[00:48.840 --> 00:54.120]  closed. However, the House Appropriations Committee refused to give Barack Obama the
[00:54.120 --> 01:02.520]  50 million dollars he had requested to relocate the Guantanamo prisoners. Pakistani Prime
[01:02.520 --> 01:08.240]  Minister Youssef Raza Gilani announced Thursday his government is abandoning diplomacy in
[01:08.240 --> 01:14.240]  the Swat Valley and urging the army to eliminate the militants and terrorists. The announcement
[01:14.240 --> 01:18.320]  comes weeks after Gilani had declared that a peace deal with the militant groups was
[01:18.320 --> 01:27.160]  the only alternative. The Teraq-e-Taliban Pakistan TTP and TNSM began establishing
[01:27.160 --> 01:32.720]  their own courts. The deal was that the government would set up religious courts in return for
[01:32.720 --> 01:38.160]  ending the faction's armed patrols in the region. The Northwest Frontier Province government
[01:38.160 --> 01:45.360]  found itself at odds with TNSM leader Sufi Mohammed over appointees to the new courts.
[01:45.360 --> 01:52.120]  At the same time, the Pakistani military started attacking TTP positions. The TTP then took
[01:52.120 --> 01:58.280]  control of much of the region. An estimated 500,000 civilians have been driven from their
[01:58.280 --> 02:09.760]  homes. The advances of the Taliban insurgents beyond the federally administered tribal areas
[02:09.760 --> 02:15.880]  in recent weeks and the failure of the Pakistani military to counter them have come as a reality
[02:15.880 --> 02:22.560]  check to the Obama administration. These officials are now forced to face the fact that the Pakistani
[02:22.560 --> 02:28.080]  military does not share the U.S. view that the radical Islamist threat should be its
[02:28.080 --> 02:34.480]  top priority. After the terrorist attacks in Mumbai last November and rising Pakistani-Indian
[02:34.480 --> 02:41.160]  tensions, it was clear Pakistan was not interested in shifting its attention to the Taliban.

[06:51.540 --> 06:56.540]  I believe so. They were talking about how to get your mortgage discharged, right?
[06:56.540 --> 07:04.540]  Yes, because what they're saying is that even the original note holder doesn't have the original note anymore.
[07:04.540 --> 07:12.540]  And so, yes, as far as I know, it doesn't matter whether your mortgage has been sold to another bank
[07:12.540 --> 07:17.540]  or if it's the same company, from what I understand, you can do it in any case.
[07:17.540 --> 07:22.540]  Or taken over because Countrywide was taken over by Bank of America.
[07:22.540 --> 07:29.540]  Yes, yes, yes. You can do it then too because from what I understand, they don't have it anymore.
[07:29.540 --> 07:36.540]  They had to do something else with it in order to get the money to loan you because they didn't create it.
[07:36.540 --> 07:46.540]  And in fact, they were saying that there's a law that it's illegal for them to loan out other people's money, okay,
[07:46.540 --> 07:50.540]  like other people's money that's on deposit. They can't loan it out.
[07:50.540 --> 07:52.540]  So where did they get the money from?
[07:52.540 --> 07:58.540]  And according to what they're saying, they had to send in the original note to the government
[07:58.540 --> 08:03.540]  or to the Federal Reserve or something to get the money from the Federal Reserve to make the loan.

[08:05.540 --> 08:10.540]  So with this new signature, through Bank of America, through the loan modification,
[08:10.540 --> 08:14.540]  then that paperwork is basically still the same?

[10:08.540 --> 10:14.540]  because they have to present the wet ink signature note according to the federal rules of evidence,
[10:14.540 --> 10:20.540]  and they have not done that, and so now the whole thing is at a halt, okay?
[10:20.540 --> 10:25.540]  Apparently they've dropped the foreclosure case, so they're just not proceeding with it,
[10:25.540 --> 10:31.540]  and right now it's in a state of, well, they're not continuing to foreclose on his house,
[10:31.540 --> 10:35.540]  and so he's – but he's still pursuing his lawsuit against them.
[10:35.540 --> 10:36.540]  Right.
[10:36.540 --> 10:41.540]  Now, my question is, are these payments at this point because it is in litigation or –
[10:41.540 --> 10:43.540]  Now, that I don't know.
[10:43.540 --> 10:48.540]  I think the whole thing started because Chase Bank took over his mortgage
[10:48.540 --> 10:51.540]  or they bought the mortgage from whatever the original bank was,
[10:51.540 --> 10:55.540]  and Mike kept making payments and then they just decided to refuse his payments
[10:55.540 --> 10:58.540]  and send them back and then foreclose on his house,
[10:58.540 --> 11:00.540]  and I don't know if he's still making payments or not.

[14:00.540 --> 14:03.540]  and after that, I don't know what the heck can happen, you know?

[14:11.540 --> 14:17.540]  So there was a moratorium on repossession.
[14:17.540 --> 14:22.540]  And the moratorium was waiting for Obama to get his plan in place.

[14:25.540 --> 14:28.540]  And that's why the bank said the moratorium is over.
[14:28.540 --> 14:33.540]  Now he has a plan for modifying these loans.
[14:33.540 --> 14:37.540]  But there's something you need to know.
[14:37.540 --> 14:45.540]  The FBI, their primary concern is terrorists.
[14:45.540 --> 14:50.540]  Their third concern is mortgage fraud.
[14:50.540 --> 14:52.540]  The feds are going after these guys.
[14:52.540 --> 14:55.540]  The heat is on.
[14:55.540 --> 14:58.540]  So if ever there was a good time, now is a good time.

[15:54.540 --> 16:04.540]  Now I am on a W-2, and clearly income can't be what it was when I was self-employed because now there's evidence of all my income.

[16:10.540 --> 16:13.540]  Well, you might be able to make the loan go away.
[16:13.540 --> 16:19.540]  And if you can't make the loan go away, it's kind of like playing poker.

[16:22.540 --> 16:29.540]  And if you can't make the loan go away, you can most likely get a whole lot better deal.

[22:23.540 --> 22:29.540]  just because I called into the Liberty Beat when Richard was hosting and they needed us right there on the spot
[22:29.540 --> 22:35.540]  Awesome they may actually some of them actually made a beeline on their way home from work
[22:35.540 --> 22:47.540]  Turn back to the Capitol that's great yeah so everybody waited patiently the bill forced they put the bills that have the most testimony towards the end
[22:47.540 --> 22:53.540]  which doesn't make very much sense but it didn't end up getting heard being heard so like one one o'clock or so 1 a.m.
[22:53.540 --> 23:01.540]  a lot of people stuck around some really good testimony was given there's a couple a mother and a father that had lost children
[23:01.540 --> 23:07.540]  they gave their testimony at first they give the people that were proponents of Senate Bill 298 the sobriety checkpoint bill
[23:07.540 --> 23:16.540]  it was a very touching story very sad one of them showed the picture of his son that he lost and he also lost his neighbor's son tragically
[23:16.540 --> 23:23.540]  and then after that Jim Stutchman came up he was the first opponent of the bill he ran for Congressional District 25 here in Texas
[23:23.540 --> 23:30.540]  against Lloyd Doggett as a libertarian very great man veteran wonderful man I didn't know but he lost a father whenever he was 30
[23:30.540 --> 23:39.540]  to a drunk driver so he went ahead and filled the committee in on that and of course he gave him but I may have had this tragedy
[23:39.540 --> 23:48.540]  35 years ago I lost my father I haven't forgotten about it but my father would not have wanted our rights to be violated
[23:48.540 --> 23:57.540]  because as a result of his death as a result of some irresponsible behavior the testimony was very well we hit him on all sorts of different levels
[23:57.540 --> 24:03.540]  some people just went up there and just told them that's the very important thing about showing up about humanizing
[24:03.540 --> 24:10.540]  you look at the representatives directly in the face you stare at them let them know that you're there that you're paying attention
[24:10.540 --> 24:17.540]  and that the citizens are showing up to these things and you tell them many of the people just said this is wrong this is wrong
[24:17.540 --> 24:24.540]  I don't want to be in a state who has checkpoints this isn't American you know we basically hit him from every angle
[24:24.540 --> 24:31.540]  and I think that we had a really good impact the hearing went very well they were very receptive a couple times they thanked us
[24:31.540 --> 24:38.540]  they said you know it's always good to see people participating again and it lets us know that democracy is working
[24:38.540 --> 24:45.540]  which of course we'll find out depending on whether or not the bill stays pending in the committee but we had a good time
[24:45.540 --> 24:52.540]  there were some good people in the committee I haven't yet done a follow up meeting with the members or with their staff to see how they feel
[24:52.540 --> 25:00.540]  but judging on the phone calls that we made utilized the campaign for liberty network here in Texas for the first time on a bill
[25:00.540 --> 25:07.540]  at the state level and there's a list of probably about 13,000 people so imagine they must have at least had a few hundred calls against it
[25:07.540 --> 25:15.540]  the committee not to mention all of the wonderful testimony and all the people that signed cards against it and again it's all about showing up
[25:15.540 --> 25:26.540]  well now John, John let me ask you something did y'all get anybody to dress up like Hitler and go in there and testify for the checkpoints
[25:26.540 --> 25:33.540]  talk about how great it was in Germany when you said you were going to do that I was laughing so hard
[25:33.540 --> 25:40.540]  we decided that that probably wouldn't have been the best idea especially after somebody gets up there
[25:40.540 --> 25:47.540]  and the committee was crying after one of the checkpoints that lost their child I think it would have been a step in the wrong direction
[25:47.540 --> 25:55.540]  but I'll guarantee you this if that bill does pass we will show up in Hitler costumes two checkpoints standing right there on the side of the highway
[25:55.540 --> 26:00.540]  we could goose step right through it
[26:00.540 --> 26:11.540]  so hilarious oh my gosh so wow so John so what was your feeling by the end of the committee hearings
[26:11.540 --> 26:16.540]  do you think that the committee was swayed in either direction strongly
[26:16.540 --> 26:25.540]  yes if they hadn't already made up their minds or if they aren't in the pocket of Mothers Against Drunk Driving who has a $40 million budget a year
[26:25.540 --> 26:33.540]  I think that we definitely swayed them and we definitely had a positive impact on the outcome of this particular bill
[26:33.540 --> 26:39.540]  and you know the session ends at the beginning of June so if this bill doesn't go anywhere
[26:39.540 --> 26:44.540]  and it's going to take some more work you know we'll probably institute maybe another little phone call campaign
[26:44.540 --> 26:51.540]  people to show up at the offices in person and ensure that it doesn't it stays pending in this committee
[26:51.540 --> 26:57.540]  but you know if it doesn't go anywhere then boom you know there's proof in the pudding that if you gather some people
[26:57.540 --> 27:02.540]  you know all it took was 30 people you know some phone calls it didn't really take that much energy and effort
[27:02.540 --> 27:06.540]  we really can have a major impact here at the state and local level
[27:06.540 --> 27:15.540]  absolutely and I know that for a fact because they were going to do mandatory pet shipping in San Marcos
[27:15.540 --> 27:22.540]  and that's when Catherine Albrecht came to town and she went over she went down to San Marcos and testified her and a few other people
[27:22.540 --> 27:29.540]  and all that you know there was like 50 hundred people outside you know shouting no chip no chip you know
[27:29.540 --> 27:35.540]  and they were going to do it City Council was going to do it in San Marcos and after the research she presented
[27:35.540 --> 27:42.540]  and after everyone's testimonies and the big protests and everything then San Marcos City Council decided that they are not going to do it
[27:42.540 --> 27:48.540]  okay and they were going to do it no question about it okay so we definitely can make a difference
[27:48.540 --> 27:56.540]  yeah there's a victory right there and that needs to be trumpeted and magnified and everybody needs to see what happens when you show up
[27:56.540 --> 28:05.540]  when you participate yeah exactly not doom and gloom we don't have not all of our liberty is taken away right now you know
[28:05.540 --> 28:10.540]  we're right in the middle of it on the precipice of some very nasty times but we have the ability to turn it around
[28:10.540 --> 28:17.540]  and if we don't act then we pretty much better blame ourselves for not prohibiting it because it is a very big responsibility
[28:17.540 --> 28:24.540]  to be born into a republic like the United States and our previous generation and generations before unfortunately have dropped the ball

[38:32.540 --> 38:39.540]  and here in the city of Austin our city council is up half of the seats are up for reelection as well as the mayor's seat
[38:39.540 --> 38:47.540]  and again it illustrates harmonizing perfectly in that Texas for Accountable Government endorsed Carol E. Strayhorn for mayor
[38:47.540 --> 39:01.540]  Now I was in a big support of hers during the governor, gubernatorial election but here at the local level she is definitely a lot more on par ideologically wise
[39:01.540 --> 39:06.540]  and again that's most important than the other two, what's more important than that is she's willing to work with us
[39:06.540 --> 39:14.540]  she's an opportunist of course, she sees us as a means to help her get out the vote and actually get some boots on the ground
[39:14.540 --> 39:22.540]  because from the Ron Paul campaign we got it, we have the ability to mobilize and to do some real solid grassroots canvassing and activism
[39:22.540 --> 39:29.540]  so she's using us in a way but at the same time we're having a wonderful opportunity, you scratch my back, I'll scratch your back
[39:29.540 --> 39:38.540]  she's definitely not in bed with the growth machine here in the city of Austin, that's a lot of what drives local politics all across the country
[39:38.540 --> 39:44.540]  the development interest and the lawyers and the land development and the banks and the bonds that come from it
[39:44.540 --> 39:50.540]  they pretty much have control of our Austin city hall and that's not even an overstatement
[39:50.540 --> 39:58.540]  and the two individuals that are running against her, Lee Leffingwell and Brewster McCracken who are both already council members
[39:58.540 --> 40:07.540]  they are already deeply entrenched within the growth machine and the clutches of the Austin Chamber of Commerce which pretty much runs the show
[40:07.540 --> 40:17.540]  so we cannot have one of these guys as our mayor, not only that, Carol Strayhorn, she was kicking butts on the toll roads back in 2004, 2005
[40:17.540 --> 40:23.540]  she went up and down and organized against the trans-Texas corridor, we've interviewed her with changeaustin.org
[40:23.540 --> 40:31.540]  that's another one of our partner groups here in Austin, they did a candidates interview and they let us throw a couple questions in
[40:31.540 --> 40:40.540]  and we asked all the candidates how they feel about the police blood withdrawal issue and how they feel about collecting DNA from suspects of Class B misdemeanors

[40:45.540 --> 40:52.540]  and of course Brewster McCracken is okay with the police doing blood withdrawals and he said with the DNA collection

[41:51.540 --> 41:58.540]  the fact that they fought us on Proposition 2 which was a big grassroots fight against a luxury shopping mall here in North Austin

[42:04.540 --> 42:10.540]  Yeah, let's give the developers more money to develop and ruin our aquifer
[42:10.540 --> 42:20.540]  Yeah, it sounds like a good idea and trot all over the neighborhood associations when they protest and stuff like that

[42:21.540 --> 42:25.540]  Yeah, and now we have a $30 million deficit so we can't even pay them

[42:49.540 --> 42:57.540]  but he used City Hall to fight against the citizen-driven petition, charter, referendum, it's terrible

[46:50.540 --> 47:00.540]  Here's, sorry that was a motorcycle, here's the bread and butter though, and this is something that we've asked her straight to her face, and this is an issue that's huge right now all across the country
[47:00.540 --> 47:12.540]  We see tyranny and police state and the militarization of our police departments coming down the pike, and it's all emanating from the filth ridden federal government
[47:12.540 --> 47:20.540]  And they're stomping their big powerful feet and their big powerful lobby, for example at the committee hearing for the sobriety checkpoints
[47:20.540 --> 47:27.540]  They brought one of the NHTSA, National Highway and Traffic Safety Administration bigwigs down to come and give their testimony on how much they feel
[47:27.540 --> 47:39.540]  You know they really want to make the streets in America so safe, we've got to have checkpoints, total, oh man, really slimy woman, but either way it's all coming from the federal government
[47:39.540 --> 47:49.540]  But yeah it's all coming from the federal government, just boom, boom, boom, boom, boom, at the state level, just paying attention this last session
[47:49.540 --> 47:55.540]  This is my first session to really dig deep into it and actually show up at the hearing, and it's all coming from the federal government
[47:55.540 --> 48:06.540]  For example there's another bill that would take federal money and use DEA, it says that it can use federal entities to put police, I'm sorry to put license plate standing cameras up and down our highway
[48:06.540 --> 48:13.540]  Boom, boom, boom, feds, feds, feds, federal money to train the police officers, so we ask Carol Keaton Strayhorn straight to her face
[48:13.540 --> 48:19.540]  Grandma, are you going to lay down for the feds, are you going to stick up, are you going to let us handle our own affairs
[48:19.540 --> 48:30.540]  For example if a Katrina type event happens, are you going to lay down for FEMA and let them come run shot all over our liberties and do the worst, most terrible bureaucratic job ever
[48:30.540 --> 48:39.540]  Or are you going to say no, this is the city of Austin, this is the state of Texas, we can take care of ourselves, and she's down with that, she's tipped to it
[48:39.540 --> 48:47.540]  And I can tell you the other two candidates would definitely, without a doubt, especially Brewster McCracken, well this is conjecture of course, I'm not speaking in fact here
[48:47.540 --> 48:53.540]  But I would imagine that them two would be more willing to lay down for the feds, and I would say Brewster more than Leffingwell
[48:53.540 --> 49:00.540]  Because Brewster is trying to work his way up the political ladder, trying to move as far ahead as he possibly can
[49:00.540 --> 49:09.540]  So with Carol Strayhorn, not only do we get a seat at the table because we're helping her to get an office, but she also respects the principle of subsidiarity
[49:09.540 --> 49:17.540]  Which is to state that the authority should be vested in the lowest possible area, the lowest possible level, be it the local or the state level
[49:17.540 --> 49:23.540]  And she's down with that, so that's one of the bigger motivators to go out and campaign for her
[49:23.540 --> 49:32.540]  The other candidate, Sam Oseminy, he actually just called me on the line on my phone right now, he's running for place six, he ran last year, I was his campaign manager
[49:32.540 --> 49:39.540]  He's a wonderful man, he has an excellent message, a very powerful speaker, he's got it down, he would definitely be changed
[49:39.540 --> 49:48.540]  For smaller government, fiscal responsibility, he's running against Cheryl Cole, an incumbent who's just as much of a tool as the rest of them as far as the development machine goes
[49:48.540 --> 49:52.540]  Not to mention she's also down with police blood withdrawals
[49:52.540 --> 49:58.540]  So Sam Oseminy's actually got a shot this time, last time we didn't do too well, it was like a four or five way race
[49:58.540 --> 50:03.540]  And we basically got nominated, but he's been kicking some serious butt
[50:03.540 --> 50:11.540]  We got much more of a network here one year later through all the efforts of the Texas for Accountable Government and all the other organizations that are around
[50:11.540 --> 50:21.540]  And I feel that if people go out and vote tomorrow for Sam Oseminy, we definitely have a genuine chance of putting one of us right there with a seat at the table
[50:21.540 --> 50:24.540]  So definitely get out there and support Sam Oseminy
[50:24.540 --> 50:35.540]  And then place one is a race between Perla Kovatsos and Chris Riley, both of which, which many of the Austin politicians and Central Texas politicians, they all graduate from the LBJ School of Public Affairs
[50:35.540 --> 50:39.540]  Which is the government graduate program here at the University of Texas
[50:39.540 --> 50:44.540]  Which interestingly enough, the dean of that school used to be a gentleman by the name of James Steinberg
[50:44.540 --> 50:51.540]  Who is not only a Build-A-Berg attendee, but he's also a trilateral commission member as well as a Council on Foreign Relations member
[50:51.540 --> 51:02.540]  So the educational institutions in our country, the universities, especially the big ones, are definitely tentacles for the philosophy of collectivism and world government
[51:02.540 --> 51:08.540]  And that's where, I'm not trying to put a label on Perla or Chris in saying that, I was just going up on a side note
[51:08.540 --> 51:16.540]  Chris and Perla both graduated from that school, they both spent a lot of time in the planning commissions in the city of Austin
[51:16.540 --> 51:25.540]  So I personally feel that Perla, she's younger, Chris is more, he's more knowledgeable about the city of Austin and he's more of a politician, I feel
[51:25.540 --> 51:30.540]  Perla's more of a people's candidate, she would be more willing to open her door and meet with you
[51:30.540 --> 51:41.540]  And I do feel that she is less susceptible to the growth machine which inevitably shapes and shifts candidates more towards growth, growth, growth, come to Austin, come to Austin
[51:41.540 --> 51:49.540]  Let's put up condos and high rises, I feel that he is more susceptible to that, so I'm personally going to vote for Perla Cavazos
[51:49.540 --> 51:54.540]  And of course in place two, Mike Martinez, the incumbent, is running against Jose Quintero
[51:54.540 --> 52:01.540]  Jose Quintero is an Eastside resident who finally got fed up, he participated in the city hall, city politics
[52:01.540 --> 52:04.540]  He would go to the hearings and testify in front of the city council and whatnot
[52:04.540 --> 52:12.540]  He finally got so fed up with the crazy property taxes and our Eastside, which is the poor part of town, which is more minorities here in the city of Austin
[52:12.540 --> 52:20.540]  Every town's got a poor side, he lives there and there's gentrification going on right now, there's massive condos going up
[52:20.540 --> 52:29.540]  They're jacking up these individuals that can't even barely pay their rent in some cases or their mortgage and their property taxes are going through the roof
[52:29.540 --> 52:38.540]  So he said enough of it. Meanwhile, he's like, what's going on here? Why is this a big growth machine? What's with all these new buildings and whatnot?
[52:38.540 --> 52:46.540]  What's with this idea of smart growth? He goes to Brave New Books, bravenewbookstore.com, and gets some info on Agenda 21
[52:46.540 --> 52:51.540]  Now he's getting to the whole Agenda 21 thing and how it's showing cities all over the country
[52:51.540 --> 52:58.540]  Yes, smart growth is absolutely Agenda 21, no question about it, that's what Greg and Don talk about on their show
[52:58.540 --> 53:03.540]  Definitely. See, it's all connected. So this guy's running for city council place two, he got my vote
[53:03.540 --> 53:09.540]  And that's it. There's also Bill Spelman, he's running unopposed in place five, he was a previous city council candidate
[53:09.540 --> 53:15.540]  I think he's a man of the people and he has good intentions, but it's just going to be more of the same, but he's already guaranteed a seat
[53:15.540 --> 53:24.540]  So I'm voting for Carol Keaton Strayhorn, Carla Cavazzo, Jose Quintero, and my main man, Sam Oseminy, Oseminy Sam
[53:24.540 --> 53:30.540]  And here's what you can do to help because it doesn't stop with voting, voting unfortunately is not enough for individuals
[53:30.540 --> 53:37.540]  And candidates that support the liberty philosophy, for some reason America doesn't seem to be in favor of freedom nowadays
[53:37.540 --> 53:43.540]  According to the people that they put in office, we can't, we've got to do more than vote because our numbers are so limited right now
[53:43.540 --> 53:50.540]  Actually I do believe that we have a majoritarian stance, people don't realize it yet, they're just too lost in the left-right paradigm
[53:50.540 --> 53:55.540]  They don't realize the importance of city elections and local elections, but we need people to get out and participate
[53:55.540 --> 54:02.540]  We need people to show what the Ron Paul revolution and what these grassroots activists are all about
[54:02.540 --> 54:08.540]  And for Carol Strayhorn, I'm going to give out my number on the air, I did last night and actually ended up panning out
[54:08.540 --> 54:13.540]  So don't anybody call me if you're just going to harass me, but if you genuinely want to help in the election tomorrow

[01:05:26.540 --> 01:05:32.540]  I've been a student of it for a long time, but I'm ready to file a flurry of complaints, criminal complaints

[01:05:35.540 --> 01:05:41.540]  I'm out in New York, so it's not new, but you get a little corruption everywhere you go

[01:05:43.540 --> 01:05:52.540]  I went into traffic court, filed a motion to dismiss, just based off of the presumption that there's no corpus telepti
[01:05:52.540 --> 01:05:57.540]  I'm just curious, the judge denied the motion verbally
[01:05:57.540 --> 01:06:04.540]  And I remember you saying something to someone, Randy, when a judge did it verbally, but there's nothing in the record
[01:06:04.540 --> 01:06:09.540]  Am I missing something that I could possibly go back and attack on?
[01:06:09.540 --> 01:06:15.540]  No, generally a judge can deny a motion verbally
[01:06:15.540 --> 01:06:21.540]  When the judge has to do something was more when he approves the motion
[01:06:21.540 --> 01:06:29.540]  And you ask the court to order the other side to do something or issue some sort of an order
[01:06:29.540 --> 01:06:35.540]  Then he would have to write something, like if he's going to dismiss, he can't do that verbally, he has to
[01:06:35.540 --> 01:06:41.540]  There has to be an order of dismissal, but he can turn down motions verbally
[01:06:41.540 --> 01:06:51.540]  When a judge turns down a motion, the first thing you want to shoot to him is a motion for findings, effect, and conclusions at law
[01:06:51.540 --> 01:06:57.540]  Okay, is that something I should have done verbally? This is going almost over a year ago and I'm still battling it
[01:06:57.540 --> 01:07:02.540]  It's a little late for findings, effect, and conclusions at law, that needs to be done right away

[01:14:57.540 --> 01:15:18.540]  Yeah, and it's harder for them to handle too, because if it's some major deal, the grand jury is probably less likely to indict them, you know, they're less likely to get, you know, it's easier to blow off a big charge, you know, because it's so outrageous, but something little, it actually does cause them more problems, it's like a stumbling block
[01:15:18.540 --> 01:15:28.540]  I mean, because like a big wall or a big tree, you just walk around it, but when there's like a pebble on the ground, you know, you slip on it and fall

[01:20:15.540 --> 01:20:24.540]  And I have a lawyer in the, sent a motion for continuance in so I wouldn't be going in there the day after surgery
[01:20:24.540 --> 01:20:32.540]  And they denied because there's been maybe six continuances or something already
[01:20:32.540 --> 01:20:39.540]  And for some reason they can't see, fit the issue one based on the medical situation
[01:20:39.540 --> 01:20:46.540]  I got a copy of video footage from the police station
[01:20:46.540 --> 01:20:57.540]  Which it was indicated in the prosecutor's submission as what he was going to introduce as evidence
[01:20:57.540 --> 01:21:01.540]  His discovery filing as a breathalyzer room recording
[01:21:01.540 --> 01:21:12.540]  However what I noticed on the recording was that the video, for one the breathalyzer room was pitch black, it was really dark
[01:21:12.540 --> 01:21:18.540]  And the videotape actually is from across the adjacent room
[01:21:18.540 --> 01:21:23.540]  So it's probably shot from some 20 feet away from the breathalyzer room
[01:21:23.540 --> 01:21:29.540]  So you can just see basically a dark doorway, you can't even see me in there
[01:21:29.540 --> 01:21:35.540]  I don't know if there's supposed to be some lighting in a room when someone's trying to submit a test
[01:21:35.540 --> 01:21:40.540]  But there was no light and that's very clear from the videotape footage
[01:21:40.540 --> 01:21:47.540]  And it has been telling me after the first round of attempts which lasted about four minutes
[01:21:47.540 --> 01:21:51.540]  To sit down and wait to take the test again
[01:21:51.540 --> 01:21:58.540]  Then one of the officers got on the phone and consulted someone on the law or their superior or something
[01:21:58.540 --> 01:22:03.540]  And their decision was to not let me take the test again at all
[01:22:03.540 --> 01:22:07.540]  And so they charged me with refusing
[01:22:07.540 --> 01:22:12.540]  They're telling me to hold on, take the test again in a couple minutes
[01:22:12.540 --> 01:22:17.540]  And then reneging on that
[01:22:17.540 --> 01:22:20.540]  Wait a minute, wait a minute, stop, stop
[01:22:20.540 --> 01:22:25.540]  Okay, you took the test the first time?
[01:22:25.540 --> 01:22:31.540]  Well I attempted to, I was blowing into the tube and it seemed like maybe they had punched a hole in the tube or something
[01:22:31.540 --> 01:22:34.540]  Okay, so you didn't refuse to take the test?
[01:22:34.540 --> 01:22:36.540]  Absolutely not
[01:22:36.540 --> 01:22:38.540]  How much of the videotape shows that?

[01:22:42.540 --> 01:22:47.540]  And it really sounded like she was into it, she was going blow, blow, blow, blow, blow, blow, blow, blow, blow, blow, blow

[01:22:49.540 --> 01:22:56.540]  And one of the samples actually registered a.081 according to the machine
[01:22:56.540 --> 01:23:05.540]  However, my lawyer pointed out to me that he could see from the results that the machine was actually.02
[01:23:05.540 --> 01:23:08.540]  High in its reading, which means that
[01:23:08.540 --> 01:23:20.540]  Okay, so they're saying that you actually did the breathalyzer and they got a reading off of it
[01:23:20.540 --> 01:23:23.540]  They're saying that it was incomplete
[01:23:23.540 --> 01:23:25.540]  Okay, stop, stop
[01:23:25.540 --> 01:23:29.540]  They said you didn't take it
[01:23:29.540 --> 01:23:36.540]  And then they said that you did do the breathalyzer but you didn't do it exactly precisely the way they wanted it to
[01:23:36.540 --> 01:23:42.540]  You should file aggravated perjury, tampering with the government document against them
[01:23:42.540 --> 01:23:50.540]  Yeah, it's not your fault if their equipment was malfunctioning
[01:23:50.540 --> 01:23:52.540]  Or the tester themselves
[01:23:52.540 --> 01:23:55.540]  Yeah, that doesn't mean that you refused to take it
[01:23:55.540 --> 01:23:59.540]  You have evidence that you took the test
[01:23:59.540 --> 01:24:04.540]  Well, and besides that, Randy, I mean, somewhere this should go to some kind of reasonableness
[01:24:04.540 --> 01:24:11.540]  Because if their equipment or just the whole way the test is set up, even if the equipment isn't now functioning
[01:24:11.540 --> 01:24:17.540]  If it's so difficult to take the test, I mean, you've got to sit there and hyperventilate for four minutes

[01:24:22.540 --> 01:24:27.540]  How can they say that you refused to take it or that you just didn't take it
[01:24:27.540 --> 01:24:32.540]  If you're sitting here having to go and blow as hard as you can for four minutes, that's unreasonable

[01:24:33.540 --> 01:24:36.540]  See, that's the whole thing in this case, Debra, from what he's describing
[01:24:36.540 --> 01:24:39.540]  This videotape clearly shows that he is being given the test
[01:24:39.540 --> 01:24:48.540]  The prosecutor is clearly stating that they are testifying this evidence is this man giving this test
[01:24:48.540 --> 01:24:52.540]  So the charge is false upon its face in open court
[01:24:52.540 --> 01:24:53.540]  Yeah, no kidding

[01:24:55.540 --> 01:25:02.540]  Well, there's a lot of tricks that people can manipulate while they're pretending to try to submit the test

[01:25:08.540 --> 01:25:13.540]  How is the charge defined?
[01:25:13.540 --> 01:25:17.540]  Well, they noted, they claimed that I was
[01:25:17.540 --> 01:25:21.540]  No, no, no, no, no, no, nobody cares what they said
[01:25:21.540 --> 01:25:27.540]  What does the law say constitutes the commission of the act?
[01:25:27.540 --> 01:25:30.540]  Well, refusal isn't simply someone says I'm not taking it
[01:25:30.540 --> 01:25:41.540]  Refusal is if according to their discretion you don't sufficiently complete the test
[01:25:41.540 --> 01:25:43.540]  And so that's what they're trying to say
[01:25:43.540 --> 01:25:45.540]  That's unconstitutionally vague
[01:25:45.540 --> 01:25:48.540]  That is ridiculous
[01:25:48.540 --> 01:25:54.540]  Yeah, that leads it up to their discretion to say that you can breathe any way they don't want you to

[01:25:55.540 --> 01:26:00.540]  How much training did they give you in how to take the test before they gave it to you?
[01:26:00.540 --> 01:26:05.540]  Yeah, really, I mean, was you have to pass a six month course to figure it out or what?
[01:26:05.540 --> 01:26:09.540]  Well, she said take a deep breath and blow and don't stop blowing until I tell you to stop
[01:26:09.540 --> 01:26:17.540]  And then she was telling me that if it beeped, that it meant that the test was not going right

[01:26:19.540 --> 01:26:24.540]  So the thing had a short tone and a long tone, but it was all, well, beeped to me
[01:26:24.540 --> 01:26:29.540]  And so, I mean, I pointed that out to her
[01:26:29.540 --> 01:26:35.540]  And I don't know, she basically accused me of blowing past the tube
[01:26:35.540 --> 01:26:41.540]  I mean, regardless, they say it was impartial, it didn't register complete, but.08
[01:26:41.540 --> 01:26:48.540]  Okay, then what's your point here? Where are you going?
[01:26:48.540 --> 01:26:51.540]  Well, I don't know about bringing up constitutionality

[01:50:43.540 --> 01:50:47.540]  Where we have a couple of large industrial plants located
[01:50:47.540 --> 01:50:49.540]  And I had one of my customers come in
[01:50:49.540 --> 01:50:57.540]  He had just been given a traffic citation by, in fact, one of the same police officers that wrote my traffic citations
[01:50:57.540 --> 01:51:05.540]  And the officer charged him with going through the train intersection illegally
[01:51:05.540 --> 01:51:11.540]  Basically saying that he was required to stop and stay stopped at all times
[01:51:11.540 --> 01:51:16.540]  And charged him with a criminal act of going through a crossing illegally
[01:51:16.540 --> 01:51:24.540]  However, the section of code in Texas that deals with this is section 545.251 and 252
[01:51:24.540 --> 01:51:32.540]  Now, in both of those sections, 251 is the only one that defines what an offense is
[01:51:32.540 --> 01:51:36.540]  Now, at this particular intersection, there is nothing more than a flashing signal light
[01:51:36.540 --> 01:51:41.540]  There are no drop bars or arms of any kind to block the intersection
[01:51:41.540 --> 01:51:47.540]  It's a four-lane highway through there where it goes around, so it's just using the signal lights
[01:51:47.540 --> 01:51:57.540]  Now, the statute is very specific in 542.252 where it says that an operator approaching a stop sign
[01:51:57.540 --> 01:52:04.540]  Or other official traffic control device that requires a stop and that is erected under subsection A
[01:52:04.540 --> 01:52:11.540]  Shall not stop closer than 15 feet or farther than 50 feet from the nearest rail of the railroad
[01:52:11.540 --> 01:52:15.540]  And may proceed only with due care
[01:52:15.540 --> 01:52:20.540]  Now, basically due care would mean that you're not in danger of causing an accident with the train
[01:52:20.540 --> 01:52:25.540]  The train's far enough away from the intersection that there's no chance of it getting anywhere near the intersection
[01:52:25.540 --> 01:52:29.540]  While you're proceeding through it or anything like that
[01:52:29.540 --> 01:52:32.540]  Good old common sense type stuff
[01:52:32.540 --> 01:52:42.540]  The only part, however, that defines an offense is 545.251, subsection D
[01:52:42.540 --> 01:52:50.540]  An operator commits an offense if the operator drives around, under, or through a crossing gate or a barrier
[01:52:50.540 --> 01:52:57.540]  At a railroad crossing while the gate or barrier is closed, being closed, or being opened
[01:52:57.540 --> 01:53:02.540]  Now, that is the only section in these two that defines an offense
[01:53:02.540 --> 01:53:07.540]  So, right off the bat, once again, Officer Fitch has committed aggravated perjury
[01:53:07.540 --> 01:53:12.540]  By making a false charge against someone in order to get his money out of them in fines
[01:53:12.540 --> 01:53:17.540]  So, just an FYI, it goes back to what I said each time I've talked
[01:53:17.540 --> 01:53:23.540]  Under no circumstances take anybody's word about what it is that the law says
[01:53:23.540 --> 01:53:25.540]  Look at it for yourself
[01:53:25.540 --> 01:53:29.540]  Always try to find out what section you're being charged under
[01:53:29.540 --> 01:53:33.540]  Do not presume that you know what any word within that section means
[01:53:33.540 --> 01:53:42.540]  Because, just like here, this charge only works against an operator of a vehicle
[01:53:42.540 --> 01:53:48.540]  And we can show nine ways from Sunday that operators got nothing to do with a common traveler in an automobile
[01:53:48.540 --> 01:53:51.540]  But either way, safety first, don't pull out in front of trains
[01:53:51.540 --> 01:53:55.540]  And a point about definitions
[01:53:55.540 --> 01:53:59.540]  Don't look in Webster
[01:53:59.540 --> 01:54:02.540]  Look in blacks
[01:54:02.540 --> 01:54:04.540]  You want to explain that, Eddie?
[01:54:04.540 --> 01:54:11.540]  Yeah, basically speaking, the first thing you do is see if that term is defined within the statute you're reading
[01:54:11.540 --> 01:54:17.540]  And then make very sure that you determine what scope that definition involves
[01:54:17.540 --> 01:54:23.540]  You will see definitions that say, in this chapter, this particular term means
[01:54:23.540 --> 01:54:27.540]  Or in this section, this particular term means
[01:54:27.540 --> 01:54:29.540]  Remember that that is the scope
[01:54:29.540 --> 01:54:38.540]  It limits that definition only to that specific section, chapter, article, however it sets it up
[01:54:38.540 --> 01:54:46.540]  If the term is not defined within that chapter, section, subsection, subtitle, title, whatever
[01:54:46.540 --> 01:54:50.540]  Then the very first place you go check is Chapter 311 Government Code
[01:54:50.540 --> 01:54:53.540]  Now there's not a whole lot of definitions in 311 Government Code
[01:54:53.540 --> 01:54:58.540]  So after you've read it once or twice, you'll know what you don't have to go there to look for
[01:54:58.540 --> 01:55:05.540]  But once you leave that, you go first to a law dictionary, not to a common English dictionary
[01:55:05.540 --> 01:55:11.540]  Because when they say that all words not defined shall be construed in their common usage
[01:55:11.540 --> 01:55:17.540]  They are talking their common usage in law, not in common everyday English
[01:55:17.540 --> 01:55:20.540]  So always check the law dictionary first
[01:55:20.540 --> 01:55:29.540]  Now the other caveat to that is remember, state courts, federal courts, other than the Supreme Court all use Black's Law

[01:55:34.540 --> 01:55:44.540]  There can be an argument made that the definitions of bouviers, according to the Supreme Court way of usage, will supersede those of Blacks
