[07:08.840 --> 07:27.840]  My mother warned me about this. She said, you know, I told her that it seems like every year goes faster and faster. And she said, well, son, that's not going to get any better.
[07:27.840 --> 07:41.840]  And it really does. And I think it's because as we get older, we have paid attention to a lot of things, and we get a lot of information stored.
[07:41.840 --> 07:48.840]  So our attention tends to gravitate toward new information.
[07:48.840 --> 08:02.840]  And at my age, there's not much new information available. So I don't notice as much. It seems like time goes faster, or maybe not.
[08:02.840 --> 08:09.840]  Okay, I was expecting Dr. Joe to show up. He will eventually come on.
[08:09.840 --> 08:21.840]  He's finally prepared to come on the air and talk about what has happened to him. We hear lots of horror stories.
[08:21.840 --> 08:31.840]  Few do we hear that are as absolutely outrageous as this one.
[08:31.840 --> 08:42.840]  And that's what originally I was brought to Dr. Joe because of what they did to him. And when I looked at it, it was insanely outrageous.
[08:42.840 --> 08:56.840]  And we're developing a methodology to go after them. And if I'm going to use a jurisdiction as a crash dummy to demonstrate the flaws in the system,
[08:56.840 --> 09:01.840]  the more corrupt and inept the system is, the better.
[09:01.840 --> 09:11.840]  And it looks like Victoria County, Texas is the armpit of Texas when it comes to jurisprudence.
[09:11.840 --> 09:17.840]  So we're going to use Victoria County as our crash dummy.
[09:17.840 --> 09:29.840]  And I have some practices and procedures that I'm putting together that will allow us to take apart a jurisdiction piece by piece.
[09:29.840 --> 09:38.840]  First thing I want to do is get a public official to do something ignorant, but just tiny, slightly ignorant.
[09:38.840 --> 09:47.840]  I have a ticket in Rome, Texas, and I got a ticket on April Fool's Day.
[09:47.840 --> 09:57.840]  And I appeared on the night. And instead of coming in and saying, hey, I got this ticket and letting the clerk ask how you please,
[09:57.840 --> 10:14.840]  I came in and said, oh, I have this ticket. And I gave her a photocopy of it. I would like you to stamp this and initial it so I can show that I gave it to you this day.
[10:14.840 --> 10:24.840]  And she said, sure. And she did that. And as clerks generally are, if you don't give clerks a hard time, they're generally pleasant and professional and just doing their business.
[10:24.840 --> 10:29.840]  And I said, here, I need to file this document.
[10:29.840 --> 10:44.840]  And she was kind of taken aback because people almost never file motions in traffic cases to the point that I've had clerks not know that you could.
[10:44.840 --> 10:46.840]  Yeah, I'd have the same response.
[10:46.840 --> 10:56.840]  I'd say, I bet you had the same thing. They didn't know it could be done. So I gave her this 30-page challenge subject matter jurisdiction.
[10:56.840 --> 11:07.840]  And she made a mistake. Because I didn't do the standard stuff, things didn't just walk along the way she expected them to.
[11:07.840 --> 11:18.840]  And she did not get it get marked in her software that I had appeared in response to this ticket.
[11:18.840 --> 11:33.840]  So I got a letter from the Department of Public Safety stating that I failed to appear in accordance with my promise on this citation and that they would not renew my driver's license.
[11:33.840 --> 11:45.840]  Oh, naughty, naughty. So I charged the clerk with tampering with a government document.
[11:45.840 --> 11:48.840]  Made a false statement on a government document.
[11:48.840 --> 12:02.840]  I have reason to believe and do believe that the clerk gave notice to the Department of Public Safety that I failed to appear when in fact I did appear.
[12:02.840 --> 12:06.840]  Now she's going to say, oh, that was just a clerical error.
[12:06.840 --> 12:18.840]  Yeah, I know. When I didn't put the registration sticker on my windshield, that was a clerical error.
[12:18.840 --> 12:23.840]  I'm being prosecuted, so you are too.
[12:23.840 --> 12:43.840]  So I have the complaint made. I'm accusing the clerk of Class A misdemeanor, tampering with a government document, 3710 Penal Code, and official oppression, 3903.
[12:43.840 --> 12:53.840]  Official oppression goes to her setting a hearing. I asked her to set a hearing on my subject matter jurisdiction challenge, and she set a hearing.
[12:53.840 --> 12:58.840]  But she didn't say what the hearing was for. She just generally set a hearing.
[12:58.840 --> 13:07.840]  And I went to the Zoom meeting, and I wanted to just hear my subject matter jurisdiction challenge. We're not going to hear your motions today.
[13:07.840 --> 13:19.840]  Yeah, we are. This hearing was set to hear my subject matter jurisdiction challenge, and you can't get past the threshold of this courtroom until you've heard it.
[13:19.840 --> 13:27.840]  Well, we're not going to hear it today. Well, in that case, I need you to arrest your clerk.
[13:27.840 --> 13:38.840]  Well, that didn't go over so big. And then I wanted him to arrest himself for not arresting his clerk, and that didn't go over too.
[13:38.840 --> 13:46.840]  I will ask you to disqualify yourself. Mr. Pelton, do you mean you wish to accuse me? No, Your Honor, I do not.
[13:46.840 --> 14:00.840]  I wish to disqualify you for cause. You have abandoned your position as a judge in violation of your oath of office, and I need you to stand down.
[14:00.840 --> 14:17.840]  And of course, he refused. So I told him, we're done here, and now I'm going to file against the judge. But first, I'm going to file against his clerk for this clerical error.
[14:17.840 --> 14:37.840]  And guys, if you're going to take on a jurisdiction, you need to find a way to get at them. You want to find something that the law commands them to do, which they are not going to want to do.
[14:37.840 --> 14:50.840]  And in this case, I'm asking the magistrate, the judge in his capacity as a magistrate, to issue a warrant for his clerk.
[14:50.840 --> 15:05.840]  Well, he's not going to want to do that. So I can feel fairly certain he's not going to do that. So when he doesn't, then I get to sue him personally.
[15:05.840 --> 15:15.840]  Of course, I'll file criminal charges against him and a judicioconda complaint and a bar grievance against his bar license.
[15:15.840 --> 15:25.840]  But I'll also file against him criminally, and I'm sorry, I'll also sue him personally. And here's how we get there.
[15:25.840 --> 15:42.840]  It is this way in Texas, and I suspect it will be this way in most states. When a public official is commanded by law to do a certain thing wherein the official has no discretion,
[15:42.840 --> 15:56.840]  where they can't decide if they want to do this thing or do not want to do this thing, it is an administrative act, and they fail to perform that administrative act. They have no immunity.
[15:56.840 --> 16:14.840]  So I'm going to sue the judge personally. I want to get his bass boat. And when the judge doesn't issue the warrant the way 15.09 commands him to do, then I'm going to go here in the town I live in,
[16:14.840 --> 16:28.840]  to the JP's office for this area of the county, and see Ms. Mandy Hayes, her honor Mandy Hayes, real sweet lady, known her for a long time.
[16:28.840 --> 16:40.840]  And I'm going to ask her to issue a warrant for this judge and the clerk, and she's going to respectfully decline. And guess what I'm going to do to her?

[21:18.840 --> 21:43.840]  So I have a case, I brought my first case to, I brought it to small claims court. It's, I'm suing a debt collector for failure to validate a debt and failure, the debt doesn't even exist, it's been paid off already.
[21:43.840 --> 22:04.840]  And I received a statement from the original creditor that such as happened. Now, the question that I have, so the defendant just filed a motion for affirmative defenses.
[22:04.840 --> 22:05.840]  A motion for what?
[22:05.840 --> 22:11.840]  That's weird. A motion for affirmative defenses? That's weird.
[22:11.840 --> 22:16.840]  What's he, what's the plaintiff defending against?
[22:16.840 --> 22:18.840]  Well, I'm the plaintiff.
[22:18.840 --> 22:23.840]  That was, that's why Brett said that was strange.
[22:23.840 --> 22:28.840]  Okay, so I'm the plaintiff, they're the defendant. So they filed...
[22:28.840 --> 22:32.840]  Exactly. So why are they asking you to compute for defenses?
[22:32.840 --> 22:36.840]  Brett, we got it backwards. He's the plaintiff.
[22:36.840 --> 22:37.840]  Right.
[22:37.840 --> 22:39.840]  You're suing the lawyers?
[22:39.840 --> 22:41.840]  Yes.
[22:41.840 --> 22:44.840]  So they filed an answer to complain and affirmative defenses.
[22:44.840 --> 23:00.840]  Okay, an answer can include affirmative defenses to what they're being accused of. That makes sense. A motion to affirmative defenses doesn't make sense, but an answer with affirmative defenses makes perfect sense. Sorry. Okay, go ahead.
[23:00.840 --> 23:19.840]  So, so I'm going to go through a couple other defenses. So, first thing, obviously, failure to stay in claim form, which relief can be granted. Just a little background on that. So this is my first time ever filing a claim and I walked into the court with, you know, my complaint printed out and everything and I walked up to the clerk.
[23:19.840 --> 23:40.840]  And first thing she said was, oh, well, you can't, you know, I printed out what I thought was the paperwork I needed to file indigenently. She came back with a separate form of papers and a separate complaint paper, which only had room to write maybe two, three sentences.
[23:40.840 --> 23:54.840]  You know, I can't really state my whole complaint on the small little window of opportunity she let me state my claim on. She said I had to file it on this certain paper that she gave me.
[23:54.840 --> 24:01.840]  That is absolutely untrue.
[24:01.840 --> 24:12.840]  Right. So, I mean, I didn't know any better. So I ended up throwing out my original complaint, kind of summarizing, get the best I could to fit on this little piece of paper she gave me.
[24:12.840 --> 24:37.840]  Oh, this is wonderful. So you get this objection and of course you get a Rule 12B6 motion to dismiss for failure to state a claim. That's a knee-jerk response. Since Ashcroft v. Tomley, Twombly, T-W-O-M-B-O-Y, that's kind of a knee-jerk reaction from lawyers.
[24:37.840 --> 24:52.840]  So what you do now is file an amended pleading. You look at their, what their arguments are and what their issues are, and you take your original suit and file it as an amended pleading.
[24:52.840 --> 25:07.840]  So I'm tasked with 28 days of the original complaint. So would I have to file a motion to leave? No, you get one amended pleading without having to ask permission of the court.
[25:07.840 --> 25:20.840]  Even after 28 days after my original pleading? Because I think I saw that it has to be my original. No, no, no, you do that after you get a response from your original pleading.
[25:20.840 --> 25:34.840]  So look at the response that the defendant gave and look at your pleading and make adjustments based on their response.
[25:34.840 --> 25:55.840]  When I file a lawsuit, I expect the other side to raise all kinds of objections and I want to use that. I want them to tell me what they think is wrong with my suit so I can adjust it by filing an amended pleading.
[25:55.840 --> 25:59.840]  It's just a matter of course. Expect to do that always.
[25:59.840 --> 26:16.840]  Okay, let's see what else do I have here in my defenses. They said that, so this debt collector, this alleged debt arose out of California.
[26:16.840 --> 26:26.840]  I never contacted them until recently when I, you know, attempted to validate it and then they came back with a validation and then an attempt to collect.
[26:26.840 --> 26:36.840]  And once I, you know, the act of me validating, trying to validate this claim and their failure to do so was my claim.
[26:36.840 --> 26:48.840]  That's how my claim arose and they're trying to say that, you know, they don't have jurisdiction because all interactions between the parties occurred within the state of California, which is not true.
[26:48.840 --> 26:53.840]  I mean, I've never even talked to these people in California.
[26:53.840 --> 27:04.840]  What they probably did was reached in their file and pulled out a standard boilerplate response and filed it.
[27:04.840 --> 27:08.840]  This got every argument you can think of, whether it was made or not.
[27:08.840 --> 27:22.840]  In that case, if they address issues that were like in this case where you are not in California, then that's a frivolous pleading and ask for sanctions and make sure you bar greed them.
[27:22.840 --> 27:25.840]  Have you bar greed them yet?
[27:25.840 --> 27:28.840]  I haven't yet.
[27:28.840 --> 27:33.840]  That should happen immediately.
[27:33.840 --> 27:34.840]  Okay.
[27:34.840 --> 27:40.840]  Just as a matter of course, let them know that you know the tricks.
[27:40.840 --> 27:42.840]  You know how to beat them up.
[27:42.840 --> 27:57.840]  So bar greed them and ask for sanctions for filing a frivolous pleading because the council, learned council, raised arguments that were not before the arguments and issues that are not before the court.
[27:57.840 --> 27:58.840]  Okay.
[27:58.840 --> 28:04.840]  By giving you that boilerplate, they just got everything in there and they throw it at the court.
[28:04.840 --> 28:08.840]  They force you to have to deal with that.
[28:08.840 --> 28:18.840]  You have to develop an answer and research out those issues and the frivolous so that you get sanctions for it.
[28:18.840 --> 28:29.840]  When you get a pleading from opposing council and it has case law in it, make sure you read the case law.
[28:29.840 --> 28:32.840]  You don't have to read the whole case.
[28:32.840 --> 28:49.840]  I just put together a speedy trial motion and I had this case law in there and I had a section where I copied a section out of a case and it listed two or three other cases.
[28:49.840 --> 29:11.840]  So I searched for the case and found one of the cases that it cited and then looked at the quotation I used and looked for a keyword in that location in the case that I had cited that would be representative of the issue.
[29:11.840 --> 29:20.840]  I put that keyword into the second citation and boom, it took me right to the paragraph it was referring to.
[29:20.840 --> 29:23.840]  So do that to these guys.
[29:23.840 --> 29:25.840]  Lawyers post garbage.
[29:25.840 --> 29:35.840]  If you can catch the lawyer posting garbage case law, you can stick it to him big time.
[29:35.840 --> 29:41.840]  That is the second biggest no-no that a lawyer can do.
[29:41.840 --> 29:48.840]  And if he misstates a single case, you hammer him with it and ask for sanctions.

[47:48.840 --> 47:59.840]  As I mentioned, in 1983, Dr. Dirk Pearson and Dr. Sandy Shaw from Rensselaer Polytechnic Institute,
[47:59.840 --> 48:06.840]  or was it? It was one of those big prestigious colleges in the Northeast.
[48:06.840 --> 48:10.840]  They wrote a book called Life Extension, and in it they said,
[48:10.840 --> 48:16.840]  we're analyzing and we're deciphering the molecular structure of the aging process.
[48:16.840 --> 48:24.840]  Stay alive. If you can stay alive for another 10, 20 years, you may be able to stay alive forever,
[48:24.840 --> 48:27.840]  or for a vastly extended lifespan.
[48:27.840 --> 48:31.840]  So I followed their work, which I found to be just scientifically,
[48:31.840 --> 48:38.840]  just absolutely on the money every time, and I personally was injured,

[49:22.840 --> 49:30.840]  And people began to notice that I had greatly improved my overall health and my movement, et cetera.

[50:25.840 --> 50:32.840]  And the results were consistently just out of sight, unbelievably good.
[50:32.840 --> 50:38.840]  And then I began having problems with the medical board, and they said I was practicing medicine without a license.
[50:38.840 --> 50:46.840]  Well, if you look at their law, their law is to regulate the practice of medicine before the public.
[50:46.840 --> 50:54.840]  And all of my people had joined a private membership association, and we were not practicing medicine, A,
[50:54.840 --> 50:57.840]  and we were not doing anything before the public.
[50:57.840 --> 51:05.840]  But ultimately, I was arrested, and they had served me with papers,
[51:05.840 --> 51:12.840]  and I made a motion to dismiss for lack of subject matter jurisdiction, and they denied that.
[51:12.840 --> 51:19.840]  Judges denied 12 motions one day while I was standing there, and the prosecutor was standing next to me.
[51:19.840 --> 51:25.840]  And it was just the most unbelievable railroading you could imagine.
[51:25.840 --> 51:31.840]  On the indictment, there were no names of anybody that was complaining or had been injured.
[51:31.840 --> 51:34.840]  So the judge just wrote some names in.
[51:34.840 --> 51:36.840]  And I said, you can't do that.
[51:36.840 --> 51:38.840]  And he said, watch me.
[51:38.840 --> 51:39.840]  Well, the prosecution...
[51:39.840 --> 51:43.840]  Wrote some names in, just randomly making up names?
[51:43.840 --> 51:44.840]  No.
[51:44.840 --> 51:50.840]  You know, they had done an investigation, and they knew some of the people who had benefited from my work.
[51:50.840 --> 51:52.840]  And I mean, these were friends of mine.
[51:52.840 --> 51:56.840]  So they just took some of their names and put them in the indictment.
[51:56.840 --> 52:01.840]  Before they put them in the indictment, the indictment basically said,
[52:01.840 --> 52:05.840]  Caruso went into an empty room and practiced medicine on nobody at all.
[52:05.840 --> 52:07.840]  And then the judge put in some names.
[52:07.840 --> 52:09.840]  I said, you can't do that.
[52:09.840 --> 52:11.840]  It's tampering with a government document.
[52:11.840 --> 52:12.840]  He laughed and said, watch me.
[52:12.840 --> 52:15.840]  Plus, he's not allowed to testify in the first place.
[52:15.840 --> 52:21.840]  Well, and the prosecutor was standing right there, so the prosecutor witnessed what?
[52:21.840 --> 52:25.840]  The only tampering with a government document.
[52:25.840 --> 52:31.840]  And to make a long story short, they put together a show trial.
[52:31.840 --> 52:34.840]  They ran me through a show trial, found me guilty.
[52:34.840 --> 52:39.840]  Ultimately, I appealed the decision of the first court.
[52:39.840 --> 52:46.840]  And the appeals court upheld the decision, but I appealed it to the court of criminal appeals.
[52:46.840 --> 52:50.840]  And they came back and said, Caruso is completely innocent.
[52:50.840 --> 52:52.840]  There were no crimes.
[52:52.840 --> 52:58.840]  And the trial court never acquired subject matter jurisdiction.
[52:58.840 --> 53:05.840]  And in the light of Caruso's objection, they were absolutely, completely out of line.
[53:05.840 --> 53:07.840]  We vacate the case.
[53:07.840 --> 53:09.840]  They didn't even dismiss the case.
[53:09.840 --> 53:10.840]  They vacated it.
[53:10.840 --> 53:14.840]  They said, there's nothing here and there never was.
[53:14.840 --> 53:22.840]  So that was phase one, after one phase one of my adventures in...
[53:22.840 --> 53:34.840]  When I read the ruling of the court, I was astounded because the court of criminal appeals
[53:34.840 --> 53:40.840]  literally threw everybody under the bus.
[53:40.840 --> 53:45.840]  There were a lot of other ways they could have made the ruling.
[53:45.840 --> 53:51.840]  But they ruled that the court never had jurisdiction from day one.
[53:51.840 --> 53:56.840]  What that meant was everybody was liable.
[53:56.840 --> 54:02.840]  Nobody had any immunity of any kind.
[54:02.840 --> 54:07.840]  And for the court of appeals to throw a whole jurisdiction under the bus,
[54:07.840 --> 54:11.840]  to me, was absolutely astounding.
[54:11.840 --> 54:16.840]  Dr. Joe, tell them about your bond hearing.
[54:16.840 --> 54:20.840]  Oh, you know, they arrested me and put me behind bars.
[54:20.840 --> 54:26.840]  You have to understand, I haven't had so much as a parking ticket in 40 years.
[54:26.840 --> 54:28.840]  And I said to one of my lawyers, I said, what's going on?
[54:28.840 --> 54:30.840]  He said, well, you're not an ax murderer.
[54:30.840 --> 54:32.840]  This is not a big deal.
[54:32.840 --> 54:37.840]  Little did I find out that the judge and the prosecutor had it in for me.
[54:37.840 --> 54:40.840]  And so I spent a couple weeks behind bars.
[54:40.840 --> 54:43.840]  My brother went and got an attorney.
[54:43.840 --> 54:47.840]  The attorney made none of the appropriate arguments.
[54:47.840 --> 54:51.840]  He got me out on a bond, and I was out for two and a half years.
[54:51.840 --> 54:55.840]  And during that period of time, I didn't kill anybody and didn't rob any banks.
[54:55.840 --> 54:59.840]  I didn't change my modus operandi at all.
[54:59.840 --> 55:02.840]  I eventually went for a trial.
[55:02.840 --> 55:06.840]  They told me if you plead guilty, it's a $50 fine, you go home.
[55:06.840 --> 55:10.840]  But I couldn't do it because I wasn't guilty.
[55:10.840 --> 55:14.840]  And so they threw everything they could at me.
[55:14.840 --> 55:18.840]  And they ended up getting a guilty verdict from the jury.
[55:18.840 --> 55:21.840]  And this was all ultra viris.
[55:21.840 --> 55:26.840]  The judge had no authority to convene a court and no authority to conduct a trial,
[55:26.840 --> 55:30.840]  and he knew it, and I had told him that in writing.
[55:30.840 --> 55:33.840]  And he did it anyways.
[55:33.840 --> 55:35.840]  And so they railroaded me through.
[55:35.840 --> 55:43.840]  I spent eight months behind bars for what the Supreme said in Texas.
[55:43.840 --> 55:46.840]  There were no crimes committed.
[55:46.840 --> 55:53.840]  And I can't tell you the horrors of the conditions in Texas jails.
[55:53.840 --> 55:57.840]  I was in jail down in Garza West.
[55:57.840 --> 56:02.840]  And I'm in my 60s at the time, and with a heart condition, high blood pressure.
[56:02.840 --> 56:05.840]  And I was a few miles from the border.
[56:05.840 --> 56:07.840]  I could spit and hit the border.
[56:07.840 --> 56:10.840]  And it was so hot.
[56:10.840 --> 56:12.840]  There was no air conditioning.
[56:12.840 --> 56:16.840]  And I went there, I believe, in January or February.
[56:16.840 --> 56:21.840]  And at night, it would go down into the 30s and 40s.
[56:21.840 --> 56:24.840]  And we had two jackets and two blankets.
[56:24.840 --> 56:27.840]  And the wind would shift direction at night.
[56:27.840 --> 56:29.840]  And it would blow down from the north.
[56:29.840 --> 56:33.840]  And these were old buildings, and they would blow through the sewage.
[56:33.840 --> 56:39.840]  And it would blow methane gas up into the buildings.
[56:39.840 --> 56:43.840]  And I didn't know whether I was going to freeze to death, die of starvation
[56:43.840 --> 56:47.840]  because the food was horrible, or die of poison gas.
[56:47.840 --> 56:56.840]  And I was absolutely innocent, and everybody knew it.
[56:56.840 --> 56:59.840]  Tell them about the bond hearing.
[56:59.840 --> 57:02.840]  Oh, yeah, we went to a bond hearing with Judge Bobby Bell,
[57:02.840 --> 57:07.840]  who I hope to return the favor.
[57:07.840 --> 57:14.840]  So I'm there, and the bond company said, well, the bond company sent a representative.
[57:14.840 --> 57:17.840]  And I had made bond, and I was a good guy.
[57:17.840 --> 57:19.840]  I called him every time I was supposed to do it.
[57:19.840 --> 57:20.840]  I showed up for every hearing.
[57:20.840 --> 57:22.840]  I did everything I was supposed to do.
[57:22.840 --> 57:26.840]  I was innocent, and I knew it.
[57:26.840 --> 57:32.840]  And so we went to a bond hearing, and I had a lawyer named Rick Davis.
[57:32.840 --> 57:36.840]  And he said, we want a bond for DeRuzzo.
[57:36.840 --> 57:38.840]  And the prosecutor was there.
[57:38.840 --> 57:42.840]  And the judge said, well, what is it you'll offer?
[57:42.840 --> 57:47.840]  And the attorney said, we'll do $100,000, which is murder bond.
[57:47.840 --> 57:50.840]  If you commit a murder, you can get out on a $100,000 bond.
[57:50.840 --> 57:53.840]  Well, the prosecutor said, no, he's got his own airplane.
[57:53.840 --> 57:55.840]  He's a flight risk.
[57:55.840 --> 57:58.840]  And so the judge said, no, you can't.
[57:58.840 --> 58:02.840]  And the bonding company was there, and the judge turned to the bonding company
[58:02.840 --> 58:05.840]  and said, what's DeRuzzo's limit?
[58:05.840 --> 58:09.840]  And the bonding company said, we know him, no limit.
[58:09.840 --> 58:11.840]  And the judge said, no, he's got no limit.
[58:11.840 --> 58:13.840]  Will you do $1 million?
[58:13.840 --> 58:15.840]  They said, yes, we'll do $1 million.
[58:15.840 --> 58:17.840]  He has no limit.
[58:17.840 --> 58:20.840]  And the judge said, nobody has no limit.
[58:20.840 --> 58:23.840]  Will you do $100 million?
[58:23.840 --> 58:26.840]  And we're talking for a $50 misdemeanor.
[58:26.840 --> 58:31.840]  And the bonding agency said, yes, we have access to Lloyd's of London's money.

[01:05:40.840 --> 01:05:44.840]  And off I went. They dragged me away.

[01:05:45.840 --> 01:05:46.840]  And put me in a place.
[01:05:46.840 --> 01:05:51.840]  You know, it's hard to understand how hideous some of these prisons really are.
[01:05:51.840 --> 01:05:54.840]  I had a situation where I was in the lower bunk.
[01:05:54.840 --> 01:06:00.840]  The guy above me had one of those spiderweb tattoos on his head.
[01:06:00.840 --> 01:06:04.840]  You know what those are, Brett?
[01:06:04.840 --> 01:06:06.840]  The spiderweb tattoo?
[01:06:06.840 --> 01:06:09.840]  Don't you have one of those, Brett?
[01:06:09.840 --> 01:06:11.840]  Yeah, doesn't your wife have one of those?
[01:06:11.840 --> 01:06:14.840]  That's what I've heard. You know, the spiderweb.
[01:06:14.840 --> 01:06:22.840]  He is married to a five foot two petite Brazilian woman.
[01:06:22.840 --> 01:06:24.840]  Yeah, she'll kick Mr. Spiderweb.
[01:06:24.840 --> 01:06:26.840]  Careful.
[01:06:26.840 --> 01:06:29.840]  You're in deep water here.
[01:06:29.840 --> 01:06:35.840]  I'm laying there in bed, you know, in a cot and I've got this guy above me
[01:06:35.840 --> 01:06:37.840]  and he drools on the floor next to me.
[01:06:37.840 --> 01:06:41.840]  He's the one with the spiderweb, you know, tattoo on his head.
[01:06:41.840 --> 01:06:44.840]  And there's a guy in the next bunk over.
[01:06:44.840 --> 01:06:48.840]  He has a nine-year-old girl that he just saw on the left.
[01:06:48.840 --> 01:06:53.840]  He's been sentenced to 12 years behind bars for selling methamphetamines.
[01:06:53.840 --> 01:06:56.840]  And all night long all he says is,
[01:06:56.840 --> 01:06:59.840]  should I kill myself or should I kill somebody else?
[01:06:59.840 --> 01:07:02.840]  Should I kill myself or should I kill somebody else?
[01:07:02.840 --> 01:07:07.840]  And then the wind will bring methane gas in so that it smells horrible.
[01:07:07.840 --> 01:07:11.840]  And Mr. Spiderweb is laying up in the bed saying things like,
[01:07:11.840 --> 01:07:14.840]  I'm going to kill you, I'm going to cut your throat,
[01:07:14.840 --> 01:07:17.840]  and I'm going to rape your still warm corpse.
[01:07:17.840 --> 01:07:21.840]  And here I am, I'm just a civilian trying to get through this.
[01:07:21.840 --> 01:07:24.840]  And I didn't do anything.
[01:07:24.840 --> 01:07:29.840]  I was completely innocent and they all knew it.
[01:07:29.840 --> 01:07:34.840]  There was one thing that was interesting.
[01:07:34.840 --> 01:07:37.840]  There was a judge named Judge Cheshire.
[01:07:37.840 --> 01:07:40.840]  He was the one who wrote in the names on the indictment
[01:07:40.840 --> 01:07:42.840]  where there weren't any names.
[01:07:42.840 --> 01:07:44.840]  I made a judicial conduct complaint against him,
[01:07:44.840 --> 01:07:47.840]  and shortly thereafter he passed away.
[01:07:47.840 --> 01:07:50.840]  And I can only hope, or conjecture,
[01:07:50.840 --> 01:07:55.840]  that my judicial conduct complaint caused him such consternation
[01:07:55.840 --> 01:07:57.840]  he had a heart attack and died.
[01:07:57.840 --> 01:08:02.840]  But after that, people in Victoria judicial system,
[01:08:02.840 --> 01:08:05.840]  they were unbelievably horrible to me.
[01:08:05.840 --> 01:08:08.840]  I mean, they were just nasty.
[01:08:08.840 --> 01:08:12.840]  I think Judge Cheshire passed away from a heart attack
[01:08:12.840 --> 01:08:17.840]  because I complained about what was going on down in Victoria.
[01:08:17.840 --> 01:08:21.840]  And he was afraid he would get out.
[01:08:21.840 --> 01:08:24.840]  So I'm sure everybody's wondering,
[01:08:24.840 --> 01:08:32.840]  why on earth would this jurisdiction go to this much trouble
[01:08:32.840 --> 01:08:35.840]  to persecute one person?
[01:08:35.840 --> 01:08:38.840]  And you know, when I first heard this story, that's what I wondered.
[01:08:38.840 --> 01:08:40.840]  What am I missing here?
[01:08:40.840 --> 01:08:42.840]  There's got to be something else here.
[01:08:42.840 --> 01:08:46.840]  And then Dr. Joe got me all the documentation,
[01:08:46.840 --> 01:08:49.840]  and started looking through the documentation,
[01:08:49.840 --> 01:08:57.840]  and every district court in Victoria County
[01:08:57.840 --> 01:09:01.840]  handled part of Dr. Joe's case.
[01:09:01.840 --> 01:09:04.840]  They broke the case up into four segments
[01:09:04.840 --> 01:09:08.840]  so that each court could get a little piece of the action.
[01:09:08.840 --> 01:09:10.840]  Yeah, so I'm looking at this and saying,
[01:09:10.840 --> 01:09:13.840]  what in the heck is going on here?
[01:09:13.840 --> 01:09:16.840]  What finally occurred to me?
[01:09:16.840 --> 01:09:24.840]  Dr. Joe flew down to Victoria in a $70,000 airplane,
[01:09:24.840 --> 01:09:27.840]  and they seized that airplane.
[01:09:27.840 --> 01:09:29.840]  And he had quite a bit of assets.
[01:09:29.840 --> 01:09:33.840]  The court spends most of the time prosecuting people
[01:09:33.840 --> 01:09:37.840]  who don't have a pot to piss in or a window to throw it out of.
[01:09:37.840 --> 01:09:42.840]  But here they got a shot at Dr. Joe, and he had assets.
[01:09:42.840 --> 01:09:48.840]  You know what happens if the courts seize assets
[01:09:48.840 --> 01:09:54.840]  from a supposed criminal and liquidate those assets?
[01:09:54.840 --> 01:10:01.840]  If the accused does not object to the liquidation,
[01:10:01.840 --> 01:10:05.840]  then the courts get to put into their budget
[01:10:05.840 --> 01:10:10.840]  70% of the proceeds of the assets.
[01:10:10.840 --> 01:10:17.840]  If the accused objects and fights the claim
[01:10:17.840 --> 01:10:19.840]  and they get to liquidate the assets,
[01:10:19.840 --> 01:10:27.840]  they get to put 100% into their own budgets.
[01:10:27.840 --> 01:10:29.840]  Well, isn't that convenient?
[01:10:29.840 --> 01:10:33.840]  This was an asset forfeiture scam.
[01:10:33.840 --> 01:10:39.840]  Randy looked at one document done by Beatrice Gonzalez,
[01:10:39.840 --> 01:10:42.840]  and it said, in a heading, and then it said,
[01:10:42.840 --> 01:10:46.840]  for first degree felonies, we have asset forfeiture.
[01:10:46.840 --> 01:10:50.840]  For second degree felonies, we have asset forfeiture.
[01:10:50.840 --> 01:10:52.840]  For third degree felonies,
[01:10:52.840 --> 01:10:57.840]  we do not have authority for asset forfeiture.
[01:10:57.840 --> 01:11:00.840]  We're seizing this as part of a third degree felony.
[01:11:00.840 --> 01:11:04.840]  They knew, and they put it in their own documentation.
[01:11:04.840 --> 01:11:08.840]  They had no authority to do what they did.
[01:11:08.840 --> 01:11:11.840]  And that could be established
[01:11:11.840 --> 01:11:14.840]  from the four corners of the document itself.
[01:11:14.840 --> 01:11:17.840]  It needs no one's testimony.
[01:11:17.840 --> 01:11:19.840]  Any reasonable person of ordinary prudence
[01:11:19.840 --> 01:11:22.840]  can read that document, and it is clear.
[01:11:22.840 --> 01:11:26.840]  They had no power to seize anything.
[01:11:26.840 --> 01:11:29.840]  They seized that $70,000 airplane,
[01:11:29.840 --> 01:11:34.840]  let it sit on a tarmac at Victoria Airport,
[01:11:34.840 --> 01:11:38.840]  and somebody came in and stole it.
[01:11:38.840 --> 01:11:43.840]  Well, Dr. Joe, you didn't mention that while you were in prison,
[01:11:43.840 --> 01:11:46.840]  you caught COVID twice and had three strokes
[01:11:46.840 --> 01:11:49.840]  and darn near killed you.
[01:11:49.840 --> 01:11:51.840]  And while he's recovering,
[01:11:51.840 --> 01:11:54.840]  the Court of Criminal Appeals said,
[01:11:54.840 --> 01:11:56.840]  you guys never had jurisdiction to start with,
[01:11:56.840 --> 01:11:59.840]  and they released his property to him,
[01:11:59.840 --> 01:12:01.840]  but he's darn near dead.
[01:12:01.840 --> 01:12:04.840]  He's incapable of securing the property,
[01:12:04.840 --> 01:12:06.840]  and they just left it sitting out there on the ramp.
[01:12:06.840 --> 01:12:09.840]  Somebody come in and stole it.
[01:12:09.840 --> 01:12:12.840]  This is our criminal justice system.
[01:12:12.840 --> 01:12:15.840]  This is the justice you can expect
[01:12:15.840 --> 01:12:18.840]  if you live in Victoria County, Texas.
[01:12:18.840 --> 01:12:23.840]  And unfortunately, Victoria County is not unique.
[01:12:23.840 --> 01:12:29.840]  So we are crafting a process

[01:13:40.840 --> 01:13:42.840]  Oh, my mistake, my mistake.
[01:13:42.840 --> 01:13:46.840]  And I scratched it out with a pen and wrote in my name.

[01:14:23.840 --> 01:14:28.840]  and argued with the dispatcher about sending an officer out to arrest the judge.
[01:14:28.840 --> 01:14:30.840]  He came out while I was writing criminal complaints,
[01:14:30.840 --> 01:14:32.840]  waiting for the police officer.
[01:14:32.840 --> 01:14:35.840]  And he said, well, Mr. Kelton, did you talk to an attorney?
[01:14:35.840 --> 01:14:37.840]  Stop, stop, stop.
[01:14:37.840 --> 01:14:39.840]  I can't be talking to you.
[01:14:39.840 --> 01:14:43.840]  I have someone coming, and I'll give them a full report.
[01:14:43.840 --> 01:14:46.840]  But since I'm going to be filing criminal complaints against you,
[01:14:46.840 --> 01:14:51.840]  it would be inappropriate for us to have any further communications.
[01:14:51.840 --> 01:14:54.840]  I just neutered him.
[01:14:54.840 --> 01:14:59.840]  I hope he realizes that I played him like a cheap fiddle.

[01:15:40.840 --> 01:15:46.840]  of failing to perform a duty he was required to perform specifically.
[01:15:46.840 --> 01:15:52.840]  He was commanded by statute to issue a warrant forthwith, and he did not.
[01:15:52.840 --> 01:15:59.840]  So I asked Judge Maher to issue a warrant forthwith against Judge Whittaker.
[01:15:59.840 --> 01:16:05.840]  And he didn't get the irony because he didn't issue a warrant.
[01:16:05.840 --> 01:16:08.840]  Or if he did, he didn't notify me that he did.
[01:16:08.840 --> 01:16:12.840]  So now I've prepared criminal charges against him
[01:16:12.840 --> 01:16:18.840]  and filed those with the illustrious Judge Bell,
[01:16:18.840 --> 01:16:25.840]  the one who wouldn't take a $300 million bond.

[01:26:43.840 --> 01:26:53.840]  But they brought some COVID infected people in a door or an entrance several hundred yards away.

[01:26:55.840 --> 01:26:58.840]  I was in a cell by myself.
[01:26:58.840 --> 01:27:01.840]  And all of a sudden, I just couldn't move.

[01:27:04.840 --> 01:27:11.840]  And they came and knocked on my door, and they said, Daruza, move your hand or say something so we know you're OK.

[01:27:12.840 --> 01:27:14.840]  I was laying there, and it was warm.
[01:27:14.840 --> 01:27:18.840]  It was like I was enveloped in warm cotton candy.

[01:27:20.840 --> 01:27:22.840]  I couldn't do anything.
[01:27:22.840 --> 01:27:27.840]  And they came in, and they shined the temperature measuring device on me and said, yep,

[01:27:29.840 --> 01:27:34.840]  And they put me on a gurney, and they wheeled me out and took me to a hospital.
[01:27:34.840 --> 01:27:37.840]  I was in intensive care for 10 days.

[01:27:39.840 --> 01:27:40.840]  I got out of there.
[01:27:40.840 --> 01:27:42.840]  I went back to the ordinary cell.
[01:27:42.840 --> 01:27:46.840]  And then four days later, all of a sudden, I couldn't move again.
[01:27:46.840 --> 01:27:49.840]  And we went through the exact same thing.
[01:27:49.840 --> 01:27:53.840]  And then they took me for another 10 days back to the hospital.
[01:27:53.840 --> 01:27:56.840]  And slowly, in intensive care, I got better.
[01:27:56.840 --> 01:28:00.840]  But by the time all of this was done, I was so sick and weak.
[01:28:00.840 --> 01:28:02.840]  I mean, I could barely move.
[01:28:02.840 --> 01:28:05.840]  I'm not really lucky I lived through it.
[01:28:05.840 --> 01:28:09.840]  Warm cotton candy.

[01:34:18.840 --> 01:34:22.840]  And after, and I've been doing this for 15 years,
[01:34:22.840 --> 01:34:28.840]  and we've had people on the air that on the break that said to Brett,
[01:34:28.840 --> 01:34:30.840]  they're not telling us everything.
[01:34:30.840 --> 01:34:36.840]  They're trying to make their story sound as absolutely as horrible as they can,
[01:34:36.840 --> 01:34:40.840]  and clearly they're not telling us everything.
[01:34:40.840 --> 01:34:45.840]  When I heard this story, it was a holy crap moment
[01:34:45.840 --> 01:34:50.840]  because I didn't get any red flags.
[01:34:50.840 --> 01:34:57.840]  I didn't get any indication that anything was being hidden.
[01:34:57.840 --> 01:35:04.840]  I hear all these horrible stories, but none of them compare to this one.
[01:35:04.840 --> 01:35:13.840]  And with what Dr. Joe was doing, that part I had experienced myself with.
[01:35:13.840 --> 01:35:17.840]  When I was in Vietnam, I dropped a 750-pound bomb on my foot
[01:35:17.840 --> 01:35:28.840]  and crushed the joint in my big toe right where the main joint attaches to the foot.
[01:35:28.840 --> 01:35:34.840]  And I had to wear a plate in my shoe, steel plate in my shoe for 50 years
[01:35:34.840 --> 01:35:39.840]  so that when I stepped, when I leaned forward, that toe wouldn't bend
[01:35:39.840 --> 01:35:44.840]  because if that toe bent at all, in five minutes I couldn't walk.
[01:35:44.840 --> 01:35:47.840]  That is completely gone.
[01:35:47.840 --> 01:35:51.840]  I banged that toe into a pipe sticking out of my floor
[01:35:51.840 --> 01:35:53.840]  wherever it had a gas heater.
[01:35:53.840 --> 01:35:56.840]  I hit that thing straight on with that toe and I thought,
[01:35:56.840 --> 01:35:59.840]  oh my, this is not going to be good.
[01:35:59.840 --> 01:36:03.840]  Before that, if I did anything even vaguely similar to that,
[01:36:03.840 --> 01:36:07.840]  my foot would swell up to twice its size.
[01:36:07.840 --> 01:36:10.840]  Five minutes, pain was gone, nothing.
[01:36:10.840 --> 01:36:13.840]  It is fixed.
[01:36:13.840 --> 01:36:16.840]  This is what he was doing for people.
[01:36:16.840 --> 01:36:22.840]  He was keeping people alive that would otherwise die.
[01:36:22.840 --> 01:36:25.840]  And they went after him.
[01:36:25.840 --> 01:36:30.840]  I don't think, Dr. Joe thinks they went after him because he was healing people
[01:36:30.840 --> 01:36:34.840]  and the medical association didn't want him healing people.
[01:36:34.840 --> 01:36:37.840]  Big Pharma certainly doesn't want him healing people
[01:36:37.840 --> 01:36:42.840]  because they want to use you as a toxic waste dump.
[01:36:42.840 --> 01:36:48.840]  As you get older, you get ill and they start selling you these poisonous chemicals
[01:36:48.840 --> 01:36:51.840]  and they'll keep selling you poisonous chemicals
[01:36:51.840 --> 01:36:57.840]  until they've absorbed your entire estate that you've developed over your entire life

[01:39:34.840 --> 01:39:38.840]  I sat there for 10 minutes but it wouldn't come out of my mouth
[01:39:38.840 --> 01:39:40.840]  and this waitress came over and said,
[01:39:40.840 --> 01:39:42.840]  is anything wrong with your avocado?
[01:39:42.840 --> 01:39:46.840]  Oh, please, I was going to get it.
[01:39:46.840 --> 01:39:48.840]  This was becoming a real problem.
[01:39:48.840 --> 01:39:52.840]  When Dr. Joe asked me, what is your biggest concern?
[01:39:52.840 --> 01:39:54.840]  I had a hip where I got shot off a jeep.
[01:39:54.840 --> 01:39:56.840]  They gave me a lot of trouble.

[01:43:02.840 --> 01:43:08.840]  and may actually give us the chance to demonstrate to all of these other jurisdictions,

[01:48:26.840 --> 01:48:33.840]  hey, these variances are an agreement, a contract, because they're duly signed,
[01:48:33.840 --> 01:48:35.840]  and you need to uphold them.
[01:48:35.840 --> 01:48:39.840]  But basically, the courts, they don't care about variances.
[01:48:39.840 --> 01:48:42.840]  Okay, hold on, hold on.
[01:48:42.840 --> 01:48:48.840]  If I understand this right, you bought a property in Massachusetts,
[01:48:48.840 --> 01:48:55.840]  and that property had deed restrictions and had ordinances
[01:48:55.840 --> 01:48:59.840]  controlling how the property was used and what was to be done with it.
[01:48:59.840 --> 01:49:06.840]  So that was a contract, and those were conditions under which you purchased this property.
[01:49:06.840 --> 01:49:12.840]  And now the city is trying to change the rules in the middle of the game.

[01:49:14.840 --> 01:49:19.840]  So it's not really about what I'm trying to do to my property.

[01:55:00.840 --> 01:55:03.840]  And they say, well, you don't have standing, so we don't care.

[01:55:47.840 --> 01:55:53.840]  And then do a search, what state are you in?

[01:55:56.840 --> 01:56:02.840]  Do a search, Walker v. Packer, Massachusetts,

[01:56:41.840 --> 01:56:47.840]  and in the process denies being the full and free access to her enjoyment right,
[01:56:47.840 --> 01:56:51.840]  well, that's a crime in every state.
[01:56:51.840 --> 01:56:56.840]  An official misconduct in most states, in Texas, is official oppression.
[01:56:56.840 --> 01:56:59.840]  That's criminal.
[01:56:59.840 --> 01:57:03.840]  You can go after them criminally.
[01:57:03.840 --> 01:57:06.840]  The judges or the city or both?
[01:57:06.840 --> 01:57:08.840]  The judge.
[01:57:08.840 --> 01:57:17.840]  If a judge, and this is very clear in Texas, it is so clear in Texas,
