[04:12.880 --> 04:16.840] Apparently some judge issued some order about something, he didn't go into detail, we didn't [04:16.840 --> 04:23.960] have time because I was producing Tom Keighley's show which comes on before this one. [04:23.960 --> 04:29.960] And he wanted to make sure he got his suit filed timely. [04:29.960 --> 04:39.080] I think he misunderstood the tolling of the time limits. [04:39.080 --> 04:46.080] He was measuring time from when the issues he's complaining about began. [04:46.080 --> 04:55.400] And the clock on an issue with government officials doesn't start to run until whatever [04:55.400 --> 04:58.720] they're doing ends. [04:58.720 --> 05:03.340] So what he's complaining about are things that are ongoing. [05:03.340 --> 05:06.560] So the clock hasn't even started yet. [05:06.560 --> 05:15.680] So he was good, but just to be sure, I suggested get down there and get that thing filed so [05:15.680 --> 05:17.640] you don't have to worry about it. [05:17.640 --> 05:23.600] So he may be back later, I'm not sure how long it's going to take him. [05:40.200 --> 05:49.040] I just went to the local justice of the peace and filed criminal charges with her against [05:49.040 --> 05:57.880] the city of Rome judge, city of Rome clerk and chief of police and the officer who wrote [05:57.880 --> 06:00.880] me the ticket. [06:00.880 --> 06:05.600] It was kind of funny, I went by to pick up my mail and it's right next to the JP's office [06:05.600 --> 06:11.400] and I noticed the JP's office was full of cars, wow, look at all those cars. [06:11.400 --> 06:16.320] That must mean the judge is in the building having hearings and I went in and sure enough [06:16.320 --> 06:17.920] they were. [06:17.920 --> 06:24.000] The whole little courtroom there was full of people and the county attorney was there [06:24.000 --> 06:27.560] doing his little let's make a deal routine. [06:27.560 --> 06:32.400] So I went in and sat down in the courtroom and the bailiff saw me. [06:32.400 --> 06:36.680] He walked up to the bar and just stood there and stared at me. [06:36.680 --> 06:43.160] I finally looked up at him, howdy, hello Mr. Kelton. [06:43.160 --> 06:45.760] He came over and he said, did you sign in? [06:45.760 --> 06:46.760] I said no. [06:46.760 --> 06:50.680] He said well you see, you need to sign in, no don't. [06:50.680 --> 06:53.640] Do you have a ticket here today? [06:53.640 --> 06:59.640] I said no, Mr. Kelton do you mind if I ask why you're here? [06:59.640 --> 07:06.000] Oh entertainment, I'm just here for a little entertainment and then I realized I didn't [07:06.000 --> 07:08.200] have my hearing aids, I forgot them. [07:08.200 --> 07:12.120] Oh my goodness, I can't hear what's going on. [07:12.120 --> 07:20.840] So I told him, I've got a present for your boss or the JP, tell him not to go anywhere, [07:20.840 --> 07:28.640] I'll be right back and I went and got my documents that came back and he was having a jury trial [07:28.640 --> 07:31.200] over a traffic ticket. [07:31.200 --> 07:40.000] The guy gets popped at 87 miles an hour in a 70 zone and he didn't know how to fight [07:40.000 --> 07:43.800] it and they found him incredibly guilty in whole words. [07:43.800 --> 07:49.920] I gave them the clerks my folder and told them to give it to the judge and she probably wanted [07:49.920 --> 07:50.920] to talk to me. [07:50.920 --> 07:56.800] I told the county attorney who was there that you might want to hang around and give the [07:56.800 --> 08:04.440] judge some really good legal advice but he chickened out and he hit the road immediately. [08:04.440 --> 08:10.560] So I haven't heard from the judge, I'll give her two weeks and then I'll send her a tort [08:10.560 --> 08:11.920] letter. [08:11.920 --> 08:23.120] I'm working on the response to the civil suit I filed against the justice of the peace in [08:23.120 --> 08:26.240] Victoria County. [08:26.240 --> 08:33.160] They served him, the guy got served and they answered within just over a week. [08:33.160 --> 08:39.440] Generally you kind of wait a while but they found their answer immediately because what [08:39.440 --> 08:44.200] they did was went to their folder and pulled out their standard answer for when someone [08:44.200 --> 08:48.480] sues a judge and they filed it. [08:48.480 --> 08:52.400] Well I think I found a problem. [08:52.400 --> 09:00.480] The document was titled a challenge to subject matter jurisdiction but it didn't challenge [09:00.480 --> 09:08.040] the jurisdiction of the trial court to hear the issues before the trial court. [09:08.040 --> 09:16.400] It did not challenge my standing to invoke the jurisdiction of the trial court. [09:16.400 --> 09:25.840] It claimed an affirmative defense and the affirmative defense they claimed was immunity, [09:25.840 --> 09:28.160] that the judge had absolute immunity. [09:28.160 --> 09:37.320] Well in my suit I very carefully crafted it for that exact purpose. [09:37.320 --> 09:40.400] I was hoping I would get a better document from them. [09:40.400 --> 09:47.920] I was hoping they would have came up with something I had not seen but they didn't. [09:47.920 --> 09:55.840] So in reading through the rules, if any of you have taken my suggestion and got O'Connor's [09:55.840 --> 10:07.880] Civil Trials or the one I was reading through is O'Connor's Rules of Court, O'Connor's [10:07.880 --> 10:18.080] Texas Rules of Civil Trials, the first hundred pages is a synopsis of all the stuff you need [10:18.080 --> 10:25.680] to know about filing and answering documents in a Texas court. [10:25.680 --> 10:29.280] Come across something I have never seen before. [10:29.280 --> 10:35.440] I have never seen it enforced but it's in here. [10:35.440 --> 10:41.960] You are required to number the paragraphs and some of the federal courts require you [10:41.960 --> 10:51.000] to number lines but Texas Civil Rules require that you number the paragraphs and that you [10:51.000 --> 10:54.200] keep each paragraph to a single subject. [10:54.200 --> 10:59.160] Well if you listen to me talking about document creation that's exactly what I have been talking [10:59.160 --> 11:00.160] about for a long time. [11:00.160 --> 11:05.400] I already did that but I was surprised to find it's actually in the rules but I never [11:05.400 --> 11:07.720] see anybody doing that. [11:07.720 --> 11:18.160] If you file a constitutional challenge there is a form you must file with it. [11:18.160 --> 11:22.520] After all these years I have never seen or heard of such a form but it's actually in [11:22.520 --> 11:35.560] the code but I was reading through the code and I read about pleadings and motions, pleadings. [11:35.560 --> 11:41.680] The term plea is an archaic term that's not much used anymore. [11:41.680 --> 11:50.200] Now in Texas plea, plea to the jurisdiction, plea and abatement, there is a lot of older [11:50.200 --> 11:55.880] filings that used to have these names are now all considered motions. [11:55.880 --> 12:05.480] The only pleadings is the original complaint and a response to that complaint. [12:05.480 --> 12:08.720] Pleadings must be verified. [12:08.720 --> 12:13.320] Well they filed a challenge to subject matter jurisdiction and a challenge to subject matter [12:13.320 --> 12:18.420] jurisdiction does not have to be verified. [12:18.420 --> 12:24.680] So this one wasn't verified, bad move bubba. [12:24.680 --> 12:37.320] They called it a challenge to subject matter jurisdiction but the rules speak to a not [12:37.320 --> 12:50.480] labeling a motion being improperly named that the name is not controlling. [12:50.480 --> 12:57.440] It doesn't matter what you call a document, the document shall be treated based on the [12:57.440 --> 13:00.840] content not the title. [13:00.840 --> 13:07.960] So they call this a challenge to subject matter jurisdiction but in no place, oh caption, [13:07.960 --> 13:13.720] caption was the word, improper caption, nowhere in there did they challenge subject matter [13:13.720 --> 13:15.800] jurisdiction. [13:15.800 --> 13:21.760] So I'm alleging an improper caption, there are two other things it can be. [13:21.760 --> 13:31.860] One thing it could be is a challenge to in personum jurisdiction but in reading the rules [13:31.860 --> 13:36.320] on in personum I got another big surprise. [13:36.320 --> 13:50.760] In Texas in personum jurisdiction challenge only goes to forum non-convenes and what that [13:50.760 --> 13:59.480] means is I'm from another state and you're trying to sue me in your state, your long [13:59.480 --> 14:07.560] arm doesn't reach this far and that's all in personum goes to. [14:07.560 --> 14:18.720] Okay, so effectively they challenged the courts of power to rule over the person but under [14:18.720 --> 14:28.240] Texas rules that's not exactly an in personum pleading that has to be filed first, it's [14:28.240 --> 14:30.960] just a motion of some kind. [14:30.960 --> 14:47.400] But if it were construed as an in personum filing, a plea to an in personum must be verified. [14:47.400 --> 14:51.640] But since they're not claiming they were out of state since they're state public officials [14:51.640 --> 14:53.840] at the end of the day I don't think that was going to apply. [14:53.840 --> 15:02.960] So the only other thing it can be is an answer but an answer also has to be verified. [15:02.960 --> 15:09.040] If it's a plea, if it's an answer or response to a motion it doesn't have to be verified [15:09.040 --> 15:15.400] unless it contains specific facts that were not already before the court. [15:15.400 --> 15:24.840] But if it is an answer to an original petition it must be verified and it's not. [15:24.840 --> 15:29.480] If you guys listen to me for very long you'll remember me telling people if you have any [15:29.480 --> 15:36.360] doubt at all about whether something should be verified or not, verify it. [15:36.360 --> 15:40.960] If you verify something that doesn't need to be it won't make a difference but if you [15:40.960 --> 15:46.080] don't verify something that needs to be verified you're screwed. [15:46.080 --> 15:50.720] And here's the problem, normally with a motion or pleading if you don't verify it and they [15:50.720 --> 15:58.000] complain about it then you can ask the judge to have the clerk issue an oath and verify [15:58.000 --> 16:04.280] your pleading for you right there or you can re-file and verify it. [16:04.280 --> 16:11.080] But on an original answer they've got until the Monday after the 21st day, the clocks [16:11.080 --> 16:13.840] run completely out. [16:13.840 --> 16:19.840] They didn't verify it so while it is in the record the judge cannot see it, that's going [16:19.840 --> 16:23.240] to be one of my arguments. [16:23.240 --> 16:25.320] That is going to be so much fun. [16:25.320 --> 16:31.480] I've got a young lawyer, they always give the new lawyer the pro se litigants because [16:31.480 --> 16:34.600] generally they're easy to handle. [16:34.600 --> 16:40.840] Well let's see how he handles this when I bar grieving for filing a frivolous pleading. [20:10.440 --> 20:15.440] And last week I was having a lot of trouble, I think I said. [20:15.440 --> 20:17.440] Wait, are you on your Bluetooth? [20:17.440 --> 20:19.440] No, I'm not. [20:19.440 --> 20:23.160] Okay, a little muffled is all. [20:23.160 --> 20:25.160] Maybe I should put in my hearing aids. [20:25.160 --> 20:29.160] Maybe that would help. [20:29.160 --> 20:37.080] Anyway, I contacted, you know, my appeal was eventually, my designation of the record was [20:37.080 --> 20:40.320] eventually accepted this week. [20:40.320 --> 20:46.720] However, at the same time, they rejected the court reporter's transcript. [20:46.720 --> 20:53.440] Now I put those same transcripts in the previous two times and they had not been rejected. [20:53.440 --> 20:58.360] They said they were rejected because they failed to conform to Rule 8.144. [20:58.360 --> 21:03.960] It's a very complicated rule and it talks about how it's got to be a quarter of an inch [21:03.960 --> 21:07.360] from here and one and a quarter from here and this, that, and the other. [21:07.360 --> 21:12.560] Well, of course, because it's a reporter's transcript that it has to be certified, I [21:12.560 --> 21:17.400] can't change it because then it's not the court reporter's certified transcript. [21:17.400 --> 21:22.360] Plus it's in PDF format so I can't change it. [21:22.360 --> 21:28.640] So anyway, I contacted the first court reporter or the second court reporter and she asked [21:28.640 --> 21:34.360] if I'd filed an appeal because she said she did it in the correct format. [21:34.360 --> 21:39.360] And I told her and I gave her the appeal number, I get an email back saying, your next step [21:39.360 --> 21:43.440] is to contact the appeals division, which I did. [21:43.440 --> 21:47.200] They failed to respond to my phone message. [21:47.200 --> 21:49.640] I contacted the other court reporter. [21:49.640 --> 21:53.520] She has never responded by phone or email. [21:53.520 --> 21:59.520] So then I contacted the appeals court again yesterday, no response. [21:59.520 --> 22:04.400] So last night I wrote up a letter to the clerk of the appeals court and to the CEO of the [22:04.400 --> 22:10.440] court and delivered it today to the drop box. [22:10.440 --> 22:17.280] And then I sent a copy to the district attorney saying, you know, FYI, what's going on in [22:17.280 --> 22:19.080] your courthouse? [22:19.080 --> 22:22.920] And I just, in the letter I said, I'm not sure what I'm supposed to do. [22:22.920 --> 22:29.640] I copied the emails I sent to the court reporter and the one who responded, I said, I'm trying [22:29.640 --> 22:35.880] to timely make these corrections and do everything properly, but I'm getting no responses. [22:35.880 --> 22:42.800] Please advise us to what I'm supposed to do to make, because I only have 15 days and I [22:42.800 --> 22:47.240] think seven of those have already gone, trying to get hold of them. [22:47.240 --> 22:53.560] So I get a call from the assistant district attorney this afternoon, who also knows me [22:53.560 --> 22:58.840] because he's the one prosecuting that consignment store owner. [22:58.840 --> 23:02.920] And he said, well, the district attorney, you know, he doesn't have anything to do with [23:02.920 --> 23:03.920] civil stuff. [23:03.920 --> 23:05.640] I said, this isn't actually the civil part. [23:05.640 --> 23:13.240] This is the fact that the clerks are not doing their job and refusing to file lawful documents [23:13.240 --> 23:15.320] and then not responding. [23:15.320 --> 23:18.800] And I said, how is a person supposed to respond? [23:18.800 --> 23:22.720] Where am I supposed to go to get some action? [23:22.720 --> 23:26.880] And he said, well, have you tried to get an attorney? [23:26.880 --> 23:29.680] I said, you already know I can't afford one. [23:29.680 --> 23:34.160] And I said, those pro bonos don't work on these kinds of cases. [23:34.160 --> 23:39.000] And I said, you know, I just want them to do their job. [23:39.000 --> 23:42.920] They seem to forget that they work for us, not the other way around. [23:42.920 --> 23:44.920] And I said, you know me, I'm a British bulldog. [23:44.920 --> 23:45.920] I'm not giving up. [23:45.920 --> 23:46.920] And he just started laughing. [23:46.920 --> 23:49.520] He said, yeah, I know. [23:49.520 --> 23:54.880] And I said, they need to come to the table and they need to be more helpful and responsive [23:54.880 --> 23:57.000] to the public whom they serve. [23:57.000 --> 24:04.120] I said, they were keen to give me erroneous legal information about my filing not, you [24:04.120 --> 24:06.280] know, not being timely. [24:06.280 --> 24:09.800] And then they threatened to reject it if I e-filed it. [24:09.800 --> 24:12.560] And that was a verbal direct threat to me. [24:12.560 --> 24:15.160] I said, who do I go to? [24:15.160 --> 24:20.640] He said, well, I suggest you come to the courthouse tomorrow and personally speak with them. [24:20.640 --> 24:24.000] I said, well, I spent an hour and a half there last week. [24:24.000 --> 24:27.440] I guess I'll spend another hour and a half if I need to. [24:27.440 --> 24:33.840] And I said, could you explain to me why the CEO of the courthouse is unavailable to speak [24:33.840 --> 24:34.840] to the public? [24:34.840 --> 24:39.040] And he said, well, how do you know they are? [24:39.040 --> 24:45.760] I said, because the clerk said that we, public has no access to the CEO of the courthouse. [24:45.760 --> 24:46.760] And he didn't know what to say. [24:46.760 --> 24:52.120] He said, well, try again and keep trying to get hold of the court reporters and see what [24:52.120 --> 24:54.880] you can do tomorrow. [35:02.240 --> 35:08.520] But this guy, the judge, he did not like any of them. [35:08.520 --> 35:15.280] The only one he liked was the rights, preservation of rights or something like that. [35:15.280 --> 35:18.200] Everything else was trash. [35:18.200 --> 35:24.880] It was BS, only he used the whole word and he used it about 10 times. [35:24.880 --> 35:32.840] He called everything I file BS using the entire word at least 10 times. [35:32.840 --> 35:40.320] He spelled out the word BS, the entire word, at least three or four times. [35:40.320 --> 35:46.120] He called whoever I got these documents from, he thought I had downloaded them from the [35:46.120 --> 35:57.800] internet, a goofball, at least three or four times, and he denied the challenge to subject [35:57.800 --> 36:02.400] matter jurisdiction because he has jurisdiction. [36:02.400 --> 36:09.480] Oh my goodness, I should have known that. [36:09.480 --> 36:11.480] What was I thinking? [36:11.480 --> 36:14.040] That's not all. [36:14.040 --> 36:18.440] There was even more little fireworks towards the end. [36:18.440 --> 36:32.480] But I am working on, what do you call it, traditional misconduct form, and I was wondering, [36:32.480 --> 36:39.400] should I do one form with a whole bunch of misconduct on it or should I do a separate [36:39.400 --> 36:43.080] form with one misconduct? [37:20.800 --> 37:29.720] Now, I'm going to go through that subject matter jurisdiction challenge, and each point [37:29.720 --> 37:36.200] of law where I asked for a ruling or made a claim that he did not address, I'm going [37:36.200 --> 37:40.120] to charge him criminally for each one under Walker v. Packer. [37:40.120 --> 37:41.120] Really? [37:41.120 --> 37:44.440] What about Walker v. Packer? [37:44.440 --> 37:53.720] Walker v. Packer says a judge has no discretion in properly applying the law to the facts. [37:53.720 --> 37:57.640] A failure to do so is an abuse of discretion. [37:57.640 --> 38:06.600] Well, the way I read 39.03 penal code, if a public official abuses his discretion and [38:06.600 --> 38:12.040] in the process denies me in the full and free access to or enjoyment of a right, well, that's [38:12.040 --> 38:16.320] a class A misdemeanor in the state of Texas. [38:16.320 --> 38:21.760] So, okay, let's dance. [38:21.760 --> 38:24.280] Do you have my email? [38:24.280 --> 38:25.280] I do. [38:25.280 --> 38:32.680] Good, send me an email, and I'll send you the lawsuit I'm crafting. [38:32.680 --> 38:35.520] I've sued a JV. [38:35.520 --> 38:42.920] When you file criminal complaints, if you prepare criminal complaints against this guy [38:42.920 --> 38:50.760] and file it with the local JP, which I just did, and the local JP does not issue a warrant [38:50.760 --> 38:55.880] or a summons, then you file suit against the local JP. [38:55.880 --> 39:00.920] That's what I did to one in Victoria County. [39:00.920 --> 39:06.680] 1505, look at Chapter 15. [39:06.680 --> 39:13.640] 1509 says that if a complaint is forwarded to the court and it meets the requirements [39:13.640 --> 39:21.400] of 1505, the judge shall issue a warrant forthwith. [39:21.400 --> 39:27.760] Now, 1503 says anytime a judge is authorized to issue a warrant, he can issue a summons [39:27.760 --> 39:28.760] instead. [39:28.760 --> 39:33.800] So, the JP was commanded to issue a warrant or a summons. [39:33.800 --> 39:37.280] That was not discretionary. [39:37.280 --> 39:44.720] So, you file a complaint against this judge, and when the JP takes no action, then you [39:44.720 --> 39:54.600] send a tort letter to the JP, and I will send you my lawsuit that I filed. [39:54.600 --> 39:59.720] And when I get, I've got a response from it, it's the standard response. [39:59.720 --> 40:06.520] You were on this first segment, that's what I was talking about. [41:39.680 --> 41:47.280] Well, let me tell you, he didn't know anything, he didn't know anything about what you guys [41:47.280 --> 41:48.280] do. [41:48.280 --> 41:54.040] He didn't know what a verified complaint is. [41:54.040 --> 41:59.360] He did not read all the filings that I turned in. [41:59.360 --> 42:00.360] He skimmed them. [48:00.200 --> 48:03.200] And then I had to figure out how to erase it, because I didn't really know how to do it. [48:03.200 --> 48:07.200] I handed the phone to the bailiff, he said, here, you erase it, because I don't know how to do it. [48:07.200 --> 48:11.200] He couldn't figure it out, so he handed it back, and so I figured it out. [48:11.200 --> 48:15.200] But they threatened me with sending arrest. [48:15.200 --> 48:20.200] Okay, that's more charges we get to bring. [48:20.200 --> 48:23.200] You may be able to see the judge directly for that. [48:23.200 --> 48:27.200] And the bailiff, if the bailiff's hand was anywhere near his pistol, [48:27.200 --> 48:30.200] that's first degree felony aggravated assault. [48:30.200 --> 48:35.200] Oh, he had his hands right there by his belt, right by his pistol. [48:35.200 --> 48:38.200] Okay, first degree felony. [48:38.200 --> 48:43.200] I filed that against the officer who wrote me the ticket. [48:43.200 --> 48:47.200] It was the municipal policeman who wrote you the ticket. [48:47.200 --> 48:53.200] So I will send you the criminal complaint I filed against the officer, [48:53.200 --> 49:01.200] and the one I filed against the chief of police for not presenting my complaint to some magistrate, [49:01.200 --> 49:13.200] and the one I'm preparing to file against the prosecuting attorney to whom he sent the complaint, [49:13.200 --> 49:16.200] I guess to get her advice, and then it disappeared. [49:16.200 --> 49:24.200] So she didn't give notice to some magistrate, so I'll file criminally against her, [49:24.200 --> 49:29.200] and then sue the whole kit and caboodle of them. [49:29.200 --> 49:32.200] Let me ask you a question. [49:32.200 --> 49:35.200] Okay. [49:35.200 --> 49:46.200] Along those lines, so can I file criminal complaints against the mayor and the entire city council [49:46.200 --> 49:54.200] because they run the city, they choose the police chief. [49:57.200 --> 50:07.200] You have the police chief sending his officers out to enforce the Texas transportation code, [50:07.200 --> 50:14.200] but there is nothing in Texas law that authorizes them to enforce the Texas transportation code. [50:14.200 --> 50:19.200] That's what that subject matter jurisdiction challenge was all about. [50:19.200 --> 50:21.200] Right. [50:21.200 --> 50:23.200] So sue the whole city. [50:23.200 --> 50:34.200] Every member, you can accuse each member of the council and the mayor of RICO, [50:34.200 --> 50:47.200] all conspiring to deny the public in due process by acts of first-degree felony aggravated assault. [50:47.200 --> 50:53.200] Now, that officer pulled me over when he turned those lights on. [50:53.200 --> 51:02.200] The only duty I have to pull over and stop when someone turns their lights on me is under the transportation code. [51:02.200 --> 51:06.200] Well, this guy couldn't enforce the transportation code. [51:06.200 --> 51:10.200] There's no authorization for him to enforce it. [51:10.200 --> 51:14.200] There's an authorization for the DPS to enforce it, [51:14.200 --> 51:20.200] and there can be an authorization for a sheriff's deputy if they're appointed as a traffic control officer [51:20.200 --> 51:24.200] by the county commissioner's court and paid by the county commissioner's court, [51:24.200 --> 51:33.200] but there is nothing in Texas law that authorizes a municipal police officer to enforce transportation code. [51:33.200 --> 51:37.200] So this judge said it was all BS. [51:37.200 --> 51:40.200] Well, let's see if it really is BS. [51:40.200 --> 51:50.200] It's an act in concert and collusion with ongoing criminal conspiracy as contemplated by Chapter 71 of the Texas Penal Code, [51:50.200 --> 51:55.200] called the Street Game Statute. Cole, and I talked to a lady there, [53:20.200 --> 53:28.200] and she said she didn't have any of the information, but she sent me a file of everything [53:28.200 --> 53:35.200] about any police officer in Belton, 414 pages. [53:35.200 --> 53:44.200] And I guess I'm supposed to go through there and see if there's an association, authorization, DPS. [53:44.200 --> 53:51.200] But is there a way to request this stuff? [54:25.200 --> 54:30.200] We can do anything we want to, [54:30.200 --> 54:38.200] unless you and I and the rest of these citizens have agreed through their legislatures [54:38.200 --> 54:44.200] to laws that limit us in certain aspects. [54:44.200 --> 54:51.200] So, public officials on the other hand may only do what they are specifically authorized to do. [54:51.200 --> 54:55.200] Now the legislature created the transportation code [54:55.200 --> 55:03.200] and specifically authorized the Department of Public Safety to enforce the transportation code. [55:03.200 --> 55:13.200] Eddie Craig used to like to quote a Latin phrase that essentially meant what is not included is excluded. [55:13.200 --> 55:18.200] Included in the transportation code is an authorization for sheriff's deputies [55:18.200 --> 55:23.200] if they're appointed by the county commissioner's court to act as traffic control officers. [55:23.200 --> 55:27.200] But it's not clear on what that means. [55:27.200 --> 55:33.200] It says traffic control officers, but it's not clear. [55:33.200 --> 55:41.200] It implies that they can enforce the transportation code, but it doesn't exactly say that. [55:41.200 --> 55:44.200] Okay, without taking up that issue, [55:44.200 --> 55:53.200] there is a specific authorization for at least one policing agency to enforce the transportation code. [55:53.200 --> 55:58.200] There is no authorization for any other. [55:58.200 --> 56:04.200] The transportation code is not a part of the public law. [56:04.200 --> 56:09.200] Public law, yes, but it's not a part of the criminal statutes. [56:09.200 --> 56:16.200] Peace officers are authorized to enforce the criminal laws, the criminal statutes. [56:16.200 --> 56:25.200] The transportation code is a commercial statutory scheme [56:25.200 --> 56:31.200] that only applies to someone in a commercial activity. [56:31.200 --> 56:36.200] Nothing authorizes the municipal police to enforce that. [56:36.200 --> 56:42.200] That we need to push because they're not going to want that to get to the Supreme. [56:42.200 --> 56:43.200] Right. [56:43.200 --> 56:46.200] If the court of appeals thinks it's BS, [56:46.200 --> 56:53.200] we'll see how they defend it when we see if the court of appeals thinks it's BS. [01:09:41.200 --> 01:09:45.200] So in Maine, protection from abuse, you know, when they go ex parte [01:09:45.200 --> 01:09:50.200] and they can get a 21-day order regardless of, you know, the fact that they're, [01:09:50.200 --> 01:09:57.200] in this case, a convicted felon with a violent history that's documented. [01:09:57.200 --> 01:10:01.200] Are you talking about abused women? [01:10:01.200 --> 01:10:02.200] Yes. [01:10:02.200 --> 01:10:03.200] Oh, okay. [01:10:03.200 --> 01:10:08.200] I'm helping out a dear friend who has no criminal record, [01:10:08.200 --> 01:10:11.200] raised two teenage boys on her own. [01:10:11.200 --> 01:10:12.200] They're still minors, right? [01:10:12.200 --> 01:10:18.200] So she finally went after dad for child support because he owes over $20,000. [01:10:18.200 --> 01:10:20.200] Dad gets license pulled. [01:10:20.200 --> 01:10:21.200] He doesn't know what to do. [01:10:21.200 --> 01:10:26.200] So he retaliates with the protection from abuse order, right? [01:10:26.200 --> 01:10:27.200] That's what they do. [01:10:27.200 --> 01:10:34.200] So he was able in Maine to go to court, not even see a judge just write on a little piece of paper, [01:10:34.200 --> 01:10:43.200] oh, she's going to harm the kids, you know, not even any sort of specifics or firsthand knowledge, nothing. [01:10:43.200 --> 01:10:48.200] So he gets the PFA, protection from abuse. [01:10:48.200 --> 01:10:53.200] We go to court the next day, file for an immediate hearing, don't wait 21 days. [01:10:53.200 --> 01:10:58.200] That hearing gets continued because the boys are older, 13 and 15. [01:10:58.200 --> 01:11:03.200] So they're not, there's younger kids that take precedent, you know, like they have to, either way. [01:11:03.200 --> 01:11:11.200] We had a scheduled hearing twice now where he showed up, we showed up, and they keep continuing it. [01:11:11.200 --> 01:11:14.200] So they told us now, we asked for another hearing. [01:11:14.200 --> 01:11:15.200] It was denied. [01:11:15.200 --> 01:11:18.200] They said, oh, this is scheduled for August 29th. [01:11:18.200 --> 01:11:28.200] So honest to God, Randy, this would be six weeks of her having no access to her children based on a felon [01:11:28.200 --> 01:11:32.200] who's convicted of numerous violent crimes. [01:11:32.200 --> 01:11:35.200] And there's nothing we can do. [01:11:35.200 --> 01:11:37.200] I mean, I navigate the system. [01:11:37.200 --> 01:11:41.200] I'm successful in a lot of ways, but this is, I'm up against a wall. [01:11:41.200 --> 01:11:47.200] I went to the clerk, said, serve him two days, we need a hearing. [01:11:47.200 --> 01:11:50.200] And she said, I have to go to the judge first. [01:11:50.200 --> 01:11:56.200] And I'm like, how, in Maine, PFAs are under the Maine rules of civil procedure, [01:11:56.200 --> 01:12:02.200] which means that, you know, why would a judge need to say anything? [01:12:02.200 --> 01:12:04.200] Does that make sense to you? [01:12:04.200 --> 01:12:16.200] No, I don't know what Maine's laws on this particular issue looks like, so I don't know how to address it. [01:12:16.200 --> 01:12:21.200] What about the attorney general? [01:12:21.200 --> 01:12:26.200] Does the attorney general in Maine collect child support? [01:12:26.200 --> 01:12:28.200] Oh, possibly. [01:12:28.200 --> 01:12:30.200] I know it's DHHS. [01:12:30.200 --> 01:12:40.200] If he owes you that much in child support, if he was in Texas, or if you were in Texas and he was in Maine, [01:12:40.200 --> 01:12:50.200] they'll go to Maine and get him and bring him to Texas, and he will stay either in jail or working in Texas until it's paid. [01:12:50.200 --> 01:12:53.200] That may be your ace in the hole. [01:12:53.200 --> 01:12:54.200] I hope so. [01:12:54.200 --> 01:12:55.200] I'm a veteran. [01:12:55.200 --> 01:13:00.200] I remember in my active duty, they would take a soldier who the wife would call and say, [01:13:00.200 --> 01:13:08.200] or ex-wife would call and say he owed money, and they'd put them up in front of like 500 soldiers and just like absolutely berate them. [01:13:08.200 --> 01:13:14.200] That's the way it should be, but Maine is so blue and gross, and so is our AG, though. [01:13:14.200 --> 01:13:17.200] That's the problem with going through these people. [01:13:17.200 --> 01:13:20.200] Well, sometimes you have to beat them up a little. [01:13:20.200 --> 01:13:24.200] Everybody's afraid to get these guys upset at them. [01:13:24.200 --> 01:13:25.200] They don't understand. [01:13:25.200 --> 01:13:29.200] They think if you upset one of these guys at you, they'll retaliate against you. [01:13:29.200 --> 01:13:31.200] No, they won't. [01:13:31.200 --> 01:13:36.200] They don't want negative politics. [01:13:36.200 --> 01:13:37.200] You know who I am. [01:13:37.200 --> 01:13:39.200] You know what I do. [01:13:39.200 --> 01:13:42.200] They don't retaliate against me. [01:13:42.200 --> 01:13:43.200] No. [01:13:42.200 --> 01:13:46.200] They don't want anything to do with me. [01:13:46.200 --> 01:13:47.200] Right. [01:13:47.200 --> 01:13:51.200] Because they know I'll give them some political difficulty. [01:13:51.200 --> 01:13:58.200] Dr. Joe's on, and he was with me last time we were in Victoria County. [01:13:58.200 --> 01:14:09.200] These guys were running around on their tippy toes because they know just give me the slightest opportunity, I'll land on you like a ton of bricks. [01:14:09.200 --> 01:14:14.200] I landed on their JP, and nobody can protect him from me. [01:14:14.200 --> 01:14:24.200] How do we hold the judge, the brand new judge who issued this 21-day order, which has now turned into like a continue, continue six weeks, [01:14:24.200 --> 01:14:29.200] how do we hold that brand new Governor Janet Mills' appointee? [01:14:29.200 --> 01:14:33.200] How do we hold her liable for I don't know, judicial complaints? [01:14:33.200 --> 01:14:36.200] File a judicial conduct complaint against her. [01:14:36.200 --> 01:14:42.200] Yeah, but that doesn't help to get her boys back before, you know, three more weeks. [01:14:42.200 --> 01:14:46.200] I can't advise you on what the law is in Maine until I've read it. [01:14:46.200 --> 01:14:53.200] Well, the statute says 21 days, you know, they will be heard, but they're lawless up here. [01:14:53.200 --> 01:14:55.200] They don't care. [01:14:55.200 --> 01:14:57.200] No, no, no, no, they're not lawless. [01:14:57.200 --> 01:15:02.200] They're only lawless when people don't take them to the law. [01:15:02.200 --> 01:15:03.200] They're lawless here. [01:15:03.200 --> 01:15:16.200] These guys are just doing whatever they want to, and they will keep doing it until you step right square in the middle of them. [01:15:16.200 --> 01:15:21.200] It's no different in Maine than anywhere else. [01:15:21.200 --> 01:15:26.200] Well, unfortunately, that's not because Maine's blue. [01:15:26.200 --> 01:15:31.200] That's because people are simply the way people are. [01:15:31.200 --> 01:15:33.200] We have a trifecta of evil up here. [01:15:33.200 --> 01:15:35.200] We got the AG. [01:15:35.200 --> 01:15:37.200] We got the governor. [01:15:37.200 --> 01:15:39.200] Everybody's blue, the secretary of state. [01:15:39.200 --> 01:15:45.200] But either way, I know you can hold them to the law, but where the timing is kind of necessary. [01:15:45.200 --> 01:15:57.200] Keep in mind, you can never expect to win your case simply because you have the law and the facts on your side. [01:15:57.200 --> 01:15:59.200] To think so is naive. [01:15:59.200 --> 01:16:02.200] It is not that way now. [01:16:02.200 --> 01:16:08.200] It never has been that way so long as we have had human beings for judges. [01:16:08.200 --> 01:16:18.200] With that said, the fact that they are human beings should tell us how to handle them. [01:16:18.200 --> 01:16:24.200] Human beings do not let difficulty bring the judge difficulty. [01:16:24.200 --> 01:16:31.200] You filed a judicial complaint against the judge for failing to maintain his calendar. [01:16:31.200 --> 01:16:37.200] We actually got one sanctioned in New York for that over a traffic ticket. [01:16:37.200 --> 01:16:40.200] It caused too much delay. [01:16:40.200 --> 01:16:44.200] But that will go on his record and mark his record forever. [01:16:44.200 --> 01:16:45.200] Get him off the dime. [01:22:30.200 --> 01:22:33.200] Most states publish a book. [01:22:33.200 --> 01:22:41.200] Texas has O'Connor's and they publish their litigation guide in books every two years. [01:22:41.200 --> 01:22:43.200] They publish a new volume. [01:22:43.200 --> 01:22:51.200] And the lawyers always want to get the newest stuff so they buy all the new books and they push the old ones in the back of their closet. [01:22:51.200 --> 01:22:59.200] Eddie Craig called a lawyer and asked him do you have any old litigation guides or any old legal books you want to get rid of? [01:22:59.200 --> 01:23:01.200] He said you're going to need a box truck. [01:23:01.200 --> 01:23:04.200] They've got an 18-foot truck to haul them out with. [01:23:04.200 --> 01:23:09.200] But that was all the old law books you always used to see in lawyer's offices. [01:23:09.200 --> 01:23:11.200] That's all outdated now so they got rid of all of those. [01:26:53.200 --> 01:27:00.200] The bailiffs are our friends, they made sure they went up front because one time the court clerks were pretending to be busy and there was nobody in line. [01:27:04.200 --> 01:27:08.200] They're sitting there talking about the weekends, you know, like nobody's around. [01:27:08.200 --> 01:27:10.200] So the bailiff went back there and told them they need to pull. [01:27:10.200 --> 01:27:14.200] They're a custodian for my record and you better pull it right now. [01:27:14.200 --> 01:27:15.200] And then it happened. [01:27:15.200 --> 01:27:16.200] The bailiffs are our friends. [01:27:16.200 --> 01:27:17.200] I love those people. [01:27:27.200 --> 01:27:31.200] I went to the Dallas court, county court. [01:27:31.200 --> 01:27:33.200] I'd been there once before and they gave me a hard time. [01:27:33.200 --> 01:27:36.200] So I went to a bailiff and a big tall guy. [01:27:36.200 --> 01:27:38.200] I said, I need some help. [01:27:38.200 --> 01:27:40.200] He said, well, what do you need? [01:27:40.200 --> 01:27:44.200] I said, well, I'm going to go ask for some records from the county clerk. [01:27:44.200 --> 01:27:47.200] And the last time I was here, they didn't give them to me. [01:27:47.200 --> 01:27:49.200] They gave me a hard time. [01:27:49.200 --> 01:27:52.200] And if they do that again, I want you to be there so you'll see [01:27:52.200 --> 01:27:55.200] and hear the offense of being committed, [01:27:55.200 --> 01:27:57.200] offense of official oppression being committed. [01:27:57.200 --> 01:28:00.200] Then I'm going to want you to arrest the clerk. [01:28:00.200 --> 01:28:03.200] Well, I do that because generally they won't come with me, [01:28:03.200 --> 01:28:07.200] but they'll run around and tell the clerk that I'm going to try to get her arrested. [01:28:07.200 --> 01:28:10.200] And that generally gets them to not give me a hard time. [01:28:10.200 --> 01:28:13.200] But this guy looked down at me and thought a minute [01:28:13.200 --> 01:28:16.200] and this big smile come across his face. [01:28:16.200 --> 01:28:18.200] Sure. [01:28:18.200 --> 01:28:21.200] I got in line and we're standing there in line. [01:28:21.200 --> 01:28:22.200] He's standing right next to me. [01:28:22.200 --> 01:28:24.200] We get up to the window. [01:28:24.200 --> 01:28:27.200] The clerk looked at me and then looked up at this big bailiff. [01:28:27.200 --> 01:28:30.200] And she said to him, can I help you? [01:28:30.200 --> 01:28:33.200] And the bailiff said, he grinned. [01:28:33.200 --> 01:28:37.200] I knew they had something going on, him and the clerks. [01:28:37.200 --> 01:28:43.200] He grinned real big and said, I'm with him. [01:28:43.200 --> 01:28:46.200] It was incredible. [01:28:46.200 --> 01:28:50.200] She was jumping all over herself to get me what I wanted. [01:35:04.200 --> 01:35:10.200] And he just cruised down and go over, ignore all of that, go to the meet with Ken. [01:35:10.200 --> 01:35:11.200] That's what he did. [01:35:11.200 --> 01:35:15.200] He went down to what Ken was asking for and just signed it. [01:35:15.200 --> 01:35:20.200] Now, he knew that wasn't put in by a lawyer, but when he was reading it, [01:35:20.200 --> 01:35:24.200] it's like it slipped out of his mind that this was pro se, [01:35:24.200 --> 01:35:28.200] because it looked exactly like what the lawyers gave him. [01:35:28.200 --> 01:35:30.200] And litigation guide will let you do that. [01:35:30.200 --> 01:35:34.200] Once you get that, and look at this husband. [01:36:17.200 --> 01:36:19.200] Okay, you run into your first bump, [01:36:19.200 --> 01:36:26.200] and it may be that this new judge doesn't have his feet down good yet. [01:36:32.200 --> 01:36:35.200] I'm a guy, and if I do something wrong, [01:36:35.200 --> 01:36:38.200] and someone gives me a good, swift kick in the butt, [01:36:38.200 --> 01:36:41.200] I tend not to take that personal. [01:36:41.200 --> 01:36:42.200] Right. [01:36:42.200 --> 01:36:45.200] I take that as an indication I need to do it better next time. [01:36:45.200 --> 01:36:49.200] And generally, when someone gives me a good, swift kick, [01:36:49.200 --> 01:36:51.200] I then tend to respect them for it. [01:37:24.200 --> 01:37:27.200] You'll be surprised how helpful they'll be. [01:37:27.200 --> 01:37:32.200] How can I move the attorney general off the dime? [01:37:32.200 --> 01:37:34.200] And they'll probably give you what you need. [01:37:34.200 --> 01:37:39.200] Do something for the people, not the government, you know? [01:37:39.200 --> 01:37:41.200] No, these guys aren't all bad guys. [01:37:41.200 --> 01:37:44.200] Prosecutors, you know, we pick on them, we vilify them, [01:37:44.200 --> 01:37:46.200] but they're not really all bad guys. [01:37:46.200 --> 01:37:53.200] When you talk about protecting the children and protecting women from felons, [01:37:53.200 --> 01:37:56.200] the DA is going to be on your side. [01:49:37.200 --> 01:49:45.200] I filed a petition for writ of mandamus asking the appellate court to order these guys to toss this jerk [01:49:45.200 --> 01:49:50.200] and get you a real judge to adjudicate your case. [01:49:50.200 --> 01:49:54.200] How is there even time to do anything like that? [01:49:54.200 --> 01:49:58.200] We filed a motion for what I'd call a plea in abatement. [01:50:52.200 --> 01:50:58.200] Most guys come into court and the courts screw them around and they whine and they complain [01:50:58.200 --> 01:51:03.200] and lick their wounds and go home. [01:51:03.200 --> 01:51:06.200] Most people don't take them on. [01:51:06.200 --> 01:51:12.200] And filing a petition for writ of mandamus, it doesn't matter if you get it or not. [01:51:12.200 --> 01:51:18.200] That's telling them, I'm going to appeal you guys all the way to the Supreme if I have to. [01:51:18.200 --> 01:51:26.200] I'm going to cost you a fortune if you don't do what I want you to. [01:51:26.200 --> 01:51:32.200] Just being a victim, letting them beat you up and feeling bad about it, [01:51:32.200 --> 01:51:34.200] that's not going to change anything. [01:53:13.200 --> 01:53:18.200] And if they can kick you around to do ignorant stuff too, you can get you to go away. [01:53:18.200 --> 01:53:19.200] Wonderful. [01:53:23.200 --> 01:53:32.200] And you have powers and abilities far beyond those of mortal attorneys. [01:53:32.200 --> 01:53:34.200] You file a suit against them. [01:53:34.200 --> 01:53:39.200] You file this, you know, they'll immediately file a motion to dismiss. [01:53:39.200 --> 01:53:44.200] And you file a bar grievance against the lawyers for filing a frivolous pleading. [01:53:44.200 --> 01:53:46.200] And this, you'll find it interesting. [01:53:46.200 --> 01:53:52.200] You know, when you start researching the issues, it's not as hard as you think. [01:53:52.200 --> 01:53:55.200] You know, you think about what it's like to be a lawyer. [01:53:55.200 --> 01:53:58.200] Well, it's difficult because it's all this law you have to know. [01:53:58.200 --> 01:54:01.200] But you don't have to know all that law. [01:54:01.200 --> 01:54:04.200] You're pinpoint focused. [01:54:04.200 --> 01:54:08.200] There's just one thing you have to look at, and it's not that difficult. [01:54:08.200 --> 01:54:14.200] I spent three hours this morning researching out an issue. [01:54:14.200 --> 01:54:23.200] And it was actually interesting getting to read this case. [01:54:23.200 --> 01:54:26.200] And this case talks about this other case, and I go to that case. [01:54:26.200 --> 01:54:33.200] And you don't have to read the whole case because, like, the issue I'm looking for, [01:54:33.200 --> 01:54:35.200] I read a case, and it refers to another case. [01:54:35.200 --> 01:54:40.200] So I take some of the key words out of this case, open the other case, [01:54:40.200 --> 01:54:46.200] put those key words in, boom, takes me right to the section I want to look at. [01:54:46.200 --> 01:54:54.200] And what the courts do is they explain how they got to the issues they get to. [01:54:54.200 --> 01:54:58.200] They say, oh, in this case, we rule this way, and on that other case, we rule that way. [01:54:58.200 --> 01:55:03.200] And this is in between, so we're ruling here to close this gap in between. [01:55:03.200 --> 01:55:09.200] And after reading it, it's like two or three paragraphs of each case. [01:55:09.200 --> 01:55:12.200] This all starts to fit together. [01:55:12.200 --> 01:55:18.200] Lawyers, they don't do that because it's not profitable for them. [01:55:18.200 --> 01:55:24.200] When you start digging in those cases and start hammering on with the case law, [01:55:24.200 --> 01:55:28.200] now the lawyer's got to get the books out. [01:55:28.200 --> 01:55:31.200] And they hate that because it costs them a fortune. [01:55:31.200 --> 01:55:34.200] And when you bargain them into the Stone Age, [01:55:34.200 --> 01:55:39.200] the first law firm is going to disappear and you're going to get another one. [01:55:39.200 --> 01:55:43.200] And that's going to cost your client a fortune. [01:55:43.200 --> 01:55:45.200] And you start hammering them. [01:55:45.200 --> 01:55:48.200] You file judicial conduct complaints against the judge just to annoy him. [01:55:48.200 --> 01:55:54.200] I ask the judge to arrest himself. [01:55:54.200 --> 01:55:57.200] Then I ask him for a bailiff at the next hearing. [01:55:57.200 --> 01:55:58.200] Well, why do you need a bailiff? [01:55:58.200 --> 01:56:00.200] Well, because you're committing crimes in the courtroom, [01:56:00.200 --> 01:56:03.200] and I'm going to want him to arrest you. [01:56:03.200 --> 01:56:06.200] I'm going to deny that request. [01:56:06.200 --> 01:56:08.200] The judge denied it? [01:56:08.200 --> 01:56:11.200] Yeah, he denied it. [01:56:11.200 --> 01:56:13.200] Who cares? [01:56:13.200 --> 01:56:14.200] I'm jerking him around. [01:56:14.200 --> 01:56:17.200] He knows I'm jerking him around. [01:56:17.200 --> 01:56:23.200] And he just can't help doing stupid stuff. [01:56:23.200 --> 01:56:30.200] When I get out of his court, I am going to work him over. [01:56:30.200 --> 01:56:33.200] You're going to be in a little higher level court. [01:56:33.200 --> 01:56:41.200] You'll get a little better quality judge, a judge who has a career he wants to protect. [01:56:41.200 --> 01:56:43.200] These guys aren't so hard to beat up. [01:56:50.200 --> 01:56:54.200] The guy filed an answer with a subject matter jurisdiction challenge. [01:56:54.200 --> 01:56:55.200] But I looked at it. [01:56:55.200 --> 01:56:59.200] He really challenged subject matter jurisdiction. [01:56:59.200 --> 01:57:02.200] He said that the judge had immunity. [01:57:02.200 --> 01:57:05.200] Well, immunity is an affirmative defense. [01:57:05.200 --> 01:57:11.200] So the subject matter jurisdiction filing wasn't subject matter jurisdiction. [01:57:11.200 --> 01:57:15.200] And subject matter jurisdiction filing doesn't have to be notarized. [01:57:15.200 --> 01:57:17.200] And it wasn't. [01:57:17.200 --> 01:57:21.200] But if it's not really a subject matter jurisdiction challenge and it's an answer, [01:57:21.200 --> 01:57:24.200] that had to be notarized. [01:58:03.200 --> 01:58:08.200] They're verified affidavits, not just declarations. [01:58:08.200 --> 01:58:10.200] They don't have to be verified. [01:58:10.200 --> 01:58:14.200] Any fact in a pleading must be verified. [01:58:14.200 --> 01:58:19.200] If it's not, then move to dismiss the whole thing. [01:58:19.200 --> 01:58:20.200] Yeah. [01:58:20.200 --> 01:58:27.200] It's in front of the court, but the court can't see it because it's not verified. [01:58:27.200 --> 01:58:28.200] It doesn't meet the rules.
