[04:39.480 --> 04:43.440]  So apparently, I mean, you told us a story about what happened at the Secretary of State's
[04:43.440 --> 04:50.640]  office, maybe you could go, you know, review that history.
[04:50.640 --> 04:57.640]  When they brought you to jail, did the FBI call APD or did the FBI bring you there?
[04:57.640 --> 05:02.040]  No, the FBI called the Austin PD.
[05:02.040 --> 05:08.120]  So the Austin PD went and got you from the FBI's office and brought you back to the municipal
[05:08.120 --> 05:11.040]  jail or the county jail, okay.
[05:11.040 --> 05:17.500]  Before the Fed talked to me, he ran NCIC on me.
[05:17.500 --> 05:26.920]  And it seems that the DPS issued the warrant, got the warrant issued and then put it on
[05:26.920 --> 05:33.480]  the NCIC to make sure that if I got stopped anywhere, I'd get arrested and taken to jail.
[05:33.480 --> 05:38.120]  And I think they were hoping it would be a lot more inconvenient than it was.

[07:39.760 --> 07:47.520]  Code of Criminal Procedure specifies what a judge can call, can summon someone into court

[07:49.680 --> 07:51.320]  And there's a whole number of things.
[07:51.320 --> 07:58.340]  But to find out if he has an attorney is not one of them.
[07:58.340 --> 08:05.320]  So when I get to court, first thing I'm going to want to know is what am I doing here?
[08:05.320 --> 08:09.520]  And he's going to say they wanted to find out if I had an attorney or not.
[08:09.520 --> 08:13.560]  And I'm going to tell him, well, that's not the question I asked.
[08:13.560 --> 08:22.160]  I want to know under what specific statutory authority did you summon me under threat of
[08:22.160 --> 08:27.200]  arrest to come here before this court?
[08:27.200 --> 08:30.740]  And he's going to do some little song and dance.
[08:30.740 --> 08:41.640]  And then I'm going to point him toward Chapter 28, Title 2801 of the Texas Code of Criminal
[08:41.640 --> 08:49.000]  Procedure, which specifies what a judge can summon someone to court for.
[08:49.000 --> 08:56.760]  And ask him to tell me which one of those in that list did he summon me for.
[08:56.760 --> 09:03.600]  And he's going to suggest that he summoned me under his inherent power as a judge.
[09:03.600 --> 09:10.640]  He said, well, that will be nice if you had that inherent power.
[09:10.640 --> 09:19.120]  But where a power is specified by the legislature, it cannot arbitrarily be expanded on by a
[09:19.120 --> 09:23.040]  supposed inherent power of the court.
[09:23.040 --> 09:29.640]  The legislature went to the trouble to very clearly specify what a person can be summoned
[09:29.640 --> 09:33.520]  to court for.
[09:33.520 --> 09:38.600]  And to find out if he has an attorney is not in the list, Bubba.
[09:38.600 --> 09:47.760]  So when he can't give me a good reason, I'm going to ask him to disqualify himself as
[09:47.760 --> 09:53.520]  he has committed a criminal act from the bench to my detriment.
[09:53.520 --> 10:01.360]  And I will be preparing criminal charges to present to a grand jury against him.
[10:01.360 --> 10:06.560]  And I'm going to ask him to disqualify himself until such time as the criminal allegations

[11:30.640 --> 11:35.080]  They wouldn't notarize it so I called the DPS to memorialize the refusal and take a
[11:35.080 --> 11:41.600]  complaint which the officer refused to do and ordered me from the room, the building,
[11:41.600 --> 11:46.720]  and physically forced me up to the lobby and then let me leave the lobby, wanted my identification
[11:46.720 --> 11:51.200]  which I gave him, then he wanted my driver's license which I wouldn't give him, and they
[11:51.200 --> 11:56.400]  wound up knocking the crap out of me and arresting me.
[11:56.400 --> 12:00.960]  Let me read the statement by officer Enrico Cruz.
[12:00.960 --> 12:08.040]  I, officer Enrico Cruz, derised at the James Rutter building and went to room B205, the
[12:08.040 --> 12:12.440]  officer secretary of state notary public section.
[12:12.440 --> 12:18.080]  I made contact with Kelton Randall D who had some personal papers of his which he was trying
[12:18.080 --> 12:27.720]  to get an aposteele from the secretary of state, attorney Hoang Nahilda.
[12:27.720 --> 12:33.000]  Hoang noticeably irritated, advised Kelton again as she had already explained to him
[12:33.000 --> 12:37.400]  before that an aposteele could not be issued to him legally from her office because the
[12:37.400 --> 12:42.160]  document is only issued and attached to documents pertaining to business outside the United
[12:42.160 --> 12:43.160]  States of America.
[12:43.160 --> 12:47.960]  I asked Miss Hoang if this meant that Mr. Kelton could no longer be helped and she said

[13:29.160 --> 13:34.280]  I told Kelton to have a seat while I waited for DPS communications to advise me of any
[13:34.280 --> 13:39.960]  history or alarms at which point he tried to leave again and I repeated to him that

[13:43.640 --> 13:49.440]  I was notified by DPS communication that he had a Texas driver's license 09456456 and
[13:49.440 --> 13:50.960]  the status was clear.
[13:50.960 --> 13:55.700]  I gave Kelton his Texas identification card back and said that he would be receiving a
[13:55.700 --> 14:00.560]  criminal trespass warning and that he was free to leave.

[14:06.000 --> 14:12.320]  I called APD and they are coming to take my complaint because you falsely arrested me.
[14:12.320 --> 14:17.260]  My supervisor Sergeant Stephen McNeil who had arrived took Mr. Kelton outside to advise
[14:17.260 --> 14:19.040]  him he was free to leave.
[14:19.040 --> 14:22.160]  Kelton said no I am waiting for APD.
[14:22.160 --> 14:28.840]  The phone call to APD dispatched by Officer John Esposito to confirm that an officer was
[14:28.840 --> 14:32.040]  en route to take a report turned out negative.
[14:32.040 --> 14:36.680]  APD advised Esposito there was nothing on their log instructing anyone to go and take
[14:36.680 --> 14:41.880]  a report about a false arrest from anyone named Kelton, Randall Duane.
[14:41.880 --> 14:45.600]  Kelton was handcuffed and arrested for criminal trespass and booked in the Travis County
[14:45.600 --> 14:47.960]  Jail.

[27:02.680 --> 27:05.680]  He didn't do anything stupid
[27:05.680 --> 27:08.680]  And then the sergeant came in and the sergeant just lost it
[27:08.680 --> 27:11.680]  I think the sergeant was on drugs
[27:11.680 --> 27:17.680]  He gave all of the indications of having no impulse control
[27:17.680 --> 27:22.680]  So when they put me in the patrol car
[27:22.680 --> 27:24.680]  I told this black guy, he got in the car
[27:24.680 --> 27:27.680]  I said, oh no, no, you need to get out of here
[27:27.680 --> 27:29.680]  No, I have to take you to jail
[27:29.680 --> 27:31.680]  No, no, no, no, no
[27:31.680 --> 27:34.680]  You're the only one that conducted yourself with any kind of professional decorum

[28:04.680 --> 28:08.680]  To stop, you know, to end things so they didn't get worse

[28:11.680 --> 28:16.680]  But I'm going to get him on the stand

[33:01.680 --> 33:15.680]  But there is a statute under 2202 Texas penal code that talks about assault, aggravated assault
[33:15.680 --> 33:26.680]  And if a person commits assault while displaying a deadly weapon, that's a second degree felony in the state of Texas
[33:26.680 --> 33:36.680]  Except if that person is acting under the color of an official authority
[33:36.680 --> 33:42.680]  Color in legal terms means pretense
[33:42.680 --> 33:47.680]  In which case it is a first degree felony
[33:47.680 --> 33:53.680]  You know, aggravated kidnapping, first degree murder
[33:53.680 --> 33:56.680]  They're all first degree felonies
[33:56.680 --> 34:00.680]  I'm sorry, first degree murder is a capital felony
[34:00.680 --> 34:04.680]  But murder is a first degree felony
[34:04.680 --> 34:11.680]  The legislature considered that really serious business
[34:11.680 --> 34:23.680]  And in the statute, they addressed assault by a public official or someone acting under the color of official authority
[34:23.680 --> 34:31.680]  They considered that before they considered an assault against a public official
[34:31.680 --> 34:46.680]  However, when I went to Lexus and did a search on it, on assault by a public official, I got zero hits
[34:46.680 --> 34:54.680]  Now, to understand how profound that is, there's a guy named Rhett Pease
[34:54.680 --> 34:57.680]  Rhett Pease is just an ordinary guy
[34:57.680 --> 35:00.680]  Well, he's kind of a pain in the neck
[35:00.680 --> 35:04.680]  He sues everybody
[35:04.680 --> 35:09.680]  Emotionally loses, sometimes I guess he wins, I don't know
[35:09.680 --> 35:16.680]  I one time ran Rhett Pease's name on Lexus
[35:16.680 --> 35:20.680]  I got every suit he ever filed
[35:20.680 --> 35:23.680]  It's on Lexus
[35:23.680 --> 35:33.680]  He's just some ordinary guy, podunk Texas, files a few lawsuits against some ordinary people and a couple against some judges and stuff
[35:33.680 --> 35:39.680]  But every single one of them is in Lexus
[35:39.680 --> 35:53.680]  Not one single case where a public official is accused of assaulting a person while displaying a deadly weapon
[35:53.680 --> 36:06.680]  Every single time a police officer uses force when force is not warranted while he's displaying a deadly weapon
[36:06.680 --> 36:18.680]  That falls under 22.02 paragraph B to A
[36:18.680 --> 36:21.680]  Clearly dead center right under it
[36:21.680 --> 36:26.680]  They call it police brutality, but that's a legal fiction
[36:26.680 --> 36:29.680]  There is no such thing as police brutality
[36:29.680 --> 36:33.680]  There is aggravated assault by a public official
[36:33.680 --> 36:37.680]  So I'm going to charge the assistant director of the DPS
[36:37.680 --> 36:41.680]  There is no director, he's retired
[36:41.680 --> 36:44.680]  But there is an assistant director
[36:44.680 --> 36:55.680]  When I go into court Monday, the first thing I will do before anything else is tell the judge that I have some papers to present to the court
[36:55.680 --> 37:01.680]  And the prosecutor will object because he hasn't seen them
[37:01.680 --> 37:07.680]  And I will tell the prosecutor, no you haven't seen them because they're not any of your business yet
[37:07.680 --> 37:10.680]  They will be in a minute
[37:10.680 --> 37:14.680]  And that will probably get the judge's attention
[37:14.680 --> 37:22.680]  But if the prosecutor insists on seeing them, then I'll give them to the prosecutor
[37:22.680 --> 37:27.680]  And tell the judge, I guess I don't need to give them to you now
[37:27.680 --> 37:31.680]  He does
[37:31.680 --> 37:37.680]  Prosecutors are going to look at them and they're going to be a stack of verified criminal affidavits
[37:37.680 --> 37:40.680]  And here's the deal
[37:40.680 --> 37:46.680]  When I present verified criminal affidavits to a judge
[37:46.680 --> 37:51.680]  He stops being a judge and becomes a magistrate
[37:51.680 --> 37:54.680]  I invoke his duty as a magistrate
[37:54.680 --> 37:58.680]  If the prosecuting attorney intercedes
[37:58.680 --> 38:03.680]  And the judge directs me to give the documents to the prosecuting attorney
[38:03.680 --> 38:11.680]  When he reads them, then his duty under Article 2.03 Code of Criminal Procedure is invoked
[38:11.680 --> 38:20.680]  I'm sorry, the statute for the judge was Article 2.10 Code of Criminal Procedure invoked the judge's duty as a magistrate
[38:20.680 --> 38:24.680]  And it has been given to the prosecutor
[38:24.680 --> 38:28.680]  When the prosecutor reads the criminal affidavit
[38:28.680 --> 38:37.680]  Then he has had it made known to him that a public official has violated a law relating to his office
[38:37.680 --> 38:43.680]  And that's covered under Article 2.03 Code of Criminal Procedure
[38:43.680 --> 38:48.680]  And gives the prosecutor a specific duty
[38:48.680 --> 38:55.680]  He gives the complaint to an information and submit both to the grand jury
[38:55.680 --> 39:04.680]  Article 2.05 commands him to submit a copy of the complaint to some magistrate
[39:04.680 --> 39:12.680]  So, now it's the prosecutor's duty to give a copy to the judge, because he's a magistrate
[39:12.680 --> 39:17.680]  And present the other to the grand jury
[39:17.680 --> 39:20.680]  Gotcha, Bubba!
[39:20.680 --> 39:25.680]  And what he's going to say is I have to give him to the district attorney
[39:25.680 --> 39:35.680]  And I will say, well, Article 2.03 did not say when a district attorney is made known
[39:35.680 --> 39:41.680]  It says when a prosecuting attorney is made known
[39:41.680 --> 39:48.680]  Unless I'm badly mistaken, you're a prosecuting attorney for the state of Texas
[39:48.680 --> 39:52.680]  Unless, of course, you don't have an oath of office
[39:52.680 --> 39:57.680]  In which case, you're an imposter
[39:57.680 --> 40:02.680]  And that'll be the first thing we do in the court
[40:02.680 --> 40:09.680]  If I can get it done, you see, all of this is a learning process
[40:09.680 --> 40:16.680]  What I don't always know is what kind of shenanigans they're going to try to pull
[40:16.680 --> 40:20.680]  If the judge just simply refuses to hear the complaints
[40:20.680 --> 40:24.680]  Then I'll order the prosecutor to give those to the judge
[40:24.680 --> 40:28.680]  In accordance with Article 2.05 code-groom procedure
[40:28.680 --> 40:33.680]  And frankly, I haven't done this this way in court enough
[40:33.680 --> 40:39.680]  To know what the prosecutor is going to try to do
[40:39.680 --> 40:46.680]  He'll probably launch into an ad hominem attack against me
[40:46.680 --> 40:49.680]  And I'll feel disparaged if he does
[40:49.680 --> 40:53.680]  You hurt my feelings
[40:53.680 --> 40:57.680]  But it'll be a test, I'll get to find out what the prosecutor does
[40:57.680 --> 41:02.680]  I suspect that whatever he tries to do, I'm pretty well going to be ready for it
[41:02.680 --> 41:06.680]  I've done this, I've messed with prosecutors enough
[41:06.680 --> 41:11.680]  That I've pretty well got their standard fair
[41:11.680 --> 41:20.680]  What he's probably going to do is tell the judge that I need to file these with a Justice of the Peace
[41:20.680 --> 41:30.680]  And I'm going to ask the judge to show me in some statute
[41:30.680 --> 41:36.680]  Where a complaint is directed to a Justice of the Peace
[41:36.680 --> 41:39.680]  I looked all through the code and I couldn't find it, maybe learning
[41:39.680 --> 41:43.680]  What I won't do is talk to the prosecutor
[41:43.680 --> 41:47.680]  I only talk to the judge and that drives the prosecutor crazy
[41:47.680 --> 41:51.680]  If the prosecutor talks to me, I ignore him
[41:51.680 --> 41:59.680]  Because in court, you're there to address the court, not each other
[41:59.680 --> 42:03.680]  So you're not supposed to talk to each other
[42:03.680 --> 42:07.680]  If the prosecutor's not supposed to speak to you, you're not supposed to speak to him
[42:07.680 --> 42:13.680]  Any time the prosecutor speaks to me, then I ask the judge to direct the prosecutor
[42:13.680 --> 42:18.680]  Or instruct the prosecutor to direct his comments to the court
[42:18.680 --> 42:25.680]  That he's not my buddy and I'm not interested in engaging in the idle conversation with him
[42:25.680 --> 42:31.680]  This is the first part of the plan and the other part, I've got the weekend
[42:31.680 --> 42:41.680]  To put together every annoying and obnoxious maneuver I can pull in front of the court
[42:41.680 --> 42:48.680]  I want to get a hold of Joe Edwards and kind of get down how to stand at arm's length from the court

[47:46.680 --> 47:51.680]  In the presence of the jailers and the judge and the magistrate
[47:51.680 --> 48:01.680]  While I was being held in a cell and physically preventing from attending the hearing
[48:01.680 --> 48:05.680]  And the judge is going to say, well, this is a misdemeanor
[48:05.680 --> 48:09.680]  And you don't have a right to an examining trial

[49:27.680 --> 49:32.680]  So the presupposition must be that there was an examining trial

[49:53.680 --> 49:57.680]  Outside a proper hearing
[49:57.680 --> 50:05.680]  Because obviously the judge had documents in his hand relating to me, how'd he get them?
[50:05.680 --> 50:09.680]  And I'm going to ask the judge to arrest the magistrate
[50:09.680 --> 50:15.680]  Because there will be criminal complaints against the magistrate in the stack that I brought
[50:15.680 --> 50:22.680]  I don't know how far we'll get, the judge may just blow the whole thing off
[50:22.680 --> 50:30.680]  And say, this case is continued, you're to come back next day
[50:30.680 --> 50:35.680]  So if he does that, that's what I really expect him to do, is just kind of blow me out of there
[50:35.680 --> 50:40.680]  Because he's likely to be bushwhacked by me
[50:40.680 --> 50:44.680]  He's not going to know who I am when I come in the door
[50:44.680 --> 50:46.680]  And he's not going to know until I land on him
[50:46.680 --> 50:49.680]  I don't know about that, Randy
[50:49.680 --> 50:52.680]  I think they know who you are by now
[50:52.680 --> 50:59.680]  Well, I'm sure that the DPS is not waving a red flag
[50:59.680 --> 51:04.680]  They're trying to mitigate their potential liability
[51:04.680 --> 51:08.680]  So they're not going to raise a red flag
[51:08.680 --> 51:17.680]  And so probably, unless the judge, unless they've gotten together and talked about this no good SOB who's causing trouble
[51:17.680 --> 51:21.680]  He's not going to really know who I am until I land on him
[51:21.680 --> 51:27.680]  And then he's going to want to back up, regroup and find out what's going on here
[51:27.680 --> 51:32.680]  So I expect what he'll do is a very quick continuance
[51:32.680 --> 51:36.680]  To which I will object and demand my right to a speedy trial
[51:36.680 --> 51:41.680]  I'll tell the court I am ready for trial right now
[51:41.680 --> 51:45.680]  And since the Speedy Trial Act has been overturned
[51:45.680 --> 51:50.680]  The prosecution no longer has 90 days in which to get me to court
[51:50.680 --> 51:55.680]  Without having to show cause for delay, he doesn't have any time
[51:55.680 --> 52:01.680]  So, after the showing of cause for delay, I want to be tried right here, right now
[52:01.680 --> 52:04.680]  I'm ready
[52:04.680 --> 52:08.680]  And they're not going to be ready
[52:08.680 --> 52:11.680]  So he's going to refuse that
[52:11.680 --> 52:16.680]  But he will know that I know
[52:16.680 --> 52:25.680]  And for anybody out there, if you get a criminal charge, always make a demand for speedy trial
[52:25.680 --> 52:30.680]  There are a number of just ordinary motions that should be filed
[52:30.680 --> 52:33.680]  Demand for court reporter
[52:33.680 --> 52:37.680]  Invoke the rule of witnesses
[52:37.680 --> 52:45.680]  That means that no two witnesses, no one witness can hear the testimony of another witness
[52:45.680 --> 52:53.680]  And frankly, that's how I crucified these officers in the trial where the deputy tried to kill me
[52:53.680 --> 53:00.680]  Because the officer who committed the act against me
[53:00.680 --> 53:03.680]  I embarrassed him really bad on the stand
[53:03.680 --> 53:09.680]  He got off the stand and went in the district attorney's office with all the other officers
[53:09.680 --> 53:14.680]  And talked to the sheriff about his testimony
[53:14.680 --> 53:18.680]  And told the sheriff something I had said to him
[53:18.680 --> 53:25.680]  And the sheriff, when I called him to the stand, repeated what this officer told him
[53:25.680 --> 53:29.680]  Not understanding the importance of it
[53:29.680 --> 53:34.680]  And the jury knew exactly where he got this information
[53:34.680 --> 53:41.680]  They knew that he had talked to the other witness before he come on the stand
[53:41.680 --> 53:44.680]  And repeated something that was said in court
[53:44.680 --> 53:49.680]  So the rule of witnesses is a good one to file
[53:49.680 --> 53:58.680]  The reason I won the case was that the two officers couldn't hear each other's testimony on the stand
[53:58.680 --> 54:03.680]  I called one right after the other so they didn't get a chance to discuss it either
[54:03.680 --> 54:06.680]  And I asked them both the same questions
[54:06.680 --> 54:11.680]  One answered one way, the other answered the other way
[54:11.680 --> 54:14.680]  Really critical questions
[54:14.680 --> 54:19.680]  And it's what I told the jury, the details, watch the details
[54:19.680 --> 54:20.680]  So that's where we get them
[54:20.680 --> 54:23.680]  So rule of witnesses is a real good one to file
[54:23.680 --> 54:25.680]  And there is an inliminy motion
[54:25.680 --> 54:27.680]  Motion inliminy
[54:27.680 --> 54:32.680]  L-I-M-I-N-I-E, I think
[54:32.680 --> 54:35.680]  Something like that, it's an odd spelling
[54:35.680 --> 54:45.680]  An inliminy motion is a motion that lists all of the questions the other side is forbidden to ask
[54:45.680 --> 54:57.680]  One of the questions is to ask about any prior interactions or experience with the individual
[54:57.680 --> 55:05.680]  The county attorney asked the sheriff if he had ever had any prior experience with Mr. Kelton
[55:05.680 --> 55:07.680]  I objected
[55:07.680 --> 55:09.680]  The judge overruled
[55:09.680 --> 55:15.680]  That exact question was in my inliminy motion
[55:15.680 --> 55:20.680]  And the judge forbade the prosecutor to ask the question
[55:20.680 --> 55:23.680]  In a motion hearing 8 o'clock that morning
[55:23.680 --> 55:29.680]  But before the jury, he allowed him to ask it
[55:29.680 --> 55:32.680]  Bad move, Bubba
[55:32.680 --> 55:38.680]  Because he let the sheriff just run off at the mouth about what a scoundrel I was
[55:38.680 --> 55:44.680]  And that's when he made the statement that he had heard from the other officer
[55:44.680 --> 55:49.680]  And nailed their hides to the wall
[55:49.680 --> 55:54.680]  So inliminy motion, good motion to file, Brady motion
[55:54.680 --> 56:01.680]  In a criminal case, Brady is a discovery motion
[56:01.680 --> 56:03.680]  And it's a lot more extensive
[56:03.680 --> 56:09.680]  I have about a 15 page Brady motion
[56:09.680 --> 56:14.680]  The way I find good motions is I go through court records
[56:14.680 --> 56:18.680]  You go down and you try to find the thickest case you can
[56:18.680 --> 56:22.680]  Because that's the one where somebody had a lot of money
[56:22.680 --> 56:29.680]  And he could afford to hire an expensive attorney who's not afraid of the judge
[56:29.680 --> 56:33.680]  And put on a good defense
[56:33.680 --> 56:38.680]  And going through those kinds of files, I found some incredible motions
[56:38.680 --> 56:42.680]  I've got a 30 page inliminy motion
[56:42.680 --> 56:44.680]  In my inliminy motion, I was in court
[56:44.680 --> 56:48.680]  And the judge is going through all of these questions
[56:48.680 --> 56:53.680]  And I had one in there that forbid the prosecutor
[56:53.680 --> 56:58.680]  To ask any questions concerning any hypnotic interviews
[56:58.680 --> 57:01.680]  And the judge, he's pretty ticked off
[57:01.680 --> 57:04.680]  Because he knows most of these don't have anything to do with anything
[57:04.680 --> 57:07.680]  He said, Mr. Kelter, were you hypnotized?
[57:07.680 --> 57:09.680]  And I said, well, I don't know, judge
[57:09.680 --> 57:13.680]  You know how I make you, forget that kind of stuff, ask him
[57:13.680 --> 57:17.680]  And the judge, deny, deny, deny
[57:17.680 --> 57:21.680]  Oh, it drove him crazy, it was a hoot
[57:21.680 --> 57:23.680]  And there was a whole stack of questions of that nature
[57:23.680 --> 57:25.680]  Everything you could think of
[57:25.680 --> 57:30.680]  So I have that in my blanks on my jurisprudence site
[57:30.680 --> 57:33.680]  The Brady and the inliminy
[57:33.680 --> 57:39.680]  And a number of just standard motions you should always file
[57:39.680 --> 57:50.680]  One of the things you should always file is a, I want to say a jury challenge
[57:50.680 --> 57:53.680]  Anyway, there's a statement you make to the jury
[57:53.680 --> 57:55.680]  I'll think of the term in a minute
[57:55.680 --> 58:01.680]  I don't have that on my website because it changes jury instructions
[58:01.680 --> 58:05.680]  Jury instructions is an art form
[58:05.680 --> 58:07.680]  Frankly, it's one I'm not good at yet
[58:07.680 --> 58:09.680]  It takes some more study
[58:09.680 --> 58:13.680]  But anybody who's going to fight their own case needs to know about jury instructions
[58:13.680 --> 58:16.680]  And there are books on jury instructions
[58:16.680 --> 58:20.680]  And you can go on the internet and do a search for it
[58:20.680 --> 58:24.680]  There are standard jury instructions
[58:24.680 --> 58:29.680]  And it's good to know those, to have those filed in the case
[58:29.680 --> 58:34.680]  Because it tends to short circuit the crap hole of the prosecutor president
[58:34.680 --> 58:40.680]  So when I get in there Monday, I'm going to try to have all of those standard motions

[01:03:38.680 --> 01:03:42.680]  I know you said that there's an issue with subject matter jurisdiction
[01:03:42.680 --> 01:03:48.680]  But why wouldn't you fight it under something along the lines of insufficiency or failure of due process
[01:03:48.680 --> 01:03:53.680]  To actually have jurisdiction over you to place you before the court
[01:03:53.680 --> 01:04:00.680]  Well because failure of due process doesn't cost them impersonal jurisdiction
[01:04:00.680 --> 01:04:07.680]  Failure of due process causes them subject matter jurisdiction
[01:04:07.680 --> 01:04:14.680]  And subject matter jurisdiction is a lot better because it cannot be waived
[01:04:14.680 --> 01:04:19.680]  And subject matter jurisdiction must come first
[01:04:19.680 --> 01:04:27.680]  They first must demonstrate that they have jurisdiction over the subject matter
[01:04:27.680 --> 01:04:34.680]  And then they have to demonstrate that they have jurisdiction over the individual personally
[01:04:34.680 --> 01:04:39.680]  But you had said that you wanted to talk to Joe Edwards about being at arm's length from the court
[01:04:39.680 --> 01:04:44.680]  And if you were to make a special appearance and argue that they didn't have in personum
[01:04:44.680 --> 01:04:49.680]  Which would be the, you would have to argue that first or else you would waive it
[01:04:49.680 --> 01:04:55.680]  Yeah but I can't be in personum jurisdiction in this case
[01:04:55.680 --> 01:05:02.680]  Okay but I guess then my question is why not, what has occurred that gives them that
[01:05:02.680 --> 01:05:07.680]  I am within the territorial boundaries of the state of Texas
[01:05:07.680 --> 01:05:18.680]  In this case the allegation of the location of the offense is within the territorial boundaries of the county of Travis
[01:05:18.680 --> 01:05:31.680]  And I have an allegation that I was observed to violate a penal statute within the boundaries of the county
[01:05:31.680 --> 01:05:37.680]  That gives the county in personum jurisdiction over me
[01:05:37.680 --> 01:05:44.680]  Now these other guys have some more arcane ways of arguing in personum jurisdiction
[01:05:44.680 --> 01:05:50.680]  But I'm not familiar enough with them yet
[01:05:50.680 --> 01:06:01.680]  You know this stuff of me being a man on the land and not the corporate entity
[01:06:01.680 --> 01:06:08.680]  I've heard people make that argument but it always winds up an argument that goes to a legal conclusion
[01:06:08.680 --> 01:06:13.680]  They don't get there directly from law
[01:06:13.680 --> 01:06:17.680]  Or at least not enough that I would be able to argue it in a court
[01:06:17.680 --> 01:06:25.680]  So the last thing I want to do is get into an argument where I'm going to get my behind kicked
[01:06:25.680 --> 01:06:28.680]  Right
[01:06:28.680 --> 01:06:34.680]  And you know there may well be a good argument there and if some folks have got me some good arguments
[01:06:34.680 --> 01:06:38.680]  I would be more than happy to throw them in the judges face
[01:06:38.680 --> 01:06:43.680]  I want everything I can throw at them that I can find
[01:06:43.680 --> 01:06:48.680]  But first, before anything else can happen
[01:06:48.680 --> 01:06:52.680]  The court has to demonstrate subject matter jurisdiction
[01:06:52.680 --> 01:06:57.680]  And there are a lot of ways for them to lose subject matter jurisdiction
[01:06:57.680 --> 01:07:09.680]  And one of the primary ways I'm able to demonstrate here is that the documents before the court
[01:07:09.680 --> 01:07:15.680]  Are before the court as a result of fraud and violation of due process
[01:07:15.680 --> 01:07:22.680]  Therefore, they are insufficient to invoke the subject matter jurisdiction of the court
[01:07:22.680 --> 01:07:35.680]  And I will maintain that it is the court's duty to prove up its jurisdiction before it attempts to exercise jurisdiction
[01:07:35.680 --> 01:07:45.680]  And I'm tempted to go in and demand that the court stand down or prove up jurisdiction
[01:07:45.680 --> 01:07:52.680]  And when the judge fails then ask the bailiff to arrest the judge
[01:07:52.680 --> 01:07:59.680]  Because if I don't raise an issue to subject matter jurisdiction
[01:07:59.680 --> 01:08:03.680]  The court can act as if he has subject matter jurisdiction
[01:08:03.680 --> 01:08:10.680]  Even if he doesn't, if it's never raised it never becomes an issue
[01:08:10.680 --> 01:08:16.680]  But once I raise the issue of subject matter jurisdiction
[01:08:16.680 --> 01:08:25.680]  Then the court no longer has subject matter jurisdiction until it proves that it has subject matter jurisdiction
[01:08:25.680 --> 01:08:31.680]  So when he just claims he has it or just moves ahead
[01:08:31.680 --> 01:08:37.680]  Then I ask the bailiff to arrest him for impersonating a judicial officer
[01:08:37.680 --> 01:08:46.680]  Is there a complaint, a verified complaint and an information in the file?
[01:08:46.680 --> 01:08:52.680]  Good question, I looked at the file but at the time I was in a terrible hurry
[01:08:52.680 --> 01:08:56.680]  I don't think an information, oh yeah I think it will be
[01:08:56.680 --> 01:09:01.680]  In Travis County they have an information the next day
[01:09:01.680 --> 01:09:10.680]  Now I have the documents from the JP and the complaint is in there and the statement of probable cause
[01:09:10.680 --> 01:09:15.680]  I don't have a copy of the records that the court clerk has
[01:09:15.680 --> 01:09:22.680]  I will try to get those tomorrow, tomorrow is my last day I need to go down and get those
[01:09:22.680 --> 01:09:27.680]  You're talking about the JP, the magistrate for the
[01:09:27.680 --> 01:09:32.680]  Where you're supposed to go before the magistrate to see if there's probable cause?
[01:09:32.680 --> 01:09:38.680]  No, this is the magistrate that issued the warrant
[01:09:38.680 --> 01:09:47.680]  That magistrate is commanded to make the warrant open for public inspection immediately after it's executed
[01:09:47.680 --> 01:09:54.680]  I went down there and I got a little crapola from his clerk and as soon as she gave me about a half ounce
[01:09:54.680 --> 01:10:01.680]  I said wait right here I need to go get security and she really got excited
[01:10:01.680 --> 01:10:07.680]  And wound up going back and talking to the judge and she was in tears
[01:10:07.680 --> 01:10:14.680]  And you know I talked to the judge and he said well Mr. Goffman you've been here before and you've always conducted yourself with decorum
[01:10:14.680 --> 01:10:22.680]  Well I did this time, I just asked for the copy of the warrant and she said they didn't have it that I'd have to go to the clerk
[01:10:22.680 --> 01:10:31.680]  And I considered that a violation of 15.26 code of criminal procedure because the court required to have it
[01:10:31.680 --> 01:10:35.680]  And she said well I just couldn't find it yet
[01:10:35.680 --> 01:10:40.680]  I don't know that, all I know is you told me I had to go somewhere else
[01:10:40.680 --> 01:10:48.680]  So I went to get security just to document your refusal to show me the warrant
[01:10:48.680 --> 01:10:52.680]  And the judge was oh well gee whiz
[01:10:52.680 --> 01:11:00.680]  Once I did that they stopped being so smart mouth and got on their toes and went and found it
[01:11:00.680 --> 01:11:07.680]  But that was good, now they know I mean business
[01:11:07.680 --> 01:11:14.680]  And she had to admit to the judge that I never raised my voice, I never threatened anyone with anything
[01:11:14.680 --> 01:11:17.680]  I just went for security
[01:11:17.680 --> 01:11:23.680]  I tell you guys that works
[01:11:23.680 --> 01:11:27.680]  You do that to them they know you mean business
[01:11:27.680 --> 01:11:34.680]  Sometimes if I expect trouble I take security with me
[01:11:34.680 --> 01:11:38.680]  But when you were originally arrested and they took you down
[01:11:38.680 --> 01:11:45.680]  Aren't they supposed to take you before magistrate to determine if there's cause to hold you?

[01:12:33.680 --> 01:12:44.680]  Under Heath Boyd, an arrest without a warrant is considered on its face to be unreasonable

[01:12:46.680 --> 01:12:52.680]  So the onus is on the police to show cause for the arrest
[01:12:52.680 --> 01:12:58.680]  To take me to a neutral magistrate and show cause

[01:13:05.680 --> 01:13:10.680]  This time when they brought me in, even on a warrant they're required to do it

[01:13:14.680 --> 01:13:21.680]  So they bring me in and there's this guy in the jail with muscles and places where I don't have places
[01:13:21.680 --> 01:13:28.680]  And I told him you are to take me directly to the nearest magistrate
[01:13:28.680 --> 01:13:32.680]  And he kind of tensed up like he was going to have trouble
[01:13:32.680 --> 01:13:35.680]  No I have to book you in, I said I understand that
[01:13:35.680 --> 01:13:38.680]  But I have to ask this question
[01:13:38.680 --> 01:13:41.680]  I have to make this request
[01:13:41.680 --> 01:13:44.680]  He said well there's a magistrate in the building, you'll get to see one
[01:13:44.680 --> 01:13:46.680]  Well take me to see the magistrate right now
[01:13:46.680 --> 01:13:48.680]  I told you I have to do this
[01:13:48.680 --> 01:13:54.680]  I said I know but I also told you I have to make the request and you have to say no
[01:13:54.680 --> 01:13:56.680]  He said you want me to say no?
[01:13:56.680 --> 01:13:59.680]  No, no I can't say that
[01:13:59.680 --> 01:14:03.680]  I can only say I need you to take me to the magistrate
[01:14:03.680 --> 01:14:11.680]  And clearly by now he's got over being concerned with trouble and he's intrigued
[01:14:11.680 --> 01:14:15.680]  He said what's going on here?
[01:14:15.680 --> 01:14:19.680]  I said I'm just covering all the bases
[01:14:19.680 --> 01:14:22.680]  You're supposed to take me directly to the nearest magistrate
[01:14:22.680 --> 01:14:26.680]  But if I don't demand it then I can't complain about it later
[01:14:26.680 --> 01:14:29.680]  He said you're going to complain about me?
[01:14:29.680 --> 01:14:32.680]  Well yeah but only a little bit
[01:14:32.680 --> 01:14:36.680]  Oh well okay as long as it's only a little bit
[01:14:36.680 --> 01:14:38.680]  I do have to give them credit

[01:21:07.680 --> 01:21:13.680]  And two days later she gets an answer to the motion
[01:21:13.680 --> 01:21:17.680]  Saying, I'll have, we will have this discovery this day
[01:21:17.680 --> 01:21:21.680]  This discovery this day, this discovery this day
[01:21:21.680 --> 01:21:25.680]  I think she got their attention
[01:21:25.680 --> 01:21:29.680]  So that's 15 bar grievances and she's got more
[01:21:29.680 --> 01:21:32.680]  This law firm is history
[01:21:32.680 --> 01:21:35.680]  And that's what I'm going to do

[01:22:35.680 --> 01:22:37.680]  Is this a US citizen?

[01:22:41.680 --> 01:22:42.680]  Oh boy
[01:22:42.680 --> 01:22:47.680]  They come to storm in his house, you know, you're a standard storm trooper
[01:22:47.680 --> 01:22:52.680]  Terrify everybody, be sure you're terrified of me stuff
[01:22:52.680 --> 01:22:56.680]  And drug this kid off, he's been held a couple of months
[01:22:56.680 --> 01:22:57.680]  With no trial
[01:22:57.680 --> 01:23:02.680]  And unfortunately it's never been adjudicated because of the Padilla case
[01:23:02.680 --> 01:23:04.680]  Same thing, he was a citizen
[01:23:04.680 --> 01:23:08.680]  And what happened was, and he appealed it all the way to the Supreme Court
[01:23:08.680 --> 01:23:12.680]  And then the feds dropped the case
[01:23:12.680 --> 01:23:15.680]  So that the Supreme Court could never make a ruling on it
[01:23:15.680 --> 01:23:17.680]  So there's no precedent
[01:23:17.680 --> 01:23:19.680]  Now they're doing it again
[01:23:19.680 --> 01:23:25.680]  This time they may have a way of sabotaging themselves

[01:23:27.680 --> 01:23:33.680]  This time a 16 year old, all American kid
[01:23:33.680 --> 01:23:37.680]  No issues of any kind
[01:23:37.680 --> 01:23:39.680]  In the heartland
[01:23:39.680 --> 01:23:43.680]  And these guys come in with guns in hand, storm in and drag him off
[01:23:43.680 --> 01:23:47.680]  They may have crapped in their milk this time
[01:23:47.680 --> 01:23:52.680]  This is one that everybody in America will look at and say

[01:34:20.680 --> 01:34:31.680]  So it says in the name of the state of Texas, I, Randall D. Kelton, have reason to believe and do believe
[01:34:31.680 --> 01:34:36.680]  This is language that's pretty well stipulated
[01:34:36.680 --> 01:34:42.680]  The complaint, it'll have a heading and it'll have an ending and then there'll be a middle section where you put the details
[01:34:42.680 --> 01:34:49.680]  So you say, you know, I'm whoever I am and I have reason to believe and do believe based on the following
[01:34:49.680 --> 01:34:53.680]  And then you state the facts
[01:34:53.680 --> 01:34:58.680]  When you state the facts, state only the facts with no argument
[01:34:58.680 --> 01:35:06.680]  With no terms implying your distaste or your irritation or anything like that
[01:35:06.680 --> 01:35:08.680]  Just the facts, ma'am
[01:35:08.680 --> 01:35:10.680]  State the facts clearly and succinctly
[01:35:10.680 --> 01:35:13.680]  This is precisely what happened
[01:35:13.680 --> 01:35:18.680]  And then after you've stated the facts, then you state
[01:35:18.680 --> 01:35:24.680]  Therefore, I allege that this person committed this criminal act
[01:35:24.680 --> 01:35:29.680]  I generally go after public officials so I accuse them of violating a law relating to their office
[01:35:29.680 --> 01:35:36.680]  I maintain, you know, I tell the facts and I maintain that this act is a violation of
[01:35:36.680 --> 01:35:45.680]  1.24 Code of Criminal Procedure, which is a law relating to the official's office
[01:35:45.680 --> 01:35:50.680]  And when an official violates a law relating to his office, he commits a criminal act
[01:35:50.680 --> 01:35:54.680]  Then I'll say, and therefore honor before this certain date
[01:35:54.680 --> 01:35:58.680]  And generally honor before is important
[01:35:58.680 --> 01:36:06.680]  Because the one thing on criminal complaints that was deadly, that couldn't be fixed
[01:36:06.680 --> 01:36:13.680]  Was if you accuse somebody of committing a crime before they committed it
[01:36:13.680 --> 01:36:21.680]  If you screw up on the date so that you accuse them today of committing a crime tomorrow
[01:36:21.680 --> 01:36:25.680]  Can't be fixed, has to be thrown out and started over again
[01:36:25.680 --> 01:36:31.680]  Almost anything else in a criminal complaint can be fixed if they don't like it
[01:36:31.680 --> 01:36:34.680]  But be careful you get the date right
[01:36:34.680 --> 01:36:40.680]  Honor before the date and generally that'll be the date that you're filing the complaint
[01:36:40.680 --> 01:36:46.680]  This individual, name the individual, committed the violation of this statute
[01:36:46.680 --> 01:36:49.680]  And I always put a statute
[01:36:49.680 --> 01:36:56.680]  And don't say he was speeding or he committed assault or robbery
[01:36:56.680 --> 01:36:59.680]  Put the statute that you're citing
[01:36:59.680 --> 01:37:02.680]  That way there's no question about the sufficiency of the complaint
[01:37:02.680 --> 01:37:05.680]  And then once you got that written up
[01:37:05.680 --> 01:37:09.680]  Take it to a notary and have it notarized
[01:37:09.680 --> 01:37:12.680]  In law this is called verification
[01:37:12.680 --> 01:37:19.680]  Once it's notarized that becomes a verified criminal affidavit
[01:37:19.680 --> 01:37:24.680]  That's different than going to the police and complaining to them
[01:37:24.680 --> 01:37:27.680]  That invokes no duty on the police
[01:37:27.680 --> 01:37:34.680]  It only gives them notice that a crime might have been committed and they can go and investigate
[01:37:34.680 --> 01:37:39.680]  When you as a citizen, as a sovereign citizen
[01:37:39.680 --> 01:37:46.680]  Place in the hand of a police officer a verified criminal affidavit
[01:37:46.680 --> 01:37:51.680]  Now he has made known officially that a crime has been committed
[01:37:51.680 --> 01:37:54.680]  It bypasses his discretion
[01:37:54.680 --> 01:38:01.680]  Now with that said I normally don't give criminal complaints to police officers
[01:38:01.680 --> 01:38:05.680]  I tend to give them to magistrates
[01:38:05.680 --> 01:38:10.680]  Generally the lowest level judges will be the ones who take criminal complaints
[01:38:10.680 --> 01:38:12.680]  And they're going to object
[01:38:12.680 --> 01:38:18.680]  Because they tend to only get criminal complaints from police officers
[01:38:18.680 --> 01:38:23.680]  And this is new to them although this is very well established in laws

[01:38:37.680 --> 01:38:45.680]  In the commonwealth you have to be personally injured by the crime in order to file the complaint

[01:38:49.680 --> 01:38:53.680]  Any person who has knowledge that a crime has been committed not only has the right
[01:38:53.680 --> 01:38:57.680]  But the duty to file a criminal complaint
[01:38:57.680 --> 01:39:02.680]  Not go down complaining to the police but to file a verified criminal affidavit
[01:39:02.680 --> 01:39:07.680]  So you file it with the magistrate or you can file it with a prosecuting attorney
[01:39:07.680 --> 01:39:13.680]  Or you can send it directly to the grand jury
[01:39:13.680 --> 01:39:19.680]  It will depend on your state and we're kind of running out of time

[01:55:12.680 --> 01:55:15.680]  How long did they...okay, okay
[01:55:15.680 --> 01:55:18.680]  Did they bang on the door and tell him who they were?

[01:55:20.680 --> 01:55:22.680]  You hear the problem a lot of times we get
[01:55:22.680 --> 01:55:25.680]  And this is what I was addressing with the 16-year-old
[01:55:25.680 --> 01:55:31.680]  When people tell us the awful things that the officials have done to them
[01:55:31.680 --> 01:55:35.680]  They almost never tell us the whole story
[01:55:35.680 --> 01:55:36.680]  Right
[01:55:36.680 --> 01:55:39.680]  Especially when they're implicated
[01:55:39.680 --> 01:55:46.680]  If the police told them that he had to leave the house, that they had her in possession
[01:55:46.680 --> 01:55:50.680]  And he refused to leave, if they banged on the door he refused to open it
[01:55:50.680 --> 01:55:52.680]  Now they have cause to arrest him
[01:55:52.680 --> 01:55:56.680]  And if they notified him and he still didn't open the door
[01:55:56.680 --> 01:56:01.680]  Then they kicked down the door and arrest him for resisting arrest
[01:56:01.680 --> 01:56:04.680]  Not for anything he did after they broke the door down
[01:56:04.680 --> 01:56:09.680]  But for what he did before they broke the door down
[01:56:09.680 --> 01:56:11.680]  But I'm not sure they had a break order either
[01:56:11.680 --> 01:56:14.680]  I think you're required to have a break order here
[01:56:14.680 --> 01:56:22.680]  Well, if they have a possession order then it's not his house anymore
[01:56:22.680 --> 01:56:27.680]  So he can't claim that they broke into his house
[01:56:27.680 --> 01:56:31.680]  You cannot break into a person's house at least in Texas
[01:56:31.680 --> 01:56:35.680]  To arrest someone for a misdemeanor
[01:56:35.680 --> 01:56:40.680]  And you can't break into a third party's house
[01:56:40.680 --> 01:56:44.680]  To arrest someone even for a felony
[01:56:44.680 --> 01:56:48.680]  Unless you have a warrant authorizing you to search and seize
[01:56:48.680 --> 01:56:52.680]  You can have a warrant to arrest for a felony
[01:56:52.680 --> 01:56:56.680]  And break the person's own front door to arrest him
[01:56:56.680 --> 01:56:58.680]  But if he's at his next door neighbor's
[01:56:58.680 --> 01:57:01.680]  You can't break the next door neighbor's door
[01:57:01.680 --> 01:57:06.680]  You have to go get a writ to search and seize that house
[01:57:06.680 --> 01:57:09.680]  On a misdemeanor you can't break the door in any case
[01:57:09.680 --> 01:57:11.680]  Right, right
[01:57:11.680 --> 01:57:14.680]  So they want to present the writ
[01:57:14.680 --> 01:57:18.680]  The problem here is they got a writ of possession
[01:57:18.680 --> 01:57:21.680]  So it's not his house anymore
[01:57:21.680 --> 01:57:24.680]  So he can't raise that issue
[01:57:24.680 --> 01:57:29.680]  And their whole purpose there was to remove him from the house
[01:57:29.680 --> 01:57:34.680]  So, you know, the police aren't always to bad guys
[01:57:34.680 --> 01:57:38.680]  And if they're sent here to remove him from the house
[01:57:38.680 --> 01:57:40.680]  They're authorized to do that
[01:57:40.680 --> 01:57:44.680]  Was it being given the chance to leave peacefully
[01:57:44.680 --> 01:57:48.680]  That he was just at gunpoint just thrown out
[01:57:48.680 --> 01:57:51.680]  Well, once he didn't leave peacefully
[01:57:51.680 --> 01:57:54.680]  And they had to break the door
[01:57:54.680 --> 01:58:00.680]  They don't know what they're going to find on the other side of that door

[01:58:02.680 --> 01:58:06.680]  I don't like police barging in with guns in hands
[01:58:06.680 --> 01:58:08.680]  And sticking them in your faces
[01:58:08.680 --> 01:58:14.680]  Having been in combat myself
[01:58:14.680 --> 01:58:19.680]  If the guy forces me to break his door
[01:58:19.680 --> 01:58:22.680]  I got to be careful
[01:58:22.680 --> 01:58:25.680]  If he's willing to force me to break the door
[01:58:25.680 --> 01:58:27.680]  What else is he willing to do?
[01:58:27.680 --> 01:58:32.680]  And in these kinds of situations you don't get two mistakes
