41.260 --> 11:47.640] So everywhere the term taxpayer is defined in law, it is associated with a legal fiction.
[11:47.640 --> 11:51.480] It is not associated with living people.
[11:51.480 --> 11:55.080] It's never been associated with living people.
[11:55.080 --> 12:02.200] And you will also find that when they define property, Section 1.04 tax code says the definition

[12:03.940 --> 12:09.540] Property means any matter or thing capable of private ownership.
[12:09.540 --> 12:15.780] Now there is a separate definition for real property, for personal property, and tangible
[12:15.780 --> 12:18.160] personal property.
[12:18.160 --> 12:24.580] So as you can see, they all have different definitions and different terminology.
[12:24.580 --> 12:28.600] So they are going to mean different things and they're going to apply different ways.

[13:38.020 --> 13:50.340] But once that payment to the state was matured, then the lien ended, but the state didn't
[13:50.340 --> 13:53.200] tell anybody.
[13:53.200 --> 14:00.840] So they just kept claiming that they held title and they convinced these moronic attorneys
[14:00.840 --> 14:06.080] who didn't know any better to perpetuate the title.
[14:06.080 --> 14:12.480] When in fact, all they had to do was bring forward the original land patent and the land
[14:12.480 --> 14:18.760] that was sold by the state to private interest became the private property of the private
[14:18.760 --> 14:23.760] interest and then the state could no longer tax it.
[14:23.760 --> 14:33.120] One of the things I especially liked about it was that if you bring the land patent forward,
[14:33.120 --> 14:41.760] the laws affecting property taxes that were in effect when the land patent was granted
[14:41.760 --> 14:48.240] are the ones that apply to the land when you bring the patent forward.
[14:48.240 --> 14:55.720] And try not to steal Pat's thunder, that was to me the most succinct presentation of how
[14:55.720 --> 15:00.880] this should work that I had ever come across.
[15:00.880 --> 15:09.920] So if you have property and no one has a legal claim against the property, we should be able
[15:09.920 --> 15:19.040] to bring the patent forward and it becomes our personal private property and the implications

[01:11:32.640 --> 01:11:39.600] special treatment by the board to help them find somebody to alleviate their problem.
[01:11:39.600 --> 01:11:44.720] But you still cannot prevent them from obtaining a license and practicing law.
[01:11:44.720 --> 01:11:46.520] Oh boy.
[01:11:46.520 --> 01:11:51.160] Now the 82.063 retention of client's money.
[01:11:51.160 --> 01:11:56.400] This while it can help in some cases, this section here is pretty much a license to steal

[01:25:56.580 --> 01:25:58.580] land.
[01:25:58.580 --> 01:26:06.580] It says that private land does not have private mineral rights or water rights.
[01:26:06.580 --> 01:26:12.940] This is a major change from all the previous land laws in all the states and in the federal
[01:26:12.940 --> 01:26:18.020] government prior to the UN coming out with that.
[01:26:18.020 --> 01:26:22.420] If you want to get a new land patent, just be advised that's what you're looking at.
[01:26:22.420 --> 01:26:33.100] You're going to get the surface and the surface is down to 300 feet and it used to, like my
[01:26:33.100 --> 01:26:39.500] piece of property, it was patented in 1935 under previous land laws because of when it
[01:26:39.500 --> 01:26:41.540] was originally sold.
[01:26:41.540 --> 01:26:47.500] It has all the minerals, it has all the water, it has all the transitory waters, in other
[01:26:47.500 --> 01:26:55.020] words rainfall, runoff and other waters that may come across its surface and subsurface
[01:26:55.020 --> 01:27:01.180] and all the air to the edge of space.
[01:27:01.180 --> 01:27:07.260] That also includes all the animals that are on the surface and subsurface and in the air
[01:27:07.260 --> 01:27:09.180] above it.
[01:27:09.180 --> 01:27:18.540] I know this sounds strange, but as land law changed over time, it was rewritten, sometimes
[01:27:18.540 --> 01:27:29.020] things were taken out like some of the transitory animals, sometimes transitory water rights.
[01:27:29.020 --> 01:27:34.900] When you do do your research and you get your land patent, it will tell you which land law
[01:27:34.900 --> 01:27:45.380] it was written pursuant to, go get a copy of that particular land law, download it,
[01:27:45.380 --> 01:27:51.220] buy a copy of the book, whatever you got to do to get it in hard copy and I'd get two
[01:27:51.220 --> 01:27:58.780] copies of it because one of them is not going to be enough, I guarantee you, because it
[01:27:58.780 --> 01:28:12.420] will address such issues as easement, land taxes and what happens when somebody dams
[01:28:12.420 --> 01:28:22.100] up a river somewhere or a stream or breaks a dam or on a river or a stream or sucks an
[01:28:22.100 --> 01:28:29.420] aquifer dry or slant drills under your property, but they wouldn't do things like that.
[01:28:29.420 --> 01:28:39.140] I know that's too obscured of occurred, right?
[01:28:39.140 --> 01:28:45.780] The state of Texas in all the land laws has maintained a minimum of a three percent mineral
[01:28:45.780 --> 01:28:56.660] right ownership of very particular minerals, normally the oil, the coal, some gas in some

[01:29:03.500 --> 01:29:12.580] That used to be because of gunpowder and stuff, so when you get your land patent, please get

[01:32:47.500 --> 01:32:54.500] I want to say this. Just getting your land patent will not get you out of property taxes.
[01:32:54.500 --> 01:33:11.500] Property taxes is a fraud or fraudulent contract because of a lot of side issues that Randy and Eddie, they're probably more up on than I am.
[01:33:11.500 --> 01:33:20.500] I've been real lucky in dealing with my local tax people because a lot of the ranchers out here have their land patent
[01:33:20.500 --> 01:33:25.500] because the land has been in the same family since this was a republic.
[01:33:25.500 --> 01:33:28.500] And I'm not talking about the U.S.
[01:33:28.500 --> 01:33:37.500] And they're a little ornery when it comes to paying for the right of owning their own property and using it the way they want to.
[01:33:37.500 --> 01:33:43.500] All the land patent does, and I'm going to reiterate this a couple of times through this evening,
[01:33:43.500 --> 01:33:54.500] the land patent is a declaration of true ownership, true title to the property.
[01:33:54.500 --> 01:34:05.500] A deed is a commercial piece of property that bankers love to have because they can do whatever they want to with it, and so can attorneys.
[01:34:05.500 --> 01:34:11.500] But a deed is color of ownership. It is not true ownership.
[01:34:11.500 --> 01:34:21.500] If you want to get a good feel for this, go to the G.L.O. website, the Texas G.L.O., the General Land Office website.
[01:34:21.500 --> 01:34:30.500] You can Google it or you can do an x-quick search on it and go to Sovereign Land Sales.

[01:34:32.500 --> 01:34:41.500] In Texas, the state still sells school land under sovereign title.
[01:34:41.500 --> 01:34:46.500] And the phone number that's listed is actually for the state surveyor,
[01:34:46.500 --> 01:34:51.500] but he'll transfer you over to the state patent clerk who's an attorney.
[01:34:51.500 --> 01:35:01.500] And the only attorney I know that actually admits to being a land patent attorney works for the state.
[01:35:01.500 --> 01:35:11.500] And he was not real conversant with me when I spent three hours on the phone with him about bringing a patent forward.
[01:35:11.500 --> 01:35:18.500] What I was looking for after having done a lot of research and talking to a lot of people all over the United States
[01:35:18.500 --> 01:35:26.500] and listening to a lot of information put out by very well-meaning people,
[01:35:26.500 --> 01:35:35.500] I found that one, the federal government and Texas transferred land originally on patents.
[01:35:35.500 --> 01:35:42.500] When that land was sold by the individuals, they sold the patent normally.
[01:35:42.500 --> 01:35:45.500] And that patent then had to be brought forward.
[01:35:45.500 --> 01:35:54.500] Or when it was inherited by their heirs or transferred to an assignee, that's where you get the sale,
[01:35:54.500 --> 01:35:59.500] then there was a transfer of that patent.
[01:35:59.500 --> 01:36:02.500] It was brought forward in the other person's name.
[01:36:02.500 --> 01:36:10.500] I wanted to know what was the old procedure before 1950 for bringing that forward.
[01:36:10.500 --> 01:36:12.500] And there was a lot of books out there.
[01:36:12.500 --> 01:36:22.500] Unfortunately, most of them were out of print, and trying to find something online has not been very beneficial.
[01:36:22.500 --> 01:36:25.500] So I started going to the source.
[01:36:25.500 --> 01:36:29.500] You go right to the GLO and you ask them what was the procedure.
[01:36:29.500 --> 01:36:40.500] You go to the archivist and you ask them to look at old copies of other patents and how they were brought forward.
[01:36:40.500 --> 01:36:51.500] The people over in the archives are a great deal more informative and more helpful than anybody else that I have talked to.
[01:36:51.500 --> 01:36:57.500] One, they have copies of the original document, and two, they know exactly what you're talking about
[01:36:57.500 --> 01:37:03.500] and love it when somebody asks them for their opinion or for their information.
[01:37:03.500 --> 01:37:07.500] They're like librarians, only better.
[01:37:07.500 --> 01:37:12.500] They actually have the real stuff.
[01:37:12.500 --> 01:37:16.500] What you do to get your patents, that's always the question.
[01:37:16.500 --> 01:37:18.500] Well, everybody has a deed.
[01:37:18.500 --> 01:37:22.500] The deed has a property description.
[01:37:22.500 --> 01:37:35.500] If you're in a subdivision in a township, you normally have it by street, new subdivision block number and this kind of stuff,
[01:37:35.500 --> 01:37:47.500] but it refers you back to a section and block of a major survey that you can find if you go to your county clerk's office.
[01:37:47.500 --> 01:38:02.500] Normally they have all the major surveys on paper file in their archives in the county records division.
[01:38:02.500 --> 01:38:05.500] You can go there, take your deed with you.
[01:38:05.500 --> 01:38:10.500] Somebody will help you find the appropriate block and section that you want,
[01:38:10.500 --> 01:38:20.500] and they will actually show you on the major survey, and the surveys are laid out in sections, square miles, 640 acres,
[01:38:20.500 --> 01:38:44.500] and they show it may be section A2 of block 72 of survey like mine is Galveston and Houston and San Antonio Rail Company survey of 1856, I believe it was.
[01:38:44.500 --> 01:38:53.500] Now, unfortunately the surveyor that did that was riding on a drunken mule and he was probably sharing that same rye whiskey with the surveyor.
[01:38:53.500 --> 01:39:03.500] So in 1890 they redid the survey and reset some of the PIN and have a new survey from 1890.
[01:39:03.500 --> 01:39:05.500] You can get a copy of that.
[01:39:05.500 --> 01:39:13.500] It doesn't cost you, but, well, depending upon which office you're in and what the county fees are,
[01:39:13.500 --> 01:39:24.500] get a copy of your block and section of that survey and the description of the survey note for that block and section,
[01:39:24.500 --> 01:39:30.500] and it should probably run you about $8 a certified copy for that one particular little thing,
[01:39:30.500 --> 01:39:35.500] and that will be a legal sized piece of paper normally.
[01:39:35.500 --> 01:39:37.500] Get two copies of it.
[01:39:37.500 --> 01:39:43.500] Get two copies of everything you're going to get and you're going to need them.
[01:39:43.500 --> 01:39:51.500] Now, you take that and you go to the archive section in Texas to Austin,
[01:39:51.500 --> 01:40:00.500] and that is three blocks north of the Capitol building in the general land office building on Congress Avenue.
[01:40:00.500 --> 01:40:03.500] On the first floor, go in the front door, go to the left, and there it is.
[01:40:03.500 --> 01:40:05.500] You can't miss it.
[01:40:05.500 --> 01:40:16.500] The state constitution and the constitution of the republic are both on display there in an Argonne-Gasfield case,
[01:40:16.500 --> 01:40:21.500] and if you want to spend an hour or two reading it, it's there.
[01:40:21.500 --> 01:40:33.500] They won't let you touch it, but what you're going to want to do is give the archivist your block and section of your survey
[01:40:33.500 --> 01:40:41.500] and ask them for the patent for that particular block and survey.
[01:40:41.500 --> 01:40:53.500] They'll call it up and they'll bring it out to you, and you'll sit down and you can make notes and stuff on a separate piece of paper,
[01:40:53.500 --> 01:41:01.500] and they'll have the original sales deed, the original receipt when it was paid for,
[01:41:01.500 --> 01:41:05.500] and if it had ever gone into foreclosure for nonpayment,
[01:41:05.500 --> 01:41:13.500] which happened a number of times because of the change in land laws, changing the mineral rights that were transferred with the patent,
[01:41:13.500 --> 01:41:22.500] a lot of times people would buy something, then not pay for it, let it go into foreclosure, and then rebuy it
[01:41:22.500 --> 01:41:30.500] because the state changed the land law while they were originally buying the property,
[01:41:30.500 --> 01:41:37.500] and they wanted the mineral rights or more mineral rights, or they wanted the additional water rights,
[01:41:37.500 --> 01:41:46.500] so that's why that occurred, and you may see the same person that bought the same piece of property four or five times
[01:41:46.500 --> 01:41:55.500] and let it go into foreclosure, but get a copy, and you can request it, of the original sales deed,
[01:41:55.500 --> 01:42:02.500] two copies, get two copies of the patent, and it depends on when the patent was issued,
[01:42:02.500 --> 01:42:08.500] whether it will be in full color or just in black ink on parchment,
[01:42:08.500 --> 01:42:20.500] but it's an oversized document and it's called a letter patent issued by the Commissioner of the General Land Office
[01:42:20.500 --> 01:42:28.500] and signed and granted by the Governor of the State of Texas.
[01:42:28.500 --> 01:42:34.500] Get two copies of that. It will cost you five dollars for a certified copy,
[01:42:34.500 --> 01:42:45.500] and you should already have a survey of your little piece of property because you probably don't have a full section.
[01:42:45.500 --> 01:42:54.500] Most people living in town don't buy a mile by a mile in town somewhere. It's a little expensive.
[01:42:54.500 --> 01:43:01.500] So get a current, if you don't already have it, survey of your piece of property
[01:43:01.500 --> 01:43:06.500] and make sure that the survey notes are in meet and bound.
[01:43:06.500 --> 01:43:14.500] The surveyor will know what you're talking about, and depending upon where you're at,
[01:43:14.500 --> 01:43:17.500] where your property is at, how big it is and all that.
[01:43:17.500 --> 01:43:21.500] A survey can run anywhere from two hundred to several thousand dollars.
[01:43:21.500 --> 01:43:25.500] But get two original copies of that.
[01:43:25.500 --> 01:43:33.500] The surveyor will either have a raised seal or a colored ink seal that he'll stamp it with.
