[04:57.480 --> 05:03.240] important to get the message out because tomorrow is election day and it's election day actually

[05:05.880 --> 05:15.000] People in every state will be able to vote for delegates to the Continental Congress
[05:15.000 --> 05:21.240] 2009 and this is a very historic event that's coming up, it will be happening in November
[05:21.240 --> 05:26.160] but tomorrow is the election day to choose the delegates from the states that will go
[05:26.160 --> 05:31.240] and represent the people of each state including the District of Columbia and yes, here in
[05:31.240 --> 05:37.120] Texas we have eight voting centers spread out around the state.
[05:37.120 --> 05:41.640] We do have one here in Austin for people listening here in Austin, it's going to be at the Ruta
[05:41.640 --> 05:48.160] Maya importing company, the Ruta Maya Coffee House down on South Congress and if I could
[05:48.160 --> 05:56.000] I'll just throw out some websites or a website where people can go and get information because
[05:56.000 --> 06:02.080] I just want to be sure that people can find where they can go vote.

[06:29.840 --> 06:37.280] very top of their state page the delegates who are running, excuse me the candidates
[06:37.280 --> 06:46.080] who are running for the position of delegate are shown on each homepage or each state page.
[06:46.080 --> 06:54.640] For instance here in Texas we have let's see I think it's 14, yes 14 candidates running
[06:54.640 --> 07:00.800] for three positions because each state as I said will be sending three delegates to
[07:00.800 --> 07:06.720] the Continental Congress 2009 which is going to be happening in St. Charles, Illinois which
[07:06.720 --> 07:15.520] is about an hour outside of Chicago and if I could probably talk, you're off about this
[07:15.520 --> 07:18.960] whole thing about the Continental Congress but I know you've got a big show coming up
[07:18.960 --> 07:24.640] and all the information people need to know about the Continental Congress can be found
[07:24.640 --> 07:30.160] on the website but essentially it's a peaceful way for people to come together, talk about
[07:30.160 --> 07:35.380] the violations that have been happening against you know the Constitution, how the government
[07:35.380 --> 07:42.680] is not following the Constitution and just like the first one which was back in 1774
[07:42.680 --> 07:50.800] they basically came up with some direction that they wanted to take because at that time
[07:50.800 --> 07:58.840] it was King George and they had been trying to get their grievances you know answered
[07:58.840 --> 08:06.320] and things changed but they weren't able to do that and then it led into finally deciding
[08:06.320 --> 08:10.800] to strike on you know for independence but nobody knows what the outcome of this Continental
[08:10.800 --> 08:15.840] Congress will be but the first step is this election and the important thing to know is
[08:15.840 --> 08:21.360] that these elections are going to be held using hand counted paper ballots so if you
[08:21.360 --> 08:26.040] can make it to a voting center you will be voting in the way that we all should be voting
[08:26.040 --> 08:32.280] and this is something Vote Rescue has been a proponent of for nearly five years now is
[08:32.280 --> 08:37.120] totally transparent elections where every step is observable and a example.
[08:37.120 --> 08:40.480] They are going to count them in public view.
[08:40.480 --> 08:49.360] They are counted in public yes sir they surely are and all the states let's just say that
[08:49.360 --> 08:57.600] there are voting centers I believe in about 18 different states so not every state has
[08:57.600 --> 09:00.560] you know voting center or voting centers.
[09:00.560 --> 09:08.680] If you are in a state that does not have one you can still vote by mail.
[09:08.680 --> 09:14.240] We do have it set up so that you can send in a mail in ballot but you have to fill out
[09:14.240 --> 09:20.840] a registration form that needs to be notarized so it means to you know finding the notary
[09:20.840 --> 09:25.840] in the morning and then getting it postmarked by tomorrow night so that it will be counted
[09:25.840 --> 09:31.640] and we are counting the mail in ballots a week from tomorrow but all the ballots cast
[09:31.640 --> 09:38.640] tomorrow at these voting centers will be counted in public and everyone is welcome to be part
[09:38.640 --> 09:44.200] be present and observe that because that is what we are trying to show is that this is
[09:44.200 --> 09:50.920] how we want our elections run so it is wonderful that we have got this opportunity to educate
[09:50.920 --> 09:59.120] people about hand counted paper ballot elections in conjunction with this goal of sending delegates
[09:59.120 --> 10:01.120] to the Continental Congress.
[10:01.120 --> 10:06.160] Excellent and it is my understanding just to put this out there to the listeners this
[10:06.160 --> 10:13.320] is not some kind of parallel government or we are electing a common law congress or any
[10:13.320 --> 10:19.880] of this kind of craziness like that this is just a meeting of the minds of people getting
[10:19.880 --> 10:22.200] together to discuss ideas basically.

[11:52.360 --> 11:58.400] on this issue for probably 14 years or more specifically sending in grievances to the
[11:58.400 --> 12:01.800] government so this isn't something that just has evolved overnight.
[12:01.800 --> 12:08.120] Bob's been, and he's got a huge following through We the People and he decided that
[12:08.120 --> 12:12.280] Continental Congress was the next step and a lot of people have agreed and this is where

[18:59.680 --> 19:02.160] heard from our mutual friend Aaron.

[19:11.040 --> 19:15.560] a few months ago talking about, you know, what you've been doing from the beginning.

[19:23.160 --> 19:27.720] I tell you what, I think you hit it right on the head, nail on the head there.
[19:27.720 --> 19:31.480] It has been a bit of a soap opera, if you will.
[19:31.480 --> 19:36.960] In September 10th of 2008, my vehicle was photographed going through an intersection
[19:36.960 --> 19:46.320] here in College Station by a photo enforcement camera and I got a notice about a month later.
[19:46.320 --> 19:51.800] While reading the notice on the front, of course, I realized that it proclaimed me guilty
[19:51.800 --> 19:58.840] without a trial and I, of course, went down to the court and tried to appeal it, further
[19:58.840 --> 20:03.420] found out there's no option for a jury trial, there's no option for appeal, there's no
[20:03.420 --> 20:11.200] option to face and cross-examine the witnesses in the case and at the same time the state
[20:11.200 --> 20:18.240] can choose to charge you under a criminal charge under section 544 of the transportation
[20:18.240 --> 20:23.800] code or under section 707, which is a photo enforcement, the state gets to choose how
[20:23.800 --> 20:34.320] they want to prosecute you for the same violation and because of the due process violations
[20:34.320 --> 20:42.400] and the 14th Amendment equal protection challenges I had from day one, it just smelled bad to
[20:42.400 --> 20:51.760] me so I fought that initially through the city and then worked through the state legislature
[20:51.760 --> 20:58.280] trying to get the law changed and the drama goes that the city of College Station, when
[20:58.280 --> 21:05.440] we were close to having an amendment to the transportation bill in this past session passed
[21:05.440 --> 21:11.280] a 20-year extension to the existing red light camera contract here in College Station on
[21:11.280 --> 21:17.320] May 29th and on June 3rd I put up a little tent out on one of the main streets here in
[21:17.320 --> 21:24.960] College Station and began collecting signatures for an ordinance initiative as we have the
[21:24.960 --> 21:30.720] rights under the College Station City Charter, we completed that and turned it in and now
[21:30.720 --> 21:37.360] sure enough we're going to get the vote on this on November 3rd and in a lot of ways
[21:37.360 --> 21:45.800] the drama just tightens from that spot because in the ensuing couple of months here the photo
[21:45.800 --> 21:53.320] enforcement vendor for the City of College Station has began funding a political action
[21:53.320 --> 22:02.000] committee that's opposing us, they've had about $25,000 in campaign expenditures through
[22:02.000 --> 22:10.560] September 24th and we are sitting proudly at $1,800 and about $75,000 just under $1,900
[22:10.560 --> 22:18.080] in campaign expenditures but knock on wood I think it's going to come our way on November
[22:18.080 --> 22:25.560] 3rd that's the one that matters when people go to the polls for real and vote on November
[22:25.560 --> 22:28.240] 3rd to get rid of the red light cameras.
[22:28.240 --> 22:35.080] Okay so Jim just to reiterate let me get this straight again for our listeners, the private
[22:35.080 --> 22:42.160] company that would be contracted for these red light cameras set up a political action
[22:42.160 --> 22:49.320] committee and funded how much money out of their own pocket like $10,000 or something?
[22:49.320 --> 22:57.120] Yes the vendor to the City of College Station sent a check for $10,000 to some local residents
[22:57.120 --> 23:06.360] to help fund their opposition to me, the company that actually prints the red light camera
[23:06.360 --> 23:15.720] tickets for that vendor in Houston gave an in kind donation of $6,500 to their campaign
[23:15.720 --> 23:22.320] to print up and distribute and mail out a nice glossy brochure, I mean I feel like those
[23:22.320 --> 23:29.000] companies have the right just like anybody else to express an opinion, it's just amazing
[23:29.000 --> 23:37.080] to me that it's billed as a grass roots opposition to what we're doing in the city and there
[23:37.080 --> 23:43.520] isn't a single person from College Station that's donated a dollar to their campaign.
[23:43.520 --> 23:49.000] Yeah grass roots opposition to your opposition to red light cameras.
[23:49.000 --> 23:52.320] Right, hey hey hey these roots go deep.

[25:28.880 --> 25:35.680] funded out of Arizona hired an administrative law firm out of Austin to do an investigation
[25:35.680 --> 25:44.880] on me and as it turns out under the Texas election code if an individual spends $100
[25:44.880 --> 25:52.680] of their own money circulating a petition that person owes a campaign finance report
[25:52.680 --> 25:58.200] to the local authority regarding the measure that they're working on.
[25:58.200 --> 26:02.760] I was totally clueless, I had no idea that it was a requirement of the law so of course
[26:02.760 --> 26:12.320] I didn't file anything so that is the source of ethics charges against me from Austin out
[26:12.320 --> 26:26.320] of a law firm out of Austin and then I looked at that, the state rules call for general
[26:26.320 --> 26:34.000] political action committees can take as much cash as they want for individuals, specific
[26:34.000 --> 26:38.080] action political action committees which I would be because I only have one issue and
[26:38.080 --> 26:46.160] that's a red light camera, have a limitation of $100 in donations in cash.
[26:46.160 --> 26:53.560] I took a $2,000 donation, I receded it in a receipt book, I deposited it in the HAC
[26:53.560 --> 27:01.400] bank account and talked about it on the radio much like I'm doing here and of course that
[27:01.400 --> 27:07.240] was one of the ethics charges too so I returned the $2,000 donation that day as soon as I
[27:07.240 --> 27:11.080] became aware of the regulation.
[27:11.080 --> 27:17.080] I look at this much like many other citizens that there's kind of a soft tyranny that there
[27:17.080 --> 27:25.880] are so many regulations and so much code that must be complied with that any one of us,
[27:25.880 --> 27:33.440] if somebody wants to bear down on us and investigate our lives, that is kind of a tyranny over
[27:33.440 --> 27:41.960] us in that it's virtually impossible for a citizen, I'm not an attorney, I have no training
[27:41.960 --> 27:47.080] in the law, to comply with all the laws that are on the book.
[27:47.080 --> 27:50.480] If somebody wants to investigate your life long enough they're going to find something
[27:50.480 --> 27:53.280] to bring against you and that's kind of my scenario.
[27:53.280 --> 28:01.200] Even as most youth I'll take my lumps when I go in front of the ethics commission and
[28:01.200 --> 28:06.160] I'll just deal with that, I consider it tuition, if you will.

[28:40.480 --> 28:46.320] about what the city is doing and I received an open record request on October 5th that
[28:46.320 --> 28:56.280] revealed that the city was spending $20,000 of public funds on a brochure that, quote
[28:56.280 --> 28:58.640] unquote, was a voter education brochure.
[28:58.640 --> 29:02.000] Those are all online on my web page.
[29:02.000 --> 29:07.760] I have both the stories, I have the campaign finance reports in totality for both of our
[29:07.760 --> 29:16.280] groups and I also have the complaint I filed with the Texas Ethics Commission regarding
[29:16.280 --> 29:23.480] the city of College Station, City Manager Glenn Brown approving the expenditure of $20,000
[29:23.480 --> 29:26.400] of public funds for that advertising.
[29:26.400 --> 29:30.880] There's a couple of components in that code that have to be met.

[32:22.040 --> 32:29.040] Bill of Rights, Article 1 of the state constitution, Article 29, or Section 29 of Article 1 specifically
[32:29.040 --> 32:35.040] states that all of the proclamations in the Bill of Rights are forever removed from the
[32:35.040 --> 32:38.040] general powers of the legislature.
[32:38.040 --> 32:43.040] They can't vote on it, they can't write a law that alters it or in any way affects any
[32:43.040 --> 32:48.040] of the rights in the Bill of Rights in Texas, and this would do exactly that.
[32:48.040 --> 32:53.040] They are prohibiting political speech and movement by a citizen when that power is
[32:53.040 --> 33:00.040] strictly reserved to him within our state constitution.
[33:00.040 --> 33:09.040] Every time I come on here, I learn something brand new.
[33:09.040 --> 33:14.040] The difficulty faced in this kind of thing is that you've got to go up there and you've
[33:14.040 --> 33:17.040] got to fight all this, right?
[33:17.040 --> 33:26.040] You're a normal citizen in a small town in Texas, and to go up there and swing for the
[33:26.040 --> 33:35.040] teachers in Austin is a rather daunting task for the regular U.S. citizen, you know?
[33:35.040 --> 33:38.040] Well, first off, Jim, you're not a U.S. citizen.
[33:38.040 --> 33:40.040] Don't ever fall into that trap.
[33:40.040 --> 33:46.040] The second thing is that the Agenda 21 guys on their show tonight said something I absolutely
[33:46.040 --> 33:48.040] agree with.
[33:48.040 --> 33:54.040] In order to enforce your rights, you must know your rights and you must be willing to
[33:54.040 --> 33:56.040] get on them no matter what.
[33:56.040 --> 34:01.040] The moment you back off of your rights is the moment you lose them, and we have done
[34:01.040 --> 34:03.040] too much backing up.
[34:03.040 --> 34:05.040] Well, I would sure agree with that.
[34:05.040 --> 34:10.040] I would sure agree with that because, you know, in this scenario, I mean, that's been
[34:10.040 --> 34:16.040] the foundation of my argument no matter how elementary from a rule of law perspective.
[34:16.040 --> 34:22.040] I mean, frankly, I didn't even realize, I mean, you know, just like most people, you
[34:22.040 --> 34:28.040] grow up just kind of understanding and trying to assimilate into the population.
[34:28.040 --> 34:34.040] You know, the rule of law is at foundation here the only thing we have that's keeping
[34:34.040 --> 34:36.040] us from tyranny.
[34:36.040 --> 34:41.040] And in this scenario, I think the state has definitely gone overboard on this
[34:41.040 --> 34:45.040] photo enforcement type issue.
[34:45.040 --> 34:49.040] Well, it all comes down to other arguments I've got for the traffic seminar and
[34:49.040 --> 34:54.040] everything else, but it really comes to the point where if people could just learn
[34:54.040 --> 34:59.040] basic English definitions, they would have enough questions to go find the legal
[34:59.040 --> 35:00.040] definitions.
[35:00.040 --> 35:06.040] Everybody out there, go to a dictionary, for instance, and look up the word
[35:06.040 --> 35:08.040] transportation.
[35:08.040 --> 35:12.040] Every statute he's discussing right here that he's railing against and the ones I
[35:12.040 --> 35:16.040] intend to discuss fall under the transportation code.
[35:16.040 --> 35:22.040] Transportation, the definition of it is commerce.
[35:22.040 --> 35:27.040] We're dealing with a code that is intended to regulate commerce.
[35:27.040 --> 35:31.040] Therefore, the only people that any of the sections of that code can apply to are
[35:31.040 --> 35:35.040] those engaged in commerce.
[35:35.040 --> 35:39.040] That's the only authority we gave our legislature to regulate.
[35:39.040 --> 35:41.040] It certainly was not us.
[35:41.040 --> 35:46.040] And I can prove that right out of one of the statements made in the State
[35:46.040 --> 35:48.040] Constitution Bill of Rights.
[35:48.040 --> 35:49.040] Jim.

[37:28.040 --> 37:35.040] And when you countersue to remove it to a higher court and you become the
[37:35.040 --> 37:37.040] plaintiff, you become the aggressor.
[37:37.040 --> 37:42.040] So it's a whole different animal when you're crawling down their throat,
[37:42.040 --> 37:46.040] stomping your feet all the way and using their law to do it.

[37:47.040 --> 37:51.040] And Justice O'Connor's book, O'Connor's Causes of Action, makes it very,
[37:51.040 --> 37:55.040] very clear in the section on suits against the government,
[37:55.040 --> 38:02.040] if any public official violates a self-enacting clause of the state
[38:02.040 --> 38:10.040] Constitution, they have zero immunity against suit.

[38:11.040 --> 38:15.040] So if the mayor and the city council wants to institute an unauthorized
[38:15.040 --> 38:23.040] tax in the form of this red light camera, then and reach into the pocket of
[38:23.040 --> 38:27.040] the citizen and take money and put it in the city coffers,
[38:27.040 --> 38:33.040] then it's fair for you to reach in their pockets and put money into your
[38:33.040 --> 38:34.040] coffers.

[40:42.040 --> 40:46.040] So you have reason to believe that is the case.
[40:46.040 --> 40:49.040] Did you file criminal charges against the perpetrator?

[41:57.040 --> 42:02.040] You present that to a magistrate that invokes his duty under Article 210,
[42:02.040 --> 42:07.040] as a magistrate, to hold an examining trial under Article 211.
[42:07.040 --> 42:15.040] If the magistrate fails to perform a duty, requires, fails to perform his duty,
[42:15.040 --> 42:20.040] that's misfeasance in office, and in the process denies you and your right
[42:20.040 --> 42:25.040] to petition the court for redress of grievance and equal protection of the laws.
[42:25.040 --> 42:28.040] That's a violation of 39.03 Penal Code.
[42:28.040 --> 42:29.040] It's a Class A misdemeanor.
[42:29.040 --> 42:35.040] Then you take a complaint against the mayor to the district attorney,
[42:35.040 --> 42:38.040] accusing him of official oppression.
[42:38.040 --> 42:43.040] The district attorney said, I'm not going to give this to the grand jury.

[42:45.040 --> 42:50.040] You filed against the district attorney for not putting the mayor in front of
[42:50.040 --> 42:54.040] the grand jury, and all of a sudden the mayor is watching this turn into a

[42:57.040 --> 43:04.040] Everybody's getting in trouble because they won't prosecute me.
[43:04.040 --> 43:08.040] This, a good chance, especially in a small community, will get you some

[47:16.040 --> 47:21.040] The intent of the City Council in this red light program has always been to
[47:21.040 --> 47:23.040] improve safety, right?
[47:23.040 --> 47:30.040] To me, those are not unbiased statements relating to the red light camera system.

[47:32.040 --> 47:33.040] Yes.
[47:33.040 --> 47:38.040] Under a section labeled facts by the City of College System, by the way, this is
[47:38.040 --> 47:39.040] all online.
[47:39.040 --> 47:44.040] I've posted the entire complaint online, so the brochure is there and everything.

[47:47.040 --> 47:53.040] The facts, and I attached the email here also, show that red light camera crashes
[47:53.040 --> 48:01.040] from 2007 to 2008 were up 200% at the red light camera intersection at the

[49:53.040 --> 50:00.040] but certainly through the use of Open Records Act, it is a tremendous tool.

[50:04.040 --> 50:08.040] in that Open Records Clause every minute you possible can.

[50:10.040 --> 50:15.040] whatever the ethics charges they're trying to bring against you is a separate issue

[52:57.040 --> 53:05.040] I don't know exactly how all that works, but somehow change it so that it's a more general type of political action committee?

[53:14.040 --> 53:21.040] But then you have a whole different set of rules that apply to a general in that.
[53:21.040 --> 53:27.040] For instance, for a general PAC, you can't take an equivalent contribution.

[53:56.040 --> 54:05.040] Now, if you don't fill in the form, of course, somebody takes the effort to hire an attorney in Austin to do an investigation of you.

[54:11.040 --> 54:17.040] I think where Eddie's going is it's a person is the one who's required to do this,

[01:04:46.040 --> 01:04:54.040] And what I'm doing in the traffic material is I'm presenting the first part about how the right to travel is a right, and the courts have all said so.

[01:04:58.040 --> 01:05:02.040] Well, one, the very first arguments I make is this. This is the statement.
[01:05:02.040 --> 01:05:15.040] We the people also remind the court that the state is obligated by law to provide to the defense and to introduce to this court not only the evidence state intends to use to secure a conviction,
[01:05:15.040 --> 01:05:23.040] but also any and all exculpatory evidence, law, statements, or testimony in its possession or within its knowledge.
[01:05:23.040 --> 01:05:36.040] This includes the related and relevant state and federal statutes themselves and any and all case law interpretations thereof, as well as to ensure that any trial on the merits is fair and impartial.
[01:05:36.040 --> 01:05:39.040] This is where I get the argument from.
[01:05:39.040 --> 01:05:43.040] You go to Code of Criminal Procedure 1.03.
[01:05:43.040 --> 01:05:48.040] Now, you know how the lawyers love to say, oh, well, we just have a completely different interpretation of the statutes.
[01:05:48.040 --> 01:05:50.040] You don't understand the law.
[01:05:50.040 --> 01:05:53.040] Well, this is what the law says.
[01:05:53.040 --> 01:06:06.040] The object of this code, to make the rules of procedure in respect to the prevention and punishment of offenses intelligible to all persons whose rights are to be affected by them.
[01:06:06.040 --> 01:06:16.040] Now, that means these things are written in straightforward enough English that everybody is supposed to be able to understand them, unless I have a misinterpretation of that also.
[01:06:16.040 --> 01:06:37.040] Then you go down to number four, to bring to the investigation of each offense on the trial all the evidence tending to produce conviction or acquittal and to ensure in number five a fair and impartial trial.
[01:06:37.040 --> 01:06:50.040] Now, tell me that does not say that the prosecution is obligated by law to provide you with every bit of the information that can convict you or set you free.
[01:06:50.040 --> 01:07:08.040] Let me reference you to Article 2.01 under duties of officers, very first duty goes to prosecuting attorneys and it says it shall be the primary duty of the prosecuting attorney not to secure conviction.
[01:07:08.040 --> 01:07:09.040] Exactly.
[01:07:09.040 --> 01:07:20.040] But to ensure that justice is served he shall not secret evidence or witnesses that may show the innocence of the accused or mitigate the guilt of the accused.
[01:07:20.040 --> 01:07:24.040] That is absolutely correct.
[01:07:24.040 --> 01:07:32.040] And it is in paramateria with 103, 104, 105.
[01:07:32.040 --> 01:07:40.040] So as you can see, they have to build your case for you as well as what you can produce out of it.
[01:07:40.040 --> 01:07:55.040] If they know very full well that they are using in a statute in a manner other than the way it applies and it is written, they are in direct violation of their duty under the law because they are withholding information that would prove your innocence.
[01:07:55.040 --> 01:08:05.040] And that goes to a statute every citizen should have memorized, 39.03 penal code.
[01:08:05.040 --> 01:08:18.040] If a public official acting under the code of his authority exerts or purports to exert an authority he does not specifically have or if he fails to perform a duty he is required to perform.
[01:08:18.040 --> 01:08:32.040] And in the process, denies a citizen in the full free access to enjoyment of right that is a class A misdemeanor in the state of Texas, he can get up to six months in the state jail.
[01:08:32.040 --> 01:08:46.040] Any law, it says a law, if they violate a law relating to their office or exert or purport to exert an authority there do not expressly have.
[01:08:46.040 --> 01:09:02.040] And that was my concern earlier when we were talking about defending ourselves and talking about what the state was authorized to do, or what the state was forbidden to do, it is what they are authorized to do that is important.
[01:09:02.040 --> 01:09:16.040] If we keep 39.03 fixed in your mind, when I go into any governmental agency, I've got 39.03 fixed foremost in my mind.

[01:50:29.040 --> 01:50:34.040] Under our state Constitution, the sheriff is a judicial officer.
[01:50:34.040 --> 01:50:41.040] His office is defined and created in Article 5, which is the judicial branch.
[01:50:41.040 --> 01:50:50.040] Now, in the entire Texas Constitution, the term law enforcement is mentioned
[01:50:50.040 --> 01:51:00.040] only in conjunction with the mention of the sheriff, the deputy sheriff, and the constable, and the justice of the peace.
[01:51:00.040 --> 01:51:11.040] Nowhere is there any mention of a municipal police force that is to be termed or engaged in law enforcement.
[01:51:11.040 --> 01:51:21.040] There is no authority in the Constitution that creates a law enforcement agency known as the Department of Public Safety.
[01:51:21.040 --> 01:51:35.040] It mentions by name an entity called the Department of Public Safety, but there is absolutely nothing in the language that I can find that creates the agency.
[01:51:35.040 --> 01:51:38.040] There's no authority to create the agency.
[01:51:38.040 --> 01:51:40.040] It's just simply named.
[01:51:40.040 --> 01:51:56.040] Eddie, as far as the municipal police, is that not, do the municipalities not have authority to bring their own police force into existence under their charter with the state?

[01:56:25.040 --> 01:56:38.040] Yeah, and Randy, we went into the discussion over the reading of the administrative code with the DPS and Chapter 411, which discusses what the DPS can and cannot do.
[01:56:38.040 --> 01:56:51.040] And it turns out that the information in 411 goes hand in hand with what we determined in the administrative code that the DPS can investigate crime, but they cannot enforce it.
[01:56:51.040 --> 01:56:56.040] They can enforce commercial traffic statutes.

[01:56:57.040 --> 01:57:01.040] That does not make them a law enforcement agency.

[01:57:06.040 --> 01:57:35.040] The law in the administrative code specifically says that the DPS can stop a motor vehicle entering or exiting a port or on any highway that is in violation of Article 6.41 or 04 of the Texas Transportation Code, which deals strictly and entirely with commercial activity.
[01:57:35.040 --> 01:57:41.040] So, again, there is no law enforcement authority involved in that.
[01:57:41.040 --> 01:57:43.040] That is commercial authority.
[01:57:43.040 --> 01:57:45.040] That is civil in nature.
[01:57:45.040 --> 01:57:51.040] Now, this creates a whole new black hole constitutional issue.
[01:57:51.040 --> 01:58:16.040] If the argument now becomes one that is civil in nature, that means our attorney general has to be aiding and abetting criminal acts by writing opinions that state the term misdemeanor in the transportation code that does not specifically specify a criminal misdemeanor is being misinterpreted and applied as a criminal act when, in fact, it can only be civil.
