[00:00.000 --> 00:05.500] The Bill of Rights contains the first ten amendments of our Constitution. [00:05.500 --> 00:09.500] They guarantee the specific freedoms Americans should know and protect. [00:09.500 --> 00:11.000] Our liberty depends on it. [00:11.000 --> 00:16.500] I'm Dr. Catherine Albrecht, and I'll be right back with an unforgettable way to remember your First Amendment rights. [00:16.500 --> 00:18.500] Privacy is under attack. [00:18.500 --> 00:22.000] When you give up data about yourself, you'll never get it back again. [00:22.000 --> 00:26.500] And once your privacy is gone, you'll find your freedoms will start to vanish too. [00:26.500 --> 00:32.000] So protect your rights, say no to surveillance, and keep your information to yourself. [00:32.000 --> 00:34.500] Privacy, it's worth hanging on to. [00:34.500 --> 00:38.000] This public service announcement is brought to you by StartPage.com, [00:38.000 --> 00:42.000] the private search engine alternative to Google, Yahoo, and Bing. [00:42.000 --> 00:45.500] Start over with StartPage. [00:45.500 --> 00:47.500] Spar, it's what fighters do. [00:47.500 --> 00:51.000] It's also how I remember the five guarantees of the First Amendment. [00:51.000 --> 00:54.000] If you plan to take away my rights, I'm going to spar with you. [00:54.000 --> 00:56.500] Spar with an extra P. [00:56.500 --> 01:03.000] S for speech, P for press, another P for petition, A for assembly, and R for religion. [01:03.000 --> 01:08.500] Most Americans are familiar with the First Amendment guarantees of free speech, press, assembly, and religion. [01:08.500 --> 01:10.500] But petition for redress is another matter. [01:10.500 --> 01:14.500] We have the right to petition the government for a redress of grievances. [01:14.500 --> 01:17.500] It means that if we're unhappy with what's going on in our government, [01:17.500 --> 01:21.000] we can spell out the reasons without fear of being thrown into jail. [01:21.000 --> 01:22.500] I'm Dr. Catherine Albrecht. [01:22.500 --> 01:30.500] More news and information at CatherineAlbrecht.com. [01:30.500 --> 01:34.500] The Bill of Rights contains the first ten amendments of our Constitution. [01:34.500 --> 01:38.000] They guarantee a specific freedom Americans should know and protect. [01:38.000 --> 01:39.500] Our liberty depends on it. [01:39.500 --> 01:46.000] I'm Dr. Catherine Albrecht, and I'll be right back with an unforgettable way to remember one of your constitutional rights. [01:46.000 --> 01:48.000] Privacy is under attack. [01:48.000 --> 01:51.500] When you give up data about yourself, you'll never get it back again. [01:51.500 --> 01:56.500] And once your privacy is gone, you'll find your freedoms will start to vanish too. [01:56.500 --> 02:01.500] So protect your rights, say no to surveillance, and keep your information to yourself. [02:01.500 --> 02:04.000] Privacy, it's worth hanging on to. [02:11.500 --> 02:15.500] Start over with StartPage. [02:15.500 --> 02:19.500] When I think of the Second Amendment, I visualize myself wrapping my two arms [02:19.500 --> 02:22.000] around the Bill of Rights in a big old bear hug. [02:22.000 --> 02:26.000] It's how I remember that the Second Amendment guarantees us the right to bear arms, [02:26.000 --> 02:30.000] arms that embrace our freedoms and won't let anyone take them away without a fight. [02:30.000 --> 02:33.500] Get it? Two arms, bear hug, bear arms? [02:33.500 --> 02:38.500] The late Senator Hubert Humphrey captured the spirit of the Second Amendment so well when he said, [02:38.500 --> 02:43.500] the right of the citizens to bear arms is just one guarantee against arbitrary government, [02:43.500 --> 02:47.500] one more safeguard against the tyranny which now appears remote in America, [02:47.500 --> 02:50.500] but which historically has proved to always be possible. [02:50.500 --> 03:18.500] I'm Dr. Catherine Albrecht. More news and information at CatherineAlbrecht.com. [03:20.500 --> 03:26.500] Whatcha gonna do? Whatcha gonna do? [03:26.500 --> 03:29.500] Bad boys, bad boys, whatcha gonna do? [03:29.500 --> 03:32.500] Whatcha gonna do when they come for you? [03:32.500 --> 03:35.500] Bad boys, bad boys, whatcha gonna do? [03:35.500 --> 03:38.500] Whatcha gonna do when they come for you? [03:38.500 --> 03:43.500] When you were eight and you had bad traits, you'd go to school and learn the golden rules. [03:43.500 --> 03:46.500] So why are you acting like a bloody fool? [03:46.500 --> 03:52.500] And if you get high and you must get cool, bad boys, bad boys, whatcha gonna do? [03:52.500 --> 03:54.500] Whatcha gonna do when they come for you? [03:54.500 --> 03:57.500] Bad boys, bad boys, whatcha gonna do? [03:57.500 --> 04:00.500] Whatcha gonna do when they come for you? [04:00.500 --> 04:03.500] You chuck it on this one, you chuck it on that one, [04:03.500 --> 04:05.500] you chuck it on your mother, and you chuck it on your father. [04:05.500 --> 04:08.500] You chuck it on your brother, and you chuck it on your sister. [04:08.500 --> 04:11.500] You chuck it on that one and you chuck it on me! [04:11.500 --> 04:18.500] Bad boys, bad boys, whatcha gonna do? Whatcha gonna do when they come for you? [04:21.520 --> 04:28.420] Bad boys, bad boys, whatcha gonna do? Whatcha gonna do when they come for you? [04:28.420 --> 04:33.180] Bad boys, bad boys, whatcha gonna do? Whatcha gonna do when they come for you? [04:33.180 --> 04:37.880] Nobody know getting no break, police know getting no break [04:37.880 --> 04:40.680] Not your own soldier, man, I give you no pain [04:40.680 --> 04:43.280] Not keeping you out, you're not giving you no breaks [04:43.280 --> 04:45.480] Hey, hey, bad boy, bad boy [04:45.480 --> 04:47.680] I'll watch it on the news, I'll watch it on the news [04:47.680 --> 04:49.880] Okay, howdy, howdy [04:49.880 --> 04:52.880] Randy Kelton, Brett Fountain, Real Barrio [04:52.880 --> 04:58.680] On this, the sixth day of May, 2022 [04:58.680 --> 05:02.080] Our five, four-hour info marathon [05:02.080 --> 05:06.080] I was trying to lengthen it out there a little bit, Brett [05:06.080 --> 05:09.280] Actually, we haven't went into overtime in a very long time [05:09.280 --> 05:11.880] Maybe it's a good day to do it [05:11.880 --> 05:13.680] Okay, I'm going to start out [05:13.680 --> 05:19.280] I did a, I was called to do a presentation at a meeting [05:19.280 --> 05:24.080] And George P. Bush was going to be there to speak [05:24.080 --> 05:31.880] And Mark Grouse, the, he's running for a [05:31.880 --> 05:37.680] Tarrant County District Attorney, he is a state rep at the moment [05:37.680 --> 05:40.480] And he's running for District Attorney, they were both there [05:40.480 --> 05:44.880] And I got the opportunity to speak to them [05:44.880 --> 05:52.680] George P. Bush, this is Jeb Bush's son, the ex-Governor of Florida [05:52.680 --> 05:58.280] He is, Jeb Bush married a Mexican woman, so [05:58.280 --> 06:00.880] George P. is half Mexican [06:00.880 --> 06:03.880] And so he's here running for Attorney General [06:03.880 --> 06:05.480] I'm sure they're grooming him [06:05.480 --> 06:12.880] And it is my opinion, based on what I see happening [06:12.880 --> 06:16.680] Our current Attorney General has some felony charges against him [06:16.680 --> 06:22.480] For stock fraud or securities fraud of some sort [06:22.480 --> 06:26.680] And he also has a whistle-blower complaint [06:26.680 --> 06:32.680] Against him, accusing him of several things [06:32.680 --> 06:40.480] One of them is bribery and I think sexual harassment [06:40.480 --> 06:44.080] I'm not sure about that, but a couple of things [06:44.080 --> 06:51.680] And the current Attorney General is not really defending himself [06:51.680 --> 07:02.480] He's not doing much at all in the way of trying to get himself re-elected [07:02.480 --> 07:10.880] He's not attending any of the dates [07:10.880 --> 07:14.480] He's just kind of staying in the background [07:14.480 --> 07:20.080] And I'm thinking that the picture's already in [07:20.080 --> 07:25.480] They're grooming George P. Bush for higher office [07:25.480 --> 07:28.480] And he's just building his background now [07:28.480 --> 07:35.080] He was the Land Commissioner and now he's going for Attorney General [07:35.080 --> 07:38.880] So he's just building a resume [07:38.880 --> 07:42.280] And I suspect that the fix is already in [07:42.280 --> 07:47.080] That he's going to be the next Governor, I'm sorry, the next Attorney General [07:47.080 --> 07:50.080] What do you mean, the fix? [07:50.080 --> 07:54.680] Well, it takes me back to Tom DeLay [07:54.680 --> 08:01.480] I filed a writ of habeas corpus in Tom DeLay's, in the Tom DeLay case [08:01.480 --> 08:06.080] Because no one had ever filed a criminal complaint against Tom DeLay [08:06.080 --> 08:10.280] They're prosecuting him and he has no accuser [08:10.280 --> 08:15.480] I went to the courtroom, I sent a copy, I filed a copy in the record [08:15.480 --> 08:18.280] I sent one to his attorney, Dick DeGaron [08:18.280 --> 08:26.480] Dick DeGaron is the guy who represented the Branch Davidians in Waco and lost [08:26.480 --> 08:29.880] Everything I looked at with Dick DeGaron, he lost [08:29.880 --> 08:35.080] So he's representing Tom DeLay and I filed a habeas [08:35.080 --> 08:37.880] And he called me and asked if I was the one to file the habeas [08:37.880 --> 08:38.880] I said, yes, I am [08:38.880 --> 08:41.880] He said, well, I'm the lead attorney and I didn't authorize it [08:41.880 --> 08:43.080] He said, authorize it? [08:43.080 --> 08:45.280] Heck, you should have filed it [08:45.280 --> 08:47.080] He hung up on me [08:47.080 --> 08:52.280] So when they started the trial, they came in in the morning [08:52.280 --> 09:01.480] And I went up to the bar and put a copy of my habeas in Tom DeLay's hand [09:01.480 --> 09:05.280] And he looked at me and he looked terrified [09:05.280 --> 09:06.680] Oh boy [09:06.680 --> 09:11.280] And I thought, what in the heck is going on? [09:11.280 --> 09:14.280] Then they picked a jury and went out for lunch and come back [09:14.280 --> 09:19.080] And Judge Dietz was talking to the jury and I stood up in the courtroom and said [09:19.080 --> 09:20.480] Your honor, my name is Randall Kelton [09:20.480 --> 09:21.880] I have business with this court [09:21.880 --> 09:24.880] It supersedes any business now before the court [09:24.880 --> 09:26.280] You're the one that filed the habeas [09:26.280 --> 09:28.280] Yes, as a matter of fact, I am [09:28.280 --> 09:32.080] They had me thrown out of the courtroom [09:32.080 --> 09:35.880] Well, they prosecuted him, found him guilty [09:35.880 --> 09:43.080] And he spent two years in jail awaiting an appeal [09:43.080 --> 09:49.080] Now, this was the Speaker of the House of Representatives of the United States [09:49.080 --> 09:52.880] One of the highest level public officials in the country [09:52.880 --> 09:56.880] And he spent two years in jail awaiting appeal [09:56.880 --> 09:59.280] With no accuser [09:59.280 --> 10:02.080] With no accuser and no bail [10:02.080 --> 10:04.680] What in the world kind of deal was going on? [10:04.680 --> 10:10.280] Then the court of appeals threw out the conviction [10:10.280 --> 10:13.480] For lack of evidence [10:13.480 --> 10:19.680] So why did he spend two years in jail without bail? [10:19.680 --> 10:23.280] And why did your habeas go unanswered? [10:23.280 --> 10:27.280] Because the fix was in [10:27.280 --> 10:35.280] He had agreed to this to keep them from prosecuting him for something much worse [10:35.280 --> 10:39.080] That they didn't want us to know about [10:39.080 --> 10:40.280] Fix was in [10:40.280 --> 10:43.280] I think I'm certain fix is in here [10:43.280 --> 10:48.280] And George P. Bush is going to be our next attorney general [10:48.280 --> 10:54.280] So, I tried to lay a plant [10:54.280 --> 11:05.880] I told him that we may, that because of 16.17 Texas Code of Criminal Procedure [11:05.880 --> 11:09.680] I'm sorry, that's not him, that was the prosecutor [11:09.680 --> 11:14.480] That the Texas is the worst police state the world's ever seen [11:14.480 --> 11:19.280] And I gave him the standard statistics [11:19.280 --> 11:26.680] China incarcerates approximately 126 people per 100,000 [11:26.680 --> 11:31.080] Russia, 357 [11:31.080 --> 11:36.280] United States, 650 per 100,000 [11:36.280 --> 11:41.680] Texas, 750 [11:41.680 --> 11:44.480] By far the worst police state the world's ever seen [11:44.480 --> 11:49.480] Except for Louisiana and maybe Oklahoma [11:49.480 --> 11:53.880] They're a little bit higher, but Louisiana, that's a whole different country [11:53.880 --> 11:56.880] They don't really count, that's something different [11:56.880 --> 11:58.280] Look, we [11:58.280 --> 12:00.680] They don't even have counties over there [12:00.680 --> 12:03.080] They have parishes [12:03.080 --> 12:13.880] We had, we incarcerate approximately six times the amount of per capita as communist China [12:13.880 --> 12:17.280] What's with that? [12:17.280 --> 12:19.880] We ought to be ashamed of ourselves [12:19.880 --> 12:26.680] And I indicated to him that if he issued an attorney general opinion [12:26.680 --> 12:30.480] That said that when a policeman arrests someone for any reason [12:30.480 --> 12:32.880] Before they take them to jail [12:32.880 --> 12:36.680] If they're required to contact a magistrate and hold an examining trial [12:36.680 --> 12:40.880] And get permission from the magistrate to take them to jail [12:40.880 --> 12:45.080] That that will disrupt this process that's going on [12:45.080 --> 12:47.880] That's caused this mass incarceration [12:47.880 --> 12:55.480] And can save the public millions, hundreds of millions every year [12:55.480 --> 12:58.880] I hope I got his attention [12:58.880 --> 13:02.480] And then I will send, I'll be sending him the [13:02.480 --> 13:06.680] All of my briefing papers on that subject [13:06.680 --> 13:09.480] And hope that if he does get in [13:09.480 --> 13:16.280] Then I will be filing criminal charges against prosecuting attorneys [13:16.280 --> 13:20.080] And causing all kinds of grief and mayhem [13:20.080 --> 13:28.280] And I'll set up a situation to get a public official to request an opinion [13:28.280 --> 13:33.080] Concerning the duty to take before a magistrate [13:33.080 --> 13:37.080] It's already been addressed in attorney general opinion H500 [13:37.080 --> 13:47.080] I'm going to want him to issue an attorney general opinion following H500 [13:47.080 --> 13:55.880] And so that every policeman is ordered to contact a magistrate before they take someone to jail [13:55.880 --> 14:02.480] This will disrupt the process put in place by prosecutors [14:02.480 --> 14:06.080] That create a situation where everyone accused of crime [14:06.080 --> 14:12.480] Is put in a position so they have no reasonable option other than to make a deal [14:12.480 --> 14:17.680] Well how would that be different than what's already in hard law [14:17.680 --> 14:19.280] It's already there in black and white [14:19.280 --> 14:21.480] Why would this order be any different? [14:21.480 --> 14:22.680] Oh it's no different [14:22.680 --> 14:26.480] It's just, it's not an order from the attorney general [14:26.480 --> 14:27.880] It's a brief [14:27.880 --> 14:31.080] Attorney general opinions are briefs [14:31.080 --> 14:36.080] I was in front of Judge Shipman in Denton County [14:36.080 --> 14:38.880] And I was kind of working him over [14:38.880 --> 14:43.880] And about taking before a magistrate [14:43.880 --> 14:48.080] And I referenced attorney general opinion H500 [14:48.080 --> 14:53.880] That said that any magistrate can hear any complaint felony or misdemeanor state or federal [14:53.880 --> 14:56.880] From anywhere in the state of Texas [14:56.880 --> 14:58.680] And he said Mr. Kelton [14:58.680 --> 15:00.880] As far as this court is concerned [15:00.880 --> 15:06.480] You can use an attorney general's opinion as toilet paper [15:06.480 --> 15:08.880] I said well your honor [15:08.880 --> 15:17.280] I hope you don't find the underlying story decisive quite so versatile [15:17.280 --> 15:21.280] An attorney general's opinion is a legal brief [15:21.280 --> 15:24.080] Issued by the state [15:24.080 --> 15:29.280] And I want the next attorney general to issue a legal brief [15:29.280 --> 15:33.680] That concurs with attorney general opinion H500 [15:33.680 --> 15:36.680] And states that any time a person arrested [15:36.680 --> 15:39.680] For any reason felony or misdemeanor state or federal [15:39.680 --> 15:41.280] From anywhere in the state of Texas [15:41.280 --> 15:46.480] They are to be taken directly to the nearest magistrate [15:46.480 --> 15:50.680] Either in person or electronically [15:50.680 --> 15:55.080] That it's in the law that they can hold this hearing electronically [15:55.080 --> 15:57.880] So if a policeman arrests someone [15:57.880 --> 16:00.080] He takes him to jail [16:00.080 --> 16:02.680] Call the magistrate [16:02.680 --> 16:06.880] The magistrate can do an examining trial over the phone [16:06.880 --> 16:11.080] And give that officer permission to take him to the jail [16:11.080 --> 16:13.080] Or he can tell him no [16:13.080 --> 16:16.680] You got a 16 year old girl here who's been out at a party [16:16.680 --> 16:18.080] She drank a little too much [16:18.080 --> 16:19.880] She's a little intoxicated [16:19.880 --> 16:23.680] Do not take her and throw her in no drug take [16:23.680 --> 16:25.680] You take her home [16:25.680 --> 16:28.680] And we'll address this tomorrow [16:28.680 --> 16:32.080] Get back to reasonable law enforcement [16:32.080 --> 16:35.880] And with as much pressure as the police are under right now [16:35.880 --> 16:40.080] I think they would be absolutely relieved [16:40.080 --> 16:41.480] To be able to do that [16:41.480 --> 16:44.080] And not have to throw everybody to jail [16:44.080 --> 16:45.280] Yeah [16:45.280 --> 16:46.680] When you find a good cop [16:46.680 --> 16:48.480] He wants to do the right thing [16:48.480 --> [21:25.280 --> 21:29.280] Okay, howdy, howdy, Randy Kelton, Brett Doughton, You Need Love Radio [21:29.280 --> 21:33.280] We're having a little technical issue here [21:33.280 --> 21:37.280] I hope it doesn't get any worse, I think we may have it covered [21:37.280 --> 21:44.280] I did turn the phones on, call in number 512-646-1984 [21:44.280 --> 21:51.280] And we have a call from Elise in Arizona, hello Elise [21:51.280 --> 21:55.280] What fur are you calling us today? [21:55.280 --> 21:59.280] I couldn't help myself [21:59.280 --> 22:05.280] Very cute, I didn't realize that you knew it was me, I guess because you saw my number [22:05.280 --> 22:14.280] Well, we have a database and once you've called in one time, we put you in the database and then I can see who you are [22:14.280 --> 22:17.280] Fancy schmancy [22:17.280 --> 22:24.280] Yeah, the first time someone calls in, it just shows the phone number and so we don't necessarily want to tell that to everybody [22:24.280 --> 22:28.280] So we just say the area code and say, hey, give us our first name and estate [22:28.280 --> 22:34.280] After that, we type that in and then we'll be able to just see the name that you gave us [22:34.280 --> 22:37.280] Yeah, I know who you are [22:37.280 --> 22:42.280] You don't know who I am, but I know where you live [22:42.280 --> 22:43.280] Uh oh [22:43.280 --> 22:46.280] Okay, what do you have for us today? [22:46.280 --> 22:51.280] Well, my heart is beating out of my chest again [22:51.280 --> 22:58.280] First of all, thank you for taking that 16-year-old girl home instead of to jail, right? I heard you [22:58.280 --> 23:01.280] That's lovely, decent [23:01.280 --> 23:05.280] We didn't do that, but that's what I want done [23:05.280 --> 23:10.280] And what I want to do is give the policeman the option of doing that [23:10.280 --> 23:14.280] They don't have that option now [23:14.280 --> 23:15.280] Yeah, that's lovely [23:15.280 --> 23:25.280] I know a lot of policemen and I don't know a single one who became a policeman so he could be a jackbooty thug [23:25.280 --> 23:28.280] They all want to be the good guys [23:28.280 --> 23:36.280] Now they're being demonized everywhere. They've been trained in militaristic procedures [23:36.280 --> 23:45.280] I'm watching these policemen use the kind of tactics we were trained to use in combat in an occupied country [23:45.280 --> 23:48.280] And this is not an occupied country [23:48.280 --> 23:53.280] And most of the policemen I know do not like those tactics [23:53.280 --> 24:03.280] They want to be good guys, so let's see if we can't give them the opportunity to be the good guys they want to be [24:03.280 --> 24:04.280] Thank you [24:04.280 --> 24:08.280] Yeah, that's really, really beautiful and heart-centered [24:08.280 --> 24:11.280] But you know who you are at this point of your life [24:11.280 --> 24:13.280] I'm not telling you anything new about you [24:13.280 --> 24:15.280] So I just want to thank you for all women [24:15.280 --> 24:17.280] Really, I'm very, very serious [24:17.280 --> 24:18.280] Thank you so much [24:18.280 --> 24:22.280] Oh, please call my wife and tell her that [24:22.280 --> 24:29.280] The ringer on her phone for me is a jackass for you [24:29.280 --> 24:32.280] I don't know why she'd do that [24:32.280 --> 24:36.280] Well, maybe I do [24:36.280 --> 24:45.280] But I'm married, us poor guys, we're so mistreated and we feel so sorry for us [24:45.280 --> 24:48.280] But we have to because women won't [24:48.280 --> 24:51.280] But that's okay because we're good at it [24:51.280 --> 24:54.280] Okay, what do you have for us today? [24:54.280 --> 24:58.280] All right, so I don't know if you remember, this is with the dentist [24:58.280 --> 25:01.280] I took her to small claims court, she changed the venue [25:01.280 --> 25:06.280] Her lawyer withdrew, now she has a new lawyer [25:06.280 --> 25:10.280] Have you bar grieved the new lawyer yet? [25:10.280 --> 25:14.280] Oh my goodness, Randy, this lawyer is a top dog [25:14.280 --> 25:16.280] I'm so scared [25:16.280 --> 25:18.280] I don't know why I'm scared [25:18.280 --> 25:22.280] It's probably from my past, it has nothing to do with the current moment [25:22.280 --> 25:27.280] But this lawyer, the company has been around since the 50s [25:27.280 --> 25:29.280] The owner of it is in his 90s [25:29.280 --> 25:32.280] They're all about big brothers and sisters [25:32.280 --> 25:36.280] She is the lawyer as a female [25:36.280 --> 25:42.280] And she, so the question was, at the previous call [25:42.280 --> 25:46.280] You asked me, why would she have a private lawyer? [25:46.280 --> 25:50.280] I didn't tell her insurance company, that's where we left off [25:50.280 --> 25:52.280] Oh, that's right, I remember now [25:52.280 --> 25:54.280] Oh, the dentist [25:54.280 --> 25:59.280] I got it, yes, that part jogged my memory, thank you [25:59.280 --> 26:05.280] And this current lawyer represents national insurance carriers [26:05.280 --> 26:07.280] Major corporations [26:07.280 --> 26:12.280] Oh, that's wonderful, that's perfect [26:12.280 --> 26:15.280] You're always so positive [26:15.280 --> 26:19.280] This lawyer, this lawyer don't care about that dentist [26:19.280 --> 26:23.280] This lawyer cares about how much it's going to cost them [26:23.280 --> 26:29.280] And she can make a deal that throws the dentist under the bus [26:29.280 --> 26:33.280] So long as it saves the insurance company money [26:33.280 --> 26:38.280] And the dentist doesn't have to like it or even agree with it [26:38.280 --> 26:46.280] So this is a private lawyer again, this isn't someone that she got from her insurance company? [26:46.280 --> 26:51.280] No, no, no, if she's representing the insurance company [26:51.280 --> 26:55.280] It's almost certainly the insurance company that hired her [26:55.280 --> 27:02.280] Right, she represents healthcare providers, dentists, nurses [27:02.280 --> 27:04.280] National insurance carriers [27:04.280 --> 27:09.280] So the dentist ultimately probably did tell her insurance company finally [27:09.280 --> 27:12.280] And they chose this law firm, correct? [27:12.280 --> 27:15.280] This is what happens, they're insured [27:15.280 --> 27:22.280] So when they get sued, the insurance company is the one that represents them [27:22.280 --> 27:25.280] And that's a problem for them [27:25.280 --> 27:31.280] Because if you're a professional, you don't want to lose the case [27:31.280 --> 27:35.280] But if you're the insurance company, you don't care [27:35.280 --> 27:39.280] If it's going to cost you more to win the case [27:39.280 --> 27:46.280] Than if you just make a deal, they're going to make a deal [27:46.280 --> 27:50.280] And the dentist doesn't have anything to say about it [27:50.280 --> 27:53.280] So it takes it out of the dentist's control [27:53.280 --> 27:57.280] So all you have to do is annoy the law firm [27:57.280 --> 28:01.280] And give them the opinion that you're really PO'd [28:01.280 --> 28:04.280] And you're going to fight them until hell freezes over [28:04.280 --> 28:08.280] And then they want to come to the table and make a deal [28:08.280 --> 28:15.280] Okay, so that brings me to the next item, the final item [28:15.280 --> 28:22.280] And I do have a hearing, this was before the new lawyer came to play [28:22.280 --> 28:24.280] And that is in a few weeks [28:24.280 --> 28:29.280] My question is, the hearing is about motion [28:29.280 --> 28:33.280] Allegedly, I'm the one who got this hearing scheduled [28:33.280 --> 28:37.280] Because of all my definite statements [28:37.280 --> 28:44.280] My reply to her counterclaim as a scandalous thingamajiggy [28:44.280 --> 28:49.280] I can't think now, oh my God, can you guys hear my heartbeat? [28:49.280 --> 28:56.280] So my question is this, I have a lot of pending items in the queue, in the docket [28:56.280 --> 29:01.280] I just served my amended complaint [29:01.280 --> 29:07.280] Which might bring about a new counterclaim [29:07.280 --> 29:11.280] And I already have a request for production [29:11.280 --> 29:15.280] And I have all sorts of things in the docket [29:15.280 --> 29:20.280] Does that nullify all the work that I've done already, that's the first question [29:20.280 --> 29:23.280] Wait, wait, wait, that [29:23.280 --> 29:26.280] What does that report you? [29:26.280 --> 29:30.280] Does the amending of your complaint, is that what you mean? [29:30.280 --> 29:33.280] That you're wondering if it changes something? [29:33.280 --> 29:38.280] Yes, I'm wondering, oh there's music [29:38.280 --> 29:40.280] Should I keep talking? [29:40.280 --> 29:42.280] That is a good question [29:42.280 --> 29:47.280] It depends on the nature of what you have before the court [29:47.280 --> 29:55.280] Your request for productions and that sort of thing won't be affected by the amended complaint [29:55.280 --> 30:01.280] Only those things that go directly to the claims [30:01.280 --> 30:05.280] It's clear cell phones have changed the way we live and work [30:05.280 --> 30:08.280] But have they negatively affected our health? [30:08.280 --> 30:15.280] I'll be back in just a moment with new findings about how cell phones may actually alter our brain chemistry [30:15.280 --> 30:17.280] Privacy is under attack [30:17.280 --> 30:20.280] When you give up data about yourself, you'll never get it back again [30:20.280 --> 30:25.280] And once your privacy is gone, you'll find your freedoms will start to vanish too [30:25.280 --> 30:30.280] So protect your rights, say no to surveillance and keep your information to yourself [30:30.280 --> 30:33.280] Privacy, it's worth hanging on to [30:33.280 --> 30:36.280] This public service announcement is brought to you by startpage.com [30:36.280 --> 30:40.280] The private search engine alternative to Google, Yahoo and Bing [30:40.280 --> 30:44.280] Start over with startpage [30:44.280 --> 30:47.280] Cell phones emit radio frequency energy, it's a fact [30:47.280 --> 30:52.280] But whether it's dangerous to have a phone beaming this kind of radiation near your head has been disputed [30:52.280 --> 30:57.280] Some have blamed it for brain tumors while cell phone companies have downplayed concerns [30:57.280 --> 31:02.280] Well, now the Journal of the American Medical Association is confirming that cell phones affect brain chemistry [31:02.280 --> 31:11.280] A study of 47 volunteers showed that glucose metabolism in the area of the brain closest to the cell phone antenna increases when the cell phone is on [31:11.280 --> 31:16.280] While researchers aren't sure whether this exposure causes damage, I'm not taking any chances [31:16.280 --> 31:20.280] I always keep the phone far from my body and I use a corded headset [31:20.280 --> 31:25.280] I'm Dr. Catherine Albrecht, more news and information at CatherineAlbrecht.com [31:25.280 --> 31:34.280] I lost my son, my nephew, my uncle, my son on September 11, 2001 [31:34.280 --> 31:38.280] Most people don't know that a third tower fell on September 11 [31:38.280 --> 31:42.280] World Trade Center 7, a 47-story skyscraper, was not hit by a plane [31:42.280 --> 31:46.280] Although the official explanation is that fire brought down Building 7 [31:46.280 --> 31:50.280] Over 1,200 architects and engineers have looked into the evidence [31:50.280 --> 31:52.280] And believe there's more to the story [31:52.280 --> 31:55.280] Bring justice to my son, my uncle, my nephew, my son [31:55.280 --> 31:57.280] Go to buildingwatch.org [31:57.280 --> 32:00.280] Why it sells, why it matters, and what you can do [32:00.280 --> 32:06.280] Are you looking to have a closer relationship with God and a better understanding of His Word? [34:17.280 --> 34:26.280] And the other question is, may I continue sending my request for production, interrogatories, admissions? [34:26.280 --> 34:30.280] May I continue working, doing my thing? [34:30.280 --> 34:34.280] Absolutely. All of that stays in place. [34:34.280 --> 34:39.280] Now, if they look at the amended complaint, because you have to understand, [34:39.280 --> 34:46.280] when you file an amended complaint, you have to have everything in there. [34:46.280 --> 34:52.280] When you say amended, it sounds like you take the original complaint and you just add some amendments to it. [34:52.280 --> 34:54.280] No, no, no, that's not how it works. [34:54.280 --> 34:59.280] When you file an amended complaint, the original is gone. [34:59.280 --> 35:06.280] Everything you want to claim must be in the amended complaint. [35:06.280 --> 35:13.280] So if you have stuff in the original that you want in the amended, you have to put it in there, [35:13.280 --> 35:18.280] because the original petition is no longer before the court. [35:18.280 --> 35:23.280] Did you make sure you have all your claims in the amended? [35:23.280 --> 35:27.280] I have all my claims and then some. [35:27.280 --> 35:30.280] Good. That's exactly how it's supposed to be. [35:30.280 --> 35:31.280] Excellent. [35:31.280 --> 35:38.280] So long as the discovery is appropriate to the amended complaint, it will have no effect. [35:38.280 --> 35:45.280] If the discovery you've asked for previously is not relevant to the amended complaint, [35:45.280 --> 35:51.280] let them complain about that. Let them tell the judge and argue about it. [35:51.280 --> 35:55.280] All of that kind of thing is still before the court. [35:55.280 --> 36:04.280] Do you have any other motions before the court that don't have to do with discovery? [36:04.280 --> 36:08.280] That don't have to do with discovery, yes. [36:08.280 --> 36:16.280] I have a reply motion or maybe I have a definite statement motion. [36:16.280 --> 36:21.280] I have a scandalous motion. [36:21.280 --> 36:24.280] Scandalous? Oh, that sounds like fun. [36:24.280 --> 36:27.280] I've never seen one of those. Sounds great. [36:27.280 --> 36:33.280] A definite statement. Since you are the plaintiff? [36:33.280 --> 36:34.280] Yes. [36:34.280 --> 36:41.280] Then what is the nature of the definite statement you requested? [36:41.280 --> 36:46.280] They requested a medical exam for my tooth. [36:46.280 --> 36:50.280] By the way, I extracted this tooth so the evidence is gone. [36:50.280 --> 36:54.280] I don't know what's going to happen. They don't know that yet. [36:54.280 --> 37:07.280] But they said the complaint is about a breach of contract. [37:07.280 --> 37:11.280] They asked for a medical exam because they said that the health of the tooth [37:11.280 --> 37:15.280] or whatever is going on with the tooth is important for the defendant [37:15.280 --> 37:20.280] to continue in this lawsuit and the defendant... [37:20.280 --> 37:23.280] Wait a minute. This is a dentist? [37:23.280 --> 37:25.280] Yes. [37:25.280 --> 37:31.280] What does a medical exam have to do with dental? [37:31.280 --> 37:38.280] Is the medical exam restricted to dental issues? [37:38.280 --> 37:45.280] It is under the umbrella. The medical exam can be the tooth. [37:45.280 --> 37:48.280] That would be considered a medical exam. [37:48.280 --> 37:58.280] You would want to make sure that if you're filing a petition alleging a dental issue [37:58.280 --> 38:07.280] to object to a dental exam would be... What's the term, Brett? [38:07.280 --> 38:09.280] The judge would not look good on that. [38:09.280 --> 38:12.280] It seems overly broad. [38:12.280 --> 38:18.280] If you're asking for anything beyond dental, then that's overly broad. [38:18.280 --> 38:21.280] You'd want to object to that. [38:21.280 --> 38:24.280] Well, it's not anything beyond dental. I did object. [38:24.280 --> 38:29.280] Then they went... They asked the judge to... [38:29.280 --> 38:35.280] What does he have to... Not to compel, but... [38:35.280 --> 38:39.280] I can't think of it now. I'm so sorry, you guys. [38:39.280 --> 38:42.280] That's the standard procedure in discovery. [38:42.280 --> 38:44.280] In discovery... [38:44.280 --> 38:45.280] Right. [38:45.280 --> 38:50.280] Most people think you file a motion for discovery. [38:50.280 --> 38:52.280] No, that's not how it works. [38:52.280 --> 38:56.280] You send your request for discovery to the other party. [38:56.280 --> 38:59.280] Initially, the court has nothing to do with it. [38:59.280 --> 39:01.280] You just ask them for discovery. [39:01.280 --> 39:08.280] If they don't want to give you discovery, then they have to file an objection to it with the court. [39:08.280 --> 39:13.280] The court has to either approve or deny their objection. [39:13.280 --> 39:18.280] If you request information, they just don't give it to you. [39:18.280 --> 39:24.280] Then you go to the court and ask the court to file a motion to compel. [39:24.280 --> 39:28.280] This is not for you, Elise. I know you already understand this. [39:28.280 --> 39:32.280] This is so everybody else understands how discovery works. [39:32.280 --> 39:38.280] Discovery initially is between the two parties and not the court. [39:38.280 --> 39:42.280] Unless one of the parties doesn't provide the discovery, [39:42.280 --> 39:48.280] then they have to go to the court and ask the court to compel discovery. [39:48.280 --> 39:51.280] I have to do that, actually. [39:51.280 --> 39:56.280] One of my motions is a motion to compel discovery because she did not reply at the right time. [39:56.280 --> 40:00.280] I don't know what she's counting on her calendar because she's late. [40:00.280 --> 40:05.280] Aside from that, they filed a motion for medical examination. [40:05.280 --> 40:13.280] And on what they asked for, I asked for a definite statement because they said that in my amended complaint, [40:13.280 --> 40:20.280] which wasn't approved yet, but I sent them a copy, paragraphs five through seven. [40:20.280 --> 40:22.280] Wait, wait, wait, wait, wait, wait. Hold on. [40:22.280 --> 40:26.280] Is this your first amended complaint? [40:26.280 --> 40:29.280] First and last, yes. Right? [40:29.280 --> 40:34.280] First amended complaint does not have to be approved. [40:34.280 --> 40:39.280] You can always do a first amended complaint without permission of the court. [40:39.280 --> 40:43.280] A second amended complaint, you'll have to ask for permission from the court. [40:43.280 --> 40:45.280] And third and fourth. [40:45.280 --> 40:51.280] But initially, I didn't know that and so I had asked the court for approval and they did approve it. [40:51.280 --> 40:55.280] I did not know that at the time because... [40:55.280 --> 40:57.280] But that's okay. [40:57.280 --> 41:00.280] It never hurts to ask the court for approval. [41:00.280 --> 41:04.280] You're simply showing respect to the court. [41:04.280 --> 41:05.280] No worries. [41:05.280 --> 41:12.280] In all cases, you should always show respect to the court unless they're screwing up really bad. [41:12.280 --> 41:15.280] They respond to that well. [41:15.280 --> 41:25.280] I sat as a judge in a mock trial once and I was surprised at how difficult that was. [41:25.280 --> 41:35.280] Judges get put in positions to where they have to make rulings that they always know somebody's going to be unhappy with their ruling. [41:35.280 --> 41:44.280] And for a party to express respect for the court and the position they're in really goes a long way. [41:44.280 --> 41:49.280] Now, that should not make a difference, but it does. [41:49.280 --> 41:54.280] When I go into court, I always wear a suit and tie. [41:54.280 --> 42:04.280] I do loosen my tie a little bit, but I don't slide it up too tight. [42:04.280 --> 42:10.280] But these people come in with t-shirts on and with stupid sayings on them. [42:10.280 --> 42:13.280] That's just disrespectful to the court. [42:13.280 --> 42:25.280] It's subtle, but you want the court not to unnecessarily be biased against you. [42:25.280 --> 42:36.280] Of course, you're not supposed to be biased, but we are human beings and we're often biased whether we want to be or not. [42:36.280 --> 42:52.280] So I suggest to everyone take care so as not to introduce an unnecessary bias and always show respect for the court. [42:52.280 --> 43:08.280] And when the court rules against you and you have to file a motion in opposition to it, always start with the court's criticism is well taken. [43:08.280 --> 43:11.280] It shows respect for the court. [43:11.280 --> 43:18.280] And whether they intend to think better of you or not, they will. [43:18.280 --> 43:22.280] Okay, I'll shut up now. [43:22.280 --> 43:24.280] Yeah, your tie. [43:24.280 --> 43:25.280] It was funny. [43:25.280 --> 43:27.280] I giggled because you're a naughty boy. [43:27.280 --> 43:30.280] You like getting into a little bit of trouble all the time, don't you, Randy? [43:30.280 --> 43:32.280] That's what I've noticed about you. [43:32.280 --> 43:37.280] Very funny. [43:37.280 --> 43:39.280] Is she calling you a troublemaker? [43:39.280 --> 43:44.280] Very. [43:44.280 --> 43:56.280] I'm in the process of filing a lawsuit against a magistrate because I gave him a criminal complaint and he asked me if I was an attorney. [43:56.280 --> 44:00.280] Oh, no, no, I sleep well at night. [44:00.280 --> 44:06.280] Through advances in technology, our lives have greatly improved, except in the area of nutrition. [44:06.280 --> 44:09.280] People feed their pets better than they feed themselves. [44:09.280 --> 44:11.280] And it's time we changed all that. [47:02.280 --> 47:10.280] I'm just so glad to make my living pushing buttons. [47:10.280 --> 47:16.280] Oh, oh, oh, oh, oh. [47:16.280 --> 47:20.280] Oh, oh, oh, oh, oh. [47:20.280 --> 47:22.280] We sat down to play Monopoly. [47:22.280 --> 47:25.280] We all wanted to win the game. [47:25.280 --> 47:29.280] We gave some guy his money supply. [47:29.280 --> 47:34.280] Okay, we are back from the Kelton Brick Fountain with Rule of Law Radio. [47:34.280 --> 47:40.280] And I apologize for falling off the cliff. It seems like we have a sync problem. [47:40.280 --> 47:43.280] We're about 17 seconds out of sync. [47:43.280 --> 47:47.280] But Deborah is on and she is getting that fixed for us. [47:47.280 --> 47:53.280] Okay, when we went out, I was being a bad boy. [47:53.280 --> 47:56.280] I try not to be a bad boy. [47:56.280 --> 47:58.280] What I try to be, and every time I want to be a bad boy... [47:58.280 --> 48:00.280] You don't try very hard, do you? [48:00.280 --> 48:04.280] I always try to be the master of the servant. [48:04.280 --> 48:12.280] Whenever I deal with my public officials, my mindset is they're the servants, I'm the master. [48:12.280 --> 48:17.280] And the master does not have to be rude or disrespectful, [48:17.280 --> 48:24.280] but there is a position that the master takes. [48:24.280 --> 48:33.280] And I request that my public officials perform their duty in accordance with my law. [48:33.280 --> 48:39.280] And in that regard, I am not reasonable and I am not understanding. [48:39.280 --> 48:43.280] And they think I'm a bad boy for that, well, let them. [48:43.280 --> 48:48.280] And if we all do that, you know, the police do that to us. [48:48.280 --> 48:51.280] You know, I'm just doing my job, just doing my job. [48:51.280 --> 48:54.280] Public officials fail to perform duties they're required to perform [48:54.280 --> 48:57.280] and I land on them like a ton of bricks. [48:57.280 --> 49:00.280] Just doing my job, Bubba. [49:00.280 --> 49:03.280] Don't take it personal. [49:03.280 --> 49:04.280] Okay, go ahead. [49:04.280 --> 49:09.280] I'm having too much fun today. [49:09.280 --> 49:11.280] Are there any of these? [49:11.280 --> 49:13.280] Yes, yes. [49:13.280 --> 49:16.280] I enjoyed your fun, so that was great. [49:16.280 --> 49:19.280] So thank you. [49:19.280 --> 49:25.280] So I can continue doing my thing with discovery, [49:25.280 --> 49:27.280] regardless if there is an amended complaint, [49:27.280 --> 49:31.280] regardless if there might be a new counterclaim, I can continue on. [49:31.280 --> 49:33.280] Is that correct? [49:33.280 --> 49:40.280] Yes, there's just one little detail that's often missed or overlooked. [49:40.280 --> 49:43.280] When you file the original petition, [49:43.280 --> 49:49.280] the opposing party must file a response, [49:49.280 --> 49:54.280] generally it is an odd number here that comes up in most states, [49:54.280 --> 50:01.280] a Monday after the 20th day. [50:01.280 --> 50:06.280] However, when you file an amended complaint, [50:06.280 --> 50:12.280] there is no requirement that they respond. [50:12.280 --> 50:19.280] Now, if they don't respond to the original petition by the Monday after the 20th day, [50:19.280 --> 50:24.280] then you can file for a default judgment. [50:24.280 --> 50:27.280] You file an amended complaint and they don't respond, [50:27.280 --> 50:31.280] you can't file for a default judgment. [50:31.280 --> 50:39.280] In that case, you file for a summary judgment. [50:39.280 --> 50:44.280] It's a minor difference, but it's an important difference to understand. [50:44.280 --> 50:49.280] You file a summary judgment motion because you have filed a pleading [50:49.280 --> 50:56.280] and you have made claims and the other party failed to oppose those claims. [50:56.280 --> 51:00.280] So now your claims have no opposition. [51:00.280 --> 51:05.280] Any time you file a motion or a pleading after the original petition [51:05.280 --> 51:09.280] and the other party doesn't respond to it within the statutory time limit, [51:09.280 --> 51:15.280] it's generally 30 days to somewhere thereabouts of varying the different states. [51:15.280 --> 51:22.280] If they don't file timely, then you can file for summary judgment. [51:22.280 --> 51:28.280] Only on the original petition can you file for default judgment. [51:28.280 --> 51:31.280] That's kind of important because if you file an original petition [51:31.280 --> 51:34.280] and the other party doesn't respond timely, [51:34.280 --> 51:38.280] then you go to the clerk with a motion for default judgment, [51:38.280 --> 51:42.280] give it to the clerk, and the clerk will look in the record [51:42.280 --> 51:47.280] and see on this day this complaint was filed. [51:47.280 --> 51:54.280] On this day, the record shows that it was served on opposing party. [51:54.280 --> 52:00.280] She'll count to the Monday after the 20th day [52:00.280 --> 52:03.280] and look in the record and see if there is a response. [52:03.280 --> 52:09.280] If there's not a response, she can sign the default judgment, she or he, the clerk. [52:09.280 --> 52:14.280] And then it can be you have your default judgment. [52:14.280 --> 52:19.280] The other party has to object, and if they object, then it has to go before a judge, [52:19.280 --> 52:24.280] and then the judge can affirm the default judgment. [52:24.280 --> 52:27.280] That's different than summary judgment. [52:27.280 --> 52:32.280] When you file a summary judgment, it's not default, so the clerk can't sign it. [52:32.280 --> 52:37.280] Then you have to set a hearing and go before the court [52:37.280 --> 52:41.280] and demonstrate to the court that you filed. [52:41.280 --> 52:45.280] They did not timely respond and ask the court to grant you summary judgment. [52:45.280 --> 52:48.280] Does that make sense? [52:48.280 --> 52:49.280] It does make sense. [52:49.280 --> 52:54.280] The amended complaint gets a motion of summary judgment [52:54.280 --> 53:01.280] if they fail to oppose within the allotted legal timeframe. [53:01.280 --> 53:04.280] Wait a minute, that didn't make sense to me. [53:04.280 --> 53:09.280] The amended complaint, how did that get to summary judgment? [53:09.280 --> 53:11.280] Did they not answer the amended complaint? [53:11.280 --> 53:17.280] Well, if they don't answer the amended complaint, if they fail to oppose it, [53:17.280 --> 53:23.280] I thought in that allotted amount of time, I thought I'm able to file a motion of a summary judgment. [53:23.280 --> 53:25.280] I thought that's what you said. [53:25.280 --> 53:26.280] Exactly. [53:26.280 --> 53:28.280] That is exactly right. [53:28.280 --> 53:32.280] It's a technical detail, but it's important we understand those. [53:32.280 --> 53:35.280] So yes, the original, if they don't respond, you get default. [53:35.280 --> 53:38.280] The clerk can sign off on that one. [53:38.280 --> 53:46.280] If it's amended or the other motion or pleading they don't respond to, then it's summary. [53:46.280 --> 53:49.280] Yeah, that's actually a big difference, actually. [53:49.280 --> 53:52.280] I think it's a big difference anyway. [53:52.280 --> 53:54.280] So that's important. [53:54.280 --> 54:03.280] And sir, Randy, you're a gentleman and a scholar. [54:03.280 --> 54:05.280] Really, you're wonderful. [54:05.280 --> 54:07.280] Brett, I love you too. [54:07.280 --> 54:08.280] You're wonderful too. [54:08.280 --> 54:11.280] Sorry I'm paying so much attention to Randy today. [54:11.280 --> 54:16.280] Wait a minute, wait a minute, but you like me better, right? [54:16.280 --> 54:20.280] So much better. [54:20.280 --> 54:22.280] I'm kidding, Brett. [54:22.280 --> 54:24.280] No, I'm supposed to get offended. [54:24.280 --> 54:25.280] Is that the deal, Randy? [54:25.280 --> 54:26.280] Do I need to be offended? [54:26.280 --> 54:32.280] Oh, yeah, you need to be offended. [54:32.280 --> 54:36.280] Thank you so much for all you do, for all of us. [54:36.280 --> 54:43.280] This show is the most rewarding thing I've ever done. [54:43.280 --> 54:46.280] Oh, wow. [54:46.280 --> 54:52.280] The hosts on this network pretty well support the network. [54:52.280 --> 54:54.280] We don't get paid. [54:54.280 --> 55:05.280] We put in our time and I put in quite a bit of money as a rule over the years, but it is absolutely worth it. [55:05.280 --> 55:14.280] The best way to learn this material is to teach it. [55:14.280 --> 55:16.280] Wow. [55:16.280 --> 55:22.280] I get to stand in front of George P. Bush and he's an attorney. [55:22.280 --> 55:31.280] He's a high-level politician, and I get to walk him through the codes with absolute confidence. [55:31.280 --> 55:35.280] I wouldn't be able to do that if it wasn't for this show. [55:35.280 --> 55:39.280] So thank you all for supporting this show. [55:39.280 --> 55:43.280] Without all of you, we wouldn't be here. [55:43.280 --> 55:48.280] And I wouldn't have the opportunity to affect positive change that I have. [55:48.280 --> 55:52.280] It's all because of you guys. [55:52.280 --> 55:57.280] And Brett. [55:57.280 --> 56:06.280] But I'm not going to mention Eddie because if we say anything nice about Eddie Craig, he tends to get the big head. [56:06.280 --> 56:14.280] For those of you who don't know, Eddie Craig does a traffic show on Monday nights at 8 Central. [56:14.280 --> 56:21.280] And we pick on him a lot because only because he deserves it. [56:21.280 --> 56:22.280] Okay. [56:22.280 --> 56:26.280] Do you have anything else for us, Elise? [56:26.280 --> 56:27.280] I don't think so. [56:27.280 --> 56:28.280] No. [56:28.280 --> 56:30.280] Just, you know, it's all good. [56:30.280 --> 56:32.280] Thank you so much again. [56:32.280 --> 56:36.280] You can come on any time as long as you talk nice about us. [56:36.280 --> 56:37.280] Okay. [56:37.280 --> 56:40.280] Sending you both, yeah, only nice things. [56:40.280 --> 56:43.280] Sending you both a big, big warm hug. [56:43.280 --> 56:44.280] Okay. [56:44.280 --> 56:46.280] Thank you very much. [56:46.280 --> 56:47.280] Thanks, Elise. [56:47.280 --> 56:48.280] Thank you. [56:48.280 --> 56:49.280] Okay. [56:49.280 --> 56:52.280] Now we're going to go to E.J. in California. [56:52.280 --> 56:54.280] Hello, E.J. [56:54.280 --> 56:58.280] What do you have for us today? [56:58.280 --> 56:59.280] Hello. [56:59.280 --> 57:07.280] I have a question regarding the letter that I'm going to write and possibly mail it tomorrow [57:07.280 --> 57:12.280] or Monday and have three parts. [57:12.280 --> 57:14.280] The first part would be... [57:14.280 --> 57:15.280] Okay. [57:15.280 --> 57:16.280] Hold on, E.J. [57:16.280 --> 57:17.280] Okay. [57:17.280 --> 57:22.280] We have a lot of people listening and most of them probably don't know what the context [57:22.280 --> 57:24.280] of what you're dealing with is. [57:24.280 --> 57:30.280] Can you kind of give us a synopsis of where you're at so people are kind of oriented [57:30.280 --> 57:33.280] on what you're talking about? [57:33.280 --> 57:42.280] I have filed a lawsuit against the hospital when I was visiting my parents. [57:42.280 --> 57:46.280] So the motion, I mean the case was dismissed. [57:46.280 --> 57:47.280] Okay. [57:47.280 --> 57:55.280] This is where the security wouldn't let you in without a mask or tossed you out. [57:55.280 --> 58:00.280] No, this was where she was walking down the hall and saw something the security guards [58:00.280 --> 58:05.280] were doing that she wasn't supposed to see and they turned her around and escorted her [58:05.280 --> 58:09.280] the other way and then started claiming that she was doing all sorts of... [58:09.280 --> 58:17.280] They claimed that you had hit the guard and they stole your phone and all this. [58:17.280 --> 58:18.280] Yes. [58:18.280 --> 58:27.280] He actually crushed me grabbing my phone and he ran behind the ER lobby. [58:27.280 --> 58:28.280] Right. [58:28.280 --> 58:31.280] Because he had to check what was on your phone. [58:31.280 --> 58:32.280] Hold on. [58:32.280 --> 58:33.280] We're about to... [58:33.280 --> 58:34.280] Okay. [58:34.280 --> 58:35.280] Okay. [58:35.280 --> 58:36.280] Never fixed it. [58:36.280 --> 58:40.280] We have been going out 17 seconds early but I apparently never fixed it. [58:40.280 --> 58:41.280] Hang on. [58:41.280 --> 58:46.280] We're about to go to our sponsors, Randy Kelton, Brett Fountain, a little radio and I'll be [58:46.280 --> 58:47.280] right back. [01:00:02.280 --> 01:00:05.280] The Bill of Rights contains the first 10 amendments of our Constitution. [01:00:05.280 --> 01:00:09.280] They guarantee the specific freedoms Americans should know and protect. [01:00:09.280 --> 01:00:10.280] Our liberty depends on it. [01:00:10.280 --> 01:00:14.280] I'm Dr. Catherine Albrecht and I'll be right back with an unforgettable way to remember [01:00:14.280 --> 01:00:17.280] one of your constitutional rights. [01:00:17.280 --> 01:00:19.280] Privacy is under attack. [01:00:19.280 --> 01:00:22.280] When you give up data about yourself, you'll never get it back again. [01:00:22.280 --> 01:00:27.280] And once your privacy is gone, you'll find your freedoms will start to vanish too. [01:00:27.280 --> 01:00:32.280] So protect your rights, say no to surveillance and keep your information to yourself. [01:00:32.280 --> 01:00:35.280] Privacy, it's worth hanging on to. [01:00:35.280 --> 01:00:39.280] This public service announcement is brought to you by Startpage.com, the private search [01:00:39.280 --> 01:00:42.280] engine alternative to Google, Yahoo and Vim. [01:00:42.280 --> 01:00:46.280] Start over with Startpage. [01:00:46.280 --> 01:00:48.280] Imagine your mom and dad are getting ready for bed. [01:00:48.280 --> 01:00:51.280] They pull back the covers and find a third party there. [01:00:51.280 --> 01:00:54.280] He announces, I'm with the military and I'm sleeping here tonight. [01:00:54.280 --> 01:00:58.280] That shocking image of a third party in my parents' bed reminds me what the Third [01:00:58.280 --> 01:01:00.280] Amendment was designed to prevent. [01:01:00.280 --> 01:01:04.280] It protects us from being forced to share our homes with soldiers, a common demand in [01:01:04.280 --> 01:01:06.280] the days of our founding fathers. [01:01:06.280 --> 01:01:08.280] Third party, Third Amendment? [01:01:08.280 --> 01:01:09.280] Get it? [01:01:09.280 --> 01:01:13.280] So if you answer a knock at your door and guys in fatigues demand lodging, tell them [01:01:13.280 --> 01:01:17.280] to dust off their copy of the Bill of Rights and reread the Third Amendment. [01:01:17.280 --> 01:01:18.280] I'm Dr. Catherine Albrecht. [01:01:18.280 --> 01:01:31.280] More news and information at CatherineAlbrecht.com. [01:01:31.280 --> 01:01:35.280] The Bill of Rights contains the first ten amendments of our Constitution. [01:01:35.280 --> 01:01:38.280] They guarantee the specific freedoms Americans should know and protect. [01:01:38.280 --> 01:01:40.280] Our liberty depends on it. [01:01:40.280 --> 01:01:44.280] I'm Dr. Catherine Albrecht and I'll be right back with an unforgettable way to remember [01:01:44.280 --> 01:01:46.280] one of your constitutional rights. [01:01:46.280 --> 01:01:48.280] Privacy is under attack. [01:01:48.280 --> 01:01:52.280] When you give up data about yourself, you'll never get it back again. [01:01:52.280 --> 01:01:57.280] And once your privacy is gone, you'll find your freedoms will start to vanish too. [01:01:57.280 --> 01:01:58.280] So protect your rights. [01:01:58.280 --> 01:02:02.280] Say no to surveillance and keep your information to yourself. [01:02:02.280 --> 01:02:04.280] Privacy, it's worth hanging on to. [01:02:04.280 --> 01:02:09.280] This public service announcement is brought to you by StartPage.com, the private search [01:02:09.280 --> 01:02:12.280] engine alternative to Google, Yahoo and Bing. [01:02:12.280 --> 01:02:16.280] Start over with StartPage. [01:02:16.280 --> 01:02:20.280] Imagine four eyes staring at you through binoculars, a magnifying glass or a pair of [01:02:20.280 --> 01:02:21.280] x-ray goggles. [01:02:21.280 --> 01:02:25.280] That imagery reminds me that the Fourth Amendment guarantees Americans freedom from [01:02:25.280 --> 01:02:27.280] unreasonable search and seizure. [01:02:27.280 --> 01:02:30.280] Fourth Amendment, four eyes staring at you? [01:02:30.280 --> 01:02:31.280] Get it? [01:02:31.280 --> 01:02:34.280] Unfortunately, the government is trampling our Fourth Amendment rights in the name of [01:02:34.280 --> 01:02:35.280] security. [01:02:35.280 --> 01:02:39.280] Case in point, TSA airport scanners that peer under your clothing. [01:02:39.280 --> 01:02:43.280] When government employees demand a peep at your privates without probable cause, I say [01:02:43.280 --> 01:02:46.280] it's time to sound the constitutional alarm bells. [01:02:46.280 --> 01:02:50.280] Join me in asking our representatives to dust off the Bill of Rights and use their [01:02:50.280 --> 01:02:53.280] googly eyes to take a gander at the Fourth. [01:02:53.280 --> 01:02:54.280] I'm Dr. Catherine Albrecht. [01:02:54.280 --> 01:03:10.280] More news and information at CatherineAlbrecht.com. [01:03:10.280 --> 01:03:25.280] Thank you. [01:03:25.280 --> 01:03:40.280] Thank you. [01:03:40.280 --> 01:03:55.280] Thank you. [01:03:55.280 --> 01:03:56.280] Okay. [01:03:56.280 --> 01:04:10.280] Well, we are back. [01:04:10.280 --> 01:04:14.280] It's the sixth of May. [01:04:14.280 --> 01:04:15.280] Yeah. [01:04:15.280 --> 01:04:16.280] We missed Cinco de Mayo. [01:04:16.280 --> 01:04:19.280] So this is Cinco de Sete. [01:04:19.280 --> 01:04:20.280] Well, okay. [01:04:20.280 --> 01:04:21.280] Close enough. [01:04:21.280 --> 01:04:26.280] You're saying the five of the seven. [01:04:26.280 --> 01:04:31.280] Ocho Sete Cinco Sete. [01:04:31.280 --> 01:04:34.280] Yeah, kind of. [01:04:34.280 --> 01:04:43.280] Anyway, it's the sixth of May, 2022. [01:04:43.280 --> 01:04:49.280] And our call-in number, 512-646-1984, we have some room on the board. [01:04:49.280 --> 01:04:53.280] If you have a question or comment, give us a call. [01:04:53.280 --> 01:05:01.280] We're talking to EJ in California, and EJ has been kicking behind. [01:05:01.280 --> 01:05:08.280] These security guards messed with her, and they screwed up major. [01:05:08.280 --> 01:05:10.280] Okay. [01:05:10.280 --> 01:05:13.280] Now everybody knows kind of where you're at. [01:05:13.280 --> 01:05:17.280] What are you up to now, EJ? [01:05:17.280 --> 01:05:24.280] I'm up to writing, responding back to the Scheister's. [01:05:24.280 --> 01:05:27.280] You're up to writing what? [01:05:27.280 --> 01:05:31.280] A response letter. [01:05:31.280 --> 01:05:35.280] What are you responding to? [01:05:35.280 --> 01:05:44.280] They wrote me a threatening letter last Friday threatening to follow a motion to compel, [01:05:44.280 --> 01:05:52.280] because I didn't answer the interrogatory letter at once. [01:05:52.280 --> 01:05:54.280] Don't go scratch. [01:05:54.280 --> 01:05:56.280] Go scratch. [01:05:56.280 --> 01:06:01.280] They wrote you a letter threatening to follow a motion to compel? [01:06:01.280 --> 01:06:05.280] What the heck is that? [01:06:05.280 --> 01:06:11.280] They're trying to get you to say something or do something they can use. [01:06:11.280 --> 01:06:17.280] As a rule, if they ask for discovery, you don't give them discovery. [01:06:17.280 --> 01:06:22.280] They don't threaten you with a letter. [01:06:22.280 --> 01:06:25.280] They must think you're a chump. [01:06:25.280 --> 01:06:31.280] If you follow a motion to compel, knock yourself out. [01:06:31.280 --> 01:06:34.280] Why are you sending me a letter threatening me? [01:06:34.280 --> 01:06:36.280] You should bargain for that. [01:06:36.280 --> 01:06:38.280] There you go. [01:06:38.280 --> 01:06:41.280] I think it's a civil rules of procedure. [01:06:41.280 --> 01:06:51.280] They need to give me a meeting confer, a letter just saying that let's do a meeting confer. [01:06:51.280 --> 01:06:55.280] If not, then they can go ahead and follow the motion to compel. [01:06:55.280 --> 01:06:58.280] If they don't notice me, they can't follow it. [01:06:58.280 --> 01:07:02.280] They're just noticing me within the 10 days. [01:07:02.280 --> 01:07:08.280] California may be different than Texas. [01:07:08.280 --> 01:07:09.280] Okay. [01:07:09.280 --> 01:07:15.280] Well, then tell them, well, knock yourself out. [01:07:15.280 --> 01:07:18.280] Knock yourself out. [01:07:18.280 --> 01:07:22.280] I'm writing back to you. [01:07:22.280 --> 01:07:27.280] Please knock yourself out. [01:07:27.280 --> 01:07:34.280] And I'm attaching my fee schedule, and I'm CC-ing the CEO of the hospital. [01:07:34.280 --> 01:07:38.280] So I'm going to CC the name of the CEO. [01:07:38.280 --> 01:07:42.280] And also, I just wanted to get your thoughts on this. [01:07:42.280 --> 01:07:48.280] I did a search over the internet for the top five, [01:07:48.280 --> 01:07:53.280] what is it, the airs and emissions insurance for hospitals. [01:07:53.280 --> 01:07:55.280] Would that be a good idea? [01:07:55.280 --> 01:07:57.280] I mean, there's a lot. [01:07:57.280 --> 01:08:00.280] I found 10, top 10. [01:08:00.280 --> 01:08:05.280] Admiral, Ally, Beegley, Chubb. [01:08:05.280 --> 01:08:07.280] I mean, it's like 10. [01:08:07.280 --> 01:08:13.280] So I wanted to get your wonderful opinion, your wise counsel, [01:08:13.280 --> 01:08:20.280] and just go ahead and CC all these 10 ENO. [01:08:20.280 --> 01:08:22.280] Or no, I'm just talking about it. [01:08:22.280 --> 01:08:35.280] Just mentioning errors and omissions is going to constrict the anal sphincter factor. [01:08:35.280 --> 01:08:39.280] Just letting them know that you're aware of their insurance, [01:08:39.280 --> 01:08:47.280] that tells them you're aware of the effect of what you're doing is going to have on their insurance coverage. [01:08:47.280 --> 01:09:00.280] And the effect your suit will have will far outstrip anything you're asking for as far as damages. [01:09:00.280 --> 01:09:05.280] It will cost them more because their insurance coverage is going to go up. [01:09:05.280 --> 01:09:07.280] Every time they get a claim against them, [01:09:07.280 --> 01:09:20.280] the agent, whoever handles the insurance, is looking for any reason he can find to increase their weight. [01:09:20.280 --> 01:09:31.280] And especially with large hospitals, the numbers are so large that a small increase amounts to a lot of money. [01:09:31.280 --> 01:09:36.280] And this is not a one-time increase like, oh, just this next month your premiums will be higher, right? [01:09:36.280 --> 01:09:38.280] This is a gift that keeps on giving. [01:09:38.280 --> 01:09:40.280] Exactly. [01:09:40.280 --> 01:09:44.280] Have you asked for mediation yet? [01:09:44.280 --> 01:09:52.280] No, not yet, because our conference, our first conference call, [01:09:52.280 --> 01:09:59.280] it's called the status conference, and it's coming up in a month, June 6th. [01:09:59.280 --> 01:10:07.280] But I haven't found the other hospital descendant, sorry, the security descendant. [01:10:07.280 --> 01:10:11.280] I haven't served them at all. [01:10:11.280 --> 01:10:21.280] That may be the time you may want to ask the court to order non-binding mediation. [01:10:21.280 --> 01:10:23.280] Okay. [01:10:23.280 --> 01:10:31.280] You don't want to ask for binding mediation because they might fly off the mediator. [01:10:31.280 --> 01:10:34.280] So you ask for non-binding mediation. [01:10:34.280 --> 01:10:39.280] This gives the lawyers an opportunity to actually talk to you. [01:10:39.280 --> 01:10:49.280] If you're a pro se litigant, the lawyers will be embarrassed making a deal with a pro se litigant. [01:10:49.280 --> 01:10:54.280] So all the other lawyers will think they're chumps because they couldn't handle a pro se. [01:10:54.280 --> 01:10:57.280] But if you ask the court to order mediation, [01:10:57.280 --> 01:11:03.280] then they can come to the table and not lose face and make a deal, make you sink away. [01:11:03.280 --> 01:11:04.280] Okay. [01:11:04.280 --> 01:11:10.280] But it only goes away when you have the check in your hand. [01:11:10.280 --> 01:11:18.280] If you sign anything before you have the check in your hand, you will never get the check. [01:11:18.280 --> 01:11:22.280] They'll just refuse to pay you, and then you have to go back and sue them, [01:11:22.280 --> 01:11:25.280] and a major effort to try to collect it. [01:11:25.280 --> 01:11:30.280] So the only deal you accept is the one where they put the check in front of you. [01:11:30.280 --> 01:11:32.280] Okay. [01:11:32.280 --> 01:11:35.280] And this is how we win. [01:11:35.280 --> 01:11:42.280] To win with a court ruling in our favor is extremely difficult. [01:11:42.280 --> 01:11:52.280] And because it would cost them so much in the long run, they will fight you no matter what it costs. [01:11:52.280 --> 01:12:03.280] But if you give them an opportunity to come to the table and make this go away, they most likely will. [01:12:03.280 --> 01:12:06.280] When I asked the court, would that be verbal? [01:12:06.280 --> 01:12:12.280] Of course, no. It's going to be verbal as well as a notice to the judge. [01:12:12.280 --> 01:12:15.280] If you're in the court, you can ask them verbally, [01:12:15.280 --> 01:12:23.280] or it wouldn't hurt to file a motion asking the court to order non-binding mediation. [01:12:23.280 --> 01:12:24.280] Okay. [01:12:24.280 --> 01:12:27.280] The court will know what you're doing. [01:12:27.280 --> 01:12:28.280] Okay. [01:12:28.280 --> 01:12:34.280] You're giving the other side an opportunity to make this go away and not lose face. [01:12:34.280 --> 01:12:36.280] Okay. [01:12:36.280 --> 01:12:39.280] The court will like it because it clears his calendar, [01:12:39.280 --> 01:12:45.280] and good chance the other side will like it because now they can make a deal to not lose face, [01:12:45.280 --> 01:12:50.280] and everybody goes home, and this is all over. [01:12:50.280 --> 01:12:52.280] The hospital is very cheap. [01:12:52.280 --> 01:13:01.280] I've done research on how much they've asked during the negotiation table. [01:13:01.280 --> 01:13:11.280] I've researched nurses who were terminated, and they only offered them very small. [01:13:11.280 --> 01:13:17.280] They said no, and they went to trial. [01:13:17.280 --> 01:13:19.280] They're very cheap. [01:13:19.280 --> 01:13:21.280] The hospital is very cheap. [01:13:21.280 --> 01:13:23.280] I know that for sure. [01:13:23.280 --> 01:13:24.280] They'll fight. [01:13:24.280 --> 01:13:37.280] I can tell from the doctors that tried to sue this hospital, and they're lions. [01:13:37.280 --> 01:13:42.280] No, they're not lions. [01:13:42.280 --> 01:13:50.280] If a doctor lies, then I'm going to complain to the medical board. [01:13:50.280 --> 01:13:58.280] Now, when you file a bar grievance, the state bar will throw that grievance in the trash, [01:13:58.280 --> 01:14:03.280] but when you file a complaint with the medical board, they don't. [01:14:03.280 --> 01:14:06.280] I have a friend who's a clinical psychologist, [01:14:06.280 --> 01:14:13.280] and he invested some money into a silver deal with a guy who was just a shyster [01:14:13.280 --> 01:14:19.280] and screwed him out of about 20 grand, and he brought me in to help him, [01:14:19.280 --> 01:14:22.280] and we kind of beat the guy up. [01:14:22.280 --> 01:14:28.280] To retaliate, he filed a complaint against him with the American Medical Association, [01:14:28.280 --> 01:14:34.280] and Dr. V said, you would not believe what they put me through. [01:14:34.280 --> 01:14:40.280] His accusation was absolutely false. [01:14:40.280 --> 01:14:44.280] He claimed that he was a patient of the doctor, and the doctor screwed him around. [01:14:44.280 --> 01:14:48.280] He was never a patient of the doctor, and the doctor proved it. [01:14:48.280 --> 01:14:58.280] But he said it cost him about $50,000 just to prove that he didn't do anything wrong. [01:14:58.280 --> 01:15:03.280] So the Medical Association really goes after these guys. [01:15:03.280 --> 01:15:06.280] So you file a complaint with the American Medical Association, [01:15:06.280 --> 01:15:15.280] boy, they'll run him through the wringer, and they won't ever want that to happen again. [01:15:15.280 --> 01:15:25.280] Is there a foundation, I haven't done too much research on how the hospitals treat the family members [01:15:25.280 --> 01:15:31.280] wrongly, accusing the security guards, saying false accusations, [01:15:31.280 --> 01:15:40.280] and there must be like a governing board over hospitals in the U.S. or even just in California. [01:15:40.280 --> 01:15:45.280] I've got to do some research, start making some complaints as well. [01:15:45.280 --> 01:15:49.280] Can you move the microphone a little away from your mouth? [01:15:49.280 --> 01:15:50.280] It's distorting. [01:15:50.280 --> 01:15:51.280] Yeah, sorry. [01:15:51.280 --> 01:15:54.280] Yeah, I'm on this really bad phone. [01:15:54.280 --> 01:15:57.280] Is this better right here? [01:15:57.280 --> 01:15:58.280] I think so. [01:15:58.280 --> 01:16:01.280] Okay, go ahead. [01:16:01.280 --> 01:16:02.280] Okay. [01:16:02.280 --> 01:16:11.280] So going back to the letter, I do need to reply to them, reply to the shysters. [01:16:11.280 --> 01:16:15.280] So I'll just say, you know, go ahead. [01:16:15.280 --> 01:16:20.280] You can file what you want. [01:16:20.280 --> 01:16:24.280] I will be ordering, I don't know about the non-binding mediation. [01:16:24.280 --> 01:16:30.280] I don't need to state anything regarding the non-binding mediation. [01:16:30.280 --> 01:16:42.280] And secondly, I'd like to... [01:16:42.280 --> 01:16:46.280] Wait, I lost you there. [01:16:46.280 --> 01:16:47.280] Kind of cut out. [01:16:47.280 --> 01:16:51.280] We're about to sell our sponsors anyway. [01:16:51.280 --> 01:16:52.280] Okay, hang on. [01:16:52.280 --> 01:17:00.280] Randy Kelton, Brett Fountain, we'll be like that. [01:18:08.280 --> 01:18:10.280] I'd be lost without Logos. [01:18:10.280 --> 01:18:13.280] And I really want to help keep this network on the air. [01:18:13.280 --> 01:18:16.280] And I'd love to volunteer as a show producer, but I'm a bit of a Luddite. [01:18:16.280 --> 01:18:20.280] And I really don't have any money to give because I spent it all on supplements. [01:18:20.280 --> 01:18:22.280] How can I help Logos? [01:18:22.280 --> 01:18:24.280] Well, I'm glad you asked. [01:18:24.280 --> 01:18:27.280] Whenever you order anything from Amazon, you can help Logos. [01:18:44.280 --> 01:18:45.280] No. [01:18:45.280 --> 01:18:47.280] Do I have to do anything different when I order? [01:18:47.280 --> 01:18:48.280] No. [01:18:48.280 --> 01:18:49.280] Can I use my Amazon Prime? [01:18:49.280 --> 01:18:50.280] No. [01:18:50.280 --> 01:18:51.280] I mean, yes. [01:18:51.280 --> 01:18:52.280] Wow. [01:18:52.280 --> 01:18:54.280] Giving without doing anything or spending any money. [01:18:54.280 --> 01:18:55.280] This is perfect. [01:18:55.280 --> 01:18:57.280] Thank you so much. [01:18:57.280 --> 01:18:58.280] We are welcome. [01:18:58.280 --> 01:19:00.280] Happy holidays, Logos. [01:19:00.280 --> 01:19:15.280] This is the Logos Logos Radio Network. [01:19:15.280 --> 01:19:20.280] Ain't gonna blame me. [01:19:20.280 --> 01:19:27.280] Don't blame me. [01:19:27.280 --> 01:19:36.280] Well, ain't gonna fool me with that same old trick again. [01:19:36.280 --> 01:19:41.280] I was blindsided, but now I can see your plans. [01:19:41.280 --> 01:19:46.280] You put the beer in my pocket, took the money from my hand. [01:19:46.280 --> 01:19:55.280] Ain't gonna fool me with that same old trick again. [01:19:55.280 --> 01:20:02.280] Ain't gonna fool me. [01:20:02.280 --> 01:20:03.280] Okay. [01:20:03.280 --> 01:20:04.280] We are back. [01:20:04.280 --> 01:20:10.280] Bradley Kelton, Brett Fountain, Rural World Radio, and we're talking to EJ in California. [01:20:10.280 --> 01:20:15.280] We do have some space on the caller board, so if you have a question or comment, give us a call. [01:20:15.280 --> 01:20:19.280] 512-646-1984. [01:20:19.280 --> 01:20:28.280] Okay, EJ, at the end there, you were distorting so bad I couldn't understand what you were saying. [01:20:28.280 --> 01:20:29.280] Okay. [01:20:29.280 --> 01:20:39.280] I'm responding to the Scheister's letter regarding the motion to compel. [01:20:39.280 --> 01:20:49.280] I'm just going to let them know that they sent it to an incorrect email. [01:20:49.280 --> 01:20:54.280] So it is an insufficient service of process. [01:20:54.280 --> 01:20:56.280] Okay, hold on, hold on. [01:20:56.280 --> 01:20:58.280] Let me address that. [01:20:58.280 --> 01:21:07.280] We have a lot of people in the Patriot movement who look for any tiny little thing they can object to. [01:21:07.280 --> 01:21:19.280] If they sent the notice to the wrong place, but you got notice anyway, the court is going to say you have constructive notice. [01:21:19.280 --> 01:21:28.280] Notice does not go to whether or not the other party did things, gave notice in exactly the right way. [01:21:28.280 --> 01:21:32.280] Notice goes to constructive notice. [01:21:32.280 --> 01:21:38.280] If you found out about it, you don't get to complain about notice, [01:21:38.280 --> 01:21:47.280] but what you can do is notify them that they are sending notice to the wrong place so that in the future [01:21:47.280 --> 01:21:56.280] you can claim that they deliberately gave improper notice. [01:21:56.280 --> 01:22:02.280] At the end of the day, the courts are essentially reasonable, [01:22:02.280 --> 01:22:08.280] and they're not going to split hairs over these minor issues. [01:22:08.280 --> 01:22:11.280] Does that make sense? [01:22:11.280 --> 01:22:12.280] Yes. [01:22:12.280 --> 01:22:15.280] So would this be a good way to respond to them? [01:22:15.280 --> 01:22:20.280] Unfortunately, you are delivering to an incorrect email. [01:22:20.280 --> 01:22:27.280] I'm going to suggest that in respect to the court itself, [01:22:27.280 --> 01:22:35.280] those issues should be addressed with opposing party, perhaps either through a letter or through email. [01:22:35.280 --> 01:22:38.280] Email is probably the best. [01:22:38.280 --> 01:22:41.280] Then if they continue to send it to the wrong address, [01:22:41.280 --> 01:22:48.280] then you can file a motion with the court to order them to give proper service. [01:22:48.280 --> 01:22:53.280] If you go to the court and say they sent it to this wrong place, [01:22:53.280 --> 01:22:58.280] I still get notice of it, but they were technically incorrect. [01:22:58.280 --> 01:23:04.280] The judge is going to say, don't give me a pain in the neck with that irrelevant crap. [01:23:04.280 --> 01:23:12.280] It can just annoy the judges because it's not really relevant or pertinent to the issues before the court. [01:23:12.280 --> 01:23:18.280] But if you give them notice and they deliberately ignore it, then that's pertinent. [01:23:18.280 --> 01:23:19.280] Okay. [01:23:19.280 --> 01:23:21.280] Does that make sense? [01:23:21.280 --> 01:23:22.280] Yes, it makes sense. [01:23:22.280 --> 01:23:23.280] But I'll just let them know. [01:23:23.280 --> 01:23:26.280] Unfortunately, you are delivering to an incorrect email. [01:23:26.280 --> 01:23:28.280] You just need sufficient process of service. [01:23:28.280 --> 01:23:30.280] I'll just let them know. [01:23:30.280 --> 01:23:33.280] I think that's okay to say to them and deliver. [01:23:33.280 --> 01:23:39.280] That is as long as you don't ask the court to get involved. [01:23:39.280 --> 01:23:40.280] Okay, got it. [01:23:40.280 --> 01:23:42.280] Yeah, unless they ignore it. [01:23:42.280 --> 01:23:47.280] When they ignore it, then you can go to the court and register your issue [01:23:47.280 --> 01:23:50.280] and ask the court to order them to give you proper service. [01:23:50.280 --> 01:23:53.280] And that won't be over the court. [01:23:53.280 --> 01:23:56.280] They won't feel like you're splitting minor hairs. [01:23:56.280 --> 01:23:59.280] There's a term called non-s pro-tunk. [01:23:59.280 --> 01:24:08.280] Non-s pro-tunk is like a typo, a non-substantive error. [01:24:08.280 --> 01:24:12.280] It's an error, but it really doesn't have any substance. [01:24:12.280 --> 01:24:14.280] You know, you send it to the wrong address. [01:24:14.280 --> 01:24:18.280] I got it anyway, but I'd rather you send it to this address. [01:24:18.280 --> 01:24:22.280] That goes to the concept of non-s pro-tunk. [01:24:22.280 --> 01:24:31.280] So anytime there's something, a minor issue that really doesn't have any real precedent, [01:24:31.280 --> 01:24:37.280] don't take that to the judge because it'll sound like you're nitpicking. [01:24:37.280 --> 01:24:42.280] And that nitpicking shows disrespect for the court. [01:24:42.280 --> 01:24:44.280] But when you come to the court and say, [01:24:44.280 --> 01:24:49.280] and I've told these guys over and over and it keeps sending them to the wrong place, [01:24:49.280 --> 01:24:53.280] then the judge won't feel like he's being disrespected. [01:24:53.280 --> 01:24:58.280] Then he'll be more likely to sting them. [01:24:58.280 --> 01:25:00.280] That make sense? [01:25:00.280 --> 01:25:15.280] Yes. And then within the letter, I would note that due to the address being wrong, [01:25:15.280 --> 01:25:26.280] it is the incorrect address for another police record, the PMA. [01:25:26.280 --> 01:25:31.280] Well, let me make a suggestion something you could do is when you send them notice, [01:25:31.280 --> 01:25:42.280] spell their names wrong. [01:25:42.280 --> 01:25:47.280] I really like spelling a guy's name wrong. [01:25:47.280 --> 01:25:56.280] Especially if they have names that are, if one little minor spelling makes it sound like something bad. [01:25:56.280 --> 01:26:05.280] There's an attorney that my friend needs help with dealing with this attorney that got pushed on him. [01:26:05.280 --> 01:26:18.280] And it just turns out that one minor letter change makes his last name turd bull. Turd bull. [01:26:18.280 --> 01:26:23.280] That's what he gets on all these documents. [01:26:23.280 --> 01:26:28.280] In the foreclosure, when all this, the foreclosure debacle was going on, [01:26:28.280 --> 01:26:36.280] one of the biggest one was biggest foreclosure meals was daffin frappin and something several others. [01:26:36.280 --> 01:26:45.280] And I used to divide it daffin frappin and kiss my behind. [01:26:45.280 --> 01:26:50.280] That's not something they can complain about, but it gets your point across. [01:26:50.280 --> 01:26:54.280] Fix this. [01:26:54.280 --> 01:27:02.280] My favorite motion I filed, I called the lawyer the shyster. [01:27:02.280 --> 01:27:05.280] The shyster this, shyster that. [01:27:05.280 --> 01:27:11.280] The judge is reading the pleading and you can tell he's trying to keep from chuckling. [01:27:11.280 --> 01:27:20.280] And he said, Mr. Kelton, you don't have the lawyer's name in here. [01:27:20.280 --> 01:27:24.280] Oh, bad judge. Oh, I'm sorry about that. [01:27:24.280 --> 01:27:29.280] I was writing the pleading and I intended to do a search and replace and I just forgot. [01:27:29.280 --> 01:27:35.280] The judge looked at me and said, yes, Mr. Kelton, I'm sure you just forgot. [01:27:35.280 --> 01:27:39.280] But we won't do that again, will we? Oh, no, no, no, absolutely not. [01:27:39.280 --> 01:27:46.280] But you could tell that the judge was tickled by it. [01:27:46.280 --> 01:27:58.280] They're supposed to keep this decorum, but it doesn't hurt on occasion to lighten things up a bit. [01:27:58.280 --> 01:28:01.280] But it reminds them that we're all human beings. [01:28:01.280 --> 01:28:08.280] And if we all come into court and we're all so stoic and deadly serious, [01:28:08.280 --> 01:28:11.280] you get things out of perspective. [01:28:11.280 --> 01:28:16.280] And if you're not, if you can lighten things up with the court a little bit, [01:28:16.280 --> 01:28:21.280] that lets the court know that you're not afraid of them. [01:28:21.280 --> 01:28:27.280] The lawyer is afraid of them, but he's in there dangling by his bar card. [01:28:27.280 --> 01:28:31.280] You're not. [01:28:31.280 --> 01:28:40.280] And if you lighten things up a bit, you never pick on minor unimportant details. [01:28:40.280 --> 01:28:43.280] They could become a problem. You simply mention them. [01:28:43.280 --> 01:28:48.280] But you never make a big deal of minor unimportant details. [01:28:48.280 --> 01:28:55.280] The judge will appreciate that. He will get a feel for your demeanor. [01:28:55.280 --> 01:29:02.280] And they're not supposed to be affected by those kind of things, but human beings are. [01:29:02.280 --> 01:29:10.280] And the best thing I've ever had people do is tell the court that the criticisms are well taken. [01:29:10.280 --> 01:29:16.280] That has had absolutely phenomenal results with judges. [01:29:16.280 --> 01:29:20.280] It just seems to shift gears in the judge. [01:29:20.280 --> 01:29:28.280] And all of a sudden, they're not considering you just a pain in the neck, per se. [01:29:28.280 --> 01:29:33.280] They tend to return the respect that you give them. [01:29:33.280 --> 01:29:36.280] Okay. [01:29:36.280 --> 01:29:38.280] Okay, why not off? [01:29:38.280 --> 01:29:44.280] We've got 23 seconds. We've been having a 17-second clock issue. [01:29:44.280 --> 01:29:49.280] Hang on. We do have some open spaces on our caller board. [01:29:49.280 --> 01:29:53.280] So if you have a question or comment, give us a call. [01:29:53.280 --> 01:30:00.280] 512-646-1984. We'll be right back. [01:30:00.280 --> 01:30:06.280] Sorry, soft drink lovers. Even diet drinks can make you fat. [01:30:06.280 --> 01:30:11.280] A new study shows that diet soda drinkers gain much more weight than people who avoid the stuff. [01:30:11.280 --> 01:30:17.280] I'm Dr. Catherine Albrecht, and I'll be back in a moment with a scoop on supposedly skinny sodas. [01:30:17.280 --> 01:30:22.280] Privacy is under attack. When you give up data about yourself, you'll never get it back again. [01:30:22.280 --> 01:30:27.280] And once your privacy is gone, you'll find your freedoms will start to vanish, too. [01:30:27.280 --> 01:30:32.280] So protect your rights. Say no to surveillance and keep your information to yourself. [01:30:32.280 --> 01:30:35.280] Privacy, it's worth hanging on to. [01:30:35.280 --> 01:30:38.280] This public service announcement is brought to you by StartPage.com, [01:30:38.280 --> 01:30:42.280] the private search engine alternative to Google, Yahoo, and Bing. [01:30:42.280 --> 01:30:45.280] Start over with StartPage. [01:30:45.280 --> 01:30:51.280] Artificial sweeteners cut the calories and help you lose weight, right? Wrong. [01:30:51.280 --> 01:30:56.280] Researchers at UT San Antonio followed hundreds of diet soda drinkers for nearly a decade. [01:30:56.280 --> 01:31:03.280] They found that regularly drinking diet soda expanded people's waistlines five times more than no soda at all. [01:31:03.280 --> 01:31:06.280] The study's authors say artificial sweeteners trigger the appetite, [01:31:06.280 --> 01:31:10.280] but unlike regular sugars, don't deliver anything to squelch it. [01:31:10.280 --> 01:31:16.280] Waking up hunger without satisfying it leads to cravings, which can result in a larger overall calorie intake. [01:31:16.280 --> 01:31:19.280] So use natural sweeteners to maintain a healthy weight, [01:31:19.280 --> 01:31:24.280] but if you need to shed some pounds, avoid the sweet stuff altogether and drink water instead. [01:31:24.280 --> 01:31:30.280] I'm Dr. Catherine Albrecht. More news and information at CatherineAlbrecht.com. [01:31:30.280 --> 01:31:36.280] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11. [01:31:36.280 --> 01:31:38.280] The government says that fire brought it down. [01:31:38.280 --> 01:31:43.280] However, 1,500 architects and engineers concluded it was a controlled demolition. [01:31:43.280 --> 01:31:46.280] Over 6,000 of my fellow service members have given their lives. [01:31:46.280 --> 01:31:48.280] Thousands of my fellow first responders are dying. [01:32:19.280 --> 01:32:22.280] Traffic courts afford us the least expensive opportunity [01:32:22.280 --> 01:32:25.280] to learn how to enforce and preserve our rights through due process. [01:33:05.280 --> 01:33:15.280] LogosRadioNetwork.com [01:33:36.280 --> 01:33:42.280] The wicked come with temptations [01:33:42.280 --> 01:33:47.280] They're trying to buy the whole place [01:33:47.280 --> 01:33:53.280] They want to force the new nation [01:33:53.280 --> 01:33:58.280] Because they've fallen from grace [01:33:58.280 --> 01:34:04.280] I will not drink from that cup [01:34:04.280 --> 01:34:07.280] I just can't act that way [01:34:34.280 --> 01:34:38.280] It's giving me opportunities to talk about things that everybody needs to hear. [01:34:38.280 --> 01:34:45.280] Okay, what else do we need to address for you? [01:34:45.280 --> 01:34:51.280] Where are you now in this process? [01:34:51.280 --> 01:34:58.280] The summary judgment was filed. [01:34:58.280 --> 01:35:07.280] Did you contact the clerk and ask the clerk to set a date for a hearing on your motion for summary judgment? [01:35:07.280 --> 01:35:10.280] Yes, it is calendared. [01:35:10.280 --> 01:35:13.280] That's in August, though. August 1st. [01:35:13.280 --> 01:35:16.280] It's part of California rules. [01:35:16.280 --> 01:35:19.280] We've got to wait like, I think, 90 days. [01:35:19.280 --> 01:35:21.280] That's a long time. [01:35:21.280 --> 01:35:25.280] That's 60 to 90 days. That's about what the... [01:35:25.280 --> 01:35:31.280] Has the opposing party been pushing for discovery in this time period? [01:35:31.280 --> 01:35:33.280] Yes. [01:35:33.280 --> 01:35:41.280] Then you've got an opposition to discovery because the summary judgment motion is dispositive. [01:35:41.280 --> 01:35:44.280] Dispositive. [01:35:44.280 --> 01:35:47.280] I'm sorry, before I miss the D. [01:35:47.280 --> 01:35:53.280] Dispositive in that it will dispose of the case [01:35:53.280 --> 01:36:01.280] to require discovery when there is a summary judgment motion before the court [01:36:01.280 --> 01:36:09.280] would be to subject the litigants to undue cost in providing the discovery [01:36:09.280 --> 01:36:17.280] because if you get a positive ruling on the summary judgment motion, the case is disposed of. [01:36:17.280 --> 01:36:25.280] So it would be judicially inefficient to require discovery when there is a dispositive motion before the court. [01:36:25.280 --> 01:36:27.280] Does that make sense? [01:36:27.280 --> 01:36:35.280] Yes. So file a opposition to discovery. [01:36:35.280 --> 01:36:41.280] Because there is a dispositive motion before the court. [01:36:41.280 --> 01:36:42.280] Okay. [01:36:42.280 --> 01:36:49.280] Ask the court to stay all discovery until the dispositive motion is heard. [01:36:49.280 --> 01:36:53.280] Can you say that one more time? Ask the court to... [01:36:53.280 --> 01:37:06.280] Ask the court to delay or abate any discovery until the dispositive motion is heard [01:37:06.280 --> 01:37:10.280] in the interest of judicial economy. [01:37:10.280 --> 01:37:13.280] Wonderful. Okay. [01:37:13.280 --> 01:37:16.280] These are the words they tend to use. [01:37:16.280 --> 01:37:21.280] Yeah, this is beautiful. This is what I need to hear. [01:37:21.280 --> 01:37:26.280] So I'll just, within the letter, I will say... [01:37:26.280 --> 01:37:33.280] Should I let them know I will be filing an opposition to discovery? [01:37:33.280 --> 01:37:37.280] No, no, no. You don't even want to talk about discovery. [01:37:37.280 --> 01:37:40.280] And that's the whole point. [01:37:40.280 --> 01:37:45.280] We don't even talk about discovery until a dispositive motion is heard. [01:37:45.280 --> 01:37:50.280] Okay. What kind of motion... [01:37:50.280 --> 01:37:54.280] Will that be a motion to the judge? [01:37:54.280 --> 01:38:00.280] Yes. A motion to stay discovery. [01:38:00.280 --> 01:38:02.280] To stay? [01:38:02.280 --> 01:38:09.280] Yes. Stay discovery until the dispositive motion before the court is heard. [01:38:09.280 --> 01:38:14.280] It's a waste of time for you to have to produce discovery. [01:38:14.280 --> 01:38:21.280] You have a motion before the court that if you're ruled in your favor, the issue goes away. [01:38:21.280 --> 01:38:25.280] Yeah, the whole case is over with. There's no need for discovery. [01:38:25.280 --> 01:38:32.280] If that one motion gets heard, then everything goes poof. [01:38:32.280 --> 01:38:45.280] Okay. So that is linked with the police subpoena, the police record subpoena that they just sent me. [01:38:45.280 --> 01:38:53.280] Yeah, a subpoena for discovery, they can wipe you behind with a subpoena for discovery. [01:38:53.280 --> 01:38:56.280] That's a polite request. [01:38:56.280 --> 01:39:05.280] If you ignore the subpoena, then they have to go to the court and get the court to order you to respond to the subpoena. [01:39:05.280 --> 01:39:07.280] So don't worry about that. [01:39:07.280 --> 01:39:14.280] And because you have a dispositive motion before the court, it's inappropriate for them to require discovery. [01:39:14.280 --> 01:39:18.280] They're trying to increase your cost of litigation unnecessarily. [01:39:18.280 --> 01:39:30.280] That's correct. But it looks like it's going to go forward unless I motion to quash five days before May 23rd. [01:39:30.280 --> 01:39:39.280] That's when the litigation support is going to go to the police station and get all records, like seven years of records. [01:39:39.280 --> 01:39:49.280] But that's just, like you said, it's really not to get paid. [01:39:49.280 --> 01:39:55.280] So I do need to do a motion to quash. I need to give them notice to the Scheichters. [01:39:55.280 --> 01:40:02.280] Well, not necessarily at this point a motion to quash, but a motion to stay. [01:40:02.280 --> 01:40:04.280] A motion to stay? [01:40:04.280 --> 01:40:12.280] Just don't ask you. The court's not likely to quash discovery, but stay discovery. [01:40:12.280 --> 01:40:15.280] Just the motion is before the court for discovery. [01:40:15.280 --> 01:40:21.280] Just put a stop on it until the dispositive motion is heard. [01:40:21.280 --> 01:40:29.280] That's heard. If they rule against you, then their motion for discovery is still, it becomes active again. [01:40:29.280 --> 01:40:34.280] They don't have to refile it. [01:40:34.280 --> 01:40:44.280] Even though within the deposition, it's called a, what is this, a subpoena for police records. [01:40:44.280 --> 01:40:56.280] It says unless they see a motion to quash before the five days of May 23rd, this will move forward. [01:40:56.280 --> 01:40:58.280] That's what they said. [01:40:58.280 --> 01:41:05.280] Yeah, what are they going to do move forward? They're going to ask the court to order you to respond. [01:41:05.280 --> 01:41:07.280] Big deal. [01:41:07.280 --> 01:41:16.280] You ask the court to stay all of that, and you want to make requests to the court that are reasonable. [01:41:16.280 --> 01:41:21.280] These guys, they just want to hammer you and cause you as much difficulty as possible. [01:41:21.280 --> 01:41:26.280] So you make requests to the court that are reasonable to stay discovery. [01:41:26.280 --> 01:41:29.280] You have a dispositive motion before the court. [01:41:29.280 --> 01:41:34.280] If ruled in your favor, this issue will be disposed of. [01:41:34.280 --> 01:41:45.280] So it would be inappropriate to force you to incur costs responding to something that could be disposed of. [01:41:45.280 --> 01:41:48.280] So just ask for a stay. [01:41:48.280 --> 01:41:52.280] S-T-A-Y, stay. [01:41:52.280 --> 01:41:54.280] Is that correct? [01:41:54.280 --> 01:42:02.280] And whatever you do, don't get impressed by the crap hole of the lawyer on the other side since, do you? [01:42:02.280 --> 01:42:10.280] They think they're important, and since you're a pro se, they think you'll be impressed with their importance. [01:42:10.280 --> 01:42:16.280] They love to help you understand how important they think they are. [01:42:16.280 --> 01:42:24.280] So if you're not impressed with them, then what are they going to do about it? [01:42:24.280 --> 01:42:35.280] A lot of this, people call in and they think that everything is precisely prescribed in court proceedings. [01:42:35.280 --> 01:42:37.280] That is not the case. [01:42:37.280 --> 01:42:39.280] It's just nothing. [01:42:39.280 --> 01:42:46.280] Things are much too volatile, and they're dependent on circumstances. [01:42:46.280 --> 01:42:51.280] And everything goes to a reasonable person of ordinary prudence. [01:42:51.280 --> 01:42:54.280] So think in terms of what is reasonable. [01:42:54.280 --> 01:43:01.280] These guys want you to produce discovery and say, well, I've got a motion that will make the case go away, [01:43:01.280 --> 01:43:06.280] so it would be inappropriate to force discovery at this point. [01:43:06.280 --> 01:43:16.280] And if it sounds reasonable, the court's likely to rule in your favor. [01:43:16.280 --> 01:43:25.280] A good portion of what I do here really doesn't go to specific rule of law. [01:43:25.280 --> 01:43:29.280] It just goes to good common sense. [01:43:29.280 --> 01:43:35.280] What will work well for the court, what will make the court's job easier? [01:43:35.280 --> 01:43:43.280] Because most of what goes on here is not precisely prescribed. [01:43:43.280 --> 01:43:44.280] It's not that hard. [01:43:44.280 --> 01:43:45.280] Hang on. [01:43:45.280 --> 01:44:00.280] You have to go to our sponsors, Randy Kelton, Brett Fountain, rule of law radio, and we'll be right back. [01:46:01.280 --> 01:46:23.280] Well, you know karma is lurking around the corner. You'd better watch your baby and tell him to take it, and he can tell you to follow you. Yeah, baby Jerry, sing reality. [01:46:23.280 --> 01:46:37.280] Okay, karma is lurking around the corner. Sing, Jerry, come back. [01:46:37.280 --> 01:46:43.280] Okay, we are back. I'm Joe Brett Fountain with Rule of Law Radio, and we're talking to EJ in Texas. [01:46:43.280 --> 01:46:49.280] EJ, have you addressed all of your issues today? [01:46:49.280 --> 01:47:11.280] One more question then, motion to stay. Instead of doing the motion to quash the police report, the subpoena police report, or the motion to strike the answer, I can do motion to stay instead. [01:47:11.280 --> 01:47:26.280] Yeah, okay. Those two pieces didn't fit together. Motion to strike the answer. I understood that you didn't have an answer. [01:47:26.280 --> 01:47:34.280] Their answer, the striker's answer, they answered after 30 days. [01:47:34.280 --> 01:47:38.280] Oh, so they didn't answer timely. [01:47:38.280 --> 01:47:41.280] Correct. It was untimely. [01:47:41.280 --> 01:47:51.280] Absolutely. Motion to strike their answer, and that would support your motion for summary judgment. [01:47:51.280 --> 01:47:53.280] Okay, wonderful. I think I got it. [01:47:53.280 --> 01:48:02.280] You can't go for the summary judgment if there is an answer. First, you have to get rid of the answer. [01:48:02.280 --> 01:48:11.280] So, first, a motion to stay, discovery, and a motion to strike your answer is untimely. [01:48:11.280 --> 01:48:16.280] That's untimely. Got it. Thank you so much. Thank you. [01:48:16.280 --> 01:48:19.280] Okay, keep up the good work, EJ. [01:48:19.280 --> 01:48:24.280] Thank you. [01:48:24.280 --> 01:48:33.280] Okay, now we're going to Bina in California. Hello, Bina. What do you have for us today? [01:48:33.280 --> 01:48:41.280] Hey there, Randy and Brett. Since you didn't have any callers, I figured I'd call in. [01:48:41.280 --> 01:48:44.280] Great. [01:48:44.280 --> 01:48:57.280] I've been working my way through just a pile of California things, and one that I have not called in about is an assault. [01:48:57.280 --> 01:49:05.280] I was assaulted by an individual two years ago, and I sustained an injury. [01:49:05.280 --> 01:49:11.280] They stuck me in the head with an object that they threw at me. [01:49:11.280 --> 01:49:17.280] This was sort of the culmination of... Wait, wait, wait. Who threw at you? [01:49:17.280 --> 01:49:39.280] My assaulter attacked me one day and hurled a glass solid object and struck me in my head as I was trying to escape their attack, basically. [01:49:39.280 --> 01:49:43.280] Wow. So sorry. [01:49:43.280 --> 01:49:59.280] You know, thank you, Brett. It took some time to get past the trauma of what happened, but I will say that there's something in me that finds a way to push through things that I survive, obviously. [01:49:59.280 --> 01:50:14.280] And it propelled me out of a very toxic environment. My way of looking at it was I sort of... I escaped purgatory and I went to Eaton. [01:50:14.280 --> 01:50:29.280] You know, the short of it was I lost my apartment and someone that I knew had space available in their home, so they rented the space to me. [01:50:29.280 --> 01:50:36.280] This person was the recipient of county in-home care services. [01:50:36.280 --> 01:50:44.280] It was their county in-home care provider who assaulted me. [01:50:44.280 --> 01:50:53.280] The very first day this individual met me, I was greeted with this hostile barrage where they literally threatened to quit the job. [01:50:53.280 --> 01:51:04.280] I was given a tandem parking space, and so when they arrived at work that day and saw my vehicle parked there, so began the saga. [01:51:04.280 --> 01:51:18.280] I was there for a year and a half, and about, I guess, a month and a half in, I realized that I was dealing with somebody that was emotionally imbalanced. [01:51:18.280 --> 01:51:24.280] And so I treated it like détente, and I said absolutely nothing to this individual. [01:51:24.280 --> 01:51:36.280] I would conduct whatever I needed to do in the kitchen area prior to their morning arrival because, you know, it's just not my manner to be confrontational. [01:51:36.280 --> 01:51:39.280] I want to leave people alone. [01:51:39.280 --> 01:51:48.280] Well, on the day of the attack, well, there is an important interim thing that transpired. [01:51:48.280 --> 01:51:58.280] I reported this individual to the county since they are a county worker when they had thrown away property that belonged to me. [01:51:58.280 --> 01:52:07.280] And it appeared that this person was also padding their hours because I lived there, obviously, and I knew what kind of cleaning needed to be done. [01:52:07.280 --> 01:52:14.280] And this person would spend five and six hours there when there would be two dishes in the sink or things like that. [01:52:14.280 --> 01:52:17.280] So anyway, I reported them to the county. [01:52:17.280 --> 01:52:21.280] I imagine the county let them know of this report. [01:52:21.280 --> 01:52:30.280] From that time going forward, and that would have been September 2019, the hostilities just mounted. [01:52:30.280 --> 01:52:34.280] So fast forward to April of 2020. [01:52:34.280 --> 01:52:43.280] We are now in the grips of COVID, and this person kind of greeted me one day. [01:52:43.280 --> 01:52:53.280] That morning I had an appointment. I went out to meet my person who was coming to do some service work to my car. [01:52:53.280 --> 01:52:55.280] We ended up rescheduling. [01:52:55.280 --> 01:53:07.280] I went back in, reset, grabbed my things with the intention of going to meet up with a classmate because I work and I was taking professional development classes as well. [01:53:07.280 --> 01:53:21.280] When I came out of my room, this county worker was standing opposite my room door, arms akimbo, in a very defensive stance. [01:53:21.280 --> 01:53:32.280] Because I didn't say anything to this person, I just treated it like just another day where I'm dealing with this person and it's like, okay. [01:53:32.280 --> 01:53:45.280] I want to let the person who rents me the room aware of what was going on because I would just hand off this person's craziness to the person renting me the room. [01:53:45.280 --> 01:53:49.280] Because when I say I said nothing to them, I literally would say nothing to them. [01:53:49.280 --> 01:53:53.280] When I went to the individual's room, he was not there. [01:53:53.280 --> 01:54:00.280] The light was on and the county worker yelled behind me, he's not there. [01:54:00.280 --> 01:54:17.280] So when I exited his room, she, my attacker, had scissors in her hand and was reenacting or pantomiming, I guess I could say, because she did not stab me. [01:54:17.280 --> 01:54:27.280] But she had scissors in her hand and thrusting the scissors as though she was going to stab me in my head, kind of like a la, what's this, the movie Fatal Attraction? [01:54:27.280 --> 01:54:32.280] Remember the Glenn Close scene? That's what I was looking at. [01:54:32.280 --> 01:54:39.280] In that moment, I could not believe what I was seeing and I'm thinking, is this really happening? [01:54:39.280 --> 01:54:50.280] And I'm looking up at scissors coming down toward my, the crown of my head and I'm thinking, this is really happening and you need to take this seriously. [01:54:50.280 --> 01:54:57.280] So I attempted to grab her wrist to stop the thrust, but I couldn't. [01:54:57.280 --> 01:55:04.280] And so at that point, I tried to get away and she grabbed the dress that I was wearing, I could hear the threads snap. [01:55:04.280 --> 01:55:14.280] She had cleaning fluid, she started spraying that at me, some of it, you know, sort of, you know, landed on my face to my shoulder. [01:55:14.280 --> 01:55:15.280] Wow. [01:55:15.280 --> 01:55:21.280] Yeah, even talking about it, it just gives me pause, it's still so incredible. [01:55:21.280 --> 01:55:27.280] I had flip-flops on, I had a dress, I had a little tote that I carry my things in. [01:55:27.280 --> 01:55:31.280] I had my purse, so I certainly was not dressed for combat. [01:55:31.280 --> 01:55:46.280] Okay. Well, she must have released me because I was able to run back toward my room door, which may have been all of seven feet away from where all this was happening. [01:55:46.280 --> 01:56:01.280] I got to the door and the knob was on the left, so my body was perpendicular to the door and my left temple faced her. [01:56:01.280 --> 01:56:03.280] So I'm perpendicular to the door. [01:56:03.280 --> 01:56:11.280] She starts screaming like a banshee and grabbing all the tchotchkes that were in the room and just starts hurling them at me. [01:56:11.280 --> 01:56:20.280] And she picks up a solid glass globe, it might have been a four or five inch diameter object, and hurled it at me. [01:56:20.280 --> 01:56:29.280] And I got to give her credit for her pitch, but she struck me right in the temple of my head before I was able to get back into the room. [01:56:29.280 --> 01:56:31.280] I was shocked by what had just happened. [01:56:31.280 --> 01:56:42.280] I could hear all the ringing in my head and I got behind the door in shock and an utter disbelief at what had just happened. [01:56:42.280 --> 01:56:47.280] I braced the door with my body because there was no lock on it. [01:56:47.280 --> 01:57:03.280] And I immediately called 911 and I said, I've been attacked, and she's on the opposite side of the door literally yelling like a banshee indecipherably. [01:57:03.280 --> 01:57:05.280] I didn't know what to do. [01:57:05.280 --> 01:57:07.280] The 911 tells me, stay there. [01:57:07.280 --> 01:57:11.280] I told them that there's a security code to get into the property and they said, don't worry about it. [01:57:11.280 --> 01:57:13.280] We'll call you when we get there. [01:57:13.280 --> 01:57:17.280] And so I told them I didn't know the bypass code for the gate. [01:57:17.280 --> 01:57:20.280] And I said, we'll just call you when we're there. [01:57:20.280 --> 01:57:24.280] So for 20, 30 minutes, that's all I could do. [01:57:24.280 --> 01:57:26.280] My body was against that door. [01:57:26.280 --> 01:57:28.280] I'm hyperventilating. [01:57:28.280 --> 01:57:34.280] My blood pressure had probably raised over 200. [01:57:34.280 --> 01:57:37.280] Every sound I heard unnerved me more. [01:57:37.280 --> 01:57:39.280] I didn't know where she was. [01:57:39.280 --> 01:57:41.280] I didn't know what was going on. [01:57:41.280 --> 01:57:46.280] The man, the elderly person renting me the room still wasn't there. [01:57:46.280 --> 01:57:49.280] I texted him and told him what had just happened. [01:57:49.280 --> 01:57:51.280] He never responded. [01:57:51.280 --> 01:58:00.280] Eventually, he comes back and when I heard the door open, I peeked out. [01:58:00.280 --> 01:58:04.280] All he says to me is, I need to speak to you. [01:58:04.280 --> 01:58:07.280] And I just said, I'm not talking to you. [01:58:07.280 --> 01:58:08.280] I closed the door. [01:58:08.280 --> 01:58:14.280] 911 calls me back and they say her name when they call my phone. [01:58:14.280 --> 01:58:19.280] And I thought, really? [01:58:19.280 --> 01:58:26.280] What I learned was she phoned 911, accusing me of assaulting and attacking her. [01:58:26.280 --> 01:58:31.280] Absolute untrue. [01:58:31.280 --> 01:58:38.280] I told them I was the individual and then they sort of corrected themselves and said, [01:58:38.280 --> 01:58:40.280] well, you know, the officers are there.
