It specifically states that the land has been transferred to the patent holder,

but only in accordance with the land law that is in effect at the time the patent is issued.

And as the land law changes over time and the patents were issued with specific caveats,

then you have to abide by those caveats and by the land law for that particular year.

and they all revolve around the land laws that were in effect from the late 1830s with the republic

all the way up through current land laws where water rights are a major issue.

Any piece of land that you may choose to look at,

you might have to go back to the date of the land patent and apply a whole different set of code to it.

if they will go and do the research, bring their little parcel of that land patent forward,

because land patents were normally issued using either a section, a half section, or a quarter section of land.

But you can accept the assignment for a small parcel of land within a land patent.

You can't just have your land patent and then not pay.

You still have to complete the process and go through steps to get your land taken off of the tax roll.

And part of that has to do with what is commercial land and what is private land.

Because the land patent is true ownership, and they're not an assignee on that land patent unless you make them such.

not having anything to do with a contract related to the land per se –

Land cannot be taken by the court under a judgment because the land is not something that can be taken that way with patents,

So even with a house in Austin, if it was ever bequeathed in a land patent, then you can still bring that patent forward.

so that the land law that deals with our piece of property is the land law from 1918,

and we are the assignees on that land patent, and we have accepted the assignment,

We've had a lot of people tell us a lot of nonsense about land patents.

And they will send you an email back telling you that your land patent is such and such and such and such,

The land patent thing is very, very specific with land law.

The land law is very specific dealing with water and water rights.

So if a group of people own some land and somebody turns their water off, they have remedy to fix that problem.

Okay. So around 9 o'clock and then we'll go over land patent issues,

So Pat, let me ask you something about this land patent thing

There's been some adjudication on this within the state dealing with land patents and ad valorem taxes.

When you did your research, what time frame did they start going away from the land patents and going to the warranty deeds

It was signed by two people, the commissioner of the general land office in Austin and the governor of the state.

There's very little amount of land left in the state of Texas that does not have a patent issued on it.

He's the patent attorney, the land patent attorney for the general land office in Austin.

He still issues land patents, brand new ones.

But I advise against that because you would be tying the land patent to the current land law,

It is the answer to the land grab going up from Mexico all the way to Canada. It's not

I want to say this. Just getting your land patent will not get you out of property taxes.

I've been real lucky in dealing with my local tax people because a lot of the ranchers out here have their land patent

I found that one, the federal government and Texas transferred land originally on patents.

When that land was sold by the individuals, they sold the patent normally.

and that is three blocks north of the Capitol building in the general land office building on Congress Avenue.

which happened a number of times because of the change in land laws, changing the mineral rights that were transferred with the patent,

but it's an oversized document and it's called a letter patent issued by the Commissioner of the General Land Office

And he refused to answer any of my questions about land patents.

As in our case, we bought our property through the Texas Veterans Land Board,

But if you call the land office, do not tell them anything about what you're trying to do with it

You're trying to bring a land patent forward or something

Over which they have absolutely no rights considering the status of the land patent itself

Then they foreclose and take the land we never gave them that authority

They raised his land taxes three times as much as it was last year

You know if you try it with the land patent

In other words, like if you get your land patent brought forward, all these kinds of things,

You cannot file a lien on an alloyal or land patent title.

But having said that, you have to understand what a land patent truly is.

If you have land patents, if you have a loyal title, that is yours.

Well, I just wanted to say I went to Bureau of Land Management on their computer there.

And she looked it up at Bureau of Land Management,

signed by the President of the United States, James Buchanan, for a land patent.

So I'm actually holding my land patent right here, and it took me all of an hour of research.

so that it went with the land patent.

If you do a search for your state and then put land patents,

the appropriate office will probably come up under BLM land patents.

I went to another website and I found a listing of all the land patents in Wisconsin.

Yeah, he has his land patent on his own property.

And if you need to find the copy, your copy of your land patent,

it's in the archive section of the General Land Office in Austin.

And how do we go and look for that land patent?

If you'll Google the Texas General Land Office, they'll come up with a website.

and it's going to ask you some very specific questions starting with which county you are in or the land is in.

Okay, and it's the Texas General Land Office?

you will have a U.S. land patent issued on it if it has one.

because the court will not override a land patent.

and do a land patent on the block and be able to acquire full title over and above

They are going to disavow all knowledge of a land patent.

So if I have brought forward the land patent, then I can tell the city to go scratch.

All right, so bottom line is this whole land patent process,

They don't complete the process, and then they get their land taken away.

Harmon Taylor has made mention to the land patent, and he states that it has everything to do with your choice of law when you purchase property.

The land patent is paramount, and the land patent is determined by the organic laws of the state of Texas, which is the original de jure Republic.

Well, I know, but why are you no longer a voter just because you get a land patent?

You're saying that once you get a land patent, you lose, you can't have a voter registration card anymore.

And I wanted you guys, both of y'all, to go into this because there's a lot of people in the state, most people I would say, who are not landowners or don't even have a color of title or a color of deed to their land who have not gone through this process.

And so I want to, I want you guys to explain why if you are a true landowner with a land patent that you can't have a voter registration card anymore.

So just because you have a land patent or you brought forward your land patent on the property you own,

Okay, when you are a land owner, let's go back to words of art known only by sages of the law.

So when you say you are a land owner, you are nothing more than a tenant and you pay

Back to the land patent.

The land patent makes you an absolute holder of absolute title, not an owner, but a holder of absolute title, different terms.

You're either going to be a riot tenure and hold no more than equitable title, or you're going to have absolute title, land patent.

A loydeal title and land patent are the same.

The loydeal title or land patent, not if, but when people bring them forward, in other words, they accept the assignment of the land patent, they become freeholders.

Even by the current GLO, their own website calls it sovereign land and is a sovereign transfer of property by their own admission.

of bringing their land patent forward, becoming a freeholder, all these things,

Protesters say the wall has been built to allow more land to be annexed to the nearby settlements rather than for military purposes.

It is our land beyond this wall and we will not give up on it.

And I did have one other comment. Was that Paul that was on the other night about the land patents, Deborah?

If you have problems with that land patent, I was thinking that the assessor would be the weak link in the chain.

If you sue the assessor for not accepting the land patent or taking you off the tax roll, what do you think about that?

Hey, and the implications of this land patent are incredible.

It's the only document I've ever seen that says you own this land forever, forever.

Nope. And I can say right now because I've been to the state archives library and pulled all the files, there is not one square inch of land in Travis County that is under the jurisdiction of the federal government, period.

to talk about mortgage issues. And since Michael from Maryland has been waiting so long and

called a homestead exemption in our state. I don't know if Maryland has that or not,

I mean, as far as their land, are they doing to tell them that they're going to have to have energy-efficient land to sell their land?

I don't know the full history of your territory, but I'm familiar with Texas's history as far as the land grants go.

If they ever come around here and start doing that stuff to us, I'm going back into the Spanish land grants

talking about the land patent issues as well.

and let the Indian tribe have the land and let them fund the annuity.

And tomorrow night, Eric Madsen from Team Law is going to be talking about land patents to follow up on the sequel,

But that was hundreds of years after the initial settling of the country where the land was granted and the nation began.

So in order to get the people, for the people to come across, the king offered that he would grant them the land and the right to self-government.

They had left England and gone to Holland and taken up residence in Holland and they were happily farming over there.

And so no loss to the Dutch for them to come to England and England was happy to have them gone because they were a thorn in the side of the king who was ruling also a little bit through religion.

But when the king granted this offer, they saw an opportunity because they recognized as long as they were tenants, as they were in Holland on somebody else's land,

because again Holland was a kingdom, they would remain unable to live in accord with their religious designs and desires.

But finally they negotiated that the land would be granted to them.

They had to pay for that transportation, and the way they had to pay for it was they had to give Great Britain 50 percent of their production from the land for seven years.

And arriving here to this new land and not having things like paper or tin or sugar or many things that they needed,

But they were still the judges and governors for the people here, and the people here were still under their own sovereign right of rule on their land and their properties.

And so by the time you get to the French-American War, what happens is the French and England are at war.

And so the French come up to the Canadian Indians and negotiate with them and tell them, hey, we're going to go to, you know, we're at war with England and we're going to be fighting these people.

most of those being that England started trying to set statutes to control this country.

Well, when England started trying to set statutes to control this country, that caused the states to get together and form their own parliament.

For crying out loud, there's not a single person in your parliament that owns one inch of land and virtually 80 percent of the population here owns over 50 acres of land.

So when we are dealing with land, again, we see the difference in the ownership of land being very clear when you look at the feudal title,

because in feudal title the land or the domain is owned by the king.

So as we come forward with a constitutional republic and we have a lodeal title for land being granted by the king to the Mayflower colonists

and to the people that have come to this country there ever after, land and property appurtenant to the land

You have the landowner is the owner of the land and that same person is the owner of the property appurtenant land.

Where you get the land passed on the other side.

No. The king can own property as well. The king can own the land and the property.

and no one else owns any land in the kingdom other than the king.

From the very beginning all of the people that owned land in this country also owned the property pertinent to land.

the fact that you own the land and the property is not going to interfere with your private contractual ability.

This is a gigantic misnomer that most people don't understand when they start dealing with land interests

and they start seeing the old laws that talk about land ownership and the fact that

when you have the patent of the land the patent and the land are not subject to debt or taxes.

It only has to do with the ownership of the land and the property pertinent to land.

So the foundation of how land operates in this country was set by the King of Great Britain

when he started granting land to the people along with the property pertinent to land.

Rhode Island would never agree on anything so the entire time they almost never got anything accomplished

because if everybody else would agree Rhode Island wouldn't agree and they called it Rogue Island

Rhode Island even though they signed in did not give up their charter with England

So our deal with land and land rights and land patent,

Knowing that when you read the land patent and the words say,

that the land is given and granted to the person named on the patent

and that the land and the property of pertinence of the land

The land was granted and then added to the grant of the land was the property of pertinence of the land

Anything that sits within that space, real property, again land is not tangible,

in other words the property that appertains to the land and therefore its private ownership,

whether it be by the same landowner as the land or by a different party,

and begin to secure the land and the property of pertinence of the land.

Now, another issue that comes and becomes important when you're dealing with land patent

and that is you notice that the land patent is a grant, grant-made patent.

The land is merely the empty vacant space.

up the whole world of understanding what land is when you're dealing with the patent and

So, the bottom line is the land itself is the empty vacant space.

Dominion and land is one and the same thing.

Property of person's land is all the stuff within the dominion.

and the property of person's land and the owner of the land are one and the same person.

then we jump to the issue of the land patent when it's granted

So again, when you get the land patent, the land patent was initially granted.

So you'll see from time to time, a king will grant the land over and over and over again.

Now when we're dealing with land issues, the land patent comes to you,

and it says that this land is granted to you, or to the person who is named,

because when they look at the land ownership,

But notice that the land is intangible.

Land is not something that is tangible, it's domain,

So he purchases the property, and I grant him the title to the land that goes along with that property

The land is granted to you and to your heirs and assigns forever.

When the patent was issued, the land was granted to that person who was named

So, when you decide you want to sell the property or person's land to somebody

The word and means what it says, and, and it says that that land belongs to the person who is named and their heirs

So, in land law, when a person acquires the title to the land, what does that mean? Well, the title for the land is the patent

The problem is, today, there's a whole bunch of people who have no understanding of this foundation we've just gone over, and they go back and they look at that land law and it says, land cannot be subjected to debt or taxes

And their ownership of the land gives them the domain

If they are also the owner of the property, and they acquired that by deed, then they own the land and the property, and the title will be called a fee-simple title, or a fee-simple absolute title, or a lodeo title

So when you have that fee-simple title, you have the land and the property appurtenant to the land

And so you agree to that, and you sign the document, and now what do you have? What does that have to do with your land ownership?

Nothing, it seems. Nothing. Absolutely nothing. That is absolutely correct. It has nothing whatsoever to do with your land ownership

Now we've basically covered everything you need to know about land and land patents and all that

We spent the entire four hours with Pat from Texas discussing land patent issues and what kind of documents need to be gathered

so that you can get your land patent

All right, we're going to get to the land patent issue, but I do want to spend a few minutes

But at any rate, what we really wanted to get you on for is to talk about the land patent issue.

So anyway, let's go to the land patents now.

But at any rate, let's go to the land patent thing.

So what kind of research did you get into to lead you to the land patent issue?

Well, again, the issue that we were dealing with was an issue dealing with land ownership.

the laws of Colorado preclude an ownership issue, a land ownership issue,

And so we worked to have the case moved up to the district court so we could deal with the land ownership issue

It was an issue dealing with land ownership.

The process of learning about the land ownership and delving into land ownership was an interesting one.

Allodial is a, the word means that there is only one owner of both the land and the property.

You have to understand, land is not what we typically think as we grow up and what we might read in statute.

When it says vacant land and it describes vacant land as being the real estate,

the land prior to there being any buildings built on it.

Now, when you're dealing with title for land, people talk about land and land title all the time.

And when they're talking about land and land title, they have no idea,

They think that the title for the land is their deed.

In fact, I thought my title for the land was my document that showed I was the owner of that land.

Bottom line, when you're dealing with land and land issues, it's important to know what land is.

So in order to understand what land is, you have to know where the title for the land is.

Now, the patent is simply a grant of the land made patent.

Now, to understand what land is, you have to be able to go and pick up the patent and actually read the patent.

and then it distinguishes the land by saying, and the property appurtenant to the land, to the person who is named on the grant.

Now, when they distinguish the property appurtenant to the land from the land, that sets off the definition of what land is.

What you have to understand is land is defined by the two-dimensional boundary on the surface of the earth.

Anyway, regardless of how the land is actually described, when you get the land description,

The land is defined by a third dimension as well.

From the center of the earth to the heavens above, land is not the contents of that space.

To understand what land is, the definition of land, what land actually is, is better to understand the word domain.

then you understand what land ownership is.

the king, as in all kingdoms, operates land ownership under a feudal title.

Now, feudal title means that the owner of the land and the owner of the property pertinent to land are two different parties.

In other words, the king in a kingdom, like in Great Britain, the Queen of England, owns all of the land in Great Britain.

And because she has the right to the tribute, you cannot take the property pertinent to the land away from her land without paying the proper tribute.

Once you've got the recognition and the tribute paid, then you can take property from the land because the Queen has authorized that.

Now, in this country, the distinction was when England first started trying to settle the United States of America, they failed.

That whole section of land was called Virginia.

It became known to the people in France and England and Holland that to be sent to the Americas was a death sentence, and nobody wanted to go.

In the King's Folly, what he did was he offered to grant land to the people.

So they would receive the patent-secured land ownership, which would give them the sovereign right of self-government.

But the setting of it and what got people to start coming, that first group, was they were granted the land and the right to self-government.

Yeah, you can't possibly understand land if you don't understand what we're talking about right now.

So the first thing that you do, and that's why people use the land patent service that

Team Law provides, because our land patent sandwich takes that property and that land,

the land patent itself for that purpose.

Again, because if you secure the property and the land from the trust to the man, and

the land ownership transfers.

Let me ask you something, Eric, because you just said about the land ownership transfers.

No, I said the land and property ownership transfers.

So at least the land ownership is included in that statement, and it sounded to me earlier

like you were saying that with the land patent, the acceptance of the land patent, that the
