[34:16.840 --> 34:21.680]  time of the offense and i'm not sure that that didn't have something to do with what

[01:27:46.540 --> 01:27:51.780]  to yield right of way and he said, well, not in a long time where you may want to read

[01:49:53.500 --> 01:50:01.500]  Yeah, you will notice that we'll quote a statute from Texas and you'll look it up in Pennsylvania law

[01:50:05.500 --> 01:50:13.500]  The reason for that is, is the feds have a model criminal code, code of criminal procedure
[01:50:13.500 --> 01:50:18.500]  And most of the states follow that model more or less
[01:50:18.500 --> 01:50:22.500]  And that gives consistency in the laws across the United States
[01:50:22.500 --> 01:50:26.500]  If you're lucky, it depends on what type of state you're in
[01:50:26.500 --> 01:50:28.500]  If it's Spanish law, that's mostly the case
[01:50:28.500 --> 01:50:32.500]  Commonwealth, like Pennsylvania, can sometimes be a lot different
[01:50:32.500 --> 01:50:38.500]  Like especially the grand jury system, you know, it's very difficult to get grand jury impoundment in Pennsylvania
[01:50:38.500 --> 01:50:45.500]  Now, if you're in a younger state, a very young state like New Mexico, boy, you got a lot of problems there
[01:50:45.500 --> 01:50:50.500]  Because their code of criminal procedure is not statute, it's actually rules of court
[01:50:50.500 --> 01:50:55.500]  And so they have, it is a very difficult situation in New Mexico
[01:50:55.500 --> 01:51:01.500]  Because they don't even have like the outlining of magistrates and grand juries and stuff like that
[01:51:01.500 --> 01:51:07.500]  That's not even in law, that's not, they don't have any statutes that say anything about that
[01:51:07.500 --> 01:51:12.500]  It's all rules of court and so, you know, it becomes very difficult to challenge
[01:51:12.500 --> 01:51:21.500]  So you have to look up what kind of state that you're in to see exactly what the principles really are
[01:51:21.500 --> 01:51:27.500]  Yes, and from my being going to different states and looking at the law in different states
[01:51:27.500 --> 01:51:41.500]  I live in Texas, and surprisingly enough, Texas seems to have the most comprehensive set of laws of any place I've ever been
[01:51:41.500 --> 01:51:47.500]  Texas law tends to address most every issue
[01:51:47.500 --> 01:51:54.500]  That's because we're our own nation, okay, because Texas was independent at one time
[01:51:54.500 --> 01:52:00.500]  And apparently it was never actually formally incorporated properly into the United States government
[01:52:00.500 --> 01:52:06.500]  I mean, it's looking to me like technically we still are our own government, but that's not possible to enforce at this time
[01:52:06.500 --> 01:52:10.500]  But that's why Texas has the most comprehensive law, because we're our own nation
[01:52:10.500 --> 01:52:20.500]  Maybe, but as concerns the model, criminal code and penal code, Texas seems to address most everything
[01:52:20.500 --> 01:52:25.500]  Now there are a couple of states that address things that Texas don't, but it is the most comprehensive
[01:52:25.500 --> 01:52:33.500]  And we tend to talk about Texas because we know Texas, but it goes to due process
[01:52:33.500 --> 01:52:40.500]  Almost all of the states will be generally the same because due process demands it
[01:52:40.500 --> 01:52:50.500]  There will be some variations. Once you understand how it should be, then you can go into your law and see how your law addresses the issues you bring here
[01:52:50.500 --> 01:52:55.500]  So listening to our Texas law is not really a waste of time
[01:52:55.500 --> 01:53:04.500]  It gives you a good idea of how the law should be structured so that you know where to go look in your law to find out what yours does
[01:53:04.500 --> 01:53:14.500]  Now, Pennsylvania is a Commonwealth, and it has some stark differences from the Spanish law states
[01:53:14.500 --> 01:53:29.500]  And one of the primary ones is in a Commonwealth, and for certain in Pennsylvania, you can't file a criminal complaint unless you are personally injured
[01:53:29.500 --> 01:53:39.500]  In the Spanish law states like Texas, if I have knowledge that a crime has been committed, not only can I file a criminal complaint, I have a duty to do so
[01:53:39.500 --> 01:53:43.500]  In Pennsylvania, you can't file a complaint unless you've been harmed

[01:53:58.500 --> 01:54:01.500]  They're not actually breaking a law when they do that, so they got it rough over there
[01:54:01.500 --> 01:54:15.500]  Well, one of the things you can do is import law from another state, and this is how the feds and most of the states deal with these issues
[01:54:15.500 --> 01:54:23.500]  They trust the legislatures of other states. Each state trusts the legislature of other states
[01:54:23.500 --> 01:54:33.500]  So if the legislature in Texas has not addressed an issue, and another state's legislature has addressed that issue
[01:54:33.500 --> 01:54:48.500]  You can go to that state and pull the law from that state to this state because each of the states trusts that each of the legislatures passed just law
[01:54:48.500 --> 01:54:56.500]  You can only draw law from another state in a place where your state hasn't addressed the issue at all
[01:54:56.500 --> 01:55:07.500]  And I've only found one time that in Texas, a law was brought in from another state, and it was actually brought from North Carolina
[01:55:07.500 --> 01:55:13.500]  At the moment, I don't remember exactly what it was, but it was a very focused issue
[01:55:13.500 --> 01:55:19.500]  And this was from the Texas Court of Criminal Appeals
[01:55:19.500 --> 01:55:29.500]  They said that this issue was not addressed in Texas, but it was addressed in North Carolina, so they pulled North Carolina's law and used it in Texas
[01:55:29.500 --> 01:55:33.500]  That you can do, but first you have to look at the ones in your own state
[01:55:33.500 --> 01:55:44.500]  But once you've got a general idea of how due process works, that's what attorneys do. They get an overview of how law works
[01:55:44.500 --> 01:55:54.500]  They can go into any state and practice law, and they only have to look up the places where the law varies, and it's not that great
[01:55:54.500 --> 01:56:09.500]  So on the surface, it looks really overwhelming, but it's really not. Once you kind of get over the initial hard part, it's like anything you start to learn, and it's difficult at first
[01:56:09.500 --> 01:56:17.500]  But after a little while, the pieces start fitting together and falling into place, and then it all begins to make sense
[01:56:17.500 --> 01:56:26.500]  Once you have an idea of how due process is supposed to work, I went from here to Pennsylvania
[01:56:26.500 --> 01:56:34.500]  I got out Pennsylvania's penal code and code of criminal procedure. It took me two hours to go through it
[01:56:34.500 --> 01:56:39.500]  The reason it didn't take long is because 90% of it was the same
[01:56:39.500 --> 01:56:47.500]  There were a few things that weren't, and frankly, I found some gems in there
[01:56:47.500 --> 01:57:02.500]  Pennsylvania had some really whopper statutes on specific issues, and it happened to be the issues I was dealing with is misuse of funds that were much better than Texas
[01:57:02.500 --> 01:57:17.500]  But 90% of it was the same. I went to Colorado, North Carolina. I knew exactly what to look for because I understood Texas law and what should be there
[01:57:17.500 --> 01:57:25.500]  So I could look at it and say, wait a minute, wait a minute, there should be something here, and then I go look, and sure enough, there it is
[01:57:25.500 --> 01:57:32.500]  So I'm really just kind of trying to get you to understand this is easier than it
