[06:06.540 --> 06:11.640]  Just give us a brief story of a timeline here to bring our listeners up to date and tell
[06:11.640 --> 06:13.640]  us what happened on Tuesday.
[06:13.640 --> 06:24.080]  Well, I guess the thing starts with my friend David Baw from Missouri came down for a visit
[06:24.080 --> 06:31.640]  and he was out walking around in Jacksonville, Texas and he saw a church building for sale
[06:31.640 --> 06:37.720]  and we negotiated on that.
[06:37.720 --> 06:47.760]  So we tried to raise the funds for our church group and put the deal together and we did
[06:47.760 --> 06:55.880]  that and we finalized that in April of 2008.
[06:55.880 --> 07:06.000]  And unbeknownst to us that there was other people that had, I mean, there was an interest
[07:06.000 --> 07:10.720]  from somebody else in terms of acquiring that building.
[07:10.720 --> 07:18.640]  And next thing you know, I mean, after the real estate deal on April 30th, within like
[07:18.640 --> 07:29.040]  two weeks of May 15th, we started to receive what amounted to some three SWAT type attacks
[07:29.040 --> 07:30.800]  in less than a month.
[07:30.800 --> 07:33.800]  It was pretty amazing stuff.
[07:33.800 --> 07:42.640]  The Jacksonville Police Department was attacking us church people in a church and then they
[07:42.640 --> 07:48.920]  wonder why they're having a problem because they brought a whole bunch of false charges
[07:48.920 --> 07:57.440]  and out of seven charges that have been adjudicated so far or handled so far, it's church people
[07:57.440 --> 08:03.240]  seven versus with seven church people with seven victories versus the Jacksonville Police
[08:03.240 --> 08:04.520]  Department at zero.
[08:04.520 --> 08:07.920]  Wait a minute, Robert, you jumped way ahead.
[08:07.920 --> 08:12.160]  How did the first charge occur?
[08:12.160 --> 08:13.920]  How did the first what?
[08:13.920 --> 08:15.400]  The first charge.
[08:15.400 --> 08:24.880]  Well, the first charge was against David for, they alleged that he was a felony parole absconder.
[08:24.880 --> 08:27.240]  And wait a minute, before that.
[08:27.240 --> 08:30.480]  Oh, you mean the failure to identify?
[08:30.480 --> 08:32.800]  Yeah, where it started.
[08:32.800 --> 08:43.240]  Oh, okay, well, they had a, David was out with, you know, outside and one of the Jacksonville
[08:43.240 --> 08:49.400]  police officers came along and insisted he identify himself apparently and David asked
[08:49.400 --> 08:55.240]  for his probable cause and one thing led to another and David was put in jail for failure
[08:55.240 --> 08:57.760]  to identify.
[08:57.760 --> 09:06.480]  But I myself know that failure to identify is just a completely bogus charge, you know,
[09:06.480 --> 09:13.000]  you have a right to remain silent and if they've got a charge against you, they go ahead and
[09:13.000 --> 09:14.000]  arrest you.
[09:14.000 --> 09:20.720]  I mean, whether it's murder or public intoxication or whatever the case may be, but they have
[09:20.720 --> 09:25.440]  to arrest you first before they can even raise the issue.
[09:25.440 --> 09:33.520]  And anyway, yeah, it's my understanding that that the charge of failure to identify is
[09:33.520 --> 09:40.000]  when you've already been arrested and then you failed to identify not before they can't
[09:40.000 --> 09:44.600]  this is not a show your paper society, they cannot arrest you for not identifying yourself.
[09:44.600 --> 09:49.480]  They have no right to force you to identify yourself unless you've already been arrested.
[09:49.480 --> 09:56.760]  And the thing is that they insisted that David identify himself and they couldn't they couldn't
[09:56.760 --> 10:02.320]  provide him with a real probable cause and they ended up putting him in jail.
[10:02.320 --> 10:07.240]  And the way things the way things went, David objected to the thing and told them there
[10:07.240 --> 10:13.440]  was a false charge and he filed a, you know, a motion to quash or demand a quash or something
[10:13.440 --> 10:24.880]  like that and they postponed the proceedings and they had him in court on May the 14th
[10:24.880 --> 10:32.480]  and the whole room was full of people getting their class C non jailable, fine only, class
[10:32.480 --> 10:34.720]  C misdemeanors adjudicated.
[10:34.720 --> 10:41.720]  But when it came to David, they singled him out and said, no, you, you come back on July
[10:41.720 --> 10:42.720]  the 9th.
[10:42.720 --> 10:43.720]  Okay.
[10:43.720 --> 10:44.720]  Hold on, Robert.
[10:44.720 --> 10:45.720]  Yeah.
[10:45.720 --> 10:53.320]  So the listeners understand David lives in Missouri and on, on May the 7th, he filed
[10:53.320 --> 10:57.520]  suit against these folks may 17th.
[10:57.520 --> 11:01.160]  They ordered him to come to trial on a class C misdemeanor.
[11:01.160 --> 11:08.480]  He came down from Missouri to Texas on a class C misdemeanor and when he got to court, they
[11:08.480 --> 11:12.960]  canceled his until what happened the next day.
[11:12.960 --> 11:21.360]  The next day they came in with a SWAT attack and arrested David for being in Texas.
[11:21.360 --> 11:22.360]  Yeah.
[11:22.360 --> 11:27.720]  After they had summoned him to Texas.
[11:27.720 --> 11:29.200]  Yeah, exactly.
[11:29.200 --> 11:36.400]  And uh, and they, uh, they, uh, came in with, uh, with the, you know, the battering ram,
[11:36.400 --> 11:41.040]  they smashed the door to smithereens, they, they come charging in with their SWAT gear
[11:41.040 --> 11:48.000]  and the machine guns and whatever else they got going and, and, uh, uh, they took Dave
[11:48.000 --> 11:54.120]  away and they accused him of being a felony parole absconder and he spent 276 days in
[11:54.120 --> 12:03.280]  solitary confinement and, uh, was then unconditionally, uh, discharged and, uh, that was the end
[12:03.280 --> 12:06.760]  of that and he went home.
[12:06.760 --> 12:13.520]  I mean, you know, he, he was out, he was out of jail because he was never a parole absconder
[12:13.520 --> 12:20.760]  to start with and it appeared as though the city of Jacksonville was doing this to keep
[12:20.760 --> 12:25.520]  him from, from prosecuting his civil case.
[12:25.520 --> 12:27.000]  So he wasn't on parole?
[12:27.000 --> 12:31.840]  No, no, he never agreed to any such thing.
[12:31.840 --> 12:34.400]  Okay.
[12:34.400 --> 12:38.400]  So what did they find when they were there?
[12:38.400 --> 12:46.280]  Well, the building that they broke into is a large building, uh, with 75 feet of frontage
[12:46.280 --> 12:47.280]  on main street.
[12:47.280 --> 12:52.040]  And then the building's a hundred feet deep down a main drag called East Rusk at the main
[12:52.040 --> 12:54.040]  highway through Jacksonville.
[12:54.040 --> 12:59.920]  And uh, uh, there's four postal designations and the place they broke into is a dental
[12:59.920 --> 13:03.560]  clinic with six dental operating rooms and a dental lab.
[13:03.560 --> 13:09.200]  And so they found some leftover dental antibiotics.
[13:09.200 --> 13:18.840]  Well, they roasted me out of bed at machine gunpoint and, uh, and, uh, uh, I was handcuffed
[13:18.840 --> 13:24.600]  and taken up to the front and, uh, at, you know, at gunpoint and, uh, then they confront
[13:24.600 --> 13:29.280]  me with the so-called drugs as if they're mine.
[13:29.280 --> 13:35.480]  And uh, they bought the, uh, four charges against me to that effect possession of dangerous
[13:35.480 --> 13:36.480]  drugs.
[13:36.480 --> 13:40.720]  When, uh, you know, what were the nature of the drugs?
[13:40.720 --> 13:46.480]  Well, the thing is I had no idea that the drugs were there and when they, they left
[13:46.480 --> 13:51.880]  the inventory and when I got my hands on the inventory, I faxed it to a pharmacist that
[13:51.880 --> 13:58.360]  I knew of in Pennsylvania and he listed all the stuff on the inventory, described what
[13:58.360 --> 14:04.760]  it was, antibiotic, antibiotic, antibiotic, and, uh, and at the end of it all, he said,
[14:04.760 --> 14:11.240]  uh, all of the above would be expected to be in a dental clinic for, uh, uh, uh, routine
[14:11.240 --> 14:13.560]  use and dispensing to patients.
[14:13.560 --> 14:19.560]  Well, they broke into a dental clinic, you know, it was a closed one, but, uh, you know,
[14:19.560 --> 14:24.880]  and I had no idea the stuff was there, it was just antibiotics, but the police chief
[14:24.880 --> 14:32.000]  put in the newspaper that it's the same thing as 15 pounds of methamphetamines.
[14:32.000 --> 14:35.640]  Well, that is a huge lie.
[14:35.640 --> 14:37.640]  It's existed.
[14:37.640 --> 14:42.460]  Wait a minute, Robert, you're not, you're not trying to tell everybody that a police

[24:46.200 --> 24:53.400]  And the chief of police said that I was found hiding in a remote part of the building.
[24:53.400 --> 25:01.680]  Well, gosh, hiding at my desk, hiding in front of the computer with the lights on, I mean
[25:01.680 --> 25:07.280]  if I was hiding in a cardboard box or hiding in an air vent or hiding under the carpet,

[25:09.160 --> 25:17.960]  So I was taken out at gunpoint and up against the wall outside for the television crews
[25:17.960 --> 25:23.760]  and all whatever else they had cooking there and put on display.
[25:23.760 --> 25:29.520]  And the chief of police shook his finger in my face and declared that he was going to

[25:37.840 --> 25:45.400]  Well, in fact, ultimately he tried to get the FBI to attack me, IRS, ICE, Homeland Security,
[25:45.400 --> 25:47.840]  U.S. Marshals Secret Service.
[25:47.840 --> 25:54.040]  I mean it's like half a dozen federal agencies that he tried to get to attack me and none
[25:54.040 --> 26:00.000]  of them have made an actual charge against me in over a year.
[26:00.000 --> 26:05.680]  But the plan, the plan apparently was to have me deported because I was born and raised
[26:05.680 --> 26:07.560]  in Canada.
[26:07.560 --> 26:17.000]  So like I mentioned earlier, extradition failed in David's case.
[26:17.000 --> 26:20.560]  I mean it was a huge debacle.
[26:20.560 --> 26:29.040]  I mean they had, by falsification of the record, they had induced the governor of Missouri
[26:29.040 --> 26:31.920]  to issue a governor's warrant.
[26:31.920 --> 26:38.480]  They had Governor Rick Perry sign on what amounted to falsified documentation because
[26:38.480 --> 26:43.480]  of the false information that the Jacksonville Police Department fed.
[26:43.480 --> 26:50.360]  They got Governor Rick Perry's signature on falsified documentation.
[26:50.360 --> 26:58.000]  And then David spent 276 days in jail, solitary confinement and finally beat them on the extradition
[26:58.000 --> 27:02.040]  issue and that had never happened before.
[27:02.040 --> 27:05.160]  It was just like too incredible for words.
[27:05.160 --> 27:10.640]  Then they're coming for me on May the 22nd expecting that they were going to have me
[27:10.640 --> 27:11.640]  deported.
[27:11.640 --> 27:17.080]  Well, as Randy can verify, I'm still here.
[27:17.080 --> 27:21.840]  And that was another big, big surprise.
[27:21.840 --> 27:34.560]  And the man from immigration was thoroughly professional.
[27:34.560 --> 27:40.240]  He was highly intelligent and absolutely courteous.
[27:40.240 --> 27:50.760]  And at the end of our interview, there was no detainer because he already knew what the
[27:50.760 --> 27:52.960]  deal was.
[27:52.960 --> 27:59.160]  And I have a 60-year lifetime record of no violence.
[27:59.160 --> 28:07.640]  And in Texas, a 29-year record, the whole time I've been in Texas, 29 years of making
[28:07.640 --> 28:12.800]  all my court appearances with not a single failure to appear on my record.
[28:12.800 --> 28:16.360]  So that's how that is.
[28:16.360 --> 28:27.480]  And so there was no deportation and there was no immigration detainer.
[28:27.480 --> 28:31.520]  And it's taken a long time.
[28:31.520 --> 28:40.760]  It's taken well over a year for this thing to come to the point where we were on Tuesday
[28:40.760 --> 28:45.440]  for a pretrial evidentiary hearing.
[28:45.440 --> 28:51.980]  And witnesses were called, and first thing in the morning, the prosecutor dropped one
[28:51.980 --> 28:56.960]  of the charges because it was redundant, but he'd been doing the filings in the case for
[28:56.960 --> 29:00.680]  months.
[29:00.680 --> 29:07.440]  And then he dropped that one charge, and we were proceeding on the other three, and they
[29:07.440 --> 29:10.040]  presented their first witness.
[29:10.040 --> 29:23.480]  And well, gosh, the judge called for a conference, and then he announced that the court would
[29:23.480 --> 29:31.600]  be in recess until 1230, which meant that myself and some others, my supporters and
[29:31.600 --> 29:40.200]  all, we went to lunch, and the police and the prosecutor were in a huddle because they
[29:40.200 --> 29:49.160]  were given the 1230 thing when we'd be back on the record was going to be like the showdown
[29:49.160 --> 29:51.720]  at the OK Corral.
[29:51.720 --> 29:59.520]  And after hearing two more of their witnesses, namely the chief of police and his right-hand
[29:59.520 --> 30:12.120]  sidekick, Detective Jason Price, once those two guys were heard on the record, the judge
[30:12.120 --> 30:23.680]  the issue was that the case was set for jury trial on August 31st, but by dropping the
[30:23.680 --> 30:31.720]  requirement for a jury, the judge could hear the thing right there, which he did, and determined
[30:31.720 --> 30:34.920]  that I was not guilty on all counts.
[30:34.920 --> 30:42.840]  Okay, and I take it you never testified, or you never even got to your side of the case?
[30:42.840 --> 30:43.840]  No.
[30:43.840 --> 30:49.320]  This died after the prosecutor presented all of his evidence.
[30:49.320 --> 30:50.880]  He had no evidence.
[30:50.880 --> 30:53.640]  That was the problem for him.
[30:53.640 --> 30:59.360]  And the judge saw through that, like apparently what the judge had said, something to the
[30:59.360 --> 31:06.480]  effect of, well, if you find a key of cocaine in the church, do you arrest the pope?
[31:06.480 --> 31:11.680]  Or the example I had in mind was like, if the police get on a Greyhound bus and find
[31:11.680 --> 31:16.560]  somebody that's got drugs in their duffel bag, does that mean that the bus driver should
[31:16.560 --> 31:17.560]  go to prison?
[31:17.560 --> 31:23.640]  You know, he could make his case and say, well, gosh, the bus driver is transporting
[31:23.640 --> 31:24.640]  drugs.
[31:24.640 --> 31:29.960]  Well, that only works if the bus driver knows that they're there.
[31:29.960 --> 31:36.900]  I didn't know that there were drugs there, and the drugs have no link to me, you know?
[31:36.900 --> 31:38.240]  I didn't purchase them.

[31:57.520 --> 32:06.080]  property owners are responsible for any drugs that any guests may bring on the property.
[32:06.080 --> 32:10.240]  And they're responsible for searching everyone that comes on the property to know if their
[32:10.240 --> 32:13.480]  guests are bringing anything on the property.
[32:13.480 --> 32:19.000]  That's to try to stop people from having social gatherings on their properties.
[32:19.000 --> 32:25.880]  The problem they had was the dentist office was, the building was owned by the dentist.
[32:25.880 --> 32:31.580]  Yeah, so they couldn't very well turn around and throw it on Robert, because he wasn't,
[32:31.580 --> 32:34.560]  they couldn't even use the Rave Act against Robert, because he's not the owner of the
[32:34.560 --> 32:35.560]  building.
[32:35.560 --> 32:42.000]  Yeah, I'm not the owner of the building, and furthermore, I wasn't the only one there.
[32:42.000 --> 32:49.560]  I mean, it's like, if you get right down to it, Dave was closer to where the drugs were
[32:49.560 --> 32:50.560]  than me.
[32:50.560 --> 33:00.360]  Not by a lot, but by, I don't know, 20, 25 feet, 20, 30 feet anyway, he was closer to
[33:00.360 --> 33:07.520]  the drugs, but even that, we were both separated from there by two postal designations.
[33:07.520 --> 33:13.240]  You know, it's like going into the Holiday Inn and saying, well, somebody in Suite 201
[33:13.240 --> 33:19.960]  has drugs, so we'll arrest the guys over in 205, you know.
[33:19.960 --> 33:20.960]  These are antibiotics.
[33:20.960 --> 33:21.960]  Can you deny antibiotics?
[33:21.960 --> 33:22.960]  Exactly.

[33:47.360 --> 33:54.280]  There was a funny thing that came up because in the newspaper, they had a banner headline,
[33:54.280 --> 34:01.560]  God, red-handed, and they had Dave's picture, and they had a picture of the so-called drugs,
[34:01.560 --> 34:08.440]  and on the stuff was the name and address of the dental clinic, and there was also a
[34:08.440 --> 34:09.440]  phone number.
[34:09.440 --> 34:15.800]  So, what drug dealer puts name, address, and phone number on packages of illegal drugs?
[34:15.800 --> 34:17.600]  Yeah, no kidding.
[34:17.600 --> 34:23.960]  I mean, people with intelligence looked at that, and they almost died laughing.
[34:23.960 --> 34:28.640]  I mean, how can anybody be so preposterous?
[34:28.640 --> 34:33.880]  And the detective is there on the witness stand, and the judge is kind of sort of like
[34:33.880 --> 34:39.200]  rolling his eyes, like, you've got to be kidding me, you know?
[34:39.200 --> 34:44.440]  And when a trace was written on the phone number, what does it come back?
[34:44.440 --> 34:45.440]  The dentist.
[34:45.440 --> 34:49.680]  It's the dentist's phone number, not my phone number.
[34:49.680 --> 34:53.040]  I had nothing to do with it.
[34:53.040 --> 34:57.640]  So clearly, they were just trying to find something to pin on you, huh, Robert?
[34:57.640 --> 34:58.640]  Exactly.
[34:58.640 --> 35:02.400]  They had in mind to have me deported.
[35:02.400 --> 35:09.960]  And as a matter of fact, it shows up in their paperwork, because in the Texas Code of Criminal
[35:09.960 --> 35:23.200]  Procedure, the search warrant comes under Chapter 18, and it's 18.02 for search warrant.
[35:23.200 --> 35:30.200]  And then there's 12 categories of search warrants, and the application for the search
[35:30.200 --> 35:33.400]  warrant was Category 12.
[35:33.400 --> 35:37.440]  They alleged that they were coming for David.
[35:37.440 --> 35:42.600]  Category 12, the one that they put on their paperwork, is contraband.
[35:42.600 --> 35:46.920]  Now, does Dave qualify as being contraband?
[35:46.920 --> 35:49.280]  I don't think so.
[35:49.280 --> 35:54.400]  But they had it figured out that they were going to get the dental antibiotics or whatever
[35:54.400 --> 35:56.840]  the heck they figured they were going to get.
[35:56.840 --> 36:02.680]  And that was contraband, and they actually put that on the application of the search
[36:02.680 --> 36:03.680]  warrant.
[36:03.680 --> 36:06.800]  So they gave themselves away right there.
[36:06.800 --> 36:14.720]  Wasn't one of the officers of Franklin familiar with the dental office and aware of what was
[36:14.720 --> 36:17.400]  left in there?
[36:17.400 --> 36:29.600]  They had sent in some kind of undercover guy from the police department previously, and
[36:29.600 --> 36:36.040]  when the dentist was around, and so that would have been a part of their records, and I don't
[36:36.040 --> 36:41.160]  even know who the guy was or whether he still works there.
[36:41.160 --> 36:45.000]  But all of that stuff was a part of their records, and so they knew.
[36:45.000 --> 36:48.920]  They knew that that was formerly a dental clinic.
[36:48.920 --> 36:51.320]  They knew what to expect was there.
[36:51.320 --> 36:55.440]  I mean, I never think about those things because I never think about drugs because I'm not

[36:57.280 --> 37:05.520]  By the way, for anybody that knows me, I mean, to know that for 11 years, I was involved

[37:16.400 --> 37:24.200]  I was constantly offered free drugs and so on, and I declined that stuff at all occasions.

[38:58.880 --> 39:04.440]  If I was brought to trial in front of him, he'd be making his own search warrant good
[39:04.440 --> 39:12.040]  like as in trying to find me guilty when I'm not.
[39:12.040 --> 39:21.840]  It was clear that I was up against something of a real problem and what ended up happening
[39:21.840 --> 39:31.720]  is they received a fax from the top administrative judge over 34 counties appointing another
[39:31.720 --> 39:34.000]  judge coming out of Dallas.
[39:34.000 --> 39:36.880]  Wait a minute, Robert.
[39:36.880 --> 39:42.280]  Tell them what happened when you appeared in court on December 3rd.
[39:42.280 --> 39:54.800]  Well, okay, December 3rd was 2008, but what came before that was that they announced in
[39:54.800 --> 40:03.600]  I think it was July, somewhere in July, that they had a felony baritory charge against
[40:03.600 --> 40:10.720]  me, which could give me 10 years in prison and they at the same time apparently put me
[40:10.720 --> 40:12.800]  on something like America's Most Wanted.
[40:12.800 --> 40:20.520]  I was repeatedly on television, my picture, I wasn't in the studio or anything.
[40:20.520 --> 40:23.480]  They put my picture on television.
[40:23.480 --> 40:29.800]  They declared that I was a wanted fugitive, that Homeland Security or something like that
[40:29.800 --> 40:30.800]  was looking for me.
[40:30.800 --> 40:34.600]  They said that the US Marshals wanted to talk to me.
[40:34.600 --> 40:40.600]  It was like a nationwide man under some kind of crap looking for me.
[40:40.600 --> 40:45.720]  And the part that was really interesting was that I was a wanted fugitive.
[40:45.720 --> 40:53.240]  Well, the problem for them is apparently they have no understanding of what a fugitive is.
[40:53.240 --> 40:56.040]  A fugitive is one who flees the jurisdiction.
[40:56.040 --> 41:02.600]  Well, all that happened is I'd gone to Austin to study criminal complaints and learn from
[41:02.600 --> 41:05.400]  Randy Kelton.
[41:05.400 --> 41:14.600]  And so to call me a fugitive when the bond that I was out on was for all of Texas and
[41:14.600 --> 41:16.680]  I was in Austin.
[41:16.680 --> 41:19.160]  I believe Austin is in Texas, isn't it?

[41:20.160 --> 41:21.160]  Yeah, last time you checked.
[41:21.160 --> 41:31.320]  And they themselves said that they suspected that I was in Austin, but that I was a fugitive.
[41:31.320 --> 41:37.000]  Now when I walked into court on December 3rd, I had my Bible in hand.
[41:37.000 --> 41:41.160]  I walked into court and I said to the bailiff, I heard a rumor that there's a warrant for
[41:41.160 --> 41:42.160]  my arrest.
[41:42.160 --> 41:44.560]  Could you please check on that?
[41:44.560 --> 41:45.680]  They checked.
[41:45.680 --> 41:50.840]  They called the Jacksonville police and I had the handcuffs on me and I was taken away
[41:50.840 --> 41:55.080]  to Jacksonville, which of course is completely against the law.
[41:55.080 --> 42:00.120]  Okay, wait a minute, Robert, you missed a part.
[42:00.120 --> 42:07.040]  Were you not arrested in front of the magistrate who issued the warrant?
[42:07.040 --> 42:08.040]  Exactly correct.
[42:08.040 --> 42:11.640]  So Randy, you want to tell them the significance of that?
[42:11.640 --> 42:20.320]  When a magistrate issues a warrant, necessarily it's an ex parte hearing because if you were
[42:20.320 --> 42:25.160]  there to argue your side, there would be no need for a warrant unless you're already in
[42:25.160 --> 42:27.140]  front of the magistrate.
[42:27.140 --> 42:33.680]  So a policeman comes to a magistrate and says, I have reason to believe and do believe that
[42:33.680 --> 42:39.260]  this person has committed this criminal act based on this probable cause information.
[42:39.260 --> 42:43.140]  And the judge looks at it in an ex parte hearing.
[42:43.140 --> 42:46.240]  You can't tell your side because you're not there.
[42:46.240 --> 42:49.480]  The whole point is to get you and bring you there.
[42:49.480 --> 42:58.120]  So when the magistrate issues the warrant, the warrant must say, arrest this person and

[43:01.280 --> 43:05.520]  Bring him before me so that now I can hold an examining trial with both people here.
[43:05.520 --> 43:10.720]  Well, in this case, he was standing before the magistrate who issued the warrant.

[43:13.640 --> 43:19.840]  Yes, I demanded an examining trial and they refused to give me one.
[43:19.840 --> 43:26.080]  And the officer came from the Jacksonville Police Department and took me away in handcuffs.

[47:40.840 --> 47:45.040]  have seen the look on his face with some of the nonsense that they were trying to pull.
[47:45.040 --> 47:54.040]  I mean, it was like incredible lies and it was just ridiculous, but you know, the bigger
[47:54.040 --> 48:03.080]  the lie, the bigger the farce and so, you know, I'd run into this one other time before
[48:03.080 --> 48:13.880]  in 1991, I was in federal court before Barefoot Sanders and a federal felony charge or actually
[48:13.880 --> 48:23.760]  two of them were brought against me and one was dismissed at the, before the trial stuff
[48:23.760 --> 48:31.000]  just started, you know, I argued my motions to dismiss separately on each thing and one
[48:31.000 --> 48:32.000]  was dismissed.
[48:32.000 --> 48:39.080]  We went to trial on the other and the Richardson police officer took the stand and stuff that
[48:39.080 --> 48:48.360]  he said was a complete total lie and you know, but Barefoot Sanders was not convinced with
[48:48.360 --> 48:54.160]  that nonsense and I was acquitted.

[49:56.120 --> 50:03.680]  Felony tampering with a government record, another bogus charge.
[50:03.680 --> 50:05.960]  Because you filed a criminal complaint?

[50:25.640 --> 50:31.240]  You got to let them know that you were harmed and give them opportunity to straighten everything

[50:36.720 --> 50:41.560]  were harmed by and give them opportunity to repair.
[50:41.560 --> 50:45.000]  They get 60 days to repair before you can file suit.

[50:48.040 --> 50:54.640]  So Robert files a tort letter and this moron, Jason, it wasn't Jason Price, one of these
[50:54.640 --> 51:03.700]  moron police officers said, he said we committed aggravated kidnapping and that wasn't true.
[51:03.700 --> 51:06.000]  So they charged him with tampering with a government document.
[51:06.000 --> 51:10.400]  Yeah, but how is sending a letter a government document anyway, for one thing?
[51:10.400 --> 51:15.000]  And I thought you guys told me at one point that he did get charged with tampering with
[51:15.000 --> 51:18.600]  a government document for filing a criminal complaint, that what did happen somewhere
[51:18.600 --> 51:19.600]  along the way.
[51:19.600 --> 51:25.440]  No, I'm the one that got charged with criminally for filing criminal complaints.

[51:28.440 --> 51:31.560]  That must've been some erroneous information because I remember at one point y'all told
[51:31.560 --> 51:35.360]  me that he filed a criminal complaint, got charged with tampering with a government

[51:36.360 --> 51:42.480]  Well, Robert did file a set of criminal complaints on November 23rd with the district attorney
[51:42.480 --> 51:46.600]  and the district attorney never did anything with him.
[51:46.600 --> 51:54.680]  Robert was arrested for sending a tort letter wherein he accused Jason Price of arresting
[51:54.680 --> 52:04.760]  him in or taking custody of him in Rusk and taking him from that jurisdiction to a foreign
[52:04.760 --> 52:12.520]  jurisdiction, Jack City of Jacksonville, assaulting him there and then bringing him back to Rusk.
[52:12.520 --> 52:22.680]  And he maintained that the transport from the city that had jurisdiction, from the location
[52:22.680 --> 52:29.320]  that had jurisdiction to a city that didn't was an act of aggravated kidnapping.
[52:29.320 --> 52:38.020]  And the complainant disagreed with Robert's evaluation.
[52:38.020 --> 52:45.040]  In his statement, he said that the only fact that Robert stated was that he was arrested
[52:45.040 --> 52:50.060]  on December 3rd and that he didn't disagree with that.
[52:50.060 --> 52:56.960]  So he agreed that the only fact in the letter was accurate, but he disagreed with the opinion
[52:56.960 --> 53:01.000]  that the act of arresting him was an act of kidnapping.
[53:01.000 --> 53:08.040]  So he accused him of coming to a false conclusion.
[53:08.040 --> 53:11.640]  That was the basis of the allegation.
[53:11.640 --> 53:24.080]  Well, even if it was a government record, the allegation of aggravated kidnapping was
[53:24.080 --> 53:26.920]  a conclusion based on the facts.
[53:26.920 --> 53:35.920]  It wasn't presented as a fact, but I don't think this guy understood that subtle difference.
[53:35.920 --> 53:38.640]  The district attorney didn't either.
[53:38.640 --> 53:41.600]  I don't know who Jason Brace understands very much.
[53:41.600 --> 53:48.480]  He purports to be a detective, but I don't know, he seems to be a little bit of a defective
[53:48.480 --> 53:49.480]  detective.
[53:49.480 --> 53:55.040]  Well, yeah, I like that.
[53:55.040 --> 54:02.160]  It's surprising the more we look at this, because this plot thickens.
[54:02.160 --> 54:12.560]  The last time Robert was in court that I was around was March the 23rd, and on that day,
[54:12.560 --> 54:16.240]  I filed a set of documents with the grand jury.
[54:16.240 --> 54:24.920]  Well, I actually didn't file anything because the documents were not signed or notarized.
[54:24.920 --> 54:31.100]  They were merely a request to the grand jury for guidance.
[54:31.100 --> 54:39.360]  It was my intention of letting these guys know how deep the water was they were treading
[54:39.360 --> 54:43.440]  and give them opportunity to back up and do the right thing.
[54:43.440 --> 54:48.760]  So I gave the grand jury a set of complaints, but they weren't signed or they weren't verified.
[54:48.760 --> 54:53.400]  So they were not official complaints.
[54:53.400 --> 54:55.000]  That was March the 23rd.
[54:55.000 --> 55:04.360]  On April the 27th, the investigator for the district attorney's office accused me of operating
[55:04.360 --> 55:11.200]  an investigating company without a license, and he accused me of committing that act on
[55:11.200 --> 55:14.000]  March the 23rd.
[55:14.000 --> 55:20.600]  Same day I filed criminal charges against the county attorney and county judge.
[55:20.600 --> 55:28.280]  He took the complaint, which stated that he had reason to believe and did believe that
[55:28.280 --> 55:34.680]  Ronald E. Keltner, on about March 23rd, committed the criminal act of operating an investigating
[55:34.680 --> 55:39.880]  business without a license based on the following colon, nothing.
[55:39.880 --> 55:45.080]  Well, you need to have some facts in support.
[55:45.080 --> 55:49.040]  A complaint with no facts in support is not a complaint.
[55:49.040 --> 55:52.480]  That's what the case law says.
[55:52.480 --> 55:56.640]  Well, he had been the sheriff of Nacogdoches County.
[55:56.640 --> 56:01.760]  Eddie Craig noticed him, worked for him, and he's the reason Eddie Craig got out of the
[56:01.760 --> 56:03.240]  law enforcement business.
[56:03.240 --> 56:08.080]  Well, it can't be construed he didn't know better.
[56:08.080 --> 56:13.800]  So he put a statement on a government document that he tampered with the government document
[56:13.800 --> 56:20.800]  by omitting something that was required to be there, and I call that tampering the government
[56:20.800 --> 56:21.800]  document.
[56:21.800 --> 56:26.280]  It's a little more clear than what they accused Robert of.
[56:26.280 --> 56:27.280]  And then I maintained...
[56:27.280 --> 56:33.600]  Well, the real tampering was done by Jason Price because he put on a for real government
[56:33.600 --> 56:37.800]  document their incident report, he put erroneous information.
[56:37.800 --> 56:38.800]  Yes.
[56:38.800 --> 56:43.080]  So we have... The thing is we have more complaints to file against these guys that we can keep
[56:43.080 --> 56:45.640]  up with.
[56:45.640 --> 56:53.200]  They done everything wrong and so badly wrong that it's hard to keep up with all the complaints.
[56:53.200 --> 56:59.800]  It looks like stacking when you start going through all of the things they did illegally.
[56:59.800 --> 57:08.360]  So in this case, he gave this document to the county attorney, and the county attorney
[57:08.360 --> 57:10.720]  prepared an information and filed it with the court.
[57:10.720 --> 57:14.280]  Well, there's a little problem with that.
[57:14.280 --> 57:18.800]  He's one of the guys I filed 11 complaints against.
[57:18.800 --> 57:24.400]  So he was disqualified as a matter of law, but he didn't let that bother him.
[57:24.400 --> 57:30.120]  He prepared the information, gave it to the county judge who found probable cause based
[57:30.120 --> 57:32.360]  on no facts.
[57:32.360 --> 57:38.980]  Problem with that is 11 of the criminal complaints I gave to the grand jury were against him.
[57:38.980 --> 57:45.400]  So he was clearly disqualified, but that wasn't a problem.
[57:45.400 --> 57:47.800]  What was a problem is he didn't fill out the warrant.
[57:47.800 --> 57:52.960]  He had the clerk do it, and the clerk's forbidden to do that by law.
[57:52.960 --> 57:59.400]  Then he had his court coordinator order me to come to court.
[57:59.400 --> 58:01.720]  That was simulating a legal process.
[58:01.720 --> 58:05.280]  Now they're all in deep doo-doo.

[01:02:22.680 --> 01:02:28.280]  court, criminal complaints to the Department of Justice, criminal complaints to the federal
[01:02:28.280 --> 01:02:37.920]  grand jury, mandamus and demand for a court of inquiry to the district court, bar grievance,
[01:02:37.920 --> 01:02:45.960]  judicial conduct complaints, I've got more to do, Texas Rangers and T-Close complaints,
[01:02:45.960 --> 01:02:50.480]  we've got a lot more to do, but we've got all those in place.
[01:02:50.480 --> 01:02:56.880]  So with that as the background, these guys have all of these charges against Robert,
[01:02:56.880 --> 01:03:02.440]  the drugs, the thing that was missed in all of this, David Ball gets arrested in the parking
[01:03:02.440 --> 01:03:12.880]  lot, he gets out of jail April, early May he filed suit against these guys, middle May
[01:03:12.880 --> 01:03:18.720]  he comes down for a hearing, they cancel the hearing, arrest him the next day, they find
[01:03:18.720 --> 01:03:25.040]  these antibiotics they already knew were there and then they get a warrant to come back and
[01:03:25.040 --> 01:03:29.640]  collect the antibiotics and in the warrant, the officer who filed for the warrant stated
[01:03:29.640 --> 01:03:37.240]  that he had knowledge that Mr. Fox had warrants for his arrest.
[01:03:37.240 --> 01:03:40.920]  So the judge issued a warrant for his arrest based on that, well if there were warrants
[01:03:40.920 --> 01:03:45.840]  for his arrest it would need another warrant, but actually there were no warrants, so it
[01:03:45.840 --> 01:03:47.280]  was bogus.
[01:03:47.280 --> 01:03:54.840]  So they come in and take everything Robert has, they have a warrant authorizing them
[01:03:54.840 --> 01:04:01.120]  to search for drugs and records of the sale of drugs, they take everything into place,
[01:04:01.120 --> 01:04:04.160]  even though an FBI agent warned them not to.
[01:04:04.160 --> 01:04:05.160]  They take everything.
[01:04:05.160 --> 01:04:11.320]  They didn't take everything, we had a little bit of a glitch there Randy, they took a bunch
[01:04:11.320 --> 01:04:19.080]  of stuff on May the 22nd, but they came back on June the 11th with a 16 foot trailer apparently,
[01:04:19.080 --> 01:04:25.040]  they took all the computers, they took the file cabinets, they took the files, they took
[01:04:25.040 --> 01:04:29.480]  all kinds of stuff, they took swords, they weren't even on the search warrant, they
[01:04:29.480 --> 01:04:32.240]  took all kinds of things that weren't on the search warrant.
[01:04:32.240 --> 01:04:37.920]  90% of what they took wasn't on the search warrant and under law that's absolutely forbidden.
[01:04:37.920 --> 01:04:45.160]  A search warrant must be so clear in what is to be taken that the person executing the
[01:04:45.160 --> 01:04:49.520]  warrant can make no judgment of his own.
[01:04:49.520 --> 01:04:55.720]  If he has to make a judgment as to what the warrant means, it's insufficient, it has
[01:04:55.720 --> 01:04:57.140]  to be very specific.
[01:04:57.140 --> 01:05:02.240]  So they take all this stuff, even though the FBI agent warned them not to.
[01:05:02.240 --> 01:05:07.360]  Robert files notice of his intent to file suit.
[01:05:07.360 --> 01:05:12.340]  Every time Robert comes to court, they arrest him again, the chief of police said he has
[01:05:12.340 --> 01:05:16.760]  more jail cells than Robert has paper.
[01:05:16.760 --> 01:05:24.100]  With both Robert and David, they clearly intended to trap them in jail so they couldn't adjudicate
[01:05:24.100 --> 01:05:25.600]  the suits against them.
[01:05:25.600 --> 01:05:27.680]  Yeah, by that statement, I would say so.
[01:05:27.680 --> 01:05:34.640]  So to stop them, what Robert does is transfer his civil suit to me.
[01:05:34.640 --> 01:05:39.000]  Now they're ticked because even if they get Robert in jail, now I own it.
[01:05:39.000 --> 01:05:42.200]  They can't do anything with me.
[01:05:42.200 --> 01:05:46.600]  So when I file the complaints against them, now they get a shot at me.
[01:05:46.600 --> 01:05:51.480]  Now it's a bogus shot, but they think to get one, they're going to try to trap me in jail
[01:05:51.480 --> 01:05:54.500]  so they can keep me from pursuing them.
[01:05:54.500 --> 01:06:00.720]  This is a very definite and obvious pattern on the part of these individuals.
[01:06:00.720 --> 01:06:07.080]  Not only obvious pattern, Randy, it is criminal because it is called retaliation and it's
[01:06:07.080 --> 01:06:10.440]  also witness tampering.
[01:06:10.440 --> 01:06:19.520]  The federal charges I filed under 18 U.S. Code 1512 carries, if there's no physical
[01:06:19.520 --> 01:06:26.600]  assault on the witness, just tampering otherwise, if you harm the witness, it's 30 years.
[01:06:26.600 --> 01:06:30.440]  If you don't, it's only 20 years in prison.
[01:06:30.440 --> 01:06:33.540]  So this is what I come back at them with.
[01:06:33.540 --> 01:06:39.600]  So they've got me filing all these really ugly charges with everybody I can find.
[01:06:39.600 --> 01:06:43.840]  So they come after me, I come after them big time.
[01:06:43.840 --> 01:06:50.360]  They come into court with Robert and get cremated.
[01:06:50.360 --> 01:06:53.840]  They got their hats handed to them.
[01:06:53.840 --> 01:06:57.040]  Now their whole house of cards has fallen apart.
[01:06:57.040 --> 01:07:01.400]  This is a testament to hanging in there.
[01:07:01.400 --> 01:07:05.440]  David Baugh spent how many days in jail, Robert?
[01:07:05.440 --> 01:07:13.800]  Altogether 311, because they got him for the allegedly felony parole of Skodder, but of
[01:07:13.800 --> 01:07:19.880]  course he was discharged and released with no condition.
[01:07:19.880 --> 01:07:27.480]  I mean, he completely beat him on that stuff, and that took 276 days.
[01:07:27.480 --> 01:07:32.960]  And to thank him for that, they go ahead and re-arrest him and throw him back in for another
[01:07:32.960 --> 01:07:34.920]  35.
[01:07:34.920 --> 01:07:35.920]  And that was on a charge of...
[01:07:35.920 --> 01:07:39.880]  It's called retaliation and it's witness tampering.
[01:07:39.880 --> 01:07:42.000]  Wait, what was the second charge?

[01:08:06.760 --> 01:08:10.840]  And they did this witness tampering thing to Judy Scott, too, because she was in the
[01:08:10.840 --> 01:08:13.960]  office and saw everything that happened.
[01:08:13.960 --> 01:08:19.680]  They handcuffed her so tight that she had scars, and they abused her terribly.
[01:08:19.680 --> 01:08:22.880]  That's felony elder abuse.

[01:08:54.080 --> 01:09:01.920]  And they had three cruiser cars, and of course, the effective detective Jason Price was there.
[01:09:01.920 --> 01:09:09.000]  And they had Judy get out of her van and pose for pictures at the back of her van.

[01:09:11.600 --> 01:09:17.960]  Well, they obviously have no honor or no dignity.
[01:09:17.960 --> 01:09:22.680]  And they don't seem to have very many smarts either, because their house of cards is beginning

[01:11:09.400 --> 01:11:17.440]  Well, the problem is, is they had no authority to send me a notice to appear, because I had
[01:11:17.440 --> 01:11:21.720]  never been arrested, never promised to appear.
[01:11:21.720 --> 01:11:26.320]  Only the way they could get me to court is with a summons, and they would have to serve
[01:11:26.320 --> 01:11:27.320]  the summons on me.
[01:11:27.320 --> 01:11:33.000]  They didn't bother, they just had the clerk, the judge's clerk, send me a notice to appear
[01:11:33.000 --> 01:11:35.000]  for an arraignment.
[01:11:35.000 --> 01:11:40.440]  Well, I kind of felt like that was a bad idea.
[01:11:40.440 --> 01:11:49.560]  After I saw what happened to Robert and David, and which reminds me of this person, Mark
[01:11:49.560 --> 01:11:57.000]  Coker, your sniveling little cowardly witness, what happened to Mark Coker when he went to
[01:11:57.000 --> 01:11:59.920]  court with you and you called him as a witness?
[01:11:59.920 --> 01:12:08.320]  Well, he declared that because of what he had already witnessed, and the retaliation
[01:12:08.320 --> 01:12:16.720]  and the witness tampering and the rest of that, that he was not going to be a witness.
[01:12:16.720 --> 01:12:23.640]  But he's a good man, he's really a good man, but he's obviously got his eyes and
[01:12:23.640 --> 01:12:34.240]  ears open, because everyone that is associated with me has been threatened in the media.
[01:12:34.240 --> 01:12:39.680]  They've been threatened with armed attack, and how serious this is, the listeners need
