[20:21.080 --> 20:26.920] Oh yeah, a little bit. He said, well, Mr. Kelton, he went there, gave him a license. [20:26.920 --> 20:37.800] You know, you were speeding and changing lanes without a blinker and weaving in and out. [20:37.800 --> 20:43.400] I wouldn't show him proof of insurance. And I talked to him a bit and he said, you sound [20:43.400 --> 20:48.920] like someone else I pulled over. I said, was his name Scott Richardson? No, no, no. I think [20:48.920 --> 20:55.360] it started with an F. Oh, Brett Fountain. Yeah, that's the one. Well, yeah, he's my [20:55.360 --> 21:06.720] co-host. And he started getting a bit agitated. So I took, so I was annoying him and I have [21:06.720 --> 21:11.400] a way of doing that. I pulled out my cell phone and he said, you need to put that phone [21:11.400 --> 21:18.120] down while I'm talking to you. And I said, no, I think I need to call 911. You appeared [21:18.120 --> 21:23.280] to be getting agitated and I'm afraid for my safety. I'm concerned that I need to get [21:23.280 --> 21:29.960] someone out here to get you in control. Do I need to get you in control? He took a step [21:29.960 --> 21:34.280] back and he raised up so his head was above the window and I couldn't see him. But I heard [21:34.280 --> 21:39.000] him take a real deep breath and exhale. He leaned back down, looked in the window and [21:39.000 --> 21:45.520] said, no, Mr. Kelton, you do not need to call 911. And from that point on, he did write [21:45.520 --> 21:57.000] me a ticket, a couple of them, but he gathered up his professionalism and continued and handled [21:57.000 --> 22:04.600] himself like a professional. And I can't ask anything more from a policeman. I don't ask [22:04.600 --> 22:12.200] him not to write me a ticket. I only ask them to conduct themselves with dignity and respect. [22:12.200 --> 22:18.400] And everybody I talked to in Rome conducted themselves with dignity and respect. Clearly [22:18.400 --> 22:29.000] I was annoying this peace officer. I could feel his tension, but the only indication [22:29.000 --> 22:37.920] I got was body language. I did not get any indication from his voice, demeanor or behavior. [22:37.920 --> 22:43.320] And that I appreciate. That's the kind of policeman I want. That's the kind of policeman [22:43.320 --> 22:49.520] if I need someone with a pistol on their hip, I want them to send him because I'm not afraid [22:49.520 --> 22:56.600] he'll freak out and shoot me. I think we've all seen the video of the police officer saw [22:56.600 --> 23:04.520] someone kneeling down, taking photos of his stop and he freaked out and had a panic attack [23:04.520 --> 23:10.640] and shot several times that the guy fortunately didn't hit him. But that's not the kind of [23:10.640 --> 23:16.320] police officer I want to run around with a pistol on a hip. The kind of policemen I want [23:16.320 --> 23:21.800] with a pistol on his hip are the kind that when I annoy them and when I do things that [23:21.800 --> 23:31.000] act as pattern interruptions, interrupt their expectations, their hand doesn't go to their [23:31.000 --> 23:39.160] pistol. Like the little guy in the Travis County courthouse who, when I asked him to [23:39.160 --> 23:44.320] go get this clerk and have her come down because I'm not going to go wear a mask in the courthouse, [23:44.320 --> 23:50.320] the one that looked up at me, little short guy and said, was that an order? I thought [23:50.320 --> 23:56.400] a minute. Yes, matter of fact, it is. She said, how's that worked out for you so far? [23:56.400 --> 24:02.440] I leaned over him and looked down at him and said, pretty good. You want to, you want to [24:02.440 --> 24:09.880] test it? He said, yes, I do. Well, wait right there. Don't go anywhere. Someone's going [24:09.880 --> 24:15.080] to want to talk to you, Bubba. And I walked back about five or six feet, took out my cell [24:15.080 --> 24:21.440] phone and dialed 911. And he came over and said, you can't use a cell phone here. You'll [24:21.440 --> 24:27.080] have to go outside. I said, are you going to interfere with a 911 call? And he had his [24:27.080 --> 24:31.920] hand on his pistol, had his thumb hanging over his pistol. And I said, get your hand [24:31.920 --> 24:37.280] off that pistol. He snatched his hand off that pistol like it was on fire. And one of [24:37.280 --> 24:43.600] the other bailiffs come in and pulled him away. The other bailiff knew who I was. I [24:43.600 --> 24:49.240] didn't recognize him, but he knew who I was because I had taken him to the local district, [24:49.240 --> 24:54.840] district, I'm sorry, the local justice of the peace and asked him to arrest the JP. [24:54.840 --> 25:01.280] This was back when I was getting the, all of the judges of the court of criminal appeals [25:01.280 --> 25:09.200] put before a grand jury. That was in 2008. So he knew who I was, but this, and this guy [25:09.200 --> 25:15.560] never did. He was the kind of policeman I like. He never lost his cool. It was clear [25:15.560 --> 25:20.840] to him, to me not to mess with this guy because he's a pro. You're not going to get him to [25:20.840 --> 25:24.800] do anything stupid. If you give him a shot at you, he's going to arrest you and he's [25:24.800 --> 25:29.520] going to have a good one. So these are the kind I like. They don't have to do what I [25:29.520 --> 25:35.760] want to. Just do what they swore, though, if they would do. And so far with Rome, I've [25:35.760 --> 25:43.600] gotten that and real pleased with what I got. The clear, you know, reasonably the chief [25:43.600 --> 25:50.620] of police did not want to process a criminal complaint against one of his officers for [25:50.620 --> 25:56.960] doing what he had directed the officer to do because that was my complaint. Not that [25:56.960 --> 26:06.880] he did anything ignorant or aggressive, but that he followed policy. And the chief was, [26:06.880 --> 26:13.200] he called me today and we got a conversation. He was clearly not happy. And finally, in [26:13.200 --> 26:18.600] a bit of frustration, he just said, send me the complaint. And I said, I will be glad [26:18.600 --> 26:27.360] to do that. And if I don't find that a warrant has been issued within seven or 10 days, then [26:27.360 --> 26:34.360] I will be back to take the next step. And that was a provocation to him and he did not [26:34.360 --> 26:44.120] bite. He held his tongue. I was real pleased with him. So I'm charging the officer with [26:44.120 --> 26:53.560] first degree felony aggravated assault. I will, if the chief does not give out my complaint [26:53.560 --> 27:01.800] to some magistrate, then I'll file against the chief for an act in concert and collusion [27:01.800 --> 27:07.000] with aggravated, first degree felony aggravated assault and shielding from prosecution, which [27:07.000 --> 27:14.080] in this case will be a second degree felony. And I'll file that with their local municipal [27:14.080 --> 27:23.040] judge. And we'll see what he does with it. And by talking to the police and telling them [27:23.040 --> 27:32.200] exactly what I want them to do, I quoted to the chief 15.09, the one that directs a magistrate [27:32.200 --> 27:40.280] when they're, a complaint is forwarded to them that they are to issue a warrant. What [27:40.280 --> 27:51.360] is, must issue a warrant. You're talking about 15.09? Yeah. So issue a, oh, forthwit, forthwit. [27:51.360 --> 27:58.480] That's what it's looking for. So issue a warrant forthwit. And when the municipal judge does [27:58.480 --> 28:06.280] an issue a warrant forthwit, each step up the line gives me a bigger fish and a more [28:06.280 --> 28:17.240] vulnerable fish. When he does an issue a warrant under 15.09, that is an administrative act [28:17.240 --> 28:23.240] like 2.13 that directs a peace officer when he has it made known to him that a crime's [28:23.240 --> 28:29.120] been committed. He's to give notice to some magistrate. That's administrative. That's [28:29.120 --> 28:37.680] not something over which he has discretion. And since it's administrative, there is no [28:37.680 --> 28:47.960] immunity for that. The judge, when he's required to perform an act where he has no discretion, [28:47.960 --> 28:54.680] that's an administrative act. And it falls outside the scope of his judicial capacity [28:54.680 --> 29:02.840] and he has no immunity for that. I can come back and sue them personally. And if the city [29:02.840 --> 29:09.800] attempts to pay for their lawyer, then I'll charge them with misappropriation of public [29:09.800 --> 29:17.160] funds. Yeah, right on. And sue the lawyer. Yeah, of course, the standard bar grieve the [29:17.160 --> 29:27.000] lawyer. I was going to send a T. Cole complaint against this officer, but I'm conflicted. [29:27.000 --> 29:36.640] Well, if the officer had broken protocol for just one instance, I would have felt better [29:36.640 --> 29:43.200] about it. But I poked him and gouged him and annoyed him and irritated him. And he really [29:43.200 --> 29:51.400] handled himself well. And I don't think that I have it in me to sting his career when he's [29:51.400 --> 29:58.160] following policy. Now, I might do that to the chief, because the chief said the policies. I've helped a lot of people with foreclosure [01:04:46.640 --> 01:04:51.640] Man, I could have kept her in that house for eight to ten years [01:04:51.640 --> 01:04:54.640] It's way too easy [01:04:54.640 --> 01:05:05.640] I've got a question. She has a reason that she believes that the eviction order was void [01:05:05.640 --> 01:05:13.640] I guess she has an appeal of restitution. It was on appeal [01:05:13.640 --> 01:05:21.640] I don't know how far that got, but I know that she did appeal it [01:05:21.640 --> 01:05:28.640] And the judge at the hearing for the writ of restitution did make a procedural error [01:05:28.640 --> 01:05:33.640] But she failed to put that in her appeal to the appellate court [01:05:33.640 --> 01:05:36.640] And she waived it [01:05:36.640 --> 01:05:44.640] I think it got returned, but she's doing all these things and she doesn't understand how all of it works [01:05:44.640 --> 01:05:51.640] By the time I got her paperwork, I told her, I said, well, you didn't even put the statute in there [01:05:51.640 --> 01:05:56.640] The judge literally did exactly what the statute tells her not to do [01:05:56.640 --> 01:06:01.640] And it was almost like a knockout of the park [01:06:01.640 --> 01:06:03.640] She should have won the appeal [01:06:03.640 --> 01:06:07.640] But I don't know what happened beyond when they [01:06:07.640 --> 01:06:15.640] What is the status of the appeal at the moment? [01:07:43.640 --> 01:07:47.640] Good faith estimate [01:07:47.640 --> 01:07:50.640] There's another one [01:07:50.640 --> 01:07:54.640] I've lost it for the moment [01:07:54.640 --> 01:07:56.640] There's a [01:07:56.640 --> 01:07:58.640] One they always get messed up [01:07:58.640 --> 01:08:00.640] I'll think of it in a second [01:08:00.640 --> 01:08:02.640] It's been a while since I've done foreclosures [01:08:02.640 --> 01:08:03.640] Did over 700 of them [01:08:03.640 --> 01:08:05.640] I shouldn't forget any of this [01:08:05.640 --> 01:08:09.640] But I can always get a claim against the lender [01:08:09.640 --> 01:08:13.640] For two to three times the amount of the original mortgage [01:08:13.640 --> 01:08:17.640] But it looks like she has done a lot of litigation [01:08:17.640 --> 01:08:20.640] It sounds like she should have known better [01:08:20.640 --> 01:08:23.640] If she got to this point [01:08:23.640 --> 01:08:27.640] They would have given her notice to vacate [01:08:27.640 --> 01:08:30.640] That they were coming to evict [01:08:30.640 --> 01:08:33.640] She should have ran to the bankruptcy court [01:08:33.640 --> 01:08:35.640] And filed bankruptcy under Chapter 7 [01:08:35.640 --> 01:08:38.640] And claimed the property as unsecured [01:08:38.640 --> 01:08:40.640] We had a [01:08:40.640 --> 01:08:43.640] I had a guy go to the court at 9 o'clock [01:08:43.640 --> 01:08:45.640] And file bankruptcy [01:08:45.640 --> 01:08:48.640] The constable got there at 10 o'clock [01:08:48.640 --> 01:08:51.640] And threatened to shoot the guy's dogs [01:08:51.640 --> 01:08:55.640] If he didn't get them up so he could evict them [01:08:55.640 --> 01:08:57.640] And he told the guy that [01:08:57.640 --> 01:08:59.640] He filed bankruptcy with the federal court [01:08:59.640 --> 01:09:01.640] In his federal stay [01:09:01.640 --> 01:09:03.640] The constable told him [01:09:03.640 --> 01:09:05.640] He didn't care what there was [01:09:05.640 --> 01:09:07.640] He's there to evict [01:09:07.640 --> 01:09:09.640] And the guy called me [01:09:09.640 --> 01:09:11.640] And I told him to call the sheriff [01:09:11.640 --> 01:09:13.640] The sheriff called the constable [01:09:13.640 --> 01:09:18.640] And the sheriff talked the constable out of being more ignorant than he was [01:09:18.640 --> 01:09:21.640] And then they had a hearing [01:09:21.640 --> 01:09:25.640] With the federal judge over the attempt to evict [01:09:25.640 --> 01:09:27.640] And the federal judge said [01:09:27.640 --> 01:09:35.640] Who was it that threatened to shoot this man's dog in defiance of my stay? [01:09:35.640 --> 01:09:37.640] It was a telephone conference [01:09:37.640 --> 01:09:40.640] And he said it got real quiet on there [01:09:40.640 --> 01:09:42.640] I bet [01:09:42.640 --> 01:09:44.640] You file a bankruptcy [01:09:44.640 --> 01:09:47.640] It stops everything immediately [01:09:47.640 --> 01:09:50.640] That would have stopped this [01:09:50.640 --> 01:09:55.640] Who is advising this woman? [01:09:55.640 --> 01:09:58.640] This has been going on for so long [01:09:58.640 --> 01:10:00.640] I think at one time she did file for bankruptcy [01:10:00.640 --> 01:10:02.640] And this is a hard money lender [01:10:02.640 --> 01:10:04.640] And I think that hard money lender came in [01:10:04.640 --> 01:10:07.640] And it did something after the bankruptcy [01:10:07.640 --> 01:10:13.640] But this is so far ago that I don't have detailed knowledge [01:10:13.640 --> 01:10:15.640] Right off the top [01:10:15.640 --> 01:10:17.640] I tried to explain to her [01:10:17.640 --> 01:10:20.640] She should have left [01:10:20.640 --> 01:10:22.640] She did get notice of the eviction [01:10:22.640 --> 01:10:24.640] Even though she didn't tell me [01:10:24.640 --> 01:10:28.640] I knew that they didn't just show up out of the blue [01:10:28.640 --> 01:10:32.640] And this is one thing that everybody needs to be warned of [01:10:32.640 --> 01:10:36.640] When someone comes to you for your help [01:10:36.640 --> 01:10:39.640] They never tell you everything [01:10:39.640 --> 01:10:43.640] And it's not always intentional [01:10:43.640 --> 01:10:47.640] They come to you and they want to solicit your help [01:10:47.640 --> 01:10:51.640] So their inner mind tends to deliver up [01:10:51.640 --> 01:10:55.640] What they need to get you to help them [01:10:55.640 --> 01:10:59.640] It doesn't deliver up the bad stuff [01:10:59.640 --> 01:11:01.640] That comes out later [01:11:01.640 --> 01:11:04.640] And there's this notion that [01:11:04.640 --> 01:11:08.640] If they tell you the bad stuff you won't help them [01:11:08.640 --> 01:11:10.640] But that's not the way it is [01:11:10.640 --> 01:11:12.640] If you're helping other people do this stuff you understand [01:11:12.640 --> 01:11:15.640] I don't care what you did [01:11:15.640 --> 01:11:18.640] I need to know what went on so I can craft a remedy [01:11:18.640 --> 01:11:20.640] It doesn't matter what you did [01:11:20.640 --> 01:11:24.640] But you gotta tell me or I can't craft you a remedy for it [01:11:24.640 --> 01:11:26.640] But they forget to tell me [01:11:26.640 --> 01:11:28.640] And it's not always their fault [01:11:28.640 --> 01:11:31.640] You get in these fights [01:11:31.640 --> 01:11:36.640] And they're extremely emotional [01:11:36.640 --> 01:11:42.640] People get PTSD [01:11:42.640 --> 01:11:46.640] They tend to move from one emotional high point to the next [01:11:46.640 --> 01:11:48.640] To the next, to the next [01:11:48.640 --> 01:11:53.640] One of the problems I have with people in these circumstances [01:11:53.640 --> 01:12:01.640] Is they don't have a well defined ultimate outcome [01:12:01.640 --> 01:12:04.640] You have to know where you're going [01:12:04.640 --> 01:12:07.640] If you don't know where you're going you can almost be certain [01:12:07.640 --> 01:12:11.640] You will wind up somewhere else [01:12:11.640 --> 01:12:14.640] Like Martin Luther King said [01:12:14.640 --> 01:12:18.640] Keep your eye on the prize [01:12:18.640 --> 01:12:20.640] They'll push you one way and another way [01:12:20.640 --> 01:12:24.640] And if you're responding to these different issues [01:12:24.640 --> 01:12:28.640] And you don't have your intended outcome clearly focused [01:12:28.640 --> 01:12:32.640] They will run you down one rabbit trail after another [01:12:32.640 --> 01:12:35.640] You have helped more than one person [01:12:35.640 --> 01:12:41.640] Who was fighting an issue that was absolutely irrelevant [01:12:41.640 --> 01:12:43.640] But they were so angry [01:12:43.640 --> 01:12:48.640] It becomes about the fight and not about the outcome [01:12:48.640 --> 01:12:50.640] Good illustration [01:12:50.640 --> 01:12:54.640] A friend of mine was helping some people in Pennsylvania with taxes [01:12:54.640 --> 01:12:59.640] They sent them to the next door neighbor to help them with tax liens [01:12:59.640 --> 01:13:01.640] So they gave her a copy of the tax liens [01:13:01.640 --> 01:13:03.640] And she said, do you want to get rid of these liens? [01:13:03.640 --> 01:13:04.640] And they said, yes we do [01:13:04.640 --> 01:13:07.640] She ripped them up and threw them in the trash [01:13:07.640 --> 01:13:08.640] What? [01:13:08.640 --> 01:13:12.640] She said, look, these liens expired two years ago [01:13:12.640 --> 01:13:16.640] And the IRS did not reinstate them [01:13:16.640 --> 01:13:18.640] So what did they do? [01:13:18.640 --> 01:13:22.640] They wrote a scathing letter to the IRS [01:13:22.640 --> 01:13:26.640] So what do you think the IRS did? [01:13:26.640 --> 01:13:29.640] They reinstated the liens [01:13:29.640 --> 01:13:32.640] It became about the fight [01:13:32.640 --> 01:13:36.640] They lost their direction [01:13:36.640 --> 01:13:40.640] If their intent was to retain the property [01:13:40.640 --> 01:13:46.640] Everything they did should be filtered through that intent [01:13:46.640 --> 01:13:51.640] It will keep you well tracked [01:13:51.640 --> 01:13:57.640] They are all very good at sending you down rabbit holes [01:13:57.640 --> 01:13:59.640] When I was helping people with foreclosures [01:13:59.640 --> 01:14:03.640] There were all kinds of issues I could go after them with [01:14:03.640 --> 01:14:05.640] But most of them didn't matter [01:14:05.640 --> 01:14:08.640] Even if I wanted I didn't get anywhere [01:14:08.640 --> 01:14:10.640] So who cares? [01:14:10.640 --> 01:14:17.640] I've had a number of times that I've answered motions or pleadings [01:14:17.640 --> 01:14:20.640] Where there's only one issue that I answered [01:14:20.640 --> 01:14:24.640] The rest of them I put in there in the court that these are irrelevant [01:14:24.640 --> 01:14:28.640] It doesn't matter one way or the other so I won't even bother with them [01:14:28.640 --> 01:14:31.640] And courts appreciate that [01:14:31.640 --> 01:14:37.640] And the lawyer on the other side gets the idea that these folks know what they're doing [01:14:37.640 --> 01:14:40.640] Then they get more careful [01:14:40.640 --> 01:14:46.640] It sounds like you have someone who's been in the fight too long [01:14:46.640 --> 01:14:48.640] It's not about the fight [01:14:48.640 --> 01:14:52.640] It's not about the outcome, it's about the fight [01:14:52.640 --> 01:14:57.640] One thing that seems to be another common misconception [01:14:57.640 --> 01:15:00.640] People get their eyes off of what's going on [01:15:00.640 --> 01:15:06.640] Is when they can't seem to distinguish [01:15:06.640 --> 01:15:10.640] Getting themselves off the hook for what they're being accused of [01:15:10.640 --> 01:15:13.640] Like this lady accused of assault [01:15:13.640 --> 01:15:21.640] She can't focus on the specific cold hard facts that go to that [01:15:21.640 --> 01:15:25.640] Because she's so concerned with everything went wrong [01:15:25.640 --> 01:15:29.640] It was completely wrong for somebody to do this and to do that [01:15:29.640 --> 01:15:34.640] And so they imagine that just by being able to point the finger at somebody else [01:15:34.640 --> 01:15:38.640] That's automatically going to get them off the hook [01:15:38.640 --> 01:15:40.640] Yes, that's not the case [01:15:40.640 --> 01:15:48.640] The best thing she could do about the trespass is throw herself on the mercy of the court [01:15:48.640 --> 01:15:54.640] The court understands how traumatic it is to get thrown out of your home [01:15:54.640 --> 01:15:57.640] And ask the court to forgive her [01:15:57.640 --> 01:16:02.640] Fight what you can win, don't fight what you can't win [01:16:02.640 --> 01:16:10.640] Then go after the officers for excessive use of force [01:16:10.640 --> 01:16:13.640] But I can't speak to the foreclosure [01:16:13.640 --> 01:16:18.640] Nowhere near enough information [01:16:18.640 --> 01:16:25.640] I think I'm trying to convince her to drop the foreclosure [01:16:25.640 --> 01:16:29.640] She's been in this for so long [01:16:29.640 --> 01:16:31.640] I mean years [01:16:31.640 --> 01:16:34.640] And I've only been trying to help her not too long ago [01:16:34.640 --> 01:16:36.640] She's got to give it up [01:16:36.640 --> 01:16:39.640] But now she's battling this [01:16:39.640 --> 01:16:43.640] If she had the ability to fight the foreclosure [01:16:43.640 --> 01:16:45.640] She's better off doing it without all these charges [01:16:45.640 --> 01:16:49.640] I wish she would have just left [01:16:49.640 --> 01:16:52.640] She may have gained the most she can gain [01:16:52.640 --> 01:16:57.640] When people come to me during the foreclosure crisis [01:16:57.640 --> 01:16:59.640] I would tell them [01:16:59.640 --> 01:17:04.640] Are you being harassed by debt collectors with phone calls, letters or even lawsuits? And then they'd change a couple of issues, [01:20:57.920 --> 01:21:03.440] or a couple of facts on the mortgage, and they'd sell it to somebody else. And each time they sold [01:21:03.440 --> 01:21:10.880] it, they would get a mortgage insurance policy on it that would pay 85% of the mortgage. In [01:21:10.880 --> 01:21:15.920] the event of a foreclosure. Oh, that doesn't sound like fraud at all. [01:21:18.160 --> 01:21:21.600] But they bought all the judges. The judges are pretty well bought and paid for, [01:21:22.320 --> 01:21:29.360] and they have enough money. Like Miss Patty, if they sold her mortgage 40 or 50 times, [01:21:29.920 --> 01:21:36.080] they don't care what they have to spend to get a foreclosure. If they can't get a foreclosure, [01:21:36.080 --> 01:21:44.240] they're going to have to pay back all of these company, these investors that bought a copy of [01:21:44.240 --> 01:21:50.800] that mortgage. If they get a foreclosure, then they have purchased mortgage insurance on each [01:21:50.800 --> 01:21:57.440] one of them. The mortgage insurance will pay off 85%. They make a huge payday. [01:37:31.860 --> 01:37:40.900] She's got two felony bad checks, two misdemeanor bad checks, and 10 felony embezzlement charges [01:37:40.900 --> 01:37:47.620] from the district attorney's office. And she's got our adversary proceeding and her bankruptcy [01:37:47.620 --> 01:37:51.460] that has stopped her getting her discharge for three years. She's had two attorneys, both who have withdrawn for lack of cooperation [01:39:05.220 --> 01:39:12.420] and lack of adherence to contractual obligations, which in layman's terms, she didn't finish paying [01:39:12.420 --> 01:39:21.860] them. And we've been trying to get discovery for, since 2020. And I just kept going at it [01:39:21.860 --> 01:39:29.140] and going at it. And finally, you know, I filed two motions to compel, but they were never quite [01:39:29.140 --> 01:39:36.820] right. But everything I did was with the thought that even in the email to her, when she became [01:39:36.820 --> 01:39:44.900] pro se, it was all knowing that I would send it to the court for the court to see what we'd [01:39:44.900 --> 01:39:51.140] been trying to do behind the scenes. And she would just react and be nasty and mean, and I would be [01:39:51.140 --> 01:40:00.580] very polite and very forthright. And so I did that and the old judge left because she was getting a [01:40:00.580 --> 01:40:08.180] new position. And so the last time we did this, she said, okay, the other side refused to stipulate, [01:40:08.180 --> 01:40:13.220] refused to answer my email, refused to get on a meet and confer. So I just put it in the court. [01:40:13.220 --> 01:40:19.620] I keep putting declarations in because as one attorney told me on the helpline, he said, [01:40:20.900 --> 01:40:30.100] if the judge doesn't see it in writing, they don't know what's happening. And I said, so I can [01:40:30.100 --> 01:40:37.140] put something in the court, a declaration said, if the judge doesn't see it, they don't know. [01:40:37.140 --> 01:40:41.940] Said, okay, I'll put a declaration in then. That's who he was basically telling me what to do [01:40:41.940 --> 01:40:49.780] without telling me. And then I put that in the day before the status conference hearing. [01:40:50.420 --> 01:40:57.060] That night, the judge put a minute order in, status hearing canceled, three months extension [01:40:57.060 --> 01:41:04.580] of discovery, all discovery disputes must be finalized by March the 1st. And the status [01:41:04.580 --> 01:41:10.820] conference hearing with the new judge was going to be March 8th. So I'm still trying to get these [01:41:10.820 --> 01:41:16.260] tax returns. We got emails. They're in the mail. The tax person will send them to you. [01:41:16.820 --> 01:41:23.460] Oh, we emailed them to you. They're going to be UPS with tracking. I mean, oh, now we found [01:41:23.460 --> 01:41:28.180] something wrong with them. So we'll have to wait. An attorney told me I shouldn't send them yet. [01:41:28.740 --> 01:41:35.060] So I just kept calmly sending these emails and marking them. And finally, [01:41:35.060 --> 01:41:43.780] she was just being a real butt head. So, and she wouldn't wait a minute. Are you saying she was [01:41:43.780 --> 01:41:54.660] being churlish? Or more than churlish, worse than churlish, worse. Yeah, I don't even, [01:41:54.660 --> 01:42:04.420] probably triple churlish. And so what I did, I said, you know, I sent her an email, [01:42:04.420 --> 01:42:11.620] was supposed to put a joint status report in. And I sent her an email with our writing, [01:42:11.620 --> 01:42:16.660] because you have to, the plaintiff has to start it. And then they send it to the defendant. And [01:42:16.660 --> 01:42:21.300] the defendant has to put their part in. And it's basically telling the judge, are we ready for [01:42:21.300 --> 01:42:28.180] trial? What's the status of settlement? All those things. And I said, I'd like it back by the 25th. [01:42:28.180 --> 01:42:35.300] So I can file it because it has to be filed seven days minimum before. And I mailed it to her, [01:42:35.300 --> 01:42:40.660] and I emailed it to her on the same day. On the 24th, I hadn't gotten anything. I said, Andrea, [01:42:40.660 --> 01:42:47.060] I don't have your status conference report. And she emailed me the next morning and said, [01:42:47.060 --> 01:42:55.300] well, I didn't get it 24th. And I'm like, what, you didn't get it? And she said, I filed a response [01:42:55.300 --> 01:43:00.180] to the court. Well, you didn't get it. How can you file a response if you didn't get it? Then I [01:43:00.180 --> 01:43:07.060] realized her writing is so bad, she meant I didn't get it until the 24th. And so I sent her an email, [01:43:07.060 --> 01:43:13.220] I said, but you did get it because I emailed it to you as well on the 19th. And you have until 5 [01:43:13.220 --> 01:43:18.980] p.m. today to get it. Otherwise I will file out with other UNL address. She didn't get it to me. He got to the hearing [01:46:54.980 --> 01:47:02.740] after I filed the rebuttal because her answer was so bad. She claimed we never wanted to settle. [01:47:02.740 --> 01:47:09.380] She actually put in there that Tina Cole Brooks filed multiple lawsuits where she wasn't owed the [01:47:09.380 --> 01:47:16.020] money or when no money was owed. Oh, really? So you're a judge and an attorney now, and you can [01:47:16.660 --> 01:47:24.900] assess that? So I decided to file a rebuttal, and it was a lengthy one, but it was very, you know, [01:47:24.900 --> 01:47:31.620] simply put. I numbered every paragraph, and I just went through and rebutted plainly, and then I added [01:47:31.620 --> 01:47:39.460] in the emails between us and her former attorney where we went all about a settlement and came to [01:47:39.460 --> 01:47:45.700] an agreement of a settlement, which she reneged on. So I threw all that in there so the new judge [01:47:45.700 --> 01:47:49.940] would see the lives, and I said, I'm putting this in there so that the honorable judge, new to this [01:47:49.940 --> 01:47:58.980] case, can have a chance to read it without wading through the three years of files. And we got to [01:47:58.980 --> 01:48:07.860] the hearing. I have never seen a judge like this. It was a joy to behold. We were on Zoom, and she [01:48:07.860 --> 01:48:14.100] wouldn't show her face on Zoom. She just did not put her face on, whereas we all did. And the judge [01:48:14.100 --> 01:48:21.220] started off by speaking to me because I'm the lead plaintiff, and he said, Ms. Codwick, what is it [01:48:21.220 --> 01:48:28.900] you're, you know, needing here? It seems to the court that you're just needing tax returns from [01:48:28.900 --> 01:48:34.980] 2016 through 2020 through 2019. I said, yes, Your Honor, that's really what we're needing. There are [01:48:34.980 --> 01:48:40.100] a few other things, but we'll just stick with this because it's the most important. And he went [01:48:40.100 --> 01:48:44.660] through the other plaintiffs and said, is that what you were thinking we need? And they all said, yes, [01:48:44.660 --> 01:48:52.340] we concur with you. And then he went to Andrea and he said, so what about these tax returns? [01:48:52.340 --> 01:48:58.100] What's the problem? Well, I filed and she waffled and wondered and waved. And he said, we're going [01:48:58.100 --> 01:49:04.180] to go through this year by year. We're going to start with 2016. Did you file anything? Well, [01:49:04.180 --> 01:49:12.020] I filed and I wasn't. And did you file anything? And he just kept hammering them. But he was very [01:49:12.020 --> 01:49:18.900] calm. He wasn't mean. He was very professional. And we just thought we don't have to do anything. [01:49:18.900 --> 01:49:23.140] We're just going to sit here and watch it. And he went through every year. And then he said, [01:49:24.180 --> 01:49:32.420] you've got till April 8th. And he said, I don't like it when people don't take notice of my orders. [01:49:32.420 --> 01:49:40.500] I get very grumpy, he said. And he said, this is the order. He said, you're going to send this to [01:49:40.500 --> 01:49:47.300] these plaintiffs, each one of them by April 8th. And you're going to send it with tracking. And so [01:49:47.300 --> 01:49:52.420] it can be signed for because she keeps saying she sends it and we never get it. And so he was very [01:49:52.420 --> 01:49:58.580] specific about that because he saw all my rebuttals. And then he said, do you have their addresses? [01:49:58.580 --> 01:50:03.220] Well, I think maybe somewhere, I think I have Ms. Kuhnbrooks. Well, I usually email her, [01:50:03.780 --> 01:50:08.900] but I can call her and get it. He said, no, we're going to do this right here, right now. [01:50:08.900 --> 01:50:14.180] And he said, Ms. Kuhnbrooks, what's an address you can have things sent to you [01:50:14.180 --> 01:50:20.420] where you have to sign for it? So we did that with each one of us. We gave it to him. And he said, [01:50:20.420 --> 01:50:27.220] so by April 8th, it has to be in the mail, tracking and signed for. And then she tried to say that I [01:50:27.220 --> 01:50:33.220] didn't live at the address, you know, so it's not real. And he said to me, Ms. Kuhnbrooks, [01:50:33.220 --> 01:50:39.860] is this an address you can find for mail? I said, absolutely, Your Honor. It's the UPS box. [01:50:39.860 --> 01:50:45.380] It goes in there. It's tracked in their email. I have to go down there and sign it. Thank you. [01:50:45.380 --> 01:50:52.580] That's all. Then he went on to what else can this court do for you? And he said, I'm going to go to [01:50:52.580 --> 01:50:58.980] Ms. Kuhlbrook first. Ms. Kuhlbrook, what can this court do for you to move this case? And I said, [01:50:58.980 --> 01:51:04.740] we'd like to have a trial date. You would? Okay. And he asked all the others. Yes. Then he went to [01:51:04.740 --> 01:51:10.580] her and he said, because the other plaintiff, her husband didn't come in. And she said, no, [01:51:10.580 --> 01:51:16.100] I'm not ready for trial. No, no way. I can't do this alone. I've got to get an attorney. I need [01:51:16.100 --> 01:51:22.740] counsel and I'm sick and I've been to 40 attorneys and none of them will take it on because it's so [01:51:22.740 --> 01:51:30.820] far gone. And one said they would, but they wanted $25,000 upfront and we just don't have that money. [01:51:30.820 --> 01:51:36.500] That's why we filed bankruptcy. So if we could get till middle of next year, and he said, [01:51:36.500 --> 01:51:41.780] that is ridiculous. This case has gone on way too long. I'm having no more games in my courtroom. [01:51:41.780 --> 01:51:47.300] He said, you will come prepared and if you don't get an attorney, you will be prepared to talk [01:51:47.300 --> 01:51:54.500] about trial dates on May the 3rd. He said, I want you, and then he put the order in his thing and [01:51:54.500 --> 01:52:05.060] his order said we all have to be there in person. That's his order. And we were just stunned in a [01:52:05.060 --> 01:52:14.820] way, pleasantly stunned because he caught everything. He must've read everything I put in and he stopped [01:52:14.820 --> 01:52:23.380] her games right there and then. That is wonderful. It was wonderful to see. It was really wonderful [01:52:23.380 --> 01:52:28.420] to see. Now he said he's going to that pretrial conference and do all these things. He said, [01:52:28.420 --> 01:52:34.100] when you come on the 3rd, be prepared. I'm going to ask you all to do certain things and I expect [01:52:34.100 --> 01:52:41.380] you to do all these things. And so we're going on the 3rd. And the funny thing is the day before [01:52:41.380 --> 01:52:47.940] she has to be here in our town with the DA's office. She's going in front of the judge on [01:52:47.940 --> 01:52:54.180] the 2nd here and she must appear. And then the next day she's going to be two towns down, [01:52:55.060 --> 01:53:00.340] two hours away and she must appear there. So she's going to have a little stress on the plate. [01:53:02.260 --> 01:53:05.140] Yes, it sounds like her world is collapsing around her. [01:53:05.140 --> 01:53:15.060] It is. And what this has taught me is, you know, to read the rules, do the best you can in a complex [01:53:15.060 --> 01:53:22.020] situation. And the courts appreciate you at least trying to follow the rules as difficult as they [01:53:22.020 --> 01:53:30.260] are in an AP and to always when you're in this kind of situation, when you're dealing with a really [01:53:30.260 --> 01:53:37.220] bad defendant or the other way around, to put things in the court. If you've had these nasty [01:53:37.220 --> 01:53:42.100] emails going back and forth, to just write them down. If you've been calm about yours and been [01:53:42.100 --> 01:53:49.380] professional, then you put in. So because the court wouldn't have known all these attempts at [01:53:49.380 --> 01:53:56.660] settlement and all these things if I hadn't put it into the court for them to see. And she never [01:53:56.660 --> 01:54:01.620] did put anything into court. She would threaten, I'm going to complain. I'm, you know, you're [01:54:01.620 --> 01:54:07.300] bullying and harassing me because you asked me what I was trying to hide. And I said, oh really? [01:54:07.300 --> 01:54:12.660] I said, then I guess I'll let the judge know how bullying and harassing you were to me when you [01:54:12.660 --> 01:54:18.180] said my email is full of crap. That was a most unprofessional statement. And I actually put that [01:54:18.180 --> 01:54:26.500] into the court as well. So it just taught me a lot. It's been a tough road, but it's good. [01:54:27.940 --> 01:54:36.660] And I think the lesson that Tina brings is keep your perspective and never stop. [01:54:39.460 --> 01:54:44.980] It gets oppressive sometimes. And we've had Tina on when she was really down, [01:54:44.980 --> 01:54:52.660] but she never gave up. Yeah, you need to never stop. That's a good way to describe her.
