[05:53.600 --> 05:57.600] Yeah, I told Brett before we started that it was real hot in here [05:58.600 --> 06:00.600] So I had to kind of take off some clothes [06:01.600 --> 06:06.600] So he's talking to a fat 73-year-old naked guy on the phone or on the radio [06:07.600 --> 06:12.600] Because I'm trying to flat that image in his mind to screw him all up [06:12.600 --> 06:16.600] I told him I didn't really mind, it didn't make any difference [06:17.600 --> 06:19.600] I've been over in Finland plenty of times [06:20.600 --> 06:24.600] Been over in the saunas and it was just no big deal [06:25.600 --> 06:27.600] They ruined all my fun [06:28.600 --> 06:30.600] We're having way too much fun today [06:31.600 --> 06:37.600] So where we left off is I was talking about the Beaumont Report and the Code of Federal Regulations [06:38.600 --> 06:40.600] And what all of these officials have to adhere to [06:40.600 --> 06:46.600] You can't just go around making your wish list of orders that you're going to give to your employees [06:47.600 --> 06:50.600] They sign no contracts, they have no obligation to do any of this stuff [06:51.600 --> 06:54.600] It's really upsetting to me, but there are tools to fight back with [06:55.600 --> 07:01.600] And those tools are A, you have the right to be secure in your person, right? [07:01.600 --> 07:12.600] Number one, number two, you've got the Beaumont Report that was codified into law in I think 78, 79 [07:13.600 --> 07:16.600] I'm surprised I've never heard of that [07:17.600 --> 07:22.600] Nobody has heard of it and this guy discovered it, this guy Brian Ward was doing a lot of research [07:22.600 --> 07:31.600] And it's very clear that you cannot do anything to any person [07:32.600 --> 07:40.600] Even California has under the Health and Safety Code 24174, you cannot experiment on people without informed consent [07:41.600 --> 07:45.600] And that includes pros and cons with the right to refuse [07:46.600 --> 07:48.600] Everybody has a right to refuse [07:48.600 --> 07:53.600] You cannot, there is no such thing as you have to take this vaccine to keep your job [07:54.600 --> 07:59.600] That is totally illegal and totally unconstitutional and the testing is as well [08:00.600 --> 08:07.600] You can't tell somebody that they have to give you DNA samples that go to a lab and you have no idea how that's being compiled [08:08.600 --> 08:12.600] And what they're doing now is it's not me, it's my boss that's saying it [08:13.600 --> 08:16.600] It's not me, the federal government is saying it or this person is saying it [08:16.600 --> 08:23.600] I guarantee you that all of those institutions that are still testing are taking federal funding to keep that going like the hospitals [08:24.600 --> 08:33.600] Because the end goal, for those who don't know, the end goal is the actual obeisance of all society like China [08:34.600 --> 08:43.600] They want to institute the QR coding, they want the social credit score, they want the digital dollars, they want the digital currency [08:43.600 --> 08:50.600] And they want everybody to comply with every order without any governmental interference that will all be run by corporations [08:51.600 --> 08:52.600] That's where this is going [08:53.600 --> 09:01.600] Who's issuing the orders, the corporations? Who is actually funding that? The federal government, the Department of Defense, the federal government [09:02.600 --> 09:06.600] The federal government is your enemy people, this is why it continues [09:06.600 --> 09:15.600] And when you can use the Code of Federal Regulations to stop what's going on and stick it in their face, those lawyers don't have a recourse [09:16.600 --> 09:17.600] They won't have a response [09:18.600 --> 09:22.600] They won't be able to come back and say, well, we're just complying with this and we're just complying with that [09:23.600 --> 09:29.600] Okay, well then show me your legally effective informed consent in plain language to me with the right to refuse [09:29.600 --> 09:40.600] Do not report 45 CFR 46, write it down, read it, understand your rights people and go after these, go after these people [09:41.600 --> 09:47.600] Don't let them do this because they're going to do this forever if we don't stop it, that's their plan [09:48.600 --> 09:55.600] And we've kind of known that for a long time, I'm glad I'm finally hearing about this [09:55.600 --> 09:58.600] I am concerned that it is a CFR [10:00.600 --> 10:08.600] Based on a recent ruling by the Supreme, CFRs are no longer law, they're no longer enforceable [10:10.600 --> 10:12.600] You aware of that? [10:13.600 --> 10:13.600] No [10:13.600 --> 10:24.600] That's Code of Federal Regulations, regulations are issued by agencies and the Supreme, this ruling was passed based on EPA regs [10:25.600 --> 10:34.600] And they said that regulations by agencies are not law and can't be enforced as law [10:35.600 --> 10:40.600] That if the legislature wants this as law, they have to enforce it as law [10:40.600 --> 10:48.600] And they used to say that the regulations overshadowed law, overshadowed the courts [10:49.600 --> 10:58.600] That the courts could not interfere with a regulation because the regulating agency knew more about the issues than the courts did [10:59.600 --> 11:04.600] So the regulations took precedence, well a recent Supreme Court decision turned all that around [11:04.600 --> 11:13.600] Yeah, that kind of falls into the category of administrative law and administrators and how that developed over time as well [11:14.600 --> 11:24.600] But the Belmont report is not a federal regulation, it's different and it is equivalent to law and your state has the same law [11:24.600 --> 11:33.600] Is that you cannot be coerced into taking a test or putting something in your nose or giving a saliva sample or giving a DNA sample [11:34.600 --> 11:37.600] Or giving your medical information out or taking a vaccine, you cannot be coerced [11:38.600 --> 11:49.600] And it takes people getting educated to push back on that because if that pushback doesn't happen, you are aware of the consequences of that [11:49.600 --> 11:58.600] Is that at some point you will be forced through a corporate structure because the federal government supports it or requires it or demands it [11:59.600 --> 12:05.600] Through a corporate structure to follow some rule that has no law behind it [12:06.600 --> 12:10.600] There is no law behind any of this, these are all mandates, there's no law behind any of this [12:11.600 --> 12:14.600] Anyway, that's it so far [12:14.600 --> 12:20.600] Okay, wonderful, do you have anything else? [12:21.600 --> 12:26.600] Okay, I've got Belmont report 45 CFR 46, is that correct? [12:27.600 --> 12:28.600] Yes [12:29.600 --> 12:30.600] Okay, good [12:31.600 --> 12:35.600] Regulations are not law then ordinances are not law so there you go [12:35.600 --> 12:45.600] Okay, we can do something with ordinances as not law, they're called ordinances because they can't be called law [12:46.600 --> 12:56.600] Because they are enacted by an agency that is not the legislature and only the legislature can write law [12:56.600 --> 13:06.600] So they call them ordinances and they only apply to people in contractual privity with the agency that produce the ordinances [13:07.600 --> 13:15.600] You can't apply them to the general public because if you do that, then it acts like a public law and only the legislature can write public law [13:16.600 --> 13:22.600] We found a habeas on that, not a habeas, a really habeas corpus, no? [13:22.600 --> 13:29.600] No, a writ of mandamus, we found a writ of mandamus in the appellate court in Fort Worth [13:30.600 --> 13:39.600] And they pick up, except 12% of the mandamus is filed and they rule in favor of the filer 2% of the time [13:40.600 --> 13:48.600] We filed it as a pro se, claiming that the court did not have subject matter jurisdiction [13:48.600 --> 13:55.600] The appellate court didn't have subject matter jurisdiction because the trial court didn't have subject matter jurisdiction [13:56.600 --> 14:07.600] And then they looked at it and looked at our arguments and said, holy mackerel, if we rule in their favor, then all the ordinances in the state go out the window [14:08.600 --> 14:12.600] So they looked in the record and found a different reason to dismiss the case [14:12.600 --> 14:21.600] So we got our dismissal, but not for the reason we wanted, but because we got a dismissal, we couldn't appeal [14:22.600 --> 14:26.600] That's how they kept that issue from getting before the Supreme Court [14:26.600 --> 14:42.600] Well, yeah, just like Brett's situation where the state trooper jurisdiction is, there's territorial, impersonum, and subject matter, and the courts want to gloss over all of that [14:43.600 --> 14:49.600] Just like the counties and the cities want to gloss over ordinances, do they have any actual jurisdiction? They don't [14:49.600 --> 14:58.600] But it's a pretend world at this point, and so we can break that down into something that is a reasonable facsimile of real life [14:59.600 --> 15:04.600] You can't just create an ordinance and say it applies to everybody in the land. This is not a kingdom [15:05.600 --> 15:16.600] We still rule by law, and an ordinance does not, in effect, have any impact on anyone except for the police departments who are paid by municipalities or counties [15:16.600 --> 15:27.600] to go and run people down in extortum. [20:22.600 --> 20:25.600] Talk to anything you want [20:26.600 --> 20:32.600] Okay, I'll just go with the issues that I have right now [20:32.600 --> 20:42.600] So the first is the notice of abatement, it would be a notice not a motion for the judge, the retired judge [20:43.600 --> 20:50.600] To step aside and have an elected judge move forward with my case, with the case [20:51.600 --> 20:59.600] So that is a notice that I need to put in and it's like 10 days prior to the hearing that's coming up [20:59.600 --> 21:03.600] The hearing, the next hearing is a motion to stay proceeding [21:04.600 --> 21:11.600] They'll probably strike that because the summary judgment was denied [21:12.600 --> 21:19.600] So I guess my question is the abatement to, is that a notice that I need to put in? [21:20.600 --> 21:23.600] I'm not sure what you're speaking to [21:23.600 --> 21:38.600] Okay, so the retired judge is not moving, she's not wanting to let me move forward with an elected judge [21:39.600 --> 21:47.600] She keeps saying that she is a, what do you call it, an active judge [21:47.600 --> 21:53.600] An active, I mean she's active, but she's retired, you know [21:54.600 --> 21:58.600] Then send her some criminal complaints and let's see how active she is [21:59.600 --> 22:02.600] Okay [22:03.600 --> 22:08.600] That's what I just did to the judge in Victoria County, I dropped some criminal complaints on him [22:08.600 --> 22:24.600] Now, I sued the justice of the peace because I gave him criminal complaints and he refused to issue a warrant under 15.09 [22:25.600 --> 22:27.600] He actually refused to even read them [22:28.600 --> 22:31.600] So I sued him and we're in court based on that suit for that reason [22:31.600 --> 22:38.600] And I gave this judge some criminal complaints and he refused to read them [22:39.600 --> 22:41.600] Uh huh, yeah [22:42.600 --> 22:47.600] Yeah, so what does he think I'm going to do to him? [22:48.600 --> 22:51.600] He did not see the irony [22:52.600 --> 22:55.600] So okay, go ahead, I kind of interrupted you [22:55.600 --> 23:03.600] So the criminal complaint would be the judge [23:04.600 --> 23:18.600] What would be the complaint then that she's just keeping herself in the case when I asked her to step aside to recuse herself [23:19.600 --> 23:23.600] Because I've already put a motion in that's not going to be heard until February [23:23.600 --> 23:30.600] She said okay, well I'm still going to be here and then we can hear your motion in February [23:31.600 --> 23:35.600] Well, she'll be there if you can't get her in jail first [23:36.600 --> 23:39.600] Okay [23:40.600 --> 23:43.600] Well that's what I'm going to try to do to this judge [23:44.600 --> 23:47.600] That I maintained that he didn't have standing [23:47.600 --> 23:52.600] And he was brought in there to screw me [23:53.600 --> 24:01.600] This is why he was there, that's why they bring in retired judges so they can move it against you out of hand at every turn [24:02.600 --> 24:08.600] So this one thinks that I have no remedy against him and yours probably does too [24:09.600 --> 24:12.600] Unless you file criminal charges against him and that changes everything [24:13.600 --> 24:14.600] Okay [24:14.600 --> 24:29.600] So I'm going to accuse the appointed judge and the trial judge who recused himself for a criminal conspiracy to deny me due process [24:30.600 --> 24:31.600] Okay [24:31.600 --> 24:44.600] Your trial judge that this retired judge is sitting in for, did he or her have grounds to recuse himself? [24:44.600 --> 25:03.600] Yes, because I put in a motion timely and I asked her that I need to be heard by an elected judge and she just [25:04.600 --> 25:06.600] No, you missed my question [25:06.600 --> 25:15.600] Who was the original judge in the case? If this is an appointed judge, she was appointed to take some other judge's position [25:16.600 --> 25:20.600] The original judge? [25:21.600 --> 25:22.600] Yes [25:23.600 --> 25:24.600] That was appointed to the case? You're moving the court to abate the case [26:28.600 --> 26:37.600] Well, it looks like the next upcoming motion date is not until next year [26:38.600 --> 26:39.600] Like, excuse me [26:39.600 --> 26:49.600] I don't know, you just file the motion and then set it for hearing. It doesn't matter what their standing dates are [26:50.600 --> 26:56.600] You just file the motion and then go to the court coordinator and ask the court coordinator when the judge is going to hear motions next [26:57.600 --> 27:01.600] And ask her to set this motion on for hearing at the next motion hearing date [27:01.600 --> 27:08.600] Judges usually set aside one day or two days just to hear motions [27:09.600 --> 27:16.600] So you find out when that day is going to be and ask the court coordinator to set your motion for a hearing on that day [27:17.600 --> 27:24.600] Okay, so call them instead of applying for a hearing online [27:24.600 --> 27:30.600] Like, I can set a motion date online and that's not until February [27:31.600 --> 27:34.600] And that's what the court clerk would tell me [27:35.600 --> 27:44.600] Okay, file a motion with the court. Anytime you file a motion with the court, if you want it heard, you have to get it put on for hearing [27:44.600 --> 27:54.600] So, you file the motion and then you contact the court coordinator, that's generally the judge's clerk [27:55.600 --> 27:58.600] And ask when the judge's next date for hearing motions is [27:59.600 --> 28:04.600] And she'll tell you and you ask her to set this motion for hearing on that date [28:05.600 --> 28:08.600] And then you notice the party on the other side [28:09.600 --> 28:12.600] That's how you get something heard [28:12.600 --> 28:21.600] Yeah, it seems like this California court, they're so backlogged that it's [28:22.600 --> 28:29.600] No, no, no, okay, hold it. They're backlogged, but motions generally take 30 to 45 seconds for a judge [28:30.600 --> 28:35.600] So they set a date on the week and all they do is hear motions [28:36.600 --> 28:39.600] And they just crank right through them [28:39.600 --> 28:45.600] So, you just file a motion and ask the court to put it on for hearing at the next hearing date [28:46.600 --> 28:49.600] You notice the other side, it gets put on for hearing [28:50.600 --> 29:00.600] Okay, I'll try that. [34:22.600 --> 34:32.600] Okay, so the court is really backlogged and what the clerks do is they're like we can't give you a motion date over the phone [34:33.600 --> 34:42.600] but you can go online and there is a schedule of motion date and you fill in all the information and all these dates pop up [34:42.600 --> 34:48.600] The last two days I was there, the next motion date is in February [34:49.600 --> 34:56.600] So if I do call them back they'll say well that's what it says so you've got to pick those dates [34:57.600 --> 35:03.600] because I did that before I said you know I need to be heard before that can you please squeeze me in [35:03.600 --> 35:12.600] They're like nope you know there's others before you and you've got to take whatever so everything's digitized now [35:13.600 --> 35:23.600] So this abatement is I pick a date in February, you know the judge is going to say the same thing [35:24.600 --> 35:27.600] Well then we'll hear in February, continue [35:28.600 --> 35:30.600] Try an emergency restraining order [35:30.600 --> 35:38.600] Okay, they're going to have some provision for that [35:39.600 --> 35:41.600] Restraining order? [35:42.600 --> 35:55.600] Yeah, file the motion for abatement as an emergency restraining order, restrain the court from taking any action until whatever can happen [35:55.600 --> 35:59.600] Until your motion can be heard [36:00.600 --> 36:07.600] Okay, this one as well as I did a motion to disqualify her [36:08.600 --> 36:18.600] She said well we're going to continue because the disqualification that's set to be heard in February 2021 [36:18.600 --> 36:27.600] Yeah, but once the motion's before the court then the judge can't act until that's heard [36:28.600 --> 36:35.600] Really even though I put the motion of disqualification? [36:36.600 --> 36:43.600] Yeah, once that's before the court then the court is essentially disqualified until this is heard [36:43.600 --> 36:53.600] Think about it, I mean you can't deny people all of their due process rights because you're busy [36:54.600 --> 36:55.600] Okay [36:56.600 --> 37:04.600] And the courts have ruled that you can't deny because of a crowded docket, that's the court's problem, not your problem, you still have your constitutional rights [37:04.600 --> 37:16.600] Okay, then I do need to follow some criminal complaints against the judge, the female judge [37:17.600 --> 37:26.600] So I didn't know to say that then, yeah, we need to, everything stops, it's debated until that motion is heard [37:27.600 --> 37:28.600] Exactly [37:28.600 --> 37:43.600] Okay, so I will attempt to say that to the judge, it's going to come up, the motion to stay proceeding in October [37:44.600 --> 37:54.600] So I need to practice that, and the motion to stay proceeding, she can't really rule on that until she hears the motion to disqualify [37:54.600 --> 38:06.600] Yes, and if they try to file a plea and abatement and ask for an emergency order to abate all proceedings [38:07.600 --> 38:18.600] Emergency order to abate all proceedings, and it should be in writing, correct, the emergency order? [38:19.600 --> 38:20.600] Absolutely [38:21.600 --> 38:22.600] Absolutely, okay [38:22.600 --> 38:29.600] Generally with emergency restraining order, you go in and file it, the court gives it to the judge, the judge signs it, it gives it back to you [38:30.600 --> 38:39.600] Okay, gotcha, this is great, this is what I need to get clarified [38:40.600 --> 38:44.600] Notice of abatement, that's coming up [38:44.600 --> 38:55.600] That's coming up, one more thing, this is probably another criminal complaint, I did go in person to the liars office to serve them a letter [38:56.600 --> 39:08.600] I was in their area, so I decided to drop by, they're in a huge building, they have to hold an entire 14th floor, the security wouldn't let me up [39:08.600 --> 39:20.600] All the elevators are locked, you need a key to go up, so the security calls the receptionist and she said, who are you? [39:21.600 --> 39:27.600] Tell her my name, I have a letter for the two liars, can I drop it off? [39:27.600 --> 39:38.600] And she said, wait a minute, so I wait there for a while, you know, about 10-20 minutes, she calls back, she goes, who are you and what do you have in your hands? [39:39.600 --> 39:49.600] It's just a letter to the liars, and she goes, okay, wait a minute, so then I wait and I said, forget it, they're not going to let me up [39:49.600 --> 40:05.600] Okay, hold on, everybody, they all have to have some form of service, tell them you're serving documents on the law firm, they have to have someone in California by statute to accept service [40:06.600 --> 40:12.600] Okay, even though I'm not a process server, anyone can serve? [40:12.600 --> 40:26.600] Yes, anyone can serve, except the litigant, and that's only the original petition, everything else you can just send to them, send it by mail and don't worry about it [40:26.600 --> 40:49.600] Oh, okay, yeah, the next day I just did a one-day delivery because they wouldn't accept me just, you know, leaving it with the security, so I did a one-day delivery, it was another, they're trying to get production of business records from the law enforcement [40:49.600 --> 40:55.600] And they're dating back to 2015, why? It doesn't make sense [40:56.600 --> 41:03.600] There's probably an objection to it, it has to go before the court and the court has to order it [41:04.600 --> 41:06.600] Okay, all right [41:07.600 --> 41:10.600] They can ask for anything they want to, but they only get what the judge says they can get [41:10.600 --> 41:28.600] I already did a motion to quash, I already followed a motion to quash, and then a motion for protective order, those two motions [41:29.600 --> 41:34.600] That should be an emergency order, so that should be heard immediately [41:34.600 --> 41:51.600] Oh, another emergency order, a following objection, I can do that, and do the emergency order restraining order as well, there's a lot of things here [41:51.600 --> 42:05.600] I don't have to respond to that, was that a question? [47:37.600 --> 47:40.600] Doing pretty good for an old fat guy [47:41.600 --> 47:42.600] That's key for yourself [47:43.600 --> 47:48.600] Oh, doing pretty good for an old and young fat guy [47:49.600 --> 47:52.600] Oh, okay, you got that straightened out [47:52.600 --> 48:04.600] Okay, I called because I was looking at the court seal, or no, the court stamp on the municipal court stamp that I got on [48:05.600 --> 48:13.600] Because I was on the way to the appeals court yesterday, I looked at, and I saw the stamp and I'm like, oh my gosh, it doesn't even say Irving Municipal Court [48:13.600 --> 48:25.600] It says municipal court, and it has a date, and that's it, and so I, so then I thought, well, they're not even going to know whether or not I actually served it in the right court because it doesn't even say Irving on it [48:26.600 --> 48:33.600] So when I handed it to her, I said, but I'll show you, I said, I did file it in their court, I said, but I just looked at their stamp and they only put municipal court [48:34.600 --> 48:41.600] And I don't know how you're going to know that that was the right court or what, so anyway, she just hit me strange, and I thought that was kind of strange too [48:41.600 --> 48:49.600] So is there a law that requires them to put, you know, their court stamp on documents that come into the case file? [48:50.600 --> 48:53.600] I don't know, but probably not [48:54.600 --> 48:55.600] Oh [48:55.600 --> 49:03.600] The law doesn't, tends to not specify something that generic or that minor [49:03.600 --> 49:13.600] The law doesn't address everything, and that, but that's probably something you can bring to the attention of the court, and they'll likely fix it [49:14.600 --> 49:27.600] Yeah, I just thought that it's something they could use against me later if they, if they close to like, if they say that, well, we didn't stamp that, that doesn't say Irving, you know what I'm saying, so I don't see how the court can get away with that [49:27.600 --> 49:33.600] Well, it is a problem. I had an issue with that in New York City and in Brooklyn [49:34.600 --> 49:49.600] They had a guy in a federal lockup, and I went down there and they weren't using the court stamp they had, they had a rubber stamp they were using, and I asked if I could see it, and she said, sure, she gave it to me, and it's got these little rollers on it, so you can roll the date back and forth [49:49.600 --> 50:02.600] Yeah, and I asked them, I said, how do you get the date right? She said, well, each day we roll the numbers forward, and I'm holding it, looking at it, and I said, well, that's interesting, can you also roll the numbers backwards? [50:03.600 --> 50:06.600] And she said, can I see that, and she grabbed it, and poof, she was gone [50:07.600 --> 50:10.600] In an hour, this kid was out of jail [50:11.600 --> 50:12.600] Oh, wow [50:12.600 --> 50:19.600] So, it can be a problem, but if you bring it up to the court, they're likely to fix it [50:20.600 --> 50:33.600] Yeah, well, you know, I'm hopefully out of that court, but you know what I was just thinking, I'm not really going to be out of that court if the other court decides that they're going to make them give me a new trial, that's not what I'm asking for though [50:34.600 --> 50:40.600] Well, if they give you a new trial from a higher court, this court's going to get a lot more careful [50:40.600 --> 50:52.600] But I didn't ask for a new trial, I asked for them to let me appeal, so hopefully I can just appeal in writing, and they'll decide in writing, you know, what's going to happen, you know? [50:53.600 --> 50:55.600] Yeah, and that's most likely what will happen [50:55.600 --> 51:12.600] I hope so, but yeah, so it was interesting, I was worried about them not taking my filing, and so I had my recording on and everything, waiting for them to give me a hard time, and they actually were really nice people over there [51:12.600 --> 51:29.600] When you get out of the municipal and JP courts, these are for the most part civil courts, and they are civil, most of these people deal with lawyers all day, so they're not in the habit of being nasty and tacky [51:29.600 --> 51:46.600] Right, right, so that was, I said, well thank you, you know, I was standing here thinking I was going to get a hard time, and I really appreciate how nice you are, you know, you're just real friendly, so I said, wow, I'm not used to this [51:47.600 --> 51:55.600] Well that's good, they need to hear that we appreciate it, it'll make them more inclined to do it [51:55.600 --> 52:14.600] Mm-hmm, but you know, but she did say, well we'll take it and we'll make sure that it's under our jurisdiction, which I had already researched it, so you know, I don't know how long it's going to take them, but hopefully my time to file the appeal brief doesn't happen until they make a decision on if they're going to take the appeal, right? [52:14.600 --> 52:28.600] Wait a minute, that didn't make sense, they won't make a decision on an appeal brief until they decide whether or not to take your appeal [52:28.600 --> 52:53.600] Yeah, what I mean is, I'm asking them in the writ to make Irving Court accept my paupers affidavit or whatever and so that they can perfect the appeal so the appeal can go to the appeals court, so until that's done where the court's going to mandate them to do whatever they're supposed to do, if they think they're supposed to do it [52:53.600 --> 53:01.600] then I don't have to file an appeal brief until after that's already been decided, right? [01:04:23.600 --> 01:04:34.600] Okay, so I work for the state of Illinois, unfortunately, and so I am being mandated to wear a mask [01:04:34.600 --> 01:04:45.600] I work from home primarily, and we have to rotate in the office about every two months, we do a two week rotation in the office [01:04:46.600 --> 01:05:01.600] So back in March, I had my rotation coming up in April, and so I gave them like a two week heads up that I wasn't going to consent to wearing a mask anymore because I don't feel well when I wear it [01:05:01.600 --> 01:05:16.600] And, you know, I kind of outlined, you know, like my rights, why I don't have to wear a mask, one of the things, I heard the caller, a couple callers ago that talked about, you guys were talking about the Nuremberg code [01:05:17.600 --> 01:05:29.600] I did cite that, and then they have to give us informed consent, and I provided a, it was a link to 150 mask studies that showed that they're ineffective and they're harmful to health, things like that [01:05:29.600 --> 01:05:45.600] Anyway, they told me that I would either have to wear a mask or I would have to take my, I would have to use vacation time for that whole two weeks if I wasn't going to wear a mask to come into the office [01:05:45.600 --> 01:06:01.600] But I told them I was going to come and I was not going to wear a mask, so I did go, I was seeing a client, and I forgot to mention, it's only when we see clients that we have to wear a mask [01:06:02.600 --> 01:06:10.600] We can walk around, you know, without it, but if there's a client there who does not have to wear a mask, we have to wear a mask in front of the client [01:06:10.600 --> 01:06:14.600] Have you considered a burka? [01:06:15.600 --> 01:06:34.600] No, yeah, well here's the funny thing, I literally, the first day, as I'm seeing a client in the first hour, I am behind plexiglass, the whole thing is plexiglass, okay, and I have, it's a cubicle with two walls and plexiglass [01:06:34.600 --> 01:06:52.600] So the client is on the other side of that plexiglass, they sent a manager from a different department that doesn't even work in our building over because our, my boss wasn't there that day, and she came personally to tell me to wear a mask [01:06:52.600 --> 01:07:09.600] And I told her, well I had already emailed them and told them that I wouldn't be doing that, she pulled me away, disciplined me, told me I was not to see any clients, I would have to stay at my desk, my other, my personal cubicle [01:07:09.600 --> 01:07:21.600] Anyway, I worked the full two weeks without seeing clients, and then on my last day, they gave me a five day unpaid suspension for my first day back home [01:07:22.600 --> 01:07:35.600] And then in July, same thing happened, I went in the office, I told them, every day they asked me if I would wear a mask, I told them no, I'm not going to wear a mask, I don't consent to masking [01:07:35.600 --> 01:07:47.600] And that time I got a 15 day suspension, and now I'm in the office again for my two week rotation, I just got disciplined again today [01:07:47.600 --> 01:08:08.600] This time it's probably going to be 20 day suspension for a termination, I'm not sure, but I have gone through the, you know, I went through the inspector general, office of the executive inspector general as I filed a complaint [01:08:08.600 --> 01:08:18.600] Stating, you know, different laws, and you know, I feel like they're violating our rights, they're not giving us our informed consent [01:08:18.600 --> 01:08:44.600] And, you know, we actually have a law on the books here in Illinois, it's healthcare right of conscience act, which we literally, you know, you have a right to, if you don't, you know, if something goes against your conscience, then you don't have to follow whatever somebody is saying [01:08:44.600 --> 01:09:01.600] But I'm not worrying that very well, but anyway, I have told them that I will not, you know, I'm not ever going to consent to this, every time that they ask me, they're harassing me and trying to click me into doing something that I don't want to do [01:09:01.600 --> 01:09:18.600] I did say that I would be suing the, it's the secretary of our division, which is the Department of Human Services, we do SNAP and Medicaid, she's the one that made the mandate [01:09:19.600 --> 01:09:27.600] Nobody, I keep asking if anybody else is responsible for the mandate, but nobody has ever named anybody else, so I think it's just her [01:09:27.600 --> 01:09:33.600] Sue her personally and do it before they fire her [01:09:34.600 --> 01:09:36.600] Okay, before I get fired? They're already taking your money away [01:10:08.600 --> 01:10:10.600] They're retaliating with that? [01:10:11.600 --> 01:10:20.600] That goes to breach of contract, you have an employment contract with them and I suspect your employment contract does not have mask provisions in it [01:10:20.600 --> 01:10:34.600] Right, well and I'm in a union with, actually I'm not paying union dues anymore because I realize that the unions aren't for us, they're just another political organization [01:10:34.600 --> 01:11:01.600] But they, yeah, I mean they're not fighting for me at all, but okay, so I just, like I said, I have my discipline today and then usually like they'll wait until my last day of my, so like next Friday is my last day in the office [01:11:01.600 --> 01:11:13.600] So what do you suggest I do? Do I do like a tort letter or what, I don't know what to do, I'm sorry [01:11:14.600 --> 01:11:27.600] I mean I've already done a bunch of emails, I've sent her lots of emails that I have documented, I've saved everything, I've, you know, I've spelled it all out, but I don't know if I have to do something formal [01:11:27.600 --> 01:11:35.600] Okay, send her a tort letter first, generally with a governmental agency you send them a tort letter, they've got 60 days [01:11:36.600 --> 01:11:52.600] If they attempt to fire you, then you file a petition for restraining order with the local county court and ask the judge to order that you have a tort letter filed with them and you're waiting for the 60 days [01:11:52.600 --> 01:12:01.600] until you can file a civil action and ask for a restraining order to keep them from firing you in the interim [01:12:02.600 --> 01:12:04.600] Okay [01:12:05.600 --> 01:12:14.600] Yeah, you file it with a court, with a judge, the restraining order and ask the judge to issue an order [01:12:15.600 --> 01:12:20.600] And what type of court, just my county, my local? [01:12:20.600 --> 01:12:25.600] I'm not intimately aware of how the courts work in Illinois [01:12:26.600 --> 01:12:34.600] Why I grew up there, I didn't spend much time in jail because we could outrun the cops [01:12:35.600 --> 01:12:38.600] We were street punks [01:12:39.600 --> 01:12:44.600] And most of you went around on bicycles, those fat cops couldn't catch us [01:12:44.600 --> 01:12:53.600] There was the motorcycle that came after us on a lagoon, a pond inside a park, a humble park [01:12:54.600 --> 01:13:03.600] And he didn't know about the sewer that dumped into the tank and it had a soft spot and his motorcycle kind of fell through it [01:13:04.600 --> 01:13:10.600] But fortunately he was very drunk so we didn't get thrown in jail over that [01:13:11.600 --> 01:13:12.600] Wow [01:13:12.600 --> 01:13:17.600] We're on ice skates and he chases us around on the ice with a three wheel motorcycle [01:13:18.600 --> 01:13:27.600] And he got after me and I led him into this soft spot and got close to it and I scooched sideways and stopped and then shot off at 90 degrees [01:13:28.600 --> 01:13:34.600] He tried to turn the motorcycle, it kind of rotated a couple of times and then, bloop, it dropped through the ice [01:13:35.600 --> 01:13:37.600] He's sitting there up to his shoulders in water [01:13:38.600 --> 01:13:39.600] Ow, me [01:13:39.600 --> 01:13:41.600] Yeah, we were hoodlums [01:13:42.600 --> 01:13:54.600] Yeah, just file, it's probably the county court and ask for a restraining order against the agency to prevent them from terminating you until your cause of actions can be heard [01:13:54.600 --> 01:14:09.600] Okay, and you think, I mean, yeah, so I can personally sue her because she doesn't have qualified immunity because, right? Rosen [01:23:23.600 --> 01:23:33.600] So this gets more interesting because remember, these judges are being paid monies by the county, okay [01:23:34.600 --> 01:23:43.600] And that has a conflict of interest right there, and even hearing the case, because their pay comes from the state [01:23:44.600 --> 01:23:49.600] And they're not disclosing these county payments, and they're significant, upwards of $60,000 a year [01:23:49.600 --> 01:24:00.600] So I love this form, I use a form that the U.S. District Court has a form for complaint violation of civil rights [01:24:01.600 --> 01:24:17.600] And in the first section that I get to type something in, I put right to public speedy trials, arrest and charges on 2-11-2015, ongoing 150 hearings, no trial, and almost 8 years [01:24:17.600 --> 01:24:28.600] The D.A., judges, county, and public defender's office, all working in concert to convict on charges that were brought in bad faith and are a legal impossibility [01:24:29.600 --> 01:24:38.600] Accusing plaintiffs of crimes that are not a crime and statutes that do not apply, plaintiff has been tortured and terrorized for almost 8 years [01:24:38.600 --> 01:24:49.600] This is a targeted, malicious prosecution, caused plaintiffs to succumb to a heart attack, plaintiff suffered a second heart attack in the courtroom [01:24:50.600 --> 01:25:01.600] The judge proceeded with the hearing even after 9-1-1 was called, plaintiff cannot get a fair trial, the judges are receiving substantial money payments from the county [01:25:01.600 --> 01:25:09.600] And plaintiff believes the payments create an absolute conflict and a violation of 18 U.S.D. 1341 [01:25:10.600 --> 01:25:17.600] And you know, plaintiff has been subjected to ongoing retaliation for exposing the payments to the judges and demanding disqualification for cause [01:25:17.600 --> 01:25:30.600] And then I say, you know, the violations 1st, 4th, 5th, 6th, 7th, 13th, and 14th Amendments, you know, and of course, 42 U.S.D., 1983, 85, 1991 [01:25:30.600 --> 01:25:48.600] Okay, and then, let's see, it goes on because I'll just go, the relief I'm asking for is, order the lower court to cease the case and dismiss all charges for denial of due process and or violation of PDT trial rights [01:25:49.600 --> 01:25:55.600] Or that almost 8 years is too long and is prejudiced to the accused [01:25:55.600 --> 01:26:15.600] You know what, and then I'm saying, actual damages of $5 million, tentative damages to be presented at trial, but an amount to cause change of what will be shown to be a custom and practice of all those involved [01:26:15.600 --> 01:26:28.600] Because like I told you, I'm not the only one, I'm the most severe, but I know of other cases in this county for merely exercising their people's First Amendment rights [01:26:29.600 --> 01:26:38.600] They've gone from having a home and everything else to actually living in a tent out in the streets [01:26:38.600 --> 01:26:57.600] And so I also want to shout out and congratulate the people that were on the show earlier tonight and enforcing their God-given rights to not be injected with experimental drugs [01:26:57.600 --> 01:27:08.600] And not accept to wear a mask where they're suffering oxygen deprivation plus all the saliva that's getting on that mask is turning into bacteria [01:27:09.600 --> 01:27:18.600] And so I also applaud those people. We need people, if you don't exercise your rights, you don't have any [01:27:18.600 --> 01:27:30.600] So that's a side thing, but now what will come of all this, I don't know, because the removal is the first part in federal court [01:27:31.600 --> 01:27:41.600] Now I go back to the state court, file a notice of removal, and it should stop the case because they lose jurisdiction [01:27:41.600 --> 01:27:54.600] It'll stop the case because in the matter of removal, you do not file a motion for removal, you actually remove the case [01:27:55.600 --> 01:27:56.600] Correct [01:27:57.600 --> 01:28:00.600] So when you file the notice of removal, it's removed [01:28:01.600 --> 01:28:02.600] Correct [01:28:02.600 --> 01:28:11.600] In a major case in North Carolina, this black guy went into a white bar and wound up killing somebody and they prosecuted him, found him guilty [01:28:12.600 --> 01:28:18.600] Well, in the process, he filed a federal action and a notice of removal [01:28:19.600 --> 01:28:25.600] Well, the state court already had a jury picked and they went on with the trial anyway and found him guilty [01:28:26.600 --> 01:28:29.600] Found him incredibly guilty [01:28:29.600 --> 01:28:38.600] But the feds threw out the whole thing because when the removal was filed, the court lost jurisdiction that day [01:28:39.600 --> 01:28:51.600] So they had to try him a second time, it got to the same outcome, but they had to retry the case because removal eliminates jurisdiction when it's filed [01:28:51.600 --> 01:29:03.600] Well, there are some caveats to that, Randy. I did not pay the filing fee, I put in a fee waiver request [01:29:04.600 --> 01:29:17.600] And they've got some new policies and one of them was, as I was leaving with all my papers, the clerk said, oh, don't serve the other side until you get the judges ruling on your fee waiver [01:29:17.600 --> 01:29:39.600] And so they can try to say that it's not fair because if they deny the fee waiver, also because they have some rules, not laws, that if the magistrate sees your complaint as frivolous, then because you're on a fee waiver [01:29:39.600 --> 01:29:46.600] But no, no, that's going to be iffy because it's removed until you're just doing, oh, that's right, you don't have the fee yet [01:29:46.600 --> 01:30:09.600] Hang on, you might be right, Randy Kelton, Brett Fountain, we'll be right back [01:30:16.600 --> 01:30:21.600] Privacy is under attack. 01:34:22.600] I was falsely arrested, I was screamed at by a public defender, why don't you have another heart attack and die [01:34:22.600 --> 01:34:31.600] I've had more than 20 defense lawyers look at the charges and all have told me it is a legal impossibility and what is alleged is not a crime [01:34:32.600 --> 01:34:43.600] Just weeks after my first heart attack, the court ordered me to appear for a hearing against doctor's orders and doctor's letter included that I was subject to sudden death in the letter [01:34:43.600 --> 01:34:54.600] I began to have another heart attack in the courtroom, the paramedics were called, the judge continued to conduct the hearing and badger me until paramedics entered the building [01:34:55.600 --> 01:35:07.600] At that point she left the bench, ran out of the courtroom, the paramedics transferred me to emergency, my blood pressure was 200 over 136, I believe this was an act of brave heart attempted murder [01:35:07.600 --> 01:35:16.600] So there's other things I've written in here and like you suggested in the past Randy, when you do a pleading you want to say things [01:35:17.600 --> 01:35:26.600] You want to say in the beginning and the middle and the end the same thing over and over and what is in the beginning and the middle and the end is that it's been eight years [01:35:26.600 --> 01:35:44.600] And so that should get the magistrate's attention that is warranted that this is not frivolous, a blatant violation of civil rights and won't dismiss it out of hand [01:35:45.600 --> 01:35:52.600] Yeah, I don't think they will, this is too outrageous [01:35:52.600 --> 01:36:06.600] And so where we're at is on Monday at 9 a.m. I'm to appear at the Superior Court, the Hall of Justice for a commencement of a criminal trial [01:36:06.600 --> 01:36:29.600] I also not only named the lawyer that's been forced on me in this federal civil rights lawsuit but a couple weeks ago I mentioned and I filed a small claim lawsuit naming him and the United States and the claim is perjury of oath [01:36:29.600 --> 01:36:48.600] And I've served Garland, the attorney general and this process we learned about is expected that the attorney general will remove the case to federal court [01:36:48.600 --> 01:37:03.600] But where if this fails I also have the small claims lawsuit against the lawyer so he can't represent me plus all the bar complaint [01:37:04.600 --> 01:37:11.600] Which I'm going to try to file into the case over the weekend because I have the ability to electronically file into the case [01:37:11.600 --> 01:37:21.600] And remember Judge Nishigaya is saying that I can't file things into the case because I'm represented by a lawyer [01:37:21.600 --> 01:37:44.600] And they take, the client tries to take that as a blanket thing and like I've told them before, no, no, no, if I'm filing mandatory judicial notice evidence or if I'm filing a removal or something like that and there were some other things, no, no, no, don't you dare [01:37:44.600 --> 01:37:50.600] Oh, oh wait a minute, file a notice of removal [01:37:51.600 --> 01:37:54.600] Oh don't worry Randy, that's what I'm saying [01:37:55.600 --> 01:38:03.600] They're going to have to say, they're going to have to research it and they're going to, when you file the notice of removal it's removed [01:38:03.600 --> 01:38:14.600] They're going to have to go to the federal court and say wait a minute, wait a minute, this is not removed, this guy's not properly filed, he's not properly in the federal court but they have to get it remanded back [01:38:14.600 --> 01:38:34.600] I got that and here's the deal, I've got the documents right here so the next part of this process is I take back to the state court and they were, the state court was closed today, we're now celebrating an indigent holiday of some sort at the state level [01:38:34.600 --> 01:38:55.600] So not indigent, I mean the Indians and so that's a new holiday so the state court was closed today and they close at noon today anyway, they're hardly open anymore but the point is now, I now file into the state court case and I'll do it Monday morning before I go into the courtroom [01:38:55.600 --> 01:39:11.600] I'm going to go into the clerk's office and file the notice of removal along with a copy of the removal so yes, the clerk will enter into the docket that the case is removed [01:39:12.600 --> 01:39:23.600] That should put the skids on them until they can get it remanded or get a judge to say it wasn't actually removed but in the meantime they're stuck [01:51:29.600 --> 01:51:32.600] I'll say that again, I missed part of it [01:51:33.600 --> 01:51:39.600] How are the ones who are compiling these numbers determining that these deaths are Vax-related? [01:51:39.600 --> 01:51:57.600] Well, when a person, first of all, when a person goes to an athlete who's in the peak of health, goes to the vaccine, gets the vaccine, and from one day to one or two weeks later drops dead from a heart attack [01:51:58.600 --> 01:52:02.600] Now, that, you have to be careful [01:52:03.600 --> 01:52:04.600] That doesn't prove anything [01:52:05.600 --> 01:52:07.600] He could have died from galloping fungi [01:52:07.600 --> 01:52:09.600] You know, you don't know [01:52:10.600 --> 01:52:13.600] But the numbers are very consistent [01:52:14.600 --> 01:52:24.600] And when you see something that's been happening like has been happening, and there are doctors who slough it off, they don't want to get involved in it, and I don't blame them [01:52:25.600 --> 01:52:32.600] Their license is hanging in the balance, and doctors have been coerced and manipulated and bossed around and threatened [01:52:32.600 --> 01:52:36.600] Because there are some that are not afraid of telling the truth [01:52:37.600 --> 01:52:49.600] And when you see the number, when the funeral directors, they tell you that the overall deaths from 19 to age 64 have gone up by 40 percent [01:52:50.600 --> 01:52:52.600] It warrants further study [01:52:53.600 --> 01:52:58.600] And now there's enough numbers in, you don't got to study it anymore [01:52:58.600 --> 01:53:01.600] You see it right in front of your face [01:53:02.600 --> 01:53:08.600] Okay, that is a little of a problem that's mostly conjecture [01:53:09.600 --> 01:53:13.600] And it would be nice if we had something more definitive [01:53:14.600 --> 01:53:21.600] But again, that's kind of the nature of this poison, is it tends to affect a lot of people differently [01:53:21.600 --> 01:53:30.600] So there are all of this different symptoms that they lead to the same results, and it tends to be death [01:53:31.600 --> 01:53:39.600] I was listening to a program that was on public radio, which I seldom listen to anymore [01:53:40.600 --> 01:53:46.600] And they were talking, this was someone who built prosthetic legs, prosthetics [01:53:46.600 --> 01:53:54.600] And they said this right at the end of the program, and I think the censors missed it [01:53:55.600 --> 01:54:06.600] They indicated that they were getting a lot more call for prosthetics from young people due to COVID-19 related blood clots [01:54:07.600 --> 01:54:10.600] Yeah, well [01:54:10.600 --> 01:54:22.600] Somehow the censors missed that part, we've got an article about a guitarist who got the shot and lost nine fingers to blood clots [01:54:23.600 --> 01:54:29.600] Yeah, well did you know that the blood clots have been as long as three feet and in a few cases six feet long [01:54:30.600 --> 01:54:38.600] And they're not the usual blood clots, they seem, if I remember correctly, they are made out of an amyloid protein [01:54:38.600 --> 01:54:47.600] Something, amyloid something, and they're like plastic, they're like, what do they call that?
