[05:25.360 --> 05:40.360]  And the fact that when you get a certificate of title, it's not really ownership because it's a certificate and technically the state has got your manufacturer's statement of origin.
[05:40.360 --> 05:59.360]  So the question I have is the people we were – the discussions we were having was about if you can turn in a form to the state to get your MSO from them and they are supposed to be able to send it to you.
[05:59.360 --> 06:07.360]  They've apparently put them on microfilm and then shredded them when you bought your car if you didn't pay cash for it and ask for it.
[06:07.360 --> 06:20.360]  So the question then comes if you can get your MSO back from the state, I understand that makes you the actual owner, the holder in due course, the actual owner of the car.
[06:20.360 --> 06:22.360]  Here's the problem with that analogy.
[06:22.360 --> 06:32.360]  In order for you to have true, equitable title, you must have the original wet ink signature document, which you will not have.
[06:32.360 --> 06:37.360]  All you will have is a reproduced copy from the microfiche.
[06:37.360 --> 06:41.360]  The original was destroyed and it was destroyed intentionally.
[06:41.360 --> 06:56.360]  Actually, if you have certification from the state that the original was destroyed and this is an accurate reproduction of the original, that can stand in the place of the original.
[06:56.360 --> 07:11.360]  Okay. So if you can get it though and become holder in due course, then it's my understanding you don't have to register the car and you don't have to enter the car because you're no longer leasing it from the state, if you will.

[07:55.360 --> 08:09.360]  Your private property ownership rights have been turned over to the state by the car dealer when you signed all the paperwork that allowed them to act on your behalf to give title to your property to the state.
[08:09.360 --> 08:24.360]  The state knows that MSO is the true equitable title to the car. You are not informed at the time of the transfer that you have any opportunity to have that equitable title returned to you ever.
[08:24.360 --> 08:31.360]  Even when the car is paid in full, you're never told or sent back your true title.
[08:31.360 --> 08:34.360]  You're not renting your property from the state.
[08:34.360 --> 08:41.360]  What you've allowed the dealer to do is to notify the state that this property is in commercial activity.
[08:41.360 --> 08:51.360]  This property, therefore, is turned over to you through the regulatory side of the law because it's been set up and purchased for commercial purposes.
[08:51.360 --> 08:55.360]  The entire transportation code is based on that fact.
[08:55.360 --> 08:56.360]  Okay.
[08:56.360 --> 09:01.360]  So if you do get a hold of your MSO or a certified copy.
[09:01.360 --> 09:10.360]  If you can get a true certified copy with a seal, then you stand a chance of being able to declare, I own it.

[09:13.360 --> 09:29.360]  And then would that be something that when you, if you get stopped for a ticket or whatever or for speeding or any other thing, if you get stopped, then you can show them your manufacturer's statement of ownership?

[21:32.360 --> 21:43.360]  That's exactly why in Chapter 311 Government Code where it said person includes, that is illustrative of the source grouping,

[21:52.360 --> 21:59.360]  Because Chapter 311 specifically states that unless these two sections cannot be reconciled,

[22:07.360 --> 22:14.360]  If includes and means are something different, then there's not a conflict unless those differences create one.

[01:09:16.360 --> 01:09:21.360]  Basically, they're in the process of coming to recognize the truth.
[01:09:21.360 --> 01:09:23.360]  And deep down, they do recognize the truth.
[01:09:23.360 --> 01:09:26.360]  And that's why they're in that state of denial right now.
[01:09:26.360 --> 01:09:32.360]  So it is encouraging because it shows that they are moving through that grieving process to acceptance.
[01:09:32.360 --> 01:09:42.360]  And the grieving process is not just like, you know, you go through the stages in a linear order and then you arrive at acceptance and then it's over.
[01:09:42.360 --> 01:09:49.360]  You know, people pass back and forth between different stages as they're coming to that ultimate acceptance.
[01:09:49.360 --> 01:09:58.360]  And then, you know, you still have faced the anger and the denial and all these kinds of things sometimes and the blame and that sort of thing.
[01:09:58.360 --> 01:10:05.360]  Yes. And those, I suspect that most all of our listeners are awake.
[01:10:05.360 --> 01:10:11.360]  And I suspect you tend to talk to the people around you and try to wake them up.
