[11:00.560 --> 11:06.800] And I got on a bus at the Museum of Science and Industries, just on the south side. [11:06.800 --> 11:12.160] The north side is white and Puerto Rican, Mexican, south side is black for the most [11:12.160 --> 11:13.160] part. [11:13.160 --> 11:18.920] And in those days, when I was living there, we did not go to the south side. [11:18.920 --> 11:22.840] It was not a good idea to be white on the south side. [11:22.840 --> 11:24.880] So we stayed out of there. [11:24.880 --> 11:30.280] So it was 20 years, 30 years later, I got on the wrong bus, and just going south. [11:30.280 --> 11:33.760] And all the white people got off of it pretty soon, and it was only black people. [11:33.760 --> 11:38.960] I'm sitting next to this black woman, and I said, ma'am, is it just me, or did I get [11:38.960 --> 11:39.960] on the wrong bus? [11:39.960 --> 11:46.920] Oh, and she just cackled, oh yeah, white honky, you definitely on the wrong bus. [11:46.920 --> 11:53.160] And the whole bus, they were ribbing and joking with me. [11:53.160 --> 11:56.920] Everybody just laughed and joked, no attitude at all. [11:56.920 --> 12:00.560] I was amazed at how different it was. [12:00.560 --> 12:08.840] And Chicago changed the most when Mayor Daley's son, after Mayor Daley retired, his son ran [12:08.840 --> 12:12.400] and he completely changed everything. [12:12.400 --> 12:16.040] And apparently, the city completely changed. [12:16.040 --> 12:22.520] I got out of Chicago because I was more afraid of the police than I was the criminals. [12:22.520 --> 12:28.920] The police were more deadly, more dangerous, but that's part of what Operation Greylord [12:28.920 --> 12:35.360] was trying to fix, but they never did beat Daley. [12:35.360 --> 12:38.520] He stayed in office until he retired. [12:38.520 --> 12:49.240] Anyway, okay, who do you, so you have judges you're going to go after in Hillsboro? [12:49.240 --> 12:57.160] This was going more after the, well, another public official that's again been shielded. [12:57.160 --> 13:06.800] In other words, I have criminal complaints that had gone back, they were turned in August [13:06.800 --> 13:07.800] of 2020. [13:07.800 --> 13:08.800] Yeah, 2020. [13:08.800 --> 13:13.880] Who did you give them to? [13:13.880 --> 13:19.640] They were taken to the, they were taken to the peace officer at the police office, police [13:19.640 --> 13:20.640] station. [13:20.640 --> 13:23.080] Do you have the police officer's name? [13:23.080 --> 13:24.560] Yes, I do. [13:24.560 --> 13:27.000] I have a record request on all that. [13:27.000 --> 13:29.320] I've got their log. [13:29.320 --> 13:36.660] Charge him with shielding from prosecution violation of 38.05 for failing to give notice [13:36.660 --> 13:39.920] to some magistrate of crime. [13:39.920 --> 13:49.000] 2.13 paragraph C, when a peace officer has made known to him that a crime has been committed, [13:49.000 --> 13:54.440] he shall give notice to some magistrate. [13:54.440 --> 13:58.520] You might want to put in an information request and request the name of the magistrate to [13:58.520 --> 14:05.360] whom this officer gave notice. [14:05.360 --> 14:10.160] When you get a back of response that says we have no records responsive to your request, [14:10.160 --> 14:12.520] you can do what I did. [14:12.520 --> 14:20.640] Go down to the district court, this is the Hillsboro 66 Judicial District, with Lee Harris [14:20.640 --> 14:23.160] as the judge. [14:23.160 --> 14:27.960] Find a time when he's having a trial and go up to the bailiff and tell the bailiff your [14:27.960 --> 14:33.520] name and instruct the judge that you have business with the court. [14:33.520 --> 14:37.000] And the bailiff will ask the nature of the business and you say give him these. [14:37.000 --> 14:39.760] You give him a set of documents. [14:39.760 --> 14:47.520] It'll be a verified criminal complaint against the officer and he'll give it to the judge. [14:47.520 --> 14:52.840] And when the judge finishes the hearing, he'll likely get up and walk out of the court and [14:52.840 --> 14:55.520] pay no attention to you. [14:55.520 --> 14:58.040] That's what he did to me. [14:58.040 --> 15:07.360] So I went to the JP and filed criminal charges against the judge. [15:07.360 --> 15:09.280] That was great fun. [15:09.280 --> 15:11.720] And I filed a criminal charge against the sheriff. [15:11.720 --> 15:18.480] The complaint I filed with the judge was a complaint against the sheriff for telling [15:18.480 --> 15:24.960] me he had no records responsive to my request and I asked for 17.30 records. [15:24.960 --> 15:31.560] So when I went to this JP and filed against the judge, I also filed against the sheriff [15:31.560 --> 15:36.840] because he told me he had no records responsive to my request and I told the JP, I know he [15:36.840 --> 15:46.080] has those records and you know he has those records because you gave them to him. [15:46.080 --> 15:53.140] He's the one that does the morning hearings at the jail, gotcha. [15:53.140 --> 15:55.560] So then what did the JP do? [15:55.560 --> 15:56.560] I don't know yet. [15:56.560 --> 16:01.760] I'm going to find out real quick. [16:01.760 --> 16:06.760] I sat down with him, went through the whole routine and he listened real close. [16:06.760 --> 16:09.520] And I told him, I'm just using you as a crash dummy. [16:09.520 --> 16:17.480] Actually, I'm using Hillsborough, Hill County as a crash dummy. [16:17.480 --> 16:19.360] You didn't spot? [16:19.360 --> 16:20.360] I don't care about him. [16:20.360 --> 16:23.040] I don't care about the complaints. [16:23.040 --> 16:25.480] I'm just using this for some other purpose. [16:25.480 --> 16:29.400] So he's going to listen to what everybody tells him. [16:29.400 --> 16:35.480] But his problem is I just filed criminal charges against the district judge, the one everybody's [16:35.480 --> 16:36.480] afraid of. [20:12.680 --> 20:14.680] Yeah, pretty recently, right? [20:14.680 --> 20:16.680] Yeah, last week. [20:16.680 --> 20:20.680] Yeah, so he's going to be pretty sensitive about that particular issue. [20:20.680 --> 20:27.680] Yeah, when this kid that I was there to help, he had a hearing in that court and I went [20:27.680 --> 20:31.680] and sat in the court and the judge couldn't help it, he kept looking up at me and I kept [20:31.680 --> 20:34.680] catching him looking, he'd look down. [20:34.680 --> 20:41.680] He's trying to be cool and indifferent. [20:41.680 --> 20:48.680] But, and I was telling Brad on the break that I had a good conversation with the prosecutor. [20:48.680 --> 20:54.680] And I talked to him on the phone for about an hour and a half about this process. [20:54.680 --> 20:59.680] And when I was sitting in the courtroom, I saw this guy, I asked him, are you Mark? [20:59.680 --> 21:00.680] And he said, yeah, I am. [21:00.680 --> 21:02.680] I told him, you know, I'm Randy Kelton. [21:02.680 --> 21:04.680] Oh, come on, glad to meet you. [21:04.680 --> 21:12.680] And he tried to defend his position over the 1617 issue. [21:12.680 --> 21:15.680] And clearly he could not. [21:15.680 --> 21:21.680] He made two or three statements and he said, well, we'll have to see how this works out. [21:21.680 --> 21:28.680] I've already told him that I'm going to use Hill County as a crash dummy. [21:28.680 --> 21:32.680] So what were the things that he tried and failed that were just lame excuses that he [21:32.680 --> 21:33.680] tried to come up with? [21:33.680 --> 21:34.680] What did he do? [21:34.680 --> 21:42.680] Well, he was saying that this is a pretty standard and tried and true methodology. [21:42.680 --> 21:44.680] And I said, yeah, I got that. [21:44.680 --> 21:46.680] I hope so. [21:46.680 --> 21:52.680] But under Monell, it doesn't matter what the policy is. [21:52.680 --> 21:56.680] As far as I'm concerned, they can use the policy as toilet paper. [21:56.680 --> 21:58.680] I only care what the code says. [21:58.680 --> 22:01.680] And the code seems pretty clear and they're not following it. [22:01.680 --> 22:05.680] Well, Mr. Kelton, it could be something that you've missed. [22:05.680 --> 22:08.680] I don't know what it could be after all this time. [22:08.680 --> 22:11.680] He was not very specific. [22:11.680 --> 22:15.680] He was unclear. [22:15.680 --> 22:17.680] It was clear he was stumbling. [22:17.680 --> 22:20.680] He didn't have a way to count it. [22:20.680 --> 22:22.680] He could have missed something. [22:22.680 --> 22:27.680] That's not a very strong position there. [22:27.680 --> 22:28.680] It was clear. [22:28.680 --> 22:32.680] The first time I talked to him, he was very articulate. [22:32.680 --> 22:34.680] He spoke well. [22:34.680 --> 22:39.680] And he spoke and then he stopped and then gave me time to speak and then I stopped. [22:39.680 --> 22:41.680] It was a really good conversation. [22:41.680 --> 22:48.680] I was surprised at how well-spoken he was and how knowledgeable he was in the code. [22:48.680 --> 22:53.680] When I mentioned this subordinate clause 14.06, he was aware of it. [22:53.680 --> 22:55.680] He almost quoted it. [22:55.680 --> 22:57.680] So he was very knowledgeable about this. [22:57.680 --> 22:59.680] That's interesting. [22:59.680 --> 23:02.680] That's kind of an obscure thing for somebody to be already aware of. [23:02.680 --> 23:03.680] Yeah. [23:03.680 --> 23:06.680] Well, he's been a prosecutor for his whole career. [23:06.680 --> 23:09.680] So he's probably looked at the code quite a bit. [23:09.680 --> 23:13.680] But I don't think he had it questioned this way. [23:13.680 --> 23:19.680] Nobody ever really took that subordinate clause apart. [23:19.680 --> 23:23.680] And he's trying to find a way to justify what they're doing. [23:23.680 --> 23:26.680] But there's a problem with it. [23:26.680 --> 23:29.680] They're doing what they call a magistration hearing. [23:29.680 --> 23:33.680] They take his jail all night and bring before him the magistrate in the morning. [23:33.680 --> 23:38.680] This subordinate clause that says you take a person directly to the nearest magistrate [23:38.680 --> 23:43.680] or in order to more expeditiously provide the warnings in 15.17, [23:43.680 --> 23:48.680] you can take the person to any other county in Texas. [23:48.680 --> 23:51.680] They took that to mean, well, you don't have to bother with an examining trial. [23:51.680 --> 23:56.680] You can skip Chapter 16 and throw them in jail and take them before a magistrate [23:56.680 --> 23:59.680] and the magistrate will give these warnings. [23:59.680 --> 24:06.680] Okay. But that subordinate clause did not say that the magistrate could, [24:06.680 --> 24:15.680] in that circumstance, issue a problem of cause determination or set bail [24:15.680 --> 24:20.680] or anything else, only giving the warnings. [24:20.680 --> 24:24.680] So how do you set bail? [24:24.680 --> 24:30.680] You can only set bail once you've made a determination of probable cause. [24:30.680 --> 24:32.680] Yeah, there's no other place for that. [24:32.680 --> 24:38.680] In this instance, they are in the county of original jurisdiction. [24:38.680 --> 24:44.680] And instead of bringing them before a magistrate for an examining trial, [24:44.680 --> 24:55.680] they're using this 15.16, that's for on a warrant, or 14.06, [24:55.680 --> 24:58.680] not on a warrant and this subordinate clause that says you can take them [24:58.680 --> 25:01.680] to any other county in Texas. [25:01.680 --> 25:05.680] Well, they're not in an other county. [25:05.680 --> 25:08.680] They're in the county of jurisdiction. [25:08.680 --> 25:13.680] That other, that term other in there screws up their position. [25:13.680 --> 25:16.680] So if you wanted to do this, you'd have to take them out of county [25:16.680 --> 25:21.680] to another county and have this done and bring them back in the county. [25:21.680 --> 25:27.680] It's the only way an eighth grader can make sense of that. [25:27.680 --> 25:30.680] Well, they've also got this video conferencing thing, [25:30.680 --> 25:33.680] so they might get creative and call up like FaceTime [25:33.680 --> 25:37.680] and hook up with somebody that's a magistrate in a different county. [25:37.680 --> 25:42.680] I'm going to ask them to do, to use that video conferencing tool. [25:42.680 --> 25:49.680] I'm going to ask them, send an email to the governor [25:49.680 --> 25:53.680] and to one of the members of the Senate subcommittee hearing, [25:53.680 --> 25:56.680] the criminal justice subcommittee hearing, [25:56.680 --> 26:05.680] that I want them to petition the legislature for a statement of legislative intent [26:05.680 --> 26:12.680] and have them clarify that other county in Texas means any county [26:12.680 --> 26:16.680] other than the county of original jurisdiction. [26:16.680 --> 26:24.680] So if they're arrested out of county, then they can do this only to provide the warnings [26:24.680 --> 26:28.680] so that when they get back to county where they have the witnesses [26:28.680 --> 26:31.680] and all the paperwork and documentation, [26:31.680 --> 26:36.680] then they can be brought before a magistrate for a proper examining trial. [26:36.680 --> 26:43.680] But what I'm going to ask them to say is that with the new legislation [26:43.680 --> 26:48.680] that allows for a video conference hearing, [26:48.680 --> 26:53.680] that we simply request that the officer making the rest take out his cell phone [26:53.680 --> 26:57.680] and call a magistrate. [26:57.680 --> 27:04.680] And the magistrate can hold an examining trial on the phone. [27:04.680 --> 27:08.680] First thing he does, the officer hands the phone to the accused [27:08.680 --> 27:13.680] and the magistrate will read him his rights. [27:13.680 --> 27:19.680] And before any evidence is entered in the court against the accused, [27:19.680 --> 27:23.680] the accused shall have a right to make a statement to the court. [27:23.680 --> 27:26.680] Give the person the opportunity to make a statement to the court. [27:26.680 --> 27:32.680] Now, granted, that's probably a really bad idea. [27:32.680 --> 27:34.680] But it's in law. [27:34.680 --> 27:39.680] It's what law commands, that they have that opportunity. [27:39.680 --> 27:43.680] Then he gives the phone back to the policeman. [27:43.680 --> 27:46.680] The policeman tells his side of the story. [27:46.680 --> 27:50.680] And the magistrate decides whether or not there's sufficient problem [27:50.680 --> 27:53.680] to cause to warrant an arrest. [27:53.680 --> 27:56.680] And if he does, he can set bail right there and the person can make bail [27:56.680 --> 28:00.680] or he can release the person on his own recognizance. [28:00.680 --> 28:02.680] If the guy can set bail, you let him go. [28:02.680 --> 28:04.680] If not, take him to jail. [28:04.680 --> 28:07.680] By permission of the magistrate, not on your own, [28:07.680 --> 28:11.680] and that's after you've explained yourself to the magistrate. [28:11.680 --> 28:13.680] That's what was intended. [28:13.680 --> 28:15.680] We can do it on the phone. [28:15.680 --> 28:23.680] It is far less cumbersome than it was when this was originally instituted. [28:23.680 --> 28:29.680] And that will stop policemen for arresting you for any BS reason they want to. [28:29.680 --> 28:31.680] They arrested me in the district attorney's office, [28:31.680 --> 28:36.680] having a private conversation with the district attorney for a public offense. [28:36.680 --> 28:40.680] You cannot commit a public offense in a private office, period. [28:40.680 --> 28:43.680] I was 30 feet from the magistrate. [28:43.680 --> 28:45.680] It took me straight to jail. [28:45.680 --> 28:50.680] Had they took me to that magistrate, even though he hated me, [28:50.680 --> 28:57.680] and I was there to file criminal charges with him, and they blocked me. [28:57.680 --> 29:00.680] Had he took me to that magistrate, that magistrate would have said, [29:00.680 --> 29:06.680] you can't arrest this guy for that, he would have released me immediately. [29:06.680 --> 29:08.680] This would have gone away. [29:08.680 --> 29:13.680] They wouldn't be facing a $400 million lawsuit. [29:13.680 --> 29:18.680] And since the officer had so much time to make up a story, [29:18.680 --> 29:25.680] he threw the district judge under the bus. [29:25.680 --> 29:30.680] So if they had done it right, this would just really wouldn't be a problem. [29:30.680 --> 29:35.680] And if they had done it right, the policeman would not have dared to arrest me, [29:35.680 --> 29:40.680] because he's going to have to tell that judge right now why he arrested me. [29:40.680 --> 29:45.680] I didn't get an arrest report until six weeks later. [29:45.680 --> 29:49.680] That's got to stop, and this will stop it. [34:53.680 --> 34:56.680] What she meant was, I don't want to throw anybody out of the bus. [34:56.680 --> 35:00.680] Yes. [35:00.680 --> 35:02.680] And I laughed at her. [35:02.680 --> 35:04.680] Chicken. [35:04.680 --> 35:06.680] So he wasn't there. [35:06.680 --> 35:13.680] But since she didn't tell me that he issued warrants, I'm going to assume that he didn't. [35:13.680 --> 35:21.680] And then just go to the sheriff and file criminal charges against him with the sheriff. [35:21.680 --> 35:24.680] Put the sheriff on the dime. [35:24.680 --> 35:29.680] And then I'm going to go, we've got a county judge in Hillsboro. [35:29.680 --> 35:32.680] I'll go to him with criminal complaints against everybody. [35:32.680 --> 35:36.680] And now I've got everybody in the county. [35:36.680 --> 35:45.680] So from there, I'll go to the Court of Appeals, Court of Criminal Appeals, Supreme, and then out to the Fed. [35:45.680 --> 35:46.680] Okay. [35:46.680 --> 35:51.680] So what are you going to do, Stephen? [35:51.680 --> 35:53.680] I got a lot of work to do. [35:53.680 --> 35:56.680] I've got a long, long-going issue. [35:56.680 --> 36:01.680] So I had to get something drafted and I'll be making a visit to Mr. Harris. [36:01.680 --> 36:04.680] If you want a county judge, that one, he's not much older than me. [37:14.680 --> 37:15.680] It was a year. [37:15.680 --> 37:20.680] They decided that they needed to come back, so I filed criminal complaints on them. [37:20.680 --> 37:25.680] And I forgot that I've got a recording in March the next year. [37:25.680 --> 37:29.680] I've got the police chief saying, yeah, I got those. [37:29.680 --> 37:31.680] We didn't do anything with that. [37:31.680 --> 37:32.680] Whatever. [37:32.680 --> 37:35.680] And now I've got that they have no record of it. [37:35.680 --> 37:38.680] They obviously didn't take it to any magistrate or anything else. [37:38.680 --> 37:44.680] So they also don't have a record of that recorded call where they met with my wife [37:44.680 --> 37:46.680] and he said that he dismissed it on his own. [37:46.680 --> 37:48.680] So that's perfect. [37:48.680 --> 37:54.680] So make up your documentation and take it to the district judge. [37:54.680 --> 37:56.680] Yes, sir. [37:56.680 --> 37:59.680] He will be familiar with the process. [37:59.680 --> 38:06.680] And since you're doing it behind me, he's probably never had this done to him before. [38:56.680 --> 39:01.680] He's getting other people to do it. [39:01.680 --> 39:13.680] So it may get the judge to make some calls and tell them I'm not throwing myself under the bus for you guys. [39:35.680 --> 39:48.680] If he doesn't issue the warrant, then my argument is that in a written mandamus I've written up for Victoria County, [39:48.680 --> 39:56.680] the judge in the case recused himself and without cause. [39:56.680 --> 40:06.680] So I'm claiming that the judge failed to perform his duty in the way he swore to do under his oath of office. [40:06.680 --> 40:11.680] He swore on his oath and then he accepted payment. [40:11.680 --> 40:16.680] And then he failed to do what he swore on his oath he would do. [40:16.680 --> 40:21.680] By that failure, he repudiated his contract with the state. [40:21.680 --> 40:28.680] And in my case, I asked the court to either order him to get himself back in here and honor his contract [40:28.680 --> 40:37.680] or petition under Texas Civil Practice and Remedies Code, Chapter 66 for court warrant removal from office [40:37.680 --> 40:43.680] because he repudiated his contract. [01:20:15.680 --> 01:20:23.680] So I have been, you know, I've filed original writ of mandamus [01:20:23.680 --> 01:20:27.680] or have that with them on public records violation, [01:20:27.680 --> 01:20:36.680] which in Ohio, that is one of the remedies allowed by statute [01:20:36.680 --> 01:20:40.680] to get them to produce the records, [01:20:40.680 --> 01:20:48.680] and then there's a limited ceiling on the statutory award. [01:20:48.680 --> 01:20:55.680] So my question is basically I'm trying to get my strategy for the mediation [01:20:55.680 --> 01:21:03.680] because my hope is that because I have so much on them [01:21:03.680 --> 01:21:08.680] and they want me to go away, that I can get a settlement at that time [01:21:08.680 --> 01:21:15.680] that will far extend beyond what they could be, [01:21:15.680 --> 01:21:20.680] what the judgment could be specifically on the mandamus, [01:21:20.680 --> 01:21:23.680] that they just want me to go away because I've prepared [01:21:23.680 --> 01:21:25.680] and showed them with all this documentation [01:21:25.680 --> 01:21:32.680] what I plan to do beyond the mandamus action. [01:22:37.680 --> 01:22:43.680] In Texas, if you're in a civil or criminal action, [01:22:43.680 --> 01:22:47.680] you cannot use the Open Records Act. [01:22:47.680 --> 01:22:54.680] So can you use both discovery and Open Records in Ohio at the same time? [01:22:54.680 --> 01:22:58.680] So this, the mandamus on the Open Records, [01:22:58.680 --> 01:23:06.680] it essentially becomes litigated exactly as you would litigate a civil suit. [01:23:06.680 --> 01:23:11.680] So the school board district lawyer was quite surprised [01:23:11.680 --> 01:23:17.680] when at the status conference, the judge, you know, mentioned doing discovery, [01:23:17.680 --> 01:23:20.680] and she kind of was like, well, we've never done that before. [01:23:20.680 --> 01:23:22.680] And I said, no, I'd love to do it. [01:23:22.680 --> 01:23:31.680] So it is a part of this action, even though, you know, they need to produce these records. [01:23:31.680 --> 01:23:36.680] But it's so there's just, so I'm allowed to do discovery and trochries depositions. [01:23:36.680 --> 01:23:45.680] Now, there's four, so the records request are a sort of a side, you know, [01:23:45.680 --> 01:23:50.680] a side point of my fight, if you will, with the school board. [01:23:50.680 --> 01:23:53.680] It's just it was part of my investigation. [01:23:53.680 --> 01:24:02.680] It started with masking my daughter and snowballed from that issue to where, you know, [01:24:02.680 --> 01:24:09.680] where I was giving them a notice of liability up to the point of, you know, [01:24:09.680 --> 01:24:13.680] reading them off basically a notice of liability at a school board meeting [01:24:13.680 --> 01:24:20.680] where they then called the police on me for going over time and threatened me with trespass. [01:24:20.680 --> 01:24:25.680] And then so that was one kind of situation that happened. [01:24:25.680 --> 01:24:34.680] My plan originally was to bring a 1983-42 USC civil suit against them. [01:24:34.680 --> 01:24:41.680] But then when they got so backwards on records request, I went for that first. [01:24:41.680 --> 01:24:44.680] And so that's what I've been kind of focusing on. [01:24:44.680 --> 01:24:52.680] However, another part of our story is that, [01:24:52.680 --> 01:24:56.680] and this is where I think there may be the most, [01:24:56.680 --> 01:25:01.680] where they're really trying to cover things up and where I may have the most meat [01:25:01.680 --> 01:25:11.680] to get a settlement from them, is that one of the incoming school board members [01:25:11.680 --> 01:25:17.680] was also president of a version of the PTA at the middle school. [01:25:17.680 --> 01:25:26.680] And he basically handed me over the president position when he went onto the school board. [01:25:26.680 --> 01:25:28.680] It's a conflict of interest. [01:25:28.680 --> 01:25:31.680] I don't know exactly why he did it at this point in time. [01:25:31.680 --> 01:25:36.680] I was working, quote, with him because I thought that he stood behind some things [01:25:36.680 --> 01:25:41.680] and they all, it turns out they're all terrible, big surprise. [01:25:41.680 --> 01:25:47.680] So I became the president of this little PTA group. [01:25:47.680 --> 01:25:54.680] And over the short duration, I realized that they had like zero systems in place. [01:25:54.680 --> 01:26:00.680] In the cash box, there was like two or three other organizations in the cash box, [01:26:00.680 --> 01:26:03.680] and there was no like bank, and there was no receipts, [01:26:03.680 --> 01:26:06.680] and they had children running the concession. [01:26:06.680 --> 01:26:13.680] And I was trying to straighten it out, and the treasurer, [01:26:13.680 --> 01:26:17.680] who never would actually meet with me or actually speak to me, [01:26:17.680 --> 01:26:22.680] kept avoiding me so that we never had a meeting, I never could see the books. [01:26:22.680 --> 01:26:30.680] Well, a long story short in that, two days after, within that situation, [01:26:30.680 --> 01:26:37.680] I thought like there was pushback from her and pushback from me as far as her just trying to say, [01:26:37.680 --> 01:26:43.680] oh, just leave all the money in the cash box and not allowing me to get on the bank, [01:26:43.680 --> 01:26:48.680] you know, get my name on the bank account, which was supposed to happen. [01:26:48.680 --> 01:26:56.680] So I was going through this when the school board called the police on me at the school board meeting. [01:26:56.680 --> 01:27:01.680] And two days later, I had a detective from the township call me [01:27:01.680 --> 01:27:09.680] and basically said that he needed me to come in because of the missing money from the PTA organization. [01:27:09.680 --> 01:27:10.680] Just out of the blue. [01:27:10.680 --> 01:27:13.680] And I said, well, who called you about this? [01:27:13.680 --> 01:27:15.680] Like who even told you this? [01:27:15.680 --> 01:27:18.680] I'm thinking how do you think, how do you even know there's missing money? [01:27:18.680 --> 01:27:19.680] There's no receipts? [01:27:19.680 --> 01:27:22.680] How much is missing exactly? [01:27:22.680 --> 01:27:26.680] It was just so out of the blue. [01:27:26.680 --> 01:27:31.680] And he wouldn't give me an official name, but he said school officials. [01:27:31.680 --> 01:27:35.680] So that's when I was first really getting into the telegram group. [01:27:35.680 --> 01:27:39.680] And so I ended up again trying to make this a shorter story. [01:27:39.680 --> 01:27:45.680] But, you know, I ended up giving an affidavit of my side of the situation and actually asking him to investigate. [01:27:45.680 --> 01:27:49.680] And I knew right away that he even said that he had watched videotapes. [01:27:49.680 --> 01:27:57.680] I knew right away the principal who was another person that is involved in this whole saga from the beginning [01:27:57.680 --> 01:28:04.680] because he refused me entrance to the school for conferences for masks. [01:28:04.680 --> 01:28:07.680] So it's like all these little things they've been doing. [01:28:07.680 --> 01:28:12.680] I knew he had turned, he had to be the one that allowed him to watch the videotape. [01:28:12.680 --> 01:28:17.680] Long story short, they tried to harass me and intimidate me basically. [01:28:17.680 --> 01:28:20.680] They called the police on me at the school board meeting. [01:28:20.680 --> 01:28:24.680] They tried to like get me, and I was like really, you know, kind of. [01:28:24.680 --> 01:28:30.680] When they called the police, was this the same ones that called because you used over the number of minutes? [01:28:30.680 --> 01:28:36.680] They wanted you to talk for two minutes and you went over and then they called the police? [01:28:36.680 --> 01:28:43.680] So that's the school district themselves, like the school board members and the superintendent. [01:28:43.680 --> 01:28:47.680] I can't say that they're the ones who called the police, but it's school officials. [01:28:47.680 --> 01:28:55.680] It's the principal of the middle school and the treasurer of that PTA organization who also works for the school. [01:28:55.680 --> 01:29:00.680] And the president before me is a school board member. [01:29:00.680 --> 01:29:03.680] So it's like very, very interconnected. [01:34:28.680 --> 01:34:38.680] So, yeah, so basically with the PTA situation, one of the public records requests is for [01:34:38.680 --> 01:34:46.680] the past four years of the log books of the meeting records and the bank statement because [01:34:46.680 --> 01:34:55.680] they kicked me off of that organization by sending out an email and saying, oh, we elected [01:34:55.680 --> 01:35:02.680] you outside of bylaws, so all the officers are basically incorrect and so we're dissolving [01:35:02.680 --> 01:35:07.680] this and we're just going to, the principal's account is going to absorb whatever money [01:35:07.680 --> 01:35:08.680] is in the bank. [01:35:08.680 --> 01:35:11.680] So they never produced anything. [01:35:11.680 --> 01:35:17.680] And so I put in that the public records, one of the records requests that I have in court [01:35:17.680 --> 01:35:18.680] right now. [01:35:18.680 --> 01:35:24.680] And another one of those is for the principal's account because I was told he's going to [01:35:24.680 --> 01:35:27.680] absorb this money. [01:35:27.680 --> 01:35:29.680] There's a lot of issues with the money. [01:35:29.680 --> 01:35:34.680] And so they've avoided those records requests and the school district is saying, that's [01:35:34.680 --> 01:35:36.680] an organization that's separate of ours. [01:35:36.680 --> 01:35:42.680] Now I've proven in my pleadings and through the statutes that they are responsible for [01:35:42.680 --> 01:35:43.680] those records. [01:35:43.680 --> 01:35:45.680] And I believe I've proven that. [01:35:45.680 --> 01:35:48.680] I believe they're backed into a corner on that. [01:35:48.680 --> 01:35:54.680] So I'm confident that they will have to, that they will be judged that they have to produce [01:35:54.680 --> 01:35:55.680] them. [01:35:55.680 --> 01:35:57.680] For some reason, they don't want to. [01:35:57.680 --> 01:35:59.680] They don't have them. [01:35:59.680 --> 01:36:05.680] Now this connects really into the school board because again, the person who is responsible [01:36:05.680 --> 01:36:09.680] for all these records for four years is now on the school board. [01:36:09.680 --> 01:36:12.680] He's a school board member. [01:36:12.680 --> 01:36:23.680] So that being said, the discovery, the interrogatory and the position, I really want to focus on [01:36:23.680 --> 01:36:28.680] this issue because I feel that's where there's a lot of covering up. [01:36:28.680 --> 01:36:34.680] And they told me that the woman, the treasurer said she left the book in the office and the [01:36:34.680 --> 01:36:39.680] office lady is like, oh, you know, I can't find it or it's lost. [01:36:39.680 --> 01:36:48.680] And so that's one issue that I really feel like for some reason they are working so hard. [01:36:48.680 --> 01:36:53.680] I mean, they call, you know, they got the police involved to try to chase me off. [01:36:53.680 --> 01:36:58.680] They don't want me on that. [01:36:58.680 --> 01:37:02.680] And then another part thing just happened with them. [01:37:02.680 --> 01:37:06.680] So I'm telling you this so that maybe you can then give me ideas on how I can approach [01:37:06.680 --> 01:37:11.680] the mediation, having all this background and all these things on them and compiling [01:37:11.680 --> 01:37:16.680] it into like, hey, you know, settle, I'll go away. [01:37:16.680 --> 01:37:21.680] But if you don't, this is what I'm going to do from here on because I have been a major [01:37:21.680 --> 01:37:27.680] thorn in their side up until a few months ago, I got quiet because it went to litigation. [01:37:27.680 --> 01:37:31.680] So, but this is really interesting, I think. [01:37:31.680 --> 01:37:39.680] My daughter recently, I recently found out that in class she's been, she was giving, [01:37:39.680 --> 01:37:42.680] being given a book to do a project on. [01:37:42.680 --> 01:37:47.680] And when I figured out what, when I found out what that book was, my husband was shocked [01:37:47.680 --> 01:37:51.680] at the nature and subject of the book. [01:37:51.680 --> 01:37:58.680] So, so I emailed, you know, I emailed and said, I cannot believe. [01:37:58.680 --> 01:38:02.680] Now, I had just, there was a, it was the project we signed off. [01:38:02.680 --> 01:38:08.680] It was a project to do a project on a classical book. [01:38:08.680 --> 01:38:12.680] So there was a handful of books that they needed a parent signature on. [01:38:12.680 --> 01:38:16.680] I signed off for Catcher in the Rye. [01:38:16.680 --> 01:38:21.680] And I thinking that my daughter and I would read it together and kind of go over anything [01:38:21.680 --> 01:38:22.680] we needed to. [01:38:22.680 --> 01:38:25.680] Well, I didn't realize that it wasn't a Catcher in the Rye. [01:38:25.680 --> 01:38:30.680] It was some book called Clockwork Orange that I had never heard of. [01:38:30.680 --> 01:38:37.680] But again, it was, I don't know if you two are familiar with it, but it's obscene basically. [01:38:37.680 --> 01:38:40.680] I'm very familiar with Clockwork Orange. [01:38:40.680 --> 01:38:43.680] So I said that, and this is an eighth grade class. [01:38:43.680 --> 01:38:48.680] And the teacher's handing him her, his copy because I didn't. [01:38:48.680 --> 01:38:53.680] So I sent an email out like basically I can't believe that you're doing this, [01:38:53.680 --> 01:38:55.680] that you would think this is appropriate. [01:38:55.680 --> 01:39:00.680] I cited, you know, different laws on, and the statutes on obscene, you know, [01:39:00.680 --> 01:39:02.680] giving obscene materials to minors. [01:39:02.680 --> 01:39:09.680] And so immediately the next day apparently they took the book away from all the kids. [01:39:09.680 --> 01:39:11.680] And it was a big thing in the school. [01:39:11.680 --> 01:39:17.680] And then I guess some parents complained that their kids got the book taken away. [01:39:17.680 --> 01:39:18.680] So they gave it back. [01:39:18.680 --> 01:39:20.680] So I didn't, I've left that where it is right now. [01:39:20.680 --> 01:39:24.680] Even though I think there's some more public records requests I can do accordingly. [01:39:24.680 --> 01:39:28.680] The principal scrambled to say, oh, I talked to the teacher and everything's fine [01:39:28.680 --> 01:39:30.680] and she won't get deemed any points. [01:39:30.680 --> 01:39:32.680] And if you have any questions, let me know. [01:39:32.680 --> 01:39:34.680] And I said, well, yeah, I do have a question. [01:39:34.680 --> 01:39:37.680] How long has this teacher been giving this book to minors? [01:39:37.680 --> 01:39:40.680] What is his justification for doing so? [01:39:40.680 --> 01:39:44.680] And what is your justification for allowing it in your school? [01:39:44.680 --> 01:39:48.680] And then of course he didn't respond to that email. [01:39:48.680 --> 01:39:51.680] So that, but that circles back. [01:39:51.680 --> 01:39:54.680] He wanted you to ask other questions, not something like that. [01:39:54.680 --> 01:39:56.680] Yeah, not like, I know. [01:39:56.680 --> 01:40:01.680] And it was like, and I have quite a few emails like that where they just don't, [01:40:01.680 --> 01:40:03.680] when they don't want to respond, you know, [01:40:03.680 --> 01:40:05.680] when it's like the question about what's going on with this PAC, [01:40:05.680 --> 01:40:09.680] just literally no response. [01:40:09.680 --> 01:40:18.680] So, but this is where I think there's, this is where they're probably pretty scared or worried. [01:40:18.680 --> 01:40:25.680] Last year in a public record or a public meeting, I was pointing, [01:40:25.680 --> 01:40:29.680] we had another issue with a book and I saw in the policies, [01:40:29.680 --> 01:40:34.680] I think they're actually the state board, school board policies that they are required, [01:40:34.680 --> 01:40:42.680] the district is required to form a parent partnered curriculum review committee [01:40:42.680 --> 01:40:44.680] to keep an eye on curriculum. [01:40:44.680 --> 01:40:50.680] And so at the time, so I had brought this forward to the school board last year [01:40:50.680 --> 01:40:57.680] and the superintendent was agreed and it was known that she was gathering up [01:40:57.680 --> 01:41:00.680] and making plans for this review committee. [01:41:00.680 --> 01:41:04.680] And actually a friend of mine was supposed to be in this committee. [01:41:04.680 --> 01:41:08.680] Well, they were right on the cusp of supposedly creating this committee [01:41:08.680 --> 01:41:12.680] when the incident happened where they called the police on me at the meeting. [01:41:12.680 --> 01:41:17.680] And you know how they do, you get distracted and go in other directions. [01:41:17.680 --> 01:41:21.680] And as far as I know, they never actually even formed that committee. [01:41:21.680 --> 01:41:27.680] So then a year later, my daughter, you know, gets through four chapters of this obscene book. [01:41:27.680 --> 01:41:32.680] So I just feel like there's, you know, that looks pretty bad for them [01:41:32.680 --> 01:41:38.680] that they promised to put this committee up that they're required by policy to do, [01:41:38.680 --> 01:41:42.680] that they don't get it done and then lo and behold, you know, [01:41:42.680 --> 01:41:47.680] we suffer damages, you know, based on that lack. [01:41:47.680 --> 01:41:51.680] So these are all the little, these are all the pockets of things I have going on. [01:41:51.680 --> 01:41:57.680] And my plan is to somehow compile them together. [01:41:57.680 --> 01:42:02.680] And I had mentioned last time I was talking to you guys to go into the mediation [01:42:02.680 --> 01:42:09.680] and have like a folder for each school board member, the principal and the superintendent, [01:42:09.680 --> 01:42:13.680] and have, you know, the criminal complaints ready to go. [01:42:13.680 --> 01:42:24.680] And my goal is to have the outline of the, as a federal lawsuit written, naming each of them. [01:42:24.680 --> 01:42:29.680] That would, I think, be very big if I at least had said, you know, showed that. [01:42:29.680 --> 01:42:32.680] I also have another mandamus that I can file, [01:42:32.680 --> 01:42:37.680] that I will file immediately after the mediation if we don't settle. [01:42:37.680 --> 01:42:46.680] And, but what I think would be very helpful is to have very good deposition questions ready to go [01:42:46.680 --> 01:42:48.680] that they're not going to want to answer. [01:42:48.680 --> 01:42:56.680] And then also let them know that I plan to, you know, make, you know, a public record schedule. [01:42:56.680 --> 01:43:05.680] And here's all, you know, here's what I'll be asking for because I feel very strongly they want me to go away. [01:43:05.680 --> 01:43:07.680] And... [01:47:24.680 --> 01:47:26.680] I'm standing on the throat of the sheriff. [01:47:26.680 --> 01:47:29.680] I'm trying to get the sheriff arrested, trying to get the district judge arrested. [01:47:29.680 --> 01:47:32.680] Now I'm going to try to get the JP arrested. [01:47:32.680 --> 01:47:40.680] When they talk to me, they have to be extremely careful. [01:47:40.680 --> 01:47:50.680] If I hear one word from them that I can anyway interpret as a threat, it gets a 911 call right now. [01:47:50.680 --> 01:47:53.680] Threaten to arrest me? [01:47:53.680 --> 01:47:56.680] You better have some really good grounds. [01:47:56.680 --> 01:48:01.680] We're going for witness tampering, obstruction, retaliation. [01:48:01.680 --> 01:48:04.680] Not anything else I can think of. [01:48:04.680 --> 01:48:06.680] You come for me, I'm coming for you. [01:48:06.680 --> 01:48:10.680] They came for you with guys with guns. [01:48:10.680 --> 01:48:15.680] Well, really twice because they also had a detective call me. [01:48:31.680 --> 01:48:40.680] What does Robert's Rules of Order say about the remedy for someone speaking over time? [01:48:40.680 --> 01:48:46.680] It doesn't even come close to criminal trespass. [01:48:46.680 --> 01:48:49.680] You're here as a member of the public. [01:48:49.680 --> 01:48:57.680] The only way they could get to trespass is to give you a written order to leave. [01:48:57.680 --> 01:49:03.680] The written order to leave could not be just because they wanted you to. [01:49:03.680 --> 01:49:07.680] They would have to have standing to do that. [01:49:07.680 --> 01:49:12.680] I saw where somebody tried to get somebody else kicked off and was a member of the public, [01:49:12.680 --> 01:49:19.680] and he prevailed, the one who they were trying to eject, [01:49:19.680 --> 01:49:24.680] because they couldn't show that they had a higher claim to the property, [01:49:24.680 --> 01:49:30.680] that one member of the public had a higher claim than the other member of the public. [01:49:30.680 --> 01:49:36.680] And you being speaking to a school board as a member of the public, [01:49:36.680 --> 01:49:43.680] you had a higher claim of being there as they did, and they tried to get you arrested. [01:49:43.680 --> 01:49:51.680] They also went back on camera afterwards, because it's a recorded meeting, [01:49:51.680 --> 01:49:54.680] talking about how the police had me removed, [01:49:54.680 --> 01:50:00.680] because I was ranting and raving for 20 minutes, I mean, blatant lies. [01:50:00.680 --> 01:50:04.680] So they also, you know, it's on record. [01:50:04.680 --> 01:50:08.680] So then that's defamation of character. [01:50:08.680 --> 01:50:11.680] Yes. Now, I did originally, after this happened, [01:50:11.680 --> 01:50:14.680] I originally called around to a couple of lawyers, [01:50:14.680 --> 01:50:25.680] and nobody thought it was basically, I was told that because I had inserted myself in a political issue, [01:50:25.680 --> 01:50:31.680] so that it means that, like, you can't really get... [01:50:31.680 --> 01:50:35.680] Wrong criteria, wrong criteria. [01:50:35.680 --> 01:50:37.680] Who cares if you can win it or not? [01:50:37.680 --> 01:50:38.680] Political issue. [01:50:38.680 --> 01:50:40.680] It ain't about winning. [01:50:40.680 --> 01:50:45.680] It's how much you can black their eye with it. [01:50:45.680 --> 01:50:48.680] Well, so that's just one thing, though. [01:50:48.680 --> 01:50:50.680] You know, that's one... [01:50:50.680 --> 01:50:53.680] Like I'm saying, there's this whole... [01:50:53.680 --> 01:50:55.680] Wait, wait, wait. [01:50:55.680 --> 01:51:00.680] Before we pass this issue, this is a big deal. [01:51:00.680 --> 01:51:11.680] These public officials attempted to use guys with guns to keep you from raising an issue before them. [01:51:11.680 --> 01:51:14.680] The way I read my codes, that's official misconduct. [01:51:14.680 --> 01:51:18.680] That's a class A misdemeanor in every state. [01:51:18.680 --> 01:51:25.680] Didn't you charge one judge of aggravated assault because he tried to use a bailiff against you? [01:51:25.680 --> 01:51:28.680] Who, me? [01:51:28.680 --> 01:51:29.680] Yeah. [01:51:29.680 --> 01:51:32.680] I don't remember if I did that one. [01:51:32.680 --> 01:51:35.680] Good chance I did. [01:51:35.680 --> 01:51:39.680] Because the bailiff has a pistol. [01:51:39.680 --> 01:51:47.680] And if the judge has the bailiff do anything to me, that's first degree felony aggravated assault. [01:51:47.680 --> 01:51:53.680] You know, unless I give him reason to have me arrested. [01:51:53.680 --> 01:51:56.680] So I won't tolerate it. [01:51:56.680 --> 01:52:04.680] And when I go in there, I'm looking toward giving them an opportunity to do something like this so I can hammer them with it. [01:52:04.680 --> 01:52:10.680] You should file official oppression charges against every member of this board. [01:52:10.680 --> 01:52:12.680] Well, and this is what I'm trying to do is hammer them. [01:52:12.680 --> 01:52:13.680] But here's the thing. [01:52:13.680 --> 01:52:16.680] I'm sending my daughter to private school next year. [01:52:16.680 --> 01:52:17.680] She has... [01:52:17.680 --> 01:52:19.680] Well, she's starting high school. [01:52:19.680 --> 01:52:20.680] She cannot... [01:52:20.680 --> 01:52:21.680] I do not want to be... [01:52:21.680 --> 01:52:23.680] I will not be in this district. [01:52:23.680 --> 01:52:26.680] Obviously, they're targeting me and her by proxy. [01:52:26.680 --> 01:52:29.680] And on top of that, they're extremely corrupt. [01:52:29.680 --> 01:52:32.680] My goal is to go into that mediation and have it so stacked against them. [01:52:32.680 --> 01:52:34.680] Now, I have it. [01:52:34.680 --> 01:52:36.680] They've done these things. [01:52:36.680 --> 01:52:41.680] I need to compile it so that they pay for my daughter's private school. [01:52:41.680 --> 01:52:42.680] And I'm out. [01:52:42.680 --> 01:52:43.680] I'm good. [01:52:43.680 --> 01:52:44.680] I'm happy. [01:52:44.680 --> 01:52:45.680] That's it. [01:52:45.680 --> 01:52:48.680] I'm talking about major leverage here. [01:52:48.680 --> 01:52:50.680] You go for them criminally. [01:52:50.680 --> 01:52:54.680] That becomes a really big deal. [01:52:54.680 --> 01:52:57.680] Now they're looking to go to jail. [01:52:57.680 --> 01:53:00.680] It's one thing to be spending the district's money. [01:53:00.680 --> 01:53:05.680] It's a whole other animal when you're looking to go into jail. [01:53:05.680 --> 01:53:08.680] The government sued the tobacco companies three times. [01:53:08.680 --> 01:53:13.680] First two times, they lost because the tobacco companies had so much money. [01:53:13.680 --> 01:53:16.680] Third time, they sued them under RICO. [01:53:16.680 --> 01:53:23.680] Now these high-dollar executives are looking at potentially going to prison, [01:53:23.680 --> 01:53:32.680] and they made the largest settlement in history up to that time to keep themselves from going to jail. [01:53:32.680 --> 01:53:37.680] You have real leverage there. [01:53:37.680 --> 01:53:40.680] Throw it in the mix. [01:53:40.680 --> 01:53:41.680] Yes. [01:53:41.680 --> 01:53:49.680] If they even frown at you after you file criminal charges against them, retaliation, witness tampering. [01:53:49.680 --> 01:53:54.680] I've stood in court eight different times, nine now, nine times, [01:53:54.680 --> 01:53:59.680] and asked the bailiff to arrest the judge right in front of the judge. [01:53:59.680 --> 01:54:06.680] Every single time, that judge kept his mouth shut because he knew one word out of him. [01:54:06.680 --> 01:54:12.680] Once I'm making criminal accusations and he is in deep doo-doo. [01:54:12.680 --> 01:54:19.680] So every time they kept their mouth shut, I suspect these board members won't know enough to do that. [01:54:19.680 --> 01:54:26.680] You file a verified criminal affidavit with some magistrate against them, they're not going to prosecute them. [01:54:26.680 --> 01:54:33.680] And when they don't, then you jump up and down and wail in righteous indignation about the inequity of it all, [01:54:33.680 --> 01:54:37.680] and now I'm going to have to file against you judge for protecting these guys. [01:54:37.680 --> 01:54:42.680] What's going to happen is these judges are going to go to these guys and say, you better do something. [01:54:42.680 --> 01:54:47.680] I'm not throwing myself under the bus for you. [01:54:47.680 --> 01:54:49.680] It's all politics. [01:54:49.680 --> 01:54:54.680] And that criminal issue gave you a really strong piece of leverage. [01:54:54.680 --> 01:54:57.680] That's my story, and I'm sticking to it. [01:55:49.680 --> 01:55:54.680] I just want to get his attention, and I guarantee you when you start pushing criminal charges, [01:55:54.680 --> 01:55:58.680] all of these guys are going to try to protect him.
