[23:17.240 --> 23:26.240] No, he was an assistant district clerk but he was kind of the head assistant guy [23:26.240 --> 23:35.240] When you were asking about swearing a document, are you talking about to say this is subscribed and sworn? [23:35.240 --> 23:41.240] Yeah, I wanted him to issue the oath and swear to this document and he said we don't do that [23:41.240 --> 23:46.240] I said actually yes you do [23:46.240 --> 23:49.240] Oh no, you'll have to go to a notary [23:49.240 --> 23:52.240] So I went out in the hall and asked the bailiffs to arrest him [23:52.240 --> 24:00.240] Well, let me explain the techniques I've developed [24:00.240 --> 24:06.240] When I come into the courthouse, they've got their little scanner thing [24:06.240 --> 24:11.240] We have to take out our wallets and our belt and all that stuff [24:11.240 --> 24:15.240] I always jack with the bailiffs there [24:15.240 --> 24:18.240] I talk to them, I joke with them [24:18.240 --> 24:24.240] I told the bailiff when I walked through, I had my cowboy boots on and they've got a steel shank [24:24.240 --> 24:28.240] So they always set off the buzzer [24:28.240 --> 24:38.240] And the guy stepped up and I said look, if I make that paddle you've got beep, are you going to spank me with it? [24:38.240 --> 24:41.240] I always do that and he said no, no, I'm not going to spank you [24:41.240 --> 24:46.240] And then I tell him about, I was in Philadelphia in the federal courthouse [24:46.240 --> 24:58.240] I made the thing beep and this big portly female bailiff stepped up with one of these paddles [24:58.240 --> 25:03.240] And I asked her if I make that thing beep, are you going to spank me with that paddle? [25:03.240 --> 25:07.240] And oh, her face brightened up, she held up the paddle, you bet! [25:07.240 --> 25:12.240] I said wait a minute, wait a minute, you're too excited about that [25:12.240 --> 25:16.240] So I tell him about that and he just makes these jokes back and forth [25:16.240 --> 25:22.240] So they kind of feel like this guy's not a bad guy, he's just kind of laughing and joking [25:22.240 --> 25:30.240] And then I go into the county clerk's office and this assistant clerk, the only male guy in the office [25:30.240 --> 25:36.240] Wants to jerk me around so I go out to the bailiffs and ask them to go in there and arrest her [25:36.240 --> 25:39.240] And I've just been joking with them [25:39.240 --> 25:42.240] And now I'm asking them to arrest the clerk [25:42.240 --> 25:45.240] I said come on guys, take your chicken suit off [25:45.240 --> 25:48.240] Go in this guy's first rodeo [26:12.240 --> 26:19.240] This guy has something going on and he's playing us [26:19.240 --> 26:24.240] And that's why I was trying to get them to be really, really careful [26:24.240 --> 26:30.240] And the last time I was there I did the same thing and I came this time and they were really, really careful with me [26:30.240 --> 26:35.240] So I jerked around the county clerk and then I went up and talked to the district clerk [26:35.240 --> 26:40.240] And she had no attitude at all [26:40.240 --> 26:45.240] And she was absolutely a consummate professional [26:45.240 --> 26:53.240] And I treated her with the most dignity and respect that I could muster [26:53.240 --> 27:03.240] The reason I did that is because when I go after the district judges and the prosecuting attorney [27:03.240 --> 27:09.240] Because they haven't given the clerk records that she should have [27:09.240 --> 27:16.240] And they're going to come in there griping about me and she's going to say, hey, I talked to this guy, he was really a nice guy [27:16.240 --> 27:21.240] I didn't have any problem with him at all [27:21.240 --> 27:28.240] If we are going to take these guys on, we need to get our professionalism in order [27:28.240 --> 27:36.240] We need to get our goals and our purpose firmly fixed [27:36.240 --> 27:42.240] And then use these people to get us to where we want to be [27:42.240 --> 27:53.240] You and I, as citizens in a republic, do not have the liberty to have an attitude [27:53.240 --> 27:57.240] If someone says something to us we don't like [27:57.240 --> 28:02.240] We don't have the liberty to do a little song and dance and seltzer down your pants for them [28:02.240 --> 28:06.240] We don't get to jump up and down and rail in righteous indignation [28:06.240 --> 28:08.240] We need to keep our stuff together [28:08.240 --> 28:12.240] I didn't say that word S-H-I, you know [28:12.240 --> 28:15.240] But we need to keep that together [28:15.240 --> 28:17.240] We need to be the pro [28:17.240 --> 28:20.240] So we go in there and play them [28:20.240 --> 28:22.240] We play them like a cheap fiddle [28:22.240 --> 28:26.240] So that's what I did, I played them like a cheap fiddle [28:26.240 --> 28:33.240] And the justice of the peace to whom I filed the original criminal complaints [28:33.240 --> 28:38.240] Which I've talked to about here several times [28:38.240 --> 28:41.240] And he refused to even read them [28:41.240 --> 28:46.240] I filed a notice of intent to sue and then I sued him [28:46.240 --> 28:52.240] So I'm back and the week before I sued him and I'm back [28:52.240 --> 28:57.240] I got a notice from the constable showing that he has been served [28:57.240 --> 29:04.240] And the assistant clerk said, oh well, Mr. Kelton, he's already filed an answer [29:04.240 --> 29:07.240] Oh, wonderful [29:07.240 --> 29:15.240] So I sued him and he got served and within a week he already had an answer in [29:15.240 --> 29:20.240] So that told me that I got their attention [29:20.240 --> 29:25.240] So I paid him eight bucks to look at the eight page motion [29:25.240 --> 29:31.240] And the lawyers claimed that the judge was immune from suit [29:31.240 --> 29:38.240] And when we come back I'm going to talk about this because it gets pretty complex [29:38.240 --> 29:42.240] And we need to be able to wrap our head around this [29:42.240 --> 29:47.240] The first thing I did is I took his answer [29:47.240 --> 29:52.240] And I looked at the cases that he cited [29:52.240 --> 29:55.240] And I used like something's hanging over your head and what if you get something wrong [35:06.240 --> 35:08.240] You just get to go beat them up [35:08.240 --> 35:12.240] I've got a $400 million lawsuit I filed against my county [35:12.240 --> 35:17.240] It is really hard for me to work on that suit [35:17.240 --> 35:21.240] Because I have an investment in it [35:21.240 --> 35:25.240] If I do something wrong, it's just a big deal for me [35:25.240 --> 35:28.240] And I have to struggle to work on that [35:28.240 --> 35:35.240] But when I go in for Dr. Joe, heck, I don't have a dog in this hunt [35:35.240 --> 35:38.240] It is so much easier [35:38.240 --> 35:44.240] You know, I tell everybody the best fight to have is the one you picked [35:44.240 --> 35:50.240] If you pick the fight, you don't really have a dog in that hunt [35:50.240 --> 35:53.240] So it is so much easier [35:53.240 --> 35:58.240] We have so many people calling in because they have serious issues affecting them [35:58.240 --> 36:02.240] And we tell them you need to do these things to help you out [36:02.240 --> 36:13.240] But they are so oppressed by the possibility of them losing their liberty, of losing their case [36:13.240 --> 36:26.240] When Cherokee County came after me, to address the issues they were bringing was an incredible struggle for me [36:26.240 --> 36:35.240] There's something about it, when they come after you, to fight it is just horribly oppressive [36:35.240 --> 36:38.240] It was incredibly difficult [36:38.240 --> 36:43.240] I probably could have won that if I had been more vigorous [36:43.240 --> 36:46.240] But it just was so hard [36:46.240 --> 36:48.240] They're coming after me [36:48.240 --> 36:49.240] It's oppressive [36:49.240 --> 36:53.240] If I make the slightest mistake, the sky can fall in on me [36:53.240 --> 37:00.240] So to get it down, to figure out how to do it, go pick a fight [37:00.240 --> 37:05.240] Go pick a fight, you don't have a dog in the hunt [37:05.240 --> 37:10.240] Dr. Joe, they went after Dr. Joe, I didn't have anything to do with that [37:10.240 --> 37:17.240] I don't have a dog in that hunt, so I went down there and I'm just having great fun at their expense [37:17.240 --> 37:21.240] And it makes it much easier for me to come after them [37:21.240 --> 37:29.240] That is an odd phenomena that I did not expect when I started all of this [37:29.240 --> 37:35.240] I've had four or five lawsuits I could have filed [37:35.240 --> 37:41.240] But when I have a dog in the hunt, it is so hard [37:41.240 --> 37:49.240] And when they say that a lawyer who represents himself has a flu for a client, they're right [37:49.240 --> 37:59.240] Because even if he's a lawyer, it's really hard for him to produce documents and pleadings that could determine his future [37:59.240 --> 38:03.240] It is a struggle, so go pick a fight [38:03.240 --> 38:05.240] Help somebody else [38:05.240 --> 38:07.240] Exactly, help somebody else [38:07.240 --> 38:09.240] Pick up on their fight [38:09.240 --> 38:11.240] I went to Victoria County [38:11.240 --> 38:12.240] Totally different [38:12.240 --> 38:15.240] I was having so much fun [38:15.240 --> 38:25.240] I sued this Justice of the Peace because he refused to act on the criminal complaints I filed against him [38:25.240 --> 38:30.240] And I know all these guys are looking at this and saying, this is all BS [38:30.240 --> 38:34.240] This is such minor nitpicking stuff, it's no big deal [38:34.240 --> 38:37.240] So he hires a law firm [38:37.240 --> 38:41.240] I have to give the JP credit [38:41.240 --> 38:46.240] He understood that I sued him in his personal capacity [38:46.240 --> 38:49.240] I was hoping that he would have the county [38:49.240 --> 38:53.240] Oh, you don't have a county attorney in Victoria County [38:53.240 --> 38:57.240] I was hoping he would have the district attorney answer for him [38:57.240 --> 39:03.240] But somebody was smart enough to know that idea [39:03.240 --> 39:06.240] Maybe the district attorney [39:06.240 --> 39:08.240] That's what I think it was [39:08.240 --> 39:10.240] I'm not messing with that [39:10.240 --> 39:14.240] This district attorney doesn't have a dog in this hunt [39:14.240 --> 39:19.240] They know I'm there because of what they did to Dr. Joe [39:19.240 --> 39:25.240] And the district attorney looked at it and said, I didn't have anything to do with that [39:25.240 --> 39:31.240] So she could give the JP good advice [39:31.240 --> 39:39.240] If she did talk to them about it, and I'm sure she did, she told him, this guy sued you in your personal capacity [39:39.240 --> 39:45.240] You may have official immunity, but you have to plead it [39:45.240 --> 39:51.240] And you can't plead it with a government attorney, you have to hire your own [39:51.240 --> 39:54.240] And he did [39:54.240 --> 40:00.240] But they answered my suit within four or five days [40:00.240 --> 40:04.240] Brett, what does that tell you? [40:04.240 --> 40:08.240] It tells me that he didn't think about asking for discovery [40:08.240 --> 40:12.240] He's already to the point where he's ready for an answer [40:12.240 --> 40:15.240] He has to answer before he asks for discovery [40:15.240 --> 40:20.240] But generally they always take all the time they can [40:20.240 --> 40:23.240] But they answered immediately [40:23.240 --> 40:28.240] I went to Victoria County a week after I filed the complaints [40:28.240 --> 40:44.240] And I told them I didn't get any notice from the constable that he had filed service on the Justice of the Peace [40:44.240 --> 40:53.240] So if he hasn't, I want you to cancel my request that the bailiff serve it, and I'll serve it when I have served myself from somebody else [40:53.240 --> 40:57.240] And they said, oh, well, they've already answered [40:57.240 --> 41:00.240] Say what? [41:00.240 --> 41:04.240] I filed suit and a week later I've already got an answer [41:04.240 --> 41:08.240] Do you think he's really confident in that immunity? [41:08.240 --> 41:12.240] I think I got their attention [41:12.240 --> 41:15.240] And they jumped in there as fast as they could [41:15.240 --> 41:26.240] And the law firm they called went to their file and pulled out their standard response to a suit against a public official [41:26.240 --> 41:31.240] I don't think they realized I played them like a cheap fiddle [41:31.240 --> 41:34.240] I've got to set them up for this [41:34.240 --> 41:36.240] So they just filed their standard motion [41:36.240 --> 41:47.240] Okay, when you get a response from opposing counsel, read it very carefully [41:47.240 --> 41:55.240] Take their response and save it into a different file, one that you could edit [41:55.240 --> 42:08.240] See, they filed a response that was a PDF file, and I opened it in Acrobat and I exported it to a Word file so I could edit it [42:08.240 --> 42:21.240] Then I went through the file and I took every case that they cited and went to that case and opened it [42:21.240 --> 42:35.240] And I looked at the context under which they cited it and I put in a search term to look for the section in the case which they were speaking to [42:35.240 --> 42:41.240] And holy moly what I found [42:41.240 --> 42:47.240] They claimed they filed a challenge to subject matter jurisdiction [42:47.240 --> 42:52.240] Okay, listen closely, this gets complex [42:52.240 --> 43:02.240] They filed a challenge to subject matter jurisdiction and claimed that the judge has absolute immunity [43:02.240 --> 43:08.240] Brett, what is wrong with that picture? [43:08.240 --> 43:13.240] Immunity only extends to when they're not doing crimes? [43:13.240 --> 43:22.240] No, they claim subject matter jurisdiction, and that was a set up there [43:22.240 --> 43:33.240] This is so subtle that I would never have caught this if I hadn't opened the case that they cited [43:33.240 --> 43:51.240] The case that they cited said the defendant filed a motion, a challenge to subject matter jurisdiction, but only argued in personum jurisdiction [43:51.240 --> 43:59.240] I read that and said, whoa, whoa, whoa, wait a minute, wait a minute, what? [46:45.240 --> 46:48.240] And we're down in Victoria County. [46:48.240 --> 46:54.240] It is a fight that I picked and I'm having way too much fun. [46:54.240 --> 47:01.240] So I went to the JP and asked him to issue some warrants and he refused. [47:01.240 --> 47:05.240] And when I listened to the recording, he didn't say, I'm not going to take these. [47:05.240 --> 47:12.240] He said, I'm not going to weed these and threw them down stormed out. [47:12.240 --> 47:19.240] So I called 911 and asked for an officer to come out and file a criminal complaint against him. [47:19.240 --> 47:22.240] And we did the whole song and dance. [47:22.240 --> 47:29.240] So subsequently I filed a criminal complaint against him with a district judge just to set up the district judge. [47:29.240 --> 47:36.240] And then I filed suit against him and he immediately filed a response. [47:36.240 --> 47:44.240] But the response said, it was titled Challenge to Subject Matter Jurisdiction. [47:44.240 --> 47:56.240] But they never addressed the authority of this particular court to hear this particular kind of case. [47:56.240 --> 47:58.240] That's subject matter jurisdiction. [47:58.240 --> 48:04.240] What they said was is that the judge has absolute immunity. [48:04.240 --> 48:08.240] Well, that doesn't go to subject matter. [48:08.240 --> 48:10.240] That's personal jurisdiction. [48:10.240 --> 48:11.240] Exactly. [48:11.240 --> 48:16.240] This court could rule on this particular kind of issue. [48:16.240 --> 48:29.240] And once subject matter is established, then they can come back and say the court does not have in personum jurisdiction, [48:29.240 --> 48:38.240] doesn't have jurisdiction over this particular person because this particular person is a judge. [48:38.240 --> 48:42.240] And a judge has absolute immunity. [48:42.240 --> 48:45.240] That's in personum. [48:45.240 --> 49:01.240] So I go back to the court and say that the response filed was titled Subject Matter Jurisdiction. [49:01.240 --> 49:06.240] But the defendant did not challenge subject matter jurisdiction. [49:06.240 --> 49:12.240] In fact, they challenged in personum jurisdiction. [49:12.240 --> 49:15.240] Important distinction here. [49:15.240 --> 49:25.240] It does not matter how the defendant titled his plea. [49:25.240 --> 49:31.240] The title of the pleading is not controlling. [49:31.240 --> 49:34.240] The content of the pleading is controlling. [49:34.240 --> 49:45.240] I was in Cherokee County trying to help Robert Fox, and he was a long-time legal research guy, very well known. [49:45.240 --> 49:49.240] And he filed these motions and pleadings. [49:49.240 --> 49:53.240] And I was sitting in the court, and the court is going through these documents, [49:53.240 --> 49:59.240] and they're saying we're not really sure of what he's asking for here. [49:59.240 --> 50:02.240] We don't know what the content is. [50:02.240 --> 50:09.240] His title doesn't match what he's asking for, so they're trying to decide what to call these pleadings. [50:09.240 --> 50:13.240] Because the title of the pleading is not controlling. [50:13.240 --> 50:16.240] The content of the pleading is controlling. [50:16.240 --> 50:22.240] In this case, the defendant filed a challenge to subject matter jurisdiction, [50:22.240 --> 50:27.240] but there was nothing in the pleading going to subject matter jurisdiction. [50:27.240 --> 50:37.240] So I can't ask the court to just dismiss this whole thing because their pleading was not a challenge to subject matter jurisdiction. [50:37.240 --> 50:40.240] It was what it was. [50:40.240 --> 50:48.240] And what it actually was was a challenge to in personum jurisdiction. [50:48.240 --> 50:54.240] They challenged not that the court could not hear this kind of case, [50:54.240 --> 50:59.240] but that the judge could not be sued under these circumstances. [50:59.240 --> 51:02.240] So that goes to in personum. [51:02.240 --> 51:07.240] So now I'm crafting a response to that motion. [51:07.240 --> 51:18.240] And I will address the fact that the pleading was, oh, what's the term, not, that the issue was not artfully. [51:18.240 --> 51:20.240] Unresponsive. [51:20.240 --> 51:25.240] Well, no, not artfully pled. [51:25.240 --> 51:32.240] It was responsive, but they responded to in personum instead of subject matter. [51:32.240 --> 51:36.240] They called it subject matter, but that didn't make any difference. [51:36.240 --> 51:41.240] It was actually an in personum challenge. [51:41.240 --> 51:47.240] So assuming they challenged in personum, that's what I'm going to answer. [51:47.240 --> 51:54.240] If I answered subject matter, I would have screwed up. [51:54.240 --> 52:06.240] So guys, goyles, when you get an emotion or a response to a pleading, read it very carefully. [52:06.240 --> 52:14.240] And the first thing you should do is take every case they cite, open it, [52:14.240 --> 52:18.240] go on the Internet and search out that case, [52:18.240 --> 52:28.240] and take some of the verbiage that they used in speaking to that particular case and hit Control F. [52:43.240 --> 52:48.240] The second case I opened, it addressed what they were going to, [52:48.240 --> 52:55.240] but it said that the motion was filed as a subject matter jurisdiction challenge, [52:55.240 --> 53:03.240] but in fact, they only addressed in personum jurisdiction. [53:03.240 --> 53:10.240] Holy moly, they addressed the wrong issue. [53:10.240 --> 53:13.240] They addressed in personum, but they did not do it artfully, [53:13.240 --> 53:21.240] because they did it under a title of subject matter jurisdiction. [53:21.240 --> 53:24.240] So I went back and looked into in personum. [53:24.240 --> 53:26.240] And here's the deal. [53:26.240 --> 53:37.240] I claimed that the judge in this case had no discretion. [53:37.240 --> 53:45.240] The statute said that when a complaint is filed, the judge shall issue a warrant for threat. [53:45.240 --> 53:48.240] It did not say may, might, or can if he wants to. [53:48.240 --> 53:53.240] Shall issue a warrant for threat. [53:53.240 --> 54:00.240] And I maintained that the judge did not issue a warrant for threat. [54:00.240 --> 54:14.240] And I have case law to show that when a judicial officer issues an order or an opinion [54:14.240 --> 54:27.240] over which he has no discretion, that order or opinion is administrative and not judicial. [54:27.240 --> 54:42.240] A very fine but important distinction, because the case law says when a public official [54:42.240 --> 54:53.240] fails to exercise an authority over which he has no discretion, he has no immunity, [54:53.240 --> 54:57.240] I played the judge like a cheap fiddle. [54:57.240 --> 55:03.240] I wrote my pleading based on that consideration. [55:03.240 --> 55:11.240] I claimed that the judge failed to perform a duty he was commanded to perform. [55:11.240 --> 55:14.240] And the other side didn't get it. [55:14.240 --> 55:16.240] They missed that subtle point. [55:16.240 --> 55:20.240] They said, well, the judge has absolute immunity. [55:20.240 --> 55:24.240] And they argued his absolute immunity. [55:24.240 --> 55:31.240] They didn't argue the sufficiency of my assertion or allegation. [55:31.240 --> 55:34.240] That's what they should have done. [55:34.240 --> 55:36.240] They argued that he had absolute immunity. [55:36.240 --> 55:40.240] He didn't have to do what I asked him to do. [55:40.240 --> 55:45.240] And then I can say, oh, yes, he did. [55:45.240 --> 55:53.240] When the judge has no discretion, 15.09 says, when a complaint is forwarded to a magistrate, [55:53.240 --> 56:00.240] the magistrate shall issue a warrant forthwith. [56:00.240 --> 56:03.240] Yeah, that's an administrative duty of a magistrate. [56:03.240 --> 56:06.240] Do you hear any discretion in there? [56:06.240 --> 56:09.240] It did not say, yeah. [56:09.240 --> 56:15.240] They might can if he wants to. It said shall. And that makes sense. [56:15.240 --> 56:26.240] Because 15, I think it's.03, says that in any circumstance where a warrant is required, [56:26.240 --> 56:32.240] a summons may be issued in place of it. [56:32.240 --> 56:34.240] I forget exactly the terminology. [56:34.240 --> 56:40.240] But it says that the magistrate can issue either a warrant or a summons. [56:40.240 --> 56:50.240] So I'm saying in 15.09 it says a warrant, but 15.03 says it can also be a summons. [56:50.240 --> 56:58.240] So you summon the official before the court, and then you hold an examining trial. [56:58.240 --> 57:05.240] And in the examining trial, then we do a determination of probable cause. [57:05.240 --> 57:08.240] They bypass that. [57:08.240 --> 57:10.240] All day. [57:10.240 --> 57:16.240] That's what I set them up for. And they missed it. [57:16.240 --> 57:23.240] It doesn't say that the magistrate must find probable cause, [57:23.240 --> 57:33.240] but that he must issue a warrant, brackets, or a summons because of 15.03. [57:33.240 --> 57:41.240] It's not in 15.09, but 15.09 is subject to 15.03, so he can issue a summons. [57:41.240 --> 57:47.240] So he should have issued either one or the other, but he didn't. [57:47.240 --> 57:53.240] And since he didn't, he violated a law relating to his office and in the process denied me [57:53.240 --> 58:01.240] and the full free access to enjoyment right in violation of 39.03. [01:04:34.240 --> 01:04:37.240] He hired a private law firm. [01:04:37.240 --> 01:04:40.240] And they answered almost immediately. [01:04:40.240 --> 01:04:45.240] I suspect they'd been listening to my show. [01:04:45.240 --> 01:04:51.240] Because I said on the show that I want them served on a Monday. [01:04:51.240 --> 01:04:58.240] Because a Monday gives them exactly 21 days to file. [01:04:58.240 --> 01:05:03.240] To file and answer. That's the least amount of time they can have to file. [01:05:03.240 --> 01:05:07.240] These guys got served. I filed. [01:05:07.240 --> 01:05:12.240] And then a week later I went down there and they had already answered. [01:06:30.240 --> 01:06:39.240] He didn't believe that an ordinary citizen could come to him and bring him a criminal complaint. [01:06:39.240 --> 01:06:41.240] He was following his training. [01:06:41.240 --> 01:06:50.240] I have no reason to believe that Judge Bob Whitaker is anything other than a right-minded public official [01:06:50.240 --> 01:06:55.240] doing the best he can in the situation he's in. [01:06:55.240 --> 01:07:01.240] And then he has some jerk like me come down and land on him like a ton of bricks. [01:07:01.240 --> 01:07:05.240] Well, he don't feel like a bad guy. [01:07:05.240 --> 01:07:09.240] He's acting in accordance with his training. [01:07:09.240 --> 01:07:19.240] And yeah, I don't like it that I have to take someone who feels as though he's acting in the best of faith [01:07:19.240 --> 01:07:21.240] but is subject to bad training. [01:07:21.240 --> 01:07:24.240] I don't like to have to go beat him up. [01:07:24.240 --> 01:07:28.240] But we're all grown-ups here. [01:07:28.240 --> 01:07:31.240] Deal with it. [01:07:43.240 --> 01:07:47.240] Well, while I was down there in Victoria County, [01:07:47.240 --> 01:07:54.240] I filed criminal charges against the district judge, Judge Maher, [01:07:54.240 --> 01:08:02.240] with whom I filed criminal charges against the Justice of the Peace. [01:08:02.240 --> 01:08:13.240] Now, it doesn't make any difference if the Justice of the Peace was acting improper or not. [01:08:13.240 --> 01:08:22.240] The fact that I filed a criminal charge with the district judge in his capacity as a magistrate [01:08:22.240 --> 01:08:30.240] invoked a duty that he has as a magistrate and a duty from which he cannot shield himself. [01:08:30.240 --> 01:08:34.240] So I filed with Judge Maher. [01:08:34.240 --> 01:08:37.240] And Judge Maher did nothing. [01:08:37.240 --> 01:08:46.240] And then I let that stew a little while, and then I came back and filed a tort letter to Judge Whitaker [01:08:46.240 --> 01:08:51.240] notifying him of my intent to sue, and then I filed the lawsuit. [01:08:51.240 --> 01:08:54.240] So I followed all the steps. [01:08:54.240 --> 01:09:01.240] So this JP is sitting back there thinking that he's following all the rules. [01:09:01.240 --> 01:09:06.240] He is following the rules based on the way he has been trained. [01:09:06.240 --> 01:09:10.240] The problem is he's been trained improperly. [01:09:10.240 --> 01:09:16.240] And the one thing I hope I can get across to everyone, [01:09:16.240 --> 01:09:20.240] this is not about anger or avarice. [01:09:20.240 --> 01:09:25.240] Never go after these guys because you're angry at them. [01:09:25.240 --> 01:09:28.240] If you do that, you'll always screw it up. [01:09:28.240 --> 01:09:31.240] It'll make you really easy to manipulate. [01:09:31.240 --> 01:09:36.240] I do not have an ax to grind with Judge Whitaker. [01:09:36.240 --> 01:09:43.240] Yeah, I asked him to do something, not so much that he didn't want to do it, [01:09:43.240 --> 01:09:50.240] but I don't believe he had any notion that he could do it. [01:09:50.240 --> 01:09:55.240] He's just acting in accordance with the way things have been done all this time. [01:09:55.240 --> 01:10:04.240] And it's most important to me that I nail him not for acting out of anger or avarice, [01:10:04.240 --> 01:10:07.240] but just following his training. [01:10:07.240 --> 01:10:17.240] How much more devastating will this be when he finds out that his training was flawed? [01:10:17.240 --> 01:10:24.240] He can't come to me and say, oh, my training was flawed, so I'm innocent. [01:10:24.240 --> 01:10:28.240] Sorry, Bubba. Life is tough. [01:10:28.240 --> 01:10:31.240] You listened to the people who trained you. [01:10:31.240 --> 01:10:34.240] You had faith in them. Good luck with that. [01:11:01.240 --> 01:11:05.240] If I can take Judge Whitaker and hammer him, [01:11:05.240 --> 01:11:16.240] so now I come back to him with a criminal complaint against his bailiff for refusing to arrest him. [01:11:16.240 --> 01:11:19.240] I did that. [01:11:19.240 --> 01:11:22.240] I never spoke to the JP when I was down there. [01:11:22.240 --> 01:11:28.240] I made them let me observe the morning hearings for the people in the jail. [01:11:28.240 --> 01:11:37.240] In Victoria County, Judge Whitaker's office is right next door to the jail. [01:11:37.240 --> 01:11:45.240] All morning hearings are done by Judge Whitaker for people who've been arrested. [01:11:45.240 --> 01:11:48.240] Generally, like I'm in Wise County, [01:11:48.240 --> 01:11:56.240] and they have different JP's come in for different days to do the morning hearings in the jail. [01:11:56.240 --> 01:12:01.240] But in Victoria County, Judge Whitaker does them all. [01:12:01.240 --> 01:12:04.240] That was an oops. [01:12:04.240 --> 01:12:07.240] So I wanted to watch the hearing. [01:12:07.240 --> 01:12:10.240] I went to the sheriff's department, and the sheriff's department said, [01:12:10.240 --> 01:12:15.240] no, you can't watch the hearing, and the sergeant who told me that, I asked him, [01:12:15.240 --> 01:12:20.240] do you have a card with your name and badge number and such on it? [01:12:20.240 --> 01:12:23.240] And now I don't have any with me today. [01:12:23.240 --> 01:12:24.240] Okay, what is your name? [01:12:24.240 --> 01:12:25.240] And he gave it to me. [01:12:25.240 --> 01:12:26.240] What's your badge number? [01:12:26.240 --> 01:12:27.240] He gave it to me. [01:12:27.240 --> 01:12:35.240] So you're telling me that I can't watch the hearing, a public hearing that's being held? [01:12:35.240 --> 01:12:38.240] No, you can't. [01:12:38.240 --> 01:12:44.240] So is the hearing held in person or is it on video? [01:12:44.240 --> 01:12:45.240] He said, well, it's on video. [01:12:45.240 --> 01:12:47.240] Well, I want to watch. [01:12:47.240 --> 01:12:52.240] We don't have the ability to allow you to watch. [01:12:52.240 --> 01:12:54.240] Okay. [01:12:54.240 --> 01:13:00.240] So now I'm going to file criminal charges against him. [01:13:00.240 --> 01:13:02.240] You want to play smarty pants? [01:13:50.240 --> 01:14:03.240] So Dr. Joe is online. Dr. Joe, he's going to file a judicial conduct, I mean a T-Cold complaint against the sergeant. [01:15:28.240 --> 01:15:37.240] So if you have reason to believe and do believe, you do not have to have personal knowledge like I do. [01:20:27.240 --> 01:20:33.240] Dr. Joe brought me into this situation and I had no dog in the hunt. [01:20:33.240 --> 01:20:42.240] So I went down there and asked them to do what the law commanded them to do. [01:20:42.240 --> 01:20:49.240] And when they failed to do what the law commanded them to do, then it gave me a dog in the hunt. [01:20:49.240 --> 01:21:05.240] And what the deal was is I claimed that Dr. Joe promised me that if I was able to recover the airplane they stole from him, that he would give me $20,000. [01:21:05.240 --> 01:21:15.240] And so I went to this judge and filed criminal charges against a couple of guys and accused them of stealing this airplane. [01:21:15.240 --> 01:21:33.240] To be frank, after serious investigation I found that there may be, the facts may show that these guys did not act with men's rights. [01:21:33.240 --> 01:21:40.240] They may not have believed that they were stealing the airplane. [01:21:40.240 --> 01:21:50.240] So if the magistrate had taken my complaints and issued either a warrant or a summons, [01:21:50.240 --> 01:22:05.240] and these two individuals were allowed to come before the court and show that they acted in good faith, then nothing would have came of my complaints. [01:22:05.240 --> 01:22:11.240] But the judge did not do what he was required to do. [01:22:11.240 --> 01:22:29.240] He refused, and in refusing he denied me in the due course of the laws of the state of Texas and denied me in the $20,000 Dr. Joe promised me if I could secure his airplane. [01:22:29.240 --> 01:22:47.240] And since the judge failed to perform a duty he was required to perform and in the process denied me in my ability to secure the airplane, he denied me in my $20,000 payment. [01:22:47.240 --> 01:23:03.240] And since he acted outside the scope of his authority, I claim that I have a right to procure an airy damages, which amount to triple damages. [01:23:03.240 --> 01:23:10.240] I have a right to a $60,000 recovery. It's in the code. [01:23:10.240 --> 01:23:24.240] So let's see how the judge defends himself. Well, the way he defended himself is he said that he's a judge and he has absolute immunity. [01:23:24.240 --> 01:23:30.240] Clearly their lawyers did not realize that I set him up. [01:23:30.240 --> 01:23:38.240] He would have absolute immunity if he had discretion. [01:23:38.240 --> 01:23:50.240] But the complaint that I filed was carefully constructed to show that he did not have discretion. [01:23:50.240 --> 01:24:09.240] You know, Andy, that's kind of telling the fact that they wouldn't notice that the immunity covers judicial acts. That kind of speaks to the fact that he's not accustomed to doing his magisterial duties ever. [01:24:09.240 --> 01:24:24.240] Exactly. In Texas, if you are arrested for any reason, with or without a warrant, if you're arrested for an on-site offense without a warrant, [01:24:24.240 --> 01:24:37.240] 14.06 commands the arresting officer to take you directly to the nearest magistrate and the magistrate is commanded to hold an examining trial. [01:24:37.240 --> 01:24:52.240] If you are arrested on an existing warrant, and anybody here who's ever had a warrant, if you'll read that warrant, it says you are to arrest this person and bring him before me, [01:24:52.240 --> 01:25:14.240] he being the official who issued the warrant. And that's because 15.09 commands the official to issue the warrant, and the warrant commands the person to be brought before the magistrate who issued the warrant. [01:25:14.240 --> 01:25:27.240] Then the magistrate must hold an examining trial in accordance with Chapter 16, Texas Code of Criminal Procedure. [01:25:27.240 --> 01:25:45.240] If you are in another state, every state will have this requirement because of the case Gerstein v. Pugh, P-U-G-H. Gerstein Pugh is a similar case. [01:25:45.240 --> 01:26:02.240] It's a relatively recent case. I think it's 1996. It's a Florida case. Florida did not have statutes that required a preliminary determination of probable cause. [01:26:02.240 --> 01:26:29.240] And the federal court says there must be a preliminary determination of probable cause. Anytime someone's arrested, it says that a person who is arrested must be brought before a magistrate for a determination of probable cause. [01:26:29.240 --> 01:26:52.240] Gerstein Pugh is a federal case. Every state must have a procedure that reflects the requirement of Gerstein v. Pugh. There must be a preliminary determination. [01:26:52.240 --> 01:27:03.240] This went into law in 1216 A.D. on the filing of the Magna Carta libertatum. [01:27:03.240 --> 01:27:29.240] If a sheriff arrested a freeman in this is Old England for any reason, he must take that freeman directly to the nearest magistrate and explain himself. If you will look at your county and look at the justices of the peace, you will find that their offices are spread around the county. [01:27:29.240 --> 01:27:55.240] That is not by accident. If you look at the justices of the peace that are in the county and do a measurement, put a pinpoint on the justice of the peace and draw a circle 15 miles from the JP's office. [01:27:55.240 --> 01:28:05.240] In that 15 miles, that's how long someone can be expected to travel on horseback in a day. [01:28:05.240 --> 01:28:16.240] You will find that in your county there is a magistrate within 15 miles of any point in the county. [01:28:16.240 --> 01:28:44.240] Regular courts are all held in the courthouse, but JP's are spread around the county, and that's why. If a policeman arrests someone for any reason, they wanted that policeman to be within 15 miles of a magistrate within the county so he could take that person directly to that magistrate and explain himself. [01:28:44.240 --> 01:28:57.240] And that was because they did not want the public to fear the police. Now they may have to fear the magistrate, but they elect the magistrate. [01:28:57.240 --> 01:29:10.240] The policeman is hired. They didn't want to be afraid of these police, so if a policeman arrests someone for any reason, they must take them directly to the nearest magistrate and explain themselves. [01:29:10.240 --> 01:29:19.240] It was the magistrate who was intended to hold the key to the jailhouse door, not the policeman. [01:29:19.240 --> 01:29:27.240] I hope that makes sense. This is absolutely critically important. [01:29:27.240 --> 01:29:35.240] In Texas the average conviction rate for all crimes across the board at the present time is 99.6. [01:29:35.240 --> 01:29:51.240] It rounds up to 100. And the only reason that's the case is because the police no longer take someone directly to the nearest magistrate and explain themselves. [01:29:51.240 --> 01:30:06.240] If they had to do that, the vast majority of these criminal accusations simply... [01:33:58.240 --> 01:34:08.240] What went on in Victoria County was so profound that I may spend the rest of this show addressing that. [01:34:08.240 --> 01:34:15.240] If you will call back tomorrow night, I will make sure I get to all of you. [01:34:15.240 --> 01:34:20.240] But this is what this show is all about. [01:34:20.240 --> 01:34:23.240] How do we take on the system? [01:34:23.240 --> 01:34:40.240] How do you and I and Brett and Tina and Jack and EJ and Jason take on the system with absolute impunity? [01:34:40.240 --> 01:34:51.240] We can do this and the only way we can do this effectively is to realize that for the most part the public officials we're dealing with are not bad guys. [01:34:51.240 --> 01:34:55.240] They're just doing what they were trained to do. [01:34:55.240 --> 01:35:02.240] The justice of the peace here, the bailiff, they were just doing what they were trained to do. [01:35:02.240 --> 01:35:05.240] They don't think of themselves as bad guys. [01:35:05.240 --> 01:35:10.240] And if we think of them as bad guys, we weaken our position. [01:35:10.240 --> 01:35:24.240] In this case, I went to this hearing and fortunately I had a guy who had listened to my show, and when I was driving down to Victoria, [01:35:24.240 --> 01:35:36.240] I got a call from him and he said that he was in Goliad, a county next to Victoria, and he'd been listening to my show for ten years. [01:35:36.240 --> 01:35:42.240] And he heard on my show that I was coming down there and he wanted to meet with me. [01:35:42.240 --> 01:35:47.240] And that worked out well and Dr. Joe and I, we met with him. [01:35:47.240 --> 01:36:05.240] And he and a friend of his who had, he acted, I was his guru and he was this friend of his guru, these two guys came to the court with me. [01:36:05.240 --> 01:36:12.240] Most of the time when I go to jerk around the courts, I'm there all by myself. [01:36:12.240 --> 01:36:24.240] These two guys were with me and I just can't adequately express how powerful that was. [01:36:24.240 --> 01:36:38.240] I stepped on the justice of the peace and the justice of the peace, when I demanded to observe the morning hearing he holds for people who've been arrested overnight, [01:36:38.240 --> 01:36:47.240] called in his attorney that he had hired to represent him in my suit against the JP. [01:36:47.240 --> 01:36:55.240] I guess the JP didn't realize that I could force him to hold that hearing in front of me. [01:36:55.240 --> 01:37:00.240] So he called in his own attorney to watch the proceedings. [01:37:00.240 --> 01:37:12.240] And I suspect his attorney got an eyeful because his attorney was sitting in the room when I asked the bailiff to arrest the judge. [01:37:12.240 --> 01:37:15.240] But I'll get to that in a minute. [01:37:15.240 --> 01:37:24.240] I had two witnesses and there is nothing more powerful than having a witness. [01:37:24.240 --> 01:37:35.240] I've been doing this for a long time and 90% of the time when I go before the courts and jerk them around this way, I'm all by myself. [01:37:35.240 --> 01:37:50.240] I have a lot of people that say, oh, when you do these kind of things, you need to call me. I want to come and watch. When I call them, I'm sorry, but I have to go give my cat a bath today. [01:37:50.240 --> 01:37:52.240] That's what I get the most. [01:37:52.240 --> 01:37:55.240] Most of the time I'm by myself. [01:37:55.240 --> 01:38:06.240] This time I had two witnesses and I cannot express the power of two witnesses. [01:38:06.240 --> 01:38:09.240] They didn't have to say anything. They didn't have to do anything. [01:38:09.240 --> 01:38:12.240] They're just sitting there and watching. [01:38:12.240 --> 01:38:22.240] And when these guys have two neutral parties sitting and watching, everything changes. [01:38:22.240 --> 01:38:32.240] Nobody ever said anything to me that I could in any way interpret as a threat. [01:38:32.240 --> 01:38:37.240] Everybody tippy-toed around me. [01:38:37.240 --> 01:38:41.240] The judge never once looked at me. [01:38:41.240 --> 01:38:47.240] He moved back and forth, but he was absolutely careful never to look in my direction. [01:38:47.240 --> 01:38:51.240] He called in his attorney and the lawsuit I filed against him. [01:38:51.240 --> 01:38:58.240] I guess he thought the attorney would somehow neutralize something, but the attorney was absolutely impotent. [01:38:58.240 --> 01:39:01.240] There was nothing he could do. [01:39:01.240 --> 01:39:07.240] I did not talk to him. I made no – and he was smart enough not to try to talk to me. [01:39:07.240 --> 01:39:14.240] But one of my witnesses talked to him and asked him who he was and what he was doing there, and he talked to them. [01:39:14.240 --> 01:39:17.240] And that came to me by proxy. [01:39:17.240 --> 01:39:31.240] But the attorney himself kept his distance because he knew any conversation between him and me could be devastating to him. [01:39:31.240 --> 01:39:40.240] And the whole interview – and in the course of this, I never once spoke to the JP. [01:39:40.240 --> 01:39:47.240] He knew I was there to hammer him because I already sued him, of course, but he's acting in his official capacity, [01:39:47.240 --> 01:39:52.240] so I'm asking to observe what he's doing, and he can't deny that. [01:39:52.240 --> 01:39:56.240] And he was clearly on his tippy-toes. [01:39:56.240 --> 01:40:02.240] And then at one point, he actually spoke to me because I put in an information request. [01:40:02.240 --> 01:40:13.240] I wanted to see all the documents that were before the judge when he held the supposed hearings for people who would have been arrested overnight. [01:40:13.240 --> 01:40:24.240] And he spoke to me in court and said, Mr. Kelton, I have your information request here, and I will forward it to our attorney. [01:40:24.240 --> 01:40:27.240] Well, that's all well and good, Your Honor. [01:40:27.240 --> 01:40:35.240] But in the meantime, you need to provide these records for my inspection and or copying right now. [01:40:35.240 --> 01:40:41.240] Well, Mr. Kelton, I'm not going to provide them for you right now until I have a response from my attorney. [01:40:41.240 --> 01:40:42.240] I turned to the bailiff. [01:40:42.240 --> 01:40:47.240] Mr. Bailiff, you need to arrest this judge. [01:40:47.240 --> 01:40:53.240] And the bailiff said, no, Mr. Kelton, I'm not going to arrest a judge. [01:40:53.240 --> 01:40:55.240] I didn't pursue the bailiff. [01:40:55.240 --> 01:40:58.240] The only I asked the bailiff to take his chicken suit off. [01:40:58.240 --> 01:41:03.240] But I had witnesses here, so I didn't need to do all of that. [01:41:03.240 --> 01:41:18.240] After the hearings that he held, I instructed the bailiff that after these hearings are over, once your duty here is finished, I need to speak to you. [01:41:18.240 --> 01:41:22.240] And after the hearings are over, he came out and spoke to me. [01:41:22.240 --> 01:41:36.240] And we had about 25 or 30 minutes of back and forth, which I have recorded, where the bailiff was on his tippy toes the whole time. [01:41:36.240 --> 01:41:41.240] Oh, Mr. Kelton, I'm just a bailiff. [01:41:41.240 --> 01:41:46.240] I'm just here to make sure that nobody causes trouble, blah, blah, blah. [01:41:46.240 --> 01:41:53.240] No, you're here to make sure that nobody violates the law, even if it's the judge. [01:41:53.240 --> 01:41:56.240] And in this case, the judge did, in fact, violate the law. [01:41:56.240 --> 01:42:00.240] And I asked you to arrest him, and you failed to do that. [01:42:00.240 --> 01:42:03.240] Oh, Mr. Kelton, I'm just a bailiff. [01:42:03.240 --> 01:42:07.240] I don't really want to be in the middle of all of this. [01:42:07.240 --> 01:42:09.240] Well, sorry, Bubba. [01:42:09.240 --> 01:42:11.240] Your job. [01:42:11.240 --> 01:42:12.240] You can't hide. [01:42:12.240 --> 01:42:14.240] You can't shield yourself from this. [01:42:14.240 --> 01:42:17.240] We had about 20 minutes back and forth. [01:42:17.240 --> 01:42:24.240] And to his credit, the bailiff never once lost his composure. [01:42:24.240 --> 01:42:26.240] Well, he almost did. [01:42:26.240 --> 01:42:30.240] He asked me for identification. [01:42:30.240 --> 01:42:33.240] Mr. Bailiff, you knew who I am. [01:42:33.240 --> 01:42:35.240] Well, I need to see your identification. [01:42:35.240 --> 01:42:37.240] I said no. [01:42:37.240 --> 01:42:40.240] Mr. Kelton, I need to see your driver's license. [01:42:40.240 --> 01:42:42.240] No. [01:42:42.240 --> 01:42:46.240] He said, are you refusing to identify yourself? [01:42:46.240 --> 01:42:48.240] Yes. [01:42:48.240 --> 01:42:51.240] Well, that amounts to failure to I.D. [01:42:51.240 --> 01:42:53.240] Oh, failure to I.D. Oh, wonderful. [01:42:53.240 --> 01:42:56.240] Okay, so you're going to arrest me for failure to I.D.? [01:42:56.240 --> 01:42:59.240] And I stuck out my wrist, my hands toward him, held my wrist together, [01:42:59.240 --> 01:43:01.240] saying, here, here, get out your cups. [01:43:01.240 --> 01:43:02.240] Stick them on there. [01:43:02.240 --> 01:43:03.240] Arrest me. [01:43:03.240 --> 01:43:05.240] Go ahead. [01:43:05.240 --> 01:43:08.240] He said, no, Mr. Kelton, I don't need to arrest you. [01:43:08.240 --> 01:43:09.240] Yeah, you do. [01:43:09.240 --> 01:43:10.240] Yeah, you do. [01:43:10.240 --> 01:43:11.240] I failed to identify. [01:43:11.240 --> 01:43:12.240] Stick them on me. [01:43:12.240 --> 01:43:14.240] Go ahead. [01:48:08.240 --> 01:48:14.240] He knew when something was going on that was outside his scope, [01:48:14.240 --> 01:48:18.240] and no matter how much I pressed him, [01:48:18.240 --> 01:48:24.240] no matter how much pattern interruption I did to him, [01:48:24.240 --> 01:48:28.240] he never lost his cool. [01:48:28.240 --> 01:48:38.240] If I need someone with a pistol on his hip, I want this guy, someone like this guy. [01:48:38.240 --> 01:48:40.240] This was a good guy. [01:48:40.240 --> 01:48:45.240] Yeah, I caught him in a situation he wasn't happy with, [01:48:45.240 --> 01:48:49.240] but at the end of the day, he was a good guy. [01:48:49.240 --> 01:48:51.240] Now, I went to the Sheriff's Department [01:48:51.240 --> 01:48:56.240] and asked to witness the morning arraignment hearings [01:48:56.240 --> 01:49:02.240] and got Sergeant Diggs in Victoria County, [01:49:02.240 --> 01:49:07.240] and he was not so smart as this bailiff. [01:49:07.240 --> 01:49:11.240] He told me that they didn't have video, [01:49:11.240 --> 01:49:15.240] that I couldn't watch the morning arraignment. [01:49:15.240 --> 01:49:20.240] I'm going to land on him like a ton of bricks. [01:49:20.240 --> 01:49:30.240] I'm not going to land on the bailiff like a ton of bricks because he was smarter. [01:49:30.240 --> 01:49:36.240] He didn't give me that opportunity. [01:49:36.240 --> 01:49:43.240] We need to teach our public officials to act professionally. [01:49:43.240 --> 01:49:48.240] We are the masters of our servants. [01:49:48.240 --> 01:49:53.240] We need to come in with this persona. [01:49:53.240 --> 01:50:01.240] We can't come in there angry and just trying to beat someone up [01:50:01.240 --> 01:50:05.240] because that will never work well for us. [01:50:05.240 --> 01:50:11.240] We need our public officials to know that they have people out here [01:50:11.240 --> 01:50:20.240] who will come in and set them up and potentially ruin their career, [01:50:20.240 --> 01:50:27.240] deny them in their retirement [01:50:27.240 --> 01:50:33.240] because they have done what they were trained to do. [01:50:33.240 --> 01:50:39.240] This particular bailiff, frankly, surprised me. [01:50:39.240 --> 01:50:49.240] He looked like your typical cowboy, John Wayne-style attitude from his cowboy hat [01:50:49.240 --> 01:50:55.240] and his handlebar mustache and his stance, but he was much smarter than that. [01:50:55.240 --> 01:50:58.240] He knew when he was being set up. [01:50:58.240 --> 01:51:05.240] We need every public official to be able to recognize when they're being set up [01:51:05.240 --> 01:51:09.240] so that they do what the law commands them to do, whether they want to or not, [01:51:09.240 --> 01:51:13.240] whether the superiors will agree with it or not [01:51:13.240 --> 01:51:21.240] because they will be held to account for their own personal behavior. [01:51:21.240 --> 01:51:29.240] And when they do do the right thing, we need to be prepared [01:51:29.240 --> 01:51:33.240] to give them the adulation they deserve. [01:51:33.240 --> 01:51:37.240] This particular J.P., I sent him an email, [01:51:37.240 --> 01:51:44.240] and I told him that I'm going to do some really onerous and ugly-looking stuff to you. [01:51:44.240 --> 01:51:52.240] But before I do that, I feel like I owe it to you to express my appreciation. [01:51:52.240 --> 01:51:58.240] I stepped right square in the middle of you, and I'm very good at it. [01:51:58.240 --> 01:52:01.240] I have a lot of experience at it. [01:52:01.240 --> 01:52:08.240] And you, at all times, maintained your professional composure. [01:53:59.240 --> 01:54:04.240] When you approach an enemy who's better armed than you, [01:54:04.240 --> 01:54:06.240] you can't do it with guns. [01:54:06.240 --> 01:54:09.240] You have to find another way to do it.
