[21:38.680 --> 21:44.680]  which is just another reason why those of you that shouldn't have need of a license
[21:44.680 --> 21:47.680]  and registration and all that other stuff should not get them,
[21:47.680 --> 21:51.680]  because your private information becomes very public information.

[23:55.680 --> 24:03.680]  And I got a question to ask you. Did you send anybody a notice that you own a private refrigerator?

[24:31.680 --> 24:36.680]  If we let them get away with one thing, we shouldn't expect it to be too long before they're trying to get away with everything,

[25:42.680 --> 25:48.680]  and right now I'm not ready to take on the driver's license issue because they're pretty much, from my understanding,
[25:48.680 --> 25:54.680]  they're a lot stiffer on that issue than some of the other states,
[25:54.680 --> 25:59.680]  and some of my fellow patriots that have tried to fight that are sitting in jail.
[25:59.680 --> 26:05.680]  Well, here's the only thing about that form you need to understand, and it's true of any government form.
[26:05.680 --> 26:14.680]  Anytime you put anything on a piece of paper that belongs to the government, you are seeking a privilege,
[26:14.680 --> 26:20.680]  and a privilege can always be revoked.
[26:20.680 --> 26:22.680]  Now, keep that in mind.
[26:22.680 --> 26:28.680]  When you fill out a piece of paper and give it to a government, you're asking permission for something.
[26:28.680 --> 26:33.680]  There is no other kind of piece of paper that they make.
[26:33.680 --> 26:38.680]  I think that's right.
[26:38.680 --> 26:41.680]  Okay, well, that's a pretty good opinion.

[28:29.680 --> 28:31.680]  and they've already declared you guilty,
[28:31.680 --> 28:35.680]  and the only reason you're going is to argue whether or not you want to pay it,

[01:20:06.680 --> 01:20:16.680]  So what happened is I get this ticket from the officer, and my, I've been listening to you guys for quite some time, and I'm very impressed with all the stuff that Randy's come up with,
[01:20:16.680 --> 01:20:20.680]  and, well, really all three of you, I don't want to discount anyone there.
[01:20:20.680 --> 01:20:31.680]  But basically, I was kind of prepared from the information that I've gotten from you guys in the past, and I went in expecting that I should be, you know, my promise to appear was before magistrate.
[01:20:31.680 --> 01:20:39.680]  I called the courthouse and so forth, and they said there's not one there, and they said there's never one there because they have day jobs,
[01:20:39.680 --> 01:20:45.680]  and that they only come in at night when there's actually court that they have to hold court.
[01:20:45.680 --> 01:20:49.680]  So I was okay, and their normal business hours, they close at 430.
[01:20:49.680 --> 01:20:51.680]  So I show up up there.
[01:20:51.680 --> 01:21:02.680]  My promise to appear was honored before October 1st of 2009, and I showed up with this affidavit in hand expecting there wouldn't be one there and so forth.
[01:21:02.680 --> 01:21:06.680]  So I was prepared to sign it and go next door and get it notarized and so forth.
[01:21:06.680 --> 01:21:16.680]  The affidavit that I wrote was quite interesting if you want to hear briefly. I've got it numbered basically saying I am Don so-and-so.
[01:21:16.680 --> 01:21:18.680]  I'm 39 years old at such-and-such address.
[01:21:18.680 --> 01:21:33.680]  Then bullet point to on September 2nd, excuse me, on the second day of September 2009, I was issued by Officer so-and-so a notice to appear before the municipal court of such-and-such city at this address
[01:21:33.680 --> 01:21:44.680]  as referenced on this such-and-such city police department electronic printout with a presumed document serial number of this six-digit number
[01:21:44.680 --> 01:21:46.680]  because it didn't say that it was a citation number or anything.
[01:21:46.680 --> 01:21:52.680]  It just had a number on there, and I assumed that it was actually their ticket number.
[01:21:52.680 --> 01:21:58.680]  And the notice stated you must appear on or before Thursday, October 1st, 2,200.
[01:21:58.680 --> 01:22:00.680]  The nine was not on the date.
[01:22:00.680 --> 01:22:09.680]  So bullet point number four, I said being of sound mind and moderate intelligence, I assume the year to be 2009.
[01:22:09.680 --> 01:22:11.680]  And then this is where it gets really good.
[01:22:11.680 --> 01:22:18.680]  I said pursuant to the above-mentioned promise to appear, I arrived at the prescribed address on October 1st at 3 p.m.
[01:22:18.680 --> 01:22:28.680]  as evidenced by the court's date stamp on this page to appear before magistrate as required by Texas Transportation Code 543.006B.
[01:22:28.680 --> 01:22:37.680]  So the place specified in the notice to appear must be before magistrate having jurisdiction of the offense who is in the municipality
[01:22:37.680 --> 01:22:41.680]  or the county in which the offense is alleged to have been committed.
[01:22:41.680 --> 01:22:45.680]  And then bullet point number six, no magistrate was present at this place and time.
[01:22:45.680 --> 01:22:50.680]  In fact, I was told by the court officer by phone that the magistrate is never present.
[01:22:50.680 --> 01:23:01.680]  And the presiding judge such and such and the associate judge such and such have day jobs and only come in for court sessions.
[01:23:01.680 --> 01:23:08.680]  Bullet point number seven, after appearing as promised and no magistrate having subject matter jurisdiction being present
[01:23:08.680 --> 01:23:15.680]  and being told no magistrate will be present this day, I have not willfully violated a written promise to appear
[01:23:15.680 --> 01:23:21.680]  and have committed no misdemeanor pursuant to Texas Transportation Code 543.006B,
[01:23:21.680 --> 01:23:29.680]  a person who willfully violates a written promise to appear in court given as provided by this subchapter commits a misdemeanor
[01:23:29.680 --> 01:23:33.680]  regardless of the disposition of the charges which the person is arrested.
[01:23:33.680 --> 01:23:39.680]  Then bullet point number eight, I said I will consider any warrant issued pursuant to failure to appear to be judicial misconduct
[01:23:39.680 --> 01:23:43.680]  and all remedies within the law will be pursued.
[01:23:43.680 --> 01:23:49.680]  I signed it and asked the court clerk to stamp it and he wanted to read it.
[01:23:49.680 --> 01:23:51.680]  Well, okay, read it.
[01:23:51.680 --> 01:23:53.680]  And I said, well, I need to get it notarized.
[01:23:53.680 --> 01:23:55.680]  He goes, well, I can notarize it here.
[01:23:55.680 --> 01:24:02.680]  Well, after he read this, he goes, I can't stamp this and I'm not notarizing it and I need to call the judge.
[01:24:02.680 --> 01:24:12.680]  So he takes my documents in the back room, comes back out and says the judge said that she'll be here at five o'clock if you want to see her.
[01:24:12.680 --> 01:24:14.680]  I was like, all right, whatever.
[01:24:14.680 --> 01:24:16.680]  Remember, they close at 430.
[01:24:16.680 --> 01:24:23.680]  So I walk next door and I get it notarized stating the information, you know, that is my affidavit and I leave.
[01:24:23.680 --> 01:24:29.680]  So I come back at five o'clock and the doors are locked as I expected them to be.
[01:24:29.680 --> 01:24:33.680]  And there's a police officer standing inside and walks over and opens the door.
[01:24:33.680 --> 01:24:34.680]  And he says, are you here to see someone?
[01:24:34.680 --> 01:24:36.680]  I said, yeah, I think the judge is supposed to be.
[01:24:36.680 --> 01:24:37.680]  He says, yeah, come on in.
[01:24:37.680 --> 01:24:39.680]  She's running a couple of minutes late.
[01:24:39.680 --> 01:24:43.680]  So I walk into this courtroom and it's empty.
[01:24:43.680 --> 01:24:44.680]  There's nobody in there.
[01:24:44.680 --> 01:24:45.680]  It's just me.
[01:24:45.680 --> 01:24:53.680]  And about five minutes later, the judge walks in with the clerk, sits on the stand and says, how may I help you?
[01:24:53.680 --> 01:24:55.680]  I said, well, Your Honor, I promised to appear.
[01:24:55.680 --> 01:24:56.680]  Here I am.
[01:24:56.680 --> 01:24:58.680]  What am I here for?
[01:24:58.680 --> 01:25:00.680]  She goes, well, you're here for a ticket.
[01:25:00.680 --> 01:25:03.680]  And I said, she goes, what do you want me to do?
[01:25:03.680 --> 01:25:06.680]  And I said, well, I said, what do you want me to do?
[01:25:06.680 --> 01:25:09.680]  I said, I'm doing what I promised to do.
[01:25:09.680 --> 01:25:11.680]  I appeared.
[01:25:11.680 --> 01:25:15.680]  Now, I was pretty nervous about all this because this is something new to me.
[01:25:15.680 --> 01:25:16.680]  And I didn't really know.
[01:25:16.680 --> 01:25:20.680]  I'm not as familiar with the procedures in court and so forth.
[01:25:20.680 --> 01:25:25.680]  And something I didn't pick up on right away was there was no prosecutor present.
[01:25:25.680 --> 01:25:28.680]  And this is where it gets really, really good.
[01:25:28.680 --> 01:25:33.680]  I told her, I said, she goes, well, do you want to schedule it for a trial?
[01:25:33.680 --> 01:25:35.680]  And I said, well, what is the charge, Your Honor?
[01:25:35.680 --> 01:25:37.680]  She goes, well, the charge is no seat belt.
[01:25:37.680 --> 01:25:39.680]  And I said, well, do you have a complaint?
[01:25:39.680 --> 01:25:41.680]  She goes, well, the ticket is a complaint.
[01:25:41.680 --> 01:25:47.680]  I said, no, ma'am, the ticket can't be the complaint because in Texas it has to be an information or an indictment.
[01:25:47.680 --> 01:25:51.680]  And she goes, well, no, Title 45 or something.
[01:25:51.680 --> 01:26:00.680]  She started spitting off the title, I think Title 45 that said that the complaint can be issued on a citation alone or something like that.
[01:26:00.680 --> 01:26:02.680]  But I wasn't prepared to be able to argue with her.
[01:26:02.680 --> 01:26:06.680]  And she goes, and I said, well, do you have the complaint?
[01:26:06.680 --> 01:26:08.680]  And she goes, well, I can get a complaint.
[01:26:08.680 --> 01:26:11.680]  And I said, well, I think I have to have a complaint before I can plead.
[01:26:11.680 --> 01:26:12.680]  I don't know what the complaint is.
[01:26:12.680 --> 01:26:14.680]  I can't plead one way or the other without a complaint.
[01:26:14.680 --> 01:26:15.680]  She goes, well, have a seat.
[01:26:15.680 --> 01:26:19.680]  We'll get the officer in here and get a sworn statement from him.
[01:26:19.680 --> 01:26:25.680]  So I sat down and about 10 minutes later an officer comes in, which was not the officer that gave me the ticket, by the way.
[01:26:25.680 --> 01:26:27.680]  And I thought, well, okay, where is this going?
[01:26:27.680 --> 01:26:34.680]  So he goes up and he swears a statement that, and this is what I didn't understand this whole process.
[01:26:34.680 --> 01:26:40.680]  And she told me that when he left, she said that you'll know that that's not the officer that gave you the ticket.
[01:26:40.680 --> 01:26:49.680]  And his statement is considered hearsay, which is allowed under such and such rule, or that's an exception under the hearsay rule.
[01:26:49.680 --> 01:26:53.680]  And I could not find anything that actually would allow this statement.
[01:26:53.680 --> 01:26:55.680]  Yes, okay, there is one.
[01:26:55.680 --> 01:26:56.680]  Okay.
[01:26:56.680 --> 01:26:59.680]  She just stepped in it big time.
[01:26:59.680 --> 01:27:06.680]  The exception is at an examining trial.
[01:27:06.680 --> 01:27:10.680]  Hearsay is sufficient to make the allegation.
[01:27:10.680 --> 01:27:19.680]  So there's only one place she can hold an examining trial, and that's under Chapter 16, a whole chapter.
[01:27:19.680 --> 01:27:27.680]  Now you need to go back and talk to that judge about exercising the hearsay exemption.
[01:27:27.680 --> 01:27:33.680]  And what about all of this other stuff that's in here?
[01:27:33.680 --> 01:27:34.680]  Okay.
[01:27:34.680 --> 01:27:40.680]  Well, this is where after I left the court, I'll try to be brief about the rest of this story.
[01:27:40.680 --> 01:27:43.680]  But basically she said, okay, well, we've got the complaint here.
[01:27:43.680 --> 01:27:49.680]  She says, normally I'm not required to give you the complaint until one day before trial, but I'm going to go ahead and give it to you.
[01:27:49.680 --> 01:27:52.680]  And she says, do you want a jury trial or the judge?
[01:27:52.680 --> 01:27:55.680]  And I said, well, I'll leave it up to you and trust you.
[01:27:55.680 --> 01:28:00.680]  And she goes, well, actually she said I'm going to go ahead and recuse myself,
[01:28:00.680 --> 01:28:05.680]  and she's going to let the other judge do it because she's already reviewed all this information and seen my file and everything.
[01:28:05.680 --> 01:28:10.680]  And she goes, do you want a jury trial or a bench trial?
[01:28:10.680 --> 01:28:11.680]  And I said, well, I'll trust you.
[01:28:11.680 --> 01:28:13.680]  She goes, no, you've got to decide.
[01:28:13.680 --> 01:28:17.680]  No, I said what I mean is I will trust you in making the decisions on the case.
[01:28:17.680 --> 01:28:19.680]  So I went ahead and just did a bench trial.
[01:28:19.680 --> 01:28:24.680]  I figured it would be easier than dragging it out through a jury, and it would be easier to convince one person than 12.
[01:28:24.680 --> 01:28:31.680]  But anyway, so basically she was, after I left the court, I got to thinking,
[01:28:31.680 --> 01:28:34.680]  because she brought up the comment about ex parte conversation.
[01:28:34.680 --> 01:28:36.680]  She goes, well, what do you want me to do with this?
[01:28:36.680 --> 01:28:40.680]  I said, well, she goes, I can't rule on my own motion.
[01:28:40.680 --> 01:28:42.680]  I thought that was kind of a hint to me that I need to make a motion.
[01:28:42.680 --> 01:28:44.680]  I said, well, I move to dismiss.
[01:28:44.680 --> 01:28:48.680]  She goes, well, I can't rule on that because of the fact that the prosecutor is not here.
[01:28:48.680 --> 01:28:50.680]  And any conversation would be ex parte.
[01:28:50.680 --> 01:28:51.680]  Well, I didn't think about it.
[01:28:51.680 --> 01:28:53.680]  The entire proceeding was ex parte.
[01:28:53.680 --> 01:28:59.680]  And as a matter of fact, the very beginning of the conversation was she actually said, okay,
[01:28:59.680 --> 01:29:02.680]  let it be known that it's 5 o'clock, Mr. Beckham is here and so forth.
[01:29:02.680 --> 01:29:04.680]  And I was like, are we on the record?
[01:29:04.680 --> 01:29:06.680]  That was what I asked her when she said that.
[01:29:06.680 --> 01:29:07.680]  She goes, no.
[01:29:07.680 --> 01:29:09.680]  I said, well, I didn't think this was a court of record.
[01:29:09.680 --> 01:29:10.680]  She goes, well, how do you know that?
[01:29:10.680 --> 01:29:12.680]  I said, well, I asked.
[01:29:12.680 --> 01:29:16.680]  So I said, really, nothing that we do here even matters.
[01:29:16.680 --> 01:29:20.680]  And she was real friendly, you know, based on the circumstances.
[01:29:20.680 --> 01:29:23.680]  But the bottom line is I think she screwed up left and right here,
[01:29:23.680 --> 01:29:32.680]  especially when to me she was acting as prosecutor when she solicited the complaint from the officer.
[01:29:32.680 --> 01:29:38.680]  She actually went and asked the officer to get the officer in the courtroom to swear the complaint.
[01:29:38.680 --> 01:29:40.680]  Hey, Don, hang on the line here.
[01:29:40.680 --> 01:29:43.680]  So you can continue on the other side of the break.

[01:31:45.680 --> 01:31:49.680]  Yeah, first thing is, Don, the judge lied through her teeth.
[01:31:49.680 --> 01:32:00.680]  There is no part of Chapter 45 that allows a municipal court to proceed on complaint alone, does not exist.
[01:32:00.680 --> 01:32:11.680]  In fact, the Texas Supreme Court has ruled in only one instance, and that's a JP court, can they move forward on complaint alone, but not a municipal court.
[01:32:11.680 --> 01:32:25.680]  And even the Supreme Court has failed to take into account the Texas Constitution, which specifically states that there are only two documents that grant jurisdiction to a court, and they are an indictment or an information.
[01:32:25.680 --> 01:32:34.680]  The complaint does not grant jurisdiction to the court for any purpose other than issuing a warrant.
[01:32:34.680 --> 01:32:47.680]  Yeah, I've heard you say that, and that brings me to a question regarding that. I was looking at the Constitution. I was listening to a last week's show last night and was looking through the Constitution on some of the points you've made.
[01:32:47.680 --> 01:32:53.680]  And I looked at that section you're referring to, and I'm a little confused by that.
[01:32:53.680 --> 01:33:14.680]  It says that the information or indictment is necessary unless the punishment is a fine or incarceration in the penitentiary, I believe.
[01:33:14.680 --> 01:33:21.680]  I'm going to pull that up as we're talking here and actually see, because I did have a question. I was going to email you about that particular topic.
[01:33:21.680 --> 01:33:38.680]  But back on this particular issue, it's funny, she went ahead and called the officer in, he swore in the complaint, and asked how I plead, and I said, not guilty, and I wanted a bench trial.
[01:33:38.680 --> 01:33:51.680]  And we're negotiating the date, massaging on her calendar where this date's going to fall, and it actually fell right after the seminar.
[01:33:51.680 --> 01:33:58.680]  And I asked her, I said, well, I don't know if that's going to give me enough time to get my pre-trial motions in, because I actually have a seminar to go to on this very topic.
[01:33:58.680 --> 01:34:04.680]  And she was like, what topic? And I said, on traffic law. And that raised her eyebrows.
[01:34:04.680 --> 01:34:15.680]  So anyway, she was quite accommodating on the dates. She goes, well, I want you to be sure to get your education, and so forth, almost kind of sarcastically.
[01:34:15.680 --> 01:34:28.680]  And she set the date for November 4th, and she said that apparently she accepts the motions, any motions, because I told her I was going to challenge subject matter jurisdiction.
[01:34:28.680 --> 01:34:31.680]  And she goes, well, what makes you think we don't have jurisdiction?
[01:34:31.680 --> 01:34:40.680]  I said, well, honestly, Your Honor, I didn't expect you to be here today, so I'm not prepared to make that argument right now.
[01:34:40.680 --> 01:34:46.680]  Besides that, I didn't even think at the time, the fact that there was no prosecutor, I shouldn't be having to make the argument.
[01:34:46.680 --> 01:35:00.680]  But anyway, so I'm scheduled for November 4th, and I'm hoping that that is not too close to the information, that I'm too close to the seminar, that I can't get certain pre-trial motions filed with them.
[01:35:00.680 --> 01:35:05.680]  Like, I'm not sure if I really should request a court reporter, do the motion for requesting a court reporter.
[01:35:05.680 --> 01:35:18.680]  You always want a court reporter. You want it on the record, because if you appeal any decision they make, the court is required by law to forward a certified copy of the transcript to the appellate court.
[01:35:18.680 --> 01:35:21.680]  That's right in the Code of Criminal Procedure.
[01:35:21.680 --> 01:35:25.680]  Now, that's my responsibility to get the copy of that transcript.
[01:35:25.680 --> 01:35:37.680]  No, no, no, no, no. The law specifically says that on an appeal, the court must forward a certified copy of the transcript of the proceedings to the appellate court.
[01:35:37.680 --> 01:35:44.680]  I wish I would have known that on a previous case, because I had to pay like $300 for the transcript.
[01:35:44.680 --> 01:35:51.680]  Now, you have to get a copy of the transcript to study for yourself, if you wish to do, to argue points of error in the transcript.
[01:35:51.680 --> 01:36:01.680]  But the law specifically says that if an appeal is taken, it's the court's responsibility to ensure that the appellate court gets a certified copy of the transcript of the proceedings.
[01:36:01.680 --> 01:36:05.680]  I brought that issue up to Randy and showed it to him right where it says that.
[01:36:05.680 --> 01:36:10.680]  Yeah, I'd like to see that statute also too, because like I said, I had an attorney dealing with an appeal for a family member.
[01:36:10.680 --> 01:36:15.680]  44.18 Code of Criminal Procedure and 44.17.
[01:36:15.680 --> 01:36:19.680]  All right, I'll go look that up. Yeah, I had a family member that basically, go ahead.
[01:36:19.680 --> 01:36:22.680]  The charge is seatbelt, right?
[01:36:22.680 --> 01:36:26.680]  Yes, actually the charge is that it's not really a charge anywhere.
[01:36:26.680 --> 01:36:38.680]  It's basically a complaint that says, I, the undersigned affiant, do solemnly swear, and this is where he got away with this, I guess, this hearsay thing, because he never swore that he saw me without the seatbelt.
[01:36:38.680 --> 01:36:50.680]  He says, I, the undersigned affiant, do solemnly swear that I have good reason to believe and do believe that Don's underhearing called defendant on the second day of September,
[01:36:50.680 --> 01:36:58.680]  and before making this filing complaint in the territory limits of this city and the county of Montgomery, the state of Texas,
[01:36:58.680 --> 01:37:10.680]  then, did then and there unlawfully operate a motor vehicle on a public roadway to wit, and then the actual, the actual physical address he pulled me over and says,
[01:37:10.680 --> 01:37:17.680]  did occupy the front seat of the motor vehicle as a driver and was not secured by the safety belt.
[01:37:17.680 --> 01:37:18.680]  Okay, stop right there for a second.
[01:37:18.680 --> 01:37:22.680]  I know all of the definitions that you're going to go for with motor vehicle and operating.
[01:37:22.680 --> 01:37:30.680]  No, no, no. We're not even going to have to go there. We don't have to. Section 545.413, safety belts, offense.
[01:37:30.680 --> 01:37:35.680]  This is what has to occur for you to be cited for a seatbelt ticket, okay?
[01:37:35.680 --> 01:37:36.680]  Okay.
[01:37:36.680 --> 01:37:49.680]  A person commits an offense if the person is at least 15 years of age, is riding in the front seat of a passenger vehicle while the vehicle is being operated,
[01:37:49.680 --> 01:37:59.680]  is occupying a seat that is equipped with a safety belt and is not secured by a safety belt or as the operator of a school bus, okay?
[01:37:59.680 --> 01:38:01.680]  And the person is not secured.
[01:38:01.680 --> 01:38:07.680]  A person commits an offense if the person operates a passenger vehicle that is equipped with safety belts
[01:38:07.680 --> 01:38:15.680]  and allows a child who is younger than 17 years of age and who is not required to be secured in a child passenger safety seat system
[01:38:15.680 --> 01:38:21.680]  to ride in the vehicle without requiring the child to be secured by a safety belt, okay?
[01:38:21.680 --> 01:38:22.680]  Right.
[01:38:22.680 --> 01:38:24.680]  And the child is actually occupying a seat.
[01:38:24.680 --> 01:38:32.680]  You see, the problem here is, one, you're not the person operating a passenger vehicle.
[01:38:32.680 --> 01:38:37.680]  In-law passenger vehicle would be a taxicab, shuttle bus, so on and so forth.
[01:38:37.680 --> 01:38:40.680]  That definition exists right there in the code.
[01:38:40.680 --> 01:38:45.680]  A passenger vehicle is a vehicle that is used for commercial transportation.
[01:38:45.680 --> 01:38:46.680]  Right.
[01:38:46.680 --> 01:38:56.680]  I've been, I've heard you go down this road many, many times about how the definition basically removed you from the applicability of the statute.

[01:42:18.680 --> 01:42:32.680]  And here you have no valid criminal affidavit as the affidavit is insufficient on its face to show cause for issuing a civil warrant.
[01:42:32.680 --> 01:42:35.680]  And that's what the judge has to do after the examining trial.

[01:42:37.680 --> 01:42:40.680]  You need to check for an order.
[01:42:40.680 --> 01:42:47.680]  Look in chapter 16, chapter, look in 1617 and 1620.

[01:49:45.680 --> 01:49:54.680]  What it does do is deprive you of subject matter jurisdiction to decide whether or not I committed this act.
