If the issuing named magistrate is in another county, the person arrested shall, without unnecessary delay, be taken before some magistrate in the county in which he was arrested.

In this case here there was no, I mean it was arrest without a warrant.

Now, what, this is an arrest without a warrant.

Now, if the guy comes out and says, I just saw somebody shoot somebody behind a building over there and the policeman runs around the building, sees a guy laying down with blood running all over and another guy walking away with a weapon, he can arrest that person without a warrant, even though he didn't personally see or hear the offense being committed.

So that's when they can arrest without a warrant. Now, once the arrest is made, he has a duty to take the person to the nearest magistrate.

Now, this is the same in every state or at least every state that I look for, looked at, that it goes to a federal requirement. If a person is arrested, it's not intended that the police have the power to arrest and imprison.

And it's the magistrate who holds the key to the jailhouse door, not the police officer. If we allow police to arrest and imprison, it will create a horrible situation just exactly like the one we have, where the public fears their police and consequently the police fear their public and we find ourselves in a police state.

Now, the policeman who actually witnessed the infraction can write the criminal complaint. Or if he was told by someone that this person committed a felony and he arrested the person for the felony, he could write the complaint telling the judge that this person told me that he personally witnessed this third party commit a felony.

Then, if you have been arrested with no warrant, it is the warrant based on a valid criminal complaint that gives the court subject matter jurisdiction.

He prepares a warrant, and it is that warrant that gives the court subject matter jurisdiction. Now, they would have had it if the warrant existed already, and the policeman could arrest on the warrant.

But if he had arrested someone on a warrant, he would still have to bring them directly to the nearest magistrate.

Reason being, when a warrant is issued for someone's arrest, the person is not in front of the magistrate as a matter of law.

A warrant will always direct the police officer or some officer to arrest this person and bring him before me, bring him before the magistrate who issued the warrant.

But it's not a submit sufficient for a finding of probable cause on arrest.

So once they arrest the person, they have to bring him back before the same magistrate, the one that issued the warrant, because he did it ex parte.

And if they ran out and arrest me, and then brought me before the judge, and the officer told the judge that, and then the officer turned to me and asked me, did you do that?

As a matter of policy in every state I've been to up until now, if a person is arrested, the person is taken directly to jail as a matter of policy.
