[00:00.000 --> 00:05.000] The Bill of Rights contains the first ten amendments of our Constitution. [00:05.000 --> 00:09.000] They guarantee the specific freedoms Americans should know and protect. [00:09.000 --> 00:11.000] Our liberty depends on it. [00:11.000 --> 00:14.000] I'm Dr. Catherine Albrecht, and I'll be right back with an unforgettable way [00:14.000 --> 00:17.000] to remember one of your constitutional rights. [00:17.000 --> 00:19.000] Privacy is under attack. [00:19.000 --> 00:22.000] When you give up data about yourself, you'll never get it back again. [00:22.000 --> 00:27.000] And once your privacy is gone, you'll find your freedoms will start to vanish too. [00:27.000 --> 00:32.000] So protect your rights, say no to surveillance, and keep your information to yourself. [00:32.000 --> 00:35.000] Privacy, it's worth hanging on to. [00:35.000 --> 00:38.000] This public service announcement is brought to you by StartPage.com, [00:38.000 --> 00:42.000] the private search engine alternative to Google, Yahoo, and VIN. [00:42.000 --> 00:45.000] Start over with StartPage. [00:45.000 --> 00:49.000] Most people think of seven as a more civilized number than six. [00:49.000 --> 00:54.000] Think about the number six as implicated in evil, as in the biblical 666. [00:54.000 --> 00:58.000] So it would fill right in that the Seventh Amendment would be about civil trials. [00:58.000 --> 01:01.000] Civil seven, civil trials, get it? [01:01.000 --> 01:05.000] Civil trials are ones where people sue instead of beating each other up over a dispute, [01:05.000 --> 01:07.000] like the dividing line between properties. [01:07.000 --> 01:12.000] They take their dispute to a courthouse and settle matters civilly without the fisticuffs. [01:12.000 --> 01:17.000] The Seventh Amendment guarantees that Americans have the right to a jury in certain civil matters [01:17.000 --> 01:20.000] instead of having a lone judge rule on the case. [01:20.000 --> 01:32.000] I'm Dr. Catherine Albrecht. More news and information at CatherineAlbrecht.com. [01:32.000 --> 01:36.000] The Bill of Rights contains the first ten amendments of our Constitution. [01:36.000 --> 01:39.000] They guarantee the specific freedoms Americans should know and protect. [01:39.000 --> 01:41.000] Our liberty depends on it. [01:41.000 --> 01:44.000] I'm Dr. Catherine Albrecht, and I'll be right back with an unforgettable way [01:44.000 --> 01:47.000] to remember one of your constitutional rights. [02:13.000 --> 02:16.000] Start over with StartPage. [02:16.000 --> 02:22.000] Remember the scene in George Orwell's novel, 1984, when Winston is threatened with his worst fear? [02:22.000 --> 02:26.000] That fear was having a cage of hungry rats unleashed on his face. [02:26.000 --> 02:30.000] But what if his worst fear was spiders? Eight-legged spiders, to be exact. [02:30.000 --> 02:33.000] Getting a faceful of spiders would be pretty cruel and unusual. [02:33.000 --> 02:37.000] That image of eight-legged spiders will help you remember the Eighth Amendment. [02:37.000 --> 02:41.000] Our founding fathers added the Eighth Amendment to the U.S. Constitution [02:41.000 --> 02:44.000] to protect us from creepy-crawly eight-legged punishments [02:44.000 --> 02:48.000] and other cruel and unusual prison practices that were common in their day. [02:48.000 --> 02:52.000] The Eighth Amendment also prohibits the government from acquiring excessive bail [02:52.000 --> 02:54.000] and charging excessive fines. [03:29.000 --> 03:32.000] Whatcha gonna do when they come for you? [03:32.000 --> 03:35.000] Bad boys, bad boys, whatcha gonna do? [03:35.000 --> 03:37.000] Whatcha gonna do when they come for you? [03:37.000 --> 03:40.000] When you were eight and you had bad treats, [03:40.000 --> 03:43.000] you'd go to school and learn the golden rule. [03:43.000 --> 03:46.000] So why are you acting like a bloody fool? [03:46.000 --> 03:48.000] If you get fucked then you must get cool. [03:48.000 --> 03:51.000] Bad boys, bad boys, whatcha gonna do? [03:51.000 --> 03:54.000] Whatcha gonna do when they come for you? [03:54.000 --> 03:57.000] Bad boys, bad boys, whatcha gonna do? [03:57.000 --> 04:00.000] Whatcha gonna do when they come for you? [04:00.000 --> 04:03.000] You chuck it on that one, you chuck it on this one, [04:03.000 --> 04:06.000] you chuck it on your mother and you chuck it on your father, [04:06.000 --> 04:08.000] you chuck it on your brother and you chuck it on your sister [04:08.000 --> 04:11.000] You chuck it on that one and you chuck it on me! [04:11.000 --> 04:14.000] Bad boys, bad boys, whatcha gonna do? [04:14.000 --> 04:16.000] Whatcha gonna do when they come for you? [04:16.000 --> 04:19.000] Bad boys, bad boys, whatcha gonna do? [04:49.000 --> 04:51.840] Bad boys, dumb boys, whatcha gonna do? [04:51.940 --> 04:54.340] Whatcha gonna do when they come for you? [04:54.500 --> 04:57.280] Bad boys, bad boys, whatcha gonna do? [04:57.440 --> 04:59.800] Whatcha gonna do when they come for you? [05:00.000 --> 05:02.780] Bad boys, bad boys, whatcha gonna do? [05:02.780 --> 05:06.780] Whatcha gonna do when they're done for you? [05:32.780 --> 05:48.620] This is the Thursday the 19th day of May 2022 and we are making some headway [05:48.620 --> 05:54.660] with getting some criminal complaints put together for some of our local [05:54.660 --> 06:01.060] officials and working out some strategies for going after them. If any [06:01.060 --> 06:07.380] of you, let me turn the color lines on. I've had a little difficulty [06:07.380 --> 06:13.060] getting things started up today so a little bit behind. I'm turning on the [06:13.060 --> 06:22.420] phone lines. Execute. Okay our calling number is 512-646-1984. If you have a [06:22.420 --> 06:30.180] question or comment give us a call. I had a little computer issue earlier and [06:30.180 --> 06:38.740] all of my icons that I need to load up these programs were deleted off my [06:38.740 --> 06:43.740] computer so I got a little distracted getting things on the air. We didn't [06:43.740 --> 06:48.580] generally don't figure this out until the last minute. Fortunately Debra was [06:48.580 --> 06:54.700] there to bail me out. She got us on the air. So if you have a question or comment [06:54.700 --> 06:59.700] somebody call in and bail me out of here. I didn't have anything prepared for the [06:59.700 --> 07:07.740] beginning of this show. We have been on the telegram channels. I am surprised at [07:07.740 --> 07:12.700] the level of sophistication but the people on these channels are the things [07:12.700 --> 07:22.860] they're doing. I did a presentation on this SGT channel the other day and he [07:22.860 --> 07:29.340] was concerned about the World Health Organization are having some kind of a [07:29.340 --> 07:40.500] meeting or where they're preparing a set of procedures where they can dictate to [07:40.500 --> 07:47.220] all of the countries what they're supposed to do in the time of a pandemic [07:47.220 --> 07:57.780] or health crisis. And these folks were concerned that if this whatever [07:57.780 --> 08:07.820] resolution they're going to pass passes that somehow these foreign entities will [08:07.820 --> 08:16.260] take over control of the United States. Yeah forget that noise. They might do [08:16.260 --> 08:24.820] that in some countries but after this first pandemic and the outrageous [08:24.820 --> 08:31.620] actions of governors across the country and the subsequent reaction of the [08:31.620 --> 08:36.860] people to it I suspect that the World Health Organization can pass anything [08:36.860 --> 08:44.220] they want to but when they tried to visit that on the individual states that [08:44.220 --> 08:49.980] they're going to have themselves a serious problem. It was my concern when [08:49.980 --> 08:57.540] this first began and these governors started issuing these essentially edicts [08:57.540 --> 09:05.660] commanding that people follow the governor's rules that whatever they were [09:05.660 --> 09:11.860] planning it was a bit too soon and it's turned out to be the case that if you [09:11.860 --> 09:17.700] wanted the American population so obedient that they would let a governor [09:17.700 --> 09:24.460] steal the government from us that was a little bit too soon. That was the reason [09:24.460 --> 09:31.260] I filed that 150 page criminal complaint against the Texas governor and it turned [09:31.260 --> 09:39.700] out that the governors of at least 20 states were looking for a reason to get [09:39.700 --> 09:48.060] rid of those proclamations and those executive orders that they had issued [09:48.060 --> 09:56.260] because the public was not happy with them even a little bit. And if they try [09:56.260 --> 10:04.340] to do that again the opposition will be much more organized. So even if the [10:04.340 --> 10:08.940] health organization puts together all these directives and commands telling [10:08.940 --> 10:14.380] us what to do a very large portion of the United States doesn't believe it and [10:14.380 --> 10:21.020] even if the federal government opted into this that don't help them because [10:21.020 --> 10:28.420] people for the most part or for a large part have forgotten what state really [10:28.420 --> 10:40.220] means. We come to think that state means a jurisdictional boundary within a [10:40.220 --> 10:47.060] federal union. Like a county is a jurisdictional boundary within a state [10:47.060 --> 10:52.740] and they tend to equate the states as a similar jurisdictional boundary within [10:52.740 --> 11:00.260] a overruling and overriding federal government. Well sorry guys that's not [11:00.260 --> 11:11.740] how it works. State means sovereign nation and that has never changed. The [11:11.740 --> 11:18.380] states have granted to the federal union certain very specific and limited [11:18.380 --> 11:27.340] limited authorities. The federal union has grossly exceeded those authorities [11:27.340 --> 11:33.100] and their problem is if they're not extremely careful they'll wind up with [11:33.100 --> 11:39.580] guys like Governor Abbott who will take actions telling the president to go [11:39.580 --> 11:47.540] screw himself. You can pass all these edicts you want to and those edicts can [11:47.540 --> 11:51.740] apply to federal government employees but they're not applying to anybody in [11:51.740 --> 11:57.260] Texas and he's made it clear to him and we'll have we have a lot of other states [11:57.260 --> 12:05.300] doing the same thing. I think they if they were planning on taking control of [12:05.300 --> 12:12.660] the public through these pandemics and such they moved a little too quickly. [12:12.660 --> 12:18.180] It's not going to work this time and for the most part people have had enough of [12:18.180 --> 12:28.700] it. Okay I have Ted in California. Ted what have you been up to? Hey Randy good [12:28.700 --> 12:42.060] evening I just called in to save you but you know what your perspective comes [12:42.060 --> 12:53.500] from where you reign in Texas there. Here in California a good part of the [12:53.500 --> 13:01.660] population here they they went right along with all this and I don't know of [13:01.660 --> 13:10.980] a governor that took more advantage of this pandemic situation than California [13:10.980 --> 13:20.180] Governor Gavin Newsom and even even as a lot of the rest of the country like to [13:20.180 --> 13:29.300] believe there's a bunch of just deep blue here in California it's really not [13:29.300 --> 13:39.540] the case. It's the Silicon Valley the San Francisco Bay Area and the LA area the [13:39.540 --> 13:43.940] rest of the state remember there's a lot of farming in this in the state of [13:43.940 --> 13:49.300] California and there's a lot of independent people in California who [13:49.300 --> 13:57.140] have family values and who are conservative mainly because they're just [13:57.140 --> 14:05.220] hard workers and they want to keep the money that they work for and they get [14:05.220 --> 14:13.260] they get beat out by these jury-manded voting districts for example and that's [14:13.260 --> 14:25.940] how we're stuck with Nancy Pelosi for example but this governor even the [14:25.940 --> 14:33.220] California Supreme Court ruled against his orders on numerous occasions as well [14:33.220 --> 14:43.580] as the United States Supreme Court even that really hasn't deterred him and it's [14:43.580 --> 14:51.300] you know we had a recall election here during this pandemic and the numbers [14:51.300 --> 14:56.700] from that election don't make sense because almost three million people [14:56.700 --> 15:04.900] ultimately signed the petition to have this recall election and I'm gonna have [15:04.900 --> 15:11.980] to go check on the final numbers but it's just not adding up and I don't know [15:11.980 --> 15:18.020] what else to say other than maybe they've gotten real good at these these [15:18.020 --> 15:24.420] mail-in elections it doesn't make sense to me because I know a lot of people [15:24.420 --> 15:29.820] were ticked off but on the counter to that all you have to do is walk around [15:29.820 --> 15:36.100] Silicon Valley go out anywhere and you can see the liberals because they're [15:36.100 --> 15:41.940] still wearing masks here and their their their poor kids are wearing masks and [15:41.940 --> 15:51.300] some of them have that outlandishly elaborate mask like they're scared to [15:51.300 --> 16:01.460] death so again I also know being here in California thank goodness the rest of [16:01.460 --> 16:09.820] this country is not California and I've spent most of my life here I have spent [16:09.820 --> 16:15.540] few years down in Texas in Houston Texas I'm familiar pretty with Dallas and [16:15.540 --> 16:22.980] Austin and I've lived and traveled all over the country I lived in Clarksville [16:22.980 --> 16:26.580] Tennessee for three years for example so I've been around a little bit I'm a [16:26.580 --> 16:32.580] pilot I fly over I've traveled a lot both by car and air and I traveled for [16:32.580 --> 16:41.100] IBM for many years and but you know the read I'm not so sure that enough people [16:41.100 --> 16:49.420] are on board okay all right but I also believe that you know we're about to go [16:49.420 --> 16:54.420] to [21:26.660 --> 21:31.660] We not find no bomb, not gun, where the hell we got children in sea. [21:31.660 --> 21:36.660] I send them overseas in army, in Lord Navy, what them do it with. [21:36.660 --> 21:41.660] Them have them gone crazy, know them want to, all come tell me. [21:41.660 --> 21:46.660] How multi-science, how multi-science, how multi-science, how multi-science, [21:46.660 --> 21:50.660] all come tell me. How multi-science, how multi-science, [21:50.660 --> 21:53.660] service and multi-science, for something of me. [21:53.660 --> 21:56.660] We have to question. [21:56.660 --> 21:59.660] Wonder, wonder. [21:59.660 --> 22:02.660] They don't have the answer. [22:02.660 --> 22:04.660] Okay now buddy. [22:04.660 --> 22:07.660] We have to question. [22:07.660 --> 22:10.660] Look again. [22:10.660 --> 22:12.660] Don't have the answer. [22:12.660 --> 22:13.660] So come search, search. [22:13.660 --> 22:18.660] And we ask questions that you can't answer [22:18.660 --> 22:23.660] They're not from a nuclear weapon, but Lord, they're from a wine country [22:23.660 --> 22:28.660] That they walk past with so much money and people, Lord, they say it's a killing [22:28.660 --> 22:33.660] So they'll reserve them a thief's money, they'll print it and they'll give it to me [22:33.660 --> 22:38.660] And we have to pay the tax back on here and they're not freer than both people, you see [22:38.660 --> 22:43.660] Newtman, Mr. of the country, next president, and then some yourself [22:43.660 --> 22:48.660] The child left behind, them tell me, well, what about education for country? [22:48.660 --> 22:52.660] The education leveled at me, something like a dent to suicide [22:52.660 --> 22:56.660] And we ask questions that you can't answer [22:56.660 --> 23:01.660] They're not from a nuclear weapon, but Lord, they're from a wine country [23:01.660 --> 23:06.660] That they walk past with so much money and people, Lord, they say it's a killing [23:06.660 --> 23:11.660] So they'll reserve them a thief's money, they'll print it and they'll give it to me [23:11.660 --> 23:16.660] And we ask questions that you can't answer [23:16.660 --> 23:21.660] They're not from a nuclear weapon, but Lord, they say it's a killing [23:21.660 --> 23:26.660] So they'll reserve them a thief's money, they'll print it and they'll give it to me [23:26.660 --> 23:31.660] And we ask questions that you can't answer [23:31.660 --> 23:36.660] They're not from a nuclear weapon, but Lord, they say it's a killing [23:36.660 --> 23:41.660] So they'll reserve them a thief's money, they'll print it and they'll give it to me [23:41.660 --> 23:46.660] And we ask questions that you can't answer [23:46.660 --> 23:51.660] They're not from a nuclear weapon, but Lord, they say it's a killing [23:51.660 --> 23:56.660] So they'll reserve them a thief's money, they'll print it and they'll give it to me [23:56.660 --> 24:01.660] And we ask questions that you can't answer [24:01.660 --> 24:06.660] They're not from a nuclear weapon, but Lord, they say it's a killing [24:06.660 --> 24:11.660] So they'll reserve them a thief's money, they'll print it and they'll give it to me [24:11.660 --> 24:16.660] And we ask questions that you can't answer [24:16.660 --> 24:21.660] They're not from a nuclear weapon, but Lord, they say it's a killing [24:21.660 --> 24:26.660] Hey folks, we're back. I'm having some issues [24:26.660 --> 24:31.660] I've had some computer issues and they've affected my ability to get on the show [24:31.660 --> 24:36.660] So we were trying to get that fixed up with a break and we ran over a little bit [24:36.660 --> 24:41.660] Okay, Ted, where were we? [24:41.660 --> 24:46.660] Well, just to wrap up, I'm shocked that Governor Newsom hasn't been removed by some means [24:46.660 --> 24:53.660] Because as far as I know, we are still in California under a state of emergency [24:53.660 --> 24:58.660] And this governor is completely out of control [24:58.660 --> 25:03.660] He is absolutely a dictator [25:03.660 --> 25:11.660] And he has a super majority in the state legislature backing him up [25:11.660 --> 25:16.660] So it's pretty disturbing [25:16.660 --> 25:21.660] And what's more disturbing is how everybody here seems to be asleep [25:21.660 --> 25:26.660] There's no protests, there's nothing really major going on [25:26.660 --> 25:31.660] Everybody's just struggling along, I guess [25:31.660 --> 25:36.660] Aren't you paying $6 a gallon for fuel? [25:36.660 --> 25:41.660] Yeah, we're only paying $6 a gallon for fuel [25:41.660 --> 25:46.660] And diesel is higher than that [25:46.660 --> 25:52.660] I'm in Texas and Texas was my favorite place on earth [25:52.660 --> 26:00.660] But it seems we have so many people flooding out of the Northeast and California [26:00.660 --> 26:05.660] That it's not a place I'm comfortable being anymore [26:05.660 --> 26:12.660] When I drove around here for 35 years, if I put on my blinker to change lanes [26:12.660 --> 26:15.660] The guy behind me would back off and let me change lanes [26:15.660 --> 26:17.660] I did the same for other people [26:17.660 --> 26:20.660] I put on my blinker now and they try to wham me [26:20.660 --> 26:26.660] I had a truck actually hit the back of my car to keep me from getting in the lane [26:26.660 --> 26:31.660] Accelerated up next to me and came over and banged my bumper [26:31.660 --> 26:36.660] California's bringing the way they drive in California here [26:36.660 --> 26:38.660] They're bringing their politics here [26:38.660 --> 26:46.660] And I'm afraid they're going to destroy Texas just the way they destroyed California [26:46.660 --> 26:50.660] Boston used to be my favorite place on earth [26:50.660 --> 26:53.660] Now I don't like to go there [26:53.660 --> 26:59.660] The one thing I see, the pervading thing I see on people's faces [26:59.660 --> 27:03.660] Is abject terror [27:03.660 --> 27:11.660] They have the population absolutely terrified [27:11.660 --> 27:19.660] And that allows them to do anything they want [27:19.660 --> 27:25.660] I'm concerned we lost this war before we realized it even got started [27:25.660 --> 27:30.660] I won't even turn on public radio anymore [27:30.660 --> 27:38.660] PR no longer for me stands for public radio, it stands for propaganda rag [27:38.660 --> 27:51.660] Public radio is accepting our tax money so that they can be a propaganda pundit for the Democrats [27:51.660 --> 27:53.660] And I don't like to be political [27:53.660 --> 27:56.660] I'm not a Republican, I'm not a Democrat [27:56.660 --> 28:04.660] But right now I see absolute insanity [28:04.660 --> 28:08.660] So what are you going to do to fix it Ted? [28:08.660 --> 28:13.660] Well we're going to keep doing this show here and we're going to keep going to court [28:13.660 --> 28:16.660] And I did want to dive deep into that [28:16.660 --> 28:23.660] I talked today to the guy I spoke of before that got off of his DUI charge [28:23.660 --> 28:31.660] And one of the things that he brought up in the court was the fact that it's a corporation for profit [28:31.660 --> 28:35.660] That's one thing that I wanted to talk a little bit about [28:35.660 --> 28:43.660] And then the other thing he brought up was a letter of rogatory, I believe is how you say it [28:43.660 --> 28:55.660] And he handed his lawyer in court something that he wanted the lawyer to read into the record addressing the judge [28:55.660 --> 29:06.660] The lawyer refused to do it and so he turned around and motioned for dismissal for ineffective assistance of counsel [29:06.660 --> 29:13.660] He talked to me about the private and public side of the court [29:13.660 --> 29:25.660] And because I wanted to know, this being his fourth DUI charge and I believe he had three prior convictions [29:25.660 --> 29:31.660] How the heck did the court just dismiss his case? [29:31.660 --> 29:39.660] And that's what I know so far [29:39.660 --> 29:47.660] But I do know the courts don't want to talk about how it's all about money [29:47.660 --> 29:54.660] And they're leeches and they're trying to get on to you and get every drop they can [29:54.660 --> 30:01.660] It's not about justice [30:25.660 --> 30:30.660] So protect your rights, say no to surveillance and keep your information to yourself [30:30.660 --> 30:32.660] Privacy, it's worth hanging on to [30:32.660 --> 30:36.660] This public service announcement is brought to you by Startpage.com [30:36.660 --> 30:40.660] The private search engine alternative to Google, Yahoo and Bing [30:40.660 --> 30:43.660] Start over with Startpage [30:43.660 --> 30:50.660] Data privacy is a big deal so nearly every company has a policy explaining how they handle your personal information [30:50.660 --> 30:53.660] But what happens if it escapes their control? [30:53.660 --> 30:56.660] It's not an idle question, according to a recent survey [30:56.660 --> 31:03.660] A shocking 90% of US companies admit their security was breached by hackers in the last year [31:03.660 --> 31:07.660] That's one more reason you should trust your searches to Startpage.com [31:07.660 --> 31:11.660] Unlike other search engines, Startpage doesn't store any data on you [31:11.660 --> 31:15.660] They've never been hacked but even if they were, there would be nothing for criminals to see [31:15.660 --> 31:17.660] The cupboard would be bare [31:17.660 --> 31:20.660] Too bad other companies don't treat your data the same way [31:20.660 --> 31:25.660] I'm Dr. Catherine Albrecht, more news and information at CatherineAlbrecht.com [31:30.660 --> 31:34.660] I lost my son, my nephew, my uncle, my son on September 11, 2001 [31:34.660 --> 31:38.660] Most people don't know that a third tower fell on September 11 [31:38.660 --> 31:42.660] World Trade Center 7, a 47-story skyscraper, was not hit by a plane [31:42.660 --> 31:46.660] Although the official explanation is that fire brought down Building 7 [31:46.660 --> 31:50.660] Over 1,200 architects and engineers have looked into the evidence [31:50.660 --> 31:52.660] And believe there is more to the story [31:52.660 --> 31:55.660] Bring justice to my son, my uncle, my nephew, my son [31:55.660 --> 31:57.660] Go to buildingwhat.org [31:57.660 --> 32:00.660] Why it fell, why it matters, and what you can do [32:01.660 --> 32:04.660] Rule of Law Radio is proud to offer the Rule of Law traffic seminar [32:04.660 --> 32:07.660] In today's America, we live in an us-against-them society [32:07.660 --> 32:09.660] And if we the people are ever going to have a free society [32:09.660 --> 32:12.660] Then we're going to have to stand and defend our own rights [32:12.660 --> 32:15.660] Among those rights are the right to travel freely from place to place [32:15.660 --> 32:17.660] The right to act in our own private capacity [32:17.660 --> 32:19.660] And most importantly, the right to due process of law [32:19.660 --> 32:22.660] Traffic courts afford us the least expensive opportunity to learn [32:22.660 --> 32:25.660] How to enforce and preserve our rights through due process [32:25.660 --> 32:28.660] Former Sheriff's Deputy Eddie Craig, in conjunction with Rule of Law Radio [32:28.660 --> 32:31.660] Has put together the most comprehensive teaching tool available [32:31.660 --> 32:33.660] That will help you understand what due process is [32:33.660 --> 32:35.660] And how to hold courts to the rule of law [32:35.660 --> 32:37.660] You can get your own copy of this invaluable material [32:37.660 --> 32:40.660] By going to ruleoflawradio.com and ordering your copy today [32:40.660 --> 32:42.660] By ordering now, you'll receive a copy of Eddie's book [32:42.660 --> 32:45.660] The Texas Transportation Code, The Law Versus the Lie [32:45.660 --> 32:47.660] Video and audio of the original 2009 seminar [32:47.660 --> 32:50.660] Hundreds of research documents and other useful resource material [32:50.660 --> 32:54.660] Learn how to fight for your rights with the help of this material from ruleoflawradio.com [32:54.660 --> 33:13.660] Order your copy today and together we can have the free society we all want and deserve [33:13.660 --> 33:25.660] Mr. Officer, you're taking the law in your head. Won't you follow the law of the land? I don't understand. [33:25.660 --> 33:33.660] Your blood is too particular to serve. I got to beat Arabians. Officer! [33:33.660 --> 33:55.660] When you're going to stop abuse, your power. [33:55.660 --> 34:06.660] So please Mr. Michael, I teach officers not to abuse their power. Send a request to the leader, the captain of all officers. [34:06.660 --> 34:11.660] Tell them to uphold the law and please don't abuse their power. [34:11.660 --> 34:17.660] They beat and they beat and they cheat and they cheat and they lie every hour. [34:17.660 --> 34:28.660] So Mr. Officer, please stop abusing your power. You pulled me over. I tell you to be silent, sir. [34:28.660 --> 34:39.660] I need to speak to my lawyer, Mr. Officer. You're acting like you're the judge. You're finding me guilty, sir. [34:39.660 --> 34:47.660] So when you're going to stop abuse, your power. [35:09.660 --> 35:25.660] So Randy, at the first of the year, you were sounding pretty positive and that you felt that the pendulum had swung far out to the left and that it was coming back. [35:25.660 --> 35:34.660] With everything that I've said, I still have hope that that's the case and that more people are waking up. [35:34.660 --> 35:44.660] It's just not in a state like California where you have a large mass of these sheep. [35:44.660 --> 35:55.660] But I'm counting on other states that are recognizing, as you first detailed at the top of the show, [35:55.660 --> 36:05.660] that these governors were trying to get out of these mandates they put and realized that people were waking up and they weren't having it. [36:05.660 --> 36:17.660] I still see that as a primary force, but we have so much changing in Texas. [36:17.660 --> 36:25.660] I'm just concerned about the next election. We really need the next election to shift the pendulum back. [36:25.660 --> 36:33.660] We just had a primary election and it seems like the Democrats did better than the Republicans in this primary. [36:33.660 --> 36:38.660] That's kind of frightening. [36:38.660 --> 36:45.660] They're going to use the same... [36:45.660 --> 36:48.660] I don't know. I don't believe any of those numbers anymore. [36:48.660 --> 36:54.660] After what they did last time, shoot, I don't believe one number I see. [36:54.660 --> 37:10.660] Here's what finally got me over the hump and that is a friend of mine pointed out to me that supposedly Joe Biden got more votes than Barack Obama. [37:10.660 --> 37:20.660] That was the final for me. I saw the closed circuit videos of them pulling ballots out of boxes and all these other things. [37:20.660 --> 37:30.660] There's a movie going around right now, but this friend of mine, a black friend by the way, he told me that the other day. [37:30.660 --> 37:40.660] That was like, yeah, right. Joe Biden got more votes than Barack Obama. Never. [37:40.660 --> 37:48.660] It didn't happen. It's just the math shows you. [37:48.660 --> 37:55.660] They've got the news media that will tell you that's conspiracy and they'll tell you, oh, no, it didn't make this difference. [37:55.660 --> 38:05.660] Of course, they're always going to say that. Again, I'm a guy that has been eyeball to eyeball with a politician that lied to me. [38:05.660 --> 38:11.660] I know he was lying to me and he said it so convincingly. [38:11.660 --> 38:17.660] They're not going to tell you what they're up to. That's how they get it done. [38:17.660 --> 38:26.660] It all started, I think, because conservatives are not interested so much in politics. [38:26.660 --> 38:34.660] They just want to live their lives. The left and the Democrats, they were all for changing things. [38:34.660 --> 38:43.660] They got out there and they voted. I think that the conservative people in this country, they want government to leave them alone. [38:43.660 --> 38:49.660] They're not involved. That's what causes the downfall. [38:49.660 --> 38:56.660] Again, I believe they'll try to do the same thing in Texas that they did in California. [38:56.660 --> 39:04.660] I'm talking about gerrymandering districts, fooling with the vote count. [39:04.660 --> 39:15.660] I don't believe the elections that happened here. There's no way that these things passed. [39:15.660 --> 39:19.660] No way. I'm not going to believe it. [39:19.660 --> 39:26.660] Like I said about that school board and they added another high school. Nobody was for that. Nobody. [39:26.660 --> 39:37.660] When you get more votes for one candidate than the maximum number of total voters that exist in that area, why wouldn't you believe that? [39:37.660 --> 39:42.660] What's wrong with you? You don't believe that? You're not going to believe it? Why? [39:42.660 --> 39:49.660] Because I'm a conspiracy theorist. They'll point their finger at me and say I'm a conspiracy theorist, Brett. [39:49.660 --> 39:57.660] I'm a racist. I'm a homophobe, you name it. It's funny. [39:57.660 --> 40:05.660] I had a long conversation with my mom about this earlier today. It's how we got here, a lot of it. [40:05.660 --> 40:15.660] I blame the public education system, but I also blame the parents who wanted to be friends to their children rather than parents. [40:15.660 --> 40:30.660] We have a nation of very weak-minded people now and easily offended. They don't have mental strength. [40:30.660 --> 40:41.660] Like this comedian just said recently, anybody that thinks words are violent hasn't been plugged in the face. [40:41.660 --> 40:54.660] Anyway, there's a couple things bugging me, and it goes on the line of the last call when I was talking about the structure out here. [40:54.660 --> 41:02.660] It is apparent that the court is actually a corporation. [41:02.660 --> 41:12.660] In California, it rolls up through the Supreme Court, and they have a Dunn's number, a Dun & Bradstreet number. [41:12.660 --> 41:19.660] In fact, they're organized as corporations, and I'll say for-profit corporations. [41:19.660 --> 41:25.660] Now, if that's our government, why are they corporations? [41:25.660 --> 41:32.660] When I say government, it's a branch of the government. It's the judicial branch. [41:32.660 --> 41:45.660] This criminal court is supposedly part of the process to keep the peace and safety of the people, and why are they incorporated? [41:45.660 --> 41:49.660] Let me talk to that, because that's always been a problem for me. [41:49.660 --> 41:56.660] The fact that a court may have an incorporated structure behind it is merely to do business, [41:56.660 --> 42:02.660] and we have a lot of patriots out there who are trying to make this something that matters. [42:02.660 --> 42:04.660] It's not something that matters. [42:04.660 --> 42:11.660] They incorporate so they have a business structure so they can buy toilet paper and pay their health and hire people. [42:11.660 --> 42:22.660] When a judge steps up on the bench, he does not do so in his corporate capacity. He does so in his constitutional capacity. [42:22.660 --> 42:31.660] The fact that there's a corporation back there is a rabbit hole. It means nothing. [42:31.660 --> 42:41.660] That corporation does not absolve that judge from his duty in his constitutional capacity. [42:41.660 --> 42:51.660] I think the government has put these people out there to seed this stuff into the mind of the patriots, [42:51.660 --> 43:00.660] to give them something to chase that is in line with what J.P. Morgan said back in the day. [43:00.660 --> 43:10.660] Let's keep these guys fighting over issues we don't care about, because they don't bother us. [43:10.660 --> 43:18.660] We need to focus on what the real issues are. When that judge steps up on that bench, he either follows the law or he doesn't. [43:18.660 --> 43:25.660] If he doesn't, we need to appeal, but we don't need to appeal to another judge. [43:25.660 --> 43:30.660] We need to appeal to a grand jury and see if we can't get him indicted. [43:30.660 --> 43:35.660] We're going to start changing these things and we'll stop being led down rabbit holes and get down to business. [43:35.660 --> 43:43.660] Hang on. I have to go to our caller board. It's full. Thank you all, guys, for bailing me out. [43:43.660 --> 43:50.660] When we get back, Ted, we need to move on. We've got a whole board full of callers. [43:50.660 --> 43:55.660] Randy Shelton, Brent Felton, we'll be right back. [44:21.660 --> 44:28.660] Well, I'm glad you asked. [46:25.660 --> 46:34.660] Such a scoundrel and a soldier, a warrior of love, scuffle and they keep his heat. All they're taking is misunderstanding. [46:34.660 --> 47:01.660] Somebody calls the police, watching the sparks fly. [47:01.660 --> 47:06.660] Breaching isn't addiction, the hard works can leave you cold as nails. [47:06.660 --> 47:12.660] It's impossibility, torture and cruelty, heavy loads of taping on scales. [47:12.660 --> 47:18.660] The time is colliding with the compass, you find out after a while. [47:18.660 --> 47:23.660] It's not your moral standard, it's your patience that's on trial. [47:23.660 --> 47:45.660] Watching the sparks fly. [47:53.660 --> 48:15.660] Okay, we are back, Randy Kelton, Brett Fountain, Rule of Law Radio. [48:15.660 --> 48:23.660] And sorry about the delay, we were working on our mics on the break and trying to get my sound correct. [48:23.660 --> 48:26.660] Brett, are you getting any feedback from my headsets? [48:26.660 --> 48:28.660] No, it actually sounds great. [48:28.660 --> 48:36.660] Okay, good, because it's a little louder in my ears, so I want to make sure it's not leaking out of the headset into the mic. [48:36.660 --> 48:49.660] Okay, we have Ted, okay thank you Ted, Ted from California dropped off. Now we're going to Elise in Arizona, hello for Elise. [48:49.660 --> 48:56.660] I couldn't help myself. Brett actually played that for me the other day on the break. [48:56.660 --> 49:01.660] I didn't know you played piano, Brett. [49:01.660 --> 49:06.660] Okay, what do you have for us today Elise? [49:06.660 --> 49:13.660] Hi guys, Randy you sound a little better, that was a little depressing with Ted, but it's reality, right? [49:13.660 --> 49:16.660] It's the reality that we're living in, so I get it. [49:16.660 --> 49:28.660] I have some administrative items and I was wondering if you needed perhaps a 45 sentence paragraph about my case [49:28.660 --> 49:37.660] and then I can get into the item or you can direct me. [49:37.660 --> 49:43.660] Okay, remind me about your case. [49:43.660 --> 49:47.660] What has happened so far or just one sentence quick thingy? [49:47.660 --> 49:50.660] Just the one sentence. [49:50.660 --> 49:59.660] I'm the one who took, I'm the plaintiff in the lawsuit that took a dentist to Small Plains Court. [49:59.660 --> 50:03.660] Oh the dentist, yeah the dentist with attitude. [50:03.660 --> 50:05.660] The lunatic, yeah. [50:05.660 --> 50:11.660] Now I know who we are. [50:11.660 --> 50:17.660] Okay, so where are you at in that case? [50:17.660 --> 50:27.660] Okay, well a lot has happened and currently the hotshot lawyer sends a motion to dismiss my amended complaint. [50:27.660 --> 50:39.660] She's saying that the defendant's answer and counterclaim, my question is is the answer and counterclaim nullified [50:39.660 --> 50:48.660] because the defendant is answering my amended complaint with a motion to dismiss. [50:48.660 --> 51:02.660] Okay, the answer is not necessarily nullified if it answers sufficiently, stands to answer your amended complaint. [51:02.660 --> 51:12.660] When you file an amended pleading, all of your claims in the original petition are nullified. [51:12.660 --> 51:16.660] The amended petition no longer exists. [51:16.660 --> 51:26.660] But if the defendant believes that his answer to the original petition still answers the current petition, [51:26.660 --> 51:34.660] then I'm not sure. I would think there would be no need to refile, [51:34.660 --> 51:43.660] but he would need to clarify to the court that he stands by his original answer. [51:43.660 --> 51:48.660] Because when you file an amended petition, you're not going to change everything. [51:48.660 --> 51:54.660] And if his original petition addressed all of these issues and you've addressed the same ones, [51:54.660 --> 52:02.660] and in your answer you brought new issues that the opposing counsel doesn't feel needs to be addressed, [52:02.660 --> 52:04.660] then he can just ignore them. [52:04.660 --> 52:12.660] And I've done that in cases where I was helping people, where the lawyer brought up irrelevant issues, [52:12.660 --> 52:15.660] where even if they were right, it made no difference. [52:15.660 --> 52:19.660] So we didn't argue those issues. [52:19.660 --> 52:25.660] A lot of times the lawyer, especially if they're dealing with a pro se, they won't lead you down a rabbit hole. [52:25.660 --> 52:30.660] They want to get you spending your time arguing issues that are irrelevant. [52:30.660 --> 52:37.660] And this may be the position of the lawyer, as he feels like he has already answered all your claims. [52:37.660 --> 52:40.660] Does that make sense? [52:40.660 --> 52:43.660] It does make sense. It's still confusing to me. [52:43.660 --> 52:47.660] Not that it matters. It's an estrogen lawyer. It's a female. [52:47.660 --> 52:53.660] The reason why I'm asking about the counterclaim is because it is a full out lie, [52:53.660 --> 52:56.660] and I want it to be able to do something about it. [52:56.660 --> 52:58.660] But if it doesn't matter, it doesn't matter. [52:58.660 --> 53:02.660] That's not your counterclaim. That's their counterclaim? [53:02.660 --> 53:07.660] Yeah. And that's not even really the issue that I'm facing. [53:07.660 --> 53:13.660] But because the motion to dismiss my amended complaint in this motion, [53:13.660 --> 53:18.660] she states that her answer and counterclaim, I'm using the word nullified. [53:18.660 --> 53:19.660] That's not what she said. [53:19.660 --> 53:23.660] But she said that it doesn't matter, their counterclaim and answer, [53:23.660 --> 53:30.660] because I have an amended complaint, and now their answer is the motion to dismiss. [53:30.660 --> 53:40.660] Okay. Are they claiming that a motion to dismiss for failure to state a claim on which recovery can be had? [53:40.660 --> 53:47.660] No. This is a motion to dismiss because either it's going to be dismissed [53:47.660 --> 53:56.660] or they're asking the judge for a court order requiring preliminary expert opinion affidavit. [53:56.660 --> 54:02.660] Preliminary expert opinions about what? [54:02.660 --> 54:10.660] Because I'm not suing an individual, I'm suing a healthcare professional, and ARS rules, ABCDE, [54:10.660 --> 54:17.660] whatever those rules are, which I have in front of me, state that if you're filing a claim, [54:17.660 --> 54:23.660] that's the word that they're constantly using, if you're filing a claim against a healthcare provider, [54:23.660 --> 54:28.660] I have to do certain things like a written statement and so on and so forth, [54:28.660 --> 54:38.660] and I need to get an expert opinion about what happened, which would cost hundreds of dollars. [54:38.660 --> 54:41.660] Expert opinion? [54:41.660 --> 54:42.660] Go ahead, Brett. [54:42.660 --> 54:47.660] No, I'm just wondering, expert opinion about what? [54:47.660 --> 54:57.660] Yes. About the fact, I'll tell you right here. [54:57.660 --> 55:02.660] Whether or not expert opinion testimony is necessary to prove the healthcare professional's standard of care [55:02.660 --> 55:05.660] or liability for the claim. [55:05.660 --> 55:16.660] And because it was a breach of contract, which I chose, obviously, and I also, Randy, [55:16.660 --> 55:22.660] I replied to one of your telegram posts and I attached my amended complaint [55:22.660 --> 55:29.660] and this woman's motion to dismiss. [55:29.660 --> 55:31.660] Do you want me to read it at all to you? [55:31.660 --> 55:39.660] I'm not sure what, you know, I don't know what you want me to do or continue with my questions. [55:39.660 --> 55:42.660] I have no problem doing whatever you need me to do. [55:42.660 --> 55:43.660] Well, I'm not sure. [55:43.660 --> 55:51.660] I need to understand what the nature, what the purpose of the expert testimony is. [55:51.660 --> 56:02.660] Are they asking for an expert testimony to determine whether or not the dentist performed his duty in a professional-like manner? [56:02.660 --> 56:13.660] Well, I heard her say just now, as she was reading that, that it was to be, she had to say whether or not, [56:13.660 --> 56:18.660] or at least she said whether, an expert opinion would be needed. [56:18.660 --> 56:24.660] So that sounds like maybe it's not that she has to produce the expert witness [56:24.660 --> 56:30.660] as much as make a declaration as to whether an expert witness is needed. [56:30.660 --> 56:33.660] Is that what I was hearing? [56:33.660 --> 56:34.660] I don't know. [56:34.660 --> 56:38.660] Elise, is that what you were seeing there? [56:38.660 --> 56:39.660] No, I can... [56:39.660 --> 56:40.660] And it said whether? [56:40.660 --> 56:49.660] Let's see. [56:49.660 --> 56:57.660] I'm supposed to file a requisite certification and... [56:57.660 --> 56:58.660] Wait a minute. [56:58.660 --> 56:59.660] Wait a minute. [56:59.660 --> 57:01.660] Let's take a step back. [57:01.660 --> 57:08.660] Does your complaint against the dentist require an expert? [57:08.660 --> 57:14.660] Is your claim against the dentist clear enough and reasonable enough [57:14.660 --> 57:22.660] that an ordinary person of reasonable prudence could understand the specifics of your claim? [57:22.660 --> 57:27.660] Are you claiming that, let's say, the dentist pulled the wrong tooth. [57:27.660 --> 57:29.660] Now, that wouldn't take an expert. [57:29.660 --> 57:36.660] But if you're claiming that the dentist put a cap on and he left some contagion under the cap [57:36.660 --> 57:40.660] and it caused it to get infected, that would take a professional. [57:40.660 --> 57:49.660] Is the nature of the claim you're bringing a claim that would take an expert professional [57:49.660 --> 57:55.660] to understand the claim? [57:55.660 --> 57:57.660] I asked for a tooth extraction. [57:57.660 --> 57:59.660] It did not happen. [57:59.660 --> 58:01.660] I was misled. [58:01.660 --> 58:08.660] Now, it's going to take an expert to determine if she pulled a tooth in or not. [58:08.660 --> 58:17.660] An ordinary person of reasonable prudence can't look in there and see a tooth in there. [58:17.660 --> 58:22.660] If that's what the issue is, you should ask for sanctions against opposing counsel [58:22.660 --> 58:27.660] for bringing a frivolous motion. [58:27.660 --> 58:32.660] All of this, look at all of it as being reasonable. [58:32.660 --> 58:37.660] We've had thousands of cases and they try to find reasonable positions for all of them. [58:37.660 --> 58:41.660] But if this is about whether or not she pulled a tooth, that don't take an expert. [58:41.660 --> 58:46.660] Hang on, Randy Kelton, Brett Fountain, Good Law Radio, we'll be right back. [58:46.660 --> 58:49.660] Soon as I take my teeth out. [58:49.660 --> 58:53.660] The Bible remains the most popular book in the world. [58:53.660 --> 58:57.660] Yet countless readers are frustrated because they struggle to understand it. [58:57.660 --> 59:01.660] Some new translations try to help by simplifying the text, [59:01.660 --> 59:06.660] but in the process can compromise the profound meaning of the scripture. [59:06.660 --> 59:08.660] Enter the recovery version. [59:08.660 --> 59:12.660] First, this new translation is extremely faithful and accurate, [59:12.660 --> 59:17.660] but the real story is the more than 9,000 explanatory footnotes. [59:17.660 --> 59:21.660] Difficult and profound passages are opened up in a marvelous way, [59:21.660 --> 59:27.660] providing an entrance into the riches of the word beyond which you've ever experienced before. [01:00:01.660 --> 01:00:05.660] The Bill of Rights contains the first ten amendments of our Constitution. [01:00:05.660 --> 01:00:08.660] They guarantee the specific freedoms Americans should know and protect. [01:00:08.660 --> 01:00:10.660] Our liberty depends on it. [01:00:10.660 --> 01:00:16.660] I'm Dr. Catherine Albrecht, and I'll be right back with an unforgettable way to remember one of your constitutional rights. [01:00:16.660 --> 01:00:18.660] Privacy is under attack. [01:00:18.660 --> 01:00:22.660] When you give up data about yourself, you'll never get it back again. [01:00:22.660 --> 01:00:27.660] And once your privacy is gone, you'll find your freedoms will start to vanish too. [01:00:27.660 --> 01:00:32.660] So protect your rights, say no to surveillance, and keep your information to yourself. [01:00:32.660 --> 01:00:34.660] Privacy, it's worth hanging on to. [01:00:34.660 --> 01:00:38.660] This public service announcement is brought to you by startpage.com, [01:00:38.660 --> 01:00:42.660] the private search engine alternative to Google, Yahoo, and Bing. [01:00:42.660 --> 01:00:45.660] Start over with StartPage. [01:00:45.660 --> 01:00:49.660] Most people think of seven as a more civilized number than six. [01:00:49.660 --> 01:00:54.660] Think about the number six as implicated in evil, as in the biblical 666. [01:00:54.660 --> 01:00:58.660] So it would fit right in that the Seventh Amendment would be about civil trials. [01:00:58.660 --> 01:01:00.660] Civil seven, civil trials, get it? [01:01:00.660 --> 01:01:07.660] Civil trials are ones where people sue instead of beating each other up over a dispute, like the dividing line between properties. [01:01:07.660 --> 01:01:11.660] They take their dispute to a courthouse and settle matters civilly without the fisticuffs. [01:01:11.660 --> 01:01:16.660] The Seventh Amendment guarantees that Americans have the right to a jury in certain civil matters [01:01:16.660 --> 01:01:19.660] instead of having a lone judge rule on the case. [01:01:19.660 --> 01:01:24.660] I'm Dr. Catherine Albrecht. More news and information at CatherineAlbrecht.com. [01:01:40.660 --> 01:01:46.660] I'm Dr. Catherine Albrecht, and I'll be right back with an unforgettable way to remember one of your constitutional rights. [01:01:46.660 --> 01:01:48.660] Privacy is under attack. [01:01:48.660 --> 01:01:52.660] When you give up data about yourself, you'll never get it back again. [01:01:52.660 --> 01:01:57.660] And once your privacy is gone, you'll find your freedoms will start to vanish too. [01:01:57.660 --> 01:02:02.660] So protect your rights, say no to surveillance, and keep your information to yourself. [01:02:02.660 --> 01:02:05.660] Privacy, it's worth hanging on to. [01:02:12.660 --> 01:02:15.660] Start over with StartPage. [01:02:15.660 --> 01:02:21.660] Remember the scene in George Orwell's novel, 1984, when Winston is threatened with his worst fear? [01:02:21.660 --> 01:02:25.660] That fear was having a cage of hungry rats unleashed on his face. [01:02:25.660 --> 01:02:29.660] But what if his worst fear was spiders? Eight-legged spiders, to be exact. [01:02:29.660 --> 01:02:33.660] Getting a face full of spiders would be pretty cruel and unusual. [01:02:33.660 --> 01:02:37.660] That image of eight-legged spiders will help you remember the Eighth Amendment. [01:02:37.660 --> 01:02:40.660] Our Founding Fathers added the Eighth Amendment to the U.S. Constitution [01:02:40.660 --> 01:02:43.660] to protect us from creepy-crawly eight-legged punishments [01:02:43.660 --> 01:02:47.660] and other cruel and unusual prison practices that were common in their day. [01:02:47.660 --> 01:02:51.660] The Eighth Amendment also prohibits the government from requiring excessive bail [01:02:51.660 --> 01:02:53.660] and charging excessive fines. [01:02:53.660 --> 01:03:07.660] I'm Dr. Catherine Albrecht. More news and information at CatherineAlbrecht.com. [01:03:23.660 --> 01:03:28.660] Thank you for watching. [01:03:53.660 --> 01:03:56.660] Thank you for watching. [01:04:23.660 --> 01:04:26.660] Thank you for watching. [01:04:54.660 --> 01:04:58.660] Music [01:05:12.660 --> 01:05:16.660] Okay, we are back. Randy Kelton, Bret Fountain, Hewlin Low Radio. [01:05:16.660 --> 01:05:21.660] At its official DebraSounds says I sound good. [01:05:21.660 --> 01:05:23.500] She didn't say I sounded smart. [01:05:24.540 --> 01:05:25.300] Just good. [01:05:26.460 --> 01:05:30.300] Said you've got a great face for radio or something like that. [01:05:33.420 --> 01:05:35.780] Pastor Mast made that official. [01:05:38.220 --> 01:05:39.540] So you want to tell everybody the date? [01:05:40.420 --> 01:05:40.820] Yes. [01:05:41.540 --> 01:05:42.620] I just put you on the spot. [01:05:43.180 --> 01:05:49.580] 19th day of May, Thursday, the 19th day of May, 2022. [01:05:49.580 --> 01:05:51.540] And we're talking to Elise in Arizona. [01:05:51.860 --> 01:05:59.060] And Elise, lawyers like to play little nitpicky games, but at the end of the [01:05:59.060 --> 01:06:08.380] day, the case goes to a reasonable person of ordinary proves, and you need to, to [01:06:08.380 --> 01:06:16.820] file a response asking the other lawyer, are you really saying to this court that [01:06:16.820 --> 01:06:24.220] there must be a professional opinion brought to the court to determine whether [01:06:24.220 --> 01:06:27.780] or not a particular tooth was extracted. [01:06:29.380 --> 01:06:33.860] It is it a position that a judge is too stupid to be able to look in someone's [01:06:33.860 --> 01:06:35.460] mouth and see if a tooth is there. [01:06:36.100 --> 01:06:37.700] Is this what you're saying? [01:06:39.220 --> 01:06:40.940] Is that what she's saying? [01:06:40.940 --> 01:06:46.100] What I'm saying is this woman wants to make us a medical malpractice action suit. [01:06:48.380 --> 01:06:57.100] And she is quoting these rules that make it look like it is a malpractice suit. [01:06:57.420 --> 01:07:01.340] And I'm in a lawsuit that has nothing to do with heart and what's going on. [01:07:01.380 --> 01:07:04.020] It's about laws and it's a black and white issue. [01:07:04.020 --> 01:07:05.100] Like there's no gray. [01:07:05.100 --> 01:07:10.660] And one of the rules she chose specifically says against the health care [01:07:10.660 --> 01:07:15.220] provider based upon such providers, alleged negligence, misconduct, errors, [01:07:15.260 --> 01:07:19.940] or omissions, a breach of contract in the rendering of healthcare, medical [01:07:19.940 --> 01:07:21.940] services, nursing, yada, yada, yada. [01:07:25.020 --> 01:07:29.740] So that's one of the rules, which makes it look like, look like it's a malpractice suit. [01:07:29.740 --> 01:07:36.220] So you're saying it's not a malpractice suit, it's a contractual suit based on breach of contract. [01:07:37.980 --> 01:07:38.500] Yes. [01:07:38.540 --> 01:07:43.420] And she's also saying that the un-my-amended complaint alleges improper informed consent, [01:07:43.740 --> 01:07:49.660] dissatisfaction with the dental work provided, and a disagreement with the scope of dental [01:07:49.660 --> 01:07:56.060] work provided by the health care provider based upon a breach of contract in the rendering of [01:07:56.060 --> 01:08:02.220] healthcare, medical services, and a disagreement with the scope of dental work completed. [01:08:04.060 --> 01:08:05.020] Okay, hold on. [01:08:06.140 --> 01:08:09.980] You have a judge sitting up there on the bench and the judge is not a dentist. [01:08:11.260 --> 01:08:15.980] But the judge is ostensibly a reasonable person of ordinary prudence. [01:08:17.660 --> 01:08:23.980] And you have a litigant talking to the judge, giving them information [01:08:23.980 --> 01:08:25.980] concerning reasonable information. [01:08:25.980 --> 01:08:33.980] Which the judge fully understands because he was a lawyer and he knew it was her job as a lawyer [01:08:34.940 --> 01:08:39.900] to say anything and do anything they can so that their client would win. [01:08:41.580 --> 01:08:42.460] He gets that. [01:08:43.820 --> 01:08:51.260] And it has been my experience that the best thing you can do is speak clearly and intelligently to [01:08:51.260 --> 01:08:57.500] the judge and treat the judge as if he is intelligent. [01:08:57.500 --> 01:09:01.260] I have had a number of cases when I was helping people with foreclosure issues [01:09:01.820 --> 01:09:11.260] where I have put in paragraph 16, 17, 18, 19 will not be addressed as they are irrelevant, [01:09:11.260 --> 01:09:12.700] nonsense arguments. [01:09:12.700 --> 01:09:15.180] I will not waste the court's time on these. [01:09:15.180 --> 01:09:18.780] And I have never had a judge complain about that. [01:09:18.780 --> 01:09:23.260] They understand what is nonsense and they understand that especially when lawyers are [01:09:23.260 --> 01:09:28.860] dealing with pro se litigants, they are going to try to lead the pro se litigant down a rabbit hole. [01:09:30.540 --> 01:09:36.780] Best do not let the lawyer distract you from your case. [01:09:38.780 --> 01:09:46.620] Your only purpose in the trial court is to set the record for appeal. [01:09:46.620 --> 01:09:53.420] If this lawyer is saying that your arguments cannot be addressed because they were not [01:09:53.420 --> 01:09:57.820] supported by an expert witness, nonsense. [01:09:59.820 --> 01:10:05.820] If a reasonable person can look at the evidence and come to a conclusion, we do not need an expert. [01:10:08.220 --> 01:10:13.580] And if she is saying that because of rule, says you have to have an expert to determine if a [01:10:13.580 --> 01:10:19.180] light is turned on or turned off, then the rule is inapplicable. [01:10:21.660 --> 01:10:24.220] Do not let her lead you down a rabbit hole. [01:10:26.460 --> 01:10:32.460] This lawyer would love to get you arguing an issue that simply makes no difference at [01:10:32.460 --> 01:10:33.420] the end of the day. [01:10:34.540 --> 01:10:36.220] You spend your time on that. [01:10:36.220 --> 01:10:38.620] You do not spend your time on the issues that matter. [01:10:38.620 --> 01:10:39.740] Does that make sense? [01:10:39.740 --> 01:10:43.020] It does make sense. [01:10:43.020 --> 01:10:47.900] And if the judge, let us just say, approves the motion to dismiss, does that mean that [01:10:47.900 --> 01:10:49.100] the lawsuit is over with? [01:10:50.060 --> 01:10:51.340] Absolutely not. [01:10:52.220 --> 01:10:58.860] Your only purpose in the trial court is to set the record for appeal. [01:10:59.900 --> 01:11:03.260] Never expect to win in the trial court. [01:11:04.460 --> 01:11:08.860] It would be nice if you did, but that is secondary. [01:11:08.860 --> 01:11:13.260] That is just a plum that somebody might throw you on occasion. [01:11:13.980 --> 01:11:16.620] Where you expect to win is in the trial court. [01:11:17.180 --> 01:11:25.260] So your only purpose, I said trial court, you only expect to win in the appellate court. [01:11:27.900 --> 01:11:33.740] In the trial court, your only purpose is to put the facts and the law on the record. [01:11:33.740 --> 01:11:36.380] You get the facts and law on the record. [01:11:36.380 --> 01:11:41.980] No matter what the judge does, when you get to the appellate court, you argue the facts [01:11:41.980 --> 01:11:43.980] and the law that are on the record. [01:11:45.180 --> 01:11:49.580] If the lawyers bought the judge in the trial court, not a problem. [01:11:50.300 --> 01:11:55.100] And it's been my experience that the more corrupt the judge is in the trial court, the [01:11:55.100 --> 01:11:57.580] easier it is in the appellate court. [01:11:58.700 --> 01:12:00.380] They do more stupid stuff. [01:12:00.380 --> 01:12:07.900] And for the most part, pro-says especially, 90% of them never get to the appellate court. [01:12:09.180 --> 01:12:17.980] Your only thought, what facts do I need and what law applies to those facts when I get [01:12:17.980 --> 01:12:19.340] to the appellate court. [01:12:19.340 --> 01:12:22.620] My only purpose here is to put that on the record in front of this judge. [01:12:22.620 --> 01:12:23.980] I don't care how he rules about it. [01:12:25.180 --> 01:12:27.660] Do not let that disappoint you. [01:12:27.660 --> 01:12:30.700] Do not let that distract you. [01:12:30.700 --> 01:12:37.420] If you have the facts and law on the record, and the facts and law lead to a particular [01:12:37.420 --> 01:12:41.180] outcome, that's the place for the appellate court. [01:12:43.260 --> 01:12:48.780] Judges do whatever they want to, and they'll screw you around all they can. [01:12:48.780 --> 01:12:49.820] Don't worry about them. [01:12:49.820 --> 01:12:56.940] When the judge realizes that you don't care what he does, your only purpose is to set [01:12:56.940 --> 01:13:02.860] the record for appeal, then things tend to change because judges don't like to be overturned. [01:13:06.860 --> 01:13:07.360] Okay. [01:13:08.540 --> 01:13:11.580] You're always so positive and so empowering. [01:13:11.580 --> 01:13:14.140] I have a big smile on my face, but thank you. [01:13:14.780 --> 01:13:16.220] You're wonderful. [01:13:16.220 --> 01:13:19.900] I have two questions, maybe just one. [01:13:19.900 --> 01:13:23.020] For that, I need you to call my wife and tell her that. [01:13:25.020 --> 01:13:27.020] You have to tell her twice. [01:13:27.020 --> 01:13:33.020] Yes, twice at least, because she won't believe it the first time. [01:13:33.020 --> 01:13:35.020] Okay, go ahead. [01:13:35.020 --> 01:13:55.420] When the defendant files a motion, the motion is moot, and that is approved, what does that [01:13:55.420 --> 01:14:01.260] do in appeal, in the court of appeals, if anything? [01:14:01.260 --> 01:14:04.940] I don't know, for some reason, that word moot, I've been thinking like it has a big meaning [01:14:06.220 --> 01:14:09.020] in the appeal court, but no, it's not. [01:14:09.020 --> 01:14:13.660] Moot, saying that even if it was ruled in your favor, it wouldn't make any difference. [01:14:15.900 --> 01:14:17.740] So, regarding appeals, that's not- [01:14:17.740 --> 01:14:19.580] What the judge rules doesn't matter. [01:14:21.260 --> 01:14:25.180] If you have the facts and law on the record, the judge can rule anything [01:14:25.180 --> 01:14:26.780] he wants to, it doesn't affect you. [01:14:26.780 --> 01:14:32.380] If a judge rules against you on an issue, your only purpose is to put the facts and [01:14:32.380 --> 01:14:33.580] law on the record. [01:14:33.580 --> 01:14:39.580] So, when he rules against you on a motion or a pleading, then you immediately file a [01:14:39.580 --> 01:14:43.180] request for findings of fact and conclusions of law. [01:14:43.980 --> 01:14:50.780] What facts that are on the record did you consider, and what law did you apply to those [01:14:50.780 --> 01:14:51.580] facts? [01:14:51.580 --> 01:14:58.380] When you appeal, the only thing you can appeal is an abuse of discretion by the judge for [01:14:58.380 --> 01:15:02.380] failing to properly apply the law to the facts. [01:15:03.980 --> 01:15:11.580] So, when he alleges to apply the law to the facts, you ask him for exactly what law, what [01:15:11.580 --> 01:15:12.380] facts. [01:15:13.180 --> 01:15:17.180] If he doesn't give them to you, I file criminal charges against the judge. [01:15:17.180 --> 01:15:18.780] That is so much fun. [01:15:18.780 --> 01:15:23.180] They tell you, that feels like it's you could appeal. [01:15:23.180 --> 01:15:23.980] Yeah, we can. [01:15:24.780 --> 01:15:27.180] But we've got two sources of appeal. [01:15:28.780 --> 01:15:33.180] One is to the appellate court, and the other one's to a grand jury. [01:15:33.980 --> 01:15:36.780] One of them you're not going to like very much, your honor. [01:15:37.580 --> 01:15:38.380] Exactly. [01:15:38.380 --> 01:15:48.780] Walker v. Packer says, a judge has no discretion in properly applying the law to the facts. [01:15:49.180 --> 01:15:52.380] A failure to do so is an abuse of discretion. [01:15:52.780 --> 01:15:59.180] And it goes on to say, the only thing that you can appeal to the court of appeals is [01:15:59.180 --> 01:16:01.980] an abuse of discretion by the court of appeals. [01:16:01.980 --> 01:16:07.980] The only thing that you can appeal to the court of appeals is an abuse of discretion [01:16:07.980 --> 01:16:09.580] by the trial judge. [01:16:11.980 --> 01:16:18.380] The way I read the penal code, if a public official abuses his discretion, and in the [01:16:18.380 --> 01:16:24.780] process denies me the full free access to or enjoyment of a right, well, that's a crime [01:16:24.780 --> 01:16:32.780] for every state, because every state has a reflection of the Ku Klux Klan Act of 1871. [01:16:34.380 --> 01:16:39.180] The Ku Klux Klan Act establishes your right to sue a public official, but that's the [01:16:39.180 --> 01:16:39.980] second act. [01:16:39.980 --> 01:16:45.580] The first part makes it a crime for a public official to abuse his discretion and deny [01:16:45.580 --> 01:16:46.380] you the right. [01:16:46.780 --> 01:16:48.380] So I want to do two appeals. [01:16:48.380 --> 01:16:53.580] The point is, if the judge rules, you want to know how he got to that ruling. [01:16:55.180 --> 01:16:56.780] You start demanding that. [01:16:57.980 --> 01:17:02.380] Are you looking to have a closer relationship with God and a better understanding of his [01:17:02.380 --> 01:17:02.780] word? [01:17:03.180 --> 01:17:08.380] Then tune in to LogosRadioNetwork.com on Wednesdays from 8 to 10 p.m. Central time for [01:17:08.380 --> 01:17:13.580] scripture talk, where Nana and her guests discuss the scriptures in accord with 2 Timothy [01:17:13.580 --> 01:17:19.180] 2.15. Study to show thyself approved unto God, a workman that needeth not to be ashamed, [01:17:19.180 --> 01:17:20.780] rightly dividing the word of truth. [01:17:21.580 --> 01:17:25.980] Starting in January, our first hour studies are in the Book of Mark, where we'll go verse [01:17:25.980 --> 01:17:31.180] by verse and discuss the true gospel message. Our second hour topical studies will vary [01:17:31.180 --> 01:17:36.380] each week with discussions on sound doctrine and Christian character development. We wish [01:17:36.380 --> 01:17:44.380] to reflect God's light and be a blessing to all those with a hearing ear. Our goal is [01:17:44.380 --> 01:17:49.180] to strengthen our faith and to transform ourselves more into the likeness of our Lord and Savior [01:17:49.180 --> 01:17:55.180] Jesus. So tune in to scripture talk live on LogosRadioNetwork.com Wednesdays from 8 to [01:17:55.180 --> 01:17:59.180] 10 p.m. to inspire and motivate your studies of the scriptures. [01:18:01.180 --> 01:18:05.980] Through advances in technology, our lives have greatly improved, except in the area [01:18:05.980 --> 01:18:10.380] of nutrition. People feed their pets better than they feed themselves, and it's time [01:18:10.380 --> 01:18:16.380] we changed all that. Our primary defense against aging and disease in this toxic environment [01:18:16.380 --> 01:18:21.580] is good nutrition. In a world where natural foods have been irradiated, adulterated, [01:18:21.580 --> 01:18:27.580] and mutilated, young Jevity can provide the nutrients you need. LogosRadioNetwork gets [01:18:27.580 --> 01:18:33.180] many requests to endorse all sorts of products, most of which we reject. We have come to trust [01:18:33.180 --> 01:18:39.180] young Jevity so much, we became a marketing distributor along with Alex Jones, Ben Fuchs, [01:18:39.180 --> 01:18:45.180] and many others. When you order from LogosRadioNetwork.com, your health will improve [01:18:45.180 --> 01:18:51.180] as you help support quality radio. As you realize the benefits of young Jevity, you may [01:18:51.180 --> 01:18:56.380] want to join us. As a distributor, you can experience improved health, help your friends [01:18:56.380 --> 01:19:06.380] and family, and increase your income. Order now. This is the LogosRadioNetwork. [01:19:27.380 --> 01:19:41.380] Well, ain't gonna fool me with that same old trick again. I was blindsided, but now I can see your plan. [01:19:41.380 --> 01:19:51.380] You put the fear in my pocket, took the money from my hand. Ain't gonna fool me with that same old trick again. [01:19:51.380 --> 01:20:01.380] Ain't gonna fool me with that same old trick again. [01:20:11.380 --> 01:20:15.380] Ain't gonna drop me with that same old trick again. [01:20:15.380 --> 01:20:23.380] Okay, we are back, Randy Kelton, Brett Fountain, LogosRadio, and talk on the plate about judges [01:20:23.380 --> 01:20:29.380] who get up there on the stand and think, well, deep out of it. [01:20:29.380 --> 01:20:35.380] It is the perception, or it appears to be the perception, that when a judge gets elected [01:20:35.380 --> 01:20:40.380] as a judge and gets up there on the bench, he can pretty well do what he wants to. [01:20:40.380 --> 01:20:48.380] And I suggest, Elise, that you and I and Brett and everybody else listening demonstrate to these folks [01:20:48.380 --> 01:20:55.380] that that is not the case. You may not do anything you want to. [01:20:55.380 --> 01:21:03.380] You shall do exactly what you are required to do, or we're going to beat you up pretty good. [01:21:03.380 --> 01:21:07.380] This is the way we're going to change things. [01:21:07.380 --> 01:21:15.380] Do you have anything else for us? We're going to run out of time on this show. [01:21:15.380 --> 01:21:20.380] Yes, I do. I can always call back tomorrow. [01:21:20.380 --> 01:21:27.380] I've spent a lot of time on yours because you're raising sophisticated issues. [01:21:27.380 --> 01:21:30.380] These are the kind of things I like to talk about. [01:21:30.380 --> 01:21:32.380] But I've got three more callers and we're running out of time. [01:21:32.380 --> 01:21:37.380] Call back tomorrow. We'll have more time to address this in more detail. [01:21:37.380 --> 01:21:40.380] Okey-dokey. Thank you to you both. Have a beautiful evening. [01:21:40.380 --> 01:21:42.380] Thank you so much for everything. [01:21:42.380 --> 01:21:47.380] And make sure when you call in tomorrow you say something nice about us. [01:21:47.380 --> 01:21:48.380] Always. [01:21:48.380 --> 01:21:56.380] Always a prerequisite, except for Ted from Utah who's next. Thank you, Elise. [01:21:56.380 --> 01:22:01.380] Ted from Utah, he's an ex-truck driver and you know how truck drivers are. [01:22:01.380 --> 01:22:05.380] Hello, Ted. What do you have for us today? [01:22:05.380 --> 01:22:09.380] Oh, I've got an interesting thing, Randy. [01:22:09.380 --> 01:22:14.380] I've got somebody calling me trying to collect a bill that I don't owe. [01:22:14.380 --> 01:22:19.380] I asked them to prove it up and they tell me they can't do that. [01:22:19.380 --> 01:22:22.380] I mean, I don't know who they are. [01:22:22.380 --> 01:22:28.380] You know, they identify themselves, but they're so fast you can't understand what they say. [01:22:28.380 --> 01:22:34.380] Wait a minute. Are they doing this in writing or on the telephone? [01:22:34.380 --> 01:22:37.380] Telephone. [01:22:37.380 --> 01:22:42.380] When I get guys on the telephone, I have great fun at their expense. [01:22:42.380 --> 01:22:47.380] Oh, wait, wait. You said all that. You went through a lot of stuff, but I didn't get it. [01:22:47.380 --> 01:22:51.380] Can you say all that again? [01:22:51.380 --> 01:22:54.380] I tell them I do not do business on the phone. [01:22:54.380 --> 01:22:57.380] I talk to them in truck driver English. [01:22:57.380 --> 01:23:01.380] If you want to talk to me, if you want to communicate some information, here's my email. [01:23:01.380 --> 01:23:05.380] Send it to me and we'll talk. [01:23:05.380 --> 01:23:11.380] What's said on the phone means nothing unless you have it recorded. [01:23:11.380 --> 01:23:17.380] I'd like to ask them what's the official, can you tell me the full business name? [01:23:17.380 --> 01:23:19.380] Can you spell that out for me, please? [01:23:19.380 --> 01:23:21.380] And what's the CEO's name? [01:23:21.380 --> 01:23:25.380] Yeah, the name of the man or woman who's principal. [01:23:25.380 --> 01:23:27.380] You're the agent for this man or woman, right? [01:23:27.380 --> 01:23:29.380] Can you give me that name? [01:23:29.380 --> 01:23:37.380] And what's the address, the mailing address for the headquarters where that CEO can be served? [01:23:37.380 --> 01:23:40.380] For some reason, they don't want to talk to me too much after that. [01:23:40.380 --> 01:23:45.380] That's rotten, Brett. You ruined everything for them. [01:23:45.380 --> 01:23:48.380] I never thought about that. [01:23:48.380 --> 01:23:56.380] How can I get an address? You can't even fill them without a proper name. [01:23:56.380 --> 01:24:04.380] Yeah, these guys doing this debt collection, sometimes they're reasonable, they're real, [01:24:04.380 --> 01:24:07.380] and sometimes they're just made up. [01:24:07.380 --> 01:24:12.380] I had a friend who was a professional criminal. [01:24:12.380 --> 01:24:18.380] And he made his standard income by sending invoices to companies. [01:24:18.380 --> 01:24:24.380] He said, this was 1970, and he said, never send an invoice over $25. [01:24:24.380 --> 01:24:28.380] If it's under $25, even if they don't think it's valid, [01:24:28.380 --> 01:24:34.380] it will cost them more to challenge it than it does to pay it. [01:24:34.380 --> 01:24:37.380] And once they've paid it once, [01:24:37.380 --> 01:24:42.380] then the people who see it know they've paid it before and they just pay it regular. [01:24:42.380 --> 01:24:45.380] He made his income just by sending invoices. [01:24:45.380 --> 01:24:51.380] And if they realize that it's bogus, then they just don't pay it. [01:24:51.380 --> 01:24:58.380] But if they do pay it, they did so voluntarily, and it's not a crime. [01:24:58.380 --> 01:25:03.380] So you've got all these debt collectors calling you, telling you that you owe money. [01:25:03.380 --> 01:25:08.380] If you send them money, it doesn't matter if you owed it or not. [01:25:08.380 --> 01:25:12.380] They get to keep it. [01:25:12.380 --> 01:25:14.380] I understand that. [01:25:14.380 --> 01:25:19.380] You know, since last round, I accused you of being a scam artist. [01:25:19.380 --> 01:25:23.380] I said, you know, if it's not a scam, you can prove up the bill. [01:25:23.380 --> 01:25:25.380] Prove it up. [01:25:25.380 --> 01:25:29.380] Oh, I can't do that. [01:25:29.380 --> 01:25:36.380] Okay, what you're asking for specifically is debt validation. [01:25:36.380 --> 01:25:39.380] Tell them, can you validate the debt? [01:25:39.380 --> 01:25:43.380] They'll know what that word means. [01:25:43.380 --> 01:25:48.380] Validate in this context is a term of art. [01:25:48.380 --> 01:25:52.380] Under the Fair Debt Collections Practices Act, [01:25:52.380 --> 01:26:00.380] validating a debt requires the bookkeeping to show all of the debts and all the expenditures, [01:26:00.380 --> 01:26:06.380] all the payments and the outcome and the end goal, the whole record of the debt. [01:26:06.380 --> 01:26:08.380] We do that in foreclosures with us. [01:26:08.380 --> 01:26:11.380] They never can. [01:26:11.380 --> 01:26:20.380] The reason they never can is when the mortgage indebtedness is sold to another party. [01:26:20.380 --> 01:26:23.380] For some reason, I don't understand. [01:26:23.380 --> 01:26:30.380] They send the note, but they don't send the accounting records with it. [01:26:30.380 --> 01:26:40.380] So if they sign a new holder of the note, he doesn't have any records of previous payments. [01:26:40.380 --> 01:26:45.380] So it's impossible for him to validate the debt. [01:26:45.380 --> 01:26:47.380] It's nuts. [01:26:47.380 --> 01:26:51.380] So it's really easy to hammer them. [01:26:51.380 --> 01:26:53.380] Yeah. [01:26:53.380 --> 01:26:59.380] This is David sometimes twice a day. [01:26:59.380 --> 01:27:03.380] So you've just got somebody calling you on the phone claiming that you own a debt. [01:27:03.380 --> 01:27:05.380] Tell them, here's my email. [01:27:05.380 --> 01:27:07.380] Send it to me or here's my mailing address. [01:27:07.380 --> 01:27:12.380] Send me something I can look at and read. [01:27:12.380 --> 01:27:14.380] Okay. [01:27:14.380 --> 01:27:19.380] Tell them that you're old and you can't hear well on the phone. [01:27:19.380 --> 01:27:23.380] And in that case, for you, that won't be a lie. [01:27:23.380 --> 01:27:26.380] That won't be a lie. [01:27:26.380 --> 01:27:27.380] Yeah. [01:27:27.380 --> 01:27:28.380] They lie. [01:27:28.380 --> 01:27:29.380] Why can't I? [01:27:29.380 --> 01:27:33.380] You know, I suppose we bought skin care products. [01:27:33.380 --> 01:27:34.380] You've met me. [01:27:34.380 --> 01:27:39.380] Do I look like I care about skin care products? [01:27:39.380 --> 01:27:40.380] Wait. [01:27:40.380 --> 01:27:41.380] Could you understand him, Brett? [01:27:41.380 --> 01:27:42.380] I couldn't. [01:27:42.380 --> 01:27:44.380] He said it's something about skin products. [01:27:44.380 --> 01:27:46.380] He said, well, Randy, you've met me. [01:27:46.380 --> 01:27:51.380] Do I look like I care about skin care products? [01:27:51.380 --> 01:27:58.380] We were going to get Ted to be a phlebotomist for us to take blood. [01:27:58.380 --> 01:28:09.380] The only drawback was is he had a heart operation and it gave him surgical palsy. [01:28:09.380 --> 01:28:17.380] He could take 20 people's blood at the same time. [01:28:17.380 --> 01:28:20.380] Yeah. [01:28:20.380 --> 01:28:24.380] That'd be great fun. [01:28:24.380 --> 01:28:27.380] And I practice on you. [01:28:27.380 --> 01:28:31.380] I wouldn't go for that. [01:28:31.380 --> 01:28:33.380] Okay. [01:28:33.380 --> 01:28:36.380] So do you have anything else for us, Ted? [01:28:36.380 --> 01:28:39.380] No, that'll do it. [01:28:39.380 --> 01:28:40.380] Thanks, Randy. [01:28:40.380 --> 01:28:44.380] I actually just called because you were seeing somebody fill in, so I'm out of here. [01:28:44.380 --> 01:28:45.380] Bye. [01:28:45.380 --> 01:28:46.380] Yeah. [01:28:46.380 --> 01:28:48.380] I was kind of desperate at the beginning of the show. [01:28:48.380 --> 01:28:52.380] I didn't have time to put together an initial presentation. [01:28:52.380 --> 01:28:57.380] I had too many technical difficulties going on, so I was kind of stressed out. [01:28:57.380 --> 01:28:58.380] Okay. [01:28:58.380 --> 01:29:00.380] Thank you, Ted. [01:29:00.380 --> 01:29:03.380] Now we're going to go to Penny in Texas. [01:29:03.380 --> 01:29:05.380] Hello, Penny. [01:29:05.380 --> 01:29:09.380] We've got Olivier in Tennessee. [01:29:09.380 --> 01:29:11.380] Penny, are you there? [01:29:11.380 --> 01:29:13.380] Yeah, I am. [01:29:13.380 --> 01:29:15.380] Can you hold on? [01:29:15.380 --> 01:29:19.380] You've got to hear what Olivier has to say. [01:29:19.380 --> 01:29:21.380] Yeah, I do. [01:29:21.380 --> 01:29:24.380] Olivier, talk to us. [01:29:24.380 --> 01:29:26.380] Hello? [01:29:26.380 --> 01:29:28.380] Yeah, tell us what you told me. [01:29:28.380 --> 01:29:32.380] I was driving back from Austin and Olivier called me. [01:29:32.380 --> 01:29:35.380] It was great. [01:29:35.380 --> 01:29:40.380] Tell us what you did to the lawyer, to your lawyer. [01:29:40.380 --> 01:29:43.380] You got the commercial break about to come up. [01:29:43.380 --> 01:29:45.380] Oh, that. [01:29:45.380 --> 01:29:47.380] You've got to do something like that. [01:29:47.380 --> 01:30:02.380] We'll be right back. [01:30:02.380 --> 01:30:09.380] Reality TV, sugar, obesity, jet lag, the list of things that makes us dumber just keeps on growing. [01:30:09.380 --> 01:30:12.380] But now researchers say we can add stress to the list. [01:30:12.380 --> 01:30:14.380] I'm Dr. Catherine Albrecht. [01:30:14.380 --> 01:30:16.380] Back with details in a moment. [01:30:16.380 --> 01:30:18.380] Privacy is under attack. [01:30:18.380 --> 01:30:22.380] When you give up data about yourself, you'll never get it back again. [01:30:22.380 --> 01:30:27.380] And once your privacy is gone, you'll find your freedoms will start to vanish too. [01:30:27.380 --> 01:30:32.380] So protect your rights, say no to surveillance, and keep your information to yourself. [01:30:32.380 --> 01:30:35.380] Privacy, it's worth hanging on to. [01:30:35.380 --> 01:30:42.380] This message is brought to you by StartPage.com, the private search engine alternative to Google, Yahoo, and Bing. [01:30:42.380 --> 01:30:45.380] Start over with StartPage. [01:30:45.380 --> 01:30:48.380] Are you always on the go and juggling multiple projects? [01:30:48.380 --> 01:30:52.380] If so, you might think that multitasking proves you're smart. [01:30:52.380 --> 01:30:56.380] But think again, all that stress might be eating your brain. [01:30:56.380 --> 01:31:00.380] A new study finds stress reduces the number of connections between neurons, [01:31:00.380 --> 01:31:04.380] which actually makes it harder for people to manage problems. [01:31:04.380 --> 01:31:10.380] Researchers at Yale University found that stressed out people have less gray matter in their prefrontal cortex. [01:31:10.380 --> 01:31:15.380] That's the part of the brain that helps us weigh conflicting ideas and regulate our emotions. [01:31:15.380 --> 01:31:18.380] So take a deep breath and chill out. [01:31:18.380 --> 01:31:21.380] It'll help keep your mind as sharp as a tack. [01:31:21.380 --> 01:31:26.380] I'm Dr. Catherine Albrecht for StartPage.com, the world's most private search engine. [01:31:31.380 --> 01:31:36.380] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11. [01:31:36.380 --> 01:31:38.380] The government says that fire brought it down. [01:31:38.380 --> 01:31:43.380] However, 1,500 architects and engineers concluded it was a controlled demolition. [01:31:43.380 --> 01:31:46.380] Over 6,000 of my fellow service members have given their lives, [01:31:46.380 --> 01:31:49.380] and thousands of my fellow first responders are dying. [01:31:49.380 --> 01:31:50.380] I'm not a conspiracy theorist. [01:31:50.380 --> 01:31:51.380] I'm a structural engineer. [01:31:51.380 --> 01:31:52.380] I'm a New York City correction officer. [01:31:52.380 --> 01:31:53.380] I'm an Air Force pilot. [01:31:53.380 --> 01:31:55.380] I'm a father who lost his son. [01:31:55.380 --> 01:31:58.380] We're Americans, and we deserve the truth. [01:31:58.380 --> 01:32:01.380] Go to RememberBuilding7.org today. [01:32:02.380 --> 01:32:05.380] Rule of Law Radio is proud to offer the Rule of Law traffic seminar. [01:32:13.380 --> 01:32:16.380] Among those rights are the right to travel freely from place to place, [01:32:16.380 --> 01:32:18.380] the right to act in our own private capacity, [01:32:18.380 --> 01:32:20.380] and most importantly, the right to due process of law. [01:32:20.380 --> 01:32:24.380] Traffic courts afford us the least expensive opportunity to learn how to enforce [01:32:24.380 --> 01:32:26.380] and preserve our rights through due process. [01:33:52.380 --> 01:33:56.380] My name is Randy Kelton. [01:33:56.380 --> 01:33:59.380] Talking for Olivier in Texas, before we go to Olivier, Penny, [01:33:59.380 --> 01:34:02.380] if we don't get back to you, if you'll call back tomorrow night, [01:34:02.380 --> 01:34:04.380] I'll bring you up to the front. [01:34:04.380 --> 01:34:10.380] But I think you'll find this for me. [01:34:10.380 --> 01:34:13.380] Olivier called me while I was coming back from Austin. [01:34:13.380 --> 01:34:19.380] And once he told me what he did, I told him, you've got to call in. [01:34:19.380 --> 01:34:27.380] Okay, Olivier, tell us what you did to your lawyer. [01:34:27.380 --> 01:34:30.380] I'll give you the version. [01:34:30.380 --> 01:34:35.380] And tomorrow I'll call in to, because I was beginning to do the research to [01:34:35.380 --> 01:34:39.380] respond to what the attorney did. [01:34:39.380 --> 01:34:45.380] And the research is so devastating that I realized that I made the argument in [01:34:45.380 --> 01:34:49.380] preparation for this moment and forgot about it until now, [01:34:49.380 --> 01:34:54.380] because I had a section of my research named A1 motions. [01:34:54.380 --> 01:34:56.380] I'm like, how come it doesn't make sense? [01:34:56.380 --> 01:34:58.380] So I just tapped into it, looked into it. [01:34:58.380 --> 01:35:04.380] It had all the information that needed to be addressed with the Supreme Court [01:35:04.380 --> 01:35:06.380] cases and everything. [01:35:06.380 --> 01:35:11.380] So I'll call back tomorrow night and go over that with you to show how [01:35:11.380 --> 01:35:20.380] devastating the issue is about to be. [01:35:20.380 --> 01:35:25.380] But everybody needs to hear how you handled your lawyer. [01:35:25.380 --> 01:35:27.380] Right. [01:35:27.380 --> 01:35:34.380] Just as an introduction, Olivier was in Florida. [01:35:34.380 --> 01:35:41.380] He had the audacity to drive while blocked. [01:35:41.380 --> 01:35:44.380] You did that, didn't you, Olivier? [01:35:44.380 --> 01:35:46.380] Yeah, I got in a car accident too. [01:35:46.380 --> 01:35:49.380] I got hit by a car. [01:35:49.380 --> 01:35:52.380] And now he's showing him a different color. [01:35:52.380 --> 01:35:55.380] Okay, go ahead. [01:35:55.380 --> 01:35:58.380] So now they found me guilty during trial. [01:35:58.380 --> 01:36:02.380] This is the case where I got hit by a car accident. [01:36:02.380 --> 01:36:05.380] The police officer came, took the story, [01:36:05.380 --> 01:36:10.380] realized that she hit me, took a lot of the tickets to the hospital. [01:36:10.380 --> 01:36:12.380] He went and did his little research. [01:36:12.380 --> 01:36:20.380] He saw that I had two prior incidences which were still ongoing in court, [01:36:20.380 --> 01:36:27.380] but he took it as those were guilty verdicts and this is my third offense. [01:36:27.380 --> 01:36:30.380] So he arrested me as a felon and booked me as a felon, [01:36:30.380 --> 01:36:32.380] everything as a felon. [01:36:32.380 --> 01:36:34.380] So now we go to court. [01:36:34.380 --> 01:36:35.380] We have the trial. [01:36:35.380 --> 01:36:37.380] I'm found guilty. [01:36:37.380 --> 01:36:40.380] They dismissed all my motions. [01:36:40.380 --> 01:36:50.380] On appeal, the attorney sent a paperwork to my house saying that she found nothing [01:36:50.380 --> 01:37:00.380] meritorious, no meritorious arguments, and Father Anderson's brief asked him to be relieved because there's nothing to argue. [01:37:00.380 --> 01:37:11.380] And after this happens, I have 30 days to file an answer if I want to bring up any issues myself. [01:37:11.380 --> 01:37:15.380] So I was at the point where I'm feeling like, well, this is around time. [01:37:15.380 --> 01:37:18.380] It's about time for that to happen. [01:37:18.380 --> 01:37:22.380] So I called the pellet court, which is another division, [01:37:22.380 --> 01:37:34.380] and then I asked them to help me address the calendar issue with my foot when the time is up to submit the motion. [01:37:34.380 --> 01:37:35.380] He told me on the 22nd. [01:37:35.380 --> 01:37:37.380] I said, okay, thank you. [01:37:37.380 --> 01:37:40.380] He said, well, do you want to speak to your attorney? [01:37:40.380 --> 01:37:41.380] I said, huh? [01:37:41.380 --> 01:37:42.380] I can speak to him? [01:37:42.380 --> 01:37:44.380] Because she didn't call me. [01:37:44.380 --> 01:37:46.380] She said, yeah, you can speak to her. [01:37:46.380 --> 01:37:49.380] I'm like, well, if she's in, I'll speak to her. [01:37:49.380 --> 01:37:53.380] So he transferred me over, and lo and behold, she clicked over. [01:37:53.380 --> 01:37:57.380] She must not have been doing nothing because it didn't take long at all. [01:37:57.380 --> 01:37:58.380] I sent the phone. [01:37:58.380 --> 01:37:59.380] I said, how? [01:37:59.380 --> 01:38:00.380] Hi. [01:38:00.380 --> 01:38:01.380] How are you doing, Mr. Livia? [01:38:01.380 --> 01:38:02.380] I'm fine. [01:38:02.380 --> 01:38:05.380] And he said, is there anything you need to address? [01:38:05.380 --> 01:38:07.380] I said, well, yeah. [01:38:07.380 --> 01:38:13.380] I just called to get the date, the verified date on this Anderson brief where I needed an answer. [01:38:13.380 --> 01:38:17.380] And then he said, well, I filed it on the 22nd. [01:38:17.380 --> 01:38:20.380] It should be on the 22nd of next month. [01:38:20.380 --> 01:38:21.380] I said, okay. [01:38:21.380 --> 01:38:24.380] Well, he said, is there anything else? [01:38:24.380 --> 01:38:26.380] I said, yeah, there is something else. [01:38:26.380 --> 01:38:28.380] Can you explain this Anderson brief to me? [01:38:28.380 --> 01:38:33.380] And she said, well, the Anderson, she was researching through papers and everything. [01:38:33.380 --> 01:38:36.380] In my head, I'm like, oh, you're looking through paperwork? [01:38:36.380 --> 01:38:38.380] Well, that don't mean anything. [01:38:38.380 --> 01:38:41.380] And she finally gets to it. [01:38:41.380 --> 01:38:43.380] You're going to embarrass that person. [01:38:43.380 --> 01:38:45.380] She's going to get embarrassed. [01:38:45.380 --> 01:38:47.380] You got to watch out. [01:38:47.380 --> 01:38:49.380] I said, okay, all right. [01:38:49.380 --> 01:38:50.380] I was listening. [01:38:50.380 --> 01:38:52.380] She says, yeah, it's the brief. [01:38:52.380 --> 01:38:57.380] It's saying that when the attorney doesn't find anything meritable in the argument, they're [01:38:57.380 --> 01:39:05.380] allowed to find the Anderson brief and write the reason why there's no merit in the argument. [01:39:05.380 --> 01:39:12.380] And after that, the appellate can write their own brief. [01:39:12.380 --> 01:39:13.380] I'm like, oh, okay. [01:39:13.380 --> 01:39:14.380] Okay. [01:39:14.380 --> 01:39:15.380] I figured. [01:39:15.380 --> 01:39:16.380] But that's what I thought it said. [01:39:16.380 --> 01:39:17.380] That's what I thought it said. [01:39:17.380 --> 01:39:18.380] Okay. [01:39:18.380 --> 01:39:19.380] Good. [01:39:19.380 --> 01:39:25.380] I said, well, you said that there's no merit to, no merit to, meritable argument. [01:39:25.380 --> 01:39:28.380] And I started reading the case file. [01:39:28.380 --> 01:39:36.380] And in the case file, you said that I stated that I was working for my brother. [01:39:36.380 --> 01:39:42.380] Where did I testify that I said that? [01:39:42.380 --> 01:39:46.380] Where is there a witness to testify that I said that? [01:39:46.380 --> 01:39:48.380] Where are you getting that from? [01:39:48.380 --> 01:39:50.380] She goes through the flipping throughs. [01:39:50.380 --> 01:39:54.380] She's like, well, I saw it somewhere. [01:39:54.380 --> 01:39:55.380] Let me see. [01:39:55.380 --> 01:39:57.380] She starts flipping through paperwork. [01:39:57.380 --> 01:40:03.380] I think I saw it in the, in the transcript where the officer said, the officer said, [01:40:03.380 --> 01:40:04.380] oh, okay. [01:40:04.380 --> 01:40:09.380] The officer said, was there a eyewitness testimony? [01:40:09.380 --> 01:40:13.380] Was there a written testament? [01:40:13.380 --> 01:40:18.380] Was there a video of me testifying and saying that? [01:40:18.380 --> 01:40:19.380] No. [01:40:19.380 --> 01:40:28.380] But you just used that information in your brief, in your address in the court. [01:40:28.380 --> 01:40:31.380] She was just quiet. [01:40:31.380 --> 01:40:34.380] Like, well, I said, okay. [01:40:34.380 --> 01:40:46.380] Well, in that case, if there's no one to verify that information, has the court met its burden to meet the [01:40:46.380 --> 01:40:50.380] corpus delicti, has corpus delicti been met? [01:40:50.380 --> 01:40:59.380] And she's like, I have to look at that. [01:40:59.380 --> 01:41:00.380] You have to look at that. [01:41:00.380 --> 01:41:02.380] But there's no marital issue. [01:41:02.380 --> 01:41:04.380] I said, okay. [01:41:04.380 --> 01:41:09.380] I said, now, the officer, he arrested me for a felony. [01:41:09.380 --> 01:41:11.380] Isn't that correct? [01:41:11.380 --> 01:41:17.380] Yeah, I think, okay, yeah, he arrested me for a felony. [01:41:17.380 --> 01:41:19.380] Was I being charged for a felony? [01:41:19.380 --> 01:41:20.380] No. [01:41:20.380 --> 01:41:21.380] Would I have been going to trial for a felony? [01:41:21.380 --> 01:41:22.380] No. [01:41:22.380 --> 01:41:23.380] That's okay. [01:41:23.380 --> 01:41:25.380] Well, how did that happen? [01:41:25.380 --> 01:41:34.380] Because I know during trial, I made the judge address how adjudication works and adjudication of [01:41:34.380 --> 01:41:35.380] guilty work. [01:41:35.380 --> 01:41:46.380] So tell me, how did the officer get to arresting me for a felony for cases that are currently [01:41:46.380 --> 01:41:48.380] pending in court? [01:41:48.380 --> 01:41:55.380] Which one of them has already been dismissed because I sued the officer, the judge, the [01:41:55.380 --> 01:42:05.380] prosecutor, and the state attorney, and the state attorney general. [01:42:05.380 --> 01:42:07.380] And that case has been dismissed. [01:42:07.380 --> 01:42:09.380] And this other case is about to be pending. [01:42:09.380 --> 01:42:11.380] It's going to be dismissed also. [01:42:11.380 --> 01:42:22.380] So how did this officer get to use two cases that are nonexistent to charge me for a felony [01:42:22.380 --> 01:42:24.380] and bring me to jail? [01:42:24.380 --> 01:42:25.380] Well, I had to pay for bonds. [01:42:25.380 --> 01:42:31.380] And you're telling me that there's no marital arguments. [01:42:31.380 --> 01:42:41.380] She's sitting there like, I said, no. [01:42:41.380 --> 01:42:46.380] She said, well, he saw the, I said, she was trying to explain the same time I was talking. [01:42:46.380 --> 01:42:51.380] She was like, well, he saw the other two and, you know, he just saw it. [01:42:51.380 --> 01:42:52.380] I said, yeah, exactly. [01:42:52.380 --> 01:42:54.380] I'm agreeing with you. [01:42:54.380 --> 01:42:58.380] That's exactly why his voice of vagueness. [01:42:58.380 --> 01:43:06.380] But you filed an Anderson brief stating that there is no marital issues in the case. [01:43:06.380 --> 01:43:12.380] I said, okay, now the next issue. [01:43:12.380 --> 01:43:18.380] I said, the next issue, what's the next issue on this thing? [01:43:18.380 --> 01:43:28.380] I asked her, I said, my license was suspended for fines and fees. [01:43:28.380 --> 01:43:40.380] I said, when was their determination hearing to know, to tell me, to have to determine if they can suspend my license or not? [01:43:40.380 --> 01:43:45.380] And she was, she was, we're coming on a commercial break. [01:43:45.380 --> 01:43:48.380] Okay. I was just, I was just going to say that. [01:43:48.380 --> 01:43:50.380] Okay. Hang on. [01:43:50.380 --> 01:43:52.380] Randy Kelton, Brett Fountainer. [01:43:52.380 --> 01:43:54.380] You were going to let him go over the clip. We'll go back to Penny in Texas here. [01:46:51.380 --> 01:46:54.380] Alright, Olivier, continue on there. [01:46:54.380 --> 01:47:02.380] Okay, so now I asked her, where was the determination hearing for the indigency? [01:47:02.380 --> 01:47:10.380] And she was like, uh, determination hearing. I was like, yeah, because there needs to be a determination hearing when a right is being suspended. [01:47:10.380 --> 01:47:19.380] She was like, uh, that's the due process. I said, yeah, that is. I said, yeah, but that's not what I'm talking about. [01:47:19.380 --> 01:47:31.380] Due process is involved, but what I'm talking about is the determination hearing to determine if the person is indigent or if they're willfully not paying the fee. [01:47:31.380 --> 01:47:41.380] And she was like, uh, well, I said, exactly, it's not there, but you filed an Anderson breach stating that there's no marital issues. [01:47:41.380 --> 01:47:56.380] So she was like, well, you can file a brief. I'm like, I will file a brief, but now tell me how is an officer able to arrest me on the charge and bring me to jail? [01:47:56.380 --> 01:48:05.380] And then when you go to jail for spending license, how long does it usually take an individual to get out of jail and be processed? Six months? [01:48:05.380 --> 01:48:21.380] I said, six months. What happened in six months? In six months, they're losing their car, their family, their whole family is being destabilized. [01:48:21.380 --> 01:48:40.380] And, and because of a, because of a process where, because of a process where your language that the courts, the courts are written is coded that a normal individual can't figure it out to, to address this in court. [01:48:40.380 --> 01:48:55.380] And now you took in liberty to write, uh, that I said that I was driving from, I was working for my brother to, to dilute the, um, issue that I'm bringing to the table. [01:48:55.380 --> 01:49:05.380] That one, that this is a commercial issue. This is a commercial act. The two, there's a difference between someone who's working for hire and someone who's not working for hire. [01:49:05.380 --> 01:49:18.380] We have a right to use the road. Now that I'm just in this, this issue, you, you write wrote, uh, uh, Anderson Brees stating that there ain't no marital issues. [01:49:18.380 --> 01:49:30.380] I said, and, and as I'm, as I'm stating that she, she busts out with, oh my God, they've been doing this wrong. They've been doing this wrong. [01:49:30.380 --> 01:49:42.380] I said, so once I, once I heard her whisper that out, like, you know, like, like realize, like a realization, like she's like, oh my God, this has been wrong. [01:49:42.380 --> 01:49:48.380] I'm like, so I figured I was like, okay, I'm going to stop battering her because she's been waiting for me, like to start cursing. [01:49:48.380 --> 01:50:01.380] And then because it sounds, I was speaking, I was speaking very aggressive, but not, uh, I wasn't cursing or anything, but I was very fresh about it, very aggressive about it. [01:50:01.380 --> 01:50:10.380] So she was like, oh my God. I like, so I think, so once I realized she's in queue, I'm like, okay. I said, so, well, we're going to take care of this right now. [01:50:10.380 --> 01:50:21.380] What we're going to do is, uh, she, she said, well, uh, you could file a brief and then I said, uh, then they'll, um, they won't do procedure. [01:50:21.380 --> 01:50:28.380] Uh, they won't hold procedure against you. I said, you say that I want, I want to believe that. [01:50:28.380 --> 01:50:31.380] I said, I want to believe that, but we all know that's not how it is. [01:50:31.380 --> 01:50:43.380] Cause I've read plenty of cases where, um, that is not the issue. And you, and you said that there's no matterable, there's no matterable arguments. [01:50:43.380 --> 01:50:54.380] And you agreed with every issue that I've mentioned so far. I haven't even mentioned the right to livelihood. I haven't even, are you familiar with that? [01:50:54.380 --> 01:51:03.380] She says, the right to livelihood, they created a license. Once they create the license, that attaches to automatic rights. [01:51:03.380 --> 01:51:08.380] It doesn't matter if we're using that license for personal or profit. [01:51:08.380 --> 01:51:14.380] That means that, that means that determination hearing is mandatory. [01:51:14.380 --> 01:51:25.380] And in, in this, in this document, the court is saying that there is no determination hearing requirement. [01:51:25.380 --> 01:51:33.380] I said, so now, well, what, what I'm going to do is I'm going to write and bring, give you the information that I have. [01:51:33.380 --> 01:51:38.380] Write up the issues. I said, I said, wait, I said, are you still my attorney? [01:51:38.380 --> 01:51:45.380] She said, well, Mr. Lizzie, uh, the court hasn't really, yeah. Um, I said, great. [01:51:45.380 --> 01:51:51.380] What I'm going to do is I'm going to send you this information and allow you to review this information. [01:51:51.380 --> 01:51:58.380] And you're going to show me how to properly file a, um, answer. [01:51:58.380 --> 01:52:05.380] And she said, what else did, I said, no, it doesn't work like that. I'm going to be in your courtroom a lot. [01:52:05.380 --> 01:52:13.380] So I'm going to need you to show me all the procedural and everything that I need to know and understand to correct these issues. [01:52:13.380 --> 01:52:23.380] Because I, I understand, I have a clear understanding that the people, there's a disconnection because from the people's education and understanding and application in the court. [01:52:23.380 --> 01:52:27.380] And we're going to take care of that right now. [01:52:27.380 --> 01:52:32.380] She said, well, here's my email address. I said, thank you. [01:52:32.380 --> 01:52:37.380] I sent her the email, she sent me the email address and I told her, I'm going to call you. [01:52:37.380 --> 01:52:40.380] I'm going to contact you back in three days. [01:52:40.380 --> 01:52:53.380] And then, uh, we're going to go from the scheduled meeting so you can come and educate me on how these procedures work. [01:52:53.380 --> 01:52:57.380] So how old is this lawyer? [01:52:57.380 --> 01:53:02.380] I don't know how old is she? She, she, she's a, I never, she never talked to her. I never caught, she never called me. [01:53:02.380 --> 01:53:05.380] I never talked to her nothing. You never talked to me. [01:53:05.380 --> 01:53:09.380] You already filed an annus debris saying that there's no marital issues. [01:53:09.380 --> 01:53:17.380] And then, and then during the conversation, I said, there's no marital issues. I made constitutional arguments. [01:53:17.380 --> 01:53:24.380] How are you going to file a paperwork saying that there's no marital issues when constitutional argument has to be reviewed? [01:53:24.380 --> 01:53:33.380] You could say that a constitution, a statute is unlawful, but what's your reasoning? There's many reasonings. [01:53:33.380 --> 01:53:39.380] You didn't even talk to me to try to understand the reasoning. [01:53:39.380 --> 01:53:43.380] But you filed an annus debris saying that there's no marital issues. [01:53:43.380 --> 01:53:53.380] And then on the first page, the way, when you start to read the document, the way that the person who types the document, the court case, [01:53:53.380 --> 01:54:01.380] the first page, the first two pages is devastating. It's so devastating. It's, it's embarrassing. [01:54:01.380 --> 01:54:10.380] I don't even have to write a response. If the way that when I call tomorrow night and read the way that the first two pages read, [01:54:10.380 --> 01:54:19.380] everything is, I'm like, well, it's not like this. It is. It is. The first two pages. [01:54:19.380 --> 01:54:24.380] Everything, the way that they wrote it up is beautiful. Then the response that I have now, [01:54:24.380 --> 01:54:32.380] it shows where the United Supreme Court says that the determination hearing is a must. [01:54:32.380 --> 01:54:38.380] And now I've got paperwork from the lower court saying that there is no requirement for determination hearing. [01:54:38.380 --> 01:54:44.380] Why? There's going to be some conflict. [01:54:44.380 --> 01:54:51.380] This should get very interesting. This is what happens when you do your homework. [01:54:51.380 --> 01:55:01.380] I first encountered Olivier. I keep calling him Olivier, but he's actually Mordiche. His last name's Olivier. [01:55:01.380 --> 01:55:10.380] I first encountered him on my show. And then I went to Tennessee to take care of my 98-year-old mom. [01:55:10.380 --> 01:55:15.380] And he was in Clarksville, which was about, what, 90 miles away. [01:55:15.380 --> 01:55:24.380] And Olivier contacted me and asked me what to do. And I told him what I do most people. I said, well, get this and read it. [01:55:24.380 --> 01:55:28.380] And yeah, he did that. [01:55:28.380 --> 01:55:33.380] And the first time I saw him was in Clarksville. [01:55:33.380 --> 01:55:46.380] He walked into the court and he looked like your typical Negro, threadlocks, T-shirt. [01:55:46.380 --> 01:55:56.380] Walked into the court, walked up to the podium, opened his mouth, and everybody in the room's mouth dropped open. [01:55:56.380 --> 01:56:02.380] Was this articulated legal arguments coming out of this guy? [01:56:02.380 --> 01:56:11.380] If anybody ever was a sleeper, Olivier is that sleeper. They don't see it coming. [01:56:11.380 --> 01:56:17.380] And he's been calling me for advice and assistance all this time. [01:56:17.380 --> 01:56:26.380] And I'm beginning to feel like I'm the one that now needs to begin to call him for assistance. [01:56:26.380 --> 01:56:29.380] Olivier, how hard is this? [01:56:29.380 --> 01:56:39.380] Now, all these people out here that are frustrated with him coming after him, I mean, who has more against him than you do? [01:56:39.380 --> 01:56:45.380] I'm a white guy. They don't mess with white guys near as much as you do with black guys. [01:56:45.380 --> 01:56:53.380] And you are kicking their behinds. How hard was this for you? [01:56:53.380 --> 01:56:57.380] How hard was it? [01:56:57.380 --> 01:57:07.380] Very hard, but compared to what was at stake, it was easy. [01:57:07.380 --> 01:57:12.380] I mean, it's about time for me to start having children. [01:57:12.380 --> 01:57:17.380] It's about time for, you know what I'm saying, that aspect of my life. [01:57:17.380 --> 01:57:24.380] And I did not, I don't want to leave something unattended to for my kids. [01:57:24.380 --> 01:57:27.380] There we go. [01:57:27.380 --> 01:57:33.380] You know, so I was like, you know what, I'll go through 10 years in prison right quick. [01:57:33.380 --> 01:57:42.380] Even though I'm 38 or 33, I'm still healthy. I'll work out, you know what I'm saying, not miss out on the part. [01:57:42.380 --> 01:57:50.380] So when I leave this planet, I know that I didn't leave the faucet running for my kids. [01:57:50.380 --> 01:57:55.380] That's what it takes. And that's all it takes. You don't have to be smarter. [01:57:55.380 --> 01:58:03.380] You don't have to be more fluent. You just have to have some determination. [01:58:03.380 --> 01:58:07.380] This guy called me and asked me what to do and actually did it. [01:58:07.380 --> 01:58:11.380] And now he's at the point where I need to ask him what to do. [01:58:11.380 --> 01:58:15.380] This is why we do this show. [01:58:15.380 --> 01:58:20.380] If we could get an Olivier in every county in the state of Texas, [01:58:20.380 --> 01:58:28.380] the problems we're having with the legal system would simply go away. [01:58:28.380 --> 01:58:35.380] And I suspect you're going to have a dramatic impact on Florida. [01:58:35.380 --> 01:58:37.380] OK, we are out of time. [01:58:37.380 --> 01:58:42.380] Olivier, you got to call back tomorrow and Penny, if you're caught in tomorrow, we'll take you first.
