I don't remember ever seeing that in a speeding charge, but it's a required element. So why isn't it in there?

Now, every speeding complaint that I've ever seen has two criteria that have always,

according to the case law, been necessary in a speeding charge.

They must prove in a speeding charge if an offense was actually defined anywhere, which it isn't,

That in a nutshell is speeding. Now this goes hand in hand with federal and Supreme Court case law that I've read that says

there can never be a speeding offense. That's exactly why 351 exists.

And he said, you know, he's charging me a speeding. I said, well, you can't charge me a

speeding. I'm not in commerce. Well, the speeding laws apply to everyone. Oh, they do. Have you

Now, when you read those two statutes, you find out that there is a set of condition precedents that must exist before an allegation of speeding can even be made.

That precedent set of precedents is that the person who is being charged with speeding failed to control their speed so as to avoid a collision with another person or vehicle who is already lawfully upon or entering the highway.

Right, speeding is a crime, trust me.
