[00:00.000 --> 00:05.800] The Bill of Rights contains the first ten amendments of our Constitution. [00:05.800 --> 00:09.460] They guarantee the specific freedoms Americans should know and protect. [00:09.460 --> 00:10.880] Our liberty depends on it. [00:10.880 --> 00:14.860] I'm Dr. Catherine Albrecht, and I'll be right back with an unforgettable way to remember [00:14.860 --> 00:16.960] your First Amendment rights. [00:16.960 --> 00:18.560] Privacy is under attack. [00:18.560 --> 00:22.160] When you give up data about yourself, you'll never get it back again. [00:22.160 --> 00:26.920] And once your privacy is gone, you'll find your freedoms will start to vanish, too. [00:26.920 --> 00:32.000] So protect your rights, say no to surveillance, and keep your information to yourself. [00:32.000 --> 00:33.000] Privacy. [00:33.000 --> 00:34.680] It's worth hanging on to. [00:34.680 --> 00:38.960] This public service announcement is brought to you by Startpage.com, the private search [00:38.960 --> 00:42.520] engine alternative to Google, Yahoo, and Bing. [00:42.520 --> 00:44.520] Start over with Startpage. [00:44.520 --> 00:45.520] Spar. [00:45.520 --> 00:47.800] It's what fighters do. [00:47.800 --> 00:50.840] It's also how I remember the five guarantees of the First Amendment. [00:50.840 --> 00:54.520] If you plan to take away my rights, I'm going to spar with you. [00:54.520 --> 00:56.080] S-P-A-R with an extra P. [00:56.080 --> 01:03.080] S for speech, P for press, another P for petition, A for assembly, and R for religion. [01:03.080 --> 01:07.040] Most Americans are familiar with the First Amendment guarantees of free speech, press, [01:07.040 --> 01:10.440] assembly, and religion, but petition for redress is another matter. [01:10.440 --> 01:14.600] We have the right to petition the government for a redress of grievances. [01:14.600 --> 01:18.120] It means that if we're unhappy with what's going on in our government, we can spell out [01:18.120 --> 01:20.840] the reasons without fear of being thrown into jail. [01:20.840 --> 01:22.720] I'm Dr. Catherine Albrecht. [01:22.720 --> 01:31.080] More news and information at CatherineAlbrecht.com. [01:31.080 --> 01:34.720] The Bill of Rights contains the first ten amendments of our Constitution. [01:34.720 --> 01:38.200] They guarantee the specific freedoms Americans should know and protect. [01:38.200 --> 01:39.680] Our liberty depends on it. [01:39.680 --> 01:43.560] I'm Dr. Catherine Albrecht, and I'll be right back with an unforgettable way to remember [01:43.560 --> 01:46.680] one of your constitutional rights. [01:46.680 --> 01:48.280] Privacy is under attack. [01:48.280 --> 01:51.880] When you give up data about yourself, you'll never get it back again. [01:51.880 --> 01:56.680] And once your privacy is gone, you'll find your freedoms will start to vanish, too. [01:56.680 --> 02:01.680] So protect your rights, say no to surveillance, and keep your information to yourself. [02:01.680 --> 02:04.440] Privacy, it's worth hanging on to. [02:04.440 --> 02:08.720] This public service announcement is brought to you by StartPage.com, the private search [02:08.720 --> 02:12.280] engine alternative to Google, Yahoo, and Bing. [02:12.280 --> 02:15.840] Start over with StartPage. [02:15.840 --> 02:20.200] When I think of the Second Amendment, I visualize myself wrapping my two arms around the Bill [02:20.200 --> 02:22.280] of Rights in a big old bear hug. [02:22.280 --> 02:26.840] It's how I remember that the Second Amendment guarantees us the right to bear arms, arms [02:26.840 --> 02:30.640] that embrace our freedoms and won't let anyone take them away without a fight. [02:30.640 --> 02:31.640] Get it? [02:31.640 --> 02:33.920] Two arms, bear hug, bear arms? [02:33.920 --> 02:37.520] The late Senator Hubert Humphrey captured the spirit of the Second Amendment so well [02:37.520 --> 02:43.280] when he said, the right of the citizens to bear arms is just one guarantee against arbitrary [02:43.280 --> 02:47.400] government, one more safeguard against the tyranny, which now appears remote in America, [02:47.400 --> 02:50.440] but which historically has proved to always be possible. [02:50.440 --> 02:52.440] I'm Dr. Catherine Albrecht. [02:52.440 --> 03:18.600] More news and information at CatherineAlbrecht.com. [03:18.600 --> 03:29.240] Go to CatherineAlbrecht.com. [03:29.240 --> 03:34.240] Not later, we are originators [03:34.240 --> 03:39.240] And the pathway seems to get straighter every day [03:39.240 --> 03:43.240] And I can take anything that belongs to me [03:43.240 --> 03:46.240] And put it to good use [03:46.240 --> 03:49.240] Well, I was good for the gander [03:49.240 --> 03:53.240] Gonna work for the fools [03:53.240 --> 03:57.240] I know some architects [03:57.240 --> 04:01.240] I know some engineers [04:01.240 --> 04:04.240] They see me every day [04:04.240 --> 04:08.240] They know certain things quick [04:08.240 --> 04:11.240] What's up with the blatant deception? [04:11.240 --> 04:15.240] What is the nature of what you might gain? [04:15.240 --> 04:18.240] I see something headed straight for you [04:18.240 --> 04:23.240] I think it looks just like a train [04:23.240 --> 04:26.240] It smells like a sham or something [04:26.240 --> 04:30.240] I can see them playing fast and loose [04:30.240 --> 04:33.240] Well, I was good for the gander [04:33.240 --> 04:38.240] Gonna work for the fools [04:38.240 --> 04:41.240] Oh, oh, we're back, this is bad [04:41.240 --> 04:46.240] It's the top of the hour and Brett wouldn't remind me of what the day and the time was [04:46.240 --> 04:49.240] I'm gonna have to figure that out myself [04:49.240 --> 04:52.240] And at my advanced age [04:52.240 --> 04:59.240] I tried to tell him October earlier and he didn't appreciate that, so now why tell him I just let him figure it out [04:59.240 --> 05:02.240] Okay, it is [05:02.240 --> 05:06.240] August the 26th, 2022 [05:06.240 --> 05:11.240] Our Friday, our four hour info marathon [05:11.240 --> 05:16.240] And when we went out we were talking to [05:16.240 --> 05:19.240] Grace about [05:19.240 --> 05:22.240] How to do case law research, it's not so hard [05:22.240 --> 05:27.240] It used to be difficult, it used to be really complicated, it's not so hard anymore [05:27.240 --> 05:35.240] Just go on Google and put in a search for case law [05:35.240 --> 05:38.240] Family law [05:38.240 --> 05:41.240] Injunction [05:41.240 --> 05:47.240] And don't look so much for specific cases, but look for lawyer sites [05:47.240 --> 05:49.240] That talk about it [05:49.240 --> 05:55.240] And you click on the lawyer site and often you will find a treatise on the subject [05:55.240 --> 06:01.240] They want to tell other lawyers how knowledgeable they are in this particular area [06:01.240 --> 06:10.240] So if you have a case and it goes to this area rather than you try to figure out how to argue that yourself [06:10.240 --> 06:13.240] Just bring me into the case [06:13.240 --> 06:17.240] As another lawyer in the case and I'll argue that for you [06:17.240 --> 06:23.240] So that's how they get their business, but they also give you all the information you need [06:23.240 --> 06:31.240] If you are writing all of your pleadings yourself, you're not doing enough homework [06:31.240 --> 06:36.240] If you're not plagiarizing, you haven't done enough homework [06:36.240 --> 06:44.240] I look for the section that tells what I want the court to hear and I just copy that out and paste it in [06:44.240 --> 06:46.240] Does that sound doable? [06:46.240 --> 06:57.240] Yeah, I'll have to practice the etiquette and stuff in court [06:57.240 --> 07:04.240] I'm listening to your voice and to your character, you're not going to have a problem with etiquette in court [07:04.240 --> 07:11.240] There are no special rules, dignity and respect for everyone in court [07:11.240 --> 07:13.240] That's the rules [07:13.240 --> 07:18.240] If you act with dignity and respect, you're going to get it [07:18.240 --> 07:23.240] And the other lawyer can act without dignity and respect and it will just harm him [07:23.240 --> 07:33.240] You can ask the judge anything you want to so long as you do it with respect [07:33.240 --> 07:39.240] He will answer you or he will not and if he doesn't, he'll tell you why he can't answer you [07:39.240 --> 07:43.240] But this is not some big contest [07:43.240 --> 07:48.240] This is the judge trying to figure out what your issue is [07:48.240 --> 07:52.240] Trying to figure out what the opposing side's issue is [07:52.240 --> 08:01.240] And find a civil remedy that will serve both parties as best as possible [08:01.240 --> 08:04.240] And there's no magic key [08:04.240 --> 08:11.240] The primary thing you must have walking in the door is dignity and respect [08:11.240 --> 08:15.240] And that just flows out of your voice and your style [08:15.240 --> 08:18.240] You're not going to have much problem with that [08:18.240 --> 08:21.240] Ask any question you want to [08:21.240 --> 08:24.240] Don't worry about it [08:24.240 --> 08:27.240] And if you're polite with the judge [08:27.240 --> 08:31.240] I had a hearing yesterday and I was polite with the judge [08:31.240 --> 08:36.240] But I did warn him that if he didn't let everybody who was logged in listen to the case [08:36.240 --> 08:38.240] I'd consider it a criminal act [08:38.240 --> 08:40.240] But he never took that personally [08:40.240 --> 08:45.240] Because I was pleasant and polite [08:45.240 --> 08:51.240] I was never argumentative or if I was angry he could not tell [08:51.240 --> 08:54.240] I don't know [08:54.240 --> 08:55.240] Go ahead [08:55.240 --> 09:00.240] I realized he was kind of giving me hints on what I needed moving forward [09:00.240 --> 09:05.240] Kind of was like the, to get a protective order [09:05.240 --> 09:11.240] He's kind of hinting that I need more evidence to show he's a danger to me and especially the children [09:11.240 --> 09:13.240] Yeah, they do that [09:13.240 --> 09:16.240] And sometimes people take it personally when they do that [09:16.240 --> 09:19.240] They think, well, what do you mean? I've got all the evidence [09:19.240 --> 09:21.240] But he's actually, he is helping you [09:21.240 --> 09:24.240] That's good that you're taking it that way [09:24.240 --> 09:29.240] Yes, and Martichet was going to call in tonight, I wish he had of [09:29.240 --> 09:33.240] Martichet is an excellent example of that [09:33.240 --> 09:38.240] He filed a federal lawsuit and the judge dismissed his lawsuit [09:38.240 --> 09:40.240] And he was furious [09:40.240 --> 09:44.240] And I said, Martichet, read the judgment [09:44.240 --> 09:48.240] And in a federal case there's always a order and a judgment [09:48.240 --> 09:52.240] And the judgment is effectively finding the fact and conclusions at law [09:52.240 --> 09:57.240] It's the judge saying, this is why I came to the decision I did [09:57.240 --> 10:00.240] Read it carefully [10:00.240 --> 10:03.240] Because generally what the judge wants [10:03.240 --> 10:09.240] Is he wants both sides to bring him their best argument and issue [10:09.240 --> 10:15.240] And then he will compare the two and use his heightened knowledge [10:15.240 --> 10:23.240] To find the most reasonable and the most effective remedy for both parties [10:23.240 --> 10:28.240] So in order to get that, more so in the Fed and the state [10:28.240 --> 10:32.240] Is they will tell you exactly what you need [10:32.240 --> 10:37.240] And he read the document and the judge told him exactly what was wrong with his case [10:37.240 --> 10:40.240] And what he needed to do to fix it [10:40.240 --> 10:44.240] And that was okay because he did the same thing to the other side [10:44.240 --> 10:47.240] So he's even [10:47.240 --> 10:51.240] And after that, when Martichet returned [10:51.240 --> 10:57.240] I told him to tell the judge that the judge's criticisms are well taken [10:57.240 --> 10:59.240] And he did that [10:59.240 --> 11:02.240] And they dismissed his case again [11:02.240 --> 11:04.240] But when they dismissed his case [11:04.240 --> 11:08.240] They referenced the fact that he said that their arguments were well taken [11:08.240 --> 11:11.240] That their criticisms were well taken [11:11.240 --> 11:17.240] And he hoped that these would be as well taken [11:17.240 --> 11:20.240] So they're telling him, yes, they paid attention to that [11:20.240 --> 11:27.240] And they appreciated the fact that he indicated to the judge that he respected their position [11:27.240 --> 11:31.240] And they gave him really good advice [11:31.240 --> 11:35.240] And the judge will do that for you [11:35.240 --> 11:40.240] So long as you give him the impression that the most important thing to you [11:40.240 --> 11:44.240] Are those children [11:44.240 --> 11:48.240] As long as he thinks you're only concerned as those children [11:48.240 --> 11:51.240] And you're only concerned about your situation [11:51.240 --> 11:53.240] Just so that you can take care of the children [11:53.240 --> 11:57.240] You're very likely to get what you want [11:57.240 --> 12:01.240] All right, okay [12:01.240 --> 12:04.240] All right, another question [12:04.240 --> 12:07.240] I believe I caught my husband lying under oath [12:07.240 --> 12:10.240] So after he assaulted me [12:10.240 --> 12:15.240] Like 12 hours later he purchased a gun [12:15.240 --> 12:19.240] The judge asked him about the gun [12:19.240 --> 12:23.240] And he said he returned it to the store [12:23.240 --> 12:26.240] Well, according to the return policy [12:26.240 --> 12:28.240] All gun sales are final [12:28.240 --> 12:30.240] No returns are allowed [12:30.240 --> 12:33.240] Go to the store [12:33.240 --> 12:36.240] And get that from the store [12:36.240 --> 12:39.240] That is a big deal [12:39.240 --> 12:41.240] That's a really, really big deal [12:41.240 --> 12:48.240] That is not something that you are at liberty to let go [12:48.240 --> 12:51.240] That's way, way, way too dangerous [12:51.240 --> 12:57.240] There are things I'm going to say, well, yeah, but let's not nitpick [12:57.240 --> 13:02.240] But if he purchased a gun after he beat you up [13:02.240 --> 13:05.240] And then told the judge that he took it back [13:05.240 --> 13:10.240] And didn't, that is a big deal [13:10.240 --> 13:13.240] Now that's your life [13:13.240 --> 13:15.240] I would be very, very concerned [13:15.240 --> 13:19.240] And I suspect the judge is going to be just as concerned [13:19.240 --> 13:24.240] I have the credit card charged [13:24.240 --> 13:29.240] Nothing was returned on that credit card [13:29.240 --> 13:34.240] Get that in writing from the store [13:34.240 --> 13:36.240] So that you can present that in court [13:36.240 --> 13:40.240] It's not presentable unless you get it from the store and verified [13:40.240 --> 13:42.240] The return policy? [13:42.240 --> 13:45.240] Yes, not just the return policy [13:45.240 --> 13:49.240] But ask the store to look at it [13:49.240 --> 13:53.240] You know, this is your husband's account [13:53.240 --> 13:57.240] And you think that he returned the gun and kept the money [13:57.240 --> 13:59.240] He was supposed to give me that money back [13:59.240 --> 14:01.240] Did he really bring that back? [14:01.240 --> 14:04.240] Okay, it's okay to fib to him a little bit [14:04.240 --> 14:07.240] But get him to tell you whether he actually brought it back [14:07.240 --> 14:11.240] And, you know, he might have talked him into taking it back [14:11.240 --> 14:16.240] You don't want to bring this issue up unless you conclude that you're correct [14:16.240 --> 14:20.240] But absolutely do that [14:20.240 --> 14:23.240] That will really get the judge's attention [14:23.240 --> 14:28.240] And he's likely to land on your husband like a ton of bricks [14:28.240 --> 14:33.240] Judges do not like to be lied to [14:33.240 --> 14:37.240] They take that personal [14:37.240 --> 14:43.240] Yes, that is very concerning [14:43.240 --> 14:47.240] Because that would mean he probably still has the weapon [14:47.240 --> 14:50.240] He's not supposed to have [14:50.240 --> 14:56.240] How is your relationship with the local police? [14:56.240 --> 15:00.240] The police asked both of them [15:00.240 --> 15:03.240] Let me tell you, police are not the bad guys [15:03.240 --> 15:06.240] We've got some bad apples out there, a couple of them [15:06.240 --> 15:08.240] But police mostly want to be good guys [15:08.240 --> 15:11.240] And if you go to the police [15:11.240 --> 15:16.240] And tell them that your husband beat you up and then he bought this pistol [15:16.240 --> 15:18.240] And he told the judge that he returned it [15:18.240 --> 15:25.240] But you don't think he did because the store doesn't have a return policy [15:25.240 --> 15:30.240] You can ask them to check the store and see if he actually returned it [15:30.240 --> 15:35.240] You don't tell the cops that you didn't get your money back on the credit card [15:35.240 --> 15:41.240] Tell them you're afraid for yourself and your children [15:41.240 --> 15:45.240] And you're going to find people there that are human just like the rest of us [15:45.240 --> 15:50.240] Especially the police are not going to want this guy to [15:50.240 --> 15:56.240] They're not going to want to read next month that this guy came in and shot you and your children [15:56.240 --> 15:58.240] They're not going to want that on their conscience [15:58.240 --> 16:02.240] Very likely they will pick up the phone right there and call the place [16:02.240 --> 16:05.240] And ask them to check and verify [16:05.240 --> 16:08.240] You can get that handled [16:08.240 --> 16:14.240] I did speak to one of the deputies who helped me out [16:14.240 --> 16:21.240] And so they told me to talk to the court coordinator [16:21.240 --> 16:24.240] And the DA or my investigator [16:24.240 --> 16:30.240] So I'm only waiting to try to get the truth out [16:30.240 --> 16:36.240] Then talk to the DA and ask the DA if he could send an officer out [16:36.240 --> 16:41.240] Just have one of his investigators call that place [16:41.240 --> 16:46.240] And see if in fact he did return that pistol like he said he did [16:46.240 --> 16:48.240] And very likely he'll do that [16:48.240 --> 16:50.240] That's not hard for him to do [16:50.240 --> 16:53.240] And he's not going to want someone to say [16:53.240 --> 16:56.240] Well she went to the DA and asked him to check [16:56.240 --> 16:59.240] And he refused and subsequently this issue occurred [16:59.240 --> 17:04.240] Are you being harassed by debt collectors with phone calls, letters or even lawsuits? [21:01.240 --> 21:03.240] No, go for it, go figure that out [21:03.240 --> 21:04.240] Okay [21:04.240 --> 21:08.240] Some things you can't wait for [21:08.240 --> 21:12.240] And if he said he gave that gun back and he didn't [21:12.240 --> 21:21.240] That is a level of deception that will tighten every angle sphincter in the place [21:21.240 --> 21:24.240] Is that criminal? [21:24.240 --> 21:26.240] Yes [21:26.240 --> 21:29.240] I think generally the courts don't like to [21:29.240 --> 21:35.240] You know, if somebody comes in and they feel about a little minor thing that's not relevant [21:35.240 --> 21:44.240] And actually whether he has that gun or not is not especially material to the case itself [21:44.240 --> 21:47.240] But it creates a level of threat [21:47.240 --> 21:55.240] Now you've accused him of beating you up and that shows a lack of self control on part of his person [21:55.240 --> 22:01.240] And then you've alleged that he purchased the gun and he's essentially admitted that [22:01.240 --> 22:04.240] But he claimed he brought it back [22:04.240 --> 22:14.240] If he lied about something that material, that is a really, really big deal [22:14.240 --> 22:19.240] That's the point where everybody slams on the brakes and says, whoa! [22:19.240 --> 22:20.240] Yeah [22:20.240 --> 22:23.240] No, we can't pass this [22:23.240 --> 22:27.240] Yeah, and it's not like he just bought a really expensive fishing rod [22:27.240 --> 22:29.240] And maybe he took it back, maybe he didn't [22:29.240 --> 22:35.240] This is a weapon, so it stands out for everybody [22:35.240 --> 22:39.240] You know, heavier [22:39.240 --> 22:44.240] So I would definitely, just for your sake and the sake of the children [22:44.240 --> 22:47.240] Find out for certain and talk to the DA [22:47.240 --> 22:49.240] They will do that [22:49.240 --> 22:52.240] They've got investigators for that kind of thing [22:52.240 --> 22:57.240] You know, we do this show and mostly we speak to the church of the malcontents [22:57.240 --> 22:59.240] People want to fight with these guys [22:59.240 --> 23:02.240] They figure the only way to deal with them is to fight with them [23:02.240 --> 23:04.240] And a lot of times that's the case [23:04.240 --> 23:08.240] And frankly, Brett and I have gotten really good at fighting that with them [23:08.240 --> 23:12.240] But you don't always have to fight [23:12.240 --> 23:17.240] I go in and pick fights where a fight is needed [23:17.240 --> 23:25.240] And in the process of that, I avoid fights I could have that I don't need to have that aren't important [23:25.240 --> 23:27.240] And there's a lot of things that aren't important [23:27.240 --> 23:31.240] This is not one of them [23:31.240 --> 23:36.240] This is a everybody slams on the brakes kind of an issue [23:36.240 --> 23:42.240] And I'm relatively certain you relay this to the police and the prosecutor [23:42.240 --> 23:45.240] And they're going to say the same thing [23:45.240 --> 23:49.240] The last thing they want to happen is to have to come down there [23:49.240 --> 23:53.240] And investigate the death of you or one of your children [23:53.240 --> 23:55.240] That they're not going to want to happen [23:55.240 --> 23:59.240] And they will go to great lengths to make sure that doesn't happen [23:59.240 --> 24:02.240] So absolutely do that [24:02.240 --> 24:05.240] Yeah, I think tomorrow he's expecting [24:05.240 --> 24:08.240] He doesn't know how to work either [24:08.240 --> 24:11.240] So I think tomorrow he's expecting to see the kids [24:11.240 --> 24:17.240] He doesn't realize the judge, we haven't signed off on the orders [24:17.240 --> 24:22.240] But I'm going to not communicate [24:22.240 --> 24:26.240] The best thing you can do is not communicate [24:26.240 --> 24:30.240] You know, in going after public officials [24:30.240 --> 24:34.240] That's one of the most powerful tools I've found [24:34.240 --> 24:37.240] Is to say nothing [24:37.240 --> 24:43.240] When I went to a judge and I asked him to issue some warrants and he refused [24:43.240 --> 24:46.240] He turned and walked out [24:46.240 --> 24:49.240] I didn't want to talk to him anymore, we're done [24:49.240 --> 24:54.240] Anything I said to him would make things worse [24:54.240 --> 24:58.240] And you know, they say you have a right to remain silent [24:58.240 --> 25:02.240] And there's a lot of wisdom in that [25:02.240 --> 25:08.240] If you do not know exactly what to say and exactly why you're saying it [25:08.240 --> 25:11.240] Just shut up [25:11.240 --> 25:18.240] No matter how much you want to let the other side know how to cow ate the cabbage [25:18.240 --> 25:23.240] Just shut up, because what happens is [25:23.240 --> 25:27.240] What you don't tell them they imagine [25:27.240 --> 25:33.240] And they will always imagine something much worse than what you tell them [25:33.240 --> 25:36.240] It's just the way that human beings work [25:36.240 --> 25:40.240] And the fact that you're not telling them [25:40.240 --> 25:43.240] Makes them even more concerned [25:43.240 --> 25:50.240] So only speak if you have very good reason to speak [25:50.240 --> 25:54.240] Otherwise, everything goes in writing [25:54.240 --> 25:57.240] Yes, yes [25:57.240 --> 25:59.240] And this is what I suggest [25:59.240 --> 26:05.240] I suggest you craft a letter to the Sheriff's Department [26:05.240 --> 26:10.240] And take it to them and sign it, give it to them [26:10.240 --> 26:15.240] And ask just not you moving your mouth and making sounds in the air [26:15.240 --> 26:21.240] Now it's a hard physical document that will have evidence behind it [26:21.240 --> 26:26.240] Even better if you can email it to them as well [26:26.240 --> 26:29.240] Give it to them hard copy and email [26:29.240 --> 26:37.240] Email is good because it leaves traces that's almost impossible to erase [26:37.240 --> 26:40.240] But this needs to be in front of them in an official way [26:40.240 --> 26:46.240] So that you invoke their official authority [26:46.240 --> 26:51.240] You go to the DA or to the Sheriff and say [26:51.240 --> 26:57.240] I have reason to believe this guy lied to the court [26:57.240 --> 27:00.240] That invokes their duty [27:00.240 --> 27:05.240] Now you're alleging an act of aggravated perjury [27:05.240 --> 27:08.240] And that authorizes them to take the next action [27:08.240 --> 27:14.240] So they're not just playing favorites or doing stuff because they want to [27:14.240 --> 27:17.240] And best if you give it to them in writing [27:17.240 --> 27:19.240] Now they can show this is why [27:19.240 --> 27:23.240] If anybody asks, this is why I did that [27:23.240 --> 27:25.240] Does that make sense? [27:25.240 --> 27:27.240] Yes [27:27.240 --> 27:32.240] Do that, you'll break him from lying to the judge [27:32.240 --> 27:36.240] Because if he lied to the judge and the judge finds out [27:36.240 --> 27:47.240] He is not going to be a happy camper [27:47.240 --> 27:52.240] And if that's the case, you need to get that stopped early [27:52.240 --> 27:54.240] And this should help [27:54.240 --> 28:02.240] Okay, you've done great. Give yourself a pat on the back [28:02.240 --> 28:03.240] Thank you [28:03.240 --> 28:10.240] And keep us up to date how this goes [28:10.240 --> 28:14.240] I do have another question [28:14.240 --> 28:17.240] So two and a half years, my dad was on hospice [28:17.240 --> 28:26.240] My bipolar sister from out of state who we hadn't seen in three or four years came [28:26.240 --> 28:33.240] Like right after he passed [28:33.240 --> 28:36.240] She alleged that I assaulted her and called the police [28:36.240 --> 28:40.240] So I have this [28:40.240 --> 28:45.240] They gave me a misdemeanor fee charge [28:45.240 --> 28:49.240] And nothing happened [28:49.240 --> 28:52.240] I got a lawyer paid in 500 bucks [28:52.240 --> 28:54.240] The lawyer retired [28:54.240 --> 28:58.240] I spoke to him like maybe like two weeks ago [28:58.240 --> 29:01.240] He hadn't received an update since then [29:01.240 --> 29:04.240] He ignores my voicemail [29:04.240 --> 29:07.240] Okay, send me an email about that [29:07.240 --> 29:08.240] Okay, all right [29:08.240 --> 29:14.240] I may be able to craft you something that'll make that go away [29:14.240 --> 29:15.240] All right, awesome [29:15.240 --> 29:27.240] Yeah, because that can help me get a police deal since the civil one didn't work [29:27.240 --> 29:29.240] Okay, I'm having a little trouble hearing that [29:29.240 --> 29:31.240] Brett, did you hear that? [29:31.240 --> 29:33.240] The battery went out in my hearing aid [29:33.240 --> 29:35.240] Oh, my goodness [29:35.240 --> 29:37.240] Well, that's okay. She stopped talking [29:37.240 --> 29:39.240] That's why you didn't hear the rest [29:39.240 --> 29:41.240] What? Grace, do you have anything else for us? [34:42.240 --> 34:55.240] Um, no, no. Yeah, I think that Mr. Kelton is holding the board right there, please yell [34:55.240 --> 35:02.240] Okay, I just wanted to say you have been very gracious [35:02.240 --> 35:08.240] And we're proud of you for dealing with all of this on three fronts and not falling apart [35:08.240 --> 35:17.240] You're maintaining your position and you're doing great, I know it's not easy [35:17.240 --> 35:23.240] It's, you know, it's been up and down for me [35:23.240 --> 35:29.240] It's been up and down some days, I feel like I just can't do it, but I get right back up [35:29.240 --> 35:32.240] And I do it because I have to [35:32.240 --> 35:40.240] It's been super, it's been really empowering being, I guess, in that relationship [35:40.240 --> 35:45.240] Being in an abusive relationship like that for years [35:45.240 --> 35:56.240] And being groomed and not realizing it to realizing my worth and my potential [35:56.240 --> 36:03.240] Because I did not picture myself doing this beginning of this year [36:03.240 --> 36:07.240] Or even saying three months [36:07.240 --> 36:13.240] Send me an email, there's something else I'd like to address with you [36:13.240 --> 36:17.240] Send me an email at randyatrootoflawradio.com [36:17.240 --> 36:21.240] Have you ever read my rubber ball theory? [36:21.240 --> 36:23.240] I haven't [36:23.240 --> 36:32.240] You need to read it, send me an email, I'll send it to you and I'll explain to you why I want you to read it [36:32.240 --> 36:37.240] We only grow stronger by adversity [36:37.240 --> 36:42.240] I'm 73 years old, I look back at my history [36:42.240 --> 36:52.240] And the only times that stand out are not the times when things were going well, when life was easy [36:52.240 --> 37:00.240] The things that marked my life were the periods of extreme difficulty [37:00.240 --> 37:07.240] Were the times when I had placed on me more than I thought I could bear [37:07.240 --> 37:14.240] I remember one time waking up in the hospital after a three-day coma [37:14.240 --> 37:20.240] And my business partner, the first person I spoke to, he said [37:20.240 --> 37:22.240] I have something to tell you [37:22.240 --> 37:25.240] I said, I'm not going to like this, am I? [37:25.240 --> 37:27.240] He said no [37:27.240 --> 37:34.240] He said, you know the money you gave me to purchase insurance on that truck you wrecked with? [37:34.240 --> 37:36.240] Yeah? [37:36.240 --> 37:41.240] Well, I didn't get insurance [37:41.240 --> 37:43.240] And it went downhill from there [37:43.240 --> 37:48.240] At the time I was in traction, I had a leg exploded around the steering wheel [37:48.240 --> 37:51.240] I was in a heck of a mess [37:51.240 --> 37:56.240] And I lost everything, I had sold my business to him and lost everything [37:56.240 --> 38:00.240] He bankrupted and turned in all my equipment on his bankruptcy [38:00.240 --> 38:05.240] So here I was, completely bankrupt, crippled [38:05.240 --> 38:08.240] I was a mess, I had a couple of kids, wife and a couple of kids to take care of [38:08.240 --> 38:11.240] It was a horrible mess [38:11.240 --> 38:15.240] Now here I am some 40 years later [38:15.240 --> 38:22.240] Fat as a pig, I've never missed a meal [38:22.240 --> 38:25.240] Was that a wonderful experience? [38:25.240 --> 38:28.240] Of what? [38:28.240 --> 38:33.240] Whatever you think is bad, it can always get worse [38:33.240 --> 38:38.240] That was three days after I woke up on the side of the highway [38:38.240 --> 38:42.240] And some guy's asking me if I've been drinking and I'm trying to tell him no [38:42.240 --> 38:46.240] But when I tried to speak, it's like I fell down in this well [38:46.240 --> 38:49.240] And when I stopped trying to talk, I would rise back up [38:49.240 --> 38:53.240] And then I heard helicopter props and I thought, oh damn, I've been hit [38:53.240 --> 38:56.240] I'm thinking I'm back in Vietnam [38:56.240 --> 39:02.240] And I feel movement, I can't see and I can't hear but I can feel [39:02.240 --> 39:06.240] I'm sorry, I can't feel or see but I can hear and feel [39:06.240 --> 39:10.240] I feel hands on me and movement and I hear the helicopter props get louder [39:10.240 --> 39:15.240] And then I hear one guy say to the other, watch out for this one [39:15.240 --> 39:18.240] I don't think he's going to make it [39:18.240 --> 39:21.240] And I put 10 or 15 guys in one helicopter [39:21.240 --> 39:25.240] And we would slide them in in the blood on the bottom of the helicopter [39:25.240 --> 39:27.240] To just slide them in there [39:27.240 --> 39:34.240] And I remember as I could feel the helicopter rising off the LZ [39:34.240 --> 39:37.240] And I remember thinking, which one? [39:37.240 --> 39:41.240] Which one's not going to make it? [39:41.240 --> 39:44.240] And I got through all of that [39:44.240 --> 39:50.240] I went to Vietnam and it was really, really bad [39:50.240 --> 39:55.240] And even there I didn't miss a meal [39:55.240 --> 39:58.240] A couple with the Army were pretty crabby [39:58.240 --> 40:00.240] Cold fried chicken and pork and beans for breakfast [40:00.240 --> 40:06.240] But when I thought things were really bad, they weren't so bad [40:06.240 --> 40:08.240] I got through it [40:08.240 --> 40:19.240] And I only am what I am because of the steel against which I was able to grind myself [40:19.240 --> 40:24.240] Without that steel I would be nothing [40:24.240 --> 40:28.240] It's a great opportunity, don't waste it [40:28.240 --> 40:30.240] Send me an email, we need to talk [40:30.240 --> 40:34.240] I'll give you some really, really powerful tools [40:34.240 --> 40:37.240] Thank you, thank you for your service [40:37.240 --> 40:40.240] Oh, don't thank me for my service [40:40.240 --> 40:47.240] It was 30 years after before anyone thanked me for my service [40:47.240 --> 40:50.240] And it still stings me [40:50.240 --> 40:56.240] But that comes from being an old disgruntled vet [40:56.240 --> 41:01.240] My dad was a vet too [41:01.240 --> 41:04.240] Yeah, when I came back from Vietnam [41:04.240 --> 41:07.240] Really bad things happened before I came back [41:07.240 --> 41:09.240] Really bad [41:09.240 --> 41:14.240] And I hit SeaTac Airport at 1 o'clock in the morning after my brother passed away [41:14.240 --> 41:16.240] With 15 cents in my pocket [41:16.240 --> 41:19.240] And I'm trying to get back to Chicago [41:19.240 --> 41:27.240] Because I don't want my parents to see two guys in uniform walking up their sidewalk [41:27.240 --> 41:30.240] I wanted it to be me [41:30.240 --> 41:34.240] So I'm walking through the terminal at SeaTac Airport [41:34.240 --> 41:39.240] And this young woman is walking toward me with about three little kids [41:39.240 --> 41:43.240] I'm in jungle fatigue since I've been in for a couple of weeks [41:43.240 --> 41:47.240] They're soaked in blood and they're kind of ragged [41:47.240 --> 41:51.240] And I didn't realize at the time I smelled like the tropics [41:51.240 --> 41:54.240] The tropics just reek of mildew [41:54.240 --> 42:03.240] She saw me, pushed her children behind her, and moved over against the wall while I passed [42:03.240 --> 42:12.240] To this day, that is the absolute worst experience of my life [42:12.240 --> 42:16.240] After all I've been through [42:16.240 --> 42:24.240] After spending two weeks holding my twin brother's hand while he died of gangrene [42:24.240 --> 42:30.240] After watching these tiny little children die of horrible, horrible wounds [42:30.240 --> 42:35.240] Children that had nothing to do with the horror we created [42:35.240 --> 42:42.240] I come back and this woman feels like she has to protect her children from me [42:42.240 --> 42:47.240] Betrayal, there's nothing worse than betrayal [42:47.240 --> 42:50.240] Your husband turns against you [42:50.240 --> 42:55.240] There's nothing worse than betrayal [42:55.240 --> 43:00.240] But at the end of the day, it made me stronger [43:00.240 --> 43:06.240] And the term, you know, the saying that what doesn't kill you makes you stronger [43:06.240 --> 43:08.240] There's a whole lot to that [43:08.240 --> 43:13.240] I can hear it in your voice, I can hear it in your posture [43:13.240 --> 43:19.240] That for you this has been a growing experience and I will do everything I can to help you [43:19.240 --> 43:22.240] So send me an email, we'll talk [43:22.240 --> 43:24.240] Okay, all right, I'll do that [43:24.240 --> 43:26.240] Thank you, Grace [43:26.240 --> 43:32.240] Okay, we are going to EJ in California [43:32.240 --> 43:34.240] Wait a minute, do we have any first time callers? Randy Kelton, Brett Fountain, Weed Law Radio, and we're talking to E.J. in California [47:58.240 --> 48:03.240] Okay, E.J., what do you have for us today? [48:03.240 --> 48:16.240] Hi, my case management is coming up, so I need to complete a case management statement [48:16.240 --> 48:23.240] And the 15th day is on a Sunday, which is coming up this Sunday [48:23.240 --> 48:34.240] So the 15th day, I can safely file the next day after the 15th day [48:34.240 --> 48:39.240] Wait a minute, that doesn't make sense to me. The 15th day from what? [48:39.240 --> 48:43.240] Oh, from the case management hearing date, sorry [48:43.240 --> 48:48.240] Have you asked the court to order mediation? [48:48.240 --> 48:50.240] No, I have not [48:50.240 --> 48:58.240] I'm going to suggest it's probably time you do that. You're getting some things moving in your direction [48:58.240 --> 49:02.240] Now is a good time to ask the court for mediation [49:02.240 --> 49:11.240] Okay, I feel like the Scheister's don't want to do that. They just want to go directly to trial [49:11.240 --> 49:19.240] No, no, no, no, you've got to understand. The Scheister's do not dare try to mediate with a pro se litigant [49:19.240 --> 49:26.240] They may want to, but they would be embarrassed to do that [49:26.240 --> 49:31.240] What you need to do is give them plausible deniability [49:31.240 --> 49:37.240] You heard that I filed a 150 page criminal complaint against the governor in Texas [49:37.240 --> 49:45.240] And as soon as it went to the grand jury, he rescinded all of his executive orders, all at one time [49:45.240 --> 49:54.240] And I heard that and said, what the heck? There is no way that the grand jury would have indicted him [49:54.240 --> 49:59.240] There's no chance this was because I filed this complaint [49:59.240 --> 50:03.240] He was looking for an excuse [50:03.240 --> 50:13.240] He filed all these executive orders thinking it was his duty to protect everybody from this unprecedented apocalypse that was coming [50:13.240 --> 50:19.240] But it turned out it wasn't an apocalypse, and Joe Sixpack was not a happy camper [50:19.240 --> 50:24.240] And he was not going to vote for him when the next election came, so what do I do? [50:24.240 --> 50:28.240] He needed an excuse to get rid of all of these [50:28.240 --> 50:35.240] Well, I got some jack leg in Podunk, Texas who filed a 150 page criminal complaint against me [50:35.240 --> 50:38.240] That's a good enough excuse [50:38.240 --> 50:41.240] Give me an excuse [50:41.240 --> 50:45.240] These guys are fighting you, and you're beating them up, and you're a pro se [50:45.240 --> 50:51.240] They don't dare admit that a pro se is beating them up [50:51.240 --> 51:00.240] Unless you go to the court and have him order mediation, and they say, oh my goodness, Judge, I don't want to negotiate with this no good pro se [51:00.240 --> 51:02.240] The judge says, well, you have to [51:02.240 --> 51:08.240] And they say, whew, oh good, cut us off that dime [51:08.240 --> 51:10.240] Does that make sense? [51:10.240 --> 51:19.240] Yes, it makes perfect sense, but I feel like they just want to go to a jury trial because they know that I'm going to perish in that arena [51:19.240 --> 51:25.240] They're playing poker [51:25.240 --> 51:30.240] They will never show one slight iota of reluctance [51:30.240 --> 51:37.240] They're going to demonstrate that they are absolutely supremely confident [51:37.240 --> 51:38.240] That's what they do [51:38.240 --> 51:41.240] That's what they have to do [51:41.240 --> 51:42.240] They don't have any choice [51:42.240 --> 51:44.240] They may be trembling in their boots [51:44.240 --> 51:46.240] Have you been bark weaving them? [51:46.240 --> 51:49.240] They're probably pooping their pants [51:49.240 --> 51:53.240] And oh my goodness, she's going to screw us big time, but what can we do? [51:53.240 --> 51:55.240] We've got to keep up this front [51:55.240 --> 51:58.240] Otherwise, our client's going to come after us [51:58.240 --> 52:05.240] How are we going to justify billing our client if we don't think we can win this thing? [52:05.240 --> 52:07.240] So they have to put up this front [52:07.240 --> 52:10.240] Take them off the dime [52:10.240 --> 52:12.240] Ask the court to order mediation [52:12.240 --> 52:15.240] Everybody gets to take a deep breath [52:15.240 --> 52:16.240] We've got a way out of this [52:16.240 --> 52:20.240] And they can tell their client, look, you might win this in the end [52:20.240 --> 52:26.240] But if you do, it's going to cost you more in our legal fees than it's going to cost you to pay this guy off [52:26.240 --> 52:30.240] You'd be better off paying him off, getting us all off the dime [52:30.240 --> 52:37.240] Remember, it's all politics and all politics follows the money [52:37.240 --> 52:46.240] For the mediation, should I wait until the case management hearing? [52:46.240 --> 52:50.240] No, you've had a win or two [52:50.240 --> 52:51.240] You've held on to them [52:51.240 --> 52:55.240] They've tried to dump you and they couldn't get you dumped [52:55.240 --> 52:57.240] Now's a good time [52:57.240 --> 53:03.240] Okay, so requests for mediation or something like that? [53:03.240 --> 53:04.240] Yeah, ask them [53:04.240 --> 53:07.240] Move the court to order mediation [53:07.240 --> 53:09.240] Move the court, okay, wonderful [53:09.240 --> 53:14.240] Yeah, expect the other side to object to it [53:14.240 --> 53:17.240] And that's okay because they got to put up a show [53:17.240 --> 53:22.240] But expect a mediocre objection [53:22.240 --> 53:23.240] Okay [53:23.240 --> 53:31.240] If the court orders mediation, he doesn't have to do any more work, he clears his docket [53:31.240 --> 53:34.240] Yes, I think I do agree with you now [53:34.240 --> 53:42.240] First, I thought they'll just be to the death, you know [53:42.240 --> 53:46.240] Let's see who dies first [53:46.240 --> 53:50.240] Everybody's in business, everybody's playing poker [53:50.240 --> 53:51.240] I see [53:51.240 --> 53:55.240] They will show no weakness [53:55.240 --> 53:56.240] Wow [53:56.240 --> 54:01.240] By ordering mediation, oh crap, I don't want to mediate [54:01.240 --> 54:06.240] Oh, don't make me mediate, please, please don't make me mediate [54:06.240 --> 54:11.240] Please don't throw me in that broad bed [54:11.240 --> 54:16.240] Okay, so I would do that this coming Monday, Tuesday [54:16.240 --> 54:22.240] But within a, what do you call it, I would move the court for mediation [54:22.240 --> 54:31.240] And then I have another question, I have to fill out a three page with this case conference statement [54:31.240 --> 54:41.240] And it asks, one of the questions asks, do you have any other defendants you like to add in your suit? [54:41.240 --> 54:46.240] I was going to put the CEO, so I'm going to put his name [54:46.240 --> 54:50.240] And then before I do this, I wanted to ask you, that's why I called you tonight [54:50.240 --> 54:57.240] I wanted to add the attorney for the hospital, her name is Jo Lynn [54:57.240 --> 55:02.240] Because she put in a, what do you call it, a declaration [55:02.240 --> 55:08.240] That if she had to testify in open court, she would do that [55:08.240 --> 55:13.240] I was never a first hand witness, I don't know why she would say that [55:13.240 --> 55:17.240] I'm just like, oh my gosh, I mean, are you kidding me? [55:17.240 --> 55:24.240] And then an IT professional who wasn't even at the incident, he said he would testify [55:24.240 --> 55:28.240] Of course you're going to testify, you know, about the computers [55:28.240 --> 55:40.240] But did you actually see the defendant under oath say that, you know, that he was, what do you call it [55:40.240 --> 55:47.240] All these things that happened to him by a 4'11 Asian lady, I don't think so [55:47.240 --> 55:50.240] But anyway, I'm getting too emotional right now [55:50.240 --> 55:56.240] So I was going to add the attorney's name as well as the IT professional [55:56.240 --> 55:58.240] Would that be a good idea or not? [55:58.240 --> 56:05.240] Do that after you ask for mediation, then go ahead and add the attorney [56:05.240 --> 56:07.240] Turn the heat up [56:07.240 --> 56:10.240] Turn the heat up, that's correct [56:10.240 --> 56:16.240] Okay, wonderful, I really appreciate your wonderful counsel [56:16.240 --> 56:18.240] Just unbelievable [56:18.240 --> 56:26.240] Thank you so much for listening to you, I wish you'd get more Zoom calls [56:26.240 --> 56:32.240] Because it's good for us, we know what to say instead of getting the headlights [56:32.240 --> 56:35.240] Were you on my Zoom call the other day? [56:35.240 --> 56:37.240] Yes [56:37.240 --> 56:41.240] Oh good [56:41.240 --> 56:48.240] What you got from that, that you can actually deal with a judge [56:48.240 --> 56:56.240] As long as you are respectful and courteous, you can pretty well do what you want to [56:56.240 --> 57:01.240] If I'd have been disrespectful to the judge, it would have been much different [57:01.240 --> 57:10.240] I indicated to him that I'd file criminal charges against him, but I was respectful in the process [57:10.240 --> 57:13.240] He just grinned [57:13.240 --> 57:18.240] Yes he did, he was very respectful to you, to both of you [57:18.240 --> 57:22.240] It was a very good communication, it was unbelievable [57:22.240 --> 57:26.240] I was very pleased with that interaction [57:26.240 --> 57:28.240] I hope the next one goes as well [57:28.240 --> 57:32.240] I think they got the word that I was problematic, that I was coming after them [57:32.240 --> 57:36.240] And that's what you want, you want them to think you're not a chump [57:36.240 --> 57:43.240] And with what you've done already, clearly you're not a chump [57:43.240 --> 57:45.240] Oh that's sweet [57:45.240 --> 57:52.240] If you ask for mediation, and then you come back and land on them like a ton of bricks [57:52.240 --> 57:57.240] They're going to want to mediate, it's all about how much money it's going to cost [57:57.240 --> 58:01.240] I see, I got it, I think that's all from me, I just wanted to get your end [58:01.240 --> 58:04.240] I donated, thank you so much [58:04.240 --> 58:06.240] Okay, thank you EJ [58:06.240 --> 58:13.240] Now we're going to go to Jane in Texas, except Jane's only got 38 seconds [58:13.240 --> 58:17.240] Okay Jane, you're on, make it quick [58:17.240 --> 58:19.240] How are you? Third Amendment? Get it? [01:01:09.240 --> 01:01:12.240] So if you answer a knock at your door and guys in fatigues demand lodging [01:01:12.240 --> 01:01:16.240] Tell them to dust off their copy of the Bill of Rights and re-read the Third Amendment [01:01:16.240 --> 01:01:31.240] I'm Dr. Catherine Albrecht. Four eyes staring at you? Get it? [01:02:30.240 --> 01:02:34.240] Unfortunately, the government is trampling our Fourth Amendment rights in the name of security [01:02:34.240 --> 01:02:39.240] Keys in point, TSA airport scanners that peer under your clothing [01:02:39.240 --> 01:02:46.240] When government employees demand a peep at your privates without probable cause, I say it's time to sound the constitutional alarm bells [01:02:46.240 --> 01:02:53.240] Join me in asking our representatives to dust off the Bill of Rights and use their googly eyes to take a gander at the Fourth [01:02:53.240 --> 01:03:10.240] I'm Dr. Catherine Albrecht. Randy Count and Brett Fountain with La Radio on this Friday, the 26th day of August, 2022 [01:04:37.240 --> 01:04:45.240] And it took us a little time to come in. Sometimes I get in odd moods [01:04:45.240 --> 01:04:55.240] I've been in one of those spaces lately. If you've ever been in combat, you know what it means to be addicted to adrenaline [01:04:55.240 --> 01:04:59.240] And adrenaline addiction never goes away [01:04:59.240 --> 01:05:07.240] And I've kind of been flashing back to some of that and I'm struggling to get past it and not get myself thrown in jail [01:05:07.240 --> 01:05:11.240] I'm at a point where I want to fight. Jane, you want to fight? [01:05:11.240 --> 01:05:15.240] Yes, I want to fight. Would you go to court with me on Tuesday? [01:05:15.240 --> 01:05:17.240] Tuesday? [01:05:17.240 --> 01:05:25.240] Yeah, I have the municipal court in Fort Worth and I filed all the traffic documents back in April [01:05:25.240 --> 01:05:29.240] Send me directions and times, I'll be there [01:05:29.240 --> 01:05:32.240] Alright [01:05:32.240 --> 01:05:41.240] I told you, I'm cranked up. I had to take an anxiety pill today. Every once in a while [01:05:41.240 --> 01:05:49.240] I have PTSD and every once in a while it comes back and haunts me [01:05:49.240 --> 01:05:56.240] Anybody who's been in combat, they tend to come back addicted to adrenaline [01:05:56.240 --> 01:05:59.240] Adrenaline is a horrible addiction [01:05:59.240 --> 01:06:01.240] I bet [01:06:01.240 --> 01:06:07.240] I had times, I've told you about being shot off a jeep once [01:06:07.240 --> 01:06:12.240] There was no experience in my life more exciting and exhilarating [01:06:12.240 --> 01:06:14.240] Wow [01:06:14.240 --> 01:06:21.240] Than standing on a jeep, spotting incoming and you can see them coming right at you [01:06:21.240 --> 01:06:27.240] And knowing they would like nothing better than to kill you with one of those [01:06:27.240 --> 01:06:28.240] Right [01:06:28.240 --> 01:06:32.240] And we're standing there essentially giving them the finger [01:06:32.240 --> 01:06:37.240] And then they did shoot us off the jeep. They didn't shoot me [01:06:37.240 --> 01:06:42.240] They hit the jeep itself and blew the bonnet off. The bonnet hit me in the butt and smashed me into a wall [01:06:42.240 --> 01:06:45.240] Gave me a purple butt [01:06:45.240 --> 01:06:46.240] Wow [01:06:46.240 --> 01:06:50.240] If I'd got one trickle of blood, I'd got a purple heart [01:06:50.240 --> 01:06:56.240] In which case I would never have to pay for license plates again. I'd be a hero [01:06:56.240 --> 01:07:00.240] But instead I got a purple tush and I was old butt shot [01:07:00.240 --> 01:07:04.240] But there was nothing more exciting than that [01:07:04.240 --> 01:07:07.240] Why that? [01:07:07.240 --> 01:07:14.240] In times to come, Jane, you will look back on this experience [01:07:14.240 --> 01:07:18.240] The way I look back on that experience [01:07:18.240 --> 01:07:23.240] They're coming after you. They're bringing everything they've got [01:07:23.240 --> 01:07:28.240] And you're standing up to them fighting back [01:07:28.240 --> 01:07:32.240] I was once sentenced to a year in jail in Cherokee County [01:07:32.240 --> 01:07:36.240] Because I filed criminal charges with the grand jury against a judge [01:07:36.240 --> 01:07:43.240] Trying to help an old legal reformer, Robert Fox [01:07:43.240 --> 01:07:52.240] I look back on that and it was one of the defining times of my life [01:07:52.240 --> 01:07:58.240] I got to do the right thing for the right reason no matter what they did [01:07:58.240 --> 01:08:01.240] They convicted me, gave me a year in jail [01:08:01.240 --> 01:08:09.240] After 27 days in solitary confinement, I filed 35 criminal complaints against them with the court of appeals [01:08:09.240 --> 01:08:12.240] And in two days I was out [01:08:12.240 --> 01:08:14.240] Wow [01:08:14.240 --> 01:08:17.240] But it wasn't getting out [01:08:17.240 --> 01:08:20.240] It was getting convicted [01:08:20.240 --> 01:08:23.240] After 27 days I looked in the mirror [01:08:23.240 --> 01:08:26.240] The stainless steel mirror they've got [01:08:26.240 --> 01:08:30.240] They wouldn't let me in with the population because I knew too much [01:08:30.240 --> 01:08:34.240] I looked in the mirror and I said to myself, self [01:08:34.240 --> 01:08:40.240] You ran your mouth to the jury, you told the jury that at the end of the day it doesn't matter what you do [01:08:40.240 --> 01:08:44.240] If you rule against me and you put me in jail it won't make any difference [01:08:44.240 --> 01:08:50.240] I'm here for the right, doing the right thing for the right reason so it makes no difference [01:08:50.240 --> 01:08:51.240] Right [01:08:51.240 --> 01:08:55.240] And the jury threw the book at you [01:08:55.240 --> 01:09:00.240] So, did you mean what you said? [01:09:00.240 --> 01:09:07.240] And I looked in that mirror and said, you're damn right I meant what I said [01:09:07.240 --> 01:09:09.240] And then I was looking at it, you're in jail [01:09:09.240 --> 01:09:15.240] Life occasionally tests us [01:09:15.240 --> 01:09:19.240] I looked back at that now and it was a defining moment [01:09:19.240 --> 01:09:23.240] I stood on that jeep in Vietnam, it was a deciding moment [01:09:23.240 --> 01:09:26.240] I was shot down three times in C-130 Hurks [01:09:26.240 --> 01:09:30.240] And it was incredible [01:09:30.240 --> 01:09:36.240] The most exhilarating, exciting things that can happen in your life [01:09:36.240 --> 01:09:46.240] And here I am back in the United States looking for something that comes close [01:09:46.240 --> 01:09:50.240] I get to stand in court with a judge and tell the judge [01:09:50.240 --> 01:09:59.240] If you don't put all those people on this Zoom program I'll consider that a criminal act [01:09:59.240 --> 01:10:09.240] And frankly, it paled before places I've been, the adrenaline you get addicted to [01:10:09.240 --> 01:10:12.240] Jane, be careful [01:10:12.240 --> 01:10:13.240] Right [01:10:13.240 --> 01:10:16.240] You're likely to get addicted [01:10:16.240 --> 01:10:24.240] You don't realize it now, but this is way more fun than you know [01:10:24.240 --> 01:10:30.240] Well it was fun there for a little while, but now I'm getting, they're raking me over the coals [01:10:30.240 --> 01:10:33.240] It doesn't matter [01:10:33.240 --> 01:10:42.240] As long as you do the right thing for the right reason, it makes absolutely no difference what they do [01:10:42.240 --> 01:10:52.240] Because when they're done, when this is over, you get to look back and say, Jane, who the heck are you? [01:10:52.240 --> 01:10:57.240] What value do you bring? [01:10:57.240 --> 01:11:09.240] How many people get to say that I took on the system, no matter what they threw at me, I took on the system [01:11:09.240 --> 01:11:12.240] There is a value to that that is hard to explain [01:11:12.240 --> 01:11:20.240] I do not recommend people getting themselves into those kinds of circumstances [01:11:20.240 --> 01:11:27.240] But in your case, Jane, they kicked this soap box up under your feet [01:11:27.240 --> 01:11:29.240] They have [01:11:29.240 --> 01:11:34.240] They don't get to complain when you stand squarely on it [01:11:34.240 --> 01:11:42.240] And I can tell you from experience, in life there's nothing more valuable [01:11:42.240 --> 01:11:44.240] Right [01:11:44.240 --> 01:11:55.240] We all get old, I have a friend who treats people in old folks homes, and he says that getting old is about learning to deal with loss and regret [01:11:55.240 --> 01:12:01.240] We lose our body functions, we lose our family members, we lose everything, but that's not the worst thing [01:12:01.240 --> 01:12:04.240] We regret [01:12:04.240 --> 01:12:09.240] We regret everything we did and everything we did not do [01:12:09.240 --> 01:12:10.240] Right [01:12:10.240 --> 01:12:16.240] So be extremely careful about the regret that you create [01:12:16.240 --> 01:12:31.240] I suggest to you, Jane, that regardless of what happens in this case, regardless of what it costs you of the difficulty, the time you spend in [01:12:31.240 --> 01:12:41.240] At the end of the day, when you look back on your life and you look at this, this will be something that justifies your life [01:12:41.240 --> 01:12:45.240] Which one? I got three of them going [01:12:45.240 --> 01:12:47.240] The fact that you're taking them on [01:12:47.240 --> 01:12:49.240] Right [01:12:49.240 --> 01:12:57.240] It defines you, it's difficult while you're in it, it's frustrating, it's frightening, it actually is terrifying [01:12:57.240 --> 01:13:03.240] I stood in front of a jury and they found me guilty and sentenced me to a year in prison [01:13:03.240 --> 01:13:07.240] That was tough [01:13:07.240 --> 01:13:09.240] Did you go? [01:13:09.240 --> 01:13:17.240] Well, no, I spent 27 days in solitary confinement, filed criminal charges against everybody with the court of appeals, two days later I was out [01:13:17.240 --> 01:13:21.240] But I was willing to spend a year in prison if that's what it took [01:13:21.240 --> 01:13:23.240] Right [01:13:23.240 --> 01:13:32.240] I spent a couple years in the military and almost a year in Vietnam, compared to prison, that was a, prison was a cakewalk [01:13:32.240 --> 01:13:34.240] Right, right [01:13:34.240 --> 01:13:45.240] So we choose our path and you've chosen the path less traveled [01:13:45.240 --> 01:13:55.240] At the end of the day, you'll look back and you'll see so many people who did not have the courage or the fortitude to choose the path less traveled [01:13:55.240 --> 01:13:57.240] Right [01:13:57.240 --> 01:14:05.240] Okay, okay, I'm waxing philosophical, let's go back to what do you have for us today? [01:14:05.240 --> 01:14:15.240] Okay, now for Tuesday is the traffic speeding in a school zone, which they are not buying by documents [01:14:15.240 --> 01:14:24.240] So one question I have about the, one of the comments in the documents or one of the statements is the training that the officers are given [01:14:24.240 --> 01:14:39.240] And it says like on page 18 of this certain resource that, that speeding in itself is not an offense, but that resource has been updated in 2022 [01:14:39.240 --> 01:14:45.240] And it costs $30 to get it and I don't know if they've changed that or not, I'm hoping they haven't, do you know? [01:14:45.240 --> 01:14:53.240] Wait a minute, it's changed and it costs $30 to get it? What did that mean? [01:14:53.240 --> 01:15:03.240] $30, I found the book and that they have, they just put out and it costs $30 to get it, it's that training guide for, it's not a training guide [01:15:03.240 --> 01:15:11.240] It's that one page that you referenced in the motion that says on page 18 it says speeding in itself is not an offense [01:15:11.240 --> 01:15:14.240] That's the Texas transportation code [01:15:14.240 --> 01:15:17.240] That's right, that's what they're charging $30 to get that [01:15:17.240 --> 01:15:19.240] No, it's online [01:15:19.240 --> 01:15:26.240] Yeah, I know that's where I went and it was $30, but have you seen it then, 2022? [01:15:26.240 --> 01:15:30.240] You should be able to open it up online and then download it [01:15:30.240 --> 01:15:37.240] It sounds like she's talking about some other resource, some training resource about the Texas transportation code [01:15:37.240 --> 01:15:39.240] That's what I was thinking [01:15:39.240 --> 01:15:46.240] No, it's the actual website, if you go to their actual website, the people who put that out, that's what I'm talking about [01:15:46.240 --> 01:15:51.240] People who put that out, what did that mean? [01:15:51.240 --> 01:15:54.240] Let me see if I can find it [01:15:54.240 --> 01:15:58.240] Okay, I am [01:15:58.240 --> 01:16:01.240] What's it called, Texas what? [01:16:01.240 --> 01:16:03.240] Texas transportation code [01:16:03.240 --> 01:16:09.240] Okay, yeah, yeah, it's not Texas traffic, well, okay, Texas transportation code [01:16:09.240 --> 01:16:15.240] I thought it was Texas traffic training or whatever it was [01:16:15.240 --> 01:16:20.240] Texas transportation code is the law [01:16:20.240 --> 01:16:32.240] Okay, but that's not where you reference in that book, in the motion that says on page 18 of this certain book it says that speeding in itself is not an offense [01:16:32.240 --> 01:16:36.240] Does it say that in the transportation code? [01:18:49.240 --> 01:18:50.240] No [01:18:50.240 --> 01:18:51.240] I mean, yes [01:18:51.240 --> 01:18:55.240] Wow, giving without doing anything or spending any money, this is perfect [01:18:55.240 --> 01:18:56.240] Thank you so much [01:18:56.240 --> 01:18:58.240] We are welcome [01:18:58.240 --> 01:19:00.240] Happy holidays, Logos [01:19:00.240 --> 01:19:10.240] This is the Logos RadioNetwork [01:19:10.240 --> 01:19:14.240] Oh, come on [01:19:14.240 --> 01:19:36.240] Okay, we are back [01:19:36.240 --> 01:19:45.240] Randy Kelton, Brett Fountain, Root of our Radio, and we're talking to Jane in Texas [01:19:45.240 --> 01:19:52.240] If I sound like I'm waxing philosophical, every once in a while that happens to me [01:19:52.240 --> 01:20:00.240] I've had a bad couple of days and it kind of takes me back to places I'd rather not go [01:20:00.240 --> 01:20:09.240] So I apologize if I've used people inappropriately to address old issues [01:20:09.240 --> 01:20:18.240] But I do appreciate you, Jane, for taking on hard issues that kind of use up your life [01:20:18.240 --> 01:20:21.240] But at the end of the day, it will be worth it [01:20:21.240 --> 01:20:23.240] What do you have for us today, Jane? [01:20:23.240 --> 01:20:26.240] I'll stop with my stuff [01:20:26.240 --> 01:20:33.240] Okay, let me just bypass that one real quick because I don't know which one is more important [01:20:33.240 --> 01:20:42.240] On my appeal for, well, I don't even know if I have an appeal in municipal court for the two convictions [01:20:42.240 --> 01:20:49.240] They emailed me or see what happened [01:20:49.240 --> 01:20:56.240] I filed, I've been filed, I sent the timeline to Brett what I had been filing [01:20:56.240 --> 01:21:03.240] But then I'm looking in the rules and stuff like that and seeing that [01:21:03.240 --> 01:21:06.240] Hold on there, Jane [01:21:06.240 --> 01:21:11.240] I don't know if everybody else is getting this, but you're making me nuts [01:21:11.240 --> 01:21:17.240] Take a step back and figure out what it is you want to say [01:21:17.240 --> 01:21:21.240] I'm going in four or five different directions at the same time [01:21:21.240 --> 01:21:30.240] Okay, I guess what I want to say is, first of all, is there something that addresses the inability to pay [01:21:30.240 --> 01:21:35.240] And how long that order is good for by the county court [01:21:35.240 --> 01:21:45.240] Because Irving is saying that I have to prove my inability to pay again to them in order to make the appeal [01:21:45.240 --> 01:21:55.240] You should file with Irving claiming that inability to pay is res judicata [01:21:55.240 --> 01:22:03.240] It has already been adjudicated and Irving has no power to usurp that ruling [01:22:03.240 --> 01:22:08.240] Who granted you inability to pay? [01:22:08.240 --> 01:22:14.240] County court at law number four [01:22:14.240 --> 01:22:23.240] Okay, you need to file a challenge to this municipal court or was it a municipal court? [01:22:23.240 --> 01:22:25.240] Yes, it's Irving's municipal court [01:22:25.240 --> 01:22:29.240] They have no power to usurp a ruling by the county court [01:22:29.240 --> 01:22:39.240] That you have been adjudged as indigent and this court has no power to revisit that determination [01:22:39.240 --> 01:22:44.240] Is that a timeline though? If that happened back in February [01:22:44.240 --> 01:22:50.240] They have to come up with some evidence that your financial condition has changed [01:22:50.240 --> 01:22:52.240] Did they do that? [01:22:52.240 --> 01:22:54.240] No, they did not [01:22:54.240 --> 01:22:57.240] They have no standing [01:22:57.240 --> 01:23:03.240] As I understand, only the court reporter can make this determination [01:23:03.240 --> 01:23:10.240] Well, they sent me an email saying that I am, because I'm asking for clarification [01:23:10.240 --> 01:23:16.240] Like we talked last weekend, I sent a request for clarification of the findings and facts, exclusions of law [01:23:16.240 --> 01:23:21.240] And also a second request for the written transcript since I was indigent [01:23:21.240 --> 01:23:35.240] So they replied to that and said we're scheduling a hearing on September 9 for you to, for us to clarify the findings [01:23:35.240 --> 01:23:44.240] You just file the decision by the county court and claim that the issue is res judicata [01:23:44.240 --> 01:23:45.240] Okay [01:23:45.240 --> 01:23:51.240] And this court has no power to disturb a ruling by the county court [01:23:51.240 --> 01:23:59.240] Okay, and then today, whenever they sent me that email yesterday saying I had to come before on the 9th [01:23:59.240 --> 01:24:03.240] I replied and I said that's not sensible because it's going to be past my appeal [01:24:03.240 --> 01:24:12.240] And then they replied back today saying that, okay, we'll give you until the 19th for you to get your inability to pay stuff rate, your statement [01:24:12.240 --> 01:24:22.240] Okay, you should file a motion with the court to dismiss the inability to pay hearing as res judicata [01:24:22.240 --> 01:24:24.240] Okay, okay [01:24:24.240 --> 01:24:26.240] This has already been determined [01:24:26.240 --> 01:24:27.240] Yes [01:24:27.240 --> 01:24:32.240] A municipal court cannot revisit a determination by a court of record [01:24:32.240 --> 01:24:34.240] Right, and you know [01:24:34.240 --> 01:24:44.240] Or better to say an inferior court cannot disturb a determination by the county court [01:24:44.240 --> 01:24:47.240] Okay, all right [01:24:47.240 --> 01:24:50.240] They love being called inferior [01:24:50.240 --> 01:24:54.240] I bet they do [01:24:54.240 --> 01:24:58.240] Okay, so have I [01:24:58.240 --> 01:25:06.240] Okay, just a thought, a question, did you file a judicial complaint against the [01:25:06.240 --> 01:25:11.240] Wait, the prosecutor filed this document? [01:25:11.240 --> 01:25:13.240] How did this get filed? [01:25:13.240 --> 01:25:17.240] As far as they're requesting during the hearing? [01:25:17.240 --> 01:25:26.240] Well, who tried to re-judicate your determination of inability to pay? [01:25:26.240 --> 01:25:32.240] That came from the judge, but I haven't gotten a hard copy. It was through email [01:25:32.240 --> 01:25:36.240] Okay, the judge raised this issue? [01:25:36.240 --> 01:25:43.240] The lady that works for the judge, I guess I'm not sure her position, but she's the one that actually works for the judge [01:25:43.240 --> 01:25:47.240] She's the one communicating this with me from the judge [01:25:47.240 --> 01:25:58.240] Okay, as far as I understand, the only one who can raise an issue is the court recorder [01:25:58.240 --> 01:25:59.240] Okay [01:25:59.240 --> 01:26:05.240] And when you file a motion for inability to pay, they've only got three days to respond [01:26:05.240 --> 01:26:10.240] Well, I didn't file a motion. I filed the order whenever I did the motion [01:26:10.240 --> 01:26:14.240] Okay, you already have an order. This is res judicata [01:26:14.240 --> 01:26:16.240] Okay, yes [01:26:16.240 --> 01:26:20.240] You can file a subject matter jurisdiction challenge [01:26:20.240 --> 01:26:22.240] Well, no, I've already done that and they denied that [01:26:22.240 --> 01:26:29.240] No, no, no, hold on, hold on. No, you can't deny that. That comes back. That does not go away [01:26:29.240 --> 01:26:33.240] That should get criminal charges against the judge, but here [01:26:33.240 --> 01:26:37.240] They would love for you to buy that it got denied and they don't have to deal with it anymore [01:26:37.240 --> 01:26:44.240] They would love for you to just not bring it up anymore just because the tone of their voice made it sound final [01:26:44.240 --> 01:26:49.240] When I said subject matter jurisdiction, it was specific to this ruling [01:26:49.240 --> 01:26:51.240] Okay, so what? [01:26:51.240 --> 01:27:00.240] The municipal or JP court has no power to overrule a determination by a county court [01:27:00.240 --> 01:27:03.240] Can I cite any laws that say that? [01:27:03.240 --> 01:27:07.240] Yeah, I'm sure you can. I just don't have them in memory [01:27:07.240 --> 01:27:14.240] Have I sent you my subject matter jurisdiction folder? [01:27:14.240 --> 01:27:19.240] I think so, that the whole school document brought the ones that were in it before [01:27:19.240 --> 01:27:25.240] It's in there somewhere. Just do a search for subject matter jurisdiction [01:27:25.240 --> 01:27:28.240] How would you say this, Brett? [01:27:28.240 --> 01:27:36.240] Where subject matter jurisdiction, I'm sorry, where indigency has already been determined by one court [01:27:36.240 --> 01:27:41.240] What other court can challenge that determination? [01:27:41.240 --> 01:27:44.240] I would probably search for the word popper [01:27:44.240 --> 01:27:52.240] Yeah, I have been looking for that and I did see something that said that somebody else, they had to prove it [01:27:52.240 --> 01:27:56.240] That I was not indigent anymore. I didn't see that somewhere [01:27:56.240 --> 01:28:04.240] But did you prove it in the county court to their satisfaction such that they granted you this status? [01:28:04.240 --> 01:28:06.240] Yes, yes [01:28:06.240 --> 01:28:12.240] This is res judicata. The only thing about this is res judicata. This has already been determined [01:28:12.240 --> 01:28:13.240] Okay [01:28:13.240 --> 01:28:17.240] Look up indigency res judicata [01:28:17.240 --> 01:28:25.240] Okay, all right, I'll do that. Okay, so now any of the filings that I have already filed with these people [01:28:25.240 --> 01:28:34.240] Have I extended my appeal at all because it seems to me like I might have already messed up because I didn't file a brief [01:28:34.240 --> 01:28:40.240] And I didn't perfect the appeal bond because they didn't accept it [01:28:40.240 --> 01:28:45.240] And Eddie said that they had to approve my appeal. Is that true? [01:28:45.240 --> 01:28:51.240] I don't know enough about what you're speaking to to know. You filed a notice of appeal [01:28:51.240 --> 01:28:52.240] Yes [01:28:52.240 --> 01:28:55.240] Was the notice timely? [01:28:55.240 --> 01:29:00.240] The notice was very timely. It was before I did the motion for a new trial [01:29:00.240 --> 01:29:10.240] Did they require a deposit of some kind? [01:29:10.240 --> 01:29:12.240] Yes, appeal bond [01:29:12.240 --> 01:29:13.240] Bond, okay [01:29:13.240 --> 01:29:21.240] Within 10 days, but then whenever I file a notice of appeal, I put a notice of informant's progress with it [01:29:21.240 --> 01:29:24.240] Okay, that's all you needed [01:29:24.240 --> 01:29:26.240] Yep, you did it [01:29:26.240 --> 01:29:30.240] So you essentially have perfected your appeal [01:29:30.240 --> 01:29:33.240] That's what I thought, but they're not accepting it, so [01:29:33.240 --> 01:29:35.240] Who's not? [01:29:35.240 --> 01:29:37.240] The court's not because they're trying to make me prove it [01:29:37.240 --> 01:29:39.240] The lower court? [01:29:39.240 --> 01:29:41.240] The municipal court [01:29:41.240 --> 01:29:46.240] Did you file criminal charges against the judge? [01:29:46.240 --> 01:29:48.240] Right [01:29:48.240 --> 01:29:51.240] Okay, and then, okay [01:29:51.240 --> 01:30:00.240] Okay, hang on, go into our sponsors, Randy Kelton, Brett Fountain, Wood of Law Radio, we'll be right back [01:30:00.240 --> 01:30:05.240] A top cybersecurity expert has a warning for America [01:30:05.240 --> 01:30:11.240] If you build an electrical smart grid, the hackers will come and they could cause a catastrophic blackout [01:30:11.240 --> 01:30:15.240] I'm Dr. Catherine Albrecht, back with the shocking details in a moment [01:30:15.240 --> 01:30:18.240] Privacy is under attack [01:30:18.240 --> 01:30:21.240] When you give up data about yourself, you'll never get it back again [01:30:21.240 --> 01:30:26.240] And once your privacy is gone, you'll find your freedoms will start to vanish too [01:30:26.240 --> 01:30:31.240] So protect your rights, say no to surveillance, and keep your information to yourself [01:30:31.240 --> 01:30:34.240] Privacy, it's worth hanging on to [01:30:34.240 --> 01:30:41.240] This message is brought to you by Startpage.com, the private search engine alternative to Google, Yahoo, and Bing [01:30:41.240 --> 01:30:45.240] Start over with Startpage [01:30:45.240 --> 01:30:52.240] Governments love power, so it's only natural they'd want to control the power going into your home, too, with a smart grid [01:30:52.240 --> 01:30:59.240] So they're installing a national network of smart meters to remotely monitor electric use for efficiency and avoid grid failure [01:30:59.240 --> 01:31:03.240] But cybersecurity expert David Chalk says not so fast [01:31:03.240 --> 01:31:08.240] If we make the national power grid controllable through the web, hackers will have a field day [01:31:08.240 --> 01:31:15.240] Working remotely, they could tap in and black out the entire nation, leaving us vulnerable to our enemies [01:31:15.240 --> 01:31:19.240] I've long opposed smart meters for privacy and health reasons [01:31:19.240 --> 01:31:24.240] The catastrophic failures caused by hackers? There's nothing smart about that [01:31:24.240 --> 01:31:31.240] I'm Dr. Catherine Albrecht for Startpage.com, the world's most private search engine [01:31:31.240 --> 01:31:37.240] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11 [01:31:37.240 --> 01:31:43.240] It says that fire brought it down. However, 1,500 architects and engineers have concluded it was a controlled demolition [01:31:43.240 --> 01:31:46.240] Over 6,000 of my fellow service members have given their lives [01:31:46.240 --> 01:31:49.240] And thousands of my fellow first responders are dying [01:31:49.240 --> 01:31:54.240] I'm not a conspiracy theorist. I'm a structural engineer. I'm a New York City correction officer. I'm an Air Force pilot [01:31:54.240 --> 01:31:58.240] I'm a father who lost his son. We're Americans, and we deserve the truth [01:31:58.240 --> 01:32:01.240] Go to RememberBuilding7.org today [01:32:01.240 --> 01:32:08.240] Rule of Law Radio is proud to offer the Rule of Law traffic seminar. Okay, Jane, I need to clarify exactly where you're at [01:33:45.240 --> 01:33:51.240] You're having an issue with the inability to pay [01:33:51.240 --> 01:34:01.240] A county court has approved your inability to pay and a municipal court is trying to undermine that [01:34:01.240 --> 01:34:04.240] Yes [01:34:04.240 --> 01:34:07.240] What does the municipal court have anything to say about that? [01:34:07.240 --> 01:34:11.240] It's being appealed from the municipal court to the county court, right? [01:34:11.240 --> 01:34:14.240] So it's already been approved by the county court [01:34:14.240 --> 01:34:18.240] What does the municipal court even, why do they have anything to say? [01:34:18.240 --> 01:34:23.240] I'm trying to figure out what the remedy is [01:34:23.240 --> 01:34:26.240] This is what they've done [01:34:26.240 --> 01:34:33.240] So what do we do to circumvent this? [01:34:33.240 --> 01:34:36.240] Motion to dismiss res judicata [01:34:36.240 --> 01:34:40.240] Okay [01:34:40.240 --> 01:34:44.240] All right [01:34:44.240 --> 01:34:53.240] You might do a search on the Internet for inability to pay res judicata [01:34:53.240 --> 01:34:54.240] See what you come up with [01:34:54.240 --> 01:35:00.240] Okay, yeah, I didn't do that part yet [01:35:00.240 --> 01:35:07.240] But I did find that we were talking about a while ago, this is the other court now [01:35:07.240 --> 01:35:14.240] The book is called District and County Association Skies to Traffic Stop [01:35:14.240 --> 01:35:17.240] Wait a minute, say that again [01:35:17.240 --> 01:35:20.240] This is the other court now, the Fort Worth court again [01:35:20.240 --> 01:35:25.240] I'm switching back over there because I found the reference in your filings [01:35:25.240 --> 01:35:33.240] or in the thing that I filed that says there's a book called District and County Association Skies to Traffic Stop [01:35:33.240 --> 01:35:39.240] and page 18 going faster than the posted speed limit is not in itself an offense [01:35:39.240 --> 01:35:44.240] That's in one of your motions [01:35:44.240 --> 01:35:58.240] I do vaguely remember doing that, it is in the law that you have to have created some kind of dangerous condition [01:35:58.240 --> 01:36:05.240] But my problem with doing that is you're getting to the merits [01:36:05.240 --> 01:36:08.240] We want to avoid getting to the merits [01:36:08.240 --> 01:36:12.240] Okay [01:36:12.240 --> 01:36:15.240] What we could avoid that would have been [01:36:15.240 --> 01:36:23.240] Maybe, it's not necessarily a bad thing to mention that though because that also goes to the sufficiency of an allegation [01:36:23.240 --> 01:36:29.240] the sufficiency of a charging instrument that could it be good enough to even start the whole case [01:36:29.240 --> 01:36:36.240] can a case commence on a charging instrument or something that's in lieu of a charging instrument [01:36:36.240 --> 01:36:41.240] when it doesn't even give all the essential elements of any offense [01:36:41.240 --> 01:36:43.240] Good point [01:36:43.240 --> 01:36:45.240] Right [01:36:45.240 --> 01:36:51.240] So what are the elements that they would have to address? [01:36:51.240 --> 01:36:58.240] One of the elements is the transportation area is commercial [01:36:58.240 --> 01:36:59.240] Right [01:36:59.240 --> 01:37:08.240] Because speed limit signs, Brett do you remember what statute is that says speed limit signs apply [01:37:08.240 --> 01:37:12.240] I think that's maybe like 201.904, let me see [01:37:12.240 --> 01:37:21.240] Yeah I don't have all those in the motions I filed but they're just not, they're not willing to accept it without me coming to court and arguing it to their face on Tuesday [01:37:21.240 --> 01:37:24.240] Did you raise an objection to oral argument? [01:37:24.240 --> 01:37:32.240] No I didn't do that, I just, I didn't even think that they, I thought it disappeared and all of a sudden, boom, I get the thing in the mail [01:37:32.240 --> 01:37:40.240] this has been about April, May, June, July, August, about four months later saying okay we read all your, they didn't say okay we read all your stuff [01:37:40.240 --> 01:37:49.240] they just said we want you to come to court you know you have a court date on this coming up Tuesday so what that'll be on the 30th [01:37:49.240 --> 01:37:52.240] I think it's 1.30 or 2.30 this afternoon [01:37:52.240 --> 01:37:55.240] How old is this case? [01:37:55.240 --> 01:38:01.240] It happened on April the 22nd or April the 12th this year [01:38:01.240 --> 01:38:04.240] Okay [01:38:04.240 --> 01:38:10.240] Have you filed a motion to dismiss to roll to prosecute? [01:38:10.240 --> 01:38:21.240] I didn't do that but I filed, I filed the amended subject matter jurisdiction challenge and then I filed a criminal complaint against the officer [01:38:21.240 --> 01:38:31.240] notice of rights and preservation, motion to dismiss, I did request for informational arresting officer and the police department [01:38:31.240 --> 01:38:41.240] and then I did a counterclaim against the officer and let's see all the stuff that you had in there [01:38:41.240 --> 01:38:47.240] special appearance, subject matter jurisdiction challenge, all those things [01:38:47.240 --> 01:38:56.240] and then I also did a public information request on their ordinances that made them a minute before [01:38:56.240 --> 01:38:59.240] but they didn't respond on that one [01:38:59.240 --> 01:39:03.240] Then you need to file for summary judgment [01:39:03.240 --> 01:39:05.240] Okay [01:39:05.240 --> 01:39:16.240] Well this happens on Tuesday I don't know if I have, I can get that done before Tuesday or is that when you're going to show up with me in court? [01:39:16.240 --> 01:39:24.240] If they're going to call you into court, okay, what you've spoken to is a little bit complex for me to do over the radio [01:39:24.240 --> 01:39:26.240] Yes [01:39:26.240 --> 01:39:29.240] But it appears as though they're out of time [01:39:29.240 --> 01:39:50.240] I have a first amendment argument saying that, I'm sorry a speedy trial argument saying that the legislature on passing the speedy trial act [01:39:50.240 --> 01:40:01.240] the speedy trial act has been overturned but on passing the speedy trial act in the abstract of the legislature [01:40:01.240 --> 01:40:13.240] the legislature indicated that it intended that a delay of 30 days in a Class C misdemeanor was unreasonable [01:40:13.240 --> 01:40:19.240] 60 days in Class B, 90 days Class A, 120 days felony [01:40:19.240 --> 01:40:27.240] So while the speedy trial act has been overturned as unconstitutional it was overturned on other issues [01:40:27.240 --> 01:40:37.240] It was the clearly stated intent of the legislature that a Class C misdemeanor be prosecuted within 30 days [01:40:37.240 --> 01:40:43.240] I have a brief on that if you'll send me a request I will send that to you [01:40:43.240 --> 01:40:49.240] Yeah, I need that because that's Tuesday coming up, I'm supposed to go to court Tuesday, this Tuesday coming up on the 30th [01:40:49.240 --> 01:40:55.240] So should I take it with me or just file it? [01:40:55.240 --> 01:40:58.240] Tuesday, what's that? [01:40:58.240 --> 01:41:00.240] The 30th [01:41:00.240 --> 01:41:03.240] Yeah, it's kind of close [01:41:03.240 --> 01:41:04.240] Take it with you [01:41:04.240 --> 01:41:10.240] What was, what was Sheriff's Department? [01:41:10.240 --> 01:41:19.240] You need to move for a continuance, you're, wait a minute, I don't know enough about this traffic case [01:41:19.240 --> 01:41:27.240] I was driving to work on my partner, I was getting ready to go pick up a load and I was coming over a hill [01:41:27.240 --> 01:41:35.240] and an officer on a motorcycle was down at the bottom of the hill and when I came over I had the momentum over the hill [01:41:35.240 --> 01:41:39.240] had me going a little bit and then the speed zone, the school zone was right after the hill [01:41:39.240 --> 01:41:45.240] Okay, have you challenged the authority of the officer? [01:41:45.240 --> 01:41:47.240] Oh yeah, I did [01:41:47.240 --> 01:41:49.240] Okay [01:41:49.240 --> 01:41:55.240] And I found that one about the speed signs, it is 201.904 [01:41:55.240 --> 01:42:03.240] Okay, and all that's in those motions that I filed and those challenges [01:42:03.240 --> 01:42:09.240] They had an initial report date on May 30th and I show up, I think it was May the 5th [01:42:09.240 --> 01:42:14.240] and I show up there and then they said, well, we just got your documents, the other documents [01:42:14.240 --> 01:42:18.240] I did the amended challenge, just subject matter of jurisdiction [01:42:18.240 --> 01:42:24.240] and I just did it like a couple days before I showed up and then when I showed up [01:42:24.240 --> 01:42:27.240] even though I was supposed to be there that day, they didn't tell me I wasn't supposed to [01:42:27.240 --> 01:42:32.240] they told me that I was, they were still going over my documents and that they would get back in touch with me [01:42:32.240 --> 01:42:38.240] and that's all of a sudden, you know, not all of a sudden but three or four months later [01:42:38.240 --> 01:42:44.240] that's when I get the request to come to court or notice or order to come to court [01:42:44.240 --> 01:42:50.240] Send me an email, I'll send you the speedy trial motion [01:42:50.240 --> 01:42:58.240] Okay, now what I have not needed to request a speedy trial initially in order to [01:42:58.240 --> 01:43:04.240] Don't I waive that by not doing that initially? [01:43:04.240 --> 01:43:08.240] No, that's part of the argument [01:43:08.240 --> 01:43:09.240] Okay [01:43:09.240 --> 01:43:14.240] That speedy trial is a matter of substantive due process [01:43:14.240 --> 01:43:15.240] Okay [01:43:15.240 --> 01:43:25.240] And this notion that you have to activate your rights in order for your rights to be, to apply is nonsense [01:43:25.240 --> 01:43:26.240] Okay [01:43:26.240 --> 01:43:34.240] That speedy trial goes to a statutory requirement on the part of public officials [01:43:34.240 --> 01:43:35.240] Okay [01:43:35.240 --> 01:43:42.240] For them to claim that you did not have your right because you didn't claim it as unconstitutional on a space [01:43:42.240 --> 01:43:45.240] Okay [01:43:45.240 --> 01:43:52.240] You're commanding that they do what the law specifically commanded them to do [01:43:52.240 --> 01:43:57.240] That's a little redundant there but you don't have to activate [01:43:57.240 --> 01:44:00.240] Hang on, going to our break, we'll be right back [01:44:00.240 --> 01:44:06.240] Through advances in technology our lives have greatly improved except in the area of nutrition [01:44:06.240 --> 01:44:11.240] People feed their pets better than they feed themselves and it's time we changed all that [01:44:11.240 --> 01:44:17.240] Our primary defense against aging and disease in this toxic environment is good nutrition [01:44:17.240 --> 01:44:22.240] In a world where natural foods have been irradiated, adulterated, and mutilated [01:44:22.240 --> 01:44:25.240] Young Jevity can provide the nutrients you need [01:44:25.240 --> 01:44:31.240] Logos Radio Network gets many requests to endorse all sorts of products, most of which we reject [01:44:31.240 --> 01:44:34.240] We have come to trust Young Jevity so much [01:44:34.240 --> 01:44:39.240] We became a marketing distributor along with Alex Jones, Ben Fuchs, and many others [01:44:39.240 --> 01:44:47.240] When you order from LogosRadioNetwork.com, your health will improve as you help support quality radio [01:44:47.240 --> 01:44:51.240] As you realize the benefits of Young Jevity, you may want to join us [01:44:51.240 --> 01:44:58.240] As a distributor, you can experience improved health, help your friends and family, and increase your income [01:44:58.240 --> 01:45:02.240] Order now [01:45:02.240 --> 01:45:05.240] Are you the plaintiff or defendant in a lawsuit? [01:47:57.240 --> 01:48:01.240] Even just since the trial, I filed a lot of things [01:48:01.240 --> 01:48:04.240] Let me pull it up real quick [01:48:04.240 --> 01:48:07.240] I sent it to Brett the other day [01:48:07.240 --> 01:48:11.240] Let's see here if he still has it [01:48:11.240 --> 01:48:13.240] A whole [01:48:13.240 --> 01:48:14.240] Oh, here they are [01:48:14.240 --> 01:48:19.240] I filed, okay, I got convicted on the 20th of July [01:48:19.240 --> 01:48:29.240] I filed the findings of that Inclusion of Law on the 29th, along with the Notice of Appeal and Informer's Papyrus [01:48:29.240 --> 01:48:33.240] And I also filed a motion for a new trial on the same day, the 29th of July [01:48:33.240 --> 01:48:36.240] Okay, hold on, Informer Papyrus [01:48:36.240 --> 01:48:37.240] Uh-huh [01:48:37.240 --> 01:48:40.240] Did you file the order granting you Informer Papyrus? [01:48:40.240 --> 01:48:41.240] Yes [01:48:41.240 --> 01:48:42.240] Yes [01:48:42.240 --> 01:48:43.240] Good [01:48:43.240 --> 01:48:44.240] Okay [01:48:44.240 --> 01:48:45.240] Okay [01:48:45.240 --> 01:48:46.240] Go ahead [01:48:46.240 --> 01:48:52.240] And then on the 3rd of August, I filed an amended motion for a new trial with points of error [01:48:52.240 --> 01:48:58.240] And on the 5th, a judge signed an order denying my motion for a new trial [01:48:58.240 --> 01:49:05.240] And attempted to do Findings of Fact and Conclusions of Law, but didn't really do it [01:49:05.240 --> 01:49:15.240] On the August 10th, I received a denial, and then on August 10th, I filed a first request for the written transcript [01:49:15.240 --> 01:49:21.240] Because of my indices status, whatever, you know, Papyrus [01:49:21.240 --> 01:49:30.240] On the 22nd, I filed a request for clarification of Findings of Fact and a second request for the written transcript [01:49:30.240 --> 01:49:37.240] And then on the 25th, which is just yesterday, the court set a hearing for clarification on September 9th [01:49:37.240 --> 01:49:42.240] And also for me to prove my indices status, I can't say that word [01:49:42.240 --> 01:49:50.240] And also yesterday, I replied to their email saying that that was inaccessible as it would be too late for my appeal [01:49:50.240 --> 01:49:58.240] And then they replied back today saying, okay, we'll give you until the 19th of September to prove your indices, you know, my Papyrus [01:49:58.240 --> 01:50:02.240] And we still want you to come here so we can clarify the findings [01:50:02.240 --> 01:50:06.240] Okay, have you filed the order granting you Informa Papyrus? [01:50:06.240 --> 01:50:12.240] Yes, I filed it on the 29th, that was seven, nine days after the... [01:50:12.240 --> 01:50:17.240] Then all you have to do is have it go to a hearing, then notify the court [01:50:17.240 --> 01:50:25.240] You're noted, your determination of Informa Papyrus is res judicata, it is before the court [01:50:25.240 --> 01:50:27.240] You've already handled that, that's great [01:50:27.240 --> 01:50:36.240] And this court has no power to usurp or what's the term? [01:50:36.240 --> 01:50:45.240] I want to say they can't interfere with the determination by a higher court, but there's a terminology for that [01:50:45.240 --> 01:50:47.240] I don't know, over through? [01:50:47.240 --> 01:50:57.240] Just that this issue is res judicata and this court has no power to usurp a county court [01:50:57.240 --> 01:51:03.240] Okay, so then they will be forced to perfect the appeal, right? I mean, they'll be forced to approve it, right? [01:51:03.240 --> 01:51:08.240] Yes, if they refuse, then that gets a petition for writ of mandamus [01:51:08.240 --> 01:51:11.240] Okay [01:51:11.240 --> 01:51:18.240] It shouldn't be very complicated, you ask the court of appeals to order them to perfect your appeal [01:51:18.240 --> 01:51:26.240] Okay, okay, all right, okay, I can do that [01:51:26.240 --> 01:51:35.240] And they said also in the email today that the more time that they're giving me, the extra week they're giving me is not going to affect my appeal [01:51:35.240 --> 01:51:43.240] So not let it, it won't affect my appeal, which from what I've read, I've already blown off my appeal because I should have [01:51:43.240 --> 01:51:53.240] Well, actually they did though, right? They're the ones that messed me up and didn't approve the appeal [01:51:53.240 --> 01:51:56.240] You were contradictory there [01:51:56.240 --> 01:52:12.240] Yeah, I messed up because I didn't do the 10-day thing after they made the denial for the new trial that I messed up because I didn't perfect the appeal with the appeal bond [01:52:12.240 --> 01:52:16.240] But I don't have to, since I filed an order of poppers [01:52:16.240 --> 01:52:19.240] Yeah, you don't have to, you're good [01:52:19.240 --> 01:52:25.240] Yeah, they're the ones that are delaying my appeal, not me [01:52:25.240 --> 01:52:26.240] Right [01:52:26.240 --> 01:52:32.240] Yeah, okay, all right [01:52:32.240 --> 01:52:36.240] Well good, I'm glad we got that straightened out [01:52:36.240 --> 01:52:39.240] Okay, I have one issue for you, Jane [01:52:39.240 --> 01:52:41.240] Okay [01:52:41.240 --> 01:52:47.240] We have, I've been doing this show for a long time and we get people like you who get in here and fight these issues [01:52:47.240 --> 01:52:53.240] And as soon as your issue goes away, you disappear [01:52:53.240 --> 01:52:57.240] You go back to your life and you forget all about us [01:52:57.240 --> 01:52:59.240] I'm not [01:52:59.240 --> 01:53:01.240] You don't get to forget about us, Jane [01:53:01.240 --> 01:53:08.240] I'm not going to, I'm never going to get out of court, I've got three things going on and it seems like none of them are going away [01:53:08.240 --> 01:53:11.240] You have become a resource [01:53:11.240 --> 01:53:13.240] Good [01:53:13.240 --> 01:53:25.240] Well, I was reading the posts on the channel and one place someone was asking you for advice and I looked at what you gave them [01:53:25.240 --> 01:53:36.240] And you gave them good advice on issues you still questioned us about [01:53:36.240 --> 01:53:47.240] You are, you're becoming very knowledgeable and I'm going to say you don't get to just disappear when your issues are adjudicated [01:53:47.240 --> 01:53:57.240] Well, thank you, I appreciate all the help you all give me and I wanted to say that you mentioned a while ago that you hate mediation or whatever [01:53:57.240 --> 01:54:04.240] That freaking civil court is sending me the second mediation for me and my neighbor and I, can you believe that? [01:54:04.240 --> 01:54:09.240] Second mediation [01:54:09.240 --> 01:54:13.240] Yeah, it's a complete waste of resources and time and everything [01:54:13.240 --> 01:54:18.240] What did the sides offer? [01:54:18.240 --> 01:54:27.240] Nobody offered anything because we haven't been to trial yet because the judge is still thinking that we should be able to mediate [01:54:27.240 --> 01:54:35.240] But there is no way in the world that we're going to come to any kind of agreement, you know, I already know that for a fact [01:54:35.240 --> 01:54:48.240] So I'm not, I thought I was waiting on that one but she filed some videos, only evidence that she has [01:54:48.240 --> 01:54:59.240] But all her stuff is going to be rejected when we finally get to go to trial because it's not relevant to her, to my counterclaim or to her claim [01:54:59.240 --> 01:55:04.240] You know, so the attorney is going to take care of that, I do have an attorney on that pro bono [01:55:04.240 --> 01:55:15.240] So I'm trying to stay out of it, I'm not out of it because every time I bring up something he says, well, you know, I'm kind of like, what are we here for? [01:55:15.240 --> 01:55:21.240] You know, we're doing that, we're taking care of that and just leave this to us and you focus on the other things you got to do, you know [01:55:21.240 --> 01:55:25.240] But it's hard for me to stay off of it, you know [01:55:25.240 --> 01:55:35.240] Well, you have a personal stake in it so you're throwing, you want to throw everything up against the wall that you can come up with [01:55:35.240 --> 01:55:43.240] The lawyer doesn't have a personal stake in it, he wants to take on the issues he thinks he can win [01:55:43.240 --> 01:55:51.240] But I think he does, he does care about what's happening and everything and he does feel the pain that I feel [01:55:51.240 --> 01:56:01.240] You know, it's not totally, but he does understand what I've been through, you know, so, but, you know, I don't know [01:56:01.240 --> 01:56:05.240] If he does well, give us his name [01:56:05.240 --> 01:56:11.240] Oh yeah, yeah, I think he's a good guy, so one of the good ones [01:56:11.240 --> 01:56:16.240] If we can find a good one, we want to keep contact with him, we want to send him business [01:56:16.240 --> 01:56:20.240] Right, yeah, that's for sure [01:56:20.240 --> 01:56:25.240] Okay, well, are you out of time because it says 1203 on my clock [01:56:25.240 --> 01:56:32.240] Yeah, we've only got a couple more callers and a couple more minutes [01:56:32.240 --> 01:56:39.240] We've got one more caller, we've got two minutes, I'm going to dump you like a hot rock, Jane, and go to John and Ken [01:56:39.240 --> 01:56:44.240] I'm going to get an email right now asking for that speedy trial thing [01:56:44.240 --> 01:56:47.240] Two minutes, Jane, we're running out of time [01:56:47.240 --> 01:56:49.240] Thank you, thank you, bye Brent [01:56:49.240 --> 01:56:51.240] Thank you, Jane [01:56:51.240 --> 01:56:59.240] Okay, now we're going to Jim, John in Kansas, John, we've only got a couple minutes, what do you got for us? [01:56:59.240 --> 01:57:02.240] Okay, can you hear me? [01:57:02.240 --> 01:57:04.240] I can hear you [01:57:04.240 --> 01:57:06.240] Hello? [01:57:06.240 --> 01:57:09.240] I can hear you, go, you're running out of time [01:57:09.240 --> 01:57:10.240] Okay, we're running out of time [01:57:10.240 --> 01:57:17.240] Hey, I called a few weeks ago regarding a guy who had a criminal trespass charge in Kansas [01:57:17.240 --> 01:57:22.240] We ended up going to trial, and I'm going to be real brief here [01:57:22.240 --> 01:57:29.240] Went to trial, municipal trial, we had a court reporter, we got the police to basically [01:57:29.240 --> 01:57:35.240] They testified that he didn't remain on the property [01:57:35.240 --> 01:57:41.240] Every witness we got to basically tell that he didn't remain on the property [01:57:41.240 --> 01:57:48.240] Went through a whole trial, about six hours, and we got to the end of it, the judge ruled [01:57:48.240 --> 01:57:53.240] You know, well, he didn't remain on the property, but he didn't leave fast enough [01:57:53.240 --> 01:57:58.240] So I charged him guilty of criminal trespass [01:57:58.240 --> 01:58:03.240] Did he stipulate what amounted to fast enough? [01:58:03.240 --> 01:58:09.240] Well, he said, well, he said if you, you know, I'd understand if it was just a few seconds [01:58:09.240 --> 01:58:16.240] But you stayed there for, you know, five to ten minutes, so I'm going to find you guilty of criminal trespass [01:58:16.240 --> 01:58:19.240] Is he going to repeal? [01:58:19.240 --> 01:58:27.240] Oh, absolutely, yeah, we already got the, perfected the appeal, and we're going to go through with that [01:58:27.240 --> 01:58:34.240] And, you know, and I guess, I mean, real quick, you know, with the repeal, you know [01:58:34.240 --> 01:58:36.240] Fifteen seconds [01:58:36.240 --> 01:58:41.240] It's up there in Kansas City, in Johnson County, Kansas, I mean, they're pretty corrupt [01:58:41.240 --> 01:58:46.240] I'm sorry, you are out of time, this is Randy Kelton, Brett Fountain Wheelbarrow Radio [01:58:46.240 --> 01:58:50.240] Thank you for listening, and good night [01:58:50.240 --> 01:58:57.240] Bibles for America is offering absolutely free a unique study Bible called the New Testament Recovery Version [01:58:57.240 --> 01:59:04.240] The New Testament Recovery Version has over 9,000 footnotes that explain what the Bible says verse by verse [01:59:04.240 --> 01:59:08.240] Helping you to know God and to know the meaning of life [01:59:08.240 --> 01:59:11.240] Order your free copy today from Bibles for America [01:59:11.240 --> 01:59:20.240] Call us toll free at 888-551-0102 or visit us online at bfa.org [01:59:20.240 --> 01:59:25.240] This translation is highly accurate and it comes with over 13,000 cross references [01:59:25.240 --> 01:59:29.240] Plus charts and maps and an outline for every book of the Bible [01:59:29.240 --> 01:59:32.240] This is truly a Bible you can understand [01:59:32.240 --> 01:59:35.240] To get your free copy of the New Testament Recovery Version [01:59:35.240 --> 01:59:40.240] Call us toll free at 888-551-0102 [01:59:40.240 --> 01:59:49.240] That's 888-551-0102 or visit us online at bfa.org [01:59:49.240 --> 02:00:11.240] Looking for some truth?
