[07:05.560 --> 07:14.260] We got two Luzerne, L-U-Z-E-R-N-E county judges indicted, Luzerne County's president judge
[07:14.260 --> 07:20.920] and the former president judge will soon have to turn themselves after agreeing to plead
[07:20.920 --> 07:25.260] guilty to corruption charges.
[07:25.260 --> 07:31.120] Federal investigators said they stole millions of dollars all in a web of deceit and fraud.
[07:31.120 --> 07:35.200] This has been speculation for months that charges will be filed against Judges Mark
[07:35.200 --> 07:41.720] Siavarella and Michael Conahan, I hope I'm pronouncing it right.
[07:41.720 --> 07:47.040] Anyway, Monday the U.S. Attorney, FBI, and IRS announced those charges in a plea agreement.
[07:47.040 --> 07:50.600] It's the first big development of a two-year investigation into corruption at the Luzerne
[07:50.600 --> 07:52.920] County Courthouse.
[07:52.920 --> 07:59.280] Investigators laid out a scheme of fraud and deceit that they said made the judges 2.6 million.
[07:59.280 --> 08:05.760] Quote, today this office has filed a two-count information charging President Judge Mark
[08:05.760 --> 08:12.360] Siavarella and former President Michael Conahan, said U.S. Attorney Martin Carlson.
[08:12.360 --> 08:16.600] An announcement for the U.S. Attorney that puts two Luzerne County judges on the wrong
[08:16.600 --> 08:17.600] side of the law.

[08:56.960 --> 09:00.920] Federal investigators said the corruption revolved around the county's juvenile detention

[09:04.920 --> 09:09.360] Federal investigators said the two judges worked with those who ran the Pennsylvania
[09:09.360 --> 09:15.560] child care facility to get it open, keep it inoperational, and keep juvenile defenders
[09:15.560 --> 09:20.720] filling the beds there in exchange for 2.6 million in kickbacks.
[09:20.720 --> 09:25.320] Court documents show the judges even sent young people to the detention center who should
[09:25.320 --> 09:27.160] not have been in custody.
[09:27.160 --> 09:32.880] Quote, they sold their oath of offices to the highest bidders and engaged in an ongoing
[09:32.880 --> 09:37.640] scheme to defraud the public out of honest services that were expected of them, said
[09:37.640 --> 09:40.320] FBI Special Agent Daron Roberts.
[09:40.320 --> 09:46.240] The federal charges claim Conahan and Siavarella funneled the kickbacks into various accounts
[09:46.240 --> 09:53.000] through their other businesses, even in the name of a shared condominium in Florida.
[09:53.000 --> 09:57.720] Now this pair will be off the bench at this bar, and they have agreed to end, and they
[09:57.720 --> 10:01.320] have agreed to each spend seven years in prison.
[10:01.320 --> 10:07.080] The behavior filed in the charges today represents flagrant abuse of public trust of all citizens
[10:07.080 --> 10:13.600] in Luzerne County and honest taxpayers everywhere, said the IRS Special Agent Leslie DiMarco.
[10:13.600 --> 10:16.560] The new juvenile facility was controversial from the start.
[10:16.560 --> 10:21.640] A recent state study ruled it way overpriced.
[10:21.640 --> 10:26.160] Today we learned the judges even sent young people to the detention facility near Pittston

[10:28.320 --> 10:33.560] As for the judges themselves, they are free, but will have to turn themselves in for federal

[10:35.240 --> 10:39.960] A judicial misconduct board removed Judge Ann Locuta last month.

[27:33.240 --> 27:38.880] the Alex Jones Show that week, Mosley stated at the beginning of the interview that he
[27:38.880 --> 27:43.120] is an attorney and his brother-in-law owns a publishing company associated with a swift
[27:43.120 --> 27:47.120] boat book that attacked the war record of John Kerry, Democratic candidate for president
[27:47.120 --> 27:55.080] in 2004, here we go, an internet search revealed Mosley is also the executive director of the
[27:55.080 --> 28:00.520] USC Port Commission, a public policy organization that warns against foreign control and ownership
[28:00.520 --> 28:06.160] of the U.S. ports, this organization is also part of another policy forming group, the
[28:06.160 --> 28:11.360] U.S. Intelligence Council, which disseminates publications regarding threats of China and
[28:11.360 --> 28:17.120] concern of our ports, okay, let me pause here for a second, basically this is fear mongering
[28:17.120 --> 28:24.800] propaganda, okay, let me continue, more searching led to what looks like a press release disguised

[33:45.880 --> 33:55.560] are elsewhere, so I determined that Mr. Mosley is in the business of disseminating deaf media,

[34:02.520 --> 34:09.920] Senator Connie Mack, who is a US Senator of Florida, under whom Mosley interned, this
[34:09.920 --> 34:15.360] email Mosley asked for certain limited government regulations to protect consumers and businesses,
[34:15.360 --> 34:22.120] it all seems very innocent at first, he specifically encourages an increase in COD postal service
[34:22.120 --> 34:26.040] transactions, he claims these transactions do a lot to protect the buyer as well as the
[34:26.040 --> 34:30.680] seller, because neither pays ahead of time, so risk is reduced on both sides, doesn't
[34:30.680 --> 34:35.440] sound too bad until he gets to the part where he says that, quote, however, there's still
[34:35.440 --> 34:42.040] a hole, a dishonest con artist can send a box, in all caps, that contains junk rather

[34:47.760 --> 34:55.240] box, all caps, and verify all caps, that it contains the product ordered before all caps,

[35:49.520 --> 35:56.000] trading in very valuable small items like gems, but which policy would be at the expense
[35:56.000 --> 36:01.120] of Americans and possibly becoming even more subject to government surveillance in the
[36:01.120 --> 36:06.080] postal system and lead to an increase in power of centralized federal government in general.

[36:44.880 --> 36:51.800] paperwork setups to protect international gym traders from being accused of terrorism

[41:47.280 --> 41:54.000] City did a televised news piece in June 26, 2006, Bill Gephardt hailed up a huge handful
[41:54.000 --> 42:00.960] of what he called, quote, scare political mail, preying on some nationalistic theme sent
[42:00.960 --> 42:07.560] to, all sent to one 86-year-old woman in Utah saying that she was not alone in receiving
[42:07.560 --> 42:12.480] this barrage of mail and donation requests from these organizations headed up by Mr.
[42:12.480 --> 42:19.880] Jonathan Mosley, concerned about the threat of China taking over our ports, Bill Gephardt
[42:19.880 --> 42:25.040] reports that the mail was traced back to charity called the U.S. Public Policy Council out
[42:25.040 --> 42:31.920] of Frederick, Maryland, of which the USC Port Commission is a project, Gephardt also reports
[42:31.920 --> 42:38.520] only 33% of contributions actually go to any program involved with the USC Port Commission,
[42:38.520 --> 42:42.480] so where the hell else is it all going, Mr. Mosley, huh, huh?

[47:38.520 --> 47:45.520] But in the last year and a half, two years, it's become clear that they are not the problem,
[47:45.520 --> 47:51.120] not even close to the problem, that they're just chumps.
[47:51.120 --> 47:56.040] For the most part, prosecuting attorneys are attorneys that had a little too much fun in
[47:56.040 --> 47:59.200] law school, and they get out of law school.
[47:59.200 --> 48:09.800] It takes them two or three times to pass their bar, and no reputable law firm will hire them.
[48:09.800 --> 48:14.840] The law firms pick up the top of the cream of the crop, and the rest of them, they wait
[48:14.840 --> 48:21.600] until they get in the field and have some experience and prove themselves.
[48:21.600 --> 48:30.440] Well, it's hard to start out as an attorney because you can't go directly to your client.
[48:30.440 --> 48:36.760] In the movies where they show attorneys following ambulances and go around the hospital giving
[48:36.760 --> 48:42.960] people their cards, well, that's a felony in Texas.
[48:42.960 --> 48:51.080] Clients under the baritory statute cannot directly solicit their service, and it specifically
[48:51.080 --> 49:03.440] singles out doctors, chiropractors, attorneys, and private investigators.
[49:03.440 --> 49:07.520] Your clients have to come to you.
[49:07.520 --> 49:12.760] They finally let attorneys start doing billboard type advertising, and they let them do some
[49:12.760 --> 49:18.600] limited solicitation for people who've been arrested, but for the most part, your clients

[49:23.800 --> 49:28.880] If you're not the sharpest knife in the drawer to start with, the best place to go to work

[50:51.680 --> 50:56.600] They don't have to pay attention to any of the statutory law, and I'm saying, wait a

[50:57.600 --> 51:05.880] I haven't seen one of these guys who were smart enough to have a clue about that.

[51:41.560 --> 51:50.280] have no idea of all of this supposed stuff that's going on, so just they're making deals.
[51:50.280 --> 51:54.200] They know that the law is supposed to matter, but they never read it.

[52:30.600 --> 52:33.720] are essentially in the same place.

[52:37.280 --> 52:43.600] When you go through the system, the judge is where the system ends.
[52:43.600 --> 52:48.920] He's the focal point of everything that goes on below him.
[52:48.920 --> 52:54.360] Judges are the ones we have to go after, and I'm working up some really interesting strategies

[52:56.880 --> 53:06.160] One of the ones I'm working on now goes to the difference between a judicial decision
[53:06.160 --> 53:10.640] and an administrative decision.
[53:10.640 --> 53:20.360] There are certain things a judge must do in cases where something occurs and the judge
[53:20.360 --> 53:25.080] is mandated by law to do a certain thing.
[53:25.080 --> 53:28.400] In that case, he has no discretion.
[53:28.400 --> 53:35.400] The decision he makes is mandated by law, therefore it's administrative or it's ministerial
[53:35.400 --> 53:38.480] and not judicial.
[53:38.480 --> 53:46.400] Judicial is where the judge exercises judicial discretion, where he weighs the facts on each
[53:46.400 --> 53:54.160] side, applies the law to the facts, and renders a judicial decision based on the facts and
[53:54.160 --> 53:56.120] the law.
[53:56.120 --> 54:02.840] In those cases where he makes decisions that aren't done that way, for instance, say your
[54:02.840 --> 54:11.360] attorney doesn't adjudicate all the issues in your case, and you file a bar grievance
[54:11.360 --> 54:18.080] on every single issue he should have adjudicated, and your attorney doesn't talk to you.
[54:18.080 --> 54:23.680] He doesn't respond to your calls, so you file a bar grievance for that.
[54:23.680 --> 54:28.480] The attorney doesn't promptly or timely address an issue.
[54:28.480 --> 54:33.240] You file a bar grievance for that, or if your attorney fails to advise you of something
[54:33.240 --> 54:36.840] he had a duty to advise you of, you file a bar grievance for that, and you get a good
[54:36.840 --> 54:43.600] stack of bar grievances against him, and he gets apoplexy because it's going to ruin his
[54:43.600 --> 54:44.600] career.
[54:44.600 --> 54:50.520] So the first thing he's going to do is run to the judge and ask the judge to remove him
[54:50.520 --> 54:55.520] from the case, because this guy's beating me up, and you're going to run to the judge
[54:55.520 --> 55:01.120] and say, whoa, Bubba, I have a private contract with this attorney.
[55:01.120 --> 55:06.360] You butt out, and the judge is going to tell you, well, I have authority to remove him
[55:06.360 --> 55:11.920] from this case if I want to, and say, yes, you do, and he's going to remove him from
[55:11.920 --> 55:14.280] the case.
[55:14.280 --> 55:19.600] That's when he finds out what we were really after, because what we're really trying to
[55:19.600 --> 55:25.160] do is set the judge up to make a decision for us.
[55:25.160 --> 55:32.160] Now, this particular decision does not go to the adjudication of the case.
[55:32.160 --> 55:35.280] It doesn't involve law.
[55:35.280 --> 55:38.360] It doesn't involve the facts of the case.
[55:38.360 --> 55:43.520] It involves the administration of the court's affairs.
[55:43.520 --> 55:48.280] It's an administrative decision, and why do we want a judge to make an administrative
[55:48.280 --> 55:49.280] decision?
[55:49.280 --> 55:51.840] It goes to immunity.
[55:51.840 --> 55:58.520] A judge is absolutely immune from decisions he makes on the bench.
[55:58.520 --> 56:02.400] Well, not exactly.
[56:02.400 --> 56:07.240] He's immune from judicial decisions he makes on the bench.
[56:07.240 --> 56:15.800] When it comes to ministerial or administrative decisions, he has zero immunity from civil

[56:17.080 --> 56:26.080] So, when he removes this attorney from the case, that's a ministerial act, an act for
[56:26.080 --> 56:34.080] which he has no immunity, and an act that has the effect of interfering with a private

[56:43.240 --> 56:45.880] a civil tort.

[56:48.240 --> 56:52.560] He is immediately disqualified.

[56:55.480 --> 57:02.400] Now you get to go to the next judge and say, yo, Bubba, I have a right to counsel of my

[01:21:14.360 --> 01:21:21.360] As the guy mentioned to you before on a call a couple months ago about that guy who got a DWI on a motorcycle in Houston
[01:21:21.360 --> 01:21:25.360] And anyway so we went down to take a look at his case and pull the file
[01:21:25.360 --> 01:21:32.360] And when we opened it up and started looking around in it uh we found a document filed in there from a different case number
[01:21:32.360 --> 01:21:39.360] So we we pulled that aside and set that off and gave it to them and they weren't really surprised to see that so that was kind of interesting
[01:21:39.360 --> 01:21:45.360] Um also so we found the um the complaint uh and the information in his case
[01:21:45.360 --> 01:21:51.360] And they were signed uh and entered or recorded and dated in the file you know
[01:21:51.360 --> 01:21:58.360] Wait wait wait wait wait wait was the complaint handwritten?
[01:21:58.360 --> 01:22:03.360] Um it was a typed up document and it was signed by someone
[01:22:03.360 --> 01:22:08.360] What was the date that it was filed in the court?

[01:23:03.360 --> 01:23:12.360] Resting officer went home but he left a statement of probable cause was that in the record?

[01:23:23.360 --> 01:23:25.360] I didn't see a warrant either

[01:25:20.360 --> 01:25:36.360] Okay what I was really looking for in this one though was to find out what jumped off the page to me was that the person who signed the affidavit who signed the complaint was not one of the officers that was listed as a witness is that a fatal issue or not?
[01:25:36.360 --> 01:25:59.360] No they can do that uh the anyone can file a complaint uh as long as they have knowledge it can be hearsay knowledge the requisite for filing a complaint is that you have reason to believe and do believe that this person committed a crime
[01:25:59.360 --> 01:26:13.360] Now the jailer read a statement of probable cause by the officer and believed it because he knew the officer and trusted the officer and therefore he can file the complaint and give it to the magistrate
[01:26:13.360 --> 01:26:14.360] Okay
[01:26:14.360 --> 01:26:40.360] But the magistrate is supposed to seal all the documents he had just a statement by the jailer is not sufficient without facts and support and the jailer would have had to give the magistrate the statement of probable cause by the officer but didn't matter because they never hold an examining trial
[01:26:40.360 --> 01:26:45.360] They don't the judge never examines into the sufficiency of the allegation
[01:26:45.360 --> 01:26:46.360] He reads
[01:26:46.360 --> 01:26:52.360] He was brought before magistrate he was arrested on a Saturday and Monday morning he was brought before magistrate through video
[01:26:52.360 --> 01:26:53.360] Yeah
[01:26:53.360 --> 01:26:54.360] You know
[01:26:54.360 --> 01:27:22.360] So that that's grounds for that that goes to my rid of my rid of habeas corpus all this is in there there are specific case law that it was a Mississippi case during the race riots during the mid 60s where a bunch of protesters were arrested and held over the weekend because the court the police claimed that a magistrate wasn't available and the court said screw that
[01:27:22.360 --> 01:27:31.360] You have to go find one, and they didn't show that they made a due diligence in effort to locate. Now in Houston.
[01:27:31.360 --> 01:27:36.360] The police can hardly claim that they couldn't find a magistrate.
[01:27:36.360 --> 01:27:48.360] Right, they got a lot of them, every, every judge is a magistrate and they would have to show due diligence after locate. But in fact they held him over the weekend as a matter of policy.
[01:27:48.360 --> 01:27:59.360] And that goes to policy and the monel sense, a city or a county is civilly liable.
[01:27:59.360 --> 01:28:08.360] If the, the tort or the causes of action were the result of established policy.
[01:28:08.360 --> 01:28:11.360] This is clearly policy.
[01:28:11.360 --> 01:28:15.360] And recently I figured out another way to get to them.
[01:28:15.360 --> 01:28:26.360] I was reading a court case where someone was arrested handcuffed put in the back of the car, and on the way to jail.
[01:28:26.360 --> 01:28:33.360] The officer got into a high speed chase and slug this woman all over the back of the car.
[01:28:33.360 --> 01:28:46.360] Well, she sued it for intentional tort. He intended to participate in this chase knowing that it would cause injury to the person in the back.
[01:28:46.360 --> 01:29:01.360] Yeah, and that's odd because usually when a officer makes an arrest or even if they're in the process of writing a ticket or something, they usually don't at the same time start to engage in crime fighting, you know, another event.
[01:29:01.360 --> 01:29:04.360] Getting a high speed chase with a prisoner in the car.
[01:29:04.360 --> 01:29:07.360] Especially that, that's kind of, that's kind of outrageous.
[01:29:07.360 --> 01:29:21.360] But what the court said was you can't, if the, if the officer is acting within the scope of his capacity, then you cannot sue the officer.
[01:29:21.360 --> 01:29:29.360] And if the officers acting within the scope of his capacity, you can't sue the city.
[01:29:29.360 --> 01:29:42.360] And I looked at it and I had just read in the civil torts and remedies that if a city employee harms you with a motor driven piece of equipment, the city waves its sovereign immunity.

[01:34:36.360 --> 01:35:01.360] And I had just read in Civil Torch and Remedies where the city or the county in matters of tort arising out of the operation of a motor-driven equipment belonging to the city or county, the city or county waives its sovereign immunity.
[01:35:01.360 --> 01:35:12.360] And that's the only time it does. Well, that was a motor-driven piece of equipment, and it facilitated the commission of the tort.
[01:35:12.360 --> 01:35:19.360] He couldn't have done it without using the motor-driven piece of equipment.
[01:35:19.360 --> 01:35:32.360] And that goes to like me in Williamson County. They arrested me when I called the police. I called 911 to get arrested. District Attorney arrested me instead.
[01:35:32.360 --> 01:35:47.360] Take me outside, put me in a motor-driven piece of equipment belonging to the city to facilitate the commission of aggravated kidnapping.
[01:35:47.360 --> 01:35:59.360] And I will maintain that in that case, the city waived its sovereign immunity because the motor-driven piece of equipment was used to facilitate the commission of the crime.
[01:35:59.360 --> 01:36:13.360] Gotcha, Bubba. So anytime you're arrested and put in a patrol car, you should be able to sue the city if they in the process of doing that, they violated any law.
[01:36:13.360 --> 01:36:22.360] Does that sound like fun, Tim? Yeah. Just to make sure I'm clear on this, because I just want to make sure we're getting the right piece of paper,
[01:36:22.360 --> 01:36:27.360] because I thought I had it with that complaint that was signed by somebody else, but evidently not.
[01:36:27.360 --> 01:36:32.360] But what you're saying is the order of probable cause is the thing I need to go after next. Yes, let me read this.
[01:36:32.360 --> 01:36:42.360] Article 16.17, decision of judge. After the examining trial has been had, the judge shall make an order committing the defendant to the jail of the proper county.
[01:36:42.360 --> 01:36:48.360] Discharging him or admitting him to bail as the law and facts of the case may require.
[01:36:48.360 --> 01:37:04.360] Failure of the judge to make or enter an order within 48 hours after the examining trial has been completed operates as a finding of no probable cause, and the accused shall be discharged.
[01:37:04.360 --> 01:37:17.360] Now, what the magistrate is going to say is, oh, oh, oh, we did not do an examining trial, we did a magistration.
[01:37:17.360 --> 01:37:39.360] This is how they get there. 14.06 says that the officer making the arrest must take the person arrested, 14.06, except as otherwise provided by this article in each case enumerated in this code.
[01:37:39.360 --> 01:37:50.360] The person making the arrest or the person having custody of the person arrested shall take the person arrested or have him taken without unnecessary delay.
[01:37:50.360 --> 01:38:05.360] Delay, but not later than 48 hours after the person is arrested, before the magistrate who may have ordered the arrest, before some magistrate of the county where the arrest was made without an order,
[01:38:05.360 --> 01:38:22.360] or, and here's where they do a song and dance, to provide more expeditiously to the person arrested the warnings described in Article 1517 of this code before a magistrate in any other county of this state.

[01:41:23.360 --> 01:41:30.360] and to cause the arrest of offenders by the use of lawful means in order that they may be brought to punishment.

[01:41:32.360 --> 01:41:44.360] 2.11, Examining Court, when the magistrate sits for the purpose of inquiring into a criminal accusation against any person.
[01:41:44.360 --> 01:41:48.360] This is called an examining court.
[01:41:48.360 --> 01:42:02.360] You go back to Chapter 16, the title of Chapter 16, the commitment or discharge of the accused 16.01, Examining Trial,
[01:42:02.360 --> 01:42:13.360] when the accused has been brought before a magistrate for an examining trial that officer shall proceed to examine into the truth of the accusation made.
[01:42:13.360 --> 01:42:19.360] The judge cannot say that he did not hold an examining trial.
[01:42:19.360 --> 01:42:26.360] He could not set bail until after he held an examining trial.
[01:42:26.360 --> 01:42:33.360] So when your guy was brought before the magistrate, the magistrate advised him of bail that was already set,
[01:42:33.360 --> 01:42:43.360] which is authorized to do under 1517. Go back to 1517, which is referred to by 1406.
[01:42:43.360 --> 01:42:53.360] I know this may sound a little confusing, but in 1517, I'm looking at it, it's a page and a half, one paragraph.
[01:42:53.360 --> 01:43:08.360] It was designed to be misinterpreted, but if you break, if you outline it into sentences, the ninth sentence in the huge paragraphs,
[01:43:08.360 --> 01:43:23.360] the subordinate clause to the ninth sentence says that the magistrate may release the accused on bail if the law allows.
[01:43:23.360 --> 01:43:35.360] Now, they can if the law allows. Well, the law does allow after an examining trial, and they're using this say we don't have to examine trial.

[01:47:56.360 --> 01:48:00.360] It was intended that he have the authority to arrest, but not to imprison.

[01:48:09.360 --> 01:48:12.360] He's gonna cut his head off if he didn't sign.

[01:48:14.360 --> 01:48:18.360] It's very well adjudicated, and it has worked extremely well
[01:48:18.360 --> 01:48:21.360] until about the last 30 years when they stopped using it,

[01:48:24.360 --> 01:48:29.360] and now look at the relationship between the police and the public.

[01:48:31.360 --> 01:48:40.360] It's a, we're in, essentially, we're under siege.
[01:48:40.360 --> 01:48:41.360] Nobody trusts the police.
[01:48:41.360 --> 01:48:43.360] The police don't trust us.
[01:48:43.360 --> 01:48:46.360] Everybody's at each other's throat.
[01:48:46.360 --> 01:48:48.360] So it had a very good purpose.
[01:48:48.360 --> 01:48:51.360] It's well adjudicated, and that's why the law,
[01:48:51.360 --> 01:48:57.360] if you look at it in paramateria as a whole,
[01:48:57.360 --> 01:49:01.360] it all fits together extremely well.
[01:49:01.360 --> 01:49:04.360] And if you talk to any of these magistrates about this,
[01:49:04.360 --> 01:49:06.360] he's gonna say, well, we don't,
[01:49:06.360 --> 01:49:10.360] you don't have the right to an examining trial in a misdemeanor.
[01:49:10.360 --> 01:49:13.360] Not true.
[01:49:13.360 --> 01:49:18.360] You don't necessarily have a right to an examining trial
[01:49:18.360 --> 01:49:23.360] unless your liberty has been interfered with.
[01:49:23.360 --> 01:49:30.360] If they have abridged your liberty, an examining trial always attaches.
[01:49:30.360 --> 01:49:35.360] They don't teach that in JP school.
[01:49:35.360 --> 01:49:37.360] They call this thing a magistration.
[01:49:37.360 --> 01:49:39.360] Well, the magistration doesn't exist.
[01:49:39.360 --> 01:49:44.360] It's a term they made up to describe what they're doing.
[01:49:44.360 --> 01:49:47.360] What they should be doing is taking you before a magistrate
[01:49:47.360 --> 01:49:49.360] and have an examining trial,
[01:49:49.360 --> 01:49:56.360] because that is the only way the magistrate can legally set bail.
[01:49:56.360 --> 01:50:01.360] Well, that's the whole purpose of a magistrate to begin with.

[01:51:34.360 --> 01:51:37.360] because they're always trying to turn everything upside down.
[01:51:37.360 --> 01:51:40.360] They're on the bottom by definition, and they don't want to be on the bottom.
[01:51:40.360 --> 01:51:43.360] They don't want to just execute law without question.
[01:51:43.360 --> 01:51:47.360] You know, they want to make law and rule.
[01:51:47.360 --> 01:51:50.360] All right, so we have to, it's going to be a constant battle.
[01:51:50.360 --> 01:51:53.360] I've always said, you know, our founding forefathers,
[01:51:53.360 --> 01:51:55.360] even going all the way back to the Magna Carta,
[01:51:55.360 --> 01:52:01.360] as much as they would have wanted or wished to hand us liberty and freedom
[01:52:01.360 --> 01:52:04.360] on a silver platter, and we just don't have to worry about it anymore,
[01:52:04.360 --> 01:52:07.360] they knew in their hearts that's not the way it is,
[01:52:07.360 --> 01:52:09.360] that's not the way it's ever going to be.
[01:52:09.360 --> 01:52:12.360] The best they could do is pass along the fight.
[01:52:12.360 --> 01:52:14.360] We're always going to have to be diligent.
[01:52:14.360 --> 01:52:20.360] The story is that right after the signing of the Declaration,
[01:52:20.360 --> 01:52:26.360] I'm sorry, of the Constitution, Ben Franklin walked out of the building,
[01:52:26.360 --> 01:52:31.360] and a woman stopped him and asked him, what have you given us?
[01:52:31.360 --> 01:52:37.360] He said, we have given you a republic if you can keep it.
[01:52:37.360 --> 01:52:41.360] Yeah, we've given you another day to continue the fight.
[01:52:41.360 --> 01:52:45.360] You know, stay on top if you can.
[01:52:45.360 --> 01:52:46.360] It's always going to be a struggle,
[01:52:46.360 --> 01:52:49.360] and we shouldn't be frustrated because we have to fight this fight.
[01:52:49.360 --> 01:52:55.360] If we get everything fixed, our grandkids are going to have to do it again.
[01:52:55.360 --> 01:52:58.360] It's just the nature of human beings.
[01:52:58.360 --> 01:53:00.360] We shouldn't be too upset about that.

[01:55:27.360 --> 01:55:31.360] I can assure you, the first time you get before a magistrate,
[01:55:31.360 --> 01:55:35.360] and he says, well, we don't do an examining trial.
[01:55:35.360 --> 01:55:38.360] We do a magistration.
[01:55:38.360 --> 01:55:41.360] And you say, well, how the heck do you set bail
[01:55:41.360 --> 01:55:44.360] if you don't do an examining trial?
[01:55:44.360 --> 01:55:47.360] And they get this blank look.
[01:55:47.360 --> 01:55:48.360] When do you set bail?
[01:55:48.360 --> 01:55:51.360] Where does the law authorize you to set bail?
[01:55:51.360 --> 01:55:54.360] I can only find it in one place, 17.05.
[01:55:54.360 --> 01:55:59.360] Deborah was with me in Williamson County when I quoted that to this magistrate
[01:55:59.360 --> 01:56:01.360] who's saying that he does a magistration.
[01:56:01.360 --> 01:56:04.360] And I'm saying, no, you're doing an examining trial.
[01:56:04.360 --> 01:56:08.360] And he was an attorney, and we're bouncing back and forth.
[01:56:08.360 --> 01:56:14.360] And when I quoted 17.05 to him, his eyes went out of focus.
[01:56:14.360 --> 01:56:17.360] His jaw kind of dropped down, and he kind of froze in place.
[01:56:17.360 --> 01:56:21.360] In NLP, we call that pattern interruption.
[01:56:21.360 --> 01:56:24.360] Yeah, the same thing happened to the JP here in Travis County.
[01:56:24.360 --> 01:56:27.360] Yeah, and I interrupted a pattern for him,
[01:56:27.360 --> 01:56:31.360] and his eyes went out of focus because he backed up and went inside,
[01:56:31.360 --> 01:56:35.360] and he's doing what they call transderivational search.
[01:56:35.360 --> 01:56:42.360] He's looking internally for a way to reconnect this pattern back together.
[01:56:42.360 --> 01:56:45.360] That's the most devastating thing you can do to a human being
[01:56:45.360 --> 01:56:49.360] is leave him with nothing to do.
[01:56:49.360 --> 01:56:54.360] Interrupt his patterns and leave him with no pattern to run.
[01:56:54.360 --> 01:56:57.360] Now he has to stop and figure out what's going on.
[01:56:57.360 --> 01:57:02.360] And you could see this guy doing it, but clearly it nailed him proper.
[01:57:02.360 --> 01:57:05.360] And it was right after that he asked me how I would feel,
[01:57:05.360 --> 01:57:11.360] what I would think if within a couple weeks they got all of this corrected.
